[03:48.120 --> 03:56.120] And just before the show opened, I was talking to the producer about the clerk in Kentucky
[03:56.120 --> 04:01.800] who refused to issue marriage license.
[04:01.800 --> 04:09.120] And I don't see how this is a difficult issue.
[04:09.120 --> 04:17.760] Sometimes I have problems with people when they fail to maintain a consistent set of
[04:17.760 --> 04:21.200] beliefs.
[04:21.200 --> 04:26.480] And here we have a clerk that has strong religious convictions.
[04:26.480 --> 04:32.440] And she certainly has a right to her religious convictions.
[04:32.440 --> 04:39.760] And I don't think anybody would object to her having her strong religious convictions.
[04:39.760 --> 04:46.280] And she's in a position to where she is being asked to do something that goes against her
[04:46.280 --> 04:50.320] religious convictions.
[04:50.320 --> 04:56.560] And since what she's being asked to do goes against her religious convictions, she's refusing
[04:56.560 --> 04:57.560] to do it.
[04:57.560 --> 05:03.960] And now she's been brought before the federal court and held in contempt.
[05:03.960 --> 05:07.040] And I think that is as it should be.
[05:07.040 --> 05:14.960] I know I'm likely to upset a lot of Christians, but this is not a Christian issue.

[05:20.240 --> 05:28.600] When we look at this particular issue, it's a perfect example of be careful what you ask

[05:29.600 --> 05:35.640] There are a lot of people out there saying, well, I think it's right for her to refuse
[05:35.640 --> 05:39.600] to issue these licenses.
[05:39.600 --> 05:47.560] And if this violates her moral convictions, I think they are correct.
[05:47.560 --> 05:52.720] She is right in not issuing the licenses.
[05:52.720 --> 06:03.800] However, she's not right in collecting payment for performing a duty that she is not prepared
[06:03.800 --> 06:05.720] to perform.
[06:05.720 --> 06:13.960] When she took office, she swore in her oath to uphold the law.
[06:13.960 --> 06:21.760] And since the law conflicted with her moral convictions, what she wants is to have both
[06:21.760 --> 06:23.440] sides.
[06:23.440 --> 06:26.040] She wants to collect that pay.
[06:26.040 --> 06:35.280] She wants to maintain her position, but she also wants to do what she wants to do.
[06:35.280 --> 06:41.760] Well, I believe she has a right not to issue licenses.
[06:41.760 --> 06:45.400] That right comes with a responsibility.
[06:45.400 --> 06:56.880] If she elects to perform based on her religious convictions instead of her sworn oath, I'm
[06:56.880 --> 07:04.280] certain she can do that, but she has a duty to step down from the position so that someone
[07:04.280 --> 07:10.800] who will abide by their oath can take that position.
[07:10.800 --> 07:20.600] Now, because this is a Christian issue, this is basically a Christian society, and because
[07:20.600 --> 07:31.600] this goes against a large section of our population who tends to be conservative and right-wing,
[07:31.600 --> 07:33.600] I happen to be one of them.
[07:33.600 --> 07:42.680] I'm not anti-gay, but I tend to be conservative and right-wing.
[07:42.680 --> 07:48.080] Then we have a lot of people supporting her, and I'm saying to these people, you guys
[07:48.080 --> 07:58.680] got to get your structures, your belief systems straightened out.
[07:58.680 --> 08:04.880] These are the same people that will come to the court and scream bloody murder when a
[08:04.880 --> 08:15.840] judge gets up on the bench and rules the way he wants to, in spite of what the law says.
[08:15.840 --> 08:19.960] These judges who get up on the bench and says, nobody's coming into my court and getting
[08:19.960 --> 08:26.400] a free house, he should get down off that bench.
[08:26.400 --> 08:34.920] Now, he can have that conviction if he wants to, but not while he's on that bench, not
[08:34.920 --> 08:43.560] while he's sworn to perform his duty, a police officer, because you are black and poor, and
[08:43.560 --> 08:49.520] he doesn't like black and poor, and a white guy beats the crap out of you.
[08:49.520 --> 08:56.120] You file a complaint and he says, well, you know, I think he deserved it.
[08:56.120 --> 09:01.640] He'll jump up and down and rail in righteous indignation over that.
[09:01.640 --> 09:11.480] We have a clerk in Kentucky doing precisely the same thing, so I believe she ought to
[09:11.480 --> 09:18.480] be, if I don't like the idea of her going to jail for contempt of court, but she should
[09:18.480 --> 09:25.600] be subject to co- warranted removal from office.
[09:25.600 --> 09:35.960] The Bible says, render unto Caesar, keep the church out of law.
[09:35.960 --> 09:45.400] We have for how many thousands of years tried to legislate morality.
[09:45.400 --> 09:55.760] This is a problem I see with the Islamic extremists, they're trying to legislate morality.
[09:55.760 --> 09:58.240] Never have been able to do that.

