[04:48.800 --> 04:58.240]  tonight I did want to give a report on the complaints I've got filed with the Tarrant
[04:58.240 --> 05:04.760]  County District Attorney against the Dallas County District Attorney I don't know if this
[05:04.760 --> 05:14.280]  is good or bad it's probably a good sign in that in that nothing has occurred so far generally
[05:14.280 --> 05:23.280]  a the grand jury when they consider an issue it takes them a very short time to find a true
[05:23.280 --> 05:37.080]  bill or no bill but so far so good nothing has occurred and that means that at least the grand
[05:37.080 --> 05:46.680]  jury is reading the documents that we have put in front of them and in you know the more I look
[05:46.680 --> 05:56.800]  at this the more powerful it appears to become because this is really a secondary maneuver on
[05:56.800 --> 06:07.360]  my part I really wanted to get a change to legislation where we require the grand jury to
[06:07.360 --> 06:16.640]  sit but to set aside time in each meeting to hear complaints by private citizens I wasn't able to
[06:16.640 --> 06:23.320]  get it sponsored this session but I'm hoping in two years when when the Texas legislature comes
[06:23.320 --> 06:32.880]  back in session that we'll be able to get it sponsored Texas is unusual in that well I say
[06:32.880 --> 06:42.480]  it's unusual I think it's unusual that the legislature only sits every second year so it
[06:42.480 --> 06:47.920]  takes two years from one session to the next to get something if you don't get it on this time you
[06:47.920 --> 06:56.680]  got two years before you can try it again in the states that sit more often any of you that are
[06:56.680 --> 07:05.240]  out there listening to this program and you have issues with public officials this may be a very
[07:05.240 --> 07:18.240]  fertile ground to take up those issues in that ask your legislators to introduce legislation that
[07:18.240 --> 07:29.960]  would require grand juries to sit to set aside time at each meeting to hear complaints by private
[07:29.960 --> 07:41.480]  citizens not to have a private citizen present a complaint this is a fine distinction that they
[07:41.480 --> 07:50.840]  make here in Texas and in the Fed and I suspect in most every state it's kind of a linguistic song
[07:50.840 --> 07:56.920]  and dance the prosecutors do so they can keep control with prosecution this thing of presentment
[07:56.920 --> 08:07.480]  both in the state and in the Fed there the the law stipulates that the prosecuting attorney may
[08:07.480 --> 08:16.080]  present to the grand jury as a matter of right now no one else is authorized to present to the
[08:16.080 --> 08:29.120]  grand jury as a matter of right however in Texas state law a grand jury has a duty to examine into
[08:29.120 --> 08:35.560]  all criminal accusations that that come by way of their own personal knowledge or come by the by
[08:35.560 --> 08:44.160]  way of the knowledge of any grand juror by way of the prosecuting attorney or any credible person
[08:44.160 --> 08:58.000]  in the Fed it says the grand jury shall examine into all criminal accusations that come to their
[08:58.000 --> 09:09.280]  knowledge by whatever means so that very clearly places no restrictions on how the grand jury gets
[09:09.280 --> 09:20.480]  notice so you or I as a private citizen we don't want to go in and present to the grand jury what
[09:20.480 --> 09:30.040]  we want to do is present notice to the grand jury that crime has been committed and when they have
[09:30.040 --> 09:40.360]  notice then they can ask the prosecutor prosecutor to do a proper presentment or they can ask you to
[09:40.360 --> 09:50.760]  come in and do a proper presentment the prosecuting attorney this will tell you that only he can
[09:50.760 --> 09:59.200]  present to the grand jury and that is not true only the prosecuting attorney may present to the
[09:59.200 --> 10:07.440]  grand jury as a matter of right anyone can present to the grand jury at the grand jury's
[10:07.440 --> 10:16.320]  request but what we want to do for the most part is not to do a presentment we want to merely give
[10:16.320 --> 10:28.560]  notice and if your state does not have that provision then you should certainly move to
[10:28.560 --> 10:39.960]  have that provision included in the in a legislation at your next legislative session this is a good
[10:39.960 --> 10:54.320]  time for that because with all of the current uproar over the police the public concern about the
[10:54.320 --> 11:05.400]  validity of a grand jury in the face of the Ferguson Missouri case Washington DC Pennsylvania
[11:05.400 --> 11:12.360]  North Carolina or South Carolina there's been a number of cases where the public felt person
[11:12.360 --> 11:21.200]  should should have been prosecuted but grand juries didn't are not prosecuting police officers but
[11:21.200 --> 11:31.160]  the prosecuting essentially everybody else so in order to eliminate this distrust of the grand jury
[11:31.160 --> 11:40.680]  and the the criminal justice system by simply requiring the grand jury to take notice of crime
[11:40.680 --> 11:55.520]  from private citizens we will create a situation to where public officials when they exercise the
[11:55.520 --> 12:05.360]  duties of their office have to be very careful because now a public official is likely to have
[12:05.360 --> 12:15.040]  to explain his behavior to a grand jury of my peers of your peers not a grand jury of his peers
[12:15.040 --> 12:25.200]  and right now police policemen for the most part have to answer to their own peers because they
[12:25.200 --> 12:34.120]  have so maneuvered the system that any complaint against a police officer is always funneled to
[12:34.120 --> 12:49.080]  his own department to to people who work with him every day it's like the bar and the Commission
[12:49.080 --> 12:55.640]  on Judicial Conduct both the bar and the Commission of Judicial Conduct are made up of lawyers and
[12:55.640 --> 13:03.320]  judges among others but if the lawyers and judges on the panels where the bar is totally lawyers the
[13:03.320 --> 13:08.880]  Judicial Conduct Commission is made up of judges and then private citizens who don't know anything
