[00:00.000 --> 00:07.720] The following newsflash is brought to you by the Lone Star Lowdown, providing you deli
[00:07.720 --> 00:15.440] bulletins for the commodities market, today in history, news updates, and the inside scoop
[00:15.440 --> 00:23.320] into the tides of the alternative.
[00:23.320 --> 00:29.800] Markets for Wednesday the 22nd of February 2017 are currently trading with gold at $1,237.21
[00:29.800 --> 00:36.520] an ounce, silver $18.01 an ounce, Texas crude $53.40 a barrel, and Bitcoin is still rising
[00:36.520 --> 00:45.840]  sitting at about $1,130 U.S. currency.
[00:45.840 --> 00:51.440] Today in history, the year 1943, members of the White Rose Resistance, a nonviolent intellectual
[00:51.440 --> 00:55.720] resistance group in Nazi Germany led by a group of students and a professor at the University
[00:55.720 --> 01:00.920] of Munich that conducted an anonymous leaflet and graffiti campaign which called for active
[01:00.920 --> 01:06.120] opposition against the Nazi regime, started on June 27, 1942, and ending with the arrest
[01:06.120 --> 01:12.440] of the core group, Sophie Scholl, Hans Scholl, and Christoph Props by the Gustapo on February
[01:12.440 --> 01:19.520]  18 were executed today in history.
[01:19.520 --> 01:24.920] In recent years, the Palestinian Baaduin village of Gan Al-Amar near Jerusalem was raided by
[01:24.920 --> 01:29.400] Israeli defense forces on Sunday after Israeli's government issued a demolition order for the
[01:29.400 --> 01:30.480]  Palestinian village.
[01:30.480 --> 01:34.560] The IDF imposed a military closure on dozens of structures, homes, and the only school
[01:34.560 --> 01:39.400] in the area, giving residents just a few days until Thursday of this week to evacuate.
[01:39.400 --> 01:43.200] It's estimated that 40 Palestinian homes in the central West Bank community are targeted
[01:43.200 --> 01:44.200]  for demolition.
[01:44.200 --> 01:49.120] In 2014, the United Nations Office for the Coordination of Humanitarian Affairs identified
[01:49.120 --> 01:54.440] the Gan Al-Amar village as one of the 46 settlements in the area that's at risk of forced relocation
[01:54.440 --> 01:55.440]  by Israel.
[01:55.440 --> 01:58.600] Villagers were given construction termination warrants and will have a chance to present
[01:58.600 --> 02:01.080] their case during a hearing on Thursday.
[02:01.080 --> 02:04.400] Israeli officials maintain that the village was built illegally in the hotly disputed
[02:04.400 --> 02:14.720] E1 corridor, which physically links East Jerusalem and the Mali Adumim settlement.
[02:14.720 --> 02:18.360] According to the Canadian Border Service Agency, more than 1,400 people have made claims at
[02:18.360 --> 02:23.280] land border ports of entry in the region since November, which is more in the last four months
[02:23.280 --> 02:24.760]  than the entire year of 2015.
[02:24.760 --> 02:30.080] Apparently, the number of people seeking asylum has soared in the last year and spiked recently,
[02:30.080 --> 02:32.240] with Quebec seeing the greatest numbers.
[02:32.240 --> 02:35.840] Canadian authorities are saying that the migrants come from all over the world and ranging in
[02:35.840 --> 02:38.960] all ages, from parents with infants to the elderly.
[02:38.960 --> 02:42.720] Inspector Martin Roach of the Royal Canadian Mountain Police stated that since, quote,
[02:42.720 --> 02:46.760] they're not reporting to the open port of entry, they're being placed under arrest
[02:46.760 --> 02:50.440] and then interviewed to make sure there's no national security nexus.
[02:50.440 --> 02:57.440] This is Rick Brody with your Lowdown for February 22nd, 2017.
[04:20.440 --> 04:29.720] Howdy, howdy, this is Randy Kelton, Deborah Stevens, Rule of Law Radio on this Thursday,
[04:29.720 --> 04:35.280]  the 23rd day of February 2017.
[04:35.280 --> 04:40.600] And I do have the phone lines open, we'll keep them open all night.
[04:40.600 --> 04:49.200] Little update on what's been going on around here, I've been working on a set of documents
[04:49.200 --> 04:50.800]  for traffic.
[04:50.800 --> 04:55.600] I'm kind of working over South Lake, Texas.
[04:55.600 --> 05:06.360] South Lake is just south of or just west of the DFW airport, and it's a couple hundred
[05:06.360 --> 05:10.240] thousand people and they write lots and lots of tickets.
[05:10.240 --> 05:17.080] They wrote a friend of mine, one of his drivers, a ticket, and I went down there to a hearing
[05:17.080 --> 05:22.640] and they were having one of these cattle call hearings where they order you to show up so
[05:22.640 --> 05:27.040] that you can meet with a prosecuting attorney.
[05:27.040 --> 05:35.680] And subsequently filed with the municipal judge 58 counts of impersonating a public
[05:35.680 --> 05:36.680]  official.
[05:36.680 --> 05:47.840] As you might guess, the municipal judge was not pleased with my filing and instructed
[05:47.840 --> 05:57.720] me that I could not file a criminal complaint unless I was harmed by the crime.
[05:57.720 --> 06:04.360] And I told her that was confusing since 38.171 Texas Penal Code makes it a Class A misdemeanor
[06:04.360 --> 06:08.720] if you have knowledge that a felon has been committed and you don't report that knowledge.
[06:08.720 --> 06:13.640] Now you're telling me I can't report the knowledge unless I've been injured by the act.
[06:13.640 --> 06:20.080]  And that's absolutely, that's the deal, she's not taking my complaint.
[06:20.080 --> 06:34.280] So I went to the local JP and you probably won't believe this, but he was no more receptive.
[06:34.280 --> 06:36.480] You can take my complaint if you can believe that.
[06:36.480 --> 06:43.040] Now this guy, well both of these are, I haven't bargrieved them in five judicial condo complaints
[06:43.040 --> 06:52.280] quite yet, but I'm in the process of stacking the chips on them.
[06:52.280 --> 06:58.880] My next stop is the county court and when the county judge refuses to hear the complaint
[06:58.880 --> 07:03.840] then the next stop will be a district court asking for a court of inquiry.
[07:03.840 --> 07:08.320] So that side should get interested.
[07:08.320 --> 07:15.400] I have a complaint in against my local federal judge.
[07:15.400 --> 07:19.880] He dismissed one of my cases with prejudice.
[07:19.880 --> 07:24.880] I'm trying to take a bit of a different approach toward judges.
[07:24.880 --> 07:32.040] This is not something that I've been actively doing in the past, but when the judge sits
[07:32.040 --> 07:42.240] on the bench and renders a ruling that has the effect of denying a litigant in the due
[07:42.240 --> 07:50.080] course of the laws, for instance, if you file a motion or a pleading with more than one
[07:50.080 --> 07:57.240] issue in it and the judge rules against one or two of the issues and just ignores the
[07:57.240 --> 08:00.320]  third one.
[08:00.320 --> 08:08.160] Well the way I read the law, that's an act of official oppression wherein the judge denied
[08:08.160 --> 08:14.960] the petitioner the right to petition the court for redress of grievance because he refused
[08:14.960 --> 08:18.880]  to hear his complaint.
[08:18.880 --> 08:22.520] And the courts say, well if you don't like the ruling you get from the judge you can
[08:22.520 --> 08:27.080]  always appeal to a higher court.
[08:27.080 --> 08:32.680] Yeah you go before a corrupt judge, he renders a bogus decision and they say, oh that's okay.
[08:32.680 --> 08:37.520] You can go before a whole panel of corrupt judges and they'll really screw you royals.
[08:37.520 --> 08:43.000] Now that's what I told Bob Perkins, head criminal district judge in Travis County when I was
[08:43.000 --> 08:48.360] filing criminal charges against all the highest judges in Texas.
[08:48.360 --> 08:52.760]  Well I had a better idea then, I have a better idea now.
[08:52.760 --> 08:59.320] Instead of appealing to the court of appeals or in conjunction with appealing to the court
[08:59.320 --> 09:06.560] of appeals, I filed criminal charges against the judge or the grand jury and appeal to
[09:06.560 --> 09:13.640] them to indict the scoundrel and see how that works out for them.
[09:13.640 --> 09:20.040] So I filed criminal charges against Judge John McBride.
[09:20.040 --> 09:23.480]  Judge McBride is a real stinker.
[09:23.480 --> 09:30.720] This guy is, he just not, doesn't play well with others and all of the lawyers hate to
[09:30.720 --> 09:36.480] get in front of this guy because he will sanction them at the drop of the hat.
[09:36.480 --> 09:44.240] He's been sanctioned himself by the higher courts on more than one occasion for his treatment
[09:44.240 --> 09:47.760] of litigants before his court.
[09:47.760 --> 09:56.760] If you file a pro se pleading before John McBride, John McBride will dismiss your pleading
[09:56.760 --> 10:05.400] with prejudice absolutely without regard to the right of things of the rule of law.
[10:05.400 --> 10:13.560] I filed a quiet title action in the state which had only state issues in it.
[10:13.560 --> 10:18.840] Wells Fargo removed it to the federal court which they had a right to do.
[10:18.840 --> 10:29.160] However with the 2011 venue and removal clarification act, the judge was required to sever all state
[10:29.160 --> 10:32.800] claims and remand them to the state.
[10:32.800 --> 10:35.760] He was required by statute.
[10:35.760 --> 10:45.320] This is a relatively new law that went into effect in 2012 that had the effect of changing
[10:45.320 --> 10:49.200] several, couple hundred years of law.
[10:49.200 --> 10:58.760] It had been held that if a state case is appealed to the county court, the county court can
[10:58.760 --> 11:09.480] hear, I'm sorry, if a state case is appealed to the federal court and it has federal and
[11:09.480 --> 11:16.320] state issues, the feds can hear both the state and the fed issues under judicial economy.
[11:16.320 --> 11:23.760] Well, some of the circuits began to disagree with that so there was a split in the circuit.
[11:23.760 --> 11:28.640] Some of the circuits said, no, we can't hear state issues, it's an undue preemption of state
[11:28.640 --> 11:29.640]  law.
[11:29.640 --> 11:35.960] So the legislature weighed in on the issue and they agreed with the latter and said while
[11:35.960 --> 11:44.960] a case with state issues can be appealed to the federal court, the state issues cannot
[11:44.960 --> 11:49.600] be heard by the federal court, they must sever them and remand.
[11:49.600 --> 11:53.680] Well there were only state issues in this case.
[11:53.680 --> 12:00.600] And since the statute forbade the judge to hear them, I didn't file a motion to remand,
[12:00.600 --> 12:04.680]  I filed a challenge to subject matter jurisdiction.
[12:04.680 --> 12:09.760]  The other side immediately filed a 12B6.
[12:09.760 --> 12:16.640] Without hearing the subject matter jurists challenge, Judge Mupuy dismissed my case with
[12:16.640 --> 12:19.640]  prejudice.
[12:19.640 --> 12:29.400] The same day I non-suited, the reason I non-suited is that Wells Fargo claimed they weren't the
[12:29.400 --> 12:30.400]  lender.
[12:30.400 --> 12:36.040]  Oh my goodness, since you're not the lender, I made a mistake and I non-suited.
[12:36.040 --> 12:44.720] What that did is subjected Wells Fargo to a collateral estoppel.
[12:44.720 --> 12:51.520] They cannot now come back to the court and claim they have standing to enforce this contract
[12:51.520 --> 12:57.320] because they've already stated in the court that they are not the lender and because they
[12:57.320 --> 12:59.280]  stated that I'm non-suited.
[12:59.280 --> 13:03.680] So the point was I didn't have a dog in the hut.
[13:03.680 --> 13:11.480] The judge dismissed with prejudice but I didn't care because I was dismissing it anyway.
[13:11.480 --> 13:16.480] And yes, he didn't have the authority to do that.
[13:16.480 --> 13:25.080] So I filed criminal charges with the local special agent in charge, the FBI in Dallas.
[13:25.080 --> 13:27.960] Now he's had time to report it to the attorney general.
[13:27.960 --> 13:36.560] Now I am preparing a FOIA to the attorney general requesting a copy of the notice given
[13:36.560 --> 13:46.040] to him under 28 USC 535 by the special agent in charge in Dallas.
[13:46.040 --> 13:50.200] When a federal official has it made known to them that another federal official has
[13:50.200 --> 13:55.960] violated the law or committed a crime, it doesn't say related to his office or anything
[13:55.960 --> 14:04.480] else just committed a crime, that employee is required to report the crime directly to
[14:04.480 --> 14:07.160]  the attorney general.
[14:07.160 --> 14:10.960] Somehow I bet the SAC did not do that.
[14:10.960 --> 14:14.840] And when I send my information request to the attorney general, I'll get a response
[14:14.840 --> 14:21.040] saying we have no documents responsive to your request and then I'll file against the
[14:21.040 --> 14:28.360] SAC with the attorney, with the US attorney and just start a big fight down there.
[14:28.360 --> 14:32.600] I do have a couple of callers online so I'm going to go ahead to them.
[14:32.600 --> 14:34.760] Okay, we have Paul in Tennessee.
[14:34.760 --> 14:35.760]  Hello, Paul.
[14:35.760 --> 14:36.760]  Hey, Randy.
[14:36.760 --> 14:43.240] I'm sorry I've missed you a few times but I thank you for taking the call and I highly
[14:43.240 --> 14:46.240] recommend it to you by a good friend.
[14:46.240 --> 14:47.240]  Okay.
[14:47.240 --> 14:50.000] What do you have for us today?
[14:50.000 --> 14:58.320] Well I have a special appearance in Nashville on the 2nd of March for a pre-trial hearing
[14:58.320 --> 15:04.680] in regard to an action that the US attorney's office brought against me in regard to some
[15:04.680 --> 15:07.840]  ATF issues.
[15:07.840 --> 15:11.680] And we've got a lot of papers that got put in for pre-trial.
[15:11.680 --> 15:18.600] I'm in the middle of the, the best way I can describe it is the steamroller process
[15:18.600 --> 15:25.920] and we have not got government response yet and I'm told to expect that on tomorrow.
[15:25.920 --> 15:32.440] But all the pre-trial papers are in and we have a pre-trial hearing on the 2nd of March
[15:32.440 --> 15:42.920] and basically the action brought against me was based on a task force officer who came
[15:42.920 --> 15:50.080] onto my property while I was not even in the country and between him and his good friend,
[15:50.080 --> 15:57.480] his confidential source created a big problem for me.
[15:57.480 --> 16:08.160] And they got a warrant based on a trespass and things have gone downhill from there.
