[05:31.960 --> 05:36.040]  I've got a friend of mine up in Connecticut, his name is Jason.
[05:36.040 --> 05:41.960]  He was going to call in and let us know about a recent police encounter that he had.
[05:41.960 --> 05:46.280]  So I'm going to go ahead and bring him on the air before and get his information out
[05:46.280 --> 05:49.840]  here before we continue on with my little information here.

[05:57.840 --> 06:06.080]  Last Wednesday night I was traveling in my personal conveyance on Interstate 84 in Connecticut
[06:06.080 --> 06:13.160]  and I was pulled over by a man in blue and came up to my window.
[06:13.160 --> 06:17.880]  Well, actually, when he was parked behind me, I pulled my visor down and turned on my digital
[06:17.880 --> 06:25.400]  recorder and then I also turned on the digital recorder on my phone.
[06:25.400 --> 06:29.680]  And he came up to my passenger side window and he said, I'm charging such and such from
[06:29.680 --> 06:34.920]  Connecticut State Police, Troop K. And I need your license to the registration and I said
[06:34.920 --> 06:40.480]  I am not engaged in any commercial use of the highways nor am I operating in any for
[06:40.480 --> 06:41.480]  higher capacity.
[06:41.480 --> 06:44.840]  Please acknowledge that you've been so informed.
[06:44.840 --> 06:48.760]  And because my left window is also open, he said, I can't hear you.
[06:48.760 --> 06:55.480]  I repeated it a second time that I can't hear you and I repeated it a third time very politely
[06:55.480 --> 06:59.120]  and he said he can't hear me if he asked me if I'd roll up my left window which I did
[06:59.120 --> 07:00.120]  and then I repeat it.
[07:00.120 --> 07:03.960]  I said, this conversation is being recorded and I repeated what I just said.

[07:10.160 --> 07:16.000]  And he started to just mumble and talked about, you know, Connecticut, the law and so forth
[07:16.000 --> 07:20.880]  and talked about, you know, just mentioned that I'm from Texas and so forth and I repeated
[07:20.880 --> 07:25.480]  myself again and he said, I need you to see your identification.
[07:25.480 --> 07:29.240]  I said, what form of identification do you require, he said, I have his license and then
[07:29.240 --> 07:34.120]  I said it is nothing short of fraud and he said, sit tight, stay in your vehicle.
[07:34.120 --> 07:38.800]  And he went back to his vehicle and about five minutes later I hear over the broad,
[07:38.800 --> 07:44.000]  over the speaker says, sure, you're free to go, you may engage in your free commerce
[07:44.000 --> 07:47.000]  and I waved to him and I drove off.
[07:47.000 --> 07:51.600]  Well, sounds like something worked.
[07:51.600 --> 07:52.600]  Yeah.
[07:52.600 --> 07:57.640]  Well, yeah, that's useful information.
[07:57.640 --> 08:02.720]  So you see folks, the stuff that I'm trying to get you to understand about what transportation
[08:02.720 --> 08:07.720]  is and what it isn't, some of these guys know and those that don't and actually bother to
[08:07.720 --> 08:10.760]  check on it sometimes actually get told.
[08:10.760 --> 08:14.680]  Of course, now there's always going to be those in charge and those that work for them
[08:14.680 --> 08:16.960]  that don't care what the law says.
[08:16.960 --> 08:20.160]  I mean, I just read an article today.
[08:20.160 --> 08:26.440]  There was a police chief in some town, I forget where, but he said, I don't care what the
[08:26.440 --> 08:31.800]  law is if they're carrying a concealed weapon, they're going to jail.
[08:31.800 --> 08:35.520]  Now, oh, I'm sorry, it was in Houston.
[08:35.520 --> 08:41.800]  The police chief in Houston who said that, that I don't care what the law is, speaking
[08:41.800 --> 08:46.760]  of the concealed carry license here in Texas, he says, I don't care what the law is if they're
[08:46.760 --> 08:48.920]  carrying concealed, they're going to jail.
[08:48.920 --> 08:53.280]  Now this is a police chief that says outright, I don't care what the law is, I'm going to
[08:53.280 --> 08:59.680]  do what I want the way I think it ought to be and the rest of you are just going to have
[08:59.680 --> 09:04.040]  to submit to it and when my officers do the same thing, you're going to have to submit
[09:04.040 --> 09:09.240]  to that because we will kill you if you don't.
[09:09.240 --> 09:14.480]  These are the kind of officers that need to be sued until the city decides they're too
[09:14.480 --> 09:17.800]  expensive to keep on the payroll because the cops aren't going to have to pay out of their
[09:17.800 --> 09:22.640]  own pocket, though they should, they won't.
[09:22.640 --> 09:26.520]  So we need to start making sure that we go back after them when they do this kind of
[09:26.520 --> 09:27.520]  stuff.
[09:27.520 --> 09:29.560]  Jason, I appreciate you calling in and letting us all know about that.
[09:29.560 --> 09:34.000]  You said, I believe you told me this was the second time this had worked for you.
[09:34.000 --> 09:35.000]  Right.
[09:35.000 --> 09:39.960]  The first time was about a year ago and I was pulled over and I basically, I initiated the
[09:39.960 --> 09:40.960]  same conversation.
[09:40.960 --> 09:44.560]  I said, I'm not engaged in any commercial use of the roads or the highways or the byways
[09:44.560 --> 09:47.640]  and I'm not operating in any more higher capacity.
[09:47.640 --> 09:51.360]  Please acknowledge that you've been so informed and the officer said, I have been so informed.
[09:51.360 --> 09:57.640]  So he was talking to me and so I was trying to educate him about what the law really is
[09:57.640 --> 09:59.480]  and how it's all about terminology.
[09:59.480 --> 10:03.880]  So he called for his backup or something and he came up to me.
[10:03.880 --> 10:08.360]  Anyway, I was talking to them and he said, I can't disagree with anything you're saying.
[10:08.360 --> 10:14.880]  So then the conversation really turned into both keepers and how these police officers
[10:14.880 --> 10:21.000]  don't follow the law and they're not trained what the law really is.
[10:21.000 --> 10:28.920]  They were really impressed and open minded and I told them about you and so twice in
[10:28.920 --> 10:33.440]  a row now it's worked and I've avoided getting a ticket and it's so stupid because I didn't
[10:33.440 --> 10:37.840]  really tell whatever speed and in this case I was going uphill this time I was telling
[10:37.840 --> 10:41.120]  you about this case that just happened to me on Wednesday and I was going uphill and
[10:41.120 --> 10:47.000]  I was in the slow lane just cruising uphill and I wasn't even really focusing on my speed
[10:47.000 --> 10:52.320]  and if I do speed it's only in short little bursts but they don't care they catch anyway.
[10:52.320 --> 10:57.160]  But yeah, twice now he's basically they've backed off and let me go.
[10:57.160 --> 11:02.720]  So yeah, it's nice when they actually understand that there's something's not the way they
[11:02.720 --> 11:07.880]  think it is or hopefully the information you gave them was enough to pique their interest
[11:07.880 --> 11:10.400]  to go and look for themselves.
[11:10.400 --> 11:14.480]  That wouldn't that be a wonderful thing if the cops actually bothered to check on what
[11:14.480 --> 11:17.280]  they're told to verify it before they turn around.
[11:17.280 --> 11:24.800]  I mean, you got Acevedo here in Austin saying he wants to vet everybody that owns a gun.
[11:24.800 --> 11:29.640]  The police need to vet them to see whether or not they should be owning a gun, blah,
[11:29.640 --> 11:31.360]  blah, blah.
[11:31.360 --> 11:36.800]  So you would think that by now knowing that they're paid to lie about most of the things
[11:36.800 --> 11:43.120]  they say or do and they're trained to lie in every case where they do something wrong
[11:43.120 --> 11:49.000]  and the chief of police has to know this because he's responsible for that training that they
[11:49.000 --> 11:56.480]  would vet anything another cop told them or a training instructor told them but they don't.
[11:56.480 --> 11:59.880]  But they're perfectly willing to vet your right to keep and bear arms even though they
[11:59.880 --> 12:03.880]  have no power and authority to do any such thing.
[12:03.880 --> 12:06.480]  So I'm glad they were at least willing to listen.
[12:06.480 --> 12:12.800]  That reminds me very much of the officer in Rockdale here in Texas that quit right after
[12:12.800 --> 12:14.200]  he and I had an encounter.
[12:14.200 --> 12:18.080]  He got out of law enforcement and went to work doing something else.

