[05:17.680 --> 05:24.840] Turns out that Obama, as dumb and ignorant as he actually is, can't seem to escape being
[05:24.840 --> 05:32.760] surrounded by those that demonstrate that they're equally as dumb or ignorant.
[05:32.760 --> 05:39.200] Eric Holder, as we all know, the facilitator of Fast and Furious, whether he cares to admit
[05:39.200 --> 05:45.720] it in public or not, and who is willing to lie under oath about when he knew what, just
[05:45.720 --> 05:48.240] like his boss is.
[05:48.240 --> 05:55.800] Turns out that he lied about when he knew because emails that have been gotten through
[05:55.800 --> 06:03.520] public information requests and such have revealed that Valerie Jarrett was sending him communications
[06:03.520 --> 06:12.920] regarding Fast and Furious at least 10 months prior to when he says he actually knew anything.
[06:12.920 --> 06:20.280] Folks, I'm going to say something real, real short and simple here about political parties,
[06:20.280 --> 06:24.200] Democrats, Republicans, and so on and so forth.
[06:24.200 --> 06:30.560] And if you live in America this long and do not understand this concept, then you're already
[06:30.560 --> 06:33.760] beyond hope and it doesn't matter.
[06:33.760 --> 06:37.800] And the country is going to slide right over the same cliff you have mentally if that's

[06:44.400 --> 06:51.960] Fighting over your political party, Democrat or Republican is no different than fighting

[07:01.240 --> 07:07.080] fighting does over which ones which makes you look stupid.

[07:11.280 --> 07:18.160] stupid because fighting over them shows that you remain completely ignorant of the fact
[07:18.160 --> 07:23.760] that they are two heads on the same snake.
[07:23.760 --> 07:33.320] How has that concept managed to escape Americans for so long and why do those that have actually
[07:33.320 --> 07:41.160] noticed choose to ignore it as if it isn't true?
[07:41.160 --> 07:47.160] You want to talk about cognitive dissonance when you know for a fact the information you
[07:47.160 --> 07:54.920] are relying on is dead wrong and you still insist that it is the truth.
[07:54.920 --> 08:00.360] And that is Obama in a nutshell.
[08:00.360 --> 08:06.600] It took him months to get off of harping that it was that so-called Muslim bashing video
[08:06.600 --> 08:13.240] that made fun of Mohamed that started the mess in Benghazi, no it wasn't, but had nothing
[08:13.240 --> 08:19.040] to do with it, absolutely nothing to do with it.
[08:19.040 --> 08:25.400] I'll tell you part of what did America's foreign policy of interfering in other country's
[08:25.400 --> 08:32.360] business, stealing other country's resources at the barrel of a gun, putting in our dictators
[08:32.360 --> 08:42.120] and our puppets into their country to control their people and make them pawns of the U.S.
[08:42.120 --> 08:49.600] Yeah those things, they might have had something to do with it, but it sure as hell was not
[08:49.600 --> 08:59.640] some video made by some guy in Russia making fun of Mohamed.
[08:59.640 --> 09:10.400] Why would they attack Benghazi over something the U.S. didn't even do?
[09:10.400 --> 09:17.280] A Russian guy made the film that the U.S. was hyping was the cause of all this and it was
[09:17.280 --> 09:24.320] only released in Russia and it was only released on the Internet.
[09:24.320 --> 09:28.600] We didn't have anything to do with it, so why would that motivate them to attack our consulate
[09:28.600 --> 09:32.840] in Benghazi, why?
[09:32.840 --> 09:45.280] It wouldn't, it's just another political smoke green from the two headed snake party, okay?
[09:45.280 --> 09:50.760] And notice I didn't say the two parties, I said the two headed snake party, every one
[09:50.760 --> 09:57.280] of them crawls around on their belly, snatching up anything they can find and stealing the
[09:57.280 --> 10:06.040] warmth to survive from everything they can because every one of them just as cold-blooded
[10:06.040 --> 10:15.280] as they can possibly be and I am not making any known exceptions to any of the existing
[10:15.280 --> 10:20.360] members of this body.
[10:20.360 --> 10:22.040] Why?
[10:22.040 --> 10:27.040] Because like anyone else what they will do in public and what they will do behind closed
[10:27.040 --> 10:35.400] doors to the public is never the same, never the same.
[10:35.400 --> 10:45.600] For instance, everybody adores Ted Cruz and I'm not saying Ted Cruz is as bad as most
[10:45.600 --> 10:51.640] of them but let's look at one very simple fact that even Ted Cruz can't and won't argue
[10:51.640 --> 10:52.880] against.
[10:52.880 --> 10:59.600] When Obama refuses to enforce a law that he doesn't believe in, he's not doing it because
[10:59.600 --> 11:07.800] he believes the law is unconstitutional and therefore should be ignored and unenforced.
[11:07.800 --> 11:13.320] He's doing it because that's his political choice to do things his own way regardless
[11:13.320 --> 11:18.000] of what the Constitution says.
[11:18.000 --> 11:26.000] Whereas Ted Cruz made the argument that no one gets to pick and choose what laws they
[11:26.000 --> 11:33.240] enforce if and when those laws have been enacted by the proper legislative body.
[11:33.240 --> 11:40.160] Ted, I disagree wholeheartedly.
[11:40.160 --> 11:50.240] No person anywhere including and especially the other departments of government should
[11:50.240 --> 12:01.080] or must enforce a law that they feel is unconstitutional, period.
[12:01.080 --> 12:10.920] A sheriff or any other law enforcement or peace officer individual should not be required
[12:10.920 --> 12:19.720] to harm someone under a bad law to wait for the ones that created the bad law to choose
[12:19.720 --> 12:30.040] to fix it because our system of government is supposed to be adversarial.
[12:30.040 --> 12:35.520] It's not supposed to be cooperative against the people.
[12:35.520 --> 12:42.200] So I completely disagree with Ted's theory on this even though I completely agree when
[12:42.200 --> 12:49.120] it comes to the way Obama's doing things because he's not doing anything related to
[12:49.120 --> 12:51.560] a constitutional question.
[12:51.560 --> 12:57.680] He's doing it to pad the voter pool for people that will keep his head of the snake at the
[12:57.680 --> 13:00.680] forefront of the snake.