[13:08.880 --> 13:17.160]  so when a judge tells them something is law or the way things should be done these non lawyers
[13:17.160 --> 13:26.000]  will pretty well follow what the judges say it's my position that on the Bar Association
[13:26.000 --> 13:35.960]  grievance committee or the State Commission on Judicial Conduct there should be no professionals
[13:35.960 --> 13:46.680]  licensed in the profession they're regulating that should be absolutely forbidden because it
[13:46.680 --> 13:59.240]  naturally leads to a conflict of interest we had some discussion last night over court reporters
[13:59.240 --> 14:08.480]  Jeff Hill had called in and he was going to court but he was concerned because in the past he had
[14:08.480 --> 14:16.880]  looked in the transcript and key statements by the judge and the prosecutor were not in the
[14:16.880 --> 14:23.600]  transcript statements that would have been damaging to the prosecution they weren't in
[14:23.600 --> 14:30.800]  the transcript so he was asking how he could handle that and we suggested he bring his own
[14:30.800 --> 14:40.280]  court reporter and the concern would be well the court reporter is part of the good old
[14:40.280 --> 14:46.840]  boy establishment they're part of the group and they're not going to do anything the judge or
[14:46.840 --> 14:56.440]  prosecutor doesn't want them to do well the fact is that judges became judges because they were
[14:56.440 --> 15:03.160]  lawyers and judges and lawyers all know each other they all work with each other regularly
[15:03.160 --> 15:14.880]  essentially they all have their snouts in the same trough but those secondary personnel the clerks and
[15:14.880 --> 15:23.320]  bailiffs and court reporters they don't have their snout in that trough and it's always been my
[15:23.320 --> 15:32.040]  contention that these judges and lawyers throw those clowns under the bus in a heartbeat but
[15:32.040 --> 15:38.680]  what happened in a family law case is the court they went into a hearing and there was no court
[15:38.680 --> 15:46.480]  reporter so the litigant objected and they reset the hearing and directed Ann Diamond who is the
[15:46.480 --> 15:56.080]  head of the civil section of the district attorney's office in Turner County and she's
[15:56.080 --> 16:04.240]  been there forever frankly she's a nice woman when they came to the next hearing no court reporter
[16:04.240 --> 16:15.000]  so the litigant filed a complaint against the court reporter and claiming that she was never
[16:15.000 --> 16:20.160]  instructed to be at the meeting well they held a hearing in Austin that the court reporter had to
[16:20.160 --> 16:27.160]  come down from Tarrant County of Fort Worth to Austin to attend and if she didn't agree with
[16:27.160 --> 16:34.680]  the findings of this hearing then she would have to stand trial criminally and she threw the
[16:34.680 --> 16:41.920]  prosecutor under the bus and the district attorney and the district attorney swore she gave her notice
[16:41.920 --> 16:45.840]  the other one swore they didn't she wound up with these two at each other's throats because
[16:45.840 --> 16:51.880]  they were gonna throw that clerk under the bus hang on Randy Kelton Steve's Kidmore we blow

[20:31.520 --> 20:38.240]  didn't think that we could change the system yeah I thought like everybody else we need to do laws
[20:38.240 --> 20:47.160]  every time we have a problem people say we need new laws and we have legislators that are elected
[20:47.160 --> 20:58.520]  every two or four years and it's their job to come up with new laws that's what they do so we have
[20:58.520 --> 21:09.120]  them writing laws for everything well in this case we have a very serious problem however from
[21:09.120 --> 21:19.000]  long research of the system there's no indication that we need new law laws we have are just fine
[21:19.000 --> 21:28.520]  from when I read the penal code code of criminal procedure and rules of civil procedure in Texas I
[21:28.520 --> 21:40.400]  find all the remedy I need I don't see any place where I don't have law other than really minor
[21:40.400 --> 21:47.120]  things and there's a there's a couple of there's more laws that we don't need than we do but as
[21:47.120 --> 21:55.080]  true the remedy for the problem with the police and public officials we have all the law we need
[21:55.080 --> 22:04.920]  we don't really need any new law because the law itself already authorizes credible people to give
[22:04.920 --> 22:12.120]  notice of crime to the grand jury and that's in 20.09 Texas Code of Criminal Procedure that says
[22:12.120 --> 22:19.160]  the grand jury shall examine into all criminal all crimes subject to indictment that come by
[22:19.160 --> 22:25.000]  their by way of their own knowledge prosecuting attorney an incredible person that authorizes us
[22:25.000 --> 22:32.440]  to give notice to the grand jury it makes it the duty of the grand jury to hear that so we've
[22:32.440 --> 22:39.960]  already got that what I would like to see is a specific requirement that they set aside time to
[22:39.960 --> 22:49.320]  hear complaints by private citizens that's not precisely in law so they kind of do what they
[22:49.320 --> 23:03.200]  want to you know as far as the time that they schedule so I would like to see that legislation
[23:03.200 --> 23:11.080]  but other than that we don't really need any and these complaints that I filed with the Dallas
[23:11.080 --> 23:19.400]  County District Attorney against I'm sorry with the Tarot County District Attorney against the
[23:19.400 --> 23:29.560]  Dallas County District Attorney really opened a door I was talking about this to my local prosecutor
[23:29.560 --> 23:39.280]  whom I happen to think a lot of and I had addressed it with him earlier and he said that he had done
[23:39.280 --> 23:49.280]  some research on this and he couldn't find anything that restricted the venue of a grand jury this was
[23:49.280 --> 23:56.480]  my argument and I know you've probably heard this before if you listen all the time you really need