[10:02.000 --> 10:08.800] My moral behavior is between me and my God, so long as my moral behavior doesn't interfere

[10:23.940 --> 10:30.480] When I get there, I'll have to answer to him for that, and it's a decision that I have

[10:35.160 --> 10:46.360] Look at the Muslim extremists, they have strong religious beliefs, but they're not even close

[10:59.040 --> 11:06.840] I don't think anybody would accept that, but it's not a far stretch from what they're

[11:18.720 --> 11:22.720] That's my story, and I'm sticking to it, and I've probably got all the Christians out
[11:22.720 --> 11:33.480] there upset at me, but if we are to have a stable system, we all need to develop a consistent
[11:33.480 --> 11:36.800] set of beliefs.
[11:36.800 --> 11:46.100] If we hold one set of beliefs in one context, and another set of beliefs in another context,
[11:46.100 --> 11:52.800] we will always have an unstable system, just like we've got right now.
[11:52.800 --> 12:01.560] I was doing a seminar in Pennsylvania, and some of the people there were having problems
[12:01.560 --> 12:06.520] filing certain documents in the public record.
[12:06.520 --> 12:16.400] One of them asked if he could file criminally against the clerk for allowing some kind of
[12:16.400 --> 12:18.760] document to be filed.
[12:18.760 --> 12:25.000] They were complaining about the filing of IRS liens.
[12:25.000 --> 12:30.600] They were claiming that they were filed in violation of state law.
[12:30.600 --> 12:37.240] He wanted to file against the clerk for allowing the IRS to file those.
[12:37.240 --> 12:41.800] Then I told him then, be careful what you ask for.
[12:41.800 --> 12:49.280] You're asking the clerk to decide what can be filed in her court, and what can't be in
[12:49.280 --> 12:54.120] the public record, and what can't be filed in the public record.
[12:54.120 --> 12:57.760] I for one don't want the clerk making that decision.
[12:57.760 --> 13:03.120] If I take something down to the clerk to file, I want the clerk to take that and file it.
[13:03.120 --> 13:13.240] Now if someone has an objection, someone withstanding to raise the objection, like the court itself,
[13:13.240 --> 13:21.960] the clerk or opposing counsel, let them bring that issue before the court.
[13:21.960 --> 13:28.120] Here in Texas we have a special statute for that purpose.
[13:28.120 --> 13:33.920] If a clerk in Texas believes that a document is filed improperly, they have two days in
[13:33.920 --> 13:37.480] which to give notice to the district court.
[13:37.480 --> 13:43.520] The district court will issue a declaratory judgment hearing to determine if the document
[13:43.520 --> 13:45.840] meets the statutory filing requirements.
[13:45.840 --> 13:53.080] It is the district clerk that is to make that, I mean district court that is to make that
[13:53.080 --> 13:55.880] decision, not the district clerk.
[13:55.880 --> 14:03.280] So I go down with a less penance or a power of attorney and the clerk doesn't want to
[14:03.280 --> 14:06.960] file it, so she doesn't.
[14:06.960 --> 14:13.760] So now the property I'm trying to protect is left at risk because there is no filing
[14:13.760 --> 14:16.520] of the public record.
[14:16.520 --> 14:21.520] Should the clerk go to jail for that?
[14:21.520 --> 14:28.200] 39.03 Texas Pina Code says that if a public official acting under the color and pretense
[14:28.200 --> 14:32.800] of their authority fails to perform a duty they're required to perform and in the process
[14:32.800 --> 14:37.400] does not have to be informed for the access to rejoinment right, well that's Class A misdemeanor
[14:37.400 --> 14:39.840] in the state of Texas.
[14:39.840 --> 14:51.280] I suspect if you look at the code in Kentucky then it's also a criminal act in Kentucky.
[14:51.280 --> 14:55.480] So careful what we ask for.

