[00:59.000 --> 01:04.760]  last fourth hijacked plane was debris scattered over miles near Shanksville, Pennsylvania.
[01:04.760 --> 01:11.760]  In total, 2,996 people lost their lives, including the hijackers. Over 220 senior military intelligence
[01:11.960 --> 01:17.040]  service members, law enforcement, government officials, 1,500 engineers and architects,
[01:17.040 --> 01:23.040]  250 pilots and aviation professionals, 400 professors, 300 survivors and family members,
[01:23.040 --> 01:28.200]  200 artists, entertainers, and media professionals, and over 400 medical professionals have all
[01:28.200 --> 01:35.200]  come out and labeled these attacks as false flags. They are calling for an investigation.
[01:37.000 --> 01:40.920]  In recent news, New York's Governor Andrew Cuomo's administration formally approved a
[01:40.920 --> 01:45.840]  $15 minimum wage for fast food employees yesterday. The state plans to gradually implement the
[01:45.840 --> 01:50.160]  mandate over a three-year period for New York City and a six-year period for the rest of
[01:50.160 --> 01:54.120]  the state. Republicans also held a hearing into the process behind the fast food wage
[01:54.120 --> 01:58.220]  increase, which some restaurant owners have said they may challenge in court. Franchise
[01:58.220 --> 02:02.440]  owners say that the increase singles them out and gives an unfair advantage to mom and
[02:02.440 --> 02:06.440]  pop competitors. They are warning that many franchises may be forced to raise prices
[02:06.440 --> 02:11.640]  or cut positions in order to absorb the higher mandated labor costs. The pay increase is
[02:11.640 --> 02:18.640]  expected to affect some 200,000 employees. White House Press Secretary Josh Earnest said
[02:21.360 --> 02:25.680]  in a briefing yesterday that while the administration was continuing to examine responses to refugee
[02:25.680 --> 02:29.720]  crisis which has overwhelmed Europe in recent days, the president has decided to raise the
[02:29.720 --> 02:34.400]  number of Syrian refugees admitted into the United States to at least 10,000 for the fiscal
[02:34.400 --> 02:39.040]  year beginning in October. Since the beginning of the conflict in Syria in 2011, the US has
[02:39.040 --> 02:43.560]  taken in less than 1,500 Syrian refugees. Officials have said that the US may accept
[02:43.560 --> 02:47.880]  an additional 30,000 refugees from across the world next year, up from the current figure
[02:47.880 --> 03:12.880]  of 70,000. More than half of them are children, officials say. This was your Lowdown for September 11, 2013.

[04:01.880 --> 04:07.880]  the one thing you should always find, you gotta saddle up your boys, you gotta draw
[04:07.880 --> 04:14.880]  a hard line, and the guns for the settlers will sing a victory tune, and we'll all be
[04:14.880 --> 04:21.880]  back at the local soon. We'll raise up our glasses against evil forces singing, West
[04:21.880 --> 04:37.880]  kid for my man, bear for my horses. We ain't got too many gangsters doing 30 days, too
[04:37.880 --> 04:43.880]  much corruption and crime in the streets, it's down the long arm of the law, but a few
[04:43.880 --> 04:47.880]  more friends. Alright folks, good evening, this is the Monday Night Rule of Law Radio

[04:56.880 --> 05:01.880]  you would think that by this time, people would have gotten wise to the official story
[05:01.880 --> 05:08.880]  being the BS, that those with eyes and actual intellect of any magnitude above double digits
[05:08.880 --> 05:16.880]  would know was a complete falsehood from the very beginning. Yet, there are still people
[05:16.880 --> 05:23.880]  that will fight tooth and nail to maintain the illusion of reality that they have got
[05:23.880 --> 05:30.880]  in their mind because it would be so dangerous to their mental stability, it seems, to recognize
[05:30.880 --> 05:37.880]  the fallacy of what we call America these days, and the people that are in charge of
[05:37.880 --> 05:43.880]  it, and how they got that way, and how they're staying that way, and what they're doing to
[05:43.880 --> 05:54.880]  the rest of us to make that so. People have become so dependent on their illusions of
[05:54.880 --> 06:07.880]  truth that they will literally destroy anyone that attempts to expose them to real truth.
[06:07.880 --> 06:16.880]  Now, by no means do I pretend to be the bringer of all truth or that I can recognize a bringer
[06:16.880 --> 06:21.880]  of all truth in all forms. There are certain instances where you may be able to pull the
[06:21.880 --> 06:28.880]  wool over my eyes in a given situation just like you can anyone else's. But I will guarantee
[06:28.880 --> 06:34.880]  you of one thing, you're going to work at it. You're not going to just be able to do
[06:34.880 --> 06:39.880]  it and walk away with a smile on your face. If you're going to fool me into believing
[06:39.880 --> 06:44.880]  something, then you're going to work your behind off. It's going to be the con of a
[06:44.880 --> 06:54.880]  lifetime. Our goal here is to make the rest of you the same way, to stop taking things
[06:54.880 --> 07:01.880]  that are spoon-fed to you through the media, through your government officials, and make
[07:01.880 --> 07:10.880]  you understand that you are being told half-truths if you're being given any truth.
[07:10.880 --> 07:19.880]  It's like one of the books I was reading today on the income tax stuff and how the IRS and
[07:19.880 --> 07:26.880]  the Treasury Department, the Secretary of the Treasury, and the federal courts continuously
[07:26.880 --> 07:35.880]  refuse to apply the code the way it's written and how the IRS in all of its publications
[07:35.880 --> 07:44.880]  on tax protesters and everything like that intentionally and knowingly misconstrues the
[07:44.880 --> 07:53.880]  ruling in the case or what was said in the case and the actual underlying congressional
[07:53.880 --> 08:02.880]  law that governs their ability to levy and collect taxes in the first place. And there
[08:02.880 --> 08:07.880]  are lots of people that have exposed what they do and how they do it.
[08:07.880 --> 08:13.880]  For instance, one of the things that I just could not believe, well, I could believe it,
[08:13.880 --> 08:22.880]  but that just made me shake my head was the audacity with which they argued how the courts
[08:22.880 --> 08:30.880]  ruled on the term includes in relation to the income tax code. Because I know for a
[08:30.880 --> 08:38.880]  fact that what they're saying the case said is completely false. It has to be completely
[08:38.880 --> 08:46.880]  false because the Supreme Court has ruled how to read the word includes in law many,
[08:46.880 --> 08:54.880]  many times and it's been consistently done each time. So no lower federal court is empowered
[08:54.880 --> 09:03.880]  in any way to alter how the term includes is to be applied when used in law.
[09:03.880 --> 09:12.880]  Yet, this IRS publication has the audacity to make the statement that the case law says
[09:12.880 --> 09:19.880]  that the term includes is intended to be entirely expensive. It's not limited only to the things
[09:19.880 --> 09:25.880]  that are listed. That, ladies and gentlemen, is a half truth.
[09:25.880 --> 09:31.880]  They want you to believe the term expensive means anything they care to proclaim to be
[09:31.880 --> 09:40.880]  taxable or defined as an employee or an employer in this case. And it's not true because if
[09:40.880 --> 09:48.880]  it were true then they could call anyone an employee and anyone an employer rather than
[09:48.880 --> 09:56.880]  the class of individual that is listed after includes, which is the limit of their ability
[09:56.880 --> 10:02.880]  to expand what it encompasses. Because the Supreme Court has said that the
[10:02.880 --> 10:15.880]  use of the term includes is it creates a class or type of class in which the expansion must
[10:15.880 --> 10:22.880]  remain, which just like Dr. Graves says in his jurisdictionary describing a lawsuit,
[10:22.880 --> 10:28.880]  when he's talking about the use of the terms includes, when you use includes in law and
[10:28.880 --> 10:37.880]  say if it includes oranges, lemons, grapefruits, and other fruits, what does that actually
[10:37.880 --> 10:44.880]  mean in law? When it says other fruits, does it mean that it includes apples, peaches,
[10:44.880 --> 10:52.880]  bananas, watermelons? No. And the reason it doesn't? Because it gave us the character,
[10:52.880 --> 11:03.880]  the class, the type that includes was limited to but expandable with in the first three,
[11:03.880 --> 11:12.880]  oranges, lemons, and grapefruits. The class or type would be citrus fruits. That's why
[11:12.880 --> 11:20.880]  apples, bananas, watermelons, peaches would not be a part of the definition relating to
[11:20.880 --> 11:29.880]  whatever term is being defined in that inclusion. Because they're not citrus fruits. When the
[11:29.880 --> 11:40.880]  term includes is being used in law, there must be a common denominator that associates
[11:40.880 --> 11:49.880]  all things in the list following the term includes. There has to be something that puts
[11:49.880 --> 11:58.880]  them within the same category, class, or type. And if there isn't, then the interpretation
[11:58.880 --> 12:09.880]  being applied to it can't be done. Because expansion in such a way would make the law
[12:09.880 --> 12:17.880]  that uses it to be vague and ambiguous as to who has a duty under it. Because let's
[12:17.880 --> 12:25.880]  face facts. If they actually meant that it included everybody, all they would have had
[12:25.880 --> 12:34.880]  to have done in the definition employee means any person that works for any other person,
[12:34.880 --> 12:42.880]  company, business, you name it, and gets paid. That's an employee. It would have been that
[12:42.880 --> 12:48.880]  simple if that's how it was intended to be. And this is logic that can't seem to get into
[12:48.880 --> 12:55.880]  an attorney's brain no matter how hard you try. The more they write in a definition about
[12:55.880 --> 13:02.880]  how to precisely define it, the more they're attempting to hide something from you as to
[13:02.880 --> 13:12.880]  what it actually encompasses. That should be evident. And if it's not something that's
[13:12.880 --> 13:19.880]  listed there, then it isn't something to which the definition can apply. But every attorney
[13:19.880 --> 13:27.880]  that you come across tries to argue that includes allows them to expand it in an unlimited
[13:27.880 --> 13:35.880]  fashion when they know that to be a complete and total lie. And if they don't, then they
[13:35.880 --> 13:41.880]  should have never graduated law school. And they certainly shouldn't be out practicing
[13:41.880 --> 13:46.880]  law. But then again, maybe there's a reason why they're constantly practicing because
[13:46.880 --> 13:53.880]  they're inept at getting it right. And practice is all they can do because they never get
[13:53.880 --> 14:07.880]  it right. People, you may think I hate attorneys. That's not true. I loathe attorneys. Okay?
[14:07.880 --> 14:14.880]  Everything about them. Now, there may be good people that have the misfortune to actually
[14:14.880 --> 14:21.880]  be attorneys. But I have to make the same argument about good attorneys that we would
[14:21.880 --> 14:29.880]  make about good cops. Okay? Now, here's the problem when it comes to good cops. There
[14:29.880 --> 14:41.880]  really is no such thing. Why is there no such thing? Well, that, believe it or not, is a
[14:41.880 --> 14:48.880]  self-answering question. And I got somebody staring at me over here, cute as he is. He's
[14:48.880 --> 14:55.880]  sneaking up and watching. Anyway, the problem here is when you have these cops that agree
[14:55.880 --> 15:02.880]  knowing upfront that they are going into a job where they are going to have to enforce
[15:02.880 --> 15:10.880]  arbitrary dictates and ludicrous malicious revenue-generating take advantage of the poor
[15:10.880 --> 15:18.880]  statutory ordinance schemes, and they'd have to know this, and they've taken oath to do
[15:18.880 --> 15:24.880]  this, you can't call them a good cop. When many of these things they're being told that
[15:24.880 --> 15:30.880]  they have to enforce violates constitutional principles and mandates, it causes problems,
[15:30.880 --> 15:37.880]  it's immoral, it would be illegal in any place that followed the rule of law, you can't say
[15:37.880 --> 15:44.880]  they're good cops. They're not good cops. There are no good cops because they go into
[15:44.880 --> 15:49.880]  this job knowing that is what they're going to be expected to do, and they take the job
[15:49.880 --> 15:56.880]  anyway. And when they're in there, you don't see them arresting any of their brethren in
[15:56.880 --> 16:02.880]  blue for the violations that they perpetrate against the public, and the very few that
[16:02.880 --> 16:12.880]  immediately became ostracized, fired, penalized, criminally charged themselves. The question
[16:12.880 --> 16:17.880]  was, is how long did it take them to reach that breaking point where they would dare
[16:17.880 --> 16:24.880]  to intercede so were they good cops before they got to this point, now that we had called
[16:24.880 --> 16:31.880]  them good cops for trying? Don't know. We don't have that prior history to go by. But
[16:31.880 --> 16:36.880]  the fact is, none of them are good. They can't be. Not doing what they do the way they do
[16:36.880 --> 16:42.880]  it and knowing that the system they operate in allows it, encourages it, profits from

