[08:28.640 --> 08:36.520]  of the Texas legal system in relation to these Class C misdemeanor and other misdemeanor
[08:36.520 --> 08:42.800]  level offenses that people are being hooked up with every single day courtesy of our corrupt
[08:42.800 --> 08:46.280]  government system as it exists.
[08:46.280 --> 08:53.480]  What I would like to read to you before the end of this segment is the introduction, which
[08:53.480 --> 08:57.560]  is approximately four pages long, for the new book.
[08:57.560 --> 09:02.040]  I want to read the introduction in its entirety as I have it.
[09:02.040 --> 09:03.400]  Please pay close attention.
[09:03.400 --> 09:09.080]  Any input on the intro would be appreciated, but I'm hoping that I've got this pretty well
[09:09.080 --> 09:15.600]  nailed down as to how I want the reader to begin in this new book.

[09:19.600 --> 09:23.040]  This is not meant to be some erudite prose on the legal system.
[09:23.040 --> 09:28.160]  It is most certainly not to point out how the American legal system is the best in the
[09:28.160 --> 09:29.160]  world.
[09:29.160 --> 09:33.720]  We are certainly not going to defend the current system with the tired and apathetic statement,
[09:33.720 --> 09:38.720]  it may not be perfect, but it's the best that we have and that there is.
[09:38.720 --> 09:43.520]  Anyone that actually understands inherent unalienable rights and how they are ignored
[09:43.520 --> 09:49.080]  and abused by the labyrinthine mire that is the American legal system will immediately
[09:49.080 --> 09:53.120]  tell you that this is a complete load of crap.
[09:53.120 --> 09:58.040]  Justice and the protection of individual rights are pathetically inane ideals in relation
[09:58.040 --> 10:02.920]  to modern legal reasoning, methodologies, and procedures.
[10:02.920 --> 10:08.700]  Courts at all levels ignore the rule of law, the rules of procedure, and the intended purpose
[10:08.700 --> 10:14.600]  of securing inherent individual rights under the protection of constitutional principles
[10:14.600 --> 10:19.600]  from stealthy encroachment and or destruction by the corporate state.
[10:19.600 --> 10:24.280]  This has become the norm to such a degree that it can honestly be said that except by
[10:24.280 --> 10:30.960]  sheer accident, political motive, or bribery, there is no such thing as justice in the American
[10:30.960 --> 10:32.800]  court system.
[10:32.800 --> 10:39.160]  In the 1998 movie, A Civil Action, John Travolta's protagonist character, Jan Schlickman, is
[10:39.160 --> 10:44.560]  suing two large corporations for poisoning a town's drinking water and causing the illness
[10:44.560 --> 10:47.480]  and death of several of its children.
[10:47.480 --> 10:51.600]  While waiting for the trial jury's verdict, Schlickman is in the hallway of the court with
[10:51.600 --> 10:56.240]  opposing counsel, Jerome Thatcher, played by Robert Duvall.
[10:56.240 --> 11:01.200]  Thatcher is talking about never having waited for a jury verdict in 40 years of practicing
[11:01.200 --> 11:02.240]  law.
[11:02.240 --> 11:06.960]  As the exchange continues, Thatcher asks Schlickman's opinion of whose side the jury will likely
[11:06.960 --> 11:11.720]  decide in favor of since it is taking so long for them to deliberate.
[11:11.720 --> 11:17.840]  The dialogue goes like this, like this, Thatcher, what's your take?
[11:17.840 --> 11:21.040]  Schlickman, they'll see the truth.
[11:21.040 --> 11:23.480]  Thatcher, the truth?
[11:23.480 --> 11:26.320]  I thought we were talking about a court of law.
[11:26.320 --> 11:30.400]  Come on, you've been around long enough to know that a courtroom isn't the place to look
[11:30.400 --> 11:31.400]  for the truth.
[11:31.400 --> 11:36.480]  You'd be lucky to find anything here that even resembles the truth.
[11:36.480 --> 11:42.580]  This may simply be dialogue from a movie script, but it is the most accurate verbal depiction
[11:42.580 --> 11:48.240]  of just what the dysfunctional American court system has become that I have ever heard portrayed
[11:48.240 --> 11:49.980]  anywhere.
[11:49.980 --> 11:55.560]  This negative viewpoint of modern courts is compounded by my own actual experiences in
[11:55.560 --> 12:02.320]  these courts of just us, where it is extremely evident that even the law itself holds no
[12:02.320 --> 12:06.020]  real sway or meaning within their walls.
[12:06.020 --> 12:11.280]  There is a standard retort among public defense lawyers when a client asks why she or he doesn't
[12:11.280 --> 12:16.900]  argue the specifics of a law or statute and the lack of evidence for specific elements
[12:16.900 --> 12:22.440]  of a charge in the client's defense, and it goes something like this.
[12:22.440 --> 12:25.240]  It doesn't matter what the law reads or means.
[12:25.240 --> 12:29.160]  It only matters what the judge says it reads or means.
[12:29.160 --> 12:34.080]  The numerous ethical and moral problem with such a resigned approach by a defense attorney
[12:34.080 --> 12:39.640]  should be self-evident, but you would be surprised by how many people just accept that this is
[12:39.640 --> 12:46.660]  the way it is and trust their attorney to be doing his best or her best on their behalf.