[23:38.360 --> 23:43.080] My issue with this house, and basically what I'm looking at is I purchased the home two
[23:43.080 --> 23:49.500] years ago, I moved from Florida to North Carolina, and I'm not sure the specific amount of time
[23:49.500 --> 23:54.880] after closing, but it couldn't have been more than a few days, we agreed to let the
[23:54.880 --> 23:59.000] people who sold us the home back on the property to pick up some stuff, and when they came
[23:59.000 --> 24:04.320] back on the property, my wife took a walk with his wife, and she was explaining to her
[24:04.320 --> 24:08.160] how the first thing we wanted to do was put a hardwood floor downstairs, and the lady
[24:08.160 --> 24:12.800] proceeded to say that, well, you can't do that because of the concrete, so I inquired
[24:12.800 --> 24:21.480] more, and I found out that they had hid the fact that underneath the carpet pad and a
[24:21.480 --> 24:27.080] runner, well, the bottom floor of this home used to be a garage, and underneath the carpet
[24:27.080 --> 24:33.560] is an 18-foot long, 6-foot deep, 32-inch wide, unventilated oil pit.

[24:34.560 --> 24:43.120] You know, like if you go to Jiffy Lube, you drive up over that big rectangle on the floor,
[24:43.120 --> 24:47.520] that's what I have in my floor, something not quite as nice as what you'd have at Jiffy

[25:31.640 --> 25:36.440] any good feedback, and I was so upset about it, and I eventually just stuck my head in

[26:55.520 --> 27:03.400] He wrote me a quit claim, and I immediately filed a recension based on my standing under

[27:04.400 --> 27:09.840] I haven't seen the law in North Carolina, but in Texas, chaperony is legal.

[27:13.000 --> 27:20.940] If you have a lawsuit, or grounds for a lawsuit, and you can't find a lawyer who will pick
[27:20.940 --> 27:26.820] it up, and you don't know how to do it yourself, you can sell it to someone.
[27:26.820 --> 27:33.000] You can actually sell it to the lawyer, and then they can stand in your shoes if you give
[27:33.000 --> 27:35.800] them a quit claim.

[28:45.720 --> 28:55.040] of the funds that it has received from the borrower, and once the lender has rescinded
[28:55.040 --> 29:02.680] his portion, then the lender must tender their portion, either give them back the property
[29:02.680 --> 29:10.400] or give back to the lender everything they received from the lender.
[29:10.400 --> 29:18.880] What the courts were saying was that the borrower, I'm sorry, the lender, when he received a
[29:18.880 --> 29:27.360] notice of rescindion, did not have to rescind, did not have to tender back to the borrower
[29:27.360 --> 29:35.480] everything it received, unless the borrower filed a lawsuit.
[29:35.480 --> 29:39.480] That was the question before the court.
[29:39.480 --> 29:45.280] I don't know who in the bank allowed this to get before the U.S. Supreme, but it was
[29:45.280 --> 29:51.000] a bad mistake because they got a really bad decision against the banks.
[29:51.000 --> 29:53.920] The Supreme said, yes, you have to issue it.

