[00:42.000 --> 00:49.000]  In recent news, five people were killed and eight wounded when an arriving airline passenger, 26-year-old Esteban Santiago,
[00:49.000 --> 00:53.000]  an Army National Guard veteran, pulled out a handgun from his checked luggage
[00:53.000 --> 00:58.000]  and began opening fire in the baggage claims area at the Fort Lauderdale Airport Friday today.
[00:58.000 --> 01:02.000]  According to a witness, the gunman apparently began firing without a word,
[01:02.000 --> 01:06.000]  going through about three magazines before running out of ammunition.
[01:06.000 --> 01:10.000]  He then threw the gun down and laid on the ground until the police apprehended him.
[01:10.000 --> 01:16.000]  He was arrested unharmed with no law enforcement officers firing any shots and is being questioned by the FBI.
[01:16.000 --> 01:22.000]  Apparently, the shooter's brother told the Associated Press that Esteban had been receiving psychological treatment.
[01:22.000 --> 01:29.000]  He is a veteran who was deployed to Iraq in 2010 and spent a year there with the 130th Engineering Battalion.
[01:29.000 --> 01:35.000]  He later received a general discharge from the Alaska Army National Guard last year for unsatisfactory performance.
[01:35.000 --> 01:42.000]  Our thoughts and prayers go out to the victims and family members.
[01:42.000 --> 01:47.000]  Texas lawmaker Representative Jonathan Stickland is sponsoring a bill during the next legislative session
[01:47.000 --> 01:52.000]  which seeks to remove the need for the handgun license process in the state.
[01:52.000 --> 01:56.000]  The Constitutional Carry Bill would give residents the right to carry a gun with or without a permit.
[01:56.000 --> 01:58.000]  When interviewed about it, Stickland said that,
[01:58.000 --> 02:02.000]  quote, we don't think that Texans should have to pay for their Second Amendment rights.
[02:02.000 --> 02:09.000]  This bill would get rid of the mandatory test and fee Texans are currently having to pay and restoring constitutional rights.
[02:09.000 --> 02:14.000]  If people were trying to pass a required test to make you pay a fee for your First Amendment rights,
[02:14.000 --> 02:21.000]  then people would be going insane about that. Why it's somehow become allowable with the Second Amendment, I have no idea.
[02:21.000 --> 02:25.000]  This bill does not expand who can carry or where they can carry.
[02:25.000 --> 02:29.000]  If you are a felon or anything like that, this is not an expansion of who can carry.
[02:29.000 --> 02:33.000]  You will still have to go through the background checks of purchasing the weapon.
[02:33.000 --> 02:37.000]  Unfortunately, Texas is not leading on this issue and constitutional carry passing
[02:37.000 --> 02:47.000]  means that there is a whole new group of people previously who have not been able to afford the fees to pay the price for the mandatory classes who will now be able to carry.
[02:47.000 --> 02:53.000]  If passed, Texas will become the 11th state with constitutional carry.

[21:18.000 --> 21:19.920]  When I heard you said you handed the book to your boss
[21:19.920 --> 21:21.360]  There was a big smile on my face
[21:21.360 --> 21:26.320]  Now, I am barred by the federal courts from giving advice to individuals
[21:26.320 --> 21:29.600]  So, Andrew, I can't specifically talk to your situation
[21:30.480 --> 21:34.480]  But freedom of speech does permit me to address these things in a generic manner
[21:34.480 --> 21:36.800]  Anybody who's out there running a business
[21:36.800 --> 21:43.440]  And one of the big problems is that a company will go along, say, for 20 or 30 years
[21:43.440 --> 21:46.480]  And they're filing tax returns and filing tax returns and filing tax returns
[21:46.480 --> 21:50.480]  They're giving out their taxpayer identification number across the board
[21:50.480 --> 21:53.600]  To everybody and anyone who asks, because they don't know better
[21:53.600 --> 22:00.560]  And then suddenly, somebody like Andrew becomes informed and says, wait, hang on
[22:00.560 --> 22:02.560]  This has all been wrong
[22:02.560 --> 22:05.760]  We didn't understand what the law really said
[22:05.760 --> 22:07.760]  Now we do
[22:07.760 --> 22:12.080]  So now, how do we unravel the situation?
[22:12.080 --> 22:14.960]  Well, the sad part about it is with your current
[22:14.960 --> 22:18.480]  Most companies these days, of course, the corporations, LLCs, things like that
[22:18.480 --> 22:24.480]  You can't actually take an enterprise that's been in the system for all that time
[22:24.480 --> 22:27.040]  Filing tax returns and just stop
[22:27.040 --> 22:33.760]  That is an absolutely sure way to bring the unjust actions of the IRS to your doorstep
[22:33.760 --> 22:39.120]  So what I typically tell people is to liquidate the firm that they've had
[22:39.120 --> 22:43.440]  That has been engaged in that sort of wrongful conduct, unknowingly wrongful
[22:43.440 --> 22:49.920]  And then create a new enterprise and then that enterprise from that day forward
[22:49.920 --> 22:51.920]  Always follows the law
[22:51.920 --> 22:53.920]  Now that doesn't mean you can't keep the same name
[22:53.920 --> 22:57.440]  Let's say your company is XYZ Manufacturing Company
[22:57.440 --> 23:03.440]  You can certainly open another corporation and have the corporation just take out a DBA, XYZ Manufacturing
[23:03.440 --> 23:11.440]  But that new corporation, absent being involved in any of the activities for which Congress has made
[23:11.440 --> 23:17.440]  A business libel or imposed a tax, other than that, should never give out a tax number
[23:17.440 --> 23:21.440]  And should never file tax returns
[23:21.440 --> 23:27.440]  Thank you. I also wanted to ask you, I know the answer to this question is obviously no
[23:27.440 --> 23:29.440]  But I really want to know why it's no
[23:29.440 --> 23:35.440]  Why is it useless in practice to file a lien against the IRS for all the money they've stolen from us?
[23:35.440 --> 23:43.440]  It's useless because the government does not acknowledge that they stole anything
[23:43.440 --> 23:49.440]  And they are not going to allow a lien to be used to, from their point of view, harm them
[23:49.440 --> 23:53.440]  And there's a really important thing that people need to understand
[23:53.440 --> 23:59.440]  And I tell people all the time, never seek a refund
[23:59.440 --> 24:09.440]  And the reason for that is, the way the courts have looked at this is that if you file a tax return and paid the money over
[24:09.440 --> 24:21.440]  Even by mistake, even though we could make a very strong case for the fact that the government has knowingly, willfully, and intentionally bamboozled 320 million Americans
[24:21.440 --> 24:25.440]  Even though we could make a very credible case for that, the way the courts have come down on this
[24:25.440 --> 24:32.440]  If you don't know the law, and you file a tax return, and you pay a tax, that's a closed chapter
[24:32.440 --> 24:40.440]  If you try and then go back and claim, hey, wait, Congress never imposed the tax on me or made me liable for it
[24:40.440 --> 24:45.440]  The courts say, sorry, you filed, you paid, closed chapter
[24:45.440 --> 24:48.440]  Now, is that moral and correct? Of course not
[24:48.440 --> 24:50.440]  But the government is not moral and correct
[24:50.440 --> 24:58.440]  And when people go back and try and get a refund or use a lien, I told clients for all the 15 years I assisted non-taxpayers
[24:58.440 --> 25:00.440]  I told them, never, ever do that
[25:00.440 --> 25:04.440]  You will regret it. The government punishes people who do that
[25:04.440 --> 25:11.440]  Now, just on the same note of what Andrew was talking about there, Dave, as far as the business side of it goes
[25:11.440 --> 25:19.440]  What is your recommendation when it comes to individuals in that situation that they've been gullibly paying this for all these years
[25:19.440 --> 25:24.440]  And then suddenly come to realize they never owed it? What's their recourse?
[25:24.440 --> 25:32.440]  Are you talking about an individual who is in business or just say somebody who just works for the company down the road?
[25:32.440 --> 25:42.440]  Someone who works down the road, someone who's filing taxes as just an individual who works for someone else, just a personal income tax
[25:42.440 --> 25:47.440]  I have to answer this a bit theoretically because people haven't read the book
[25:47.440 --> 25:58.440]  The 98% of the people listening to this show who have not read the book, I have to give an answer that may sound a little odd because they don't have the background to get it
[25:58.440 --> 26:09.440]  What they have to do is they have to talk to their employer and have that company stop filing tax forms on them
[26:09.440 --> 26:13.440]  I know some people are guffawing at that right now, they're like, oh really? Come on
[26:13.440 --> 26:20.440]  But what Andrew did by giving the book to his boss is a tremendous first step, especially if they're willing to read it
[26:20.440 --> 26:32.440]  When clients of mine have done this, they've given the book or given other forms of documentation that Express was in the book to the companies they work for
[26:32.440 --> 26:40.440]  And back when I provided services to non-tax payers, I would follow that up by having conference calls with my client and with whoever they were talking to
[26:40.440 --> 26:43.440]  Whether it be a company or a bank or something like that
[26:43.440 --> 27:03.440]  And I can tell you that in every single case over a 15 year period, bar none, the person on the other end of the phone didn't have any relevant responses to what the law actually says
[27:03.440 --> 27:09.440]  They do one of two things, either they say, I didn't know that, let me research this, I'll get back to you
[27:09.440 --> 27:18.440]  Or they say, I don't care what the law says, we're going to continue to do X even though that's not what the law says
[27:18.440 --> 27:25.440]  And one of the things we need to do in this country, and hopefully if the movie comes out and enough Americans understand this
[27:25.440 --> 27:31.440]  We need to actually get people like the ACLU, I know people have a love-hate relationship with them in some cases
[27:31.440 --> 27:42.440]  But we need to get somebody like the ACLU to bring a lawsuit against these companies for them breaking the law
[27:42.440 --> 27:50.440]  Yeah and I've considered actually going after a company I used to work for, I used to work for Pennzoil Quaker State
[27:50.440 --> 27:57.440]  I was their chief programming lead, I wrote all the software that runs every jiffy lube in the world
[27:57.440 --> 28:07.440]  And they were trying to withhold income taxes from my check when I went from being a consultant with them to a full-timer with them
[28:07.440 --> 28:12.440]  And when they refused to stop withholding, I said, then switch me back to a contractor status
[28:12.440 --> 28:16.440]  I don't care if the contract runs out but I'm not going to work for you if you're going to steal from my paycheck
[28:16.440 --> 28:25.440]  And I went round and round with their HR department over this, and finally they put me back into a contractor status and refunded all of my money
[28:25.440 --> 28:27.440]  Ah, beautiful
[28:27.440 --> 28:31.440]  But at that point it was kind of like, look dude, no no no no
[28:31.440 --> 28:36.440]  And the thing is, Pennzoil Quaker State is owned by a bunch of attorneys
[28:36.440 --> 28:39.440]  And they're the ones I was arguing with
[28:39.440 --> 28:44.440]  Oh, if we have the chance later, we have the time later in the show
[28:44.440 --> 28:49.440]  I'll tell you some stories about some conversation with some attorneys that will blow your audience's mind