[23:56.480 --> 24:07.760]  to get this one down my argument is that district judges create the grand jury of create consecrates
[24:07.760 --> 24:18.320]  grand jury they impaneled them a district judge is a state judge and the state judge we used to
[24:18.320 --> 24:24.560]  they used to be circuit judges used to ride a circuit but as we became more populated they
[24:24.560 --> 24:32.840]  needed more judges so they put judges in all the counties and to keep the judges from stepping on
[24:32.840 --> 24:42.400]  each other's legal toes they restricted their jurisdiction to a venue so this judge with a
[24:42.400 --> 24:54.320]  restricted venue in panels of grand jury but there's nothing in law that indicates that's
[24:54.320 --> 25:04.640]  a legislature intended that a grand jury only hear complaints for crimes that occurred within
[25:04.640 --> 25:15.160]  the county in which the grand jury is seated when creating a grand jury jurisdiction is paramount
[25:15.160 --> 25:26.880]  so if the legislature intended that there'll be a venue jurisdiction they would have put it in
[25:26.880 --> 25:36.560]  there but they didn't so since the grand jury is a statewide grand jury and there is no venue
[25:36.560 --> 25:41.440]  restriction like there is for district judges it must be presumed that a grand jury has statewide
[25:41.440 --> 25:47.160]  jurisdiction and that was essentially the conclusion that not only my local prosecutor came
[25:47.160 --> 25:53.680]  to but also the tarot county district attorney came to when I went to them with complaints
[25:53.680 --> 26:05.960]  against another district attorney partly it was the issue was carefully set up now if you listen
[26:05.960 --> 26:14.840]  to me talk on the show you know that I'd never have a problem getting issue getting issues that
[26:14.840 --> 26:21.240]  I can file criminal complaints for the public officials that are very accommodating in that
[26:21.240 --> 26:32.560]  regard so finding criminal complaints to file is not the problem carefully figuring out which
[26:32.560 --> 26:41.520]  complaints to file that's the issue and in this case I spent a lot of time trying to figure out
[26:41.520 --> 26:56.040]  how to do this and in the very case that I filed I had complaints against a judge and a lawyer for
[26:56.040 --> 27:02.800]  a trial that we had and then I took those complaints or a judge a lawyer a trustee a whole
[27:02.800 --> 27:09.160]  bunch of people I took those complaints to another justice of the peace because everything in the
[27:09.160 --> 27:15.840]  code directs complaint to a justice of the peace or not to a justice of the peace to a magistrate
[27:15.840 --> 27:21.120]  and all justices of the peace are magistrates well I sent them to him and he sent them back to me
[27:21.120 --> 27:28.960]  said I needed to file them in the proper place so I took a complaint against the JP to the district
[27:28.960 --> 27:36.720]  attorney in Dallas County filed against the JP and the district attorney had us escorted out of the
[27:36.720 --> 27:45.480]  building by people with guns so now I go to the Tarrant County grand jury and I don't really I
[27:45.480 --> 27:53.800]  included all those other complaints but those were included primarily in support of the complaint
[27:53.800 --> 28:00.520]  against the district attorney for not acting on those complaints for denying me access to a grand
[28:00.520 --> 28:08.840]  jury to give notice well it it was intended to give the Tarrant County district attorney
[28:08.840 --> 28:18.640]  plausible deniability so that she could say look guys he come to me to file complaints against
[28:18.640 --> 28:24.840]  another district attorney for not giving his complaints to a grand jury so you really think
[28:24.840 --> 28:31.400]  I'm going to do that with his complaints so I have nothing to do with in the state law
[28:31.400 --> 28:39.320]  specifically directs a prosecuting attorney under 2.03 when a prosecuting attorney is made
[28:39.320 --> 28:44.160]  known in any way that a public official violated law relating to his office he shall reduce
[28:44.160 --> 28:50.120]  complaint and information submitted to the grand jury used to say for threat they took it out but
[28:50.120 --> 28:59.960]  that leaves them no wiggle room no no discretion at all and she read it she interpreted that way
[28:59.960 --> 29:06.840]  and stood aside and let me hand it to it now that opened an incredibly large door when I was
[29:06.840 --> 29:13.040]  talking to my prosecutor the bailiff who's also a friend of mine was sitting in there and he said
[29:13.040 --> 29:21.920]  well how does that matter and the Greg said well if mr. Galton gets mad at me he can file
[29:21.920 --> 29:28.760]  a complaint against me with another grand jury I said oh no Greg it's a lot worse than that
[29:28.760 --> 29:38.720]  I get to file a complaint against you with every grand jury in the state of Texas and the look on
[29:38.720 --> 29:48.000]  his face when that kind of clicked into place was absolutely priceless and he concurred yes as a
[29:48.000 --> 29:54.880]  matter of fact again we do have our guest bridge up and we have a guest up on the bridge so we

When you take that into consideration that when you have someone like us, like my husband and I, who have filed a rescission under Killa and the bank conspires with their attorneys to foreclose on a mortgage that does not exist,

[47:23.440 --> 47:29.440]  I mean county clerks, preparing a RICO suit?
[47:29.440 --> 47:35.440]  She said they're taking it very slow because right now they have an election going
[47:35.440 --> 47:42.440]  where the county prosecutor is swamped and running for reelection at the same time,
[47:42.440 --> 47:46.440]  and she can't even look at anything until after November.
[47:46.440 --> 47:56.440]  Well, this might be a feather in a potential, in a candidate's bonnet.
[47:56.440 --> 48:01.440]  You might call the prosecutor and tell him that the clerk is considering this,
[48:01.440 --> 48:05.440]  but she doesn't want to bog you down while you're in an election,
[48:05.440 --> 48:09.440]  and this would be really good for your election bid.