[16:08.160 --> 16:15.280] We got the warrant unsealed only less than a week ago and there's an entire attachment
[16:15.280 --> 16:23.040] section missing from the warrant and the warrant has no something called particularity in either
[16:23.040 --> 16:28.880] departments, the area to be searched or the other side of it.
[16:28.880 --> 16:36.120] But the issue is quite complex because they did a lot of damage to me while I was not
[16:36.120 --> 16:37.120]  even on the property.
[16:37.120 --> 16:44.960] They destroyed certain computer evidence in terms of that nature and hence this has become
[16:44.960 --> 16:48.400]  a very, very big problem.
[16:48.400 --> 16:49.400]  Hold on, hold on.
[16:49.400 --> 16:50.400]  We're about to go to break.
[16:50.400 --> 16:54.400] This is Randy Kelton, Deborah Stevens, Rule of Law Radio.
[16:54.400 --> 16:59.160]  Our call in number 512-646-1984, we'll be right back.
[16:59.160 --> 17:00.160]  Dang, Cookie.
[17:00.160 --> 17:01.160]  Cookie?
[17:01.160 --> 17:02.160]  Me love cookies.
[17:02.160 --> 17:03.160]  Oh, hi, Cookie Munchers.
[17:03.160 --> 17:04.160] No, these are yucky cookies.
[17:04.160 --> 17:05.160]  Cookies?
[17:05.160 --> 17:06.160]  Yucky?
[17:06.160 --> 17:07.160]  No, no bad cookies.
[17:07.160 --> 17:08.160]  You can't even eat these cookies.
[17:08.160 --> 17:09.160]  These are cyber cookies.
[17:09.160 --> 17:10.160]  No, I can't eat it.
[17:10.160 --> 17:11.160] No, they are cyber cookies.
[17:11.160 --> 17:14.160]  No, I can't eat it.
[17:14.160 --> 17:17.160] No, they are cyber cookies and they clog up your computer.
[17:17.160 --> 17:18.160]  These are apples.
[17:18.160 --> 17:19.160]  Really?
[17:19.160 --> 17:20.160]  Oh, that's an actual apple.
[17:20.160 --> 17:21.160]  Yummy apple.
[17:21.160 --> 17:26.840] I'm going to throw away these yucky cookies in the trash.
[17:26.840 --> 17:33.040] I click control, shift, delete and then scroll down to cookies and clear them.
[17:33.040 --> 17:34.600]  Bye bye, yucky cookies.
[17:34.600 --> 17:40.240] Now I go to logosradio.network.com and I click on the Amazon box on the upper right hand
[17:40.240 --> 17:46.280] side, bookmark the link and I can go to Amazon through this link and order you some yummy
[17:46.280 --> 17:47.280]  new cookies.
[17:47.280 --> 17:48.280]  New cookies?

[17:49.280 --> 17:53.680] Consider it an early Christmas present and every time I order on Amazon, I go through
[17:53.680 --> 17:57.280] this link and I give a little present to this radio network too.
[17:57.280 --> 17:58.280]  These are cookies.

[18:59.880 --> 19:08.880] You are listening to the Logos Radio Network, the Logos Radio Network.com.
[19:08.880 --> 19:38.040]  Okay.
[19:38.040 --> 19:39.040]  We are back.
[19:39.040 --> 19:44.400] Randy Kelton, Rule of Law Radio, and we're talking to Paul in Tennessee.
[19:44.400 --> 19:54.800] Now Paul, your case is serious and complex, so on this show, I won't be able to get into
[19:54.800 --> 19:56.600] the complexity of your case.
[19:56.600 --> 20:03.000] Let me give you some general stuff that goes on with the feds.
[20:03.000 --> 20:13.280] One of the things we talk about on the radio about cases in court, about going to court,
[20:13.280 --> 20:20.280] you can expect the court to rule against you out of hand at every turn.
[20:20.280 --> 20:27.120] Now maybe they want you to treat the court as if they're going to, and you will never
[20:27.120 --> 20:34.400] win your case simply because you have the law and the facts on your side.
[20:34.400 --> 20:36.000] To think so is naive.
[20:36.000 --> 20:39.360] It is not that way now.
[20:39.360 --> 20:44.800] It never has been that way in these United States.
[20:44.800 --> 20:53.320] You'll win your case if you have the politics on your side, and all politics is local.
[20:53.320 --> 20:57.640] So if you're going to have a chance of beating these guys, you've got to understand where
[20:57.640 --> 20:59.280]  they live.
[20:59.280 --> 21:09.560] And right now, that U.S. attorney, he's living in a very precarious place.
[21:09.560 --> 21:18.720] When a new president takes office, every U.S. attorney in the country must file a resignation
[21:18.720 --> 21:22.000]  with the new president.
[21:22.000 --> 21:29.480] And the president decides rather to accept that resignation or not.
[21:29.480 --> 21:36.680] And with Trump coming in, he ran as a Republican, but he's really not.
[21:36.680 --> 21:42.440] Neither the Republicans nor the Democrats like him, and he doesn't like either one of
[21:42.440 --> 21:44.840]  them.
[21:44.840 --> 21:48.480]  So everybody's nervous.
[21:48.480 --> 21:51.080]  Nobody knows what's going to happen.
[21:51.080 --> 21:54.720] They don't know if they're going to keep their jobs or not.
[21:54.720 --> 21:59.680] And Trump is new to politics.
[21:59.680 --> 22:05.000] So he's going to need some folks he can count on to be on his side.
[22:05.000 --> 22:11.000] And one of the ways presidents generally do that is with really nice appointments.
[22:11.000 --> 22:18.440] So Trump is going to want to make some really nice appointments with that political climate
[22:18.440 --> 22:19.440]  set.
[22:19.440 --> 22:22.400]  Let's talk about the U.S. attorney.
[22:22.400 --> 22:29.720] For the most part, U.S. attorneys do not care if you are innocent or guilty.
[22:29.720 --> 22:35.200] What they're going to try to do is force you to take a deal, and they have some really
[22:35.200 --> 22:41.600] dirty, rotten, lousy tricks in order they use to get that done with.
[22:41.600 --> 22:54.680] One of the things that you need to do is put in a request to the federal court requesting
[22:54.680 --> 23:03.520] the billing to the court reporter for the grand jury for the period of time before and
[23:03.520 --> 23:05.680]  after you were indicted.
[23:05.680 --> 23:06.680]  Okay.
[23:06.680 --> 23:13.480]  Here's the reason.
[23:13.480 --> 23:21.800] You want the billing that the grand jury's court reporter gave to the clerk.
[23:21.800 --> 23:29.600] Now everything about the grand jury is secret except the money they have to pay out.
[23:29.600 --> 23:38.040] We did this in California, they were going after our next player, and when we put in
[23:38.040 --> 23:42.320] the request, the court reporter came back and said, I mean, the clerk came back and
[23:42.320 --> 23:50.680] said there was no billings on the day we were looking for.
[23:50.680 --> 23:53.520]  Wonder how that happens.
[23:53.520 --> 23:55.720] This is how that happens.
[23:55.720 --> 24:02.000] The U.S. attorney has a rubber stamp with the grand jury's name on it.
[24:02.000 --> 24:11.640] Generally, what the U.S. attorney do is go to the grand jury for a minor issue to get
[24:11.640 --> 24:13.240]  an indictment.
[24:13.240 --> 24:19.920] Once he has a minor indictment, now he'll start his research and everything else he
[24:19.920 --> 24:28.280] finds, every other subsequent indictment is called a superseding indictment, and he rubber
[24:28.280 --> 24:31.520] stamps all the superseding indictments.
[24:31.520 --> 24:33.000]  Wow.
[24:33.000 --> 24:34.560]  Yeah.
[24:34.560 --> 24:44.800] So, when the litigant filed the claim that there was no grand jury hearing that day,
[24:44.800 --> 24:47.680] all of a sudden the indictment went away.
[24:47.680 --> 24:50.600] That was really ugly politics.
[24:50.600 --> 24:56.840] So that's the first thing you want to look at, and when you do this, they will let the
[24:56.840 --> 25:01.520]  U.S. attorney know what you're asking for.
[25:01.520 --> 25:07.960] Even if he hasn't rubber stamped a superseding indictment, this will absolutely make sure
[25:07.960 --> 25:11.600]  he doesn't because he knows you're watching.
[25:11.600 --> 25:12.600]  Okay.
[25:12.600 --> 25:20.920] Next thing, he doesn't care if you're guilty or innocent because the saying is you may
[25:20.920 --> 25:24.000] beat the time, but you won't beat the ride.
[25:24.000 --> 25:32.400] He's going to try to drag you through the courts and hound you and pressure you until
[25:32.400 --> 25:35.560]  you make a deal with it.
[25:35.560 --> 25:42.280] So my suggestion is, and this is a little radical, it may be difficult at first, but
[25:42.280 --> 25:48.440] if he wants to start a fight with you, accommodate him.
[25:48.440 --> 25:55.200] Two people can do this.
[25:55.200 --> 25:59.440] First thing you need to do is look at everything he's done.
[25:59.440 --> 26:02.620] These guys are so corrupt.
[26:02.620 --> 26:08.560] They wouldn't follow the law even if they knew what it was, and they don't.
[26:08.560 --> 26:14.280] I have yet to find a single prosecutor who knew the law he was enforcing.
[26:14.280 --> 26:17.320]  Now, there is a statute.
[26:17.320 --> 26:18.320]  Bar grievance.
[26:18.320 --> 26:19.320]  Yeah.
[26:19.320 --> 26:24.840] Well, more than bar grievance, U.S. attorney, this is even better.
[26:24.840 --> 26:25.840]  It's a...
[26:25.840 --> 26:26.840]  Okay.
[26:26.840 --> 26:29.680]  Bushwhack technique.
[26:29.680 --> 26:32.680]  Write down 28 U.S.C. 535.
[26:32.680 --> 26:33.680]  Okay.
[26:33.680 --> 26:37.960] Pull that out and read it.
[26:37.960 --> 26:44.520] What it is, it appears to be a whistleblower statute.
[26:44.520 --> 26:53.360] The effect of it is, you are a government official and you have knowledge that another
[26:53.360 --> 26:56.840] employee of the government has committed a crime.
[26:56.840 --> 27:06.120] It's kind of tough for you to tell on your fellow officials.
[27:06.120 --> 27:11.760] So the legislature passed this statute that says, if you're a federal official and you
[27:11.760 --> 27:19.000] have knowledge that another official has committed a crime, you are to give notice to the attorney
[27:19.000 --> 27:22.820]  general in Washington, D.C.
[27:22.820 --> 27:28.280] So you bypass all the locals, all the people you work with.
[27:28.280 --> 27:37.880] And since you are statutorily required, if you don't and the fact of the crime comes
[27:37.880 --> 27:45.320] out and the fact that you knew about it comes out, then you're subject to prosecution.
[27:45.320 --> 27:50.320] So it gives the official plausible deniability.
[27:50.320 --> 27:52.120]  Okay.
[27:52.120 --> 27:58.240] I doubt that any official has ever given notice to the attorney general.
[27:58.240 --> 28:05.640] So I was saying earlier, I filed some criminal charges against the federal judge.
[28:05.640 --> 28:18.240] And once you file against them, the prosecutor, an FBI agent, anybody, then you kind of poison
[28:18.240 --> 28:21.720]  their well.
[28:21.720 --> 28:32.200] Now that I filed against the federal judge, the FBI agents absolutely will not talk to
[28:32.200 --> 28:34.840]  me.
[28:34.840 --> 28:36.960] Part of it is they know who I am.
[28:36.960 --> 28:47.760] The other part is, if an agent or anyone working for the FBI says one word that I can construe
[28:47.760 --> 28:56.920] as a threat, for instance, I've had a U.S. attorney in Fort Lauderdale tell me when I
[28:56.920 --> 29:04.560] filed a criminal complaint with the grand jury there, that if I did that again, that
[29:04.560 --> 29:09.880] he would charge me with jury tampering.
[29:09.880 --> 29:16.040]  Oh, my, I took that as a threat.
[29:16.040 --> 29:22.640] That is tampering with a witness, obstruction of justice.
[29:22.640 --> 29:30.000] So I told the U.S. attorney, I'm going to send a complaint in against you for threatening
[29:30.000 --> 29:31.000]  me.
[29:31.000 --> 29:35.840] And if you interfere with that complaint, then I'll charge you with witness tampering
[29:35.840 --> 29:37.360]  and obstruction of justice.
[29:37.360 --> 29:41.920] If you want to charge me with jury tampering, you knock yourself out.
[29:41.920 --> 29:45.040] We'll see who comes out ahead on this.
[29:45.040 --> 29:51.200] The next day, they fired the IRS agent group going after it.
[29:51.200 --> 29:55.000] They fired that agent to get us to go away and leave them alone.
[29:55.000 --> 30:02.280] Well, at the time, there wasn't a new president in place.
[30:02.280 --> 30:07.160] Millions of Americans take medication for temporary relief from arthritis, but now a
[30:07.160 --> 30:11.360] simple mind's trick is cutting arthritis pain in half without drugs.
[30:11.360 --> 30:16.880] I'm Dr. Catherine Albrecht, back with some fascinating new research, next.
[30:16.880 --> 30:18.600]  Privacy is under attack.
[30:18.600 --> 30:22.200] When you give up data about yourself, you'll never get it back again.
[30:22.200 --> 30:27.200] And once your privacy is gone, you'll find your freedoms will start to vanish, too.
[30:27.200 --> 30:32.400] So protect your rights, say no to surveillance, and keep your information to yourself.
[30:32.400 --> 30:34.960]  Privacy, it's worth hanging on to.
[30:34.960 --> 30:40.600] This message is brought to you by StartPage.com, the private search engine alternative to Google,
[30:40.600 --> 30:42.320]  Yahoo, and Bing.
[30:42.320 --> 30:46.400]  Start over with StartPage.
[30:46.400 --> 30:50.560] Arthritis or a painful inflammation of the joints affects millions of Americans.
[30:50.560 --> 30:55.040] There's no cure, only temporary relief through painkillers and physical therapy.
[30:55.040 --> 30:59.480] But British researchers have discovered a simple optical illusion that eases arthritis
[30:59.480 --> 31:00.480]  pain.
[31:00.480 --> 31:05.420] Volunteers place their hands into a box with a camera that projects images of their fingers
[31:05.420 --> 31:09.520] being virtually stretched and shrunk by someone pulling them gently.
[31:09.520 --> 31:14.320] The images cut patients' pain in half and gave them increased range of motion.
[31:14.320 --> 31:17.600] For some sufferers, the pain went away entirely.
[31:17.600 --> 31:22.600] It's amazing, but this simple illusion shows the power of our minds over matter and over
[31:22.600 --> 31:23.600]  pain.
[31:23.600 --> 31:31.360] I'm Dr. Catherine Albrecht for StartPage.com, the world's most private search engine.