[13:07.920 --> 13:15.960] So if you're still falling for any of this, lower your dosage on your meds or up the

[16:08.400 --> 16:13.760] If they said that you defaulted and now owe them, that's a civil process because you can't

[16:16.040 --> 16:22.240] They cannot convict you in absentee in a criminal case unless you were present when the trial
[16:22.240 --> 16:24.880] started and then disappeared.

[16:25.880 --> 16:33.520] So, for all I know, I mean, nobody gave me any temptations for all I know, I should've
[16:33.520 --> 16:39.880] blew off the wound or whatever, but yeah, you can always argue that you never received

[21:51.560 --> 21:58.120] And almost always one of those ways is by mail, by U.S. Postal Service.

[22:00.120 --> 22:03.080] Not after the fact.
[22:03.080 --> 22:04.960] Well, of course, it's after the fact.
[22:04.960 --> 22:07.480] They can't send it to you before the fact.
[22:07.480 --> 22:12.120] I mean, I got this notice like three months later.

[22:13.120 --> 22:18.640] They're trying to claim a default, but the problem is they can't prove they ever served
[22:18.640 --> 22:20.440] you in the first place.
[22:20.440 --> 22:23.400] Therefore, you're challenging it.
[22:23.400 --> 22:29.360] And one of the points that you can use to challenge it is no proper service.
[22:29.360 --> 22:31.800] Service has to have three contingencies.
[22:31.800 --> 22:35.760] It must be proper, sufficient, and timely.
[22:35.760 --> 22:42.000] Proper means it must be done in the manner required by law, if any.
[22:42.000 --> 22:47.000] Sufficient means it gives you enough information to properly inform you of the issue at hand
[22:47.000 --> 22:51.760] and the actions that need to be taken by you.
[22:51.760 --> 22:58.200] Timely means it has to be, you have to be given notice in enough time to perform the
[22:58.200 --> 22:59.880] actions required.
[22:59.880 --> 23:00.880] Right.
[23:00.880 --> 23:07.680] So, if what you have does not meet those three requirements, it's not proper notice.
[23:07.680 --> 23:08.680] Okay.

[23:09.680 --> 23:11.480] That's the first question.
[23:11.480 --> 23:20.000] They kind of tied into the second question where I went to Honolulu to get my, what is
[23:20.000 --> 23:23.440] that, bill of sale for my automobile.

[23:26.160 --> 23:34.000] The bill of sale, now, it is my thought that, it took an act of Congress, by the way, to
[23:34.000 --> 23:40.280] get that, but I finally got it and I got to go back to put the affidavit in and stuff
[23:40.280 --> 23:41.280] to the DMV.
[23:41.280 --> 23:48.280] But at the DMV, is there going to be a record of the citations on their record?
[23:48.280 --> 23:49.560] I have no idea.
[23:49.560 --> 23:53.320] It depends on how it's reported.
[23:53.320 --> 23:55.240] You'd have to see how that works in Hawaii.

[47:36.160 --> 47:44.160] look at where they've placed the military bases over in Afghanistan and Kuwait and Iraq
[47:44.160 --> 47:49.160] and Iran and all the other places over there where they're trying to arrange or have already
[47:49.160 --> 47:56.160] been and set up that line of military bases that goes from the northern side of the countries
[47:56.160 --> 48:03.160] all the way down to the seacoast, they parallel that huge pipeline they've been trying to
[48:03.160 --> 48:04.160] build.
[48:04.160 --> 48:10.160] We're not there to get rid of regimes that are hostile to the U.S.
[48:10.160 --> 48:17.160] We're there to steal natural resources and to put in military protection of those resources
[48:17.160 --> 48:20.160] via that pipeline.

