[04:53.160 --> 05:00.080]  And in order to initiate an action in the criminal side, you must claim a violation

[05:12.520 --> 05:17.680]  You can't just go to the court and say the dirty rotten scoundrels, they did this bad
[05:17.680 --> 05:21.240]  thing, they did that bad thing, they did the other bad thing.
[05:21.240 --> 05:33.320]  You have to claim, make a claim in terms of a defined tort or a defined cause of action.
[05:33.320 --> 05:41.880]  Now a tort is where if you're driving your truck and the guy in front of you loses his
[05:41.880 --> 05:48.040]  load and he bounces off in front of you and you blow a couple tires, you would sue him
[05:48.040 --> 05:52.160]  for creating a civil tort.
[05:52.160 --> 05:59.360]  For the most part in contract law, you would make your claim based on a defined cause of
[05:59.360 --> 06:00.360]  action.
[06:00.360 --> 06:01.560]  Fraud is one.
[06:01.560 --> 06:10.640]  Fraud per se, fraud by non-disclosure, infliction of emotional distress, there's a whole list
[06:10.640 --> 06:12.800]  of causes of action.
[06:12.800 --> 06:20.840]  Do a search on the internet for New Mexico causes of action and you'll find some treatments
[06:20.840 --> 06:22.920]  of causes of action.
[06:22.920 --> 06:31.800]  Each cause of action, just like a criminal accusation, has a set of elements that must
[06:31.800 --> 06:42.320]  be met, that must be pled and you can't just go down it and say this person made a proactive
[06:42.320 --> 06:44.840]  statement of fact.
[06:44.840 --> 06:48.840]  The person knew that proactive statement of fact was untrue.
[06:48.840 --> 06:54.440]  The person knew that I did not have equal access to information so that I could not
[06:54.440 --> 06:58.040]  determine the truth or falsity of the statement.
[06:58.040 --> 07:03.680]  The person intended that I accept his statement of true, I did accept his statement of true
[07:03.680 --> 07:06.080]  and was harmed thereby.
[07:06.080 --> 07:10.760]  That's a statement of the elements of fraud by non-disclosure.
[07:10.760 --> 07:16.200]  You have to say the person did made these statements to me, he said this, that and the
[07:16.200 --> 07:21.640]  other and he knew that when he was making the statements to me that they were wrong.
[07:21.640 --> 07:28.040]  You need to make the, state the elements in terms of the facts in the case.