[31:31.360 --> 31:35.720] Did you know there are three million edible food plants on earth, and none have the nutritional
[31:35.720 --> 31:37.400] value of the hemp plant?
[31:37.400 --> 31:39.960]  MFUSA.org offers you hemp protein powder.
[31:39.960 --> 31:45.840] It does not contain chemicals or THC, is non-GMO, and is 100% gluten free.
[31:45.840 --> 31:51.080] Hemp protein powder burns fat, builds muscle, contains 53% protein, and feeds the body the
[31:51.080 --> 31:52.440]  nutrients it needs.
[31:52.440 --> 32:02.800] Call 888-910-4367 and see what our powder, seeds, and oil can do for you, only at MFUSA.org.
[32:02.800 --> 32:05.640] Rule of Law Radio is proud to offer the Rule of Law traffic seminar.
[32:05.640 --> 32:09.480] In today's America, we live in an us-against-them society, and if we the people are ever going
[32:09.480 --> 32:13.400] to have a free society, then we're going to have to stand and defend our own rights.
[32:13.400 --> 32:16.640] Among those rights are the right to travel freely from place to place, the right to act
[32:16.640 --> 32:20.320] in our own private capacity, and most importantly, the right to due process of law.
[32:20.320 --> 32:24.520] Traffic courts afford us the least expensive opportunity to learn how to enforce and preserve
[32:24.520 --> 32:26.000] our rights through due process.
[32:26.000 --> 32:29.880] Former Sheriff's Deputy A. Craig, in conjunction with Rule of Law Radio, has put together the
[32:29.880 --> 32:33.680] most comprehensive teaching tool available that will help you understand what due process
[32:33.680 --> 32:35.840] is and how to hold courts to the rule of law.
[32:35.840 --> 32:40.080] You can get your own copy of this invaluable material by going to ruleoflawradio.com and
[32:40.080 --> 32:41.400]  ordering your copy today.

[32:54.720 --> 33:03.400] Order your copy today, and together we can have the free society we all want and deserve.
[33:03.400 --> 33:06.800]  Free speech radio, logosradionetwork.com.
[33:34.000 --> 33:39.900]  When you're gonna stop abuse, you're power.
[33:39.900 --> 33:57.000]  When you're gonna stop abuse, you're power.
[33:57.000 --> 34:20.440] Okay, we are back, Randy Kelton, Debra Stevens, Rule of Law Radio, and Paul, it takes a while
[34:20.440 --> 34:27.240] to get all of these pieces put together so you understand the routine, but we have a
[34:27.240 --> 34:31.000] whole routine for turning the heat up on these guys.
[34:31.000 --> 34:38.260] You mentioned bar grievances, definitely bar grievances, judicial conduct complaints.
[34:38.260 --> 34:43.720] You understand that these guys are not your buddies.
[34:43.720 --> 34:44.720]  The judge?
[34:44.720 --> 34:46.920]  May I ask you a question?
[34:46.920 --> 34:47.920]  Sure.
[34:47.920 --> 34:56.840] How do you feel about a district attorney who invites me to a special meeting in his
[34:56.840 --> 35:08.920] office and offers, well, really it's the communication of a threat, because if you don't do this,
[35:08.920 --> 35:15.280] I'm going to drag your 15-year-old son into court to testify against you and put you in
[35:15.280 --> 35:16.280]  jail?
[35:16.280 --> 35:24.040] A month later, when I declined his offer, which was not an offer, he actually sent two
[35:24.040 --> 35:31.280] of the agents to my son's high school, dragged him out of class, to serve in the subpoena.
[35:31.280 --> 35:44.200] Okay, I don't know enough about the case to understand whether he has grounds for that
[35:44.200 --> 35:52.800] or not, if it is your position that someone entered your property while you were out of
[35:52.800 --> 36:00.480] country and secured information that they then used to get a warrant, that's a great
[36:00.480 --> 36:11.360] thing to keep them in court with, but that goes to the merits of the case, and there's
[36:11.360 --> 36:15.080] something important to understand before you get to the merits.
[36:15.080 --> 36:22.560] One thing about going into a meeting with the prosecuting attorney, never ever go into
[36:22.560 --> 36:29.240] a private office with the prosecuting attorney.
[36:29.240 --> 36:36.280] They can lie like dogs, don't ever talk to them without a recording.
[36:36.280 --> 36:43.600] Take two recorders with you, one they can see, one they can't see.
[36:43.600 --> 36:47.280] Take the one they can see and place it on the table, and they're going to insist that
[36:47.280 --> 36:52.880] you turn it off, turn it off, don't tell them about the other one.
[36:52.880 --> 37:00.200] We had someone call in from New York and played the audio of the police officers trying to
[37:00.200 --> 37:05.640] figure out how to erase the first tape.
[37:05.640 --> 37:12.440] That was a hoot, but if you can avoid it, never go into his office.
[37:12.440 --> 37:21.120] If he wants to meet with you, public place, make sure you take a witness, and he may tell
[37:21.120 --> 37:28.880] you, well, only you can be here, and you tell him, then we don't talk.
[37:28.880 --> 37:31.240]  That's not going to happen.
[37:31.240 --> 37:37.040] If he doesn't want what he said recorded, there's a real good reason he doesn't want
[37:37.040 --> 37:40.960]  what he says recorded.
[37:40.960 --> 37:47.440] Every time you talk to one of them, as soon as you're finished, sit down and write out
[37:47.440 --> 37:50.640]  a statement of what was said.
[37:50.640 --> 37:56.060] Immediately, that is one of the most powerful tools you can have.
[37:56.060 --> 37:59.800]  That's better than a recording.
[37:59.800 --> 38:04.320] They will jump up and down and rail in righteous indignation about recordings and try to keep
[38:04.320 --> 38:05.320]  those out.
[38:05.320 --> 38:14.040] But if you write a transcript, especially if you have a recording, then you write out
[38:14.040 --> 38:17.600]  a transcript of what's in the recording.
[38:17.600 --> 38:24.400] In the transcript, you can make comments about what was going on that aren't necessarily
[38:24.400 --> 38:33.720] represented in the voice recording, what was going on when the person was speaking or in
[38:33.720 --> 38:36.480]  between.
[38:36.480 --> 38:45.000] That is more powerful in court than a recording, and that's not something they can keep out.
[38:45.000 --> 38:49.360] Those are just some basic things to know and understand.
[38:49.360 --> 38:55.080] Have you read the code, the statute that they're charging you with?
[38:55.080 --> 38:58.040]  I have, yes.
[38:58.040 --> 39:05.120] Have you looked up case law concerning how that statute is to be enforced?
[39:05.120 --> 39:20.440] There's two of the things that they propose that not even seasoned people, seasoned lawyers,
[39:20.440 --> 39:23.920] can actually narrow down and make sense out of.
[39:23.920 --> 39:29.320] It's so messed up, two of those issues.
[39:29.320 --> 39:40.920] Even the agent who has false officer calling what you want, high at hand, has serious... He
[39:40.920 --> 39:43.760] does not understand what he wrote either.
[39:43.760 --> 39:52.800] Okay, then that should... Before I say anything about that, I would need to see what's there
[39:52.800 --> 39:56.120] to best evaluate how to handle that.
[39:56.120 --> 40:00.640] Something like that is good for you, but you need to be careful how you use it.
[40:00.640 --> 40:02.320] You don't want to give them fair warning.
[40:02.320 --> 40:04.560]  That's one of my rules.
[40:04.560 --> 40:09.280] Never ever give fair warning.
[40:09.280 --> 40:16.960] Bushwhack is better, and bushwhack's perfectly acceptable in criminal trials.
[40:16.960 --> 40:23.200] They frown on it in civil, but in criminal, never let them know what you got until it's
[40:23.200 --> 40:29.840] too late for them to do something about it.
[40:29.840 --> 40:35.720] It's hard for me to... I can't really give you a whole lot on your issue, but all I can
[40:35.720 --> 40:38.520] do at this point is give you general information.
[40:38.520 --> 40:41.520]  Do you have a lawyer?
[40:41.520 --> 40:48.520] I've got elbow counsel, and it's better that way because the one I had before was actually
[40:48.520 --> 40:51.320]  probably the best friend's golf mate.
[40:51.320 --> 40:53.640]  Oh, that's even better.
[40:53.640 --> 40:59.480] You should... Oh, never let the lawyer get away.
[40:59.480 --> 41:09.800] The lawyer's going to try to screw you, however, he hasn't ran into the pro se from hell yet.
[41:09.800 --> 41:12.440] This is how you handle your lawyer.
[41:12.440 --> 41:19.120] You tell the lawyer what he's going to do, and when he doesn't, you bar-grieve him.
[41:19.120 --> 41:24.000] When you bar-grieve him, he's going to have a conniption fit, and he's going to run to
[41:24.000 --> 41:30.200] the court and ask the court to remove him from the case.
[41:30.200 --> 41:34.480] You're going to go to the court and tell the court, don't you dare remove him from that
[41:34.480 --> 41:35.880]  case.
[41:35.880 --> 41:39.880] He is my counsel of choice, and he's under contract.
[41:39.880 --> 41:45.080] We had a woman in a bankruptcy recently, and the judge, she bar-grieved the lawyer because
[41:45.080 --> 41:49.000]  he wouldn't file motions of pleadings.
[41:49.000 --> 41:54.920] He asked to be removed, and she went in and objected, and the judge said, well, Miss Ortiz,
[41:54.920 --> 41:59.120] if you can't get along with your lawyer, why don't you want him to withdraw?
[41:59.120 --> 42:02.000]  She said, he's under contract.
[42:02.000 --> 42:04.120]  I paid him.
[42:04.120 --> 42:05.440]  He owes me.
[42:05.440 --> 42:09.680]  I don't care if he likes me or not.
[42:09.680 --> 42:13.840] The judge turned to the lawyer and said, I'm sorry, counsel, you're going to have to find
[42:13.840 --> 42:17.000] a way to get along with your lawyer.
[42:17.000 --> 42:24.800] If the judge had removed the lawyer, then you get to sue the judge for interfering with
[42:24.800 --> 42:27.480]  a private contract.
[42:27.480 --> 42:32.360] That's outside the scope of his authority.
[42:32.360 --> 42:43.160] He can allow the lawyer to withdraw, but only if you authorize it, so don't authorize it.
[42:43.160 --> 42:45.120]  Here's how it works.
[42:45.120 --> 42:48.760] You go into court, and you sit down at the table.
[42:48.760 --> 42:53.120]  It's like a four-sided chessboard.
[42:53.120 --> 42:54.240]  You're one of the players.
[42:54.240 --> 42:56.560]  You're sitting at the table.
[42:56.560 --> 43:01.960] Your lawyer's to your right, opposing counsel is to your left, the judge is across from
[43:01.960 --> 43:03.520]  you.
[43:03.520 --> 43:06.920] You have a relationship with your lawyer.
[43:06.920 --> 43:12.720] Your lawyer has a relationship with opposing counsel and with the judge, so you're the
[43:12.720 --> 43:22.040] odd man out, unless you can use their relationships with one another to your advantage.
[43:22.040 --> 43:29.280] The way you do that is you kick your lawyer right square in his professional pants.
[43:29.280 --> 43:34.480] He then goes to the judge and the other lawyer and say, I've got an unruly client here.
[43:34.480 --> 43:36.080]  He's going to ruin my career.
[43:36.080 --> 43:38.920] You guys got to help me out.
[43:38.920 --> 43:39.920]  Hang on.
[43:39.920 --> 43:40.920]  Going to break.
[43:40.920 --> 43:43.480] I'm Andy Kelton, Debra Stevens, Root of Law Radio.

[46:04.960 --> 46:34.360] Okay, we are back, Randy Kelton, Rule of Law Radio, and we're talking to Paul in Tennessee
[46:34.360 --> 46:43.360] and Paul, I just did a quick search on the break.
[46:43.360 --> 46:48.280] You're calling these suppressors, and I take that to mean they are silencers.
[46:48.280 --> 46:54.320] Well, they call them silencers in England, they're moderators in a whole different category
[46:54.320 --> 46:55.320]  in England.
[46:55.320 --> 47:05.280] Okay, one quick search of the internet, I put, are silencers legal?
[47:05.280 --> 47:08.560]  Silencers are legal in 42 states.
[47:08.560 --> 47:09.560] Tennessee is one of them.
[47:09.560 --> 47:12.280]  They're legal in Tennessee too.
[47:12.280 --> 47:14.440]  So they're legal in Tennessee.
[47:14.440 --> 47:19.880] So what is their claim?
[47:19.880 --> 47:26.320] Their claim is that I knowingly avoided and I have possession of without paying a tax
[47:26.320 --> 47:30.240]  stamp.
[47:30.240 --> 47:33.360]  So they're claiming an import tax?
[47:33.360 --> 47:38.240] An import tax and an ownership tax of some sort.
[47:38.240 --> 47:40.280] So this is just a tax issue.
[47:40.280 --> 47:44.400]  It's a tax issue.
[47:44.400 --> 47:52.840] So that makes this a whole lot easier.
[47:52.840 --> 47:59.560] Is there a way you can get to excusable error?
[47:59.560 --> 48:06.000] Okay, wait, this is going to be too complex to do on the air.
[48:06.000 --> 48:07.000]  Okay.
[48:07.000 --> 48:15.600] I need to send me an email and the first thing I need is a timeline.
[48:15.600 --> 48:19.000] Everything happened, that happened and when.
[48:19.000 --> 48:24.000] No explanation, no argument, just this happened, this happened, this happened, this happened.
[48:24.000 --> 48:29.440] That's so that when we talk, you know, you will tend to go from one important issue to
[48:29.440 --> 48:31.760] the next, to the next.
[48:31.760 --> 48:36.440] And I don't always know how these relate to one another.
[48:36.440 --> 48:43.480] So the most valuable tool I can have and the most valuable tool you can have is a detailed
[48:43.480 --> 48:46.760]  timeline of events.
[48:46.760 --> 48:51.760] Once I have that, then we can talk and I always know exactly where you are.
[48:51.760 --> 48:58.080] And then I can go through this because I do something in particular.
[48:58.080 --> 49:04.840] I look at the applicable law and then I look to see if the public officials followed the
[49:04.840 --> 49:07.080]  law.
[49:07.080 --> 49:10.160]  When I help somebody, I don't care if they're guilty, innocent.
[49:10.160 --> 49:12.600]  I don't care.
[49:12.600 --> 49:15.160]  That's not what I do.
[49:15.160 --> 49:26.360] I make sure my public officials follow the law to the letter and when they don't, I have
[49:26.360 --> 49:32.320] tools you can beat them up with big time.