[51:37.160 --> 51:45.160] I have a little inside knowledge on that area, and I think that I'll let you comment on this.
[51:45.160 --> 51:58.160] But if these so-called municipalities are sending letters through the mail, if somebody out there is willing enough to go through the process, it probably doesn't take that much.
[51:58.160 --> 52:05.160] But if these guys are abusing their mailing privileges, they can be revoked.
[52:05.160 --> 52:07.160] And if you notice on all these...
[52:07.160 --> 52:10.160] They're not abusing them. They're not even using them in some cases.
[52:10.160 --> 52:16.160] And if they are using them, they're using them non-certified, which means they can't prove delivery.
[52:16.160 --> 52:17.160] Right.
[52:17.160 --> 52:26.160] But what they're doing is they're sending these letters through the mail, and it has a little square, pre-printed envelope up there in the corner.
[52:26.160 --> 52:36.160] It says permit number. And if they're going to claim that they sent a notice through the mail using that permit number, I believe that they are getting very close.
[52:36.160 --> 52:47.160] If not, they've already done it, is they're abusing that privilege to obtain that permit number, and that privilege can be revoked.
[52:47.160 --> 52:57.160] And now they're going to have to start using stamps on the mail, or they're going to have to start using the red meter dates that they put on it.
[52:57.160 --> 53:08.160] But what we're doing, essentially what I'm getting to is holding their feet to the fire by pulling their permits, because they are abusing them.
[53:08.160 --> 53:10.160] All right.
[53:10.160 --> 53:15.160] If you gather, if you know what I'm getting at.
[53:15.160 --> 53:18.160] I know what you're getting at.
[53:18.160 --> 53:26.160] Yeah, because they're, they applied to get those permits to use that, but they're abusing that privilege.
[53:26.160 --> 53:30.160] So like any other privilege, it can be revoked.
[53:30.160 --> 53:43.160] Well, the thing about it is, if you look at the rules by which they are supposed to play, and the manner in which they are supposed to do these processes that they do as far as summonses and things of that nature,
[53:43.160 --> 53:48.160] what they are literally doing is committing mail fraud.
[53:48.160 --> 53:55.160] Texas law requires, there are only three ways for a person to be validly brought before a court.
[53:55.160 --> 53:59.160] Sapina summons warrant.
[53:59.160 --> 54:01.160] That's it.
[54:01.160 --> 54:10.160] Anything else, they, it's just a form letter, and that's what they send out in these cases, 99% of the time is a form letter.
[54:10.160 --> 54:15.160] It's not a proper Sapina, it's not a proper summons, it's not a proper warrant.
[54:15.160 --> 54:29.160] And if you compare it to what the law says those things must have and what format they must be in and the things that they must contain and how they must contain it, they don't comply.
[54:29.160 --> 54:41.160] The moment they put that in the mail to someone, these form letters, and that form letter is asserted as pretending to have the legal authority of one of these three things when in fact it has none,
[54:41.160 --> 54:57.160] in order to get an individual to comply with the alleged authority that this non-instrument is purporting to convey, they commit a mail fraud.
[54:57.160 --> 55:14.160] So it's just one of those things where the problem with not knowing the rules of the game is that you will be taken advantage of by those who do.
[55:14.160 --> 55:27.160] Still there Rob? Yes, I'm here Eddie. I will get back, I'm going to start delving into that aspect very soon because of what they're doing with the mail fraud aspect.
[55:27.160 --> 55:36.160] Okay. Because they are using, they are sending out all these red light camera citations, even debt collectors, everybody, there are no stamps.
[55:36.160 --> 55:46.160] There's no meter date on the outside of that envelope proving when they even mailed it. So I suggest everybody if they get a letter like that,
[55:46.160 --> 55:55.160] hang on to it and use it as, keep it as your evidence because there's no proof when they ever mailed that envelope.
[55:55.160 --> 56:07.160] Well the win is not necessarily the problem either. It can also simply be they have no proof that the person to whom it was addressed ever received it.
[56:07.160 --> 56:20.160] Exactly. I was about to get into that but thank you Eddie. Yeah, exactly. They have no proof of when they mailed it or when you received it.

[56:44.160 --> 56:51.160] A lot of people just throw away the outside envelope. No, the outside of that envelope is your evidence just as well as the stuff.

[56:56.160 --> 57:04.160] Right. And if they want to put a post-it note or some other note to say about the time they received it, stuff like that,

[57:11.160 --> 57:22.160] But I wanted to bring that up because that is crucial to a lot of things that are going on because there's a lot of these agencies that can't even get their feet off the ground.