[07:46.320 --> 07:51.880]  You have a good statement of facts, you have a good statement of factual accusation.
[07:51.880 --> 07:55.320]  Now all you have to do is go underneath it.
[07:55.320 --> 08:03.160]  Do some research on causes of action and then go back and look at your statements and rewrite
[08:03.160 --> 08:10.120]  your statements so that the statements make an assertion of each of the elements of the
[08:10.120 --> 08:11.760]  cause of action.
[08:11.760 --> 08:17.120]  It's really a lot simpler than it sounds.
[08:17.120 --> 08:21.920]  Once you start through the facts, they'll kind of jump out at you and you take the facts
[08:21.920 --> 08:27.080]  and just reword them slightly so that they'll kind of read in the verbiage of a cause of
[08:27.080 --> 08:32.760]  action because that tells the reader what you're going to tell them.
[08:32.760 --> 08:38.880]  When you go down and write the cause of action, you'll be writing it in language that you've
[08:38.880 --> 08:45.160]  already used earlier and your reader will recognize it and better understand the context
[08:45.160 --> 08:46.160]  of your cause of action.
[08:46.160 --> 08:52.320]  So I just need to specifically add causes of action and a prayer.
[08:52.320 --> 08:53.320]  Exactly.
[08:53.320 --> 08:57.560]  The prayer is what do you want and look at some of the prayers.
[08:57.560 --> 09:11.200]  I suggest that if you can find it, get a set of, there are pattern jury charges.
[09:11.200 --> 09:14.160]  Look up, say, fraud by nondisclosure.
[09:14.160 --> 09:18.240]  Look up the pattern jury charge for fraud by nondisclosure.
[09:18.240 --> 09:24.880]  If anybody out there is writing a suit, that is the place you should start.
[09:24.880 --> 09:30.160]  There are pattern jury charges.
[09:30.160 --> 09:37.760]  The pattern jury charge lists everything that has to be proven so that the jury can find
[09:37.760 --> 09:40.720]  in your favor.
[09:40.720 --> 09:43.880]  Anything else is superfluous.
[09:43.880 --> 09:50.760]  If it's not in the pattern jury charge, no reason to waste your time with it.
[09:50.760 --> 09:56.760]  That will give you direction and then by the time you get to causes of action, it will
[09:56.760 --> 09:57.760]  be natural.
[09:57.760 --> 10:01.120]  You'll already have it structured in your document.
[10:01.120 --> 10:02.120]  Cool.
[10:02.120 --> 10:06.160]  It's not as hard as it seems.
[10:06.160 --> 10:11.300]  There's just a bit of a formal structure.
[10:11.300 --> 10:18.440]  Making an argument in law is not like making an argument with the guy across the street.
[10:18.440 --> 10:24.160]  It has a specific structure and in a civil case, statement of facts, which you have,
[10:24.160 --> 10:32.540]  which often is missing from a set of documents, stating the facts is an art form.
[10:32.540 --> 10:39.220]  You want to state your facts in a way that will cause the reader to come to the conclusions
[10:39.220 --> 10:45.760]  that you want him to come to so that when you then do a statement of factual accusation,
[10:45.760 --> 10:52.720]  you take those bare facts, just facts, no argument of any kind, because that will taint
[10:52.720 --> 10:55.840]  your reader.
[10:55.840 --> 11:01.400]  Put in the facts you need to get the reader to come to the conclusion you want him to.
[11:01.400 --> 11:06.120]  If it doesn't bring you to that conclusion, don't put the fact in there.
[11:06.120 --> 11:10.240]  You only have to put in relevant facts.
[11:10.240 --> 11:14.800]  Put in the facts so if somebody reads it and you ask them what they think about it, they'll
[11:14.800 --> 11:18.240]  give you the conclusion you want them to come to.
[11:18.240 --> 11:25.120]  Then when you do factual accusation, they'll read your accusation and they will mentally,
[11:25.120 --> 11:27.840]  they'll agree with you.

[11:34.920 --> 11:39.640]  And then when you get to causes of action, you will already have your statement written
[11:39.640 --> 11:42.600]  in the verbiage of the cause of action.

[11:49.560 --> 11:57.280]  One other question you said regarding the amount of damages, now it's only a five-year

[12:51.840 --> 13:00.120]  Said, your honor, I checked the county record and there is no record of a trustee's deed

[13:02.760 --> 13:07.880]  And the judge said, well, Mr. Kelkin, he has a trustee's deed right here.
[13:07.880 --> 13:17.160]  Yes, he does, but you can't see it because it is not properly before the court.

[13:22.000 --> 13:28.520]  If he attempts to rule on something that is not before him, what's the crime?

[14:36.360 --> 14:42.760]  And so I accepted it and I filed a withdrawal of my motion for no answer default.

[14:50.760 --> 14:54.720]  and beat yourself around the eyes and ears.

[21:56.560 --> 22:04.000]  and then shut the phone off and reopen it, or shut the app off and reopen it, because

[22:11.480 --> 22:19.040]  all of these documents that, these pages that go in the document, tell it to insert, once

[22:26.840 --> 22:35.040]  If you open Word and tell it to save as, and you can't find PDF, then go out to the internet

[24:17.520 --> 24:22.420]  On this day, at this time, there was filed with the county recorder a document titled
[24:22.420 --> 24:32.840]  as follows, colon, carriage return, then I go over to the PDF document and select the

[24:38.280 --> 24:41.480]  Is it supposed to drop in as an image?
[24:41.480 --> 24:47.920]  Well, if someone has scanned the document as a PDF, when I drop that thing in there,
[24:47.920 --> 24:51.960]  it goes berserk.
[24:51.960 --> 24:54.680]  It just does all kind of weird stuff.
[24:54.680 --> 25:02.120]  I'd never have figured out what is going on, but it's some kind of superfluous code in

[25:03.120 --> 25:11.800]  So, to fix it, I tell, I use Acrobat if you have it, if not, there are a couple of programs
[25:11.800 --> 25:17.360]  online that you can download, Foxit is one of them, that can read the PDF.

