[01:15.040 --> 01:19.320]  Service predicting another 4 to 5 inches through the area in the weekend.
[01:19.320 --> 01:22.840]  Just as last April, if you recall, more than 1,000 people were evacuated from northern
[01:22.840 --> 01:27.400]  Houston during another historic flood, and often over the weekend, more than 2,000 inmates
[01:27.400 --> 01:30.360]  were evacuated from prisons in low-lying regions.
[01:30.360 --> 01:35.080]  Consider that just two years ago, the Brussels River had run dry in some places due to drought,
[01:35.080 --> 01:37.320]  but is now in an obviously saturated state.
[01:37.320 --> 01:41.440]  A flash flood watch is currently in effect for all of south central Texas, according
[01:41.440 --> 01:44.920]  to the National Weather Service, and a river flood warning is in effect for the Brussels

[01:45.920 --> 01:53.720]  More than half a dozen fatalities have been a consequence of this flood.
[01:53.720 --> 01:57.280]  In what can be some of the most eyebrow-raising endorsements for presidential hopefuls of
[01:57.280 --> 02:01.520]  the United States, the president of Venezuela, Nicolas Maduro, came out and endorsed democratic
[02:01.520 --> 02:06.120]  socialist Bernie Sanders on Tuesday, calling him our revolutionary friend and implying
[02:06.120 --> 02:09.840]  that it is our broken political system as to the reason why Sanders is being marginalized.
[02:09.840 --> 02:15.440]  If that wasn't enough, North Korean state media DPRK Today published a column also released
[02:15.440 --> 02:19.960]  on Tuesday which came out and endorsed Republican newcomer Donald Trump, calling him a wise
[02:19.960 --> 02:24.240]  politician and stating that it turns out that Trump is not a rough-talking, screwy, ignorant
[02:24.240 --> 02:28.640]  candidate they say he is, but is actually a wise politician and pristine presidential
[02:28.640 --> 02:29.640]  candidate.
[02:29.640 --> 02:33.400]  As of yet, no authoritarian dictator has come out and endorsed Hillary Clinton, though some
[02:33.400 --> 02:37.600]  suspect this is due to many of them wanting to retain some level of credibility.
[02:37.600 --> 02:41.400]  In what could only be considered ominous omens, it seems that many of black cats are crossing
[02:41.400 --> 02:44.720]  the American people's path to this upcoming presidential election.

