[00:36.960 --> 00:37.960]  That's coinarch.com.
[00:37.960 --> 00:43.680] In the news, a new study from the International Physicians for the Prevention of Nuclear War
[00:43.680 --> 00:48.480] has found that the United States' war on terror has caused more than a million deaths in Iraq,
[00:48.480 --> 00:50.560]  Afghanistan and Pakistan.
[00:50.560 --> 00:55.500] The report points out that while the U.S.-led multinational force in Iraq, NATO and other
[00:55.500 --> 01:00.640] military operations, have maintained statistics for American casualties, they have failed
[01:00.640 --> 01:02.780] to track the number of foreign deaths.
[01:02.780 --> 01:08.160] The study also says the U.S. government number ignore casualties, injured or killed, involving
[01:08.160 --> 01:13.880]  enemy combatants and civilians.
[01:13.880 --> 01:20.040] A new 9-11 review commission report examined how well the FBI implemented changes recommended
[01:20.040 --> 01:22.660]  following the September 11 attacks.
[01:22.660 --> 01:27.560] The report suggests the FBI should expand domestic spying operations to include entire
[01:27.560 --> 01:30.560] ethnic communities as part of the war on terror.
[01:30.560 --> 01:34.760] The commission calls for domain awareness or monitoring of racial, ethnic or religious
[01:34.760 --> 01:39.760] groups in search of individuals who might become radicalized and commit acts of terror.
[01:39.760 --> 01:45.040] The report also discusses the FBI using community outreach or infiltration of communities suspected
[01:45.040 --> 01:48.760]  of terrorism.
[01:48.760 --> 01:53.280] Both the Democrats and Republicans are proposing legislative solutions to the Federal Communications
[01:53.280 --> 01:56.600]  Commission's recent net neutrality measures.
[01:56.600 --> 02:00.880] Republicans have introduced legislation to codify the FCC's order, including prohibitions
[02:00.880 --> 02:05.880] on Internet service providers from blocking, slowing or selling priority delivery of content
[02:05.880 --> 02:07.360]  to consumers.
[02:07.360 --> 02:11.600] Leading Democrats have expressed an interest in working with Republicans to pass a bill
[02:11.600 --> 02:14.800] that establishes net neutrality as law.
[02:14.800 --> 02:18.480] The Liberty Beat is brought to you by Central Texas Gunworks.

[13:24.520 --> 13:32.920] out for help and from what you've told me about his parenting it seems clear that the
[13:32.920 --> 13:42.760] parents are the problem and I'm going to suggest that therein lies the solution.
[13:42.760 --> 13:50.200] The parents need a little discipline so that they learn how to give discipline to the child
[13:50.200 --> 13:57.640] or depending on how dysfunctional the parent is the parent the parents themselves are the
[13:57.640 --> 14:08.360] child may need to be in another place with that said let's go back to remedy there are
[14:08.360 --> 14:14.680] you know I keep as I do this show people bring things up and I keep thinking about the line
[14:14.680 --> 14:22.040] in the song that says after all the crap I've learned in high school it's a wonder I can
[14:22.040 --> 14:31.000] think it all the things we will talk about you won't find in high school school system
[14:31.000 --> 14:38.840] doesn't teach this part and they absolutely should so first I'm going to give a few basics
[14:38.840 --> 14:50.440] to give reference to the remedies I'll address later and these go to some common commonly
[14:50.440 --> 15:01.160] held misconceptions about the nature of the law and the system that we live in and the
[15:01.160 --> 15:09.000] first one is that the courts are just that you can go to the courts and seek justice
[15:10.280 --> 15:17.320] nothing could be further from the truth if you go to court you can expect the court to
[15:17.320 --> 15:23.000] rule against you out of hand at every turn you know I help people with foreclosure issues and
[15:23.000 --> 15:29.400] this is what I tell them if you file a case in court the banks have pretty well bought and paid
[15:29.400 --> 15:35.320] for the courts the courts going to rule against you out of hand at every turn not necessarily a
[15:35.320 --> 15:44.360] problem it's merely a parameter I'm an engineer engineers we we really don't have opinions about
[15:44.360 --> 15:51.560] how the world should be we just have to deal with it so these are parameters expect the courts to
[15:51.560 --> 16:00.360] rule against you also you should understand you will never win your case simply because you have
[16:00.360 --> 16:09.080] the law and the facts on your side to think so it's naive it is not that way now it never ever has
[16:09.080 --> 16:18.840] been that way I once read an interpretation of a plaque found in across in Nineveh across from
[16:18.840 --> 16:28.040] Mosul in Iraq in a library they discovered there that was six thousand years old this was an
[16:28.040 --> 16:36.840] Akkadian king commissioned this plaque to proclaim that he was reasserting the old law because those
[16:36.840 --> 16:44.280] impositions of power and influence have so perverted the law that the citizen can no longer
[16:44.280 --> 16:52.280] achieve justice if this has been going on for at least six thousand years don't expect it to
[16:52.280 --> 16:56.840] change tomorrow but that's not necessarily a bad thing going to break we'll be right back on the
[16:56.840 --> 17:04.280] other side we're in our time through advances in technology our lives have greatly improved
[17:04.280 --> 17:09.240] except in the area of nutrition people feed their pets better than they feed themselves
[17:09.240 --> 17:15.080] and it's time we changed all that our primary defense against aging and disease in this toxic
[17:15.080 --> 17:21.080] environment is good nutrition in a world where natural foods have been irradiated adulterated
[17:21.080 --> 17:27.080] and mutilated young Jevity can provide the nutrients you need Logos Radio Network gets

[18:59.880 --> 19:20.360] you are listening to the logos radio network logosradio.com
[19:30.680 --> 19:39.080] okay we are back randy kelton derby stevens rule of law radio and we're talking about
[19:39.720 --> 19:45.880] how to handle really difficult situations and i know what i'm saying may sound
[19:47.480 --> 19:53.880] depressing or you know it may may give you the feeling that you have no remedy
[19:53.880 --> 20:01.480] i'm going to assure you you actually absolutely do have remedy the reason remedy is so hard to find
[20:02.440 --> 20:09.000] is things are not the way we expect them to be and they certainly are not the way they taught us
[20:09.000 --> 20:15.000] in high school that they were first thing to understand is you'll never win your case
[20:15.800 --> 20:22.200] simply because you have the law and the facts on your side you will win the case if you have
[20:22.200 --> 20:33.320] the politics on your side everything is political and all politics is local that's the key that's
[20:33.320 --> 20:41.960] the magic understanding that will change the way you go about this the school the school is
[20:41.960 --> 20:52.040] school is while they have a set of rules laws and guidelines they only use those to manipulate the politics
[20:53.960 --> 20:58.360] everything is about politics everything is about what my boss thinks about me
[20:59.080 --> 21:05.480] and what my subordinates think about me i'm at a certain level on the totem pole
[21:05.480 --> 21:11.000] everybody above me is worried about me trying to get their position and everybody below me
[21:11.000 --> 21:17.240] is trying to get my position everything's political so if we're going to win our case
[21:17.240 --> 21:24.760] if we're going to get something done i'm an engineer and and i'm very cognizant of the law
[21:24.760 --> 21:32.840] i treat the law as a tech manual it took me a long time to understand that nobody else treats it as a
[21:32.840 --> 21:38.360] nobody else treats it as a tech manual they just use it as a tool to get what they want
[21:40.760 --> 21:47.320] politics is everything so how do we generate politics here one of the things when i first
[21:47.320 --> 21:53.640] heard the issue the problem is clearly not the child child screaming out for help
[21:53.640 --> 22:02.600] and anything we do to the child any finger we point directly at the child will bring negative
[22:02.600 --> 22:10.120] politics back at us so what we have to do is think in a little higher terms
[22:12.040 --> 22:18.680] what influences brought this child to this position and how can we get at those influences
[22:18.680 --> 22:25.480] my first thought is that the parents were the ones who were responsible for the child
[22:26.280 --> 22:32.920] 14 year olds not responsible for himself yet the parents are so how do we get at the parents
[22:34.680 --> 22:45.080] in listening to people talk about this issue i get the impression that this child's use of his
[22:45.080 --> 22:51.880] first amendment rights has caused a considerable amount of emotional distress
[22:54.040 --> 23:02.600] now while causing somewhat emotional distress may not be legal it's certainly a civil tort
[23:05.160 --> 23:11.720] and what if all you folks got together who have been traumatized by this situation
[23:11.720 --> 23:18.760] and filed a tort letter with the parents first in order to sue the courts want you to