[25:21.600 --> 25:27.000]  When you save it as an image, it essentially takes a picture of what it sees and it gets
[25:27.000 --> 25:30.320]  rid of all that superfluous code.
[25:30.320 --> 25:35.080]  Then you take that image and drop it in a Word document, save the Word document back
[25:35.080 --> 25:40.780]  to a PDF, now you got a clean PDF, no trash in it.
[25:40.780 --> 25:45.920]  Now you can run character recognition on it, you got your nice clean document, but for
[25:45.920 --> 25:52.440]  the most part, I suspect if you're just doing research, the photograph itself is plenty.

[26:43.920 --> 26:48.480]  crop out the portion of the screen you want to capture.
[26:48.480 --> 26:55.360]  And then I save that and then just go to the next page and that way I can capture the documents
[26:55.360 --> 27:01.600]  off the screen because most of the time these programs won't let you save the document.
[27:01.600 --> 27:07.920]  So if you can't see the whole document, then shrink the screen to you can and then pull
[27:07.920 --> 27:09.520]  it and drop it.
[27:09.520 --> 27:16.840]  If once you have it down and it's hard to read, you can open it in an editor like Gimp

[27:17.840 --> 27:24.640]  If you have Photoshop, if you don't, you can download Gimp, G-I-M-P, that's a open source

[28:35.520 --> 28:41.760]  that doesn't give you all the documents associated with the case.
[28:41.760 --> 28:46.720]  I found that you can download them from Pacer, but don't you have to pay for every one of
[28:46.720 --> 28:47.720]  those, right?
[28:47.720 --> 28:52.080]  Yeah, but it's only like eight cents a page.

[28:53.400 --> 29:00.400]  It also costs you to look at them on Pacer, but it's such a small amount, it is well worth

[36:55.600 --> 37:00.560]  And I don't know when does the action accrue on, let's say, a credit card debt.

[37:03.680 --> 37:05.920]  Is it the day you quit paying?
[37:05.920 --> 37:12.120]  It's generally when you get a notice of default.

[38:33.960 --> 38:42.080]  If you look for statute of limitations, credit card debt, that'll probably get you the statute.
[38:42.080 --> 38:52.480]  Because in order for an action to be adjudicatable, it's going to have to state what constitutes

