[05:54.720 --> 06:00.720]  Regarding getting rid of social security numbers and the statutes governing all that and everything else
[06:00.720 --> 06:08.720]  Just for general information purposes, the information you need to know in relation to canceling the social security agreement
[06:08.720 --> 06:16.720]  As far as it being possible, it doesn't give a process for it, a procedure for it, or who to do it with, but it is possible
[06:16.720 --> 06:27.720]  Under the code of federal regulations, section 404.1905, you will find the statute dealing with termination of agreements
[06:27.720 --> 06:31.720]  And that is from the social security act
[06:31.720 --> 06:37.720]  So there is statute on the books that allows for the termination of any agreement at the federal level
[06:37.720 --> 06:40.720]  And this is the code that makes for that
[06:40.720 --> 06:47.720]  The process, like I say, there isn't one. When I did it, I simply sent in a notice to the social security administration
[06:47.720 --> 06:59.720]  That I was hereby rescinding and withdrawing any and all future use, reference, or attachment to a designated number of such and such
[06:59.720 --> 07:05.720]  And would waive all future benefits, privileges associated with SANE
[07:05.720 --> 07:11.720]  And that's really all I did. So don't let them tell you you can't do it, because you can
[07:11.720 --> 07:16.720]  Now the one thing this statute does make very clear, and it's very short so I'm going to read it to you
[07:16.720 --> 07:22.720]  Each agreement shall contain provisions for its possible termination
[07:22.720 --> 07:31.720]  If an agreement is terminated, entitlement to benefits and coverage acquired by an individual before termination shall be retained
[07:31.720 --> 07:37.720]  The agreement shall provide for notification of termination to the other party and the effective date of termination
[07:37.720 --> 07:41.720]  Now just so you understand fully what that means
[07:41.720 --> 07:48.720]  That means you're free to terminate the agreement, but any money we have stolen from you under false pretenses
[07:48.720 --> 07:57.720]  And promise to pay you back under even more false pretenses, we get to keep as a reward for our criminal activities
[07:57.720 --> 08:06.720]  Who says crime does not pay in America? It pays very well if you're the government, or a politician, or a lawyer
[08:06.720 --> 08:13.720]  And that folks is something we got to change, and we have to change it big time
[08:13.720 --> 08:17.720]  Now why is this important? Well it's important for several reasons
[08:17.720 --> 08:21.720]  First and foremost when it comes to things like bank accounts for instance
[08:21.720 --> 08:29.720]  Now every bank will tell you their policy prohibits them from opening any form of bank account without a social security number
[08:29.720 --> 08:35.720]  However, banks according to the federal courts are quasi-federal agencies
[08:35.720 --> 08:41.720]  They are entirely regulated by the federal codes, they are therefore under federal control
[08:41.720 --> 08:46.720]  Therefore their policies are not allowed to be in violation of federal law
[08:46.720 --> 08:57.720]  The Privacy Act of 1974 says that no one, federal, state, or local, whether it be private or government
[08:57.720 --> 09:06.720]  Shall deprive any individual of a right, benefit, or privilege because of that individual's refusal to disclose a social security number
[09:06.720 --> 09:17.720]  So the bank's policy is moot, it violates the Privacy Act, it also violates other federal law relating to information collection by banks
[09:17.720 --> 09:28.720]  For instance, Code of Federal Regulations 103.28 where it deals with identification required by financial institutions
[09:28.720 --> 09:36.720]  That section specifically tells the following to a bank
[09:36.720 --> 09:43.720]  Before concluding any transaction with respect to which a report is required under section 103.22
[09:43.720 --> 09:50.720]  A financial institution shall verify and record the name and address of the individual presenting a transaction
[09:50.720 --> 09:58.720]  As well as record the identity, account number, and the social security or taxpayer identification number if any
[09:58.720 --> 10:04.720]  Of any person or entity on whose behalf such transaction is to be affected
[10:04.720 --> 10:14.720]  Now, they're required to ask for a social security number under that statute, but they are not required to obtain one
[10:14.720 --> 10:19.720]  How do we verify that? Well, we look at 103.34
[10:19.720 --> 10:27.720]  Which reads, in the event that a bank has been unable to secure the required identification
[10:27.720 --> 10:33.720]  It shall nevertheless not be deemed to be in violation of this section if
[10:33.720 --> 10:38.720]  1. It has made a reasonable effort to secure such identification and
[10:38.720 --> 10:46.720]  2. It maintains a list of the names, addresses, and account numbers of those persons from whom it has been unable to secure
[10:46.720 --> 10:52.720]  Such identification and makes the names, addresses, and account numbers of those persons available to the secretary
[10:52.720 --> 10:57.720]  As directed by him. Now that is Secretary of the Treasury by the way