[29:01.440 --> 29:06.440]  Well, there's basically a couple of options the way I see this from reading your book
[29:06.440 --> 29:12.440]  I would understand, like, you would object to the words that have, that are legal terms
[29:12.440 --> 29:20.440]  Like just how any subset objecting to certain words if I try to take it, there are certain words like person, employer and such that you would object to
[29:20.440 --> 29:26.440]  But there's also another strategy, I use the law that never was strategy
[29:26.440 --> 29:29.440]  There's the book that you briefly mentioned in your book called The Law That Never Was
[29:29.440 --> 29:32.440]  It talks about how the 16th Amendment was never legally ratified
[29:32.440 --> 29:39.440]  And the IRS always uses the 16th Amendment as justification for what they do even though it's not just an occasion
[29:39.440 --> 29:46.440]  So does it make more sense to use the objective attorney method or argue the 16th Amendment is not a valid method
[29:46.440 --> 29:50.440]  If you find yourself in a position in the courtroom where you've got to fight it
[29:50.440 --> 29:53.440]  Alright, well hang on and we'll address that answer on the other side

[34:10.440 --> 34:13.440]  A couple of things about the 16th Amendment
[34:13.440 --> 34:15.440]  I wouldn't use that in court for two reasons
[34:15.440 --> 34:19.440]  Number one, the federal courts have held that the determination
[34:19.440 --> 34:22.440]  As to whether something was properly ratified
[34:22.440 --> 34:28.080]  point in history is that the 16th Amendment was properly ratified. The mechanics of it
[34:28.080 --> 34:34.240]  notwithstanding, whether it actually was ratified is irrelevant to whether it is considered
[34:34.240 --> 34:40.320]  ratified. And in law, in this country at this time, it is considered ratified. So that argument
[34:40.320 --> 34:45.320]  is going to fail in court. Secondly, the 16th Amendment didn't do anything. So to raise
[34:45.320 --> 34:50.080]  the issue of the 16th Amendment doesn't alter what the government is claiming. Now, when
[34:50.080 --> 34:55.240]  you spoke about would you make the argument about the various terms clarifying their meaning,
[34:55.240 --> 34:59.600]  I would. But only within the context, there was only one way to respond to the government
[34:59.600 --> 35:08.000]  when they come at you and say that you owe taxes. It is to put them on notice that they
[35:08.000 --> 35:14.600]  have not and are unable to show that you are within a class of person that Congress has
[35:14.600 --> 35:20.960]  imposed a tax upon or otherwise made liable. So when you get into terms such as taxpayer
[35:20.960 --> 35:30.300]  and gross income and U.S. person, you're not arguing those points to win a debate on definitions.
[35:30.300 --> 35:35.440]  You would only argue those points, which are, I don't want to say trivial because they're
[35:35.440 --> 35:41.400]  not, but they're not really the important part. The important part is they are stepping
[35:41.400 --> 35:46.640]  stones to get to the conclusion, which is to get it to the point where the government
[35:46.640 --> 35:52.280]  is pulling their hair out and has to surrender that, yes, when the proper definitions are
[35:52.280 --> 35:58.600]  applied and the proper regulations and statutes are brought forth, they cannot show that you
[35:58.600 --> 36:03.020]  are within a class of person made liable or the taxes imposed upon.
[36:03.020 --> 36:07.080]  It's going to kind of work like what I tell you with the transportation versus not in
[36:07.080 --> 36:15.560]  transportation. In this case, it's taxable and we're going not taxable. You get it?
[36:15.560 --> 36:16.560]  Yeah.

[37:53.120 --> 38:04.040]  number attached to it. We were posed as collateral back in 1934 after FDR. We declared bankruptcy,
[38:04.040 --> 38:09.040]  and the national debt was then collateralized on all the people, and after the 14th Amendment
[38:09.040 --> 38:14.640]  explained what a citizen was, a citizen being a member of the United States of America as
[38:14.640 --> 38:22.040]  a corporation, following under that corporate law uniform commercial code.
[38:22.040 --> 38:28.840]  Now, I will not try to see if you guys understand that at all. I know that the contract law
[38:28.840 --> 38:32.800]  and the contract world is a big, big world out there, and I don't want to make any mistakes,
[38:32.800 --> 38:40.600]  so my question to you would be is, how do I claim my interest on my straw man, my two-dimensional
[38:40.600 --> 38:42.800]  addiction that they use in the courts?

[40:37.560 --> 40:46.600]  the story that when a car ships from the manufacturer, the certificate of origin goes with the car,
[40:46.600 --> 40:53.080]  it arrives at the dealer, the dealer surrenders the certificate of origin over to the DMV,
[40:53.080 --> 40:59.720]  and the DMV inputs it into their computer and then shreds them. Thus, the DMV actually
[40:59.720 --> 41:05.160]  owns your car, and the whole thing is a scam, and you never really own your car.
[41:05.160 --> 41:07.960]  Eddie, I'm sure you've heard this on your show.
[41:07.960 --> 41:10.880]  Yeah, actually, I talked about it just the other day.
[41:10.880 --> 41:15.840]  So time goes on. I hear this. I'm not pursuing it. It wasn't anything that I was particularly
[41:15.840 --> 41:20.840]  interested in, but then I ended up having a relationship, a friendship with a person
[41:20.840 --> 41:28.600]  who was a manager, an F&I manager at a very large car dealership in Southern California.
[41:28.600 --> 41:33.920]  So I started asking these questions, and she said, oh, so they're sent to the DMV where
[41:33.920 --> 41:36.400]  they're input into the computer, and then they're shredded, blah, blah, blah. I said,
[41:36.400 --> 41:39.480]  that's the story. She said, OK, come with me.
[41:39.480 --> 41:45.000]  And we walked back to this gigantic store room in the dealership, and there's all these
[41:45.000 --> 41:51.440]  Manila folders, I mean, tens of thousands of them. And she pulls one of them out, and
[41:51.440 --> 41:56.020]  she says, here's the manufacturer's certificate of origin. It pulls out another one, and here
[41:56.020 --> 42:01.120]  it is, and another one, here it is, and another one. And she says, the story that you're telling
[42:01.120 --> 42:06.280]  me that you've heard, this is absurd. The manufacturer's certificate of origin only
[42:06.280 --> 42:11.960]  validates that we, the dealership, have a legal right to possess the piece of hardware
[42:11.960 --> 42:17.080]  that is shipped to us from, we'll just use Michigan as the old-style example. And we have
[42:17.080 --> 42:21.880]  a legal right to have it on our lot and to sell it because Chevrolet or Ford or whoever
[42:21.880 --> 42:25.880]  has given us that authority via the manufacturer's certificate of origin.
[42:25.880 --> 42:30.760]  She said, it doesn't go to the DMV, and they don't shred it, and we keep it for years and
[42:30.760 --> 42:36.200]  years and years and years and years in case down the road a DMV investigator challenges
[42:36.200 --> 42:41.400]  our right to possess the vehicle and sold it. So I share this story to say a lot of
[42:41.400 --> 42:49.720]  these Patriot movement ideas, once you actually look at what's really happening, and we'll
[42:49.720 --> 42:54.640]  go with Emmett's point about commerce, it's what's happening really in commerce is not
[42:54.640 --> 43:02.000]  at all what the Patriot community has fooled themselves into believing.
[43:02.000 --> 43:06.560]  This goes into what I was saying the other day and what the certificate of title to the
[43:06.560 --> 43:11.880]  car actually is when it's issued by the Department of Public Safety. The certificate of title
[43:11.880 --> 43:18.480]  is itself a negotiable instrument. It's listed in the Texas Business and Commerce Code as
[43:18.480 --> 43:24.760]  a negotiable instrument. The purpose of that instrument is to be able to transfer ownership
[43:24.760 --> 43:30.680]  or at least legal ownership of that automobile as property from one person to another. You
[43:30.680 --> 43:34.280]  do that simply by endorsing the back of the certificate of title.

