[00:00.000 --> 00:05.840] The following newsflash is brought to you by the Lone Star Lowdown, providing the deli
[00:05.840 --> 00:13.480] bulletins for the commodities market, today in history, news updates, and the inside scoop
[00:13.480 --> 00:21.240] into the tides of the alternative.
[00:21.240 --> 00:27.920] Markets for the 30th of October 2015 opened up with gold at $1,141.72 an ounce, silver
[00:27.920 --> 00:34.320] at $15.54 an ounce, Texas crude at $46.06 a barrel, and Bitcoin is currently sitting
[00:34.320 --> 00:43.720]  at about 322 U.S. currency.
[00:43.720 --> 00:49.880] Today in history, Monday, October 30, 1961, Soviet Union tests the 58-megaton hydrogen
[00:49.880 --> 00:53.920] bomb, the AN-602, nicknamed the Tsar Bomba.
[00:53.920 --> 01:02.360] It remains the most powerful man-made explosion on earth in human history.
[01:02.360 --> 01:06.740] In recent news, China has officially ended the largest eugenics program in human history.
[01:06.740 --> 01:10.520] The People's Republic will be abandoning their infamous one-child policy in order to encourage
[01:10.520 --> 01:14.360] much-needed population growth for one of the world's biggest economies.
[01:14.360 --> 01:19.000] Strict reproduction controls were introduced by Deng Xiaoping in 1979.
[01:19.000 --> 01:22.400] Since then, the working age of the population shrank last year for the first time in two
[01:22.400 --> 01:28.000] decades and like the United States, they are facing a senior citizen crisis since the population
[01:28.000 --> 01:30.400] of those being retired is growing.
[01:30.400 --> 01:33.960] The Communist Party's Central Committee decision to allow couples to have two children was
[01:33.960 --> 01:38.640] revealed by Zheng Hao News, sourcing a document released at the end of a multi-day party policy
[01:38.640 --> 01:40.000]  meeting in Beijing.
[01:40.000 --> 01:43.320] The Communist Party communicated, did state, that the government would want to continue
[01:43.320 --> 01:52.800] control and managing of family planning decisions despite the change.
[01:52.800 --> 01:56.080] The Tor project has launched its first beta version of Tor Messenger.
[01:56.080 --> 01:58.700]  It's a long-awaited open source instant messaging app.
[01:58.700 --> 02:03.480] The app integrates the off-the-record or OTR protocol to encrypt messages and route them
[02:03.480 --> 02:07.260] over Tor just as smoothly as the Tor browser does for the web.
[02:07.260 --> 02:12.680] It's also compatible with the same XMPP or Chattr protocol used by millions of Facebook
[02:12.680 --> 02:18.440] and Google accounts, as well as desktop clients, ADM for Mac and Pigeon for Windows.
[02:18.440 --> 02:19.440]  The result?
[02:19.440 --> 02:23.600] Well, anyone can download the software in a mere seconds, start sending messages to
[02:23.600 --> 02:28.300] their pre-existing contacts that are strongly encrypted and dispersed through Tor's maze
[02:28.300 --> 02:31.320] of volunteer networked computers around the world.
[02:31.320 --> 02:35.440] Tor Messenger is in beta at the moment, however, its developers are welcoming the open source
[02:35.440 --> 02:38.840] community to scrutinize the software for bugs and glitches.
[02:38.840 --> 02:43.600] After some auditing and patchwork, Tor Messenger is set to become a powerful and popular tool
[02:43.600 --> 03:09.760]  for instant dummy-proof, NSA and hacker-proof communications.
[03:09.760 --> 03:27.440] The app integrates the OTR protocol to encrypt messages and route them over Tor just as smoothly
[03:27.440 --> 03:31.320] as the Tor browser does for the web.
[03:31.320 --> 03:38.280] The app integrates the OTR protocol to encrypt messages and route them over Tor just as smoothly
[03:38.280 --> 03:39.280] as the Tor browser does for the web.
[03:39.280 --> 03:44.780] The app integrates the OTR protocol to encrypt messages and route them over Tor just as smoothly
[03:44.780 --> 03:47.780] as the Tor browser does for the web.
[03:47.780 --> 03:53.320] The app integrates the OTR protocol to encrypt messages and route them over Tor that has
[03:53.320 --> 04:04.520]  been encrypted and↑
[04:04.520 --> 04:10.440] for listening and I'm going to start out tonight going back to something I've been working on.
[04:12.040 --> 04:20.920] I'm putting together an outline for an ebook and I'm calling it Legal 101.
[04:23.160 --> 04:31.320] Not Law 101 because this is really not so much about law but more about how the legal system
[04:31.320 --> 04:43.160] really works. I keep thinking of the lyric in Paul Simon's song Codachrome where he says that
[04:43.160 --> 04:52.440] after all the crap I've learned in high school it's a wonder I can think at all. Well when it
[04:52.440 --> 05:04.200] comes to civics and it comes to our system of law in this country I think that's a good description
[05:05.800 --> 05:10.520] because it's not anything like you were told in high school.
[05:12.440 --> 05:20.120] The whole premise and idea that you were given in high school was a political construct.
[05:20.120 --> 05:31.560] It's not like that at all and if you go into court under the perception that it is the way they
[05:31.560 --> 05:37.320] told you the things are the way they told you it was in high school you are going to be terribly
[05:37.320 --> 05:48.520] disappointed and you're not going to know how to handle yourself in the court. And the primary
[05:48.520 --> 05:56.040] paradigm shift we need to make is court is not about law it's about politics
[05:57.320 --> 06:05.080] and I know a lot of people bristle at that. We tend to think if it's all about politics
[06:06.440 --> 06:15.400] then everything is arbitrary and capricious. Yeah as a matter of fact it is. I was looking
[06:15.400 --> 06:24.040] reading some documents today that explain the securitization procedure and explain how
[06:24.760 --> 06:35.240] the note is bifurcated and how under standard rules of contract when these kind of things occur
[06:36.520 --> 06:42.040] the alleged holder can't prove that he's a holder and nobody has the
[06:42.040 --> 06:47.000] power to foreclose. Well the banks have heard all these I mean the courts have heard all these
[06:47.000 --> 06:54.280] arguments and they really don't care. They don't care what the law is they don't care what
[06:55.960 --> 07:01.000]  500 years of contract maritime and
[07:01.000 --> 07:09.880] UCC says they just don't care. They're going to do whatever is politically convenient
[07:11.080 --> 07:23.800] or expedient and the law doesn't matter. I know that makes it difficult but in the end it's no less
[07:23.800 --> 07:34.280] difficult than and adjudicating your case based on law and it's not a lot less predictable.
[07:36.760 --> 07:44.120] It's just a different way of doing things than we're accustomed to and in going to school in this
[07:44.120 --> 07:54.280] country and listening to our parents and grandparents and radio and tv and watching all these programs
[07:54.280 --> 08:01.080] about cops and robbers you you develop certain ideas that are for the most part fallacies.
[08:02.760 --> 08:06.520] You get notions about the way things are that just aren't true.
[08:06.520 --> 08:17.000] And one of the primary ones the ones that seem the one that seems most important to all of us in terms
[08:17.000 --> 08:25.880] of our personal security is we like to think the system's fair and we're taught in high school
[08:25.880 --> 08:33.240] that we live in a system of law that the system that is designed to promote justice and equality
[08:33.240 --> 08:41.320] and all these other things and that's just not true. It may have some facial design
[08:42.680 --> 08:46.520] that implies that that is some sort of an intent
[08:46.520 --> 08:56.760] but it is not the result not by a long shot. The system is not fair and if you expect fairness,
[08:56.760 --> 09:04.040] if you expect people to do the right thing for the right reasons you'll be disappointed every time
[09:04.840 --> 09:12.760] especially when you're dealing with a system that is not fair and it's not a fair system.
[09:12.760 --> 09:19.960] Pointed every time especially when you're dealing with lawyers and judges because they'll tell you
[09:19.960 --> 09:27.160] real fast they're not there to determine right or wrong they're there to apply the law that's what
[09:27.160 --> 09:34.280] they'll tell you but they don't apply the law they apply whatever is convenient for them at the moment
[09:34.280 --> 09:42.440] and it's all driven by politics and one of the the second fallacy is when you go into court
[09:43.640 --> 09:49.720] and you hear the lawyers talk to the judge the judge talk to them to the litigants and
[09:50.680 --> 09:54.120] you get the impression for the most part that they're speaking English.
[09:54.120 --> 10:02.040]  They're not speaking English. They're speaking a very specific English dialect
[10:03.720 --> 10:12.280] called legalese. It's real important that you understand they are not speaking English.
[10:13.560 --> 10:20.600] They use words that sound familiar. Words you think you know and understand
[10:20.600 --> 10:34.200] and in a large part the words they use have been carefully chosen. So as to state one thing in law
[10:34.200 --> 10:43.400] while giving another impression to the litigant, persons when they speak about persons in law we
[10:43.400 --> 10:48.440] think of a person as a living breathing human being but that's not what it means in law.
[10:49.960 --> 10:55.080] It can be a living human breathing human being but it can also be a fictional entity.
[10:55.800 --> 11:03.880] A company, corporation, LLC these can be persons under law and not understanding that
[11:03.880 --> 11:12.440] can leave you at a horrible disadvantage and there are a lot of terms that have special meanings
[11:12.440 --> 11:22.840] in law. You need to pay real close attention when lawyers and judges are speaking because you'll
[11:22.840 --> 11:35.800] hear them use terms that if you try to define the term in the way you normally define it doesn't
[11:35.800 --> 11:44.200] seem to fit in this circumstance and then you need to consider there's a good chance that is a term of art
[11:44.200 --> 11:51.560] and a term of art is a term that has a special definition in a particular circumstance
[11:52.920 --> 12:00.440] and I just turned the phone lines on and the phone lines are completely jammed already. Oh my goodness.
[12:02.680 --> 12:07.560] So since we have so many callers I won't go through the rest of this
[12:07.560 --> 12:19.080] it takes a while to frame this paradigm but once you have the the paradigm framed differently
[12:20.280 --> 12:29.000] it makes the system more understandable and where it was going is everything is pulled out of the system
[12:29.000 --> 12:37.400] it makes the system more understandable and where it was going is everything is political
[12:38.440 --> 12:46.440] and all politics is local. You won't win your case simply because you have the facts and law on your side.
[12:47.560 --> 12:55.000] You win your case if you can manipulate the local politics. If you pay attention to the pressures
[12:55.000 --> 13:03.480] on the judges prosecutors the other litigants police bailiffs you need to understand what their
[13:04.440 --> 13:15.800] business pressures on them are especially your lawyer. Your lawyer is not there to do what you
[13:15.800 --> 13:23.000] think he's there to do and if we get time if we run out of callers I'll go back to this and explain
[13:23.000 --> 13:32.600] what your lawyer is really there to do and I'll leave you with the assertion that if you believe
[13:32.600 --> 13:42.680] that your lawyer is there to to vigorously adjudicate your rights you are dreaming that is
[13:42.680 --> 13:48.120] not why he's there. Okay we're going to go to a call board because we have a full board today
[13:48.120 --> 13:56.520] and we're going to start with Andrew in Pennsylvania. Hello Andrew. Andrew's not the first caller on the
[13:56.520 --> 14:02.920] board but Andrew called in last night and he was on the board all night and we didn't get to him.