[12:46.660 --> 12:51.280]  The only way these people could be making a bigger mistake in trusting someone is to
[12:51.280 --> 12:56.040]  knowingly enter into a real estate deal with a known con man for the purchase of the Golden
[12:56.040 --> 12:57.800]  Gate Bridge.
[12:57.800 --> 13:03.400]  Does it really escape that many people that there simply has to be a reality-based reason
[13:03.400 --> 13:09.160]  that there are so many lawyer jokes depicting them as either sleazy scumbag crooks or just
[13:09.160 --> 13:11.480]  plain stupid?
[13:11.480 --> 13:15.940]  And those that are actually neither are of absolutely no help because they have chosen
[13:15.940 --> 13:22.440]  not to practice in these areas of law, but instead are engaged in the relatively safer
[13:22.440 --> 13:26.220]  areas of contract and other commercial law.
[13:26.220 --> 13:32.840]  What is unbeknownst to most is that the so-called civilized world is actually controlled in
[13:32.840 --> 13:37.420]  many hidden ways by those operating from within the legal profession.
[13:37.420 --> 13:42.240]  And it is done not only despite the numerous constitutional prohibitions against injuring
[13:42.240 --> 13:47.440]  the rights of the people, but also in violation of the crystal clear separation of powers
[13:47.440 --> 13:52.480]  and void ab initio clause of the Texas and various other constitutions.
[13:52.480 --> 13:57.360]  The separation of powers issue also exists at the federal level just as it does in the
[13:57.360 --> 13:59.520]  several states of the union.
[13:59.520 --> 14:03.840]  And it occurs when the members of any one branch of government acts under any authority
[14:03.840 --> 14:09.840]  or power rightfully belonging to another department or to a member of another department.
[14:09.840 --> 14:15.320]  The states, however, are no better at following and obeying constitutional prohibitions than
[14:15.320 --> 14:20.600]  the federal government happens to be, despite the tired rhetoric of how often or how much
[14:20.600 --> 14:25.120]  and how often they fight for the people's rights against the evils and avarice of the
[14:25.120 --> 14:26.640]  federal government.
[14:26.640 --> 14:31.220]  This is pure Wizard of Oz fantasy on the grandest scale.
[14:31.220 --> 14:36.520]  The whole legal and justice system is one big pathetic joke, but the only ones laughing
[14:36.520 --> 14:41.400]  are the other nations of the world that see how totally hypocritical we the American people
[14:41.400 --> 14:45.240]  have allowed ourselves and our government to become.
[14:45.240 --> 14:50.600]  We revel in allowing our government to openly proclaim freedom, liberty, and equality for
[14:50.600 --> 14:56.520]  all, while it continuously wages egregiously duplicitous wars that result in the mass murdering
[14:56.520 --> 15:01.480]  of literally accumulated millions of people of other sovereign nations, all for nothing
[15:01.480 --> 15:07.200]  less than the ability of elitist special interests to begin or to continue stealing that people's
[15:07.200 --> 15:12.960]  wealth and natural resources in both the American people's name and the completely delusional
[15:12.960 --> 15:18.720]  claim of national security or interests, all the while the true purpose and result being
[15:18.720 --> 15:24.880]  nothing more than the unjust enrichments of those elitists in power, whether through government
[15:24.880 --> 15:29.760]  contracts under the table dealings or through other external financial interests.
[15:29.760 --> 15:33.840]  These power grabs and backroom dealings are not just limited to members of the United
[15:33.840 --> 15:37.600]  States Congress and the individual state legislatures.
[15:37.600 --> 15:42.800]  These modern un-American courts can be described as nothing less than the governmental facilitators
[15:42.800 --> 15:48.480]  of each and every progressive failing of limited government that exists in America today, while
[15:48.480 --> 15:55.480]  we the people are guilty of being the enablers of our own downfall and enslavement.
[15:55.480 --> 16:01.040]  This pathetically apathetic mindset has allowed our public servants to foist upon us the Department
[16:01.040 --> 16:07.680]  of Homeland Security, the Patriot Acts 1 and 2, the NDAA, and numerous other agencies
[16:07.680 --> 16:13.360]  and programs that are not only grossly and plainly unconstitutional, they are the complete
[16:13.360 --> 16:18.920]  antithesis of a constitutional republic and individual rights and liberties.
[16:18.920 --> 16:24.040]  And the American courts are upholding every single trespass of this nature as a valid
[16:24.040 --> 16:30.280]  exercise of governmental power and authority, despite clearly worded constitutional provisions
[16:30.280 --> 16:33.520]  and historical writings to the contrary.
[16:33.520 --> 16:38.240]  If opinions allowing actions such as these are true examples of a judge's exercise of
[16:38.240 --> 16:44.080]  power to interpret and decide what the constitutions and laws really reads and means, then we need
[16:44.080 --> 16:50.320]  to consider publicly charging, trying, convicting, and hanging more than a few judges and prosecutors
[16:50.320 --> 16:51.840]  for sedition and treason.

