[00:00.000 --> 00:05.800] The following newsflash is brought to you by the Lone Star Lowdown, providing your deli
[00:05.800 --> 00:13.400] bulletins for the commodities market, today in history, news updates, and the inside scoop
[00:13.400 --> 00:21.320] into the tides of the alternative.
[00:21.320 --> 00:26.760] Markets per Wednesday, the 4th of May, 2016, are currently treading with gold at $1,274.01
[00:26.760 --> 00:34.200] an ounce, silver $17.26 an ounce, Texas crude $43.65 a barrel, and Bitcoin is currently
[00:34.200 --> 00:42.920]  at about $448 U.S. currency.
[00:42.920 --> 00:48.480] Today in history, the year 1415, Protestant Christian reformers John Wycliffe and Jan
[00:48.480 --> 00:52.160] Haas are condemned as heretics at the Council of Constance.
[00:52.160 --> 00:55.920] This declaration led to the digging up and burning of Wycliffe's bones, who had died
[00:55.920 --> 01:01.000] a few decades before, with his ashes being dumped into a river, into the eventual execution
[01:01.000 --> 01:06.240] of Jan Haas by burning at the stake, yet another attempt at stamping out Protestantism via
[01:06.240 --> 01:13.080] the Catholic Inquisition today in history.
[01:13.080 --> 01:16.700] In recent news, White House spokesman Josh Earnest said concerning President Obama's
[01:16.700 --> 01:20.600] first visit to Flint, Michigan, in response to the lead poisoning crisis that has been
[01:20.600 --> 01:24.680] happening there, that, quote, this administration will continue to help mobilize the resources
[01:24.680 --> 01:28.440] necessary that will allow Flint to recover and come back stronger than ever.
[01:28.440 --> 01:30.480] This is not an exercise in finger pointing.
[01:30.480 --> 01:34.520] This is an exercise in asserting the responsibility that everybody has to make sure the people
[01:34.520 --> 01:37.360] of Flint have an opportunity to get back on their feet.
[01:37.360 --> 01:41.240] President Obama did declare a state of emergency in mid-January and ordered federal aid in
[01:41.240 --> 01:43.560] addition to the state and local response.
[01:43.560 --> 01:47.560] His first priority in Flint is to be updated on the federal response to the crisis and
[01:47.560 --> 01:55.080] is even meeting with some city residents.
[01:55.080 --> 01:58.920] Israel's Justice Minister Ayelet Shaked in an interview with the Washington Post stated
[01:58.920 --> 02:03.880] today that, quote, in the past, we've seen European leaders speaking against the Jews.
[02:03.880 --> 02:05.280] Now we see them speaking against Israel.
[02:05.280 --> 02:10.680] It is the same anti-Semitism of blood libel, spreading lies, distorting reality, and brainwashing
[02:10.680 --> 02:12.920] people into hating Israel and the Jews.
[02:12.920 --> 02:17.680] She went as far as to say that the supporters of movements such as BDS, which call for putting
[02:17.680 --> 02:21.520] economic and political pressure on Israel in order to achieve compliance with international
[02:21.520 --> 02:27.040] law and gain rights for Palestinians, are, quote, using the same kind of anti-Semitism,
[02:27.040 --> 02:30.560] but instead of saying they're against the Jews, they say that they're against Israel.
[02:30.560 --> 02:34.200] In response to comments made in recent weeks by members of Britain's Labor Party claiming
[02:34.200 --> 02:38.720] that Hitler was a Zionist and previous remarks by lawmakers that Israel's population should
[02:38.720 --> 02:43.560] be transported out of the Middle East to America, Shaked stated that, quote, today it is not
[02:43.560 --> 02:47.920] politically correct to be anti-Semitic, but being anti-Israeli is acceptable.
[02:47.920 --> 02:51.720] People who have such anti-Semitic views should not be allowed to hold central leadership
[02:51.720 --> 02:52.720]  positions.
[02:52.720 --> 03:09.960] This is Rick Rode with your Lowdown for May 4th, 2016.
[03:09.960 --> 03:36.520] Thank you for joining us, and we'll see you next time on Lowdown for May 4th, 2016.
[03:39.960 --> 03:54.840] Okay, we are back, Randy Kelton, packed with our radio, and we're going to Ryan in California.
[03:54.840 --> 03:58.160] Hello, Mr. Ryan, what do you have for us today?
[03:58.160 --> 03:59.160]  Hi, Randy.
[03:59.160 --> 04:02.160] Hopefully my connection is still good.
[04:02.160 --> 04:03.160]  Yes, yes, yes.
[04:03.160 --> 04:04.160]  Good sound.
[04:04.160 --> 04:05.160]  Okay.
[04:05.160 --> 04:06.160]  Okay, good.
[04:06.160 --> 04:07.160]  I'm glad.
[04:07.160 --> 04:14.800] I don't know how to make this simple at all, but I had a call with regard to a case back
[04:14.800 --> 04:17.240]  in 2007.
[04:17.240 --> 04:23.760] I was cultivating marijuana within the county limits and with a medical prescription.
[04:23.760 --> 04:30.320] And what I was led to believe, following a name change on my electric bill, PG&E's billing
[04:30.320 --> 04:35.480] department flagged their own legal department, who in turn contacted the county sheriff with
[04:35.480 --> 04:37.560]  a concern about my electric usage.
[04:37.560 --> 04:43.000] PG&E provided the sheriff department with my bill, then the sheriff used this bill,
[04:43.000 --> 04:48.200] and some photos of somebody's trash cans with stems and twigs wrapped up in a newspaper
[04:48.200 --> 04:51.200]  to a judge to issue a search warrant.
[04:51.200 --> 04:59.040] About half a dozen sheriffs served this warrant in January of 2007 when I was away at lunch.
[04:59.040 --> 05:01.960] When I returned, they searched me and my girlfriend.
[05:01.960 --> 05:03.240]  They let her leave.
[05:03.240 --> 05:07.680] I was told I wasn't under arrest, but not allowed to leave or move around in my own
[05:07.680 --> 05:08.680]  home.
[05:08.680 --> 05:13.040] They emptied my pockets and interrogated me for about two and a half hours.
[05:13.040 --> 05:16.240] I knew in my gut from the start they didn't have any right to be in my house.
[05:16.240 --> 05:22.000] There was no reason for them to be there that I was aware of.
[05:22.000 --> 05:26.400] Intermittently, various officers approached me with questions and making subtle threats.
[05:26.400 --> 05:31.360] They didn't seem to act like law enforcement, so half the time I believed that I was being
[05:31.360 --> 05:35.000] robbed and my life was in danger.
[05:35.000 --> 05:40.480] They threatened to make mine a federal case sometime during that as well.
[05:40.480 --> 05:45.160] They did a real good job convincing me that I broke the law, but wasn't under arrest.
[05:45.160 --> 05:50.000] So I decided to get them out of my house any way possible.
[05:50.000 --> 05:54.760] So I told them that I intended to sell any extra marijuana that I might have someday
[05:54.760 --> 06:00.120]  to a licensed club or a dispensary.
[06:00.120 --> 06:04.880] I didn't say that I had any extra, but I was in possession of one pound and had some
[06:04.880 --> 06:07.440] plants growing in my garage.
[06:07.440 --> 06:11.880] They took $800 from my safe and took my medicine and all my plants.
[06:11.880 --> 06:16.360] At the end, one of the sheriff's deputies handed me a business card and told me I could
[06:16.360 --> 06:19.280] start growing again, but only if it was for myself.
[06:19.280 --> 06:25.960] Now, four months later, the DA mailed me a summons regarding a complaint filed, which
[06:25.960 --> 06:29.800] included two felony counts and one misdemeanor count.
[06:29.800 --> 06:36.600] I retained an attorney who took my case on from start to finish, so she said, for $10,000.
[06:36.600 --> 06:42.460] They dragged on for almost two years and the closer we got to trial, the more my attorney
[06:42.460 --> 06:47.560] complained about having run out of money and wanted to dismiss herself from my case.
[06:47.560 --> 06:52.240] The attorney filed a request to have the public defender sign to me and directed me to fill
[06:52.240 --> 06:58.240] out a financial form fraudulently so that I would qualify for free representation.
[06:58.240 --> 07:01.760] The judge asked the attorney why she wanted to be dismissed and she responded accurately
[07:01.760 --> 07:03.800] that I could not afford her service.
[07:03.800 --> 07:06.040]  Accurately, I couldn't afford anyone else's service.
[07:06.040 --> 07:12.400] By the way, I later found she was disbarred from Texas.
[07:12.400 --> 07:17.160] The judge then asked me if what she stated was accurate and if that's what I wish to
[07:17.160 --> 07:18.160]  do.
[07:18.160 --> 07:21.320] I informed the judge that I have paid her up front and am told to represent me through
[07:21.320 --> 07:22.320]  trial.
[07:22.320 --> 07:26.880] I did not wish to retain any other attorney and in truth, I didn't want to be implicated
[07:26.880 --> 07:31.200] or associated with defrauding the court of the state of California, so she stayed on
[07:31.200 --> 07:32.200]  reluctantly.
[07:32.200 --> 07:38.080] Now, my attorney and the assistant DA made a deal for one count of felony cultivation
[07:38.080 --> 07:46.240] to which I played no contest, which I was sentenced on 60 days community service, jaded
[07:46.240 --> 07:51.320] fees and penalties, three years probation without circumceder, no jail time or drug
[07:51.320 --> 07:58.120] classes and included with a promise to expunge my case at completion of probation.
[07:58.120 --> 08:04.440] I did all the above and hired a different attorney to file a motion 17B.
[08:04.440 --> 08:10.040] The first judge refused to hear the motion and he yelled at the lawyers to get out of
[08:10.040 --> 08:12.200]  his court.
[08:12.200 --> 08:14.440]  Very confusing and a little frightening.
[08:14.440 --> 08:19.720] The second judge heard the motion and allowed me to, if I'm using the word correctly, revoke
[08:19.720 --> 08:27.080] my plea of no contest and enter a plea of not guilty by reopening my original case.
[08:27.080 --> 08:34.160] The felony was dismissed and the misdemeanor was reintroduced as a charge or I was recharged
[08:34.160 --> 08:36.680]  with a misdemeanor to which I fled not guilty.
[08:36.680 --> 08:40.880] I was informed that my rights at that point were restored.
[08:40.880 --> 08:45.200] The clerk's office never sent my expungement or the court minutes to DOJ.
[08:45.200 --> 08:49.840] This was in 2011 by this time.
[08:49.840 --> 08:56.960] I went and just recently this year, having to work security now, I used to be a chiropractor.
[08:56.960 --> 08:59.560] I went to purchase a gun for my security job and got denied.
[08:59.560 --> 09:05.400] I went back to the court and got the papers sent off to the DOJ.
[09:05.400 --> 09:08.520] That court actually laughed at me and said, we don't arrest people for things like that
[09:08.520 --> 09:09.520]  these days.
[09:09.520 --> 09:13.440] I went to purchase a second gun and it was denied again.
[09:13.440 --> 09:14.440]  I called the court.
[09:14.440 --> 09:20.360] I found a mistake and was really confused by the proceedings because they weren't very
[09:20.360 --> 09:21.360]  common.
[09:21.360 --> 09:25.960] She was never seen anything like that before.
[09:25.960 --> 09:31.680] That leads us right about to today where I have been without my chiropractic license
[09:31.680 --> 09:39.960] of practice since 2009, lost my gun rights until whenever the DOJ processes the paperwork
[09:39.960 --> 09:40.960]  if they do.
[09:40.960 --> 09:45.520] Lost my practice, my home, two cars, all my possessions and valuables, destroyed my credit
[09:45.520 --> 09:47.960] and defaulted on my student loans.
[09:47.960 --> 09:54.800] I didn't know anything obviously about common law or my rights at this time.
[09:54.800 --> 10:01.480] I've just over the last year or so been learning as much as possible about the right to travel.
[10:01.480 --> 10:06.160] I don't know what to do if anything from here about this case.
[10:06.160 --> 10:14.200] Okay, what would you like to achieve?
[10:14.200 --> 10:15.680] What do you want to do?
[10:15.680 --> 10:23.600] Well, I feel like filling my rights were violated in several different ways.
[10:23.600 --> 10:26.480]  I don't want to sound like a victim, but I do feel victimized.
[10:26.480 --> 10:27.720]  Okay, hold on.
[10:27.720 --> 10:33.520] At the end of the day, how would you like things to be different?
[10:33.520 --> 10:39.000] What would you like to achieve as a ultimate outcome?
[10:39.000 --> 10:46.160] As an ultimate outcome, I would like for justice to be served on those who trespass against
[10:46.160 --> 10:47.160]  me.
[10:47.160 --> 10:48.160]  Okay, hold on.
[10:48.160 --> 10:49.160]  Forget about justice.
[10:49.160 --> 10:50.160]  Okay.
[10:50.160 --> 10:56.840] The system is not just, never has been and never will be.
[10:56.840 --> 11:03.440] I know they talk about justice in high school and all that, but when we get out here looking
[11:03.440 --> 11:11.800] for justice, justice is so subjective that nobody can really define what it is.
[11:11.800 --> 11:23.960] In order to achieve some outcome, we need to determine some place that you want to get
[11:23.960 --> 11:25.800]  to.
[11:25.800 --> 11:37.440] If you could reach this point, then is this something that you could live with?
[11:37.440 --> 11:39.240]  I know this sounds harsh, but-
[11:39.240 --> 11:42.480]  Well, that's very clear.
[11:42.480 --> 11:43.480]  Yeah.
[11:43.480 --> 11:51.560] If you're trying to secure justice from the system, you will be continually disappointed.
[11:51.560 --> 11:58.320] One of the dangers of getting into these kinds of circumstances, especially when you didn't
[11:58.320 --> 12:06.320] know what was going on in the beginning and they really rolled rough shot over you, is
[12:06.320 --> 12:13.360] if you're not careful, it becomes about the fight and not about an outcome.
[12:13.360 --> 12:18.080] I had a friend that helped people with IRS issues.
[12:18.080 --> 12:19.080]  She was in Pennsylvania.
[12:19.080 --> 12:23.520] They sent her to the next door neighbors who had some IRS tax liens they were trying to
[12:23.520 --> 12:25.560]  get rid of.
[12:25.560 --> 12:28.320] She sat down and asked them, what do you want to do?
[12:28.320 --> 12:29.680] I want to get rid of these liens.
[12:29.680 --> 12:30.680] She looked at them and said, okay.
[12:30.680 --> 12:32.360] She tore them up and threw them in the trash.
[12:32.360 --> 12:33.360]  They're gone.
[12:33.360 --> 12:35.640] Now what do you want?
[12:35.640 --> 12:36.640]  They were flabbergasted.
[12:36.640 --> 12:43.160] She said, guys, these liens expired two years ago and the IRS didn't reinstate them.
[12:43.160 --> 12:44.160]  They're gone.
[12:44.160 --> 12:47.360] What do these people do?
[12:47.360 --> 12:57.160] They sent a blistering letter to the IRS and when the IRS did, they reinstated the liens.
[12:57.160 --> 13:06.680] At the end of the day, where would you like to be to get yourself back in a position where
[13:06.680 --> 13:08.600] you can restart your life?
[13:08.600 --> 13:18.880] You may be able to get justice, but not if you're being run over by a truck.
[13:18.880 --> 13:22.080] First we need to get stabilized.
