[21:37.640 --> 21:39.400]  Yes, starting January the 1st,
[21:39.400 --> 21:42.880]  we now in the state of Texas now have open carry.
[21:42.880 --> 21:44.760]  You can now openly carry your handgun.
[21:44.760 --> 21:48.280]  So what that means is Texas is now the 45th state
[21:48.280 --> 21:51.920]  to actually have open carry of a handgun.
[21:51.920 --> 21:54.600]  So you have to have a handgun license.
[21:54.600 --> 21:56.120]  The state of Texas, what they've done is
[21:56.120 --> 21:57.640]  they've actually changed their
[21:57.640 --> 22:00.000]  concealed handgun license program.
[22:00.000 --> 22:02.920]  So it's no longer called the concealed handgun license.
[22:02.920 --> 22:06.880]  It's now called the license to carry handgun, LTC.
[22:06.880 --> 22:09.200]  So that means that you will have choice in Texas.
[22:09.200 --> 22:11.480]  You'll be able to conceal carry your handgun
[22:11.480 --> 22:14.400]  or openly carry your handgun with a handgun license.
[22:14.400 --> 22:17.760]  And that also means that you can have a handgun license
[22:17.760 --> 22:20.800]  from another state that Texas recognizes.
[22:20.800 --> 22:23.880]  So let's say you have a handgun license from Florida.
[22:23.880 --> 22:25.400]  Well, Texas recognizes Florida,
[22:25.400 --> 22:28.200]  so that means with that Florida license,
[22:28.200 --> 22:30.440]  you will be able to come to Texas
[22:30.440 --> 22:34.280]  and conceal carry or openly carry your handgun in Texas.
[22:34.280 --> 22:36.400]  And that went into effect January the 1st.
[22:36.400 --> 22:38.560]  Now, the kicker to this is,
[22:38.560 --> 22:40.920]  if you're going to openly carry that handgun,
[22:40.920 --> 22:43.520]  the handgun will need to be in a holster.
[22:43.520 --> 22:46.120]  It needs to be in a holster that fits on your belt
[22:46.120 --> 22:47.400]  or a shoulder holster if you're gonna
[22:47.400 --> 22:49.320]  openly carry that handgun.
[22:49.320 --> 22:51.520]  But if you're going to conceal carry your handgun,
[22:51.520 --> 22:53.320]  it doesn't have to be in a holster.
[22:53.320 --> 22:55.520]  But we recommend that gun be in a holster.
[22:55.520 --> 22:57.880]  Your gun should always be in a holster
[22:57.880 --> 22:58.720]  if you're gonna carry it.
[22:58.720 --> 23:00.280]  But for concealed carrying,
[23:00.280 --> 23:02.080]  it doesn't have to be in a holster.
[23:02.080 --> 23:04.640]  But for open carry, it does have to be in a holster.
[23:04.640 --> 23:07.760]  A holster that fits in your belt or your shoulder holster.
[23:07.760 --> 23:10.440]  Now also, what we have that's gonna go into effect
[23:10.440 --> 23:12.360]  this year is campus carry.
[23:12.360 --> 23:16.440]  Now that's gonna go into effect August the 1st of 2016.
[23:16.440 --> 23:20.600]  So what that means is, anyone with a handgun license
[23:20.600 --> 23:23.960]  will be able to carry their handgun concealed
[23:23.960 --> 23:25.960]  inside of a building of a college campus
[23:25.960 --> 23:28.480]  starting August the 1st of 2016.
[23:28.480 --> 23:30.640]  Now that's a very important date
[23:30.640 --> 23:34.080]  because August the 1st of 2016 was the 50th,
[23:34.080 --> 23:36.360]  well, it's going to be the 50th anniversary
[23:36.360 --> 23:40.080]  of the Charles Whitman shooting at UC campus.
[23:40.080 --> 23:40.920]  Wow.
[23:40.920 --> 23:43.880]  And yes, so that date is very important.
[23:43.880 --> 23:46.160]  So August the 1st of 2016 is when campus carry
[23:46.160 --> 23:47.000]  would go into effect.
[23:47.000 --> 23:47.840]  Okay, so.
[23:47.840 --> 23:48.720]  You can still carry your handgun
[23:48.720 --> 23:50.040]  inside of a building of a college campus.
[23:50.040 --> 23:52.280]  So Michael, is this across the board
[23:52.280 --> 23:56.040]  for every college campus in the state of Texas?
[23:56.040 --> 23:56.880]  Yes, it is.
[23:56.880 --> 23:58.440]  Oh, that is great.
[23:58.440 --> 24:01.320]  Yeah, that's for your public university.
[24:01.320 --> 24:03.520]  Now your private university,
[24:03.520 --> 24:07.120]  they can actually opt out is what people are using.
[24:07.120 --> 24:08.880]  And I really don't like that term
[24:08.880 --> 24:11.800]  because they can opt in and opt out right now anyway.
[24:11.800 --> 24:14.240]  So what they're gonna have to do is
[24:14.240 --> 24:15.400]  the private universities,
[24:15.400 --> 24:17.560]  if they don't want you to carry on their campus,
[24:17.560 --> 24:18.600]  they're gonna have to post a third
[24:18.600 --> 24:20.240]  that'll six on in each building.
[24:20.240 --> 24:23.160]  And for the University of Texas,
[24:23.160 --> 24:24.920]  which is a public university.
[24:24.920 --> 24:25.920]  So the public universities,
[24:25.920 --> 24:27.720]  they can actually name certain places
[24:27.720 --> 24:29.440]  that you cannot carry.
[24:29.440 --> 24:30.840]  So let's say for an example,
[24:30.840 --> 24:32.920]  they decide that they don't want anyone
[24:32.920 --> 24:34.840]  to carry inside the dorm.
[24:34.840 --> 24:35.880]  So what they're gonna have to do
[24:35.880 --> 24:38.920]  is post a third that'll six on at their dorms.
[24:38.920 --> 24:40.880]  But the majority of the campus,
[24:40.880 --> 24:43.200]  you won't be able to conceal carry inside.
[24:43.200 --> 24:44.040]  Well, is there a-
[24:44.040 --> 24:44.880]  And that's for your public university.
[24:44.880 --> 24:48.440]  This seems like kind of a loophole to me for the bad guys.
[24:48.440 --> 24:52.680]  I mean, is there a limit to how many buildings
[24:52.680 --> 24:54.360]  or what kind of buildings
[24:54.360 --> 24:57.480]  that these campuses can quote opt out of?
[24:57.480 --> 24:58.480]  I mean, what if they just decide
[24:58.480 --> 24:59.800]  to opt out of every building
[24:59.800 --> 25:01.000]  and the only way you can carry
[25:01.000 --> 25:02.720]  is just like walking up and down
[25:02.720 --> 25:04.280]  around the sidewalks of campus?
[25:04.280 --> 25:05.200]  I mean, what good is that
[25:05.200 --> 25:06.680]  if you can't carry it into the class?
[25:06.680 --> 25:07.760]  Where are you gonna leave it?
[25:07.760 --> 25:12.080]  They don't have lockers on college campuses, you know.
[25:12.920 --> 25:15.120]  Yeah, and we're actually working on that now.
[25:15.120 --> 25:17.960]  They cannot do the majority of the public university.
[25:17.960 --> 25:20.040]  They can only do certain buildings.
[25:20.040 --> 25:22.760]  So they can only do, they can't do the classroom.
[25:22.760 --> 25:24.360]  They can do like maybe the dorms.
[25:24.360 --> 25:26.640]  They can do the hospitals that are located on the campus
[25:26.640 --> 25:27.760]  and that's about it.
[25:27.760 --> 25:30.400]  Or any place that has chemicals
[25:30.400 --> 25:34.720]  or like the lab chemistry or something like that,
[25:34.720 --> 25:36.760]  it can prohibit you from carrying in that building.
[25:36.760 --> 25:39.240]  And they can prohibit from in the dorms too?
[25:39.240 --> 25:41.240]  I mean, that seems ludicrous to me
[25:41.240 --> 25:44.440]  because what good is it if you can't have it
[25:44.440 --> 25:47.000]  where you live, where you rest, where you sleep?
[25:47.000 --> 25:48.160]  I don't understand this at all.
[25:48.160 --> 25:50.160]  And if you live on campus,
[25:50.160 --> 25:53.840]  where are you supposed to store your firearm
[25:53.840 --> 25:55.320]  when you're not in the dorm?
[25:55.320 --> 25:56.320]  That's where you live.
[25:56.320 --> 25:58.840]  I mean, that's pretty bad.
[25:58.840 --> 26:00.280]  Oh, and I agree with you.

