[07:11.360 --> 07:16.040]  they have a right to ask for it and a right to get it.
[07:16.040 --> 07:21.200]  And folks, that's a problem when we let them get away with thinking that instead of telling

[07:23.520 --> 07:28.080]  And how do we, the people, tell them no through our representatives?
[07:28.080 --> 07:33.000]  We have to tell our representatives, don't you vote for that?
[07:33.000 --> 07:40.400]  And if you pass such a bill, you will never see public office again if I can help it.
[07:40.400 --> 07:46.240]  And on top of that, I will make sure that the people in this community know exactly

[07:54.240 --> 07:58.400]  Even if you didn't vote them into office, you can still get in their face.
[07:58.400 --> 08:07.160]  And that's where we need to be is in our representative's faces every single day saying, you work for

[08:16.520 --> 08:23.320]  That's one of the reasons the Texas Constitution Bill of Rights needs a recall petition clause

[08:24.920 --> 08:32.720]  And that recall petition needs to be set to a very, very low percentage, okay?
[08:32.720 --> 08:35.160]  So that we can recall these people.
[08:35.160 --> 08:42.720]  Even better than that, forget recalling Institute in the Bill of Rights, a people's grand jury
[08:42.720 --> 08:48.120]  rather than the one that's under the judiciary, which is supposed to be independent of them,
[08:48.120 --> 08:50.680]  but only a district court can convene them.
[08:50.680 --> 08:53.240]  We need one that we can convene.
[08:53.240 --> 08:57.640]  And its only job should be to go directly after public officials.
[08:57.640 --> 09:05.560]  It should have every single power available to the grand jury under Article 5, including
[09:05.560 --> 09:12.840]  investigative powers, the ability to subpoena, the ability to hear and view and demand production
[09:12.840 --> 09:15.640]  of evidence.
[09:15.640 --> 09:22.320]  And if a public servant violates any part of the Constitution or the laws of Texas or
[09:22.320 --> 09:26.320]  their oath, the grand jury can indict them.
[09:26.320 --> 09:33.680]  And the grand jury can appoint a special prosecutor to prosecute them without any elected county
[09:33.680 --> 09:39.080]  or district attorney getting in the way.
[09:39.080 --> 09:42.960]  You know, the ones that are out there being paid to protect the ones that are supposed
[09:42.960 --> 09:48.320]  to be being held accountable but aren't.
[09:48.320 --> 09:52.520]  Is prosecutorial discretion when it comes to prosecuting those that they consider one
[09:52.520 --> 09:55.600]  of their own?
[09:55.600 --> 09:59.360]  This is cronyism, okay?
[09:59.360 --> 10:04.120]  They're a bunch of paid criminals protecting their gang.
[10:04.120 --> 10:07.040]  And we need to do something about that.
[10:07.040 --> 10:13.760]  One of the things I was talking about in class this past Sunday is the fact that I don't
[10:13.760 --> 10:23.200]  know of a single state Constitution that has put biting teeth in the hands of the people
[10:23.200 --> 10:28.880]  that allegedly are responsible for that Constitution's creation and empowerment.
[10:28.880 --> 10:38.920]  No Constitution says the people have the right to seize or to arrest, seize the person of,
[10:38.920 --> 10:45.640]  buy and convict a public servant that violates any provision in it.
[10:45.640 --> 10:49.320]  Why don't the Constitutions have that within the Bill of Rights?
[10:49.320 --> 10:54.720]  Why isn't there a provision that says any person may make a citizen's arrest of any
[10:54.720 --> 11:05.000]  public official regardless of their job title, capacity or position and to procure the assistance
[11:05.000 --> 11:13.640]  of any other members of the public or law enforcement for that purpose?
[11:13.640 --> 11:19.080]  And place that public official under arrest, charge them with an actual crime and have
[11:19.080 --> 11:25.640]  that crime investigated properly from beginning to end.
[11:25.640 --> 11:33.880]  If the people were really empowered and government was truly limited by what's in the Constitution
[11:33.880 --> 11:40.400]  and they were forced to abide by it, just like they try to force us to abide by their unconstitutional
[11:40.400 --> 11:47.760]  administrative laws and regulations, we would be in a whole different state of affairs in
[11:47.760 --> 11:54.720]  America today, a whole different one.
[11:54.720 --> 12:05.240]  And I would say arguably a much better one because our public servants would still know
[12:05.240 --> 12:10.960]  there are limits on what they can do and there are limits on what they should even think
[12:10.960 --> 12:16.160]  about doing because the moment they think about it and put it into action and we find
[12:16.160 --> 12:22.400]  it violates what we told them they could not do or what they were allowed to do, they are
[12:22.400 --> 12:31.760]  now placing themselves under our control for punishment instead of them using the corporate
[12:31.760 --> 12:40.160]  entities and their hired mercenaries to make us accountable to them simply for revenue.
[12:40.160 --> 12:46.320]  I mean remember most of the prisons in America are for-profit privately owned prisons and
[12:46.320 --> 12:52.200]  the contracts for those prisons say very clearly in the terms of the contract that the state
[12:52.200 --> 12:57.120]  has to guarantee minimal capacity levels.
[12:57.120 --> 13:04.240]  They have to keep the prisons 75%, 80%, 90% full at all times or they have to pay a huge
[13:04.240 --> 13:10.360]  penalty to the private corporation that owns and runs it.
[13:10.360 --> 13:18.240]  So it behooves the state to fabricate fictitious criminal acts, elevate the level of the offense
[13:18.240 --> 13:25.520]  to such a degree that prison is a very easy to come by option so that they can meet the
[13:25.520 --> 13:29.120]  terms of the contract that they put out there.
[13:29.120 --> 13:37.440]  This again is one of the reasons why I advocate that all prisons should be publicly run but
[13:37.440 --> 13:42.320]  required to be entirely self-sufficient by the inmates that are housed there.
[13:42.320 --> 13:47.040]  They have to grow their food, maintain their buildings, they have to keep it functioning
[13:47.040 --> 13:49.160]  and when they don't, they suffer.