[01:07:29.160 --> 01:07:44.160] All right. That being said, while we are waiting on others to call in, I am going to attempt to go through a little bit of what we talked about in the class this Sunday as far as what this states.
[01:07:44.160 --> 01:07:54.160] Now, if you've ever listened to this show more than once, you're very aware of the fact that the first thing I tell you to do when you're looking at the statute is follow the rabbit trails.
[01:07:54.160 --> 01:08:02.160] The rabbit trails is the terms and phrases used to define the language of the statute itself.
[01:08:02.160 --> 01:08:21.160] Whenever there's a term or phrase in there that makes reference to anything, you need to make sure that you fully understand it by seeing if that particular term or phrase contains a definition somewhere in that code that's relative or relates to that section you're in.
[01:08:21.160 --> 01:08:41.160] Now, remember that definitions have scope. And by scope, when you read a code, the code will say something like, in this title or in this chapter or in this section, the following terms and phrases are defined as.
[01:08:41.160 --> 01:08:54.160] And then that is the scope. Once the definition is created under that scope, that definition only applies within that scope and nowhere else.
[01:08:54.160 --> 01:09:11.160] So this is one of my issues with the courts creating a doctrine that's not written into the actual statute anywhere. And that is using definitions from the penal laws in every other place where a definition doesn't exist for a particular term or phrase.
[01:09:11.160 --> 01:09:26.160] The reason I find one of these pet peas is exactly what I was talking about this weekend in relation to the definition of person in the transportation code as it relates to subtitle C.
[01:09:26.160 --> 01:09:35.160] Now there you're going to find that the term person is defined as an individual, corporation, association, limited liability company, blah, blah, blah.
[01:09:35.160 --> 01:09:48.160] Now, if you are familiar with statutory interpretation, you are familiar with how the term includes operates when it's used in law.
[01:09:48.160 --> 01:10:00.160] The term includes whether they want to call it something else being expansive or not is in fact limiting in nature.
[01:10:00.160 --> 01:10:11.160] When you use the term includes only the things that are listed are included within that group with a slight caveat.
[01:10:11.160 --> 01:10:21.160] The things listed are part of a type or class that the term includes has created.
[01:10:21.160 --> 01:10:43.160] Now if you have the jurisdictionary package from Dr. Greys, he discusses exactly that. His example is if you use the word includes and you define the term fruit in this way, fruit includes lemons, limes, grapefruits, and oranges.
[01:10:43.160 --> 01:11:00.160] What type or class does that definition establish so that the legislature can actually say that the term includes in this usage is not limiting but is expansive in nature?
[01:11:00.160 --> 01:11:06.160] What do all of these four things I just say actually have in common?
[01:11:06.160 --> 01:11:16.160] Limes, limes, grapefruits, oranges. What do they all have in common? They're all citrus fruits.
[01:11:16.160 --> 01:11:30.160] Therefore, the list, the type or class is limited to citrus fruits are the things that can be included in the definition of fruit.
[01:11:30.160 --> 01:11:43.160] You cannot put a banana in there. You cannot put a watermelon in there. They are not citrus. The type or class created was citrus because that is the common denominator between what was listed.
[01:11:43.160 --> 01:12:02.160] Well, when you take the term person in use in the transportation code and you define it as individual, corporation, limited liability company, or any other legal entity, what type or class does that definition actually create?
[01:12:02.160 --> 01:12:23.160] What must all of these things have in common? They're all fictional legal entities. They have to be including the term individual because if it's not, then this legislature has now directly violated the rules of statutory interpretation.
[01:12:23.160 --> 01:12:33.160] They've invited, they've completely kicked right in the teeth how the term includes is always defined to be used in law.
[01:12:33.160 --> 01:12:44.160] They violated the rule of a Justum Generus and they even violated the rule of the inclusion of one thing as exclusion of all others.
[01:12:44.160 --> 01:13:04.160] And the Justum Generus is like things. That's the type or class, like things. So they have violated all three of those rules if they're trying to say that the term individual there is somehow completely different than the legal entity things that are listed after it.
[01:13:04.160 --> 01:13:07.160] Or is it?
[01:13:07.160 --> 01:13:16.160] This goes to the thing that I've come up with and I argue regularly about what is a legal capacity. Okay.
[01:13:16.160 --> 01:13:39.160] A legal capacity is some position or title created by law and law alone. It does not exist in nature that a person must assume the duties, powers, authority, responsibility, and liability of in order to act with the authority and power of that capacity.
[01:13:39.160 --> 01:13:52.160] For instance, police officer, that is a legal capacity. Mayor, that is a legal capacity. Okay.
[01:13:52.160 --> 01:13:56.160] Councilman, that is a legal capacity.
[01:13:56.160 --> 01:14:08.160] Now, why does that relate to the term individual? Because the way the courts are going to use the term individual in relation to the transportation code is the definition found in the penal code.
[01:14:08.160 --> 01:14:21.160] And the definition of the penal code says that person or individual means a person who was a being or person, I forget which word it uses, who was born and is alive.
[01:14:21.160 --> 01:14:39.160] Okay. Well, those legal capacities that I just told you about the police officer, the mayor, the councilman, what do all of those have in common in relation to a person who was born and is alive?
[01:14:39.160 --> 01:14:55.160] The answer is none of those legal capacities can act with any power and authority until an individual assumes the role associated with them. Period.
[01:14:55.160 --> 01:15:00.160] The police uniform does not go out and enforce the statute. The badge doesn't do it.
[01:15:00.160 --> 01:15:23.160] The living man or woman that dons the costume in the badge is the one that does it. So until an individual steps into that capacity to act on behalf of those other legal entities in that list, that capacity has no power.
[01:15:23.160 --> 01:15:48.160] So when you see that definition of person means individual, corporation or association or limited liability company, the only correct way that you can do that and not violate the rules of statutory construction and interpretation is to argue that individual in that case is a living being acting on the behalf of one of these other things.
[01:15:48.160 --> 01:16:15.160] That is the only way that individual becomes similar, a Justum Generous, like kind, to the fictional things listed because individual means one of in that case and it means one of the legal capacities that has to be empowered by one of these other things.
[01:16:15.160 --> 01:16:38.160] You see how convoluted they make this, but this actually works in our favor because we can prove that individual does not separate itself and stand apart from the necessity of legal entities engaging in commercial activity on our roads.
[01:16:38.160 --> 01:16:53.160] That, folks, is something we need to come to understand, how they use their legalese and their word tricks to make you think, A, when all the time they're talking B.