[13:22.080 --> 13:29.040] What would it take to get you back in a stable position?
[13:29.040 --> 13:36.000] I would say having my chiropractic license reinstated, which I have that paperwork in
[13:36.000 --> 13:42.960] the works, I don't know if it'll be successful, and to have my property returned, to have
[13:42.960 --> 13:52.080] what I lost restored, and having a history in the medical profession, I would use the
[13:52.080 --> 13:56.720]  term pre-injury status in some sort.
[13:56.720 --> 13:57.720]  Okay.
[13:57.720 --> 14:03.040] Of course, I defaulted on my loans and everything, too, and that may have prohibited me from
[14:03.040 --> 14:07.960]  getting back my license.
[14:07.960 --> 14:11.600]  I guess I'm looking for reprimand.
[14:11.600 --> 14:12.600]  Okay.
[14:12.600 --> 14:13.600]  Yeah.
[14:13.600 --> 14:21.240] I understand that you want to be paid back for the harm, but in order to get paid back
[14:21.240 --> 14:26.760] from the harm, you have to be in a position where you can fight them.
[14:26.760 --> 14:36.760] One of the things that these guys do is they try to grind you down to you can't fight them.
[14:36.760 --> 14:43.000]  My suggestion is let's find a way to get re-stabilized.
[14:43.000 --> 14:46.840] They don't like people who can fight them.
[14:46.840 --> 14:52.360] Once you're out from under the criminal, are you out from under criminal that will cost
[14:52.360 --> 14:56.880] you your liberty at this point?
[14:56.880 --> 14:57.880]  I believe so.
[14:57.880 --> 15:06.880] I think that as of yesterday, the DOJ at least has been informed of the amended paperwork
[15:06.880 --> 15:10.480] sent to them, and I'm out of way of harm.
[15:10.480 --> 15:13.120]  I do have a steady job now.
[15:13.120 --> 15:14.120]  Okay.
[15:14.120 --> 15:18.040] Liberty for me is the most important thing.
[15:18.040 --> 15:24.720] I am very reluctant to suggest that somebody do something that can cost them their liberty.
[15:24.720 --> 15:28.400] You're mentioning the right to travel issue.
[15:28.400 --> 15:34.280] I'm going to suggest leave that fight to me or to Eddie Craig or to somebody else.
[15:34.280 --> 15:40.320] You got bigger battles to fight, and I've been doing this show for a long time.
[15:40.320 --> 15:46.680] I've been researching this kind of thing for 30 years, and I'm just now taking on the travel
[15:46.680 --> 15:48.400]  issue just for yucks.
[15:48.400 --> 15:55.880] I really don't care about it because I have really more important fights to fight, and
[15:55.880 --> 16:02.840] the one I'm fighting is the one that will give us an underlying structure that we can
[16:02.840 --> 16:06.200] use to win things like the travel issue.
[16:06.200 --> 16:09.600] Pick your battles really carefully is my point.
[16:09.600 --> 16:19.360] I think what's it going to take to get your chiropractic license back?
[16:19.360 --> 16:29.120] Hearing with the state board and of course clean live scan fingerprint.
[16:29.120 --> 16:30.960]  What are the requirements?
[16:30.960 --> 16:34.680] How did you get... How did they cancel it to start with?
[16:34.680 --> 16:39.600] Come on, about to go to break, and that's going to take us out because your voice sounds

[18:00.840 --> 18:05.440] Through advances in technology, our lives have greatly improved, except in the area
[18:05.440 --> 18:06.840]  of nutrition.
[18:06.840 --> 18:11.600] People feed their pets better than they feed themselves, and it's time we changed all that.
[18:11.600 --> 18:17.280] Our primary defense against aging and disease in this toxic environment is good nutrition.
[18:17.280 --> 18:23.640] In a world where natural foods have been irradiated, adulterated, and mutilated, young Jevity can
[18:23.640 --> 18:26.160] provide the nutrients you need.
[18:26.160 --> 18:30.760] Logos Radio Network gets many requests to endorse all sorts of products, most of which
[18:30.760 --> 18:31.880]  we reject.
[18:31.880 --> 18:37.120] We have come to trust young Jevity so much, we became a marketing distributor, along with
[18:37.120 --> 18:39.920] Alex Jones, Ben Fuchs, and many others.
[18:39.920 --> 18:46.320] When you order from logosradionetwork.com, your health will improve as you help support
[18:46.320 --> 18:47.320]  quality radio.
[18:47.320 --> 18:51.880] As you realize the benefits of young Jevity, you may want to join us.
[18:51.880 --> 18:57.440] As a distributor, you can experience improved health, help your friends and family, and
[18:57.440 --> 18:59.440]  increase your income.
[18:59.440 --> 19:00.440]  Order now.
[19:00.440 --> 19:05.440] You are listening to the Logos Radio Network, logosradionetwork.com.
[19:05.440 --> 19:10.440] Well, don't let nothing get to you.
[19:10.440 --> 19:15.440] Only the Father can deliver you.
[19:15.440 --> 19:22.440] Don't let bad-minded people hurt you until they can get behind you.
[19:22.440 --> 19:30.720] Norman, my friend, and all of your children.
[19:30.720 --> 19:31.720] We are back from break.
[19:31.720 --> 19:34.960] This is Rule of Law Radio with Randy Kelton and Ben Pack.
[19:34.960 --> 19:38.960] We are on the air with Ryan from California.
[19:38.960 --> 19:42.760]  Okay, Ryan.
[19:42.760 --> 19:47.960] In order to be able to fight these fights, we have to have some tools to fight them with.
[19:47.960 --> 19:55.360] JP Morgan once said, don't worry about the radical rabble.
[19:55.360 --> 20:00.600] They don't even have the money for bus fare to get to their rallies.
[20:00.600 --> 20:03.520] And to a large degree, he was right.
[20:03.520 --> 20:09.440] If we're going to seriously fight this battle, the first thing we have to do is get ourselves
[20:09.440 --> 20:13.800] in a position to where they can't push us around so easy.
[20:13.800 --> 20:24.400] And since you have a chiropractic lessons, I have a question about the student loan.
[20:24.400 --> 20:28.840] How does that affect your ability to restore your license?
[20:28.840 --> 20:33.600] Well, it was brought up to the board.
[20:33.600 --> 20:41.640] I think it's maybe a requirement, and it may depend if they enforce this in my case.
[20:41.640 --> 20:47.400] But it is said that if you are on default of your student loan, they may retain the
[20:47.400 --> 20:52.760] right to refuse re-licensure or new licenses and so forth.
[20:52.760 --> 20:56.840]  I'm looking for reinstatement, so it's a similar category.
[20:56.840 --> 20:57.840]  Okay.
[20:57.840 --> 21:04.640] The first thing I suggest is get a hold of whoever is adjudicating your student loan
[21:04.640 --> 21:12.960] and see if you can get them to reinstate because they don't want to default your student loan.
[21:12.960 --> 21:15.080] All they care about is collecting money.
[21:15.080 --> 21:23.000] And if you go to the arm and indicate that you had an interruption in your practice and
[21:23.000 --> 21:29.800] that you have that taken care of and you would like to reinstate your loan and start paying
[21:29.800 --> 21:37.960] it off again, very likely that they will bend over backwards to get you back on their books.
[21:37.960 --> 21:44.560] So all you have to do is get them to refinance that loan and you can get back on the books
[21:44.560 --> 21:48.160] and get in good standing there.
[21:48.160 --> 21:52.160] What else would prevent you from getting your license back?
[21:52.160 --> 21:56.120]  Let's see.
[21:56.120 --> 22:01.480] If they charged exorbitant fees, of course, I'd need to be able to afford those.
[22:01.480 --> 22:08.320] There is the possibility that because, and this ties into the answer to a previous question
[22:08.320 --> 22:17.640] you'd have, because the license was revoked by default, that they may be able to waive
[22:17.640 --> 22:19.640]  those fees.
[22:19.640 --> 22:24.520]  Okay.
[22:24.520 --> 22:28.640] What would it take to get them to waive those fees?
[22:28.640 --> 22:36.200] What I'm going to suggest is put justice behind you for the moment.
[22:36.200 --> 22:38.200] Justice is always going to be there waiting for you.
[22:38.200 --> 22:42.240] You can go after these guys anytime you want to.
[22:42.240 --> 22:47.920]  This is for a large degree what I do.
[22:47.920 --> 22:52.280] I had a bailiff drag me down the stairs once, shove me out the door, knock me down, break
[22:52.280 --> 22:55.560]  my elbow.
[22:55.560 --> 23:06.080] That really, really hurt and I was really, really upset at that bailiff, but I looked
[23:06.080 --> 23:14.280] at my goals and what was I trying to achieve and I asked myself, will that help me toward
[23:14.280 --> 23:18.360]  my intended ultimate outcome?
[23:18.360 --> 23:23.680] I couldn't find any way of framing that to where it would help me toward my ultimate
[23:23.680 --> 23:24.680]  outcome.
[23:24.680 --> 23:29.920] I had to just let that go, put it behind me.
[23:29.920 --> 23:35.640] Once I got in a position to where I could do something, then I come back after it.
[23:35.640 --> 23:41.080] After I got in a position where I could, it turned out it wasn't important.
[23:41.080 --> 23:43.480] It did not be done on purpose.
[23:43.480 --> 23:44.880]  It is.
[23:44.880 --> 23:51.680] Just because they did something wrong, you don't have to fight that fight now.
[23:51.680 --> 23:56.680] I was in the military and I was in combat and I was a good combat soldier.
[23:56.680 --> 24:00.480] You did not want me after you.
[24:00.480 --> 24:03.160] You're not going to make me angry.
[24:03.160 --> 24:04.160] You're not going to get me flustered.
[24:04.160 --> 24:07.060]  If I'm coming after you, I'm coming after you.
[24:07.060 --> 24:11.440] You're not going to get me to do something stupid.
[24:11.440 --> 24:21.280] There's a story about Henry V. Fighting with the French, he couldn't get at them to attack,
[24:21.280 --> 24:29.320] so he launched a set of longbows at them, fired arrows into their ranks and it upset
[24:29.320 --> 24:39.320] them so much they charged parallel into him and 500 took on 10,000 because 500 were disciplined
[24:39.320 --> 24:42.040]  and 10,000 were not.
[24:42.040 --> 24:47.480] They ran into a muddy field where they couldn't fight and they just slaughtered them.
[24:47.480 --> 24:49.520]  Let's get serious.
[24:49.520 --> 24:51.280]  Let's get mean.
[24:51.280 --> 24:54.000]  Let's get focused.
[24:54.000 --> 25:00.320] From what I hear from you, the most important thing you can do is get your license back,
[25:00.320 --> 25:06.920] get re-stabilized and once you're back in a position of strength, then we can come back
[25:06.920 --> 25:10.200] after these guys and I can show you how to do that.
[25:10.200 --> 25:16.520] I can show you how to do that where they can't come after you.
[25:16.520 --> 25:18.240]  I do this.
[25:18.240 --> 25:24.320] I just filed first degree felony aggravated assault charges against my district judge
[25:24.320 --> 25:29.520] because he had a bailiff touch me.
[25:29.520 --> 25:33.720] When he figured out I wasn't impressed with him touching me and I asked a bailiff if that
[25:33.720 --> 25:37.880] pistol was loaded, the judge figured out I was setting him up and told the bailiff to
[25:37.880 --> 25:38.880]  back off.
[25:38.880 --> 25:39.880]  Sorry, Bubba.
[25:39.880 --> 25:40.880]  Too late.
[25:40.880 --> 25:49.320] That bell's already been rung and I'm coming after him, first degree felony aggravated
[25:49.320 --> 25:54.320] assault with something so minor he can't believe it.
[25:54.320 --> 25:55.320]  Don't mess with me.
[25:55.320 --> 25:57.920] When I'm coming after you, I'm going to set you up.
[25:57.920 --> 26:01.920]  I'm not going to let you lead me into a fight I can't win.
[26:01.920 --> 26:10.640] So I take it that, you know, I was concerned when you first spoke of this that your license
[26:10.640 --> 26:14.560] was revoked because maybe there was a felony against you and you can't have a license
[26:14.560 --> 26:18.800] if you're a felony, that there was something really hard and fast that would absolutely
[26:18.800 --> 26:23.120] prevent you from getting it, but I take it that's not the case, that these are more
[26:23.120 --> 26:27.560] administrative issues that you could get sorted out?
[26:27.560 --> 26:36.440] Well, I don't know that for a fact, but because it has been expunged now, I do have a fighting
[26:36.440 --> 26:41.440] chance and I did want to take a moment, if it's all right, to respond to a question
[26:41.440 --> 26:47.600] that you asked me a couple of minutes ago and which was how exactly did the license
[26:47.600 --> 26:48.600]  get revoked?
[26:48.600 --> 26:55.280] And I have a short answer and it is the Attorney General, I believe, of California informed
[26:55.280 --> 27:00.240] the board of the charges and the worst possible details of the investigation and then finally
[27:00.240 --> 27:02.800]  the felony conviction.
[27:02.800 --> 27:07.720] The board in turn mailed me two letters of inquiry to my friend's office where my new
[27:07.720 --> 27:14.200] practice was registered and I had started practicing there and he, who was my classmate
[27:14.200 --> 27:20.440] years ago, thought fit to return those letters to the board instead of calling me or forwarding
[27:20.440 --> 27:25.440] the letters to me, but it was revoked by default that I didn't answer them.
[27:25.440 --> 27:28.240]  Hold on, back up.
[27:28.240 --> 27:31.280] Who asked him to return those letters?
[27:31.280 --> 27:34.440]  Well, no, that was his self-directed.
[27:34.440 --> 27:40.080] Oh, so he just returned them because we weren't there?
[27:40.080 --> 27:43.840]  Okay, here's the thing about defaults.
[27:43.840 --> 27:46.200]  He's taking my calls.
[27:46.200 --> 27:49.000]  Wait, I'm sorry.
[27:49.000 --> 27:56.120] My mistake, if I'm speaking and you're speaking, our suppressor should push your voice down
[27:56.120 --> 27:57.120]  below me.
[27:57.120 --> 28:01.160] So we both started to talk at the same time and I stepped on you, I'm sorry.
[28:01.160 --> 28:03.160] Say that last part again.
[28:03.160 --> 28:07.760]  Oh, that's okay, but I didn't mean to interrupt.
[28:07.760 --> 28:15.880] No, that was self-directed and I don't know the answer to that question because at this
[28:15.880 --> 28:19.200] point he stopped returning my call.
[28:19.200 --> 28:27.320] Okay, so this is, if they have a default, the default's not too bad.
[28:27.320 --> 28:32.600] That's not so hard to get over and for the most part, the board doesn't want to revoke
[28:32.600 --> 28:39.280] your license and they'll only do it if they feel they have to and almost certainly, how
[28:39.280 --> 28:42.000]  much time has passed?
[28:42.000 --> 28:46.160]  Well, since 09, September.
[28:46.160 --> 28:52.400] 09, so that's seven years, they almost certainly, there's been enough time to pass and if you
[28:52.400 --> 28:59.920] go back to them now and petition for reinstatement and give them any kind of reason, very likely
[28:59.920 --> 29:05.080] they'll reinstate you because they don't want you to, they don't want to take your license
[29:05.080 --> 29:06.080]  away from you.