[46:28.800 --> 46:32.800]  in Pennsylvania and right now we are talking about the certificate of titles and stuff
[46:32.800 --> 46:36.800]  for cars. We've got out the birth certificate. We'll get back to that in a minute.
[46:36.800 --> 46:42.800]  Now, here in Texas, they make duplicates of all that paperwork including the MSO and they
[46:42.800 --> 46:48.800]  send it in to the DMV once the car is actually sold. The difference there in Texas is what
[46:48.800 --> 46:54.800]  the legal definition of a first sale is as to what that paperwork is supposed to do.
[46:54.800 --> 47:00.800]  The dealership actually gets a power of attorney signed by you in one of the paper forms that
[47:00.800 --> 47:05.800]  they have and are required to submit to the state. The MSO originally is maintained by
[47:05.800 --> 47:10.800]  them for the inventory tax purposes as well as the reason Dave is talking about.
[47:10.800 --> 47:15.800]  Here in Texas, they have to have that to show when they're getting charged the inventory
[47:15.800 --> 47:21.800]  tax for actually having the car on the lot and in the possession of the dealership.
[47:21.800 --> 47:26.800]  The inventory tax only carries through until the time that car is transferred out of the
[47:26.800 --> 47:32.800]  possession and ownership of the dealership to an actual buyer. The difference is whether
[47:32.800 --> 47:38.800]  or not the buyer is actually someone that is causing the car to go through a first sale.
[47:38.800 --> 47:43.800]  Now, that paperwork is sent to the DMV and all gets microfished and in order to avoid
[47:43.800 --> 47:49.800]  having to store files, they do shred and burn all that paperwork after it's been microfished.
[47:49.800 --> 47:54.800]  I've had the DPS and the DMV both tell me that. That part does happen.
[47:54.800 --> 48:00.800]  But from that point on, everything about the car, they attempt to do with that negotiable
[48:00.800 --> 48:05.800]  instrument in the form of the certificate of title. And every time that car changes
[48:05.800 --> 48:09.800]  hands, it's endorsed on that certificate of title.
[48:09.800 --> 48:15.800]  The certificate of title, according to the Business and Commerce Code, is a representation
[48:15.800 --> 48:20.800]  of an outstanding possessory lien against the property.
[48:20.800 --> 48:26.800]  It gives you legal ownership, but not equity ownership. Legal ownership being the right
[48:26.800 --> 48:34.800]  of possession and use, but not to disposition. You cannot destroy, transfer, sell, or
[48:34.800 --> 48:40.800]  otherwise dispose of the property outside of that who is the actual equity owner, which
[48:40.800 --> 48:45.800]  in this case would be the leasing company or the dealership if they're leasing it to you,
[48:45.800 --> 48:49.800]  or the bank if you've got a loan on the car.
[48:49.800 --> 48:54.800]  So even though some of those things exist, let's get back to the idea of the birth certificate
[48:54.800 --> 48:58.800]  basically working the same way. Here's what I'm going to tell you.
[48:58.800 --> 49:04.800]  You are assuming that you've got the information that shows that it's being traded on some
[49:04.800 --> 49:07.800]  bundled stock, right?
[49:07.800 --> 49:08.800]  Right.
[49:08.800 --> 49:13.800]  Well, what is your definitive proof that the number you put in links back to that birth
[49:13.800 --> 49:20.800]  certificate and not to some other form in somebody else's possession?
[49:20.800 --> 49:25.800]  Well, I guess I should elaborate a little bit. It's not in anybody's possession. It's
[49:25.800 --> 49:26.800]  unclaimed property.
[49:26.800 --> 49:31.800]  Wait a minute. Where does it tell you it's unclaimed property?
[49:31.800 --> 49:36.800]  Well, if you guys understand Uniform Commercial Code, if you...
[49:36.800 --> 49:40.800]  You're not answering my question. I know what's in the commercial code as far as all this
[49:40.800 --> 49:45.800]  goes. What I'm asking you is where did you get the factual evidence to support that it
[49:45.800 --> 49:51.800]  is unclaimed property?
[49:51.800 --> 49:54.800]  Just reading articles and research and other things.
[49:54.800 --> 49:59.800]  No, no, no. What you've been reading is patronet articles. You haven't been reading legitimate
[49:59.800 --> 50:04.800]  law and legitimate business transaction methodologies.
[50:04.800 --> 50:14.800]  The Uniform Commercial Code is not law. It's a model code. Certain states have enacted
[50:14.800 --> 50:20.800]  certain parts of it, but the Uniform Commercial Code is a model code. It is not law.
[50:20.800 --> 50:24.800]  If you go to the state legislature, to the law library in the 50 states of the union,
[50:24.800 --> 50:29.800]  you're not going to find that they have enacted the Uniform Commercial Code. It's not law.
[50:29.800 --> 50:35.800]  Yeah, you're going to find that they've enacted a small penumbra of parts of the code into
[50:35.800 --> 50:41.800]  some things within state law for contract purposes and for money transfer purposes and
[50:41.800 --> 50:43.800]  money tracking purposes.
[50:43.800 --> 50:51.800]  But no one has basically staturized the entire, or what's the proper term for that, Dave?
[50:51.800 --> 50:57.800]  Statutorily codified the entire UCC. No state's done that.
[50:57.800 --> 51:01.800]  Let me tell you an interesting story. I had a gal this goes back quite a few years ago.
[51:01.800 --> 51:06.800]  She wrote me and she was very mad at me. This is when I was doing radio. And she was very
[51:06.800 --> 51:09.800]  mad at me and she said, you know, you said the commercial code, it can't be used for
[51:09.800 --> 51:14.800]  this and that. Well, let me tell you something, Mr. Champion. I've used it for this and this
[51:14.800 --> 51:17.800]  and this. And then she probably had a list of about 12 or 13 things that she had accomplished,
[51:17.800 --> 51:21.800]  which if true would be pretty damn impressive.
[51:21.800 --> 51:26.800]  So I said to her, look, you know, I have a very successful radio show with, you know,
[51:26.800 --> 51:33.800]  God knows how many people are listening. And I said, if you'll show me, if you email me the
[51:33.800 --> 51:38.800]  documentary evidence that you achieved these victories using the commercial code, I will do
[51:38.800 --> 51:43.800]  everything in my power to make you the most famous person in America because you have the
[51:43.800 --> 51:48.800]  answers to the things that people have been wanting, been trying to find out the answers to
[51:48.800 --> 51:52.800]  for, you know, 30, 40 years. So if you've really accomplished this, let me make you famous.
[51:52.800 --> 51:59.800]  Let me make you a millionaire. Send me the documentary evidence. I never heard back from her.
[51:59.800 --> 52:04.800]  And that's kind of the problem I have with this situation every time I ask for that. It's not
[52:04.800 --> 52:09.800]  that I want to disbelieve everything that people tell me about this. It's a simple fact that I
[52:09.800 --> 52:14.800]  know for a fact you can't prove any of it up. True or not, you can't prove it up because nobody
[52:14.800 --> 52:20.800]  ever gets evidence. They take theory upon theory upon theory and make inferences from theories
[52:20.800 --> 52:28.800]  instead of facts. There is this little problem in law. You can only make one level of inference
[52:28.800 --> 52:37.800]  from a verified, demonstrable fact. And no more. You can't propagate inferences upon
[52:37.800 --> 52:44.800]  inference. So once you find the groundwork evidence, you're allowed to make one level of
[52:44.800 --> 52:51.800]  inference from that. And it must be something logically attached to the evidence. If you don't
[52:51.800 --> 52:59.800]  do that, you're operating in the ether with nothing to stand on. You follow what I'm saying?
[52:59.800 --> 53:04.800]  Absolutely. Absolutely. Young guys like me look up to you guys out there really fighting hard
[53:04.800 --> 53:05.800]  for the system.
[53:05.800 --> 53:09.800]  Yeah. And don't get us wrong. It's not that we don't appreciate the effort you're making
[53:09.800 --> 53:15.800]  or anything else. But I guarantee you if you do something in that area wrong, the repercussions
[53:15.800 --> 53:23.800]  are horrible to experience. Yeah. Absolutely. Absolutely. Thank you guys for your time. I'm