[37:03.560 --> 37:09.920] I called the real estate commission, North Carolina real estate commission, and I mentioned,
[37:09.920 --> 37:15.640] you know, explained the situation to her, and it was her opinion, and I don't know how
[37:15.640 --> 37:23.000] much weight this carries, but the lady I spoke to said that as far as the, as far as knowing
[37:23.000 --> 37:28.640] about because the sellers hid the, at least as far as I know, they hid it even from their
[37:28.640 --> 37:29.640] agent.
[37:29.640 --> 37:33.640] So, as far as the commission was concerned, you know, I could file a complaint, but it
[37:33.640 --> 37:34.640] probably wouldn't go-
[37:34.640 --> 37:35.640] Agent-
[37:35.640 --> 37:36.640] For this specific-
[37:36.640 --> 37:40.640] Agent's problem, not your problem.
[37:40.640 --> 37:41.640] Okay.
[37:41.640 --> 37:47.960] The agent had a duty to do due diligence.

[38:37.840 --> 38:45.160] When you were at closing, did the seller provide documentation to show that the amounts charged
[38:45.160 --> 38:51.320] at closing, the fees listed on the HUD-1 settlement statement, did he provide documentation to
[38:51.320 --> 38:57.320] show that they were not otherwise forbidden to be charged by law?
[38:57.320 --> 39:01.640] That certain fees are not allowed to be put on there.
[39:01.640 --> 39:08.000] And those costs to the lender that are the normal part of doing business are intended
[39:08.000 --> 39:11.440] to be taken out of the interest that the lender charged.
[39:11.440 --> 39:15.600] They're not intended to be put on the HUD-1 settlement statement and interest charged
[39:15.600 --> 39:18.600] on them for 30 years.
[39:18.600 --> 39:26.400] I may send that to you as well, because I mentioned it yesterday, but I had, I had refinanced
[39:26.400 --> 39:31.080] the home because there was something wrong with the, the hindsight.
[39:31.080 --> 39:36.300] I should not have refinanced, but it was kind of an awkward position because the lady who
[39:36.300 --> 39:42.680] is doing the loan was a close friend of mine's daughter.
[39:42.680 --> 39:46.360] So I didn't want to screw her and say, well, you screwed it up.
[39:46.360 --> 39:49.680] You're stuck with it because I didn't want that.

[41:25.840 --> 41:31.600] companies for your produce areas, and that the lender did not take an undisclosed markup
[41:31.600 --> 41:32.600] on the amounts charged.
[41:32.600 --> 41:36.800] This is all right out of the Truth in Lending Act.
[41:36.800 --> 41:39.880] You didn't get any of that.
[41:39.880 --> 41:45.160] Therefore, you have reason to believe that every single fee on the HUD-1 settlement statement
[41:45.160 --> 41:46.160] is fraudulent.

[41:49.280 --> 41:54.880] I just say I send them a written note that I'm rescinding the note.

[42:07.000 --> 42:15.760] One thing I will guarantee you, you will find on the HUD-1 fraudulent fees.
[42:15.760 --> 42:25.320] Charging fraudulent fees on the HUD-1 settlement statement was so common as to be institutionalized.
[42:25.320 --> 42:35.080] Every time I made this claim for someone who was a ex-broker, and I raised this issue,
[42:35.080 --> 42:40.960] they would tell me, don't you dare put that in there, because they knew full well some
[42:40.960 --> 42:45.800] of those were fraudulent, and they didn't want them put in there because they had been
[42:45.800 --> 42:51.920] putting them on other people's HUD-1s, and they were afraid it'd come back to haunt them.
[42:51.920 --> 43:01.000] In over 600 federal lawsuits filed facing this issue, never, not once, did a single
[43:01.000 --> 43:05.480] bank prove up a single fee.
[43:05.480 --> 43:11.840] Reason being, if they proved up one and didn't prove up another, that would raise the adverse
[43:11.840 --> 43:16.360] inference that the other was what we said it was, a fraudulent fee.
[43:16.360 --> 43:21.120] They don't prove any up because there's at least one on there.
[43:21.120 --> 43:28.520] And this is your grounds for recension, as far as the lender is concerned, beyond the
[43:28.520 --> 43:34.280] failure to disclose problems with the property.
[43:34.280 --> 43:38.840] So you rescind, they try to resist it.

