[04:38.720 --> 04:49.040] 12, 2015. We are halfway through the first month of a new year and rolling forward as always. Unfortunately, however, I
[04:49.040 --> 04:55.960] don't think the road forward is about to get better. It's only going to get worse with the things, with the way they're
[04:55.960 --> 05:05.720] going. And I just want to tell folks out there, if you spent your day the way I spend mine, having to read the things
[05:05.720 --> 05:16.200] that I do and research the things that I do, it would really make you just want to find some high point in the world and jump
[05:16.200 --> 05:28.440] off. Because it is really, really disheartening to see how many truly stupid people are actually in charge of the most
[05:28.440 --> 05:41.520] important aspects of the world. Not just stupid, but downright evil and intentionally so on both counts. Now, real quick, I
[05:41.520 --> 05:45.840] just want to go into something that I talked about a little bit before, but there's something that I want to touch on for
[05:45.840 --> 05:55.920] everyone after this listening about knowing your rights versus how the system is attempting to destroy your rights. A perfect
[05:55.920 --> 06:04.760] example in this is the recent decision by the U.S. Supreme Court in the Hine versus North Carolina case. Now, everybody is up
[06:04.760 --> 06:15.880] in arms about how this case was decided, which I completely agree was very, very incorrectly and very politically motivated so
[06:15.880 --> 06:23.560] is my opinion of why. But be that as it may, let's look at a few facts about this. Now, I'm going to read to you what the
[06:23.560 --> 06:31.920] first paragraph is in this case. Listen to the details of the events as they're recorded in the case and how they
[06:31.920 --> 06:41.400] transpired at the time this gentleman was pulled over by this officer. Following a suspicious vehicle, Sergeant Martin
[06:41.400 --> 06:48.640] DeRese noticed that only one of the vehicle's brake lights was working and pulled the driver over. While issuing a warning
[06:48.640 --> 06:56.440] ticket for the broken brake light, DeRese became suspicious of the actions of the two occupants and their answers to his
[06:56.440 --> 07:07.600] question. Petitioner Nicholas Brady Hine, the car's owner, gave DeRese consent to search the vehicle. DeRese found cocaine and
[07:07.600 --> 07:14.800] Hine was arrested and charged with attempted trafficking. The trial court denied Hine's motion to suppress the seized
[07:14.800 --> 07:21.360] evidence on Fourth Amendment grounds, concluding that the vehicle's faulty brake light gave DeRese reasonable suspicion to
[07:21.360 --> 07:29.760] initiate the stop. The North Carolina Court of Appeals reversed, holding that the relevant code provision, which
[07:29.760 --> 07:40.000] requires that a car be equipped with a stop lamp, North Carolina General Statute annotated Section 20-129G, requires
[07:40.000 --> 07:48.360] only a single lamp, which Hine's vehicle had, and therefore the justification for the stop was objectively unreasonable,
[07:48.360 --> 07:56.640] reversing in turn the state Supreme Court held that even assuming no violation of the state law had occurred, DeRese's
[07:56.640 --> 08:09.040] mistaken understanding of the law was reasonable and thus the stop was invalid. The Supreme Court held because DeRese's
[08:09.040 --> 08:16.640] mistake of law was reasonable, there was reasonable suspicion justifying the stop under the Fourth Amendment.
[08:16.640 --> 08:27.600] All right, now let's take all of that in totality of how they've got this and let's understand one thing. The officer went
[08:27.600 --> 08:36.640] farther than issuing the warning ticket for what reason? He became suspicious of the answers received from the two men in
[08:36.640 --> 08:51.360] the truck to his questions. Rule one, shut up, keep shutting up, and shut up some more. Had these gentlemen not answered
[08:51.360 --> 09:00.240] the officer's questions, which they were under absolutely no obligation to do, wouldn't have been any suspicion
[09:00.240 --> 09:09.760] triggered, would there? At least not that could have been determined to be reasonable. Because the court has stated
[09:09.760 --> 09:19.200] and is fully aware, you are not required to answer these officer's questions. But these men did. Refer to the
[09:19.200 --> 09:29.360] transportation stop script, folks. Let's look at issue number two. No warrant, no probable cause to search, asked for a
[09:29.360 --> 09:43.280] voluntary consent to search, voluntary consent granted, drugs discovered, arrest made, how stupid do you have to be?
[09:43.280 --> 09:50.400] You know there's drugs in your car. You know he doesn't have a warrant and you know that so far he has no
[09:50.400 --> 09:56.320] articulable probable cause or reasonable suspicion to determine that there are drugs in the car.
[09:56.320 --> 10:05.520] And you, knowing you are trafficking in drugs, and sure, go ahead, search. At that point, it does not matter
[10:05.520 --> 10:13.680] whether the initial stop was reasonable or not. Because had you done the same thing when a cop walked up to you
[10:13.680 --> 10:19.600] in the crowd and initiated a conversation and you were giving him answers to all these questions, and he said, hey,
[10:19.600 --> 10:25.680] I know that you're not doing anything wrong at the moment and I don't really think you are, but just, you know,
[10:25.680 --> 10:34.160] hey, would you mind if I searched your backpack just to see what you're carrying? Oh, no, go ahead. And you got a
[10:34.160 --> 10:39.760] kilo of coke in the bottom of it and then you try to have it thrown out and suppressed because he discovered it.
[10:39.760 --> 10:52.080] How stupid do you have to be? Well, that's what happened right here. So even though the initial stop was not based upon
[10:52.080 --> 11:03.600] an actual fault of law or violation thereof, the subsequent search was perfectly fine because it
[11:03.600 --> 11:12.720] was consented to voluntarily. Once again, had you not consented to a warrantless search and answered