[29:06.080 --> 29:11.440] This is not something they'd like to do and in the end, everything's political.
[29:11.440 --> 29:18.360] If you just start working the political side, go to them, guys, what do you need to get
[29:18.360 --> 29:19.360]  this resolved?
[29:19.360 --> 29:25.800] What do I need to do to show you that you don't need to revoke my license?
[29:25.800 --> 29:29.560] Almost certainly you'll be able to get this fixed.
[29:29.560 --> 29:31.560] Hang on, we're about to go to break.
[29:31.560 --> 29:34.640] Vette, you want to bring this out?
[29:34.640 --> 29:39.560] All right, this is Randy Hilton and Vette Pack for Rule of Roll Radio.
[29:39.560 --> 29:43.960]  Give us a call at 405-12646-1984.
[29:43.960 --> 30:08.400] Flame it on bottled water or changing tastes, but in the US, sales of milk have slumped
[30:08.400 --> 30:13.600] to their lowest level in decades and Dr. Catherine Albrecht in a moment shall talk about why
[30:13.600 --> 30:17.280] Americans are drinking far less milk.
[30:17.280 --> 30:19.000]  Privacy is under attack.
[30:19.000 --> 30:23.400] When you give up data about yourself, you'll never get it back again and once your privacy
[30:23.400 --> 30:27.560] is gone, you'll find your freedoms will start to vanish too.
[30:27.560 --> 30:33.240] So protect your rights, say no to surveillance and keep your information to yourself.
[30:33.240 --> 30:35.360]  Privacy, it's worth hanging on to.
[30:35.360 --> 30:40.960] This message is brought to you by Startpage.com, the private search engine alternative to Google,
[30:40.960 --> 30:42.680]  Yahoo and Bing.
[30:42.680 --> 30:46.280]  Start over with Startpage.
[30:46.280 --> 30:50.400] Chocolate chip cookies and bowls of cereal must be feeling lonely because milk consumption
[30:50.400 --> 30:55.040] in America has slumped to an all-time low with more than half of adults no longer drinking
[30:55.040 --> 30:56.480]  it at all.
[30:56.480 --> 31:00.920] Last year, total milk beverage sales were about 6 billion gallons, the lowest since
[31:00.920 --> 31:01.920]  1984.
[31:01.920 --> 31:07.000] Far behind soda, bottled water and beer, so what's going on?
[31:07.000 --> 31:08.800]  Consumer tastes have changed.
[31:08.800 --> 31:12.880] Energy drinks and bottled teas have arrived and the public is afraid of the antibiotics
[31:12.880 --> 31:15.080] and synthetic hormones used on cows.
[31:15.080 --> 31:18.680] But don't worry milk lovers, there is some good news.
[31:18.680 --> 31:23.280] Organic milk sales are up 20%, even while regular milk sales fell.
[31:23.280 --> 31:31.280] I'm Dr. Catherine Albrecht for Startpage.com, the world's most private search engine.
[31:31.280 --> 31:35.640] Did you know there are 3 million edible food plants on earth and none have the nutritional
[31:35.640 --> 31:37.320] value of the hemp plant?
[31:37.320 --> 31:40.200]  HempUSA.org offers you hemp protein powder.
[31:40.200 --> 31:45.760] It does not contain chemicals or THC, is non-GMO and is 100% gluten-free.
[31:45.760 --> 31:50.960] Hemp protein powder burns fat, builds muscle, contains 53% protein and feeds the body the
[31:50.960 --> 31:52.320]  nutrients it needs.
[31:52.320 --> 32:02.760] Call 888-910-4367 and see what our powder, seeds and oil can do for you, only at HempUSA.org.
[32:02.760 --> 32:05.600] Rule of Law Radio is proud to offer the rule of law traffic seminar.
[32:05.600 --> 32:09.440] In today's America, we live in an us-against-them society and if we the people are ever going
[32:09.440 --> 32:13.080] to have a free society, then we're going to have to stand and defend our own rights.
[32:13.080 --> 32:16.600] Among those rights are the right to travel freely from place to place, the right to act
[32:16.600 --> 32:20.640] in our own private capacity and most importantly, the right to due process of law.
[32:20.640 --> 32:24.880] The courts afford us the least expensive opportunity to learn how to enforce and preserve our rights

[33:02.600 --> 33:19.920]  Live, free speech radio, logosradionetwork.com.
[33:19.920 --> 33:43.000] Okay, we are back, Randy Kelton, VetPak, Rule of Law Radio, and we're talking to Ryan in
[33:43.000 --> 33:44.000]  California.
[33:44.000 --> 33:45.000]  So, Ryan.
[33:45.000 --> 33:46.000]  Yes, sir.
[33:46.000 --> 33:50.560] What do you think it would take to get your license back?
[33:50.560 --> 33:59.640] Well, I filled out all the paperwork that I know to fill out.
[33:59.640 --> 34:06.920] I was informed by the board that returning an attorney wouldn't be necessary.
[34:06.920 --> 34:13.800] It would be too expensive for me, but I don't want to do it wrong either.
[34:13.800 --> 34:22.240] There is a stipulation, once you are approved or are scheduled for a hearing, if there's
[34:22.240 --> 34:27.040] any reason for denial, you have to wait another year before you can even apply, and then you
[34:27.040 --> 34:28.600] go back on the waiting list.
[34:28.600 --> 34:36.400] I've been waiting since, oh gosh, October, I believe, and they have quarterly meetings.
[34:36.400 --> 34:42.240] So, I did fill out their forms, and yeah.
[34:42.240 --> 34:47.120] Can you apply in another state?
[34:47.120 --> 34:48.120]  That would be nice.
[34:48.120 --> 34:51.240]  I don't believe that it's possible.
[34:51.240 --> 34:55.160] They do, certain states have reciprocation.
[34:55.160 --> 35:02.040] We have national licensing examinations and so forth, and there is some reciprocation
[35:02.040 --> 35:03.280]  between states.
[35:03.280 --> 35:07.480] For example, my California license was in good standing.
[35:07.480 --> 35:11.720] I could go to Washington, pay MSD, fill out some forms, and have a license in Washington,
[35:11.720 --> 35:15.360] but not necessarily in Oregon, there'd be some extra tests.
[35:15.360 --> 35:20.320] I suppose that it's possible that I could apply in other states.
[35:20.320 --> 35:23.320]  I haven't held a hope.
[35:23.320 --> 35:24.320]  Well, okay.
[35:24.320 --> 35:30.720] So, let's say you're in California, and your license gets revoked there, and your
[35:30.720 --> 35:36.120] parents live in Washington state, and they're ill, and you have to go to Washington state
[35:36.120 --> 35:41.400] and stay there and take care of your parents, but you need your license back.
[35:41.400 --> 35:48.440] Is going to be a provision to where you can go to the state of Washington and ask them
[35:48.440 --> 35:57.200] to review the revocation in California and reinstate your license from Washington.
[35:57.200 --> 36:06.240] If they have reciprocity, they're going to have reciprocity both ways.
[36:06.240 --> 36:09.680]  That's an interesting concept right there.
[36:09.680 --> 36:15.120] That is something that you could request.
[36:15.120 --> 36:18.800] People call me about law, and I'm not an attorney.
[36:18.800 --> 36:30.040] A lot of times, most of what I do is I look at things and think, what would a reasonable
[36:30.040 --> 36:36.520] person of ordinary prudence think in this circumstance, or what would a reasonable person
[36:36.520 --> 36:42.560] of ordinary prudence do in these circumstances to handle these issues?
[36:42.560 --> 36:50.320] If something seems like it ought to be a certain way, it almost always is, and when I go back
[36:50.320 --> 36:53.840] and check the law, it almost always comes out that way.
[36:53.840 --> 37:00.560] That's if we can think of things from a neutral perspective.
[37:00.560 --> 37:05.520] If we look at things just from our own focused individual perspective, we sometimes get all
[37:05.520 --> 37:12.520] screwed up, but from a neutral party perspective, what is right, just, and reasonable, I find
[37:12.520 --> 37:18.760] is almost always the case in law.
[37:18.760 --> 37:26.080] If you have to move to another state for some reason, if there is reciprocity, there is
[37:26.080 --> 37:34.240] certainly reciprocity that goes to reinstating your license.
[37:34.240 --> 37:42.520] You might look at the states that have the least stringent requirements, the ones that
[37:42.520 --> 37:50.760] need chiropractors more than another state, so that once you get reinstated there, then
[37:50.760 --> 37:58.760] you can come back to California or anywhere else and be able to just transfer it.
[37:58.760 --> 38:18.840] There is more than one way of getting at this thing.
[38:18.840 --> 38:24.880] You might start questioning and finding out which states need chiropractors more than
[38:24.880 --> 38:33.320] others, or which states are more likely to reinstate you.
[38:33.320 --> 38:34.320]  That shouldn't take too long.
[38:34.320 --> 38:43.720] That's a great idea, and you know, Randy, what I actually feel slightly more hopeful
[38:43.720 --> 38:51.040] hearing that than years ago when I considered it for myself the first time is that, let's
[38:51.040 --> 38:58.660] say the Pacific Northwest, due to its proximity and its beauty, I should love it up there
[38:58.660 --> 39:06.760] and wouldn't mind living there, they had a very bleak view, legally speaking, of marijuana,
[39:06.760 --> 39:14.160] and I did not want to risk taking that history up there for them to review.
[39:14.160 --> 39:22.840] In the last few years, their laws have gone very different.
[39:22.840 --> 39:26.760] Now maybe not for chiropractors, but for the general public.
[39:26.760 --> 39:33.320] Yeah, the whole issue of marijuana, you know, your license is revoked in California for
[39:33.320 --> 39:36.320]  something that's legal in Washington.
[39:36.320 --> 39:37.320]  Yes.
[39:37.320 --> 39:45.080] That's likely to give them a whole different perspective, Washington, Colorado, there are
[39:45.080 --> 39:54.160] a number of states, I wouldn't suggest Colorado, because just a couple of times I was in Colorado,
[39:54.160 --> 39:59.680]  I hated Colorado.
[39:59.680 --> 40:05.880] I couldn't get past that blue stallion in the airport with the red eyes, I just couldn't
[40:05.880 --> 40:07.840]  get past that.
[40:07.840 --> 40:13.480] Oh yeah, that was at the great big airport there, huh?
[40:13.480 --> 40:16.760]  Yeah, that's a really creepy airport.
[40:16.760 --> 40:21.080] Yeah, there's lots of stories about that.
[40:21.080 --> 40:28.840] When I was in Colorado, I was called there to do some seminars, and the people that brought
[40:28.840 --> 40:33.320] me there were at each other's throats like a pack of dogs.
[40:33.320 --> 40:38.600] I'd never been to a place where people seemed so miserable to one another.
[40:38.600 --> 40:45.040] And in Colorado's defense, I may have just been the group I was exposed to, but I was,
[40:45.040 --> 40:47.520]  I couldn't wait to get out of there.
[40:47.520 --> 40:53.240] Go back to Texas where people smile at you on occasion.
[40:53.240 --> 41:03.040] I shouldn't pick on Colorado, but yeah, I would look at states, if you're free to relocate,
[41:03.040 --> 41:10.200] but certainly look at a place that would be more friendly to your situation, it's certainly
[41:10.200 --> 41:18.000] worth looking into, and if you want to come back and seek justice later, fine.
[41:18.000 --> 41:27.480] But I'm going to suggest, I've been fighting this fight for 30 years, and I've got lots
[41:27.480 --> 41:34.240] of things to be upset about, the caller before you is from Cherokee County.
[41:34.240 --> 41:38.400] I filed criminal charges with the grand jury in Cherokee County, and the judge I filed
[41:38.400 --> 41:44.320] against prosecuted me for operating and investigating business without a license.
[41:44.320 --> 41:52.520] When I was an investigative journalist, they tried me, convicted me, gave me a year in
[41:52.520 --> 42:00.600] prison, and then after 24 days in solitary confinement, I filled out about 30 criminal
[42:00.600 --> 42:07.800] complaints and sent them to the court of criminal appeals, and two days later, the prosecuting
[42:07.800 --> 42:10.560]  attorney came in and said, let's make a deal.
[42:10.560 --> 42:19.040] They got me out of there, but I would really like to go back there and pay them back for
[42:19.040 --> 42:20.040] what they did to me.
[42:20.040 --> 42:25.880] The judge now has been removed from the bench, and they're all going to have stuff happen,
[42:25.880 --> 42:32.600] but that won't lead me toward my intended ultimate outcome.
[42:32.600 --> 42:38.840] So yeah, they beat me up, yeah, they subjected me to major misery, and I could go back and
[42:38.840 --> 42:45.720] fight them and beat them up back, but that's not going to lead me toward my intended outcome
[42:45.720 --> 42:49.040]  in the end.
[42:49.040 --> 42:55.760] Sometimes I've got to take some lumps, three dislocated ribs, two broken collarbones, broken
[42:55.760 --> 42:59.040]  elbow, and a tooth knocked out.
[42:59.040 --> 43:05.440] That's part of the injustice I've paid for trying to find justice.
[43:05.440 --> 43:16.080] Okay, I'll pay those debts and stay focused on what's most important to me, and once you
[43:16.080 --> 43:21.400] get back on your feet, then if you want to come back and fight them, call me.
[43:21.400 --> 43:28.600] I will show you how to do it, but do it from a position of power, and the only problem
[43:28.600 --> 43:36.040] you will have with doing it the way I suggest is that it can become way too much fun.
[43:36.040 --> 43:45.640] It's a whole other animal, when you go in and pick the fight, then they pick it for
[43:45.640 --> 43:46.640]  you.
[43:46.640 --> 43:52.840] Hang on, Randy Kelton, Rue de la Radio, I call it number, wait a minute, Randy Kelton,

[46:44.640 --> 46:49.680] This is rule of law radio with Randy Kelton and Vette Pack.
[46:49.680 --> 46:52.680] We are on the phone right now with Ryan from California.
[46:52.680 --> 47:02.960] Okay, Ryan, so do we have a direction, is there anything else, any questions or comments
[47:02.960 --> 47:03.960]  you need?
[47:03.960 --> 47:04.960]  Yes, sir.
[47:04.960 --> 47:06.960]  I had one more question.
[47:06.960 --> 47:12.840] You had mentioned an action that I may take regarding my student loan, I think it's a
[47:12.840 --> 47:13.840]  good one.
[47:13.840 --> 47:20.800] And what about the tax liens that have been, that have encouraged me to remain in a cash
[47:20.800 --> 47:21.800]  basis economy?
[47:21.800 --> 47:28.160] You know, they've tried to attach wages in the past and if I have an account, they'll
[47:28.160 --> 47:31.160]  certainly freeze the assets.
[47:31.160 --> 47:41.160] I see that as a pretty big hindrance to both, even with a license or if you were in headed
[47:41.160 --> 47:42.160]  with that.
[47:42.160 --> 47:49.320] If you are a, ask to your license, how does bankruptcy affect your licensing?
[47:49.320 --> 47:52.200] Okay, wait, let me back up, back up.
[47:52.200 --> 48:02.680] You said they, someone, by they do you mean the student loan people or someone else coming
[48:02.680 --> 48:04.160]  after your assets?
[48:04.160 --> 48:16.080] Oh, this would be state tax for past years and in federal tax, I presume.
[48:16.080 --> 48:20.160]  I think they're both have wings, I guess Mike.