[03:51.240 --> 04:01.400]  The State Bar Association is up for sunset, so we're going to go before the Sunset Commission
[04:01.400 --> 04:07.840]  and we're going to give a presentation, Ken Magnuson, he's pretty good at lobbying, he's
[04:07.840 --> 04:18.320]  a lot better than me, I'm a little too coarse, but he's going to give a presentation asserting
[04:18.320 --> 04:22.400]  some changes he would like to see made.
[04:22.400 --> 04:28.000]  And I'm going to speak to him and I'm going to ask him not to change anything.
[04:28.000 --> 04:35.000]  Because the State Bar Association right now, and I'll tell them that I do this radio show
[04:35.000 --> 04:42.720]  and I tell everybody that if you file a bar grievance against a lawyer in Texas, the State
[04:42.720 --> 04:48.000]  Bar is going to get that bar grievance and they're going to throw it in the trash.
[04:48.000 --> 04:52.400]  And then they're going to send you this letter back saying that we examined into your accusation
[04:52.400 --> 05:00.280]  and find it does not rise to the level of misconduct, makes no difference what you file.
[05:00.280 --> 05:02.840]  You're going to get that response back.
[05:02.840 --> 05:08.760]  It's what the bar does, we have lawyers regulating lawyers, so what would you expect them to
[05:08.760 --> 05:09.760]  do?
[05:09.760 --> 05:14.640]  And that's a great thing, and I tell everybody, that's a good thing.
[05:14.640 --> 05:23.280]  The reason that's a good thing is their insurance carrier knows that they'll throw it in the
[05:23.280 --> 05:24.280]  trash.
[05:24.280 --> 05:30.400]  Here's what, I was doing a little research on the underwriters for lawyer malpractice
[05:30.400 --> 05:31.400]  insurance.
[05:31.400 --> 05:35.960]  I've got a little article here, I'm going to read the first part to you guys, you are
[05:35.960 --> 05:38.400]  going to like this.
[05:38.400 --> 05:39.400]  Okay.
[05:39.400 --> 05:45.080]  If there is one thing you need to know about your legal malpractice policy is that the
[05:45.080 --> 05:49.960]  reporting requirements for potential claims and actual claims.
[05:49.960 --> 05:54.360]  Although many lawyers understand that they must immediately report actual claims and
[05:54.360 --> 06:00.120]  lawsuits brought against them, they do not realize that they must also report any circumstance
[06:00.120 --> 06:05.480]  of which they are aware and that may result in a claim or suit against them.
[06:05.480 --> 06:11.320]  The failure to immediately report these potential claims will result in lawyers losing the coverage
[06:11.320 --> 06:17.520]  they counted on and paid for, paid big time for.
[06:17.520 --> 06:25.720]  The good news is that you can avoid this problem if you understand the policy insurance application.
[06:25.720 --> 06:28.880]  Where does it say that I have to report potential claims?
[06:28.880 --> 06:34.080]  The notice provisions of many policies require that the insured give notice of all circumstances
[06:34.080 --> 06:38.360]  that would reasonably be expected to give rise to a claim.
[06:38.360 --> 06:43.880]  Even if the policy only requires that the insured give notice of a claim, some policies
[06:43.880 --> 06:51.040]  define a claim to include circumstances that the insured should reasonably expect will
[06:51.040 --> 06:53.200]  result in a claim.
[06:53.200 --> 06:58.960]  Additionally, your original application for the policy and each renewal application will
[06:58.960 --> 07:06.320]  inquire whether any insured is aware of circumstances that would reasonably be expected to be the
[07:06.320 --> 07:07.720]  basis of a claim.
[07:07.720 --> 07:14.600]  The applications require the insured to make inquiry of all these insurance under the policy
[07:14.600 --> 07:17.600]  before answering this question.
[07:17.600 --> 07:22.360]  The extent to which you will have to poll former partners, associates, and employees
[07:22.360 --> 07:30.800]  about potential claims they might be aware of or will depend upon your policy's definition
[07:30.800 --> 07:36.440]  of insured in the actual questions in the application.
[07:36.440 --> 07:38.500]  What is the potential claim?
[07:38.500 --> 07:46.400]  Most policies do not define a reportable potential claim beyond phrases such as any act which
[07:46.400 --> 07:51.080]  could reasonably be expected to be the basis of a claim.
[07:51.080 --> 07:56.840]  Insurers have interpreted these phrases many times and have found them unambiguous.
[07:56.840 --> 08:03.120]  A claim is usually defined to mean a demand for money or services and might also include
[08:03.120 --> 08:08.200]  the filing of a disciplinary complaint.
[08:08.200 --> 08:14.640]  The standard for determining whether an insured should have been aware of a potential claim
[08:14.640 --> 08:22.840]  is often a combination objective subjective wise, also a combination objective subjective
[08:22.840 --> 08:23.840]  one.
[08:23.840 --> 08:29.320]  The court first looks to see what information the lawyer actually subjectively possessed
[08:29.320 --> 08:34.120]  and then determines whether an objectively reasonable insured would have recognized the
[08:34.120 --> 08:36.400]  potential for a claim based on this information.
[08:36.400 --> 08:42.080]  Thus, even if you were not conscious that your conduct would likely result in a claim,
[08:42.080 --> 08:47.000]  you might have a reporting obligation if a reasonable insured would have foreseen the
[08:47.000 --> 08:51.400]  claim based on the same information you had.
[08:51.400 --> 08:56.800]  Among the circumstances where courts have found that the insured should have foreseen
[08:56.800 --> 08:59.040]  a claim are the following.
[08:59.040 --> 09:05.320]  The lawyer realized that he had failed to file tax forms or notices by a particular
[09:05.320 --> 09:06.800]  debt line.
[09:06.800 --> 09:13.520]  The client threatened to sue the lawyer, sue if the lawyer did not cure a problem.
[09:13.520 --> 09:21.160]  The client expressed this dissatisfaction with the result of a case and that he believed
[09:21.160 --> 09:23.440]  the lawyer was responsible.
[09:23.440 --> 09:29.080]  The lawyer was aware that he had breached one of the state disciplinary rules in his
[09:29.080 --> 09:36.700]  business dealings with the client and the client loses a case in the trial court because
[09:36.700 --> 09:41.200]  of some act or a mission that was within the lawyer's control, such as failure to make
[09:41.200 --> 09:47.120]  an objection, failure to designate an expert or otherwise respond to discovery request,
[09:47.120 --> 09:57.920]  spoilation of evidence, failure to prosecute or failure to file within the statute of limitations.
[09:57.920 --> 09:58.920]  This is really cool.
[09:58.920 --> 10:06.280]  Okay, you need to understand what that reporting requirement goes to and why you find court
[10:06.280 --> 10:10.000]  cases relating to that.
[10:10.000 --> 10:17.440]  Because if you have a reporting requirement as a lawyer and you don't report these claims
[10:17.440 --> 10:26.800]  or potential claims the way the contract requires you to, then if you get sued, you're not covered.
[10:26.800 --> 10:34.120]  These guys start out paying 25 grand a year and it goes up from there.
[10:34.120 --> 10:40.500]  This bar grievance, the half report bar grievances, then it doubles.
[10:40.500 --> 10:45.840]  If it's in the first year of practice, they'll cancel, two in any one year of practice, they'll
[10:45.840 --> 10:46.840]  cancel.
[10:46.840 --> 10:49.280]  Three, they'll cancel your law firms and my practice insurance.
[10:49.280 --> 10:55.600]  So I'm going to go to the legislature and ask them, oh, don't sunset the bar, keep that
[10:55.600 --> 10:58.120]  bar just the way it is.
[10:58.120 --> 11:08.000]  Frankly, I think it's wonderful, it is the greatest check to the abuse of power by lawyers
[11:08.000 --> 11:10.440]  that we could possibly have.
[11:10.440 --> 11:16.240]  And the best part is they created this mess for themselves so they don't get to whine
[11:16.240 --> 11:19.080]  and gripe about it.
[11:19.080 --> 11:21.080]  That's my story, I'm sticking to it.
[11:21.080 --> 11:22.760]  What do you think, Fatt?