[49:44.880 --> 49:49.880] and he told her that he was going to file a motion to withdraw.
[49:49.880 --> 49:53.880] And she said, don't you dare.
[49:53.880 --> 49:58.880] You are under contract, and I expect you to uphold that contract.
[49:58.880 --> 50:03.880] Well, you're doing this, and you're doing that, and she said, I don't care.
[50:03.880 --> 50:05.880] I paid you. You're under contract.
[50:05.880 --> 50:07.880] I'm not releasing you from the contract.
[50:07.880 --> 50:08.880] Well, I'm going to file it.
[50:08.880 --> 50:12.880] She said, well, if you file it, I'll file an objection.
[50:12.880 --> 50:16.880] And he said, told her that the judge will release me from the contract anyway.
[50:16.880 --> 50:18.880] And she said, I know.
[50:18.880 --> 50:23.880] Then I'll get to sue the judge for interfering with the private contract.
[50:23.880 --> 50:28.880] And that's forbidden by the Constitution.
[50:28.880 --> 50:34.880] And then he'll go to the court and ask the court to appoint counsel of your choice,
[50:34.880 --> 50:40.880] because you had counsel of your choice, and the court got rid of him.
[50:40.880 --> 50:47.880] Now I've already paid for this bankruptcy, and the lawyer that I paid, you released.
[50:47.880 --> 50:51.880] Now you get to pay my next one.
[50:51.880 --> 50:58.880] So anyway, point is, you have to control your lawyer.
[50:58.880 --> 51:02.880] You have to give your lawyer plausible deniability.
[51:02.880 --> 51:05.880] The lawyer is going to charge you a certain amount,
[51:05.880 --> 51:17.880] he's going to do what looks like something that you'll get the impression that he is performing for you.
[51:17.880 --> 51:26.880] And when he's got as much money out of you as he thinks he's going to get, he's going to throw you under the bus.
[51:26.880 --> 51:31.880] It's not personal. It's all business.
[51:31.880 --> 51:40.880] So you got to make sure that he's afraid to throw you under the bus.
[51:40.880 --> 51:43.880] And that's not hard.
[51:43.880 --> 51:46.880] The lawyer was going to dismiss the case.
[51:46.880 --> 51:49.880] She told him, don't you dare.
[51:49.880 --> 51:52.880] If you dismiss the case, we're going to appeal.
[51:52.880 --> 51:53.880] He said, I don't appeal.
[51:53.880 --> 51:55.880] She said, yeah, you're going to appeal.
[51:55.880 --> 51:58.880] You're under contract.
[51:58.880 --> 52:01.880] So he didn't dismiss the case.
[52:01.880 --> 52:06.880] But David went down to the hearing just to make sure.
[52:06.880 --> 52:10.880] And what he saw was disgusting.
[52:10.880 --> 52:24.880] He went to this bankruptcy motion hearing and he said one lawyer after another got up there and asked the court to dismiss their client's case.
[52:24.880 --> 52:29.880] The lawyer had taken the case, spent as much, he got about as much money as he could out of the client.
[52:29.880 --> 52:35.880] Once he used up that money, he threw his client under the bus.
[52:35.880 --> 52:45.880] And I can almost guarantee you that they did not tell their client that they asked the court to dismiss the case.