[23:19.560 --> 23:27.240] exercise civil all of your civil remedies prior to using the courts they want you to use the courts
[23:27.240 --> 23:35.080] as a remedy of last resort and not first resort the way you show the court that you've exercised
[23:35.080 --> 23:42.440] your civil remedy is by sending them a tort letter you send the parents a letter notifying them
[23:42.440 --> 23:51.720] of what the child has done and that the child by committing by acting in this way knowingly and
[23:51.720 --> 24:03.240] intentionally caused your children and you extreme emotional distress and that's what we need to do
[24:03.240 --> 24:12.600] stress and i can't see a jury on the planet who would disagree with you there's nothing worse
[24:13.480 --> 24:19.480]  than attacking someone's children i lost a grandson a couple of years ago
[24:21.240 --> 24:26.040] i can't imagine anything worse than outliving one of my children
[24:26.040 --> 24:33.320] so to have your children being threatened this will cause extreme emotional distress now granted
[24:33.320 --> 24:40.200] the parents may not have anything although they may if the father was arrested for shoplifting
[24:40.200 --> 24:49.800] they probably are not in the upper brackets of income however a civil action will very
[24:49.800 --> 24:56.200] a civil action will very seriously get their attention because it can potentially lead to
[24:56.200 --> 25:05.000] more serious issues if the father drives a car if they have a house they're looking at the
[25:05.000 --> 25:12.360] possibility of losing everything and you don't have to have a law violated to get out of this way
[25:12.360 --> 25:24.760] in the statements that i read he named individual persons he only named them by first name however
[25:26.280 --> 25:35.640] he is in he's talking about being in school and if there's only one possible person of that name
[25:35.640 --> 25:45.160] that he could be referring to then that person has been slandered and that's a torch now while
[25:45.160 --> 25:52.280] you have a first amendment right you can't screen fire in a crowded theater there are limits to the
[25:52.280 --> 26:01.160] first amendment rights and what the school is doing in order to avoid being sued itself it's
[26:01.160 --> 26:09.800] trying to treat first amendment rights as they're totally unassailable and that is not true so send
[26:09.800 --> 26:21.800] a tort letter to the to the school board give them notice that the school has failed in their duty to
[26:21.800 --> 26:30.920] protect the children and they allowed this abuse of the first amendment right to inflict
[26:31.400 --> 26:40.760] extreme emotional distress on all of the parents you might have everyone who has a concern send
[26:40.760 --> 26:51.640] everyone who has a concern send notice to the school board that you have been harmed and come
[26:51.640 --> 26:57.080] up with an amount it's generally not a good idea to just pick one out of the area you might pull
[26:57.080 --> 27:05.720] some you know go on the internet and do a search for severe emotional for infliction of severe
[27:05.720 --> 27:13.400] emotional distress and see what amounts have been asked for in other cases and take an amount
[27:14.360 --> 27:22.440] put it in the tort letter and send it to the school board if they get about 40 or 50 tort letters
[27:23.400 --> 27:30.920] that's going to get them a hopping and a jumping because in the end it's all about the money
[27:30.920 --> 27:36.920] and by sending the tort letters they have official notice that this is there is a problem here
[27:37.960 --> 27:48.200] if the child does anything to harm anyone even if it's not serious then you can go back to the
[27:48.200 --> 27:57.320] school under the depraved heart doctrine depraved heart doctrine if you have knowledge that something
[27:57.320 --> 28:06.840] bad's going to happen to someone and you have opportunity to intercede and you don't
[28:08.440 --> 28:15.720] and something bad happens you could potentially be charged to under the depraved heart doctrine
[28:15.720 --> 28:24.120] with whatever harm come to the person now that hasn't been adjudicated a lot in texas it is in

[33:15.960 --> 33:33.240] in the mind the hand won't you follow the law of the land
[33:45.960 --> 33:55.000] you're gonna stop okay we are back randy kelton february stevens rule of law radio
[33:56.360 --> 34:05.880] and we're talking about politics how to create ourselves a little politics and what we want to
[34:05.880 --> 34:13.080] do is black every public official's eye that we can we want to put a public official in a position
[34:13.080 --> 34:18.600] to where he's afraid he's going to have to answer questions that he doesn't want to ask
[34:18.600 --> 34:25.880] tomorrow doesn't want to answer now that's just one idea about a civil action
[34:26.680 --> 34:32.600] civil actions are extremely powerful tort letters are extremely powerful my wife bought a five
[34:32.600 --> 34:38.680] thousand dollar leather couch and it was horrible she complained about it for months they finally
[34:38.680 --> 34:44.360] told her you can bring it back but we'll charge you a 40 percent restocking charge i sent him a
[34:44.360 --> 34:50.840] tort letter in the body of the tort letter was the complaint i filed with the better business bureau
[34:52.360 --> 34:57.880] they couldn't get the money back to us fast enough sent a truck out to pick up the couch
[35:00.200 --> 35:04.280] and when you write a tort letter if you know someone who's a lawyer have them show you how
[35:04.280 --> 35:12.760] to structure the tort letter so that it looks like a lawsuit and you take the court heading
[35:12.760 --> 35:18.360] off the top of it and put a business letter heading on the top and in the bottom of a lawsuit
[35:18.360 --> 35:24.600] the last thing in a lawsuit is a prayer and in the prayer you ask the court to grant you what you
[35:24.600 --> 35:34.200] want change prayer to i have been harmed then stayed in there how you've been harmed how much
[35:34.200 --> 35:41.160] you've been harmed by make me whole or be sued boom i generally say make me whole within 30 days
[35:41.160 --> 35:48.600] or be sued sign it they will get it they'll give it to the lawyer and they will the lawyer will
[35:48.600 --> 35:54.840] look at it and say this guy's just not huffing and puffing he's already written the lawsuit he
[35:54.840 --> 36:01.400] is going to sue you that's what i did when i crafted that complaint and their lawyer looked
[36:01.400 --> 36:08.120] at it said yeah this guy's going to sue you okay now we get to the dirty tricks section
[36:09.400 --> 36:17.160] i was in a court recently and the attorney on the other side was pretty angry at me i knew the law
[36:17.160 --> 36:23.080] better than they did and they really hate that and the lawyer said mr kelton are you an attorney
[36:23.080 --> 36:32.360] i said oh no i'm not here dangling by my bar card now i tell people if you're a pro se litigant
[36:32.920 --> 36:39.000] the court's going to rule against you out of hand at every turn that's okay because as a pro se
[36:39.000 --> 36:48.200] litigants you have powers and ability far beyond those of a normal attorney an attorney goes into
[36:48.200 --> 36:57.720] court literally dangling by his bar card a court a judge can jerk a lawyer's bar card on a whim
[36:59.640 --> 37:09.640] attorneys are terrified of judges what i hope you come away from this understanding is that all of
[37:09.640 --> 37:19.400] those judges are public servants they are the servants you are the masters when you walk into
[37:19.400 --> 37:27.880] a court you have standing and you have power they can't deal with i had a friend who does
[37:27.880 --> 37:35.400] expert witness testimony around the country and he was in florida and testifying and said the judge
[37:35.400 --> 37:42.200] said the judge turned to him and said mr escoville i don't like what i'm hearing
[37:43.320 --> 37:52.040] you're very close to a contempt of court charge i said what'd you say joe did you ask the bailiff
[37:52.040 --> 38:02.760] to arrest the judge he said why no man a judge says that garbage to me 3605 texas penal code
[38:02.760 --> 38:08.760] if you say anything for the purpose of intimidating a witness or changing a witness's testimony
[38:09.480 --> 38:17.400] that's a felony in texas and i don't care if you are the judge you got a judge you have an attitude
[38:17.400 --> 38:25.560] mr judge i'll show you how to get that attitude adjusted i was in the courtroom in weiss county
[38:25.560 --> 38:31.880] texas talking to the bailiff the judge ran in the courtroom the district judge and pointed his
[38:31.880 --> 38:36.200] finger at me mr kelton you're creating a disturbance you get out of this courthouse
[38:36.200 --> 38:41.640] or i'll have you arrested i reached in my pocket pulled out this digital tape recorder i said i'm
[38:41.640 --> 38:47.000] sorry judge i didn't have this turned on click stuck it in his face will you say that again
[38:48.040 --> 38:53.880] well he didn't he ran out of the courtroom i charged him with making a terroristic threat
[38:53.880 --> 39:02.040] that your public officials absolutely do not know the law that they are under
[39:04.120 --> 39:08.360] read the penal code i have people read the penal code code criminal procedure