[11:27.880 --> 11:35.120]  When I read this, I was surprised that the court of requirements were a lot higher than
[11:35.120 --> 11:36.120]  I anticipated.
[11:36.120 --> 11:45.360]  And this gives me an idea is you should always communicate your dissatisfaction with your
[11:45.360 --> 11:54.840]  lawyer in email, email or written letter, but email is sufficient, so it's in writing.
[11:54.840 --> 11:58.920]  Most of verbal admonition is too ethereal.
[11:58.920 --> 12:05.960]  When the sound dies down, it all goes away, but if you do it in email, then it's essentially
[12:05.960 --> 12:06.960]  permanent.
[12:06.960 --> 12:12.560]  It's even more permanent than written mail because you can lose the mail or you can lose
[12:12.560 --> 12:15.480]  the green card, the email.
[12:15.480 --> 12:18.760]  Do you know the email address?
[12:18.760 --> 12:23.400]  Oh, it'll be whatever your lawyer is.
[12:23.400 --> 12:25.280]  Oh, okay.
[12:25.280 --> 12:31.280]  The reason I was researching is I'm trying to find all the underwriters, I want to get
[12:31.280 --> 12:41.840]  a list of underwriters and email addresses for underwriters and create a CC list so that
[12:41.840 --> 12:47.540]  every time we file a bar agreement, we CC every underwriter.
[12:47.540 --> 12:54.880]  Every time we file a complaint, we complain to the lawyer about a problem.
[12:54.880 --> 13:00.920]  Say we're, and a lot of us, we try to get lawyers to file documents and they refuse.
[13:00.920 --> 13:07.640]  That's just a good letter to their insurance company.
[13:07.640 --> 13:13.760]  Email the lawyer and CC it to the insurance company so the insurance company has noted
[13:13.760 --> 13:18.400]  that you're requesting your lawyer take some action towards the adjudication of your case
[13:18.400 --> 13:20.440]  and he's refusing to do so.
[13:20.440 --> 13:26.160]  I mean, how many times have we heard people say that they tried to get the lawyer to do
[13:26.160 --> 13:30.520]  things and the lawyer just refused?
[13:30.520 --> 13:35.040]  Those listen to our show, they get that all the time because they're asking the lawyer
[13:35.040 --> 13:43.000]  to do things that are required in the adjudication of their case and the last thing they want
[13:43.000 --> 13:50.640]  to do, especially if they're like a court appointed counsel, the last thing they want
[13:50.640 --> 13:57.760]  is to get the client off because that's not why they're there.
[13:57.760 --> 14:00.320]  That's not why the state's paying them.
[14:00.320 --> 14:05.360]  The state's paying them to make sure they don't have anything to appeal.
[14:05.360 --> 14:10.840]  I had a friend that a lawyer actually told him that once when he was pretty frustrated
[14:10.840 --> 14:14.840]  at me, he told me, you don't understand.
[14:14.840 --> 14:18.640]  My job is to make sure you don't have anything to appeal.
[14:18.640 --> 14:25.080]  So knowing that, we better understand why these lawyers don't want to file some of
[14:25.080 --> 14:30.240]  these documents, but it puts them at terrible risk.
[14:30.240 --> 14:36.880]  So for my part, they keep doing the state bar association just the way they are.
[14:36.880 --> 14:40.120]  It works fine for me.
[14:40.120 --> 14:50.080]  If the state bar did their job the way they should, then a frivolous or meritless grievance
[14:50.080 --> 14:59.880]  against a lawyer would be ineffective, but they created this mess where we have this
[14:59.880 --> 15:06.640]  giant club we can beat them over the head with and if they raise a complaint about it,
[15:06.640 --> 15:15.000]  I just had someone tell me that in a pleading, the lawyer complained to the judge about all
[15:15.000 --> 15:20.600]  the bar grievances he had filed and I asked him, did you file a bar grievance against
[15:20.600 --> 15:26.840]  him for that and then a petition for sanctions against the lawyer for attempting to improperly
[15:26.840 --> 15:31.200]  influence the court.
[15:31.200 --> 15:39.120]  So when the Sunset Commission meets, it should be about the middle or toward the end of January,
[15:39.120 --> 15:43.120]  anybody in Austin, you might check with the legislature and find out when they're going
[15:43.120 --> 15:44.120]  to meet.
[15:44.120 --> 15:48.400]  The more people we can get there, the better.
[15:48.400 --> 15:55.440]  They may actually change something if I get them to realize their failure to act has caused
[15:55.440 --> 15:59.240]  a horrible problem.

[21:34.640 --> 21:39.480]  So, things are moving in our favor, so that sounds good.
[21:39.480 --> 21:47.200]  The attorney is going to put in an appeal, we can put it in 1925 form, and we are talking
[21:47.200 --> 21:57.400]  to Legley about it, and we are going to file this as soon as possible and see where it
[21:57.400 --> 21:58.400]  goes.
[21:58.400 --> 22:03.200]  It will probably be another two or three years before they get this done.
[22:03.200 --> 22:11.520]  You got 30 days to give notice to the appeal, then 60 to 90 days to file the appeal, and
[22:11.520 --> 22:19.480]  the other side has probably 30 to 60 days to respond to your appeal, and then the judge
[22:19.480 --> 22:24.600]  will take a year to a year and a half to render a ruling.
[22:24.600 --> 22:30.960]  Yeah, well our statute of limitations should run out by then.
[22:30.960 --> 22:38.080]  And then if it all gets dismissed, well you have enough claims, if they actually go by

[23:43.520 --> 23:51.120]  judges thrown out of office, or see if we cannot get them prosecuted, I just file criminal

[24:00.440 --> 24:11.560]  He dismissed on a Rule 12 with prejudice and bypassed a challenge to subject matter jurisdiction.
[24:11.560 --> 24:19.760]  So I took that as criminal due process, procedural due process, and I filed 18 U.S. Code 242
[24:19.760 --> 24:28.320]  against him, and took it down and gave it to the clerk for presentation to some magistrate,
[24:28.320 --> 24:31.000]  and he stamped it and took it.
[24:31.000 --> 24:38.480]  Now, I have not heard anything, so I will go back next week and ask him who he gave
[24:38.480 --> 24:46.120]  it to, and if he cannot tell me, then I will prepare criminal complaints against all of
[24:46.120 --> 24:52.240]  the judges and accuse them all of conspiring one with the other to shield this judge from
[24:52.240 --> 25:00.920]  prosecution and violation of 3805 Texas penal code, I will file against him in the state.
[25:00.920 --> 25:06.640]  What I expect will happen is I will get a communication before that from a judge giving
[25:06.640 --> 25:12.680]  me sage advice, telling me how I really need to take this complaint to the U.S. Attorney
[25:12.680 --> 25:20.440]  or the FBI, and if I get that, then I know which judge to go after, then I'll file against
[25:20.440 --> 25:25.080]  just one of them, but if I don't get anything from any of them, I'll assume they all got
[25:25.080 --> 25:30.600]  together and all refused to act, so I'll name them all.
[25:30.600 --> 25:34.080]  If one of them didn't have anything to do with it, let him bring it up as an affirmative
[25:34.080 --> 25:38.080]  defense.