[14:03.960 --> 14:10.840] So we're going to go to Andrew first. Hello Andrew. Hello Randy. A little update in regards to that
[14:10.840 --> 14:14.840] incident that happened a little less than a month ago in which I tried using Eddie's script in
[14:14.840 --> 14:22.200] Arizona and the cop the ignorant stupid cop lost his cool and decided to take me to jail for 30
[14:22.200 --> 14:30.520] hours. First of all a couple things my mother got a check back from Arizona. She bailed me out with
[14:30.520 --> 14:38.200] my card for $500. The check she got back was for $493 making that whatever you will and in addition
[14:38.200 --> 14:44.440] to that I got a letter from the United States District Court Eastern District Court of Pennsylvania
[14:44.440 --> 14:50.680] that's a federal court. They sent me back the original petition motion to dismiss for due
[14:50.680 --> 14:56.920] process violations the removal of traffic case and the federal lawsuit all of which I plagiarized so
[14:56.920 --> 15:02.120] to speak that document you told me about on jurisprudence and the reason they sent me back
[15:02.120 --> 15:08.520] the excuse they gave me out of all the excuses they have here to return the enclosed document
[15:08.520 --> 15:15.640] for the following reasons it says here. The very first one out of the eight things here
[15:15.640 --> 15:20.280] is complaint petition captioned for another district court. Now the district court I mean
[15:20.280 --> 15:25.080] the court that I captioned at the top was the court in Arizona that I was supposed to have my
[15:25.720 --> 15:29.160] raiment on and I assumed that that's what I'm supposed to put on because that was the
[15:30.040 --> 15:34.040] relevant to the respective case number so I'm getting the stack I'm thinking well just how
[15:34.040 --> 15:38.920] stupid can these courts be I mean how what other court was I supposed to put up there I mean isn't
[15:38.920 --> 15:43.000] it kind of understood that that was the one I'm supposed to put on it so I mean. No that okay
[15:43.000 --> 15:50.840] that's they are right in that you have to caption the case to the district court now you can
[15:51.640 --> 16:02.760] stipulate the cause of action in the in the state you can identify it in the document
[16:02.760 --> 16:10.280] but what your document needs to be headed and addressed to the federal courts and not to the
[16:10.280 --> 16:18.680] state court these are these are some technical things and the federal courts are a lot more
[16:19.640 --> 16:31.160] particular about getting the the form correct so it's not necessarily that they're giving you a
[16:31.160 --> 16:39.320] hard time they just need it in a certain form and they're going to be particular about that
[16:40.680 --> 16:47.560] that's okay it gives you some it helps to educate you all right thanks so when the
[16:47.560 --> 16:52.680] break is back over can we talk about where I can go from here in regards okay Randy Kelton

[19:55.080 --> 20:07.880] okay you they sent it back because okay had the wrong caption did they notice note anything else
[20:09.720 --> 20:15.720] no no that's it i also sent the same thing to the maricopa county arizona prosecutor
[20:15.720 --> 20:23.000] i didn't get anything back from him so i don't like i said my mother also got a check back
[20:23.000 --> 20:26.920] for the bail money that she bailed me on for although they didn't give her everything back
[20:26.920 --> 20:32.600] it was seven dollars short it was 493 that she got back and not the 500 that she used to bail me out
[20:32.600 --> 20:39.320] of jail so i don't know what the significance of that is but i just play it safe and make sure
[20:39.320 --> 20:43.160] that i'm sure that i don't know if they dropped the case or not but i'm going to assume they didn't
[20:43.160 --> 20:47.560] let's assume that there's still a warrant for my arrest at this moment and i want to try to do
[20:47.560 --> 20:54.120] whatever i can to to put this to rest so i should i send this back to the federal courts all over
[20:54.120 --> 20:59.960] again and this time make sure that i uh may be clear on the uh caption that this is the u.s
[20:59.960 --> 21:08.200] district court east district of pennsylvania okay this is what you do you go online and pull down
[21:08.200 --> 21:17.560] on a federal lawsuit in the district where you're filing the where your case will be filed
[21:19.800 --> 21:25.080] and look at the form if you can find one online download it and just use their
[21:25.880 --> 21:32.200] take their names off of it put your names on it use their basic form use the same font style
[21:32.200 --> 21:40.840] uh different courts want things somewhat different like uh they might want your name and address
[21:40.840 --> 21:50.440] above the the complaint heading i know in some courts we have to do that each court has peculiarities
[21:50.440 --> 21:57.640] some of them want want lines on each side of the page with line numbers
[21:57.640 --> 22:05.240] some of them don't so you need to see what the peculiar requirements of this particular court
[22:05.240 --> 22:09.240] is and the best way to do that is just find something that's been filed in that court
[22:10.440 --> 22:19.640] you'll put you in your case it will be okay are you removing it to the federal court are you filing
[22:19.640 --> 22:27.400] are you removing it to the federal court are you filing a federal action well uh simple answer is i
[22:27.400 --> 22:33.720] was just uh doing whatever advice you gave me to do and you i don't remember bring me back up to
[22:33.720 --> 22:40.200] speed yes you well you told me you file a motion to dismiss because of due process violation a
[22:40.200 --> 22:45.720] removal of traffic case and a federal lawsuit with both the federal court in pennsylvania
[22:45.720 --> 22:54.760] and the um maricopa county arizona prosecutor and um and you basically just let me page your eyes
[22:54.760 --> 22:59.960] uh the jurors and prudence document for all three making just some minor altercations like taking out
[22:59.960 --> 23:07.000] all the texas uh base stuff and uh just maybe altering the words in a few spots like in the
[23:07.000 --> 23:11.640] traffic case one i just want to make it clear that it was a traffic stop and i like said i was not in
[23:11.640 --> 23:16.840] the for hire capacity and all that just might make it clear that that's relevant to that specific um
[23:17.560 --> 23:24.360] document but as far as which uh courts to send all the information to um like they said it was
[23:24.360 --> 23:31.160] just one of the federal courts in pennsylvania and the maricopa county prosecutor the prosecutor
[23:31.160 --> 23:36.920] never sent me anything back so i don't know what to deal with that okay well prosecutor probably
[23:36.920 --> 23:46.200] realized that he this was not something he would have to respond to because it the federal court
[23:46.200 --> 23:56.440] was not going to allow it they would they would send it back but if you do it correctly then he
[23:56.440 --> 24:04.440] has a certain amount of time to respond or he weighs his right to now you mentioned that they
[24:04.440 --> 24:11.720] sent you back your bail money yes that's my mother not all of it but like the majority of it
[24:12.440 --> 24:20.520] well it's all but seven dollars okay and it's probably some kind of fee arizona charges
[24:22.760 --> 24:31.000] okay it's very unlikely they would send that back to you unless they were dropping the case
[24:31.000 --> 24:37.640] really okay well i don't know oh yeah they want you're out of state they got your money
[24:38.920 --> 24:46.280] they're going to keep your money to pay the to convert to the fine they'll charge you
[24:48.280 --> 24:54.600] but there's a good chance when the prosecutor saw that you were concocting a federal lawsuit
[24:54.600 --> 25:01.960]  here here's a problem he's if he's been there before here's the problem he's going to have
[25:03.720 --> 25:10.600] he's got a pro se that don't know squat and he sends this suit to the feds and it's got the
[25:10.600 --> 25:18.520] wrong heading on it it's all screwed up what's going to happen is is the federal courts are
[25:18.520 --> 25:26.280] going to try to afford him due process and in the process of due giving him due process they're
[25:26.280 --> 25:33.000] going to make my life a living hell because i'm going to have to object to all of these documents
[25:33.000 --> 25:39.560] i don't like i'm going to have to write pleadings i'm going to have to write answers and for chump
[25:39.560 --> 25:49.400] chains you know the what i started out talking about the politics the prosecutor is a municipal
[25:49.400 --> 25:59.720] prosecutor or a traffic court prosecutor and he's all about making money doing song and dance with
[25:59.720 --> 26:12.120] an out-of-state litigant on a traffic citation is not profitable period he cannot win all he can do
[26:12.120 --> 26:20.200] is lose so he's got this big stack of cases he needs to get off his desk
[26:20.200 --> 26:27.480] then he gets somebody come along doesn't want to make a deal he's out of state he wants to fight
[26:28.520 --> 26:35.800] i can't clear my docket if i'm fighting with this guy so it may well be that they've decided to
[26:35.800 --> 26:44.280] dismiss it since they sent you might check with them since they sent your $500 back that's a
[26:44.280 --> 26:51.880] real good indication that they don't want anything to do with you so i would i would sure check that
[26:53.080 --> 27:02.600] yeah but in the meantime okay i'm sorry in the meantime get your suit get it corrected
[27:03.400 --> 27:07.720] now in your suit what were your causes of action
[27:07.720 --> 27:16.120] okay well basically uh minor altercation is made to the uh to the uh habeas document that you gave
[27:16.120 --> 27:22.760] me like i said i took out all the texas stuff um off the top of my head i don't know exactly what
[27:22.760 --> 27:31.080] all alterations i made to the um okay hold on that document was a habeas corpus
[27:31.080 --> 27:41.240] yes the the substance of the document you would have to make changes based on your particular
[27:41.240 --> 27:50.040] situation this was written for someone who uh this let's see this guy was arrested for dui
[27:50.040 --> 27:59.960] so basically the arrest portion is will be the same because what you arrested for is irrelevant
[28:01.640 --> 28:11.720] once once you're detained beyond the terry stop once they put the cuffs on you and start toward
[28:11.720 --> 28:21.240] the jail it's all the same so yes after you've done all of that after you've given the facts
[28:22.280 --> 28:27.960] this will give the facts and the law when you get to the end of that then you say
[28:29.320 --> 28:34.360] that they denied you due process and you you need to go back to that
[28:34.360 --> 28:43.000] hey that they denied you due process and you need to go back to that i have about 19
[28:43.880 --> 28:54.120] i remember right 19 due process claims against them i charged the bailiffs i charged the deputies
[28:54.120 --> 29:01.560] i charged the courts that i walked down through the process and everywhere that someone didn't
[29:01.560 --> 29:12.600] follow the process then you should make a claim against them generally in most states the one
[29:13.320 --> 29:21.080] thing that jurisdictions waive their absolute immunity for is false imprisonment
[29:22.600 --> 29:30.760] so there's a very good chance there that i'm relatively certain that in arizona on a charge
[29:30.760 --> 29:35.480] of false imprisonment there's going to be no official immunity from the state county or
[29:35.480 --> 29:41.160] municipality so they don't get to claim official immunity when you're charging false imprisonment
[29:43.480 --> 29:50.520] so hang on we're about to go to court the court about to go to break randy calton rule of law

[30:55.960 --> 31:01.480] two years and already had two federal clerkships lined up so when dawson felt labor pains on the
[31:01.480 --> 31:06.840] day of the test she showed up anyway then halfway through the exam she went into active labor but
[31:06.840 --> 31:12.280] even mind-blowing agony couldn't stop her she finished every question turned in the test then

[33:09.720 --> 33:25.720] yeah i got a warrant and i'm gonna solve them to the government them prosecute them okay
[33:25.720 --> 33:39.640] i okay we are back randy cutton rule of law radio we're talking to andrew in pennsylvania
[33:40.920 --> 33:43.000] okay andrew when you write a lawsuit
[33:45.560 --> 33:50.760] the lawsuit should start out by stating who the parties are
[33:50.760 --> 33:58.360] then it should go to a section on jurisdiction so you need to find a federal lawsuit
[34:00.120 --> 34:09.800] where someone in one state has sued someone in another state in a federal court and you need to
[34:09.800 --> 34:15.800] do a little research on venue it probably won't take 10 15 minutes to figure it out
[34:15.800 --> 34:28.040] who has venue when you sue a state in the federal court does the federal court in that state have
[34:28.040 --> 34:33.800] venue or does the federal court where you file the suit have venue do you understand
[34:34.360 --> 34:39.800] what we mean by venue as opposed to jurisdiction
[34:39.800 --> 34:45.960] uh yeah that last part again see who has the venue the the federal court or the who say that again
[34:45.960 --> 34:54.440] oh the federal court in in the state of the defendant or the plaintiff