[20:28.880 --> 20:32.880]  me. That's coming from a learned individual, a doctor even. I don't know what he's a doctor
[20:32.880 --> 20:38.880]  of, but he looks smart. But then again, I've seen people that looked at and proved otherwise.
[20:38.880 --> 20:44.880]  All right. That being said, let's start taking some callers. Right now, we have Andrew in

[20:51.880 --> 20:56.880]  All right. Great. I have a more serious issue to discuss with you, Eddie. It appears that
[20:56.880 --> 21:02.880]  you'll become a victim of YouTube censorship. I was trying to look for a comment that you
[21:02.880 --> 21:07.880]  placed on YouTube in the not too distant past on your Infowars presentation. The video secrets
[21:07.880 --> 21:13.880]  police don't want you to know. Someone asked you, can you give us any examples of trial
[21:13.880 --> 21:19.880]  or case law where someone has been successful fighting a traffic ticket? You said in short,
[21:19.880 --> 21:24.880]  no, most of the cases never go to trial. And even if they do, there is a conspiracy of
[21:24.880 --> 21:28.880]  sorts to cover it up. And then you wrote, it works like this. And what I was going to
[21:28.880 --> 21:35.880]  do, I was going to copy and paste that onto some social media networks and say, this is
[21:35.880 --> 21:41.880]  Eddie Craig's explanation for why you can't find a case that shows this stuff being successful.
[21:41.880 --> 21:46.880]  But I found out that that was deleted apparently by the YouTube Nazis. So if it's not too much
[21:46.880 --> 21:50.880]  trouble, could you repeat everything that you would have wrote in that? And after Deborah
[21:50.880 --> 21:54.880]  uploads this to the archives, I will go through the trouble of taking notes and writing down
[21:54.880 --> 21:59.880]  everything you say to write this on social media networks to explain why it is that you
[21:59.880 --> 22:05.880]  cannot find any trials or case law that shows your methods of fighting tickets being successful.
[22:05.880 --> 22:10.880]  Well, like I was saying, for the most part, the reason is, is most of them get quietly
[22:10.880 --> 22:15.880]  dismissed behind the scenes. But when you actually go in and start making the presentation
[22:15.880 --> 22:20.880]  of facts and arguments, we've got several different issues. You have people that don't
[22:20.880 --> 22:24.880]  understand the subject matter well enough to go in and make the proper record for it.
[22:24.880 --> 22:30.880]  So they lose it on appeal because they don't make the proper legal issue at the beginning
[22:30.880 --> 22:38.880]  and keep it at the forefront. But for those that actually do and go through this, here's
[22:38.880 --> 22:47.880]  the problem they run into. The courts, as they exist, refuse to acknowledge that everything
[22:47.880 --> 22:56.880]  that is being presented in the case is 100% presumptive. None of it exists as fact. It
[22:56.880 --> 23:05.880]  is all presumed in the very beginning to the very end. Now, in that presumption, they never
[23:05.880 --> 23:11.880]  look at what is being regulated, the subject matter. They never look at the legislative
[23:11.880 --> 23:17.880]  history to determine what the subject matter is and therefore to determine that in order
[23:17.880 --> 23:23.880]  to regulate someone under the subject matter, the state would first have to prove that they
[23:23.880 --> 23:30.880]  were engaged in the subject matter, which they also never do. But then they maintain
[23:30.880 --> 23:36.880]  the presumption of applicability of all of the terminology and definitions associated
[23:36.880 --> 23:42.880]  through that presumptive instance. For instance, they presume that you are a driver despite
[23:42.880 --> 23:48.880]  any evidence to the contrary that you weren't driving and their lack of evidence that they
[23:48.880 --> 23:54.880]  can't prove you were driving because they would first have to prove that you were engaged
[23:54.880 --> 24:01.880]  in transportation in order to prove that you were driving. They don't go into any of that.
[24:01.880 --> 24:06.880]  I've literally seen courts ignore the fact that the term transportation is not defined
[24:06.880 --> 24:13.880]  in the statute here in Texas at all and refuse to allow you to bring that information into
[24:13.880 --> 24:19.880]  a courtroom and produce it according to the case law that defines what it is, not the
[24:19.880 --> 24:25.880]  legal dictionary. People that are listening, stop trying to introduce the legal dictionary
[24:25.880 --> 24:33.880]  as what a word means in law. If it's not defined in the statute, you get up there and you show
[24:33.880 --> 24:41.880]  them nowhere does the statute contain a definition for this term. However, the term has not failed
[24:41.880 --> 24:48.880]  to be defined. The Supreme Court or the federal court such and such defined it in this way
[24:48.880 --> 24:56.880]  in this case. Since there is no definition in the statute for it, there is a legal definition
[24:56.880 --> 25:04.880]  for it in the legal dictionary supported by this specific case law. And here it is. Then
[25:04.880 --> 25:09.880]  you can bring it up, but most people don't do it correctly and they don't get it in.
[25:09.880 --> 25:15.880]  But the courts continue to apply the terminology for the related subject matter without ever
[25:15.880 --> 25:22.880]  verifying the person was engaged in the regulated activity of whatever the subject matter relates
[25:22.880 --> 25:33.880]  to. For instance, the case law on any criminal act that involves a sales transaction. The
[25:33.880 --> 25:40.880]  prosecutor, in order to prove the offense, must prove that at least there was an attempt
[25:40.880 --> 25:47.880]  to make a sale. And in order to do that, they must prove that person A attempted to sell
[25:47.880 --> 25:55.880]  it to person B. Unless they can prove that, they cannot prove the elements required for
[25:55.880 --> 26:02.880]  that offense. Well, when you look at how the terminology in a given statute relates to
[26:02.880 --> 26:08.880]  the subject matter the statute was written to encompass, you have to come to the same
[26:08.880 --> 26:14.880]  conclusion. Driver, if you want to really understand the definition of a term in a regulatory
[26:14.880 --> 26:20.880]  statute, you have to read it in the context of the code in which it's contained, the
[26:20.880 --> 26:26.880]  regulable subject being regulated. In this case, transportation. So let's read it that
[26:26.880 --> 26:32.880]  way. Driver, someone in physical control of a motor vehicle for the purpose of engaging
[26:32.880 --> 26:40.880]  in transportation. Operator, someone that manages, operates, or physically controls
[26:40.880 --> 26:48.880]  a motor vehicle for the purpose of business for engaging in transportation. You read it
[26:48.880 --> 26:54.880]  in the context like that, it becomes very clear that you can't prove the presumptive
[26:54.880 --> 27:00.880]  definitions application if you can't first prove application of the subject matter. But
[27:00.880 --> 27:08.880]  they don't. They never prove it. They simply presume it. And everything that gets you convicted
[27:08.880 --> 27:17.880]  is 100% presumption because they never proved the framework that supports the rest of the
[27:17.880 --> 27:27.880]  elements. You follow? Yes. Well, I say yes, but there was a lot to swallow there. Like
[27:27.880 --> 27:32.880]  I said. Well, I wrote it out much better because I had time to think about it and lay it out
[27:32.880 --> 27:38.880]  very directly in the comment that I did. But I wanted to make sure that I expanded upon
[27:38.880 --> 27:42.880]  enough that you could understand, everybody could understand how this works and why it
[27:42.880 --> 27:47.880]  must work this way. I mean, it's just like if they're going to regulate you and charge
[27:47.880 --> 27:53.880]  you with a crime of practicing medicine without a license, they would first have to prove