[26:49.920 --> 26:52.880]  What about on campus, on a college campus?
[26:52.880 --> 26:55.680]  But they cannot do it on a college campus.
[26:55.680 --> 26:58.520]  You cannot openly carry a handgun on a college campus,
[26:58.520 --> 27:00.920]  not in the buildings, even when concealed carry
[27:00.920 --> 27:02.000]  on campus doesn't affect-
[27:02.000 --> 27:03.760]  That will come in in August.
[27:03.760 --> 27:08.160]  No, no, he's saying that on August 1st,
[27:08.160 --> 27:11.840]  concealed carry will come into effect on campus,
[27:11.840 --> 27:15.240]  but open carry is not coming into effect on campus.

[27:47.720 --> 27:49.320]  So if they restrict your right to bring the weapon

[27:51.640 --> 27:56.640]  that has the effect of suppressing the execution of a law.

[28:00.640 --> 28:03.360]  Now, let me put it to you this way, okay?
[28:03.360 --> 28:05.360]  The majority of people that actually live in dorms
[28:05.360 --> 28:08.320]  are 18, 19, 20 years old, correct?

[28:09.160 --> 28:10.000]  Would you say that?

[28:10.840 --> 28:12.400]  Okay, those people cannot get a handgun license.

[28:52.200 --> 28:57.200]  They can't pass a rule that would deny you in your right
[28:57.200 --> 29:02.200]  to, deny you in your exercise of the right to carry a weapon.

[29:10.120 --> 29:12.000]  if they have that restriction,
[29:12.000 --> 29:16.800]  the restriction is specifically to eliminate your ability

[34:14.680 --> 34:18.680]  these new laws, or I guess mainly I'm talking about the one
[34:18.680 --> 34:23.680]  that's the license carry now, they're calling it license carry,
[34:23.680 --> 34:28.680]  that does not affect what has already been longstanding
[34:28.680 --> 34:33.680]  for a while regarding carrying while traveling, right?
[34:33.680 --> 34:37.680]  I mean, you can still have a firearm in your car
[34:37.680 --> 34:40.680]  as long as it's hidden away and stuff like that.
[34:40.680 --> 34:44.680]  And, technically, you can still have a firearm
[34:44.680 --> 34:47.680]  concealed on your person while you're on private property
[34:47.680 --> 34:50.680]  and coming and going from one private property
[34:50.680 --> 34:53.680]  to another private property while you're in your car.
[34:53.680 --> 34:55.680]  I mean, stuff like that, right?
[34:55.680 --> 34:59.680]  It doesn't affect the traveling carry, is that correct?
[34:59.680 --> 35:00.680]  That is correct.

[35:01.680 --> 35:03.680]  So right now, you could have a handgun in Texas
[35:03.680 --> 35:06.680]  without a license at home to and from your home,
[35:06.680 --> 35:08.680]  your vehicle, inside your vehicle,
[35:08.680 --> 35:11.680]  if it's a person under your control, your place of business.
[35:11.680 --> 35:13.680]  You can have a handgun without a license
[35:13.680 --> 35:15.680]  on a watercraft, that is a boat.
[35:15.680 --> 35:17.680]  You can have a handgun without a license
[35:17.680 --> 35:19.680]  in a travel trailer, camp trailer, truck camper,
[35:19.680 --> 35:21.680]  motorhome, and your horse trailer living quarters.
[35:21.680 --> 35:23.680]  And also, if it's used in an activity,
[35:23.680 --> 35:25.680]  so if you're out fishing, hunting,
[35:25.680 --> 35:28.680]  doing other lawful purposes, then yes,
[35:28.680 --> 35:32.680]  you can have that handgun and it can be loaded.
[35:32.680 --> 35:33.680]  You can have a loaded handgun.
[35:33.680 --> 35:36.680]  It just must be concealed in the vehicle.
[35:36.680 --> 35:38.680]  Okay, good, good.
[35:38.680 --> 35:39.680]  Okay, great.
[35:39.680 --> 35:45.680]  So let's continue on to the next topic.
[35:45.680 --> 35:47.680]  Michael, you wanted to make some comments
[35:47.680 --> 35:52.680]  about this demonstration.
[35:52.680 --> 35:55.680]  Oh, this mock mass shooting.
[35:55.680 --> 35:57.680]  Yeah, why don't you tell the listeners what happened
[35:57.680 --> 36:01.680]  for listeners out there that don't know what happened?
[36:01.680 --> 36:02.680]  Sure.
[36:02.680 --> 36:04.680]  There was an organization in North Texas,
[36:04.680 --> 36:07.680]  Come and Take It Texas, who wanted to do
[36:07.680 --> 36:10.680]  a demonstration at the UT campus, a mock mass shooting.
[36:10.680 --> 36:15.680]  They wanted to show UT campus what it would be like
[36:15.680 --> 36:18.680]  to experience a shooting.
[36:18.680 --> 36:20.680]  And I think that's just the dumbest idea
[36:20.680 --> 36:22.680]  you can ever come up with, you know,
[36:22.680 --> 36:24.680]  because we can take a look at the shooting
[36:24.680 --> 36:26.680]  that happened, you know, the weeks before this
[36:26.680 --> 36:29.680]  demonstration in California.
[36:29.680 --> 36:31.680]  We know what it looks like when there's a mass shooting.
[36:31.680 --> 36:33.680]  We know what to expect.
[36:33.680 --> 36:34.680]  What we're trying to do is teach people
[36:34.680 --> 36:36.680]  how to prevent them from happening.
[36:36.680 --> 36:38.680]  Teach you how not to be a victim.
[36:38.680 --> 36:40.680]  Those are some of the things we need to teach people,
[36:40.680 --> 36:42.680]  not showing them what happens
[36:42.680 --> 36:44.680]  when a mock mass shooting because we know what happens.
[36:44.680 --> 36:47.680]  You know, a lot of people get shot and killed.
[36:47.680 --> 36:49.680]  So to me, it was the dumbest thing
[36:49.680 --> 36:51.680]  that they ever wanted to do.
[36:51.680 --> 36:54.680]  And so they decided to do this on UT campus
[36:54.680 --> 36:58.680]  on a Saturday, the last day of finals for the students.
[36:58.680 --> 37:01.680]  So the students were finishing up their finals,
[37:01.680 --> 37:05.680]  getting ready to go for the Christmas break.
[37:05.680 --> 37:08.680]  And a lot of them had finished their finals.
[37:08.680 --> 37:09.680]  This group decided they were going to do
[37:09.680 --> 37:11.680]  the mock mass shooting.
[37:11.680 --> 37:13.680]  And so the students, you know, of course,
[37:13.680 --> 37:16.680]  finished their finals, decided to do a channel protest.
[37:16.680 --> 37:17.680]  Okay?
[37:17.680 --> 37:18.680]  So this is on a Saturday.
[37:18.680 --> 37:22.680]  They have nothing else to do but to mess with, you know,
[37:22.680 --> 37:24.680]  these guys during the mock mass shooting.
[37:24.680 --> 37:27.680]  And pretty much, you know, made a fool of these guys.
[37:27.680 --> 37:29.680]  And it was just, it was a disgrace,
[37:29.680 --> 37:31.680]  something that never should have happened.
[37:31.680 --> 37:33.680]  And I'm just so disappointed that they actually,
[37:33.680 --> 37:35.680]  you know, carried this out.
[37:35.680 --> 37:39.680]  And I don't understand what the motive for this was
[37:39.680 --> 37:45.680]  because supposedly this is a pro-Second Amendment organization
[37:45.680 --> 37:47.680]  that decided to do this.
[37:47.680 --> 37:52.680]  And apparently they had to have some help or some coordination
[37:52.680 --> 37:55.680]  and participation from UT students
[37:55.680 --> 37:59.680]  because outside organizations cannot just come on a campus,
[37:59.680 --> 38:02.680]  especially UT, and just hold demonstrations
[38:02.680 --> 38:03.680]  and do things like this.
[38:03.680 --> 38:04.680]  You have to be...
[38:04.680 --> 38:07.680]  And it's funny you say that because the University of Texas
[38:07.680 --> 38:10.680]  said, you know what, you're not a part of any organization on campus,
[38:10.680 --> 38:13.680]  so you're not allowed on campus.
[38:13.680 --> 38:16.680]  And they told them that if they did do some type of demonstration
[38:16.680 --> 38:19.680]  on that campus, they would have them arrested for trespassing
[38:19.680 --> 38:21.680]  because they're not part of any organization
[38:21.680 --> 38:24.680]  or any other group that's associated with the campus.
[38:24.680 --> 38:29.680]  So what they ended up doing was going in the areas in the community
[38:29.680 --> 38:32.680]  in Austin where the students live,
[38:32.680 --> 38:34.680]  and they did this in the neighborhood.
[38:34.680 --> 38:36.680]  So they didn't actually do it on UT campus.
[38:36.680 --> 38:40.680]  They did it in the neighborhoods that were just off campus.
[38:40.680 --> 38:41.680]  That is correct.
[38:41.680 --> 38:46.680]  Okay, and again, I just...
[38:46.680 --> 38:50.680]  And Michael, I know that you've caught some flak
[38:50.680 --> 38:53.680]  for your position on this matter,
[38:53.680 --> 38:56.680]  but I have to agree with you 100% on this.
[38:56.680 --> 38:58.680]  And I don't care what kind of flak I get
[38:58.680 --> 39:02.680]  because I do not understand the motive, okay?
[39:02.680 --> 39:04.680]  I am a logical person.
[39:04.680 --> 39:05.680]  I'm a math major.
[39:05.680 --> 39:06.680]  That's what I studied in college.
[39:06.680 --> 39:08.680]  I do computer programming.