[34:55.080 --> 34:58.920] okay and the word and the word venue means
[35:00.120 --> 35:05.320] okay both courts would have jurisdiction because they're both federal courts
[35:05.320 --> 35:10.440] okay both courts would have jurisdiction because they're both federal courts
[35:12.440 --> 35:21.880] but the court is going to be held in a area that's convenient to one or other of the
[35:21.880 --> 35:29.080] parties and it's most likely going to be in an area most convenient to the accused because the
[35:29.080 --> 35:37.960] accused is the one that's being put upon and the accused didn't take the action but you need to
[35:37.960 --> 35:45.400] check that to see what venue it needs to go through so all of them have jurisdiction but each of them
[35:45.400 --> 35:54.840] have a a area in which they exercise that jurisdiction and the area in which they exercise
[35:54.840 --> 36:01.800] their jurisdiction is their venue so you need a you pull down somebody pull down some lawsuits
[36:01.800 --> 36:11.000] from federal lawsuits in pennsylvania as a matter of fact we may have leslie may have one
[36:11.880 --> 36:19.400] in my documentation i just sent a copy of leslie from pennsylvania she calls him pretty regular
[36:19.400 --> 36:27.320] and i was reading through a response she made into a lawsuit with a foreclosure suit and i sent this
[36:27.320 --> 36:38.120] to someone else that i was helping with an issue as an example as an example of the kind of work
[36:38.120 --> 36:49.560] kind of work that i aspire to i don't produce work anywhere near that good so i aspire to produce
[36:49.560 --> 36:58.360] work that good she does have a lawsuit i believe she has a rico suit but i'll look through her work
[36:58.360 --> 37:08.360] and see what i've got that i can send you that she has done you may have it'll give you the structure
[37:09.880 --> 37:17.240] now her suit was against a foreclosure bill so it's not i don't think you'll have the venue
[37:17.880 --> 37:26.280] issues in her suit that you do in yours because it's a traffic ticket and you live in one state
[37:26.280 --> 37:32.680] and they're in another state but you were in that state when you got the ticket so that may affect
[37:32.680 --> 37:46.200] venue that part that part's going to take some research i can do that no problem all right so
[37:46.760 --> 37:50.680] you wanted to send me this thing from from leslie i mean do you want to send it to me by email you
[37:50.680 --> 37:56.680] know me on facebook by the way i am your facebook friend so how do you want to tell me to just send
[37:56.680 --> 38:05.000] no not say i never use facebook i get these emails that say you have 99 notifications
[38:06.280 --> 38:10.920] and once while i go look at it but it never takes away the notifications so i don't know how to use
[38:10.920 --> 38:18.280] it i need a 10 year old to show me how to use it okay i'll send you an email okay send me an email
[38:18.280 --> 38:28.840] and i'll respond to the email okay and i'll get you something from leslie she really does do nice
[38:28.840 --> 38:37.160] work and that that'll give you that once again once you've got once you have that
[38:37.960 --> 38:45.480] you know read through the suit so that you see how causes of actions are claimed
[38:45.480 --> 38:49.880] and in your case you have a cause of action for breach of due process
[38:51.080 --> 39:00.840] i had breach of due process process unlike other causes of action the courts have ruled that a
[39:01.400 --> 39:12.120] due process violation is harm per se in that you don't have to demonstrate harm due process is
[39:12.120 --> 39:18.520] a right and the deprivation of the right is harm on its face so you don't have to show that you were
[39:19.080 --> 39:24.360] harmed in a specific way just the fact that your due process rights were violated that's sufficient
[39:24.840 --> 39:33.160] but you do in a civil case you have to make your claim in terms of a defined cause of action
[39:33.160 --> 39:42.760] a criminal case criminal is a subset of civil it's a specialized subset like family law is a
[39:42.760 --> 39:54.840] subset of civil in criminal the causes of action are the statutes so as a cause of action they'll
[39:54.840 --> 40:04.120] claim a violation of a statute in civil you have to craft whatever your claim is it in terms of a
[40:04.120 --> 40:12.680] defined cause of action and like we have here in texas we have litigation guides and we have o'connor's
[40:12.680 --> 40:20.520] causes of action and they list all the defined causes of action and they list what each of the
[40:20.520 --> 40:29.480] elements of the cause of actions are and how to address each of those elements you need to look
[40:29.480 --> 40:38.120] that up in the fed for due process and probably the best way to do it is look up a due process
[40:38.680 --> 40:44.440] a suit claiming due process or false imprisonment in the fed and you should be able to should find
[40:44.440 --> 40:54.920] lots of those preferably find one within your jurisdiction or within the jurisdiction that has
[40:54.920 --> 41:02.520] venue okay what was that that you start say um let's say that again a federal lawsuit what was
[41:02.520 --> 41:08.600] that thing you just said i just want to just do uh look up a federal due process lawsuit
[41:08.600 --> 41:15.560] look up a federal due process lawsuit for false imprisonment or federal look the
[41:15.560 --> 41:19.560] false imprisonment lawsuit preferably over a traffic citation
[41:22.040 --> 41:28.040] and thank you look you know first do your research on venue to make sure what venue
[41:28.040 --> 41:36.040] this would have to be filed in and good chance you can call the federal district clerk and tell
[41:36.040 --> 41:44.200] her that you know one litigant is the state of arizona or it's a you're suing a county or a city
[41:44.200 --> 41:50.440] in arizona you got a ticket in arizona and you live in pennsylvania who would have been you should
[41:50.440 --> 42:00.840] be able to tell you immediately and then do an internet search for a similar lawsuit filed in
[42:00.840 --> 42:06.440] that venue and then pull out your plagiarizing pen
[42:09.800 --> 42:16.680] you need to start the lawsuit with parties venue then a brief statement of what the case is
[42:18.520 --> 42:27.400] plaintiff was illegally arrested in arizona for allegedly violating a traffic law
[42:27.400 --> 42:36.520] and taken to jail and held x number hours and you will show that the arrest was improper whatever
[42:36.520 --> 42:41.560] your claims are going to be just briefly tell the court what you're going to tell them
[42:42.600 --> 42:49.560] and then give them a statement of facts statement of facts is facts not arguments not explanations
[42:49.560 --> 42:56.600] i just did a statement of facts for someone today on foreclosure issues and my statement of facts
[42:56.600 --> 43:04.280] says on this day at this time there was filed with the counter recorder a document titled as follows
[43:04.280 --> 43:12.200] and i put the title in the document was dated as follows i put the date in the document
[43:12.200 --> 43:19.560] the document defined itself as a security instrument actually what i do is go to the
[43:19.560 --> 43:25.960] document and copy out that section and drop it in my statement of facts that's the extent
[43:25.960 --> 43:34.840] of explanation you give in a statement of facts just what the facts are now you can set that aside
[43:34.840 --> 43:41.320] as a separate document once you've got a statement of facts in the next thing is going to be going
[43:41.320 --> 43:47.640] to be going to break which we're about to do and when we come back we'll talk about a statement of

[46:32.920 --> 46:41.000] okay we are back randy kelton we're on our radio and we're talking to andrew in pennsylvania okay
[46:41.000 --> 46:53.080] andrew you put in a statement of facts and then you take that habeas and use that as a statement
[46:53.080 --> 47:05.400] of factual accusation look at the habeas and match the facts to the habeas on this day at this time
[47:05.400 --> 47:16.200] uh you were pulled over in a traffic stop the officer arrested you for whatever
[47:17.720 --> 47:24.600] the officer took you directly to jail at some point you did you see a magistrate
[47:26.440 --> 47:32.520] yes and i tried to object to one of the things i could object to and they couldn't even let me
[47:32.520 --> 47:39.480] object to that all the more evidence of that court okay you you was the officer present at the hearing
[47:40.760 --> 47:50.760] not the one who arrested me okay okay then look okay in texas we refer to chapter 16 is a is the
[47:50.760 --> 47:55.880] chapter the code of criminal procedure that tells the magistrate what he's to do when he holds an
[47:55.880 --> 48:02.200] examining trial and these procedures will be relatively consistent across the states
[48:04.600 --> 48:11.000] they didn't do those things so look in arizona law for examining trial
[48:12.360 --> 48:20.680] and see what this you know replace the the state's texas state statutes with arizona statutes
[48:20.680 --> 48:27.240] that should not be terribly difficult because the vast majority of what i have in there goes to
[48:27.240 --> 48:36.120] chapter 16 there's a couple of other issues but they should be easy to juxtapose and then you
[48:37.320 --> 48:47.080] take the habeas and construct a set of facts that walks down the accusations that you make
[48:47.080 --> 48:55.320] creating a statement of facts is really an art form because when the judge reads the statement
[48:55.320 --> 49:03.080] of facts he's going to try to make sense of those he's going to look at the facts as he goes through
[49:03.080 --> 49:13.320] them and try to make a determination of what your issue is what the issues between the two parties
[49:13.320 --> 49:23.160] are so construct a complete set of facts then look at the habeas these are the steps they're
[49:23.160 --> 49:30.840] supposed to take and if a fact is not relevant to anything you're talking about just leave it out
[49:30.840 --> 49:39.240] construct your facts so that if a reasonable person of ordinary prudence were to read this
[49:40.440 --> 49:52.760] series of facts of steps that were taken that it would tend to lead them to the position you want
[49:52.760 --> 50:01.000] to bring them to you look at the accusations you're going to make the officer failed to do this
[50:01.560 --> 50:09.000] in your statement of facts at the court at the proper place you say the officer failed to do this
[50:09.880 --> 50:17.240] and then the officer did this something he shouldn't do and then match it to the
[50:17.240 --> 50:24.360] due process steps for the most part that's all this relevant to your issue the fact that he
[50:25.560 --> 50:30.840] didn't use his blinkers or exceeded the speed limit and while taking you to jail or
[50:30.840 --> 50:34.360] stopped to get coffee while you were handcuffed in the back of the car
[50:35.560 --> 50:41.720] irrelevant don't even put it in there if it does not go to the adjudication of the case
[50:41.720 --> 50:48.520] don't even put it in there if it does not go to the adjudication of the case don't put take
[50:48.520 --> 50:55.560] put it in there initially and then go back through it and recraft your statement of facts
[50:55.560 --> 50:59.880] so it follows your statement of factual accusation am i making sense
[51:01.720 --> 51:07.880] yes you are very much so and i'm trying to write down all this importance as i couldn't get as you
[51:07.880 --> 51:16.760] begin to construct your statement of facts following the due process defined in the habeas
[51:17.400 --> 51:23.480] this will begin to make itself clear things that you may have thought were important
[51:24.360 --> 51:29.240] there won't be a place that they fit in there make any difference
[51:29.240 --> 51:37.160] if the cop was rude if he was disrespectful doesn't go to due process so don't even put it
[51:37.160 --> 51:44.280] in there but it'll as you do this it takes a doing it a time or two and then you get it
[51:44.280 --> 51:50.120] it really begins to make sense but you want a statement of facts that leads your reader
[51:50.120 --> 51:55.320] to the place you want him to go and then you want a statement of factual accusations that
[51:55.320 --> 52:07.640] follows your facts and assigns meanings to those facts and then you want a set of causes of action
[52:08.840 --> 52:18.840] i have at least 19 criminal violations in the habeas each criminal violation against
[52:18.840 --> 52:27.080] to your detriment is a due process violation look up due process as a cause of action
[52:28.600 --> 52:39.800] read what the elements are and each time they violated law in processing your arrest charge
[52:39.800 --> 52:48.520] that as a separate cause of action can include all of the elements that are required for each one to
[52:48.520 --> 52:56.280] stand alone as a cause of action all on its own and so if they dismissed every other cause of action
[52:56.280 --> 53:03.320] every other claim you have this one would be sufficient all by itself just walk down it that
[53:03.320 --> 53:10.120] way it takes a little practice but as you do it it'll begin to make sense how all of these pieces
[53:10.120 --> 53:18.280] fit together once you have once you have the cause of action i just had someone send me a document
