[04:30.400 --> 04:35.120]  of how you do a complete statement of facts, and then within this, I mean the statement

[04:37.440 --> 04:41.440]  Within there, you'll make the claim that he did this, this, and this.
[04:41.440 --> 04:48.880]  That amounts to a violation of this statute, and you write that accusation complete within
[04:48.880 --> 04:55.680]  your statement of factual accusation, so that you can then take a criminal complaint, say
[04:55.680 --> 04:58.240]  for tampering with a government document.

[05:49.160 --> 05:58.000]  go in and change the statute numbers, so that, and always make every criminal accusation

[07:12.280 --> 07:17.080]  there's another term for it, but this is essentially a brief in support, that's what I was looking

[07:18.080 --> 07:21.520]  Is that what points of authority is, a factual allegation?

[07:40.200 --> 07:48.680]  You have to, you give them the facts, and then you tell them the story, but we're not

[08:01.880 --> 08:08.600]  Primary rule is never make a proactive statement of law out of your own mouth.

[08:17.720 --> 08:25.880]  You got to say exactly how they did it improperly, and what code, what statute, case law, whatever
[08:25.880 --> 08:28.520]  states that that's improper.
[08:28.520 --> 08:33.520]  Now I quit using Lexus and Westlaw because I find the internet is much more valuable
[08:33.520 --> 08:34.640]  to me.
[08:34.640 --> 08:45.400]  I can find briefs, I can find primarily what I want to see is a court ruling.
[08:45.400 --> 08:53.440]  Because the court rulings are very well written, and what I'll do is if I can find a ruling
[08:53.440 --> 09:01.120]  on point, I cut the ruling out of the document and I drop it into my document, and then I
[09:01.120 --> 09:08.600]  change case and tense words to make it lead in and lead out of my document.
[09:08.600 --> 09:16.720]  When a judge reads that, the judge is going to know exactly what you did.
[09:16.720 --> 09:23.920]  He's going to know that you plagiarized that out of a court opinion, and that's exactly
[09:23.920 --> 09:27.280]  what he wants to see.
[09:27.280 --> 09:30.480]  That makes it authoritative.
[09:30.480 --> 09:33.560]  Now you're not making this statement out of your mouth, you're making it out of the
[09:33.560 --> 09:35.160]  mouth of the courts.
[09:35.160 --> 09:46.480]  If you will go on the internet and search your topic and look for legal briefs, do a
[09:46.480 --> 09:57.120]  search for traffic not in commerce, brief, brief and also points and authorities, Texas
[09:57.120 --> 09:58.600]  and see what you get.
[09:58.600 --> 10:06.840]  We've got a lot of lawyers out there, we have too many lawyers, and lawyers can't, only
[10:06.840 --> 10:12.960]  in Texas is it against the law for a lawyer to directly solicit his business.

[10:17.160 --> 10:21.880]  So the lawyer gets out of law school, how the heck is he going to get any business?
[10:21.880 --> 10:27.280]  If a law firm doesn't pick him up, he's got a problem.

[10:36.960 --> 10:45.200]  Well lawyers, since they can't solicit directly, they like to post stuff on the internet, stuff

[10:47.200 --> 10:53.280]  If you've got a guy that specializes in traffic, he's going to post a lot of his briefs and
[10:53.280 --> 10:58.080]  pleadings on the internet so other lawyers can find him.
[10:58.080 --> 11:01.520]  So if they need his expertise, they call it.
[11:01.520 --> 11:07.040]  So that's wonderful, because we can find it.
[11:07.040 --> 11:11.440]  My legal research, I look up very little on my own.
[11:11.440 --> 11:15.280]  I go on the internet and find where somebody else has already briefed out the subject and
[11:15.280 --> 11:18.120]  I take their briefs.
[11:18.120 --> 11:21.840]  You read some of my briefs, you thought it was pretty well written.

[11:31.160 --> 11:38.360]  So I guess so, I mean, now we're getting into the actual topic I wanted to really talk about,

[11:53.800 --> 12:00.120]  of case law, and then you make a few statements of fact, and then it leads into another piece
[12:00.120 --> 12:05.520]  of case law to back it up, and then you go into more statements of fact, and then you
[12:05.520 --> 12:10.880]  use another piece of case law to back that up, and you just trickle right on down through
[12:10.880 --> 12:16.680]  this story because you actually put together a story, which is your timeline, and stitched
[12:16.680 --> 12:19.280]  it all together with case law to back up everything.
[12:19.280 --> 12:23.280]  Yes, and it has to be a good story.

[12:24.280 --> 12:29.880]  You're writing a novel here or a short story.