[28:24.880 --> 28:29.880]  with bank robbery. Do you own a gun? Well, yeah, I own a gun. Do you have any money?
[28:29.880 --> 28:34.880]  Well, yeah, I got money. Then we're charging you with bank robbery. What bank? Until they
[28:34.880 --> 28:42.880]  first prove the bank was robbed and what bank that was, and then link you as being the one
[28:42.880 --> 28:46.880]  in the bank through something more than the presumption of you own a gun and you have
[28:46.880 --> 28:55.880]  money, you robbed the bank. You see what the problem? Yeah. That's what they do in these
[28:55.880 --> 29:04.880]  cases. They start on a false presumption and they never let go of it. Where most people
[29:04.880 --> 29:10.880]  screw up is that they do not object to the application of the deadly sins, which then
[29:10.880 --> 29:16.880]  lays a prima facie foundation to help that presumption maintain its integrity through
[29:16.880 --> 29:23.880]  the system. But if you disavow it and you force them to prove it and they don't, you
[29:23.880 --> 29:30.880]  should win on appeal hands down. But the court never addresses it on appeal. Even if you
[29:30.880 --> 29:36.880]  get it in the record, they ignore it. That's why it's almost impossible today to win a
[29:36.880 --> 29:43.880]  case on the merits of not engaging in transportation, because they ignore it for their presumption,

[34:46.880 --> 34:55.880]  has absolutely no clue about the English language. He had the audacity to say that specific entire
[34:55.880 --> 35:03.880]  sections of the Texas constitution were there for no observable purpose. They meant nothing.
[35:03.880 --> 35:09.880]  These are literally his words. It currently has no meaning. And he was talking about in
[35:09.880 --> 35:16.880]  one particular case, article one, section 29, saying that the words in it didn't clearly
[35:16.880 --> 35:24.880]  portray what it was attempting to do and therefore was unnecessary and means nothing in current
[35:24.880 --> 35:29.880]  mode. In other words, he's trying to say the part of the constitution that you can use
[35:29.880 --> 35:34.880]  to force the government to follow the rest of the constitution, we're going to say it
[35:34.880 --> 35:40.880]  doesn't mean anything and thus leave you powerless to make it work. He said the exact same thing
[35:40.880 --> 35:45.880]  about the clause where it said that we have the right to throw out the government, abolish
[35:45.880 --> 35:52.880]  it, destroy it, get rid of it, reform it, and whatever means we deem necessary and proper.
[35:52.880 --> 35:59.880]  That best serves the interest of the people. He said that wasn't worth anything. So folks,
[35:59.880 --> 36:05.880]  these are the kinds of people that are educating the other kinds of people that control the
[36:05.880 --> 36:14.880]  system that is stealing and robbing and taking from you every single day. Idiots abound,
[36:14.880 --> 36:21.880]  statist idiots abound even more. And there's just no way to describe this man's level of
[36:21.880 --> 36:29.880]  integrity and ability to educate as anything but status motivated. And of course, the organization
[36:29.880 --> 36:38.880]  that paid to have his annotated version of the constitution written up and published
[36:38.880 --> 36:47.880]  was our own Texas State Bar Association. Go figure. Why am I not surprised that the fraternity
[36:47.880 --> 36:54.880]  of attorneys attempted to undermine the state constitution by paying some status liberal
[36:54.880 --> 37:00.880]  moron to write a thesis on the constitution that said the parts that give the power to
[37:00.880 --> 37:08.880]  the people don't mean anything. And then he went on even further and said that parts of
[37:08.880 --> 37:13.880]  the Texas constitution did not specifically limit lawmaking power to the legislature,
[37:13.880 --> 37:19.880]  but also gave it to municipalities, to the governor, blah, blah, blah. Baloney. I went
[37:19.880 --> 37:25.880]  through that, his little dissertation on it step by step, and there is no way that it
[37:25.880 --> 37:33.880]  does what he says it does. None. Nowhere is lawmaking power given to a municipality in
[37:33.880 --> 37:40.880]  Texas. Nowhere in the constitution. Through the language it contains, the only way you
[37:40.880 --> 37:47.880]  can even reasonably interpret the one time the word ordinance appears in article 11 of
[37:47.880 --> 37:54.880]  the Texas constitution in relation to municipalities is that it relates to their internal functions.
[37:54.880 --> 38:00.880]  They can write ordinances dealing with their employees, those that contract with them,
[38:00.880 --> 38:06.880]  and those legal entities over whom they're given authority within their territorial boundaries,
[38:06.880 --> 38:13.880]  but they cannot create binding public law. So please forgive me for these rants, but
[38:13.880 --> 38:18.880]  this guy, if I'd have met him in person, I'd have immediately just punched him right
[38:18.880 --> 38:26.880]  in his idiotic mouth, because that was stupid. I mean, it goes beyond stupid with me with
[38:26.880 --> 38:33.880]  these people. All right. Let's go to Michael in Texas. Michael, what can we do for you?

[38:58.880 --> 39:04.880]  further than the time it was brought up a week or two ago or maybe a month ago? I was
[39:04.880 --> 39:09.880]  very intrigued by that because from what I'm hearing you two talk about that, when the
[39:09.880 --> 39:14.880]  policeman pulls you over, you agree to sign and appear based on the understanding that
[39:14.880 --> 39:17.880]  you're going to appear before us. Nah, just straight. And yet when you go there and you
[39:17.880 --> 39:22.880]  try to take advantage of that little offer, they pull the rug out from under you and try
[39:22.880 --> 39:27.880]  to make you cop a plea. It doesn't sound very proper and right at all.
[39:27.880 --> 39:33.880]  It isn't. And this I've also covered in my class twice. What they've actually done is
[39:33.880 --> 39:39.880]  knowingly and intentionally set you up to fail in complying with the citation. And this
[39:39.880 --> 39:44.880]  is the major factor in what they're doing, the way that it works in reality. I don't
[39:44.880 --> 39:48.880]  care what they tell you they're doing and why they're doing it. In reality, this is
[39:48.880 --> 39:54.880]  exactly how it plays out. You sign the citation promising to appear on or before a certain
[39:54.880 --> 40:00.880]  date before a magistrate, not a clerk, not a cop, not anyone else, a magistrate. You
[40:00.880 --> 40:09.880]  go in, you are told you cannot see the magistrate, which in Texas would be an ex parte communication
[40:09.880 --> 40:14.880]  if it deals with anything specifically relating to the facts of the case. That does not mean
[40:14.880 --> 40:21.880]  that you can have zero contact with the magistrate. It simply means you cannot discuss the facts
[40:21.880 --> 40:30.880]  of the case with the magistrate. All right? So you're not allowed to see the magistrate.
[40:30.880 --> 40:38.880]  Then the clerk attempts to do what the magistrate is the only one authorized to do, get you
[40:38.880 --> 40:45.880]  to enter a plea or some other judicial function that only a magistrate or judge is authorized
[40:45.880 --> 40:53.880]  by law to do. When you don't do fill out their paperwork or when you won't enter a plea in
[40:53.880 --> 41:00.880]  front of the clerk, what they do then is fill out paperwork saying that you failed to appear
[41:00.880 --> 41:07.880]  before the magistrate in compliance with the citation, even though they were the ones that
[41:07.880 --> 41:17.880]  obstructed your ability to do so. That is the groundwork for what we discussed. That's
[41:17.880 --> 41:26.880]  how you get there. They have set you up for failure to comply before you ever step foot
[41:26.880 --> 41:40.880]  in the building. Make sense? Yes, sir. Do you have time to discuss one or two other issues?
[41:40.880 --> 41:45.880]  I do unless my head explodes. I just wasn't sure how full the caller board was. It's full
[41:45.880 --> 41:48.880]  at the moment, but there's only two minutes left in this segment, so I'm going to see
[41:48.880 --> 41:58.880]  how quick you are. The other issue that I want to discuss with you has to do with this
[41:58.880 --> 42:10.880]  idea that when you're brought before the court and you want to get information on the record,
[42:10.880 --> 42:15.880]  you had mentioned in a prior podcast or prior show that that can be very, very challenging
[42:15.880 --> 42:19.880]  and there's a very specific technique that you use to do that, because I know from my
[42:19.880 --> 42:24.880]  experience, it's not at all easy sometimes. They fight it tooth and nail trying to get
[42:24.880 --> 42:28.880]  information into the record. They want to limit your discussion and the things you can
[42:28.880 --> 42:34.880]  say and ask to just cross-examining their so-called witness. Exactly, and what they're
[42:34.880 --> 42:40.880]  literally doing is tampering with your ability to put on a vigorous defense. They are literally
[42:40.880 --> 42:45.880]  railroading you through these courts when they do this, and this is how and why they do it.
[42:45.880 --> 42:49.880]  But yeah, there is a particular way to get things in through judicial notice and things
[42:49.880 --> 42:57.880]  like that. You can also pre-file judicial notice motions before you ever go in there,
[42:57.880 --> 43:02.880]  and you can demand that the court take judicial notice of certain facts asserted in those
[43:02.880 --> 43:11.880]  motions before you ever go to trial. How do you force them to do just that?
[43:11.880 --> 43:16.880]  You're not forcing them to do anything. Let's put it like this, okay? Imagine these
[43:16.880 --> 43:23.880]  two scenarios. You file motions asking the court to take judicial notice of the actual
[43:23.880 --> 43:29.880]  statutes that they're charging you with, right? The court denies the motion saying,
[43:29.880 --> 43:34.880]  I don't care what the law is. I don't want to hear what the law is. It would be the same
[43:34.880 --> 43:38.880]  thing as putting in a motion to the court and saying, Judge, I demand to have a fair
[43:38.880 --> 43:46.880]  and impartial trial from you, and the judge saying, Motion denied. You follow?
[43:46.880 --> 43:50.880]  Yes, sir. Okay, hang on just a second, Michael. We're going to take a break. We'll finish