[35:03.760 --> 35:10.000]  But they're not, but they're no longer, they got transferred last year, so he can't
[35:10.000 --> 35:15.680]  be representing them if those people are not, if he assigned that away from them to Countrywide

[36:11.280 --> 36:19.000]  If they have reason to believe that there's a potential claim against them, they're required
[36:19.000 --> 36:23.160]  to report it to the carrier.
[36:23.160 --> 36:30.520]  If they should have reported a claim and didn't, then they're not insured.
[36:30.520 --> 36:36.680]  So the more claims you report, the higher their insurance rating goes up.
[36:36.680 --> 36:49.020]  So you might email this or send this law firm a tort letter and notice them that they are
[36:49.020 --> 36:56.760]  committing malpractice to your detriment and order them to cease and desist or order them
[36:56.760 --> 37:02.120]  to make you hold or be sued and three times the value of the property because you maintain
[37:02.120 --> 37:09.240]  their action is intentionally fraudulent and an attempt to convert your property in violation
[37:09.240 --> 37:12.280]  of the Tort Claims Act.

[37:18.640 --> 37:27.560]  There's a special cause of action for this that you can sue them under, so send them

[38:00.640 --> 38:07.280]  do is look around and see if he can find some deep pockets to get into.

[38:09.280 --> 38:15.000]  If the lawyer has malpractice insurance, you're going to sting him big time.
[38:15.000 --> 38:23.600]  If he doesn't, if he's self-insured, you got a nice deep pockets you can get into.

[39:30.440 --> 39:39.000]  So since he has to know, if he violates one, you have to assume that he did that on purpose

[43:06.480 --> 43:10.440]  most of the sales here in Dallas-Fort Worth and he didn't respond to it, went ahead and

[47:45.520 --> 47:53.520]  Most of them know about me, and the reason they know about me is because I kick them

[49:30.840 --> 49:38.760]  The reason that's important is if... When I read this, it stated that the courts have