[10:57.720 --> 11:02.720]  Who of course controls who? The IRS
[11:02.720 --> 11:11.720]  Now, in order to prove to you that it's a violation of federal law, not only do you have to look at what the Privacy Act says
[11:11.720 --> 11:18.720]  Regarding the use of a social security number, you've got Title 18, Section 242 and 1983
[11:18.720 --> 11:25.720]  Both of which provide, whoever, under color of any law, statute, ordinance, regulation, or custom
[11:25.720 --> 11:34.720]  Willfully subjects any person in any state, territory, or district to the deprivation of any rights, privileges, or immunity
[11:34.720 --> 11:42.720]  Those secured or protected by the Constitution or laws of the United States shall be fined under this title or in prison
[11:42.720 --> 11:45.720]  Not more than one year or both
[11:45.720 --> 11:58.720]  42 USC Section 1983 further provides that a violator shall be liable to the party injured in an action at law, suit in equity, or other proper proceeding for redress
[11:58.720 --> 12:08.720]  Now that should be pretty clear even to a bank manager or a bank president that they cannot violate federal law without consequences
[12:08.720 --> 12:12.720]  Then you look at 42 USC Section 408 which reads
[12:12.720 --> 12:30.720]  Whoever, and then look at Section 8, subsection 8, discloses, uses, or compels the disclosure of the social security number of any person in violation of the laws of the United States shall be guilty of a felony
[12:30.720 --> 12:40.720]  And upon conviction thereof shall be fined under Title 18 or imprisoned for not more than five years or both
[12:40.720 --> 12:55.720]  Now folks, this is the same information that I used way back when I went after the Department of Public Safety here in Texas for refusing to reissue a license to me prior to my beginning of the fight on transportation
[12:55.720 --> 13:03.720]  I was still active duty military at the time and the state refused to renew my license because I wouldn't give them a social security number
[13:03.720 --> 13:11.720]  Well, I fought with them and fought with them and fought with them including the Attorney General's office at the time
[13:11.720 --> 13:22.720]  And I presented them with all of these federal statutes and they resisted and they lied and they cajoled and they threatened and they did all manner of things
[13:22.720 --> 13:37.720]  But you go into any DPS office today, you ask them for a social security number exemption form and they will give you a little slip of paper that they will tell you you have to go get notarized
[13:37.720 --> 13:52.720]  And on that slip of paper it says that I swear under penalty of perjury that I have rescinded my social security number and no longer use that number for any purpose
[13:52.720 --> 13:59.720]  And you have to go get that signed in front of a notary and bring it back to the DPS and then they'll issue a license without a social security number
[13:59.720 --> 14:09.720]  I am responsible for the existence of that little form based upon the fight I had with them. That form was not in existence when I began that fight
[14:09.720 --> 14:19.720]  And I have it on good authority that some guy threatening to go after the Department of Public Safety in federal court was the entire reason that form existed
[14:19.720 --> 14:31.720]  Well that was moi. And as you can see if you stand your ground and you beat them black and blue with the rules that control what they do you can make them cave
[14:31.720 --> 14:38.720]  Especially if there is some serious detriment to themselves for not doing so
[14:38.720 --> 14:49.720]  And in the case of title 18 the individual officer or employee or agent is liable not his principal
[14:49.720 --> 14:59.720]  So anything you go after them for under that they themselves bear the brunt of and there is no escaping it
[14:59.720 --> 15:06.720]  So that being said that's useful information to have if you intend to get rid of that number
[15:06.720 --> 15:15.720]  Now folks I'm going to tell you just like I've tried to tell other people this is not to be done casually or taken lightly as to the consequences
[15:15.720 --> 15:33.720]  Because you will find that everything in the good old you sucks of A revolves around the possession and use of that little number that we were all lied to and misled about its purpose and intent from the very beginning
[15:33.720 --> 15:51.720]  Thank you Johnson. Okay. So folks since the days of Andrew Jackson we have had no honest presidents we have had virtually no principled ethical honest representatives
[15:51.720 --> 16:03.720]  We have very few in existence at all anymore and we only had a few more than that back in the 50s
[16:03.720 --> 16:10.720]  It's going to do nothing but get worse until we do something about it
[16:10.720 --> 16:22.720]  And folks this business has to begin changing at home and I don't mean your household I mean in your particular precinct or district
[16:22.720 --> 16:26.720]  Let me tell you my idea which I've talked about before
[16:26.720 --> 16:33.720]  Everybody in Texas has a representative that represents one or more districts or precincts
[16:33.720 --> 16:40.720]  And we need to be in that representative's face every time they're within our district or precinct