[49:32.320 --> 49:38.600] If you haven't listened to the show before, it sometimes takes a couple of times through
[49:38.600 --> 49:42.040] it before you begin to understand it.
[49:42.040 --> 49:47.960] At the beginning of the show, I told about sending a criminal complaint against the federal
[49:47.960 --> 49:56.840] judge to the special agent in charge in Dallas, Texas, the special agent in charge of the
[49:56.840 --> 50:00.320]  FBI in Dallas.
[50:00.320 --> 50:06.920] And what I wanted, they had somebody call me from their intake section and said, Mr.
[50:06.920 --> 50:11.400] Kelton, what do you want us to do with this?
[50:11.400 --> 50:20.360] I said, I want you to do exactly what the law commands you to do.
[50:20.360 --> 50:27.760] But I suspect that you don't know what that is and I'm not going to tell you.
[50:27.760 --> 50:33.040] This is a test and that's exactly what it was.
[50:33.040 --> 50:39.000] I have never, this 28 USC 535, one of my listeners brought that to my attention a few months
[50:39.000 --> 50:43.840] ago and it was like a Christmas present.
[50:43.840 --> 50:49.040] Now I will check with the attorney general to see if this guy actually gave notice to
[50:49.040 --> 50:57.600] the attorney general and when he didn't, then he violated a law relating to his office and
[50:57.600 --> 51:02.800] in the process denied me the full and free access to and joined it in my right to petition
[51:02.800 --> 51:08.800] court for redress agreements and I will file criminal charges against him under 18 U.S.
[51:08.800 --> 51:15.600] Code 242, which is a class A misdemeanor in the federal government.
[51:15.600 --> 51:19.440]  Up to a year in jail, $10,000 fine.
[51:19.440 --> 51:24.040] You want to play hardball, Bubba, we'll see how this works for you.
[51:24.040 --> 51:34.000] And I will file it with the U.S. attorney and the U.S. attorney will exercise his prosecutorial
[51:34.000 --> 51:36.840] discretion and refuse to prosecute.
[51:36.840 --> 51:41.280] Well, at least I hope he does.
[51:41.280 --> 51:48.360] See another rule I have, never ask a public official to do anything you actually want
[51:48.360 --> 51:55.800] them to do because you never ask a public official to do anything that the law does
[51:55.800 --> 52:01.680] not command them to do and when they don't do it, you get to land on them like a ton
[52:01.680 --> 52:03.720]  of bricks.
[52:03.720 --> 52:12.840] So we'll look through your case and I will find numerous places where the agents and
[52:12.840 --> 52:21.160] the U.S. attorney did not follow law and then we'll pick something seemingly minor.
[52:21.160 --> 52:28.800] File a criminal complaint against an agent with the SAC, with the special agent in charge.
[52:28.800 --> 52:32.680] And then we check with the attorney general to see if he gave notice to the attorney general.
[52:32.680 --> 52:37.480] When he didn't, then we file against the agent with the U.S. attorney and when the U.S. attorney
[52:37.480 --> 52:46.400] doesn't give notice to the attorney general, then we file against the U.S. attorney, except
[52:46.400 --> 52:51.560] we don't send that one to the U.S. attorney, we send that one to the grand jury.
[52:51.560 --> 52:55.240] And if you send something to the federal grand jury, the U.S. attorney is going to intercept
[52:55.240 --> 52:56.240]  it.
[52:56.240 --> 53:06.040] Surprise, surprise, when he intercepts this one, it's a complaint against himself.
[53:06.040 --> 53:14.800] That's obstruction that we file against him, accusing him of secreting criminal complaints
[53:14.800 --> 53:17.680] against himself from the grand jury.
[53:17.680 --> 53:23.200] And we file that directly with the attorney general in D.C. and ask that he be removed
[53:23.200 --> 53:24.200]  from office.
[53:24.200 --> 53:35.520] Now this U.S. attorney knows that Trump has his resignation in his hand.
[53:35.520 --> 53:37.880] And he can just dump him because he wants to.
[53:37.880 --> 53:43.680] All Trump needs is a reason to get rid of one of these attorneys so he can put in his
[53:43.680 --> 53:44.680]  own people.
[53:44.680 --> 53:47.680]  It's all political.
[53:47.680 --> 53:56.080] So if the U.S. attorney has done everything right, he's got nothing to worry about.
[53:56.080 --> 53:58.960] But they never do everything right.
[53:58.960 --> 54:05.240]  That's like a bunch that doesn't melt in his mouth, right?
[54:05.240 --> 54:11.880] They are so accustomed to being able to do anything they want to, they are not used to
[54:11.880 --> 54:15.920] somebody coming right at them.
[54:15.920 --> 54:19.080] And it changes the whole landscape.
[54:19.080 --> 54:25.640] And it relieves me to hear that they're charging you just with not paying a tax.
[54:25.640 --> 54:26.640]  Yeah.
[54:26.640 --> 54:29.640] Okay, at the end of the day.
[54:29.640 --> 54:34.400] A couple of things related, but yeah.
[54:34.400 --> 54:42.280] At the end of the day, don't expect to win the whole enchilada.
[54:42.280 --> 54:46.240] Everything about the courts are corrupt.
[54:46.240 --> 54:47.240]  That's all there is to it.
[54:47.240 --> 54:51.480] They're just absolutely corrupt, especially the federal courts.
[54:51.480 --> 54:58.080] It is my opinion that all the federal judges are bought and paid for.
[54:58.080 --> 55:05.920] So the way to win is the problem with these corrupt courts is they are so corrupt.
[55:05.920 --> 55:10.240] Even the pay them off can't trust them.
[55:10.240 --> 55:13.600] Nobody wants to get in the courtroom.
[55:13.600 --> 55:16.920]  It's always a crap shoot.
[55:16.920 --> 55:24.280] The courts will not rule for or against a party based on the rule of law.
[55:24.280 --> 55:27.600] They will do it based on the politics.
[55:27.600 --> 55:31.080] And right now the politics are extremely volatile.
[55:31.080 --> 55:35.840] Oh, they'll use law to explain their position.
[55:35.840 --> 55:41.920] But if you have a claim they can't get around, they'll just ignore it.
[55:41.920 --> 55:46.240] And they'll rule against you on another claim, they're corrupt.
[55:46.240 --> 55:50.480] But the other side knows they're corrupt.
[55:50.480 --> 55:56.680] And use this to bring them to the table and make a deal that you both can live with because
[55:56.680 --> 56:01.240] what they really want to do is bankrupt you.
[56:01.240 --> 56:07.760] They want to cost you everything you have until you have no option, until you can't
[56:07.760 --> 56:08.760]  fight them anymore.
[56:08.760 --> 56:16.000] That U.S. attorney is using my tax dollars to steal everything you got.
[56:16.000 --> 56:19.680]  He don't care, it don't cost him anything.
[56:19.680 --> 56:27.080] And they will hound you until they use up every dime you've got and then they'll dismiss.
[56:27.080 --> 56:33.000] And I've got a half a dozen people that have done that too.
[56:33.000 --> 56:35.320] This is what they do.
[56:35.320 --> 56:41.640] The only defense I've ever seen to it is you go right back after them.
[56:41.640 --> 56:47.080] When you start holding them to the same letter of law they try to hold you to, oh, do they
[56:47.080 --> 56:49.600]  get excited?
[56:49.600 --> 56:54.120] They want to think that the law doesn't apply to them, that it only applies to you.
[56:54.120 --> 57:02.760] What they don't understand is you are the most powerful person in the courtroom.
[57:02.760 --> 57:07.560]  You're not a bailiff, a clerk, a judge, a prosecutor.
[57:07.560 --> 57:10.560]  They're all public servants.
[57:10.560 --> 57:13.440]  They're the servants, you're the master.
[57:13.440 --> 57:17.760] When you walk into that courtroom you got two hats, you got your litigants hat on.
[57:17.760 --> 57:23.560] But you're also bringing your master's hat, but one of those officials steps half inch
[57:23.560 --> 57:28.280] across the little line, you take off your litigants hat, put on your master's hat and
[57:28.280 --> 57:33.720] you start filing against the official to bring him back in line.
[57:33.720 --> 57:38.040] Judges especially are not accustomed to that.
[57:38.040 --> 57:45.800] I filed criminal charges against a federal judge for the ruling he made in court.
[57:45.800 --> 57:52.320] I have not heard a peep, everybody wants to find a place to hide.
[57:52.320 --> 57:55.200] This is what they do when you come after them.
[57:55.200 --> 57:59.680] They're coming after you, you turn back on them, you got a chance of getting them to
[57:59.680 --> 58:04.360] come to the table and make a deal you can live with so you can make this go away.
[58:04.360 --> 58:05.360]  Does that make sense?
[58:05.360 --> 58:06.360]  It does.
[58:06.360 --> 58:07.360]  Yes, it does.
[58:07.360 --> 58:14.720] You know, it would be nice to say I can help you win your case, and if anybody tells you
[58:14.720 --> 58:18.840] I can help you win your case, it's almost certainly going to be a lawyer and he's just
[58:18.840 --> 58:21.680] trying to get a retainer from you.
[58:21.680 --> 58:27.960] The courts are corrupt, I can help you bring the other side to the table.
[58:27.960 --> 58:31.000] Hang on, back to go to break, Randy Kelton.
[58:31.000 --> 58:35.320] Hang on, Dave will pick you up when we get back.

[58:58.600 --> 59:04.000] Some new translations try to help by simplifying the text, but in the process can compromise

[59:07.240 --> 59:09.640]  Enter the recovery version.
[59:09.640 --> 59:14.920] This new translation is extremely faithful and accurate, but the real story is the more

[59:18.640 --> 59:23.640] Difficult and profound passages are opened up in a marvelous way, providing an entrance

[01:00:14.960 --> 01:00:23.520] scoop into the tides of the alternative.
[01:00:23.520 --> 01:00:29.280] Markets for Wednesday the 22nd of February 2017 are currently trading with gold at $1,237.21
[01:00:29.280 --> 01:00:36.680] an ounce, silver $18.01 an ounce, Texas crude $53.40 a barrel, and Bitcoin is still rising
[01:00:36.680 --> 01:00:46.000]  sitting at about $1,130 U.S. currency.
[01:00:46.000 --> 01:00:51.600] Today in history, the year 1943, members of the White Rose Resistance, a nonviolent intellectual
[01:00:51.600 --> 01:00:55.880] resistance group in Nazi Germany led by a group of students and a professor at the University
[01:00:55.880 --> 01:01:01.080] of Munich that conducted an anonymous leaflet and graffiti campaign which called for active
[01:01:01.080 --> 01:01:06.280] opposition against the Nazi regime, started on June 27, 1942, and ending with the arrest
[01:01:06.280 --> 01:01:12.600] of the core group, Sophie Scholl, Hans Scholl, and Christoph Propst, by the Gustapo on February
[01:01:12.600 --> 01:01:19.680]  18th, were executed today in history.
[01:01:19.680 --> 01:01:25.100] In recent years, the Palestinian Badouin village of Gan Al-Amar near Jerusalem was raided by
[01:01:25.100 --> 01:01:29.560] Israeli defense forces on Sunday after Israeli's government issued a demolition order for the
[01:01:29.560 --> 01:01:30.640]  Palestinian village.
[01:01:30.640 --> 01:01:34.680] The IDF imposed a military closure on dozens of structures, homes, and the only school
[01:01:34.680 --> 01:01:39.560] in the area, giving residents just a few days until Thursday of this week to evacuate.
[01:01:39.560 --> 01:01:43.360] It's estimated that 40 Palestinian homes in the central West Bank community are targeted
[01:01:43.360 --> 01:01:44.360]  for demolition.
[01:01:44.360 --> 01:01:49.280] In 2014, the United Nations Office for the Coordination of Humanitarian Affairs identified
[01:01:49.280 --> 01:01:54.580] the Gan Al-Amar village as one of the 46 settlements in the area that's at risk of forced relocation
[01:01:54.580 --> 01:01:55.580]  by Israel.
[01:01:55.580 --> 01:01:58.760] Villagers were given construction termination warrants and will have a chance to present
[01:01:58.760 --> 01:02:01.200] their case during a hearing on Thursday.
[01:02:01.200 --> 01:02:04.560] Israeli officials maintain that the village was built illegally in the hotly disputed
[01:02:04.560 --> 01:02:14.840] E1 corridor, which physically links East Jerusalem and the Mali Adumim settlement.
[01:02:14.840 --> 01:02:18.480] According to the Canadian Border Service Agency, more than 1,400 people have made claims at
[01:02:18.480 --> 01:02:23.400] land border ports of entry in the region since November, which is more in the last four months
[01:02:23.400 --> 01:02:24.920]  than the entire year of 2015.
[01:02:24.920 --> 01:02:30.240] Apparently, the number of people seeking asylum has soared in the last year and spiked recently,
[01:02:30.240 --> 01:02:32.600] with Quebec seeing the greatest numbers.
[01:02:32.600 --> 01:02:36.000] Canadian authorities are saying that the migrants come from all over the world and ranging in
[01:02:36.000 --> 01:02:39.120] all ages, from parents with infants to the elderly.
[01:02:39.120 --> 01:02:42.920] Inspector Martin Roach of the Royal Canadian Mountain Police stated that since, quote,
[01:02:42.920 --> 01:02:46.920] they're not reporting to the open port of entry, they're being placed under arrest
[01:02:46.920 --> 01:02:53.920] and then interviewed to make sure there's no national security nexus.
[01:03:16.920 --> 01:03:34.920]  Okay.
[01:03:34.920 --> 01:03:35.920]  We are back.
[01:03:35.920 --> 01:03:39.920] Randy Kelton, Rue of La Radio, and we're talking to Paul in Tennessee.
[01:03:39.920 --> 01:03:43.760] Paul, what is going on here?
[01:03:43.760 --> 01:03:47.920]  Our tax on a suppressor is 200 bucks.
[01:03:47.920 --> 01:03:50.920]  This is chump change.
[01:03:50.920 --> 01:03:55.920] Did you have 50,000 of them or something?
[01:03:55.920 --> 01:03:56.920]  I wish.
[01:03:56.920 --> 01:03:57.920]  I could only wish.
[01:03:57.920 --> 01:04:10.920] This was a setup job by a man who was a government agent who happened to be doing some stuff
[01:04:10.920 --> 01:04:11.920]  at my place.
[01:04:11.920 --> 01:04:12.920]  Okay.
[01:04:12.920 --> 01:04:13.920]  Wait a minute.
[01:04:13.920 --> 01:04:19.120] What are the rules on paying the import tax?
[01:04:19.120 --> 01:04:22.840] How long do you have to pay it?
[01:04:22.840 --> 01:04:33.720] I do not know the answer, but I do know I tried to pay it and I was denied.
[01:04:33.720 --> 01:04:38.120] You tried to pay it before they came after you or after?