[48:09.440 --> 48:16.440]  Yeah, that's what I would think, but evidently she doesn't think that way,
[48:16.440 --> 48:21.440]  and I could try and probably call her and see.
[48:21.440 --> 48:28.440]  Ask him. He may say, great, I need something to get people talking about me.
[48:28.440 --> 48:32.440]  I know Craig Watkins, the Dallas County District Attorney, did that,
[48:32.440 --> 48:41.440]  and he filed a suit that was essentially frivolous because it was not well crafted.
[48:41.440 --> 48:45.440]  His people probably didn't read the code before they filed the suit,
[48:45.440 --> 48:49.440]  but he filed it anyway, and he got lots of press,
[48:49.440 --> 48:55.440]  and J.T. Barnum and Barnum Bailey's Circus, the statement he said,
[48:55.440 --> 49:02.440]  there is no bad publicity, so the prosecutor could get a lot of publicity
[49:02.440 --> 49:07.440]  following the Supreme Court ruling against MERS,
[49:07.440 --> 49:14.440]  or was it a supreme ruling, or was it an appeals, and now it's before the supreme?
[49:14.440 --> 49:19.440]  It's before the supreme now. It's an appeal before the Supreme Court.
[49:19.440 --> 49:26.440]  So it's through the appeals court, and this would seem like it would get the prosecutor
[49:26.440 --> 49:35.440]  lots of free publicity and free focus on him doing something
[49:35.440 --> 49:39.440]  for the people against big business.
[49:39.440 --> 49:44.440]  Yeah, that's what I thought. I was talking to Nancy today,
[49:44.440 --> 49:50.440]  and she didn't seem too happy.
[49:50.440 --> 49:56.440]  She just was kind of down in the dumps, and I didn't know what to say to cheer her up,
[49:56.440 --> 49:59.440]  so I'll have to work on that.
[49:59.440 --> 50:04.440]  Well, maybe you can get the prosecutor to come back to her.
[50:04.440 --> 50:06.440]  Yeah, that's what I was thinking.
[50:06.440 --> 50:11.440]  And another thing, too, is that I'm unique in my situation,
[50:11.440 --> 50:20.440]  and I probably have more ability with the proper pleading to win at least the RICO,
[50:20.440 --> 50:28.440]  because I can actually prove the forgery because of all the stuff that I've been through already
[50:28.440 --> 50:34.440]  and the documentation that I have.
[50:34.440 --> 50:39.440]  Okay, the problem I have with that is, you know, you go back to this,
[50:39.440 --> 50:44.440]  you'll never win your case simply because you have the facts and the law on your side.
[50:44.440 --> 50:45.440]  Right.
[50:45.440 --> 50:53.440]  But in your case, with all of the negative press concerning the banks,
[50:53.440 --> 51:02.440]  even with all of their money thrown around, they're still kind of politically taboo at the moment.
[51:02.440 --> 51:10.440]  And money's fine unless you're running for office and you're not getting the votes you need.
[51:10.440 --> 51:11.440]  Yeah.
[51:11.440 --> 51:20.440]  So this is the time that the politics can weigh against the guy with the money.
[51:20.440 --> 51:23.440]  Yeah. Yeah.
[51:23.440 --> 51:28.440]  Well, I'll have to go at that angle with her and see what I can work out.
[51:28.440 --> 51:37.440]  But like I said, because, you know, it's hard to know how this would work out because of the politics,
[51:37.440 --> 51:41.440]  because I certainly do have the facts.
[51:41.440 --> 51:47.440]  You know, I mean, there's not that many people that have the assigner of the mortgage
[51:47.440 --> 51:54.440]  stay in court and in verified documents that they prepared
[51:54.440 --> 51:59.440]  and they had nothing whatsoever to do with that particular assignment.
[51:59.440 --> 52:01.440]  It just doesn't happen.
[52:01.440 --> 52:04.440]  Yeah. That is unusual.
[52:04.440 --> 52:07.440]  So you're in a unique position.
[52:07.440 --> 52:09.440]  Yeah. That's what I thought.
[52:09.440 --> 52:13.440]  You know, how can they say that there was anything right with that?
[52:13.440 --> 52:15.440]  That goes to collateral estoppel.
[52:15.440 --> 52:24.440]  They can't come back now and say, oh, gee whiz, we made a mistake when we swore under oath
[52:24.440 --> 52:31.440]  that we had reason to it, that we had personal knowledge of this particular fact.
[52:31.440 --> 52:36.440]  Now we come back and say, well, we committed aggravated perjury when we did that.
[52:36.440 --> 52:39.440]  So they're kind of stuck with it.
[52:39.440 --> 52:46.440]  Well, not only that, but under Pennsylvania law, aggravated perjury is grounds for recalculation.
[52:46.440 --> 52:48.440]  So you should have a good case.
[52:48.440 --> 52:52.440]  You sent me a couple of other cases.
[52:52.440 --> 53:06.440]  Yanoff v. New Century Mortgage and the Bank of America where they had bankruptcy.
[53:06.440 --> 53:10.440]  NYDFS v. Deutsche Bank.

[53:14.440 --> 53:19.440]  Were these all in the same vein as the case against Bank of America?

[53:24.440 --> 53:31.440]  Yanoff v. New Century Mortgage is an amicus brief that Kamala Harris wrote.

[54:29.440 --> 54:38.440]  But they cannot work in that department, you know, where they have access to the LIBOR and all the other.
[54:38.440 --> 54:48.440]  So this one essentially establishes the right to challenge what documents?
[54:48.440 --> 54:55.440]  Documents filed in the public record or documents used to support a position?
[54:55.440 --> 54:58.440]  What did it go to?