[39:34.560 --> 39:42.760]  were very disruptive and spent most of the day contemplating and doing some research
[39:42.760 --> 39:43.760]  on this subject.
[39:43.760 --> 39:52.160]  We don't have any more callers, so I'm going to go back to this particular subject.
[39:52.160 --> 40:00.320]  But it was really reassuring in doing the show last night because we had a lot of people
[40:00.320 --> 40:10.280]  who were really well-adjusted adults with a very difficult problem, not casting stones
[40:10.280 --> 40:14.800]  but trying to find a real remedy.
[40:14.800 --> 40:20.280]  Now, I'm going to suggest a course of action.
[40:20.280 --> 40:32.280]  I mentioned a breach of the peace as an accusation, and the statute is actually designated as
[40:32.280 --> 40:35.080]  disorderly conduct.
[40:35.080 --> 40:44.160]  Disorderly conduct is precisely what this child is doing, and that's good because disorderly
[40:44.160 --> 40:49.440]  conduct is a class C misdemeanor, fine only.
[40:49.440 --> 40:58.880]  It's not the kind of thing that will place a long-term stinging on this kid's record.
[40:58.880 --> 41:07.920]  However, it will give the child a concept of consequences, which he appears not to have
[41:07.920 --> 41:10.040]  at the moment.
[41:10.040 --> 41:18.320]  He's found media as a place where he can go and do outrageous things that he can't do
[41:18.320 --> 41:20.760]  elsewhere.
[41:20.760 --> 41:32.240]  So we need to craft an intervention that will not harm the child but give him reason to
[41:32.240 --> 41:38.560]  find another way of voicing his frustration.
[41:38.560 --> 41:41.880]  Disorderly conduct, let me read disorderly conduct.
[41:41.880 --> 41:50.280]  A person commits an offense if he intentionally or knowingly uses abusive, indecent, profane,
[41:50.280 --> 41:56.280]  or vulgar language in a public place, and the language by its very utterance tends to
[41:56.280 --> 42:03.280]  incite an immediate breach of the peace, makes an offensive gesture or display in a public
[42:03.280 --> 42:16.400]  place, makes an offensive gesture or display in a public place, and the gesture or display
[42:16.400 --> 42:23.760]  tends to incite an immediate breach of the peace, creates by chemical means others negate,
[42:23.760 --> 42:26.640]  it goes on.
[42:26.640 --> 42:31.600]  This goes to exactly what the child is doing.
[42:31.600 --> 42:38.400]  Let me go to 4102, I have it listed as 4102, okay.
[42:38.400 --> 42:44.920]  He's making, using abusive, indecent, profane, or vulgar language in a public place and the
[42:44.920 --> 42:49.920]  language by its very utterance tends to incite an immediate breach of the peace.
[42:49.920 --> 42:55.640]  I should look up breach of the peace, but I'll get to that in a minute.
[42:55.640 --> 43:05.680]  The point here is we don't need a conviction, frankly, we probably don't even want a conviction.
[43:05.680 --> 43:17.200]  What we want are public officials who are, we want public officials who are in a position
[43:17.200 --> 43:27.400]  to visit consequences on the child to do so in a manner that will have a tendency to adjust
[43:27.400 --> 43:30.640]  the child's behavior.
[43:30.640 --> 43:36.920]  And if you've ever seen the skewed straight programs, that's kind of the example I'm thinking
[43:36.920 --> 43:37.920]  about.
[43:37.920 --> 43:47.040]  Right now, the child has been able to do this and experienced no negative feedback and not
[43:47.040 --> 43:48.040]  every degree important.