[48:20.160 --> 48:31.920] Oh, okay, send me an email, I know some tax people, for the most part, it's a bad idea
[48:31.920 --> 48:34.760] to fight the tax man.
[48:34.760 --> 48:39.000] You can work with the tax man, he don't want to fight with you.
[48:39.000 --> 48:45.240] All he wants to do is to be able to go back and show his boss that I have this account
[48:45.240 --> 48:49.760] here that was not paying anything.
[48:49.760 --> 48:57.080] And I got it off the books, either I collected something or for some other reason, I got
[48:57.080 --> 49:00.080] it off my book, so I don't have to mess with it anymore.
[49:00.080 --> 49:05.880] And a lot of times, if you get someone who knows what they're doing, instead of fighting
[49:05.880 --> 49:11.960] the tax guy, you give the tax guy more information than he wants, the vast majority of the tax
[49:11.960 --> 49:14.640] issues you can take care of.
[49:14.640 --> 49:18.640]  That's good to hear.
[49:18.640 --> 49:26.000] I'm not certain at this point if a bankruptcy would affect my reinstatements, but I do know
[49:26.000 --> 49:34.440] that of course you can't bankrupt, you can't list student loans on those as far as I understand
[49:34.440 --> 49:35.440]  it.
[49:35.440 --> 49:40.480] Student loans and taxes, student loans you can fight.
[49:40.480 --> 49:46.880] I fight foreclosures, but this is a credit issue, and I might want to get you in contact
[49:46.880 --> 49:50.440]  with Mike Gomiris.
[49:50.440 --> 49:59.480] Student loan is a debt collector, and he has ways of handling student loans.
[49:59.480 --> 50:08.840] Send me an email, I'll forward it to Mike Gomiris, he has a program that he sells for
[50:08.840 --> 50:17.480] I think 250 bucks, Trump change, and he shows you how to go after these guys on debt collectors.
[50:17.480 --> 50:23.200] I do foreclosure, maybe give me a foreclosure case, I'll give you a hundred ways to hammer
[50:23.200 --> 50:24.200]  them.
[50:24.200 --> 50:31.480] Mike Gomiris does the same thing with debt collectors and student loan is a debt collector.
[50:31.480 --> 50:34.160] There are ways of doing it, and we have the resources.
[50:34.160 --> 50:38.760] I don't get into that part because that's his, so I stay out of it, like Eddie Craig
[50:38.760 --> 50:41.600]  does, the traffic side.
[50:41.600 --> 50:50.000] Send me an email, and send me an email giving me the basics on what your situation is with
[50:50.000 --> 50:57.840] the student loan, and then a separate email on what your situation is with the IRS, and
[50:57.840 --> 51:05.040] I will get these, I'll forward these to people who can probably help you.
[51:05.040 --> 51:10.080] There are a lot of really cool ways of taking care of this stuff, and we've got a lot of
[51:10.080 --> 51:11.080]  them.
[51:11.080 --> 51:14.520] It's not the stuff you learned in high school.
[51:14.520 --> 51:15.520]  That's true.
[51:15.520 --> 51:21.680] Oh, thank goodness, didn't learn anything about this in high school, that's for doggone
[51:21.680 --> 51:22.680]  sure.
[51:22.680 --> 51:30.680] I was impressed by Mike Gomiris' commercials on your radio program, but not having a background
[51:30.680 --> 51:38.520] in that, and I just had no idea which way to turn, who to turn to, or what to ask him,
[51:38.520 --> 51:43.120] but I'll go ahead and send you the information that I'm aware of in two separate emails,
[51:43.120 --> 51:48.120] and I'll look forward to getting in touch with your people on those topics.
[51:48.120 --> 51:58.760] Okay, I will give that to them, and one thing you might want to look at also is jurisdictionary.
[51:58.760 --> 52:05.920] Guys go to law school, and in law school, they teach lawyers how to argue legal issues,
[52:05.920 --> 52:09.120] but they don't teach them how to practice law.
[52:09.120 --> 52:14.240] They generally get out of law school, they go to work for a law firm, and the law firm
[52:14.240 --> 52:17.720] shows them how to do all this stuff, how to file a motion, how to get a motion put on
[52:17.720 --> 52:26.200] for trial, how to deal with clients, all this stuff that they don't teach in law school.
[52:26.200 --> 52:34.120]  A jurisdictionary will give you legal practice 101.
[52:34.120 --> 52:41.120] It will, yeah, that's like 250 bucks on this course, it's 24 hours of CDs.
[52:41.120 --> 52:48.920] When you get done with that, if you call into my show, and you start talking about a legal
[52:48.920 --> 52:52.360] issue, and I say, well, you need to do this, you'll say, I already did that.
[52:52.360 --> 52:55.440] Well, you need to do that, I already did that.
[52:55.440 --> 53:01.800] I can always tell people who've been through jurisdictionary, it gives you information
[53:01.800 --> 53:09.320] the lawyers for the most part don't know, all the basic stuff you need to know.
[53:09.320 --> 53:19.240] It will change how you perceive yourself in the environment that surrounds you.
[53:19.240 --> 53:25.760] When I drive down the street, and these red lights come on behind me, I don't get those
[53:25.760 --> 53:29.240] butterflies in my stomach anymore.
[53:29.240 --> 53:34.680] I don't think, oh, no, genius, I got to deal with all this.
[53:34.680 --> 53:40.720] I think, come on, Bubba, take your best shot.
[53:40.720 --> 53:49.960] I'm fixing to give you wrong through the legal system, you are not going to believe.
[53:49.960 --> 53:57.800] These things that have happened to you, had you had jurisdictionary, this garbage would
[53:57.800 --> 54:00.680]  not have happened.
[54:00.680 --> 54:05.520] They come after me, they are not going to believe the fight they're going to get.
[54:05.520 --> 54:12.000] I'm in the process of filing criminal charges against a federal judge.
[54:12.000 --> 54:17.680] I filed a quiet title, the bank removed it to the federal court, I filed a challenge
[54:17.680 --> 54:23.480] to subject matter jurisdiction instead of a motion to remand.
[54:23.480 --> 54:27.960] The other side filed a rule 12, the judge dismissed with prejudice on the basis of the
[54:27.960 --> 54:28.960]  rule 12.
[54:28.960 --> 54:34.840] Is that a fact, Jack, we'll see how that works out for you.
[54:34.840 --> 54:42.040] I'm going to present him to a grand jury, lawyers will just file an objection or a motion
[54:42.040 --> 54:43.040]  for reconsideration.
[54:43.040 --> 54:50.960] Now, I'm going to file against him with the grand jury, shall you like that?
[54:50.960 --> 55:01.920] There is so much we can do with not a whole lot of information, we don't have to be lawyers.
[55:01.920 --> 55:08.280] This jurisdictionary will give you a basic understanding of how law works.
[55:08.280 --> 55:14.640] It's not as difficult as it sounds, lawyers won't want you to think it's really complex,
[55:14.640 --> 55:17.240]  but it's not.
[55:17.240 --> 55:24.600] Michael Mears will give you a really good way to understand that collectors, they do
[55:24.600 --> 55:27.160]  everything wrong.
[55:27.160 --> 55:33.680] They know they do everything wrong, they don't care, yeah, every once in a while somebody
[55:33.680 --> 55:41.440] comes along and stings them good, but that's so rare, it's just a cost of doing business.
[55:41.440 --> 55:45.400] Michael Mears will show you how to be the one that stings them good.
[55:45.400 --> 55:50.720] We have a guy in Michigan, his first credit card, they dismissed the debt and paid him
[55:50.720 --> 55:56.120] 6,000 to go away and leave him alone, second credit card, they dismissed the debt and paid
[55:56.120 --> 56:01.000] him 3,500 to go away and leave him alone and he was complaining you didn't have any more
[56:01.000 --> 56:06.000]  credit cards.
[56:06.000 --> 56:11.760] So there are a lot of things that we could do and we have the resources to show you how
[56:11.760 --> 56:13.160]  to do that.
[56:13.160 --> 56:21.880] It will change the way you hold yourself in the environment and it serves my interest
[56:21.880 --> 56:31.040] because it's my purpose to help everybody understand that all our public servants are
[56:31.040 --> 56:38.400] the servants, you and I, we are the masters, we're the masters of the servants and when
[56:38.400 --> 56:44.480] we understand that we are the masters of the servants, then we control our servants much
[56:44.480 --> 56:51.520] better and keep our servants from getting out of line and it doesn't take the whole
[56:51.520 --> 56:59.800] population, it only takes a few, when you know, I tell everybody that the courts hate
[56:59.800 --> 57:07.200] pro se litigants, they don't hate pro se litigants because they file stupid pleadings, they like
[57:07.200 --> 57:14.360] that part, they hate pro se litigants because every once in a while they come across the
[57:14.360 --> 57:25.240] pro se from hell and we will show you how to be the pro se from hell, the one that holds
[57:25.240 --> 57:33.840] up the rule of law, this is what the law says you were supposed to do, you didn't do what
[57:33.840 --> 57:39.600] it says you're supposed to do and this is a crime you committed when you did it and
[57:39.600 --> 57:50.360] here's my remedy against you, so let's dance, this is what we can help you with and it's
[57:50.360 --> 57:56.680] valuable to us because if I can get you out there in California or Washington just kicking
[57:56.680 --> 58:04.760] their beehives, then for every judge that you hammer big time, there's probably a hundred
[58:04.760 --> 58:12.160] people behind you that won't be mistreated, so God willing I'd be willing to do that,
[58:12.160 --> 58:16.600] I'm not afraid of a fight, I just don't want to go in with my arm tied behind my back or
[58:16.600 --> 58:24.680] my brain tied up in this question, this is what we'll do, we'll untie your hands, okay
[58:24.680 --> 58:30.960] but keep listening to the show, it takes a while for this different mindset to sink in
[58:30.960 --> 58:37.440] but once it sinks in, you will have way too much fun with it, hang on, about to go to
[58:37.440 --> 58:43.960] break, Vette you want to bring us out, sure, this is rule of law radio, Randy Kelton and

[01:00:13.400 --> 01:00:21.320] into the tides of the alternative.
[01:00:21.320 --> 01:00:26.760] Markets for Wednesday the 4th of May 2016 are currently trading with gold at $1274.01
[01:00:26.760 --> 01:00:34.240] an ounce, silver $17.26 an ounce, texas crude $43.65 a barrel and bitcoin is currently at
[01:00:34.240 --> 01:00:46.960] about $448 U.S. currency, today in history, the year 1415, Protestant Christian reformers
[01:00:46.960 --> 01:00:52.120] John Wycliffe and Jan Haas are condemned as heretics at the Council of Constance, this
[01:00:52.120 --> 01:00:56.520] declaration led to the digging up and burning of Wycliffe's bones who had died a few decades
[01:00:56.520 --> 01:01:02.000] before with his ashes being dumped into a river into the eventual execution of Jan Haas
[01:01:02.000 --> 01:01:06.760] by burning at the stake, yet another attempt at stamping out Protestantism via the Catholic
[01:01:06.760 --> 01:01:13.040]  Inquisition, today in history.
[01:01:13.040 --> 01:01:16.680] In recent news, White House spokesman Josh Earnest said concerning President Obama's
[01:01:16.680 --> 01:01:20.600] first visit to Flint, Michigan in response to the lead poisoning crisis that has been
[01:01:20.600 --> 01:01:24.680] happening there, that quote, this administration will continue to help mobilize the resources
[01:01:24.680 --> 01:01:28.400] necessary that will allow Flint to recover and come back stronger than ever.
[01:01:28.400 --> 01:01:32.400] This is not an exercise in finger pointing, this is an exercise in asserting the responsibility
[01:01:32.400 --> 01:01:36.280] that everybody has to make sure the people of Flint have an opportunity to get back on
[01:01:36.280 --> 01:01:37.280]  their feet.
[01:01:37.280 --> 01:01:41.240] President Obama did declare a state of emergency in mid-January and ordered federal aid in
[01:01:41.240 --> 01:01:43.560] addition to the state and local response.
[01:01:43.560 --> 01:01:47.560] His first priority in Flint is to be updated on the federal response to the crisis and
[01:01:47.560 --> 01:01:55.040] is even meeting with some city residents.
[01:01:55.040 --> 01:01:58.880] Israel's Justice Minister Eilat Shaked in an interview with the Washington Post stated
[01:01:58.880 --> 01:02:04.000] today that quote, in the past we've seen European leaders speaking against the Jews, now we
[01:02:04.000 --> 01:02:05.240] see them speaking against Israel.
[01:02:05.240 --> 01:02:10.640] It is the same anti-Semitism of blood libel spreading lies, distorting reality and brainwashing
[01:02:10.640 --> 01:02:12.840] people into hating Israel and the Jews.
[01:02:12.840 --> 01:02:17.640] She went as far as to say that the supporters of movements such as BDS, which call for putting
[01:02:17.640 --> 01:02:21.480] economic and political pressure on Israel in order to achieve compliance with international
[01:02:21.480 --> 01:02:27.000] law and gain rights for Palestinians are quote, using the same kind of anti-Semitism, but
[01:02:27.000 --> 01:02:30.520] instead of saying they're against the Jews, they say that they're against Israel.
[01:02:30.520 --> 01:02:34.160] In response to comments made in recent weeks by members of Britain's Labour Party claiming
[01:02:34.160 --> 01:02:38.680] that Hitler was a Zionist and previous remarks by lawmakers that Israel's population should
[01:02:38.680 --> 01:02:43.520] be transported out of the Middle East to America, Shaked stated that quote, today it is not
[01:02:43.520 --> 01:02:47.880] politically correct to be anti-Semitic, but being anti-Israeli is acceptable.
[01:02:47.880 --> 01:02:51.680] People who have such anti-Semitic views should not be allowed to hold central leadership
[01:02:51.680 --> 01:02:52.680]  positions.
[01:02:52.680 --> 01:03:09.920] This is Rick Rodey with your Lowdown for May 4th, 2016.
[01:03:09.920 --> 01:03:32.760] We are back, Randy Kelton and Vet Pack with Rule of Law Radio.
[01:03:32.760 --> 01:03:38.080] And we are talking to Ryan in California.
[01:03:38.080 --> 01:03:39.080]  Hello Ryan.
[01:03:39.080 --> 01:03:40.080]  Okay.
[01:03:40.080 --> 01:03:41.080]  Yes, Randy.
[01:03:41.080 --> 01:03:45.120] Do you have any other questions or comments?
[01:03:45.120 --> 01:03:54.800] Well let's see, I'll try to make this a short one, beyond the best of my ability here, because
[01:03:54.800 --> 01:04:05.120] I've been working security as much as possible since that incident to try to make ends meet.
[01:04:05.120 --> 01:04:09.880] And I don't want to get into a whole other case, but there's a person trying to chase
[01:04:09.880 --> 01:04:15.600]  me around with a subpoena over a work-related incident.
[01:04:15.600 --> 01:04:26.400] And I'm wondering if for the moment, since I'm not that easy to find, if your first suggestion
[01:04:26.400 --> 01:04:36.480] of stabilizing and getting into a better position to fight would also apply to this, presuming
[01:04:36.480 --> 01:04:38.680] that this doesn't get served on me.
[01:04:38.680 --> 01:04:42.360] Oh, this guy wants to serve you or something?
[01:04:42.360 --> 01:04:43.360]  What would you say?