[53:18.280 --> 53:30.040] that was a federal lawsuit and he was written by a pro se legal reform guy and he hasn't the person
[53:30.040 --> 53:34.600] who sent it to me asked you what do you think about this i said he doesn't have a prayer
[53:35.880 --> 53:42.520] and he said why not i said i don't know he didn't have a prayer the last thing you want to do
[53:43.560 --> 53:54.360] is ask the court for remedy and that's done in the form of a prayer you do your statement of your
[53:54.360 --> 54:03.400] do your statement of your introduction your statement of fact just your points in authorities
[54:03.400 --> 54:09.640] or statement of factual accusation then you do your cause of actions which amount to your claims
[54:10.360 --> 54:18.280] then you do a conclusion you sum it all up and then you ask the court for your remedy
[54:18.280 --> 54:25.480] and that's in the form of a prayer make sure it has a prayer it if it doesn't have a prayer
[54:26.040 --> 54:34.600] you don't have a prayer it doesn't invoke any duty on part of the court so those are the pieces that
[54:34.600 --> 54:41.640] need to be in there for a lawsuit and just look up a couple of them you know pull down a couple of
[54:41.640 --> 54:49.880] pull down a couple of due process traffic arrest lawsuits against arizona they'll have almost all
[54:49.880 --> 54:57.960] your case law in there for you and look at the structure look how all of these pieces
[54:58.760 --> 55:03.960] fit together in their lawsuit you look at a couple of them and it'll become clear how to
[55:03.960 --> 55:12.360] put it together and anywhere you can please your eyes please your eyes please your eyes okay does
[55:12.360 --> 55:21.000] that sound like a set of instructions absolutely and i did just send you an email um to your uh
[55:21.000 --> 55:26.200] during the last break did i put you to sleep andrew i think from lastly but no not at all
[55:26.200 --> 55:32.520] not at all you didn't put me to sleep i think i put andrew to sleep i have that effect on people
[55:32.520 --> 55:41.240] especially my wife okay looks like we may have lost andrew so now we're going to go to jan in
[55:41.240 --> 55:54.040] arizona hello jan hello this is jan well that's interesting jan are you there i am there you can't

[01:03:28.240 --> 01:03:31.240]  I won't pay for the war with my body
[01:03:31.240 --> 01:03:34.240] Ain't gonna pay for the car with my money
[01:03:34.240 --> 01:03:38.240]  I won't pay for the fun with my body
[01:03:38.240 --> 01:03:41.240] Their plans wicked and their logic shoddy
[01:03:41.240 --> 01:03:45.240] Ain't gonna pay for the war with my body
[01:03:45.240 --> 01:03:48.240]  I won't pay for the boys with my money
[01:03:48.240 --> 01:03:51.240] Ain't gonna pay for the kids with my money
[01:04:18.240 --> 01:04:21.240] Asking for that stuff from Leslie
[01:04:21.240 --> 01:04:24.240] So you check the email, you'll see that
[01:04:24.240 --> 01:04:27.240]  Okay, and I will find a
[01:04:27.240 --> 01:04:31.240]  I will find one of Leslie's documents
[01:04:31.240 --> 01:04:34.240]  She's out of Pennsylvania
[01:04:34.240 --> 01:04:37.240] And I'll find one of her federal pleadings
[01:04:37.240 --> 01:04:40.240] And get that to you
[01:04:40.240 --> 01:04:45.240] This is the kind of work I aspire to
[01:04:45.240 --> 01:04:48.240] I'm not able to produce that kind of work
[01:04:48.240 --> 01:04:51.240]  But I'm working on it
[01:04:51.240 --> 01:04:54.240]  Her work is exceptional
[01:04:54.240 --> 01:04:57.240] There are a number of rules we have
[01:04:57.240 --> 01:05:01.240] Never make a proactive statement of law out of your own mouth
[01:05:01.240 --> 01:05:04.240]  She never does that
[01:05:04.240 --> 01:05:07.240] She never says, this is what you're supposed to do
[01:05:07.240 --> 01:05:10.240]  This is what you can't do
[01:05:10.240 --> 01:05:15.240] She says, in this case, the court said this
[01:05:15.240 --> 01:05:18.240] In that case, the court said that
[01:05:18.240 --> 01:05:22.240] The statement she wants to make, she makes it with law
[01:05:22.240 --> 01:05:26.240]  She organizes her work
[01:05:26.240 --> 01:05:29.240]  Where it's very understandable
[01:05:29.240 --> 01:05:33.240] So if you're gonna start learning how to write pleadings
[01:05:33.240 --> 01:05:39.240] This is an absolutely wonderful format to look at
[01:05:39.240 --> 01:05:41.240] It will get you way ahead of the game
[01:05:41.240 --> 01:05:45.240]  Today, I was reading a document
[01:05:45.240 --> 01:05:51.240] That had a tremendous amount of information in it about MERS
[01:05:51.240 --> 01:05:56.240] But it was an original petition
[01:05:56.240 --> 01:06:03.240] But the writing was just absolutely horrible
[01:06:03.240 --> 01:06:08.240]  It was 90 pages, redundant
[01:06:08.240 --> 01:06:11.240]  He didn't connect his facts together
[01:06:11.240 --> 01:06:13.240] He jumped from one place to another
[01:06:13.240 --> 01:06:17.240] I could not make sense of this document
[01:06:17.240 --> 01:06:20.240] And there was some really tantalizing information in there
[01:06:20.240 --> 01:06:23.240] That I would have liked to have been able to understand
[01:06:23.240 --> 01:06:25.240] But it was just incomprehensible
[01:06:25.240 --> 01:06:27.240]  And a lawyer wrote this
[01:06:27.240 --> 01:06:30.240]  I should send him one of Leslie's documents
[01:06:30.240 --> 01:06:33.240] This is how to process, do it
[01:06:33.240 --> 01:06:36.240] Okay, I will get that to you
[01:06:36.240 --> 01:06:39.240] And look it over, do a little research
[01:06:39.240 --> 01:06:41.240] And then call us next week
[01:06:41.240 --> 01:06:43.240]  All right
[01:06:43.240 --> 01:06:45.240]  Thank you, Andrew
[01:06:45.240 --> 01:06:46.240]  You're welcome
[01:06:46.240 --> 01:06:47.240]  Take care, lady
[01:06:47.240 --> 01:06:51.240] Okay, now we're gonna go to Jan in Arizona
[01:06:51.240 --> 01:06:53.240]  Hello, Jan
[01:06:53.240 --> 01:06:55.240]  Hi
[01:06:55.240 --> 01:06:59.240] I apologize for that little technical glitch
[01:06:59.240 --> 01:07:03.240] Yeah, that's all right, not your fault
[01:07:03.240 --> 01:07:10.240] Okay, kind of bring us up to speed on where you're at
[01:07:10.240 --> 01:07:12.240] So everybody understands the position
[01:07:12.240 --> 01:07:15.240] I asked her to call in today
[01:07:15.240 --> 01:07:20.240] Because we're gonna talk about the procedure
[01:07:20.240 --> 01:07:22.240]  Okay, great
[01:07:22.240 --> 01:07:25.240] I've got a piece of paper right here to pen
[01:07:25.240 --> 01:07:29.240] So up to speed is that
[01:07:29.240 --> 01:07:39.240] I had a roommate who got an equity loan out on my home
[01:07:39.240 --> 01:07:42.240]  I mean, she and I were investors together
[01:07:42.240 --> 01:07:46.240] But without my consent, she got a loan
[01:07:46.240 --> 01:07:48.240] And then she abandoned the loan
[01:07:48.240 --> 01:07:51.240] And then because I was still in the house
[01:07:51.240 --> 01:07:55.240] The Fannie Mae came after me
[01:07:55.240 --> 01:07:59.240]  Okay, hold on
[01:07:59.240 --> 01:08:04.240] Did you own the house outright?
[01:08:04.240 --> 01:08:07.240]  Yes, I did
[01:08:07.240 --> 01:08:11.240] And I have filed many filings, one including that
[01:08:11.240 --> 01:08:14.240]  Wait a minute, hold on
[01:08:14.240 --> 01:08:19.240] Did you own it outright or did you own it jointly with this other person?
[01:08:19.240 --> 01:08:24.240] Oh, on paper, her name was there as well
[01:08:24.240 --> 01:08:28.240] So both of your names were on the warranty deed?
[01:08:28.240 --> 01:08:31.240]  Yes
[01:08:31.240 --> 01:08:34.240]  Interesting
[01:08:34.240 --> 01:08:38.240] And they granted the loan to one party
[01:08:38.240 --> 01:08:40.240]  They can't collect on this
[01:08:40.240 --> 01:08:44.240] Okay, then she abandoned the loan, what happened?
[01:08:44.240 --> 01:08:46.240] She abandoned the loan and the home
[01:08:46.240 --> 01:08:56.240] She was gone for two years before Fannie Mae bought the loan from
[01:08:56.240 --> 01:09:00.240] Quality Loan who had bought it from Wells Fargo
[01:09:00.240 --> 01:09:03.240]  So it's a securitized loan
[01:09:03.240 --> 01:09:04.240]  Okay, wait, wait, wait
[01:09:04.240 --> 01:09:06.240]  Let's not go there yet
[01:09:06.240 --> 01:09:07.240]  Okay
[01:09:07.240 --> 01:09:14.240] Because in fact, you really don't know who did what
[01:09:14.240 --> 01:09:19.240] All that stuff about who bought the loan from who and who sold it
[01:09:19.240 --> 01:09:21.240] You don't know any of that stuff
[01:09:21.240 --> 01:09:27.240] That's just a bunch of trash they put out there for consumer consumption
[01:09:27.240 --> 01:09:32.240] Doesn't necessarily have anything to do with anything
[01:09:32.240 --> 01:09:35.240] Who was the original lender?
[01:09:35.240 --> 01:09:39.240]  Wells Fargo
[01:09:39.240 --> 01:09:44.240] Okay, is there an assignment of the security instrument filed in
[01:09:44.240 --> 01:09:50.240] the public record from Wells Fargo to some other party?
[01:09:50.240 --> 01:09:55.240]  We can't find it anymore
[01:09:55.240 --> 01:09:59.240]  Anymore
[01:09:59.240 --> 01:10:03.240] That is an interesting statement concerning the public records
[01:10:03.240 --> 01:10:07.240] Yeah, and you know, I mean sometimes
[01:10:07.240 --> 01:10:11.240] Wait, hold on, let's not get away from this
[01:10:11.240 --> 01:10:15.240] Were you able to find it at one time?
[01:10:15.240 --> 01:10:19.240]  Yes
[01:10:19.240 --> 01:10:22.240]  And you can't find it now?
[01:10:22.240 --> 01:10:23.240]  Right
[01:10:23.240 --> 01:10:31.240] Have you went to the county registrar and asked the county registrar to search the record?
[01:10:31.240 --> 01:10:35.240] Do they have all your records in electronic format now?
[01:10:35.240 --> 01:10:36.240]  Yes
[01:10:36.240 --> 01:10:45.240] Did you ask the registrar to search the record for any documents filed against your property
[01:10:45.240 --> 01:10:48.240] since the time you received a warrant to do it?
[01:10:48.240 --> 01:10:51.240]  No
[01:10:51.240 --> 01:10:54.240] How did you search for it?
[01:10:54.240 --> 01:10:59.240] We tried to do it on the internet and one time we did it and found the documents
[01:10:59.240 --> 01:11:02.240] and the second time we could not find any documents
[01:11:02.240 --> 01:11:06.240] Okay, the document that you found
[01:11:06.240 --> 01:11:08.240] Lenny and I said we need to go
[01:11:08.240 --> 01:11:10.240]  Go ahead, I'm sorry
[01:11:10.240 --> 01:11:16.240] The document that you found, what did it state?
[01:11:16.240 --> 01:11:29.240] It was a loan to Lori for the amount she wanted to borrow to finish the home
[01:11:29.240 --> 01:11:32.240]  and that was the
[01:11:32.240 --> 01:11:34.240]  Construction loan?
[01:11:34.240 --> 01:11:35.240]  Construction loan
[01:11:35.240 --> 01:11:41.240]  It was actually, you know, it's been a while and I didn't memorize it
[01:11:41.240 --> 01:11:47.240] but I think it was an equity loan because the home, the property was completely paid for
[01:11:47.240 --> 01:11:52.240] the home and property completely paid for by me, you know, my money order
[01:11:52.240 --> 01:11:57.240] although her name was on the paperwork so that she could get a loan
[01:11:57.240 --> 01:12:04.240] Okay, the property was paid for so you can get a
[01:12:04.240 --> 01:12:07.240]  there probably was a HELOC loan
[01:12:07.240 --> 01:12:13.240]  You didn't go to a standard closing, I take it
[01:12:13.240 --> 01:12:18.240]  like before a trustee, a title company?
[01:12:18.240 --> 01:12:25.240] Yes, we did and at that signing she signed as the borrower
[01:12:25.240 --> 01:12:31.240] and I took out a lien on the property to protect myself
[01:12:31.240 --> 01:12:38.240] So your lien stands before her lien, before the lien on the loan?
[01:12:38.240 --> 01:12:42.240] There was a little fast and loose on that
[01:12:42.240 --> 01:12:47.240] We discovered at the hearing that Fannie Mae summoned me to
[01:12:47.240 --> 01:12:50.240] or that the court summoned me to with Fannie Mae as the plaintiff
[01:12:50.240 --> 01:12:58.240] and that was what we discovered was, you know, I at that time and this was in 2008
[01:12:58.240 --> 01:13:01.240] I never thought to file my own document
[01:13:01.240 --> 01:13:08.240] the people who did the loan and the lien took the documents and filed them
[01:13:08.240 --> 01:13:17.240] It turns out they held my lien for 10 days or so before they filed it after they had filed their position
[01:13:17.240 --> 01:13:22.240] Okay, did you sue the title company?
[01:13:22.240 --> 01:13:24.240]  No, I did not
[01:13:24.240 --> 01:13:27.240] That's probably where your suit will come
[01:13:27.240 --> 01:13:37.240] So they filed the loan against the property, that would have been a deed of trust
[01:13:37.240 --> 01:13:38.240]  Right
[01:13:38.240 --> 01:13:44.240] They filed it first and then they filed your lien against the property
[01:13:44.240 --> 01:13:46.240]  Right
[01:13:46.240 --> 01:13:49.240] To sue the title company
[01:13:49.240 --> 01:13:51.240]  Yeah, that's okay
[01:13:51.240 --> 01:13:52.240]  Yes, it's
[01:13:52.240 --> 01:13:54.240] That would be Wells Fargo
[01:13:54.240 --> 01:14:04.240] No, Wells Fargo wasn't the title company, it should have been a title company involved
[01:14:04.240 --> 01:14:12.240] The name on the document is Magnus
[01:14:12.240 --> 01:14:19.240] Wait, did you go to Wells Fargo to sign these documents or did you go to a title company?