[49:41.880 --> 49:46.960]  It's interesting and important to understand why it said the courts have ruled on what
[49:46.960 --> 49:49.880]  constitutes notice to their insurance carrier.
[49:49.880 --> 49:56.280]  The reason the courts would have ruled on that is because if they don't give notice
[49:56.280 --> 50:03.720]  when they should to their insurance carrier, they're not covered.
[50:03.720 --> 50:12.400]  If they get a bar grievance, they have to tell their insurance carrier.
[50:12.400 --> 50:17.000]  Legal malpractice starts at about 25 grand a year.
[50:17.000 --> 50:21.720]  One bar grievance, your first year of practice, they'll cancel immediately.
[50:21.720 --> 50:25.240]  Two bar grievances, any one year of practice, they'll cancel.
[50:25.240 --> 50:29.160]  Three, they'll cancel your law firm's malpractice insurance.
[50:29.160 --> 50:33.480]  Valid, invalid, they don't care.
[50:33.480 --> 50:39.280]  The point I made earlier is I'm going to go do a presentation to the Sunset Committee
[50:39.280 --> 50:45.200]  for the bar this year, and I'm going to tell them, guys, don't do anything.
[50:45.200 --> 50:48.920]  Leave it just like it is.
[50:48.920 --> 50:50.880]  Just the way it is is wonderful.
[50:50.880 --> 50:57.840]  Yeah, if you file a bar grievance against a lawyer in the state of Texas, state bar is
[50:57.840 --> 51:01.760]  going to get that grievance, and they're going to throw it in the trash, and they're going
[51:01.760 --> 51:05.480]  to send you this letter that says, we have examined into your accusation by the does
[51:05.480 --> 51:09.480]  not rise to the level of misconduct.
[51:09.480 --> 51:13.880]  Doesn't matter what you file, valid, invalid, it don't make any difference, and that's a
[51:13.880 --> 51:14.880]  good thing.
[51:14.880 --> 51:19.720]  And the reason it's a good thing is their insurance carrier knows they're going to throw
[51:19.720 --> 51:20.720]  it in the trash.
[51:20.720 --> 51:22.240]  So how do they gauge their level of risk?
[51:22.240 --> 51:23.240]  By valid bar grievances?
[51:23.240 --> 51:27.120]  That's going to throw them all in the trash.
[51:27.120 --> 51:33.040]  If I file a bar grievance that says that no good rotten tricester parts his hair on the
[51:33.040 --> 51:35.920]  left, if you can believe that, he should be disbarred.
[51:35.920 --> 51:40.760]  They're going to send me a letter saying, we examined into your accusation by the does
[51:40.760 --> 51:46.480]  not rise to the level of misconduct, and their insurance carrier is going to double their
[51:46.480 --> 51:47.480]  insurance premium.
[51:47.480 --> 51:54.240]  Valid, invalid, they don't care.
[51:54.240 --> 52:04.760]  So the lawyers, by protecting themselves, this is the only profession where a licensed
[52:04.760 --> 52:11.960]  profession polices itself, and they did exactly what you'd expect them to do.
[52:11.960 --> 52:15.440]  They became a public relations organization for the lawyers.
[52:15.440 --> 52:21.040]  They do nothing to police lawyers, and the insurance companies know that.
[52:21.040 --> 52:22.040]  So they don't care.
[52:22.040 --> 52:23.040]  They know what the grievances is.
[52:23.040 --> 52:27.520]  If you get a grievance, you get zapped.
[52:27.520 --> 52:32.200]  I had a lawyer tell me that's badly unfair, and I'm standing there grinning from ear to
[52:32.200 --> 52:33.200]  ear.
[52:33.200 --> 52:39.520]  Oh, man, I shouldn't have told you that, no, you shouldn't have, and it has borne itself
[52:39.520 --> 52:40.520]  out.
[52:40.520 --> 52:45.400]  Lawyers really get excited when you grieve them.
[52:45.400 --> 52:49.400]  So lawyers have all these advantages coming into the court.
[52:49.400 --> 52:54.560]  They have a political relationship with the judge and your attorney.
[52:54.560 --> 52:59.880]  You go into court, it's like sitting at a four-sided chessboard.
[52:59.880 --> 53:03.880]  You're on one side, your lawyers to your right, opposing counsel to your left, judge across
[53:03.880 --> 53:05.020]  from you.
[53:05.020 --> 53:08.080]  You have a relationship with your lawyer.
[53:08.080 --> 53:14.240]  Your lawyer has a relationship with opposing counsel and the judge, and they all have relationships
[53:14.240 --> 53:15.240]  with each other.
[53:15.240 --> 53:18.520]  So you've got one out.
[53:18.520 --> 53:23.040]  So the best way for you to get leverage is sting your lawyer.
[53:23.040 --> 53:29.640]  Now, your lawyer has to go to these guys to help you out with this unruly client, go ruin
[53:29.640 --> 53:30.640]  my career.
[53:30.640 --> 53:36.580]  You've got to figure out how to bring politics into the mix because you will never win your
[53:36.580 --> 53:39.600]  case simply because you have the law and the facts on your side.
[53:39.600 --> 53:40.600]  Right.
[53:40.600 --> 53:41.600]  You win your case.
[53:41.600 --> 53:46.280]  I've heard you say that a few times before, and now I think it's starting to click with
[53:46.280 --> 53:47.280]  me.
[53:47.280 --> 53:48.280]  Okay.
[53:48.280 --> 53:50.880]  Now, you just sting that lawyer.
[53:50.880 --> 53:57.720]  If that lawyer says one word to the court about it, you are grieving for that and ask
[53:57.720 --> 54:06.520]  the court for sanctions because he is specifically forbidden by the bar association standards
[54:06.520 --> 54:09.400]  from mentioning a bar grievance.
[54:09.400 --> 54:14.480]  He can't mention it to the court, he can't mention it to you.
[54:14.480 --> 54:22.000]  He can only talk to the state bar about it, but he knows the bar is not going to do anything,
[54:22.000 --> 54:27.120]  but its insurance company is and he can't do anything about that.
[54:27.120 --> 54:32.240]  So that's why I'm looking up all the insurance carriers and I'm going to make up a CC list.
[54:32.240 --> 54:39.400]  And I used to have a bar grievance site up and somebody built it in XML and it's all
[54:39.400 --> 54:40.400]  crashed.
[54:40.400 --> 54:41.400]  I lost it.
[54:41.400 --> 54:42.400]  So I have to rebuild the site.
[54:42.400 --> 54:54.200]  But I'm building a site and when you click on send, it will CC the bar grievance to every
[54:54.200 --> 54:57.400]  malpractice insurance underwriter.
[54:57.400 --> 54:58.960]  Wow.
[54:58.960 --> 55:02.400]  Everybody gets noticed.
[55:02.400 --> 55:08.480]  And then we'll make up a tort letter and I want to build a malpractice suit that you
[55:08.480 --> 55:13.160]  could just fill in the blank.
[55:13.160 --> 55:18.520]  The malpractice suit is way worse than a bar grievance.
[55:18.520 --> 55:20.440]  Now they got to answer it.
[55:20.440 --> 55:25.480]  They got to run the risk of losing it in their insurance carrier.
[55:25.480 --> 55:28.120]  The lawyer himself can't defend it.
[55:28.120 --> 55:33.480]  The insurance company will send somebody in to defend for him and they are not going to
[55:33.480 --> 55:37.640]  be happy campers.
[55:37.640 --> 55:41.480]  So it's a way to get us leverage.
[55:41.480 --> 55:45.480]  Judge Akanda complains against the judge.
[55:45.480 --> 55:48.200]  You don't owe that judge anything.
[55:48.200 --> 55:55.440]  Certainly don't need him to do you any favors because you can be sure he is not going to.
[55:55.440 --> 55:58.400]  You don't want him doing you any favors.
[55:58.400 --> 56:03.040]  You want him to determine the facts in accordance to the rule of evidence and apply the laws
[56:03.040 --> 56:04.680]  that comes to him with the facts in the case.
[56:04.680 --> 56:07.680]  He has another agenda?
[56:07.680 --> 56:10.960]  He's a get out off that bench.
[56:10.960 --> 56:16.280]  So that's why if a judge raises his voice to me, that's not part of determining the
[56:16.280 --> 56:19.720]  facts and applying the law.
[56:19.720 --> 56:20.720]  That's some personal issue.
[56:20.720 --> 56:23.960]  You want to have yourself a personal agenda?
[56:23.960 --> 56:26.880]  You better leave that at home.
[56:26.880 --> 56:32.160]  You don't come into court and raise your voice to your master, but he'll break you from
[56:32.160 --> 56:36.960]  sucking eggs.
[56:36.960 --> 56:44.360]  The higher level the judge, the more sensitive they are to the politics.
[56:44.360 --> 56:48.400]  These municipal judges down at the bottom, they're chump lawyers.
[56:48.400 --> 56:51.800]  You can't make it as lawyers.
[56:51.800 --> 56:56.160]  So they come part time and be a municipal judge.
[56:56.160 --> 56:58.440]  So it's not a big deal to them.
[56:58.440 --> 57:04.560]  Even if they lose the job, they don't make much and do not start personizing the jury.
[57:04.560 --> 57:12.120]  As you move up, these judges are much more sensitive to the politics.
[57:12.120 --> 57:18.400]  Every district judge wants to be on the court of appeals, but if he's got a judicial conduct
[57:18.400 --> 57:23.400]  complaint or two against him and another judge doesn't, he's going to get bumped.
[57:23.400 --> 57:26.640]  He's not going to get selected.
[57:26.640 --> 57:33.640]  So this becomes really important to these guys, the higher up you get, and you don't
[57:33.640 --> 57:34.640]  need to be your buddy.
[57:34.640 --> 57:40.520]  He's going to rule against you no matter what, unless you give him reason not to.
[57:40.520 --> 57:44.400]  They're not there for the law, are they?
[57:44.400 --> 57:45.400]  Right.
[57:45.400 --> 57:54.480]  Unless you make them, you stick the politics to them, they get a lot more careful.
[57:54.480 --> 58:03.320]  So I suggest you at least get a bar grievance against this lawyer and look up, send me another
[58:03.320 --> 58:08.560]  email and ask me about the tort claim for conversion.