[58:06.440 --> 58:18.440]  because what Jenkins said is that you couldn't come in and do a blanket fishing expedition.

[58:19.440 --> 58:27.440]  You couldn't go to the lender and say, well, you said you were the holder, but we don't believe it proved it up.
[58:27.440 --> 58:31.440]  They said you can't go there unless you've got facts to show that they're not the holder.

[01:27:44.440 --> 01:28:03.440]  This sector, which is called the Big Bend sector now, is rated as the worst sector in the entire border for border patrol actually cooperating in the movement of drugs, money, and people.
[01:28:03.440 --> 01:28:20.440]  With that having been said, I don't know what the percentage of cooperation is that it doesn't say in the reports, but as Randy well knows, my wife and I both are retired disabled veterans.

[01:33:53.440 --> 01:34:00.440]  And if you look from that gate due south, you see the mountains in Mexico, in Chihuahua.
[01:34:00.440 --> 01:34:10.440]  So we're pretty close to what the Border Patrol likes to call a really dangerous area.
[01:34:10.440 --> 01:34:15.440]  But it's more than that. We are in a remote area, very rural.
[01:34:15.440 --> 01:34:24.440]  The county has eight and a half million acres and we have less than a thousand people that live in it with only four major paved roads.
[01:34:24.440 --> 01:34:29.440]  Five if you count, one that really doesn't go anywhere except to a ranch.
[01:34:29.440 --> 01:34:37.440]  But with that having been said, we have some things going on that not only is going on here,
[01:34:37.440 --> 01:34:41.440]  but has been going on in other parts of the state.
[01:34:41.440 --> 01:34:54.440]  And you've probably heard the euphemism interagency agreement between a federal agency or a federal office of some kind
[01:34:54.440 --> 01:35:04.440]  and some state or local agency, either police department, sheriff's department, or in this case DPS.
[01:35:04.440 --> 01:35:19.440]  That interagency agreement, you've got to get a copy of it, more than likely with the payment being made to the local agency or to contracted officers.
[01:35:19.440 --> 01:35:23.440]  Those officers will be peace officers here in the state of Texas.
[01:35:23.440 --> 01:35:28.440]  That's what it looks like in other states, but it's probably the same.
[01:35:28.440 --> 01:35:41.440]  They've been doing this now for a couple of years and there's a lot of federal decisions against Border Patrol doing drug interdictions.
[01:35:41.440 --> 01:35:47.440]  And I'm going to use this as a good example because that is what is going on right here right now.
[01:35:47.440 --> 01:35:54.440]  Last year it went on down in the valley and right now it's going on here in my county and Terrell County.
[01:35:54.440 --> 01:35:57.440]  It has been for several weeks.
[01:35:57.440 --> 01:36:02.440]  They're bringing in DPS officers from other parts of the state.
[01:36:02.440 --> 01:36:12.440]  Ostensibly the officers are on vacation, but they're in uniform and they are driving their patrol cars.
[01:36:12.440 --> 01:36:18.440]  And they are being directed by Border Patrol to make stops.
[01:36:18.440 --> 01:36:23.440]  They then make a stop for a traffic violation.
[01:36:23.440 --> 01:36:26.440]  They give a warning ticket.
[01:36:26.440 --> 01:36:29.440]  It might be for five miles an hour over the limit.
[01:36:29.440 --> 01:36:32.440]  It might be for rolling through a stop sign, something.
[01:36:32.440 --> 01:36:37.440]  But normally the stop is made outside of a built-up area.
[01:36:37.440 --> 01:36:39.440]  They don't want any witnesses.
[01:36:39.440 --> 01:36:51.440]  And as soon as that transpires, the Border Patrol will roll up with drug dogs and they then have a dog circle the car.
[01:36:51.440 --> 01:36:53.440]  Naturally they're going to respond.
[01:36:53.440 --> 01:36:57.440]  And they're then confiscating automobiles.
[01:36:57.440 --> 01:36:58.440]  They're confiscating money.
[01:36:58.440 --> 01:37:01.440]  They're confiscating a bunch of other stuff.
[01:37:01.440 --> 01:37:06.440]  How I got involved with this and you have to picture this.
[01:37:06.440 --> 01:37:07.440]  I'm handicapped.
[01:37:07.440 --> 01:37:09.440]  I'm driving a full-size.
[01:37:09.440 --> 01:37:10.440]  I do not drive.
[01:37:10.440 --> 01:37:16.440]  I am traveling in a full-size van, modified for my wheelchair.
[01:37:16.440 --> 01:37:25.440]  It has a power wheelchair, a lift in it and everything else because I don't have control of one leg and one arm on opposite sides of the body.
[01:37:25.440 --> 01:37:29.440]  And I have disabled veterans license plates.
[01:37:29.440 --> 01:37:37.440]  Now, when you look at that and you read the code, and Eddie's real good at this. He's taught me a great deal.
[01:37:37.440 --> 01:37:44.440]  So has Steve and so has Randy about reading the law.
[01:37:44.440 --> 01:37:51.440]  When you have a set of disabled veterans license plates, they are considered special license plates.
[01:37:51.440 --> 01:37:53.440]  We don't pay for them.
[01:37:53.440 --> 01:37:57.440]  We pay an administrative fee for $3 for those things per year.
[01:37:57.440 --> 01:38:01.440]  But they have special regulations that go with them.
[01:38:01.440 --> 01:38:06.440]  They have to go onto the automobile that is owned by the veteran.
[01:38:06.440 --> 01:38:11.440]  And two, they are for private use only.
[01:38:11.440 --> 01:38:14.440]  And it says that in the code.