[54:02.800 --> 54:10.800]  My son has been trying to follow the program for probably five or six years. I'm fairly new to
[54:10.800 --> 54:16.800]  this. I read Dave Champion's book a year ago and I keep it and I just said I had to reread
[54:16.800 --> 54:23.800]  it. But my husband and I obviously have paid taxes for our whole entire lives and we're
[54:23.800 --> 54:28.800]  getting, he's, my husband's in his seventies and we're getting ready to retire. And our
[54:28.800 --> 54:37.800]  son brought up the fact that in order for us to transfer assets to him, we need to have
[54:37.800 --> 54:46.800]  a contractual trust. And I said, well, how do I do that? And he said, well, don't ask
[54:46.800 --> 54:53.800]  an attorney because I'll tell you there isn't such a thing. And so I tried to look up
[54:53.800 --> 55:01.800]  contractual trust and the information all seems to do with business law.
[55:01.800 --> 55:07.800]  Okay. Let me, may I jump in here because this is an area I used to work in extensively when
[55:07.800 --> 55:13.800]  I had my practice working with non-tax payers. First of all, let me say that I used to tell
[55:13.800 --> 55:17.800]  people when they would call my office and they were say in their seventies and they
[55:17.800 --> 55:23.800]  wanted to embark in the life of being a non-tax payer, I would tell them don't. You've
[55:23.800 --> 55:28.800]  worked long, you've worked hard and you don't want to take a misstep at seventy that's going
[55:28.800 --> 55:32.800]  to set you back because you don't have the time to recover. So first of all, let me say
[55:32.800 --> 55:38.800]  that I don't advocate people in their seventies jumping into this. It's something I encourage
[55:38.800 --> 55:44.800]  them to let younger people do. And hopefully the movie that Eddie and I talked about earlier
[55:44.800 --> 55:49.800]  will help more Americans become knowledgeable and brave and do the right thing.
[55:49.800 --> 55:54.800]  Now, as far as the contractual trust, this also oftentimes referred to as a common law
[55:54.800 --> 56:02.800]  trust because it relies on the common law right of contract. There are very, very few
[56:02.800 --> 56:10.800]  people who use it anymore because the government back in the early nineties did a full court
[56:10.800 --> 56:17.800]  press on these trusts trying everything they could to invalidate them including, and this
[56:17.800 --> 56:22.800]  is really important when it comes to transferring assets, including telling the legal
[56:22.800 --> 56:30.800]  departments of large banks and lawyer associations who deal with inheritance issues and transfer
[56:30.800 --> 56:36.800]  of property between generations that these were bogus trusts and that they should stay
[56:36.800 --> 56:41.800]  away from them with everything they've got. There's no evidence behind it. I mean, I've
[56:41.800 --> 56:46.800]  actually had this debate with an attorney from a bank. They cannot substantiate that
[56:46.800 --> 56:55.800]  they are bogus and I can substantiate that they are legally valid. However, once something
[56:55.800 --> 56:59.800]  somebody like the treasury department says, don't do this, this is bogus, it's going to
[56:59.800 --> 57:03.800]  get you in trouble, most especially with us, the treasury department and the department
[57:03.800 --> 57:08.800]  of justice. Suddenly they don't want to hear anything. Now, I might just say one thing.
[57:08.800 --> 57:15.800]  I don't know what the amount of your assets are, but there are statutory vehicles such
[57:15.800 --> 57:21.800]  as living wills that if the assets you're going to pass on are less than X, whatever
[57:21.800 --> 57:30.800]  X is in your state, you can pass that along really without any tax implication at all.
[57:30.800 --> 57:35.800]  Yeah, and if you're talking about things like property or things like that, what you could
[57:35.800 --> 57:41.800]  actually do prior to any of that is that instead of having to worry about something like an
[57:41.800 --> 57:47.800]  inheritance tax or all that, your son could actually buy the property that you're wanting
[57:47.800 --> 57:53.800]  to transfer to him anyway. He just buys it from you. That's one of the ways of getting
[57:53.800 --> 57:59.800]  around things like an inheritance tax and things like that before it becomes an issue.
[57:59.800 --> 58:06.800]  But if he was to buy property, then there would be a property tax involved.
[58:06.800 --> 58:10.800]  Well, the property tax is a different issue. There would be a tax involved if a trust had
[58:10.800 --> 58:16.800]  it too. They would attempt to levy a tax on it all the same. But all right, we got to
[58:16.800 --> 58:19.800]  go to a break here, Mary. Can you hang on to the other side?

[01:00:51.800 --> 01:00:56.800]  his checked luggage and began opening fire in the baggage claims area at the Fort Lauderdale
[01:00:56.800 --> 01:01:01.800]  Airport Friday today. According to a witness, the command apparently began firing without a word,
[01:01:01.800 --> 01:01:05.800]  going through about three magazines before running out of ammunition.
[01:01:05.800 --> 01:01:09.800]  He then threw the gun down and laid on the ground until the police apprehended him.
[01:01:09.800 --> 01:01:14.800]  He was arrested unharmed with no law enforcement officers firing any shots and is being questioned
[01:01:14.800 --> 01:01:19.800]  by the FBI. Apparently, the shooter's brother told the Associated Press that Esteban had
[01:01:19.800 --> 01:01:24.800]  been receiving psychological treatment. He is a veteran who was deployed to Iraq in 2010
[01:01:24.800 --> 01:01:29.800]  and spent a year there with the 130th Engineering Battalion. He later received a general discharge
[01:01:29.800 --> 01:01:34.800]  from the Alaska Army National Guard last year for unsatisfactory performance.
[01:01:34.800 --> 01:01:41.800]  Our thoughts and prayers go out to the victims and family members.
[01:01:41.800 --> 01:01:46.800]  Texas lawmaker Representative Jonathan Sticklin is sponsoring a bill during the next legislative session
[01:01:46.800 --> 01:01:50.800]  which seeks to remove the need for the handgun license process in the state.
[01:01:50.800 --> 01:01:55.800]  The constitutional carry bill would give residents the right to carry a gun with or without a permit.
[01:01:55.800 --> 01:02:00.800]  When interviewed about it, Sticklin said that, quote, we don't think that Texans should have to pay
[01:02:00.800 --> 01:02:04.800]  for their Second Amendment rights. This bill would get rid of the mandatory test and fee
[01:02:04.800 --> 01:02:08.800]  Texans are currently having to pay and restoring constitutional rights.
[01:02:08.800 --> 01:02:13.800]  If people were trying to pass a required test to make you pay a fee for your First Amendment rights,
[01:02:13.800 --> 01:02:18.800]  then people would be going insane about that. Why it's somehow become allowable with the Second Amendment,
[01:02:18.800 --> 01:02:24.800]  I have no idea. This bill does not expand who can carry or where they can carry.
[01:02:24.800 --> 01:02:28.800]  If you are a felon or anything like that, this is not an expansion of who can carry.
[01:02:28.800 --> 01:02:32.800]  You will still have to go through the background checks of purchasing the weapon.
[01:02:32.800 --> 01:02:36.800]  Unfortunately, Texas is not leading on this issue and constitutional carry passing
[01:02:36.800 --> 01:02:42.800]  means that there is a whole new group of people previously who have not been able to afford the fees
[01:02:42.800 --> 01:02:46.800]  to pay the price for the mandatory classes who will now be able to carry.
[01:02:46.800 --> 01:02:52.800]  If passed, Texas would become the 11th state with constitutional carry.