[46:43.960 --> 46:51.720]  How do we craft an intervention and get our public officials to use their position to
[46:51.720 --> 47:00.080]  help give this child reason to find another outlet for his anger and his frustration?
[47:00.080 --> 47:07.000]  For the most part, public officials, they're human beings just like the rest of us.
[47:07.000 --> 47:14.760]  Now this particular circumstance comes about in Roanoke, Texas and there's a Judge Hand
[47:14.760 --> 47:23.840]  there and while I have some access to grind with Judge Hand, some technical legal access
[47:23.840 --> 47:30.600]  to grind with him, he's not alone in that I have technical legal access to grind with
[47:30.600 --> 47:34.360]  a lot of public officials.
[47:34.360 --> 47:42.840]  With that said, Judge Hand is a grandpa and he's a grown up and he's going to care deeply
[47:42.840 --> 47:46.400]  about helping this child find a better life.
[47:46.400 --> 47:54.200]  But in order to give for him to be able to do something, we have to give him an opportunity
[47:54.200 --> 48:00.680]  and the way we can do that, what I was looking at doing is getting a number of people to
[48:00.680 --> 48:10.360]  write affidavits and a number of people then to write up a criminal affidavit accusing
[48:10.360 --> 48:21.840]  the child and the parents of disorderly conduct because essentially the child is underage
[48:21.840 --> 48:28.440]  and therefore the parents are ultimately responsible for his behavior.
[48:28.440 --> 48:36.080]  So we get a whole stack of complaints against him and we take those complaints to the district
[48:36.080 --> 48:41.840]  attorney and the district attorney is not going to want to act on it.
[48:41.840 --> 48:46.240]  I'm sorry, let me back up.
[48:46.240 --> 48:52.880]  We take complaints against the child and we prepare complaints against the principal.
[48:52.880 --> 49:01.760]  The principal of the school has a duty to protect the children and under Texas Family
[49:01.760 --> 49:15.100]  Code 261-002-003, I'm sorry, 003 actually, 002 requires the child protective services
[49:15.100 --> 49:20.380]  to keep a registry of complaints.
[49:20.380 --> 49:29.920]  What we want to do is get some complaints in that registry, 261-003, application to
[49:29.920 --> 49:40.160]  students at school, I'm getting the wrong one, there's one in here that requires that
[49:40.160 --> 49:53.480]  anyone responsible for the care of children who discovers evidence of abuse or neglect
[49:53.480 --> 50:06.920]  to report that evidence and here this is the principal has knowledge that this child has
[50:06.920 --> 50:13.400]  committed acts that amount to disorderly conduct.
[50:13.400 --> 50:20.640]  Disorderly conduct is a crime in the state of Texas and the principal is obviously aware
[50:20.640 --> 50:29.280]  that the disorderly conduct can be attributed to the parents.
[50:29.280 --> 50:39.760]  So we can claim that the principal had a duty to report this crime.
[50:39.760 --> 50:46.720]  Public officials will say they have no duty to protect you and that's true, they don't,
[50:46.720 --> 50:48.600]  but they do have a duty to enforce law.
[50:48.600 --> 50:52.280]  We don't need public officials to protect us.
[50:52.280 --> 50:53.940]  We need them to enforce law.
[50:53.940 --> 50:56.400]  We have the law to protect us.
[50:56.400 --> 50:57.920]  They just need to enforce it.
[50:57.920 --> 51:01.880]  The principal has knowledge that these crimes have been committed and failed to report those
[51:01.880 --> 51:11.360]  crimes and the principal had a duty to report those crimes, 3903 Penal Code.
[51:11.360 --> 51:15.680]  Public official acting on the call of his authority exerts or purports to exert an authority
[51:15.680 --> 51:23.560]  he does not expressly have or fails to perform a duty he is required to perform.
[51:23.560 --> 51:28.880]  That's misfeasance in office and in the process to not assist in full and free access to or
[51:28.880 --> 51:33.280]  enjoin a right, that's a Class A misdemeanor in the state of Texas.
[51:33.280 --> 51:41.760]  We take a complaint or a number of complaints against the principal to the district attorney.
[51:41.760 --> 51:45.680]  Now the district attorney is on the dime.
[51:45.680 --> 51:51.440]  When we take the complaints to the district attorney, we give the district attorney notice
[51:51.440 --> 51:58.200]  that we're aware of Article 2.03 Texas Code of Criminal Procedure in that when the notice
[51:58.200 --> 52:05.480]  is given to the prosecuting attorney, the prosecuting attorney has a statutory duty
[52:05.480 --> 52:09.600]  to present the complaint to a grand jury.
[52:09.600 --> 52:17.000]  So we file the complaints with the district attorney and you're almost certainly going