[12:19.080 --> 12:20.080]  But.

[13:48.520 --> 13:55.000]  I do my best to keep you informed from a solid, verifiable source of information.

[13:57.720 --> 14:04.560]  I try not to draw more than one level of inference from any given fact, because that's all the
[14:04.560 --> 14:08.240]  law will allow as evidence in a courtroom.

[14:15.360 --> 14:20.160]  And that's what we need to be doing, verifying this stuff, researching this stuff and checking
[14:20.160 --> 14:23.920]  it out for ourselves and stop believing what we're told.
[14:23.920 --> 14:27.680]  Most of these officers do exactly that and that's a problem.
[14:27.680 --> 14:31.440]  But now before I start taking these other calls, let me go ahead and give out the information
[14:31.440 --> 14:35.120]  that I was going to start with tonight.
[14:35.120 --> 14:41.040]  Somebody asked the question about how municipal judges get paid and whether or not they're
[14:41.040 --> 14:48.320]  paid from the fines or some percentage of fines collected on the traffic citations.
[14:48.320 --> 14:51.720]  In Texas at least, the answer to that is none of the above.
[14:51.720 --> 14:57.200]  They're not paid directly from the money collected in the traffic citations or the fines and
[14:57.200 --> 14:58.200]  fees.
[14:58.200 --> 15:05.920]  And the reason for that is, is because that would definitely create an appearance of partiality
[15:05.920 --> 15:08.600]  as to the money.
[15:08.600 --> 15:15.080]  However, once you've learned to follow the money through the system the way it goes,
[15:15.080 --> 15:23.680]  a different picture is drawn that shows that is irrelevant, okay, and here's why.
[15:23.680 --> 15:29.760]  In Texas by statute, any money collected for a transportation offense may only be used
[15:29.760 --> 15:37.960]  by the locality that's collecting it, whether it be state, county, or city, for road, bridge,
[15:37.960 --> 15:41.560]  and drainage projects for the roads and bridges.
[15:41.560 --> 15:45.840]  That's what by law the money can be allocated to.
[15:45.840 --> 15:55.280]  However, let's say a city like Austin steals $32 million.
[15:55.280 --> 16:04.760]  Now they stole a total of $64 million, but the state gets 50% of the actual fine, okay.
[16:04.760 --> 16:11.680]  The city gets, or the county, whoever else wrote the ticket gets to keep the other 50%.
[16:11.680 --> 16:17.880]  Now like I said, in 2010 the city of Austin wrote over 304,000 citations that collected
[16:17.880 --> 16:23.520]  over $64 million total on those citations.
[16:23.520 --> 16:32.080]  Now Austin in 2010 had like 1,200 cops, so do the math.
[16:32.080 --> 16:43.520]  It's an awful lot of tickets per cop for a single year, 304,000 plus with 1,200 cops approximately.
[16:43.520 --> 16:46.520]  That's a large number of tickets, but I'll go into that a little bit more when we get
[16:46.520 --> 16:47.520]  back.

[19:51.000 --> 19:55.760]  or not these judges and prosecutors get paid directly from this money.

[19:57.200 --> 20:03.000]  In order to grant the mere presence, the appearance of propriety, the judges and city attorneys
[20:03.000 --> 20:07.600]  are usually salvaged from the city general employment funds by whatever name that might
[20:07.600 --> 20:09.760]  actually be in the bookkeeping department.
[20:09.760 --> 20:14.760]  However, you should all be aware that as a matter of law, the city county, whomever