[01:20:28.160 --> 01:20:41.160] Anyway, there was a paragraph and you had corrected me through email saying that you should probably word it like this. And I'm scared that I still have a missing verb in this sentence here.
[01:20:41.160 --> 01:20:53.160] For the listener's value, it's the City of Dallas municipal ordinance that is the alleged violation or infraction or whatever.
[01:20:53.160 --> 01:21:12.160] Anyway, I demand that the City of Dallas show a home rule municipality's legislative authority to implement an ordinance that appears to be an attempt by City of Dallas to, do I say, legislate there, rule make, overrule the legislature?
[01:21:12.160 --> 01:21:18.160] To legislate in an area belonging to the legislature.
[01:21:18.160 --> 01:21:23.160] I can use the word legislating and that's okay, I'm not stipulating.
[01:21:23.160 --> 01:21:34.160] Well, you can say falsely legislate in an area exclusively under the jurisdiction of the state legislature.
[01:21:34.160 --> 01:21:51.160] Okay, and that's pretty much roughly what we got, but yeah, I was missing that one verb, but I thought on that sentence. But okay, so assuming that they swallow this letter and, you know, I speak to the mayor of Dallas and we've seen the police chief of Dallas,
[01:21:51.160 --> 01:22:04.160] but everyone's unnoticed here, and assuming that they now know that this is a criminal violation in the state of Texas, at least those says the legislature, not a civil infraction like they're trying to implement here.
[01:22:04.160 --> 01:22:12.160] We're basically saying take us to criminal court and notify me appropriately within the rules of notification.
[01:22:12.160 --> 01:22:27.160] Well, know what we're saying is if you're going to charge me, charge me under the state law like you're supposed to. And then they have a problem because under the state law, under the criminal, they have to prove you were behind the wheel.
[01:22:27.160 --> 01:22:31.160] That's where they're going to run into a problem.
[01:22:31.160 --> 01:22:35.160] That's why they don't want it under the state law.
[01:22:35.160 --> 01:22:52.160] So as long as we challenge them and say, you know, the legislature's already said this is a misdemeanor, being a criminal matter, flipping over the burden of proof to, you know, from civil to criminal beyond the reasonable doubt that they have to prove that she's behind the wheel.
[01:22:52.160 --> 01:22:55.160] Is there any case law that you can point to?
[01:22:55.160 --> 01:23:12.160] There's tons of case law that says they cannot do any legislation in an area that belongs to the state, nor can they change the offense from one type to another or the punishment from one type to another if the state's already said it.
[01:23:12.160 --> 01:23:17.160] Now, would that be like in the local government code or is that a...
[01:23:17.160 --> 01:23:20.160] Case law.
[01:23:20.160 --> 01:23:22.160] Case law.
[01:23:22.160 --> 01:23:27.160] As in the courts have ruled, that's not in the statutes.

[01:23:33.160 --> 01:23:50.160] Well, Texas, being one of them, legislate state subject or municipality, legislate state subject, prohibited, forbidden, things like that.