[20:33.720 --> 20:41.720]  They are not allowed to tax our private property, they never have been
[20:41.720 --> 20:56.720]  They simply use word disassociation with reality and substitute it for the legalese that makes it appear like they are doing something they are allowed to do
[20:56.720 --> 21:02.720]  They aren't, simple logic can prove that without having to go into any legalese whatsoever
[21:02.720 --> 21:10.720]  I have no power to tax my neighbor, I have no power to tax any of my neighbors

[21:16.720 --> 21:23.720]  And none of my other neighbors have the power to give any of my neighbors the power to tax me
[21:23.720 --> 21:33.720]  Got it? If we don't possess the power we cannot delegate it to our state officials, really that simple
[21:33.720 --> 21:38.720]  We cannot give away a power we don't possess
[21:38.720 --> 21:48.720]  So the only thing they can tax are the things they created, corporations and everything associated with legal entities
[21:48.720 --> 21:57.720]  They created those, they can tax the daylights out of them, I could care less, leave me and my property alone
[21:57.720 --> 22:05.720]  Same thing applies with the right to travel on the roads versus transportation, make them understand the difference
[22:05.720 --> 22:11.720]  Transportation is commercial, motor vehicles are commercial use property
[22:11.720 --> 22:21.720]  The right to travel is a right under the right of liberty, the courts have already said it's the right to locomotion protected under the right of liberty
[22:21.720 --> 22:30.720]  We have the right to go from place to place of our own volition at our own whim by our own means any time we want
[22:30.720 --> 22:42.720]  And our state officials have no power and authority to prevent that or interfere with it through licensing, registration and fining us for traveling on our highways
[22:42.720 --> 22:50.720]  You and I are not subject to this crap they call statutory law because it's not law
[22:50.720 --> 23:01.720]  It's an agency administrative interpretation of the underlying law and the underlying law is regulatory which means it doesn't apply to you and me in our private capacities
[23:01.720 --> 23:07.720]  Never has, never will, you've just been suckered
[23:07.720 --> 23:24.720]  So get over that and get busy doing something about it because you are not just fighting for your right to do something, you are fighting for the rights that are being stolen from your children, your grandchildren and their children to come
[23:24.720 --> 23:44.720]  Slowly but surely every single day these rights are being eroded, destroyed, forever lost to an ever hungry government machine that will never stop feeding on us unless we stop it first
[23:44.720 --> 23:54.720]  It's up to you and I to put an end to this, we need to get concentrated, get organized, get busy
[23:54.720 --> 24:03.720]  Stop letting other people tell you how to live your life, to use your property and to own what you have

[25:11.720 --> 25:26.720]  And also I have my private car but I'm just curious should I take off the license plate so as not to, I mean that's going to attract a lot of attention
[25:26.720 --> 25:31.720]  Well I'm curious before you go that far let me ask a couple questions