[01:04:11.560 --> 01:04:18.840]  The other side, even if he doesn't have a position, will be given opportunity to be
[01:04:18.840 --> 01:04:28.000]  heard, the judge will rule, if the judge rules against him he'll have opportunity to appeal
[01:04:28.000 --> 01:04:35.760]  and he can keep you in court for another three to five years.
[01:04:35.760 --> 01:04:48.440]  So I suggest you sue him, you sue him and that's why I was mentioning 138, there's
[01:04:48.440 --> 01:04:58.080]  not a way to expedite things in court and primarily for the reason that the judge is
[01:04:58.080 --> 01:05:03.440]  thinking, I don't know all the particulars here, there may be a circumstance under which
[01:05:03.440 --> 01:05:10.840]  this person and this entity can have a claim and we have to give people who may have a
[01:05:10.840 --> 01:05:15.640]  claim opportunity to state their claim.
[01:05:15.640 --> 01:05:25.240]  Now if they have filed an answer and the answer does not establish their claim, you can ask
[01:05:25.240 --> 01:05:34.040]  that the answer be stricken based on a lack of showing of jurisdiction and you might get
[01:05:34.040 --> 01:05:38.440]  a toss but even if you do, they're going to have opportunity to appeal.
[01:05:38.440 --> 01:05:42.600]  It's going to take a long time.
[01:05:42.600 --> 01:05:47.720]  So the reason that I have my default is one, the statute of limitations is completely out

[01:33:58.560 --> 01:34:05.560]  I saw him look at me, and he flips a U-turn, and I figure, okay, the guy's going to pull me over.

[01:34:07.560 --> 01:34:11.560]  And so I pulled into a parking lot, a private parking lot,
[01:34:11.560 --> 01:34:17.560]  which they were registering so that way they can't move your stuff in case you do have to go to jail.
[01:34:17.560 --> 01:34:22.560]  So anyhow, the cop pulls up on me and immediately comes out and says,
[01:34:22.560 --> 01:34:29.560]  let me see your driver's license and stuff, and I already had their right to travel document.
[01:34:29.560 --> 01:34:34.560]  It states all kinds of cases, all the screws in it, everything, you know.
[01:34:34.560 --> 01:34:43.560]  And I told him, I said, well, I just need you to read this document and sign it stating that you're going to violate my license level.
[01:34:43.560 --> 01:34:49.560]  And immediately he goes, he pulls in on it and is like, I need a supervisor.
[01:34:49.560 --> 01:34:56.560]  And so I said, just read the license plate, and I said, you know, that's all you need to do, I guess.
[01:34:56.560 --> 01:35:00.560]  And we're good because he wanted my license.
[01:35:00.560 --> 01:35:04.560]  He saw my license, he said, all right, and I wouldn't give him to him.
[01:35:04.560 --> 01:35:06.560]  He goes, well, I just need your license right there.
[01:35:06.560 --> 01:35:09.560]  I said, no, I need to give you this.
[01:35:09.560 --> 01:35:17.560]  Well, anyhow, about a third of the Mesquite Police Department shows no.
[01:35:17.560 --> 01:35:21.560]  And they all are sitting there mocking and looking at it.
[01:35:21.560 --> 01:35:26.560]  And I guess the supervisor looks at it or blah, blah, blah, and he comes over.
[01:35:26.560 --> 01:35:34.560]  And then this other guy that comes over, he's, I don't know who he was, but he started grilling me.
[01:35:34.560 --> 01:35:41.560]  And then, you know, you get the standard procedure here now where they're just going to eat your butt out.
[01:35:41.560 --> 01:35:47.560]  And so called me a constitutionalist and all this other stuff, and it was kind of funny.
[01:35:47.560 --> 01:35:55.560]  But anyhow, they were at the one contract, but he goes, well, you've got to sign this or you're going to go to jail.
[01:35:55.560 --> 01:36:00.560]  I said, okay, I'll put on their underdress and sign it, and here you go.
[01:36:00.560 --> 01:36:02.560]  He goes, when's the next time you go into jail?
[01:36:02.560 --> 01:36:04.560]  I said, well, I can't recall.
[01:36:04.560 --> 01:36:07.560]  And he said, oh, we know exactly.
[01:36:07.560 --> 01:36:09.560]  It wasn't that long ago.
[01:36:09.560 --> 01:36:14.560]  So they already saw a lock wall in there and how I've been going through that little scenario.
[01:36:14.560 --> 01:36:18.560]  And so anyhow, that's when the other thing I've started doing,
[01:36:18.560 --> 01:36:21.560]  well, you know, you think you're a constitutionalist and all this stuff.

