[00:00.000 --> 00:09.200] The following newsflash is brought to you by the Lone Star Lowdown, providing your daily
[00:09.200 --> 00:11.200] bulletins for the commodities market.
[00:11.200 --> 00:23.560] Today in history, news updates, and the inside scoop into the tides of the alternative.
[00:23.560 --> 00:28.560] Markets opened up today with gold at $1,190.80 an ounce, silver $16.50 an ounce, and the
[00:28.560 --> 00:44.240] Texas crude, $60.40 a barrel, and Bitcoin is currently sitting at $234.79.
[00:44.240 --> 00:50.480] Today in history, Sunday, May 6, 2001, Damascus, Syria, urging interfaith partnership for quote
[00:50.480 --> 00:56.760] the good of the human family, Pope John Paul II visited the great Omiad Mosque.
[00:56.760 --> 01:01.400] He was the first pontiff to visit and pray in a Muslim house of worship, and even kiss
[01:01.400 --> 01:08.400] the Quran.
[01:08.400 --> 01:12.800] In recent news, former Texas Governor Rick Perry said in an interview yesterday that
[01:12.800 --> 01:17.120] his successor, Governor Greg Abbott, went too far in directing State Guard to oversee
[01:17.120 --> 01:22.640] a US military training exercise, known as Operation Jade Helm 15, which is scheduled
[01:22.640 --> 01:24.320] to take place this summer.
[01:24.320 --> 01:29.120] Perry told the Dallas Morning News yesterday that, quote, it's okay to question your government.
[01:29.120 --> 01:33.000] I do it on a regular basis, but the military is something else.
[01:33.000 --> 01:35.040] Our military is quite trustworthy.
[01:35.040 --> 01:40.320] The civilian leadership, you can always question that, but not the men and women in uniform.
[01:40.320 --> 01:45.120] All this is a response to an announcement current Governor Greg Abbott made last week
[01:45.120 --> 01:49.560] that he was going to order the commander of the Texas military forces to monitor the military
[01:49.560 --> 01:56.160] exercise in order to address concerns of Texas citizens and to ensure that Texas communities
[01:56.160 --> 02:09.720] remain safe, secure, and informed about the military procedures occurring in their vicinity.
[02:09.720 --> 02:13.560] The American Phoenix Foundation, a group whose founders are known for deploying undercover
[02:13.560 --> 02:19.140] cameras tied to a controversial operation that targeted Acorn and former US Senator
[02:19.140 --> 02:25.280] Mary Landrieu from Louisiana, is set to unveil secretly captured video footage this summer
[02:25.280 --> 02:30.240] that the group claims will show Texas lawmakers behaving badly, confessing to a variety of
[02:30.240 --> 02:35.580] indiscretions, engaging in inappropriate relations with special interest lobbyists, and allegedly
[02:35.580 --> 02:43.720] even admitting to criminal behavior.
[02:43.720 --> 02:45.800] The Lone Star Lowdown is currently looking for sponsors.
[02:45.800 --> 02:49.840] If you have a product or a service that you would like to advertise in the Lowdown, feel
[02:49.840 --> 02:55.040] free to give us a call at 210-863-5617.
[02:55.040 --> 03:22.640] This has been the Lowdown for May 6, 2015.
[03:26.040 --> 03:30.040] Bad boys, bad boys, whatcha gonna do?
[03:30.040 --> 03:32.040] Whatcha gonna do when they come for you?
[03:32.040 --> 03:35.040] Bad boys, bad boys, whatcha gonna do?
[03:35.040 --> 03:38.040] Whatcha gonna do when they come for you?
[03:38.040 --> 03:43.040] When you were eight and you had bad traits You'd go to school and learn the golden rules
[03:43.040 --> 03:46.040] So why are you acting like a bloody fool?
[03:46.040 --> 03:49.040] If you get fucked then you must get crewed!
[03:49.040 --> 03:52.040] Bad boys, bad boys, whatcha gonna do?
[03:52.040 --> 03:55.040] Whatcha gonna do when they come for you?
[03:55.040 --> 03:58.040] Bad boys, bad boys, whatcha gonna do?
[03:58.040 --> 04:01.040] Whatcha gonna do when they come for you?
[04:01.040 --> 04:03.040] Howdy, howdy!
[04:03.040 --> 04:11.040] This is Randy Kelton, David Stevens, Rule of Law Radio on this May 7, 2015.
[04:11.040 --> 04:15.040] And I think things are improving.
[04:15.040 --> 04:18.040] At least I'm encouraged.
[04:18.040 --> 04:27.040] Looking at a press release, not a press release, a story from Baltimore PD.
[04:27.040 --> 04:34.040] Baltimore PD releases new rules for videotaping police.
[04:34.040 --> 04:41.040] In listening to the news reports and the prosecutor and the mayor,
[04:41.040 --> 04:49.040] I get the impression that they're pretty PO'd at the police department in Baltimore.
[04:49.040 --> 04:56.040] And I think the Baltimore Police Department gets it that they're pretty PO'd at them.
[04:56.040 --> 05:00.040] Because, let me read this.
[05:00.040 --> 05:06.040] I'm sure everybody's heard about what's going on with them prosecuting these police officers.
[05:06.040 --> 05:14.040] The prosecuting attorney really threw the book at these police officers and did it early.
[05:14.040 --> 05:21.040] And then the mayor came back and asked for an investigation into the police department.
[05:21.040 --> 05:31.040] So you have two of the highest, most influential officials around, both of them coming at you.
[05:31.040 --> 05:35.040] The police apparently have to do something to show good faith.
[05:35.040 --> 05:37.040] Let me read this article.
[05:37.040 --> 05:43.040] Baltimore police released an updated policy addressing citizens' ability to videotape officers
[05:43.040 --> 05:47.040] as a related court case against the department continues.
[05:47.040 --> 05:54.040] The hearing is set to take place Monday in the ACLU of Maryland's federal lawsuit against a city officer
[05:54.040 --> 06:03.040] who allegedly deleted a video of a confrontation at the 2010 Preakness Stakes, according to Associated Press.
[06:03.040 --> 06:08.040] Christopher Sharpe's constitutional rights were allegedly violated when a sergeant took his phone
[06:08.040 --> 06:16.040] for evidence and the case comes on the heels of heightened national attention to the issue.
[06:16.040 --> 06:24.040] The directive states officers cannot prevent or prohibit taking of photos or video
[06:24.040 --> 06:27.040] depicting law enforcement activities in public.
[06:27.040 --> 06:38.040] The Baltimore Sun reported which department commanders say has been the standard rule for some time
[06:38.040 --> 06:42.040] but has not been a formal written guideline until now.
[06:42.040 --> 06:47.040] This is an extension of the citizens' right to see.
[06:47.040 --> 06:54.040] Chief legal counsel for Mark Grimes said a police officer would not go up to a citizen at a crime scene
[06:54.040 --> 06:58.040] and tell the citizen to close their eyes, he said.
[06:58.040 --> 07:01.040] So the officer can't tell them they can't film.
[07:01.040 --> 07:11.040] If the filming is hindering and the camera person is breaking laws, however, officers may arrest.
[07:11.040 --> 07:19.040] It is the mere taking of photos or videos, the order states, that does not constitute probable cause
[07:19.040 --> 07:24.040] and should never be the reason for any arrest.
[07:24.040 --> 07:30.040] Cameras that may contain evidence of crime in most cases require a search warrant, a search and seizure warrant.
[07:30.040 --> 07:37.040] Officers can temporarily take the device but cannot view images until a decision on the warrant is made by,
[07:37.040 --> 07:39.040] made the policy dictates.
[07:39.040 --> 07:42.040] Few police have been given clear guidelines.
[07:42.040 --> 07:49.040] Darryl W. Stevens, a former chief of police in Charlotte, Mecklenburg, North Carolina said,
[07:49.040 --> 07:53.040] I think it's a big step for the city of Baltimore to do that.
[07:53.040 --> 08:00.040] Baltimore police seek to dismiss Sharp's lawsuit and say the issue it brings up have been addressed
[08:00.040 --> 08:06.040] through the implementation and distribution of the policies which have been emailed to officers,
[08:06.040 --> 08:12.040] taught in training, described in daily roll calls and appear below.
[08:12.040 --> 08:14.040] And here are the guidelines.
[08:14.040 --> 08:17.040] Police photo video policy.
[08:17.040 --> 08:27.040] Upon discovery that a bystander is observing, photographing or video recording the conduct of police activity,
[08:27.040 --> 08:36.040] do not impede or prevent the bystander's ability to continue doing so based solely on your discovery of his or her presence.
[08:36.040 --> 08:45.040] Do not seize or otherwise demand to take possession of any camera or video recording device the bystander may possess
[08:45.040 --> 08:49.040] based solely on your discovery of his or her presence.
[08:49.040 --> 08:56.040] Do not demand to review, manipulate or erase any images or video recording captured by the bystander
[08:56.040 --> 09:01.040] based solely on your discovery of his or her presence.
[09:01.040 --> 09:10.040] For investigative purposes, be mindful of the potential that the bystander may witness or capture image videos of events
[09:10.040 --> 09:15.040] considered at some later time to be material evidence.
[09:15.040 --> 09:24.040] Before taking any police action which would stop a bystander from observing, photographing or video recording the conduct of police activity,
[09:24.040 --> 09:32.040] officers must have observed the bystander committing some act deemed criminal such as obstruction, disorderly conduct
[09:32.040 --> 09:37.040] or interfering with an officer's lawful duties.
[09:37.040 --> 09:43.040] Those are the guidelines or the policy.
[09:43.040 --> 09:53.040] I'm a little concerned with that last one because if you do anything the officer doesn't like or fail to do something he orders you to do,
[09:53.040 --> 09:59.040] he'll charge you with interfering with his duties.
[09:59.040 --> 10:03.040] But anyway, Deborah, what do you think?
[10:03.040 --> 10:09.040] Well, it sounds good on paper. We'll see what actually happens.
[10:09.040 --> 10:18.040] I mean, you know, these corrupt rogue officers are probably just going to do whatever they want anyway, the corrupt ones that is,
[10:18.040 --> 10:26.040] and they'll just make something up and say that the person is interfering or whatever and not, you know, say,
[10:26.040 --> 10:29.040] well, I didn't do that just because he was videotaping.
[10:29.040 --> 10:38.040] I mean, plus I've seen cases where officers say that the fact of them videotaping was a distraction or a disturbance or they may say,
[10:38.040 --> 10:40.040] oh, you're too close.
[10:40.040 --> 10:48.040] I mean, in some municipalities they're allowed to, people are, quote, allowed to film, okay,
[10:48.040 --> 10:57.040] but they have to be so far away that it's like you'd have to have a $2,000 professional camera with a zoom lens to be able to actually film anything
[10:57.040 --> 11:02.040] and a $5,000 microphone to actually pick up any audio.
[11:02.040 --> 11:14.040] So we'll see if they, you know, modify these policies to set some kind of a, you know, distance limit regarding filming.
[11:14.040 --> 11:16.040] I think here in Austin it's pretty bad.
[11:16.040 --> 11:21.040] I mean, you have to be so far away that it's just basically pointless.
[11:21.040 --> 11:29.040] And so I can see this coming down the pike that something's going to happen and the officer's going to say, well, this guy was too close.
[11:29.040 --> 11:32.040] So we have to set some guidelines and some standards about how far away they're going to be.
[11:32.040 --> 11:33.040] So I don't know.
[11:33.040 --> 11:34.040] We'll see.
[11:34.040 --> 11:42.040] I mean, it sounds good on paper, but what actually is going to happen as a result of this remains to be seen.
[11:42.040 --> 11:49.040] I mean, this could just be a big dog and pony show, a PR stunt in light of this lawsuit.
[11:49.040 --> 12:03.040] I mean, I typically don't give much credence to these policies because it's the law that matters and case law is what matters sometimes even more than statute.
[12:03.040 --> 12:06.040] And, you know, we've got Supreme Court rulings on the matter.
[12:06.040 --> 12:11.040] So, yeah, their policies better be fitting with law, but we shall see.
[12:11.040 --> 12:13.040] I'm skeptical.
[12:13.040 --> 12:15.040] I'm dubious, but I could be wrong.
[12:15.040 --> 12:17.040] We shall see.
[12:17.040 --> 12:36.040] Well, this gives us leverage and this gives us precedence for going to our local policing departments and demanding that our local mayors and city councils institute these policies.
[12:36.040 --> 12:40.040] Yeah, and like I said, I think there is a policy here in Austin, but it's pretty ridiculous.
[12:40.040 --> 12:43.040] I mean, I can't remember exactly what the distance is.
[12:43.040 --> 12:58.040] But basically you have to be so far away that seriously you would have to have like, you know, some kind of spy level multi-thousand dollar microphone to be able to pick anything up much less, you know, have any clarity of video.
[12:58.040 --> 13:07.040] I mean, they basically are prohibiting people from filming by their distance requirement.
[13:07.040 --> 13:09.040] And so that needs to be challenged.
[13:09.040 --> 13:16.040] I mean, the average person is not going to have the level of equipment, you know, that is required.
[13:16.040 --> 13:33.040] You know, the average person is not going to have $10,000 worth of AV gear in order to take good video and audio footage at the distance that the policy here is requiring that people stay away, you know.
[13:33.040 --> 13:37.040] I do have a question or something that I lost track of.
[13:37.040 --> 13:46.040] There was a proposal in the legislature that filming of police officers be restricted to 25 feet away.
[13:46.040 --> 13:48.040] Do you know if that passed?
[13:48.040 --> 13:50.040] Oh, what here in Austin?
[13:50.040 --> 13:53.040] No, it was a state statute.
[13:53.040 --> 13:54.040] Oh, I don't know.
[13:54.040 --> 13:55.040] Legislators.
[13:55.040 --> 13:56.040] I don't know.
[13:56.040 --> 14:00.040] He drew a tremendous amount of heat over that one.