[39:22.680 --> 39:25.680]  was they wanted to show UT what it would be like
[39:25.680 --> 39:26.680]  to have a mass shooting there.
[39:26.680 --> 39:27.680]  Why?
[39:27.680 --> 39:33.680]  They did this after the law was passed
[39:33.680 --> 39:37.680]  to allow concealed carry on campus.
[39:37.680 --> 39:39.680]  So what is the point?
[39:39.680 --> 39:43.680]  I mean, if I was just some random passerby,
[39:43.680 --> 39:47.680]  I might, who didn't know anything about gun laws
[39:47.680 --> 39:48.680]  or anything like that,
[39:48.680 --> 39:52.680]  and maybe who knows which direction I would be leaning,
[39:52.680 --> 39:54.680]  but if I was just some random passerby,
[39:54.680 --> 39:58.680]  I almost would maybe think that this whole thing
[39:58.680 --> 40:04.680]  was being pulled off by an anti-gun organization,
[40:04.680 --> 40:07.680]  like some kind of gun grabbing organization,
[40:07.680 --> 40:12.680]  trying to stage a shooting in the wake of allowing concealed carry
[40:12.680 --> 40:16.680]  to make the point that, oh, see, this is what's going to happen
[40:16.680 --> 40:18.680]  now that guns are allowed on campus.
[40:18.680 --> 40:20.680]  I mean, if I was just some random passerby
[40:20.680 --> 40:21.680]  not really paying attention,
[40:21.680 --> 40:25.680]  I might think that because of the timing of this.
[40:25.680 --> 40:29.680]  I mean, it makes absolutely no sense at all.
[40:29.680 --> 40:33.680]  It really kind of sheds a bad light on the whole thing
[40:33.680 --> 40:36.680]  of the concealed carry, if you ask me.
[40:36.680 --> 40:37.680]  I just don't get it.
[40:37.680 --> 40:41.680]  I mean, I could understand if they would do a demonstration like that.
[40:41.680 --> 40:45.680]  If, for example, the legislature had voted,
[40:45.680 --> 40:49.680]  no, we're not going to allow any carrying on campus.
[40:49.680 --> 40:52.680]  Okay, I could understand a demonstration like that,
[40:52.680 --> 40:54.680]  because then they would be making the point of,
[40:54.680 --> 40:56.680]  see, this is what's going to happen
[40:56.680 --> 41:01.680]  because you guys are not allowing the students to defend themselves.
[41:01.680 --> 41:03.680]  Okay, that would make sense.
[41:03.680 --> 41:05.680]  Or maybe if they staged that kind of demonstration
[41:05.680 --> 41:11.680]  before the legislature made their decision to make the point of,
[41:11.680 --> 41:16.680]  see, if you guys don't start allowing the students to protect themselves,
[41:16.680 --> 41:17.680]  this is what's going to happen,
[41:17.680 --> 41:22.680]  because all these mass shootings happen in what we call victim disarmament zones,
[41:22.680 --> 41:26.680]  i.e. gun-free zones.
[41:26.680 --> 41:29.680]  But for them to do something like this after the fact,
[41:29.680 --> 41:34.680]  Michael, it makes no sense at all,
[41:34.680 --> 41:37.680]  and I think it's a dumb idea to begin with.

[42:00.680 --> 42:05.680]  It's now going to become law, August 1, 2016, for your public university
[42:05.680 --> 42:09.680]  and August 1, 2017, for your community colleges.
[42:09.680 --> 42:11.680]  It's passed.
[42:11.680 --> 42:12.680]  The governor has signed it.
[42:12.680 --> 42:18.680]  Now this group comes along who did nothing to help us get campus carry passed at all.
[42:18.680 --> 42:20.680]  Not one of them testified.
[42:20.680 --> 42:23.680]  Not one of them went to the Capitol to do anything to help us.
[42:23.680 --> 42:28.680]  And now they come forward, do this mock mass shooting and try to make a mockery
[42:28.680 --> 42:31.680]  and try to disgrace us and try to screw things up.
[42:31.680 --> 42:33.680]  And that pisses me off.

[48:41.680 --> 48:47.680]  These guys who execute these mass shootings, they want to go to a Turkish shoot.

[49:11.680 --> 49:19.680]  It's just this particular incident here, I just totally disagree with, you know, them doing anything, doing this type of demonstration.
[49:19.680 --> 49:27.680]  Do you have any feedback from them on why they did what they did at this time in this way?