[18:49.400 --> 18:56.480]  ticket and what I did is I wrote a letter asking them to dismiss however
[18:56.480 --> 19:03.440]  versus dismissing the violation or the ticket they sent me another notice for
[19:03.440 --> 19:09.960]  hearing. My hearing is on Wednesday but I'm waiting a month to know what advice
[19:09.960 --> 19:15.960]  could you give me to prevent going to the hearing. Don't go. Okay, let me ask
[19:15.960 --> 19:22.520]  let me ask this question. What kind of letter did you send them? It was a
[19:22.520 --> 19:29.120]  letter basically telling them it was some log that I pulled up some code or
[19:29.120 --> 19:35.400]  transportation code because they specified what a vehicle was or they told
[19:35.400 --> 19:43.400]  me that I was driving a vehicle so I pretty much told them what the
[19:43.400 --> 19:49.520]  definition of a vehicle was and then they said that they witnessed however with
[19:49.520 --> 19:54.760]  the photo enforcement there was really no witness. So I pretty much detailed in
[19:54.760 --> 20:00.480]  the letter what against what they told me the violation was and since the
[20:00.480 --> 20:04.840]  officer signed saying that no I don't have it in front of me so I don't remember
[20:04.840 --> 20:08.400]  the exact details. It was a few weeks ago when I had written the letter but
[20:08.400 --> 20:12.760]  anyway I asked them to dismiss it and I pretty much put in detail why they needed
[20:12.760 --> 20:17.960]  to dismiss it and I rebutted what they said it in the notice of traffic
[20:17.960 --> 20:23.080]  violation but instead of dismissing they went ahead and sent me an application
[20:23.080 --> 20:29.840]  to go to a hearing. Okay was it sent to you certified mail? Not even a court. No
[20:29.840 --> 20:34.320]  nothing. Okay well that's because it's not in a court. These are administrative
[20:34.320 --> 20:39.960]  tickets. You're not going to see anyone except the cop or you're going to see
[20:39.960 --> 20:44.880]  some sort of little civilian appointee that the cops want you to meet with so
[20:44.880 --> 20:52.360]  they can find you guilty anyway. Okay. Okay. First off they have no
[20:52.360 --> 21:00.400]  jurisdiction over you that you don't give them. Okay. These administrative citations
[21:00.400 --> 21:05.200]  are unconstitutional. They are bills of pains and penalties. No ifs, no ands, no
[21:05.200 --> 21:09.600]  buts. It is an administrative determination of guilt without judicial review.
[21:09.600 --> 21:15.160]  Now they want to say that you get it judicially reviewed later when you take
[21:15.160 --> 21:18.440]  it to the municipal court that's going to turn around and find you just as
[21:18.440 --> 21:25.880]  guilty on just as many grounds. Okay. None of which they can prove. Now when you
[21:25.880 --> 21:32.080]  asked for this dismissal do you recall any of the reasons you gave them as to
[21:32.080 --> 21:38.360]  why you think it should be dismissed? Besides arguing the definition of vehicle
[21:38.360 --> 21:51.400]  which by the way was a bad mistake. Okay. Well pretty much in the notification
[21:51.400 --> 22:00.800]  we'll pick up I don't have the notice in front of me but the officer pretty much
[22:00.800 --> 22:07.400]  claimed that he witnessed the video and... Hey you know what I watched cop shows
[22:07.400 --> 22:14.200]  on TV too. That doesn't make me co-jack. Right. So he just pretty much said that
[22:14.200 --> 22:22.000]  based on what he viewed in the video that he was to cite me and found that I
[22:22.000 --> 22:30.400]  made the violation. No. What they what they saw was a car that looked like
[22:30.400 --> 22:39.400]  yours. Right. Okay. That they alleged committed some sort of violation but
[22:39.400 --> 22:44.880]  unless they actually have pictures of you behind the wheel they didn't accuse you
[22:44.880 --> 22:50.880]  of anything except owning the car. Okay. And that's pretty much I believe that's
[22:50.880 --> 22:56.280]  also what I have put in there because I pretty much said that they couldn't
[22:56.280 --> 23:00.840]  well not not saying that I put in the letter but that's something that I was
[23:00.840 --> 23:03.880]  speaking upon other people that they didn't witness me doing it there's no
[23:03.880 --> 23:09.640]  picture or nothing of me in the video showing me doing it it's just the car.
[23:09.640 --> 23:14.600]  Right. And what they count on is people not knowing that they have to prove the
[23:14.600 --> 23:18.360]  identity of the individual they're accusing and they want to say that
[23:18.360 --> 23:23.400]  because this is administrative civil they don't have to do that and that is
[23:23.400 --> 23:31.440]  dead wrong. And then I also want to say that it was a right turn. That it was
[23:31.440 --> 23:42.080]  what? The enforcement it was a right turn on a red light. Okay. Again things you
[23:42.080 --> 23:50.200]  don't ever do is argue the merits of the accusation with these people. The moment
[23:50.200 --> 23:57.400]  you start arguing merits of the accusation you're making a mistake. Don't do
[23:57.400 --> 24:07.600]  that. Okay. Okay. It's like you know when they ask you to produce certain
[24:07.600 --> 24:11.800]  information and you do you're agreeing that that information you're producing is
[24:11.800 --> 24:15.040]  somehow relevant to what the situation they're accusing you of. It's like
[24:15.040 --> 24:18.440]  producing your license or your registration when a cop pulls you over.
[24:18.440 --> 24:23.480]  When you produce it you're agreeing that transportation is an issue here
[24:23.480 --> 24:31.760]  because that's all those things pertain to. Okay. Let me just for the sake of
[24:31.760 --> 24:34.640]  argument here let me explain some of the things that we've gone through in
[24:34.640 --> 24:38.080]  relation to the red light cameras as far as the traffic seminar and the way we
[24:38.080 --> 24:43.800]  handle these. I originally created a red light camera or speeding camera
[24:43.800 --> 24:47.840]  response letter to be sent into these individuals stating the reasons why it
[24:47.840 --> 24:52.200]  was required to be dismissed. They don't like to dismiss it because they're
[24:52.200 --> 24:56.920]  administrative they think they can just do what they want and find you guilty
[24:56.920 --> 25:03.440]  anyway. But what they don't understand is you can sue the living crap out of them
[25:03.440 --> 25:11.480]  when they do that because they're trying to create a guilt relationship
[25:11.480 --> 25:18.360]  simply because of the relationship of the car to you which is ownership only.
[25:18.360 --> 25:24.040]  They have no evidence of who's behind the wheel they're finding you guilty
[25:24.040 --> 25:33.280]  because your name is on the paperwork of who owns it. That's it. That's exactly
[25:33.280 --> 25:39.840]  why these tickets are civil and not criminal. They're administrative civil
[25:39.840 --> 25:47.000]  because in a criminal case they would have to actually identify you or they
[25:47.000 --> 25:55.320]  couldn't charge you. But they fail to understand that the moment they try to
[25:55.320 --> 25:59.360]  get around that by making this administrative and doing exactly the
[25:59.360 --> 26:05.920]  same thing and punishing you administratively they have created a