[21:26.760 --> 21:32.000]  You can easily prove this to yourself by asking very specific and pointed questions about
[21:32.000 --> 21:37.200]  and certain aspects and elements of the actual charge as taken from the laws and statutes
[21:37.200 --> 21:39.320]  themselves.
[21:39.320 --> 21:44.120]  Your lawyer will claim to know the answers and will usually provide you with some nonsense
[21:44.120 --> 21:50.040]  response, just as usually referencing both the aforementioned legal retort and adage.
[21:50.040 --> 21:55.240]  But if you already know the proper elements and requirements to prove the charge, it should
[21:55.240 --> 22:00.440]  be easily discernible that your lawyer is actually avoiding providing you the type of
[22:00.440 --> 22:05.320]  direct and clear response your on-point questions deserve and should receive.
[22:05.320 --> 22:11.200]  Therefore, it is imperative that you never make the mistake of assuming or believing
[22:11.200 --> 22:15.400]  that your lawyer is actually working in your best interest.
[22:15.400 --> 22:20.240]  The less you know, the more that she or he can get away with to the detriment of you
[22:20.240 --> 22:21.600]  and your case.
[22:21.600 --> 22:25.720]  However, the inverse is also equally true.
[22:25.720 --> 22:30.880]  If you make the effort to know as much or more than they do, you can learn to recognize
[22:30.880 --> 22:35.600]  and act to prevent your rights from being carelessly discarded and your case from being
[22:35.600 --> 22:39.900]  lost as a matter of routine judicial expediency.
[22:39.900 --> 22:45.120]  You will do this by learning the necessary rules and procedures mapped out directly from
[22:45.120 --> 22:50.640]  their own books within this book, which it is my hope will provide you with all the necessary
[22:50.640 --> 22:56.240]  information to recognize when your lawyer is attempting to throw you and your case under
[22:56.240 --> 23:01.320]  the proverbial bust, even when getting paid with money from your own pocket.

[23:32.080 --> 23:38.000]  This hardship in comprehension is mostly due to your current level of indoctrination, limited
[23:38.000 --> 23:42.820]  understanding of your inherent rights and immunities, as well as the true but too often
[23:42.820 --> 23:50.040]  ignored lawful intent and limitations upon our government's delegated power and authority.
[23:50.040 --> 23:55.400]  So if you feel like giving up at any point, it might just be a good idea for you to do
[23:55.400 --> 24:00.720]  just that right now, which means that you can stop reading this book.
[24:00.720 --> 24:04.680]  Because if you can't make the effort to get through and understand the contents within

[25:55.800 --> 25:58.840]  on that case and then be in mine.
[25:58.840 --> 26:07.200]  So what I did was I went down to another courthouse because her other trial is in Chancery Court
[26:07.200 --> 26:21.080]  and it says that on November the 26th, they set the trial that she had canceled my trial
[26:21.080 --> 26:32.600]  for, but my trial was set October the 31st, which means mine was set before theirs and
[26:32.600 --> 26:40.320]  yet she postponed my trial and filed for a continuance because that other judge would
[26:40.320 --> 26:43.440]  not let her out of the case.
[26:43.440 --> 26:49.160]  These trials are how many days apart in schedule?
[26:49.160 --> 26:50.160]  Which ones?
[26:50.160 --> 26:51.160]  Why are they?
[26:51.160 --> 26:57.560]  Yours and the one she had to get a continuance for, they're how far apart in dates?
[26:57.560 --> 27:00.080]  No, they're the same.

[40:22.600 --> 40:26.360]  Did they do it after you paid them money?
[40:26.360 --> 40:32.400]  No, this was, what do they call it, not contingency, but-
[40:32.400 --> 40:33.400]  Yeah, that's what it is.
[40:33.400 --> 40:38.080]  On a contingency basis, they only get paid if you get paid.

[40:58.160 --> 41:02.680]  The Department of Veterans Affairs had gone to the magistrate and Homeland Security, U.S.
[41:02.680 --> 41:08.360]  Marshals, General Services Administration, and I presume the reason they went to the
[41:08.360 --> 41:12.480]  U.S. Marshals was to get a warrant to tap my phone, whatever.
[41:12.480 --> 41:19.520]  I took my vehicle to a Air Force countermeasures, technical countermeasures specialist.
[41:19.520 --> 41:25.080]  He wrote me a signed affidavit that said, in his expert opinion as a specialist, that
[41:25.080 --> 41:32.020]  there was either a GPS tracker in my car at some point, or there was one, or there may
[41:32.020 --> 41:36.120]  have been one from the physical scratching underneath the car.
[41:36.120 --> 41:39.840]  And like I said, he signed an affidavit to that effect.
[41:39.840 --> 41:46.840]  I attempted to hire a private investigator, but I was unable to do so because of the retainer
[41:46.840 --> 41:47.840]  that was needed.
[41:47.840 --> 41:52.840]  So I took the State of Virginia private investigator training course, and I became a private investigator
[41:52.840 --> 41:58.240]  myself, and I began to counter surveil those that were surveilling me.
[41:58.240 --> 42:03.440]  I have spent the last few years gathering counter surveillance probative evidence, and
[42:03.440 --> 42:10.920]  I have discussed this with a senior private investigator who is a former Navy of Office
[42:10.920 --> 42:15.920]  of Special Investigations investigator who then became an attorney and is now a private
[42:15.920 --> 42:18.080]  investigator in Washington State.
[42:18.080 --> 42:22.420]  In his expert opinion, I am under surveillance.
[42:22.420 --> 42:29.920]  But the interesting thing about this is the surveillance is, it is designed to intimidate.
[42:29.920 --> 42:32.920]  I'm not going to go into too much detail, but...
[42:32.920 --> 42:38.400]  Yeah, that's going to be true anytime you're going up against the federal agency.
[42:38.400 --> 42:41.080]  Intimidation is the tactic of the day.