[39:09.160 --> 39:17.240] they look like really big books they're kind of big but 90 of what's in there really doesn't apply
[39:17.240 --> 39:23.560] except to really unusual circumstances and they're in outline format so there's a whole lot of uh
[39:23.560 --> 39:29.800] white space in there take out your penal code read through it quickly don't try to understand
[39:29.800 --> 39:35.320] all of it just read it then go back and read it again do the same thing with code of criminal
[39:35.320 --> 39:40.520] procedure and you'll get into sections about property and about probate that you really don't
[39:40.520 --> 39:48.360] care about it won't take long at all then when you go to the court you'll know their law better than
[39:48.360 --> 39:57.720] they do and i can tell you they hate that so once we get the civil part down now we go for the
[39:57.720 --> 40:07.160] officials if you have a complaint against anyone never give it to the district attorney never give
[40:07.160 --> 40:15.640] it to the police department make up a complaint and take it to a magistrate every judge is a
[40:15.640 --> 40:22.600] magistrate the problem with doing that is the judges have been trained to believe they're not
[40:22.600 --> 40:29.640] magistrates so when you go to the judge with a criminal complaint he's going to tell you that
[40:29.640 --> 40:39.960] you have to go somewhere else and when they do that they have violated 39.03 penal code if you're
[40:39.960 --> 40:46.920] going to have any dealings with public officials you have you should have this one memorized
[40:47.880 --> 40:56.760] 39.03 penal code comes from the Ku Klux Klan act 1871 after the war during the reconstruction
[40:56.760 --> 41:02.680] the north sent all these uh carpetbaggers down to the south to tell the south how to run their
[41:02.680 --> 41:11.000] business they left the sheriffs and mayors and constables in place so that the whole legal
[41:11.000 --> 41:17.000] structure didn't fall apart they just gave them new directions and for the most part the judges
[41:17.000 --> 41:22.280] and the sheriffs and the constables sent the carpetbaggers back in and they put together
[41:22.280 --> 41:27.400] the Ku Klux Klan and the Ku Klux Klan is running around doing anything it wanted to so they passed
[41:27.400 --> 41:37.640] this act that said that if a public official violates a law relating to his office or fails
[41:37.640 --> 41:43.320] to perform a duty he is required to perform i'm sorry let me back up and do that correctly
[41:43.320 --> 41:49.400] if a public official acting under the color pretense of his authority exerts or purports
[41:49.400 --> 41:57.000] to exerted authority he does not expressly have or fails to perform a duty he is required to perform
[41:57.960 --> 42:01.640] and in the process denies a citizen full free access to her enjoyment right
[42:02.760 --> 42:08.680] well that's class a misdemeanor most people know about the Ku Klux Klan act because of 42 u.s code
[42:08.680 --> 42:15.480] 1983 that's the portion of the code that authorizes you to sue this individual
[42:15.480 --> 42:20.040] that's the second part of the Ku Klux Klan act the first part makes it criminal everybody
[42:20.040 --> 42:30.680] forgets about that part so if you have a principle here that this principle has certain duties
[42:30.680 --> 42:38.360] read what his duties are and if you can construe that he failed to perform a duty he was required
[42:38.360 --> 42:42.360] to perform then you go down to the magistrate and file a criminal complaint against him
[42:42.360 --> 42:48.440] and file a criminal complaint against him okay with that said you're not going to get the
[42:48.440 --> 42:55.800] principal prosecuted we don't care about that that's all politics as soon as you file that
[42:55.800 --> 43:01.080] complaint the judges are so you need to accept the police department well say okay so you go
[43:01.080 --> 43:05.480] to the police department file a complaint against the judge for not taking the complaint
[43:05.480 --> 43:14.360] i just did that today with the tarrant county district court i accused the justice of the
[43:14.360 --> 43:20.520] peace of failing to act on a criminal complaint against another justice of the peace
[43:21.800 --> 43:26.680] and i call this my little my tar baby syndrome i go to a public official and ask them to do
[43:26.680 --> 43:33.640] something and they don't do it you see i have a rule never ask a public official to do anything
[43:33.640 --> 43:39.880] you actually want them to do because you never ask a public official to do anything that the law
[43:39.880 --> 43:45.880] does not specifically command them to do when they don't you get to clobber them big time
[43:46.920 --> 43:53.000] so when we come back we'll talk about the school board and the principle and what they're supposed
[43:53.000 --> 43:57.640] to do randy kelton david steven rule of law radio we'll be right back

[46:25.240 --> 46:49.720] okay we are back randy kelton deborah stevens rule of law radio
[46:49.720 --> 46:55.320] and i'm trying to convince condense an eight-hour seminar down into just a few minutes
[46:56.040 --> 47:03.960] but apparently i have a pretty astute audience today because someone's out there is one step ahead
[47:03.960 --> 47:11.880] of me the kooklux klan act the criminal section of the kooklux klan act was codified
[47:11.880 --> 47:24.680] into 18 us code 242 every state has a similar statute in the state statutes and in texas 39.03
[47:24.680 --> 47:33.160] penal code texas is unique in that it has two statutes on this subject it has an official
[47:33.160 --> 47:40.360] misconduct statute in every other state i've been to this the official misconduct statute is the only
[47:40.360 --> 47:47.800] one and it covers the whole area texas we have it broken into two official misconduct official
[47:47.800 --> 47:55.720] oppression official misconduct goes to a public official misabusing his office using equipment
[47:55.720 --> 48:05.160] or misappropriating funds those kinds of things official oppression separate statute distinct from
[48:05.160 --> 48:12.840] official misconduct the fa public official acting under the color or pretense of his office exerts
[48:12.840 --> 48:17.240] or purports to exert an authority he does not expressly have or fails to perform a duty he is
[48:17.240 --> 48:22.120] required to perform and in the process denies a citizen in the full and free access to her
[48:22.120 --> 48:29.160] enjoyment of right that's crime in the states texas one other statute you all should know
[48:29.160 --> 48:38.200] no article 2.03 texas code of criminal procedure chapter two duties of officers first one they
[48:38.200 --> 48:44.040] address the prosecuting attorneys 2.01 it shall be the primary duty the prosecuting attorney not to
[48:44.040 --> 48:50.120] secure conviction but to ensure that justice is served he shall not seek witnesses or evidence
[48:50.120 --> 48:54.040] that may show the innocence of the accused to mitigate the guilt of the accused well that's
[48:54.040 --> 49:00.520] nice high-minded rhetoric but it really doesn't tell the prosecutor do anything specific 2.02
[49:01.400 --> 49:05.960] tells the district attorney what kind of cases he'll handle the county attorney what he'll handle
[49:06.760 --> 49:16.760] 2.03 the very first statute that addresses something the prosecutor must do if a prosecuting
[49:16.760 --> 49:23.000] attorney is made known in any manner that a public official has violated a law relating to his office
[49:23.000 --> 49:30.520] he shall reduce complaint and information submitted to the grand jury shall does not mean may matter
[49:30.520 --> 49:39.320] can if he wants to now 2.04 2.05 address how the prosecuting attorney will handle criminal complaints
[49:39.320 --> 49:50.840] against everybody else 2.03 is a special statute exempted out of the normal procedure so it must be
[49:50.840 --> 49:59.240] given special emphasis you are in Tarrant County and you have what is probably the only district
[49:59.240 --> 50:08.120] attorney in the state of Texas who will abide by this rule you're in the right county at the right time
[50:09.800 --> 50:18.600] Sheriff Sherrod Wilson was a judge prior to being the district attorney and she was well known for
[50:18.600 --> 50:30.040] following law and this morning she followed law to the letter so with that said once you
[50:31.720 --> 50:35.560] ask a public official to do something he's required to do and that's why I say never ask
[50:35.560 --> 50:42.840] a public official to do anything that they're not required to do let me back up and say that right
[50:42.840 --> 50:50.440] never ask a public official anything you actually want him to do because you got this little invisible
[50:50.440 --> 50:57.400] tar baby and I go around to public officials and say I got this little tar baby here you want to
[50:57.400 --> 51:05.160] touch it here go ahead touch it Lake Worth I get some records the judge comes I'm looking at these
[51:05.160 --> 51:09.000] records the judge comes out and said Mr. Kelton you can't look at those records uh you are a
[51:09.000 --> 51:14.840] security risk I'm a security risk yes Miss Kelton you're a security risk I close the records push
[51:14.840 --> 51:19.720] him across the counter and the bailiff is standing there I said Mr. Bailiff did you see that yes Mr.