[14:00.040 --> 14:02.040] Yeah, I don't know.
[14:02.040 --> 14:16.040] But 25 feet, that's pretty far to be able to like really adequately pick up audio with a microphone on a cell phone.
[14:16.040 --> 14:17.040] Yeah, audio will be a problem.
[14:17.040 --> 14:19.040] Video we can do.
[14:19.040 --> 14:29.040] You can go on eBay and for about $15, $20 get a telephoto lens that will clip right on to your cell phone.
[14:29.040 --> 14:33.040] And I'm going to order a couple of those just for yucks.
[14:33.040 --> 14:34.040] Okay.
[14:34.040 --> 14:36.040] Let me know how it works out.
[14:36.040 --> 14:45.040] But I recently went to the Justice of the Peace, I think precinct one in Fort Worth.
[14:45.040 --> 14:53.040] This guy's swear engine is in the old courthouse in downtown Fort Worth.
[14:53.040 --> 15:01.040] And when I went there with someone else, I saw this sign that said all electronic devices had to be turned off.
[15:01.040 --> 15:04.040] Well, I've got a hearing aid.
[15:04.040 --> 15:16.040] And so I went to the clerk and asked for the statute or the Supreme Court rule that authorized this particular requirement.
[15:16.040 --> 15:19.040] And the judge came out.
[15:19.040 --> 15:25.040] He was wanting to be your standard Huffy Puffy, Huffy Puffy JP.
[15:25.040 --> 15:27.040] And he said, can I help you?
[15:27.040 --> 15:28.040] I said, yes, you can.
[15:28.040 --> 15:34.040] I see you have the sign here that orders all electronic devices to be turned off.
[15:34.040 --> 15:37.040] Well, I wanted to videotape your courtroom.
[15:37.040 --> 15:39.040] There's no videotaping in our courtroom.
[15:39.040 --> 15:46.040] It would interfere with the proceedings.
[15:46.040 --> 16:01.040] I said, can you show me the statute or the Supreme Court rule, the Supreme Court approved rule that authorizes you to make this restriction?
[16:01.040 --> 16:03.040] There is no rule.
[16:03.040 --> 16:04.040] Oh, there is no rule.
[16:04.040 --> 16:05.040] Okay.
[16:05.040 --> 16:09.040] So then I started to walk away because I was going around.
[16:09.040 --> 16:10.040] I was in the office.
[16:10.040 --> 16:22.040] I was going to the courtroom and I stopped and turned and looked at him and I said, well, if I videotaped your courtroom without you knowing it, that wouldn't interfere with the proceedings.
[16:22.040 --> 16:24.040] Now would it?
[16:24.040 --> 16:27.040] There would be no recording in the courtroom.
[16:27.040 --> 16:31.040] He was absolutely furious.
[16:31.040 --> 16:33.040] I don't know.
[16:33.040 --> 16:36.040] I kind of do know why this is becoming a touchy subject.
[16:36.040 --> 16:39.040] And I think he had figured out who it was.
[16:39.040 --> 16:43.040] He was an hour late coming into the courtroom.
[16:43.040 --> 16:47.040] And when he came in the courtroom, his face was glowing.
[16:47.040 --> 16:50.040] He was clearly upset.
[16:50.040 --> 17:00.040] And I asked the bailiff to tell the judge that I couldn't hear them because I'd already asked if they had.
[17:00.040 --> 17:06.040] Through advances in technology, our lives have greatly improved, except in the area of nutrition.
[17:06.040 --> 17:09.040] People feed their pets better than they feed themselves.
[17:09.040 --> 17:11.040] And it's time we changed all that.
[17:11.040 --> 17:17.040] Our primary defense against aging and disease in this toxic environment is good nutrition.

[19:33.040 --> 19:38.040] I wonder what I did on our adventure.
[19:38.040 --> 19:41.040] What did I buy in the yard with Christian.
[19:41.040 --> 19:46.040] Look what we got in the house they don't ever answer.
[19:46.040 --> 19:36.960] You always
[19:50.960 --> 19:52.960] Look what we got in the house they don't ever answer.
[19:52.960 --> 19:54.960] Okay, we are back.
[19:54.960 --> 19:57.960] Randy Kelton, Demon Stevens, Rule Of Law Radio.
[19:57.960 --> 20:01.960] And I kind of fell off the cliff there on that last outro.
[20:01.960 --> 20:08.120] kind of excited because the way the judge responded, when I told the bailiff that I
[20:08.120 --> 20:13.600] couldn't hear them and asked, I asked the bailiff if they had accommodation with hearing
[20:13.600 --> 20:14.600] impaired.
[20:14.600 --> 20:15.600] And he said, no, he didn't.
[20:15.600 --> 20:18.400] Is your sound system here working?
[20:18.400 --> 20:19.400] He said, no.
[20:19.400 --> 20:23.920] I said, well, then you asked the court to speak up because I can't hear them.
[20:23.920 --> 20:26.160] And he walked away and he didn't go ask the judge.
[20:26.160 --> 20:32.480] So I walked around and walked up to the bar right where the little swinging gates are
[20:32.480 --> 20:38.400] and stood there for 15 minutes.
[20:38.400 --> 20:43.760] The judge never recognized me.
[20:43.760 --> 20:49.280] And I suspect the reason that he didn't is by then he knew who I was and he didn't want
[20:49.280 --> 20:55.160] me setting him up like I did Judge Hayes over the hearing thing.
[20:55.160 --> 21:01.840] But the whole time, I was concerned the way the judge was working his jaw that he was
[21:01.840 --> 21:05.240] going to crack a tooth.
[21:05.240 --> 21:10.800] And that told me these guys are getting uncomfortable.
[21:10.800 --> 21:17.280] My chief of police asked me what I thought about these guys in Dallas who are going around
[21:17.280 --> 21:20.680] provoking the police by videotaping them.
[21:20.680 --> 21:28.760] And I had to think about that a minute, partly because of the way he presented it.
[21:28.760 --> 21:32.920] And it took a minute to work that through.
[21:32.920 --> 21:43.920] And then my question was provoking the police find being videotaped provocative?
[21:43.920 --> 21:49.280] And he said, well, these people are going around deliberately trying to provoke the
[21:49.280 --> 21:50.320] police.
[21:50.320 --> 21:55.160] And I told him, I think that is a wonderful thing.
[21:55.160 --> 22:05.860] Because it gives the police opportunity to learn to control their personal passions.
[22:05.860 --> 22:10.040] They can get as furious as they want to.
[22:10.040 --> 22:17.440] The problem is they're staring down the lens of this camera and they can't go into court
[22:17.440 --> 22:23.880] and make up some god awful story about all the terrible things this guy did because we
[22:23.880 --> 22:26.040] can see what goes on.
[22:26.040 --> 22:29.840] So the police have to learn to control themselves.
[22:29.840 --> 22:40.920] Now, the chief was not too pleased with my response, but in that respect, I get people
[22:40.920 --> 22:47.480] send me a lot of videos of police improprieties.
[22:47.480 --> 22:54.600] The last few videos I have gotten where the police were being videotaped, their behavior
[22:54.600 --> 23:01.840] was dramatically different than it was six months ago.
[23:01.840 --> 23:08.840] None of these latest videos had the police interfering with the people videotaping them,
[23:08.840 --> 23:12.600] except for the ones inside the courtroom.
[23:12.600 --> 23:20.680] And even there, I was amazed at how restrained these bailiffs were being.
[23:20.680 --> 23:23.320] These guys are on a hot seat.
[23:23.320 --> 23:33.280] Police all over the country right now feel like they're not trusted and feel like they're
[23:33.280 --> 23:37.560] being watched in every move they make.
[23:37.560 --> 23:45.480] It's my opinion that if that concerns a policeman, he should take that pistol off his hip, go
[23:45.480 --> 23:49.000] out and pick up dead cats and skunks off the highway.
[23:49.000 --> 23:54.800] If you're worrying about the public seeing what you're doing, then you don't need to
[23:54.800 --> 23:57.080] have a pistol on your hip.
[23:57.080 --> 24:00.440] Well, that's my story and I'm sticking to it.
[24:00.440 --> 24:10.240] I do have some more on that subject and associated subjects of how the pressure on the police
[24:10.240 --> 24:14.240] is beginning to change their policies and practices.
[24:14.240 --> 24:25.520] But we have Jeff in Mississippi, Jeff's been in a court case, this is the second time around
[24:25.520 --> 24:29.800] and he just finished the second time around, the first time it was thrown out on appeal.
[24:29.800 --> 24:30.800] Hello, Jeff.
[24:30.800 --> 24:36.120] Hey, Randy, thanks for having me on the show.
[24:36.120 --> 24:37.120] Glad to have you.
[24:37.120 --> 24:40.800] I'm glad you're, I'm not down trying to get you out of jail.
[24:40.800 --> 24:47.920] Yeah, that was a little nerve wracking, but now that that's over, it's quite a relief.
[24:47.920 --> 24:50.840] So now you're, you're ready to appeal.
[24:50.840 --> 24:56.840] Have you, okay, the, you had a lawyer and kind of give us an idea of what went on at
[24:56.840 --> 24:57.840] the trial.
[24:57.840 --> 25:02.600] Well, a lot went on.
[25:02.600 --> 25:07.680] I basically have been listening to what you've been saying for about four years now.
[25:07.680 --> 25:17.160] And when I go into court, I'm still, I'm still an average Joe, I'm an amateur.
[25:17.160 --> 25:22.920] You know, I'm not you and I'm not Richard Cornforth and Tim Turner and all these guys.
[25:22.920 --> 25:24.200] I'm just me.
[25:24.200 --> 25:28.920] So I go in, I still make a lot of mistakes and I still don't do things, but I went in
[25:28.920 --> 25:33.920] with a shotgun theory and that is I just started blasting everything.
[25:33.920 --> 25:39.920] Every 10 seconds, objection, I don't care if the guy had a blue pen, I objected.
[25:39.920 --> 25:46.160] And so I put up about maybe 100 to 150 objections and I think some of them, I think some of
[25:46.160 --> 25:50.560] those torpedoes that I sent really hurt some people.
[25:50.560 --> 25:55.480] So I think that, I think that even though I was crude, I think I set up a really good
[25:55.480 --> 26:03.960] trap and they stepped into it and I lost my case, but I knew I would, but it was a very
[26:03.960 --> 26:11.400] interesting experience because the DA, even with the, I had more proof that the apartment
[26:11.400 --> 26:16.120] building was off campus than, and they didn't have any proof that it was on.
[26:16.120 --> 26:20.000] But the DA basically just got up and snapped his fingers and told the jury to convict me
[26:20.000 --> 26:24.240] and they had this look of fear like, okay, and they just did.
[26:24.240 --> 26:33.840] So I realized how easy it is to get a jury to do anything you want, but yeah, the trial,
[26:33.840 --> 26:40.680] I objected to the roommate that supposedly turned me in, never showed up.
[26:40.680 --> 26:48.360] So I objected to hearsay because he was the one that supposedly left the police in.
[26:48.360 --> 26:54.760] And when, as soon as the police officer said that the roommate let us in, I said, objection
[26:54.760 --> 26:59.320] hearsay, the roommate's not here and you have no probable cause.
[26:59.320 --> 27:03.080] You entered the building illegally and they overruled it.
[27:03.080 --> 27:04.960] So they basically overruled everything.
[27:04.960 --> 27:08.720] They entered in about 36 documents and not one of them was original.
[27:08.720 --> 27:10.960] They were all copies.
[27:10.960 --> 27:15.320] I objected to every last one of them.
[27:15.320 --> 27:21.800] The DA accidentally went into the jury room during the trial and so-
[27:21.800 --> 27:24.120] Whoa, hold on.
[27:24.120 --> 27:26.360] During the trial or during deliberation?
[27:26.360 --> 27:34.320] No, not during deliberation, but just during one of the recesses, the DA went into the
[27:34.320 --> 27:35.320] jury room.
[27:35.320 --> 27:38.400] I guess he thought it was a bathroom or something.
[27:38.400 --> 27:39.400] And so he came out.
[27:39.400 --> 27:42.880] I mean, we were all seated, but he came back out.
[27:42.880 --> 27:45.680] People had gone to the bathroom and stuff and he came back out and they started up and
[27:45.680 --> 27:48.240] he said, your honor, I accidentally stuck my head in the jury room.
[27:48.240 --> 27:54.280] Well, I objected about five times and claimed jury tampering.
[27:54.280 --> 27:59.840] I probably don't have a leg to stand on, but it was sure fun to make him nervous.
[27:59.840 --> 28:02.040] It was a lot of fun to make him nervous.
[28:02.040 --> 28:12.600] Well, no, no, wait, this is not a witness subpoenaed from out of state.
[28:12.600 --> 28:19.440] Has this prosecutor never been in the courtroom before?
[28:19.440 --> 28:20.440] You know, that's what I claimed.
[28:20.440 --> 28:24.600] I said that he's an officer of court, he knows exactly where he's going and he just tampered
[28:24.600 --> 28:26.720] with the jury.
[28:26.720 --> 28:30.240] And what they tried to say is, oh, I didn't say anything to him and all that.
[28:30.240 --> 28:34.360] And I objected and said, it doesn't matter, just the possibility of contamination, jury
[28:34.360 --> 28:35.360] tampering.
[28:35.360 --> 28:38.160] Well, you don't know that he didn't say anything to him.
[28:38.160 --> 28:46.040] You need to, and now I want to say voir dire, voir dire is not the right term.
[28:46.040 --> 28:48.480] You need an opportunity to talk to the jurors.
[28:48.480 --> 28:49.920] Well, they did.
[28:49.920 --> 28:53.640] They pulled each of them out and each of them stood up and said, no, he didn't say anything
[28:53.640 --> 28:54.640] to us.
[28:54.640 --> 29:02.560] And I still objected, just objected and objected and objected.
[29:02.560 --> 29:03.560] And you know what?
[29:03.560 --> 29:04.560] For the first time, I wasn't scared.