[47:11.480 --> 47:14.480]  we went to Homeland Security, we went to U.S. Marshals,
[47:14.480 --> 47:16.480]  and we went to the General Services Administration.
[47:16.480 --> 47:19.480]  Right, but you know why that actually is, right?
[47:19.480 --> 47:24.480]  And you know that the only reason they got as much as they did is because of their government.
[47:24.480 --> 47:28.480]  Had they been a private insurance entity or some other thing,
[47:28.480 --> 47:31.480]  they wouldn't have got as much, but they would have still done it anyway.
[47:31.480 --> 47:37.480]  But the reason they're doing it is because you're making a medical claim, a disability claim.
[47:37.480 --> 47:45.480]  So what they're attempting to do is to catch you unawares in a situation that would compromise your claim.
[47:45.480 --> 47:49.480]  This was a medical malpractice case.
[47:49.480 --> 47:52.480]  This was not a compensation and pension claim.
[47:52.480 --> 47:54.480]  This was actually...
[47:54.480 --> 48:02.480]  I understand that, but you still have to have some resultant injury for the malpractice to be applicable.
[48:02.480 --> 48:05.480]  Well, the malpractice case, totally separate.
[48:05.480 --> 48:06.480]  That was settled.
[48:06.480 --> 48:08.480]  They threw money at me to get me to go away.
[48:08.480 --> 48:10.480]  But as I said, the case was settled.
[48:10.480 --> 48:14.480]  The assistant U.S. attorney offered me a check, and I walked away.
[48:14.480 --> 48:16.480]  But this was two years ago.
[48:16.480 --> 48:18.480]  The surveillance has continued.
[48:18.480 --> 48:23.480]  The conspicuous surveillance has continued, and it's disruptive.
[48:23.480 --> 48:32.480]  In that case, you may have a case, a new one, for undue harassment and so on and so forth.
[48:32.480 --> 48:36.480]  Okay. Undue harassment.
[48:36.480 --> 48:41.480]  I'm going to have to start researching.
[48:41.480 --> 48:42.480]  Yeah.
[48:42.480 --> 48:50.480]  You also may have a federal rights claim simply because without any ongoing federal necessity,
[48:50.480 --> 48:58.480]  as preparing for a lawsuit or whatever, then this type of surveillance has no backing, no reasonable backing.
[48:58.480 --> 49:05.480]  And so you can move to get the warrant to allow it quashed.
[49:05.480 --> 49:12.480]  The reason I have kept my head low is because I wanted them to feel comfortable with doing what they're doing.
[49:12.480 --> 49:16.480]  But it has literally been like three years since the case wrapped up.
[49:16.480 --> 49:23.480]  And every time I leave my house, their people are out there, and I record them.
[49:23.480 --> 49:26.480]  And I'm looking at a 1983 civil rights case.
[49:26.480 --> 49:31.480]  I just thought I just wanted to know if you knew anything specific about that or if you knew any attorneys.
[49:31.480 --> 49:37.480]  Because I've spoken to attorneys, and they just basically, you know, give me about 50 grand up front and we'll see where it goes.
[49:37.480 --> 49:39.480]  Yeah, exactly. And that's generally the way it works.
[49:39.480 --> 49:42.480]  Well, let me be frank with you here.
[49:42.480 --> 49:48.480]  I don't know any attorneys that I would ever recommend to anyone.
[49:48.480 --> 49:52.480]  And even if I knew good attorneys, I wouldn't recommend them to anyone.
[49:52.480 --> 49:54.480]  And there's a couple of reasons for that.
[49:54.480 --> 50:01.480]  One, I don't want the liability that comes with recommending an attorney that doesn't do the job right.
[50:01.480 --> 50:10.480]  Second, everything I do is intent on making it where you don't need to use an attorney to do it right.
[50:10.480 --> 50:12.480]  I would agree with that.
[50:12.480 --> 50:19.480]  And what we're planning to do is we've isolated it to the Roanoke Virginia Department of Veterans Affairs regional office.
[50:19.480 --> 50:24.480]  I've gotten, as part of my Freedom of Information Act request, I did get emails.
[50:24.480 --> 50:31.480]  I did request any email with identifying the person of Glenn McBride in digital or whatever format.
[50:31.480 --> 50:36.480]  And I got a bunch of emails where basically they were like, this guy's a scumbag. We hate him. We want to get him out of here.
[50:36.480 --> 50:43.480]  So when we move out of state, I want to isolate this issue. I want to make sure it becomes a federal issue.
[50:43.480 --> 50:48.480]  I don't want to have it get kicked out for subject matter jurisdiction down to a state level.
[50:48.480 --> 50:59.480]  Yeah, the only way you can do that is show that they violated some right under some pretense of Title 18, because that's really the only thing they can do.
[50:59.480 --> 51:06.480]  They have to violate a federally protected right for the federal courts to have any jurisdiction over it at all.
[51:06.480 --> 51:12.480]  And you're going to have to demonstrate the harm associated with that violation.
[51:12.480 --> 51:18.480]  It's not enough just to say they did it. You're going to have to show the harm that resulted from it.
[51:18.480 --> 51:31.480]  I think it's going to be a consortium case because my wife is feeling very intimidated because they give my wife the treatment as well.
[51:31.480 --> 51:38.480]  Yeah, mental anguish, you have to see whether or not that's something that you can claim at a federal level.
[51:38.480 --> 51:43.480]  Oh, absolutely. Yeah, it is. I have a psychologist who's willing to do a workup as an expert.
[51:43.480 --> 51:53.480]  Okay, you're not following me here. You say it is. Have you looked to determine exactly what your causes of action are?
[51:53.480 --> 52:01.480]  I've looked in the PACER and I have seen similar cases of consortium where the spouse of the victim, specifically military veterans,
[52:01.480 --> 52:10.480]  suffered through the actions of the military and through the injuries done to their spouses.