[49:29.680 --> 49:36.680]  You know, when I found out that they actually were going to do this demonstration, what I did was I contacted them on the telephone and I said,

[49:41.680 --> 49:44.680]  I said, hey, I totally disagree with what you guys are doing.
[49:44.680 --> 49:46.680]  I wish you would not do this.
[49:46.680 --> 49:53.680]  I said, I'm waiting for opinions to come down from the Texas Attorney General on several different issues.
[49:53.680 --> 50:00.680]  And by you guys doing something like this, you know, there's a possibility that you guys could mess up those opinions
[50:00.680 --> 50:05.680]  and then cause problems with us, you know, getting some things that we're trying to get done here.
[50:05.680 --> 50:07.680]  But everything is not said and done.
[50:07.680 --> 50:15.680]  You know, we're still waiting on opinions on schools, which we just got, which was not great opinion.
[50:15.680 --> 50:19.680]  At the time, we were waiting on this opinion and we're waiting on other opinions.
[50:19.680 --> 50:25.680]  And you know, by them causing some type of ruckus, causing a problem, it could have interfered with that.
[50:25.680 --> 50:27.680]  You know, we're working hard.
[50:27.680 --> 50:33.680]  Like I said, we've been working for decades trying to get this stuff done in this state, which we shouldn't have to work this hard, you know,
[50:33.680 --> 50:40.680]  especially since we have Republicans, you know, our House and our Senate is actually controlled by the Republicans.
[50:40.680 --> 50:45.680]  So it shouldn't be this difficult to get pro-Second Amendment legislation passed, but it is.
[50:45.680 --> 50:51.680]  And by this organization doing what they're doing on the UT campus, the one campus that will fight you tooth and nail,
[50:51.680 --> 51:00.680]  have no trouble with, you know, leaving classrooms, you know, to, you know, launch a counter protest, they will do this.
[51:00.680 --> 51:08.680]  You do it on that campus on Saturday, a Saturday when they have nothing else more to do than to screw with you, you do it on that campus.
[51:08.680 --> 51:12.680]  And they totally made a fool out of them.

[52:02.680 --> 52:07.680]  It was on University of Texas property, right across from Mary's Student Housing.

[52:11.680 --> 52:18.680]  So by staging a distraction over on the drag, they had the mass shooting over by the church.
[52:18.680 --> 52:22.680]  And they demonstrated that this could happen on campus.
[52:22.680 --> 52:24.680]  And I thought it was brilliant.
[52:24.680 --> 52:26.680]  And they showed this could happen.
[52:26.680 --> 52:29.680]  It took 16 minutes for the cops to get over there.
[52:29.680 --> 52:30.680]  I mean, how else are you going to show that?
[52:30.680 --> 52:42.680]  So, Bill, you're saying that the reason they did this was to influence the president or whoever makes the decisions on this matter at UT,
[52:42.680 --> 52:51.680]  that this could happen if you guys decide to ban carrying, like, say, in classrooms or something like that?
[52:51.680 --> 52:53.680]  Is that what you're saying?
[52:53.680 --> 52:54.680]  That's the big issue.
[52:54.680 --> 52:56.680]  Are they going to allow it in classrooms?
[52:56.680 --> 53:01.680]  And this demonstrated that it's necessary because shootings can happen on campus.
[53:01.680 --> 53:07.680]  Even with tons of cops about a mile away, it still took the cops 16 minutes to get over there.

[53:08.680 --> 53:10.680]  Here's the kicker to it.
[53:10.680 --> 53:14.680]  We just had a shooting the week before, a real shooting where people were actually killed.
[53:14.680 --> 53:18.680]  And if that didn't influence them, trust me, nothing else is going to influence them.
[53:18.680 --> 53:23.680]  What we need to do is actually continue on, push legislation, you know, get them,
[53:23.680 --> 53:32.680]  get our legislators to actually come back January of 2017 and make a stronger bill to get more, you know,
[53:32.680 --> 53:38.680]  be able to carry in more places on campuses and get rid of these, you know, total restrictions altogether.
[53:38.680 --> 53:40.680]  That's the way to do it.
[53:40.680 --> 53:42.680]  Do any mock-match shooting?
[53:42.680 --> 53:43.680]  We don't need to do a mock-match shooting.
[53:43.680 --> 53:45.680]  We know when a shooting is going to happen.
[53:45.680 --> 53:49.680]  We saw one last week and the week before and the week before that.
[53:49.680 --> 53:52.680]  And that still is not going to change the gun grabber's mind.
[53:52.680 --> 53:58.680]  We just saw the president of the United States pull this bullcrap of doing tears in front of the American people.
[53:58.680 --> 53:59.680]  Okay?
[53:59.680 --> 54:02.680]  Trust me, we're not going to change their mind.
[54:02.680 --> 54:05.680]  What we're going to do is going to jam some legislation down their throat.
[54:05.680 --> 54:08.680]  I'm going to put my foot on their throat, and that's what's going to change their minds
[54:08.680 --> 54:10.680]  because I'm going to get my way in the legislature.

[54:13.680 --> 54:19.680]  Yeah, or how about sue them into oblivion and take their pension and stuff like that

[54:26.680 --> 54:31.680]  and even in quasi whatever you want to call it, public-private institutions,
[54:31.680 --> 54:37.680]  a lot of times the only thing that gets their attention is to get slammed with a lawsuit.

[54:43.680 --> 54:45.680]  I'm not so sure it was a good idea.
[54:45.680 --> 54:48.680]  I think there's other ways that the point could have been made.

[54:53.680 --> 54:56.680]  I would suggest a way to get veterans.
[54:56.680 --> 55:00.680]  The reason this was weak this time is because of House Speaker Strauss.

[55:02.680 --> 55:06.680]  hoping the Democrats could shove it to death and they just missed.
[55:06.680 --> 55:13.680]  But the way to put pressure on this is to run somebody in Strauss' district.
[55:13.680 --> 55:17.680]  We got to put pressure on Strauss, got to put pressure on his lieutenants
[55:17.680 --> 55:20.680]  like Phillips and Cook, among others.
[55:20.680 --> 55:22.680]  And we got rid of Harless.
[55:22.680 --> 55:23.680]  Patricia Harless is gone.
[55:23.680 --> 55:24.680]  Now, wait a minute.
[55:24.680 --> 55:26.680]  To put pressure on them for what?
[55:26.680 --> 55:28.680]  The bill already passed.
[55:28.680 --> 55:34.680]  It sounds to me like the pressure we need to put, if any, at this point would be on the
[55:34.680 --> 55:44.680]  whoever the policymakers are at the universities to not prohibit carry in any of the buildings.

[55:46.680 --> 55:51.680]  I mean, what good is it going to do to pressure our legislators at this point?
[55:51.680 --> 55:55.680]  Well, what we can do is come back the next session and come back with a stronger bill.

[55:57.680 --> 56:00.680]  The legislature in Texas only meets every other year.

[57:09.680 --> 57:15.680]  to get him voted out in the primaries.
[57:15.680 --> 57:19.680]  That's the best way to get rid of incumbents is to have somebody,
[57:19.680 --> 57:27.680]  a competitor, an opponent in the same party get rid of them in the primaries.

[01:06:04.680 --> 01:06:07.680]  Okay. Well, I'm Jeff, and I'm from Mississippi.
[01:06:07.680 --> 01:06:09.680]  I was going to the university there.
[01:06:09.680 --> 01:06:12.680]  I got arrested for having a weapon on campus.
[01:06:12.680 --> 01:06:21.680]  I had a rifle in my bedroom closet, got convicted, and went to prison for a year down there.
[01:06:21.680 --> 01:06:29.680]  And then I got out, won my appeal, and got remanded, went back to court, and then got reconvicted.
[01:06:29.680 --> 01:06:36.680]  But it does turn out that the apartments are private property because I went and got the land title.
[01:06:36.680 --> 01:06:44.680]  So now I am trying to sue them in a Title 42, 1983.
[01:06:44.680 --> 01:06:49.680]  And I have several 1983 suits.
[01:06:49.680 --> 01:06:53.680]  And that's what I was calling is I've actually got them filed, but I have questions.
[01:06:53.680 --> 01:06:56.680]  Okay. So you were convicted.
[01:06:56.680 --> 01:06:59.680]  Then you appealed, is that right?
[01:06:59.680 --> 01:07:05.680]  And you won the appeal, but you won your appeal the first time?
[01:07:05.680 --> 01:07:06.680]  Mm-hmm.
[01:07:06.680 --> 01:07:08.680]  Okay. So what did they do?
[01:07:08.680 --> 01:07:12.680]  If you won the appeal, how did they retry you again?
[01:07:12.680 --> 01:07:19.680]  Well, I think that that was something stupid that I did because I did not object.
[01:07:19.680 --> 01:07:23.680]  But I got out of prison, won my appeal, and when I won my appeal,
[01:07:23.680 --> 01:07:27.680]  the order from the court was that it was to be remanded back to the court.
[01:07:27.680 --> 01:07:30.680]  Oh, it was to be remanded. So you were retried.
[01:07:30.680 --> 01:07:37.680]  The appeal ruled that he lacked competent counsel.
[01:07:37.680 --> 01:07:39.680]  Oh, okay.
[01:07:39.680 --> 01:07:42.680]  So that was the reason that he won the appeal.
[01:07:42.680 --> 01:07:45.680]  So it had to go back for a retrial with competent counsel.
[01:07:45.680 --> 01:07:47.680]  Okay. So you got convicted again.
[01:07:47.680 --> 01:07:51.680]  So are you appealing that second conviction?
[01:07:51.680 --> 01:07:52.680]  Yes.