[12:34.200 --> 12:41.240]  That's the hardest part I would say for a lot of people, I don't know, but for me, struggling
[12:41.240 --> 12:49.320]  out is writing the story and making it to where the 180-degree peripheral vision as
[12:49.320 --> 12:53.280]  you're going through the story to make it as descriptive as possible.

[12:56.080 --> 13:04.040]  If you're married, take it to your wife and ask her to whip you to pieces.

[13:08.560 --> 13:15.280]  Take it to somebody who has no compunction about just tearing you to pieces and have
[13:15.280 --> 13:19.160]  them whip it apart.

[13:25.560 --> 13:32.880]  Most people who are not that comfortable with you are uncomfortable with tearing your work

[15:39.240 --> 15:42.880]  is not as good as something else I had, and then you go back and get it.
[15:42.880 --> 15:45.560]  If you have everything under a different version, you got it all.
[15:45.560 --> 15:51.000]  If what you're working on craps out and you lose it, you can back up a version.
[15:51.000 --> 15:58.360]  You don't lose so much, and once you have a final document, save it as a PDF, and then
[15:58.360 --> 16:03.880]  trash all but the last version, and keep a Word version and keep a PDF version, and keep
[16:03.880 --> 16:10.680]  a PDF version so you know exactly what you actually filed.

[16:16.880 --> 16:19.320]  lot of trouble to change it.

[22:09.360 --> 22:14.240]  If a policeman gives a prosecutor a criminal complaint, he does not do so in his capacity
[22:14.240 --> 22:16.280]  as a policeman.

[22:21.600 --> 22:26.960]  It's intended that citizens write criminal complaints, and because of that, they're not
[22:26.960 --> 22:34.760]  expected to be perfect, so when the prosecutor gets a criminal complaint, he is to reduce
[22:34.760 --> 22:42.280]  the complaint to an information, and information is exactly what the complaint should look
[22:42.280 --> 22:53.200]  like when you give it to the grand jury, except prosecutors are not very artful.
[22:53.200 --> 23:00.440]  They'll just put in an extremely brief statement, and then they want to go in and testify before
[23:00.440 --> 23:04.160]  the grand jury or bring witnesses.
[23:04.160 --> 23:12.240]  Your filing complaints, you can't do that, so you want to testify in the complaint itself.
[23:12.240 --> 23:22.000]  If the prosecutor turns it into an information, then he'll take out all of your argument,
[23:22.000 --> 23:28.400]  but the grand jury gets the complaint along with the information, and that's so that the
[23:28.400 --> 23:32.880]  grand jury can look at it, or a judge can look at it, and make sure that the information
[23:32.880 --> 23:36.040]  accurately reflects the complaint.
[23:36.040 --> 23:42.480]  You want your argument in front of the grand jury, and you always write for the grand jury.
[23:42.480 --> 23:47.040]  If you're making accusations against public officials, they are required to go to the
[23:47.040 --> 23:57.920]  grand jury, so you want that argument, you want that complaint to be completing in itself,
[23:57.920 --> 24:04.680]  so that the reader doesn't have to go somewhere else to check for information.

[34:14.640 --> 34:18.080]  the violation of probation hearing because I had the writ of habeas corpus that was filed.
[34:18.080 --> 34:27.640]  And she said if I prevailed in that, that was set aside what the third court was doing.
[34:27.640 --> 34:34.160]  If I went to guilty, that writ was set aside, whatever they did.
[34:34.160 --> 34:36.120]  That was she explained to me.
[34:36.120 --> 34:38.520]  Yeah, that's true.
[34:38.520 --> 34:49.440]  But the likelihood of any court in Maryland overturning their traffic code is somewhere
[34:49.440 --> 34:55.320]  between little and none because they'd lose all that revenue.
[34:55.320 --> 35:01.080]  Well, I'm going to take it, I'm going to go into this, only to the federal court with
[35:01.080 --> 35:02.080]  it.
[35:02.080 --> 35:07.840]  I mean, you got to get these state remedies, like I had a pilot in the state court first
[35:07.840 --> 35:10.000]  and then, you know, into the federal court.
[35:10.000 --> 35:13.960]  Oh, then that's, that's a maybe.
[35:13.960 --> 35:19.400]  Still the federal courts, they're not that great, but they don't have the investment

[36:00.280 --> 36:05.360]  a license or having a suspended license when you never had one in the first place.

[36:11.440 --> 36:20.480]  The legal, that's a good point where they can rule in your favor and not overturn existing
[36:20.480 --> 36:27.080]  law and all they would have to do at the, at the enforcement level is give you a different

[36:29.080 --> 36:32.080]  No, they can't give you a different ticket.

[36:33.080 --> 36:38.120]  Ooh, that's, you may be back in that conundrum then.