[01:06:30.800 --> 01:06:36.800]  so that if the government comes after him, they don't even have to pay the fee.
[01:06:36.800 --> 01:06:39.800]  Yeah, actually the statute's very clear on that.
[01:06:39.800 --> 01:06:43.800]  They're required to request the number, not get it.
[01:06:43.800 --> 01:06:44.800]  Right.
[01:06:44.800 --> 01:06:49.800]  That's all the law requires of them, and all they have to do is put notice in on written form
[01:06:49.800 --> 01:06:53.800]  that they requested the number, but the person never provided it.
[01:06:53.800 --> 01:06:56.800]  And they're covered, and the statute's very clear on that.
[01:06:56.800 --> 01:06:59.800]  They just choose not to read it.
[01:06:59.800 --> 01:07:01.800]  Oh, okay.
[01:07:01.800 --> 01:07:08.800]  And then the other thing he's thrown into is if they've done that, then they try and 1099 him.
[01:07:08.800 --> 01:07:12.800]  Again, nothing authorizes that either.
[01:07:12.800 --> 01:07:14.800]  Okay.
[01:07:14.800 --> 01:07:17.800]  Dave, you were going to say something about the 1099?
[01:07:17.800 --> 01:07:20.800]  Well, my first thought was, how are they going to do that without a social...
[01:07:20.800 --> 01:07:21.800]  Exactly.
[01:07:21.800 --> 01:07:25.800]  Every one of those forms requires the use of a social security number or a TIN.
[01:07:25.800 --> 01:07:26.800]  Every one of them.
[01:07:26.800 --> 01:07:28.800]  And let me say something else.
[01:07:28.800 --> 01:07:39.800]  The only justification that an employer has to withhold from a worker is if the worker executes a Form W-4.
[01:07:39.800 --> 01:07:48.800]  The Form W-4 would not be the right form for the average American state citizen working in his own state
[01:07:48.800 --> 01:07:51.800]  in an occupation of common right, blah, blah, blah.
[01:07:51.800 --> 01:07:55.800]  That form has zero applicability.
[01:07:55.800 --> 01:08:02.800]  Even though it's requested millions of times a year, maybe tens of millions of times a year from American citizens,
[01:08:02.800 --> 01:08:04.800]  it is absolutely not applicable to them.
[01:08:04.800 --> 01:08:10.800]  Now, for the 1099, in order to receive one of those, you have to have filled out a Form W-9.
[01:08:10.800 --> 01:08:16.800]  And the W-4 and the W-9 serve the same purpose from the government's point of view.
[01:08:16.800 --> 01:08:24.800]  It is the citizen falsely declaring themselves to be within a class of person that they are not.
[01:08:24.800 --> 01:08:28.800]  In other words, you're falsifying a government document, and that's a felony.
[01:08:28.800 --> 01:08:29.800]  Yes.
[01:08:29.800 --> 01:08:32.800]  So for instance, let's take the W-9, for example.
[01:08:32.800 --> 01:08:36.800]  The W-9 is what you would fill out as a quote, independent contractor.
[01:08:36.800 --> 01:08:40.800]  And it says right there in the instructions, I think at the beginning of the second paragraph,
[01:08:40.800 --> 01:08:43.800]  this form is to be used exclusively by a U.S. person.
[01:08:43.800 --> 01:08:49.800]  And of course, Americans sort of having that common sense sort of thing and good heartedness say,
[01:08:49.800 --> 01:08:52.800]  oh, I must be a U.S. person.
[01:08:52.800 --> 01:08:53.800]  Well, that's not true at all.
[01:08:53.800 --> 01:09:00.800]  When you read through the law, what a U.S. person is, is a U.S. resident or a U.S. company
[01:09:00.800 --> 01:09:07.800]  that has care, custody, or control of U.S. source income that belongs to a foreign person.
[01:09:07.800 --> 01:09:12.800]  But they see it, you know, this is exclusively for a U.S. person.
[01:09:12.800 --> 01:09:15.800]  Well, hell, I was born in Arkansas, dang netta.
[01:09:15.800 --> 01:09:18.800]  That makes me a U.S. person.
[01:09:18.800 --> 01:09:20.800]  And then you say to them, dude, you're not a U.S. person.
[01:09:20.800 --> 01:09:23.800]  Don't you tell me I'm not a U.S. person.
[01:09:23.800 --> 01:09:31.800]  They want to be a U.S. person, and they do not understand that it has nothing to do with that.
[01:09:31.800 --> 01:09:34.800]  Yeah, treachery by linguistics.
[01:09:34.800 --> 01:09:35.800]  There you go.
[01:09:35.800 --> 01:09:43.800]  It's what we call legal semantics, similarity of terms and phrases without the same meaning.
[01:09:43.800 --> 01:09:52.800]  Well, what he finds is that the employer is so terrified of the IRS that they just.
[01:09:52.800 --> 01:09:54.800]  That too is by design.
[01:09:54.800 --> 01:09:56.800]  Yes.
[01:09:56.800 --> 01:10:06.800]  Let's see, who was it who made that quote, if the Americans knew that most of the IRS is bluff,
[01:10:06.800 --> 01:10:08.800]  they wouldn't comply at all?
[01:10:08.800 --> 01:10:10.800]  It was a former IRS commissioner like 50 years ago.
[01:10:10.800 --> 01:10:11.800]  Yeah.
[01:10:11.800 --> 01:10:12.800]  Yeah.
[01:10:12.800 --> 01:10:19.800]  And the IRS commissioner himself said that 99% of what the IRS does is complete and total bluff.
[01:10:19.800 --> 01:10:22.800]  And that's how they get away with what they do.
[01:10:22.800 --> 01:10:32.800]  They convince you that they can, even though legally speaking, they cannot.
[01:10:32.800 --> 01:10:37.800]  And let me talk for a moment about the tension with the company that somebody works for,
[01:10:37.800 --> 01:10:41.800]  whether they work as an independent contractor, which is a term I hate to use,
[01:10:41.800 --> 01:10:44.800]  but I will for the sake because everybody understands it,
[01:10:44.800 --> 01:10:49.800]  or whether they work as somebody who's a full-time employee of the company.
[01:10:49.800 --> 01:10:58.800]  Yes, there is tension at this time in history between the informed citizen who knows the truth,
[01:10:58.800 --> 01:11:04.800]  for instance, somebody who's right income tax shattering the mess, that person and the company.
[01:11:04.800 --> 01:11:10.800]  Now, what makes it so frustrating is the company believes they know what they're talking about.
[01:11:10.800 --> 01:11:13.800]  The company's accountant believes they know what he or she is talking about.
[01:11:13.800 --> 01:11:16.800]  The company's attorney believes he or she knows what they're talking about.
[01:11:16.800 --> 01:11:19.800]  And I will repeat what I said earlier in this show.
[01:11:19.800 --> 01:11:24.800]  I spent 15 years talking to these people on behalf of my clients and never once,
[01:11:24.800 --> 01:11:30.800]  that's a huge statement, thousands upon thousands upon thousands of clients over 15 years,
[01:11:30.800 --> 01:11:36.800]  never once did I find anybody in HR, in accounting, or the legal department,
[01:11:36.800 --> 01:11:43.800]  or the outside counsel for a company who ever had a clue what the law said about signing these forms
[01:11:43.800 --> 01:11:45.800]  and not signing these forms.
[01:11:45.800 --> 01:11:50.800]  Never once, it's appalling.
[01:11:50.800 --> 01:11:55.800]  Yeah, it's pretty much the same situation I have when I talk to attorneys about the stuff that I do on a regular basis.
[01:11:55.800 --> 01:11:58.800]  They've never read these laws, and they'll admit it.
[01:11:58.800 --> 01:12:04.800]  I mean, I made a presentation of my information to a group of people in someone's home one night.
[01:12:04.800 --> 01:12:07.800]  I was called up for a weekend to do just that thing.
[01:12:07.800 --> 01:12:13.800]  And unbeknownst to me at the time, one of the people present had been a municipal prosecutor for 13 years.
[01:12:13.800 --> 01:12:18.800]  And I'm standing there with these, the Code of Criminal Procedure, the Transportation Code,
[01:12:18.800 --> 01:12:22.800]  all these books in my hand, and I'm telling them, okay, here's what this section says,
[01:12:22.800 --> 01:12:26.800]  here's what this section says, here's how it applies, and here's how it works.
[01:12:26.800 --> 01:12:33.800]  At the end of this, this attorney comes to me and he says, I have never read any of this.
[01:12:33.800 --> 01:12:39.800]  In the 13 years I was a prosecutor, I've never even seen this.
[01:12:39.800 --> 01:12:46.800]  Can I tell you a funny story? As quickly as I can, I was talking to a lady in the accounting department on behalf of one of my clients.
[01:12:46.800 --> 01:12:50.800]  And during the beginning couple minutes of the conversation, she must have said the phrase,
[01:12:50.800 --> 01:12:57.800]  I have to have him sign a W foreign withhold from him because it's the law, the key being because it's the law.
[01:12:57.800 --> 01:13:00.800]  She said that about four or five times in the first couple minutes.
[01:13:00.800 --> 01:13:04.800]  So I said, I noticed that you've said this phrase, it's the law.
[01:13:04.800 --> 01:13:11.800]  Can you help me out, can you point me, can you cite the law, or can you quote the law?
[01:13:11.800 --> 01:13:13.800]  What do you mean?
[01:13:13.800 --> 01:13:17.800]  Well, can you tell me what it says? I mean, can you like read it out to me verbatim what it says,
[01:13:17.800 --> 01:13:20.800]  or at least tell me where it is in the code? I'll go look at it.
[01:13:20.800 --> 01:13:25.800]  Of course, this was a setup. And she says, well, I don't know where it is.
[01:13:25.800 --> 01:13:27.800]  I said, that's okay, tell me what it says.
[01:13:27.800 --> 01:13:30.800]  Well, I don't know what it says.
[01:13:30.800 --> 01:13:34.800]  I said, you know, this is really weird because you told me like five times you have to do it as the law,