[32:37.040 --> 32:42.640]  the problem is you've already responded but they've given you a notice of
[32:42.640 --> 32:48.120]  hearing that they did not send to you certified mail right so they can't prove
[32:48.120 --> 32:54.120]  that they heard that they served you with notice of the hearing right correct so
[32:54.120 --> 32:59.880]  don't go don't respond don't do anything let them rule against you and then go
[32:59.880 --> 33:11.680]  after them okay okay so then what do I do is once they come if they decide to
[33:11.680 --> 33:16.520]  come after me is there any way or is there anything that I can do or brush up
[33:16.520 --> 33:23.680]  on in order to pair for any type of engagement well there's lots you can do
[33:23.680 --> 33:28.160]  but you have to know what it is they're going to do the only thing they can do
[33:28.160 --> 33:32.960]  with these citations is send them to a debt collector and then you've got
[33:32.960 --> 33:38.280]  federal law on your side because the moment a debt collector calls you in
[33:38.280 --> 33:43.040]  relation to that citation it starts demanding money and they fail to comply
[33:43.040 --> 33:51.520]  with the FDCPA and the FSCRA they are in for a heck of a monetary problem with
[33:51.520 --> 34:01.040]  you if you go after them and believe me that's very profitable debt collectors
[34:01.040 --> 34:05.320]  are getting pounded in the federal courts right now because they don't ever
[34:05.320 --> 34:15.800]  comply with the Fair Debt Collection Practices Act okay and there and there is
[34:15.800 --> 34:20.440]  more and more case law out there right now that is siding with the consumer
[34:20.440 --> 34:30.240]  over everybody even government collectors so that's another thing about
[34:30.240 --> 34:34.440]  not responding to the citation and then letting them move against you in their
[34:34.440 --> 34:40.640]  administrative findings and turning it over to a debt collector that you can
[34:40.640 --> 34:48.520]  go after them for big-time money then okay because you're talking of anywhere
[34:48.520 --> 34:58.160]  from a 500 to up to 10,000 in some cases for each and every violation of the
[34:58.160 --> 35:06.720]  FDCPA and the FSCRA and if they contact you by telephone oh the telephony act at
[35:06.720 --> 35:11.000]  the federal level is another thing you can hit them with so you can hit them
[35:11.000 --> 35:16.480]  with three different penalties for each and every violation depending upon how
[35:16.480 --> 35:21.520]  they contacted you and what they said or did when they contacted you or what they
[35:21.520 --> 35:34.560]  didn't say or do when they contacted you okay just get you all this down and then
[35:34.560 --> 35:38.960]  if they attempted any way to directly affect your ability to renew your
[35:38.960 --> 35:42.480]  license or renew your registration or anything like that they've opened
[35:42.480 --> 35:46.800]  themselves up for a whole new lawsuit against the individual state agencies
[35:46.800 --> 35:51.600]  because they have moved against you in an administrative capacity without
[35:51.600 --> 35:57.920]  judicial review and that's a no-no you can sue them in federal court for that