[51:19.720 --> 51:26.360] Kelton I did arrest that woman why can't arrest her she's the judge should I know arrest her
[51:26.360 --> 51:33.480] anyway well I can't arrest her this is her court oh Mr. Bailiff you are confused this is not her
[51:33.480 --> 51:39.960] court this is my court and I very generously allow her to administer it according to my law she just
[51:39.960 --> 51:46.040] broke one in your sight in your present arrest her well I can't arrest the judge uh let me take you
[51:46.040 --> 51:52.760] down to my boss so he takes me downstairs to the elected constable and the constable said what can
[51:52.760 --> 51:58.760] I do for you and I turned to the bailiff and I said arrest him arrest him why would I arrest him
[51:58.760 --> 52:04.040] because he's a chicken he wouldn't arrest the judge then the guy said I'm not going to arrest
[52:04.040 --> 52:10.280] the judge so the constable refused to arrest his constable so I went across to the sheriff's
[52:10.280 --> 52:17.480] department and asked them to arrest the constable and while I'm waiting for a deputy to come to take
[52:17.480 --> 52:23.560] my complaint the constable came over and said Mr. Kelton uh if you would like I will take your
[52:23.560 --> 52:31.720] I will take your complaint to the district attorney oh no no no don't do that uh I'll get to the
[52:31.720 --> 52:39.480] district attorney but I haven't got everybody to touch my tar baby yet and he said you're what
[52:39.480 --> 52:45.560] I said I got this little tar baby and the judge stuck to it and and the constables your constables
[52:45.560 --> 52:50.440] stuck to it and and you stuck to it now I want to get the sheriff's department to stick to it
[52:50.440 --> 52:57.000] but and he stood there and watched me stick the captain of the sheriff's department to it
[52:58.760 --> 53:04.760] this will have when they know that you're there setting them up
[53:06.600 --> 53:16.040] you will change everything in order to do that read the code it's not as difficult as it seems
[53:16.040 --> 53:22.600] I've I have yet to find a single police officer or prosecutor who has read the code
[53:22.600 --> 53:29.560] and especially not someone in the school system when you've read the code and you walk them down
[53:29.560 --> 53:36.920] it now you've got somebody that wants to make you happy and not have you coming back threatening
[53:36.920 --> 53:44.200] their career again that's kind of the basic uh we're we're constrained on time tonight tomorrow
[53:44.200 --> 53:51.400] and I'll do a four-hour show so I'm going to turn the phone lines on now so if you have a
[53:52.600 --> 53:59.800] question or a comment give us a call 512-646-1984 and we'll be taking your calls for the rest of
[53:59.800 --> 54:07.480] the show and feel free to ask any question you have on the subject for now if I don't have the
[54:07.480 --> 54:14.840] answer we've probably got someone listening who will have the answer because I am sure that
[54:14.840 --> 54:22.040] throughout our listening audience this is going to be a very contentious subject so Jason after
[54:22.920 --> 54:30.280] listening to this part do you have any ideas where you may be able to stick the
[54:30.280 --> 54:39.240] principle of the school board to your tar baby? You've got me so excited here on the possibilities
[54:39.240 --> 54:45.160] of what we can do I mean I'm actually listening to everything you're saying and I am texting one
[54:45.160 --> 54:52.440] of my very very good friends who's a lawyer and prepping because I'm ready to go to war with this
[54:52.440 --> 54:58.200] I see the families on the Facebook page are ready to go to war with this you've got everybody very
[54:58.200 --> 55:04.440] excited so I can't wait what else you have to say because this is amazing. Okay well now let me make
[55:04.440 --> 55:16.120] your lawyer very nervous you are a if you go before the court you are a pro se and one of the
[55:16.120 --> 55:25.800] things we try to do here is teach people how to be the pro se from hell I tell everybody that the
[55:25.800 --> 55:31.640] courts hate pro se's they don't hate pro se's because they write stupid pleadings they like
[55:31.640 --> 55:37.320] that part then they get to just blow them off they hate pro se's because every once in a while they
[55:37.320 --> 55:45.640] come across the pro se from hell that judge say about two words I don't like first thing I'll do
[55:45.640 --> 55:50.920] is file a motion to disqualify then I'll file a judicial conduct complaint against him with the
[55:50.920 --> 55:57.400] state commission on judicial conduct and then depending on what he's done I'll file a criminal
[55:57.400 --> 56:03.240] complaint with him with a local magistrate and just get everybody just to hopping up and down
[56:04.360 --> 56:14.360] I get a lawyer that says something to the court that's not exactly true or a lawyer give me advice
[56:14.360 --> 56:24.040] that's not correct or a lawyer fail to address an issue that's pertinent to your case a lawyer not
[56:24.040 --> 56:35.720] call me back when he said he would what I'm doing here is walking down the Texas bar association
[56:35.720 --> 56:43.640] standards the standards lay out standards of professional ethics and all these things I mention
[56:43.640 --> 56:53.000] and go to standards and that will subject the lawyer to a bar grievance now if you file a bar
[56:53.000 --> 56:58.440] grievance against the lawyer in the state of Texas be he your lawyer or be he the lawyer for the
[56:59.640 --> 57:06.520] school where the lawyer advises the school board or the principal to do a certain something a
[57:06.520 --> 57:11.320] certain thing if you file a bar grievance against him the state bar of Texas is going to get that
[57:11.320 --> 57:17.480] bar grievance they're going to send you a letter back saying we examined into your complaint and
[57:17.480 --> 57:21.480] find it does not rise to the level of misconduct and then they're going to throw it in the trash
[57:23.400 --> 57:24.440]  and that's a good thing
[57:27.080 --> 57:32.520] the reason it's a good thing is their insurance carrier knows they're going to throw it in the
[57:32.520 --> 57:40.680] trash so how does their insurance carrier measure their level of risk by valid bar grievances well
[57:40.680 --> 57:47.800] heck that's all in the trash by the numbers one bar grievance your first year of practice
[57:47.800 --> 57:54.120] they'll cancel immediately two bar grievances in any one year if you've been practicing 20 years
[57:54.120 --> 58:00.040] they cancel three they'll cancel your law firms malpractice insurance it's all about the money
[58:01.640 --> 58:07.080] you get a bar grievance your malpractice insurance is going to double
[58:07.080 --> 58:16.600] the law you will have a bet triple his rates it's all about the money hang on and come back on the

[01:03:43.160 --> 01:03:55.480] we're going to go to oh rob in new mexico hello rob hey randy is this question on point
[01:03:57.720 --> 01:04:06.920] um kind of okay well if it's not call back tomorrow uh we'll have more time we've got
[01:04:06.920 --> 01:04:11.800] a special subject here and we've got a bunch of calls on that subject i'd like to take those
[01:04:11.800 --> 01:04:17.480] first if it can i can call back tomorrow i do have one question that's kind of on point
[01:04:17.480 --> 01:04:24.600] about bar grievances okay um when you get that letter back from the bar saying that
[01:04:24.600 --> 01:04:31.880] the allegations do not rise to the level of misconduct um one of the provisions in the uh
[01:04:32.920 --> 01:04:38.360] bar conduct is that if an attorney is aware of something that another attorney did wrong
[01:04:38.360 --> 01:04:45.080] they're required to report it absolutely you ever file a bar grievance against a lawyer that sends
[01:04:45.080 --> 01:04:52.680] you that letter for failing to act on what they know is done wrong that's a good idea
[01:04:54.440 --> 01:05:01.800] and no i hadn't done that i just i thought of it before but i just got another one back today
[01:05:01.800 --> 01:05:06.520] and they said well this complaint is pretty much the same as the one you said before and
[01:05:06.520 --> 01:05:11.480] we don't think that it rises to misconduct so blah blah blah blah blah so i think i'm
[01:05:11.480 --> 01:05:16.120] gonna file a bar grievance against the person that sent me that letter that is a great idea
[01:05:16.120 --> 01:05:23.640] and this is an example of the pro se from hell rob is definitely example of the pro se from hell
[01:05:24.920 --> 01:05:30.680] they hate rob because he knows how to beat him up they're used to people coming in and being
[01:05:30.680 --> 01:05:38.520] compliant and believing all the garbage they tell them and rob has a bad habit of not believing all
[01:05:38.520 --> 01:05:45.480] the garbage they tell them and holding them to their oath of office i certainly believe the
[01:05:45.480 --> 01:05:52.920] garbage you tell me randy oh i appreciate that okay thank you rob and call in tomorrow night
[01:05:52.920 --> 01:06:01.800] we'll i'd like to hear more about that yes okay oh no i haven't read it yet good night good night
[01:06:02.680 --> 01:06:10.040] okay now we're going to go to jennifer in texas hello jennifer hi randy i am one of the parents
[01:06:10.040 --> 01:06:17.080] of a student at tidwell and my question is a two-part question the first part i was wondering
[01:06:17.080 --> 01:06:25.000] if we can file this grievance tort letter as a whole and name all the parents all the parents
[01:06:25.000 --> 01:06:35.560] and all of the grievances we have together you can do that but it's not a good idea okay because
[01:06:35.560 --> 01:06:42.840] then they only get one letter what is much more powerful is they get lots and lots of letters
[01:06:42.840 --> 01:06:50.840] and especially if you're if you file a complaint against one of these officials these officials
[01:06:52.440 --> 01:06:58.680] uh they're sensitive to complaints that goes in their record and stays there you know if i file a
[01:06:59.800 --> 01:07:05.240] judicial conduct complaint against the judge the state commission on judicial conduct is just going
[01:07:05.240 --> 01:07:13.320] to throw it out but that goes as a mark against his record and stays there forever we do it to