[01:24:30.160 --> 01:24:39.160] Now, while we're waiting, let's go back to the discussion of the includes and including and everything we talked about in the class on this subject.
[01:24:39.160 --> 01:24:48.160] If you want to argue that the term person doesn't apply to you, that's the way you would do it in that particular subtitle C.
[01:24:48.160 --> 01:24:55.160] But there are many, many issues with the transportation code in general.
[01:24:55.160 --> 01:25:15.160] First and foremost, if you go back and you get the actual enactment that was created by the legislature and passed into law, and you go to the very bottom of the bill, you will find the emergency clause that was used to enact it.
[01:25:15.160 --> 01:25:30.160] Now, Article 3, Sections 29 through 39 has a very specific set of requirements on how laws are to be created by the legislature for the people of Texas.
[01:25:30.160 --> 01:25:43.160] And it does not create any exception to those rules until much, much later down under Article 3 when you get all the way down to Section 62.
[01:25:43.160 --> 01:25:58.160] The only other exception to how they can enact a law during a particular timeframe of the year while they're in session deals with bills for funds, okay?
[01:25:58.160 --> 01:26:18.160] They can raise money using bills that they can pass under a public necessity emergency, but everything else according to Section 62 of Article 3 says that in order for them to pass anything other than an appropriations bill under an emergency clause,
[01:26:18.160 --> 01:26:32.160] the emergency has to be one that is established by the parameters of 62. And 62 says that emergency exists as a result of disasters relating to enemy invasion or attack.
[01:26:32.160 --> 01:26:57.160] Doesn't say public necessity, it says that the rules that are in Article 3, Section 29 through 39 can only be suspended by an emergency declaration if the emergency is the result of disasters that are related to enemy invasion or attack, period.
[01:26:57.160 --> 01:27:13.160] Now, y'all heard me talk about this before for sure. Then they did an amendment to the Sections 29 through 39 where they put a four-fifths vote suspension into one of the rule or sections there.
[01:27:13.160 --> 01:27:22.160] The legislature can suspend this rule with a four-fifths vote in each house to suspend the rule of reading on the floor of each house over three several days.
[01:27:22.160 --> 01:27:31.160] Well, the problem is that if it was taken at face value, creates an immediate contradiction to Section 62.
[01:27:31.160 --> 01:27:42.160] They cannot amend multiple parts of the Texas Constitution by simply adding a change to one part of the Texas Constitution.
[01:27:42.160 --> 01:27:56.160] If they want to change another part to match up with the one they just created, they have to amend them all if they deal with that thing. That didn't happen.
[01:27:56.160 --> 01:28:10.160] So again, using the rules of statutory interpretation that the courts themselves and constitutional construction that the courts themselves have put into place for such predicaments, let's look at how that has to work.
[01:28:10.160 --> 01:28:32.160] Prior to the change to that section on the four-fifths majority vote, there was no designation for what the vote had to be in order for the emergency clause to be passed that exists in Section 62.
[01:28:32.160 --> 01:28:39.160] In other words, it was simply majority vote. That's all they could go by because nothing else said what it had to be.
[01:28:39.160 --> 01:29:01.160] However, the four-fifths suspension rule that they came up with cannot remove the requirement of the emergency clause required by Section 62 and thus nullify it because that's amending multiple parts of the Constitution with a single change in one section and they can't do that.
[01:29:01.160 --> 01:29:10.160] So there's only two ways that we can interpret that four-fifths majority vote to suspend the rule on reading on the floor of each house over three several days.
[01:29:10.160 --> 01:29:34.160] And that is that, A, the four-fifths vote only applies to the appropriations bills passed under the other emergency clause of public necessity or in order to suspend it in either case, there has to be a four-fifths majority vote of each house.
[01:29:34.160 --> 01:29:55.160] So which one was it? No one's challenged it, no one's questioned it, no one's brought the Texas Constitution up and started in their face to say, how can you enact a transportation code without reading it on the floor over three several days as required by the Texas Constitution using an illegal unconstitutional emergency clause?

[01:34:11.160 --> 01:34:24.160] And it's for anybody who's revoked, even if you did not revoke your signatures, but if you have revoked your signatures with the IRS, they can look at this little quick two-page instruction manual I put together.
[01:34:24.160 --> 01:34:37.160] And I can't do it any justice on here on the call. They would have to just read it. If you want Eddie, you can, and if anybody's interested, if they want to email you and you can send it out, I would appreciate it very much.

[01:34:42.160 --> 01:34:49.160] For the IRS, all their withholding certificates and all their documents. I mean, all their forms.

[01:34:55.160 --> 01:34:57.160] At some point in time, I may have.
[01:34:57.160 --> 01:35:04.160] Okay, then how do you go back and rescind the signature after the fact, after that tax year is coming down?
[01:35:04.160 --> 01:35:10.160] Well, it's rescinded based on the constructive fraud that's been committed.