[29:04.560 --> 29:10.040] I just, I just, my, my voice booms like a shotgun blast.
[29:10.040 --> 29:12.160] And it was wonderful.
[29:12.160 --> 29:15.920] The, the DA switched witnesses on me.
[29:15.920 --> 29:21.000] They had brought, had been bringing a person from the college to testify that I was just
[29:21.000 --> 29:24.000] merely a student, that I was enrolled.
[29:24.000 --> 29:28.680] And there was a name on the list and it had, it had been the same person.
[29:28.680 --> 29:31.840] And without telling me, they just brought out this new guy.
[29:31.840 --> 29:34.760] And I objected, who is this guy?
[29:34.760 --> 29:39.360] I think I hear music.
[29:39.360 --> 29:40.360] Yes you do.
[29:40.360 --> 29:43.640] I was giving you, you had about 10 more seconds, but okay.
[29:43.640 --> 29:44.640] Hang on.
[29:44.640 --> 29:50.920] Brandy Kelton, Deborah Stevens, rule of our radio, I call the number 512-646-1984.
[29:50.920 --> 29:52.320] We'll keep the phones open all night.
[29:52.320 --> 29:55.320] So if you have a question or comment, give us a call.
[29:55.320 --> 30:02.320] We'll be right back.
[30:25.520 --> 30:30.640] So protect your rights, say no to surveillance and keep your information to yourself.
[30:30.640 --> 30:33.400] Privacy, it's worth hanging on to.
[30:33.400 --> 30:37.700] This public service announcement is brought to you by StartPage.com, the private search
[30:37.700 --> 30:41.240] engine alternative to Google, Yahoo and Bing.
[30:41.240 --> 30:45.080] Start over with StartPage.
[30:45.080 --> 30:49.280] Cell phones emit radio frequency energy, it's a fact, but whether it's dangerous to have
[30:49.280 --> 30:52.520] a phone beaming this kind of radiation near your head has been disputed.
[30:52.520 --> 30:57.520] Some have blamed it for brain tumors while cell phone companies have downplayed concerns.
[30:57.520 --> 31:01.560] Well now the Journal of the American Medical Association is confirming that cell phones
[31:01.560 --> 31:02.560] affect brain chemistry.
[31:02.560 --> 31:08.200] A study of 47 volunteers showed that glucose metabolism in the area of the brain closest
[31:08.200 --> 31:11.880] to the cell phone antenna increases when the cell phone is on.
[31:11.880 --> 31:15.760] While researchers aren't sure whether this exposure causes damage, I'm not taking any
[31:15.760 --> 31:16.760] chances.
[31:16.760 --> 31:20.160] I always keep the phone far from my body and I use a corded headset.
[31:20.160 --> 31:30.720] I'm Dr. Catherine Albrecht, more news and information at CatherineAlbrecht.com.
[31:30.720 --> 31:36.080] This is Building 7, a 47 story skyscraper that fell on the afternoon of September 11th.
[31:36.080 --> 31:41.480] The government says that fire brought it down, however, 1,500 architects and engineers concluded
[31:41.480 --> 31:43.120] it was a controlled demolition.
[31:43.120 --> 31:47.200] Over 6,000 of my fellow service members have given their lives and thousands of my fellow
[31:47.200 --> 31:48.560] first responders are dying.
[31:48.560 --> 31:52.160] I'm not a conspiracy theorist, I'm a structural engineer, I'm a New York City correction
[31:52.160 --> 31:57.160] officer, I'm an Air Force pilot, I'm a father, we lost a son, we're Americans and we deserve
[31:57.160 --> 31:58.160] the truth.
[31:58.160 --> 32:01.040] Go to RememberBuilding7.org today.
[32:01.040 --> 32:04.560] You feel tired when talking about important topics like money and politics?
[32:04.560 --> 32:05.560] Boring!
[32:05.560 --> 32:08.400] Are you confused by words like the Constitution or the Federal Reserve?
[32:08.400 --> 32:09.400] What?
[32:09.400 --> 32:13.080] If so, you may be diagnosed with the deadliest disease known today, stupidity.
[32:13.080 --> 32:18.480] Hi, my name is Steve Holt and like millions of other Americans, I was diagnosed with stupidity.
[32:18.480 --> 32:23.440] At an early age, I had no idea that the number one cause of the disease is found in almost
[32:23.440 --> 32:26.040] every home in America, the television.
[32:26.040 --> 32:31.040] Unfortunately, that puts most Americans at risk of catching stupidity, but there is hope.
[32:31.040 --> 32:34.800] The staff at Brave New Books have helped me and thousands of other foxaholics suffering
[32:34.800 --> 32:37.120] from sports zombieism recover.
[32:37.120 --> 32:41.360] And because of Brave New Books, I now enjoy reading and watching educational documentaries
[32:41.360 --> 32:43.360] without feeling tired or uninterested.
[32:43.360 --> 32:51.360] So if you or anybody you know suffers from stupidity, then you need to call 512-480-2503
[32:51.360 --> 32:55.400] or visit them at 1904Guadalupe or bravenewbookstore.com.
[32:55.400 --> 32:58.800] Side effects from using Brave New Books products may include discernment and enlarged vocabulary
[32:58.800 --> 33:02.400] and an overall increase in mental functioning.
[33:02.400 --> 33:14.400] For more information on Brave New Books products, go to www.BraveNewBooks.com or visit www.BraveNewBooks.com.
[33:32.400 --> 34:02.320] Okay, we are back, Randy Kelton, Deborah Stevens, Radio, here with Jeff from Mississippi.
[34:02.320 --> 34:13.920] Okay, Jeff, what are the things in particular, okay, that they did that you think might get
[34:13.920 --> 34:14.920] this overturned?
[34:14.920 --> 34:23.200] Well, that's, okay, I'll tell you, the thing that made me win, that won my case the last
[34:23.200 --> 34:30.400] time did not happen this time, and that is my attorney, last time when I started griping
[34:30.400 --> 34:35.160] about the missing roommate, because that's who filed the police report.
[34:35.160 --> 34:38.280] So I started jumping up and down about my accusers not here.
[34:38.280 --> 34:43.040] Well, I started doing it this time, and they all looked very calm.
[34:43.040 --> 34:49.440] And the first time my lawyer panicked, and she got up and started arguing with me, like,
[34:49.440 --> 34:54.040] oh, I've never heard of this accuser either, and he's right, and this and that.
[34:54.040 --> 34:58.200] Well, just her breakdown in the courtroom is what won me in my appeal.
[34:58.200 --> 35:05.520] Unfortunately, this attorney didn't say anything, and I pointed to him about three times during
[35:05.520 --> 35:11.480] the trial and said, I want to hear what my attorney has to say, and everybody just kind
[35:11.480 --> 35:14.800] of looked around like they had no idea what I was talking about, and my attorney never
[35:14.800 --> 35:15.800] said a word.
[35:15.800 --> 35:16.800] Okay.
[35:16.800 --> 35:23.360] Well, the last time you got it overturned for ineffective counsel.
[35:23.360 --> 35:31.720] Well, I got it overturned because the judge refused to let her withdraw because she had
[35:31.720 --> 35:32.840] a mental breakdown.
[35:32.840 --> 35:35.280] She started crying, and she started saying, I want to get out of here.
[35:35.280 --> 35:36.280] I want to withdraw.
[35:36.280 --> 35:39.000] And he said, I won't do that.
[35:39.000 --> 35:44.920] Well, this attorney looked very cool and calm and collected, and he never got upset a word.
[35:44.920 --> 35:45.920] That's the problem.
[35:45.920 --> 35:48.120] You had ineffective counsel.
[35:48.120 --> 35:50.120] Okay.
[35:50.120 --> 35:54.840] And you asked counsel to assist, and counsel refused.
[35:54.840 --> 35:57.640] Okay, good.
[35:57.640 --> 36:00.240] So you essentially got the same thing.
[36:00.240 --> 36:03.040] Well, because, see, I didn't know that.
[36:03.040 --> 36:04.520] I wasn't sure.
[36:04.520 --> 36:10.160] So you definitely need to have you bargrieved your counsel.
[36:10.160 --> 36:18.000] Yes, I just sent a bar grievance off today, and I got him good because he didn't expect
[36:18.000 --> 36:19.000] this.
[36:19.000 --> 36:21.280] And they switched those witnesses out.
[36:21.280 --> 36:29.760] I started screaming about it, and the DA jumped up and said, well, I sent Mr. Hill's lawyer
[36:29.760 --> 36:35.320] a letter like a month ago telling that we were going to switch witnesses.
[36:35.320 --> 36:41.440] And then my attorney then got up and said, yes, and I sent Mr. Hill a letter last week
[36:41.440 --> 36:46.120] telling him that we were switching witnesses, and that's when I jumped up and said, I don't
[36:46.120 --> 36:47.320] have a letter.
[36:47.320 --> 36:52.800] I don't have a certified receipt, and I did that a couple of times to make people nervous.
[36:52.800 --> 36:59.200] And my attorney finally said, well, I think I'm mailed at Friday, so it's probably getting
[36:59.200 --> 37:03.200] to his house today, and, of course, I'm in the courtroom.
[37:03.200 --> 37:04.200] Right.
[37:04.200 --> 37:09.440] So I immediately screamed objection, ineffective assistance of counsel.
[37:09.440 --> 37:10.440] Perfect.
[37:10.440 --> 37:11.440] Okay, good.
[37:11.440 --> 37:15.920] You've set them up much better this time.
[37:15.920 --> 37:16.920] Okay.
[37:16.920 --> 37:17.920] That's good.
[37:17.920 --> 37:18.920] This sounds good.
[37:18.920 --> 37:19.920] This is good.
[37:19.920 --> 37:27.240] Well, the second time I got him is I tried to call the judge to the stand.
[37:27.240 --> 37:28.680] I just thought, oh, to heck with it.
[37:28.680 --> 37:29.680] Let's have a good time.
[37:29.680 --> 37:31.920] So do you have any witnesses?
[37:31.920 --> 37:32.920] Yes, you.
[37:32.920 --> 37:34.520] I can't come down.
[37:34.520 --> 37:35.520] Yes, you can.
[37:35.520 --> 37:38.680] You arrested me in October without a bond hearing and without a warrant.
[37:38.680 --> 37:39.680] Why?
[37:39.680 --> 37:41.400] You need to take the stand.
[37:41.400 --> 37:43.920] People started yelling and screaming.
[37:43.920 --> 37:48.800] Finally, my attorney jumped up and he said, oh, well, you had arrested him for failure
[37:48.800 --> 37:49.800] to appear.
[37:49.800 --> 37:52.800] And I said, objection, perjury.
[37:52.800 --> 37:58.000] That had been like two years before.
[37:58.000 --> 38:03.360] I got arrested seven days before my court date, so there's no failure to appear.
[38:03.360 --> 38:05.480] So I said, objection, perjury.
[38:05.480 --> 38:06.480] He's lying.
[38:06.480 --> 38:10.200] What do you think about that?
[38:10.200 --> 38:12.200] I think that's great.
[38:12.200 --> 38:13.200] Okay, good.
[38:13.200 --> 38:21.080] I think it's going to indicate that your attorney was deliberately contriving to get you found
[38:21.080 --> 38:22.080] guilty.
[38:22.080 --> 38:24.720] Okay, good.
[38:24.720 --> 38:27.600] This will feed your RICO suit.
[38:27.600 --> 38:31.520] Okay, that's fantastic.
[38:31.520 --> 38:38.200] All of this, this goes, probably your case more than most any that I've heard goes to
[38:38.200 --> 38:47.360] RICO because it appears as though anyone who chooses to plead not guilty and fight their
[38:47.360 --> 38:54.320] case are subject to this routine where they're called into court and then have to stay in
[38:54.320 --> 38:59.080] town waiting for the court for a week and then they don't get to them and then they
[38:59.080 --> 39:05.560] have to come back again over and over and over to make it virtually impossible to fight
[39:05.560 --> 39:06.560] your case.
[39:06.560 --> 39:14.680] So you're probably an anomaly and I do suggest you go down and carefully examine the records
[39:14.680 --> 39:25.360] and see how many people actually have a full blown trial in that court on criminal issues.
[39:25.360 --> 39:26.560] It will surprise you.
[39:26.560 --> 39:30.960] The last time I went through the records in the county I live in, it's a relatively small
[39:30.960 --> 39:44.440] county, I did January to July 1631 felony conviction, felony indictments brought one
[39:44.440 --> 39:49.280] person plead not guilty by the public record.
[39:49.280 --> 39:53.000] He was prosecuted, found guilty, headed overturned on appeal.
[39:53.000 --> 39:56.800] One trial, they couldn't get it right.
[39:56.800 --> 40:06.160] You will probably find something very similar and that goes directly to RICO.
[40:06.160 --> 40:12.360] Now just for the record I knew this would happen but I did it correctly and I got it
[40:12.360 --> 40:18.200] on the record perfectly and that is when they held the rifle up I said objection, this infringes
[40:18.200 --> 40:23.400] my second amendment right to keep and bear arms and he overruled it and 50 people sat
[40:23.400 --> 40:25.520] there and listened to him and I did it right.
[40:25.520 --> 40:30.080] I wasn't screaming or rolling around on the floor being disruptive because that's what
[40:30.080 --> 40:31.320] they're always going to go to.
[40:31.320 --> 40:36.920] No, I just sat there and did it and then in my directed verdict I said the same thing,
[40:36.920 --> 40:40.760] second amendment right violation and he overruled it.
[40:40.760 --> 40:44.760] So if there's any question it's on the paper.
[40:44.760 --> 40:52.320] Yes, the whole thing is your only purpose in the trial court is setting the record for
[40:52.320 --> 40:53.520] appeal.
[40:53.520 --> 40:58.880] Now I had the land title that had private property but as soon as I pulled that out
[40:58.880 --> 41:04.640] the DA started screaming and they suppressed that but I did so much hooping and hollering
[41:04.640 --> 41:07.120] that the jury certainly heard it.