[01:04:38.120 --> 01:04:43.880] No, it was a setup job as soon as they got back from England.
[01:04:43.880 --> 01:04:51.120] I was hit with seven carloads of armed people.
[01:04:51.120 --> 01:05:02.340] Well, what I'm looking at is it's clear that the prosecutor has a purpose other than collecting
[01:05:02.340 --> 01:05:03.840]  the import tax.
[01:05:03.840 --> 01:05:05.320]  Oh, yes.
[01:05:05.320 --> 01:05:09.160]  Yeah, he's after blood.
[01:05:09.160 --> 01:05:18.200] So we need to do some accounting and find out how much he's spent on this so far.
[01:05:18.200 --> 01:05:19.200]  Okay.
[01:05:19.200 --> 01:05:27.560] This is something I need to look at off the air because there are other things almost
[01:05:27.560 --> 01:05:33.360] certainly that crimes that the prosecutor is not prosecuting.
[01:05:33.360 --> 01:05:43.360] So this is clearly a political prosecution, so you make it nice and political for them.
[01:05:43.360 --> 01:05:45.360]  Send me an email.
[01:05:45.360 --> 01:05:50.360] Let's talk about this offline off the air because it's kind of complex and it'll take
[01:05:50.360 --> 01:05:51.360]  a while.
[01:05:51.360 --> 01:05:52.360]  I will.
[01:05:52.360 --> 01:05:55.960] I'll just thank you for the time you've given me today.
[01:05:55.960 --> 01:05:56.960]  Okay.
[01:05:56.960 --> 01:05:57.960]  Send me an email.
[01:05:57.960 --> 01:05:59.960] I'll send you my number where you can call me.
[01:05:59.960 --> 01:06:00.960]  Lovely.
[01:06:00.960 --> 01:06:02.960] Thank you ever so much, Bernie.
[01:06:02.960 --> 01:06:03.960]  Okay.
[01:06:03.960 --> 01:06:04.960]  Thank you.
[01:06:04.960 --> 01:06:05.960]  Okay.
[01:06:05.960 --> 01:06:06.960] Now we're going to go to Dave in Texas.
[01:06:06.960 --> 01:06:07.960]  Hello, Dave.
[01:06:07.960 --> 01:06:08.960]  Hello, Randy.
[01:06:08.960 --> 01:06:15.960] What do you have for us today?
[01:06:15.960 --> 01:06:20.960]  Yeah, several things.
[01:06:20.960 --> 01:06:29.960] Randy, in choosing the members of the jury, do you have any tips for doing that?
[01:06:29.960 --> 01:06:35.960] No, juries always find me incredibly guilty, so I always get it wrong.
[01:06:35.960 --> 01:06:42.960] I actually had a jury once rule that I was incredibly guilty.
[01:06:42.960 --> 01:06:46.960] I live in a small town and half the jurors knew who I was.
[01:06:46.960 --> 01:06:53.960] It was a traffic ticket and the foreman of the jury was a good friend of mine and he
[01:06:53.960 --> 01:06:58.960] got up and he said, we, the jury, find the defendant incredibly guilty.
[01:06:58.960 --> 01:07:07.960] So I'm not a good one on the jury issue.
[01:07:07.960 --> 01:07:14.960] I try very hard never to get there and never want to get to the merits of the case.
[01:07:14.960 --> 01:07:15.960]  Okay.
[01:07:15.960 --> 01:07:22.960] We have too many things we can go after them for.
[01:07:22.960 --> 01:07:24.960]  Is the trial set?
[01:07:24.960 --> 01:07:36.960] Yeah, it's set for March 6th and I wanted to just run by you my causes of action.
[01:07:36.960 --> 01:07:41.960]  I'm pretty sure they're okay.
[01:07:41.960 --> 01:07:47.960] Number one is unjust enrichment.
[01:07:47.960 --> 01:07:52.960] Number two, infliction of emotional stress.
[01:07:52.960 --> 01:07:59.960] This is against my property manager of my apartment.
[01:07:59.960 --> 01:08:03.960]  Three, retaliation.
[01:08:03.960 --> 01:08:07.960] Five, violation of the lease.
[01:08:07.960 --> 01:08:18.960] Six, additional violation of the lease and seven, additional violation of the lease.
[01:08:18.960 --> 01:08:20.960]  Wait a minute, hold on.
[01:08:20.960 --> 01:08:24.960] Which of these causes of action are these, yours?
[01:08:24.960 --> 01:08:29.960] Mine against the property management of my apartment.
[01:08:29.960 --> 01:08:32.960]  Oh, oh wait, I'm brain dead.
[01:08:32.960 --> 01:08:36.960] I'm thinking about the guy with the suppressor still.
[01:08:36.960 --> 01:08:39.960] Okay, brain dead, brain dead, okay.
[01:08:39.960 --> 01:08:47.960] Unjust enrichment, what are the elements of unjust enrichment?
[01:08:47.960 --> 01:08:56.960] So Randy, you remember last week, now this is a different case.
[01:08:56.960 --> 01:09:01.960] Last week we talked about the baseboards, but that concerned my eviction.
[01:09:01.960 --> 01:09:04.960]  Now I have another case.
[01:09:04.960 --> 01:09:10.960] I'm suing them for treating me really badly.
[01:09:10.960 --> 01:09:12.960] So this is not the eviction case.
[01:09:12.960 --> 01:09:14.960] This is me suing them.
[01:09:14.960 --> 01:09:15.960]  Oh no, okay.
[01:09:15.960 --> 01:09:16.960] We talked about the baseboards.
[01:09:16.960 --> 01:09:19.960] No, no, no, hold on, hold on.
[01:09:19.960 --> 01:09:20.960]  Yeah.
[01:09:20.960 --> 01:09:33.960] In order to make a claim for unjust enrichment, you have to claim each element of the cause of action.
[01:09:33.960 --> 01:09:40.960] When you go to a civil court, you can't just go in there and say these guys were dirty rotten scoundrels
[01:09:40.960 --> 01:09:48.960] and they did bad things to me and you ought to give me adjustment in my favor.
[01:09:48.960 --> 01:09:59.960] It's similar to a criminal in that in a criminal case, the government charges you with a specific cause of action.
[01:09:59.960 --> 01:10:01.960]  They call it a crime.
[01:10:01.960 --> 01:10:06.960] And that crime has certain elements that must be there.
[01:10:06.960 --> 01:10:19.960] When you sue in a civil case, you have to sue based on defined causes of action or torts.
[01:10:19.960 --> 01:10:27.960] And when you claim a cause of action, you need to look at the definition of that cause of action.
[01:10:27.960 --> 01:10:30.960]  And it'll have a number of elements.
[01:10:30.960 --> 01:10:40.960] You have to claim, you have to show evidence to support each element of the cause of action
[01:10:40.960 --> 01:10:45.960] or the judge will rule against you and he won't necessarily tell you why.
[01:10:45.960 --> 01:10:46.960]  Okay.
[01:10:46.960 --> 01:10:48.960] Let me give you an example here.
[01:10:48.960 --> 01:10:51.960] Unjust enrichment has three elements.
[01:10:51.960 --> 01:11:00.960] First, the plaintiff must have provided the defendant with something of value while expecting compensation in return.
[01:11:00.960 --> 01:11:10.960] Second, the defendant must have acknowledged, accepted and benefited from whatever plaintiff provided.
[01:11:10.960 --> 01:11:24.960] Third, the plaintiff must show that it would be inequitable or unconscionable for the defendant to enjoy the benefit of plaintiff's actions without paying for it.
[01:11:24.960 --> 01:11:26.960] Those are the causes of action.
[01:11:26.960 --> 01:11:31.960] I mean, the elements for a cause of action of unjust enrichment.
[01:11:31.960 --> 01:11:34.960] You have to claim each one of those.
[01:11:34.960 --> 01:11:35.960]  Okay.
[01:11:35.960 --> 01:11:40.960] Otherwise, they're going to move to dismiss. Emotional distress.
[01:11:40.960 --> 01:11:43.960]  It's similar.
[01:11:43.960 --> 01:11:45.960]  Yeah.
[01:11:45.960 --> 01:11:52.960]  Infliction of emotional distress.
[01:11:52.960 --> 01:12:12.960] Randy, all I have is that I saw a counselor, a nurse practitioner who felt that I was suffering anxiety and stress with this property management company.
[01:12:12.960 --> 01:12:15.960]  And that's really all I got.
[01:12:15.960 --> 01:12:17.960] Okay. Hold on. Hold on.
[01:12:17.960 --> 01:12:19.960]  Infliction of emotional distress.
[01:12:19.960 --> 01:12:26.960] The tort of intentional infliction of emotional distress has four elements.
[01:12:26.960 --> 01:12:30.960] The defendant must act intentionally or recklessly.
[01:12:30.960 --> 01:12:34.960] The defendant's conduct must be extreme and outrageous.
[01:12:34.960 --> 01:12:44.960] And the conduct must be the cause for severe emotional distress.
[01:12:44.960 --> 01:12:47.960]  Okay. Good. Good.
[01:12:47.960 --> 01:12:51.960]  That's exactly what I wanted to.
[01:12:51.960 --> 01:12:54.960]  Good. Okay.
[01:12:54.960 --> 01:12:57.960]  Retaliation.
[01:12:57.960 --> 01:13:04.960] Retaliation is not going to be a cause of action.
[01:13:04.960 --> 01:13:10.960]  Yeah. I know.
[01:13:10.960 --> 01:13:15.960] Retaliation will probably go to something else.
[01:13:15.960 --> 01:13:17.960]  Yeah.
[01:13:17.960 --> 01:13:19.960]  Okay.
[01:13:19.960 --> 01:13:20.960]  Okay.
[01:13:20.960 --> 01:13:23.960] I'm just on the Internet doing a simple search here.
[01:13:23.960 --> 01:13:24.960]  Retaliation.
[01:13:24.960 --> 01:13:32.960] Once you have complained about discrimination, you have engaged in what is referred to as protected activity.
[01:13:32.960 --> 01:13:44.960] Any adverse action that your employer takes against you after this point could be used to demonstrate that it was taken in retaliation for your engaging in a protected activity.
[01:13:44.960 --> 01:13:47.960]  Okay.
[01:13:47.960 --> 01:13:56.960] Did you lodge a complaint against the apartment complex?
[01:13:56.960 --> 01:14:11.960] And did the apartment complex subsequently do something that caused you harm difficult to your distress?
[01:14:11.960 --> 01:14:20.960]  I did not file a complaint.
[01:14:20.960 --> 01:14:31.960] What they did is they moved my bed into the kitchen living room area.
[01:14:31.960 --> 01:14:35.960] They said they were going to replace the rug, and they never did.
[01:14:35.960 --> 01:14:37.960] They just left me in the living room.
[01:14:37.960 --> 01:14:38.960]  I can barely walk.
[01:14:38.960 --> 01:14:40.960]  I'm so crippled.
[01:14:40.960 --> 01:14:43.960]  So I was, you know...
[01:14:43.960 --> 01:14:44.960]  Okay.
[01:14:44.960 --> 01:14:45.960]  That's not retaliation.
[01:14:45.960 --> 01:14:46.960]  That won't get you to retaliation.
[01:14:46.960 --> 01:14:51.960] That will get you to intentional infliction of emotional distress.
[01:14:51.960 --> 01:14:52.960]  Okay.
[01:14:52.960 --> 01:14:55.960]  All right.
[01:14:55.960 --> 01:14:56.960]  So...
[01:14:56.960 --> 01:15:03.960] Options of the least are going to be pretty specific.
[01:15:03.960 --> 01:15:04.960]  Yeah.
[01:15:04.960 --> 01:15:11.960]  The problem is I didn't complain.
[01:15:11.960 --> 01:15:14.960]  Randy is that I was...
[01:15:14.960 --> 01:15:17.960]  It was a conspiracy, really.
[01:15:17.960 --> 01:15:20.960] They came in and charged me with the baseboards.
[01:15:20.960 --> 01:15:22.960]  They didn't accept my rent check.
[01:15:22.960 --> 01:15:26.960] Then they moved me into the kitchen and said they were going to replace the rug.
[01:15:26.960 --> 01:15:27.960]  They never did.
[01:15:27.960 --> 01:15:34.960] Okay. This sounds like you need to have a contractual violation.
[01:15:34.960 --> 01:15:41.960] You need to sue based on the rental contract and the rental laws for Texas.
[01:15:41.960 --> 01:15:44.960]  Yeah.
[01:15:44.960 --> 01:15:54.960] You had spoken earlier to this issue that they're trying to get rid of all the old geezers and make this a college rental.
[01:15:54.960 --> 01:15:55.960]  Yeah.
[01:15:55.960 --> 01:16:03.960] So in order to force you out, they committed contractual violations against you.
[01:16:03.960 --> 01:16:11.960] They didn't allow you in the free and unencumbered enjoyment of the property.
[01:16:11.960 --> 01:16:16.960] That's something you could probably get some traction on.
[01:16:16.960 --> 01:16:18.960]  Yeah.
[01:16:18.960 --> 01:16:23.960] Discrimination Act, Americans with Disabilities Act.
[01:16:23.960 --> 01:16:29.960] Americans with Disabilities and are you over 65?
[01:16:29.960 --> 01:16:31.960]  No, I'm only 58.
[01:16:31.960 --> 01:16:33.960]  Oh, you're just a baby.
[01:16:33.960 --> 01:16:45.960] What age are you considered elders for elder abuse?
[01:16:45.960 --> 01:16:48.960]  Well, it could be 62.
[01:16:48.960 --> 01:16:51.960]  It's probably 62 or 65.
[01:16:51.960 --> 01:16:55.960] But you still have Americans with Disabilities Act is good.
[01:16:55.960 --> 01:16:59.960] Did you sue in the federal court?
[01:16:59.960 --> 01:17:00.960]  I love Logos.
[01:17:00.960 --> 01:17:04.960] Without the shows on this network, I'd be almost as ignorant as my friends.
[01:17:04.960 --> 01:17:06.960] I'm so addicted to the truth now that there's no going back.
[01:17:06.960 --> 01:17:07.960]  I need my truth fixed.
[01:17:07.960 --> 01:17:09.960]  I'd be lost without Logos.
[01:17:09.960 --> 01:17:12.960] And I really want to help keep this network on the air.
[01:17:12.960 --> 01:17:15.960]  I'd love to volunteer as a show producer, but I'm a bit of a Luddite,
[01:17:15.960 --> 01:17:19.960] and I really don't have any money to give because I spent it all on supplements.
[01:17:19.960 --> 01:17:21.960]  How can I help Logos?
[01:17:21.960 --> 01:17:23.960]  Well, I'm glad you asked.