[11:12.720 --> 11:19.920] any questions, there wouldn't have been a reasonable basis for the discovery of anything
[11:19.920 --> 11:25.840] and this would not have been a case decided the way that it is. I talked about this once before,
[11:25.840 --> 11:34.560] but the more I've been reading about how stupid our judges are in Texas and elsewhere, how they
[11:34.560 --> 11:42.160] absolutely refuse to look at the actual statutes they claim, have all the authority they exercise,
[11:42.160 --> 11:48.480] but they completely ignore them as if they don't exist and they create case opinion that runs contrary
[11:48.480 --> 11:57.680] to them and that case opinion stands for decades as if the statute never changes in its entire history
[11:57.680 --> 12:04.400] and even when it does and the opinion is now dead to water because it did, they continue to go with
[12:04.400 --> 12:09.360] the opinion and ignore the changes because they never bother to read a single pleading that we
[12:09.360 --> 12:18.640] file in the court that says, hey, you're doing it wrong. If you want to prove just how contrary to
[12:18.640 --> 12:25.280] understanding what they're really supposed to do, a judge is, ask them to actually read an argument
[12:25.280 --> 12:34.320] that says you're doing it wrong. Lawyers sure as hell won't do it. You go into a lawyer's office
[12:34.320 --> 12:38.720] and say, hey, are you aware that you've probably been misrepresenting your clients for a very long
[12:38.720 --> 12:44.480] time now? Are you aware that you've been giving bad legal advice based upon what the law actually
[12:44.480 --> 12:51.200] says versus what you're telling your clients? Are you aware that your practice is committing fraud
[12:51.200 --> 12:56.560] by telling them A, when the law says B, so you can get them to pay you money to go to court
[12:56.560 --> 13:03.520] under the pretense that you can handle it and they can't? Because that's what's happening.
[13:03.520 --> 13:11.840] The American judicial system is completely screwed. There's no other way to put it. There is no
[13:11.840 --> 13:20.000] politically correct way to put it. It is absolutely totally screwed. But so is every other form of
[13:20.000 --> 13:25.920] government we've got. We've allowed it to run completely unmanaged and uncontrolled by the
[13:25.920 --> 13:35.040] people. We've given the inmates the keys not only to the asylum, but to the armory as well, and then
[13:35.040 --> 13:42.400] we stocked them up with the money to buy the bullets. And then we said, oh, well, you go ahead
[13:42.400 --> 13:46.320] and now that you're running the asylum, you go ahead and make all the rules about how the asylum
[13:46.320 --> 13:52.800] works. What do you think they're going to do to all the doctors that were in the asylum?
[13:52.800 --> 13:57.920] Don't you think they might have an axe to grind and a vendetta to achieve before this is all said
[13:57.920 --> 14:05.440] and done? A government that is supposed to serve the people now takes exception to being told that
[14:05.440 --> 14:10.880] they're servants and acts punitively toward the public when they remind them of that?
[14:12.960 --> 14:17.760] When you challenge the authority of one of your public servants and they fail to comply with the
[14:17.760 --> 14:24.000] law, when you challenge the authority of one of your public servants and they fly off the
[14:24.000 --> 14:31.280] handle like it is absolutely beneath them to even address the issue in front of you or because of
[14:31.280 --> 14:39.200] you, because somehow or other you don't matter more than them, and you continue to believe all
[14:39.200 --> 14:48.640] of that is okay. And the people around you continue to believe all of that is okay. So do that 18, 20
[14:48.640 --> 14:54.400] hours a day like I do. Read about it, learn about it, try to figure out what to do about it, and
[14:54.400 --> 14:59.600] then look around and see how much help you've got, and you'll start looking for that high point to
[14:59.600 --> 15:06.480] jump off of, I promise you. If it wasn't for the fact that I absolutely refused to give up no matter
[15:06.480 --> 15:15.360] the odds, I probably would have done that by now. But that's just not me. I will die my dying breath
[15:15.360 --> 15:22.160] fighting tooth and nail to fix the wrongs that I know exist, no matter what the cost, no matter
[15:22.160 --> 15:27.040] what the penalty, no matter what is put in print about me or what's said about me or what the
[15:27.040 --> 15:35.040] opinion of is about me. I will do it because I know it's right, and I'm not going to let anything or
[15:35.040 --> 15:42.560] anyone stand in my way because of that. And I've got people I love and care for dearly that don't
[15:42.560 --> 15:48.880] agree with a lot of the things I say because they don't view things from the point of view that I
[15:48.880 --> 15:54.320] have. And a lot of people don't because they don't spend their time doing the things that I do to see
[15:54.320 --> 16:00.000] what I see. And that's okay. Some people don't want to, and that's okay too. But the problem is,
[16:00.000 --> 16:05.200] it goes back to the old adage of, don't judge a man until you've walked a mile in his shoes.
[16:05.200 --> 16:15.360] So don't expect me to accept that your basis for why I'm wrong, when when I ask you questions
[16:15.360 --> 16:21.040] about specific facts and you have no clue what I'm talking about, that tells me right off the bat,
[16:21.040 --> 16:27.200] you have no clue what you're talking about when you tell me I'm wrong. You have no grounds for it,
[16:27.200 --> 16:32.160] no informational basis for it, it's just your opinion. And I've learned a long time ago,
[16:32.160 --> 16:39.440] I'm not living with anybody else's opinion ever again. You can convince me something is wrong if
[16:39.440 --> 16:44.080] you can prove it to me that it's wrong or make a reasonable argument based upon the facts that it's
[16:44.080 --> 16:50.560] wrong, but you're never going to opinionate me into believing I'm wrong. All right folks, y'all hang