[20:31.440 --> 20:36.120]  The state statutes require that all monies collected from traffic citations be allocated
[20:36.120 --> 20:39.200]  for road and bridge funds and nothing else.
[20:39.200 --> 20:43.280]  So at first glance, it would appear that the city has no vested financial interest in the
[20:43.280 --> 20:46.160]  outcome of the cases pending in its courts.
[20:46.160 --> 20:51.640]  However, that is precisely what it is, the illusion that there is no such benefit that
[20:51.640 --> 20:55.760]  could result in the wreaking stint of impropriety and fraud.
[20:55.760 --> 21:00.640]  Where this process financially benefits the city and those operating its municipal courts
[21:00.640 --> 21:06.520]  is that they use those courts to generate excess funds that do not have to be allocated
[21:06.520 --> 21:12.320]  to those types of projects from its other scarcer revenue sources.
[21:12.320 --> 21:17.560]  Therefore it directly financially benefits the city as the employer of the judge, the
[21:17.560 --> 21:24.520]  police officer and city attorney acting as prosecutor for those agencies to work cooperatively
[21:24.520 --> 21:31.200]  to both accuse and find as many people guilty as possible, providing the perfect setting
[21:31.200 --> 21:35.720]  for justice and proper application of the law to be damned.
[21:35.720 --> 21:39.920]  This in turn directly financially benefits the judge, the police officer and the city
[21:39.920 --> 21:45.320]  attorney as they are the chief generators of this alternative revenue stream, thus keeping
[21:45.320 --> 21:50.720]  themselves employed and well paid by ensuring that the stream never runs dry and a profit
[21:50.720 --> 21:54.200]  is generated from the related fines and fees.
[21:54.200 --> 21:56.360]  Consider this.
[21:56.360 --> 22:02.080]  There is no real need for ticket quotas as the police are already motivated to hand out
[22:02.080 --> 22:06.040]  as many tickets as possible as often as possible.
[22:06.040 --> 22:07.520]  Why?
[22:07.520 --> 22:09.220]  Paid overtime.
[22:09.220 --> 22:15.160]  The officer will almost always be pulling extra hours every month to come sit in court
[22:15.160 --> 22:17.320]  and testify.
[22:17.320 --> 22:20.640]  These officers draw time and a half for this.
[22:20.640 --> 22:26.680]  In other words, they stand to have their monthly wage earnings increased by 30 to 50%, meeting
[22:26.680 --> 22:34.480]  their yearly income will also be increased by that same 30 to 50% overall.
[22:34.480 --> 22:40.280]  And even more of an increase is possible if the officer spends all of his or her time
[22:40.280 --> 22:43.800]  handing out as many tickets as they can.
[22:43.800 --> 22:49.960]  Imagine every cop with a citation book at their disposal has the means to instantly
[22:49.960 --> 22:56.720]  give themselves a pay raise at any time of the year by simply writing enough citations
[22:56.720 --> 23:03.600]  to guarantee that they will draw increased overtime pay by making court appearances.
[23:03.600 --> 23:09.160]  If anything, modern police departments would likely set quotas on how many citations its
[23:09.160 --> 23:14.440]  officers could write so they can't go over a certain percentage of overtime hours so
[23:14.440 --> 23:19.720]  as to keep this personal financial windfall scheme hidden from public view for as long
[23:19.720 --> 23:21.720]  as possible.
[23:21.720 --> 23:26.680]  This is yet another list of reasons to abolish this system of theft through illegal and
[23:26.680 --> 23:33.960]  constitutionally subversive extort of taxation, which is precisely what this really is.
[23:33.960 --> 23:39.680]  It is not about public safety or as an economic deterrent, why would it be?
[23:39.680 --> 23:45.760]  If it worked as such and everyone stopped committing the offenses, these municipalities
[23:45.760 --> 23:50.480]  and counties would go broke with the way they waste money, in which case they would have
[23:50.480 --> 23:55.440]  to find yet another collection of things to get the state to criminalize and turn into
[23:55.440 --> 23:58.440]  an alternative revenue source.
[23:58.440 --> 24:05.120]  However, the big problem for them in Texas at least is Title II of the Texas Code of
[24:05.120 --> 24:06.960]  Criminal Procedure.
[24:06.960 --> 24:16.000]  Our criminal procedure requires that an itemized, i.e. every single charge for fine or fee must
[24:16.000 --> 24:22.800]  be submitted in writing to the accused and it must be signed by the officer authorizing
[24:22.800 --> 24:26.280]  the bill or that is to receive the payment of it.
[24:26.280 --> 24:32.040]  And this is written in the Code of Criminal Procedure Article 103.001, which is under
[24:32.040 --> 24:33.440]  Title II.
[24:33.440 --> 24:39.520]  Furthermore, that officer may not impose a cost for any service that was not actually
[24:39.520 --> 24:45.520]  performed or for which a cost is not expressly authorized by law.
[24:45.520 --> 24:54.400]  This is written into Article 1.0302, or I'm sorry, 103.002 of the Code of Criminal Procedure.
[24:54.400 --> 24:59.600]  You will also notice that the authority to collect is expressly granted to specific
[24:59.600 --> 25:07.800]  officials, offices, or agencies, pursuant Code of Criminal Procedure Article 103.003,
[25:07.800 --> 25:10.160]  titled Collection.
[25:10.160 --> 25:16.640]  Nowhere is a municipal court, municipal judge, municipal clerk, or any other municipal entity
[25:16.640 --> 25:25.440]  or agent designated within that article as one authorized to collect those fines and fees.
[25:25.440 --> 25:30.080]  It might be worth your time, folks, to read and verify this information, but it's written
[25:30.080 --> 25:32.200]  right there into the statute.
[25:32.200 --> 25:37.320]  These are the things they're required to do and these are the things they never do.
[25:37.320 --> 25:39.640]  They never do.
[25:39.640 --> 25:43.080]  Imagine that.
[25:43.080 --> 25:48.880]  And if they're never doing these things to collect the money they're stealing, then what

[26:11.040 --> 26:17.960]  rights, your right to a fair and impartial due process, and to separate you from your
[26:17.960 --> 26:23.760]  money in the most expedient manner possible.