[52:17.000 --> 52:24.240]  to get a call from the district attorney's investigator and you explain to the investigator
[52:24.240 --> 52:34.960]  what is going on and ask the investigator to, in lieu of prosecuting the principal for
[52:34.960 --> 52:42.880]  not reporting this crime, ask the district attorney to refer your complaints to Judge
[52:42.880 --> 52:51.640]  Hand and ask Judge Hand to look into this situation and hold an examining trial under
[52:51.640 --> 52:56.720]  Chapter 16 Code of Criminal Procedure.
[52:56.720 --> 53:08.520]  Chapter 16 is an examining trial which is referenced by Article 2.10, 2.11, 2.10 defines
[53:08.520 --> 53:13.280]  the duties of a magistrate, it's the duty of the magistrate to keep the peace in the
[53:13.280 --> 53:21.360]  county using all legal means, 2.11, when a magistrate sits for the purpose of examining
[53:21.360 --> 53:29.960]  into a criminal accusation, that is an examining court, you want to get the prosecutor to ask
[53:29.960 --> 53:37.680]  Judge Hand to hold an examining court and at the examining court, the child is brought
[53:37.680 --> 53:43.880]  into court, the parents are brought into court and then the students who've been abused
[53:43.880 --> 53:51.960]  by the child can be called up to the stand, tell the court what has happened, the parents
[53:51.960 --> 53:58.440]  can be called up to the stand, explain what happened and then the child is asked to if
[53:58.440 --> 54:05.600]  he wants to explain this, explain himself, he can or he doesn't have to, the parents
[54:05.600 --> 54:13.720]  can be called to the stand and questioned and what I'm suggesting is you encourage
[54:13.720 --> 54:27.880]  Judge Hand not to prosecute this child but to give the child an example of consequences.
[54:27.880 --> 54:36.240]  What I'm suggesting is a little song and dance and seltzer down your pants, just put
[54:36.240 --> 54:44.400]  on a show for this child to give him an idea of what can happen if he fails to act and
[54:44.400 --> 54:52.480]  if he continues to act in these manners, I would suspect the child is 14 years old, he's
[54:52.480 --> 55:02.920]  not a grown up, this kind of demonstration by intelligent and compassionate adults, while
[55:02.920 --> 55:10.680]  the child wouldn't like it, we wouldn't consider it fun at all, he will get a different perspective
[55:10.680 --> 55:18.960]  on what he's been doing and maybe we can prevent the child from ruining his whole life.
[55:18.960 --> 55:31.240]  My biggest concern in this whole issue is that the child will make a threat or say something
[55:31.240 --> 55:39.800]  very offensive toward one of the children in middle school who has an older brother
[55:39.800 --> 55:49.560]  in high school, this could lead to very very bad outcomes, so I would suggest that the
[55:49.560 --> 55:59.760]  parents get together and make up a well constructed complaint against the principal.
[55:59.760 --> 56:07.440]  Now you all know that the principal knows what's going on and the principal has failed
[56:07.440 --> 56:14.760]  to do what the principal has a duty to do for political reasons, everything's political,
[56:14.760 --> 56:25.360]  the last thing the principal wants is a first amendment lawsuit, but from your perspective
[56:25.360 --> 56:31.440]  you don't care what the principal wants or doesn't want, I recently had my chief of police
[56:31.440 --> 56:35.600]  didn't want to take a complaint that I brought to him because he showed me some other complaints
[56:35.600 --> 56:42.760]  that he felt were more serious and he asked me where should I expend my funds for this
[56:42.760 --> 56:48.600]  office on this complaint or on this one over here, he said I'm not interested in your funds
[56:48.600 --> 56:53.920]  in your office, I'm interested in your oath of office and I'm interested in you abiding
[56:53.920 --> 56:59.640]  by your oath of office, if you're going to be the chief of police learn how to allocate
[56:59.640 --> 57:07.200]  funds, get the job done, I'm not interested in your complaining, but he wasn't happy about
[57:07.200 --> 57:14.160]  that and it was intended that he wasn't, he was thought to be happy, the principal needs
[57:14.160 --> 57:22.800]  to be put in a position such that the potential political fallout from a first amendment suit
[57:22.800 --> 57:35.240]  is far, far less than the fallout from a presentation of her behavior to a grand jury of your peers
[57:35.240 --> 57:47.400]  and it's kind of serendipitous that the day I was notified of this issue was the very
[57:47.400 --> 57:53.280]  day that I filed a set of criminal complaints with the Tarrant County District Attorney
[57:53.280 --> 58:00.600]  for the purpose of opening the door to grand juries, hang on, we're going to the top of