[52:34.480 --> 52:48.480]  I'm trying to get a case and use diversity because I've got three DOJ agents out of D.C. and the rest of the people are from Maine.
[52:48.480 --> 52:59.480]  I'm from Maine. My case has been going on for 10 years off and on. It's animal racketeering, but it's actually due process this time around.
[52:59.480 --> 53:09.480]  Well, it's always been due process. So the bottom line is the court is holding the case and what they're going to do is time me out.

[53:10.480 --> 53:13.480]  Which court is holding the case?

[53:41.480 --> 53:49.480]  Unfortunately, I tried that several times. He refused. I went to circuit court.
[53:49.480 --> 53:56.480]  Circuit court changed my interlocutory appeal to a writ of mandamus and said they wouldn't look at it.
[53:56.480 --> 54:02.480]  In other words, I'm not going to be getting any kind of any decisions.
[54:02.480 --> 54:10.480]  What they're doing right now is slowly each judge is recusing and I need to get this case out.
[54:10.480 --> 54:18.480]  The only way I can think of to do it is to put the three feds on it under 42 U.S.D.
[54:18.480 --> 54:27.480]  1986 because that's how I contacted them, but I contacted them not as DOJ agents, as private people.
[54:27.480 --> 54:31.480]  And as you know, 1986 says every person.
[54:31.480 --> 54:37.480]  It does not say if you have a day job at DOJ, you don't have to follow the law.
[54:37.480 --> 54:47.480]  So what I'm hoping to do is file the case based on diversity so that I can get it out of Maine's jurisdiction.
[54:47.480 --> 54:53.480]  You misunderstand what diversity jurisdiction is.
[54:53.480 --> 55:00.480]  Diversity jurisdiction is when you invoke the power of a federal court because
[55:00.480 --> 55:10.480]  parties to the suit are under different state jurisdictions or different levels of governmental jurisdiction.
[55:10.480 --> 55:18.480]  You're already engaging in diversity jurisdiction by trying to file it in a federal court.
[55:18.480 --> 55:24.480]  The reason I need to file it in a federal court is because it's a federal issue.
[55:24.480 --> 55:32.480]  Well, I understand that, but what you're wanting is a change of venue, not diversity jurisdiction.
[55:32.480 --> 55:35.480]  You've already got that.
[55:35.480 --> 55:40.480]  Yes, I filed the change of venue. They have ignored it, and they will continue to do so.
[55:40.480 --> 55:42.480]  This is what they've done before.
[55:42.480 --> 55:48.480]  They simply wait approximately nine months the last time, and then they just dismiss it.
[55:48.480 --> 55:51.480]  Okay, then non-suit it.
[55:51.480 --> 55:59.480]  File your own dismissal non-suit it, get it out of their hands, and file it in a different jurisdiction,
[55:59.480 --> 56:03.480]  one that has a jurisdiction, of course.
[56:03.480 --> 56:11.480]  But remember that that makes it hard on you because you have to appear in the other jurisdiction.
[56:11.480 --> 56:13.480]  Yeah, I don't mind.
[56:13.480 --> 56:21.480]  The problem that I have is the correct jurisdiction, if I don't put the feds on this thing, would be main.

[57:27.480 --> 57:34.480]  Then you need to look at the federal rules of procedure and see if that's something they're allowed to do.
[57:34.480 --> 57:45.480]  Because generally, I don't know how you would make the other side respond if you haven't filed the suit.
[57:45.480 --> 57:49.480]  That to me doesn't make any sense.
[57:49.480 --> 57:50.480]  No, no.
[57:50.480 --> 57:55.480]  What you do is you file the claim and you tell them you have 30 days to answer.
[57:55.480 --> 58:02.480]  If you choose not to settle this, then I will file an XYZ court.

[01:14:56.480 --> 01:15:01.480]  She needs to use her cell phone, call the local police, call the state police, whichever.

[01:15:06.480 --> 01:15:12.480]  The car behind me is the blue whatever, or she can get the license number.

[01:15:16.480 --> 01:15:24.480]  There was another case just like it in California, and that gives you the police report so that when you get your court, there's no mistaking.

[01:15:28.480 --> 01:15:36.480]  In California, it was the sheriff's men, believe it or not, with high-powered rifles, unmarked cars.

[01:15:39.480 --> 01:15:42.480]  The criminals are just taken over the world.
[01:15:42.480 --> 01:15:44.480]  It's astonishing to me.
[01:15:44.480 --> 01:15:46.480]  I have a judge in Maine.

[01:15:48.480 --> 01:15:57.480]  After there was no case in the court whatsoever, he actually converted stolen property of mine that they stole without a warrant
[01:15:57.480 --> 01:16:01.480]  while I was in handcuffs and being told I wasn't under arrest.
[01:16:01.480 --> 01:16:07.480]  He actually gave my property to the people who stole it.
[01:16:07.480 --> 01:16:09.480]  There was no case in his court.
[01:16:09.480 --> 01:16:15.480]  The case was in D.C., federal court, and he actually wrote the order.