[21:18.080 --> 21:26.320] with a bunch of signed petitions to hand to each and every legislator, house representative,
[21:26.320 --> 21:34.080] and senator, expressing their support for HB 195, which is a bill that, if passed,
[21:34.080 --> 21:42.000] will allow for unlicensed, concealed, and open carrying of a handgun. There's another
[21:42.000 --> 21:49.040] organization out there, which this is my personal opinion, they're going to be performing, I guess,
[21:49.040 --> 21:58.960] the best way of phrasing it on the air is a stunt, which is they purchased a ghost gunner
[21:58.960 --> 22:05.120] from Defense Distributed, and they're going to attempt to manufacture lower receivers on the
[22:05.120 --> 22:10.720] grounds of the Capitol or just outside the gate. That's not the best, in my personal opinion,
[22:10.720 --> 22:21.840] I don't think that's the best idea to advocate for HB 195 going, confronting with federal firearms
[22:21.840 --> 22:27.280] laws as stupid as they are. Just talk to anyone who knows anything about firearms, like what's
[22:27.280 --> 22:31.360] the difference between a pistol and a short-barreled rifle, and what you can attach to a pistol,
[22:31.360 --> 22:37.360] and what not, and why you need a tac-tent for a short-barreled rifle. It's all ridiculous
[22:37.360 --> 22:44.320] legislation which needs to be repealed, but this is not the time to, or just manufacturing firearms
[22:44.320 --> 22:51.120] with this device from 80% lowers without having a serial number, this is not the time or the place
[22:51.120 --> 22:58.640] to do something like that, than trying to advocate to get the state laws changed to allow for
[22:58.640 --> 23:05.840] essentially de facto constitutional carry of a handgun without the need of a concealed
[23:05.840 --> 23:10.640] handgun license, open carry or concealed.
[23:10.640 --> 23:22.560] All right. Eddie, do you have anything on that or? Well, the problem with any law is that the
[23:22.560 --> 23:29.280] moment it's put in law, it's subject to alteration by anybody else. They can repeal it, they can
[23:29.280 --> 23:35.200] amend it, they can limit it. My question first and foremost would be, where do you people think
[23:35.200 --> 23:42.480] you have the power and authority from us, the real people, to take away our right to keep and bear
[23:42.480 --> 23:50.240] arms in public, concealed or not concealed in the first place? Because the second sentence in the
[23:50.240 --> 23:56.320] right to keep and bear arms amendment that they put into the 1876 constitution has nothing to do
[23:56.320 --> 24:01.040] with the people. The second sentence where it says, the state shall have the right to regulate
[24:01.040 --> 24:06.080] the wearing of arms with an eye toward the prevention of crime. That's saying they can arm
[24:06.080 --> 24:11.520] the cops to operate on behalf of the state. Ain't got nothing to do with the people because our
[24:11.520 --> 24:17.360] right to keep and bear arms didn't come from the constitution. We had it anyway. Therefore,
[24:17.360 --> 24:26.400] the constitution can't take it away any more than their statutes can. That's my opinion on it.
[24:26.400 --> 24:33.360] And like you said, it goes all the way back to the late 1876 during Reconstruction and the fact that
[24:33.360 --> 24:41.680] it was actually originally a racist law to prevent the freed slaves from being able to
[24:44.320 --> 24:49.200] bear arms for their own protection. And the fact that there's all these weird quirks in it
[24:49.200 --> 24:54.400] currently where you can open carry constitutionally a long gun, that's just fine, but a pistol you
[24:54.400 --> 25:00.640] can't open carry at all with a concealed handgun license or not. So absolutely, this needs to be
[25:01.760 --> 25:08.000] basically repealing back all this draconian legislation from two centuries ago. That is
[25:08.000 --> 25:16.240] exactly what HB 195 is supposed to do. I do understand you're taking this and I agree with
[25:16.240 --> 25:21.200] that wholeheartedly. If you go to the second amendment of the constitution of the United
[25:21.200 --> 25:27.680] States, there's the rights of this since the bearer army shall now be infringed to maintain a free
[25:27.680 --> 25:35.120] state. Yeah. Well, the thing about it is in order for this to actually have an effect in Texas,
[25:35.120 --> 25:40.160] someone's going to have to step up and do the exact same thing the folks in DC did. Someone is
[25:40.160 --> 25:45.760] going to have to get charged under the Texas law and take it to the Supreme Court for the Supreme
[25:45.760 --> 25:50.080] Court to say, what's wrong with you idiots? Which part about what we did in DC are you not
[25:50.080 --> 25:57.840] understanding in Texas? The people's right to keep and bear arms goes everywhere, not just here in
[25:57.840 --> 26:07.040] DC or not just over there in that state, but everywhere. Exactly. Because otherwise we'll
[26:07.040 --> 26:13.520] end up like Europe or Australia or some of these other states, which just have their freedoms eroded.
[26:13.520 --> 26:20.720] Well, if you go by the federal constitution and believe it was still in force in effect, even if
[26:20.720 --> 26:26.480] that is true, the problem remains the same about what I was saying at the very beginning, how
[26:26.480 --> 26:34.240] apathetic we've become to allow this to even become necessary. Exactly. Every single law in
[26:34.240 --> 26:45.440] every single Republic or DC, which is not either, is absolutely unconstitutional under the provisions
[26:45.440 --> 26:52.720] of the second amendment. I don't care what the law pretends to do. Registration, background checks,