[52:45.880 --> 52:46.880] That's true.
[52:46.880 --> 52:52.880] And your lawyer will throw you under the bus in a heartbeat.
[52:52.880 --> 52:54.880] It's a business decision.
[52:54.880 --> 52:57.880] It's all about the money.
[52:57.880 --> 53:04.880] So the reason he didn't throw this one under the bus is she bargained him.
[53:04.880 --> 53:08.880] That really got him unhappy.
[53:08.880 --> 53:14.880] But it also told him, I know how to kick your behind.
[53:14.880 --> 53:20.880] You mess with me and you wind up out of business.
[53:20.880 --> 53:31.880] Now he can go to the judge and say, Your Honor, my client says, and those are key words for the court,
[53:31.880 --> 53:38.880] that says I have an unruly client that I cannot control.
[53:38.880 --> 53:46.880] My client is insisting that I do this and he's going to kick my behind if I don't, so don't blame me.
[53:46.880 --> 53:50.880] That's my ability.
[53:50.880 --> 53:56.880] And no matter how much huffing and puffing your lawyer is doing when you walk in the door,
[53:56.880 --> 54:02.880] guarantee he's feeding you all that nonsense so you'll give him the money.
[54:02.880 --> 54:08.880] Once he's got the money, that's when your problems with your lawyer will start.
[54:08.880 --> 54:12.880] I did choose a lawyer that is not in the same county.
[54:12.880 --> 54:19.880] And so I don't know, does that make a difference at all if he's not affiliated with the people?
[54:19.880 --> 54:21.880] No.
[54:21.880 --> 54:24.880] I wish it would be that that was only the case.
[54:24.880 --> 54:32.880] I do talk about the politics and the relationships, but it's all about dollar flow.
[54:32.880 --> 54:36.880] He's a businessman and he's trying to create dollar flow.
[54:36.880 --> 54:44.880] And he wants to do what makes him the most money with the least time and effort.
[54:44.880 --> 54:49.880] And they all specialize, so they do the same things over and over and over.
[54:49.880 --> 54:54.880] So they get very accustomed to do a certain set of things.
[54:54.880 --> 54:58.880] And then the case gets dismissed.
[54:58.880 --> 55:03.880] Ask this lawyer how many cases he's won in the last six months.
[55:03.880 --> 55:05.880] Okay.
[55:05.880 --> 55:08.880] And then ask to see some others.
[55:08.880 --> 55:13.880] We watch him start stuttering and stammering and running backwards.
[55:13.880 --> 55:16.880] They dismiss everybody.
[55:16.880 --> 55:19.880] Whoever's got the most money wins the case.
[55:19.880 --> 55:23.880] So understanding that, that's not necessarily a problem.
[55:23.880 --> 55:36.880] I would suggest that before you walk in the door, decide what for you would be an equitable outcome.
[55:36.880 --> 55:44.880] Maybe not the best possible you could get, but at the end of the day, what would be equitable?
[55:44.880 --> 55:47.880] What could you live with?
[55:47.880 --> 55:50.880] Write that down.
[55:50.880 --> 55:51.880] Okay.
[55:51.880 --> 55:56.880] Now you know when you're on the winning side and when you're on the losing side.