[41:07.120 --> 41:12.480] I waved that thing around in the air, here's the owner, they still suppressed it.
[41:12.480 --> 41:18.200] Now I got a question is I tried to read my affidavits into the record and they denied
[41:18.200 --> 41:23.080] me they suppressed it and I objected, you're denying me the right to due process.
[41:23.080 --> 41:28.200] It doesn't matter overruled and I said objection I take a rule to your exception just like
[41:28.200 --> 41:35.200] what you taught me and so I but I never did get to read my affidavits into the record
[41:35.200 --> 41:41.240] because they kept cutting me off and the same thing with the land title but I did so much
[41:41.240 --> 41:49.720] griping that he allowed those to be in marked identification only and I said well is that
[41:49.720 --> 41:56.960] going to my appeal and he said it is on the record.
[41:56.960 --> 42:01.680] I don't quite understand what that meant does that mean it's not going to appeal or it is
[42:01.680 --> 42:02.680] or?
[42:02.680 --> 42:11.000] Oh you've already brought up the affidavits and if you did you take this stand to testify?
[42:11.000 --> 42:15.280] Yes and I started reading the affidavits.
[42:15.280 --> 42:20.160] And they objected you to your reading of a prepared statement?
[42:20.160 --> 42:24.640] Yes I got about six words out and everybody started screaming and then as soon as it quieted
[42:24.640 --> 42:29.720] down I said about two or three more words and then they all started screaming again
[42:29.720 --> 42:35.320] and then the judge ordered me not to read that.
[42:35.320 --> 42:40.480] That's when you should have asked that it be entered into the record?
[42:40.480 --> 42:44.480] Well I did enter it into the record and he refused to enter it into evidence.
[42:44.480 --> 42:52.000] So he denied you in your right to present evidence in your defense?
[42:52.000 --> 42:56.760] Well I said you denying me right to due process was that incorrect?
[42:56.760 --> 42:57.760] That was correct.
[42:57.760 --> 43:07.440] Oh that was correct good well finally I even stated case law tool versus state an unrefuted
[43:07.440 --> 43:13.200] affidavit stands as truth and I got that in twice.
[43:13.200 --> 43:17.840] Good good this is good this is good.
[43:17.840 --> 43:23.400] Then they got me up on the stand and the DA who was normally a smart aleck said something
[43:23.400 --> 43:30.640] really stupid they wouldn't let that land title get into the evidence but then he got
[43:30.640 --> 43:35.920] up and said Mr. Hill did you know that you're on campus property and I said actually it's
[43:35.920 --> 43:41.320] not the land title right here states that the owner owns it or it's private property
[43:41.320 --> 43:47.520] it's privately owned and I thought he was going to fall apart.

[46:52.600 --> 46:57.240] okay we are back Randy Kelton Deborah Stevens rule of law radio we're talking to Jeff in
[46:57.240 --> 47:06.200] Mississippi Jeff who even though he lost he won this is probably the best you could expect
[47:06.840 --> 47:10.760] and you did well so in the courtroom
[47:10.760 --> 47:24.600] he led you back to the title of the property yes and all the evidence that they had entered
[47:24.600 --> 47:31.960] they entered a photograph no date I object objection three documents had dates on them
[47:31.960 --> 47:38.040] after my arrest because there were computer screens so they had been updated and they
[47:38.040 --> 47:46.840] said like 2011 2010 I got arrested in or 2011 2012 and I got arrested in 2010 so I jumped
[47:46.840 --> 47:53.640] up and said contamination there's been information entered onto that for a year after this thing was
[47:53.640 --> 48:01.560] brought into court so I objected here there were no signatures not one valid date no printing
[48:01.560 --> 48:05.640] all the evidence I asked him if they printed it are you the one that typed it nope do you
[48:05.640 --> 48:11.640] know who did nope I have no idea so um what were you going to ask me
[48:14.360 --> 48:20.760] you didn't get a court I forgot what I was going to ask you well I'm sorry I went off
[48:20.760 --> 48:28.840] I'm old I do that well I'm excited you should be you did good you did a lot better in court
[48:28.840 --> 48:37.160] than I did I did a lot better in court than I thought I would I was able to think in anything
[48:37.160 --> 48:43.000] that came up that looked weird I just jumped on it and you know maybe 50 percent of that was
[48:43.000 --> 48:51.960] was pointless but who cares psychologically I had those people crushed the da it took two of them
[48:51.960 --> 48:55.720] two of them came in against me and they took turns because one of them would get tired
[48:55.720 --> 49:04.840] and I cut them down pretty good but I got two big questions the first one is at the end of the trial
[49:04.840 --> 49:10.760] I said I said to the judge now I need to file for an appeal and I need to hold stop hearing
[49:10.760 --> 49:20.840] hold on stop I remember the question oh when the prosecution wested did you ask that the case be
[49:20.840 --> 49:27.960] dismissed for lack of evidence yes I said the defense moves for a directed verdict in my favor
[49:28.840 --> 49:36.120] was that incorrect or correct that was perfect okay and then I read off about 20 things
[49:36.120 --> 49:43.960] violation of the rules of evidence uh violation um the state did not have a single could not prove
[49:43.960 --> 49:49.400] anything because all the uh documents were hearsay I didn't say it like that I'm just
[49:49.400 --> 49:55.560] glossing it over uh lack of the accuser Andrew Hatton is missing lack of the police report it's
[49:55.560 --> 50:00.920] not signed and dated second amendment state constitution I went through about 20 of them
[50:00.920 --> 50:07.560] there are no postings that the code says warning signs need to be posted and the judge overruled
[50:07.560 --> 50:17.400] every one of them that that's that was to be expected okay but is that good that is perfect
[50:17.400 --> 50:22.440] okay great because I actually read them off a piece of paper so I didn't fumble or
[50:22.440 --> 50:28.600] uh slip my tongue or anything and say anything backwards I actually spoke it well wonderful
[50:30.120 --> 50:36.440] this will set your appeal uh if they kicked it back the first time almost certainly they're
[50:36.440 --> 50:42.360] going to kick it back this time this time they may dismiss all right oh you mean the appeals
[50:42.360 --> 50:49.160] court can dismiss oh absolutely I did not know that I thought it would now do I get an appeal
[50:49.160 --> 50:54.280] I mean that's kind of a crazy question but I've already won my appeal went back can I go back
[50:54.280 --> 51:02.520] again yeah this was a new trial so everything starts over that I knew that I just um okay
[51:02.520 --> 51:09.240] well okay I've got a very strange question at the end of the trial I said to the judge I need now I
[51:09.240 --> 51:14.280] need to file for this appeal and I need to file for a motion for a new trial right now and he said
[51:14.280 --> 51:21.880] consult with your attorney my attorney got up and ran out of the courtroom and I yelled at him and
[51:21.880 --> 51:27.240] said hey I don't have your phone number and he says I'm not giving it to you then he took off
[51:28.120 --> 51:36.120] perfect now and he left so I drove back to Arkansas without filing for an appeal and without
[51:36.120 --> 51:44.360] filing for a motion for a new hearing now how long how long do you have to get that in I think I've
[51:44.360 --> 51:49.400] got 30 days but I don't have this guy's phone number or email he's never sent me anything oh
[51:49.400 --> 51:57.320] this is good so what I did was today and this is this was my own thinking but it was I was thinking
[51:57.320 --> 52:03.080] as if you were sitting in the car with me so I kind of got that comical Batman Joker thing
[52:03.080 --> 52:09.080] going on and just for kicks I went and filed an affidavit that stated that that my attorney ran
[52:09.080 --> 52:13.960] out of the courtroom without giving me contact information or filing for my appeal and new trial
[52:14.760 --> 52:21.080] and I put that on an affidavit and and mailed that to the clerk today and then I did the same
[52:21.080 --> 52:26.680] thing with the bar grievance my attorney ran out of the room refused to give me his phone number
[52:26.680 --> 52:33.080] attorney ran out of the room refused to give me his phone number didn't file for my appeal and I'm
[52:33.080 --> 52:39.960] asking for sanctions for him abandoning his post that got in the post office today what do you think
[52:40.680 --> 52:49.160] I think that's great they probably set this poor chump lawyer up because they needed a sacrificial
[52:49.160 --> 52:58.840] lamb okay and he needs to be crucified okay but I still don't have I still don't have a new trial
[52:58.840 --> 53:05.400] hearing or rescheduling I'm not see last time okay notice it notice of appeal is just I hereby give
[53:05.400 --> 53:12.760] the court notice of my intention to appeal you file that a motion for a new trial now that's
[53:12.760 --> 53:21.880] it's generally a lot different a you need to request a findings of fact and conclusions at law
[53:23.000 --> 53:28.920] no I'm not I'm not sure I need Steve Steve's probably better at this part because he's
[53:28.920 --> 53:37.720] he was working for a lawyer but I've lost Steve all together okay uh in a criminal trial you need
[53:37.720 --> 53:47.800] to it to go through this and address all of the issues that you can remember and just jot them
[53:47.800 --> 53:53.560] down yeah John to make it since it's been has it been long sit down and write down everyone you
[53:53.560 --> 54:04.840] can remember write a timeline of the hearing and also request a a transcript well okay that's the
[54:04.840 --> 54:11.720] next question the court reporter wants to charge me about 1600 dollars you've been aren't you uh
[54:11.720 --> 54:19.240] haven't you been designated uh indigent indigent yes you can't charge her okay good who do I
[54:19.240 --> 54:24.280] who do I because when I wrote the clerk she just put me back to the court reporter oh you'll have
[54:24.280 --> 54:31.400] to talk to her yeah it is the court reporter but let me tell you a little court reporter story
[54:31.400 --> 54:37.640] okay we had a court reporter that was there was they came to court there was no court reporter
[54:37.640 --> 54:46.840] there nobody told her to be there so the judge ordered a this was a family court issue but there
[54:46.840 --> 54:56.520] was a representative for the district attorney's office there she was some kind of uh ad litem
[54:56.520 --> 55:01.640] ad litem something she was there to advise the court or something anywhere her name's Ann Diamond
[55:01.640 --> 55:06.280] she's ahead of their the civil section of the Tarrant county district attorney's office
[55:07.400 --> 55:17.480] and the judge ordered her directed her to to to notify this court reporter to be in court on the
[55:17.480 --> 55:21.320] date of the next hearing they go to the next hearing the court reporter's not there
[55:21.320 --> 55:29.720] so Ken helps this woman file a professional conduct complaint against the court reporter
[55:31.320 --> 55:38.360] now while these judges and lawyers protect one another if you're not a judge or a lawyer
[55:38.360 --> 55:44.440] they'll throw your behind under the bus in a heartbeat this woman this woman had to go down
[55:44.440 --> 55:51.560] this woman had to go down from Tarrant county is 200 miles from Austin or from Fort Worth had to
[55:51.560 --> 56:01.880] go to Austin to a hearing before their the licensing board and if she didn't agree with
[56:01.880 --> 56:07.080] that with their ruling then she would have be subject to criminal prosecution
[56:07.080 --> 56:12.600] so she could go before this licensing board or they could prosecute her criminally
[56:13.640 --> 56:21.480] okay and they went down there and the the prosecutor said oh I told her and she said no I didn't so the
[56:21.480 --> 56:29.000] prosecutor is throwing her behind under the bus all right so going after the court reporter for
[56:29.000 --> 56:37.000] charging you when you are have been declared indigent you should do a professional conduct
[56:37.000 --> 56:42.040] complaint against the court reporter well she hasn't done it formally she just I just sent her
[56:42.040 --> 56:48.360] an email and she returned and said you know that's formal it that's written it's oh through an email
[56:48.360 --> 56:54.360] okay oh yeah so I so I don't have to do a public records request I can just send her an email
[56:54.360 --> 57:00.440] saying I'm indigent send me the send me the transcript right now and if you have you already
[57:00.440 --> 57:07.240] emailed her and asked her for it I did I did about two months ago for the other one okay send her one
[57:07.240 --> 57:15.000] for this one and see if you can get her to do the same thing and insisting that I send her $1,600
[57:16.520 --> 57:22.920] no don't yeah don't send her $1,600 women when did how do you know it's $1,600 for this woman
[57:22.920 --> 57:29.960] $1,600 for this one uh three hundred uh three three dollars a page and um there's about
[57:29.960 --> 57:38.280] 520 pages or something or you know good good get her to to tell you how much it'll be
[57:40.040 --> 57:47.080] and you know this is the tar baby thing yeah I got this little tar baby you want to touch it
[57:47.080 --> 57:56.920] it go ahead bill me you don't go back to her and say oh blah blah you shouldn't have billed me I'm
[57:56.920 --> 58:03.880] indigent blah blah blah no no no don't argue with her about it go to the professional licensing
[58:03.880 --> 58:13.240] board about it let her explain it to them okay and then if she has been instructed by the judge
[58:13.240 --> 58:19.880] she'll throw the judge under the bus now there is a chance you guys may lose me
[58:21.960 --> 58:28.200] all right I'm up here in Dallas Fort Worth area and we have a really big squall line coming at us

[01:03:18.920 --> 01:03:35.640] so
[01:03:48.920 --> 01:03:57.160] was created equally, let's chant down Babylon and do it daily, and when night comes let's
[01:03:57.160 --> 01:04:04.920] get everybody, so one by one we have to chant them man, we check down Babylon because Babylon
[01:04:04.920 --> 01:04:12.760] is wrong, the only right man to say is the rest man, we take Mr. Ladman, the bowian man,
[01:04:12.760 --> 01:04:20.200] to chant down Babylon now, not later, to let Babylon now say we getting greater, we
[01:04:20.200 --> 01:04:28.600] bite the donkey, Mr. Choo, tell a lie, say Jesus Christ shall rescue us. Okay, we are back, Randy
[01:04:28.600 --> 01:04:32.280] Kelton, Deborah Stevens, we have our radio and we're talking to Jeff in Mississippi.