[28:22.320 --> 28:29.200] member of his cabinet with treason. Why? Giving aid and comfort to the enemy. The moment they began

[28:34.800 --> 28:41.200] attempting to alter our basic form of government, they committed treason by helping the enemies of

[35:26.960 --> 35:37.360] Yep. Now, last, not this past Sunday, but last Sunday, I was involved in an auto accident.
[35:37.360 --> 35:43.280] Somebody hit me. When the police came on the scene, the first thing the police,
[35:43.280 --> 35:48.720] you know, the police officer, you know, was always ready for driver's license, insurance,
[35:48.720 --> 35:53.520] and registration. I gave my documentation. I have an extra-constructional notice,
[35:53.520 --> 35:57.680] extra-constructive notice that I, that I sent you certified mail to the
[35:57.680 --> 36:05.920] NBA musical administration back in 1999. I showed him that. I showed him that. Plus, he ran it.
[36:05.920 --> 36:11.040] Check on that. Before he did all that, the first thing, he's already biased against me.
[36:11.040 --> 36:15.760] He told me and the person I was involved with that he's going to charge me for everything.
[36:15.760 --> 36:20.400] Didn't even find out what was going on. He just told everybody he's going to charge me
[36:20.400 --> 36:25.840] with everything. And so when the young lady... You will make me really happy if you will tell
[36:25.840 --> 36:32.960] me you were recording all of it. No, I wish I was. I wish I was.
[36:32.960 --> 36:35.440] Wrong answer, Jimmy. Yeah.