[01:04:43.360 --> 01:04:44.360]  Yes.
[01:04:44.360 --> 01:04:46.560]  It's a civil case.
[01:04:46.560 --> 01:04:55.960] Again, I was named and the restaurant bar nightclub was also named on this case.
[01:04:55.960 --> 01:05:01.680] And in short, this fellow attacked a busboy who was outside on his break.
[01:05:01.680 --> 01:05:04.480] I shoved him away and the kid went to the hospital.
[01:05:04.480 --> 01:05:10.920] I was put in jail a week later overnight and bailed out, which I have an issue with.
[01:05:10.920 --> 01:05:17.920] No criminal charges were filed after four hearing dates got dismissed.
[01:05:17.920 --> 01:05:20.840] I'd like to deal with that at some point.
[01:05:20.840 --> 01:05:24.440] What, is he trying to sue you, silly?
[01:05:24.440 --> 01:05:25.440]  Yes.
[01:05:25.440 --> 01:05:26.440]  Oh, good.
[01:05:26.440 --> 01:05:27.440]  Okay.
[01:05:27.440 --> 01:05:30.440] We can help you with that.
[01:05:30.440 --> 01:05:31.440]  Countersuit.
[01:05:31.440 --> 01:05:36.960] Oh, we have got so many tools for that.
[01:05:36.960 --> 01:05:43.240] Your first thing you do is, this is unethical.
[01:05:43.240 --> 01:05:52.520] This is just shyster practices, dirty, rotten, stinking, low down.
[01:05:52.520 --> 01:05:56.520]  I'll grieve his attorney.
[01:05:56.520 --> 01:05:59.280] His attorney will get apoplexy.
[01:05:59.280 --> 01:06:01.040]  Okay.
[01:06:01.040 --> 01:06:03.960] We can help you with that.
[01:06:03.960 --> 01:06:08.800]  I would not dodge service.
[01:06:08.800 --> 01:06:19.080] You could once, this is, if it's over, you're intervening in a physical altercation between
[01:06:19.080 --> 01:06:32.280] two other people, you're in pretty good standing and there are so many things you can do to,
[01:06:32.280 --> 01:06:36.880]  you can do things that a lawyer can't do.
[01:06:36.880 --> 01:06:44.200] If this other guy has a lawyer representing him, the lawyer is absolutely vulnerable and
[01:06:44.200 --> 01:06:49.760] we can almost certainly show you how to get the other lawyer to want to drop you from
[01:06:49.760 --> 01:06:50.760]  the suit.
[01:06:50.760 --> 01:06:54.840] They're not going to want you anyway because you don't have any pockets.
[01:06:54.840 --> 01:06:55.840]  Right.
[01:06:55.840 --> 01:07:01.640] They want the restaurant order, so I wouldn't avoid the service.
[01:07:01.640 --> 01:07:04.800]  In Texas, it's a felony to avoid service.
[01:07:04.800 --> 01:07:13.360] Well, not so much of an avoidance as much as I don't have an address.
[01:07:13.360 --> 01:07:17.480] You might want to just go ahead and take the service and then talk to us about it and we're
[01:07:17.480 --> 01:07:20.480] sure you had to go after them.
[01:07:20.480 --> 01:07:26.560] I used to have concerns about that kind of thing, not anymore.
[01:07:26.560 --> 01:07:30.200] They want to sue me, we'll fight.
[01:07:30.200 --> 01:07:36.000] I'll give you a romp through the legal system you won't believe.
[01:07:36.000 --> 01:07:44.720] If you heard Scott earlier, Scott, he was in court on a traffic issue and he raised
[01:07:44.720 --> 01:07:49.400] the right to travel and the judge shouted him down, told him he wasn't going to have
[01:07:49.400 --> 01:07:52.400] any of that kind of stuff in his courtroom.
[01:07:52.400 --> 01:07:54.400] So what do you do?
[01:07:54.400 --> 01:07:58.960] Well, he filed criminal charges as a grand jury, of course.
[01:07:58.960 --> 01:08:07.560] The judge, you won't have yourself an attitude, we'll tear your attitude off and see how that
[01:08:07.560 --> 01:08:09.800]  works for you.
[01:08:09.800 --> 01:08:12.760] As a pro se, you can do that.
[01:08:12.760 --> 01:08:21.160] The lawyer never would because the lawyer comes into court dangling by his bar card.
[01:08:21.160 --> 01:08:23.680]  You're not.
[01:08:23.680 --> 01:08:28.160] The first thing to understand, you don't care if the judge doesn't like you.
[01:08:28.160 --> 01:08:30.960]  That's not out of criteria.
[01:08:30.960 --> 01:08:36.200] I had a judge tell me once that he didn't like where I was going.
[01:08:36.200 --> 01:08:41.200]  Well, I don't really care what you like.
[01:08:41.200 --> 01:08:46.480] I'm here to put the law and the facts on the record and I don't care what you like or don't
[01:08:46.480 --> 01:08:47.480]  like.
[01:08:47.480 --> 01:08:50.800] And if you have likes or don't likes, you need to leave those at home.
[01:08:50.800 --> 01:08:54.360] Anyway, we can help you handle that.
[01:08:54.360 --> 01:08:58.400]  I definitely wouldn't avoid the service.
[01:08:58.400 --> 01:09:06.600] Yeah, it's been easy because I've been so transient really between locations and work
[01:09:06.600 --> 01:09:07.600]  anyway.
[01:09:07.600 --> 01:09:14.120] I've only just recently opened a PO box but haven't even mailed something to you.
[01:09:14.120 --> 01:09:22.680] But I could get in touch with the restaurant or the bar, their attorney and of course that
[01:09:22.680 --> 01:09:23.680]  would be it.
[01:09:23.680 --> 01:09:24.680]  Yeah.
[01:09:24.680 --> 01:09:25.680] Get a call over to the restaurant.
[01:09:25.680 --> 01:09:35.600] They're almost certainly they'll represent you because you're at their bar and this occurs.
[01:09:35.600 --> 01:09:44.560] If the other side sues you and the bar's attorney doesn't handle your side, then you're likely
[01:09:44.560 --> 01:09:50.520] to sue the bar or you're likely to make a deal with the other side and turn against
[01:09:50.520 --> 01:09:51.520]  them.
[01:09:51.520 --> 01:09:54.520]  They'll protect you.
[01:09:54.520 --> 01:09:59.960] I was afraid that they wouldn't because if they can throw me under the bus, legally speaking,
[01:09:59.960 --> 01:10:03.920] then they would hope to indemnify themselves.
[01:10:03.920 --> 01:10:07.160] Even though they didn't fire me afterwards, I wasn't disciplined and of course, had I
[01:10:07.160 --> 01:10:11.160] not intervened, I would have been fired, I had a duty obligation.
[01:10:11.160 --> 01:10:14.960] Oh, so you were working for the bar?
[01:10:14.960 --> 01:10:15.960]  Yes.
[01:10:15.960 --> 01:10:19.840]  Oh, you don't have a problem anyway.
[01:10:19.840 --> 01:10:22.040]  You're covered.
[01:10:22.040 --> 01:10:27.240] They have to name you, but you're covered by the bar.
[01:10:27.240 --> 01:10:33.560] Oh, yes, of course, the liability and so forth, personal injuries and all that stuff.
[01:10:33.560 --> 01:10:36.880] Of course, I'd be covered under their insurance, I was on payroll.
[01:10:36.880 --> 01:10:37.880]  Yeah.
[01:10:37.880 --> 01:10:40.920] So you don't have to worry about that.
[01:10:40.920 --> 01:10:47.400] And on duty at the time, but I was inconvenienced and had to bail out.
[01:10:47.400 --> 01:10:50.360] The bar hasn't paid me back for my bail or anything like that.
[01:10:50.360 --> 01:10:54.720] They did offer to pay for my defense if anything went that way.
[01:10:54.720 --> 01:10:58.120] And you know, word to the grapevine is it is going that way.
[01:10:58.120 --> 01:11:03.520] Well, yeah, then they're going to be liable in any case.
[01:11:03.520 --> 01:11:08.360] So they'll almost have to and they're insured for that purpose.
[01:11:08.360 --> 01:11:17.600] Yeah, of course, and you recommend that I just allow their attorney to proceed?
[01:11:17.600 --> 01:11:19.600]  Yes, absolutely.
[01:11:19.600 --> 01:11:24.440] You want to see what they're charging, and then we'll give you an idea of how to go back
[01:11:24.440 --> 01:11:25.440]  at them.
[01:11:25.440 --> 01:11:26.440]  Wow.
[01:11:26.440 --> 01:11:34.040] Okay, so get the information and then get a hold of you with whatever I can find out
[01:11:34.040 --> 01:11:35.040]  and stuff.
[01:11:35.040 --> 01:11:36.040]  Yes.
[01:11:36.040 --> 01:11:42.200] And then we'll talk about on the show how to go after them.
[01:11:42.200 --> 01:11:48.400] One thing about a court case, there is always something you can do.
[01:11:48.400 --> 01:11:54.800] You'll never win your case simply because you have the law and the facts on your side.
[01:11:54.800 --> 01:11:58.080] To think so is naive.
[01:11:58.080 --> 01:12:02.680] You win the case if you have the politics on your side.
[01:12:02.680 --> 01:12:10.960] And pro-says can manipulate the politics like nobody else.
[01:12:10.960 --> 01:12:19.520] It's not the way they told you it was in high school.
[01:12:19.520 --> 01:12:24.920] Would I be pro-say if their attorney is defending me?
[01:12:24.920 --> 01:12:31.760] No, but you see, their attorney can defend you, but you're also able to do things on
[01:12:31.760 --> 01:12:38.160] your own like file bar grievances against opposing counsel, judicial conduct complaints
[01:12:38.160 --> 01:12:43.320] against the judge just to be annoying, criminal complaints against the party on the other
[01:12:43.320 --> 01:12:44.320]  side.
[01:12:44.320 --> 01:12:47.160] There's all kinds of stuff you can do.
[01:12:47.160 --> 01:12:51.160]  Oh, that's good to know.
[01:12:51.160 --> 01:12:54.040] Oh, yeah, you got lots of options.
[01:12:54.040 --> 01:12:56.360]  Okay, I need to move on.
[01:12:56.360 --> 01:13:04.000] We've got Rob from New Mexico, and I'm hoping he's here to do some crowing.
[01:13:04.000 --> 01:13:10.720] He's been winning some lately, and that's not bad for a truck driver because you know
[01:13:10.720 --> 01:13:21.120] how truck drivers are, diesel fumes cause deadheading, and Rob never finds my truck
[01:13:21.120 --> 01:13:24.000] driver jokes as funny as I do.
[01:13:24.000 --> 01:13:34.800] Okay, thank you, Ryan, but give me those emails, and then keep us up to speed on what happens.
[01:13:34.800 --> 01:13:36.880] I will, and thank you again for all your time.
[01:13:36.880 --> 01:13:38.440]  It's been really valuable.
[01:13:38.440 --> 01:13:39.920]  I really appreciate it.
[01:13:39.920 --> 01:13:41.960]  Okay, thank you, Ryan.
[01:13:41.960 --> 01:13:43.960] Now we're going to go to Rob in New Mexico.
[01:13:43.960 --> 01:13:46.960] Rob, did we put you to sleep?
[01:13:46.960 --> 01:13:49.880]  No, there's the diesel fumes.
[01:13:49.880 --> 01:13:55.200] I should have got carbon monoxide and brain damage, but I'm dead now.
[01:13:55.200 --> 01:13:56.640] You heard that, did you?
[01:13:56.640 --> 01:14:04.000] Rob, do you know what the difference between a truck driver and a puppy dog is?
[01:14:04.000 --> 01:14:05.000]  No.
[01:14:05.000 --> 01:14:10.760] A puppy dog will quit whining after about six weeks.
[01:14:10.760 --> 01:14:11.760]  Okay.
[01:14:11.760 --> 01:14:12.760]  You're so mean.
[01:14:12.760 --> 01:14:23.040] I've got 25 years at the end of this month, and I ain't quit whining yet, so.
[01:14:23.040 --> 01:14:25.640]  See, it fits.
[01:14:25.640 --> 01:14:30.280] Okay, have you quit whining at your legal opponents?
[01:14:30.280 --> 01:14:35.360] Oh no, I whine at them on a regular basis.
[01:14:35.360 --> 01:14:37.800]  So here's what we have now.
[01:14:37.800 --> 01:14:41.320] Did you buy any chance to get my email I sent it after the show started?
[01:14:41.320 --> 01:14:44.880]  No, I did not.
[01:14:44.880 --> 01:14:48.000]  That would require multitasking.
[01:14:48.000 --> 01:14:49.680]  I am old.
[01:14:49.680 --> 01:14:51.680]  I do not multitask.
[01:14:51.680 --> 01:14:52.680]  Gotcha.
[01:14:52.680 --> 01:15:02.600] I met with the attorney for the sellers today at his office, which is also the office of
[01:15:02.600 --> 01:15:09.480] the debt collector attorney and the debt collector trust company that I sued in federal court.
[01:15:09.480 --> 01:15:11.480]  So that was fun.
[01:15:11.480 --> 01:15:13.840]  Wait a minute.
[01:15:13.840 --> 01:15:16.320]  Debt collector trust company?
[01:15:16.320 --> 01:15:20.560] So this is not your foreclosure issue?
[01:15:20.560 --> 01:15:21.560]  Trust company.
[01:15:21.560 --> 01:15:24.560]  Oh, trust company, okay.
[01:15:24.560 --> 01:15:31.000] So they're all in the same office building, different suites, but they're all under the
[01:15:31.000 --> 01:15:32.400]  same roof.
[01:15:32.400 --> 01:15:38.000] And the debt collector attorney is one of the directors of the trust company.
[01:15:38.000 --> 01:15:41.240] So that gets real interesting.
[01:15:41.240 --> 01:15:46.280] But I met with the attorney for the sellers for the purpose of viewing and inspecting
[01:15:46.280 --> 01:15:51.800] the original escrow documents, which he appeared to have.
[01:15:51.800 --> 01:15:57.600] They had the actual stamp from the court of court filing.
[01:15:57.600 --> 01:16:02.880] They had the actual raised notary stamp by the signatures.
[01:16:02.880 --> 01:16:05.900] So that all looked legit.
[01:16:05.900 --> 01:16:12.760] This is what my email to you goes to up in the top right, or I'm sorry, top left and
[01:16:12.760 --> 01:16:19.640] towards the middle, there's a bunch of staple holes, like a bunch of staple holes.
[01:16:19.640 --> 01:16:22.200] And I asked him what those were from.
[01:16:22.200 --> 01:16:23.200]  And he said, oh, I don't know.
[01:16:23.200 --> 01:16:25.000] I said, well, they look like staple holes.
[01:16:25.000 --> 01:16:27.600]  They said, well, I don't know that they're staple holes.
[01:16:27.600 --> 01:16:30.600] I said, well, either they're staple holes or a cat chute on it.
[01:16:30.600 --> 01:16:36.360] And he said, well, they're probably from when the contract was taken apart, the photo
[01:16:36.360 --> 01:16:37.360]  copy.
[01:16:37.360 --> 01:16:46.560] Okay, hang on about to go to break that you want to take this out.

[01:19:25.960 --> 01:19:53.360] Okay, Mr. Rob, okay, you had a meeting with these guys and they were explaining away the
[01:19:53.360 --> 01:19:56.360]  staple holes.