[01:16:18.480 --> 01:16:25.480]  And then he wrote an answer to an order that I filed in the D.C. court and denied it.

[01:16:29.480 --> 01:16:35.480]  How's that possible when Congress, under U.S. decode, says I get to remove it?
[01:16:35.480 --> 01:16:38.480]  But he abolished congressional law.
[01:16:38.480 --> 01:16:49.480]  Well, he doesn't, but this goes pretty well right into the hands of what I was saying in the opening of my book at the beginning of the show.

[01:20:40.480 --> 01:20:47.480]  out, locked us up, didn't tell us what we were being charged with for two days later.
[01:20:47.480 --> 01:20:50.480]  So, we were held down in the holding area.
[01:20:50.480 --> 01:20:55.480]  The judge came down, talked to us, told us what we were being charged with.
[01:20:55.480 --> 01:21:00.480]  And, yeah, basically tomorrow's court.
[01:21:00.480 --> 01:21:06.480]  Now, tomorrow, I guess it's just the first day, so I don't know what it's really called
[01:21:06.480 --> 01:21:15.480]  or what is going to be done there tomorrow, but the fact is that I had what they asked
[01:21:15.480 --> 01:21:16.480]  for, a driver's license.
[01:21:16.480 --> 01:21:21.480]  I had a valid driver's license, but since I did not give it to them, the officer wrote
[01:21:21.480 --> 01:21:28.480]  me a ticket for driving with the defendant's Florida driver's license.
[01:21:28.480 --> 01:21:31.480]  And I haven't had a Florida driver's license in so long.
[01:21:31.480 --> 01:21:34.480]  I have a valid Virginia license.
[01:21:34.480 --> 01:21:39.480]  I also got, I went and ordered a copy of my driver's record.
[01:21:39.480 --> 01:21:42.480]  I have that with me also.
[01:21:42.480 --> 01:21:46.480]  The Florida one you mean?
[01:21:46.480 --> 01:21:48.480]  No, the Virginia one.
[01:21:48.480 --> 01:21:53.480]  Why don't you have the one from Florida showing that the license was never suspended?

[01:22:26.480 --> 01:22:32.480]  But wouldn't, just the fact of me not giving him any type of license in the first place,
[01:22:32.480 --> 01:22:37.480]  because there was eight other cops in there and all the recordings were on.

[01:22:38.480 --> 01:22:41.480]  I mean, look at this, the way this plays out.
[01:22:41.480 --> 01:22:45.480]  A cop accuses you of having an invalid Florida license.
[01:22:45.480 --> 01:22:52.480]  You can prove that you've never had or it has been years since, or you can force them
[01:22:52.480 --> 01:22:58.480]  to bring evidence to court showing that you've had the license in Florida.
[01:22:58.480 --> 01:23:02.480]  But they can't produce that information, can they?
[01:23:02.480 --> 01:23:03.480]  No.
[01:23:03.480 --> 01:23:04.480]  Exactly.
[01:23:04.480 --> 01:23:07.480]  The burden of proof is on them.
[01:23:07.480 --> 01:23:11.480]  You simply have to challenge them to produce it.

[01:25:07.480 --> 01:25:09.480]  Now, remember this about local rules.
[01:25:09.480 --> 01:25:19.480]  Local rules normally are only applicable to written motions and other types of materials.
[01:25:19.480 --> 01:25:25.480]  Normally they don't have any local rules that go outside of that.
[01:25:25.480 --> 01:25:32.480]  They might on occasion have one that deals with something relevant to evidence introduction and so on and so forth,
[01:25:32.480 --> 01:25:35.480]  but I found that to be extremely rare.
[01:25:35.480 --> 01:25:45.480]  Usually the local rules deal only with timeframes of filing certain types of motions and other documents.
[01:25:45.480 --> 01:25:55.480]  But the actual criminal procedure and the actual rules of evidence in criminal cases, you're going to need to know those.
[01:25:55.480 --> 01:26:03.480]  And you may need to know some of the rules of civil procedure if and when the rules of criminal procedure don't cover it,
[01:26:03.480 --> 01:26:05.480]  because here in Texas it works that way.
[01:26:05.480 --> 01:26:11.480]  If there's nothing in the code of criminal procedure dealing with how something is to be done,
[01:26:11.480 --> 01:26:16.480]  then the rules of civil procedure will be applied.
[01:26:16.480 --> 01:26:19.480]  Okay, that's good to know, civil procedure.
[01:26:19.480 --> 01:26:26.480]  So these are the main things that you need to learn whatever state you get caught up in and you're trying to...