[36:42.960 --> 36:48.160] you can clearly see that she hit me. I didn't hit her. I mean, it clearly shows how the
[36:48.160 --> 36:53.520] side of my car is hit. Okay. Let me explain something to you. We have videos of cops murdering
[36:53.520 --> 37:00.720] people in all manner of ways, shooting them, strangling them, running over them with cars.
[37:00.720 --> 37:04.800] And these guys aren't going to jail. What makes you think they're going to go to jail in your case
[37:04.800 --> 37:12.080] for committing aggravated perjury? And we'll either not show the video of what happened
[37:12.080 --> 37:19.440] and everything that will be brought up will be specifically between the cop and the person on
[37:19.440 --> 37:24.080] the other side against you. Well, how do you think that's going to play out?
[37:27.680 --> 37:30.240] How do I think it's going to play out? I asked you first.
[37:33.920 --> 37:37.440] That's a good question. I'm not really sure. I'm just going to, like I said,
[37:37.440 --> 37:43.120] do what I know to bring out how the accident really happened and really show the consistency
[37:43.120 --> 37:47.520] of what I'll say will not be considered what they're saying. They're trying to say something
[37:47.520 --> 37:53.680] that's crazy that I pulled into a lane of uncoming cars, which is crazy. If I did that,
[37:53.680 --> 38:00.880] I'd have to back up. And it just sounds crazy. Yeah, but you don't know exactly what they're
[38:00.880 --> 38:05.840] going to say the cause of the situation was, do you? You can guess, but you don't know for sure.
[38:05.840 --> 38:09.280] Yeah. Well, I know he signed into improper lane change.
[38:12.240 --> 38:16.320] Okay. So I have some degree of what he's talking about in the improper lanes. He's trying to say
[38:16.320 --> 38:24.560] that I went into the lane of uncoming cars, which is crazy. Well, okay. Let me give you
[38:24.560 --> 38:28.240] another example. And I'm not trying to rain on your parade and your potential here, but
[38:28.240 --> 38:31.680] listen carefully to what I'm trying to get you to understand about how this can actually work.
[38:31.680 --> 38:39.600] I helped a young lady here three, four years ago with a case that she had where the police tried
[38:39.600 --> 38:48.960] to charge her with road rage. When in fact, she had been on the inside lane, traveling in one
[38:48.960 --> 38:55.120] direction on a two lane street or a four lanes, well, an access road, something like that. Anyway,
[38:55.120 --> 39:03.280] she was all in the right. While she was traveling, some kid in an SUV come flying out of a parking
[39:03.280 --> 39:07.600] lot, barely missed her car coming out of the parking lot, and then proceeded to go in the
[39:07.600 --> 39:14.800] same direction that she did down the street. But he was in the lane to the left of her.
[39:15.920 --> 39:21.760] Well, just as they were approaching an intersection at a light, he decided he wanted to turn right at
[39:21.760 --> 39:28.720] the light. So he began before they got to the light and went right over the front end of her car on
[39:28.720 --> 39:36.640] the driver's side wheel and everything with his SUV and hooked her car in front of his passenger
[39:36.640 --> 39:46.720] side front or passenger side rear tire under the SUV. And the cops tried to blame it on her, even
[39:46.720 --> 39:54.400] though his tire marks are on her fender and the description of the damage and everything
[39:55.360 --> 40:00.160] shows very clearly that what they're trying to charge her with could not have possibly
[40:00.160 --> 40:08.960] happened. The laws of physics would have prevented it. Because they tried to claim that she hit him
[40:08.960 --> 40:15.200] in the rear, which means her car would have had to have spun around 180 degrees.
[40:15.200 --> 40:24.320] And then slammed into him by changing direction in 90 degrees to hit him in the rear.
[40:26.240 --> 40:27.040] You follow?
[40:28.160 --> 40:33.600] Yes, they took her all the way to the day of trial trying to make that story stick.
[40:36.320 --> 40:42.400] But I helped her beat them because we caught them with their hand in the cookie jar. They were
[40:42.400 --> 40:50.400] tampering with the court record, and we caught them. So they dropped the case the day we went in for
[40:50.400 --> 40:58.400] trial. So expect the unexpected and expect the ridiculous.
[40:59.920 --> 41:04.640] Okay, that will. Well, actually, that's already happened. You know, Gary, he admitted right in
[41:04.640 --> 41:06.080] front of us before he did.
[41:06.080 --> 41:09.520] Yeah, but who's going to testify to that? You think he's going to testify to that?
[41:09.520 --> 41:15.040] No, no. And if you're the only one that will, and it's two against one, who's going to get
[41:15.040 --> 41:22.640] believed? The cop and the person that got injured. I don't say injured, but their property damaged or
[41:22.640 --> 41:26.800] whatever, and the cops backing them up against you, who's going to get believed?
[41:28.960 --> 41:37.120] So let me throw this out there one more time. Don't leave home without a working author.

[42:07.840 --> 42:15.760] said, I didn't tell him anything. And I gave him my, you know, my actual construction notice.
[42:15.760 --> 42:21.040] It's all they had. So I went to the street that I, you know, was engaged in transportation,
[42:21.040 --> 42:26.720] that I was traveling. And like I said, he had nothing that showed me admitting to being involved
[42:26.720 --> 42:31.920] in cab transfer, that even threatened all the driver's license, no insurance, no registration.
[42:31.920 --> 42:39.280] Well, let me give you a couple things to look at. First and foremost, as far as all this goes,
[42:41.040 --> 42:45.120] you're going to need a copy of the driving record to show when they actually alleged to have
[42:45.120 --> 42:50.800] suspended your license. Because if the license isn't actually suspended, that's a bogus charge,
[42:50.800 --> 43:00.160] isn't it? And if the record shows that you relinquished it way back when and they suspended it
[43:01.200 --> 43:07.520] yesterday, they have another problem. If they go back and mark it suspended a month ago,
[43:07.520 --> 43:12.560] they've got a problem. Especially if it's marked on a date after it had already expired.
[43:14.880 --> 43:20.560] Okay. At some points, where are they going to put in the paperwork that we've actually shown
[43:20.560 --> 43:24.560] that it ever got suspended? There won't be any supporting paperwork if they're just tampering
[43:24.560 --> 43:31.200] with the computer. Okay. All right. Second thing is in relation to registration. Here in Texas,
[43:31.200 --> 43:37.280] there are actually two chapters that relate to that, which is 501 and 502 of the transportation
[43:37.280 --> 43:41.440] code. But I'll cover that here in just a second when we get back, okay? But I want to give you
[43:41.440 --> 43:46.080] a heads up on what you may want to go try and look for because it may help you out. So hang on just