[01:38:14.440 --> 01:38:20.440]  You cannot put it on a commercial automobile, commercial truck or bus.
[01:38:20.440 --> 01:38:31.440]  And I had a little discussion with the arresting DPS officer that arrested me for evading arrest with a vehicle.
[01:38:31.440 --> 01:38:38.440]  Because I didn't feel like stopping on the side of a road in the middle of nowhere with no witnesses.
[01:38:38.440 --> 01:38:50.440]  I'm going to a safe place as has been put out on public service announcements for the last four years that I know of throughout the state.
[01:38:50.440 --> 01:38:53.440]  The DPS officer stopped me.
[01:38:53.440 --> 01:38:54.440]  Well, he didn't stop me.
[01:38:54.440 --> 01:39:03.440]  Two deputies rolled out a set of spikes to stop me about eight miles from a safe location with witnesses.
[01:39:03.440 --> 01:39:08.440]  Both the deputies are also our constables, so they're double-dipping.
[01:39:08.440 --> 01:39:12.440]  One major little problem there.
[01:39:12.440 --> 01:39:19.440]  About 12 Border Patrol agents were there and then the DPS officer.
[01:39:19.440 --> 01:39:25.440]  Everybody had M4s or Glocks out, safeties off, and pointed at yours truly.
[01:39:25.440 --> 01:39:33.440]  And I am such a dangerous individual, all my friends now call me John Dillinger.
[01:39:33.440 --> 01:39:36.440]  The ones that I have left anyway.
[01:39:36.440 --> 01:39:38.440]  I'm sorry.

[01:40:43.440 --> 01:40:47.440]  He was going to give me a warning ticket, but then he arrested me.

[01:40:49.440 --> 01:40:54.440]  He was not going to arrest you in the first place.
[01:40:54.440 --> 01:40:59.440]  So you can't evade an arrest that's not going to happen.
[01:40:59.440 --> 01:41:10.440]  Well, that as well as I never violated the prima facie speed limit because those signs out there are for commercial traffic only.
[01:41:10.440 --> 01:41:23.440]  As Randy well knows, and I've already written a little motion for dismiss with prejudice because his initial articulated probable cause for the stop,
[01:41:23.440 --> 01:41:35.440]  a warning ticket for 65 and a 60 when it's based upon the commercial traffic control sign doesn't hold water,
[01:41:35.440 --> 01:41:44.440]  especially when my license plates are specifically prohibited from use on a commercial vehicle.
[01:41:44.440 --> 01:41:56.440]  So he had noticed that this particular piece of equipment was not a commercial vehicle.
[01:41:56.440 --> 01:41:58.440]  Commercial, yeah, he had to have.
[01:41:58.440 --> 01:42:05.440]  All he had to do is look at the license plates and they're very prominently displayed front and rear.
[01:42:05.440 --> 01:42:11.440]  And he has to be able to read them with the plate reader that's in his sedan.
[01:42:11.440 --> 01:42:25.440]  Well, one of the problems that occurred at the stop as I'm kind of looking down the operative ends of multiple automatic weapons,
[01:42:25.440 --> 01:42:35.440]  I never lost control of my automobile, never exceeded what I was doing because I never took it off the cruise until I stopped.
[01:42:35.440 --> 01:42:42.440]  I was handcuffed, laid down on the ground, forced laid down, then handcuffed, double handcuffed.
[01:42:42.440 --> 01:42:51.440]  You know what my right arm looks like, the bone was skin draped over and my left leg was the same way.
[01:42:51.440 --> 01:42:55.440]  But he took all of my stuff out of my pocket.

[01:42:58.440 --> 01:43:01.440]  Took my wallet out, said I'd get that back in a minute.

[01:46:44.440 --> 01:46:49.440]  And his comment to me was, you're not getting these back.
[01:46:49.440 --> 01:46:56.440]  He did the inventory of my automobile that he turned over to the sheriff's department
[01:46:56.440 --> 01:47:01.440]  that was also submitted to the towing company that towed my van away
[01:47:01.440 --> 01:47:04.440]  as I was getting a chauffeured ride somewhere else.
[01:47:04.440 --> 01:47:10.440]  The problem is those keys were passed off to somebody else.
[01:47:10.440 --> 01:47:13.440]  Border Patrol, and I can't prove it yet.
[01:47:13.440 --> 01:47:14.440]  I'm going out.
[01:47:14.440 --> 01:47:19.440]  We've got some people at a couple of different universities helping me with this.
[01:47:19.440 --> 01:47:28.440]  In getting the GIS satellite data sets that I need to prove whom he gave them to,
[01:47:28.440 --> 01:47:32.440]  when we got the keys back, we got part of them back.
[01:47:32.440 --> 01:47:33.440]  Let me put it that way.
[01:47:33.440 --> 01:47:35.440]  The key ring was damaged.
[01:47:35.440 --> 01:47:38.440]  They were on the floor in the van.
[01:47:38.440 --> 01:47:42.440]  The next day we found them.
[01:47:42.440 --> 01:47:52.440]  And the errors in procedure and in due process on this whole thing reads like a comedy,
[01:47:52.440 --> 01:47:56.440]  but you can't make this stuff up.
[01:47:56.440 --> 01:48:04.440]  But without having been said, the video monitor inside the sedan
[01:48:04.440 --> 01:48:09.440]  when I was actually placed inside said, disc full.
[01:48:09.440 --> 01:48:14.440]  He had not been recording anything.
[01:48:14.440 --> 01:48:20.440]  Transports me into the sheriff's office 28 miles away.
[01:48:20.440 --> 01:48:26.440]  And we go through this little routine they helped me in.