[36:39.120 --> 36:44.600]  This, these cases are back in like 2013, they can't just give you something new.
[36:44.600 --> 36:50.120]  What is going to happen if the court rules in your favor?
[36:50.120 --> 36:59.360]  How is that going to affect, affect enforcement of the requirement they perceive for people
[36:59.360 --> 37:02.360]  to have a driver's license?
[37:02.360 --> 37:03.360]  Yeah.
[37:03.360 --> 37:10.040]  They're trying to make me get one and telling me, you know, to go, to go get a license and
[37:10.040 --> 37:14.280]  you know, come back and come back and pay the fees and come back and show I have a license
[37:14.280 --> 37:17.160]  then of course I'm going to certainly do that.
[37:17.160 --> 37:22.000]  That sounds like they're forcing you to contract with them.
[37:22.000 --> 37:23.000]  Exactly.
[37:23.000 --> 37:24.000]  Exactly.
[37:24.000 --> 37:27.000]  That's what they're doing.
[37:27.000 --> 37:35.680]  Then they're not allowed to do that because the, the, the driver's license is a contract.

[37:36.680 --> 37:41.640]  That's what, that's, that's their own understanding since they're pleading guilty to go get a
[37:41.640 --> 37:45.320]  license and that will solve this issue.
[37:45.320 --> 37:49.280]  So that's, that's where we are now where I'm doing my risk, trying to go through the state
[37:49.280 --> 37:55.640]  level to the federal level and I'm, my argument I was trying to invoke is I have not exhausted
[37:55.640 --> 37:58.120]  all my state remedies.
[37:58.120 --> 38:01.040]  So it's the case is still pending, I'm trying to get through federal court.
[38:01.040 --> 38:06.000]  So I, I'm feeling that certain question, I enforce that when I'm still appealing the
[38:06.000 --> 38:12.520]  matter due to writ of habeas corpus.
[38:12.520 --> 38:20.320]  I'm wondering what the likelihood of a positive outcome on the habeas, and I'm doing this
[38:20.320 --> 38:27.600]  from the perspective, not a rule of law, but from the understanding that everything is
[38:27.600 --> 38:28.600]  political.
[38:28.600 --> 38:34.080]  That the court made an error by, by, by filing a guilty order, I don't know if it's a subject
[38:34.080 --> 38:35.080]  license, but I don't know.
[38:35.080 --> 38:36.080]  No, wait a minute, wait a minute.
[38:36.080 --> 38:39.520]  There's another consideration we need to take.
[38:39.520 --> 38:44.960]  You're doing a consideration based on law.

[39:14.480 --> 39:16.840]  So you're, you're planning to go to, oh, so you're not in the fed yet, but you're planning

[39:19.840 --> 39:24.840]  I filed in the fed and the judge ruled that I got to exhaust my state remedy.

[40:25.760 --> 40:31.920]  Well, I'm thinking, you know, there'd be some of the down, the down the process in
[40:31.920 --> 40:37.120]  the state and versus denial of the process, a due process in the federal.
[40:37.120 --> 40:38.120]  Here's the problem.
[40:38.120 --> 40:46.800]  If you file a due process in the state, then you're likely to be subject to res judicata
[40:46.800 --> 40:51.880]  as concerns, earns filing in the fed.
[40:51.880 --> 41:00.520]  If the state has adjudicated the same issue on the same set of facts, you may be subject
[41:00.520 --> 41:05.200]  to stitch towards, to a, to a stopple.

[41:06.200 --> 41:17.280]  Also, I didn't mention back in, was it back in 1999, a judge dismissed, found me not guilty
[41:17.280 --> 41:21.920]  on driving a suspended license, so that was another county, the same state, a different
[41:21.920 --> 41:22.920]  county.
[41:22.920 --> 41:26.640]  And I tried to use that argument about res judicata, this is our adjudicated, you know,
[41:26.640 --> 41:30.600]  that was right now guilty and I'm riding in good faith that I do not have a suspended
[41:30.600 --> 41:31.600]  license.
[41:31.600 --> 41:34.600]  So the judge was not guilty on that, but they didn't want to think that because it was a
[41:34.600 --> 41:35.600]  different county.
[41:35.600 --> 41:43.520]  Did the judge in the other county rule on the same set of facts?
[41:43.520 --> 41:48.160]  The same, the same evidence as far as the license was fully suspended back in 95 and
[41:48.160 --> 41:49.760]  all this stuff.
[41:49.760 --> 41:50.760]  Yeah.
[41:50.760 --> 41:56.800]  So he ruled on the same issue, same facts and found in your favor.
[41:56.800 --> 42:01.560]  Now you come to another court and they find against you.