[25:32.720 --> 25:38.720]  First off, how well are you prepared to go to court and fight this when they stop you?
[25:38.720 --> 25:42.720]  Well I've been driving with no registration
[25:42.720 --> 25:44.720]  I'm sorry you've been what?
[25:44.720 --> 25:58.720]  I've been traveling with my expired over two years now but I know eventually I will be pulled over
[25:58.720 --> 26:01.720]  Yeah especially if you take the plates off of it
[26:01.720 --> 26:05.720]  So it's okay to leave the plates on
[26:05.720 --> 26:11.720]  Well if you're going to disassociate yourself, look there's two ways to do this
[26:11.720 --> 26:17.720]  You can be commercial ready and not actually be in commerce
[26:17.720 --> 26:21.720]  You can have the license, you can have the registration, you can have all that
[26:21.720 --> 26:25.720]  If you want to keep paying the extortion money that's associated with it
[26:25.720 --> 26:27.720]  That's up to you
[26:27.720 --> 26:31.720]  But that doesn't actually mean you're commercial and it doesn't mean you're using it
[26:31.720 --> 26:41.720]  So I'm assuming that like me the whole point of your argument is I'm tired of paying for something I'm not required to have or pay for because I'm not engaging in it
[26:41.720 --> 26:42.720]  Right
[26:42.720 --> 26:49.720]  Okay then like me I suggest you spend some time getting ready to fight before you make that jump
[26:49.720 --> 26:59.720]  You may not intend to renew your license but what are you going to argue and what are you going to do when you go to court and they want you to make your argument

[27:05.720 --> 27:13.720]  Because the moment you say I was driving they've won, you've lost, there is no argument to be made

[27:15.720 --> 27:20.720]  But that is not, just knowing the terminology is not going to be enough

[36:25.720 --> 36:34.720]  Well the thing is you're asking well okay he can make a legal determination that a crime was committed but he can't testify as to how he made this legal determination
[36:34.720 --> 36:36.720]  Something here doesn't make sense
[36:36.720 --> 36:45.720]  How's he going to offer competent testimony eyewitness to crime when he cannot accurately describe what elements make up the crime

[39:26.720 --> 39:35.720]  That is where they get you however they get you to say you're driving boom they've got you that's a confession
[39:35.720 --> 39:41.720]  Because that term as they use it relates entirely to commercial use
[39:41.720 --> 39:54.720]  If they can get you to call it a motor vehicle that you're in or that you are that you produce the license associated with having to use it on the highway as a motor vehicle
[39:54.720 --> 40:04.720]  All of those things are confessions and prima facie factual evidence that you are engaged in an activity over which they have regulatory authority
[40:04.720 --> 40:12.720]  That's why you have to be extremely careful at the stop about what you say what you do and what you provide
[40:12.720 --> 40:28.720]  Right now I did look up those definitions in Black's law dictionary and lo and behold they got people tricked up and down because of regular words like
[40:28.720 --> 40:34.720]  Oh absolutely let me read you the definition from the Hawaii statutes for vehicle
[40:34.720 --> 40:44.720]  Vehicle means every device in upon or by which any person or property is or may be transported or drawn upon a highway
[40:44.720 --> 40:50.720]  But excludes devices moved by human power or devices used exclusively upon stationary rails or tracks and mopeds
[40:50.720 --> 40:54.720]  That is virtually verbatim the Texas statute
[40:54.720 --> 40:58.720]  Oh good
[40:58.720 --> 41:05.720]  And this entire chapter here dealing with motor vehicles is under your primary code division of transportation
[41:05.720 --> 41:09.720]  Right commerce transportation
[41:09.720 --> 41:18.720]  Exactly and when you go through and look at motor vehicle and so on and so forth they match up to Texas almost identically
[41:18.720 --> 41:24.720]  Each one is a compound definition that contains a separate one or more definitions from elsewhere
[41:24.720 --> 41:31.720]  So all the codes are pretty much the same with a very few state exceptions
[41:31.720 --> 41:44.720]  Yeah and you don't go by the state the statutes and the ordinances are not law so you know the nitty gritty is you got to go to the common law correct?
[41:44.720 --> 41:54.720]  Well you don't have to go to the common law as much as you force them to prove that you're engaged in the activity regulated by their statutory law
[41:54.720 --> 42:03.720]  The problem is they can never prove it all they do is assume it all you have to do is object and rebut it
[42:03.720 --> 42:13.720]  If they never offer actual evidence then you're being convicted on a presumption not a factual or evidentiary basis
[42:13.720 --> 42:15.720]  Right
[42:15.720 --> 42:21.720]  And that's the record you have to preserve for the appeal that's the point you have to make so the appeals court can see it
[42:21.720 --> 42:29.720]  Because virtually every state in the union is violating rights constantly at the lower court levels for revenue
[42:29.720 --> 42:36.720]  They don't care about anything except getting that money justice is just a punch line to them
[42:36.720 --> 42:48.720]  Now here's one for you I'm just kind of curious I have never been pulled over in the last couple of years that I've been traveling as a free traveler
[42:48.720 --> 42:58.720]  But when I parked at the airport to go take a trip to another island and come back I got a couple of citations on my parked vehicle because
[42:58.720 --> 43:00.720]  On your parked what?
[43:00.720 --> 43:04.720]  On my parked automobile