[01:07:13.320 --> 01:07:22.200] federal judges because federal judges all want to all aspire to the court of appeals and essentially
[01:07:22.200 --> 01:07:29.000] to the supreme so we start peppering him with judicial conduct complaints and they just go
[01:07:29.000 --> 01:07:36.280] they just go ballistic because this goes on his record doesn't matter if we file a complaint
[01:07:36.280 --> 01:07:43.560] that's totally baseless it still goes on his record and they can't do anything to us for filing it
[01:07:44.920 --> 01:07:50.280] so we damage his career permanently and there's nothing he can do about it
[01:07:50.280 --> 01:08:00.360] but and your principal is in the same position anyone on the school board you file a complaint
[01:08:00.360 --> 01:08:06.360] against them that stays they run for office again they got all these complaints against them
[01:08:07.000 --> 01:08:13.240] it's all about politics so now you can file all together but i would suggest you do it one at a
[01:08:13.240 --> 01:08:21.880] time just imagine him sitting down there in the office and the guy comes in with a whole bag full
[01:08:21.880 --> 01:08:28.760] of letters that'll get their attention you had a two-part question yes and the other part of my
[01:08:28.760 --> 01:08:36.120] question is as a mandate officials at the school isn't it their responsibility to report this
[01:08:36.120 --> 01:08:43.080] child's history home life to cps and possibly get this child the mental health he needs
[01:08:44.040 --> 01:08:53.880] that i can't answer specifically i would have to look at the tea requirements and i'm glad you
[01:08:53.880 --> 01:09:00.280] brought up the child protective services child protective services takes a lot of heat
[01:09:00.280 --> 01:09:09.640] i get a lot of people calling in complaining about child protective services but child
[01:09:09.640 --> 01:09:14.520] protective services is doing their job right for the most part the parents are not going to be happy
[01:09:16.440 --> 01:09:22.760] but i've known people who work for child protective services it is really a tough job
[01:09:22.760 --> 01:09:30.520] and the one thing they care about are the children so this absolutely should be brought to child
[01:09:30.520 --> 01:09:38.360] protective services attention do you know whether or not that book has been sent to child protective
[01:09:38.360 --> 01:09:46.520] services i personally do not know but i do believe that it's been talked about throughout the parents
[01:09:46.520 --> 01:09:54.360] i believe there have been phone calls made that book should be mailed with a complaint against
[01:09:54.360 --> 01:10:04.520] the parents this book is a clear indication that the child is in severe emotional turmoil
[01:10:05.080 --> 01:10:12.280] we cannot blame the child for this he's a child right this is something the parents are doing to
[01:10:12.280 --> 01:10:19.560] him this could screw up his whole life if this gets out of hand it could ruin his whole life and
[01:10:20.120 --> 01:10:25.560] where the parents we should not we should be worried about our own children but also about
[01:10:25.560 --> 01:10:32.680] this one other people have done this to him you know i'm a parent and i understand how difficult
[01:10:32.680 --> 01:10:39.400] it is when we're doing everything we can to do it right when you have people that that
[01:10:39.400 --> 01:10:47.800] that have more emotional problems than the child does then we all need to do something to fix this
[01:10:47.800 --> 01:10:54.440] and you absolutely need to get child protective services involved if child protective services
[01:10:54.440 --> 01:11:02.520] started starts getting complaints by the stack they will have been given notice
[01:11:02.520 --> 01:11:13.400] this also goes to depraved heart and since this is not an area i'm particularly knowledgeable in
[01:11:14.360 --> 01:11:24.520] i would read the child protective service manuals read the code that applies to child protective
[01:11:24.520 --> 01:11:34.200] services and see what they are required to do what amounts to a valid complaint or a valid issue and
[01:11:34.200 --> 01:11:41.400] what doesn't i'm going to suggest to you that child protective services they're going to want to
[01:11:41.400 --> 01:11:48.920] intervene because they really do want to look out for the children and there's not a single person
[01:11:48.920 --> 01:11:54.840] and there's not a single person working there that won't see this as a screen for help so i would
[01:11:54.840 --> 01:12:01.640] do everything i could to get them involved very very likely that could fix the issue
[01:12:03.880 --> 01:12:07.800] because they're going to climb down these parents' throats stomping their feet all the way
[01:12:08.920 --> 01:12:13.720] and if the parents aren't doing their job child protective services it's likely to get them to do
[01:12:13.720 --> 01:12:20.360] it or get someone else who can do it for them the child definitely needs therapy the child needs
[01:12:20.360 --> 01:12:26.360] something to give him a sense of personal value he's struggling to find that that's what this is
[01:12:26.360 --> 01:12:37.080] all about look at me look at me i'm i am a human being after all how can we give that to him
[01:12:37.080 --> 01:12:44.280] without ruining the rest of his life and in a way that will keep him from acting out further
[01:12:45.560 --> 01:12:54.040] i'm going to suggest one thing is you have to know that he fully understands
[01:12:54.920 --> 01:13:02.120] what to expect from people as a response to what he's doing when i was five years old i knew what
[01:13:02.120 --> 01:13:07.800] would make you smile frown happy sad i pretty well knew the full range of human response within my
[01:13:07.800 --> 01:13:12.760] native culture to think that i could do something that would generate a horribly negative response
[01:13:12.760 --> 01:13:21.480] if not know exactly what i'm doing that's naive so if you react to him the way you feel like reacting
[01:13:21.480 --> 01:13:29.400] to him you're being manipulated by him i've heard complaints that he feels like he's empowered
[01:13:29.400 --> 01:13:36.200] and he's only feeling like he's empowered because people are reacting to him the way he expects them
[01:13:36.200 --> 01:13:43.640] to and a lot of times we will generate those responses even if the responses we don't want
[01:13:43.640 --> 01:13:50.200] we don't like we generate negative responses because that's responses we can generate this
[01:13:50.200 --> 01:13:59.560] kid is clearly trying to generate responses that he knows how to deal with think about that the
[01:13:59.560 --> 01:14:08.360] only thing he knows how to deal with is crap wow my goodness what has these parents done to this
[01:14:08.360 --> 01:14:18.040] child now he needs some parents to demonstrate to him consequences this can be a great learning
[01:14:18.040 --> 01:14:27.400] experience for this child without ruining his life if he has to deal with serious consequences
[01:14:29.000 --> 01:14:35.960] you can't bring those consequences to him but the school board can and the parents certainly
[01:14:35.960 --> 01:14:41.400] can they're the primary problem here so i'm suggesting let's go for the parents
[01:14:41.400 --> 01:14:50.120] parents can i add can i add something to that absolutely uh one of the things that we all
[01:14:50.120 --> 01:14:58.040] witnessed was the facebook post from the mom which was i mean it looked sweet in nature but
[01:14:58.040 --> 01:15:03.960] if you read between the lines the fingers were pointing at us basically blaming everybody for
[01:15:03.960 --> 01:15:09.160] bullying their children that they support his writing and it just showed point blank that
[01:15:09.160 --> 01:15:14.840] there was zero responsibility being taken on the parents part there was no apology in her
[01:15:14.840 --> 01:15:22.120] in her retort on her facebook page it was very very apparent that they were blaming us
[01:15:22.760 --> 01:15:27.960] our kids the schools they were blaming everybody for their kids problem never seeing in the mirror
[01:15:27.960 --> 01:15:34.680] that we obviously all of us parents see that it's a major issue in their home yes this is clearly
[01:15:34.680 --> 01:15:43.000] the parents issue and you know we had after world war two we had uh os neil and benjamin spot come
[01:15:43.000 --> 01:15:48.840] along and tell everybody you know the way you raised children and the way your parents raised
[01:15:48.840 --> 01:15:53.480] you and their parents before them for the last six thousand years of recorded history why that's all
[01:15:53.480 --> 01:15:59.480] wrong you got to let them find themselves don't discipline them let them find their own nature
[01:15:59.480 --> 01:16:06.520] benjamin spock on his deathbed said i have ruined a generation he was wrong he's run too
[01:16:08.120 --> 01:16:12.760] i told my mother what that wants and i said you know you and daddy were just a couple old
[01:16:12.760 --> 01:16:17.480] ignorant sharecroppers and you were too darned ignorant to know any better so you raised me
[01:16:17.480 --> 01:16:22.280] with discipline and my mother said well thanks a lot and i said yes mother thanks a lot
[01:16:23.800 --> 01:16:27.960] these kids who weren't raised with discipline they don't want to try to compete with me
[01:16:27.960 --> 01:16:36.120] they're out of their league and this child clearly was not raised with this so he has no sense of
[01:16:36.120 --> 01:16:45.640] himself the discipline my parents gave me that i hated at the time was empowerment and this child hasn't had
[01:16:48.600 --> 01:16:52.840] and from list of hang on we'll be right back on the other side this is randy kelton

[01:19:53.320 --> 01:20:01.240] okay we are back randy kelton deborah stevens rule of our radio and it looks like a caller
[01:20:01.240 --> 01:20:07.240] dropped off so we're going to go to angela in texas huddle angela what do you have for us tonight
[01:20:07.240 --> 01:20:13.960] um i am calling because my i have three children who attended ball middle school
[01:20:14.760 --> 01:20:20.600] and they are not directly related to this incident with a student in any way shape or form they do
[01:20:20.600 --> 01:20:27.000] know him they passed him in the facilities so the trouble i'm finding as a concerned