[01:08:15.680 --> 01:08:21.680]  And so basically you cannot pursue your second appeal
[01:08:21.680 --> 01:08:23.680]  because you can't get the transcripts out of her,
[01:08:23.680 --> 01:08:25.680]  so now you're having to sue her for the transcript.

[01:08:27.680 --> 01:08:29.680]  Yes. I'm suing her and my attorney
[01:08:29.680 --> 01:08:33.680]  because my attorney refuses to file any objections,
[01:08:33.680 --> 01:08:37.680]  and neither one of them are even responding back to me.

[01:09:12.680 --> 01:09:17.680]  that say that transcripts have to be provided within a certain period of time
[01:09:17.680 --> 01:09:19.680]  or anything like that?
[01:09:19.680 --> 01:09:23.680]  Oh, yeah. Jeff, you're familiar with that.
[01:09:23.680 --> 01:09:28.680]  Jeff, you called in. What did you want to bring us up to?
[01:09:28.680 --> 01:09:31.680]  What did you want to bring up at this point?
[01:09:31.680 --> 01:09:39.680]  Okay. Well, I've got two 1983 cases actually filed in the court.
[01:09:39.680 --> 01:09:42.680]  They got back with me.
[01:09:42.680 --> 01:09:48.680]  I had to file in forma preparis as a proper indigent.
[01:09:48.680 --> 01:09:52.680]  I didn't have the money, and I've been told by quite a few people,
[01:09:52.680 --> 01:09:56.680]  because I do make a lot of calls, that that was a really, really stupid move
[01:09:56.680 --> 01:09:58.680]  and that they could really hurt me on that.
[01:09:58.680 --> 01:10:02.680]  Okay. Let me explain the problem you can have with that.
[01:10:02.680 --> 01:10:03.680]  There's one problem.
[01:10:03.680 --> 01:10:04.680]  Okay.
[01:10:04.680 --> 01:10:12.680]  When you file in forma preparis, it gives the trial judge the option of making
[01:10:12.680 --> 01:10:16.680]  a determination whether the suit is frivolous or not frivolous.
[01:10:16.680 --> 01:10:24.680]  The trial judge can dismiss the case out of hand if it's in forma preparis.
[01:10:24.680 --> 01:10:30.680]  That's really the only detriment to filing in forma preparis.
[01:10:30.680 --> 01:10:36.680]  Has the trial judge dismissed the case as frivolous?
[01:10:36.680 --> 01:10:42.680]  No. What has happened is the court has written me a letter asking me
[01:10:42.680 --> 01:10:49.680]  if I want to waive my right to have a federal judge and instead have a magistrate.
[01:10:49.680 --> 01:10:54.680]  What I did was I personally went down to the courthouse and said,
[01:10:54.680 --> 01:10:57.680]  no, I absolutely refuse.
[01:10:57.680 --> 01:10:59.680]  I will have a real judge.
[01:10:59.680 --> 01:11:03.680]  Then I offered to write a statement and file it in.
[01:11:03.680 --> 01:11:06.680]  The clerk said, oh, you don't need to write anything,
[01:11:06.680 --> 01:11:08.680]  or you don't even need to fill the form out.
[01:11:08.680 --> 01:11:10.680]  Just don't do anything.
[01:11:10.680 --> 01:11:13.680]  No, no, that is not true.
[01:11:13.680 --> 01:11:15.680]  That's not true.
[01:11:15.680 --> 01:11:21.680]  Technically, under the law, you have to waive your right to a trial judge.
[01:11:21.680 --> 01:11:22.680]  Okay.
[01:11:22.680 --> 01:11:26.680]  That may be technically true, but I have to interject here about this magistrate
[01:11:26.680 --> 01:11:32.680]  thing because I railed about this magistrate thing about two or three weeks ago.
[01:11:32.680 --> 01:11:38.680]  This magistrate thing, especially in federal court, you have to kick and scream
[01:11:38.680 --> 01:11:44.680]  and scream bloody murder from the get-go, and I mean file standing objections
[01:11:44.680 --> 01:11:47.680]  with the original petition, with the original pleading,
[01:11:47.680 --> 01:11:52.680]  objecting to all magistrate participation, and you have to take it to the limit,
[01:11:52.680 --> 01:11:56.680]  to the point that once a magistrate gets involved, the case just stops.
[01:11:56.680 --> 01:12:00.680]  You have to just stop your own case and start filing interlocutory appeals
[01:12:00.680 --> 01:12:03.680]  and go all the way up to the U.S. Supreme Court if necessary
[01:12:03.680 --> 01:12:05.680]  to kick the magistrate out of the case.
[01:12:05.680 --> 01:12:09.680]  I mean it is a huge, huge fight, and you all can go back and listen to the
[01:12:09.680 --> 01:12:13.680]  archive on that whole tirade about magistrate participation
[01:12:13.680 --> 01:12:15.680]  and what you can do about it.
[01:12:15.680 --> 01:12:19.680]  But yeah, you can't do things verbally, Jeff.
[01:12:19.680 --> 01:12:21.680]  You have to do everything.
[01:12:21.680 --> 01:12:25.680]  You have to file documents into the court record,
[01:12:25.680 --> 01:12:28.680]  into the docket of the case every single time.
[01:12:28.680 --> 01:12:29.680]  Okay.
[01:12:29.680 --> 01:12:33.680]  So I'm going to type up a refusal that says I'm refusing a magistrate,
[01:12:33.680 --> 01:12:36.680]  and I'll go down there and file it in tomorrow.
[01:12:36.680 --> 01:12:38.680]  Yes, and that's where I was going to go.
[01:12:38.680 --> 01:12:44.680]  Technically, they can only appoint a magistrate if you fill out that agreement,
[01:12:44.680 --> 01:12:47.680]  but they'll do it whether you fill out the agreement or not.
[01:12:47.680 --> 01:12:54.680]  And what I was going to say is if the magistrate does anything,
[01:12:54.680 --> 01:12:58.680]  then you go to the state court, to the state grand jury,
[01:12:58.680 --> 01:13:07.680]  and file criminal charges to whatever jurisdiction the federal courthouse is in,
[01:13:07.680 --> 01:13:12.680]  you go to that district attorney and file criminal charges against the magistrate.
[01:13:12.680 --> 01:13:14.680]  Oh, the magistrate, okay.
[01:13:14.680 --> 01:13:17.680]  You want to dance, Bubba?
[01:13:17.680 --> 01:13:25.680]  You're in a federal courthouse, but that federal courthouse is not a federal enclave.
[01:13:25.680 --> 01:13:31.680]  It belongs to the state and is leased from the state by the federal government.
[01:13:31.680 --> 01:13:38.680]  That leaves anyone in the federal courthouse subject to the state common law.
[01:13:38.680 --> 01:13:44.680]  And when I say common law, I'm referring to the state penal laws.
[01:13:44.680 --> 01:13:47.680]  So if a public official exerts or purports to exert authority,
[01:13:47.680 --> 01:13:55.680]  he does not express to have in most every state that's official misconduct.
[01:13:55.680 --> 01:14:00.680]  So you accuse the federal magistrate of official misconduct and you file it in the state.
[01:14:00.680 --> 01:14:02.680]  When you file it in the state,
[01:14:02.680 --> 01:14:06.680]  the local magistrate is going to do a song and dance and seltzer down your pants
[01:14:06.680 --> 01:14:09.680]  and do everything he can to avoid it.
[01:14:09.680 --> 01:14:14.680]  Then you file against him and you make a big stir in the state
[01:14:14.680 --> 01:14:17.680]  because they won't prosecute the fed.
[01:14:17.680 --> 01:14:22.680]  And this puts the federal judge and the federal magistrate in a position
[01:14:22.680 --> 01:14:27.680]  to where they're subject to what the state does
[01:14:27.680 --> 01:14:33.680]  and they have no control over what the state does.
[01:14:33.680 --> 01:14:35.680]  Who wants to play Russian roulette?
[01:14:35.680 --> 01:14:37.680]  Okay, okay, and I have some more comments here.
[01:14:37.680 --> 01:14:42.680]  Listen, Jeff, you need to do more than just file a document
[01:14:42.680 --> 01:14:44.680]  saying you refuse magistrate participation
[01:14:44.680 --> 01:14:50.680]  because what they do as far as this magistrate participation thing,
[01:14:50.680 --> 01:14:56.680]  they assert that you only have to agree to magistrate participation
[01:14:56.680 --> 01:15:04.680]  regarding a magistrate basically overseeing a trial, okay,
[01:15:04.680 --> 01:15:12.680]  sitting on the bench to oversee and be the judicial entity at trial.
[01:15:12.680 --> 01:15:18.680]  But they assert that they don't need your participation to assign a magistrate
[01:15:18.680 --> 01:15:25.680]  to handle the ongoings of the case all the way up until the trial.
[01:15:25.680 --> 01:15:28.680]  And so if you just file a document saying you refuse that,
[01:15:28.680 --> 01:15:31.680]  what they're going to do is they're going to interpret that
[01:15:31.680 --> 01:15:35.680]  as you're refusing the magistrate to oversee the trial.
[01:15:35.680 --> 01:15:41.680]  What you need to do is you need to file a standing objection, okay,
[01:15:41.680 --> 01:15:47.680]  to all magistrate participation in the case, period.
[01:15:47.680 --> 01:15:51.680]  And you need to cite the Gonzalez case, okay.
[01:15:51.680 --> 01:15:56.680]  And I don't have the case cite here, but you can find it easily, very famous case.
[01:15:56.680 --> 01:15:59.680]  This is a U.S. Supreme Court controlling case law ruling.
[01:15:59.680 --> 01:16:05.680]  It was Gonzalez, and just look up Gonzalez, magistrate participation,
[01:16:05.680 --> 01:16:07.680]  U.S. Supreme Court ruling.
[01:16:07.680 --> 01:16:11.680]  And that is the case where basically this U.S. Supreme Court said,
[01:16:11.680 --> 01:16:18.680]  hey, you know what, you have to have the litigants' approval and agreement
[01:16:18.680 --> 01:16:23.680]  for a magistrate to do anything in the case whatsoever.
[01:16:23.680 --> 01:16:25.680]  And so that is your case law.
[01:16:25.680 --> 01:16:30.680]  That is your case law authority to back up your standing objection.
[01:16:30.680 --> 01:16:33.680]  But don't just say I refuse magistrate participation.
[01:16:33.680 --> 01:16:34.680]  You've got to cite that.
[01:16:34.680 --> 01:16:38.680]  It's got to be a standing objection, and you've got to cite the Gonzalez case.
[01:16:38.680 --> 01:16:41.680]  So I'll just leave it at that, and you can go look that up,