[01:14:19.240 --> 01:14:24.240] You know, I think it was Wells Fargo
[01:14:24.240 --> 01:14:29.240]  I was much more naive back then in 2008
[01:14:29.240 --> 01:14:33.240]  Okay
[01:14:33.240 --> 01:14:39.240] I'm trying to get back to why I had you come so you could start filing criminal charges
[01:14:39.240 --> 01:14:42.240]  Okay, so this was a
[01:14:42.240 --> 01:14:44.240]  I have questions
[01:14:44.240 --> 01:15:00.240] You said because we've been dismissed, I appealed it because the original judge said he knew enough to file in favor of Fannie Mae when he had not read my documents
[01:15:00.240 --> 01:15:12.240] And then the appeals court remanded it back to the judge telling him to deal with the issues that I had filed in court regarding my case
[01:15:12.240 --> 01:15:15.240] And he still never dealt with any of that
[01:15:15.240 --> 01:15:17.240]  So finally
[01:15:17.240 --> 01:15:23.240] So okay, that should get criminal charges against the judge for denying you due process
[01:15:23.240 --> 01:15:36.240] Right, and when we went to the appeals court and filed against the judge, it was Jan against the judge
[01:15:36.240 --> 01:15:48.240] We mentioned three violations, one was secreting documents and we cited the case or the case law about secreting documents
[01:15:48.240 --> 01:15:56.240] And denial of due process and issuing orders after a challenge of jurisdiction had been made
[01:15:56.240 --> 01:16:09.240] And the appeals court within a day after I filed that special action against the judge said at our discretion, we will not accept jurisdiction in this case
[01:16:09.240 --> 01:16:13.240] So now I'm trying to decide what to do next
[01:16:13.240 --> 01:16:23.240] And I'm thinking, you know, possibly go to the Supreme Court, which is in the same building on the fourth floor
[01:16:23.240 --> 01:16:34.240] Or I don't know, you know, a federal court or an appeals court that's above the state appeals court
[01:16:34.240 --> 01:16:38.240] I'm not sure what to do next
[01:16:38.240 --> 01:16:48.240] And I understand your, I think I understand your chain of, you know, starting with the criminal complaint against the judge to the sheriff
[01:16:48.240 --> 01:16:50.240] And then going on to the attorney
[01:16:50.240 --> 01:16:52.240] Hang on, hang on, we're about to go to break

[01:19:27.240 --> 01:19:30.240] We're in Kelton Rule of Law Radio
[01:19:30.240 --> 01:19:38.240] There is a question that I have that we probably can't get answered at this point
[01:19:38.240 --> 01:19:47.240] I don't think that Wells Fargo would be allowed to create a claim against property
[01:19:47.240 --> 01:19:50.240]  A loan against property
[01:19:50.240 --> 01:19:56.240] Without including all necessary parties
[01:19:56.240 --> 01:19:59.240] I'd have to look at the banking regulations
[01:19:59.240 --> 01:20:05.240] But I don't believe they could issue this type of a loan
[01:20:05.240 --> 01:20:08.240] Even if you agreed to it
[01:20:08.240 --> 01:20:13.240] But with that said, back to the judge
[01:20:13.240 --> 01:20:17.240] The judge sounds like he had something else going on
[01:20:17.240 --> 01:20:22.240] Or we're not getting all the facts
[01:20:22.240 --> 01:20:24.240] And sometimes facts are important
[01:20:24.240 --> 01:20:33.240] I would wonder why the judge said he had enough to rule
[01:20:33.240 --> 01:20:35.240] Oh, are you? Hold on, hold on, hold on
[01:20:35.240 --> 01:20:37.240]  I'm sorry, I don't have you
[01:20:37.240 --> 01:20:40.240]  Unmuted, okay
[01:20:40.240 --> 01:20:42.240] Okay, you can hear me now?
[01:20:42.240 --> 01:20:44.240]  Now I can hear you
[01:20:44.240 --> 01:20:46.240]  Okay
[01:20:46.240 --> 01:20:54.240] Why did the judge think that he had enough information to rule?
[01:20:54.240 --> 01:21:04.240] I don't know because I had filed a week prior a counterclaim with eight exhibits in it
[01:21:04.240 --> 01:21:12.240] And he admitted in the hearing on transcript that he did not have the file
[01:21:12.240 --> 01:21:16.240] The clerk said she did not have the file
[01:21:16.240 --> 01:21:21.240] And when I handed him a copy of my file, a copy of what I had filed
[01:21:21.240 --> 01:21:24.240] He said, well, I'm not going to look at that now
[01:21:24.240 --> 01:21:28.240] I know enough to rule in favor of Fannie Mae
[01:21:28.240 --> 01:21:31.240]  And I said, I will be appealing that
[01:21:31.240 --> 01:21:34.240] And he said, that is your right
[01:21:34.240 --> 01:21:38.240] And he ran from the courtroom pretty much
[01:21:38.240 --> 01:21:43.240] That should get criminal charges against him
[01:21:43.240 --> 01:21:47.240] They made it so that you can't sue judges
[01:21:47.240 --> 01:21:50.240] But you can certainly prosecute judges
[01:21:50.240 --> 01:21:57.240] And if a judge denies you in due process
[01:21:57.240 --> 01:22:00.240] Or let me back up
[01:22:00.240 --> 01:22:04.240] If a judge exerts or purports to exert an authority he doesn't have
[01:22:04.240 --> 01:22:11.240] Or if he fails to perform a duty he's required to perform
[01:22:11.240 --> 01:22:14.240]  That's misfeasance in office
[01:22:14.240 --> 01:22:22.240] And here he had a duty to grant you opportunity to pursue your claim
[01:22:22.240 --> 01:22:25.240] And he denied you that opportunity
[01:22:25.240 --> 01:22:27.240]  Yes, he did
[01:22:27.240 --> 01:22:34.240]  So let's talk about the politics
[01:22:34.240 --> 01:22:38.240]  It's all about politics
[01:22:38.240 --> 01:22:41.240]  This is a what level judge
[01:22:41.240 --> 01:22:44.240]  I take it this is a district judge
[01:22:44.240 --> 01:22:49.240] He's the highest judge in the county or the district
[01:22:49.240 --> 01:22:52.240] And the reason I say it that way in Texas
[01:22:52.240 --> 01:22:57.240] Is we have a county judge and we have a district judge
[01:22:57.240 --> 01:22:59.240] Which a district is sometimes one county
[01:22:59.240 --> 01:23:01.240] But sometimes it can take up to a three
[01:23:01.240 --> 01:23:05.240] Like I'm in a district where there's three counties in the district
[01:23:05.240 --> 01:23:08.240]  But he's the highest judge
[01:23:08.240 --> 01:23:12.240]  So it's just a case in Arizona
[01:23:12.240 --> 01:23:14.240]  Say that again
[01:23:14.240 --> 01:23:19.240] He is considered a superior court judge
[01:23:19.240 --> 01:23:22.240]  Civil
[01:23:22.240 --> 01:23:27.240] So an appeal from his court goes straight to the court of appeals
[01:23:27.240 --> 01:23:29.240]  Yes
[01:23:29.240 --> 01:23:33.240] He's the highest judge in the district, good
[01:23:33.240 --> 01:23:36.240] So we want to create a little politics
[01:23:36.240 --> 01:23:44.240] All of these judges for the most part aspire to the court of appeals
[01:23:44.240 --> 01:23:47.240]  Because that's the next step up
[01:23:47.240 --> 01:23:51.240] And the first thing, have you filed a judicial conduct complaint again?
[01:23:51.240 --> 01:23:53.240]  Yes, I have
[01:23:53.240 --> 01:23:56.240]  Oh wonderful, that's the first step
[01:23:56.240 --> 01:24:00.240] Now we start with the criminal
[01:24:00.240 --> 01:24:07.240] Okay, so you would say the first important thing was to file the judicial conduct complaint
[01:24:07.240 --> 01:24:09.240]  Yeah, that stings him
[01:24:09.240 --> 01:24:10.240]  It's important to do
[01:24:10.240 --> 01:24:15.240] It goes on his record and stays there forever
[01:24:15.240 --> 01:24:21.240] Even if you filed a judicial conduct complaint that was totally invalid
[01:24:21.240 --> 01:24:25.240] It goes on his record and stays there forever
[01:24:25.240 --> 01:24:33.240] And I used a prior conduct complaint against him and plagiarized it in order to file mine
[01:24:33.240 --> 01:24:36.240]  Oh, perfect
[01:24:36.240 --> 01:24:39.240]  A woman after my own heart
[01:24:39.240 --> 01:24:45.240] My primary skill is I am an accomplished plagiarist
[01:24:45.240 --> 01:24:49.240] I heard that when you were talking with Andrew
[01:24:49.240 --> 01:24:56.240]  Okay, now when I walk into a courthouse, a court building
[01:24:56.240 --> 01:25:01.240] I am the baddest motor scooter in the building
[01:25:01.240 --> 01:25:06.240] And there's only one reason I'm the baddest motor scooter in the building
[01:25:06.240 --> 01:25:09.240]  It's because I'm nobody
[01:25:09.240 --> 01:25:14.240]  I'm not a prosecutor, I'm not a judge, I'm not a bailiff, a court clerk
[01:25:14.240 --> 01:25:18.240]  I am not a public servant
[01:25:18.240 --> 01:25:21.240]  I am the master
[01:25:21.240 --> 01:25:26.240] When you walk in the courtroom, courthouse, you are the master
[01:25:26.240 --> 01:25:30.240] And they should never ever forget that
[01:25:30.240 --> 01:25:38.240] You're the one that can take them all to task and we're going to talk about just how to go about doing that
[01:25:38.240 --> 01:25:44.240]  I suggest you make up a verified criminal affidavit
[01:25:44.240 --> 01:25:57.240] And the reason I say it that way is I'm making a clear distinction between a criminal complaint and complaining
[01:25:57.240 --> 01:26:03.240] If you go to the police, they will give you this document that is a voluntary statement
[01:26:03.240 --> 01:26:10.240] And if you fill out that voluntary statement, you are complaining
[01:26:10.240 --> 01:26:18.240] But if you fill out a verified criminal affidavit, you fill out the affidavit as a statement of facts
[01:26:18.240 --> 01:26:26.240] And in that fact, you claim that you have reason to believe and do believe that this person committed this criminal act
[01:26:26.240 --> 01:26:35.240] And you take that to a notary and have a notary verify your signature and give that to the police, the sheriff
[01:26:35.240 --> 01:26:40.240] That invokes a duty that a voluntary statement does not
[01:26:40.240 --> 01:26:46.240] Now if you go to them with a criminal complaint, they will refuse to accept it
[01:26:46.240 --> 01:26:54.240]  So what I do is a dirty, rotten, low-down trick
[01:26:54.240 --> 01:27:00.240]  Is I get a voluntary statement
[01:27:00.240 --> 01:27:08.240] And when I give the voluntary statement back to them, it has the criminal complaint stuck on the bottom
[01:27:08.240 --> 01:27:17.240] Oh, if the looks I've got on police officers' face when they turn that page over and there's a verified criminal affidavit
[01:27:17.240 --> 01:27:20.240] They always say, what the heck is this?