[01:20:27.000 --> 01:20:34.840] parent for the safety of my children is feeling like my voice isn't very important because
[01:20:34.840 --> 01:20:43.000] my kids were not directly threatened they were not directly yeah whoa can we do as those who are still
[01:20:43.000 --> 01:20:48.840] a concerned parent for the safety of our children where is it that our voice can be heard wait a
[01:20:48.840 --> 01:20:56.840] minute wait a minute your children are absolutely affected every child in that school is is going
[01:20:56.840 --> 01:21:04.040] to be dramatically affected by this absolutely yeah this is this is not confined to the people
[01:21:04.040 --> 01:21:11.240] he's pointing fingers at every parent who has a child in this school should be outraged
[01:21:12.680 --> 01:21:23.080] not at this kid he's outraged here too as well is i'm a single mom i my hands are tied very tightly
[01:21:23.080 --> 01:21:29.320] i even if i were to be granted a transfer for my children i don't have means to transport them
[01:21:29.320 --> 01:21:34.840] because of my work schedule then again they are not granting transfers because of this whole
[01:21:34.840 --> 01:21:41.400] situation i can't afford a private school and i'm unable to home school so okay hold on hold on you
[01:21:41.400 --> 01:21:47.880] don't need to don't even you don't need to think about transfer this is everything is an opportunity
[01:21:49.000 --> 01:21:54.360] this is an opportunity for us the parents to teach the children
[01:21:54.360 --> 01:22:00.520] i know it looks difficult but it is an opportunity if we can craft a set of solutions
[01:22:01.480 --> 01:22:08.760] that demonstrate to the children that the kind of behavior that's appropriate and the potential
[01:22:08.760 --> 01:22:17.640] consequences of bad behavior i'm concerned that he's going to speak about a child who has an older
[01:22:17.640 --> 01:22:29.560] brother maybe in high school and the older brother maybe do something petulant and not only will the
[01:22:29.560 --> 01:22:34.760] older brother's life be ruined this kid could life could be ruined life could be ruined all over the
[01:22:34.760 --> 01:22:43.480] place we need to fix this and you really do have the power to fix it i guarantee you when you stop
[01:22:43.480 --> 01:22:52.360] asking public officials to do things for you and you go tell them this is what the law requires you
[01:22:52.360 --> 01:23:00.440] to do it you will go do it and when they don't then you start using the remedies that are available
[01:23:00.440 --> 01:23:09.320] professional conduct complaints are really really powerful tort letters extremely powerful
[01:23:09.320 --> 01:23:16.280] that will put the school in a position to where they will visit consequences on this child
[01:23:16.280 --> 01:23:27.480] consequences he is not going to like sued against the parents and potentially complaints against
[01:23:27.480 --> 01:23:34.440] them for child abuse i would look at the codes and see how i could craft one
[01:23:34.440 --> 01:23:40.840] the trick about you and i as private citizens filing complaints
[01:23:42.520 --> 01:23:48.840] our complaints harm if i file a criminal complaint against you it does no harm to you whatsoever
[01:23:50.280 --> 01:23:57.400] the complaint goes to a magistrate supposedly and the magistrate looks into my complaint
[01:23:57.400 --> 01:24:03.800] and he makes a determination of whether or not my complaint is valid if he decides that it's valid
[01:24:03.800 --> 01:24:10.280] then something happens my point is when you file complaints against these officials or against these
[01:24:10.280 --> 01:24:21.000] parents there can be no retribution back against you period you're simply a witness
[01:24:21.000 --> 01:24:29.240] and if anybody says anything to you that is presented to you as a warning that bad things
[01:24:29.240 --> 01:24:35.960] can happen to you for filing complaints you file complaints against them you can file complaints
[01:24:35.960 --> 01:24:43.640] it is your duty to file complaints and give notice and i am sure you it is extremely powerful
[01:24:43.640 --> 01:24:49.640] don't ask them to do anything that you want them to do ask them to do what the law says they're
[01:24:49.640 --> 01:24:56.280] they're commanded to do the principle a couple of good complaints against him he's going to get
[01:24:56.280 --> 01:25:03.720] hopping and jumping but please don't think about moving your kids on let's fix this problem
[01:25:05.400 --> 01:25:10.280] sometimes you can't do anything about it you can't do anything about it you can't do anything about
[01:25:10.280 --> 01:25:21.000] fix this problem sometimes we have to get serious and once you understand how powerful you are
[01:25:22.200 --> 01:25:31.720] as a citizen in a republic you are absolutely the most powerful person that walks into the door
[01:25:31.720 --> 01:25:37.560] i tell people when i walk into a court courthouse i'm the baddest motor scooter in the building
[01:25:37.560 --> 01:25:42.440] and there's only one reason i'm the baddest motor scooter in the building and that's because i'm
[01:25:42.440 --> 01:25:49.720]  nobody i'm not a judge i'm not a prosecutor i'm not a court employee i'm not a police officer
[01:25:50.520 --> 01:25:56.440] they're all public servants i am the master and they better not forget it
[01:25:58.200 --> 01:26:05.880] once once we develop that position the solutions will pretty well get relatively simple straightforward
[01:26:05.880 --> 01:26:10.440] does that make sense we as parents it does i think that's what we as parents have felt
[01:26:10.440 --> 01:26:17.160] very discouraged by is being made to feel like we do not have a voice and we don't have a say
[01:26:17.160 --> 01:26:22.520] and that we are tied down by the law so this is extremely helpful to us to hear
[01:26:22.520 --> 01:26:29.240] how we can go about with having a powerful voice okay i do have to give you one little piece of
[01:26:29.240 --> 01:26:36.760] warning okay when you when you start doing this there's a serious danger that it can become
[01:26:37.320 --> 01:26:46.680] way too much fun i just jacked up a jp this morning oh that was so much fun
[01:26:48.120 --> 01:26:53.400] so i have to watch myself because i do enjoy doing this to them way too much
[01:26:53.400 --> 01:27:01.880] i do enjoy doing this to them way too much when i stood at the bar in manse field while they're
[01:27:01.880 --> 01:27:06.440] having a hearing the judge looked up and said may i help you i said yes your honor my name's randall
[01:27:06.440 --> 01:27:12.600] kelton i have a hearing deficiency well mr kelton what's wrong with your hearing oh judge uh i was
[01:27:12.600 --> 01:27:18.200] down in mexico the other day and i drank too much that cheap tequila and i lost my hearing aid well
[01:27:18.200 --> 01:27:22.040] mr kelton why are you telling me this so well do you have accommodation for the hearing impaired
[01:27:22.040 --> 01:27:27.400] no i do not i see you have a sound system here will you turn it up no i will not well then will
[01:27:27.400 --> 01:27:32.520] you speak up and he did told david if i didn't sound shut up he's throwing me out of the courtroom
[01:27:33.560 --> 01:27:39.800] so my hearing was over i walked out of the courtroom pointed at the bay that you come with me got out
[01:27:39.800 --> 01:27:45.320] in the hall david said what can i do for you i need you to arrest the judge well why would i arrest
[01:27:45.320 --> 01:27:51.640] the judge class a misdemeanor official misconduct criminal violation 3903 penal code in that he failed
[01:27:51.640 --> 01:27:55.480] to perform a duty he was required to perform and in the process denied me full free access to
[01:27:55.480 --> 01:28:01.240] enjoyment of right and the bailiff said well mr kelton what right did he deny you in the right
[01:28:01.240 --> 01:28:06.760] to accommodation under the hearing under the americans with disabilities act and the bailiff
[01:28:06.760 --> 01:28:12.360] said well why didn't you tell the judge about the americans with disabilities act heck if i'd done
[01:28:12.360 --> 01:28:18.440] that he might turn hearing that he might have turned the sound system up the bay stepped back
[01:28:18.440 --> 01:28:26.440] it looked to be this big smile grew across his face and he said you set him up so yeah as a
[01:28:26.440 --> 01:28:34.600] matter of fact i did now frankly i did that as a lark i was just jerking the judge around
[01:28:35.800 --> 01:28:39.480] that turned out to be one of the most powerful things i've ever did here
[01:28:39.480 --> 01:28:47.400] every judge in tarrant county and dallas county knows about that knows that i went in there and
[01:28:47.400 --> 01:28:55.240] deliberately set up that judge to violate a law so i could file against him now they're all terrified
[01:28:55.240 --> 01:29:00.120] of me i want them terrified of you
[01:29:00.120 --> 01:29:07.800] it is easier than you think so angela whatever you do don't pull kids out teach your kids how to
[01:29:07.800 --> 01:29:16.120] i can't anyway so teach these kids how to how a parent how an adult takes the system to task
[01:29:17.640 --> 01:29:26.680] gotcha okay we appreciate your help very much okay thank you for calling now we're going to go to
[01:29:26.680 --> 01:29:35.800] cindy in texas hello cindy hello hello what do you have for us today okay i am also one of the
[01:29:35.800 --> 01:29:42.520] parents of a kid well middle schooler and i've been in constant communication with okay wait
[01:29:42.520 --> 01:29:47.000] hold on we're about to go to break uh i'll pick you up when we get back on the other side this is
[01:29:47.000 --> 01:29:53.080] randy kelton denver stevens rule of law radio our call-in number five one two six four six 1984

[01:33:39.800 --> 01:33:47.240]  okay
[01:33:51.080 --> 01:33:59.240] okay we are back and we're talking to the city in Texas
[01:34:01.000 --> 01:34:06.200] okay thank you i was saying that i've been in touch with the principal at the school
[01:34:06.200 --> 01:34:13.240] school and i didn't feel that it was safe with the boy still coming to school and i did take my
[01:34:13.240 --> 01:34:19.960] daughter out when i learned of the boy's book and i read the content of the book and i do have a
[01:34:19.960 --> 01:34:26.040] physician's note however i just learned this week the principal is threatening to take me to court