[01:13:36.800 --> 01:13:40.800]  But not to worry. I know where it is and I know what it says.
[01:13:40.800 --> 01:13:42.800]  Do you have a computer in front of you? Yes, sir, I do.
[01:13:42.800 --> 01:13:44.800]  Let's go look at it together.
[01:13:44.800 --> 01:13:50.800]  And so we go to the appropriate section together online over the phone and we start reading it together.
[01:13:50.800 --> 01:13:58.800]  And I said, okay, so having read the law, can you, if you stretch or mangled this law beyond recognition,
[01:13:58.800 --> 01:14:03.800]  is there any way you can possibly apply it to Tom?
[01:14:03.800 --> 01:14:09.800]  She said, I don't want to talk to you anymore.
[01:14:09.800 --> 01:14:13.800]  That was the outcome. I don't want to talk to you anymore.
[01:14:13.800 --> 01:14:17.800]  Once she read the law, I don't want to talk to you anymore.
[01:14:17.800 --> 01:14:22.800]  Yeah, that pattern of belief disruption is very powerful.
[01:14:22.800 --> 01:14:28.800]  Yeah. Yeah, he does. He'll get, please leave. Yeah.
[01:14:28.800 --> 01:14:35.800]  But yes, as far as your original question, as far as the transferability of precious metals and other precious things,
[01:14:35.800 --> 01:14:41.800]  antiques, anything that can be transferred to hold the value of what you're trying to give, most certainly you can do that.
[01:14:41.800 --> 01:14:47.800]  Yep. Nothing in the law for preventing it at all. You're one of the good guys.
[01:14:47.800 --> 01:14:51.800]  No, I've been paying taxes for too many years.
[01:14:51.800 --> 01:14:56.800]  By the way, my good friend Ryan Lanell just posted to me that the quote we were talking about a moment ago,

[01:21:16.800 --> 01:21:25.800]  That's the book. I have two young children, neither have Social Security numbers, but both have U.S. passports.
[01:21:25.800 --> 01:21:32.800]  I don't think that that number is actually needed to survive in the world, as you guys are actually proof of that.
[01:21:32.800 --> 01:21:36.800]  I mean, you obviously don't use yours.
[01:21:36.800 --> 01:21:44.800]  But I'd like to ask a question about those older WF-4s that I filled out, that I marked up.
[01:21:44.800 --> 01:21:52.800]  I started a job about three and a half years ago, and the first year went relatively well.
[01:21:52.800 --> 01:21:59.800]  I was getting all that they were taking out in Social Security.
[01:21:59.800 --> 01:22:08.800]  But then about a year ago, they received that grateful letter from the IRS that tells this, quote,
[01:22:08.800 --> 01:22:16.800]  employer to change my withholding. I sent there to work with them, told them that there was no way they could do that,
[01:22:16.800 --> 01:22:20.800]  no due process, no court order, state law says they can't do it.
[01:22:20.800 --> 01:22:25.800]  Well, of course, they're more scared of the IRS booty man than they are of me.
[01:22:25.800 --> 01:22:32.800]  So for 13 months now, they have been stealing property at the rate of single and none.
[01:22:32.800 --> 01:22:40.800]  And I'm to the point now where I have a pretty good criminal lawsuit written.
[01:22:40.800 --> 01:22:50.800]  And I'm pretty sure that the law states that once you mark a W-4 exempt, after 12 months, it expires.
[01:22:50.800 --> 01:22:54.800]  Wait a minute. Wait a minute. You marked exempt on a W-4?
[01:22:54.800 --> 01:22:56.800]  Three years ago, yes.
[01:22:56.800 --> 01:23:00.800]  Dave, would you like to explain to him why that was a mistake?
[01:23:00.800 --> 01:23:03.800]  He's read the book three times. He already knows why it's a mistake.
[01:23:03.800 --> 01:23:08.800]  But I'll share the mistake with the audience.
[01:23:08.800 --> 01:23:16.800]  As I said before, a W-4 designates a person as a very narrow class of person,
[01:23:16.800 --> 01:23:23.800]  which 98 percent of the Americans, the people working in America, don't fit into that classification.
[01:23:23.800 --> 01:23:27.800]  Unfortunately, it's too lengthy to get into on the show.
[01:23:27.800 --> 01:23:30.800]  You'll have to read the book to understand it. But I assure you,
[01:23:30.800 --> 01:23:36.800]  you have my word that when you buy the book and read it, you will have zero questions left.
[01:23:36.800 --> 01:23:38.800]  Dallas, would you agree with that?
[01:23:38.800 --> 01:23:41.800]  I would agree with that 100 percent.
[01:23:41.800 --> 01:23:45.800]  Okay. So they will know when they read it. Dallas knows when he read it.
[01:23:45.800 --> 01:23:50.800]  I agree with Dallas that according to the IRS's own regulations,
[01:23:50.800 --> 01:23:58.800]  the company is supposed to get a W-4 signed again every year.
[01:23:58.800 --> 01:24:08.800]  However, there is no regulation that says that a W-4 expires after a year.
[01:24:08.800 --> 01:24:14.800]  And of course, the problem is, and this is I think what Eddie was about to get into,
[01:24:14.800 --> 01:24:17.800]  the problem is having signed it, and I know you didn't know any better,
[01:24:17.800 --> 01:24:20.800]  so this is certainly not a finger-pointing blame game.
[01:24:20.800 --> 01:24:23.800]  The problem is once the W-4 is signed,
[01:24:23.800 --> 01:24:28.800]  that creates the presumption in law that you are that particular class of person.
[01:24:28.800 --> 01:24:36.800]  The interesting thing is if you are that particular class of person and you have executed that form,
[01:24:36.800 --> 01:24:43.800]  then the IRS, by its policies and guidelines, which is different than statutes and regulations,
[01:24:43.800 --> 01:24:52.800]  does have, they will tell you, the authority to command your company to withhold at single zero.
[01:24:52.800 --> 01:25:02.800]  Now, here's the thing. The letter to your employer is nothing more than a suggestion.
[01:25:02.800 --> 01:25:07.800]  The letter carries absolutely no legal weight.
[01:25:07.800 --> 01:25:10.800]  The company does not have to do what it says in that letter,
[01:25:10.800 --> 01:25:13.800]  and you probably already know this for yourself,
[01:25:13.800 --> 01:25:19.800]  but yet most companies, as you point out, are so ridiculously terrified of the IRS
[01:25:19.800 --> 01:25:24.800]  that just something that, of course, they phrase it very officiously,
[01:25:24.800 --> 01:25:31.800]  but it's nothing more than, you know, if they really put it the way it legally should read,
[01:25:31.800 --> 01:25:38.800]  it should say, hey, we noted Dallas did this. We don't think that's correct.
[01:25:38.800 --> 01:25:47.800]  We would appreciate it if you wouldn't mind changing his status to single zero,
[01:25:47.800 --> 01:25:53.800]  because that's all the legal force that it has, if you wouldn't mind perhaps doing us a favor.
[01:25:53.800 --> 01:25:57.800]  There's no legal requirement for the company to do it at all.
[01:25:57.800 --> 01:26:01.800]  Well, I agree with you 100% again, Dave.
[01:26:01.800 --> 01:26:08.800]  The fact is that they've been doing it, and to date it's around $27,000 in 12 months
[01:26:08.800 --> 01:26:13.800]  that they have withheld out of my pay.
[01:26:13.800 --> 01:26:22.800]  And Texas state law is very specific in how a, quote, employer may deduct money from your check,
[01:26:22.800 --> 01:26:26.800]  and there's really only three ways that they can do it.
[01:26:26.800 --> 01:26:32.800]  One is if I volunteer, two is a court order, and three is federal or state law.
[01:26:32.800 --> 01:26:36.800]  None of those exist in this situation.
[01:26:36.800 --> 01:26:45.800]  Maybe if I volunteered, but is there such a way to terminate the W-4?
[01:26:45.800 --> 01:26:49.800]  There should be in the sense that you provide legal notice to the company
[01:26:49.800 --> 01:26:55.800]  that effective this date, the W-4, is no longer valid and effective.
[01:26:55.800 --> 01:27:02.800]  However, and that's just within the long-established legal doctrine of giving legal notice,
[01:27:02.800 --> 01:27:15.800]  but there is no specific regulation in the tax code that says you can cancel it by this mechanism.
[01:27:15.800 --> 01:27:24.800]  And one of the other aspects to that is making notice and demand of payment in full behind that,
[01:27:24.800 --> 01:27:27.800]  meaning either there's any monopoly or...
[01:27:27.800 --> 01:27:31.800]  What you can do is supply them with a potential notice of tort,
[01:27:31.800 --> 01:27:35.800]  and what that's going to amount to is it could wind up costing you the job because of it,
[01:27:35.800 --> 01:27:39.800]  because they're not going to want to face you or the IRS long-term.
[01:27:39.800 --> 01:27:40.800]  That's the way this is going to play out.
[01:27:40.800 --> 01:27:45.800]  If you go to get this money back, short of filing an income tax return,
[01:27:45.800 --> 01:27:49.800]  this is going to play out this way, almost guaranteed it's going to play out this way.
[01:27:49.800 --> 01:27:54.800]  They're going to get rid of you because you've now become a problem child to them.
[01:27:54.800 --> 01:27:59.800]  Well, fortunately for me, Eddie, I've been a problem child to them for a long time.
[01:27:59.800 --> 01:28:05.800]  I've had several phone conversations with their on-staff attorney.
[01:28:05.800 --> 01:28:08.800]  Apparently, I'm costing them more administrative fees than I'm worth,
[01:28:08.800 --> 01:28:11.800]  but I am actually under a collective bargaining agreement.
[01:28:11.800 --> 01:28:14.800]  I actually have a written contract.
[01:28:14.800 --> 01:28:18.800]  One of the other aspects of where I work is I believe they're in breach.
[01:28:18.800 --> 01:28:19.800]  Okay, right.
[01:28:19.800 --> 01:28:21.800]  You have two things to go on here then.
[01:28:21.800 --> 01:28:25.800]  The problem, though, is that you put in the W-4.
[01:28:25.800 --> 01:28:29.800]  Had you not put in that W-4 and had been withholding,
[01:28:29.800 --> 01:28:34.800]  this would not be nearly the issue it's become because of that W-4, okay,
[01:28:34.800 --> 01:28:40.800]  because that, as Dave stated, has created the prima facie appearance
[01:28:40.800 --> 01:28:47.800]  that you are liable under that W-4 category of person for that tax.
[01:28:47.800 --> 01:28:48.800]  From the very beginning.
[01:28:48.800 --> 01:28:49.800]  Right.
[01:28:49.800 --> 01:28:52.800]  From the very beginning when you signed the W-4.
[01:28:52.800 --> 01:28:53.800]  Right.