[34:26.720 --> 34:37.120]  to a city for a video, audio, I should say, an AV recording of a certain arrest that took
[34:37.120 --> 34:38.120]  place.
[34:38.120 --> 34:48.120]  And long story short, they did not make any attempt to answer that request until approximately
[34:48.120 --> 34:51.120]  October.
[34:51.120 --> 34:58.600]  And this is after numerous re-requests and going down and personally visiting the city
[34:58.600 --> 35:02.360]  secretary asking for the information.
[35:02.360 --> 35:10.800]  Then I did receive a DVD, however, the DVD did not work, could not access it.
[35:10.800 --> 35:20.120]  So I addressed that, made the city end up issuing a thumb drive, and on the thumb drive
[35:20.120 --> 35:28.080]  it only showed, this was in late November, and on the thumb drive it only showed a portion
[35:28.080 --> 35:33.880]  of the arrest and had no audio recording whatsoever.
[35:33.880 --> 35:40.120]  So during this period between August and November, I contacted the attorney general
[35:40.120 --> 35:44.640]  and made two complaints against the city.
[35:44.640 --> 35:52.720]  The attorney general sent a toothless letter to the city telling him that they need to
[35:52.720 --> 35:54.880]  provide me with the audio.
[35:54.880 --> 36:03.560]  Then I sent a letter of complaint to the AG town that I wanted the city to be prosecuted
[36:03.560 --> 36:11.880]  civilly for failure to abide by the statute, you know, not for non-compliance of answering
[36:11.880 --> 36:12.880]  the PIIAR.
[36:12.880 --> 36:20.280]  And then today I get a notice from the city and they state that there is no audio, we
[36:20.280 --> 36:25.640]  consider the case closed, basically go away and leave this alone.
[36:25.640 --> 36:31.160]  So I would like to, so I've got two issues here, I've got the city being non-compliant,
[36:31.160 --> 36:38.120]  they still have not given me a proper reply to the PIIAR after four months.
[36:38.120 --> 36:46.720]  And then the attorney general has basically turned a blind eye and is ignoring the violation
[36:46.720 --> 36:48.920]  statute.
[36:48.920 --> 36:57.880]  And I'm upset and I want to know to who may I turn now to try and get some type of remedy.
[36:57.880 --> 37:06.480]  The only place you can go next is to a higher court for a writ of mandamus.
[37:06.480 --> 37:12.320]  And that mandamus has to request that the court direct the agency in question to provide
[37:12.320 --> 37:13.320]  it.
[37:13.320 --> 37:16.880]  However, here's what the court's going to wind up telling you in relation to this.
[37:16.880 --> 37:21.920]  I can't order the city to do, to produce something it doesn't have.
[37:21.920 --> 37:28.520]  If the city is claiming it doesn't have audio, then the question becomes why doesn't it have
[37:28.520 --> 37:29.520]  audio?
[37:29.520 --> 37:32.960]  Do your other police cruiser videos have audio?
[37:32.960 --> 37:39.240]  Why is this one without audio and et cetera, et cetera, et cetera?
[37:39.240 --> 37:47.600]  So the problem is when they decide to withhold or secret evidence, they can get away with
[37:47.600 --> 37:53.640]  it because there's no way to prove they're lying short of getting access to the records
[37:53.640 --> 37:57.040]  without them being able to control the access to the records.
[37:57.040 --> 38:01.880]  Okay, this leads me to a question.
[38:01.880 --> 38:15.640]  If the, there's a court date of parents tomorrow and if the video is requested from the prosecutor
[38:15.640 --> 38:23.720]  and there is audio evidence, which contradicts the official notice from the city that there
[38:23.720 --> 38:27.120]  isn't, then what?
[38:27.120 --> 38:32.720]  You need to read 552.321 of the government code.
[38:32.720 --> 38:36.320]  That deals with the writ of mandamus and filing suit.
[38:36.320 --> 38:41.280]  Whether or not you can actually recover any damages for that failure to do that, that's
[38:41.280 --> 38:51.000]  one thing, but if that evidence was being requested by the defense and they're denying
[38:51.000 --> 38:57.840]  it up until the day of trial, that's going to fall directly on the head of the prosecutor
[38:57.840 --> 39:04.640]  and that's exactly how the issue needs to be raised in court on the record.
[39:04.640 --> 39:09.080]  That the prosecutor was in possession of this evidence, the evidence was requested by the
[39:09.080 --> 39:14.120]  defense on numerous occasions, both from the prosecutor and from the source, was the discovery
[39:14.120 --> 39:16.040]  motion ever filed for it?
[39:16.040 --> 39:18.600]  No, it's the first appearance.
[39:18.600 --> 39:19.920]  There's never been anything.
[39:19.920 --> 39:21.600]  Then file discovery.
[39:21.600 --> 39:30.800]  File, make sure you get discovery put in for this appearance or at the very least to be
[39:30.800 --> 39:35.320]  heard at the first motion hearing.

[39:39.440 --> 39:44.600]  And make sure that the motion for discovery is directed not only at the agency, but at
[39:44.600 --> 39:51.360]  the prosecution itself, directly to the prosecutor's office for production of the evidence.

[43:00.920 --> 43:08.120]  And I asked the Attorney General in writing, I said, if the city were to provide me documentation
[43:08.120 --> 43:15.840]  that was issued with disappearing ink so that my pages that I received were blank, would

[43:20.040 --> 43:30.640]  And I must have angered some legal fight attorney at the AG because that's when they shut me

[47:37.040 --> 47:40.040]  A few of them said that some people tried to do this,
[47:40.040 --> 47:42.040]  and they went up putting them in a mental institution
[47:42.040 --> 47:45.040]  and all kinds of horror stories about what happened
[47:45.040 --> 47:50.040]  to these certain individuals that tried to exercise their right of travel.
[47:50.040 --> 47:52.040]  So we discussed that.
[47:52.040 --> 47:54.040]  I said, well, that's why you just listened to the show.
[47:54.040 --> 47:56.040]  Obviously they did something wrong.
[47:56.040 --> 47:59.040]  They tried, but the person tried to do is try to teach them
[47:59.040 --> 48:04.040]  or try to tell them that they're not, you know, engaging in commerce
[48:04.040 --> 48:07.040]  and try to prove to them that they weren't.
[48:07.040 --> 48:11.040]  But the idea is, as you've talked about many times,
[48:11.040 --> 48:16.040]  is to have them prove to you that you're engaging in commerce.
[48:16.040 --> 48:19.040]  And then they can't prove it.
[48:19.040 --> 48:20.040]  And where does it end up?
[48:20.040 --> 48:23.040]  The ones that have dismissed the case most of the time.
[48:23.040 --> 48:26.040]  It's very encouraging to know the first caller
[48:26.040 --> 48:28.040]  so that that's quite encouraging.
[48:28.040 --> 48:32.040]  That's great news to hear that some of the officers are starting to get it.
[48:32.040 --> 48:35.040]  And you're having an effect, I think,
[48:35.040 --> 48:38.040]  of course, and a lot of other folks are having an effect
[48:38.040 --> 48:43.040]  on a lot of these law enforcement officers to become peace officers
[48:43.040 --> 48:47.040]  and adhere to the true law, the true rule of law.
[48:47.040 --> 48:49.040]  Well, that would be nice.
[48:49.040 --> 48:52.040]  Don't expect me to be holding my breath, though.
[48:52.040 --> 48:55.040]  No, not exactly not.
[48:55.040 --> 48:56.040]  But yeah, they liked it.
[48:56.040 --> 48:58.040]  They liked the private plate.
[48:58.040 --> 49:01.040]  That was very, you know, that humor dominate.
[49:01.040 --> 49:03.040]  They thought that was pretty interesting and neat.
[49:03.040 --> 49:08.040]  You know, trust in God, not governments.
[49:08.040 --> 49:10.040]  They liked that quite a bit.
[49:10.040 --> 49:11.040]  But that's a lot.