[01:19:56.360 --> 01:19:57.360]  Exactly.
[01:19:57.360 --> 01:20:00.240] Trying to anyway, not doing a very good job of it.
[01:20:00.240 --> 01:20:05.480] So what I'm looking at now, I went back and looked at all the other copies that have been
[01:20:05.480 --> 01:20:08.720] given of the contract prior to this.
[01:20:08.720 --> 01:20:15.200] Now this is, you know, they got it back, allegedly, after, you know, the alleged default when
[01:20:15.200 --> 01:20:20.680] they filed in the county records and filed the special warranty deed, conveying the property
[01:20:20.680 --> 01:20:22.800]  back to the sellers.
[01:20:22.800 --> 01:20:29.440] All of the copies prior to this one, the first page is folded over, you know, there's a fold
[01:20:29.440 --> 01:20:35.640] mark in the upper left-hand corner, like there's something over page one.
[01:20:35.640 --> 01:20:39.120] And I never noticed that until today.
[01:20:39.120 --> 01:20:43.640] So I don't know what they've had attached and removed to this.
[01:20:43.640 --> 01:20:45.640]  He's claiming nothing.
[01:20:45.640 --> 01:20:50.920] So what do I do with that?
[01:20:50.920 --> 01:20:55.960]  I don't know that it would matter.
[01:20:55.960 --> 01:21:01.640] Is the contract that you signed complete?
[01:21:01.640 --> 01:21:08.280] Well, what do you mean complete?
[01:21:08.280 --> 01:21:10.840] I mean, are all the pages there?
[01:21:10.840 --> 01:21:15.200] Yeah, all the pages were there that he showed me today.
[01:21:15.200 --> 01:21:22.280] Okay, there's some stuff will go floating around the internet about staple holes.
[01:21:22.280 --> 01:21:30.840] But the only time that has any credence is where a mortgage may have been transferred,
[01:21:30.840 --> 01:21:41.600] a mortgage or a debt transferred between various parties and where the indication is that there
[01:21:41.600 --> 01:21:48.880] was an allonge attached to the note.
[01:21:48.880 --> 01:21:57.360] So if you're looking at a note and you, it has staple holes, especially in the last page,
[01:21:57.360 --> 01:22:02.320] that's an indication there may have been an allonge attached to it.
[01:22:02.320 --> 01:22:08.080] But I've heard these arguments about staple holes, and for the most part, they come up
[01:22:08.080 --> 01:22:12.200]  with a patriot mythology.
[01:22:12.200 --> 01:22:20.200] There's certainly nothing in law about staple holes, and I've heard guys argue that a document
[01:22:20.200 --> 01:22:28.520] that has staple holes in it is not an original document, unless whatever was stapled to it
[01:22:28.520 --> 01:22:30.120]  still stapled to it.
[01:22:30.120 --> 01:22:33.720] Well, I haven't found any law to back that up.
[01:22:33.720 --> 01:22:36.640]  That's just some stuff somebody said.
[01:22:36.640 --> 01:22:39.040]  Right.
[01:22:39.040 --> 01:22:41.480] There could be a lot of things stapled to it.
[01:22:41.480 --> 01:22:47.960] It could be a rubber band staple to it that, I don't know, it could be anything.
[01:22:47.960 --> 01:22:52.840] There's nothing to indicate that there was anything of any relevance stapled to it unless
[01:22:52.840 --> 01:22:56.840] something of specific relevance is missing from the document.
[01:22:56.840 --> 01:23:06.600] Well, and my question is, as far as that goes, is these other copies prior to it being returned,
[01:23:06.600 --> 01:23:11.000] and this goes also to what I said about this guy being in the same office as the trust
[01:23:11.000 --> 01:23:16.520] company, what was that first page that got folded over on all the previous copies?
[01:23:16.520 --> 01:23:22.600] Well, did it just have a dogeared page and somebody folded it back?
[01:23:22.600 --> 01:23:31.840] No, you can clearly tell that there is a page preceding page one that's folded over in the
[01:23:31.840 --> 01:23:38.560] middle of it. Okay, well, somebody might have put a cover page on it saying, I get documents
[01:23:38.560 --> 01:23:42.360] from the court and there's a cover page that just has my name and address in the middle
[01:23:42.360 --> 01:23:43.360]  of it.
[01:23:43.360 --> 01:23:44.360]  Right.
[01:23:44.360 --> 01:23:50.240] I've got one right here, an order from the court, and the first page is blank except
[01:23:50.240 --> 01:23:53.280] for my name and address right in the middle of it.
[01:23:53.280 --> 01:23:57.840] I turn that over and the order is underneath.
[01:23:57.840 --> 01:24:04.640] Just because there's staple holes or just because there was a page on top does not necessarily
[01:24:04.640 --> 01:24:15.640] give cause to believe that a material portion of the document has been removed.
[01:24:15.640 --> 01:24:27.800] Now, I always number my pages one of whatever, so if a document is removed, then it's clearer
[01:24:27.800 --> 01:24:32.000] from observing the document that it's removed.
[01:24:32.000 --> 01:24:38.240] If something's been added to the top that wasn't there when you created it or when you
[01:24:38.240 --> 01:24:46.440] signed it and then it was taken away, I don't see how it could have any relevance.
[01:24:46.440 --> 01:24:54.880] Okay. What about the fact that you got really agitated when I asked them about it?
[01:24:54.880 --> 01:24:59.560] Well, that doesn't necessarily mean anything either.
[01:24:59.560 --> 01:25:06.440] He's just maybe concerned that you're going to raise an issue that's meritless, but he's
[01:25:06.440 --> 01:25:08.920] going to have to argue the issue.
[01:25:08.920 --> 01:25:14.040] The hardest thing to argue is something that somebody just made up.
[01:25:14.040 --> 01:25:20.880] Well, that sounds like it is something I should go after then.
[01:25:20.880 --> 01:25:30.680] It might lead to something, but as far as something you can bring into court, it doesn't
[01:25:30.680 --> 01:25:31.680]  mean anything.
[01:25:31.680 --> 01:25:40.360] I've had a number of guys make this staple hole argument, but I have never found anything
[01:25:40.360 --> 01:25:43.120] of substance to support it.
[01:25:43.120 --> 01:25:47.920] You know, I'm always looking for good arguments we can bring.
[01:25:47.920 --> 01:25:48.920]  Right.
[01:25:48.920 --> 01:25:49.920]  Okay.
[01:25:49.920 --> 01:25:56.240] Then let's move from there to a slightly more pressing issue.
[01:25:56.240 --> 01:26:01.520] You know, the trust company, you know, sued them first in state court under the unfair
[01:26:01.520 --> 01:26:08.480] practice of that, and they got summary judgment, so that got dismissed.
[01:26:08.480 --> 01:26:12.760] Then they subsequently filed an affidavit of cost.
[01:26:12.760 --> 01:26:17.480] Wait, did you file an appeal on the summary judgment?
[01:26:17.480 --> 01:26:24.720] No, I didn't, I just amended my federal complaint to add them as a debt collector in the FDCPA
[01:26:24.720 --> 01:26:25.720]  case.
[01:26:25.720 --> 01:26:29.720] That was easier to master.
[01:26:29.720 --> 01:26:32.640] Did you bar grade the attorneys in that case?
[01:26:32.640 --> 01:26:33.640]  Of course.
[01:26:33.640 --> 01:26:34.640]  Okay.
[01:26:34.640 --> 01:26:38.600] Then if they put in a- Randy, would you explain?
[01:26:38.600 --> 01:26:39.600]  I'm sorry.
[01:26:39.600 --> 01:26:42.480] Randy, would you explain what bar grade means?
[01:26:42.480 --> 01:26:43.840]  Oh, yeah.
[01:26:43.840 --> 01:26:51.480] The American Bar Association sets out a set of standards for attorneys.
[01:26:51.480 --> 01:26:58.200] And if an attorney breaches one of those standards, then you can file a complaint with the licensing
[01:26:58.200 --> 01:26:59.200]  boards.
[01:26:59.200 --> 01:27:04.200] American Bar Association, I'm sorry, each state has its own.
[01:27:04.200 --> 01:27:10.280] If you practice in DC or only in the federal venue, then you'll be under the American Bar
[01:27:10.280 --> 01:27:11.280]  Association.
[01:27:11.280 --> 01:27:17.920] Every state has their own state bar association.
[01:27:17.920 --> 01:27:27.480] And that is the entity that polices licensed attorneys.
[01:27:27.480 --> 01:27:41.720] That is the only place where the licensee, licensees police themselves.
[01:27:41.720 --> 01:27:46.780] If you're a doctor, they have a special board that's not doctors that police you.
[01:27:46.780 --> 01:27:53.800] If you're a plumber, electrician, a private investigator, they all have boards that are
[01:27:53.800 --> 01:27:58.800] not licensed, they have attorneys and non-attorneys, I'm sorry, that have licensed personnel and
[01:27:58.800 --> 01:28:01.240]  non-licensed policing it.
[01:28:01.240 --> 01:28:05.200] The only one that polices themselves is the bar association.
[01:28:05.200 --> 01:28:06.200]  Okay.
[01:28:06.200 --> 01:28:15.360] If you file a bar grievance against a lawyer, the lawyer will get, I'm sorry, the bar, my
[01:28:15.360 --> 01:28:17.600]  tank is getting toggled.
[01:28:17.600 --> 01:28:22.940] If you file a bar grievance against a lawyer, the state bar association will get that grievance
[01:28:22.940 --> 01:28:27.520] and they will throw it in the trash.
[01:28:27.520 --> 01:28:32.400] You'll get this letter back from the bar saying, we examined into your complaint and find it
[01:28:32.400 --> 01:28:36.640] does not rise to the level of misconduct.
[01:28:36.640 --> 01:28:41.200]  Everyone I've ever filed, I got that back.
[01:28:41.200 --> 01:28:46.480] So people tend to think, well, if you file a complaint with the bar, the bar is not going
[01:28:46.480 --> 01:28:47.480]  to do anything.
[01:28:47.480 --> 01:28:49.040] And that is exactly right.
[01:28:49.040 --> 01:28:51.200]  They're not.
[01:28:51.200 --> 01:28:55.280]  And that's a good thing.
[01:28:55.280 --> 01:29:02.320] The reason it's a good thing is their insurance carrier knows that the bar will throw it in
[01:29:02.320 --> 01:29:04.140]  the trash.
[01:29:04.140 --> 01:29:09.080] So how does the insurance carrier measure its level of risk?
[01:29:09.080 --> 01:29:15.900] By filing bar grievances, they throw them all in the trash, by the numbers.
[01:29:15.900 --> 01:29:20.320] One bar grievance your first year of practice, they will cancel immediately.
[01:29:20.320 --> 01:29:24.360] Two bar grievances, any one year of practice, they'll cancel.
[01:29:24.360 --> 01:29:28.360]  Three, they'll cancel your law firm's malpractice insurance.
[01:29:28.360 --> 01:29:31.880] I had a lawyer tell me that is partly unfair.
[01:29:31.880 --> 01:29:39.320] And I stood there grinning from ear to ear, agreeing with him wholeheartedly.
[01:29:39.320 --> 01:29:44.480] That's what I'm talking about with bar grievances, one of the most powerful things proceeds can
[01:29:44.480 --> 01:29:45.480]  do.
[01:29:45.480 --> 01:29:46.480]  Okay.
[01:29:46.480 --> 01:29:49.480] You want to take us out, Beth?
[01:29:49.480 --> 01:29:52.040] This is rule of law, Randy.
[01:29:52.040 --> 01:29:55.520]  Please, sir, we're Randy Kelton at ATT&CK.
[01:29:55.520 --> 01:30:02.120]  You can call us at 646-1984.
[01:30:02.120 --> 01:30:07.080] Google and Apple are at it again, this time with spy planes that can photograph objects
[01:30:07.080 --> 01:30:08.080]  as small as iPhones.
[01:30:08.080 --> 01:30:09.080]  I'm Dr. Catherine Albrecht.
[01:30:09.080 --> 01:30:16.040] And if the thought of an airborne camera leering at your backyard creeps you out, stay tuned.
[01:30:16.040 --> 01:30:18.160]  Privacy is under attack.
[01:30:18.160 --> 01:30:21.760] When you give up data about yourself, you'll never get it back again.
[01:30:21.760 --> 01:30:26.760] And once your privacy is gone, you'll find your freedoms will start to vanish, too.
[01:30:26.760 --> 01:30:31.960] So protect your rights, say no to surveillance, and keep your information to yourself.
[01:30:31.960 --> 01:30:34.520]  Privacy, it's worth hanging on to.
[01:30:34.520 --> 01:30:40.200] This message is brought to you by Startpage.com, the private search engine alternative to Google,
[01:30:40.200 --> 01:30:41.860]  Yahoo, and Bing.
[01:30:41.860 --> 01:30:45.360]  Start over with Startpage.
[01:30:45.360 --> 01:30:49.400] The next time you go sunbathing in your backyard, check the sky first.
[01:30:49.400 --> 01:30:54.640] Google or Apple may have spy planes with cameras buzzing overhead, and they could be filming
[01:30:54.640 --> 01:30:55.640]  you.
[01:30:55.640 --> 01:30:59.800] Google's airborne cameras capture images so detailed they can almost count the hairs
[01:30:59.800 --> 01:31:00.980]  on your head.
[01:31:00.980 --> 01:31:06.340] And Apple has military-grade cameras so powerful they can spy into your home through skylights
[01:31:06.340 --> 01:31:07.880]  and windows.
[01:31:07.880 --> 01:31:12.640] Google says it needs all this power to produce new 3D maps with more detail than Google Earth's
[01:31:12.640 --> 01:31:13.640]  satellite images.
[01:31:13.640 --> 01:31:15.520] But who really needs this?
[01:31:15.520 --> 01:31:20.160] I say we need to shut down Google's big eyes before there's no place left to hide from
[01:31:20.160 --> 01:31:21.160]  the watchers.
[01:31:21.160 --> 01:31:31.080] I'm Dr. Catherine Albrecht for Startpage.com, the world's most private search engine.
[01:31:31.080 --> 01:31:36.440] This is Building 7, a 47-story skyscraper that fell on the afternoon of September 11.
[01:31:36.440 --> 01:31:38.640] The government says that fire brought it down.
[01:31:38.640 --> 01:31:43.520] Over 1,500 architects and engineers have concluded it was a controlled demolition.
[01:31:43.520 --> 01:31:46.160] Over 6,000 of my fellow service members have given their lives.
[01:31:46.160 --> 01:31:48.960] But thousands of my fellow first responders are dying.
[01:31:48.960 --> 01:31:50.440]  I'm not a conspiracy theorist.
[01:31:50.440 --> 01:31:51.440]  I'm a structural engineer.
[01:31:51.440 --> 01:31:52.760]  I'm a New York City correction officer.
[01:31:52.760 --> 01:31:53.760]  I'm an Air Force pilot.
[01:31:53.760 --> 01:31:55.360]  I'm a father who lost his son.
[01:31:55.360 --> 01:31:58.040] We're Americans, and we deserve the truth.
[01:31:58.040 --> 01:32:00.040]  Go to RememberBuilding7.org today.
[01:32:00.040 --> 01:32:03.400] Hey, it's Danny here for Hill Country Home Improvements.