[42:59.080 --> 43:09.640]  However, this person who got that ruling had a right to consider that ruling as accurate

[01:11:51.680 --> 01:12:04.680]  You should look at the Maryland state law on habeas, because normally habeas is the great writ, and everything should stand down before the habeas.
[01:12:04.680 --> 01:12:11.680]  But if it's a habeas that doesn't include incarceration, then there may be different rules for it.

[01:12:13.680 --> 01:12:28.680]  But anyway, I guess your main thing you need to do right now is get your notice of appeal in and then get written requests for everything that you need to show.

[01:53:34.680 --> 01:53:40.680]  who bought a Mercedes with a bill of exchange.

[01:53:42.680 --> 01:53:48.680]  Apparently, there is some substance to all of this
[01:53:48.680 --> 01:53:51.680]  because they didn't prosecute him.
[01:53:51.680 --> 01:53:53.680]  But they held him in jail for a month.
[01:53:53.680 --> 01:54:00.680]  I got there and his wife was saying that they had backdated some documents.
[01:54:00.680 --> 01:54:07.680]  So I go in there in a suit and I'm carrying the documents that were backdated.
[01:54:07.680 --> 01:54:11.680]  And I looked at the date stamp on it and I look at that
[01:54:11.680 --> 01:54:14.680]  and said, man, that looks like a rubber stamp.
[01:54:14.680 --> 01:54:21.680]  It looks like one of those little stamps where you can roll the months and days around.
[01:54:21.680 --> 01:54:27.680]  So I went in there and asked them what they used to, you know,
[01:54:27.680 --> 01:54:28.680]  I showed them this document.
[01:54:28.680 --> 01:54:30.680]  I said, it's got this date stamp on it.
[01:54:30.680 --> 01:54:34.680]  But it doesn't appear to be one of those electronic stamps
[01:54:34.680 --> 01:54:36.680]  like that thing up on the wall there.
[01:54:36.680 --> 01:54:38.680]  She said, oh, no, no, that one's broke.
[01:54:38.680 --> 01:54:44.680]  Now, this is the federal court in Brooklyn, New York.
[01:54:44.680 --> 01:54:46.680]  It's broken.
[01:54:46.680 --> 01:54:47.680]  We use this one.
[01:54:47.680 --> 01:54:49.680]  She takes it out and shows it to me.
[01:54:49.680 --> 01:54:50.680]  I said, can I see that?
[01:54:50.680 --> 01:54:51.680]  She said, sure.
[01:54:51.680 --> 01:54:53.680]  And I take it and I look at it.
[01:54:53.680 --> 01:55:00.680]  I said, now, when you change the date on this, you just kind of roll this thing around?
[01:55:00.680 --> 01:55:01.680]  She said, well, yeah.
[01:55:01.680 --> 01:55:03.680]  I said, will it roll backwards?
[01:55:03.680 --> 01:55:05.680]  And I rolled it backwards.
[01:55:05.680 --> 01:55:07.680]  She said, can I see that?
[01:55:07.680 --> 01:55:09.680]  She takes it and zips.
[01:55:09.680 --> 01:55:12.680]  She's gone in the back.
[01:55:12.680 --> 01:55:18.680]  30 minutes later, they were processing him out of jail.

[01:55:20.680 --> 01:55:24.680]  However, you know, and that's the thing about this.
[01:55:24.680 --> 01:55:28.680]  When you do this, you know, Tim Turner was pushing this kind of trash.

[01:55:30.680 --> 01:55:32.680]  Sam Kennedy was pushing it.
[01:55:32.680 --> 01:55:34.680]  He's in jail now.
[01:55:34.680 --> 01:55:44.680]  People do this and they get in trouble and they go to these guys and they say, oh, oh, well, you see this eye here?

[01:55:52.680 --> 01:56:14.680]  This UCC, I mean, this Ken, one of these UCC forms that they were using, there's an OID form they were using it to get money back from the IRS.

[01:56:17.680 --> 01:56:23.680]  And I looked at it and I said, oh, you just file this form and they'll give you back all your tax money.

[01:57:54.680 --> 01:58:01.680]  You give me any 10-digit number and I'll get a hit on it.
[01:58:01.680 --> 01:58:10.680]  He said, they're running their social security number and claiming that, I'm sorry, not 10-digit.
[01:58:10.680 --> 01:58:12.680]  They're claiming that they're finding the securities.
[01:58:12.680 --> 01:58:16.680]  He said, no, they're just finding any security that happens to have that number.
[01:58:16.680 --> 01:58:18.680]  That had nothing to do with birth certificates.
[01:58:18.680 --> 01:58:23.680]  So I have found nothing to back that up.