[46:49.880 --> 46:55.880]  I think it was, yeah, I think he was a guest on your show. And I believe his parting comments
[46:55.880 --> 47:01.880]  were that he had used some of your techniques and recommendations on some motions that he
[47:01.880 --> 47:05.880]  submitted before the courts, and they basically dismissed it out of hand. I was curious to
[47:05.880 --> 47:12.880]  know if there was something in particular that some nuggets of wisdom that the rest
[47:12.880 --> 47:14.880]  of us can draw from that.
[47:14.880 --> 47:19.880]  Well, if you have the seminar material, those nuggets of wisdom are written into the documents
[47:19.880 --> 47:25.880]  he filed. He did exactly what everyone else is supposed to do with the documents. You
[47:25.880 --> 47:31.880]  edit them according to the specific details in it that need to be edited for you. You
[47:31.880 --> 47:37.880]  file it for the proper court that applies to your case, and you read and understand
[47:37.880 --> 47:43.880]  the whole document before you file it. If you do that, then you can go in there and
[47:43.880 --> 47:51.880]  argue what's in it. And sometimes, if they actually bother to read it, they understand
[47:51.880 --> 47:59.880]  that they can't win the argument, and they quit before it ever starts.
[47:59.880 --> 48:03.880]  Fair enough. All right. Well, I think I've exhausted my questions. Thank you, Eddie.

[48:05.880 --> 48:13.880]  Yeah, folks, I spent a lot of time, research, and effort writing the stuff that's in those
[48:13.880 --> 48:18.880]  400-plus documents in the seminar material, the legal pleadings that are in there. You
[48:18.880 --> 48:25.880]  will not find a lot of case law in most of them. And the reason is, is because there
[48:25.880 --> 48:31.880]  have never been any cases that address the specific arguments the way I'm making them.
[48:31.880 --> 48:37.880]  They haven't addressed them. And the few that have addressed them have addressed them in
[48:37.880 --> 48:43.880]  ways that are completely wrong. And the reason they're wrong is because they addressed only
[48:43.880 --> 48:50.880]  a specific small part of the subject matter that they're arguing over out of context of
[48:50.880 --> 48:56.880]  all of the rest of the statutes covering the same subject matter. And then once you put
[48:56.880 --> 49:02.880]  that back in context, everything changes. It has no choice. Proving the court did it
[49:02.880 --> 49:08.880]  wrong, which they hate to admit, but the whole purpose of those documents is to make the
[49:08.880 --> 49:11.880]  argument that you screwed up, you know you screwed up, here's a good chance for you to
[49:11.880 --> 49:18.880]  fix it before you cause any more harm to the people. Whether or not they'll do it depends
[49:18.880 --> 49:24.880]  upon us, how well educated we are on what they did and how they did it, how diligent
[49:24.880 --> 49:29.880]  we are in demanding that they fix it and how diligent we are in demanding that they stop
[49:29.880 --> 49:35.880]  using methodologies like that to take advantage of us and steal.
[49:35.880 --> 49:42.880]  All right. Now we're going to go to, well, I don't know if it's Josie or Jose or somebody
[49:42.880 --> 49:56.880]  in New York. Who we got? Yeah, we got Joe. Joe. Okay. Well, I got Josie's. Well, yeah,
[49:56.880 --> 50:04.880]  I called, oh geez, that could be me. And I was telling you about a case where I was,
[50:04.880 --> 50:11.880]  you know, being charged with, you know, possession of marijuana and like that. And I want to
[50:11.880 --> 50:16.880]  let you know that it worked out real good. It would have worked out a lot better if I'd
[50:16.880 --> 50:24.880]  had a few more weeks to prepare. But I went after them on the grounds that, you know,
[50:24.880 --> 50:31.880]  they couldn't name an officer person, you know, which I, you know, possessed the marijuana
[50:31.880 --> 50:37.880]  in my home through. And also, you know, I wondered how they were going to turn personal
[50:37.880 --> 50:45.880]  possession into simple possession. And, you know, then my third argument was, you know,
[50:45.880 --> 50:54.880]  where in the lot does it say that, you know, a police department's policy can transmutate
[50:54.880 --> 51:02.880]  the, you know, what the public health code says. And, you know, I brought those arguments
[51:02.880 --> 51:06.880]  to my attorney. He didn't want anything to do with them. He didn't want to defend me.
[51:06.880 --> 51:11.880]  He said that, you know, I originally agreed to a plea bargain and that's all he was willing
[51:11.880 --> 51:15.880]  to do. So I fired him. Right. And that's all that anyone's going to be willing to do.
[51:15.880 --> 51:21.880]  Just another reason I despise attorneys. So four hours later, he calls me up, says he
[51:21.880 --> 51:26.880]  had a long talk with the DA and the DA was willing to be flexible. And I asked him, well,
[51:26.880 --> 51:31.880]  you know, which of my arguments was he most afraid of? I said, well, I certainly didn't
[51:31.880 --> 51:38.880]  show him any of your arguments. I'm like, okay, yeah, sure you didn't. So I went to
[51:38.880 --> 51:43.880]  court the next day. They wouldn't let the public into the, under the floor of the court
[51:43.880 --> 51:51.880]  house. Like everyone, everybody was fed. Oh, that's a big no-no. Yeah, I know. So, you
[51:51.880 --> 51:54.880]  know, I thought they were going to, you know, they thought they were going to scare me.
[51:54.880 --> 51:59.880]  And I just said, well, obviously I have them by the tender parts or they wouldn't be doing
[51:59.880 --> 52:05.880]  that. So, you know, they came to me with a plea offer that I didn't like. And I, then

[52:20.880 --> 52:27.880]  so they went back and had a meeting and they came back with an offer of a misdemeanor,
[52:27.880 --> 52:34.880]  you know, possession of an ounce and, you know, pay a fine and do some, you know, probation.
[52:34.880 --> 52:41.880]  So I said, well, that sounds pretty small, you know, considering I was facing a B and
[52:41.880 --> 52:48.880]  C felony. So then they brought me this like three page probationary contract. And I just
[52:48.880 --> 52:54.880]  said, well, no, that's not happening. No, I'm only going to do what, you know, they
[52:54.880 --> 52:59.880]  absolutely, you know, are required to do by law, you know, they'll see them, you know,
[52:59.880 --> 53:03.880]  every couple of weeks and they can come check my house and make sure I'm not misbehaving
[53:03.880 --> 53:11.880]  and like that. As far as everything else, no, you know, the DA doesn't like it, you
[53:11.880 --> 53:19.880]  know, but, you know, let's tangle. And so they called me into the courtroom, my sister
[53:19.880 --> 53:25.880]  and I, and there was a lot of yelling and screaming in the judges chambers. And finally
[53:25.880 --> 53:34.880]  the DA and my attorney came out, they were pretty red faced and threw the probation thing
[53:34.880 --> 53:41.880]  on the table there and everything I wanted was granted. And he said, there, are you happy
[53:41.880 --> 53:45.880]  with that? You know, the judge came out, sat down and I said, well, I should tell you a
[53:45.880 --> 53:51.880]  lot. Well, I looked it over and I said, well, if I was a woman, I'd run up there and kiss
[53:51.880 --> 53:59.880]  that man. So I signed it. And then I looked at the DA and I said, geez, you know, I really
[53:59.880 --> 54:05.880]  wanted to go toe to toe with you, but you've been such a sweetheart, I can't bring myself
[54:05.880 --> 54:12.880]  to it. So yeah, I had a really, really good time. You know, like I said, if I'd hit a
[54:12.880 --> 54:18.880]  few more weeks, I would have just told the DA, let's go. You know, but I, but I was,
[54:18.880 --> 54:26.880]  I didn't feel that I, at the time, I was prepared enough, you know, to, you know, demand a
[54:26.880 --> 54:32.880]  contest. But you know, I mean, you got to learn as you go. You know, all things considered,
[54:32.880 --> 54:39.880]  I think under the circumstances it worked out real well for me. And my probation officer,
[54:39.880 --> 54:45.880]  you know, loves what I'm doing. I've been feeding him all kinds of laws, fun stuff.
[54:45.880 --> 54:52.880]  But at any rate, next thing, I want to play devil's advocate with one of my mentors. What
[54:52.880 --> 55:01.880]  you were talking about with the IRS and, you know, defining includes to be inexpensive
[55:01.880 --> 55:10.880]  rather than a restrictive concept. Well, I'm thinking that the IRS operates under private
[55:10.880 --> 55:16.880]  law. All right. You know, the, you know, the, the common law, the public law, you know,
[55:16.880 --> 55:23.880]  doesn't apply to them. As I recall, if I got my facts right, they're an arm in the IMF.
[55:23.880 --> 55:30.880]  And, you know, in the private law, I mean, they're constantly defining, you know, their
[55:30.880 --> 55:37.880]  terms, their way. What would, I mean, you know, since, you know, they're operating under
[55:37.880 --> 55:44.880]  private law, why can't they define includes to mean whatever they wanted to? I guess that's
[55:44.880 --> 55:53.880]  my question to you. Well, the problem there is not what binds them. It's what they're
[55:53.880 --> 56:02.880]  attempting to use to bind you to engage with them. Absolutely. Okay. Yeah. Okay. So I got
[56:02.880 --> 56:08.880]  it. So, so their private law wouldn't apply if they're attempting to bring you into a
[56:08.880 --> 56:16.880]  contract where there's no contract presently exists. Well, the issue here is not in their
[56:16.880 --> 56:24.880]  eyes is not one of contract. It is what they, it is what law refers to as a legal duty.
[56:24.880 --> 56:31.880]  You don't have to have a contract with someone to have a legal duty, not to cause them harm
[56:31.880 --> 56:39.880]  or to act in a way that would prevent you yourself from causing them a harm. In other
[56:39.880 --> 56:47.880]  words, be self-regulating. What the IRS is attempting to do is to get you to comply with
[56:47.880 --> 56:53.880]  regulations that never applied to you in a way that makes it appear as if it did. And
[56:53.880 --> 57:01.880]  they do that by knowingly and intentionally misconstruing what the actual law says. What
[57:01.880 --> 57:08.880]  they rely on is their treasury regulations in place of the underlying congressional acts,
[57:08.880 --> 57:14.880]  which expands their power beyond what the law allows, which is what makes their acts
[57:14.880 --> 57:19.880]  illegal. Well, I'm really glad I asked that question because you really cleared it up
[57:19.880 --> 57:29.880]  nice with that response. I thank you. Yes, sir. Now I've got seven traffic citations
[57:29.880 --> 57:41.880]  that were acquired by a friend of mine. And we went to court and all my friend said was