[49:09.720 --> 49:15.720]  So we went on well about 15 or 20 minutes later
[49:15.720 --> 49:20.720]  we were pulling in the parking lot of my daughter's school
[49:20.720 --> 49:25.720]  Anyway I went to turn signal on looked in my left mirror to see that there
[49:25.720 --> 49:29.720]  wouldn't be anybody going to try to pass me as I was turning left in the parking
[49:29.720 --> 49:36.720]  lot and I saw this car and I thought no and then looked again and I told my wife
[49:36.720 --> 49:42.720]  that I think that's a guy and she goes no surely not so we zigzagged
[49:42.720 --> 49:48.720]  the three several lanes of the parking lot and I determined he is definitely
[49:48.720 --> 49:56.720]  following us so anyhow I kind of tried to plan my positioning my strategy
[49:56.720 --> 50:01.720]  this was all happening over the course of 30 or 40 seconds you know 45s
[50:01.720 --> 50:07.720]  back nevertheless I made a left turn in the parking lot and as soon as I
[50:07.720 --> 50:13.720]  had my truck established going straight and while he was occupied with the left
[50:13.720 --> 50:17.720]  turn I threw it in the park and I went back out you know ran back to the back
[50:17.720 --> 50:23.720]  and confronted and we ended up in a fight we fought for 12 minutes
[50:23.720 --> 50:28.720]  and you know the police showed up ended up bringing both of us to jail
[50:28.720 --> 50:34.720]  and they gave I don't know what they gave him but they gave me a ticket for
[50:34.720 --> 50:42.720]  fighting in public and I've got a hearing on that on December the 18th
[50:42.720 --> 50:47.720]  I was going to see what you might advise about that but a more a more immediate
[50:47.720 --> 50:53.720]  situation that I have to deal with on December the 3rd Wednesday is they
[50:53.720 --> 51:02.720]  told me that I had a warrant out for me in Garland, Texas anyway come to find out
[51:02.720 --> 51:15.720]  that this is allegedly a feeding ticket from 1996 anyway I have no idea really
[51:15.720 --> 51:20.720]  anything about it I faintly remember something about it but have to believe
[51:20.720 --> 51:26.720]  that I took care of it back then but I have nothing to prove anything from that
[51:26.720 --> 51:34.720]  you know time frame and it's like say I've got you know a I don't know if I
[51:34.720 --> 51:42.720]  called a hearing or a did they arrest you on the warrant apparently so yeah
[51:42.720 --> 51:49.720]  okay all right first thing is on the warrant if they did arrest you on
[51:49.720 --> 51:53.720]  the warrant the warrant has been executed so it's supposed to according to the
[51:53.720 --> 51:57.720]  code of criminal procedure be immediately placed into the court record along