[01:04:33.400 --> 01:04:37.400] Okay, Jeff, I was kind of busy on the break, I've had a big storm that's coming in about
[01:04:37.400 --> 01:04:44.680] an hour earlier than we expected, where were we when we went out, oh we were talking about
[01:04:45.240 --> 01:04:51.320] the court reporter and Deborah and I discussed this off the air, she said that you know you
[01:04:51.320 --> 01:05:03.480] ought to give her notice that you're indigent and it goes against my philosophy, never give fair warning.
[01:05:03.480 --> 01:05:11.320] Now that may be socially correct in a civil setting, but this is not a civil setting, this is law
[01:05:12.840 --> 01:05:22.840] and here Bushwhack rules today, if you've been declared indigent then she has knowledge of it,
[01:05:24.120 --> 01:05:29.080] whether she has actual knowledge or not, it's irrelevant, she has imputed knowledge because
[01:05:29.080 --> 01:05:38.040] it's public, it's in the public record, so you ask her for the transcript, she sends you a bill,
[01:05:38.840 --> 01:05:46.520] you take the bill and the declaration of indigency and you send it to the professional standards
[01:05:46.520 --> 01:05:51.080] board and they're going to come back and land on her and she's going to run to the judge,
[01:05:51.080 --> 01:05:59.400] save me, save me from the bad guy, give the judge, give them a reason not to mess with you.
[01:06:00.440 --> 01:06:07.560] Okay. You don't know or anything, they certainly will not cut you one half ounce of slack.
[01:06:08.920 --> 01:06:11.400] She yelled at me in the courtroom so I'd love to do that.
[01:06:12.680 --> 01:06:17.720] What she did what in the courtroom? She told me to shut up in the courtroom so I'd love to do that.
[01:06:17.720 --> 01:06:26.600] The court reporter did? Yeah, I had gotten up and started arguing with the DA and the
[01:06:26.600 --> 01:06:30.680] judge was saying silence, silence and then she turned around and said shut up.
[01:06:32.280 --> 01:06:40.360] Whoa, that definitely should get, she's interfering with your court case.
[01:06:40.360 --> 01:06:47.160] Oh okay. Court reporters sit there and keep their mouth shut. She yelled it louder than the DA or
[01:06:47.160 --> 01:07:00.680] the judge, she flipped. Whoa, then you definitely need to file on that and then file on her trying
[01:07:00.680 --> 01:07:08.920] to charge you when she knows you're indigent. Okay. The professional standards board said
[01:07:08.920 --> 01:07:16.760] professional standards boards like to likely sting her good. Okay. I suspect they don't get
[01:07:17.960 --> 01:07:25.320] called on their behavior very often. So for a court reporter to speak out in the courtroom,
[01:07:26.840 --> 01:07:33.320] I've never heard of that. Well, I took everybody to the limit. I took them to the edge.
[01:07:33.320 --> 01:07:38.280] Well, good. That's where they make the most mistakes.
[01:07:39.640 --> 01:07:46.120] Oh yeah. Last question, that is I want to get this judge. I've tasted a little bit of blood.
[01:07:46.120 --> 01:07:50.360] This was the first trial that I actually felt bones breaking under my power.
[01:07:51.400 --> 01:07:56.520] I mean, it really felt like I had somebody in a headlock and I could hear snapping and crackling.
[01:07:56.520 --> 01:08:05.720] Now you need follow through. Okay. So I asked a friend and he's not a lawyer,
[01:08:05.720 --> 01:08:11.480] but he knows a little bit. So I just wanted to run it by you. I said, okay, now this is done.
[01:08:11.480 --> 01:08:17.080] And he said, you know, you ought to do what is called a writ of supervisory control and get that
[01:08:17.080 --> 01:08:21.800] judge in front of a panel of other judges. Now I didn't understand what he was talking about,
[01:08:21.800 --> 01:08:27.400] but in Mississippi rules or in the statutes, they have one called temporary relief.
[01:08:27.400 --> 01:08:32.520] I don't know what that means. Prohibition to a judge or other extraordinary writs,
[01:08:32.520 --> 01:08:36.600] but none of them say writ of supervisory control. So I'm kind of lost there.
[01:08:37.160 --> 01:08:45.560] That has to be administrative. Have you looked at the judicial canons for Mississippi?
[01:08:45.560 --> 01:08:51.160] Yes, I have as far as bias and prejudice and disqualification.
[01:08:51.160 --> 01:09:00.600] Okay. Is there, there should be another set of codes that go to discipline.
[01:09:01.880 --> 01:09:05.640] Okay. Discipline of a judge. Yeah. Okay. Look in those.
[01:09:05.640 --> 01:09:11.400] That's probably where you're going to find this. Okay. Good. I'll do that. I read the,
[01:09:11.400 --> 01:09:16.280] I read the uniform bonding code and everybody said, what is that? And I said,
[01:09:16.280 --> 01:09:21.240] I'm going to need the DA's bond policy number. And they said, well, we're not going to do that.
[01:09:21.240 --> 01:09:26.760] And I read a DA shall lose their license if they refuse to give a citizen their bond
[01:09:26.760 --> 01:09:33.480] policy number or the address of the bonding company. So did they give it?
[01:09:34.440 --> 01:09:38.680] No, absolutely not. They just said, oh, the court's not going to require that
[01:09:38.680 --> 01:09:41.320] right now where the court's not going to require that.
[01:09:43.880 --> 01:09:49.960] Now you get to go after it. Okay. You need to look at how to go after him for that.
[01:09:51.000 --> 01:09:55.720] Well, they claimed that they said, what is the uniform brand bonding code? Is that federal or
[01:09:55.720 --> 01:10:01.480] state? And I first, I just kind of shrugged and didn't answer. And then they kind of threw that
[01:10:01.480 --> 01:10:11.640] back and forth. And then they said, we don't know what that is. Your problem, not my problem.
[01:10:12.920 --> 01:10:19.880] So is this a Mississippi state code? No, the uniform bonding code. A friend,
[01:10:19.880 --> 01:10:23.880] that same friend of mine just told me to go look up the uniform bonding code.
[01:10:24.600 --> 01:10:29.400] And I did. And it just says uniform bonding code. It has something to do with federal and state.
[01:10:29.400 --> 01:10:36.040] So I'm thinking it's a country wide, but I just don't know the history of it.
[01:10:36.920 --> 01:10:44.360] Okay. What it may be is something similar to the uniform penal code and uniform code
[01:10:44.360 --> 01:10:50.360] of criminal procedure that the feds put together and tried to get all the states to adopt
[01:10:51.400 --> 01:10:55.640] so that the codes across the country were essentially uniform.
[01:10:55.640 --> 01:11:03.960] Okay. And that may be why they didn't recognize it. So they're going to have some kind of bonding
[01:11:03.960 --> 01:11:13.080] code. They'd probably call it something else. Okay. You might look at the origin of the uniform
[01:11:13.080 --> 01:11:20.600] bonding code, see who put it together. Okay. And contact that office. And they can probably
[01:11:20.600 --> 01:11:26.440] tell you, if it is a suggested uniform code, they can tell you every state that has adopted it.
[01:11:27.240 --> 01:11:31.640] Oh, great. Okay. And what code they adopted it into.
[01:11:32.520 --> 01:11:37.080] Okay. But I asked for a bond and they refused to give it up.
[01:11:39.080 --> 01:11:45.640] Oh, good. You know, that goes to the philosophy of never ask a public official to do anything
[01:11:45.640 --> 01:11:50.760] you actually want them to do. Uh-huh. I've never done that before. So I don't know how important
[01:11:50.760 --> 01:11:55.160] that is. The bonding thing?
[01:11:55.160 --> 01:12:00.280] Yeah. If you, you know, go in and say, I need to see your bond. I've heard people, some people say
[01:12:00.280 --> 01:12:05.320] that's a waste of time. And then I've heard other people say that the judge or the DA will go in
[01:12:05.320 --> 01:12:09.400] there and commit suicide if you do that. I've heard both and I really don't know. I just did it.
[01:12:09.400 --> 01:12:16.360] Yeah. I've, I've heard, there's a lot of things out there that people read and they think it's
[01:12:16.360 --> 01:12:22.520] some kind of a silver bullet. There are no silver bullets, but what you may well have done
[01:12:23.320 --> 01:12:31.560] is established a claim against them. It's just setting a record.
[01:12:32.360 --> 01:12:37.480] Okay. If they're, if they are required to produce it, they didn't, you can't,
[01:12:37.480 --> 01:12:43.480] if they are required to produce it and they didn't, you got them not to. And if in Mississippi, they don't call it the
[01:12:43.480 --> 01:12:48.040] uniform bonded code, they call it somebody, something else, doesn't make any difference.
[01:12:48.920 --> 01:12:56.360] One thing I stopped doing is giving legal advice to public officials.
[01:12:59.240 --> 01:13:04.840] I asked them for what the law requires them to give me and I don't tell them why they're
[01:13:04.840 --> 01:13:11.480] supposed to give it to me. Like that JP, when I asked him if he had accommodation for the hearing
[01:13:11.480 --> 01:13:20.200] impaired, I just set him up and walked him down the steps. He didn't. So you have a sound system here.
[01:13:20.200 --> 01:13:25.080] Will you turn it up? No, I will not. Well, then will you speak up? No, I will not. I just walked him down
[01:13:25.080 --> 01:13:30.360] the steps so that I could nail him with the Americans with Disabilities Act. Last thing I was
[01:13:30.360 --> 01:13:36.360] going to do is tell him about the American Disabilities Act. Got it. He would have ruined everything.
[01:13:38.120 --> 01:13:45.880] Bushwhack. Bushwhack is a really good strategy. Once they realize you're bushwhacking them,
[01:13:45.880 --> 01:13:52.920] they get a lot more careful and that's what you want. Okay. All right, we'll all add some other
[01:13:52.920 --> 01:13:58.760] collars. I apologize for taking so long, but it's kind of a big night for me. This is wonderful.
[01:13:58.760 --> 01:14:05.480] This is good news. You're much better in court than I was. Well, I want to let everybody know
[01:14:05.480 --> 01:14:13.320] that an average Joe like me and like you can walk in and sure it's tough. You get kicked in the teeth,
[01:14:13.320 --> 01:14:20.280] but a guy like me can pull off a stunt like that than anybody can. So I want to open the door for
[01:14:20.280 --> 01:14:27.000] other people to start going into court and fighting. And this is the way we will get these guys to stop
[01:14:27.000 --> 01:14:32.520] pulling a lot of the garbage. If they wind up with somebody like you coming back at them from every
[01:14:32.520 --> 01:14:39.000] direction you can and the first time somebody says something to you about it, you file against them.
[01:14:40.600 --> 01:14:47.800] Okay. Well, next week I will ask you, I accused the DA of falsifying the mandatory checklist
[01:14:47.800 --> 01:14:55.080] and the DA blamed the foreman of the grand jury. So next week I'll ask you if I should bring charges
[01:14:55.080 --> 01:15:00.360] against the foreman of the grand jury against the very, uh, to the very same DA in court.
[01:15:01.080 --> 01:15:09.800] Absolutely. Oh, that is great. I once told my district attorney when the
[01:15:09.800 --> 01:15:16.520] same district attorney that tried to defend herself. Oh, wonderful. She threw the foreman
[01:15:16.520 --> 01:15:23.160] under the bus. Well, I accused the DA of falsifying the mandatory, which it is.
[01:15:23.160 --> 01:15:27.800] It says that it's got a signed statement from the witness. Well, I'm holding the police report and
[01:15:27.800 --> 01:15:35.320] it's not signed. Plus it was sealed up until six months ago. So of course it's a lie. And then the
[01:15:35.320 --> 01:15:39.240] DA jumped up and said, Oh, no, the only person that could have done that would have been the
[01:15:39.240 --> 01:15:46.280] foreman of the grand jury. And we would have to be calling her a liar. That'll work. So bring
[01:15:46.280 --> 01:15:52.360] charges against the foreman to the very DA that got up and, and, and, and was defending herself.
[01:15:52.360 --> 01:15:59.400] Right. Oh, absolutely. Then the foreman will throw whoever will most likely throw the prosecutor or
[01:15:59.400 --> 01:16:05.880] the judge under the bus. Good. Okay. Well, I'll bring that up next time and I'll let you guys move
[01:16:05.880 --> 01:16:12.360] on to the next caller and I sure appreciate everything you've done. Well, I'm glad to see.
[01:16:13.080 --> 01:16:20.360] It's always nice when the student out does the master and I'm being facetious calling myself
[01:16:20.360 --> 01:16:27.960] the master because I'm just a chomp like the rest of you. Yeah. Yeah. This time chomp, but I'm
[01:16:27.960 --> 01:16:35.240] getting there. Okay. Thanks a lot, Jeff. Thank you. You're here. You're the, you're the reason we do

[01:19:20.840 --> 01:19:21.880] Don't blame me
[01:19:21.880 --> 01:19:25.080] Ain't gonna blame me
[01:19:29.880 --> 01:19:35.480] Okay, we are back. Randy Kelton, Debra Stevens, Wheel of Law Radio and we're going to Patrick
[01:19:35.480 --> 01:19:39.960] in Texas. Hello Patrick, what do you have for us today? Good evening Randy, how are you doing?