[01:17:23.960 --> 01:17:26.960] Whenever you order anything from Amazon, you can help Logos
[01:17:26.960 --> 01:17:28.960] with ordering your supplies or holiday gifts.
[01:17:28.960 --> 01:17:30.960] First thing you do is clear your cookies.
[01:17:30.960 --> 01:17:33.960]  Now, go to LogosRadioNetwork.com.
[01:17:33.960 --> 01:17:36.960] Click on the Amazon logo and bookmark it.
[01:17:36.960 --> 01:17:40.960] Now, when you order anything from Amazon, you use that link,
[01:17:40.960 --> 01:17:42.960]  and Logos gets a few pesos.
[01:17:42.960 --> 01:17:43.960]  Do I pay extra?
[01:17:43.960 --> 01:17:44.960]  No.
[01:17:44.960 --> 01:17:46.960] Do I have to do anything different when I order?
[01:17:46.960 --> 01:17:47.960]  No.
[01:17:47.960 --> 01:17:48.960]  Can I use my Amazon Prime?
[01:17:48.960 --> 01:17:49.960]  No.
[01:17:49.960 --> 01:17:50.960]  I mean, yes.
[01:17:50.960 --> 01:17:53.960] Wow, giving without doing anything or spending any money.
[01:17:53.960 --> 01:17:54.960]  This is perfect.
[01:17:54.960 --> 01:17:56.960]  Thank you so much.
[01:17:56.960 --> 01:17:57.960]  We are welcome.
[01:17:57.960 --> 01:17:59.960]  Happy holidays, Logos.

[01:19:00.960 --> 01:19:10.960] This is the Logos Logos Radio Network.
[01:19:31.960 --> 01:19:33.960]  Okay, we are back.
[01:19:33.960 --> 01:19:37.960] Randy Kelton, Deborah Stevens, Rule of Law Radio, and we're talking to Dave in Texas.
[01:19:37.960 --> 01:19:41.960] Okay, Dave, last week I gave you an assignment.
[01:19:41.960 --> 01:19:44.960] Did you do that assignment?
[01:19:44.960 --> 01:19:45.960]  Yes, I did.
[01:19:45.960 --> 01:19:56.960] Yes, Randy, I read Chapter 92 of the Texas Code of Property Tenancy.
[01:19:56.960 --> 01:20:00.960]  I read the entire Code, 84 pages.
[01:20:00.960 --> 01:20:09.960]  I've read the entire listings under Austin's Tenants' Rights.
[01:20:09.960 --> 01:20:16.960] And the last question you asked me is where am I suing?
[01:20:16.960 --> 01:20:22.960] And the answer is the management company I'm suing in JP Court
[01:20:22.960 --> 01:20:29.960] and the owner I'm suing in federal court.
[01:20:29.960 --> 01:20:33.960] So that would be a bigger case against the landlord.
[01:20:33.960 --> 01:20:41.960] I'm going to basically charge him with RICO because this happened to many elderly people here.
[01:20:41.960 --> 01:20:47.960] The guy came in, gave all these ridiculous charges like baseboards,
[01:20:47.960 --> 01:20:57.960] and I mean it's racketeering, but let's go back to the JP case.
[01:20:57.960 --> 01:21:05.960] Yeah, I'm going to push disability against an American citizen.
[01:21:05.960 --> 01:21:12.960] They're going to push that I'm in violation, that I cannot sue them in JP Court
[01:21:12.960 --> 01:21:20.960] because they have an eviction case going with me in county court,
[01:21:20.960 --> 01:21:36.960] and they're saying because I have not paid them the rent that I am unable to sue them in JP.
[01:21:36.960 --> 01:21:40.960] Do they have case law to support that?
[01:21:40.960 --> 01:21:45.960] No, they just, they filed an answer to my petition
[01:21:45.960 --> 01:21:50.960] and they said that I'm not with the lease.
[01:21:50.960 --> 01:21:53.960]  Okay, here's a rule.
[01:21:53.960 --> 01:21:59.960] You can never make a proactive statement of law out of your own mouth.
[01:21:59.960 --> 01:22:04.960] Now you're a pro se and sometimes you can get away with that.
[01:22:04.960 --> 01:22:07.960]  Lawyers can't get away with that.
[01:22:07.960 --> 01:22:14.960] If the lawyer has filed an answer and he made a proactive statement of law
[01:22:14.960 --> 01:22:18.960] and it wasn't out of the mouth of the court,
[01:22:18.960 --> 01:22:26.960] if he doesn't have a case law or statutory citation there to support, move for sanctions.
[01:22:26.960 --> 01:22:30.960]  Bar greed.
[01:22:30.960 --> 01:22:32.960]  Okay, all right.
[01:22:32.960 --> 01:22:38.960] We already have bar greed, Randy, which you told me three weeks ago
[01:22:38.960 --> 01:22:44.960] and they've replaced him with another lawyer.
[01:22:44.960 --> 01:22:50.960] This other lawyer's probably costing them a lot of money.
[01:22:50.960 --> 01:22:51.960]  Yeah.
[01:22:51.960 --> 01:22:57.960] They didn't, they replaced him because the first lawyer ran like a rabbit.
[01:22:57.960 --> 01:23:01.960] Right, yeah, he did, he did.
[01:23:01.960 --> 01:23:12.960] If the second lawyer is still trying to prosecute based on a response
[01:23:12.960 --> 01:23:17.960] that has made proactive statements of law out of their own mouth,
[01:23:17.960 --> 01:23:21.960] you should bar grief him as well.
[01:23:21.960 --> 01:23:23.960]  Okay, good, I will.
[01:23:23.960 --> 01:23:28.960] If he had good sense, he would have filed an amended answer
[01:23:28.960 --> 01:23:35.960] to include the case law in support because he could be making this up.
[01:23:35.960 --> 01:23:44.960] Yes, Randy, and when you read chapter 72 of tenancy,
[01:23:44.960 --> 01:23:54.960] it's really hard to even understand, I mean, how he could make this statement.
[01:23:54.960 --> 01:24:00.960]  Now, that's what I like to hear from you,
[01:24:00.960 --> 01:24:05.960] is you're talking about this based on the law that they're supposed to go by.
[01:24:05.960 --> 01:24:11.960] This is what will get you credence in the court.
[01:24:11.960 --> 01:24:15.960]  Good, good, good, good.
[01:24:15.960 --> 01:24:21.960] It's a lot more fun when you go in there and you know their code better than they do.
[01:24:21.960 --> 01:24:29.960] Yeah, yeah, I'm going to go in with all 84 pages of the code.
[01:24:29.960 --> 01:24:36.960] And you'll probably be surprised as you go through the case,
[01:24:36.960 --> 01:24:43.960] the other side will mention something and that code will jump right out at you.
[01:24:43.960 --> 01:24:52.960] You'll remember the code that was about what he said, you'll be able to go right.
[01:24:52.960 --> 01:24:59.960] You also, Randy, told me to read the lease three times, and I did, and you're right.
[01:24:59.960 --> 01:25:09.960] And I found something in the lease that says that they are responsible for my safety,
[01:25:09.960 --> 01:25:13.960]  so I'm thinking maybe I can use that.
[01:25:13.960 --> 01:25:17.960] I mean, what they did to me was not...
[01:25:17.960 --> 01:25:20.960]  Breach of contract.
[01:25:20.960 --> 01:25:25.960] Yeah, yeah, exactly, exactly, yeah.
[01:25:25.960 --> 01:25:31.960] But if that's not in your pleading, you might want them to,
[01:25:31.960 --> 01:25:36.960] want the court to throw out your JP case so you can refile in the county court
[01:25:36.960 --> 01:25:39.960] or district court for a whole lot more money.
[01:25:39.960 --> 01:25:41.960]  Yeah, yeah.
[01:25:41.960 --> 01:25:45.960] And this case will get you some experience,
[01:25:45.960 --> 01:25:51.960] so when you go after them in the higher court, you'll be more prepared.
[01:25:51.960 --> 01:25:53.960]  Absolutely, absolutely.
[01:25:53.960 --> 01:25:55.960]  It does get easier.
[01:25:55.960 --> 01:26:05.960] And what you'll find as you move into the higher courts, they become more professional.
[01:26:05.960 --> 01:26:06.960]  Okay.
[01:26:06.960 --> 01:26:13.960] They will pay more attention because they're more politically motivated,
[01:26:13.960 --> 01:26:17.960] and they understand the law better.
[01:26:17.960 --> 01:26:21.960]  Yeah, that's true, that's true.
[01:26:21.960 --> 01:26:28.960] All right, well, once again, Randy, you've done an amazing job of helping me with my case,
[01:26:28.960 --> 01:26:31.960] and I want to thank you very, very much.
[01:26:31.960 --> 01:26:35.960] Okay, go in there and whip their behinds.
[01:26:35.960 --> 01:26:43.960] Oh, as to a jury, in the lower courts, I'm almost at the point to where I don't want a jury.
[01:26:43.960 --> 01:26:47.960] I want the judge to make all the rulings.
[01:26:47.960 --> 01:26:53.960]  I can't hold a jury responsible for making bad rulings,
[01:26:53.960 --> 01:26:57.960]  but I can hold a judge responsible.
[01:26:57.960 --> 01:27:03.960] Ah, yeah, yeah, that's right. Yeah, that's your expertise, yeah.
[01:27:03.960 --> 01:27:06.960] Yeah, I want to stick it to the judge.
[01:27:06.960 --> 01:27:08.960] So you go ahead and make this bad ruling.
[01:27:08.960 --> 01:27:13.960] If the jury makes a bad ruling, I don't have any recourse.
[01:27:13.960 --> 01:27:18.960] And they always find me guilty anyway.
[01:27:18.960 --> 01:27:21.960]  It's only because I am.
[01:27:21.960 --> 01:27:23.960]  Okay, we're going to move ahead.
[01:27:23.960 --> 01:27:26.960] I've got two more callers and running out of time.
[01:27:26.960 --> 01:27:29.960] Keep us up to date, Dave.
[01:27:29.960 --> 01:27:32.960]  I will, I will. Thank you.
[01:27:32.960 --> 01:27:35.960] Okay, now we're going to go to Jimmy in Maryland.
[01:27:35.960 --> 01:27:40.960] Hello, Jimmy, what do you have for us today?
[01:27:40.960 --> 01:27:44.960]  Hey, Randy, I haven't talked to you for a year.
[01:27:44.960 --> 01:27:50.960] The guy that turned his license in that's fighting cases in Charles County, Maryland.
[01:27:50.960 --> 01:27:57.960] I have been successful in doing some things, cleared up in some old cases where it was,
[01:27:57.960 --> 01:28:02.960] the license was suspended for a fair period.
[01:28:02.960 --> 01:28:06.960] It turned out he was taken identity for California addresses
[01:28:06.960 --> 01:28:08.960] and had lived in California.
[01:28:08.960 --> 01:28:12.960] So then he could get like four cases dismissed.
[01:28:12.960 --> 01:28:23.960] And now I'm in the process of a judicial challenge and motion for a new trial.
[01:28:23.960 --> 01:28:28.960] And I want to ask you, like you said earlier,
[01:28:28.960 --> 01:28:32.960] you don't want to tell them everything, what you got in your filing.
[01:28:32.960 --> 01:28:33.960]  Right.
[01:28:33.960 --> 01:28:36.960] I want to get some better clarity on what, you know,
[01:28:36.960 --> 01:28:43.960] because of the evidence from the cases where I got myself dismissed because I had no way of knowing
[01:28:43.960 --> 01:28:46.960] that it was mistaken identity going on with the license that I turned in.
[01:28:46.960 --> 01:28:50.960] I didn't think that, you know, to look this stuff up until I was forced to.
[01:28:50.960 --> 01:29:00.960] So I'm trying to see what exactly do I put in my request for a judicial challenge and for a new trial.
[01:29:00.960 --> 01:29:05.960] Well, one thing to put in is lack of notice.
[01:29:05.960 --> 01:29:10.960] A motion to vacate judgment for lack of notice.
[01:29:10.960 --> 01:29:18.960] They secured a judgment without you having an opportunity to adjudicate your case.
[01:29:18.960 --> 01:29:20.960]  Okay.
[01:29:20.960 --> 01:29:22.960]  Okay, so that's one way I'll do it.
[01:29:22.960 --> 01:29:28.960] And that's something that will almost always get you a new trial.
[01:29:28.960 --> 01:29:30.960]  Okay, hang on.
[01:29:30.960 --> 01:29:31.960]  We're about to go to break.
[01:29:31.960 --> 01:29:35.960] This is Randy Kelton, Derber Stevens, Radio.
[01:29:35.960 --> 01:29:40.960] And it's a good time to go to Logos Radio Network and check out our gun giveaway.
[01:29:40.960 --> 01:29:44.960] We have our fundraiser going on.
[01:29:44.960 --> 01:29:48.960] And you can find my e-book on Logos Radio Network.
[01:29:48.960 --> 01:29:49.960]  We're selling that.
[01:29:49.960 --> 01:29:53.960] And you buy the e-book, you get four chances toward the gun giveaway.
[01:29:53.960 --> 01:29:56.960] We also have this traffic seminar.
[01:29:56.960 --> 01:30:02.960]  We'll be right back.
[01:30:02.960 --> 01:30:04.960]  Here's a get-rich-quick scheme for you.
[01:30:04.960 --> 01:30:08.960] What would you do if your ATM machine wouldn't stop spitting out cash?
[01:30:08.960 --> 01:30:16.960] I'm Dr. Catherine Albrecht, and I'll tell you what one guy did with $1.5 million from a generous ATM in a moment.
[01:30:16.960 --> 01:30:18.960]  Privacy is under attack.
[01:30:18.960 --> 01:30:21.960] When you give up data about yourself, you'll never get it back again.
[01:30:21.960 --> 01:30:26.960] And once your privacy is gone, you'll find your freedoms will start to vanish, too.
[01:30:26.960 --> 01:30:28.960]  So protect your rights.
[01:30:28.960 --> 01:30:32.960] Say no to surveillance and keep your information to yourself.
[01:30:32.960 --> 01:30:34.960]  Privacy, it's worth hanging on to.
[01:30:34.960 --> 01:30:41.960] This message is brought to you by StartPage.com, the private search engine alternative to Google, Yahoo, and Bing.
[01:30:41.960 --> 01:30:45.960]  Start over with StartPage.
[01:30:45.960 --> 01:30:48.960] Ronald Page must have thought he'd hit the lotto.
[01:30:48.960 --> 01:30:56.960] A Bank of America teller accidentally changed his account to allow unlimited cash withdrawals, even though he only had $300 in his account.
[01:30:56.960 --> 01:31:02.960] For six whole months, Page cashed in, withdrawing $1.5 million in all.
[01:31:02.960 --> 01:31:07.960] Did he pack the cash in a suitcase and make for Switzerland or invest it and change his name?