[01:29:17.800 --> 01:29:22.800]  that doesn't mean it places an obligation on them to concur.
[01:29:22.800 --> 01:29:26.800]  Now, the other issue there is if you hadn't signed anything
[01:29:26.800 --> 01:29:28.800]  and they had started to do this withholding,
[01:29:28.800 --> 01:29:34.800]  now you've got an issue of them taking your property
[01:29:34.800 --> 01:29:38.800]  and no legal authority behind them on which to do it
[01:29:38.800 --> 01:29:41.800]  because that letter is not a court order.
[01:29:41.800 --> 01:29:42.800]  I agree.
[01:29:42.800 --> 01:29:43.800]  Okay.

[01:35:08.800 --> 01:35:14.800]  I think it's important to understand that the term exempt on a W-4 does not mean the same thing
[01:35:14.800 --> 01:35:19.800]  that it means when we use it in our general life to say, oh, well, I'm exempt from that policy or whatever.
[01:35:19.800 --> 01:35:22.800]  It doesn't mean that on a W-4.
[01:35:22.800 --> 01:35:27.800]  The meaning of exempt on a W-4 means the following in the layperson's terms.
[01:35:27.800 --> 01:35:37.800]  It means I am a person who is liable for the tax upon whom the tax has been imposed.
[01:35:37.800 --> 01:35:44.800]  And I am subject, I am subject to withholding.
[01:35:44.800 --> 01:35:49.800]  But for various technical reasons, perhaps I overpaid last year.
[01:35:49.800 --> 01:35:55.800]  I don't have to have any withholding done right now.
[01:35:55.800 --> 01:36:00.800]  It does not mean I am a person who is exempt.
[01:36:00.800 --> 01:36:05.800]  That's a very critical distinction when marking exempt on a W-4.
[01:36:05.800 --> 01:36:10.800]  And that's the reason for my, uh-oh, Dave telling what he did wrong with that.
[01:36:10.800 --> 01:36:12.800]  You get it, Dallas?
[01:36:12.800 --> 01:36:14.800]  Absolutely. I couldn't agree more.
[01:36:14.800 --> 01:36:21.800]  Okay. So now the situation is down to what is your remedy for what's happened up to this point?
[01:36:21.800 --> 01:36:25.800]  And again, I will defer that to Dave.
[01:36:25.800 --> 01:36:30.800]  You know, one of the things I wanted to comment about when I said terminating the W-4 and I said on a specific date,
[01:36:30.800 --> 01:36:34.800]  I didn't mean retroactively because I heard Eddie use that word.
[01:36:34.800 --> 01:36:41.800]  I don't believe that you can cancel a legal document retroactively.
[01:36:41.800 --> 01:36:45.800]  However, what I meant was I'm submitting this letter to you on the 5th.
[01:36:45.800 --> 01:36:47.800]  It's dated, the effective date is the 6th.
[01:36:47.800 --> 01:36:51.800]  It ceases to be valid tomorrow, not three years ago.
[01:36:51.800 --> 01:36:54.800]  That was not what I was getting at.
[01:36:54.800 --> 01:37:04.800]  There really is, having filled out a W-4, it's really tough because you swore, and this is what we need solutions to.
[01:37:04.800 --> 01:37:10.800]  This is why I think the movie is so important because this is obviously a corrupt situation
[01:37:10.800 --> 01:37:16.800]  where you didn't understand the meaning of the W-4.
[01:37:16.800 --> 01:37:20.800]  And for our audience who hasn't read the book, let me explain what I mean.
[01:37:20.800 --> 01:37:25.800]  People imagine when they sign under penalty of perjury, what they're doing is signing under penalty of perjury
[01:37:25.800 --> 01:37:32.800]  that you put your name down correctly and you claim the proper number of deductions or exemptions, excuse me,
[01:37:32.800 --> 01:37:38.800]  and that you put your proper taxpayer identification number on the form.
[01:37:38.800 --> 01:37:40.800]  And those are all true.
[01:37:40.800 --> 01:37:47.800]  However, what the average person does not understand is that you're also signing under penalty of perjury
[01:37:47.800 --> 01:37:52.800]  that you are a person who is subject to the authority of this document.
[01:37:52.800 --> 01:38:00.800]  The laws that are behind that document that caused the Treasury Department to create it, you are subject to those laws
[01:38:00.800 --> 01:38:05.800]  because if you weren't subject to those laws, you wouldn't be signing under penalty of perjury
[01:38:05.800 --> 01:38:09.800]  that any of the technical crap you wrote down is true.
[01:38:09.800 --> 01:38:16.800]  So we have a situation now where somebody like Dallas comes along at the time he did it not being informed,
[01:38:16.800 --> 01:38:22.800]  like 99.9% of the rest of the American public, and he fills in the data and he signs it.
[01:38:22.800 --> 01:38:31.800]  This has created a legal presumption that he is a particular class of person who is subject to these laws.
[01:38:31.800 --> 01:38:35.800]  So the best course of action that I can suggest is submit a document to your employer,
[01:38:35.800 --> 01:38:40.800]  not that they're going to care, but submit a document to your employer explaining all of this
[01:38:40.800 --> 01:38:45.800]  and stating that you were ignorant of what the implication of the document was
[01:38:45.800 --> 01:38:51.800]  and that you unknowingly and unintentionally committed perjury,
[01:38:51.800 --> 01:38:59.800]  and that knowing what you know today, you could not sign one because you are not a person subject to the laws
[01:38:59.800 --> 01:39:05.800]  that are behind that form that caused the Treasury Department to create it. Does that all make sense?
[01:39:05.800 --> 01:39:09.800]  Absolutely, since I've read the book.
[01:39:09.800 --> 01:39:12.800]  There you go.
[01:39:12.800 --> 01:39:20.800]  Real quick, what the situation as of today is, after all of this went down over the past year,
[01:39:20.800 --> 01:39:30.800]  they've been stealing my property, I got in an argument with my manager.
[01:39:30.800 --> 01:39:34.800]  They terminated for insubordination.
[01:39:34.800 --> 01:39:42.800]  Well, because of my collective bargaining agreement, they were forced to rehire me.
[01:39:42.800 --> 01:39:50.800]  They gave me a new rehire packet, and in that packet was a new W-4.
[01:39:50.800 --> 01:39:58.800]  When it all came down to filling it out, I did not give them a social on the I-9.
[01:39:58.800 --> 01:40:06.800]  That brought the vice president of the company to our local branch.
[01:40:06.800 --> 01:40:14.800]  He asked me face-to-face to sign the W-4. I told him I could not do that, and you would not honor it anyway.
[01:40:14.800 --> 01:40:23.800]  I could write a zip across, and it wouldn't matter. Well, guess what? I'm here working today without a signed W-4.
[01:40:23.800 --> 01:40:31.800]  Okay, now at this point, Eddie, you can chime in. At this point, from that day forward,