[01:35:11.160 --> 01:35:12.160] Yeah, IRS.
[01:35:12.160 --> 01:35:19.160] What is the end result of removing the signatures? What does that accomplish for you?
[01:35:19.160 --> 01:35:36.160] It accomplishes a lot because once one revokes their signature for the fraud that it is and this package is sent into the IRS, as long as they follow the instructions on these two pages that I sent out, they will be able to stay out of the internal revenue code.
[01:35:36.160 --> 01:35:44.160] Because what I did is I've completely removed myself from the internal revenue code. I'm no longer subject to it.
[01:35:44.160 --> 01:35:59.160] Well, Rob, I would argue that there's a much simpler way to do that. And the fact is, is it's not gaining you anything that I can think of, legally speaking, to revoke signature on documents that they've already processed.
[01:35:59.160 --> 01:36:13.160] The thing about it is, is once you understand what the tax is and who is liable for it versus who isn't, beating them up with their own rules once again has always been the way that I've talked about doing this.
[01:36:13.160 --> 01:36:23.160] And let's talk very quickly here about this. What's the definition of wages in the internal revenue code?
[01:36:23.160 --> 01:36:25.160] I don't have that in front of me.
[01:36:25.160 --> 01:36:36.160] The definition of wages, and I'm paraphrasing here, but basically it is the payment of remuneration to an employee by an employer.
[01:36:36.160 --> 01:36:53.160] Okay? When you go look up employee and you look at what's in that list included in that definition, the type or class created by what's there are all government employees, federal and state.
[01:36:53.160 --> 01:37:09.160] That's an employee. An employer by definition is any federal or state government agency. Once again, the type or class created by the definition using includes.
[01:37:09.160 --> 01:37:20.160] If the IRS is going to call you a taxpayer, it must first prove that you earned wages as an employee while working for an employer.
[01:37:20.160 --> 01:37:24.160] Right?
[01:37:24.160 --> 01:37:35.160] I will cut right to the chase, Eddie. The IRS, all they care about is whether or not you are a taxpayer or whether you're not a taxpayer. It's all about your status.
[01:37:35.160 --> 01:37:45.160] I agree. But in this case, taxpayer cannot exist unless, A, you earned wages, correct?
[01:37:45.160 --> 01:37:52.160] Even a taxpayer doesn't have to pay until he earns wages, right?
[01:37:52.160 --> 01:38:08.160] If you want to go down there, I don't go that far. It goes like this, Eddie. The IRS goes on a presumption and that presumption starts with the signing of the W-4 withholding allowances.
[01:38:08.160 --> 01:38:18.160] The signing of all their IRS documents is what gives the IRS, and here's the key word, the presumption of taxpayer status.

[01:38:24.160 --> 01:38:44.160] Well, that could be a two. It all boils down to one thing, the status. Either you are a taxpayer or you're not a taxpayer. Once a man or a woman revokes their signatures for the fraud that it is, the presumption of taxpayer status is completely obliterated and I have the documents proving it.
[01:38:44.160 --> 01:38:58.160] I have been through this for the past four or five years, trial and error, and I found out the best way to handle all these letters and how to get yourself out of the system and stay out of their system completely without them touching you.
[01:38:58.160 --> 01:39:20.160] I have first-hand knowledge of this and I put it together in this two-page little IRS response instruction manual and it's phenomenal because I went into the master file and I saw how they handled certain letters that I sent them and I saw the best way to handle it with one of the years that I did it.
[01:39:20.160 --> 01:39:30.160] And it works like a charm because once you revoke your signature, you're out of the code and you have to stay out of the code because the code no longer applies to you.
[01:39:30.160 --> 01:39:41.160] And just like you said on this call, Eddie, you never argue the merits. You never argue the IRS code because once you do, you're arguing the merits and you're saying that the code now applies to me.
[01:39:41.160 --> 01:39:55.160] So the only thing that the IRS has to go on from day one is the signing of that W-4 form. Without that, they have nothing to go on. So you destroy their evidence, their presumption, and they're out of the ballpark.
[01:39:55.160 --> 01:40:05.160] Well, I would argue that the statement that I'm making on what these words mean isn't merits. We're challenging exactly what you're talking about.
[01:40:05.160 --> 01:40:16.160] The status is established by the definitions applied. If the definitions don't apply to you, neither does the rest of the code. It's that simple.
[01:40:16.160 --> 01:40:30.160] If you can't show that I earned wages as an employee working for an employer, you cannot show I'm a taxpayer. If you can't show those things, you cannot show the code applies and I am liable.
[01:40:30.160 --> 01:40:44.160] There are no merits because we're not arguing over money. We're arguing over my status as one of these definitions, these legal capacities you're trying to shove me into and I don't want to be.
[01:40:44.160 --> 01:40:54.160] With the IRS, it boils down to either you're a taxpayer or you're not, but they don't want to get into the definition of a taxpayer because once they do it, it exposes their fraud.
[01:40:54.160 --> 01:40:59.160] Right. And I understand that, but you should know by now that's exactly what I'm in this for.