[01:27:20.240 --> 01:27:24.240]  I say, that's a verified criminal affidavit. I'm not going to take it
[01:27:24.240 --> 01:27:26.240] You already got it, Bubba
[01:27:26.240 --> 01:27:28.240]  They're stuck with it
[01:27:28.240 --> 01:27:32.240] Well, one of them said, we're all throwing the trash and I don't care what you do with it
[01:27:32.240 --> 01:27:38.240] You got it, I invoked your duty, you can do it or not, it's your call
[01:27:38.240 --> 01:27:44.240] And that's because you never ask a public official to do anything you actually want them to do
[01:27:44.240 --> 01:27:51.240] When you go to the sheriff's department, you want him not to do what he's supposed to do
[01:27:51.240 --> 01:27:56.240] If he does what he's supposed to do and he's smart
[01:27:56.240 --> 01:28:04.240] I just had one in a small town take my criminal complaints against their local judge and he took them
[01:28:04.240 --> 01:28:10.240] And no doubt he took them, threw them in the trash, but he took them
[01:28:10.240 --> 01:28:15.240] So now I got to figure out what he did with them and I got a way to handle that
[01:28:15.240 --> 01:28:19.240] But smart enough to take them
[01:28:19.240 --> 01:28:23.240] The vast majority of the police are not that smart
[01:28:23.240 --> 01:28:25.240]  They're way too arrogant
[01:28:25.240 --> 01:28:32.240] So you want him to refuse to take them so that you can prepare criminal charges against him
[01:28:32.240 --> 01:28:37.240] For not taking the criminal charges against this district judge
[01:28:37.240 --> 01:28:46.240] And then you take the criminal charges against him to some local magistrate
[01:28:46.240 --> 01:28:50.240] The mayors of every city are magistrates
[01:28:50.240 --> 01:28:56.240] All of your municipal court judges are magistrates and justices of the peace are magistrates
[01:28:56.240 --> 01:29:03.240] I prefer justices of the peace because the mayor doesn't always understand
[01:29:03.240 --> 01:29:11.240] And since your issue is not a municipal court, it's kind of dirty pool to suck the mayor into it
[01:29:11.240 --> 01:29:15.240]  But JP's are elected officials
[01:29:15.240 --> 01:29:22.240] Here in this area is that the justice of the peace is like your traffic court
[01:29:22.240 --> 01:29:23.240]  It is here too
[01:29:23.240 --> 01:29:24.240]  Low level
[01:29:24.240 --> 01:29:28.240]  It is, it's low level, but he's elected
[01:29:28.240 --> 01:29:29.240]  Yes
[01:29:29.240 --> 01:29:34.240]  That's a whole different animal and because he's elected, he's vulnerable
[01:29:34.240 --> 01:29:40.240] So you take it just to the peace and get him to refuse to take it
[01:29:40.240 --> 01:29:46.240] You take a complaint against the sheriff for not taking the complaint against this high level judge
[01:29:46.240 --> 01:29:50.240] Well, JP's not going to want to take it
[01:29:50.240 --> 01:29:52.240] And I'll explain why when we get back on the other side
[01:29:52.240 --> 01:29:56.240] Randy Kelton, Wheelbarrow Radio, we'll be right back
[01:29:56.240 --> 01:29:59.240]  Thank you
[01:29:59.240 --> 01:30:05.240]  I'm not a mind reader, but there's a good chance I can guess your password
[01:30:05.240 --> 01:30:10.240] Most people choose passwords from a limited repertoire, so hacking in is a piece of cake
[01:30:10.240 --> 01:30:14.240] I'm Dr. Catherine Albrecht and I'll be right back with the solution
[01:30:14.240 --> 01:30:16.240]  Privacy is under attack
[01:30:16.240 --> 01:30:20.240] When you give up data about yourself, you'll never get it back again
[01:30:20.240 --> 01:30:24.240] And once your privacy is gone, you'll find your freedoms will start to vanish too
[01:30:24.240 --> 01:30:30.240] So protect your rights, say no to surveillance, and keep your information to yourself
[01:30:30.240 --> 01:30:32.240]  Privacy, it's worth hanging on to
[01:30:32.240 --> 01:30:36.240] This public service announcement is brought to you by Startpage.com
[01:30:36.240 --> 01:30:40.240] The private search engine alternative to Google, Yahoo, and Bing
[01:30:40.240 --> 01:30:43.240]  Start over with Startpage
[01:30:43.240 --> 01:30:48.240] It's hard to remember a complicated password, but that's no excuse for a pathetic one
[01:30:48.240 --> 01:30:53.240] Recent security breaches have exposed millions of passwords, so we know what people are choosing
[01:30:53.240 --> 01:30:59.240]  The most common password is 123456, followed by 12345
[01:30:59.240 --> 01:31:01.240]  I love you is also in the top 10
[01:31:01.240 --> 01:31:04.240] If your password is too easy, beef it up
[01:31:04.240 --> 01:31:08.240] It takes just a few seconds to guess a password with seven lowercase letters
[01:31:08.240 --> 01:31:11.240] But add capital letters and numbers and things get much harder
[01:31:11.240 --> 01:31:16.240] Add some other character like a dollar sign and increase the length to 10 characters
[01:31:16.240 --> 01:31:21.240] And suddenly cracking your password is virtually impossible, and that's good security
[01:31:21.240 --> 01:31:27.240] I'm Dr. Catherine Albrecht, more news and information at CatherineAlbrecht.com
[01:31:30.240 --> 01:31:36.240] This is Building 7, a 47-story skyscraper that fell on the afternoon of September 11
[01:31:36.240 --> 01:31:38.240] The government says that fire brought it down
[01:31:38.240 --> 01:31:43.240] However, 1,500 architects and engineers concluded it was a controlled demolition
[01:31:43.240 --> 01:31:46.240] Over 6,000 of my fellow service members have given their lives
[01:31:46.240 --> 01:31:49.240] And thousands of my fellow first responders are dying
[01:31:49.240 --> 01:31:51.240]  I'm not a conspiracy theorist
[01:31:51.240 --> 01:31:52.240]  I'm a structural engineer
[01:31:52.240 --> 01:31:53.240]  I'm a New York City correction officer
[01:31:53.240 --> 01:31:54.240]  I'm an Air Force pilot
[01:31:54.240 --> 01:31:55.240] I'm the father who lost his son
[01:31:55.240 --> 01:31:58.240] We're Americans, and we deserve the truth
[01:31:58.240 --> 01:32:01.240]  Go to RememberBuilding7.org today

[01:32:11.240 --> 01:32:14.240] Okay, I might be kidding about the chemtrails, but I'm serious about your roof

[01:32:58.240 --> 01:33:01.240] May not actually be kidding about chemtrails

[01:33:05.240 --> 01:33:15.240]  Logosradionetwork.com
[01:33:36.240 --> 01:33:42.240] The wicked come with temptations
[01:33:42.240 --> 01:33:47.240] They're trying to buy the hope of the weak
[01:33:47.240 --> 01:33:51.240] They wanna ruin the nation
[01:33:51.240 --> 01:33:55.240] Sorry about that cough, I forgot to mute my mic
[01:33:55.240 --> 01:34:00.240] Randy Rudelbal, Radio 2, and we're talking to Jan in Arizona
[01:34:00.240 --> 01:34:04.240] And the justice of the peace is an inferior court
[01:34:04.240 --> 01:34:07.240] That doesn't necessarily mean the justice is inferior
[01:34:07.240 --> 01:34:18.240] It just refers to a court that is not necessarily manned by a lawyer, a learned counsel
[01:34:18.240 --> 01:34:21.240] The layperson can be a justice of the peace
[01:34:21.240 --> 01:34:27.240] And it is the consideration of justices of the peace in municipal court
[01:34:27.240 --> 01:34:37.240] That the state commissions on judicial conduct never discipline higher-level elected judges
[01:34:37.240 --> 01:34:41.240] But in order to make it look like they're actually doing something
[01:34:41.240 --> 01:34:46.240] They tend to crucify inferior court judges
[01:34:46.240 --> 01:34:49.240]  And they're right, that's exactly what they do
[01:34:49.240 --> 01:34:54.240] So when you go to the justice of the peace
[01:34:54.240 --> 01:34:57.240] With a criminal complaint against the sheriff
[01:34:57.240 --> 01:35:02.240] For not taking a criminal complaint against the highest judge district
[01:35:02.240 --> 01:35:06.240] He is not gonna be a happy camper
[01:35:06.240 --> 01:35:10.240] And he is not gonna want to do his job
[01:35:10.240 --> 01:35:16.240] And this is something that our public officials, it's a fallacy that they've developed
[01:35:16.240 --> 01:35:20.240] They've got the idea that they can do what they want to
[01:35:20.240 --> 01:35:25.240] And it's our job to demonstrate to them that that is fallacious
[01:35:25.240 --> 01:35:28.240] That is not the case
[01:35:28.240 --> 01:35:32.240] Well, you can do what you want to
[01:35:32.240 --> 01:35:35.240] But I can kick your behind for it
[01:35:35.240 --> 01:35:38.240] So you can be relatively certain that the justice of the peace
[01:35:38.240 --> 01:35:43.240] Will not act on a complaint against a district judge
[01:35:43.240 --> 01:35:46.240]  He's gonna be terrified of it
[01:35:46.240 --> 01:35:51.240]  Right. Perfect. Say okay, that'll work
[01:35:51.240 --> 01:35:54.240]  And from the JP
[01:35:54.240 --> 01:35:57.240] Since you can't, do you have an intermediate judge
[01:35:57.240 --> 01:36:01.240] Like in Texas we have a county judge
[01:36:01.240 --> 01:36:07.240] That's between the JP and the superior court judge
[01:36:07.240 --> 01:36:09.240]  No, we do not
[01:36:09.240 --> 01:36:11.240]  Okay, good, good
[01:36:11.240 --> 01:36:14.240] Now once you get past the JP
[01:36:14.240 --> 01:36:20.240] Then take a complaint against the justice of the peace to your state attorney general
[01:36:20.240 --> 01:36:27.240] Does the attorney general in Arizona have prosecutorial powers?
[01:36:27.240 --> 01:36:30.240]  I believe so
[01:36:30.240 --> 01:36:34.240]  I think so, most of them do, Texas doesn't
[01:36:34.240 --> 01:36:40.240] In Texas the prosecutors are the prosecutors of original jurisdiction
[01:36:40.240 --> 01:36:48.240] There is only one time in Texas law that the attorney general has original prosecuting powers
[01:36:48.240 --> 01:36:50.240] Or there was only one time
[01:36:50.240 --> 01:36:53.240]  Now there's two
[01:36:53.240 --> 01:36:57.240] Just the last legislature they passed new law
[01:36:57.240 --> 01:36:58.240]  And I'll get to that in a second
[01:36:58.240 --> 01:37:05.240] Used to be the only time that the attorney general was the prosecutor of original jurisdiction
[01:37:05.240 --> 01:37:12.240] Was in a complaint against a prosecuting attorney for violating the open records act
[01:37:12.240 --> 01:37:14.240]  And that was it
[01:37:14.240 --> 01:37:18.240] Well last year they put in a clause that
[01:37:18.240 --> 01:37:21.240]  In a complaint against a public official
[01:37:21.240 --> 01:37:27.240] The attorney general can exercise original jurisdiction
[01:37:27.240 --> 01:37:33.240] But in most states the attorney general is a prosecutor
[01:37:33.240 --> 01:37:43.240] So if he is in Arizona then you take the complaint against the JP to the attorney general
[01:37:43.240 --> 01:37:47.240]  Here's the problem
[01:37:47.240 --> 01:37:51.240] In the way that the complaints are structured
[01:37:51.240 --> 01:37:55.240]  They give fair warning
[01:37:55.240 --> 01:38:00.240] These guys can't claim they didn't understand what was coming at them
[01:38:00.240 --> 01:38:03.240]  It's real clear in the documentation
[01:38:03.240 --> 01:38:06.240] They're still not going to want to do it
[01:38:06.240 --> 01:38:12.240] And then when the attorney general refuses to act on the complaint
[01:38:12.240 --> 01:38:19.240] Then I would go to the chief justice of the state supreme court
[01:38:19.240 --> 01:38:22.240]  And file with him
[01:38:22.240 --> 01:38:27.240]  All judges are magistrates
[01:38:27.240 --> 01:38:30.240]  I once bushwhacked Bob Perkins
[01:38:30.240 --> 01:38:33.240] He was a head criminal district judge for Travis County
[01:38:33.240 --> 01:38:36.240]  I bushwhacked him in his courtroom
[01:38:36.240 --> 01:38:39.240] By going into the courtroom while he's having motion hearings
[01:38:39.240 --> 01:38:41.240] Because in motion hearings there's lots of breaks
[01:38:41.240 --> 01:38:44.240]  And you don't have a jury to attend with
[01:38:44.240 --> 01:38:47.240] And you generally don't have any people in the gallery either
[01:38:47.240 --> 01:38:51.240] So I walk up to the bar and I point at the bait of you
[01:38:51.240 --> 01:38:52.240]  Come here
[01:38:52.240 --> 01:38:54.240]  They hate that
[01:38:54.240 --> 01:39:00.240] Lawyers when they go into the courtroom are generally timid little mouses
[01:39:00.240 --> 01:39:02.240]  Because they're terrified of the judge
[01:39:02.240 --> 01:39:05.240]  So I'm not a timid little mout
[01:39:05.240 --> 01:39:08.240]  And I'm in a nice suit so he doesn't know who I am
[01:39:08.240 --> 01:39:12.240] And I order him over like an errand stepchild
[01:39:12.240 --> 01:39:14.240]  So he's annoyed
[01:39:14.240 --> 01:39:16.240] You call the Supreme Court judge?