[49:17.720 --> 49:25.720]  Well the first thing I'd recommend you start doing is researching your constitutional history and whatever state of the union you are in
[49:25.720 --> 49:37.720]  Your constitutional history will tell you what the rights of the people have always been in relation to their private property versus any amendment that allows the legislature to tax commercial property
[49:37.720 --> 49:45.720]  See this is the other aspect of what our neighbors cannot give power to our other neighbors to do to us
[49:45.720 --> 49:56.720]  Like I said, I have no power to tax my neighbor, my neighbor has no power to tax me, we cannot band together and tax any of our other neighbors
[49:56.720 --> 50:08.720]  We do not have that inherent power and authority, it is only by their consent that we can collect one penny from any of them, without their consent we are robbing them
[50:08.720 --> 50:19.720]  That's the end of it, so the constitutions do not grant a single right to the people in any way, shape or form
[50:19.720 --> 50:27.720]  They never have, they never will, they regulate government and what it can do in relation to the people
[50:27.720 --> 50:38.720]  It does not regulate the people, it does not grant our rights and therefore it cannot be used to extend them, diminish them or to take them away

[50:41.720 --> 51:01.720]  Okay well, thanks for all of your question answering, and to leave you with an honest note, here in Hawaii they have this new thing going on where drive sober or be pulled over

[51:19.720 --> 51:24.720]  Well the thing is, you're not required to comply with a checkpoint in any way, shape or form

[51:32.720 --> 51:42.720]  What is your probable cause, what crime do you suspect I've committed, not what you're generally checking for, do you suspect that I've been drinking, well I don't know

[51:50.720 --> 51:59.720]  Ok, anyway, I almost can hardly wait to go through a DUI checkpoint just for that purpose

[52:49.720 --> 52:54.720]  20.2 of the rules of appellate procedure that basically states
[52:54.720 --> 53:01.720]  If I want to, I don't know what the word is, move the court to find the indigent
[53:01.720 --> 53:04.720]  Then I have to do it through motion and affidavit
[53:04.720 --> 53:14.720]  So I did that, presented it to the judge, judge says essentially I don't think that this applies to class B misdemeanors
[53:14.720 --> 53:21.720]  I said well, I provided him with a couple, I forgot what I cited
[53:21.720 --> 53:26.720]  As far as the Code of Criminal Procedure is concerned, I think there was a government code
[53:26.720 --> 53:34.720]  or penal code cited in there too, as well as 20.2 saying that I can apply for this or move the court to find the indigent
[53:34.720 --> 53:48.720]  As well as the 14th court of appeals telling the county criminal court to have a hearing rather to make the determination whether or not I was able to pay
[53:48.720 --> 53:57.720]  So I kind of threw that at him and then I also said that he was supposed to have a full finding of facts and conclusions of law
[53:57.720 --> 54:06.720]  So I told him well can you please provide me with the law you're relying on to say that I can't have an appeal free of charge essentially
[54:06.720 --> 54:08.720]  Or at least not have to pay $1,000 for it
[54:08.720 --> 54:16.720]  So he said we're going to have a hearing where I have to prove my indigency which is smart
[54:16.720 --> 54:26.720]  Well just keep in mind that the indigency requirement is not to be dead broke and don't let him get away with telling you that it is
[54:26.720 --> 54:30.720]  The indigency requirement is very simple