[01:31:07.960 --> 01:31:08.960]  Nope.
[01:31:08.960 --> 01:31:13.960] By the time the bank caught on, Page had gambled it all away at three Detroit casinos.
[01:31:13.960 --> 01:31:18.960] Today, he's serving a 15-month prison sentence and has to pay back every cent.
[01:31:18.960 --> 01:31:20.960] I guess he should have known when to fold.
[01:31:20.960 --> 01:31:30.960] I'm Dr. Catherine Albrecht for StartPage.com, the world's most private search engine.
[01:31:30.960 --> 01:31:35.960] This is Building 7, a 47-story skyscraper that fell on the afternoon of September 11.
[01:31:35.960 --> 01:31:37.960] The government says that fire brought it down.
[01:31:37.960 --> 01:31:42.960] However, 1,500 architects and engineers concluded it was a controlled demolition.
[01:31:42.960 --> 01:31:45.960] Over 6,000 of my fellow service members have given their lives.
[01:31:45.960 --> 01:31:48.960] And thousands of my fellow force responders are dying.
[01:31:48.960 --> 01:31:49.960]  I'm not a conspiracy theorist.
[01:31:49.960 --> 01:31:50.960]  I'm a structural engineer.
[01:31:50.960 --> 01:31:51.960]  I'm a New York City correction officer.
[01:31:51.960 --> 01:31:52.960]  I'm an Air Force pilot.
[01:31:52.960 --> 01:31:54.960]  I'm a father who lost his son.
[01:31:54.960 --> 01:31:57.960] We're Americans, and we deserve the truth.
[01:31:57.960 --> 01:32:00.960]  Go to RememberBuilding7.org today.
[01:32:00.960 --> 01:32:02.960] Hey, it's Danny here for Hill Country Home Improvements.
[01:32:02.960 --> 01:32:05.960] Did your home receive hail or wind damage from the recent storms?
[01:32:05.960 --> 01:32:10.960] Come on, we all know the government caused it with their chemtrails, but good luck getting them to pay for it.
[01:32:10.960 --> 01:32:13.960] Okay, I might be kidding about the chemtrails, but I'm serious about your roof.
[01:32:13.960 --> 01:32:15.960]  That's why you have insurance.
[01:32:15.960 --> 01:32:20.960] And Hill Country Home Improvements can handle the claim for you with little to no out-of-pocket expense.
[01:32:20.960 --> 01:32:26.960] And we accept Bitcoin as a multiyear A-plus member of the Better Business Bureau with zero complaints.
[01:32:26.960 --> 01:32:31.960] You can trust Hill Country Home Improvements to handle your claim and your roof right the first time.
[01:32:31.960 --> 01:32:37.960]  Just call 512-992-8745 or go to hillcountryhomeimprovements.com.
[01:32:37.960 --> 01:32:44.960] Mention the crypto show and get $100 off, and we'll donate another $100 to the Logos Radio Network to help continue this programming.
[01:32:44.960 --> 01:32:49.960] So if those out-of-town roofers come knocking, your door should be locking.
[01:32:49.960 --> 01:32:55.960]  That's 512-992-8745 or hillcountryhomeimprovements.com.
[01:32:55.960 --> 01:32:58.960] Discounts are based on full roof replacement.
[01:32:58.960 --> 01:33:01.960] May not actually be kidding about chemtrails.
[01:33:01.960 --> 01:33:04.960] You are listening to the Logos Radio Network.
[01:33:04.960 --> 01:33:07.960]  Logosradionetwork.com
[01:33:35.960 --> 01:33:38.960]  Okay.
[01:33:38.960 --> 01:33:39.960]  We are back.
[01:33:39.960 --> 01:33:45.960] Randy Kelton, Devin Stevens, Real Low Radio, and we're talking to Jimmy in Maryland.
[01:33:45.960 --> 01:33:47.960]  Okay.
[01:33:47.960 --> 01:33:56.960] Are all of these tickets you got tickets that were as a result of this identity theft?
[01:33:56.960 --> 01:33:59.960] No, not all of them.
[01:33:59.960 --> 01:34:00.960]  Oh, okay.
[01:34:00.960 --> 01:34:01.960]  Not all of them.
[01:34:01.960 --> 01:34:08.960] Well, what's going on is the driver improvement has supposedly suspended a license that did not exist,
[01:34:08.960 --> 01:34:15.960] and so I cannot get a license to bring to another county for this probation hearing.
[01:34:15.960 --> 01:34:23.960] So, you know, this other court has forced me to go back and look into this, you know, what they had on record,
[01:34:23.960 --> 01:34:29.960] and I'm finding all this stuff is not right, you know, how a license was suspended.
[01:34:29.960 --> 01:34:35.960] I've gotten some things clear, and now I have this one thing that's left from a case back in 2000,
[01:34:35.960 --> 01:34:38.960] where they supposed to send me a notice of suspended license.
[01:34:38.960 --> 01:34:44.960] I never received it, and I returned the license in, like, a couple years before all this stuff occurred.
[01:34:44.960 --> 01:34:51.960]  But I'm trying to...
[01:34:51.960 --> 01:34:54.960]  You're breaking up pretty bad.
[01:34:54.960 --> 01:34:56.960]  Okay.
[01:34:56.960 --> 01:34:57.960]  Is this better?
[01:34:57.960 --> 01:35:00.960]  I'm trying to...I'm on a wireless phone.
[01:35:00.960 --> 01:35:02.960]  Oh, that's probably why.
[01:35:02.960 --> 01:35:03.960]  Okay.
[01:35:03.960 --> 01:35:06.960] Try to get close to the transceiver then.
[01:35:06.960 --> 01:35:07.960]  Do you have a...
[01:35:07.960 --> 01:35:08.960]  Okay.
[01:35:08.960 --> 01:35:10.960] ...a direct line?
[01:35:10.960 --> 01:35:12.960]  Yes.
[01:35:12.960 --> 01:35:15.960] Try this, because we're nearly done here.
[01:35:15.960 --> 01:35:18.960]  I don't want to change calls.
[01:35:18.960 --> 01:35:27.960] Okay, so you have a case that they tried without giving you proper notice?
[01:35:27.960 --> 01:35:28.960]  Yes.
[01:35:28.960 --> 01:35:37.960] Generally, just send them a motion to vacate the judgment for lack of notice,
[01:35:37.960 --> 01:35:40.960] and that's generally pretty easy to get done.
[01:35:40.960 --> 01:35:43.960] And then if they refuse, then you can always appeal that,
[01:35:43.960 --> 01:35:52.960] and almost certainly the appeals court's going to say, you know, give the guy his opportunity to defend himself.
[01:35:52.960 --> 01:35:56.960]  That's the one thing they don't like.
[01:35:56.960 --> 01:36:01.960] You know, you can get no answer default, but 70% of them are thrown out,
[01:36:01.960 --> 01:36:10.960] because the courts do not like someone being ruled against without them having an opportunity to defend themselves.
[01:36:10.960 --> 01:36:18.960] Okay, so you're telling me the notice to vacate judgment, book of notice, just in that?
[01:36:18.960 --> 01:36:21.960]  Yeah, that's about all it takes.
[01:36:21.960 --> 01:36:26.960] And then state that you received no notice of this hearing.
[01:36:26.960 --> 01:36:32.960] You were involved in an identity theft issue,
[01:36:32.960 --> 01:36:40.960] and that could have caused you somehow to have these notices misdirected, but asked for a new trial.
[01:36:40.960 --> 01:36:43.960]  No, no, this is, I don't know if I'm being clear.
[01:36:43.960 --> 01:36:48.960] This is from a conviction back in 2000, where I went to court,
[01:36:48.960 --> 01:36:56.960] and I was tried and convicted, driving a license, not having a registration card.
[01:36:56.960 --> 01:36:58.960] But I was really cited for suspended license,
[01:36:58.960 --> 01:37:04.960] and I didn't realize that all this stuff was from a two-fed to a peer cases prior to that,
[01:37:04.960 --> 01:37:08.960] where the misguided identity stuff was.
[01:37:08.960 --> 01:37:14.960] Because I turned the license in, so I'm fighting, you know, that when you turn a license in, you know, it's null and void.
[01:37:14.960 --> 01:37:18.960] That was my argument, and the judge agreed and removed, you know,
[01:37:18.960 --> 01:37:25.960] and I'm not guilty for the suspended license, but I was still found guilty for some other accounts.
[01:37:25.960 --> 01:37:29.960] Okay, so I'm not sure what you're asking me, Dan.
[01:37:29.960 --> 01:37:40.960] Well, I was asking you about filing, I really was intentionally asking you about filing, what's it called?
[01:37:40.960 --> 01:37:43.960]  Seconda complaint?
[01:37:43.960 --> 01:37:48.960]  No, no, no, it's a jurisdictional challenge.
[01:37:48.960 --> 01:37:52.960]  Subject matter jurisdiction challenge.
[01:37:52.960 --> 01:37:53.960]  Okay.
[01:37:53.960 --> 01:38:01.960] Have you read the transportation code as it has been adopted in Maryland?
[01:38:01.960 --> 01:38:04.960]  Yes. Yes, I have.
[01:38:04.960 --> 01:38:12.960] Does the transportation code as it's adopted in Maryland only go to commercial operation?
[01:38:12.960 --> 01:38:14.960]  Yes, yes.
[01:38:14.960 --> 01:38:15.960]  Okay, then.
[01:38:15.960 --> 01:38:16.960]  Exactly.
[01:38:16.960 --> 01:38:19.960] You've got good subject matter of your jurisdiction challenge.
[01:38:19.960 --> 01:38:31.960] Okay, so it'll be a jurisdictional challenge on the subject matter jurisdiction and for a new trial.
[01:38:31.960 --> 01:38:36.960] No, it's subject matter jurisdiction challenge to throw out the conviction,
[01:38:36.960 --> 01:38:41.960] as the court never had jurisdiction from the beginning.
[01:38:41.960 --> 01:38:42.960]  Okay.
[01:38:42.960 --> 01:38:47.960] So not only can they not convict you, they can't retry you either.
[01:38:47.960 --> 01:38:50.960]  Okay, so I'll do that.
[01:38:50.960 --> 01:38:55.960] I'll file a subject matter jurisdiction challenge, basically what you're telling me.
[01:38:55.960 --> 01:39:02.960] Yeah, you'll file a challenge subject matter jurisdiction and move the court to vacate the judgment.
[01:39:02.960 --> 01:39:05.960]  Okay.
[01:39:05.960 --> 01:39:06.960]  Okay, I need to move on.
[01:39:06.960 --> 01:39:08.960] We've got one more caller and we are running out of time.
[01:39:08.960 --> 01:39:09.960]  Okay.
[01:39:09.960 --> 01:39:10.960]  Okay.
[01:39:10.960 --> 01:39:11.960]  Thank you.
[01:39:11.960 --> 01:39:12.960]  Thank you, Jimmy.
[01:39:12.960 --> 01:39:14.960] Okay, now we're going to Ted in California.
[01:39:14.960 --> 01:39:18.960] Hello, Ted, what do you have for us today?
[01:39:18.960 --> 01:39:19.960]  Hi, Randy.
[01:39:19.960 --> 01:39:22.960] This is my first call in and thank you very much.
[01:39:22.960 --> 01:39:28.960] Most of the NIG has been pertinent to my particulars.
[01:39:28.960 --> 01:39:37.960]  I'm charged with a felony of PC-115 here in California.
[01:39:37.960 --> 01:39:41.960] The background is this was my home of 30 years.
[01:39:41.960 --> 01:39:44.960]  What is 115?
[01:39:44.960 --> 01:39:55.960]  It's recording an instrument, I quit claim deed.
[01:39:55.960 --> 01:40:03.960] Okay, did you quit claim the property to someone else or did someone quit claim the property to you?
[01:40:03.960 --> 01:40:09.960] The allegation is that I quit claimed the deed to my trust.
[01:40:09.960 --> 01:40:14.960]  Okay, and that's illegal?
[01:40:14.960 --> 01:40:15.960]  That's the problem, Randy.
[01:40:15.960 --> 01:40:17.960] None of this is illegal.
[01:40:17.960 --> 01:40:19.960] It's been going on for two years.
[01:40:19.960 --> 01:40:21.960]  They caused me a heart attack.
[01:40:21.960 --> 01:40:26.960] They had an army of 25 people come out and take me out of the house.
[01:40:26.960 --> 01:40:32.960] This all started with an unlawful foreclosure of my home of 30 plus years.
[01:40:32.960 --> 01:40:33.960]  Okay, hold on.
[01:40:33.960 --> 01:40:39.960] When did you quit claim the property after the foreclosure?
[01:40:39.960 --> 01:40:41.960]  Well, that's where it gets tricky.
[01:40:41.960 --> 01:40:43.960] It was after the foreclosure.
[01:40:43.960 --> 01:40:48.960] However, the foreclosure had been rescinded.
[01:40:48.960 --> 01:40:51.960]  Oh, okay.
[01:40:51.960 --> 01:40:58.960] This is a little too complex to do quickly.
[01:40:58.960 --> 01:41:08.960] In order to, the first thing I would want to see is all of the documents that had been filed
[01:41:08.960 --> 01:41:17.960] with the county recorder's office from the date you received a warranty deed.
[01:41:17.960 --> 01:41:22.960] Now, if they can charge you with filing a fraudulent document in the record,
[01:41:22.960 --> 01:41:29.960] we will have a look at what the other side has filed in the record
[01:41:29.960 --> 01:41:36.960]  relative to California Property Code 1214.
[01:41:36.960 --> 01:41:42.960] They have filed five fraudulent substitution of trustees on my title.
[01:41:42.960 --> 01:41:43.960]  The bank did.
[01:41:43.960 --> 01:41:46.960] Okay, who was the original lender?
[01:41:46.960 --> 01:41:48.960]  SunTrust Mortgage.
[01:41:48.960 --> 01:41:52.960] Is SunTrust Mortgage still in business?
[01:41:52.960 --> 01:41:54.960]  Yes.
[01:41:54.960 --> 01:42:02.960] Did SunTrust Mortgage file an assignment of the mortgage to a different party?
[01:42:02.960 --> 01:42:05.960]  Merge.
[01:42:05.960 --> 01:42:06.960]  No, no.
[01:42:06.960 --> 01:42:11.960]  They can't assign it to Merge.
[01:42:11.960 --> 01:42:13.960] They would have had to have assigned it.
[01:42:13.960 --> 01:42:17.960] Did Merge do an assignment?
[01:42:17.960 --> 01:42:20.960]  Yes, there's multiple assignments.
[01:42:20.960 --> 01:42:23.960]  Okay, I'm being specific here.
[01:42:23.960 --> 01:42:30.960] The first assignment was the first assignment by Merge?