[01:47:22.800 --> 01:47:28.800]  Basically, what he's saying is that we're not who most of us think we are,
[01:47:28.800 --> 01:47:30.800]  and we have to tell the government that.
[01:47:30.800 --> 01:47:35.800]  Otherwise, we're agreeing with everything that you want to do,
[01:47:35.800 --> 01:47:41.800]  like tax us and make silly laws that violate our rights and so on.
[01:47:41.800 --> 01:47:49.800]  So his suggestion is to affidavit the State Department of the federal government
[01:47:49.800 --> 01:47:55.800]  and your state government and just bypass everything that way.
[01:47:55.800 --> 01:47:57.800]  And that sounds like a good idea.
[01:47:57.800 --> 01:48:03.800]  However, I thought of some other ramifications and had questions about that.
[01:48:03.800 --> 01:48:08.800]  Before you get into that, let me start with this premise that you mentioned taxation.
[01:48:08.800 --> 01:48:15.800]  The 14th Amendment has exactly zero to do with the tax code.
[01:48:15.800 --> 01:48:17.800]  Right, I understand that.
[01:48:17.800 --> 01:48:21.800]  The idea that people think the government is getting away with taxing me
[01:48:21.800 --> 01:48:24.800]  because they say I'm a 14th Amendment citizen,
[01:48:24.800 --> 01:48:27.800]  it's the same as the manufacturer certificate of origin
[01:48:27.800 --> 01:48:35.800]  and the birth certificates being turned into some sort of commercial tradable paper.
[01:48:35.800 --> 01:48:38.800]  When you hear that concept, you're being taxed
[01:48:38.800 --> 01:48:41.800]  because the government is pretending you're a 14th Amendment citizen.
[01:48:41.800 --> 01:48:44.800]  That's a BS argument.
[01:48:44.800 --> 01:48:49.800]  Okay, and that's one of the areas I was in doubt of.
[01:48:49.800 --> 01:49:00.800]  But overall, his argument still sounds to be legitimate in that you can presume
[01:49:00.800 --> 01:49:04.800]  and they can presume and unless you know what they're talking about,
[01:49:04.800 --> 01:49:10.800]  you can make mistakes and claim you are a taxable person,
[01:49:10.800 --> 01:49:14.800]  not knowing it as I have done and many others.
[01:49:14.800 --> 01:49:22.800]  So when it comes to following, say, an affidavit with the feds and the state,
[01:49:22.800 --> 01:49:28.800]  how do you look upon that as a smart thing to do or a dumb thing to do?
[01:49:28.800 --> 01:49:30.800]  I don't consider it smart or dumb.
[01:49:30.800 --> 01:49:33.800]  I consider it a waste of time, and let me explain why.
[01:49:33.800 --> 01:49:36.800]  If the government is trying to do something to you,
[01:49:36.800 --> 01:49:39.800]  and I can use you because we're not talking about taxes now,
[01:49:39.800 --> 01:49:41.800]  so the injunction is not relevant.
[01:49:41.800 --> 01:49:44.800]  If the government is trying to do something to you
[01:49:44.800 --> 01:49:50.800]  and you believe that because 14th Amendment citizens
[01:49:50.800 --> 01:49:54.800]  do not have the same rights as the de jure class of citizens,
[01:49:54.800 --> 01:49:58.800]  that that's the rationale under which they're presuming
[01:49:58.800 --> 01:50:04.800]  that they can apply this law to you or take this action against you,
[01:50:04.800 --> 01:50:10.800]  at that point then you would challenge them to prove that you are a 14th Amendment citizen.
[01:50:10.800 --> 01:50:12.800]  So basically what you would say to them is,
[01:50:12.800 --> 01:50:17.800]  ah, I see, you're doing X to me, or you want to do X to me.
[01:50:17.800 --> 01:50:23.800]  You can only do X to somebody who has truncated rights, such as a 14th Amendment citizen.
[01:50:23.800 --> 01:50:29.800]  So now it's your obligation, if you want to sustain your jurisdiction in this action,
[01:50:29.800 --> 01:50:33.800]  it's your job to show I'm a 14th Amendment citizen.
[01:50:33.800 --> 01:50:39.800]  Now, the government has exactly no game in that whatsoever.
[01:50:39.800 --> 01:50:44.800]  If you look back at the United States Supreme Court cases,
[01:50:44.800 --> 01:50:48.800]  they have absolutely no argument that they can make
[01:50:48.800 --> 01:50:52.800]  that people like you or people like me are 14th Amendment citizens.
[01:50:52.800 --> 01:50:55.800]  And although the 14th Amendment, of course, as you well know,
[01:50:55.800 --> 01:51:02.800]  was created in order to gift the freed black slaves a form of citizenship,
[01:51:02.800 --> 01:51:07.800]  even if they were talking to a black man in 2017,
[01:51:07.800 --> 01:51:11.800]  they still can't prove he's a 14th Amendment citizen.
[01:51:11.800 --> 01:51:17.800]  So, you know, I say, wait till they want to do X to you, whatever X is,
[01:51:17.800 --> 01:51:22.800]  and then say, if you believe it's only predicated on you being a 14th Amendment citizen
[01:51:22.800 --> 01:51:27.800]  with truncated legal rights, then say, oh, you're only able to approach me on this
[01:51:27.800 --> 01:51:32.800]  because you think I'm this. Prove it.
[01:51:32.800 --> 01:51:37.800]  So filing these affidavits generally is not going to stop an agency
[01:51:37.800 --> 01:51:40.800]  or the federal government or your state government or the county or the city or anything else
[01:51:40.800 --> 01:51:48.800]  from taking action against you under the presumption you're a 14th Amendment citizen.
[01:51:48.800 --> 01:51:54.800]  I mean, if your county's Department Y sends you a letter saying you got to do this
[01:51:54.800 --> 01:51:57.800]  and you got to do that and you believe it's predicated on you,
[01:51:57.800 --> 01:51:59.800]  they believe you're a 14th Amendment citizen,
[01:51:59.800 --> 01:52:04.800]  they don't know about your affidavit in D.C. and nor do they care.
[01:52:04.800 --> 01:52:10.800]  Right. You would have to do one in each place based on that approach.
[01:52:10.800 --> 01:52:13.800]  Right. But my point is the person who decides they're going to send out the letter
[01:52:13.800 --> 01:52:18.800]  to harass you or demand that you do this or demand you stop doing that,
[01:52:18.800 --> 01:52:21.800]  they're not even going to know you filed such a letter.
[01:52:21.800 --> 01:52:26.800]  It's not like you file it like with your county recorder and suddenly your county,
[01:52:26.800 --> 01:52:30.800]  the chief administrator says, oh, hang on.
[01:52:30.800 --> 01:52:35.800]  We need to annotate this man's files and all of our agencies that he filed an affidavit.
[01:52:35.800 --> 01:52:39.800]  That doesn't happen. So fight it when it happens.

[01:53:44.800 --> 01:53:48.800]  and as soon as I get pulled over there are three sheriffs and a DPS
[01:53:48.800 --> 01:53:52.800]  who just left another car that they had pulled over.
[01:53:52.800 --> 01:53:56.800]  I get out of my car, lock the door, close it, and a guy comes up to me,
[01:53:56.800 --> 01:54:00.800]  tells me he pulls me over because of the snow covering my lysis plate,
[01:54:00.800 --> 01:54:03.800]  and then begins asking me where the marijuana is at.
[01:54:03.800 --> 01:54:07.800]  I tell him that I didn't understand the nature of the question,
[01:54:07.800 --> 01:54:09.800]  and I shut my mouth.
[01:54:09.800 --> 01:54:12.800]  Another sheriff came up behind me, put handcuffs on me,
[01:54:12.800 --> 01:54:15.800]  and they start reaching at the door trying to get in,
[01:54:15.800 --> 01:54:17.800]  saying that they're going to use a slim gem to get in.
[01:54:17.800 --> 01:54:21.800]  I told them that I needed to see a white time ward for them to get in,
[01:54:21.800 --> 01:54:23.800]  that I was not engaged in transportation or commerce.
[01:54:23.800 --> 01:54:28.800]  I did not understand what was going on or consent to anything.
[01:54:28.800 --> 01:54:34.800]  One of the deputies told the other one that the keys wasn't in the ignition.
[01:54:34.800 --> 01:54:38.800]  He told them that he said the keys were in the car.
[01:54:38.800 --> 01:54:41.800]  I said I never said that. They reached to my pocket.
[01:54:41.800 --> 01:54:43.800]  They grabbed my keys out, opened it.
[01:54:43.800 --> 01:54:46.800]  They found everything that was sitting there in the passenger seat,
[01:54:46.800 --> 01:54:48.800]  and they said I was going to jail.

[01:54:50.800 --> 01:54:54.800]  took me to the sheriff's department where I stayed three hours

[01:54:57.800 --> 01:55:02.800]  Then I spent another 18 hours in a solitary confinement for 20 hours
[01:55:02.800 --> 01:55:07.800]  until a justice came and magistrated me out or bonded me out.
[01:55:07.800 --> 01:55:12.800]  Now, what I'm thinking my thesis would be, long story short,
[01:55:12.800 --> 01:55:17.800]  is prove the illegality of the warrantless arrest being the traffic stop
[01:55:17.800 --> 01:55:22.800]  and try to hit them with the proof of the Poison Tree Bucket Room.
[01:55:22.800 --> 01:55:25.800]  Well, you can always file a motion to suppress,
[01:55:25.800 --> 01:55:28.800]  stating that the search of the car was illegal.
[01:55:28.800 --> 01:55:31.800]  They never gave you any basis of probable cause
[01:55:31.800 --> 01:55:34.800]  in which to arrest you in the first place, correct?
[01:55:34.800 --> 01:55:37.800]  They said that the car smelled like marijuana.
[01:55:37.800 --> 01:55:39.800]  How would they know that if it was closed up

[01:56:54.800 --> 01:56:57.800]  or live in a certain part of town or whatever,