[01:19:41.480 --> 01:19:49.560] Oh, a little iffy at the moment. You sound like it. I'm right on the leading edge of a pretty big
[01:19:49.560 --> 01:19:56.840] squall line so if I drop off, don't pay, don't think anything of it, Debra, pick it right up
[01:19:57.400 --> 01:20:03.000] but there's a good chance I could get knocked off line. All right, that sounds fair. I know
[01:20:03.000 --> 01:20:10.120] this is a quick kind of discussion for you. Get a property that backs up to a, I guess a wet
[01:20:10.120 --> 01:20:18.360] weather creek that has not been maintained by a school district for going on seven years. I've
[01:20:18.360 --> 01:20:25.720] maintained it and we've got a fence back there that was inside my property line but I wanted to
[01:20:25.720 --> 01:20:31.320] see if you could help me out a little bit with any of these adverse possession type discussions
[01:20:31.320 --> 01:20:38.600] in reference to that property because I'm tired of having to maintain it for free and obviously
[01:20:38.600 --> 01:20:42.920] the school district doesn't seem to put on their maintenance schedule and so if anything you can
[01:20:42.920 --> 01:20:48.680] provide me with or help me with, I'd appreciate it. Okay, have you? Okay, you have maintained it,
[01:20:48.680 --> 01:20:58.760] you've got loaded and cut the weeds and such? Exactly. Has the school board tried to use the
[01:20:58.760 --> 01:21:06.760] property for anything in this time? No, it's just a wet weather creek that runs through a subdivision
[01:21:06.760 --> 01:21:10.600] and they don't maintain any part of it on any roads through that subdivision over about a
[01:21:10.600 --> 01:21:19.960] two mile stretch. Did the school board or the school district give you permission to use this
[01:21:19.960 --> 01:21:26.360] property? I have not asked. I'm in the trying to figure this out phase, whether I demand them to
[01:21:27.160 --> 01:21:34.840] maintain on the schedule and just let them have it or do I do something else and enjoy it privately
[01:21:34.840 --> 01:21:42.440] when it rains, I've got a nice little creek. Okay, file a adverse, has it been seven years?
[01:21:43.960 --> 01:21:49.560] Yes sir, 2007, June 2007 would be the ownership date of the property.
[01:21:51.160 --> 01:21:56.360] So June 2014, you're 11 months over,
[01:21:56.360 --> 01:22:07.080] seven year mark, filed for adverse possession. Okay. Now, I don't really know how exactly how
[01:22:07.080 --> 01:22:16.360] to do that. I know you can, it's not, I've dealt with adverse possession quite a bit,
[01:22:16.360 --> 01:22:23.320] but I've never actually filed for adverse possession. Okay, well sure it's going to be
[01:22:23.320 --> 01:22:31.160] a heck of a fight because the school district is in a pretty, you know, financial environment.
[01:22:31.160 --> 01:22:39.720] What I suggest is, is you fence it with some type of marker and then put a no trespass sign
[01:22:40.440 --> 01:22:49.880] facing outside your property. Okay. Or purple ribbons. Okay. A purple ribbon,
[01:22:49.880 --> 01:22:57.240] two feet long, one inch wide is a no trespassing sign in Texas. Oh, nice. Okay.
[01:22:57.800 --> 01:23:04.040] Yeah, so they don't have to know what it means. Right. Their problem, not your problem,
[01:23:04.040 --> 01:23:10.760] but once you put the no trespassing sign up there, then they're likely to raise an issue.
[01:23:10.760 --> 01:23:18.920] And when they raise the issue, your defense is adverse possession that you've held it and
[01:23:18.920 --> 01:23:24.520] maintained it in excess of seven years. And primarily adverse possession was for public lands.
[01:23:26.040 --> 01:23:31.800] For public lands. Okay. Yeah. It's squatters rights. That's the popular vernacular.
[01:23:32.680 --> 01:23:36.600] Okay. Any, any property that's not being used,
[01:23:36.600 --> 01:23:45.720] you know, we had a lot of large landowners that were granted huge tracts of land and some of it,
[01:23:45.720 --> 01:23:51.480] they never saw, never used, never do anything with. And the squatter's rights were developed
[01:23:51.480 --> 01:23:57.000] to get people to move into Texas so that they could go to land that wasn't being used and just
[01:23:57.000 --> 01:24:02.440] take it. If you find a property that's all run down and nobody's taking care of it, you go in
[01:24:02.440 --> 01:24:06.760] and take care of it for seven years. There's actually a provision you can take it in four years.
[01:24:07.560 --> 01:24:12.920] And in that one, you say, this part, this is, it goes to abandoned property
[01:24:13.800 --> 01:24:20.440] that I've maintained it. When you first take it over, you photograph yourself with a newspaper
[01:24:22.120 --> 01:24:27.720] and then clean it all up and photograph yourself with a newspaper. And then after four years,
[01:24:27.720 --> 01:24:32.760] you go to the, the, the best way to do this is look for a property that's not on the tax roll.
[01:24:35.080 --> 01:24:41.800] That's nobody's paying the taxes on, maybe the city's taking it back or they, they, it's on there.
[01:24:42.440 --> 01:24:47.560] You know, they try to auction off properties and a lot of it never gets purchased. You can just take
[01:24:47.560 --> 01:24:51.880] it over and you go to the court after four years and say, I've maintained this property. I paid
[01:24:51.880 --> 01:24:59.400] the taxes on it. I want you to grant me this property and you have to publish this in some kind
[01:24:59.400 --> 01:25:05.640] of local publication for 30 days. And then the judge will ask you if you did that and you say,
[01:25:05.640 --> 01:25:11.560] yes. And then he'll look out on the courtroom and he'll say, do I hear any objections? Well,
[01:25:11.560 --> 01:25:16.840] it won't be anybody out there. Boom, he'll give it to you. The reason he does that is
[01:25:16.840 --> 01:25:22.840] they want this property back on the tax rolls. That's, that's somewhat different.
[01:25:23.640 --> 01:25:29.400] You've held it and maintained it for seven years. They have a problem.
[01:25:31.400 --> 01:25:37.800] So, you know, they may want to get into a long protracted court battle and they may not,
[01:25:37.800 --> 01:25:47.000] probably all of the school board is a, the school district is going to want is an easement.
[01:25:48.680 --> 01:25:53.800] Does this, does this connect directly to some property that they're actually using?
[01:25:55.400 --> 01:26:01.000] It does connect. I mean, it's a wet weathered creek bed and it runs,
[01:26:01.000 --> 01:26:04.040] it runs about two miles through, you know, underneath different roads.
[01:26:04.040 --> 01:26:11.240] Yeah. But does the school district have a campus on the other side of the creek?
[01:26:12.120 --> 01:26:17.960] Yeah, they do. They have, they have a campus of actually two different locations in connection
[01:26:17.960 --> 01:26:22.200] with where this thing runs up next to. Well, did they have one across the creek
[01:26:22.200 --> 01:26:27.400] from where you're at? Oh no, it's the long creek and nothing else. Just a bunch of houses in a
[01:26:27.400 --> 01:26:34.360] developed subdivision. Well, it doesn't make sense. How does the school district hold that property?
[01:26:35.160 --> 01:26:38.760] That's my question. Look on the tax rolls and it's got a zero dollar value for taxation,
[01:26:38.760 --> 01:26:41.640] which I guess maybe is good. I'm sure I'm paying for it one way or another,
[01:26:42.280 --> 01:26:47.240] but they own this creek, this wet weather creek that runs through a subdivision.
[01:26:47.240 --> 01:26:52.280] And I just, I don't understand it. It doesn't make sense to me. I thought it was a city,
[01:26:52.280 --> 01:26:56.840] obligation to maintain this thing. And I called them and they said, no, actually that's owned by,
[01:26:56.840 --> 01:27:02.440] you know, ex school district. I said, okay, why the heck do they own a wet weather creek that runs
[01:27:02.440 --> 01:27:05.880] through two miles of developed neighborhood? It doesn't make sense to me.
[01:27:06.600 --> 01:27:15.960] And there may be some special laws in that regard that might preempt adverse possession.
[01:27:15.960 --> 01:27:21.160] That's what I'm wondering, since they've got enough power to kind of enforce that.
[01:27:21.160 --> 01:27:28.520] Well, it's not about that. It's all about the money. And if it looks like you set things up
[01:27:29.320 --> 01:27:38.040] well, so they're going to have a big fight, then you might, okay, back up. Why do you want to take
[01:27:38.040 --> 01:27:42.520] title to this property? Why do you want to take title to this property?
[01:27:42.520 --> 01:27:49.080] Why do you want to take title to this property? Well, I want to enjoy it. And I want to actually
[01:27:49.080 --> 01:27:55.320] clean it up to a point where it's going to be enjoyable. Right now there's just, you know,
[01:27:55.320 --> 01:28:00.440] all sorts of hazards down there. We've got, you know, they haven't maintained it. So you've got
[01:28:00.440 --> 01:28:06.920] huge ass dips. I had an animal went down there and the water was so deep, it drowned. And there's
[01:28:06.920 --> 01:28:13.880] dead debris and like six, is it deep enough for a child to drown in? Oh, definitely. Yeah. Oh yeah.
[01:28:13.880 --> 01:28:18.760] And I've got a new baby. And so that's another concern of mine is I don't like the fact that
[01:28:18.760 --> 01:28:27.080] you're not handling this and it's a hazard. So you may well, I don't know, this is,
[01:28:27.800 --> 01:28:31.960] this is a waterway. It's going to be, there are going to be different laws for waterways.
[01:28:31.960 --> 01:28:43.080] Okay. They're real picky about waterways in Texas. Sure. I once cut a levy on a stock tank
[01:28:44.280 --> 01:28:50.440] and well, the people all around me, the people downstream from me really had a conniption.
[01:28:52.440 --> 01:28:58.440] And they tried to, they sick the waterboard on us, but the waterboard came out and they wanted
[01:28:58.440 --> 01:29:04.680] to complain because we interfered with a waterway and they were going to get real excited about it.
[01:29:04.680 --> 01:29:08.920] You know, we said, Oh, we didn't interfere with the waterway. Whoever put this levy here,
[01:29:08.920 --> 01:29:15.000] interfered with the waterway. We just un-interfered with it. They went away and left us alone.
[01:29:15.960 --> 01:29:23.560] But they got real sticky about doing anything. As long as you don't do anything to misdirect
[01:29:23.560 --> 01:29:28.760] the flow. Right. And they're going to, they're going to claim they own the water, but
[01:29:30.440 --> 01:29:33.960] this is odd. Not something I've come across before.
[01:29:35.160 --> 01:29:41.800] My main question is why would a school district own a wet water creek? And it makes no sense to me.
[01:29:41.800 --> 01:29:47.400] Yeah, that was, hang on. We're about to go to break. When we think about that over break,
[01:29:47.400 --> 01:29:55.080] Randy Kelton, Deborah Stevens, Rue of La Radio, call it number 512-646-1984. We'll be right back.
[01:30:02.040 --> 01:30:04.840] To say children are a big commitment is an understatement.
[01:30:05.400 --> 01:30:10.440] Raising a family takes enormous energy, love and patience. And of course, lots of money.
[01:30:10.440 --> 01:30:15.320] I'm Dr. Catherine Albrecht and I'll be back with the USDA's shocking estimate of the cost to raise
[01:30:15.320 --> 01:30:21.640] a child. Privacy is under attack. When you give up data about yourself, you'll never get it back
[01:30:21.640 --> 01:30:27.000] again. And once your privacy is gone, you'll find your freedoms will start to vanish too.
[01:30:27.000 --> 01:30:33.160] So protect your rights, say no to surveillance and keep your information to yourself. Privacy,
[01:30:33.160 --> 01:30:38.360] it's worth hanging on to. This public service announcement is brought to you by Startpage.com,

[01:30:45.800 --> 01:30:50.200] Raising a child is expensive, but just how expensive is a real eye-opener?
[01:30:50.200 --> 01:30:56.280] According to the U.S. Department of Agriculture, it costs about $286,000 to raise a middle-class
[01:30:56.280 --> 01:31:02.680] child through age 17. That's nearly $16,000 a year. That estimate includes housing, food,
[01:31:02.680 --> 01:31:07.160] transportation, clothing, healthcare and things like haircuts and music lessons.
[01:31:07.160 --> 01:31:12.360] But it doesn't include one of the biggest expenses parents incur, the cost of higher education.
[01:31:12.360 --> 01:31:18.200] In-state college tuition and fees at public universities currently run about $7,000 a year
[01:31:18.200 --> 01:31:21.640] and they're expected to rise faster than the rate of inflation. Yikes.
[01:31:21.640 --> 01:31:36.840] I'm Dr. Catherine Albrecht. More news and information at CatherineAlbrecht.com.

[01:32:07.560 --> 01:32:12.600] the entire body the nutrients it needs. Did you know the U.S. Government banned the hemp plant
[01:32:12.600 --> 01:32:17.400] from growing in the United States and classified it as a schedule one drug to hide it behind a
[01:32:17.400 --> 01:32:22.200] marijuana plant. People have been confused about this plant for over 80 years and many
[01:32:22.200 --> 01:32:28.440] still don't know what hemp is. So now you know hemp is not marijuana and marijuana is not hemp.
[01:32:28.440 --> 01:32:34.120] They are different varieties of the same species. HempUSA.org wants the world to know these basic
[01:32:34.120 --> 01:32:38.840] facts and to help people understand that hemp protein powder is the best kept health secret

[01:33:07.800 --> 01:33:19.080] Yeah, who you want to chip? Who you take me for? Free Tully? Who you want to chip? I'm not free Tully,
[01:33:19.080 --> 01:33:25.000] you can't chip me. All I'm saying, don't let them chip you in the morning, chip you in the evening,
[01:33:25.000 --> 01:33:31.320] put a chip in your body. And then when you go computer reading, you can't hide me from nobody.
[01:33:31.320 --> 01:33:37.000] When you say chip in your mom, chip in your daddy, chip in your grandpa and the granny,
[01:33:37.000 --> 01:33:42.440] chip in on me, chip in on your baby, chip in on your family, your whole family, chip in on your
[01:33:42.440 --> 01:33:47.560] dad and they get around me, chip in on the beef and you still go eat it, chip in on the fish,
[01:33:47.560 --> 01:33:52.360] them fall in the sea, chip in on the shark and the whale around me. You know, still mankind,
[01:33:52.360 --> 01:33:58.040] going to be crazy, they're taking the theme and they want to be be, social security, they can tell
[01:33:58.040 --> 01:34:01.720] me. No, but when they give me, they'll rip it up and see, I'm chip in when they're on it.
