[15:10.240 --> 15:18.400] and one of the first questions I asked, the officer pulls you over, did you have license
[15:18.400 --> 15:24.480] plates on your vehicle? And they, yes, no. And depending on where they said yes or no,
[15:24.480 --> 15:31.920] depending on where I went from there and anybody who has any familiarity with the law
[15:31.920 --> 15:36.640] understands how different those two are. They go to whole different sections of law.
[15:36.640 --> 15:41.600] So if you say yes, the next question I took, the system, next question was going to be,
[15:42.720 --> 15:53.520] were the license plates that were displayed on the vehicle current? And instead of asking
[15:53.520 --> 15:58.720] that question, I went in between and broke the questionnaire apart and dropped in,

[16:05.920 --> 16:11.520] there. I asked all the questions that go to that and then plugged the rest of the questions

[36:08.000 --> 36:20.720] most part adopted the federal transportation code but in a nutshell and in short no the state can
[36:20.720 --> 36:29.120] have its own definition of transportation you cannot necessarily bring a definition
[36:30.000 --> 36:37.280] from one code to another from one body of law to another one of the things that went around
[36:37.280 --> 36:41.760] in the patriot community for quite a while and we don't get that on the show anymore because

[39:16.160 --> 39:21.520] fighting with each other over boundaries and this kept their armies kept them reason for having
[39:21.520 --> 39:28.000] the army and it kept them sharp if anybody came in from the outside all of these dukes had an
[39:28.000 --> 39:33.520] agreement they would all get together pool their resources kick who that over that was out of here
[39:33.520 --> 39:38.640] and then they go back to fighting amongst themselves england was the same way england was a
[39:40.320 --> 39:48.000] group of dukes each sovereign in their own right and entered into an agreement where they would
[39:48.880 --> 39:56.240] adopt one rule over that they would all adhere to so that they could in a crisis they could pool
[39:56.240 --> 40:04.480] their their armies well the states were the same way and we dictate to the federal government
[40:04.480 --> 40:11.200] what it can do and we the states agree to follow certain rules amongst each other am i making sense

[41:16.080 --> 41:23.280] that's that's a whole different country it's a legislators in oklahoma have defined an issue

[48:16.640 --> 48:26.160] not the case and once you challenge subject matter jurisdiction the judge needs to understand
[48:26.160 --> 48:34.080] that he steps up in front of the line of fire it is not the prosecution that has to prove up
[48:34.080 --> 48:42.560] subject matter jurisdiction it is the court and i have case law that's very clear on that point
[48:42.560 --> 48:52.080] subject matter jurisdiction is threshold if you can't get past subject matter jurisdiction you
[48:52.080 --> 49:01.120] can't get to the elements and if the court does not have subject matter jurisdiction the court
[49:01.120 --> 49:10.800] is acting in its personal capacity it is impersonating a public official and is subject to all the
[49:10.800 --> 49:19.280] laws relating to impersonating a public official lawyers tend not to take the court to task on
[49:19.280 --> 49:28.480] that but i have a certain judge in north texas who ignored a subject matter jurisdiction challenge
[49:28.480 --> 49:37.360] actually i've got a lot number of them and this particular one took this position on a property
[49:37.360 --> 49:44.800] in which i had a mechanics lien filed and the mechanics lien has been in the record for over
[49:44.800 --> 49:52.480] four years so it's unchallengeable he took a subject matter jurisdiction when it was challenged
[49:52.480 --> 50:00.240] and ignored the challenge and moved ahead i'm going to sue him personally see how that works out for
[50:00.240 --> 50:10.000] him so if the if the judge is not taking subject matter jurisdiction serious then send me an email
[50:10.000 --> 50:18.480] i'll send you the case law and write a tort letter to him send him a notice of tort an opportunity
[50:18.480 --> 50:32.800] to cure that gives attention then move to disqualify him that's my story i'm sticking to it what about

[50:41.040 --> 50:50.960] challenge territorial jurisdiction basically making them prove that the body of law they're
[50:50.960 --> 51:01.520] trying to enforce has to attach to a certain area of land and so the territorial jurisdictional
[51:01.520 --> 51:07.920] challenge would challenge whether their law actually applies to that land they would actually
[51:07.920 --> 51:15.360] have to own that land and so what do you think about the territorial jurisdiction that's that is
[51:16.080 --> 51:25.840] that's generally very straightforward the say it's a municipality the boundaries of the municipality
[51:25.840 --> 51:33.760] are very strictly defined the extraterritorial jurisdiction that attached to those boundaries
[51:33.760 --> 51:44.640] will also be very strictly defined my daughter lives in the country they have a cattle farm
[51:45.760 --> 51:52.720] but they're close to bridgeport texas and bridgeport texas has followed texas state law and
[51:52.720 --> 52:00.240] extended their extraterritorial jurisdiction to encompass the land that my daughter's farm is on
[52:00.240 --> 52:11.200] but that's very specifically defined in statute and always will be so relatively simple issue to
[52:11.200 --> 52:19.760] address at least for the jurisdiction there may be an aspect that ed is going to that i'm not familiar
[52:19.760 --> 52:30.320] with yeah that um the the take that uh it river takes is that um
[52:33.200 --> 52:42.880] there's a california uh statute that says that california and the united states are uh
[52:42.880 --> 52:55.040] uh inseparably uh connected and the uh united states code uh defines what a county is that it's a
[52:55.040 --> 53:08.480] federal territory um and using the the definitions um of the united states code of what county and
[53:08.480 --> 53:19.840] state are and what and how how the states uh reciprocate those those definitions it it becomes
[53:20.560 --> 53:27.760] something that goes all the way back to the uh uh treaty of paris when when the king gave up
[53:28.640 --> 53:35.040] his rights to the land and the people the private owners became kings of that land
[53:35.040 --> 53:44.160] holding the high title you talked about 1848 when the revolution yes and and so back back

[55:08.640 --> 55:18.000] in the capacity the french spoke to and essentially the state law doesn't apply on your private
[55:18.000 --> 55:26.000] property but if you haven't brought the patent forward and you own hold the property under title
[55:27.600 --> 55:35.840] then the jurisdiction of the state extends within those boundaries does ed talk about land patent
[55:35.840 --> 55:46.560] um he he does he does uh in especially in the in the sense that when when the king relinquish
[55:46.560 --> 55:56.000] his rights to the uh to the title of the land the the only entity that can hold that highest title
[55:56.000 --> 56:03.680] would be a king or a monarchial type figure a a corporation or a government can't actually
[56:03.680 --> 56:13.120] hold that highest title so the his take is that the people have been tricked into not really