[01:03:47.720 --> 01:03:58.720]  They had to drop that case, now I am suing APD in federal court for 42 federal reco indictments
[01:03:58.720 --> 01:04:02.720]  And this isn't geared towards traffic but if I may speak about jurisdiction
[01:04:02.720 --> 01:04:03.720]  Sure
[01:04:03.720 --> 01:04:06.720]  Or that is make a statement about jurisdiction
[01:04:06.720 --> 01:04:07.720]  Sure
[01:04:07.720 --> 01:04:20.720]  In my case and this seems to be an epidemic throughout the United States that drug task force will use a magistrate, a JP court in order to sign search warrants
[01:04:20.720 --> 01:04:30.720]  Well a JP magistrate court has jurisdiction over health and safety, public abatement and as a dog catcher courts
[01:04:30.720 --> 01:04:33.720]  No jurisdiction over marijuana cases
[01:04:33.720 --> 01:04:48.720]  Not to try them, they don't have any jurisdiction to try them but in Texas any elected judge magistrate can issue a warrant for any crime that is brought before him
[01:04:48.720 --> 01:04:52.720]  He does not have to have jurisdiction to try the case to issue a warrant
[01:04:52.720 --> 01:05:02.720]  But from what I understand under TCCP, I think it is under TCCP that is for a visual inspection only of premises
[01:05:02.720 --> 01:05:05.720]  No, not true
[01:05:05.720 --> 01:05:08.720]  I don't have the regulation in front of me
[01:05:08.720 --> 01:05:22.720]  Yeah, in Texas statute it specifically authorizes warrants of arrest and search and seizure to be issued by any magistrate as long as there is a proper signed affidavit of probable cause
[01:05:22.720 --> 01:05:29.720]  Okay, I see and I did not have a
[01:05:29.720 --> 01:05:32.720]  There was no affidavit of probable cause
[01:05:32.720 --> 01:05:38.720]  Well there was but I had another judge dismiss it for lack of probable cause
[01:05:38.720 --> 01:05:46.720]  Dismiss your case, right because almost every one of those types of warrants have falsified facts
[01:05:46.720 --> 01:05:51.720]  There is no probable cause because the facts asserted were lies to begin with
[01:05:51.720 --> 01:05:53.720]  It's a fishing expedition
[01:05:53.720 --> 01:05:58.720]  Yeah, that's exactly what it is or it's just an outright lie to try to bust somebody
[01:05:58.720 --> 01:05:59.720]  That's right
[01:05:59.720 --> 01:06:05.720]  And that's what has been going on with APD for, well I'm sure throughout the United States for many years
[01:06:05.720 --> 01:06:13.720]  And they also, there are state statutes required in order to process the search warrant
[01:06:13.720 --> 01:06:18.720]  That is to have the information probable cause in order to utilize the search warrant
[01:06:18.720 --> 01:06:22.720]  That is one which they don't do any more confidential informants
[01:06:22.720 --> 01:06:28.720]  They have to list what they're going to inspect
[01:06:28.720 --> 01:06:36.720]  Yeah, they're supposed to name everything they're looking for and where they intend to search for it
[01:06:36.720 --> 01:06:41.720]  That's part of the requisite probable cause but the courts are not holding them to it
[01:06:41.720 --> 01:06:46.720]  The problem is we no longer have separate departments of government
[01:06:46.720 --> 01:06:56.720]  We have one big colluding government that operates to deprive us at every turn of our rights to increase their power
[01:06:56.720 --> 01:07:02.720]  So we don't have an adversarial form of government between the departments like we're supposed to have
[01:07:02.720 --> 01:07:08.720]  Because they cannot be a check and balance without being adversarial
[01:07:08.720 --> 01:07:10.720]  Right
[01:07:10.720 --> 01:07:20.720]  So the question is then what to do about it and I've taken the next step to file a federal lawsuit in the Western District Court here in Austin
[01:07:20.720 --> 01:07:27.720]  They violated 17 state statute violations to enforce one misdemeanor
[01:07:27.720 --> 01:07:37.720]  That's what it amounted to, that's the only amount of marijuana that was in possession of the house was a misdemeanor under two ounces
[01:07:37.720 --> 01:07:41.720]  In fact it was 10 grams
[01:07:41.720 --> 01:07:46.720]  So July 3rd I filed a federal lawsuit using the Federal Reco Act
[01:07:46.720 --> 01:07:54.720]  42 federal reco acts of racketeering and criminal activity against APD
[01:07:54.720 --> 01:07:59.720]  If I may share a website, I put together a website with all the information
[01:07:59.720 --> 01:08:08.720]  The reason why I've done this is because I'm knowing all this, knowing how governments are collaborating where there is no separation
[01:08:08.720 --> 01:08:15.720]  I'm putting together a class action lawsuit with other people that have had search warrants illegally processed and served
[01:08:15.720 --> 01:08:17.720]  Eddie do you mind if I...