[01:42:30.960 --> 01:42:41.960] No, the first assignment was by the trustee that was also an employee of SunTrust.
[01:42:41.960 --> 01:42:50.960] Okay, that was by the trustee named in the deed of trust?
[01:42:50.960 --> 01:42:51.960]  Yes.
[01:42:51.960 --> 01:42:56.960] Okay, then he can do that.
[01:42:56.960 --> 01:42:58.960]  That doesn't avoid anything.
[01:42:58.960 --> 01:43:01.960] Okay, he assigned it to who?
[01:43:01.960 --> 01:43:03.960]  Merge.
[01:43:03.960 --> 01:43:05.960]  He can't assign it to Merge.
[01:43:05.960 --> 01:43:10.960] That is a problem, and the courts have already ruled it can't assign it to Merge.
[01:43:10.960 --> 01:43:11.960]  I understand.
[01:43:11.960 --> 01:43:23.960] I've had an audit, and they said that that's when once she assigned it to Merge at a later date.
[01:43:23.960 --> 01:43:25.960]  And there's also backdating.
[01:43:25.960 --> 01:43:34.960] Sometimes they did not record the documents for more than a year after the alleged notary in signing.
[01:43:34.960 --> 01:43:39.960] Okay, technically under law they can do that.
[01:43:39.960 --> 01:43:50.960] However, you can establish that, well, it doesn't matter if it's backdated or not.
[01:43:50.960 --> 01:43:59.960] It doesn't take effect until it's filed, and they can assign it.
[01:43:59.960 --> 01:44:02.960] Nutritious food is real body armor.
[01:44:02.960 --> 01:44:08.960] It builds muscle, burns fat, improves digestion, and feeds the entire body the nutrients it needs.
[01:44:08.960 --> 01:44:12.960] Did you know the U.S. government banned the hemp plant from growing in the United States
[01:44:12.960 --> 01:44:16.960] and classified it as a Schedule I drug to hide it behind the marijuana plant?
[01:44:16.960 --> 01:44:22.960] People have been confused about this plant for over 80 years, and many still don't know what hemp is.
[01:44:22.960 --> 01:44:26.960] So now you know hemp is not marijuana, and marijuana is not hemp.
[01:44:26.960 --> 01:44:29.960] They are different varieties of the same species.
[01:44:29.960 --> 01:44:32.960] HempUSA.org wants the world to know these basic facts
[01:44:32.960 --> 01:44:38.960] and to help people understand that hemp protein powder is the best kept health secret you need to know about.

[01:46:22.960 --> 01:46:26.960] Some things in this world I will never understand.
[01:46:26.960 --> 01:46:30.960]  Some things I realize fully.
[01:46:30.960 --> 01:46:35.960]  Somebody's gonna police that policeman.
[01:46:35.960 --> 01:46:39.960]  Somebody's gonna police the police.
[01:46:39.960 --> 01:46:44.960] There's always a room at the top of the hill.
[01:46:44.960 --> 01:46:48.960] I hear through the grapevine and it's lonely left too.
[01:46:48.960 --> 01:46:52.960] They're wishing it was more than I position the bill.
[01:46:52.960 --> 01:46:56.960] They know that if they don't do it, somebody will.
[01:46:56.960 --> 01:47:00.960] Some things in this world I will never understand.
[01:47:00.960 --> 01:47:04.960]  Some things I realize fully.
[01:47:04.960 --> 01:47:18.960]  Somebody's gonna police that policeman.
[01:47:35.960 --> 01:47:46.960] Fight this mortgage issue from the perspective of assignments and securities and MERS.
[01:47:46.960 --> 01:47:54.960] I have not found that effective, especially in California.
[01:47:54.960 --> 01:48:02.960] The only thing I found effective in California is a quiet title action based on the filings in the public record.
[01:48:02.960 --> 01:48:11.960] Challenging them under 1214, the California Property Code.
[01:48:11.960 --> 01:48:20.960] And that's the one that says effectively that any claim against real property must be filed in the record in order to be valid.
[01:48:20.960 --> 01:48:24.960] But that's not what your issue is.
[01:48:24.960 --> 01:48:37.960] They've charged you with a felony for filing a quit claim after foreclosure.
[01:48:37.960 --> 01:48:40.960] And you're saying there was a rescission of the foreclosure.
[01:48:40.960 --> 01:48:44.960] That seems like an affirmative defense.
[01:48:44.960 --> 01:48:53.960] I'm wondering how you ever got, did you get an indictment?
[01:48:53.960 --> 01:48:59.960]  No, it's all on information.
[01:48:59.960 --> 01:49:01.960]  This is California.
[01:49:01.960 --> 01:49:05.960] Randy, let me give you a little bit of a background here.
[01:49:05.960 --> 01:49:10.960] Fighting the foreclosure, fighting every step of the way, fighting the UD.
[01:49:10.960 --> 01:49:18.960] In the UD, this bad judge got mixed into it because he would do what needed to be done.
[01:49:18.960 --> 01:49:26.960] I had removed the case to federal court and this judge continued to make orders.
[01:49:26.960 --> 01:49:28.960]  And so I sued the judge.
[01:49:28.960 --> 01:49:29.960]  Hold on, hold on.
[01:49:29.960 --> 01:49:31.960]  You're using pronouns here.
[01:49:31.960 --> 01:49:35.960] This judge, you mean a state judge?
[01:49:35.960 --> 01:49:37.960] Yes, the state court judge.
[01:49:37.960 --> 01:49:39.960]  I sued him in federal court.
[01:49:39.960 --> 01:49:42.960]  Oh, good.
[01:49:42.960 --> 01:49:48.960] I then went to the FBI and told them, you really need to start watching this guy.
[01:49:48.960 --> 01:49:50.960]  I'm suing him in federal court.
[01:49:50.960 --> 01:49:52.960]  He's going to pull something.
[01:49:52.960 --> 01:49:58.960] And sure enough, two months later is when I was arrested.
[01:49:58.960 --> 01:50:01.960] I, at the arrest, asked for the warrant.
[01:50:01.960 --> 01:50:05.960] I asked three of the officers at the arrest for the warrant.
[01:50:05.960 --> 01:50:08.960] They all blew me off.
[01:50:08.960 --> 01:50:13.960] And there's other details of the things that they did to me, including five hours in a chair
[01:50:13.960 --> 01:50:16.960] under an air conditioning vent.
[01:50:16.960 --> 01:50:20.960] They tried to inject me with something.
[01:50:20.960 --> 01:50:23.960]  I mean, it's unbelievable.
[01:50:23.960 --> 01:50:28.960] Have you countersued or have you filed suit against them?
[01:50:28.960 --> 01:50:29.960]  I did.
[01:50:29.960 --> 01:50:32.960] Have you filed criminal charges against them?
[01:50:32.960 --> 01:50:33.960]  No.
[01:50:33.960 --> 01:50:37.960] And based on your call tonight, I'm going to be looking at that.
[01:50:37.960 --> 01:50:38.960]  Okay.
[01:50:38.960 --> 01:50:41.960]  This is the part I do.
[01:50:41.960 --> 01:50:48.960] When I talk to somebody, I don't really want to get to the merits of your case.
[01:50:48.960 --> 01:50:50.960]  That's not my place.
[01:50:50.960 --> 01:50:54.960] I want to look at due process.
[01:50:54.960 --> 01:50:59.960] Did my public officials follow my law?
[01:50:59.960 --> 01:51:02.960] Now, this is my law.
[01:51:02.960 --> 01:51:05.960]  Now, it's yours, too, but it's mine.
[01:51:05.960 --> 01:51:13.960] And these public officials are my servants, and I expect them to follow my law to the letter.
[01:51:13.960 --> 01:51:22.960] Now, I may not have to follow the law to the letter, but then again, I'm not receiving a check
[01:51:22.960 --> 01:51:27.960] based on my sworn oath that I would follow the law to the letter.
[01:51:27.960 --> 01:51:31.960]  My public officials are.
[01:51:31.960 --> 01:51:37.960] And in California, you have a very good grand jury system.
[01:51:37.960 --> 01:51:46.960] So what I'm going to suggest you look at is filing felony retaliation and conspiracy against the judge
[01:51:46.960 --> 01:51:51.960]  and the prosecuting attorney.
[01:51:51.960 --> 01:51:57.960] Accused them of retaliating against you because you sued the judge in the federal court.
[01:51:57.960 --> 01:52:03.960] And file that with a grand jury and see what they think about it.
[01:52:03.960 --> 01:52:06.960]  Now, here's what's going to happen.
[01:52:06.960 --> 01:52:15.960] When you try to get to a grand jury, the prosecuting attorney is going to do everything he can to block you.
[01:52:15.960 --> 01:52:23.960] So get out the California Code concerning grand jury and see what it says.
[01:52:23.960 --> 01:52:28.960] The duties of the grand jury very carefully.
[01:52:28.960 --> 01:52:30.960]  Here's what it says in Texas.
[01:52:30.960 --> 01:52:33.960] And I think I know what it says in California.
[01:52:33.960 --> 01:52:40.960] In Texas, it says the grand jury shall investigate into all crimes to indictment that come to their knowledge
[01:52:40.960 --> 01:52:48.960] by way of any member of the grand jury, the prosecuting attorney, or any other credible person.
[01:52:48.960 --> 01:52:57.960] In California, if I remember right, it says the grand jury shall investigate into all crimes subject to indictment
[01:52:57.960 --> 01:53:02.960] that come to their knowledge by whatever means.
[01:53:02.960 --> 01:53:14.960] What that means is you as the master of the service,
[01:53:14.960 --> 01:53:20.960]  you don't essentially have defined rights.
[01:53:20.960 --> 01:53:23.960]  That's a misconception a lot of people have.
[01:53:23.960 --> 01:53:28.960] They point to their Constitution as defining certain rights for them.
[01:53:28.960 --> 01:53:29.960] No, no, no, no, no.
[01:53:29.960 --> 01:53:33.960] That is not what the Constitution does.
[01:53:33.960 --> 01:53:43.960] What the Constitution says is there are certain rights that we specifically forbid you to interfere with.
[01:53:43.960 --> 01:53:47.960] The Constitution doesn't grant you those rights.
[01:53:47.960 --> 01:53:54.960] They forbid anybody to interfere with the rights you already have.
[01:53:54.960 --> 01:54:05.960] You as a member of the public and a citizen, you along with all the other members of the public and citizens
[01:54:05.960 --> 01:54:16.960] have gotten together and through your legislature have placed certain restrictions upon your behavior.
[01:54:16.960 --> 01:54:24.960] You've made it a crime to kill people, to steal from people, to a whole bunch of things that we have made it crimes to do.
[01:54:24.960 --> 01:54:28.960] We have limited our behavior.
[01:54:28.960 --> 01:54:40.960] For any behavior that is not specifically limited by some statute rule or regulation,
[01:54:40.960 --> 01:54:46.960] we can do anything we want to.
[01:54:46.960 --> 01:54:57.960] Everything is all right except for those behaviors that have been specifically forbidden.
[01:54:57.960 --> 01:55:10.960] Public officials on the other hand, they don't have any rights other than those that are specifically enumerated in the law.
[01:55:10.960 --> 01:55:25.960] A public official may only do what they are specifically authorized to do and they must do what they are required to do.
[01:55:25.960 --> 01:55:28.960]  Does that make sense?
[01:55:28.960 --> 01:55:29.960]  Yes.
[01:55:29.960 --> 01:55:37.960] It is critically important you understand that point, especially when you start going to the grand jury.
[01:55:37.960 --> 01:55:44.960] I've sent a set of complaints to the grand jury in Fort Lauderdale, Florida, federal grand jury.
[01:55:44.960 --> 01:55:52.960] The U.S. Attorney called me and told me that if I did that again, he would charge me with witness tampering.
[01:55:52.960 --> 01:55:56.960]  I told him, knock yourself out.
[01:55:56.960 --> 01:56:01.960] You charge me with witness tampering, I'll charge you with retaliation and obstruction.
[01:56:01.960 --> 01:56:04.960] We'll see how this works out for you.
[01:56:04.960 --> 01:56:09.960] Well, the next day they fired the IRS agent we were going after.
[01:56:09.960 --> 01:56:13.960] He's threatening to do something he has no power to do.
[01:56:13.960 --> 01:56:23.960] If he did that today, I would be down at the federal court the next day with a criminal complaint against him giving it to some judge.
[01:56:23.960 --> 01:56:36.960] And when the judge refused to take it, wonderful, just like Judge McBride, I'll file against him with the FBI and just make their lives miserable.
[01:56:36.960 --> 01:56:43.960] From what you've told me, this seems like a clear case of retaliation.
[01:56:43.960 --> 01:56:47.960] I like to do what you have done.
[01:56:47.960 --> 01:56:51.960] You've already got to the federal court.
[01:56:51.960 --> 01:57:09.960] Based suing this judge, now you need to go back to the federal court and charge the prosecuting attorney in the federal court with retaliating against you.
[01:57:09.960 --> 01:57:17.960] Because you filed a suit against the judge in the federal court.
[01:57:17.960 --> 01:57:22.960] What you've been charged with, I've never heard of before.
[01:57:22.960 --> 01:57:29.960]  I don't even know if it is a felony to file a quit claim.
[01:57:29.960 --> 01:57:39.960] The definition of a quit claim deed is that you are releasing any interest in the property you have.
[01:57:39.960 --> 01:57:42.960] If you have none, you're releasing none.
[01:57:42.960 --> 01:57:44.960]  Nothing, yeah.
[01:57:44.960 --> 01:57:50.960] So this is how the federal court is going to look at it too.
[01:57:50.960 --> 01:57:54.960] But you quit your claim.
[01:57:54.960 --> 01:57:59.960] You don't have one, you quit nothing.
[01:57:59.960 --> 01:58:02.960]  This is retaliation.
[01:58:02.960 --> 01:58:03.960]  Sorry, we're out of time.
[01:58:03.960 --> 01:58:04.960]  Call back tomorrow night.
[01:58:04.960 --> 01:58:06.960]  We have a four hour show.
[01:58:06.960 --> 01:58:08.960] I'd like to go through some of the specifics.
[01:58:08.960 --> 01:58:18.960] But in the meantime, if you can, send me an email with all the documents that are filed in the County Rec Recorder's Office.
[01:58:18.960 --> 01:58:23.960] And then tomorrow night we can really work this over.
[01:58:23.960 --> 01:58:24.960]  Thank you for calling.
[01:58:24.960 --> 01:58:26.960] We are out of time.
[01:58:26.960 --> 01:58:29.960] This is Randy Kelley and Deborah Stevens with Wheel of Law Radio.
[01:58:29.960 --> 01:58:34.960] We'll be back tomorrow night on our four hour info marathon.
[01:58:34.960 --> 01:58:49.960] Thank you all for listening and good night.