[01:05:03.880 --> 01:05:09.880]  my friend to a foreign jurisdiction. I'm going to accuse the officers of legal practice
[01:05:09.880 --> 01:05:15.880]  of law and exorbitant prosperity and false arrest because they had no reasonable cause.
[01:05:15.880 --> 01:05:21.880]  They had no cause whatever. He was given tickets on two occasions, one with my van,
[01:05:21.880 --> 01:05:28.880]  which is not registered, you know, because it doesn't need to be, and another car that
[01:05:28.880 --> 01:05:33.880]  he bought in a private sale. And of course, you know, that he registered the car immediately.
[01:05:33.880 --> 01:05:40.880]  Now, they didn't, they didn't tow my van, but they did tow the car. So, you know, I
[01:05:40.880 --> 01:05:48.880]  was going to go ahead. I'm thinking operation of a criminal enterprise, a personage, you
[01:05:48.880 --> 01:05:53.880]  know, because, you know, there's this irreparable presumption of the office of person in play.
[01:05:53.880 --> 01:05:59.880]  Well, the facts clearly prove that no such office, you know, extend as far as, you know,
[01:05:59.880 --> 01:06:06.880]  being applicable to my friend. Forced conversion of a personal private property to commercial
[01:06:06.880 --> 01:06:12.880]  property for revenue generating purposes in violation of the Clayton Antitrust Act, falsifying
[01:06:12.880 --> 01:06:17.880]  government documents for the purpose of financial gain for municipal corporation in violation
[01:06:17.880 --> 01:06:24.880]  of the Sherman Antitrust Act, falsifying documents to records, creating fictitious obligations,
[01:06:24.880 --> 01:06:32.880]  conspiracy to defraud by a conventional contract by subjecting my friend to a court coercion,
[01:06:32.880 --> 01:06:39.880]  well, cursing my friend to accept a contractual obligation subsequent to the allegation of

[01:07:29.880 --> 01:07:36.880]  and going after the judge, any judge that does not comply with the results to the Constitution.
[01:07:36.880 --> 01:07:41.880]  The United States wars against that Constitution. That's the Cooper versus Aaron.
[01:07:41.880 --> 01:07:44.880]  And then if they say, well, you know, he isn't a judge, and I'll say, well, here's one for

[01:10:35.880 --> 01:10:41.880]  And they ended up walking out after, you know, four days of negotiations with $34 million.

[01:10:46.880 --> 01:10:50.880]  So I'm thinking, wow, if it works in the tax code, why not the motor vehicle?
[01:10:50.880 --> 01:11:00.880]  You know, his theory is that, you know, if you take state actors to federal court and federal actors to state court,

[01:13:00.880 --> 01:13:04.880]  or any false claim that they have.
[01:13:04.880 --> 01:13:13.880]  But on this particular day, a sheriff pulled up with his lights on, waved me over to him.
[01:13:13.880 --> 01:13:16.880]  When I got up to him, he said, I can't be out there.
[01:13:16.880 --> 01:13:20.880]  I'm violating a county ordinance.
[01:13:20.880 --> 01:13:24.880]  Keep in mind, I'm very well-read in the law and what I'm doing,
[01:13:24.880 --> 01:13:29.880]  and make sure I'm not breaking any laws whatsoever.
[01:13:29.880 --> 01:13:32.880]  And I asked him, is that a new county ordinance?
[01:13:32.880 --> 01:13:36.880]  He said, no, it's been on the books for 18 years.
[01:13:36.880 --> 01:13:42.880]  I said, well, sir, the ordinance you're referring to addresses commercial soliciting
[01:13:42.880 --> 01:13:47.880]  at the Port Lauderdale Airport and a couple other specific locations.
[01:13:47.880 --> 01:13:50.880]  It does not apply to this.
[01:13:50.880 --> 01:13:53.880]  Of course, he argued, and I just stood my ground,

[01:14:23.880 --> 01:14:25.880]  Weston does not have a police department.
[01:14:25.880 --> 01:14:33.880]  They contract the county sheriff to take care of their town,
[01:14:33.880 --> 01:14:40.880]  much like some of the other cities do in Florida.
[01:14:40.880 --> 01:14:42.880]  Another deputy showed up.
[01:14:42.880 --> 01:14:44.880]  I told him the situation.
[01:14:44.880 --> 01:14:47.880]  I told this man to call the supervisor.
[01:14:47.880 --> 01:14:48.880]  He refused.
[01:14:48.880 --> 01:14:51.880]  I said, call his supervisor and get him out here now.
[01:14:51.880 --> 01:14:56.880]  He got on the phone, did that, and said,
[01:14:56.880 --> 01:15:01.880]  the sergeant said he'd talk to you down at the substation in Weston.
[01:15:01.880 --> 01:15:03.880]  I said, no, sir.
[01:15:03.880 --> 01:15:07.880]  I need to speak with him here and now to put this to an end,
[01:15:07.880 --> 01:15:10.880]  before it goes any farther.
[01:15:10.880 --> 01:15:11.880]  He refused.
[01:15:11.880 --> 01:15:13.880]  Another deputy showed up.
[01:15:13.880 --> 01:15:20.880]  He's the one that ended up transporting me to the Weston substation,
[01:15:20.880 --> 01:15:24.880]  at which time I talked to the sergeant.
[01:15:24.880 --> 01:15:28.880]  By the time we got there, the charge changed from a county ordinance
[01:15:28.880 --> 01:15:31.880]  to a state ordinance, which I've been charged with before,
[01:15:31.880 --> 01:15:36.880]  which was ruled unconstitutional in the federal court in 2003
[01:15:36.880 --> 01:15:39.880]  and is still on the state books.
[01:15:39.880 --> 01:15:43.880]  They did not change the language of the statute.
[01:15:43.880 --> 01:15:47.880]  Well, the problem for the officer in this case then is this.
[01:15:47.880 --> 01:15:51.880]  There's already case law on the books that says when that's been done
[01:15:51.880 --> 01:15:54.880]  and they attempt to enforce it anyway,
[01:15:54.880 --> 01:15:58.880]  they have no immunity for the harm they cause under that
[01:15:58.880 --> 01:16:03.880]  because they cannot use as a defense the enforcement of any law
[01:16:03.880 --> 01:16:08.880]  that has already been ruled unconstitutional.
[01:16:08.880 --> 01:16:12.880]  Well, they like to use operating in good faith.
[01:16:12.880 --> 01:16:14.880]  There is no good faith.
[01:16:14.880 --> 01:16:21.880]  If that has been done, then the state is obligated to fix it.
[01:16:21.880 --> 01:16:26.880]  Their policy of good faith is irrelevant.
[01:16:26.880 --> 01:16:30.880]  It's what they attempt to call qualified immunity.
[01:16:30.880 --> 01:16:42.880]  They cannot claim qualified immunity by engaging in an unconstitutional act.