[01:10:05.720 --> 01:10:13.720]  They need to have excellent probable cause to enter your house

[01:10:16.720 --> 01:10:19.720]  They have an open ticket
[01:10:19.720 --> 01:10:25.720]  Whether they, and this is an epidemic going on within APD, they're not even charging people
[01:10:25.720 --> 01:10:32.720]  They're just getting search warrants, busting down people's doors for fishing expeditions
[01:10:32.720 --> 01:10:37.720]  Just to see if they could find anything, if they don't find anything they might not even come up with charges
[01:10:37.720 --> 01:10:42.720]  Yeah and then they're stealing property and destroying property and everything else in the process
[01:10:42.720 --> 01:10:46.720]  And then they're not held accountable for any of the damage they do and the cost they've incurred
[01:10:46.720 --> 01:10:49.720]  Upon the individual they falsely raided
[01:10:49.720 --> 01:10:50.720]  I completely agree
[01:10:50.720 --> 01:10:53.720]  The war on drugs has got to stop
[01:10:53.720 --> 01:10:56.720]  The war on morons has to begin
[01:10:56.720 --> 01:11:01.720]  For sure
[01:11:01.720 --> 01:11:06.720]  So it's a sad thing, the war on drugs has done exactly what it was designed to do

[01:12:12.720 --> 01:12:18.720]  He has failed to enter a judgement in on my case
[01:12:18.720 --> 01:12:20.720]  Right
[01:12:20.720 --> 01:12:25.720]  On a civil infraction driver and without a seatbelt
[01:12:25.720 --> 01:12:31.720]  And I get a letter in the mail
[01:12:31.720 --> 01:12:35.720]  Letters in the mail saying that I defaulted, it's a default judgement
[01:12:35.720 --> 01:12:39.720]  So what I do was
[01:12:39.720 --> 01:12:45.720]  I filed a motion to correct the record
[01:12:45.720 --> 01:12:48.720]  I filed a motion to dismiss
[01:12:48.720 --> 01:12:51.720]  Because it's a bill of pains and penalties
[01:12:51.720 --> 01:12:57.720]  And I also filed a motion to void the judgement
[01:12:57.720 --> 01:12:58.720]  So
[01:12:58.720 --> 01:12:59.720]  Okay
[01:12:59.720 --> 01:13:03.720]  The first letter I ever received
[01:13:03.720 --> 01:13:08.720]  Was from the judge saying that he had entered no judgement
[01:13:08.720 --> 01:13:13.720]  So I decided to go and get the register of action
[01:13:13.720 --> 01:13:15.720]  To see what's all in the record
[01:13:15.720 --> 01:13:18.720]  And the funny thing about it is
[01:13:18.720 --> 01:13:21.720]  After I received the letter from the judge saying
[01:13:21.720 --> 01:13:25.720]  He didn't enter a judgement
[01:13:25.720 --> 01:13:29.720]  About two days later I received an overdue
[01:13:29.720 --> 01:13:33.720]  Notice to pay
[01:13:33.720 --> 01:13:37.720]  Threatening him to put a bench warrant out on me
[01:13:37.720 --> 01:13:40.720]  So I went to get the register of action
[01:13:40.720 --> 01:13:46.720]  I did not see where the judge entered his action
[01:13:46.720 --> 01:13:48.720]  With the court
[01:13:48.720 --> 01:13:50.720]  So
[01:13:50.720 --> 01:13:53.720]  But what I did see
[01:13:53.720 --> 01:13:59.720]  Was where the judgments had been
[01:13:59.720 --> 01:14:01.720]  Counseled out
[01:14:01.720 --> 01:14:04.720]  But then this thing jumps up
[01:14:04.720 --> 01:14:06.720]  And it's hot as a firecracker
[01:14:06.720 --> 01:14:09.720]  It's the last action that the court recognizes
[01:14:09.720 --> 01:14:12.720]  So what I had to do was
[01:14:12.720 --> 01:14:19.720]  I went and put the judge's letter in the motion
[01:14:19.720 --> 01:14:23.720]  And I put this bench warrant
[01:14:23.720 --> 01:14:25.720]  This threat against my liberty
[01:14:25.720 --> 01:14:27.720]  In a motion
[01:14:27.720 --> 01:14:30.720]  And filed it as a motion to dismiss
[01:14:30.720 --> 01:14:34.720]  As a motion to correct the record
[01:14:34.720 --> 01:14:36.720]  A motion to dismiss
[01:14:36.720 --> 01:14:39.720]  Just because it's a bill of pains and penalties
[01:14:39.720 --> 01:14:41.720]  So
[01:14:41.720 --> 01:14:44.720]  I thought it was kind of peculiar
[01:14:44.720 --> 01:14:46.720]  That the judge would send me a letter
[01:14:46.720 --> 01:14:49.720]  That wasn't registered
[01:14:49.720 --> 01:14:50.720]  With the court
[01:14:50.720 --> 01:14:52.720]  So
[01:14:52.720 --> 01:14:56.720]  Yeah, it would be peculiar alright
[01:14:56.720 --> 01:15:00.720]  So what I did was I went and filed it into the record form
[01:15:00.720 --> 01:15:03.720]  That's basically what I did with the motion to dismiss
[01:15:03.720 --> 01:15:05.720]  Smart move
[01:15:05.720 --> 01:15:06.720]  So
[01:15:06.720 --> 01:15:08.720]  I'm asking for a dismissal