[01:20:11.680 --> 01:20:16.680]  that the court order the court reporter to produce the transcript?

[01:20:17.680 --> 01:20:22.680]  and that the court actually did issue an order to the court reporter
[01:20:22.680 --> 01:20:26.680]  demanding that she produce the transcript and she's just not doing it.
[01:20:26.680 --> 01:20:28.680]  How long ago did, when did this happen?
[01:20:28.680 --> 01:20:30.680]  When did the court issue this order?
[01:20:30.680 --> 01:20:33.680]  Okay, Jeff, didn't you file a mandamus,
[01:20:33.680 --> 01:20:38.680]  a petition for real mandamus to order the court reporter to produce?
[01:20:38.680 --> 01:20:41.680]  No, what happened is it went two ways.
[01:20:41.680 --> 01:20:43.680]  I have an attorney.
[01:20:43.680 --> 01:20:47.680]  And so I'm using him as a punching bag.
[01:20:47.680 --> 01:20:50.680]  And I ordered him to file a motion to compel.
[01:20:50.680 --> 01:20:54.680]  And he sent me an email saying, no, I will not.
[01:20:54.680 --> 01:20:56.680]  So I'm suing him.
[01:20:56.680 --> 01:21:00.680]  The Supreme Court clerk, not a judge,
[01:21:00.680 --> 01:21:05.680]  but the clerk has written two orders to the court reporter
[01:21:05.680 --> 01:21:07.680]  saying that you need to get this in.
[01:21:07.680 --> 01:21:11.680]  And then on like a week after the deadline,
[01:21:11.680 --> 01:21:14.680]  then the court reporter will file for an extension,
[01:21:14.680 --> 01:21:16.680]  but she's not showing cause.
[01:21:16.680 --> 01:21:22.680]  And the clerk says, you know, we're going to need you to show clause.
[01:21:22.680 --> 01:21:25.680]  And the law says that, but she's not doing it.
[01:21:25.680 --> 01:21:26.680]  Okay, now wait a minute.
[01:21:26.680 --> 01:21:28.680]  Let's get back to the Supreme Court thing.
[01:21:28.680 --> 01:21:32.680]  The Supreme Court of your state, let's get this clear.
[01:21:32.680 --> 01:21:36.680]  Have they issued an order in the case or did they just write a,
[01:21:36.680 --> 01:21:39.680]  or did the clerk of the Supreme Court just write a letter
[01:21:39.680 --> 01:21:43.680]  to this court reporter saying she needs to do this?
[01:21:43.680 --> 01:21:46.680]  Yes, the clerk herself just wrote a letter.
[01:21:46.680 --> 01:21:51.680]  Okay, the clerk of the Supreme Court wrote a letter to the court reporter
[01:21:51.680 --> 01:21:57.680]  saying that she needs to produce the transcript.
[01:21:57.680 --> 01:21:59.680]  And then what happened?
[01:21:59.680 --> 01:22:04.680]  And then the court reporter filed a motion for extension of time.
[01:22:04.680 --> 01:22:07.680]  And then what happened?
[01:22:07.680 --> 01:22:11.680]  The clerk of the district court then said you have to show cause.
[01:22:11.680 --> 01:22:14.680]  What the clerk of the district court issued a notice of deficiency
[01:22:14.680 --> 01:22:16.680]  or something to the court reporter?
[01:22:16.680 --> 01:22:18.680]  Is that what happened?
[01:22:18.680 --> 01:22:24.680]  No, the Supreme Court clerk, the same one, just wrote an order saying
[01:22:24.680 --> 01:22:29.680]  that you need to get this transcript in by the deadline.
[01:22:29.680 --> 01:22:33.680]  If you don't, we're going to demand that you show cause.
[01:22:33.680 --> 01:22:35.680]  And then what happened is the court reporter came in,
[01:22:35.680 --> 01:22:39.680]  flew in right under the radar so she wouldn't get caught,
[01:22:39.680 --> 01:22:41.680]  and filed a motion for an extension.
[01:22:41.680 --> 01:22:43.680]  And then the clerk just granted it to her.
[01:22:43.680 --> 01:22:48.680]  So it kind of looks like they're just greasing palms.
[01:22:48.680 --> 01:22:56.680]  So, and your lawyer refused to petition for a writ amandamus
[01:22:56.680 --> 01:22:58.680]  or a motion to compel?
[01:22:58.680 --> 01:23:01.680]  Yeah, a motion to compel is what I did.
[01:23:01.680 --> 01:23:03.680]  And he wrote back and said he would not do that.
[01:23:03.680 --> 01:23:05.680]  Okay, I have a comment here.
[01:23:05.680 --> 01:23:08.680]  Did you file it yourself?
[01:23:08.680 --> 01:23:10.680]  Okay, I didn't know that I could do that
[01:23:10.680 --> 01:23:13.680]  because I didn't want to lose his function.
[01:23:13.680 --> 01:23:20.680]  Nothing in the law that said your counsel is your counsel.
[01:23:20.680 --> 01:23:23.680]  You have a right to represent yourself.
[01:23:23.680 --> 01:23:29.680]  If you need counsel, you'll call counsel and get counsel from counsel.
[01:23:29.680 --> 01:23:32.680]  But in the meantime, I find nothing in law that prevents you
[01:23:32.680 --> 01:23:35.680]  from filing actions in your own behalf.
[01:23:35.680 --> 01:23:39.680]  So what will happen is that they will not allow him to do that.
[01:23:39.680 --> 01:23:45.680]  If he tries to file a document in his own case,
[01:23:45.680 --> 01:23:47.680]  either the clerk will not allow him to
[01:23:47.680 --> 01:23:51.680]  or the judge will kick it out saying you have representation.
[01:23:51.680 --> 01:23:54.680]  And I think there is case law on that.
[01:23:54.680 --> 01:23:57.680]  Did you take him to the federal court for due process violations?
[01:23:57.680 --> 01:23:59.680]  Okay, okay, wait a minute.
[01:23:59.680 --> 01:24:03.680]  Before we start getting off into that tar baby, I have another question.
[01:24:03.680 --> 01:24:06.680]  This regards timing.
[01:24:06.680 --> 01:24:09.680]  Is there something in state law in Mississippi
[01:24:09.680 --> 01:24:15.680]  where Jeff is going to run out of time to pursue his appeal
[01:24:15.680 --> 01:24:19.680]  if that transcript does not appear within a certain timeframe?
[01:24:19.680 --> 01:24:23.680]  Because if that's the case, then we need to stay on point
[01:24:23.680 --> 01:24:27.680]  and do whatever it takes to push through this motion to compel,
[01:24:27.680 --> 01:24:30.680]  even if that means Jeff firing his lawyer
[01:24:30.680 --> 01:24:34.680]  and appealing the motion to compel all the way up to the U.S. Supreme Court