[01:20:52.880 --> 01:20:55.880]  City of Weston on their cars
[01:20:55.880 --> 01:21:01.880]  They are contracted to provide security for the City of Weston
[01:21:01.880 --> 01:21:07.880]  And I believe either you or Randy mentioned and I don't remember which
[01:21:07.880 --> 01:21:16.880]  That there was case law on, for instance, when a cop is working at the grocery store or the mall
[01:21:16.880 --> 01:21:21.880]  Doing security, that there was case law on that
[01:21:21.880 --> 01:21:28.880]  That he is not a law enforcement officer at that point, he is a security guard
[01:21:28.880 --> 01:21:32.880]  No, that's actually not true, the case law says exactly the opposite
[01:21:32.880 --> 01:21:37.880]  As a peace officer he is on duty 24-7
[01:21:37.880 --> 01:21:40.880]  Okay, okay
[01:21:40.880 --> 01:21:45.880]  Even if he is moonlighting, he can still act
[01:21:45.880 --> 01:21:53.880]  Now he may not be acting entirely under his official capacity as a police officer simply to throw people out of the bar
[01:21:53.880 --> 01:22:02.880]  But if he witnesses a crime in that bar, he absolutely has the authority to invoke his police power and do the job
[01:22:02.880 --> 01:22:09.880]  Okay, now once they got me to the substation, I finally got to talk to the sergeant
[01:22:09.880 --> 01:22:17.880]  And by that point, I asked him, I said, what am I under arrest for?
[01:22:17.880 --> 01:22:24.880]  Because when they put me in the car, they told me the county ordinance wouldn't tell me which one
[01:22:24.880 --> 01:22:27.880]  Soliciting without a permit, you know
[01:22:27.880 --> 01:22:35.880]  So I got to jail and all that changed to the state statute obstructing traffic
[01:22:35.880 --> 01:22:38.880]  Or soliciting without a permit
[01:22:38.880 --> 01:22:47.880]  They actually have both of them written up between the ticket and the affidavit
[01:22:47.880 --> 01:22:54.880]  But I informed the sergeant, I said that was ruled unconstitutional, Bischoff v. Florida in 2003
[01:22:54.880 --> 01:23:02.880]  On January 2nd by Judge Antoine II, Federal Court, Orlando Division
[01:23:02.880 --> 01:23:07.880]  I said, doesn't matter, it's still in the books
[01:23:07.880 --> 01:23:09.880]  So they transport
[01:23:09.880 --> 01:23:14.880]  Well, you have the opportunity to show them that it does matter
[01:23:14.880 --> 01:23:18.880]  It matters to me
[01:23:18.880 --> 01:23:24.880]  That's what a couple of my other charges are on too, both civil and criminal
[01:23:24.880 --> 01:23:31.880]  And so far they've just ignored that point, at least on the civil charges
[01:23:31.880 --> 01:23:37.880]  After that, they transported me to the Broward County Jail
[01:23:37.880 --> 01:23:45.880]  Now they took me inside the jail while the deputy was standing in line to check in my property
[01:23:45.880 --> 01:23:49.880]  So I never got the property receipt
[01:23:49.880 --> 01:23:53.880]  Matter of fact, when I got out of jail the next day, I still hadn't got it
[01:23:53.880 --> 01:23:59.880]  And I brought that point up to several people
[01:23:59.880 --> 01:24:04.880]  After a couple hours, you know, they call you up to the desk, tell you what you're charged with
[01:24:04.880 --> 01:24:08.880]  Ask you if you want to post bail
[01:24:08.880 --> 01:24:13.880]  Now, I knew exactly how much money I went to jail with
[01:24:13.880 --> 01:24:19.880]  I had $36 and change, almost $37
[01:24:19.880 --> 01:24:25.880]  The lady at the desk said I had $21.80
[01:24:25.880 --> 01:24:28.880]  I said, well there's $15 missing
[01:24:28.880 --> 01:24:31.880]  She said I don't know nothing about that
[01:24:31.880 --> 01:24:44.880]  But on top of that, the jail, just for showing up, they take out $15 for showing up and then $7 a day
[01:24:44.880 --> 01:24:50.880]  So they wiped out the $21.80 right then and there
[01:24:50.880 --> 01:24:53.880]  Before I could use it for bail
[01:24:53.880 --> 01:25:01.880]  And they do that because I know I've been there before, you know, like walked in with $25 and bail was $25
[01:25:01.880 --> 01:25:04.880]  And I got to make bail
[01:25:04.880 --> 01:25:11.880]  Now they're taking it off the top before you can post your bail
[01:25:11.880 --> 01:25:17.880]  Well, that sounds like theft to me
[01:25:17.880 --> 01:25:18.880]  Sounds like what?
[01:25:18.880 --> 01:25:21.880]  Theft to me
[01:25:21.880 --> 01:25:27.880]  The thing about it is what they're doing, they're taking, they're penalizing you before you've been found guilty
[01:25:27.880 --> 01:25:31.880]  Bail is not meant to pay the fine
[01:25:31.880 --> 01:25:39.880]  Bail is meant to get you released in lieu of the fine until your trial comes up or a plea bargain is reached
[01:25:39.880 --> 01:25:47.880]  So if they're attempting to make you pay before you've even been convicted, then what you're dealing with is a criminal enterprise
[01:25:47.880 --> 01:25:50.880]  Well, they make you pay for being there
[01:25:50.880 --> 01:25:54.880]  Again, you haven't been convicted of anything and you're not there of your own volition
[01:25:54.880 --> 01:25:58.880]  You're there because you're compelled to be on their behalf
[01:25:58.880 --> 01:26:00.880]  I completely agree, sir
[01:26:00.880 --> 01:26:08.880]  Well, until you sue the living crap out of somebody for doing what they're doing, it's going to continue

[01:27:39.880 --> 01:27:45.880]  No, I can see where that would be problematic, especially if you intend for it to go anywhere

[01:27:47.880 --> 01:27:55.880]  Then I spent my tire money to get that fixed and now I've finally got enough saved up to buy some tires today

[01:28:03.880 --> 01:28:11.880]  Now I noticed that he says I found probable cause on the people that went up before me
[01:28:11.880 --> 01:28:16.880]  I'm not positive he said that when I walked up there he said
[01:28:16.880 --> 01:28:20.880]  Mr. Mark, would you like to end this today?
[01:28:20.880 --> 01:28:26.880]  And I said very loud and clear, no, sir
[01:28:26.880 --> 01:28:28.880]  Which shocked him, you know, he sat back in a chair
[01:28:28.880 --> 01:28:34.880]  What I should have said was, you know, what do you have in mind, you know, hear their little offer
[01:28:34.880 --> 01:28:39.880]  and then make a counter offer and explain that this case is already residue to Cotter
[01:28:39.880 --> 01:28:43.880]  You know, it's been ruled unconstitutional, etc.
[01:28:43.880 --> 01:28:50.880]  But I screwed up there and my main concern was I didn't have bail money
[01:28:50.880 --> 01:28:55.880]  I've got depots coming up on these other cases that I have to do

[01:28:58.880 --> 01:29:02.880]  So I got a lot of work to do and I can't be in jail
[01:29:02.880 --> 01:29:10.880]  Not to mention my recreational conveyance would get towed and at that point I lost it

[01:29:12.880 --> 01:29:16.880]  I can't pay the toll bill, $50 a day storage
[01:29:16.880 --> 01:29:19.880]  I can't catch up to that
[01:29:19.880 --> 01:29:23.880]  So, you know, main thing was me get out of jail ROR
[01:29:23.880 --> 01:29:26.880]  which I successfully argued that
[01:29:26.880 --> 01:29:32.880]  and granted the ROR and the attorney standing next to me
[01:29:32.880 --> 01:29:35.880]  Of course, we're on video court
[01:29:35.880 --> 01:29:40.880]  You know, the courtroom is next door or next building
[01:29:40.880 --> 01:29:45.880]  But the public defender congratulated me
[01:29:45.880 --> 01:29:47.880]  He said, good work, counselor
[01:29:47.880 --> 01:29:50.880]  and then five or six of the guys on my way out shook my hand
[01:29:50.880 --> 01:29:53.880]  All right, Mark, well, I'm going to have to let you drop off