[50:16.040 --> 50:20.040]  I don't know what your thoughts are about 9-11, your position on 9-11.

[50:53.040 --> 51:02.040]  But we saw it on TV at first that was in one of the stores there in the mall area
[51:02.040 --> 51:04.040]  where we were working.
[51:04.040 --> 51:09.040]  And then we went out and saw what was going on.
[51:09.040 --> 51:13.040]  And a little while later that's when we saw the second one hit.
[51:13.040 --> 51:20.040]  But one of the other things that we saw was the white plume of smoke from the bottom
[51:20.040 --> 51:25.040]  of the World Trade Center before the collapse began.
[51:25.040 --> 51:26.040]  Uh-huh.
[51:26.040 --> 51:31.040]  And that would not have been caused by what was going on at the top.
[51:31.040 --> 51:36.040]  But there was a big white plume of smoke that came up from the base of the buildings
[51:36.040 --> 51:39.040]  before it began to come down.
[51:39.040 --> 51:43.040]  Uh-huh.
[51:43.040 --> 51:45.040]  Bingo.
[51:45.040 --> 51:48.040]  That kind of sheets the whole thing in the foot.

[52:46.040 --> 52:52.040]  Long enough to realize the system was more messed up than I was going to be able to fix even from there.

[52:53.040 --> 52:58.040]  So within a couple of years, you knew something was not right in a big way.

[53:24.040 --> 53:34.040]  I mean, they are sinister and demonic in nature, but I can see by greedy people like this would want to carry something out like this for their purposes.

[53:36.040 --> 53:46.040]  Yeah, there's lots of things in relation to that that I've considered over the years about what was wrong with 9-11 as far as who stood to gain.

[53:49.040 --> 53:52.040]  Who stands to gain by what just happened?
[53:52.040 --> 53:57.040]  And who was trying to distract you from seeing it when it happened?
[53:57.040 --> 53:58.040]  Right.
[53:58.040 --> 54:09.040]  And that's where all of the military exercises and everything else dealing with exact scenarios no less.
[54:09.040 --> 54:10.040]  Yes.
[54:10.040 --> 54:20.040]  So there's no way to be conducting a military operation with military aircraft and you say that the government had nothing to do with it.
[54:20.040 --> 54:32.040]  There's no way to call the national command at NORAD and have them stand down aircraft and say the government had nothing to do with it.
[54:32.040 --> 54:33.040]  Right.
[54:33.040 --> 54:40.040]  And there's no way you can say that aircraft that was supposed to be covering that airspace were not covering it.
[54:40.040 --> 54:55.040]  And the ones that were directed to cover it were sent from a location hundreds of miles away rather than sending the ones that were in the immediate vicinity and say that the government was not involved.
[54:55.040 --> 54:56.040]  That's lunacy.
[54:56.040 --> 54:57.040]  Speaking.
[54:57.040 --> 54:58.040]  Yeah, absolutely.
[54:58.040 --> 55:07.040]  And as far as aircraft traveling by at the time, there are multiple witnesses saying that they saw planes going by and around.
[55:07.040 --> 55:08.040]  Yeah.
[55:08.040 --> 55:20.040]  Well, in one of the videos of the actual crashes, you can see a white plane off in the distance up in the sky, not too far from it, but far enough.
[55:20.040 --> 55:24.040]  And then there's also a helicopter that shouldn't have been there.
[55:24.040 --> 55:25.040]  Yeah.
[55:25.040 --> 55:26.040]  So.
[55:26.040 --> 55:40.040]  I don't know if it was there to record it for history from a different vantage point or if it was one of the tools used to cause it to happen.
[55:40.040 --> 55:41.040]  I don't know.
[55:41.040 --> 55:46.040]  I don't know every detail, but I have my suspicions like everyone else does.
[55:46.040 --> 55:52.040]  But one thing we can say for sure, it was not fire and it was not gravity.

[55:53.040 --> 55:54.040]  Absolutely not today.
[55:54.040 --> 55:59.040]  It doesn't make any scientific or at least not unassisted gravity.

[56:00.040 --> 56:02.040]  Doesn't make any scientific sense whatsoever.
[56:02.040 --> 56:08.040]  Now, last thing that I want to mention, and then I'll jump, let you get on to other calls and get into the second hour of your show.
[56:08.040 --> 56:19.040]  But you noticed something very peculiar that Ebola, you know, the crisis or whatever, you know, medical false flag has disappeared mysteriously.

[56:22.040 --> 56:29.040]  There's always that thing about, like I just said, who's trying to distract you and what just happened.

[56:32.040 --> 56:39.040]  I called that a few months ago as being a false flag on AJ's show and he put that up on YouTube on his channel.

[57:23.040 --> 57:29.040]  Like see right here early in the morning, like Monday through Friday here, early about eight or nine in the morning our time.
[57:29.040 --> 57:34.040]  Fighter jets flying north and south constantly for, I guess, nearly an hour.

[57:35.040 --> 57:37.040]  So there's something going on and they're hitting north.
[57:37.040 --> 57:41.040]  So north goes over, you know, the Bering Strait's over into Russia.
[57:41.040 --> 57:48.040]  So they're doing something that we don't know about yet.

[01:06:16.040 --> 01:06:21.040]  And then what are the rules of appellate procedure from a hearing of this nature in Georgia?