[53:11.720 --> 53:16.720]  the complaint was filed if a complaint was ever filed that judge knowingly
[53:16.720 --> 53:23.720]  issued a bad warrant and he has no immunity for that act because the
[53:23.720 --> 53:29.720]  issuance of a warrant is administrative it is not judicial so if he calls you
[53:29.720 --> 53:33.720]  to be arrested on the face of that warrant you can't go after the officer
[53:33.720 --> 53:41.720]  but you can dang sure go after the magistrate that issued it so if the
[53:41.720 --> 53:52.720]  it's just warrant like what what is what are the chances that some sort of a
[53:52.720 --> 53:56.720]  screwed up mistake well there's always that chance of course there's also the
[53:56.720 --> 54:02.720]  chance that it's an intentional fabrication in order to get money I mean
[54:02.720 --> 54:08.720]  I know for a fact there are people that have been sent notices that they had
[54:08.720 --> 54:13.720]  outstanding warrants for tickets from years ago that were that have never
[54:13.720 --> 54:20.720]  even been to the place where the ticket was supposedly issued okay and yet

[54:25.720 --> 54:31.720]  they don't come in and pay and yet the whole thing is a fraud perpetrated by

[54:37.720 --> 54:44.720]  revenue it doesn't have enough actual tickets so it's fabricated so her how

[56:44.720 --> 56:49.720]  transportation code that would be any of them that's a or B how do we determine
[56:49.720 --> 57:00.720]  that we look at 1406 our 15.17 G and how it points us to fit 14.06 C as the
[57:00.720 --> 57:05.720]  only power to issue a warrant by the magistrate for a nonappearance is in
[57:05.720 --> 57:10.720]  relation to A and B misdemeanors therefore the only way that the
[57:10.720 --> 57:15.720]  transportation code relation can be made is for citations is on A and B
[57:15.720 --> 57:22.720]  misdemeanors as well because the transportation code at issue there is
[57:22.720 --> 57:30.720]  general while the 15.17 proceeding is specific and which one prevails local
[57:30.720 --> 57:35.720]  and specific over general unless the general specific or the local and
[57:35.720 --> 57:42.720]  specific specifically says the general controls if there's a conflict but
[57:42.720 --> 57:47.720]  without knowing exactly what's in the record and exactly when this award was
[57:47.720 --> 57:51.720]  allegedly issued and exactly whether or not a complaint was ever filed I don't
[57:51.720 --> 57:54.720]  have anything good to tell you one way or the other because I don't know enough