[01:26:31.480 --> 01:26:34.480]  Okay, so that makes sense. So I need to cover these things,
[01:26:34.480 --> 01:26:42.480]  and I have a very easy case because I have valid everything and everything they did was wrong.
[01:26:42.480 --> 01:26:45.480]  So these are the things I need to do.
[01:26:45.480 --> 01:26:55.480]  I've got one more question because I've seen that by me hearing this, I'm inevitably forced to speak it to other people.
[01:26:55.480 --> 01:27:01.480]  And I see that people are starting to look and find it interesting.
[01:27:01.480 --> 01:27:05.480]  And one of those people is my mate, my wife or whatnot.
[01:27:05.480 --> 01:27:10.480]  And I've seen that she recently got a ticket or whatnot.
[01:27:10.480 --> 01:27:16.480]  And now we're in court, and as we're in court, the judge is talking to us.
[01:27:16.480 --> 01:27:26.480]  So we put in a demand for dismissal, just to see how they would react
[01:27:26.480 --> 01:27:35.480]  and see what kind of things are going on in the court for the lack of jurisdiction and things like that,
[01:27:35.480 --> 01:27:38.480]  and court cases from the federal courts and stuff like that.
[01:27:38.480 --> 01:27:46.480]  And the judge got in there. Within two minutes of sitting down, they called recess,
[01:27:46.480 --> 01:27:53.480]  and the judge went out the door for two minutes, and it came right back in with the paperwork
[01:27:53.480 --> 01:28:05.480]  and basically stopped whoever he was dealing with, called my wife up, and started reading the dismissal.
[01:28:05.480 --> 01:28:20.480]  And then after he read it, he started reading his reasons for why he was going to deny the motion.
[01:28:20.480 --> 01:28:29.480]  So he starts reading about recent Appellate Court decisions, said this and this and that.
[01:28:29.480 --> 01:28:33.480]  He was talking so fast that I couldn't really get all of it.
[01:28:33.480 --> 01:28:43.480]  But it was not even making a conclusion of some type of argument to what the Supreme Law is saying
[01:28:43.480 --> 01:28:48.480]  as far as that it has to be overturned.
[01:28:48.480 --> 01:28:53.480]  These type of decisions have to be overturned. They didn't say anything about that.
[01:28:53.480 --> 01:28:57.480]  So I'm sitting here like I had to order the records, but I have to go pick it up tomorrow
[01:28:57.480 --> 01:29:01.480]  so I could actually go look up all the rules that he was saying.
[01:29:01.480 --> 01:29:03.480]  Right.
[01:29:03.480 --> 01:29:12.480]  Once all that happened, it was like she was like in fear, and like how do you deal with that?
[01:29:12.480 --> 01:29:19.480]  If you can find that the information the judge was giving her was intentionally misleading,
[01:29:19.480 --> 01:29:30.480]  then you can move to recuse the judge or disqualify the judge as being absolutely partial and unfair.
[01:29:30.480 --> 01:29:39.480]  The judge was attempting to knowingly mislead her as to the law and the facts in order to not dismiss the case.
[01:29:39.480 --> 01:29:42.480]  So you can disqualify them for that if you can prove it.

[01:38:29.480 --> 01:38:38.480]  I'm willing to play the game the way they want it played, which is to prevent anyone with any proper knowledge from participating.
[01:38:38.480 --> 01:38:49.480]  I'm going to play it to make sure that justice is served as a fully informed juror, whether they like it or not.
[01:38:49.480 --> 01:38:56.480]  We have that right. That's our courtroom. It's not theirs, despite what they want you to believe.
[01:38:56.480 --> 01:39:04.480]  So if, in fact, something goes to jury trial, I have heard of cases in the past where the jury's recommendation

[01:39:08.480 --> 01:39:21.480]  It can be ignored if what the jury recommends is outside of that which is allowed by law or if in certain instances

[01:43:20.480 --> 01:43:27.480]  over which they had that regulatory authority. That's what they try to get when they call you a driver or an operator.
[01:43:27.480 --> 01:43:40.480]  They're trying to get you to assume the legal liability of that party, that capacity. And if you deny that capacity, they can't get you into that.