[01:06:23.040 --> 01:06:28.040]  Got to submit three copies of everything that is already on the record.
[01:06:28.040 --> 01:06:31.040]  So three judges can look at it.
[01:06:31.040 --> 01:06:32.040]  Yes.
[01:06:32.040 --> 01:06:39.040]  Now, they say it takes about, you know, anywhere from four to six months for them to review it and bring it back in answer.
[01:06:39.040 --> 01:06:44.040]  At a time, the TPO is pretty much going to be over with anyway.
[01:06:44.040 --> 01:06:48.040]  This order is already going to be dead and over with.
[01:06:48.040 --> 01:06:53.040]  I also have to submit a paupers affidavit.
[01:06:53.040 --> 01:06:55.040]  A habeas of paupers affidavit?
[01:06:55.040 --> 01:06:57.040]  You might want to try a habeas corpus.
[01:06:57.040 --> 01:07:04.040]  This is more or less a binding order that is limiting you and your liberty.
[01:07:04.040 --> 01:07:08.040]  A habeas corpus might actually be appropriate.

[01:07:09.040 --> 01:07:13.040]  Didn't know I could do that at the appeals level, at the appeals court.

[01:07:33.040 --> 01:07:46.040]  Now, a lot of people may argue that you can't use a habeas for this, but I'm going to argue that, look, you are under a restrictive order from a court, just like you would be if you were on a bond from a court.
[01:07:46.040 --> 01:07:54.040]  It is temporary and it's not really, it's penalizing you in ways that restrict your liberty.
[01:07:54.040 --> 01:07:58.040]  And you haven't been convicted of anything.
[01:07:58.040 --> 01:07:59.040]  That's correct.
[01:07:59.040 --> 01:08:05.040]  And that's what a habeas is used for.
[01:08:05.040 --> 01:08:06.040]  Okay.
[01:08:06.040 --> 01:08:10.040]  So I'm going to, I'm going to fill out me a habeas corpus to be a appeals court.

[01:08:30.040 --> 01:08:38.040]  So look at the state constitution and look at the statutes to see who can hear habeas proceeding.

[01:08:39.040 --> 01:08:46.040]  But it has to be some court that has the power to issue an order to this court to bring the
[01:08:46.040 --> 01:08:51.040]  evidence and information before that court to be reviewed.

[01:08:52.040 --> 01:08:59.040]  Now, according to this, and according to my rules of court, Superior Court of Georgia,
[01:08:59.040 --> 01:09:10.040]  and actually submit three things along with your appeal, you need a summary, you need
[01:09:10.040 --> 01:09:15.040]  the argument, and you need the relief, but also you need to put who has the jurisdiction.
[01:09:15.040 --> 01:09:26.040]  And under the jurisdiction here, what it says is that every appeal, every appeal that the
[01:09:26.040 --> 01:09:34.040]  Supreme Court here in Georgia don't have this, the affiliate court does, every appeal.
[01:09:34.040 --> 01:09:36.040]  Yeah.
[01:09:36.040 --> 01:09:41.040]  So, I mean, that is what I read.
[01:09:41.040 --> 01:09:47.040]  So I don't know if that's, I don't, I mean, I assume that is true since that's what it
[01:09:47.040 --> 01:09:50.040]  was, that's what it says as far as jurisdiction.
[01:09:50.040 --> 01:09:56.040]  So I'm going to put this heathest corpus together over the weekend, over this next weekend,
[01:09:56.040 --> 01:09:58.040]  and see if we can get some results.
[01:09:58.040 --> 01:10:06.040]  In the meantime, the actual pleading for the, what do you call it, the arraignment is actually
[01:10:06.040 --> 01:10:15.040]  coming up on the 15th year for everything that happened or didn't happen or whatever

[01:10:16.040 --> 01:10:21.040]  And I'm trying to figure out how do I want to attack this because, like I was telling
[01:10:21.040 --> 01:10:26.040]  you before, I was put in jail in another county, the neighboring county here, and they didn't
[01:10:26.040 --> 01:10:33.040]  take me before a magistrate until seven days later.
[01:10:33.040 --> 01:10:40.040]  And I went back through my paperwork, it actually, they actually did take me before a magistrate.
[01:10:40.040 --> 01:10:42.040]  Well, this is what happened.
[01:10:42.040 --> 01:10:47.040]  I don't know who this person was, but she gave me a bond and it's on a piece of paper
[01:10:47.040 --> 01:10:49.040]  that says from the magistrate's office.
[01:10:49.040 --> 01:10:51.040]  So that wasn't the actual magistrate.
[01:10:51.040 --> 01:10:56.040]  I didn't see the magistrate until three days after I got to the new jail, after I got to
[01:10:56.040 --> 01:11:08.040]  the actual, the actual county jail where I was supposed to be transferred to.
[01:11:08.040 --> 01:11:09.040]  Okay.
[01:11:09.040 --> 01:11:14.040]  All right, so what is your point about that?
[01:11:14.040 --> 01:11:19.040]  So my point about that is I would still like to, what I still want to do is I still want
[01:11:19.040 --> 01:11:21.040]  to file a jurisdiction issue.
[01:11:21.040 --> 01:11:25.040]  I still want to file a lawsuit with that.
[01:11:25.040 --> 01:11:31.040]  Well, if you can show where they did something that they're not allowed to do by law and