[01:04:33.320 --> 01:04:41.400]  Judges especially, they deal with people who are in crisis situations and for the most
[01:04:41.400 --> 01:04:49.240]  part these are people who have been jerked out of their orderly lives and thrust into
[01:04:49.240 --> 01:04:56.220]  a circumstance over which they have no knowledge or experience.
[01:04:56.220 --> 01:05:03.020]  When that happens to people, they tend to draw out their worst behaviors and judges
[01:05:03.020 --> 01:05:06.280]  and police officers, they deal with this stuff all the time.
[01:05:06.280 --> 01:05:14.520]  So they tend to be leery of people and they're always kind of covering their own backsides.
[01:05:14.520 --> 01:05:28.000]  If we can give Judge Hand reason to exercise some discretion here, we will do that by generating
[01:05:28.000 --> 01:05:30.860]  some political leverage.
[01:05:30.860 --> 01:05:36.340]  They all tend to try to protect one another and when the parents come in making accusations
[01:05:36.340 --> 01:05:44.760]  against the school principal, Judge Hand is not going to want the principal to lose your
[01:05:44.760 --> 01:05:51.120]  job and I'm certain that most of you who are involved in this situation don't want to lose
[01:05:51.120 --> 01:05:58.340]  your job either, but you want to do what's right, you want her to fix this problem.
[01:05:58.340 --> 01:06:03.600]  So we may have to give her reason to fix the problem.
[01:06:03.600 --> 01:06:10.040]  In order to understand how to generate the reason, we need to understand the politics
[01:06:10.040 --> 01:06:22.320]  and one way that I try to define this so it's easy to understand is with a four-sided chessboard.
[01:06:22.320 --> 01:06:25.680]  Everything here is about relationships.
[01:06:25.680 --> 01:06:33.560]  Everybody involved in this situation has relationships with others involved in it.
[01:06:33.560 --> 01:06:41.080]  Let's say the parents, the parents in this situation go to the school system to get something
[01:06:41.080 --> 01:06:42.080]  done.
[01:06:42.080 --> 01:06:48.520]  Well, consider yourself as sitting on one side of a four-sided chessboard.
[01:06:48.520 --> 01:06:51.560]  To your right is your principal.
[01:06:51.560 --> 01:06:58.280]  To your left is the school board and across from you is the Texas Education Agency.
[01:06:58.280 --> 01:07:06.960]  Well, the principal has a relationship with you and a relationship with the TEA and a
[01:07:06.960 --> 01:07:09.480]  relationship with the school board.
[01:07:09.480 --> 01:07:14.160]  You only have a relationship with the principal.
[01:07:14.160 --> 01:07:19.120]  So it makes it hard for you to get anything done and now the principal here, he's looking
[01:07:19.120 --> 01:07:29.160]  at the TEA and the school board who if he gets or she does something that causes the
[01:07:29.160 --> 01:07:36.360]  system, the school to become embroiled in a major lawsuit, his or her position is not
[01:07:36.360 --> 01:07:44.040]  going to be too stable because these two over here are going to express influence on the
[01:07:44.040 --> 01:07:46.160]  principal.
[01:07:46.160 --> 01:07:51.840]  If we want the principal to do what needs to be done, we need to give the principal
[01:07:51.840 --> 01:07:55.920]  plausible deniability.
[01:07:55.920 --> 01:07:57.960]  And how do you give them plausible deniability?
[01:07:57.960 --> 01:08:00.920]  I'll give you an example.
[01:08:00.920 --> 01:08:08.640]  I was at the Secretary of State's building in Austin trying to get an apostille.
[01:08:08.640 --> 01:08:12.920]  An apostille is a verification of a notary.
[01:08:12.920 --> 01:08:19.160]  If you have a document that you're sending out of country and it has a notary seal on
[01:08:19.160 --> 01:08:23.840]  it, the other country can't verify the notary seal.
[01:08:23.840 --> 01:08:27.680]  So you take it to the Secretary of State, they will look at the notary seal.