[01:46:59.480 --> 01:47:04.480]  What facts does he rely on that prove the code applies to me?
[01:47:04.480 --> 01:47:08.480]  That's it. Without any facts, the judge has nothing to go on.
[01:47:08.480 --> 01:47:18.480]  Yeah, but that's exactly what they're going to say that the witness, i.e., the officer, is there to testify to is those specific facts.
[01:47:18.480 --> 01:47:23.480]  Well, when you first get to court, it's usually just you and the officer, and I would object.
[01:47:23.480 --> 01:47:27.480]  Well, that depends on where you are. In Texas, it's not that way.
[01:47:27.480 --> 01:47:39.480]  Well, in Michigan, it usually is at least your first hearing, and I would object because no one's called any witnesses. Is he a witness or is he the injured party?
[01:47:39.480 --> 01:47:45.480]  If he's a witness and no one's called a witness, what is he there for? He can't be there.
[01:47:45.480 --> 01:47:53.480]  Now, if he's the injured party, well, then he can be there, but he's got to have a claim, not a complaint, but a claim.
[01:47:53.480 --> 01:47:59.480]  No, he doesn't have to have a claim as a witness. He has to have a claim as an injured party.
[01:47:59.480 --> 01:48:06.480]  Correct. And if he's not an injured party and no one's called any witnesses, he can't be there as a witness.
[01:48:06.480 --> 01:48:12.480]  Okay. I don't know where you're talking about your procedures, but here it works like this.
[01:48:12.480 --> 01:48:17.480]  The only time you ever see any witness against you is at the actual trial.
[01:48:17.480 --> 01:48:26.480]  Despite the fact that they are supposed to do what is called an examining trial so that witnesses can be questioned and evidence introduced
[01:48:26.480 --> 01:48:32.480]  and determine whether or not it's admissible prior to actually going to trial.
[01:48:32.480 --> 01:48:38.480]  But in Texas, they conveniently decided that they would do away with that despite the requirement of it in statute.
[01:48:38.480 --> 01:48:47.480]  So you don't ever see a witness or anyone else other than the judge and opposing counsel until trial.
[01:48:47.480 --> 01:48:52.480]  Okay. So the opposing counsel can't really say anything. It's all hearsay.
[01:48:52.480 --> 01:48:58.480]  The opposing counsel never does anything except meet with you to determine whether or not you want to cut a deal
[01:48:58.480 --> 01:49:02.480]  or to tell the judge they're ready to proceed to trial.
[01:49:02.480 --> 01:49:06.480]  Okay. Can you hijack his witness?
[01:49:06.480 --> 01:49:14.480]  You can cross-examine his witness and make his witness work for you if you know how.
[01:49:14.480 --> 01:49:18.480]  But again, that happens at trial.
[01:49:18.480 --> 01:49:26.480]  Okay. But when he brings his witness, does everyone have to submit a list of witnesses they're going to bring?
[01:49:26.480 --> 01:49:31.480]  Not in these types of cases, they don't. In the larger, more serious cases, they do.
[01:49:31.480 --> 01:49:38.480]  Now, you can ask for a list of witnesses. That doesn't necessarily mean they've made one or will give it to you.
[01:49:38.480 --> 01:49:41.480]  They're supposed to.
[01:49:41.480 --> 01:49:45.480]  Did you object that that's my witness and steal it from him?
[01:49:45.480 --> 01:49:47.480]  No.
[01:49:47.480 --> 01:49:50.480]  Why not? How did he get there in the first place?
[01:49:50.480 --> 01:49:57.480]  They called him there. They subpoenaed him. They named him as state's primary witness.
[01:49:57.480 --> 01:50:04.480]  Therefore, the only thing he can be to you is a hostile witness, but he's not your witness.
[01:50:04.480 --> 01:50:10.480]  Why? Well, do you think you could subpoena him also?
[01:50:10.480 --> 01:50:17.480]  Sure, you can subpoena him. That still isn't going to make him your witness because he is adverse against you.
[01:50:17.480 --> 01:50:25.480]  You have to figure out how to ask questions that get him to work for you, even though he doesn't want to.
[01:50:25.480 --> 01:50:36.480]  Now, before you get to the witness things, and you probably told me this and it's just gone up my head because I can't comprehend, who's the injured party?
[01:50:36.480 --> 01:50:41.480]  They are going to claim the state is the injured party.
[01:50:41.480 --> 01:50:47.480]  You are going to object to them claiming that the state is an injured party because the state is not present,
[01:50:47.480 --> 01:50:53.480]  except in the presence of its counsel, which is the prosecutor.
[01:50:53.480 --> 01:50:59.480]  This, again, goes to the issue of malum prohibitum versus malum inse.
[01:50:59.480 --> 01:51:08.480]  They refuse to recognize the requirement of standing through actual injury.
[01:51:08.480 --> 01:51:10.480]  So we need to find a case.
[01:51:10.480 --> 01:51:16.480]  There's lots of cases. They still ignore them. The courts have been hijacked.
[01:51:16.480 --> 01:51:23.480]  There is no justice within these courts at the trial level.
[01:51:23.480 --> 01:51:32.480]  You make your objections, you make your record, but it's not going to change anything until that record hits an appellate court.
[01:51:32.480 --> 01:51:40.480]  Okay. Is there a method to get a transcript for free under equal protection because the prosecutor gets it for free?
[01:51:40.480 --> 01:51:51.480]  Well, there's lots of case law that says that the people cannot be charged any filing fees or costs to seek justice in our own courts.
[01:51:51.480 --> 01:51:56.480]  We're not supposed to have to pay filing fees or for transcripts or for anything else.
[01:51:56.480 --> 01:52:03.480]  Those are limited to legal entities that are using the courts for their purposes.
[01:52:03.480 --> 01:52:11.480]  But the people have a right to the courts without cost regardless if it's in the interest of justice and protection of their rights.
[01:52:11.480 --> 01:52:17.480]  There's tons of case law on that. They ignore that too.
[01:52:17.480 --> 01:52:19.480]  They're pirates.
[01:52:19.480 --> 01:52:23.480]  Yes, they are. They are pirates in every sense of the word.
[01:52:23.480 --> 01:52:38.480]  And until we the people stop letting them get away with this by holding everybody's feet to the fire and stretching a few necks from a tree limb, this isn't going to change.
[01:52:38.480 --> 01:52:47.480]  We need to fill the courtrooms with friends and family so they can stand and object or help. There's got to be a way.
[01:52:47.480 --> 01:52:56.480]  Yeah, well, we don't need to just fill the courtrooms. We need to fill lots of public positions with people that understand liberty and freedom.
[01:52:56.480 --> 01:53:03.480]  And until we do that, nothing changes without brute force.
[01:53:03.480 --> 01:53:11.480]  It seems absurd that the previous gentleman needs to go to Florida to give him a piece of paper to give to somebody else.
[01:53:11.480 --> 01:53:20.480]  It's just so ridiculous to have to do all these things when you want to be a plumber. Instead, you got to be a lawyer.
[01:53:20.480 --> 01:53:22.480]  It's just ridiculous.

[01:53:23.480 --> 01:53:29.480]  But this is also the problem with letting lawyers take over every department of government, which we've done.