[46:36.000 --> 46:40.960] you an idea of what to be looking for there. All right, in Texas, when it comes to registration,
[46:40.960 --> 46:46.080] the two chapters in the transportation code relating to this is 501 and 502. 501 deals
[46:46.080 --> 46:51.920] with certificates of title. 502 deals with the actual registration. 501 for the certificate
[46:51.920 --> 47:00.720] of title specifically says it's only required by state-owned vehicles. Nobody else gets a
[47:00.720 --> 47:09.760] certificate of title. Therefore, registration applies only to who when you must have the
[47:09.760 --> 47:21.440] certificate of title in order to register. It applies to the state. Exactly. If only
[47:21.440 --> 47:28.800] state-owned vehicles are required to obtain and have a certificate of title, which is
[47:28.800 --> 47:37.920] how it's written right into 501, then the certificate of title is a requirement of
[47:37.920 --> 47:52.480] registering a motor vehicle in 502. Who has to register? The state. Exactly. See, here in Texas,
[47:52.480 --> 47:59.600] the original purpose of the Motor Vehicle Registration Act was to track down the theft
[47:59.600 --> 48:06.880] of motor vehicles and prevent it. It became a voluntary service to the public,
[48:06.880 --> 48:13.120] but it was mandatory for all vehicles owned by the state, so if they were stolen, they could be
[48:13.120 --> 48:20.800] tracked. It had nothing to do with the general public as far as being mandatory, and it still
[48:20.800 --> 48:25.440] doesn't. Then, of course, you have the driver's license statute here in Texas.
[48:26.080 --> 48:32.800] The original enactment under 6701 of Vernon's annotated civil statutes has three licenses,
[48:32.800 --> 48:40.640] operators, commercial operators, and chauffeurs. In the current driver's license codification in
[48:40.640 --> 48:46.800] the transportation code, it's defined as one of three things, an occupational license,
[48:49.360 --> 48:57.920] what we call a learner's permit, and the temporary license. When you go through the statute chapter
[48:57.920 --> 49:04.560] of chapter 521, you will find out all three of those licenses are the same thing. They're
[49:04.560 --> 49:11.760] temporary. They're not permanent. They're not even semi-permanent. They have a very short lifespan.
[49:14.080 --> 49:21.600] They all are classified as temporary licenses. It is impossible for any person
[49:21.600 --> 49:30.000] permanently domiciled in Texas to comply with the driver's license chapter. Impossible. You
[49:30.000 --> 49:39.040] would actually be committing a crime if you get a license called a driver's license in Texas,
[49:39.040 --> 49:47.200] and you live here. I proved that in class using their own statutes. I proved that in
[49:47.200 --> 49:55.760] class this past Sunday. Those are the things you're going to want to look for. What kind
[49:55.760 --> 49:59.840] of license are they saying you have to have? What's the definition of that license? Okay,
[49:59.840 --> 50:05.680] if it includes a specific list of licenses, then what is the criteria for each of those licenses,
[50:05.680 --> 50:12.240] and which one are they saying you don't actually have? If they're all classified as temporary,
[50:12.240 --> 50:19.440] then how do you obtain a temporary license when you live there permanently? Because in Texas,
[50:19.440 --> 50:27.040] it's a crime to fill out a licensing application with false information. Based upon the criteria
[50:27.040 --> 50:33.040] required in the application to get any of these three licenses, you would in fact be falsifying
[50:33.040 --> 50:41.600] a government document by applying if you live here. The statutes here in Texas create a
[50:41.600 --> 50:48.960] statutory impossibility. They cannot compel you to commit a crime to exercise a privilege
[50:48.960 --> 50:56.480] to avoid a lesser crime, because the crime you would be committing is a Class A up to a year in
[50:56.480 --> 51:06.880] jail in order to escape a Class C fine only. See the problem there? You're risking a year in jail
[51:06.880 --> 51:12.880] to avoid a $200 fine. They're both punitive actions, and it's impossible to do one and not
[51:12.880 --> 51:19.280] the other. Yes, but that's the way you use an attorney termination. You use it properly to
[51:19.280 --> 51:26.480] do some jail time. Lose your job, lose your life and all that. Yeah, and that's part of the problem.
[51:26.480 --> 51:35.440] We were never meant to be regulated by these statutes. Okay. But that's the argument that
[51:35.440 --> 51:40.160] I'm making right now, of course, only applies if you're going to have to fight this on merits.
[51:41.200 --> 51:47.520] You can win these cases on merits if you know what the statutes say. It's not the
[51:47.520 --> 51:54.000] best option to get rid of the entire system, but you can beat it on merits if you know how
[51:54.000 --> 52:06.960] to argue the merits. I have an under record that it was terminated and destroyed back in 98. So
[52:06.960 --> 52:11.680] the termination story does not exist. So it does not exist. You can't retroactivate stuff and try
[52:11.680 --> 52:17.200] to say that it's still suspended from that agreement or contract. And also I have a
[52:17.200 --> 52:23.760] I thought I did this back in 99. I had a suspended license with the judge agreed and found me not
[52:23.760 --> 52:29.680] guilty. So this is kind of like a double jeopardy type of thing here. Well, no, it's a different
[52:29.680 --> 52:41.120] event. It's a different event. It cannot stem, it cannot be the same charge from the same action.
[52:41.120 --> 52:47.280] It has to be a separate action. Otherwise, any person found not guilty of murder could go out
[52:47.280 --> 52:53.040] and murder forever and nobody could touch him, right? Okay, well, I'm thinking on this level,
[52:53.040 --> 53:01.600] it's the same license. But it's a different fact pattern. The facts are not identical,
[53:01.600 --> 53:06.640] the parties are not identical. Okay, but it's still, we're still talking about
[53:06.640 --> 53:15.520] Well, actually, I take that back. If I take that back. If the theory of double jeopardy is,

[54:41.120 --> 54:49.040] I was supposed to go, I got a letter in the mail, like you mentioned, about this summons that I
[54:49.040 --> 54:54.480] was going to go there in March. Didn't receive nothing or sign up that anybody request or wanted
[54:54.480 --> 55:00.880] it moved to another date. I just received the summons that is going to be there in March.
[55:01.600 --> 55:06.400] Right. That's another thing they do is they ask for continuances and reschedulings,
[55:06.400 --> 55:12.080] and they never serve you in these types of cases. They just do it and then say,
[55:12.080 --> 55:14.560] hey, we changed everything. We're just letting you know now.