[01:34:26.600 --> 01:34:32.760] she said due to truancy she's going to take me to court unless i either withdraw my daughter
[01:34:32.760 --> 01:34:40.600] or bring her back to school by monday oh interesting i have a rule to never interfere
[01:34:40.600 --> 01:34:50.280] with somebody when they're screwing up so now how is your daughter handling all this
[01:34:52.040 --> 01:34:58.040] well she has had issues with panic attacks before this and night terrors and that was the reason
[01:34:58.040 --> 01:35:03.480] that i took her out of school i didn't want her to regret and she is regressing now because of it
[01:35:04.280 --> 01:35:12.440] okay here's the deal if i had a really really bad heart and i'm walking across the street
[01:35:13.240 --> 01:35:17.960] and you're in a car and you pick the horn at me and excuse me and i'm not getting part of that
[01:35:19.880 --> 01:35:24.680] you're guilty of manslaughter you take me like you find me
[01:35:24.680 --> 01:35:33.160] if your daughter is prone to panic attacks and this causes a panic attack the school is responsible
[01:35:35.160 --> 01:35:39.560] they can't say well she's prone to panic attacks your problem not our problem
[01:35:40.280 --> 01:35:46.840] you take her like you find her so the school needs to get a tort letter but
[01:35:46.840 --> 01:35:57.960] if you have a doctor's release and the school is going to file a truancy complaint
[01:35:59.160 --> 01:36:07.880] you see the school forgets how serious what that is serious that how serious a criminal complaint
[01:36:07.880 --> 01:36:17.960] is if you file a government document and on that government document you put a statement that's not
[01:36:17.960 --> 01:36:25.000] true that's tampering with a government document it's felony state of texas if the principal files
[01:36:25.000 --> 01:36:34.040] a truancy complaint against your daughter when the principal knows that you have a valid excuse
[01:36:34.040 --> 01:36:39.080] that's tampering with a government document and that's crime in the state of texas
[01:36:41.000 --> 01:36:47.160] say guys you want to play hardball i'll introduce you to the deep end of the pool
[01:36:49.720 --> 01:36:57.000] so she also told me that the doctor's note was not valid because it came from her pediatrician
[01:36:57.560 --> 01:37:02.360] and i tried arguing that point we also have a note from her counselor but they completely
[01:37:02.360 --> 01:37:09.720] dismissed that note okay okay let me suggest do not talk to the principal in person if you
[01:37:09.720 --> 01:37:14.120] can avoid it don't talk to her on the phone do everything in writing
[01:37:16.200 --> 01:37:22.360] do everything in writing certified mail return receipt you want to get their attention and let
[01:37:22.360 --> 01:37:30.760] them know you mean business i mentioned a couch earlier i sent them an email told them no voice
[01:37:30.760 --> 01:37:38.120] communications do not call me make all communications in writing that was the first thing that told them
[01:37:38.120 --> 01:37:45.880] that this guy really means business and that'll tell the school get them a certified letter
[01:37:45.880 --> 01:37:52.920] noticing them to cease and desist that okay one thing don't give them fair warning
[01:37:52.920 --> 01:38:00.600] never say if you don't do this i'm going to do that never never never bushwhack is the rule
[01:38:02.280 --> 01:38:10.200] you're not a lawyer you have no duty to give them legal advice i see process documentation and they
[01:38:10.200 --> 01:38:15.640] they cite the code when they send them a letter just law says you're supposed to do this by this
[01:38:15.640 --> 01:38:21.640] code here to never never do that tell them what you want them to do you're the master they're the
[01:38:21.640 --> 01:38:29.240] you're the master they're the servant you don't have to give them legal advice so i would look at
[01:38:29.240 --> 01:38:39.400] look at the tea rules on medical issues she's trying to force your child to come to school
[01:38:39.400 --> 01:38:46.840] when she has a medical issue look at the rules on that and you send a letter and you demand that the
[01:38:46.840 --> 01:38:54.120] the principal do whatever the rule requires them to do without feeding them the rule
[01:38:56.520 --> 01:39:00.840] you don't you don't want them to know directly that you actually know what the rule is
[01:39:03.240 --> 01:39:08.600] because then if they don't do exactly what the rule calls for then you go in and file a complaint
[01:39:08.600 --> 01:39:15.160] with the tea against them immediately and if she files a currency complaint that's criminal
[01:39:15.160 --> 01:39:23.000] i did file a complaint with the tea i just did it this week wonderful okay this is good
[01:39:23.800 --> 01:39:31.560] okay nice work sandy nice work okay thank you bye-bye good that is wonderful i'm glad to be
[01:39:31.560 --> 01:39:38.600] talking to some folks that are on the ball okay we're going to go to jody in texas hello jody
[01:39:38.600 --> 01:39:45.560] yes hi randy how are you tonight i am good what do you have for us tonight hey i have a question
[01:39:47.240 --> 01:39:54.040] i love all of the ideas that you're giving us but all of these things take time and in the meantime
[01:39:54.040 --> 01:40:01.720] this child is still wandering the halls of our school we've had a lot of discussion among the
[01:40:01.720 --> 01:40:09.000] parents regarding how this child is creating a quote-unquote educational disturbance
[01:40:10.040 --> 01:40:17.960] because that seems to be the only feat that we can stand on right now to actually remove this
[01:40:17.960 --> 01:40:28.120] child from the school okay wait i have a question okay are is the only thing the child has done
[01:40:28.120 --> 01:40:37.640] are is the only thing the child has done is write this book no no no there are multiple
[01:40:37.640 --> 01:40:48.920] uh reports on file at the school against him for various other comments actions disturbances
[01:40:48.920 --> 01:41:02.120] okay read the statute breach of the peace chart go to a local jp uh you're in rono go to judge
[01:41:02.120 --> 01:41:12.840] hand and give him an allegation of breach of the peace by this child and now you will have untied
[01:41:12.840 --> 01:41:22.680] judges that judge hands hands now he can call the child in the parents here and just read them the
[01:41:22.680 --> 01:41:30.760] riot act in no case do you want the child prosecuted for this but judge hands are grown up he's a
[01:41:30.760 --> 01:41:41.400] grandpa too and they understand how to handle these things if you give a breach of the peace
[01:41:41.400 --> 01:41:47.880] complaint to judge hand against the child and name the parents as well because they're empowering
[01:41:47.880 --> 01:41:54.040] the child to do this so they're acting in concert and collusion okay now it doesn't matter whether
[01:41:54.040 --> 01:41:59.960] you can get a prosecution or not you don't care and take it to judge hand and say well these are
[01:41:59.960 --> 01:42:05.640] the problems we're having we need an intervention here's your authority to give us an intervention
[01:42:05.640 --> 01:42:11.000] a good chance he'll bring him in read him the riot act and this thing whole thing may go away
[01:42:11.880 --> 01:42:17.800] especially if you get randy oh sorry about that yeah randy just to give you an idea of what we're
[01:42:17.800 --> 01:42:24.520] talking about uh just two days ago in class uh he actually told two kids to go kill themselves
[01:42:26.760 --> 01:42:32.200] this is breach of the peace this this would fall under breach of the peace excellent thank you
[01:42:32.200 --> 01:42:40.680] excellent thank you now now if you file that uh get a number of people to bring a number of
[01:42:40.680 --> 01:42:46.280] allegations see the problem the judge has when you give this to him is he's gotten notice
[01:42:47.720 --> 01:42:51.560] if something if he doesn't act and something happens now he falls under
[01:42:51.560 --> 01:42:58.520] depraved heart and you can come back after him and even if you couldn't it's going to look really bad
[01:42:58.520 --> 01:43:05.640] you know everybody says oh this bad thing happened didn't anybody see the signs well duh
[01:43:06.280 --> 01:43:12.200] these are the signs and here they are in your face so if something happens we come back and blame you
[01:43:13.000 --> 01:43:24.200] politics okay so if uh in the meantime between the time of you know filing our breach of the
[01:43:24.200 --> 01:43:32.040] peace complaint with the judge um what are your thoughts on just bombarding the administration's
[01:43:32.040 --> 01:43:41.720] offices with children who are uncomfortable in his presence due to inappropriate remarks that he's
[01:43:41.720 --> 01:43:48.840] making in class things that cause them to feel fear if these children excuse themselves and bombard
[01:43:48.840 --> 01:43:54.600] the administration's office that would definitely help hang on we're about to go to break randy

[01:46:25.160 --> 01:46:51.320] okay we are back randy kelton debor steven's rule of law radio
[01:46:51.320 --> 01:47:02.200] and we're talking to jody in texas okay go ahead jody okay so my question before we went to commercial
[01:47:02.200 --> 01:47:11.160] was about having our children just flood the administration's office with themselves exiting
[01:47:11.160 --> 01:47:19.960] class exiting their you know time of learning because of feeling discomfort and fear in the
[01:47:19.960 --> 01:47:26.280] presence of this child especially any other children that have reported incidences of
[01:47:27.560 --> 01:47:36.760] inappropriate interaction with him to so that we can cause an educational disturbance that
[01:47:36.760 --> 01:47:50.600] that is perfect to remove him yeah that is perfect and those will help to support other strategies
[01:47:50.600 --> 01:47:57.640] we were talking about giving people a political reason to do what you want
[01:47:57.640 --> 01:48:07.560] every person a politician will consider to be 15 votes that's your sphere of influence so
[01:48:08.120 --> 01:48:12.680] how many by what margin was your mayor elected last time
[01:48:14.360 --> 01:48:21.320] i don't need you need to need enough people to get close by multiplied by 15 to the point close
[01:48:21.320 --> 01:48:28.440] to that get a number of people to file complaints with the chief of police and