[01:32:03.400 --> 01:32:06.680] Did your home receive hail or wind damage from the recent storms?
[01:32:06.680 --> 01:32:10.320] Come on, we all know the government caused it with their chemtrails, but good luck getting
[01:32:10.320 --> 01:32:11.320] them to pay for it.
[01:32:11.320 --> 01:32:14.960] Okay, I might be kidding about the chemtrails, but I'm serious about your roof.
[01:32:14.960 --> 01:32:18.760] That's why you have insurance, and Hill Country Home Improvements can handle the claim for
[01:32:18.760 --> 01:32:21.520] you with little to no out-of-pocket expense.
[01:32:21.520 --> 01:32:25.880] And we accept Bitcoin as a multi-year A-plus member of the Better Business Bureau with
[01:32:25.880 --> 01:32:27.120]  zero complaints.
[01:32:27.120 --> 01:32:31.460] You can trust Hill Country Home Improvements to handle your claim and your roof right the
[01:32:31.460 --> 01:32:32.460]  first time.
[01:32:32.460 --> 01:32:41.200] Just call 512-992-8745 or go to hillcountryhomeimprovements.com, mention the crypto show, and get $100 off.
[01:32:41.200 --> 01:32:45.800] And we'll donate another $100 to the Logos Radio Network to help continue this programming.
[01:32:45.800 --> 01:32:50.960] So if those out-of-town roofers come knocking, your door should be locking.
[01:32:50.960 --> 01:32:57.360]  That's 512-992-8745 or hillcountryhomeimprovements.com.
[01:32:57.360 --> 01:32:58.880] Discounts are based on full roof replacement.
[01:32:58.880 --> 01:33:04.600] May not actually be kidding about chemtrails.
[01:33:04.600 --> 01:33:28.840] You are listening to the Logos Radio Network, logosradionetwork.com.
[01:33:28.840 --> 01:33:29.840]  We are back.
[01:33:29.840 --> 01:33:34.240] This is Rule of Law Radio with Leanne D. Kelton at Zetpack.
[01:33:34.240 --> 01:33:36.720] Before we get started, I have a quick question for you.
[01:33:36.720 --> 01:33:42.920] So we were talking about bar grievances, and I've got this question with this.
[01:33:42.920 --> 01:33:46.940] So in order to throw a bar grievance, how does one do that?
[01:33:46.940 --> 01:33:50.120] Do you have to know the laws against the lawyer?
[01:33:50.120 --> 01:33:54.320] I mean, how do you know where to pull one of these?
[01:33:54.320 --> 01:33:55.320]  Okay.
[01:33:55.320 --> 01:33:57.840] This is the good part about bar grievances.
[01:33:57.840 --> 01:34:06.200] Now, we have the American Bar Association standards, and most states, all but three, have adopted
[01:34:06.200 --> 01:34:14.000] the model American Bar Association standards, and then they've made minor adjustments themselves.
[01:34:14.000 --> 01:34:20.440] But the only ones that need to know what those are are the lawyers.
[01:34:20.440 --> 01:34:25.760] You and I, we can grieve them for anything.
[01:34:25.760 --> 01:34:32.320] I can file a bar grievance and claim that that no good, dirty, rotten schreister parts
[01:34:32.320 --> 01:34:36.600] his hair on the left, if you can believe that.
[01:34:36.600 --> 01:34:37.600]  He should be disbarred.
[01:34:37.600 --> 01:34:38.600]  Really?
[01:34:38.600 --> 01:34:39.600]  Yeah.
[01:34:39.600 --> 01:34:40.600]  Really?
[01:34:40.600 --> 01:34:41.600]  Yeah.
[01:34:41.600 --> 01:34:45.120] The bar is going to send me a letter back saying we examined into your accusation and
[01:34:45.120 --> 01:34:49.320] find it does not rise to the level of misconduct.
[01:34:49.320 --> 01:34:59.720] I can say the lawyer took this grieving widow's money and then took her house and sold it
[01:34:59.720 --> 01:35:03.920] and had her evicted on the street, out onto the street.
[01:35:03.920 --> 01:35:08.640] And I'll get this letter from the bar that says, we examined into your accusation and
[01:35:08.640 --> 01:35:12.640] find it does not rise to the level of misconduct.
[01:35:12.640 --> 01:35:18.680] It makes no difference what you accuse a lawyer of.
[01:35:18.680 --> 01:35:25.040] If it's valid, invalid, it makes no difference.
[01:35:25.040 --> 01:35:29.600] For the most part, anything that doesn't seem right is not.
[01:35:29.600 --> 01:35:35.520] And if you read through the standards, you'll be amazed at what you can grieve them for.
[01:35:35.520 --> 01:35:40.000]  But I'm saying it doesn't matter.
[01:35:40.000 --> 01:35:42.800] Grieve them because they part their hair the wrong way.
[01:35:42.800 --> 01:35:45.000] You didn't create this mess for them.
[01:35:45.000 --> 01:35:46.000]  They did.
[01:35:46.000 --> 01:35:52.360] Okay, so what if you have a lawyer that you hired and you feel as though that this lawyer
[01:35:52.360 --> 01:35:57.920] hasn't represented you to what you need, but they told you from the very beginning, oh
[01:35:57.920 --> 01:36:02.840] yes, I can do your case, we can get this, I feel 70% sure that we're going to win this
[01:36:02.840 --> 01:36:03.840]  case.
[01:36:03.840 --> 01:36:06.240] And you get into it, halfway into it.
[01:36:06.240 --> 01:36:07.240]  They want more money.
[01:36:07.240 --> 01:36:08.400]  They want more money.
[01:36:08.400 --> 01:36:11.200]  And you don't feel like you've accomplished a damn thing.
[01:36:11.200 --> 01:36:15.960] So can you throw a bar grievance at them for saying that you don't feel like you've accomplished
[01:36:15.960 --> 01:36:20.240] it, feel like they misrepresented the fact that they could represent you?
[01:36:20.240 --> 01:36:21.860]  Absolutely.
[01:36:21.860 --> 01:36:26.200] The point is you can bar grieve them for anything you don't like.
[01:36:26.200 --> 01:36:33.480] And unfortunately, as far as the bar is concerned, it doesn't matter what you grieve them for.
[01:36:33.480 --> 01:36:35.800] The bar is not going to act against them.
[01:36:35.800 --> 01:36:38.960] So do they know that they were bar grievance?
[01:36:38.960 --> 01:36:42.600] Oh yes, absolutely they know.
[01:36:42.600 --> 01:36:48.720] And the worst part for the lawyer is when they're grieved, they have to notify their
[01:36:48.720 --> 01:36:51.800]  insurance carrier.
[01:36:51.800 --> 01:36:58.960] They have to tell on themselves because if they don't, then they're not insured.
[01:36:58.960 --> 01:37:05.240] And the point is, the bar is not going to pay any attention to what you file against
[01:37:05.240 --> 01:37:08.560] a lawyer, no matter what it is.
[01:37:08.560 --> 01:37:15.880] So you can bar grieve them for anything.
[01:37:15.880 --> 01:37:17.120] How would you go about doing that?
[01:37:17.120 --> 01:37:24.760] Say the person like Scott earlier, this happened seven years ago or whatever.
[01:37:24.760 --> 01:37:30.160] And you feel like, well, if I had have had a better lawyer, she would have said that
[01:37:30.160 --> 01:37:33.880] she couldn't represent me to my best, but here's someone she thinks could have represented
[01:37:33.880 --> 01:37:34.880]  me.
[01:37:34.880 --> 01:37:44.360] And I mean, could you possibly see that you could make, would she possibly try something
[01:37:44.360 --> 01:37:46.360]  with you?
[01:37:46.360 --> 01:37:53.720] Seven years is really too long to try to achieve any remedy.
[01:37:53.720 --> 01:38:02.320] I mean, you could bar grieve the lawyer and even if the bar grievance is out of time for
[01:38:02.320 --> 01:38:09.440] something that's absolutely doesn't matter, it's going to hurt the lawyer anyway.
[01:38:09.440 --> 01:38:14.560] And you know, lawyers complain about that, that I can bar grieve them because they part
[01:38:14.560 --> 01:38:19.200] their hair on the left and it's going to double their malpractice insurance.
[01:38:19.200 --> 01:38:24.320] And I say, sorry, guys, you created this mess.
[01:38:24.320 --> 01:38:27.360] You made it so that a bar grievance means nothing.
[01:38:27.360 --> 01:38:30.160] That's why the insurance carrier stings you so hard.
[01:38:30.160 --> 01:38:32.880] So how do you file that?
[01:38:32.880 --> 01:38:41.720] Oh, you can go to the state bar association and they have a grievance form on their website.
[01:38:41.720 --> 01:38:48.440] Now if your lawyer's done a number of things, don't put them all in one grievance.
[01:38:48.440 --> 01:38:51.560] Don't file them all at the same time.
[01:38:51.560 --> 01:38:56.200] Because if you do, the bar will treat it like one grievance.
[01:38:56.200 --> 01:39:01.360] So you file them a week apart for each thing he's done.
[01:39:01.360 --> 01:39:05.000] And that way they come in as separate grievances.
[01:39:05.000 --> 01:39:10.200] Now you'll get a notice back from the bar that says be examined into your accusation
[01:39:10.200 --> 01:39:13.880] and find it does not rise to the level of misconduct.
[01:39:13.880 --> 01:39:19.200] And I can assure you that is exactly what it says.
[01:39:19.200 --> 01:39:25.280] It doesn't matter what state you're in, they all say the same thing.
[01:39:25.280 --> 01:39:27.480]  It's how bad it is.
[01:39:27.480 --> 01:39:30.880] So you're going to get that so don't feel frustrated.
[01:39:30.880 --> 01:39:37.760] It's a good thing because what they're not going to tell you is you're going to double
[01:39:37.760 --> 01:39:40.440]  their malpractice insurance.
[01:39:40.440 --> 01:39:42.520] It hurts them big time.
[01:39:42.520 --> 01:39:44.600] So it doesn't matter what you file.
[01:39:44.600 --> 01:39:54.680] It's better that, you know, I don't suggest you file fraudulent or facetious complaints.
[01:39:54.680 --> 01:39:57.640]  We don't need to.
[01:39:57.640 --> 01:40:04.160] Lawyers will give you more than ample opportunity to file grievances against them.
[01:40:04.160 --> 01:40:11.200] And if you read through the bar association standards, you'll read like a comic book.
[01:40:11.200 --> 01:40:17.200] You won't believe the stuff you can nail them for, legitimately.
[01:40:17.200 --> 01:40:23.120] So you can go to the state bar association, they have a fill in the blank site, a form
[01:40:23.120 --> 01:40:27.960] on their site, and you can just fill that form out.
[01:40:27.960 --> 01:40:30.120] And then you download it, print it, sign it.
[01:40:30.120 --> 01:40:35.480] They won't accept it electronically and then you mail it to them.
[01:40:35.480 --> 01:40:40.160] So you'll always get that same form letter back and that's okay because you've done
[01:40:40.160 --> 01:40:41.160]  them good.
[01:40:41.160 --> 01:40:48.200] And the lawyer won't say anything to you about it because he's forbidden to.
[01:40:48.200 --> 01:40:55.640] If he mentions it in court, you ask for sanctions against him because the bar forbids him to
[01:40:55.640 --> 01:40:57.720]  do that.
[01:40:57.720 --> 01:41:00.880] And then you file a bar grievance against it for that.
[01:41:00.880 --> 01:41:03.440]  It really hurts lawyers.
[01:41:03.440 --> 01:41:08.640] Rob, how many bar grievances have you filed?
[01:41:08.640 --> 01:41:11.680]  I'm way behind, Randy.
[01:41:11.680 --> 01:41:13.640]  I'm ashamed to admit it.
[01:41:13.640 --> 01:41:18.080]  I've only filed, I think, about 15 in this case.
[01:41:18.080 --> 01:41:19.080]  15?
[01:41:19.080 --> 01:41:20.080]  What?
[01:41:20.080 --> 01:41:21.080]  Have you been sleeping?
[01:41:21.080 --> 01:41:22.080] You've been snorting too much diesel fumes?
[01:41:22.080 --> 01:41:23.080]  15?
[01:41:23.080 --> 01:41:30.560] Well, one of my envelopes that had five bar grievances against different attorneys got
[01:41:30.560 --> 01:41:36.600] returned to me because they changed the address of the bar association.
[01:41:36.600 --> 01:41:39.560]  I need to fix that and re-send it.
[01:41:39.560 --> 01:41:43.240] And you forgot the most important part about filing a bar grievance.
[01:41:43.240 --> 01:41:46.600] When you get that letter back saying that your allegations don't rise to the level of
[01:41:46.600 --> 01:41:50.560] misconduct and they're not going to do anything, you need to file a bar grievance against the
[01:41:50.560 --> 01:41:53.560] attorney that sent that letter.
[01:41:53.560 --> 01:42:06.680] This is what I've met earlier when we talked about how the courts hate pro-says because
[01:42:06.680 --> 01:42:11.960] every once in a while they run across Rob from New Mexico.
[01:42:11.960 --> 01:42:18.960] I think the court actually likes me, but the bar absolutely hates me.
[01:42:18.960 --> 01:42:20.240] And this is what we have to do.
[01:42:20.240 --> 01:42:26.640] I mean, this is dirty, rotten, low down, and it's patently unfair to lawyers.
[01:42:26.640 --> 01:42:28.200]  Sorry, guys.
[01:42:28.200 --> 01:42:29.640]  Life is tough.
[01:42:29.640 --> 01:42:35.240] You created this mess for yourself, so you don't get to come and whine to us about it.
[01:42:35.240 --> 01:42:39.880] If you'd had adequate oversight, you wouldn't have this problem.
[01:42:39.880 --> 01:42:49.760] There was an article recently in the American Bar Association newsletter that said 20% of
[01:42:49.760 --> 01:42:58.920] all litigants now are pro-say litigants primarily because they don't trust lawyers.
[01:42:58.920 --> 01:43:02.480] So lawyers have created this mess for themselves.
[01:43:02.480 --> 01:43:10.280] So I suggest to people, don't feel bashful about filing bar grievances.
[01:43:10.280 --> 01:43:15.360] If lawyers don't want bar grievances filed against them, then they need to start doing
[01:43:15.360 --> 01:43:16.360]  their job right.
[01:43:16.360 --> 01:43:17.360]  That's true.
[01:43:17.360 --> 01:43:24.680] But then on the other hand, they're in business, they're in business to make money, and they
[01:43:24.680 --> 01:43:33.760] don't dare adequately adjudicate your case because the judge is not going to be happy.
[01:43:33.760 --> 01:43:38.120] They're not going to do anything to annoy the judge, or the judge can pull their bar
[01:43:38.120 --> 01:43:41.880] card at the drop of a hat.
[01:43:41.880 --> 01:43:43.760]  So they're in a bad spot.
[01:43:43.760 --> 01:43:45.200] We need to get them out of that spot.
[01:43:45.200 --> 01:43:50.040] The best way we can get them out of that spot is grieving them to oblivion.
[01:43:50.040 --> 01:43:53.040]  Hang on, Randy Kelton.
[01:43:53.040 --> 01:44:00.280] My tang is getting talk of Randy Kelton, vet pack with my radio, we'll be right back.
[01:44:00.280 --> 01:44:03.800] You feel tired when talking about important topics like money and politics?