[01:39:16.240 --> 01:39:18.240]  I call the bailiff
[01:39:18.240 --> 01:39:20.240]  Who are you calling?
[01:39:20.240 --> 01:39:22.240] Would you say that again?
[01:39:22.240 --> 01:39:24.240]  I'm saying
[01:39:24.240 --> 01:39:28.240] You're saying you went in there and called the Supreme Court judge over to you?
[01:39:28.240 --> 01:39:29.240]  No, no, no
[01:39:29.240 --> 01:39:33.240] This was a district, a head criminal district judge for Travis County
[01:39:33.240 --> 01:39:34.240]  Okay
[01:39:34.240 --> 01:39:35.240]  No, I didn't call the judge
[01:39:35.240 --> 01:39:37.240]  I called the bailiff
[01:39:37.240 --> 01:39:38.240]  Okay, all right
[01:39:38.240 --> 01:39:41.240] The bailiff was sitting across the room and I pointed at him
[01:39:41.240 --> 01:39:43.240]  You, come here
[01:39:43.240 --> 01:39:45.240]  He didn't like being summoned
[01:39:45.240 --> 01:39:47.240]  He's not used to it
[01:39:47.240 --> 01:39:48.240]  He said, can I help you?
[01:39:48.240 --> 01:39:50.240]  Yes, my name's Randall Kelton
[01:39:50.240 --> 01:39:52.240] I instruct the judge that I have business with the court
[01:39:52.240 --> 01:39:56.240] The bailiff said, may I tell the judge the nature of the business?
[01:39:56.240 --> 01:39:58.240]  No, you may not
[01:39:58.240 --> 01:40:00.240] I have business with the court and it's none of yours
[01:40:00.240 --> 01:40:01.240]  You're just
[01:40:01.240 --> 01:40:03.240] I kind of flick my hands at him
[01:40:03.240 --> 01:40:05.240]  I go sit down
[01:40:05.240 --> 01:40:10.240] So he's wondering, who is this jerk?
[01:40:10.240 --> 01:40:13.240] And he goes up to the judge and whisper, whisper, whisper
[01:40:13.240 --> 01:40:15.240] And the judge whispers back
[01:40:15.240 --> 01:40:17.240] And he looks at me sitting out there
[01:40:17.240 --> 01:40:19.240]  Nice suit and tie
[01:40:19.240 --> 01:40:23.240]  Holding this red folder
[01:40:23.240 --> 01:40:25.240]  Judge just can't help himself
[01:40:25.240 --> 01:40:28.240]  He's got to know what's in it
[01:40:28.240 --> 01:40:29.240]  Bad mistake
[01:40:29.240 --> 01:40:30.240]  Right
[01:40:30.240 --> 01:40:32.240]  He called me up
[01:40:32.240 --> 01:40:34.240]  He said, Mr. Kelton
[01:40:34.240 --> 01:40:36.240] And I understand you have business with the court
[01:40:36.240 --> 01:40:37.240]  Yes, Your Honor, I do
[01:40:37.240 --> 01:40:39.240] Well, first he asked me that
[01:40:39.240 --> 01:40:41.240] And I stood up and I held up the red folder
[01:40:41.240 --> 01:40:44.240]  And I said, may I approach?
[01:40:44.240 --> 01:40:48.240] And that really means, can I give you these documents?
[01:40:48.240 --> 01:40:49.240]  There's two options
[01:40:49.240 --> 01:40:52.240] He'll either send the bailiff over to collect the documents
[01:40:52.240 --> 01:40:53.240]  Or he'll call you up
[01:40:53.240 --> 01:40:56.240] And in this case, he called me up to his bench
[01:40:56.240 --> 01:40:58.240] I added in the documents, he opened them up
[01:40:58.240 --> 01:41:03.240] He's looking at criminal charges against the district attorney
[01:41:03.240 --> 01:41:08.240] Accusing the district attorney of shielding criminal complaints
[01:41:08.240 --> 01:41:12.240] Against all of the highest judges in Texas from the grand jury
[01:41:12.240 --> 01:41:16.240] All 15 judges of the Court of Criminal Appeals
[01:41:16.240 --> 01:41:18.240] We have two high courts in Texas
[01:41:18.240 --> 01:41:21.240] One for criminal, one for civil
[01:41:21.240 --> 01:41:24.240] He looked at those and you could see it in his eyes
[01:41:24.240 --> 01:41:29.240] He could see his career passing before him
[01:41:29.240 --> 01:41:32.240] So these are the things we can do to them
[01:41:32.240 --> 01:41:35.240] These finally got to the grand jury
[01:41:35.240 --> 01:41:39.240] And we almost got them indicted
[01:41:39.240 --> 01:41:44.240] And I thought it was because of all of my eloquent oratory
[01:41:44.240 --> 01:41:47.240] And all of the slick maneuvers I pulled on them
[01:41:47.240 --> 01:41:51.240] And the complaints and the pressure I put on them
[01:41:51.240 --> 01:41:53.240]  I was naive
[01:41:53.240 --> 01:41:56.240] It was none of that
[01:41:56.240 --> 01:42:00.240] The assistant district attorney, Claire Dawson Brown
[01:42:00.240 --> 01:42:05.240] I finally thought I talked her into giving them to the grand jury
[01:42:05.240 --> 01:42:08.240] So grand jury gets them on the first of April
[01:42:08.240 --> 01:42:10.240] The first day at office
[01:42:10.240 --> 01:42:13.240]  April Fool's Day was really appropriate
[01:42:13.240 --> 01:42:16.240] The jury served for three months
[01:42:16.240 --> 01:42:19.240] The jury takes them 20 minutes to do an indictment
[01:42:19.240 --> 01:42:23.240]  Well, a month and a half later I called Claire
[01:42:23.240 --> 01:42:26.240] What is the deal with the grand jury?
[01:42:26.240 --> 01:42:28.240] Why did they take so long?
[01:42:28.240 --> 01:42:31.240] And she said, Mr. Kelton
[01:42:31.240 --> 01:42:37.240] I made sure that every grand juror read her entire presentment
[01:42:37.240 --> 01:42:39.240]  Say what?
[01:42:39.240 --> 01:42:42.240]  That was a 111 page presentment
[01:42:42.240 --> 01:42:45.240] My habeas corpus is in there
[01:42:45.240 --> 01:42:49.240] So I'm thinking, what in the world is going on?
[01:42:49.240 --> 01:42:51.240]  I talked to Claire and I said, Claire
[01:42:51.240 --> 01:42:54.240] In Texas law when a complaint is made against a public official
[01:42:54.240 --> 01:42:57.240] Prosecuting attorney has no discretion
[01:42:57.240 --> 01:42:59.240] You have to give it to the grand jury
[01:42:59.240 --> 01:43:01.240] So since you have to
[01:43:01.240 --> 01:43:04.240] You don't have to agree with it
[01:43:04.240 --> 01:43:06.240]  Because I don't want them indicted
[01:43:06.240 --> 01:43:08.240]  I just want them presented
[01:43:08.240 --> 01:43:12.240] So if you present to the grand jury and then go in there
[01:43:12.240 --> 01:43:14.240]  And argue against indictment
[01:43:14.240 --> 01:43:17.240] You get to be the hero
[01:43:17.240 --> 01:43:19.240]  Everybody wins
[01:43:19.240 --> 01:43:21.240]  Yeah
[01:43:21.240 --> 01:43:25.240] Then she tells me she had them read the entire document
[01:43:25.240 --> 01:43:27.240]  What?
[01:43:27.240 --> 01:43:29.240]  Wait a minute
[01:43:29.240 --> 01:43:33.240] She's not trying to talk about indictment
[01:43:33.240 --> 01:43:36.240] And I'm thinking, what in the world is going on?
[01:43:36.240 --> 01:43:38.240] Ron Earl, that dirty scoundrel
[01:43:38.240 --> 01:43:40.240]  25 year prostitute
[01:43:40.240 --> 01:43:42.240]  Who's not running for office
[01:43:42.240 --> 01:43:44.240]  He's a democrat, they're all republicans
[01:43:44.240 --> 01:43:46.240] That snake in the grass is trying to take them all out with him
[01:43:46.240 --> 01:43:49.240] Using my documents to get it done with
[01:43:49.240 --> 01:43:51.240]  Hang on, we're ready to talk
[01:43:51.240 --> 01:43:53.240]  I'll call it number 5
[01:43:53.240 --> 01:43:55.240]  646-1984
[01:43:55.240 --> 01:43:57.240]  We'll be right back
[01:44:00.240 --> 01:44:02.240] You feel tired when talking about important topics
[01:44:02.240 --> 01:44:04.240]  Like money and politics?
[01:44:04.240 --> 01:44:07.240] Are you confused by words like the Constitution or the Federal Reserve?
[01:44:07.240 --> 01:44:08.240]  What?
[01:44:08.240 --> 01:44:11.240] If so, you may be diagnosed with the deadliest disease known today
[01:44:11.240 --> 01:44:12.240]  Stupidity
[01:44:12.240 --> 01:44:14.240] Hi, my name is Steve Holt
[01:44:14.240 --> 01:44:16.240] And like millions of other Americans
[01:44:16.240 --> 01:44:19.240] I was diagnosed with stupidity at an early age
[01:44:19.240 --> 01:44:24.240] I had no idea that the number one cause of the disease is found in almost every home in America
[01:44:24.240 --> 01:44:25.240]  The television
[01:44:25.240 --> 01:44:29.240] Unfortunately, that puts most Americans at risk of catching stupidity
[01:44:29.240 --> 01:44:30.240]  But there is hope
[01:44:30.240 --> 01:44:32.240] The staff at Brave New Books have helped me
[01:44:32.240 --> 01:44:36.240] And thousands of other Foxaholics suffering from sports zombieism recover
[01:44:36.240 --> 01:44:40.240] And because of Brave New Books, I now enjoy reading and watching educational documentaries

[01:44:43.240 --> 01:44:46.240] So if you or anybody you know suffers from stupidity
[01:44:46.240 --> 01:44:50.240]  Then you need to call 512-480-2503

[01:46:26.240 --> 01:46:42.240] Okay, we are back, Randy Kelton, rule of law radio
[01:46:42.240 --> 01:46:48.240] And there was a very important point to all of that, Chad
[01:46:48.240 --> 01:46:50.240]  Yes
[01:46:50.240 --> 01:46:57.240] I almost got all the highest judges in Texas removed from office
[01:46:57.240 --> 01:47:01.240]  Well, actually I didn't do it
[01:47:01.240 --> 01:47:10.240] What I did was provide one of their political adversaries with cannon fodder
[01:47:10.240 --> 01:47:15.240] And this is what scares them more than anything
[01:47:15.240 --> 01:47:18.240] They're not going to be afraid of you
[01:47:18.240 --> 01:47:24.240] What they're going to be afraid of is somebody that's trying to get their position
[01:47:24.240 --> 01:47:29.240] Gets a hold of what you're doing and uses what you're doing
[01:47:29.240 --> 01:47:33.240] To get rid of one of their political enemies
[01:47:33.240 --> 01:47:36.240] This is exactly what Ron Earl tried to do
[01:47:36.240 --> 01:47:39.240] The grand jury did not indict
[01:47:39.240 --> 01:47:45.240] So for me it worked out perfect because the reason I filed the habeas
[01:47:45.240 --> 01:47:50.240] I mean the reason I filed a criminal complaint was they were asking
[01:47:50.240 --> 01:47:54.240] In order to file a habeas they wanted a motion for leave to file
[01:47:54.240 --> 01:48:00.240] And I told them you don't have any authority to grant or deny leave
[01:48:00.240 --> 01:48:01.240]  It's a writ of right
[01:48:01.240 --> 01:48:03.240] Well they wouldn't take it without it
[01:48:03.240 --> 01:48:06.240] I'm trying to get a kid out of jail so I filed a motion for leave
[01:48:06.240 --> 01:48:11.240] They denied me leave to file a writ of habeas corpus
[01:48:11.240 --> 01:48:13.240] What the heck is this crap?