[01:48:28.440 --> 01:48:35.800] send a skating letter to the mayor about this issue so the mayor sees a lot of voters interested
[01:48:36.840 --> 01:48:41.960] and will be inclined to tell the chief of police to investigate into it so when the chief then
[01:48:41.960 --> 01:48:49.560] winds up investigating criminal complaints of breach of the peace this could get them get these
[01:48:49.560 --> 01:48:56.600] all of them put in jail you you accuse the child which almost certainly won't go to jail
[01:48:57.160 --> 01:49:02.120] but you accuse the parents of accessories before and after the fact
[01:49:04.840 --> 01:49:10.200] then they go talk to the parents and once the police are rattling their saber at the parents
[01:49:10.920 --> 01:49:17.160] a good chance we can get this thing to go away of its own accord the parents will take care of it
[01:49:17.160 --> 01:49:24.200] like they should have in the in the first place but the police are really good at fixing these
[01:49:24.200 --> 01:49:31.160] kinds of things and you know i we had a problem with a friend of mine came to me and some really
[01:49:31.160 --> 01:49:39.000] ugly stuff about a couple of 10 year olds and uh he was all upset and i said well take this to the
[01:49:39.000 --> 01:49:44.280] church department oh they won't ever do anything i said yeah they do they care about kids and
[01:49:44.280 --> 01:49:50.520] they know how to handle kids and the one child that was writing some really 10 year old writing
[01:49:50.520 --> 01:49:57.480] really sexual stuff about a this friend of mine's daughter the police marched into the school room
[01:49:58.600 --> 01:50:05.160] two of them picked this kid up carried him off out took him in another room and just read him
[01:50:05.160 --> 01:50:12.120] the riot act railed on it big time and took him and sent him back down left there was no more
[01:50:12.120 --> 01:50:17.800] problem with him they never had any intention of filing any complaints against him they just
[01:50:17.800 --> 01:50:25.960] did what grown-ups do yeah and i think if you take this to the police if you have enough people come
[01:50:27.320 --> 01:50:31.720] and tell them you don't want this child harmed but there needs to be an intervention and you can
[01:50:31.720 --> 01:50:37.720] give me that intervention and here i have a complaint for breach of the peace that will
[01:50:37.720 --> 01:50:45.880] empower you to take some action uh the more numbers that talk to these people not the
[01:50:45.880 --> 01:50:51.000] administration administration is going to dig their heels in you need to come outside the
[01:50:51.000 --> 01:50:57.720] administration go to the mayor go to judge hands justice of the peace go to the county court
[01:50:58.520 --> 01:51:04.520] file complaints there just start making noises in all these peripheral agencies they're all going
[01:51:04.520 --> 01:51:09.640] to be calling back in here to find out what's going on and when the phones start ringing that's
[01:51:09.640 --> 01:51:16.680] when these local officials get worried about the political fallout it's all going to be political
[01:51:17.800 --> 01:51:25.400] does that make sense and jason you had a comment on this um i i did i i had somebody actually
[01:51:25.400 --> 01:51:31.880] message me and it said um how is it possible for him to only serve three days and what do we do
[01:51:31.880 --> 01:51:44.360] about it well it's possible because the principal sees first amendment a first amendment suit as
[01:51:44.360 --> 01:51:54.680] fallout and he doesn't want to get the school board or the tea involved in a major first amendment
[01:51:54.680 --> 01:52:03.480] suit so he's trying to cover his own behind so in order to get him to do what he should have
[01:52:03.480 --> 01:52:08.600] done in the first place you have to give him a good political reason and a good political reason
[01:52:08.600 --> 01:52:16.600] would be judge hand local justice of peace calling down there i want to know what's going on and why
[01:52:16.600 --> 01:52:22.760] are these people trying to give me a rest one of your students this raises the stakes for him the
[01:52:22.760 --> 01:52:29.000] only way we're going to get this done is to raise the stakes and for the most part people don't know
[01:52:29.000 --> 01:52:37.720] how to do that to these officials i hope i've given you enough that you'll be able to generate
[01:52:37.720 --> 01:52:40.040]  some serious politics
[01:52:40.040 --> 01:52:52.680] okay is is there jodie is did you have another question did i get yours answered no i think that
[01:52:52.680 --> 01:52:58.520] you absolutely answered my question um you know what do we tell our children how do we tell our
[01:52:58.520 --> 01:53:08.920] children to respond if the administration refuses to um protect them to understand their fear what
[01:53:08.920 --> 01:53:13.880] what do we tell our children how do we tell our children to stand up for themselves if they're
[01:53:13.880 --> 01:53:22.360] told sorry tough bounce you can't be here go back to class your children need to to be able to
[01:53:22.360 --> 01:53:29.000] testify they need to say this bothered me so much i went to the teacher and asked to be excused from
[01:53:29.000 --> 01:53:33.880] the class the teacher refused so i went to the principal's office and asked to be excused from
[01:53:33.880 --> 01:53:43.320] the class because i felt threatened and the principal refused the kens third rule document
[01:53:43.880 --> 01:53:51.400] document document document you get the kids to raise the issue and then write down what they did
[01:53:52.920 --> 01:53:57.000] if they go to the teacher write down what the teacher said they go to the principal write down
[01:53:57.000 --> 01:54:06.120] what the principal said collect all these together what those officials that are in a place to deal
[01:54:06.120 --> 01:54:13.960] with these kinds of situations what they need is documentation all right and when the when the
[01:54:13.960 --> 01:54:20.120] teachers and the principal see the kids documenting that's really going to get their attention
[01:54:20.120 --> 01:54:26.120] okay if we do this right they'll feel the pressure and they'll go in and fix it like they should have
[01:54:26.120 --> 01:54:35.320] in the first place and maybe we won't have to do anything ugly yeah but if we have to we have to be
[01:54:35.320 --> 01:54:42.760] ready to you don't want the child prosecuted for breach of the peace but that may be what he needs
[01:54:42.760 --> 01:54:48.280] to keep him from doing something much worse or to keep somebody else from doing something much worse
[01:54:48.280 --> 01:54:55.160] or to keep somebody else from hurting him from what he's doing absolutely all right well thank
[01:54:55.160 --> 01:55:04.520] you i appreciate it okay jason would you like to kind of give us a recap kind of close out kind of
[01:55:07.560 --> 01:55:12.040] well i think for the most part what we've heard is that we do have a voice
[01:55:12.040 --> 01:55:19.080] and for everybody who's listening we need to collaboratively get together we need to sit down
[01:55:19.080 --> 01:55:27.240] whether it be whatever wherever whenever we need to get a game plan we've got this recorded i know
[01:55:27.240 --> 01:55:32.920] there's some parents who recorded this we can go back through by the way we also have archives
[01:55:32.920 --> 01:55:41.000] that you can download excellent okay excellent and we need we need to get together and we all need
[01:55:41.000 --> 01:55:45.800] to know what we're doing that's the biggest thing i can think of we need to be one united voice
[01:55:45.800 --> 01:55:53.320] but many parts i agree with randy 100 we need to flood them with letters we haven't heard a word
[01:55:53.320 --> 01:56:00.680] from the from the school board the school board has been silent on this everything's been falling
[01:56:00.680 --> 01:56:06.920] on the the administration of the of the middle school and we need to make sure that school board
[01:56:06.920 --> 01:56:12.440] hears our voice loud and clear uh i would also say that we all need to be there april 13th
[01:56:13.080 --> 01:56:19.880] we have to be at that board meeting and we need to have our voices heard but we need to hear it
[01:56:19.880 --> 01:56:26.920] in a controlled way no screaming no yelling no arguing we need to have our facts in place
[01:56:27.400 --> 01:56:34.760] and we need to be ready to battle for our kids you guys yeah let me address uh emotion
[01:56:34.760 --> 01:56:43.160] emotion they're these guys are real good at confrontation they deal with confrontation
[01:56:43.160 --> 01:56:51.160] all the time what they're not used to and not able to deal with is someone who is comes in as
[01:56:51.160 --> 01:56:58.920] the master and treats them as a servant someone who simply comes in and says this is what you
[01:56:58.920 --> 01:57:05.080] will do i'm not interested in your opinion i'm not interested in your reasons this is what you will
[01:57:05.080 --> 01:57:11.240] do and you don't tell them what you're going to do when they don't because when you don't tell them
[01:57:11.240 --> 01:57:17.880] they're going to be sitting there wondering what's this guy setting me up for i did that to that judge
[01:57:17.880 --> 01:57:23.400] in mansfield now i go into a court and they're always wondering what i'm setting them up for you
[01:57:23.400 --> 01:57:29.800] want them wondering what are they setting me up for these guys are leading me down the garden path
[01:57:30.920 --> 01:57:34.520] that's when they'll start covering their behinds and giving you what you want
[01:57:37.160 --> 01:57:44.600] bushwack is perfectly uh acceptable in these situations and it is so much fun you won't believe
[01:57:44.600 --> 01:57:51.880] it but you'll get to see what we call that little chicken dance you know you've got them on the
[01:57:51.880 --> 01:57:58.280] dime when they start shifting from one foot to the other trying to figure out some way of dealing
[01:57:59.640 --> 01:58:05.080] the more calm you are the more straightforward you are the more people fighting
[01:58:07.880 --> 01:58:12.520] okay i thank you all for listening and this has been a very good show
[01:58:13.560 --> 01:58:19.960] if sometime down the road you'd like to do another one i'd be open to that and i would