[01:48:26.440 --> 01:48:31.440]  I can't walk without a cane, which is very limited anyway,
[01:48:31.440 --> 01:48:33.440]  and then most of the time I use my wheelchair.
[01:48:33.440 --> 01:48:39.440]  I was denied access to the cane and denied access to the wheelchair.
[01:48:39.440 --> 01:48:48.440]  None of my property was turned into the sheriff's department to be put into the property room.
[01:48:48.440 --> 01:48:56.440]  And the rest of the booking deputy wanted me to answer about four pages of questions,
[01:48:56.440 --> 01:49:02.440]  and she lost her composure completely when I told her repeatedly,
[01:49:02.440 --> 01:49:06.440]  I was not going to answer any questions without aid of counsel,
[01:49:06.440 --> 01:49:10.440]  which at that point she was required by law to stop.
[01:49:10.440 --> 01:49:14.440]  About 20 minutes later, we're still doing this dance.
[01:49:14.440 --> 01:49:17.440]  I'm not answering any questions without aid of counsel,
[01:49:17.440 --> 01:49:22.440]  and she's losing her composure telling me I cannot have a phone call,
[01:49:22.440 --> 01:49:26.440]  I cannot have aid of counsel, and I cannot see a magistrate until she books me.
[01:49:26.440 --> 01:49:31.440]  She can't book me until I answer all of her questions.
[01:49:31.440 --> 01:49:34.440]  And then we start this whole routine over again.
[01:49:34.440 --> 01:49:39.440]  Finally, she loses her temper, runs out of the room, grabs the chief deputy,
[01:49:39.440 --> 01:49:43.440]  he comes back in, tells me he just got off the phone with the sheriff,
[01:49:43.440 --> 01:49:47.440]  and the sheriff doesn't want me in his jail because I'm handicapped.
[01:49:47.440 --> 01:49:50.440]  Well, there's a problem here.
[01:49:50.440 --> 01:49:57.440]  The jail and the sheriff's office does not meet spec under the federal statutes
[01:49:57.440 --> 01:50:04.440]  for jails and penitentiaries and all this for handicapped accessibilities.
[01:50:04.440 --> 01:50:07.440]  The Federal Jail Standards Commission.
[01:50:07.440 --> 01:50:12.440]  Thank you. Correct. Or ADA or TDA.
[01:50:12.440 --> 01:50:19.440]  TDA is the Texans with Disabilities Act, and TDA is more stringent than ADA is.
[01:50:19.440 --> 01:50:24.440]  Any time that there's been a renovation of $20,000 or more in any one year,
[01:50:24.440 --> 01:50:32.440]  they are required to modify up to standard for handicapped accessibility.
[01:50:32.440 --> 01:50:34.440]  They have not done it.
[01:50:34.440 --> 01:50:40.440]  That law came into play, I want to say, 98 or 99.
[01:50:40.440 --> 01:50:43.440]  It could have been 2,000 right in that timeframe.
[01:50:43.440 --> 01:50:47.440]  I don't remember.
[01:50:47.440 --> 01:50:54.440]  But with that having been said, I got basically carried around or helped,
[01:50:54.440 --> 01:50:57.440]  hopscotch back and forth.
[01:50:57.440 --> 01:51:02.440]  And the deputy said, the sheriff said he was going to call the magistrate.
[01:51:02.440 --> 01:51:05.440]  Now, we have three magistrates, two JPs and the county judge
[01:51:05.440 --> 01:51:11.440]  that lives within two blocks of the courthouse in our county seat.
[01:51:11.440 --> 01:51:16.440]  He was going to get the proper magistrate in there and get me out.
[01:51:16.440 --> 01:51:18.440]  I'd be out in about 45 minutes.
[01:51:18.440 --> 01:51:21.440]  They're going to put me out on a PR bond.
[01:51:21.440 --> 01:51:28.440]  Well, this is all my stuff, but this basically lays out some things
[01:51:28.440 --> 01:51:31.440]  that are going wrong with the whole system.
[01:51:31.440 --> 01:51:37.440]  What I get told the next day, after some other things that have occurred,
[01:51:37.440 --> 01:51:43.440]  a friend of mine who works for TxDOT let me know that he'd been listening to the radio.
[01:51:43.440 --> 01:51:50.440]  Now, TxDOT vehicles have all the police band stuff in there
[01:51:50.440 --> 01:51:55.440]  because they have to respond on the highway to accidents and things of this nature.
[01:51:55.440 --> 01:52:01.440]  But also, they pick up all the stuff from Border Patrol.
[01:52:01.440 --> 01:52:07.440]  Border Patrol had canceled their normal roving patrols that morning
[01:52:07.440 --> 01:52:17.440]  because of mud and water standing on some of the roads and things down and out on the back roads.
[01:52:17.440 --> 01:52:22.440]  They couldn't do what they normally do, which is arrest the property owners.
[01:52:22.440 --> 01:52:25.440]  So they were going to do drug interdiction.
[01:52:25.440 --> 01:52:35.440]  What they started doing was telling the sheriff's dispatch who and where they want it stopped.
[01:52:35.440 --> 01:52:42.440]  And what they would do is they would direct the sheriff's patrol deputies or DPS.
[01:52:42.440 --> 01:52:44.440]  There was three DPS officers involved.
[01:52:44.440 --> 01:52:53.440]  The guy that stopped me was one of them, to make a stop outside the urban areas.
[01:52:53.440 --> 01:52:59.440]  We have two of them in the whole county, so that there'd be no witnesses.
[01:52:59.440 --> 01:53:02.440]  Nobody could film anything.
[01:53:02.440 --> 01:53:09.440]  And hold them long enough until the Border Patrol could show up and get the drug dogs out.