[01:34:01.720 --> 01:34:06.680] Okay, we are back. Brandy Kelton, Debra Stevens, we were on our radio and we're talking to Patrick
[01:34:06.680 --> 01:34:15.480] in Texas and I did a search over the break on Texas Water Code Water Districts
[01:34:17.080 --> 01:34:24.600] and we have lots of them. I have Texas Water Board, Texas Ground Water Conversion,
[01:34:26.120 --> 01:34:33.400] Ground Water Conservation Districts. We have a lot of code on water and that's,
[01:34:33.400 --> 01:34:41.400] I guess, understandable. Essentially, at least where we're at, all the water is owned by Fort
[01:34:41.400 --> 01:34:52.920] Worth and I know in West, in Washington State, you can't catch water in barrels
[01:34:54.040 --> 01:34:58.840] but they'll come out and put you in jail because they claim they own all the water.
[01:34:58.840 --> 01:35:02.840] So, this could turn into something pretty sticky.
[01:35:06.760 --> 01:35:13.240] Patrick, I would suggest that you do some research on the codes concerning water
[01:35:15.320 --> 01:35:19.720] and water conservation because it's likely to be something in there
[01:35:19.720 --> 01:35:30.360] that would preempt not only adverse possession but may even restrict you from even doing anything
[01:35:30.360 --> 01:35:37.080] down there. Right. I mean, is it water or since it's a wet weather, Craig, only when it rains,
[01:35:37.800 --> 01:35:43.160] it's a runoff device so as long as you don't alter the waterway, it's, you know, or the runoff.
[01:35:43.160 --> 01:35:50.120] It's a water course and they're real picky about the water courses. That's what they came after us
[01:35:50.120 --> 01:35:55.320] for. It was essentially a dry creek. The only time they ever got anything in it was when it rained
[01:35:56.760 --> 01:36:06.120] and it did just happen that two days after I cut that levee, we got a six-inch rain in two hours.
[01:36:06.120 --> 01:36:14.520] Forty-two. They tried to blame us for their flood. Sure. Look for somebody to blame liability on.
[01:36:15.400 --> 01:36:23.400] Oh, cutting that levee though was great fun. I bet. I was on a 555 forward backhoe and there's got
[01:36:23.400 --> 01:36:30.280] about a 13-foot reach on the stinger. I was on top of the levee and I had cut it all out in front of
[01:36:30.280 --> 01:36:36.840] me. So in front of me was a drop 13 feet straight down and the guy we were doing it for came and
[01:36:36.840 --> 01:36:41.720] wanted to watch and set up on the fender of that tractor. Well, I stuck the stinger all the way
[01:36:41.720 --> 01:36:46.920] down and rolled the bucket back. So it's pointing straight out away from me, but the stinger is
[01:36:46.920 --> 01:36:51.560] sticking straight down. And then I rolled the bucket. Well, the front of the bucket hit them,
[01:36:51.560 --> 01:36:56.200] hit the dirt and it picked the tractor up. And then the front of the bucket hit the dirt and it
[01:36:56.200 --> 01:37:02.920] picked the tractor up. And as I rolled it over, it just pulled the tractor out over the gap.
[01:37:03.800 --> 01:37:09.480] Well, I'm standing on that stinger, it can't fall. But he didn't know that.
[01:37:10.440 --> 01:37:17.080] He got real excited and decided his wife was calling him to dinner. And he hit the road.
[01:37:17.080 --> 01:37:25.240] That's one of them Disney type rides that you don't know how it's going to turn out.
[01:37:27.960 --> 01:37:31.160] That's kind of what I was trying to figure out. What's the best way to go about this?
[01:37:31.160 --> 01:37:35.400] Because I don't want to get into a long drawn out issue and have TRCC and all these different
[01:37:35.960 --> 01:37:40.520] entities coming and creating a heck of a hell storm to say.
[01:37:41.160 --> 01:37:44.200] Okay. What do you want to do there to the creek?
[01:37:44.200 --> 01:37:47.720] The main thing I want to do is I want to clear out the cedar, because I really don't care for
[01:37:47.720 --> 01:37:54.120] the cedar. And I want to be able to clear out all of the dead debris so that all these snakes and
[01:37:54.120 --> 01:38:02.040] all the issues are resolved and be able to enjoy the view behind the house. And at the same time,
[01:38:02.760 --> 01:38:07.960] I want to resolve the issues with the washout and like a four foot deep
[01:38:07.960 --> 01:38:15.480] settlement point that goes underneath the road where children, animals, et cetera, are at risk
[01:38:15.480 --> 01:38:20.040] of drowning. Because it doesn't look like it's four foot deep. You step into it and you're like,
[01:38:20.040 --> 01:38:25.320] oh, oh, yeah, okay, this is a big hole. Oh, this is where it comes out of a can
[01:38:25.320 --> 01:38:32.120] and then drops and cuts out an undercut? Yeah, there's a huge probably, I don't know,
[01:38:32.120 --> 01:38:41.960] let's say 12, 15, 20 foot galvanized or stainless pipe that runs underneath a neighborhood street.
[01:38:42.680 --> 01:38:49.080] And it's got rusted out rails on each side of it. So they know that there's actually some
[01:38:49.080 --> 01:38:55.320] type of a creek there. But you go down in there and all of it's washed out. There's been no
[01:38:55.320 --> 01:39:03.560] maintenance. There's been not from the watershed aspect all the way down to the grass, the dead
[01:39:03.560 --> 01:39:09.720] limbs. I mean, you get so many problems out of this because it's not maintained. And I don't
[01:39:09.720 --> 01:39:15.320] advocate a bunch of chemicals being brought in. I can help you with the mosquitoes.
[01:39:16.360 --> 01:39:21.160] Okay, that'd be good. Randy's Magic Mosquito Killer.
[01:39:21.160 --> 01:39:24.920] What is it? Go get you a five gallon bucket.
[01:39:25.960 --> 01:39:30.040] Put about three inches of water and dump a little bit of
[01:39:32.520 --> 01:39:39.800] dishwashing detergent in it or any kind of soap. And then get one of these cheap utility lights
[01:39:39.800 --> 01:39:43.880] with a little spring clip where you can clip them on a two by four or something.
[01:39:44.680 --> 01:39:47.960] Yeah. And clip it onto the top of that bucket.
[01:39:47.960 --> 01:39:57.320] Okay. Point the light down in the bucket and go to Lowe's or Home Depot to the to the light section
[01:39:58.040 --> 01:40:05.560] to the party section and get you a fluorescent blacklight. Okay.
[01:40:05.560 --> 01:40:13.320] Screw that. Blacklight. Bugs will kill themselves to get to it.
[01:40:14.360 --> 01:40:15.560] Interesting. Okay.
[01:40:15.560 --> 01:40:23.000] I was building, putting one together in the house because we had a whole bunch of flies all of a
[01:40:23.000 --> 01:40:32.440] sudden. And I had a light that was a spotlight, just a local, a little round light with a flat
[01:40:32.440 --> 01:40:38.280] bottom. And I set it down so it pointed straight up, turned it on and put a blacklight in it and
[01:40:38.280 --> 01:40:42.440] turned it on. And I had a little plastic bowl. I wanted to see how it fit. So I set it on top of it.
[01:40:42.440 --> 01:40:47.720] And as soon as I set it on top of it, bang, bang, two flies bounced off of it.
[01:40:47.720 --> 01:40:54.200] Hey, Randy, let me pipe in here about this blacklight mosquito trap that you invented.
[01:40:54.200 --> 01:41:01.720] I have done this. I did it all summer long. And let me tell you what, it works. Okay.
[01:41:01.720 --> 01:41:06.200] With no chemicals. You have to use a white bucket though. Like at Home Depot, they'll have like the
[01:41:06.200 --> 01:41:10.440] big orange five gallon buckets. You need to use a white bucket and you get one of those little
[01:41:10.440 --> 01:41:16.840] clippy lights, you know, with a small aluminum lampshade and you attach it to the side of the
[01:41:16.840 --> 01:41:23.640] bucket so that the lampshade is down in the bucket and it illuminates the bucket and the water.
[01:41:23.640 --> 01:41:31.720] Now here's how it actually works. Mosquitoes can light on, they can land on water because of the
[01:41:31.720 --> 01:41:36.600] surface tension. All right. They're accustomed to that. They think it's a safe place to land.
[01:41:36.600 --> 01:41:42.360] Well, what happens is they are absolutely, it's irresistible to them, the blacklight.
[01:41:42.360 --> 01:41:50.280] And so they fly down into the bucket and then go up underneath the lampshade to get to the blacklight.
[01:41:50.280 --> 01:41:54.120] Okay. So you get the idea. They go down the bucket and then they go up into the lampshade.
[01:41:54.120 --> 01:41:58.280] The lampshade is pointed down and it's inside the bucket. Well, they circle around for a while
[01:41:58.280 --> 01:42:02.600] and they're just loving life because they're right on this blacklight. Well, after a while,
[01:42:02.600 --> 01:42:07.960] they get tired and there's no place for them to light, a light. Okay. There's no place for them
[01:42:07.960 --> 01:42:12.680] to land. So they look down and they see the water and they think it's a safe place to land.
[01:42:12.680 --> 01:42:18.200] And so they just drop down and they try to land on the water. But because of the soap in the water,
[01:42:18.200 --> 01:42:22.680] the surface tension is cut. It's a much lower surface tension. And so they just sink to the
[01:42:22.680 --> 01:42:27.880] bottom. Gone. Mosquito problem solved. I have caught mosquitoes by the thousands using this
[01:42:27.880 --> 01:42:31.000] method. In fact, it's time to put them out again around the property. We should have done it a
[01:42:31.000 --> 01:42:36.200] month ago, but it'll catch a whole swarm. Okay. You can completely clear the area out with these
[01:42:36.200 --> 01:42:39.240] mosquito traps. I'm telling you, we had like three or four of them around the property.
[01:42:39.240 --> 01:42:44.200] And then because mosquitoes travel in swarms, it seems like they're everywhere all the time,
[01:42:44.200 --> 01:42:48.600] but they're really not. They're in swarms. And so you can kill a swarm. Now, eventually another
[01:42:48.600 --> 01:42:53.080] swarm will travel through the area. So it's not like a one-time deal, but you leave it and you've
[01:42:53.080 --> 01:42:58.200] got to empty out the soapy water every few days when you first start, because it'll catch other
[01:42:58.200 --> 01:43:02.840] stuff too. It'll catch those peanut flies. It'll catch moths, which you want to catch the moths
[01:43:02.840 --> 01:43:08.520] anyway, because those are actually cutworms. Cutworms are moths. Okay. So if you garden,
[01:43:08.520 --> 01:43:12.680] you want to get rid of those moths because the cutworms will kill your garden. And so that'll
[01:43:12.680 --> 01:43:18.360] get rid of your cutworms without using chemicals on your plants. And it gets rid of roaches. It
[01:43:18.360 --> 01:43:21.720] gets rid of all kinds of stuff. And so you've got to dump it out every few days because it gets
[01:43:21.720 --> 01:43:28.520] pretty nasty. But I'm telling you, it works. It is the best mosquito trap ever. Seriously. That's
[01:43:28.520 --> 01:43:34.920] excellent. That's a two for one discussion tonight. Perfect. That'll get rid of the mosquito
[01:43:34.920 --> 01:43:40.360] problem. I highly endorse Randy's mosquito trap, just like I highly endorse his soap. In fact,
[01:43:40.360 --> 01:43:47.000] I use the Randy soap in the mosquito trap. But you get one of those black lights, those curly
[01:43:47.000 --> 01:43:52.040] Q light bulbs that you normally never want to buy because they emit carcinogens. I know we're going
[01:43:52.040 --> 01:43:55.000] to break. I just want to let them know the curly Q black light. All right, we're going to break.
[01:43:55.000 --> 01:44:03.400] We'll be right back folks. You feel tired when talking about important topics like money and
[01:44:03.400 --> 01:44:08.680] politics? Are you confused by words like the constitution or the federal reserve? If so,
[01:44:08.680 --> 01:44:14.760] you may be diagnosed with the deadliest disease known today. Stupidity. Hi, my name is Steve Holt
[01:44:14.760 --> 01:44:19.320] and like millions of other Americans, I was diagnosed with stupidity at an early age.
[01:44:19.320 --> 01:44:24.280] I had no idea that the number one cause of the disease is found in almost every home in America,
[01:44:24.280 --> 01:44:29.080] the television. Unfortunately, that puts most Americans at risk of catching stupidity,
[01:44:29.080 --> 01:44:33.160] but there is hope. The staff at Brave New Books have helped me and thousands of other
[01:44:33.160 --> 01:44:37.640] foxaholics suffering from sports zombieism recover. And because of Brave New Books,
[01:44:37.640 --> 01:44:42.280] I now enjoy reading and watching educational documentaries without feeling tired or
[01:44:42.280 --> 01:44:47.320] uninterested. So if you or anybody you know suffers from stupidity, then you need to call

[01:46:11.160 --> 01:46:15.160] Okay, folks, we're back. We got one more segment left. We have another caller, Metta from Texas.
[01:46:15.160 --> 01:46:20.040] But yeah, normally just a quick thing about those fluorescent light bulbs, the curly-cue
[01:46:20.040 --> 01:46:25.320] light bulbs, you know, they kind of curl up like a curly-cue. Folks, don't use those unless you're
[01:46:25.320 --> 01:46:30.360] using the black light from the mosquito magnet because they emit carcinogens. They emit like
[01:46:30.360 --> 01:46:37.720] three or four different types of extremely toxic gases. It's not just the mercury in them that is
[01:46:37.720 --> 01:46:44.600] a hazard if you happen to break one. They emit carcinogenic gases. Okay, you do not want these
[01:46:44.600 --> 01:46:50.600] things in your house. You definitely don't want one over your head. Okay, do not use them. Just
[01:46:50.600 --> 01:46:56.200] use regular incandescent bulbs. Please do not use those curly-cue bulbs. They're very dangerous.