[01:34:01.880 --> 01:34:03.880]  And he don't want to do anything with it
[01:34:03.880 --> 01:34:07.880]  But I'll just kind of see if I can get some information as far as
[01:34:07.880 --> 01:34:10.880]  I know what he did wrong, let's stop
[01:34:10.880 --> 01:34:15.880]  And what he's at now just as a learning experience on my behalf
[01:34:15.880 --> 01:34:18.880]  Now, here's what the situation is
[01:34:18.880 --> 01:34:22.880]  He was, and of course he kept saying I was driving like you were doing what?
[01:34:22.880 --> 01:34:23.880]  Driving what?
[01:34:23.880 --> 01:34:25.880]  You know, anyways, I was trying to get that through his head
[01:34:25.880 --> 01:34:27.880]  I learned that much anyway
[01:34:27.880 --> 01:34:31.880]  But he was coming from the town of Giddings
[01:34:31.880 --> 01:34:34.880]  And anyways, he got stopped by DPS
[01:34:34.880 --> 01:34:39.880]  Because apparently he had a license plate light out on his truck
[01:34:39.880 --> 01:34:41.880]  I mean, on his car
[01:34:41.880 --> 01:34:44.880]  And stopped by the state trooper
[01:34:44.880 --> 01:34:47.880]  And this guy's kind of been in and out of jail
[01:34:47.880 --> 01:34:52.880]  Not anything major, just, you know, little small offenses or whatnot
[01:34:52.880 --> 01:34:55.880]  So he was afraid that he was going to go to jail
[01:34:55.880 --> 01:35:00.880]  He's got Tennessee plates because he just moved back to Texas from Tennessee
[01:35:00.880 --> 01:35:03.880]  He'd been here two, three months
[01:35:03.880 --> 01:35:05.880]  Never got the plates changed over
[01:35:05.880 --> 01:35:09.880]  Obviously never had his driver's license changed over either
[01:35:09.880 --> 01:35:12.880]  To a Texas driver's license
[01:35:12.880 --> 01:35:16.880]  And I think, I'm not 200% sure on this, but I think
[01:35:16.880 --> 01:35:21.880]  That he has his Tennessee license revoked from something or another
[01:35:21.880 --> 01:35:23.880]  I don't know for sure, but I think
[01:35:23.880 --> 01:35:28.880]  So case being is he gets stopped for that
[01:35:28.880 --> 01:35:31.880]  He offers to tell the officer
[01:35:31.880 --> 01:35:34.880]  That I don't have a Texas driver's license
[01:35:34.880 --> 01:35:38.880]  He says, I've been trying to get the state a Texas driver's license
[01:35:38.880 --> 01:35:41.880]  But it's been hard, I've been busy this, busy that
[01:35:41.880 --> 01:35:43.880]  It's kind of hard to transfer from state to state
[01:35:43.880 --> 01:35:45.880]  He kind of set a line
[01:35:45.880 --> 01:35:50.880]  The officer says, okay, well, I'm going to write you a ticket for no driver's license
[01:35:50.880 --> 01:35:52.880]  What's your address?
[01:35:52.880 --> 01:35:55.880]  Because he's got, you know, Tennessee plates
[01:35:55.880 --> 01:35:57.880]  He gives them the address where he's staying
[01:35:57.880 --> 01:36:00.880]  Which obviously is a Texas address
[01:36:00.880 --> 01:36:03.880]  He claimed that as his address
[01:36:03.880 --> 01:36:07.880]  And then, of course, the cop gets him out of the vehicle
[01:36:07.880 --> 01:36:09.880]  Asking him to step out of the car
[01:36:09.880 --> 01:36:12.880]  So he did, he complied right away
[01:36:12.880 --> 01:36:18.880]  And he was asked by the officer if he can
[01:36:18.880 --> 01:36:22.880]  The officer asked if I have permission to search the vehicle
[01:36:22.880 --> 01:36:25.880]  Because he goes, I smell something funny
[01:36:25.880 --> 01:36:29.880]  I smell marijuana or something in there
[01:36:29.880 --> 01:36:31.880]  Do you have anything in the vehicle?
[01:36:31.880 --> 01:36:34.880]  Well, he turned around and said, yes, you can search my car
[01:36:34.880 --> 01:36:37.880]  And I do have some weed, and here it is, it's right there
[01:36:37.880 --> 01:36:40.880]  He told him exactly where it is
[01:36:40.880 --> 01:36:44.880]  And so the cop, trying to play the good guy, said
[01:36:44.880 --> 01:36:47.880]  Well, if it's just a little small amount
[01:36:47.880 --> 01:36:51.880]  I'm just going to have you dumped out and just write you a ticket for paraphernalia
[01:36:51.880 --> 01:36:54.880]  Which it was just a very little trace of it left
[01:36:54.880 --> 01:36:57.880]  Apparently from what my friend told me
[01:36:57.880 --> 01:37:00.880]  And so the cop said, all right, I need to see you dispose of it
[01:37:00.880 --> 01:37:03.880]  Put it right here, dispose of it there
[01:37:03.880 --> 01:37:05.880]  And he wrote him a ticket for paraphernalia
[01:37:05.880 --> 01:37:09.880]  So I think overall he ended up with paraphernalia
[01:37:09.880 --> 01:37:12.880]  No lights on his plate
[01:37:12.880 --> 01:37:18.880]  I'm not sure if he got a citation for not having Texas plates or not
[01:37:18.880 --> 01:37:21.880]  Well, let me ask this question
[01:37:21.880 --> 01:37:24.880]  If it wasn't Texas plates
[01:37:24.880 --> 01:37:29.880]  Then he's not going to be able to ticket him for the light
[01:37:29.880 --> 01:37:32.880]  The guy doesn't live here, it's not subject to that
[01:37:32.880 --> 01:37:40.880]  But what, hopefully your friend told you this in some form or fashion
[01:37:40.880 --> 01:37:50.880]  How far away from his car was this DPS officer when he engaged his lights
[01:37:50.880 --> 01:37:53.880]  And initiated the stop?
[01:37:53.880 --> 01:37:56.880]  See he never mentioned that and I never thought to ask him that
[01:37:56.880 --> 01:38:00.880]  You need to know that because the light on your license plate
[01:38:00.880 --> 01:38:06.880]  Is only required to be visible from no more than 50 feet
[01:38:06.880 --> 01:38:08.880]  No more than 50 feet
[01:38:08.880 --> 01:38:11.880]  Correct
[01:38:11.880 --> 01:38:18.880]  It has to be visible within 50 feet or less, not more
[01:38:18.880 --> 01:38:20.880]  Which really isn't a whole lot
[01:38:20.880 --> 01:38:24.880]  No it's not and that's my point
[01:38:24.880 --> 01:38:30.880]  In order for an officer to initiate a stop for that particular offense
[01:38:30.880 --> 01:38:36.880]  The officer would have to be breaking the law himself by tailgating
[01:38:36.880 --> 01:38:43.880]  Right, right, right, okay
[01:38:43.880 --> 01:38:47.880]  Well and then here's where it kind of gets confusing with them
[01:38:47.880 --> 01:38:51.880]  Not really confusing but where I suggested, you know, hey
[01:38:51.880 --> 01:38:56.880]  You already, you know, you have Tennessee plates
[01:38:56.880 --> 01:39:01.880]  You already gave him your address as in a Texas address
[01:39:01.880 --> 01:39:04.880]  How simple would it, because I mean he doesn't care to do anything with this
[01:39:04.880 --> 01:39:06.880]  Like he just wants to get a ticket to home
[01:39:06.880 --> 01:39:10.880]  I said how simple would it have been for you to say you were visiting someone in Texas
[01:39:10.880 --> 01:39:15.880]  Because it is not against the law for someone to travel from state to state
[01:39:15.880 --> 01:39:19.880]  To have out of state license or out of state plate or anything like that
[01:39:19.880 --> 01:39:21.880]  You could have said I'm visiting some people here
[01:39:21.880 --> 01:39:23.880]  You could have gave him the old Tennessee address
[01:39:23.880 --> 01:39:25.880]  He never would have been on the wiser
[01:39:25.880 --> 01:39:30.880]  But anyways, we were talking about it
[01:39:30.880 --> 01:39:32.880]  And I told him, I said you know what
[01:39:32.880 --> 01:39:34.880]  I found out he didn't want to do nothing anyways
[01:39:34.880 --> 01:39:38.880]  I said well it's probably good that you don't want to try to fight any of this
[01:39:38.880 --> 01:39:42.880]  Because I may be wrong
[01:39:42.880 --> 01:39:46.880]  The key is that you have already waived all of your rights
[01:39:46.880 --> 01:39:50.880]  Whenever you offered all the information to this cop
[01:39:50.880 --> 01:39:53.880]  So now for you to try to go into a court of law
[01:39:53.880 --> 01:39:56.880]  And argue that you're kind of shooting yourself in the foot
[01:39:56.880 --> 01:40:00.880]  Is that a correct assumption or am I missing that aspect?
[01:40:00.880 --> 01:40:02.880]  Absolutely, absolutely
[01:40:02.880 --> 01:40:07.880]  If he gets in that court and does the same thing he did on the side of the road with that cop
[01:40:07.880 --> 01:40:13.880]  There's nothing to stop that prosecutor from turning around and charging him with possession
[01:40:13.880 --> 01:40:15.880]  Nothing
[01:40:15.880 --> 01:40:18.880]  Doesn't matter what the cop said or did
[01:40:18.880 --> 01:40:21.880]  If he confesses to having anything at all
[01:40:21.880 --> 01:40:27.880]  Then he can get the cop to testify what quantity did you see him dump
[01:40:27.880 --> 01:40:29.880]  Well, approximately this much
[01:40:29.880 --> 01:40:31.880]  Oh good, that's enough for a possession charge

[01:42:19.880 --> 01:42:26.880]  So I tried to look that up with the Louisiana codes and I came across
[01:42:26.880 --> 01:42:32.880]  First of all, Louisiana Revised Statute, Section 32401, definitions
[01:42:32.880 --> 01:42:39.880]  And then I found what I believe would be the actual charge on the citation
[01:42:39.880 --> 01:42:41.880]  If a cop were to write it
[01:42:41.880 --> 01:42:45.880]  So what I was getting at for this question is
[01:42:45.880 --> 01:42:53.880]  It says drivers, this is Section 32, 32, Section 32
[01:42:53.880 --> 01:42:59.880]  I'm sorry, I'm a little nervous, Revised Statute 32, Section 32, driver must be licensed
[01:42:59.880 --> 01:43:03.880]  No person shall drive or operate any vehicle upon the highway within the state
[01:43:03.880 --> 01:43:10.880]  Unless it has been issued a license to do so as required by the laws of the state, blah blah blah
[01:43:10.880 --> 01:43:14.880]  It doesn't say anything, do you go to fight this if you wanted to?
[01:43:14.880 --> 01:43:21.880]  Do you go back to the drivers license law which has all the definitions in it to make your case?
[01:43:21.880 --> 01:43:25.880]  Well again, it depends on how you're going after the case to begin with
[01:43:25.880 --> 01:43:32.880]  If you're going after it from a non-transportation then no, you don't ever argue the merits of anything
[01:43:32.880 --> 01:43:38.880]  You go strictly with, you have no evidence I was engaged in the regulable activity of transportation
[01:43:38.880 --> 01:43:43.880]  Therefore you cannot prove I committed a violation associated with it
[01:43:43.880 --> 01:43:47.880]  That's completely different than going to merits on a specific charge
[01:43:47.880 --> 01:43:51.880]  Hang on just a second Richard, we'll pick this up on the other side