[01:36:23.560 --> 01:36:27.560]  Like for me, you've been getting some jailhouse lawyer advice.
[01:36:27.560 --> 01:36:30.560]  And, you know, you think you're writing this stuff up.
[01:36:30.560 --> 01:36:33.560]  And he started, you know, gives me the ticket.
[01:36:33.560 --> 01:36:37.560]  And I realized that we had an invalid license on there.
[01:36:37.560 --> 01:36:41.560]  So I whipped down up the Dallas County court papers
[01:36:41.560 --> 01:36:46.560]  and said I had this already adjudicated and dismissed.
[01:36:46.560 --> 01:36:50.560]  And they wouldn't even, they looked at it and I told them what it was.
[01:36:50.560 --> 01:36:51.560]  I said, you're right.
[01:36:51.560 --> 01:36:55.560]  This case has already been dismissed for an invalid license.
[01:36:55.560 --> 01:37:00.560]  And you can strike that, you know, look, we ain't reading no more of your documents.
[01:37:00.560 --> 01:37:03.560]  And we're going to keep this other one.
[01:37:03.560 --> 01:37:07.560]  And, you know, he started giving me all kinds of grief and stuff.
[01:37:07.560 --> 01:37:10.560]  And the big guy got really cocky.
[01:37:10.560 --> 01:37:12.560]  And he said, well, what are you going to do?
[01:37:12.560 --> 01:37:13.560]  You know, are you going to leave?
[01:37:13.560 --> 01:37:16.560]  You know, if you leave, you're going to get arrested, you know,
[01:37:16.560 --> 01:37:19.560]  because you're going to be driving an invalid license, you know.
[01:37:19.560 --> 01:37:23.560]  And I said, so you're telling me if I leave out of this fucking law
[01:37:23.560 --> 01:37:26.560]  and you're my partner, I'm going to jail?
[01:37:26.560 --> 01:37:30.560]  And he said, in fact, you know, you need to be free practically
[01:37:30.560 --> 01:37:34.560]  to walk on out and think you cannot violate law on that.
[01:37:34.560 --> 01:37:36.560]  I bet you can't do that either.
[01:37:36.560 --> 01:37:40.560]  I said, you just say you're just going to try to arrest me?
[01:37:40.560 --> 01:37:42.560]  So I can't tell you what to do.
[01:37:42.560 --> 01:37:45.560]  You know, I don't know exactly what he said.
[01:37:45.560 --> 01:37:49.560]  But anyhow, he said, well, what are you going to do?