[55:34.320 --> 55:40.000] and then they tried to issue a warrant because you didn't appear, and you were relying on a
[55:40.000 --> 55:45.600] different timeframe based upon prior information, and they did this without giving you any notice.
[55:46.720 --> 55:50.720] Now you would have suffered a harm if you came back and got arrested on a warrant they issued.

[56:20.240 --> 56:24.960] improper notice would have flown. After the fact, right?
[56:24.960 --> 56:30.560] Yeah. It's always after the fact. You can't claim a harm before there's one, can you?

[56:38.000 --> 56:42.800] should not be able to challenge something before particular types of harm are inflicted,
[56:43.920 --> 56:48.720] because when it comes to our public servants and our constitutionally protected rights to demand
[56:48.720 --> 56:54.720] that our public servants obey the Constitution and respect our rights, we should not have to
[56:54.720 --> 57:01.920] wait for an injury to enforce that. If they enact a statute or a law or anything else that would even
[57:02.720 --> 57:08.720] give a hint of violating that, we the people should have the power to march right up there
[57:08.720 --> 57:13.840] and sue and say, oh, no, you don't. That ain't going to happen without us doing something about it.
[57:15.520 --> 57:22.400] But instead, somebody has to take the risk of going to jail or suffering a fine or whatever
[57:22.400 --> 57:27.920] other punitive action is attached to it in order to have standing to fight something that we put