[01:20:56.040 --> 01:21:00.040]  Pretty much just yanks me up the bike, throws me to the ground, takes me to jail,
[01:21:00.040 --> 01:21:02.040]  and steals my private property.
[01:21:02.040 --> 01:21:08.040]  How would I go about, you know, making a good viable record in that situation?
[01:21:08.040 --> 01:21:11.040]  Well, how you make the record isn't going to change.
[01:21:11.040 --> 01:21:16.040]  What you need to do is learn what the law is in Indiana that says what he can and cannot do
[01:21:16.040 --> 01:21:20.040]  and how he's required to do it, just like we had to do here in Texas.
[01:21:20.040 --> 01:21:24.040]  That way, making the record is relevant to your location.
[01:21:24.040 --> 01:21:28.040]  You can say, look, you realize under the law you're required to do A, B, and C,
[01:21:28.040 --> 01:21:32.040]  and take me before magistrate immediately, not to a jail cell.
[01:21:32.040 --> 01:21:37.040]  Now you've informed him and he can't claim ignorance of his duty under the law.
[01:21:37.040 --> 01:21:43.040]  And he can't claim it anyway, but this lets him know that you know what he's supposed to do as well.
[01:21:43.040 --> 01:21:49.040]  And when he doesn't do it, you've established that it was intentional.
[01:21:49.040 --> 01:21:57.040]  So how you make the record in your particular area requires you to become familiar with the rules of the game in your area.
[01:21:57.040 --> 01:21:58.040]  Yeah, and I have been doing that.
[01:21:58.040 --> 01:22:04.040]  I've been going over our Constitution and our civil and our criminal laws as well and motor vehicle code.
[01:22:04.040 --> 01:22:07.040]  And it's pretty much similar to your guys.
[01:22:07.040 --> 01:22:14.040]  Yeah, there's almost, the statutes are going to be almost universal in what they say and what they apply to.
[01:22:14.040 --> 01:22:24.040]  There are some differences in some states that lend it more to the idea of we think we can do this to everybody and not just those in commerce.
[01:22:24.040 --> 01:22:26.040]  But the majority of them, that's not true.
[01:22:26.040 --> 01:22:41.040]  And even those states, it won't be true if you can find the link between Title 49 USC and the state code, which will generally be found either in the administrative code or some deep dark part of the motor vehicle slash transportation code.

[01:22:44.040 --> 01:22:46.040]  That is pretty good information.

[01:41:00.040 --> 01:41:03.040]  I'll just ask him what happened in the day.
[01:41:03.040 --> 01:41:07.040]  And then he'll say that he asked me to identify myself.
[01:41:07.040 --> 01:41:10.040]  And I will say what happened then.
[01:41:10.040 --> 01:41:13.040]  And he's going to say, well, I arrested you because you didn't identify yourself.
[01:41:13.040 --> 01:41:17.040]  And what statute is that, officer?
[01:41:17.040 --> 01:41:19.040]  That's as simple as that, isn't it?

[01:41:22.040 --> 01:41:26.040]  Let me make a couple of suggestions.
[01:41:26.040 --> 01:41:34.040]  Officer, you initially performed a stop on my car for what purpose?

[01:41:39.040 --> 01:41:42.040]  It was an improper wearing of seatbelt.

[01:41:43.040 --> 01:41:50.040]  Officer, was I under arrest at the time that you stopped me?
[01:41:50.040 --> 01:41:53.040]  And what is he going to say?
[01:41:53.040 --> 01:41:56.040]  He's going to say no because I asked him the same thing.
[01:41:56.040 --> 01:41:59.040]  Ah, but that's the problem, see.
[01:41:59.040 --> 01:42:03.040]  Without that video, here's what I'm betting is going to happen.
[01:42:03.040 --> 01:42:10.040]  Officer is going to say you are under arrest anytime you commit an offense and an officer acts upon it.
[01:42:10.040 --> 01:42:18.040]  I'm not required to tell you that you're under arrest, but you were in a custodial arrest according to the transportation code.
[01:42:18.040 --> 01:42:22.040]  Now, if he says that, what are you going to do then?
[01:42:22.040 --> 01:42:28.040]  I'm going to ask him why did he write the opposite in his complaint.
[01:42:28.040 --> 01:42:32.040]  Do you have a copy of the complaint?
[01:42:32.040 --> 01:42:35.040]  Personally, I think they made a mistake in setting it.
[01:42:35.040 --> 01:42:45.040]  Okay, so how are you going to prove that he's lying via that complaint?
[01:42:45.040 --> 01:42:53.040]  How are you going to get that complaint in, or his report in, in order to make that point?
[01:42:53.040 --> 01:42:58.040]  Because again, to get that paperwork in requires foundation.
[01:42:58.040 --> 01:43:04.040]  Well, I may not be doing it as well as you, but I'm kind of fairly more confident still.