[01:08:27.680 --> 01:08:33.600]  They will check the notary's bona fides and once they're established, they will place
[01:08:33.600 --> 01:08:39.760]  on it an apostille, a warranty from the Secretary of State that this is a valid acknowledgement.
[01:08:39.760 --> 01:08:42.720]  Well, they didn't want to give me one.
[01:08:42.720 --> 01:08:45.040]  So I called 911.
[01:08:45.040 --> 01:08:47.680]  The Capitol Police showed up.
[01:08:47.680 --> 01:08:52.880]  They're actually members of the Department of Public Safety.
[01:08:52.880 --> 01:08:55.160]  And they wouldn't take my complaint.
[01:08:55.160 --> 01:09:01.120]  Then they wanted to, the guy they sent wanted to show me how tough he was.
[01:09:01.120 --> 01:09:04.680]  So I called 911 on him.
[01:09:04.680 --> 01:09:14.780]  And they wound up arresting me for criminal trespass.
[01:09:14.780 --> 01:09:17.800]  They ordered me to leave the Secretary of State's building and I told them I can't
[01:09:17.800 --> 01:09:18.800]  leave.
[01:09:18.800 --> 01:09:22.720]  I've already called the police on you guys and I'm waiting for the police to come and
[01:09:22.720 --> 01:09:24.160]  arrest you.
[01:09:24.160 --> 01:09:28.720]  If I leave, they'll charge me with making a false report.
[01:09:28.720 --> 01:09:32.800]  There's something I understood about the Department of Public Safety that most people
[01:09:32.800 --> 01:09:35.000]  probably don't.
[01:09:35.000 --> 01:09:39.200]  The Department of Public Safety aren't peace officers.
[01:09:39.200 --> 01:09:42.360]  They may be certified peace officers.
[01:09:42.360 --> 01:09:46.640]  They may have a certification, but they're not employed as peace officers.
[01:09:46.640 --> 01:09:54.100]  They are employed as police officers and in Texas, we have a special designation for a
[01:09:54.100 --> 01:10:00.240]  peace officer and a different designation for a police officer.
[01:10:00.240 --> 01:10:03.920]  A police officer is a traffic cop.
[01:10:03.920 --> 01:10:11.320]  The Texas Administrative Code that creates the Department of Public Safety specifically
[01:10:11.320 --> 01:10:20.480]  states that the Department of Public Safety may not enforce the criminal laws except at
[01:10:20.480 --> 01:10:27.320]  the request of and under the direction of local law enforcement to the traffic cops.
[01:10:27.320 --> 01:10:36.240]  In this case, they're not doing traffic, so now they're security guards.
[01:10:36.240 --> 01:10:42.600]  They threatened me in order to prevent me from testifying against them.
[01:10:42.600 --> 01:10:47.560]  I call that a violation of 3605 Penal Code, tampering with the witness.
[01:10:47.560 --> 01:10:50.800]  Called 911, asked for the Austin police to come out and arrest them.
[01:10:50.800 --> 01:10:55.440]  They got a sergeant came by and he got real ugly with me, smashed me into a wall, knocked
[01:10:55.440 --> 01:10:59.200]  out one of my teeth, threw me in jail.
[01:10:59.200 --> 01:11:03.320]  Then they found out who I was and let me out the next day without charging me, and then
[01:11:03.320 --> 01:11:05.280]  I went after them.
[01:11:05.280 --> 01:11:13.920]  Well, in facing the charge, they called me into the court.
[01:11:13.920 --> 01:11:20.200]  I got a summons to show up at court and they didn't tell me why, so I got in front of the
[01:11:20.200 --> 01:11:21.200]  judge.
[01:11:21.200 --> 01:11:26.160]  He said, your honor, I have this summons here, but then tell me why I've been summoned.
[01:11:26.160 --> 01:11:28.240]  You want to tell me what I'm doing here?
[01:11:28.240 --> 01:11:33.080]  She said, well, Mr. Kelton, we needed to find out if you had an attorney.
[01:11:33.080 --> 01:11:34.720]  I'm sorry.
[01:11:34.720 --> 01:11:40.080]  At first, I asked her why we were here and she said, because I have an attorney.

[01:22:30.480 --> 01:22:41.800]  The judge had instructed an assistant district attorney to notify the court reporter to be