[01:25:12.680 --> 01:25:15.680]  But I just want to keep that in mind here.
[01:25:15.680 --> 01:25:21.680]  Is there some kind of time limit that he is bound by no matter what?
[01:25:21.680 --> 01:25:24.680]  I don't know because I never thought about it.
[01:25:24.680 --> 01:25:26.680]  Okay, well, you need to consider that
[01:25:26.680 --> 01:25:30.680]  because all this palm greasing and all this delaying tactic
[01:25:30.680 --> 01:25:35.680]  could be a strategy to run you out of the clock
[01:25:35.680 --> 01:25:38.680]  so that you cannot appeal your case anymore,
[01:25:38.680 --> 01:25:44.680]  and unless you get that motion to compel in and have it denied
[01:25:44.680 --> 01:25:47.680]  and then appeal it to the appellate court,
[01:25:47.680 --> 01:25:52.680]  and then if they deny it, then you have to appeal that ruling to the state Supreme Court,
[01:25:52.680 --> 01:25:56.680]  and if they deny that, then you have to take it to the U.S. Supreme Court.
[01:25:56.680 --> 01:26:01.680]  You may have to do that even if it means firing your attorney.
[01:26:01.680 --> 01:26:05.680]  I mean, believe me, I am all for pressuring your attorney, okay?
[01:26:05.680 --> 01:26:07.680]  That is a great strategy.
[01:26:07.680 --> 01:26:14.680]  But what you don't want to do is you don't want to run yourself out of the clock on your appeal
[01:26:14.680 --> 01:26:17.680]  while you're spending time doing all these bar grievances
[01:26:17.680 --> 01:26:22.680]  and filing all these lawsuits against your attorney for not filing the motion to compel
[01:26:22.680 --> 01:26:25.680]  because then you'll have a criminal record for the rest of your life,
[01:26:25.680 --> 01:26:30.680]  and then all you will have left as a remedy is to just sue all these people and get money,
[01:26:30.680 --> 01:26:34.680]  and I don't think that that is a very good tradeoff, so you need to keep that in mind.
[01:26:34.680 --> 01:26:38.680]  You need to look at the statute, look at the rules of court,
[01:26:38.680 --> 01:26:44.680]  and see if there is some kind of time limit regarding pursuing this appeal.

[01:27:54.680 --> 01:28:02.680]  So while you're spending all of your time trying to hammer this court reporter to get your transcript,
[01:28:02.680 --> 01:28:08.680]  you better make sure that you're not dropping the ball on some other documents or making sure
[01:28:08.680 --> 01:28:17.680]  that the certified court record being forwarded to the appellate court isn't your responsibility.
[01:28:17.680 --> 01:28:21.680]  Sometimes it's the district court clerk's responsibility to forward it.
[01:28:21.680 --> 01:28:26.680]  Sometimes it's the appellant's responsibility to make sure that that happens.
[01:28:26.680 --> 01:28:31.680]  So what I'm saying is this could be some kind of a bait and switch thing,
[01:28:31.680 --> 01:28:36.680]  and if you don't get whatever you're responsible for taking care of done in time,
[01:28:36.680 --> 01:28:38.680]  then you may end up having a problem.
[01:28:38.680 --> 01:28:39.680]  That's all I'm trying to say.
[01:28:39.680 --> 01:28:44.680]  Just make sure that you know that you are thoroughly familiar with the process,
[01:28:44.680 --> 01:28:53.680]  because you may have to let one of the TAR babies go so that you can get on with the business

[01:39:18.680 --> 01:39:24.680]  And there is an ability to file for an extension of time and it says for good cause shown.
[01:39:24.680 --> 01:39:31.680]  So I put in an extension of time on the last day when it was due and then 12 days later
[01:39:31.680 --> 01:39:35.680]  the records did show up from the District Court.
[01:39:35.680 --> 01:39:40.680]  But I think in cases like this where people are pro se, they can easily say, well, you
[01:39:40.680 --> 01:39:42.680]  missed the deadline so you're done.
[01:39:42.680 --> 01:39:43.680]  Okay.
[01:39:43.680 --> 01:39:50.680]  So it is possible, depending on what the laws are in Mississippi, that Jeff may very well
[01:39:50.680 --> 01:39:57.680]  need to file sooner rather than later a motion for extension of time to get all of the records
[01:39:57.680 --> 01:40:05.680]  in and of course the cause is that the clerk won't give it or I guess the court reporter
[01:40:05.680 --> 01:40:07.680]  will not produce the transcript.
[01:40:07.680 --> 01:40:10.680]  I would say that's a pretty good cause for extension of time.