[01:47:23.560 --> 01:47:32.560]  And so I, as the owner of that automobile, I wrote an affidavit up, took photographs,
[01:47:32.560 --> 01:47:42.560]  and which clearly proved that the lights are the proper light, proper part number.
[01:47:42.560 --> 01:47:48.560]  They are certified by the manufacturer, the light bulb, to produce a white light only.
[01:47:48.560 --> 01:47:56.560]  Anyway, so got a nice affidavit, got nice prints, and the court refused to allow the
[01:47:56.560 --> 01:48:02.560]  accused to enter that affidavit into the record.
[01:48:02.560 --> 01:48:08.560]  So I want to know what can be done to get them to accept the affidavit.
[01:48:08.560 --> 01:48:15.560]  Well, first, I would file criminally against the judge.
[01:48:15.560 --> 01:48:20.560]  Procedural due process.
[01:48:20.560 --> 01:48:32.560]  And then move to recuse the judge for judicial incompetence.
[01:48:32.560 --> 01:48:34.560]  That's a procedural due process violation.
[01:48:34.560 --> 01:48:44.560]  That's official oppression. That's a crime in Texas.
[01:48:44.560 --> 01:48:53.560]  Okay, how about the court clerk, who is the spokesman, would not allow the affidavit to be filed?
[01:48:53.560 --> 01:49:02.560]  The court clerk is, the judge is respondent superior for the clerk.
[01:49:02.560 --> 01:49:05.560]  Okay, gotcha.
[01:49:05.560 --> 01:49:13.560]  It's even better when you go after the guy who had nothing to do with it.
[01:49:13.560 --> 01:49:19.560]  He is not going to be happy when the clerk gets him accused criminally.
[01:49:19.560 --> 01:49:24.560]  Yeah, okay. All right, that works for me.
[01:49:24.560 --> 01:49:35.560]  Just an observation, Randy. You know, we're talking about the public taking action against public officials that violate their,
[01:49:35.560 --> 01:49:41.560]  you know, violate state statute, perhaps violate their oaths of office, violate whatever.
[01:49:41.560 --> 01:49:50.560]  And I just wanted to point out something. I was thinking today about one of the political candidates, Mr. Trump,
[01:49:50.560 --> 01:50:08.560]  how he has gone publicly against a judge and accused him publicly for being biased and prejudiced in handling a case against one of Trump's corporations.
[01:50:08.560 --> 01:50:25.560]  And also went public against the presumptive Democratic candidate for president, accusing her of high crimes and saying she needs to be in jail.
[01:50:25.560 --> 01:50:49.560]  And I thought, you know, I don't know a whole lot about Mr. Trump, but I will say that he's proving that the public can have a tremendous effect against these questionable public officials just by opening his mouth and saying something.
[01:50:49.560 --> 01:50:59.560]  Absolutely. Yeah, you know, I myself and other friends have been so timid about doing this.
[01:50:59.560 --> 01:51:10.560]  And I'm thinking, look at the example that's on a national scale right now. This guy's fearless. So just an observation.
[01:51:10.560 --> 01:51:21.560]  Yeah, and more of a should be. It's not as big a problem. You know, we're terrified of doing this, and there's no reason to be.
[01:51:21.560 --> 01:51:23.560]  No reason at all.
[01:51:23.560 --> 01:51:28.560]  Yeah, this is our duty.
[01:51:28.560 --> 01:51:54.560]  You know, he's accusing Clinton of outright lying and it's clear that she violated. Forget what it was specifically over the emails, but it's clear she violated the secrecy laws in putting these sensitive emails on a private server.
[01:51:54.560 --> 01:52:07.560]  She knew she wasn't supposed to do that. She didn't care. She's a high powered lawyer. She has no excuse and can't claim ignorance of the law. She's an officer of the court.
[01:52:07.560 --> 01:52:10.560]  Yeah, but she can't recall.
[01:52:10.560 --> 01:52:28.560]  Yeah, yeah, right. The other thing she lost, she lost over 30,000 secured private classified emails. They're just missing.
[01:52:28.560 --> 01:52:44.560]  You know, if I misplace my driver license and don't have it, I get questioned like crazy for just a stupid piece of paper. You know, should I get stopped?
[01:52:44.560 --> 01:53:00.560]  It's just, it's really, it's incredible. It's outrageous. And the public is so asleep at the wheel on all this stuff. I mean, there's criminal things that are getting exposed and it's like almost nobody's batting an eye at.
[01:53:00.560 --> 01:53:24.560]  Wait a minute. Wait a minute, Gary. You know, Luke Koo won the, when was the last time you saw someone conclusively win the nomination months before the caucuses, months before the convention?
[01:53:24.560 --> 01:53:26.560]  Yeah. Well, that's a good point you're making.
[01:53:26.560 --> 01:53:38.560]  And Luke, who's there? The Republicans hate him. Democrats hate him. This says the public's fed up.
[01:53:38.560 --> 01:53:48.560]  Well, you know, I was reading some comments today on Yahoo mail or Yahoo news and you know how credible they are. Anyway.
[01:53:48.560 --> 01:53:53.560]  Hey, hey, hey, if it's on the internet, it has to be true.
[01:53:53.560 --> 01:54:11.560]  I know they had an article about, about Clinton and about how something she said today and there were 1,033 comments and every one of them talked about what a criminal she is.
[01:54:11.560 --> 01:54:18.560]  So the public, the public is not buying the lie anymore, at least in her case.
[01:54:18.560 --> 01:54:27.560]  You know, the only thing I can say is Trump is an indication of how disgusted the public is.
[01:54:27.560 --> 01:54:37.560]  And frankly, I don't care what Trump's position is. I don't care what he thinks.
[01:54:37.560 --> 01:54:40.560]  He will be a gadfly.
[01:54:40.560 --> 01:54:47.560]  He will be somebody that's not in control, under control by either party.
[01:54:47.560 --> 01:54:52.560]  And I can't think of anything anyone better to have.
[01:54:52.560 --> 01:54:56.560]  Just because he's not in anybody's pocket.
[01:54:56.560 --> 01:55:02.560]  Well, you know, I pray for him every day that he doesn't get Vince fostered. You know what I mean?

[01:55:07.560 --> 01:55:22.560]  If we had him in as president, these other countries that's been dealing with these politicians, now they got a businessman and somebody who's not reluctant to tell them to go scratch.

[01:55:30.560 --> 01:55:42.560]  And just by the way, and this is not meant to promote him. I'm just promoting the stand that he's taken against this judge that's handling a case against him.

[01:55:46.560 --> 01:55:54.560]  But look at what he's done, like with that, who is that CNN reporter that did the debates?

[01:55:59.560 --> 01:56:02.560]  Yeah, she's just beautiful and got eyes that are wicked.

[01:56:05.560 --> 01:56:07.560]  You know, she's not there anymore.
[01:56:07.560 --> 01:56:10.560]  The other one, Katie Keurig, she's history.
[01:56:10.560 --> 01:56:20.560]  And now it looks like this Hillary is in serious trouble.
[01:56:20.560 --> 01:56:28.560]  And this guy, Bernie Sanders, looks like he could take California and win the nomination.
[01:56:28.560 --> 01:56:33.560]  Because her credibility is history. Nobody's ever challenged it publicly before.

[01:56:38.560 --> 01:56:47.560]  When Hillary Clinton, she was an aide in the White House when Nixon was in.
[01:56:47.560 --> 01:56:55.560]  And Nixon wanted nothing to do with her because he considered her an unscrupulous liar.
[01:56:55.560 --> 01:56:59.560]  And this is when she was 26.
[01:56:59.560 --> 01:57:01.560]  Yep.
[01:57:01.560 --> 01:57:05.560]  So she has a long reputation of this position.

[01:57:26.560 --> 01:57:30.560]  We don't need to be. If they retaliate, it's worse for them.

[01:57:32.560 --> 01:57:38.560]  Yeah, they need to toe the line when it comes to us because we're the ones that write the paychecks.