[01:47:06.040 --> 01:47:18.040]  Well, he says at this time I told the driver that he was under arrest and he rolled his window up and I broke it.
[01:47:18.040 --> 01:47:19.040]  Okay.
[01:47:19.040 --> 01:47:21.040]  That's what I remember saying.
[01:47:21.040 --> 01:47:27.040]  Okay, at which time? See, that's the important thing.
[01:47:27.040 --> 01:47:40.040]  If the report says that he told you you were under arrest, but not that he had asked for your ID before he told you you were under arrest, then you have a problem.
[01:47:40.040 --> 01:47:45.040]  You don't have anything in his report that contradicts his testimony on the stand.
[01:47:45.040 --> 01:47:50.040]  The audio and video is the only thing that's going to do that.
[01:47:50.040 --> 01:47:51.040]  Right, right.
[01:47:51.040 --> 01:47:59.040]  He says that while I was in the jail that several people tried to get me to identify myself and I wouldn't do it.
[01:47:59.040 --> 01:48:00.040]  Well, that's a blatant lie.
[01:48:00.040 --> 01:48:03.040]  When I was in the jail, he put me in front of a camera.
[01:48:03.040 --> 01:48:05.040]  He says, are you going to identify yourself?
[01:48:05.040 --> 01:48:07.040]  And I said, yes.
[01:48:07.040 --> 01:48:09.040]  And then he walked off.
[01:48:09.040 --> 01:48:12.040]  He turned his back on me and walked off.
[01:48:12.040 --> 01:48:14.040]  I'm like, yeah, I will identify myself.
[01:48:14.040 --> 01:48:17.040]  I'm waiting for you to ask me, but he never asked me.
[01:48:17.040 --> 01:48:21.040]  Okay, so who witnessed this?
[01:48:21.040 --> 01:48:22.040]  The cameras.
[01:48:22.040 --> 01:48:24.040]  The only thing that witnessed this was the camera.
[01:48:24.040 --> 01:48:26.040]  I had requested the camera.
[01:48:26.040 --> 01:48:31.040]  They sent me pictures of the first 33 minutes in jail with no sound.
[01:48:31.040 --> 01:48:35.040]  And when I walked into this room with him, or I should say a hawk.
[01:48:35.040 --> 01:48:42.040]  Well, I think it's kind of odd that both the jail and the police cruiser show up with no sound.
[01:48:42.040 --> 01:48:44.040]  Extremely odd, I would say.
[01:48:44.040 --> 01:48:49.040]  I've got complaints for the Open Records Division of the Attorney General on both of them.
[01:48:49.040 --> 01:48:57.040]  And I would say, like your call earlier, Jason, the Attorney General's office is not there to help us.
[01:48:57.040 --> 01:48:59.040]  Oh, no, they're not there to help us.
[01:48:59.040 --> 01:49:01.040]  None of these offices are there to help us.
[01:49:01.040 --> 01:49:03.040]  Are you kidding?
[01:49:03.040 --> 01:49:10.040]  Okay, let's say, for instance, there's something useful and you do get the audio and video and it corroborates what you're saying.
[01:49:10.040 --> 01:49:16.040]  This is the method that I would use to get this established and prove that you were never informed that you were under arrest
[01:49:16.040 --> 01:49:19.040]  and therefore not required to submit any form of identification.
[01:49:19.040 --> 01:49:24.040]  And nothing in the law requires that you give them physical identification.
[01:49:24.040 --> 01:49:28.040]  It is very important that you get this into the record.
[01:49:28.040 --> 01:49:33.040]  Officer, you testified that you made this stop for such and such purpose.
[01:49:33.040 --> 01:49:37.040]  Is that correct?
[01:49:37.040 --> 01:49:39.040]  You're the cop, Ralph.
[01:49:39.040 --> 01:49:41.040]  Oh, yes, that's correct.
[01:49:41.040 --> 01:49:42.040]  Okay.
[01:49:42.040 --> 01:49:50.040]  And at the time of this stop, were you asked if I was under arrest?
[01:49:50.040 --> 01:49:52.040]  Yes, you did.
[01:49:52.040 --> 01:49:56.040]  And what did you tell me?
[01:49:56.040 --> 01:49:57.040]  I told you no.
[01:49:57.040 --> 01:49:58.040]  You were not under arrest.
[01:49:58.040 --> 01:50:00.040]  You were being detained.
[01:50:00.040 --> 01:50:08.040]  And did I ask you if I was being charged with, if I was being arrested for any crime?
[01:50:08.040 --> 01:50:10.040]  No, you did not ask me that.
[01:50:10.040 --> 01:50:12.040]  Okay.
[01:50:12.040 --> 01:50:18.040]  So I was not under arrest and you informed me that I was not under arrest.
[01:50:18.040 --> 01:50:24.040]  You also had not at that time informed me that I was being charged with any crime, correct?
[01:50:24.040 --> 01:50:26.040]  Correct.
[01:50:26.040 --> 01:50:31.040]  Did you follow report in relation to this encounter?
[01:50:31.040 --> 01:50:33.040]  Ah, as a matter of fact, I did.
[01:50:33.040 --> 01:50:35.040]  I filed two reports.
[01:50:35.040 --> 01:50:43.040]  And would these two documents happen to be those reports?
[01:50:43.040 --> 01:50:47.040]  Yes.
[01:50:47.040 --> 01:50:54.040]  And could you please tell the court what these two documents consisting of your reports are?
[01:50:54.040 --> 01:51:00.040]  One is a synopsis of my encounter and the other is a complaint.
[01:51:00.040 --> 01:51:06.040]  Could you please read the highlighted section there on the first page?
[01:51:06.040 --> 01:51:13.040]  And that should be the verbiage that says that you were not informed, that you were under arrest and blah, blah, blah.

[01:51:15.040 --> 01:51:28.040]  Now, officer, did you tell me that I was under arrest before or after you asked me to identify myself?

[01:51:48.040 --> 01:51:53.040]  So let me summarize here what we know to be factual so far.

[01:51:54.040 --> 01:51:56.040]  You told me I was not under arrest.
[01:51:56.040 --> 01:51:59.040]  You did not tell me I was being charged with any crime.
[01:51:59.040 --> 01:52:01.040]  You asked to see my identification.
[01:52:01.040 --> 01:52:06.040]  I refused or I declined because I wasn't being charged with anything.
[01:52:06.040 --> 01:52:08.040]  You then insisted.
[01:52:08.040 --> 01:52:09.040]  Again, I declined.
[01:52:09.040 --> 01:52:16.040]  You then said that you were going to place me under arrest for failure to ID and broke the window on my car.
[01:52:16.040 --> 01:52:20.040]  Does that cover those series of events so far?
[01:52:20.040 --> 01:52:23.040]  So far, that's accurate.
[01:52:23.040 --> 01:52:36.040]  So you in fact charged me with failure to identify even though you had specifically told me I was not yet being charged with any crime, nor was I under arrest.
[01:52:36.040 --> 01:52:39.040]  Yeah, is that a big deal?
[01:52:39.040 --> 01:52:47.040]  I would ask the court at this time to take judicial notice of the statute 38.02 Texas Penal Code Failure to Identify.
[01:52:47.040 --> 01:53:04.040]  So please the court, please notice that the language of this statute specifically states that the individual must already be under arrest for some other crime before they are required to provide a name, address, and date of birth.
[01:53:04.040 --> 01:53:13.040]  And nowhere within this statute is there a requirement that that information be provided in some manner other than verbal.
[01:53:13.040 --> 01:53:18.040]  No physical production of identification is required.
[01:53:18.040 --> 01:53:32.040]  The court would also please take notice that in the case of detention, the prohibition is that I cannot provide false information, but I am not required to provide any.
[01:53:32.040 --> 01:53:41.040]  As long as I don't lie about what I provide, I'm not required to provide any at all for a detention.
[01:53:41.040 --> 01:53:43.040]  I kind of like that.

[01:54:35.040 --> 01:54:47.040]  But if they don't provide it, then at your first initial appearance, you can state to the judge, judge, I filed a motion for discovery in this case and so far no discovery has been provided.
[01:54:47.040 --> 01:55:01.040]  I would appreciate at this time if the court would rule on my discovery motion and issue an order that the requested information is to be provided immediately or within it, within X number of days.

[01:55:05.040 --> 01:55:13.040]  The last thing is, if a person goes into a classy misdemeanor, it's not a court of records, a JP or magistrate, in my case, a JP.
[01:55:13.040 --> 01:55:22.040]  If I go in there and I lay out my case pretty good, but I lose, then I can appeal it to the next higher court.
[01:55:22.040 --> 01:55:27.040]  Now, I've already made some phone calls to the courts around here trying to find which ones are court of record and which ones are not.