[01:47:29.880 --> 01:47:36.880]  and I got into this whole issue about the traveling and you don't need a license and the whole story
[01:47:36.880 --> 01:47:47.880]  So she kind of took me to course on it and it was a good exercise and I was not prepared to answer all the questions
[01:47:47.880 --> 01:47:53.880]  and things that were brought up were that she said well if you're not driving and you're not operating
[01:47:53.880 --> 01:48:00.880]  well what are you doing? Could I just substitute the term on traveling, my private conveyance?
[01:48:00.880 --> 01:48:02.880]  Sure
[01:48:02.880 --> 01:48:07.880]  You're exercising your right of liberty through locomotion
[01:48:07.880 --> 01:48:13.880]  Right, she wanted to know to drive, drive, operate rather than
[01:48:13.880 --> 01:48:20.880]  What you throw back at her is this, it depends upon the definition of the term as you are using it
[01:48:20.880 --> 01:48:25.880]  Driving as it applies under the statute is not what I'm doing
[01:48:25.880 --> 01:48:33.880]  Driving under the common definition of simply going somewhere in my car, that I might be doing
[01:48:33.880 --> 01:48:36.880]  but they are not the same meaning
[01:48:36.880 --> 01:48:41.880]  Very good, I tried to touch on that which I was met with, well I just don't believe you
[01:48:41.880 --> 01:48:46.880]  I don't care which brings me onto the script, the cross examination script
[01:48:46.880 --> 01:48:53.880]  So I tried to go to that to take the scenario and hopefully enlighten her to perhaps through the script
[01:48:53.880 --> 01:48:59.880]  she starts to get it and I said I want you to pretend like you are the juror and the case
[01:48:59.880 --> 01:49:03.880]  So I learned two things from going through this exercise
[01:49:03.880 --> 01:49:14.880]  First of all, your average jurist is going to already have the attitude that you don't think the rules apply to you
[01:49:14.880 --> 01:49:19.880]  That's going to be that right away, so you're going to have no matter how convincing you are
[01:49:19.880 --> 01:49:25.880]  you don't think the rules apply to who do you think you are, everybody else has to I think
[01:49:25.880 --> 01:49:28.880]  Right, and that's why when you're doing jury voir dire
[01:49:28.880 --> 01:49:34.880]  that's the kind of thing you need to get the juror to admit they consider in what they're doing
[01:49:34.880 --> 01:49:43.880]  Great, okay and then to the scenario on page 7 of the cross examination script
[01:49:43.880 --> 01:49:48.880]  I made up that we were in court and I was charging Officer Davis
[01:49:48.880 --> 01:49:54.880]  and it's the part where says Officer Davis, is it your understanding that the complaint in your hand
[01:49:54.880 --> 01:50:02.880]  makes a legal allegation, well I had just gone on earlier about how I wasn't going to give up any license
[01:50:02.880 --> 01:50:08.880]  or proof of insurance, so then they ask, well what citation is he going to be showing you?
[01:50:08.880 --> 01:50:15.880]  You said you weren't going to sign anything, so what is the citation Officer Davis has in his hand
[01:50:15.880 --> 01:50:19.880]  that he claims is a violation of transportation?
[01:50:19.880 --> 01:50:25.880]  It would be whatever citation he attempted to issue, whether you sign for it or not is irrelevant
[01:50:25.880 --> 01:50:31.880]  the fact of the matter is the citation is not a prerequisite to prosecution for a traffic offense
[01:50:31.880 --> 01:50:40.880]  they can do it by complaint, the citation is merely an early notice of their intent to do so
[01:50:40.880 --> 01:50:46.880]  So if things go the way that I've been imagining it on this fateful day when it does
[01:50:46.880 --> 01:50:53.880]  I'm not going to present any evidence that will incriminate me, which then I don't
[01:50:53.880 --> 01:50:58.880]  well I may have a reasonable cost to say, okay, have a nice day, which I don't
[01:50:58.880 --> 01:51:02.880]  I anticipate my window being broken, the ship being out of me
[01:51:02.880 --> 01:51:06.880]  Whoa whoa whoa whoa whoa, careful with the verbiage there
[01:51:06.880 --> 01:51:08.880]  Excuse me
[01:51:11.880 --> 01:51:13.880]  Okay, continue
[01:51:13.880 --> 01:51:21.880]  I expect to have my window broken and to be pummeled by the law enforcement
[01:51:21.880 --> 01:51:26.880]  only to end up in court to defend this
[01:51:26.880 --> 01:51:31.880]  So there will be a complaint whether I sign or not?
[01:51:31.880 --> 01:51:33.880]  Correct
[01:51:33.880 --> 01:51:42.880]  Okay, is there any way in this street side stop where you do sign a complaint without admitting

[01:52:05.880 --> 01:52:13.880]  Okay, I hope the officer is understanding enough to just let me go on my way without a driver's license
[01:52:13.880 --> 01:52:15.880]  proof of insurance or registration
[01:52:15.880 --> 01:52:19.880]  Well let me put it this way, you never know what the cop is going to do
[01:52:19.880 --> 01:52:22.880]  In my experience it goes both ways
[01:52:22.880 --> 01:52:28.880]  However, in the last few years that I have been stopped by anyone anywhere
[01:52:28.880 --> 01:52:34.880]  for instance, Rockdale out just east of Austin over here
[01:52:34.880 --> 01:52:40.880]  They actually arrested me, took me to the police station
[01:52:40.880 --> 01:52:43.880]  and basically typed my information into the computer
[01:52:43.880 --> 01:52:47.880]  and then gave me a lift back to my car to get right back in it
[01:52:47.880 --> 01:52:53.880]  and go back on the road to do exactly the same thing you just took me to jail for
[01:52:53.880 --> 01:52:55.880]  Okay?
[01:52:55.880 --> 01:53:01.880]  But, but he took my seminar book
[01:53:01.880 --> 01:53:09.880]  I gave him my seminar book that I had just finished teaching the seminar here in Austin with
[01:53:09.880 --> 01:53:15.880]  and a week later I got a dismissal in the mail of every charge
[01:53:15.880 --> 01:53:19.880]  What were the charges that were brought against you?
[01:53:19.880 --> 01:53:23.880]  Failure to maintain financial responsibility, failure to produce a driver's license,
[01:53:23.880 --> 01:53:33.880]  driving while license invalid, no registration and no inspection
[01:53:33.880 --> 01:53:38.880]  So you didn't have a book tag or inspection sticker or license plate on you?
[01:53:38.880 --> 01:53:41.880]  No, my car is completely bare of those things
[01:53:41.880 --> 01:53:45.880]  It has my private plates on it and that's it

[01:54:07.880 --> 01:54:13.880]  I went the other day and the prosecutor, you know, texted the people in the back
[01:54:13.880 --> 01:54:15.880]  and they tried to make a deal, this and that
[01:54:15.880 --> 01:54:19.880]  and he says, I want you to just sit down there at the defense area,
[01:54:19.880 --> 01:54:21.880]  the defense desk in front of the judge
[01:54:21.880 --> 01:54:24.880]  and he was over here and he said, you know, if you want to,
[01:54:24.880 --> 01:54:27.880]  the office is out there right now and you can go out back
[01:54:27.880 --> 01:54:29.880]  and we can make a deal, blah, blah, blah
[01:54:29.880 --> 01:54:31.880]  and I said, no, I don't want to do that
[01:54:31.880 --> 01:54:35.880]  and he said, well, then just sit there because we're going to wait for the judge
[01:54:35.880 --> 01:54:39.880]  So the judge comes out and says, Mr. Contrero, I understand your constitution
[01:54:39.880 --> 01:54:46.880]  I get a lot of these kind of motions and all that, you know, what we do through your training
[01:54:46.880 --> 01:54:50.880]  and she said, but you know, at the same time, you're not an attorney
[01:54:50.880 --> 01:54:52.880]  That's what she told me
[01:54:52.880 --> 01:54:56.880]  And you should have said, and that makes a difference in what way?
[01:54:56.880 --> 01:55:02.880]  Because right there you had the opportunity to get them admit that this is a rigged kangaroo court
[01:55:02.880 --> 01:55:08.880]  Yeah, and so the prosecutor told me the video and apparently there's no video
[01:55:08.880 --> 01:55:12.880]  The officer came out from, he was on the other side of the street
[01:55:12.880 --> 01:55:15.880]  When he came out, if we're not past the intersection,
[01:55:15.880 --> 01:55:19.880]  you can only see the video of me passing in front of the camera
[01:55:19.880 --> 01:55:24.880]  So he wasn't behind me, he didn't see me, you know, with the camera switched over
[01:55:24.880 --> 01:55:28.880]  So he was kind of hiding from the other side of the road
[01:55:28.880 --> 01:55:31.880]  Okay, and what is it that they're charging you with?
[01:55:31.880 --> 01:55:36.880]  They're switching the lanes, you know, switching the lanes right away
[01:55:36.880 --> 01:55:40.880]  You need to take a right, but I switched before I got to the stop sign
[01:55:40.880 --> 01:55:41.880]  Okay
[01:55:41.880 --> 01:55:47.880]  And so the guy said, I'm going to send you the video because I got the video already
[01:55:47.880 --> 01:55:52.880]  And it says the prosecutor will work to see how we're going to handle the case
[01:55:52.880 --> 01:55:58.880]  Or as before, he didn't even do that, and they were trying to intimidate me with a judge
[01:55:58.880 --> 01:56:03.880]  And my question was in the back of my mind, if there's a lot of people doing this,
[01:56:03.880 --> 01:56:08.880]  the court would be backed up, you know, because, you know
[01:56:08.880 --> 01:56:13.880]  And so now I'm going to go and he asked me, do you want to bench a jury or a jewelry?
[01:56:13.880 --> 01:56:16.880]  And I said, well, I want to want a jury
[01:56:16.880 --> 01:56:20.880]  The person's video doesn't show me switching, he saw me from across the street
[01:56:20.880 --> 01:56:24.880]  Is it invalid or?
[01:56:24.880 --> 01:56:29.880]  That depends on what his angle of view was, Joe, that's going to be hard to say
[01:56:29.880 --> 01:56:34.880]  You're going to have to be able, does the video show what his view of the line and the road is?
[01:56:34.880 --> 01:56:38.880]  No, no, nothing at all, he just came out from the other side of the street
[01:56:38.880 --> 01:56:42.880]  He was watching behind the tree, you see?
[01:56:42.880 --> 01:56:48.880]  It turns out when he takes off and I'm already past the intersection, I'm already driving down the road
[01:56:48.880 --> 01:56:57.880]  Okay, but the video is not required for him to testify that he saw it, you understand that, right?
[01:56:57.880 --> 01:56:59.880]  Uh huh
[01:56:59.880 --> 01:57:06.880]  So my question is, despite what the video does or does not show,
[01:57:06.880 --> 01:57:16.880]  What is the officer's line of sight from his car from that position in order to see the lanes and the lines and your car?
[01:57:16.880 --> 01:57:22.880]  What time of night was it? Was it under streetlights, etc., etc.?
[01:57:22.880 --> 01:57:26.880]  Yeah, it was in the morning and he was behind a tree, I can see him behind a tree
[01:57:26.880 --> 01:57:29.880]  And it would be difficult for him to see that
[01:57:29.880 --> 01:57:34.880]  Would he have a clear line of sight to where you allegedly made this lane change?
[01:57:34.880 --> 01:57:37.880]  No, he didn't, because the tree was in his line of sight
[01:57:37.880 --> 01:57:40.880]  There was a tree, he was behind a line of sight
[01:57:40.880 --> 01:57:46.880]  Okay, then what you can do is you can use that video to prove his location in relation to that tree
[01:57:46.880 --> 01:57:54.880]  And then prove that there's no way he could have seen what he's saying he saw because the tree was in his line of sight