[01:44:03.800 --> 01:44:04.800]  Sorry!
[01:44:04.800 --> 01:44:07.680] Are you confused by words like the Constitution or the Federal Reserve?
[01:44:07.680 --> 01:44:08.680]  What?
[01:44:08.680 --> 01:44:12.480] If so, you may be diagnosed with the deadliest disease known today, stupidity.
[01:44:12.480 --> 01:44:17.960] Hi, my name is Steve Holt, and like millions of other Americans, I was diagnosed with stupidity
[01:44:17.960 --> 01:44:19.200]  at an early age.
[01:44:19.200 --> 01:44:23.160] I had no idea that the number one cause of the disease is found in almost every home
[01:44:23.160 --> 01:44:25.320]  in America, the television.
[01:44:25.320 --> 01:44:30.320] Unfortunately, that puts most Americans at risk of catching stupidity, but there is hope.
[01:44:30.320 --> 01:44:34.080] The staff at Brave New Books have helped me and thousands of other foxaholics suffering
[01:44:34.080 --> 01:44:38.960] from sports zombieism recover, and because of Brave New Books, I now enjoy reading and
[01:44:38.960 --> 01:44:42.560] watching educational documentaries without feeling tired or uninterested.

[01:46:29.080 --> 01:46:35.080] Okay, and we are talking to Rob in New Mexico.
[01:46:35.080 --> 01:46:42.080] Okay, Rob, where were we before we got sidetracked on having fun with attorneys?
[01:46:42.080 --> 01:46:47.080] So we were talking about an affidavit of costs submitted by an attorney.
[01:46:47.080 --> 01:46:50.080] Yeah, I got one of those too.
[01:46:50.080 --> 01:46:58.080] And I'm going to bargrieve the lawyer.
[01:46:58.080 --> 01:47:02.080] Could you explain exactly what that is that you received?
[01:47:02.080 --> 01:47:13.080] Yeah, if the court rules against you, the other side sometimes asks the court to grant them attorney fees.
[01:47:13.080 --> 01:47:14.080]  Okay.
[01:47:14.080 --> 01:47:20.080] And this guy asked for 800 bucks in attorney fees, so I'll just bargrieve him.
[01:47:20.080 --> 01:47:29.080] And I'll charge him about, I'll cost him about 20 grand a year in increased malpractice insurance.
[01:47:29.080 --> 01:47:35.080] And then if the judge, if the judge has no subject matter jurisdiction,
[01:47:35.080 --> 01:47:42.080] so if the judge grants him the $800, I'll give him a dollar.
[01:47:42.080 --> 01:47:44.080]  I'll give him a dollar.
[01:47:44.080 --> 01:47:53.080] He can't go back and ask the judge for sanctions for not paying the attorney fees because I'm paying them.
[01:47:53.080 --> 01:47:56.080]  So it's just him.
[01:47:56.080 --> 01:48:05.080] He's doing that because he thinks that I'm indigent pro se and this is a fight in me so I won't come back after him.
[01:48:05.080 --> 01:48:08.080]  We're breaking from that habit.
[01:48:08.080 --> 01:48:14.080] You can do the same thing, Rob.
[01:48:14.080 --> 01:48:16.080]  You there?
[01:48:16.080 --> 01:48:18.080]  Yeah, I'm here.
[01:48:18.080 --> 01:48:27.080] Well, my question on that, and I've already got this guy hung on FDCPA because the minute he filed the counterclaim asking for attorney fees,
[01:48:27.080 --> 01:48:30.080] I sent him a validation command and he didn't respond to it.
[01:48:30.080 --> 01:48:32.080] And he keeps asking for money.
[01:48:32.080 --> 01:48:35.080] So I'm going to be suing him in federal court.
[01:48:35.080 --> 01:48:40.080] But my question is, you have a hearing on a cost issue on the 19th.
[01:48:40.080 --> 01:48:43.080]  So I've never faced this before.
[01:48:43.080 --> 01:48:44.080]  What do I do?
[01:48:44.080 --> 01:48:47.080] They have this hearing on this particular issue.
[01:48:47.080 --> 01:48:48.080]  Wait a minute.
[01:48:48.080 --> 01:48:52.080]  A cost issue on the 19th?
[01:48:52.080 --> 01:48:55.080]  A hearing on the 19th.
[01:48:55.080 --> 01:48:56.080]  Oh, okay.
[01:48:56.080 --> 01:48:59.080]  For the cost.
[01:48:59.080 --> 01:49:00.080]  Wait a minute.
[01:49:00.080 --> 01:49:01.080] You kind of broke up there.
[01:49:01.080 --> 01:49:04.080]  A hearing on the 19th for what?
[01:49:04.080 --> 01:49:05.080]  The cost.
[01:49:05.080 --> 01:49:10.080]  Oh, okay.
[01:49:10.080 --> 01:49:12.080]  Did he win?
[01:49:12.080 --> 01:49:15.080] Did you get a case ruled against you?
[01:49:15.080 --> 01:49:19.080] Yeah, they got summary judgment.
[01:49:19.080 --> 01:49:23.080] And you didn't appeal the summary judgment?
[01:49:23.080 --> 01:49:26.080]  Right.
[01:49:26.080 --> 01:49:30.080]  Oh.
[01:49:30.080 --> 01:49:33.080]  Okay.
[01:49:33.080 --> 01:49:37.080]  There's a chance the judge will award attorney fees.
[01:49:37.080 --> 01:49:41.080] So what did he ask for in attorney fees?
[01:49:41.080 --> 01:49:44.080]  What's that?
[01:49:44.080 --> 01:49:46.080]  How much?
[01:49:46.080 --> 01:49:48.080]  Yes.
[01:49:48.080 --> 01:49:51.080]  He's asking for $7,000.
[01:49:51.080 --> 01:49:53.080]  Now that's absorbent.
[01:49:53.080 --> 01:49:58.080] And you might ask him for a complete accounting.
[01:49:58.080 --> 01:50:07.080] Well, he gave a list of everything that he did and how long it took and what he charged for it.
[01:50:07.080 --> 01:50:11.080]  That's when you should have appealed.
[01:50:11.080 --> 01:50:18.080] Most likely the court's not going to award it to him.
[01:50:18.080 --> 01:50:28.080] The thing about summary judgments is they can almost always be overturned.
[01:50:28.080 --> 01:50:29.080]  Okay.
[01:50:29.080 --> 01:50:32.080]  Why didn't you appeal?
[01:50:32.080 --> 01:50:37.080] Because I had already amended my FDCPA case to include these defendants.
[01:50:37.080 --> 01:50:46.080] And I thought it would just be easier to deal with that rather than having another case going.
[01:50:46.080 --> 01:50:48.080]  I had three cases.
[01:50:48.080 --> 01:50:50.080]  Now I only have two, but I'm still...
[01:50:50.080 --> 01:50:51.080]  Oh, okay.
[01:50:51.080 --> 01:50:52.080]  Okay.
[01:50:52.080 --> 01:51:00.080] Now you might file an objection claiming that these same issues are still being litigated
[01:51:00.080 --> 01:51:08.080] as to why the reasons for not appealing and that the issues are still before court.
[01:51:08.080 --> 01:51:12.080]  Okay.
[01:51:12.080 --> 01:51:14.080]  That sounds good.
[01:51:14.080 --> 01:51:24.080] And even if they do get a claim against you, you're familiar with Mike Maris?
[01:51:24.080 --> 01:51:26.080]  Yeah, absolutely.
[01:51:26.080 --> 01:51:31.080] You don't have to worry about that because he'll try to collect and he won't collect properly
[01:51:31.080 --> 01:51:36.080] and then you get to go back and you may be able to sue him for more than he's trying to collect.
[01:51:36.080 --> 01:51:39.080]  Yep. Yep.
[01:51:39.080 --> 01:51:44.080] But make sure you bar-greed him again just for yucks.
[01:51:44.080 --> 01:51:45.080]  Oh, yeah.
[01:51:45.080 --> 01:51:49.080] And I'm going to bar-greed the attorney today for submitting an altered document,
[01:51:49.080 --> 01:51:52.080] even if that won't fly in court.
[01:51:52.080 --> 01:51:54.080]  Yeah.
[01:51:54.080 --> 01:51:57.080]  They may mess with the bar-greeders.
[01:51:57.080 --> 01:52:00.080] It gives us leverage that we can use against them.
[01:52:00.080 --> 01:52:03.080] So we let them deal with it.
[01:52:03.080 --> 01:52:04.080]  Okay.
[01:52:04.080 --> 01:52:06.080] Do you have anybody behind me?
[01:52:06.080 --> 01:52:08.080]  Nope.
[01:52:08.080 --> 01:52:09.080]  Okay.
[01:52:09.080 --> 01:52:12.080] Let's go on to my federal case then.
[01:52:12.080 --> 01:52:17.080] You know, I sued the debt collector attorney and his law firm.
[01:52:17.080 --> 01:52:18.080]  Okay.
[01:52:18.080 --> 01:52:23.080] During the process of my state case against the escrow company,
[01:52:23.080 --> 01:52:30.080] they acknowledged that they obtained the account after a default.
[01:52:30.080 --> 01:52:35.080] So I amended my FDCPA case in federal court to include them.
[01:52:35.080 --> 01:52:38.080] In addition to the company,
[01:52:38.080 --> 01:52:45.080] I named the executive officer who submitted the affidavit in the state court,
[01:52:45.080 --> 01:52:48.080]  and I named their four directors.
[01:52:48.080 --> 01:52:58.080] Well, one of the directors has a name similar to the name of the debt collector,
[01:52:58.080 --> 01:53:01.080]  the debt collector attorney.
[01:53:01.080 --> 01:53:08.080] So I named him in his capacity as director of the trust company.
[01:53:08.080 --> 01:53:11.080] Well, they came back and answered.
[01:53:11.080 --> 01:53:15.080] The trust company answered for the trust company,
[01:53:15.080 --> 01:53:22.080] the executive officer, and all of the other directors, but not that guy.
[01:53:22.080 --> 01:53:27.080] And the debt collector attorney, his law firm,
[01:53:27.080 --> 01:53:32.080] and director of the trust company with a similar name to the debt collector attorney,
[01:53:32.080 --> 01:53:38.080] all answered, admitting that that director of the escrow company,
[01:53:38.080 --> 01:53:44.080] the trust company, is a debt collector.
[01:53:44.080 --> 01:53:49.080] But they're saying that the trust company is not a debt collector.
[01:53:49.080 --> 01:53:54.080] So how is this guy in his capacity as a director a debt collector,
[01:53:54.080 --> 01:53:58.080] because the trust company is?
[01:53:58.080 --> 01:54:07.080] So that just means he likely has two separate positions.
[01:54:07.080 --> 01:54:09.080]  That doesn't sound right.
[01:54:09.080 --> 01:54:16.080] If he's the director of the trust company, who's he collecting debts for?
[01:54:16.080 --> 01:54:19.080]  Exactly.
[01:54:19.080 --> 01:54:27.080] So that was a question. Is he collecting debts for the same company that he's the director of?
[01:54:27.080 --> 01:54:29.080]  Yeah.
[01:54:29.080 --> 01:54:39.080] Okay. How is that, from your perspective, how does that make a difference?
[01:54:39.080 --> 01:54:42.080]  It doesn't.
[01:54:42.080 --> 01:54:49.080] The trust company is a debt collector trying to collect a debt for the seller.
[01:54:49.080 --> 01:54:56.080] And they admitted that by saying that this director in his capacity as a director is a debt collector.
[01:54:56.080 --> 01:55:00.080] Oh, okay. Now I see where you're going. It took me a while to sort out where you're going.
[01:55:00.080 --> 01:55:07.080] So, okay. Did they claim they were not a debt collector?
[01:55:07.080 --> 01:55:16.080] Absolutely. The trust company and the executive and the other directors claim that they're not debt collectors.
[01:55:16.080 --> 01:55:26.080] But the debt collector admitted to being a debt collector in his capacity as director of the trust company.
[01:55:26.080 --> 01:55:34.080] Okay. So how does that affect the adjudication of your case?
[01:55:34.080 --> 01:55:40.080] And what I'm going to is how does that give you a clue?
[01:55:40.080 --> 01:55:49.080] If they had included all of the directors together with the trust company and said, we're not debt collectors.
[01:55:49.080 --> 01:55:59.080] Oh, hold on. Okay. He is a director and they didn't include him in, oh, wait a minute.
[01:55:59.080 --> 01:56:03.080] They didn't include him with the other directors.
[01:56:03.080 --> 01:56:10.080] Okay. What I'm thinking is they failed to name a interested party.
[01:56:10.080 --> 01:56:17.080] Did they file an action against you that included all these people except the debt collector?
[01:56:17.080 --> 01:56:21.080]  No, no. I sued them. They haven't done anything.
[01:56:21.080 --> 01:56:26.080] Okay. I'm trying to find a way that this creates a claim.
[01:56:26.080 --> 01:56:34.080] One way, if he's included in one place and not another, then the party is not included.
[01:56:34.080 --> 01:56:41.080] They may well have no subject matter jurisdiction because they failed to name a necessary party.
[01:56:41.080 --> 01:56:43.080]  Right.
[01:56:43.080 --> 01:56:51.080] Okay. Then what is the issue about this? Why is this important?
[01:56:51.080 --> 01:57:01.080] Well, what I just said, if they had included him in his capacity as a director with the other directors and the trust company,
[01:57:01.080 --> 01:57:06.080] that would probably fly and they could say, well, the trust company is not a debt collector,
[01:57:06.080 --> 01:57:13.080] but this guy in his capacity as an attorney in his law firm, yeah, they might be debt collectors.
[01:57:13.080 --> 01:57:19.080] Okay. But what they did instead was they cut him off.
[01:57:19.080 --> 01:57:24.080] Everybody else is represented by one attorney saying that they're not debt collectors.
[01:57:24.080 --> 01:57:33.080] He in both capacities as director of the company and as an attorney is represented by another attorney,
[01:57:33.080 --> 01:57:37.080] wherein they admitted that they are all debt collectors.
[01:57:37.080 --> 01:57:42.080] Well, did they admit they all were debt collectors or did just he was a debt collector?
[01:57:42.080 --> 01:57:46.080] Just he, just he in both capacities.
[01:57:46.080 --> 01:57:56.080] Okay. So if he is debt collector in his capacity as a director of the company, doesn't that tie the company to the debt?
[01:57:56.080 --> 01:58:06.080] Not necessarily. If he can exercise the debt collecting functions independent of his capacity as a director of the company, I wouldn't.
[01:58:06.080 --> 01:58:10.080] I'm not sure this is a really fine point of law.
[01:58:10.080 --> 01:58:18.080] Whether a executive of a company can step aside and become a debt collector separate from the company.
[01:58:18.080 --> 01:58:24.080] Saying it that way, it doesn't sound like they would be able to. It doesn't sound right.
[01:58:24.080 --> 01:58:27.080]  Yeah, they're not separating him. They're getting it.
[01:58:27.080 --> 01:58:30.080] Okay. I'm sorry. We are out of time.
[01:58:30.080 --> 01:58:37.080] You want to bring this up?
[01:58:37.080 --> 01:58:43.080] Okay. Thank you all for listening.
[01:58:43.080 --> 01:58:50.080] We'll be back next Thursday at eight o'clock and then Friday at eight. Thank you all for listening. Good night.