[01:41:28.160 --> 01:41:43.160] And that's the only ones that have the known legal duty and that is section 1441, which is the nonresident alien, 1442, which is the foreign corporation, and 1443, which is the foreign organization.
[01:41:43.160 --> 01:41:48.160] If you're not any one of those three, they can't withhold and you can hold the so-called employer accountable.

[01:47:12.160 --> 01:47:27.160] Well, that depends upon... That's true in a criminal case. In one of these administrative civil cases, there's no such thing as guilt or innocence. There is only breach of duty under contract.

[01:47:30.160 --> 01:47:45.160] Well, that means that they are under the supposition that you have an obligation to them for which they can say you owe them money when they assert you didn't comply with the obligation.
[01:47:45.160 --> 01:47:52.160] So, how do you get out of this mess? Because, you know, the only thing I can see is these people are just spilling from the people.
[01:47:52.160 --> 01:48:14.160] Well, you are correct there, but the how is a little bit more difficult than the why. The how is to educate enough people on how they're being stolen from, and the fact that they don't have the right to oppress their fellow people by allowing such laws to exist.

[01:49:27.160 --> 01:49:36.160] Understanding the rules of the games they play and how to use those rules to blacken their eye for a change is the other part of fixing it.

[01:49:40.160 --> 01:49:58.160] And that's what I've tried to do very hard here in Texas is to learn all of the procedural codes and the rules and regulations for the particular activities that I've chosen to combat directly and teach others what they are, how they apply, and specifically how they don't.

[01:50:01.160 --> 01:50:09.160] So, yeah, I can understand if you got a red light camera ticket, then there's a couple of ways to handle it.
[01:50:09.160 --> 01:50:13.160] One is to address it with a red light camera template that I have.
[01:50:13.160 --> 01:50:19.160] But if you use it, you've acknowledged receipt of their notice.
[01:50:19.160 --> 01:50:25.160] So you cannot claim lack of notice as a defense later for anything they pull.
[01:50:25.160 --> 01:50:40.160] Whereas if you ignore it and they declare they got a default judgment, you can always force them to bring that decision back under the statement of, I never got proper notice from you.
[01:50:40.160 --> 01:50:49.160] Prove you ever served me to tell me that this was something I had to respond to, which they, of course, cannot and will not do.
[01:50:49.160 --> 01:50:53.160] Now, folks listening to this, pay close attention.
[01:50:53.160 --> 01:50:57.160] Statute of limitations.
[01:50:57.160 --> 01:51:07.160] If you do not answer these citation notices they send out to you, they declare a default judgment against you.
[01:51:07.160 --> 01:51:18.160] And yet you do not have to re-up anything within the next two years, which most misdemeanors are their statute of limitations anywhere from a year to one year.
[01:51:18.160 --> 01:51:28.160] If they're criminal, or I'm sorry, a year to two years, if they're criminal, and possibly even less than that when they're civil and administrative.
[01:51:28.160 --> 01:51:33.160] So you need to find out what the statute of limitations are on civil things in Maryland.
[01:51:33.160 --> 01:51:36.160] But that being said, understand this.
[01:51:36.160 --> 01:51:46.160] If you don't have to interact with them for the statute of limitations period in question, and then you go in to say renew your license or your registration,
[01:51:46.160 --> 01:51:52.160] and find out that they've blocked it because of this, you challenge them on it directly.
[01:51:52.160 --> 01:51:58.160] Objection, you've deprived me of a privilege or a right or whatever by fraud.
[01:51:58.160 --> 01:52:00.160] You never gave me notice of this.
[01:52:00.160 --> 01:52:02.160] Prove you gave me notice of this.
[01:52:02.160 --> 01:52:12.160] You can challenge it, have it reopened, and now they have to drop it if they're going to press it because they're outside their statute of limitations to correct it.
[01:52:12.160 --> 01:52:19.160] So there's lots of different ways to go after them if you understand all the ways they're required to play the game.

[01:52:21.160 --> 01:52:24.160] So I have to start with my state statutes.

[01:52:25.160 --> 01:52:30.160] You've got to learn everything you can about the red-light camera statutes in Maryland.

[01:52:37.160 --> 01:52:42.160] All of that will tell you where you have to go next.
[01:52:42.160 --> 01:52:48.160] Civil and administrative, they have to abide by certain rules under the rules of civil procedure when they don't,
[01:52:48.160 --> 01:52:53.160] and one of those is always proper, sufficient, and timely notice.