[01:53:09.440 --> 01:53:16.440]  How many arrests were made, how many confiscations were made, I don't know yet.
[01:53:16.440 --> 01:53:23.440]  But I do have requests, PIRs, public information requests in for that information.
[01:53:23.440 --> 01:53:26.440]  And the good sheriff is overdue in getting that done.
[01:53:26.440 --> 01:53:34.440]  So the complaint has already gone up to the AG's office because the sheriff told me he isn't going to send me.
[01:53:34.440 --> 01:53:39.440]  Now, let's just put it this way, pieces of excrement.
[01:53:39.440 --> 01:53:52.440]  But with that having been said, and the sheriff is a good friend of mine, he was presented the day after my arrest.
[01:53:52.440 --> 01:53:58.440]  My wife and I spent all night working on several things, one of them was PIR requests.
[01:53:58.440 --> 01:54:03.440]  The other one was an affidavit of criminal, criminal affidavit.
[01:54:03.440 --> 01:54:09.440]  But I got the chief deputy, who's part and parcel of this whole thing, to render the oath.
[01:54:09.440 --> 01:54:18.440]  So pardon my humor here, he didn't realize what he was signing when he rendered the oath and signed the thing.
[01:54:18.440 --> 01:54:21.440]  But after he read it, he started crying.
[01:54:21.440 --> 01:54:24.440]  I accused him of aggravated robbery.
[01:54:24.440 --> 01:54:26.440]  I didn't get my keys back.
[01:54:26.440 --> 01:54:28.440]  I got some of them back.
[01:54:28.440 --> 01:54:31.440]  And the ones I got back had been duplicated.
[01:54:31.440 --> 01:54:37.440]  It was a little film from where they had pressed them into that impression medium.
[01:54:37.440 --> 01:54:47.440]  But two keys, one of them to one of my gates and the other key to some equipment on the next ranch that I monitor and stuff,
[01:54:47.440 --> 01:54:51.440]  high dollar stuff for one of the other people, one of my neighbors.
[01:54:51.440 --> 01:54:55.440]  There's an 8,000 acre ranch over there with a bunch of equipment.
[01:54:55.440 --> 01:54:57.440]  And those keys were gone.
[01:54:57.440 --> 01:55:04.440]  So I nationally called the owner of those keys and told him what had happened, and he's more than upset.
[01:55:04.440 --> 01:55:11.440]  Because it's not the price of the key, it's not the price of the lock that the key goes to.
[01:55:11.440 --> 01:55:20.440]  It's the price of the equipment or whatever it secures that is the value that is set for that.
[01:55:20.440 --> 01:55:33.440]  Well, one of them goes to one of my gates because we'd had somebody come on to the property a couple of days prior to that
[01:55:33.440 --> 01:55:39.440]  and tried to gain access through that particular gate, and they couldn't do it.
[01:55:39.440 --> 01:55:48.440]  Now, I want everybody to understand that we have two miles of highway frontage on Highway 90.
[01:55:48.440 --> 01:55:53.440]  So there are a couple of gates that access the highway,
[01:55:53.440 --> 01:56:00.440]  but then there's gates further in the property that do not face the highway,
[01:56:00.440 --> 01:56:05.440]  and the only way you can get to them is across private property.
[01:56:05.440 --> 01:56:09.440]  That's one of the gates that they took the key to.
[01:56:09.440 --> 01:56:14.440]  But they also entered through a gate that had a combination to it.
[01:56:14.440 --> 01:56:19.440]  They bypassed the combination, or they jiggled it, whatever.
[01:56:19.440 --> 01:56:28.440]  Plus, duplication of the keys, the other keys included key lock sets for some of our storage buildings
[01:56:28.440 --> 01:56:33.440]  and some other things that are all secured that they should not have keys to.
[01:56:33.440 --> 01:56:38.440]  So I have had some expense going out and changing out locks.
[01:56:38.440 --> 01:56:41.440]  Pat, we need to move along a little.
[01:56:41.440 --> 01:56:46.440]  Yeah. Let me step up to what this all entails.
[01:56:46.440 --> 01:56:58.440]  This interagency agreement that a couple of years ago, I think, went on in Austin, Dallas, and Houston
[01:56:58.440 --> 01:57:10.440]  for voluntary DNA testing activities delineated that the officers that were going to be doing that
[01:57:10.440 --> 01:57:20.440]  and the assistants in gathering all that data were paid contractors to the federal agency that was doing it.
[01:57:20.440 --> 01:57:25.440]  I do not have a copy of the current interagency agreement.
[01:57:25.440 --> 01:57:31.440]  We have already subpoenaed the head of DPS because we want to find out what's going on here.
[01:57:31.440 --> 01:57:36.440]  I have an examining trial.
[01:57:36.440 --> 01:57:39.440]  Now, I've already been booked.
[01:57:39.440 --> 01:57:46.440]  So having an examining trial after you've been booked and already out on PR bond is kind of ass backwards,
[01:57:46.440 --> 01:57:48.440]  but that's where we stand right now.
[01:57:48.440 --> 01:57:52.440]  But it's going to be done in the district court.
[01:57:52.440 --> 01:57:55.440]  So it's a court of record.
[01:57:55.440 --> 01:58:03.440]  And there's been a lot of this activity stopping people, not just in my county,
[01:58:03.440 --> 01:58:08.440]  but in other counties involving Border Patrol and DPS.
[01:58:08.440 --> 01:58:13.440]  So if there's anybody out there that knows of somebody that has been stopped like this,
[01:58:13.440 --> 01:58:19.440]  has been given a warning ticket, but then they have had the drug dogs sicked on,
[01:58:19.440 --> 01:58:23.440]  they need to contact you guys and then put them in contact with me.