[56:09.880 --> 56:14.880] And if you got them over the barrel, that may be a good calculation.

[56:16.880 --> 56:22.880] A lot of people get in these fights and they lose their way.
[56:22.880 --> 56:29.880] It stops being about the outcome and starts being about the fight.

[56:34.880 --> 56:38.880] Once you got that down and go to your lawyer and say, look,
[56:38.880 --> 56:43.880] tell your lawyer what you want, not what you can live with.

[56:45.880 --> 56:49.880] Now I don't care if you win this case or not.
[56:49.880 --> 56:55.880] What I would rather you do is use the claims we have against the bank
[56:55.880 --> 56:58.880] to negotiate a settlement.
[56:58.880 --> 57:00.880] Bring them to the table.
[57:00.880 --> 57:04.880] Now that goes to where the lawyers live.
[57:04.880 --> 57:06.880] That's what they like to do.
[57:06.880 --> 57:11.880] And in that regard, you will probably get your money's worth from the lawyer
[57:11.880 --> 57:15.880] much better than trying to get him to completely adjudicate the case.

[01:04:32.880 --> 01:04:35.880] because they didn't disclose the material facts that would have affected that decision.
[01:04:35.880 --> 01:04:38.880] It doesn't matter what's reasonable.
[01:04:38.880 --> 01:04:43.880] Well, okay, what's reasonable is relative.
[01:04:43.880 --> 01:04:48.880] Your daughter's health is a major, major issue.
[01:04:48.880 --> 01:04:56.880] And one of the things that you'd almost have a duty to include
[01:04:56.880 --> 01:05:04.880] is a claim for any health problems that your daughter suffers.
[01:05:04.880 --> 01:05:13.880] And your lawyer, this now goes to a personal injury claim.
[01:05:13.880 --> 01:05:20.880] And this is the kind of thing that will make your lawyer jump up and down and clap his hands.
[01:05:20.880 --> 01:05:23.880] He's pretty excited about it.
[01:05:23.880 --> 01:05:29.880] This is where he can go through, they've got deep pockets,
[01:05:29.880 --> 01:05:31.880] and this is where he can get into their pockets.
[01:05:31.880 --> 01:05:37.880] All of the actors have errors in emissions policies.
[01:05:37.880 --> 01:05:42.880] So he's got a lot of errors in emissions policies he can go after.
[01:05:42.880 --> 01:05:46.880] The real estate agent, the broker, he can go after the lender.
[01:05:46.880 --> 01:05:49.880] The lawyer looks for deep pockets.
[01:05:49.880 --> 01:05:53.880] So he can go after all of these.
[01:05:53.880 --> 01:05:57.880] He's going to demonstrate how he can keep them in court for a long time,
[01:05:57.880 --> 01:06:01.880] cost him a fortune, and he's going to try to make a deal, that's what all of them do.
[01:06:01.880 --> 01:06:03.880] And that's reasonable, that's how you should do it.
[01:06:03.880 --> 01:06:08.880] So do a reasonable calculation, take everything into account.
[01:06:08.880 --> 01:06:11.880] If you're asking for five times the original amount of the home,
[01:06:11.880 --> 01:06:17.880] ask for five times the original amount, if that's what's reasonable.

[01:06:21.880 --> 01:06:26.880] One thing, the value of the property or what you put into it,

[01:06:32.880 --> 01:06:38.880] So the amount that you paid for the property doesn't have anything to do with anything at this point.

[01:06:46.880 --> 01:06:53.880] These people knew that that hazard was there and did not reveal it.

[01:06:57.880 --> 01:07:01.880] and the real estate commission kind of confirmed this for me yesterday,
[01:07:01.880 --> 01:07:07.880] was listed on the disclosure form that they lied on about the whole even existing
[01:07:07.880 --> 01:07:10.880] or about there being any humidity issues in the foundation.
[01:07:10.880 --> 01:07:16.880] As attributed to the whole, there was listed on there a remodel done in 2006.
[01:07:16.880 --> 01:07:21.880] And because that remodel was listed on there, according to the commission,
[01:07:21.880 --> 01:07:27.880] it was the obligation of the listing agent and broker to pull the house inspections
[01:07:27.880 --> 01:07:30.880] to make sure the renovation was inspected and permitted.
[01:07:30.880 --> 01:07:34.880] Well, there are no building permits that exist at all for the property,
[01:07:34.880 --> 01:07:36.880] so it was never inspected and permitted.
[01:07:36.880 --> 01:07:39.880] And the attorney would seem to be excited about that,
[01:07:39.880 --> 01:07:45.880] because that seems to be the rope to get the broker on the hook, for sure.
[01:07:45.880 --> 01:07:46.880] Right.
[01:07:46.880 --> 01:07:52.880] You have building codes, and if this property is set within a jurisdiction
[01:07:52.880 --> 01:07:56.880] that was subject to building codes,
[01:07:56.880 --> 01:08:05.880] you have a right to a reasonable expectation that this property meets the local building codes.
[01:08:05.880 --> 01:08:10.880] So it's unreasonable for you to consider something as outrageous
[01:08:10.880 --> 01:08:16.880] as a grease pit in a residential property.
[01:08:16.880 --> 01:08:25.880] Now, if I bought a repair shop, I might want to look and see if they had a grease pit.
[01:08:25.880 --> 01:08:34.880] But if I buy a residential property, I have no reason to suspect that there's a grease pit anywhere.
[01:08:34.880 --> 01:08:42.880] And if there was one, the other side had an absolute duty to reveal it.
[01:08:42.880 --> 01:08:47.880] And where I was going is you have a right to expect this from that building code,
[01:08:47.880 --> 01:08:51.880] and building code requires that thing be removed,
[01:08:51.880 --> 01:08:58.880] be caved in and filled up, all the oil and stuff cleaned out of it, and it be filled in.

[01:09:02.880 --> 01:09:10.880] And the fact that the wife told your wife about it, that's important,
[01:09:10.880 --> 01:09:17.880] because what that says is that the seller wasn't hiding anything.