[01:46:56.200 --> 01:47:00.440] There have been a lot of studies done on them in universities showing that they are highly,
[01:47:00.440 --> 01:47:04.680] highly dangerous. Do not use those curly-cue light bulbs unless you're going to use the black light
[01:47:04.680 --> 01:47:09.640] one for the mosquito trap. That's about the only exception. So okay, Patrick, do you have anything
[01:47:09.640 --> 01:47:17.000] else for us tonight? I just wanted to ask, I mean, what do you think is the best means of going about
[01:47:17.000 --> 01:47:26.120] this? I would suggest you just clean it up and use it. And if they raise an issue, you raise the issue
[01:47:26.120 --> 01:47:34.520] of adverse possession and then go to them and say, let's make a deal. Being a water course,
[01:47:34.520 --> 01:47:39.000] you're almost certainly not going to be able to get possession of the property, but you probably
[01:47:39.000 --> 01:47:43.320] can get them not to want to have a fight. Well, he may be able to get possession of the property
[01:47:44.360 --> 01:47:50.840] maybe with an easement on the actual, where the water area is itself, the creek. Yeah,
[01:47:50.840 --> 01:47:55.800] because that's all they're going to care about is easement. Okay, so mainly just go ahead and
[01:47:55.800 --> 01:48:04.200] maintain it and then take any action or just maintain it. Yeah, they might just tell you,
[01:48:04.200 --> 01:48:09.400] go ahead, maintain it. Just don't change the direction of the water course. Don't restrict
[01:48:09.400 --> 01:48:14.440] the water course and we're not going to care what you do with it. And that's almost certainly going
[01:48:14.440 --> 01:48:18.520] to be the case. Yeah, don't tell them you want to cut down those horrible junipers though, because
[01:48:18.520 --> 01:48:23.800] I think there's some deal going on now in the central Texas area that people are actually not
[01:48:23.800 --> 01:48:31.080] supposed to cut those down because they're like home to some like very bizarre warbler or something.
[01:48:31.080 --> 01:48:35.560] But, you know, the thing is I don't pay attention to stuff like that because those juniper trees,
[01:48:35.560 --> 01:48:40.280] actually juniper, not cedar, people call them cedar, but I mean, at any rate, the pollen of
[01:48:40.280 --> 01:48:46.360] those things is off the chart and there are no, there's no plant life or tree life that can
[01:48:46.360 --> 01:48:51.800] inhibit their growth because they're not native. Those junipers are not native here. And my question
[01:48:51.800 --> 01:48:57.000] to all these environmentalists is, well, how did that little warbler survive before the Spaniards
[01:48:57.000 --> 01:49:01.240] brought over this horrible, disgusting juniper tree that causes everyone to be sick in Austin
[01:49:01.240 --> 01:49:07.160] all the time? Okay. And they kill the oak trees. They suck up all the water from the oak trees and
[01:49:07.160 --> 01:49:12.040] other plant life that really should be having it. Get rid of those things, man. I don't care
[01:49:12.040 --> 01:49:17.480] what these people say about this bird. I mean, at some point we have to decide what's more
[01:49:17.480 --> 01:49:22.920] important, ourselves, humans and our children and our families or some bird. Okay. I mean,
[01:49:22.920 --> 01:49:27.160] I don't know. That's a tirade for another day. Give me a break. How did it survive before?
[01:49:27.160 --> 01:49:31.800] Obviously it survived before, so it'll find a way. Yes. That's what I was saying. Okay. All righty.
[01:49:31.800 --> 01:49:35.720] All right. Good deal. I'm good. I appreciate your time and especially the mosquito information.
[01:49:35.720 --> 01:49:40.760] That's excellent. And Randy, we appreciate your insight. All right. Thanks, Patrick.
[01:49:41.880 --> 01:49:44.920] Okay, Randy, you want to go to Meta now? Absolutely.
[01:49:44.920 --> 01:49:54.200] Hello, Ms. Meta. I hate to say this, but this is Patrick, Meta's husband.
[01:49:55.320 --> 01:49:59.320] I was going to say, Meta, your voice don't sound near as sweet as it used to.
[01:50:01.320 --> 01:50:09.560] No, she's visiting her mother right now for Mother's Day weekend. But I was listening to
[01:50:09.560 --> 01:50:16.360] the last caller, Patrick. I didn't catch where in Texas he is. Austin area? If he's still listening,
[01:50:17.880 --> 01:50:27.400] Austin. Yeah, he's in the 512 area. Travis County or something? Travis,
[01:50:27.400 --> 01:50:36.760] Bastrop, one of those counties, right in your close. All right. Yeah. The water laws in the state
[01:50:36.760 --> 01:50:44.040] of Texas cover over 100 years of legislation. And it seems like every time the legislature met,
[01:50:44.760 --> 01:50:50.280] they changed the water laws as far as the surface goes. The underground stuff still
[01:50:50.280 --> 01:50:56.040] goes with the property owner. But if he's got a water course that he's trying to clean up,
[01:50:58.040 --> 01:51:05.320] without doubt he can clean it up, but he does need to be careful of a few things.
[01:51:05.320 --> 01:51:12.440] One of them is he cannot open the banks up. He has to look at, if he wants to call me,
[01:51:12.440 --> 01:51:17.640] he can call you back, give my phone number or email, and I'll give it to you here in a minute.
[01:51:18.440 --> 01:51:22.920] And he can get ahold of me direct. I've got a copy of all the land laws dealing with water
[01:51:22.920 --> 01:51:31.640] in the state for the last, since 1836. I've been fighting some underground water district changes
[01:51:31.640 --> 01:51:37.480] to property rights, dealing with water. So we've had a discussion about this in Tent Lake.
[01:51:38.440 --> 01:51:42.920] So if he wants to get ahold of me, it's not a problem. If you will send me an email,
[01:51:44.360 --> 01:51:50.360] I'll get his email and I'll forward that to him just with an introduction so that you two
[01:51:50.360 --> 01:52:00.200] can get to know each other. Yeah. Because Steve Skidmore knows I've been dealing with this for
[01:52:00.200 --> 01:52:08.520] going on two years now. We've had some problems. But surface water rights, waterways, and that's
[01:52:08.520 --> 01:52:13.320] what it sounds like he's trying to clean up. He can definitely clean that up, but he's got to be
[01:52:13.320 --> 01:52:17.880] careful how he cleans it up because if he causes too much of an increase in flow,
[01:52:19.640 --> 01:52:23.160] and that's what it sounds like he's going to wind up doing, he's going to wind up having to put some
[01:52:23.160 --> 01:52:29.320] levees in there to slow it back down to where it's the same flow rate as it is right now with all
[01:52:29.320 --> 01:52:36.360] the debris inside there. Oh, I see. That's a good point. So all the debris will cause restrictions.
[01:52:36.360 --> 01:52:43.320] So if you clean up a space, it's going to relieve the pressure on the high side and increase it
[01:52:44.200 --> 01:52:48.920] on the low side. So it's going to build up back there and begin to flood back behind you.
[01:52:50.440 --> 01:52:54.280] Yeah, you're going to have a problem. Your neighbors are going to start complaining because
[01:52:54.280 --> 01:53:03.240] you're going to cause erosion and a couple other minor things. But you can get around all that
[01:53:03.240 --> 01:53:08.520] just building some very small levees in there. It also helps the water perc down into the water
[01:53:08.520 --> 01:53:15.560] table, which they want you to do anyway. But you can also slow it down before it reaches the waterway
[01:53:15.560 --> 01:53:22.280] by building levees, just six inch to eight inch, 12 inch tall little dams
[01:53:22.280 --> 01:53:29.080] so that they go along the land and see water going down into that waterway.
[01:53:30.200 --> 01:53:32.680] When I was farming, we call that terracing.
[01:53:34.920 --> 01:53:37.880] You can call it a lot of things. I call it a lot of work.
[01:53:39.320 --> 01:53:44.600] Yes. Well, if you use a plow right, you can use the plow to move the dirt over
[01:53:45.560 --> 01:53:49.480] and it causes a flat spot and then a little terrace at the end.
[01:53:49.480 --> 01:53:56.360] Randy, in Travis County, I think there's only four spots that have dirt. The rest of it's all rock.
[01:53:59.720 --> 01:54:03.000] And some sand, which wouldn't stay in any case.
[01:54:05.000 --> 01:54:09.720] Yeah, but it can get around some stuff. I'll send you an email
[01:54:10.680 --> 01:54:16.680] tonight here in just a couple of minutes. I'm sending a meta shopping list to bring back to
[01:54:16.680 --> 01:54:22.120] the house. Has anything occurred on your ticket issue?
[01:54:24.440 --> 01:54:29.320] We have an examining trial coming up this coming Tuesday in district court.
[01:54:30.200 --> 01:54:34.280] So are they actually going to do an examining trial?
[01:54:35.960 --> 01:54:43.720] Well, I have the court date for it. I submitted a motion and I got a call from the court clerk.
[01:54:43.720 --> 01:54:49.320] She had never heard of an examining trial before, but when she looked it up in accordance with the
[01:54:49.320 --> 01:54:55.320] motion, the references and everything we put in there, she said, you're right. The magistrate
[01:54:55.320 --> 01:55:05.240] that evening was required to do it. This is a due process violation. And the district judge now
[01:55:05.240 --> 01:55:13.800] has the case, the case number is unindicted. And we're going to examine these relatives
[01:55:13.800 --> 01:55:20.760] this morning at 1030. Oh, wonderful. Have you read chapter 16, Texas Code of Criminal Procedure?
[01:55:22.200 --> 01:55:27.160] Oh, yes. I got a brand new copy of it sitting right here in front of me. They just came in today
[01:55:27.160 --> 01:55:34.280] from Westlaw. And the first thing that happens, you get notified of your rights,
[01:55:34.280 --> 01:55:39.320] then you are to be given opportunity to make a statement to the court.
[01:55:41.240 --> 01:55:51.560] And that's important because when you get to 1617, I'm sorry, 1730, 1730 is the one that tells the
[01:55:51.560 --> 01:55:58.760] magistrate after the hearing there to seal all documents had in the hearing. The statement by
[01:55:58.760 --> 01:56:06.920] the witness, if any, the complaint and something else and all other documents. But the first one
[01:56:06.920 --> 01:56:14.200] it references is the statement by the accused. And that's the one they're not likely to do.
[01:56:14.200 --> 01:56:20.760] You'd have to advise your counsel, give you time to get counsel. Tell you what it sounds like to me.
[01:56:20.760 --> 01:56:27.560] They're wanting to make this go away. And the examining trial is a really slick maneuver to
[01:56:27.560 --> 01:56:35.160] make it go away. Yeah. Well, they got a real problem out here. Yeah. Because if they got a DPS,
[01:56:35.160 --> 01:56:42.920] they're off duty, pulling some shenanigans for the border patrol. The last thing they want
[01:56:43.720 --> 01:56:47.320] is him embroiled into it in a lawsuit with some local
[01:56:47.320 --> 01:56:56.680] sharp pro se from hell. Oh, I got a deputy that put it out over the radio. I got this sworn statement
[01:56:57.480 --> 01:57:04.040] that I am anti-government and I am known to be armed and have possession of a firearm on my body
[01:57:04.040 --> 01:57:13.240] at all times. I would get real excited about that. And I do a show with Pastor Massad on Monday.
[01:57:13.240 --> 01:57:19.080] And what he starts out the show by saying, this is the most pro-government show on radio.
[01:57:22.040 --> 01:57:31.000] And we are pro-government. We're pro-proper government. We're just anti-corruption.
[01:57:31.000 --> 01:57:43.160] To do their job properly. Exactly. And the, the, the, the, the, the, the, the, the, the, the, the,
[01:57:43.160 --> 01:57:44.480] the, the, the you put that out.
[01:57:44.480 --> 01:57:47.560] Wow. He's slandered.
[01:57:49.560 --> 01:57:51.400] Oh, defamation.
[01:57:52.440 --> 01:57:55.240] That's serious because they could put your life at risk.
[01:57:55.240 --> 01:57:56.600] to do bodily harm.
[01:57:58.280 --> 01:58:04.760] That's serious slander. You got to sue the department. I'm sorry, but we are out of time.
[01:58:06.360 --> 01:58:05.720] I'll send you the email Wandy, have a good night.
[01:58:05.720 --> 01:58:07.960] I'll send you the email, Randy.
[01:58:07.960 --> 01:58:09.120] You have a good night.
[01:58:09.120 --> 01:58:09.620] OK.
[01:58:09.620 --> 01:58:10.280] Thank you, Pat.
[01:58:10.280 --> 01:58:10.780] OK.
[01:58:10.780 --> 01:58:14.680] This is Randy Kelton, David Stevens, root of our radio.
[01:58:14.680 --> 01:58:15.800] Thank you all for listening.
[01:58:15.800 --> 01:58:20.040] We'll be back tomorrow night with our four hour info marathon.
[01:58:20.040 --> 01:58:24.120] And we would appreciate it if you would check out our sponsors
[01:58:24.120 --> 01:58:26.960] and help us support this radio station.
[01:58:26.960 --> 01:58:28.800] We put in all we can.
[01:58:28.800 --> 01:58:31.280] None of the hosts get paid for their time.
[01:58:31.280 --> 01:58:33.520] We donate all of it.
[01:58:33.520 --> 01:58:36.320] And we don't age as much money as we can to keep it going.
[01:58:36.320 --> 01:58:37.800] Sometimes it gets to be a struggle.
[01:58:37.800 --> 01:58:39.760] So we'd appreciate any help you could give us.
[01:58:39.760 --> 01:58:42.160] Look forward to talking to you tomorrow night.
[01:58:42.160 --> 01:58:43.680] Thank you for listening.
[01:58:43.680 --> 01:58:44.360] And good night.