[01:48:13.240 --> 01:48:15.240]  So that's what I filed about
[01:48:15.240 --> 01:48:18.240] Well the grand jury no build them
[01:48:18.240 --> 01:48:24.240] But if you file a habeas with the court of criminal appeals in the state of Texas
[01:48:24.240 --> 01:48:28.240] They're not going to ask you for motion for leave to file
[01:48:28.240 --> 01:48:30.240]  That garbage is gone
[01:48:30.240 --> 01:48:33.240] And that was the purpose
[01:48:33.240 --> 01:48:39.240] So in doing what you're doing don't expect anybody to get prosecuted
[01:48:39.240 --> 01:48:45.240] Expect everybody to protect the person below them
[01:48:45.240 --> 01:48:53.240] What you want to do is get to the highest person you can and then reign all over him
[01:48:53.240 --> 01:49:01.240] Because the higher you are up the food chain
[01:49:01.240 --> 01:49:05.240] The more people you got gunning for your position
[01:49:05.240 --> 01:49:09.240] So the sensitive you are to the politics
[01:49:09.240 --> 01:49:12.240] The JP on the bottom is not terribly sensitive
[01:49:12.240 --> 01:49:14.240] The police officer definitely not
[01:49:14.240 --> 01:49:17.240] He has no concept of politics
[01:49:17.240 --> 01:49:19.240]  Now a sergeant has a little
[01:49:19.240 --> 01:49:21.240]  His lieutenant has more
[01:49:21.240 --> 01:49:27.240] The sheriff has a lot of consciousness about politics
[01:49:27.240 --> 01:49:31.240] The higher up you go the more sensitive they are
[01:49:31.240 --> 01:49:40.240] So you want to get up there and do a little song and dance on the chief justice of your supreme court
[01:49:40.240 --> 01:49:43.240] And reign on his parade
[01:49:43.240 --> 01:49:48.240] Create cannon fodder for anybody who's taking a shot at it
[01:49:48.240 --> 01:49:56.240] And what do you think he's going to say about the ones who started all this?
[01:49:56.240 --> 01:50:04.240] If his parade gets rained on the guys below him get a thunderstorm
[01:50:04.240 --> 01:50:08.240] And the further down it goes the worse it's going to get
[01:50:08.240 --> 01:50:10.240] This is how we make this work
[01:50:10.240 --> 01:50:14.240]  I have a question in regard to everything you're saying
[01:50:14.240 --> 01:50:18.240] And that is Lenny and I, Leonard and I had a feeling
[01:50:18.240 --> 01:50:22.240] It would kind of go this way because he's been listening to you for a while
[01:50:22.240 --> 01:50:30.240] And we've tried to get the information about when the grand jury will be in our area
[01:50:30.240 --> 01:50:33.240] And the court clerks have no idea
[01:50:33.240 --> 01:50:35.240] They sent Lenny up to the fourth floor
[01:50:35.240 --> 01:50:37.240]  Those people up there said I don't know what
[01:50:37.240 --> 01:50:40.240] Maybe go downstairs to the second floor
[01:50:40.240 --> 01:50:43.240]  And nobody likes a grand jury
[01:50:43.240 --> 01:50:47.240] Oh I just love it when they give me a run around
[01:50:47.240 --> 01:50:51.240] Have you ever called 911 on them?
[01:50:51.240 --> 01:50:53.240]  No
[01:50:53.240 --> 01:50:55.240] Oh that is so much fun
[01:50:55.240 --> 01:50:59.240]  Should I call 911 if you're not in real danger?
[01:50:59.240 --> 01:51:04.240] No, you don't have to be in real danger
[01:51:04.240 --> 01:51:09.240]  Actually you can call 911 for a crime
[01:51:09.240 --> 01:51:11.240]  Okay, for any crime
[01:51:11.240 --> 01:51:24.240] In Texas, the under duties of officers, 20.09 Texas Code of Criminal Procedure says
[01:51:24.240 --> 01:51:32.240] It shall be the duty of the grand jury to investigate into all crimes subject to indictment
[01:51:32.240 --> 01:51:38.240] That come by way of the personal knowledge of any grand juror
[01:51:38.240 --> 01:51:43.240] By way of the prosecuting attorney or any credible person
[01:51:43.240 --> 01:51:46.240]  Well I'm that credible person
[01:51:46.240 --> 01:51:55.240] And the grand jury shall investigate any crime that comes to their knowledge by way of me
[01:51:55.240 --> 01:52:04.240] So when I try to give notice to the grand jury of crime and someone interferes with me
[01:52:04.240 --> 01:52:11.240] The way I read the penal code of the state of Texas, 3606 Texas Penal Code
[01:52:11.240 --> 01:52:16.240] Calls that obstruction of justice
[01:52:16.240 --> 01:52:18.240]  Obstruction of justice
[01:52:18.240 --> 01:52:22.240]  It's a felony in Texas
[01:52:22.240 --> 01:52:25.240] You need to check Arizona law
[01:52:25.240 --> 01:52:28.240]  Here's their problem
[01:52:28.240 --> 01:52:32.240] Whenever they try to do their little song and dance stuff
[01:52:32.240 --> 01:52:35.240]  They don't understand
[01:52:35.240 --> 01:52:38.240] Most of them never read the code
[01:52:38.240 --> 01:52:46.240] They don't understand how many laws we have in there to grant remedy
[01:52:46.240 --> 01:52:53.240] And it's my position that nobody passed any laws to help you and I
[01:52:53.240 --> 01:52:55.240]  They don't care about us
[01:52:55.240 --> 01:53:05.240] These lawyers and politicians and judges are all a bunch of crooks and shysters of lawyers
[01:53:05.240 --> 01:53:11.240] And they understand they're a shark in a pool full of sharks
[01:53:11.240 --> 01:53:20.240] So they need a way to protect themselves from other people just like themselves
[01:53:20.240 --> 01:53:23.240] So they put all these protections in place
[01:53:23.240 --> 01:53:29.240] Problem, we get to use them
[01:53:29.240 --> 01:53:40.240] If I get pulled over by a police officer and he fails to conduct himself in a polite respectful manner
[01:53:40.240 --> 01:53:43.240]  I call 911
[01:53:43.240 --> 01:53:50.240] I got this person here and he is prominently displaying a deadly weapon and he is agitated
[01:53:50.240 --> 01:53:57.240] I'm afraid he's going to shoot me, get someone out here to take my complaint against him for official oppression
[01:53:57.240 --> 01:54:02.240]  They get real excited
[01:54:02.240 --> 01:54:05.240] If you press them they send the policeman out
[01:54:05.240 --> 01:54:11.240] Now you got this policeman based on your 911 call which is recorded
[01:54:11.240 --> 01:54:15.240] That you ask him to arrest another policeman
[01:54:15.240 --> 01:54:22.240] But he won't do and you get to see what we call this little chicken dance
[01:54:22.240 --> 01:54:30.240] You ever notice how a chicken stand and shift from one foot to the other back and forth sideways
[01:54:30.240 --> 01:54:34.240] That's what they start doing, they start shifting from one foot to the other
[01:54:34.240 --> 01:54:39.240]  Well Mr. Kelton, I don't know if I can take a complaint
[01:54:39.240 --> 01:54:41.240] Of course you can take a complaint, it's really easy
[01:54:41.240 --> 01:54:46.240] Just take out your report and take a full report
[01:54:46.240 --> 01:54:50.240] You don't have to make up the criminal complaint, I'll do that myself
[01:54:50.240 --> 01:54:53.240]  I just need you to take a report
[01:54:53.240 --> 01:54:56.240] It goes a long way to adjust your attitude
[01:54:56.240 --> 01:55:03.240] If I'm in the Randall County courthouse in Amberville, Texas
[01:55:03.240 --> 01:55:08.240] Actually it's in Canyon City, it's the county seat of Randall County
[01:55:08.240 --> 01:55:13.240] And I asked to see some documents
[01:55:13.240 --> 01:55:16.240] Original documents because I'm afraid documents are missing
[01:55:16.240 --> 01:55:20.240] And I want to be able to verify that they're not in the physical file
[01:55:20.240 --> 01:55:25.240] While I don't have time for the personnel, you'll have to look at them on the computer
[01:55:25.240 --> 01:55:30.240]  I said, wait right there, don't go anywhere
[01:55:30.240 --> 01:55:33.240] Somebody's going to want to talk to you
[01:55:33.240 --> 01:55:36.240] I walked over, pushed the door and pointed at the beta view, come here
[01:55:36.240 --> 01:55:39.240] He comes over, I said, now watch this
[01:55:39.240 --> 01:55:42.240] I said, Ms. Clerk, I need to see those documents I requested
[01:55:42.240 --> 01:55:46.240] I told you I don't have the time in the personnel, you'll have to look at the computer
[01:55:46.240 --> 01:55:48.240] I turned to the bailiff, did you hear that?
[01:55:48.240 --> 01:55:49.240]  Yes I did
[01:55:49.240 --> 01:55:51.240]  Arrest that woman
[01:55:51.240 --> 01:55:53.240]  Why, I can't, where's the clerk?
[01:55:53.240 --> 01:55:57.240] I said, sure you can, just go in there and throw the cuffs on her and drag her off
[01:55:57.240 --> 01:56:02.240]  Heck, it's only a couple blocks away
[01:56:02.240 --> 01:56:08.240] They got a lieutenant and the lieutenant refused to take a complaint so I called 911
[01:56:08.240 --> 01:56:12.240] And I'm sitting waiting for the 911 officer to come
[01:56:12.240 --> 01:56:18.240] I'm filling out some criminal complaints and the clerk came out with this lieutenant
[01:56:18.240 --> 01:56:21.240]  He's got a handful of documents
[01:56:21.240 --> 01:56:25.240] And the lieutenant started to say something and I held up both hands, stop, stop, stop
[01:56:25.240 --> 01:56:27.240]  I can't be talking to you
[01:56:27.240 --> 01:56:31.240] I've called another officer who will come and give him a full report
[01:56:31.240 --> 01:56:34.240] But since I'll be making criminal accusations against the both of you
[01:56:34.240 --> 01:56:38.240] It would be inappropriate for us to have any further conversation
[01:56:38.240 --> 01:56:43.240] The sergeant said, she has the documents you asked for
[01:56:43.240 --> 01:56:48.240] Sorry, Bubba, that bell's already been rung
[01:56:48.240 --> 01:56:56.240] The look on the clerk's face was absolutely priceless
[01:56:56.240 --> 01:57:00.240]  They send a policeman, he's from Canyon City
[01:57:00.240 --> 01:57:02.240]  I said, what'd they send you for?
[01:57:02.240 --> 01:57:06.240] He said, you're a city policeman, this is a county courthouse, you don't have any jurisdiction in here
[01:57:06.240 --> 01:57:09.240] Well, they told me to come
[01:57:09.240 --> 01:57:11.240] You can't help me, you can just go
[01:57:11.240 --> 01:57:15.240] And I left it be, I didn't want to have that fight
[01:57:15.240 --> 01:57:18.240] But I assure you, you go to the...
[01:57:18.240 --> 01:57:20.240]  But you didn't get the file
[01:57:20.240 --> 01:57:23.240] You will get files, you won't get any crap
[01:57:23.240 --> 01:57:27.240] You are the baddest motor scooter in the building
[01:57:27.240 --> 01:57:32.240] So you can call 911 if a public official fails to perform a duty
[01:57:32.240 --> 01:57:42.240] If a clerk lies to you and tells you she doesn't know when the grand jury meets, call 911
[01:57:42.240 --> 01:57:49.240] Now, you don't really care about filing a complaint, you want to make the complaints
[01:57:49.240 --> 01:57:56.240] The clerk looks at this as though it's something that can get terribly out of hand
[01:57:56.240 --> 01:58:03.240] You haven't lived until you stood in the courtroom and asked the bailiff to drag the judge off the bench
[01:58:03.240 --> 01:58:06.240]  That is great fun
[01:58:06.240 --> 01:58:12.240] But we can't do that because we are the masters, they are the servants
[01:58:12.240 --> 01:58:21.240] You don't want to have to do that, but when they start doing their little song and dance, everything they do works in your favor
[01:58:21.240 --> 01:58:25.240] Once you ask them to, it works in your favor
[01:58:25.240 --> 01:58:30.240] If they don't do what you ask them to, it works in your favor
[01:58:30.240 --> 01:58:35.240] They very quickly figure that out
[01:58:35.240 --> 01:58:37.240]  That's when things start to change
[01:58:37.240 --> 01:58:44.240] Hang on, Randy Kelton, Rue of La Radio, call at number 512-646-1984, Jacob Sonny, I see you there