[01:03:46.160 --> 01:03:51.680] Mississippi State University for having a rifle. I was in some apartments across the streets,
[01:03:51.680 --> 01:03:59.040] and I went to court, fired my attorney, represented myself, was able to hang the jury the first time
[01:03:59.040 --> 01:04:03.760] because no one ever brought the land title or the lease to the apartments to the court.
[01:04:04.960 --> 01:04:10.800] I had my second trial and the DA told the jury that I could have killed all their students
[01:04:10.800 --> 01:04:17.200] with a sniper rifle, so they convicted me. And I did a year in the penitentiary, got out,
[01:04:17.200 --> 01:04:23.920] got out, and then won my appeal. And the court granted me or remanded my trial back to the
[01:04:23.920 --> 01:04:29.200] circuit court. And so that's where I'm at now. The circuit court has been
[01:04:29.200 --> 01:04:36.080] postponing my trial for about the last nine months. So where I'm at now is I'm going to
[01:04:36.080 --> 01:04:44.000] go into my motions hearing tomorrow morning at the courthouse. However, here in Mississippi,
[01:04:44.000 --> 01:04:51.120] courts don't run full time because of the very small population. They'll open up shop for two
[01:04:51.120 --> 01:04:56.240] weeks, and then they'll pack up and leave and move on to the next county. So the courthouse will be...
[01:04:56.240 --> 01:05:01.360] Yeah, Mississippi courts are kind of like a traveling carnival in more ways than one.
[01:05:02.720 --> 01:05:06.960] The courthouse will be closed down. You can always walk in and talk to the clerk,
[01:05:06.960 --> 01:05:13.600] but all the courtrooms and stuff are shut. They have my motions hearing scheduled tomorrow
[01:05:13.600 --> 01:05:16.560] while the court is closed. We don't even have term here.
[01:05:17.600 --> 01:05:24.640] And so I'm not sure what's going to happen. I don't want somebody to be hiding in there
[01:05:24.640 --> 01:05:30.240] and then arrest me for having marijuana on me or something, but I've never actually encountered that.
[01:05:31.120 --> 01:05:36.720] Well, I would recommend having someone go with you, several someones if possible,
[01:05:36.720 --> 01:05:46.000] and everybody be recording something. Okay. Okay. Well, we'll try to do that.
[01:05:46.000 --> 01:05:50.880] I mean, how did they schedule you for court when there's no court?
[01:05:53.040 --> 01:05:57.920] Well, first of all, they sent me a continuance, and this has been months ago, and it just has
[01:05:57.920 --> 01:06:03.280] the date and time. And I actually showed up to the court today and the clerk said,
[01:06:03.280 --> 01:06:07.120] oh, we're closed for the next two weeks. We don't even start term for two weeks.
[01:06:07.120 --> 01:06:10.320] And I said the same thing. How are we going to have this?
[01:06:10.320 --> 01:06:13.520] And she said, oh, the judge is going to come in and have a day for motions,
[01:06:14.480 --> 01:06:18.480] which means he's going to come in, bring a court reporter in, the district attorney is going to
[01:06:18.480 --> 01:06:22.480] come in, bailiffs are going to come in. All just to hear me and a couple of other people
[01:06:22.480 --> 01:06:28.960] have motions doesn't make sense. Well, maybe not. But if they actually do it,
[01:06:28.960 --> 01:06:35.040] that's a good thing, right? Okay. So I may show up in the courts closed.
[01:06:35.040 --> 01:06:42.160] And if they try to continue it, it makes sense that they would come out and then try to continue
[01:06:42.160 --> 01:06:45.520] it. And I think they're just trying to continue this thing till the end of the world.
[01:06:46.720 --> 01:06:51.360] That could be true. They have you in the system. They don't like letting go once that happens.
[01:06:51.360 --> 01:07:00.400] Yes. And when I got out of jail, I went straight to the apartment or to the courthouse
[01:07:00.400 --> 01:07:04.480] and got the land title for the apartments. And it turns out that the apartments were private
[01:07:04.480 --> 01:07:08.240] property because they're across the street. They're actually not on the campus.
[01:07:08.960 --> 01:07:13.840] Right. Which we argued about the first time around that most likely they weren't.
[01:07:15.600 --> 01:07:18.640] Yes. So I'm going to walk in and show the jury the land title.
[01:07:18.640 --> 01:07:23.200] And chances are the DA is not going to do too well in court. So it's probably better
[01:07:23.200 --> 01:07:31.120] for them if they just keep postponing my trial. Okay. But here's the thing. You have a valid
[01:07:31.120 --> 01:07:38.640] complaint against the prosecuting attorney for secreting exculpatory evidence. The prosecuting
[01:07:38.640 --> 01:07:46.400] attorney knew that the law required that that property be owned by the university for the
[01:07:46.400 --> 01:07:55.040] charge to stick. He never brought that out at trial. Did he? He just kept arguing. Ladies
[01:07:55.040 --> 01:08:00.400] and gentlemen, we all know the campus owns the property. Exactly. And he knew better.
[01:08:01.040 --> 01:08:12.400] He lied in open court. That's prosecutorial misconduct. Good. Okay. Now if I do have my
[01:08:12.400 --> 01:08:18.720] hearing tomorrow, here's a tactic that they use all of the time that still kind of stumps me.
[01:08:18.720 --> 01:08:25.920] And that is when I'm trying to talk, they'll interrupt. And a lot of times the DA will start
[01:08:25.920 --> 01:08:30.960] going off on some kind of tangent that he has absolutely no idea what he's talking about.
[01:08:31.520 --> 01:08:35.200] So why don't you just ask the court, if it please the court, could you tell these people
[01:08:35.200 --> 01:08:38.800] to just sit down and shut up unless they have an actual real objection?
[01:08:38.800 --> 01:08:44.800] Great. Okay. You can ask the court to do that. Put a muzzle on the dog over here.
[01:08:45.920 --> 01:08:50.720] Okay, good. Now let me ask you one other question about your original trial and the information
[01:08:50.720 --> 01:08:58.240] relating to who owned the property. Did he put anyone on the stand and ask them who owned the
[01:08:58.240 --> 01:09:06.960] property? Yes. Then that's suborning perjury right there. That is suborning perjury.
[01:09:06.960 --> 01:09:14.960] That is one of the worst offenses a prosecutor can commit. Okay. Is there any chance that they
[01:09:14.960 --> 01:09:21.680] could tangle out of it like we all know that? All you need to do to prove it, irrefutably,
[01:09:22.240 --> 01:09:27.360] is to show that they have possession or should have had possession of the land title.
[01:09:28.880 --> 01:09:34.080] Okay. If you can show that the DA actually knew the land title was not the university's
[01:09:34.080 --> 01:09:39.200] name and put someone on the stand to testify that it was, that's suborning perjury.

[01:09:52.240 --> 01:09:57.280] and told everybody that I was a sniper and I could have murdered people and stuff.

[01:10:28.000 --> 01:10:34.320] kids at the Dairy Queen on Sunday? Throw it right back in his face.

[01:10:39.840 --> 01:10:45.120] then he better be willing to tell you that he's also fabricating this entire sniper business about

[01:11:02.400 --> 01:11:12.000] by doing that, but you've got to call him on it. He is doing open character assassination in court

[01:11:30.240 --> 01:11:36.720] prejudicial to the defense, so unless he's willing to confess to being a child molester

[01:12:40.480 --> 01:12:47.680] an interrogatory stating whether or not they knew of the existence of the land title.

[01:12:56.160 --> 01:13:01.040] yeah, or a request for admissions. It can be called either or in some cases,

[01:13:48.640 --> 01:13:53.520] the bus and everybody that worked with him to make it happen. And I think that's why they're
[01:13:53.520 --> 01:13:58.240] continuing the case until Oh, absolutely. They're doing whatever they can to protect
[01:13:58.240 --> 01:14:01.040] their part of the system. Okay.

[01:24:59.620 --> 01:25:06.100] like 100 people, there'll be eight to 10 people on really loud bullhorns walking around the crowd,

[01:25:12.260 --> 01:25:17.460] happened. It was a really big misunderstanding. And you know what? Everyone involved could have
[01:25:17.460 --> 01:25:22.980] handled it a little better, I think. But there's a lot of misinformation and disinformation put out
[01:25:22.980 --> 01:25:28.980] there that really demonized this most excellent talk show host. And I don't want to say any more

[01:27:49.940 --> 01:27:55.780] accountable. The police chief is not directly accountable to us, because he's appointed by city