[01:40:42.680 --> 01:40:47.680]  So what they did a few years ago is they made the people who do the transcripts, they took
[01:40:47.680 --> 01:40:51.680]  that away from the government and they outsourced it.
[01:40:51.680 --> 01:40:55.680]  So therefore, it's not a cost that can be paid to the court.
[01:40:55.680 --> 01:40:58.680]  So therefore, the court cannot waive that cost.
[01:40:58.680 --> 01:41:02.680]  So if you need a transcript, you have to come up with the funds out of your own pocket,
[01:41:02.680 --> 01:41:04.680]  even if the court has said that you're indigent.
[01:41:04.680 --> 01:41:09.680]  Yeah, and I'm not sure if that's an issue with Jeff or not.
[01:41:09.680 --> 01:41:15.680]  I think that transcript has already been paid for and that we're just waiting on the court
[01:41:15.680 --> 01:41:18.680]  reporter to produce it.
[01:41:18.680 --> 01:41:22.680]  Yeah, I would be very careful with the deadlines and make sure you at least get in a motion

[01:42:18.680 --> 01:42:26.680]  It's the appellant's responsibility to obtain a certified transcript and to forward that to the appellate court.

[01:42:36.680 --> 01:42:43.680]  But I have never, that's never been an issue in any of the cases I've dealt with because the federal courts,
[01:42:43.680 --> 01:42:51.680]  you know, clerks and court reporters have not ever pulled any stunts like this that I've experienced
[01:42:51.680 --> 01:42:57.680]  or anybody that I have known have not experienced anything like this at the federal level.
[01:42:57.680 --> 01:43:03.680]  But I know for sure that once those records are forwarded to the appellate courts,
[01:43:03.680 --> 01:43:07.680]  at that point in time, once the clerk of the appellate court looks over everything
[01:43:07.680 --> 01:43:10.680]  and says, okay, we're good to go, you've satisfied these requirements,
[01:43:10.680 --> 01:43:17.680]  then at that point they will set a deadline for when your brief is due, okay?
[01:43:17.680 --> 01:43:19.680]  And you better get that brief in.
[01:43:19.680 --> 01:43:24.680]  And if you want an extension of time, it better be a real good reason, okay?
[01:43:24.680 --> 01:43:28.680]  And as far as the deadline for filing a notice of appeal, that's it,
[01:43:28.680 --> 01:43:33.680]  that you don't get extensions for time for that in federal court, especially in civil cases.

[01:47:16.680 --> 01:47:19.680]  It was in commerce, and he decided to get very abusive.
[01:47:19.680 --> 01:47:21.680]  I didn't have my windows rolled up.
[01:47:21.680 --> 01:47:24.680]  Excuse me, shame on me for that one, although he probably would have bashed it out if they
[01:47:24.680 --> 01:47:26.680]  weren't rolled up, seeing the way he reacted.
[01:47:26.680 --> 01:47:30.680]  Well, after getting out after my dear sweet mama bailed me out with her credit card, I
[01:47:30.680 --> 01:47:37.680]  got out, called Randy, and he told me, Randy had told me, file a motion to dismiss a removal
[01:47:37.680 --> 01:47:42.680]  of traffic case and a federal lawsuit with both the Maricopa County Prosecutor and the
[01:47:42.680 --> 01:47:46.680]  federal courts, even though the federal courts sent my thing back because I did some sort
[01:47:46.680 --> 01:47:51.680]  of technical issue on catching on the thing, the prosecutor never sent me anything back,
[01:47:51.680 --> 01:47:56.680]  but they did refund my mother like a $490 something check.
[01:47:56.680 --> 01:47:58.680]  That was presumably for my bail money.
[01:47:58.680 --> 01:48:02.680]  You told me that's a very good indication they want to just drop the case against you
[01:48:02.680 --> 01:48:04.680]  because it's not profitable for them to go after you.
[01:48:04.680 --> 01:48:10.680]  Well, apparently not, because I got a summons in the mail yesterday, and it's from Maricopa
[01:48:10.680 --> 01:48:13.680]  County, Arizona in the East Mesa Justice Court.
[01:48:13.680 --> 01:48:17.680]  I'll try to read the important things here, saying the complaint has been filed in this
[01:48:17.680 --> 01:48:22.680]  court against you charging that Maricopa County on September 26, the crimes have been committed
[01:48:22.680 --> 01:48:27.680]  at excessive speed, class three misdemeanor, and failure to stop them by identification.
[01:48:27.680 --> 01:48:35.680]  First of all, this has received December 18, 2015, and it says here, and I got this yesterday
[01:48:35.680 --> 01:48:39.680]  in the mail, I had to pick it up the post office, it was certified mail, and it says,
[01:48:39.680 --> 01:48:42.680]  you are hereby summoned to appear before this court to answer this complaint.
[01:48:42.680 --> 01:48:43.680]  Wait, wait, wait, wait.
[01:48:43.680 --> 01:48:45.680]  Don't read all of the whole documents.
[01:48:45.680 --> 01:48:47.680]  You haven't noticed to appear.
[01:48:47.680 --> 01:48:49.680]  That's enough.
[01:48:49.680 --> 01:48:53.680]  They're going to prosecute the case.
[01:48:53.680 --> 01:48:58.680]  My question to you, Rios, you are in Pennsylvania.

[01:49:32.680 --> 01:49:37.680]  that, it had to stand certified mail to make it clear, okay, I got this filed in the post

[01:49:38.680 --> 01:49:43.680]  So I'm thinking, if I were to file those exact same three documents that you told me to file
[01:49:43.680 --> 01:49:47.680]  before, maybe with a couple extra invasions just to make sure they're absolutely correct.

[01:52:56.680 --> 01:53:07.680]  And my suggestion is if you want to fight the traffic issue, fight it in Pennsylvania.

[01:53:53.680 --> 01:53:59.680]  I'm going to suggest you don't let it become a big deal on a moral ground.

[01:54:04.680 --> 01:54:06.680]  Fight the fight we can win.
[01:54:06.680 --> 01:54:11.680]  If you want to fight the traffic issue, pick the fight in Pennsylvania.

[01:54:14.680 --> 01:54:21.680]  It's a lot more fun when you pick the fight than when it's in a place where you can fight it.

[01:54:27.680 --> 01:54:29.680]  They've got so much leverage against you.
[01:54:29.680 --> 01:54:41.680]  I don't think you can win it unless you're independently wealthy.
[01:54:41.680 --> 01:54:46.680]  You have to know I fully understand the moral position.
[01:54:46.680 --> 01:54:52.680]  You don't want to have to give in to these scoundrels.
[01:54:52.680 --> 01:54:55.680]  And I appreciate that position.
[01:54:55.680 --> 01:55:03.680]  But I'm a combat veteran, and I learned some things in combat.
[01:55:03.680 --> 01:55:11.680]  You only fight the fights that you can win.
[01:55:11.680 --> 01:55:20.680]  And even if you can win a fight, you don't get in it unless you'll gain something from winning it.
[01:55:20.680 --> 01:55:25.680]  If you win this fight in Pennsylvania, what's it likely to cost you?
[01:55:25.680 --> 01:55:31.680]  How much of your resources are you going to use up fighting these guys?
[01:55:31.680 --> 01:55:41.680]  And what kind of value will be returned if you beat them?

[01:55:43.680 --> 01:55:48.680]  I'm going to suggest you do what you can to make this thing go away.

[01:57:30.680 --> 01:57:36.680]  And he says that you don't want to get yourself thrown in jail.
[01:57:36.680 --> 01:57:42.680]  Okay, so there are ways, look, the main point of the script, quote, unquote,
[01:57:42.680 --> 01:57:48.680]  is to establish that you're not in transportation at the time of the traffic stop.
[01:57:48.680 --> 01:57:57.680]  There are ways that you can establish on the record that you are not in transportation at the time of the stop
[01:57:57.680 --> 01:58:00.680]  without getting yourself thrown in jail.
[01:58:00.680 --> 01:58:06.680]  So I think that it's good, you know, to have this discussion again with Eddie so that,
[01:58:06.680 --> 01:58:10.680]  Andrew, the next time this happens in Pennsylvania,
[01:58:10.680 --> 01:58:17.680]  you will know how to modify that script and work the situation so that you can legally protect yourself