[01:15:39.720 --> 01:15:42.720]  Move for a directed verdict in your favor
[01:15:42.720 --> 01:15:47.720]  Cite judicial malfeasance and corruption on the judge's part
[01:15:47.720 --> 01:15:52.720]  And if there's any criminal charges relating to intimidation of a witness
[01:15:52.720 --> 01:15:55.720]  Tampering with the record or anything of that nature
[01:15:55.720 --> 01:15:57.720]  Pile him on
[01:15:57.720 --> 01:15:59.720]  And I also
[01:15:59.720 --> 01:16:02.720]  When I first appeared in front of this judge
[01:16:02.720 --> 01:16:06.720]  I moved all proceedings beyond the record

[01:16:09.720 --> 01:16:12.720]  I don't see a transcript anywhere on there

[01:25:57.720 --> 01:26:01.720]  And from what I understand there's a big distinction between
[01:26:01.720 --> 01:26:06.720]  One who can enforce traffic law and one who cannot, am I correct?

[01:26:07.720 --> 01:26:17.720]  Police officers specifically defined in 541 as one authorized to enforce an arrest under the transportation statutes
[01:26:17.720 --> 01:26:20.720]  So the question becomes, how do they become authorized?
[01:26:20.720 --> 01:26:24.720]  Well, when you look at it where it says at the beginning of 543
[01:26:24.720 --> 01:26:29.720]  Any peace officer may arrest without war and any person found committing a violation of this subtitle
[01:26:29.720 --> 01:26:34.720]  We have to challenge what peace officer actually represents there and here's why
[01:26:34.720 --> 01:26:39.720]  Every single chapter of the transportation code that deals with enforcement
[01:26:39.720 --> 01:26:45.720]  Specifically designates the Department of Public Safety and its officers
[01:26:45.720 --> 01:26:49.720]  They are peace officers as defined in the penal code
[01:26:49.720 --> 01:26:57.720]  That however does not encompass every police officer or every officer acting as a police officer
[01:26:57.720 --> 01:27:02.720]  Because anyone else has to be authorized under the power of the Department of Public Safety
[01:27:02.720 --> 01:27:05.720]  According to the way I'm reading the statutes
[01:27:05.720 --> 01:27:11.720]  If every section on enforcement designates enforcement by the Department of Public Safety
[01:27:11.720 --> 01:27:17.720]  Then peace officer can only be referring to members of the Department of Public Safety
[01:27:17.720 --> 01:27:19.720]  Not just any cop
[01:27:19.720 --> 01:27:21.720]  Right
[01:27:21.720 --> 01:27:27.720]  And they also must be licensed under Texas occupation code and do continuing education, proficiency in firearms
[01:27:27.720 --> 01:27:31.720]  There's a whole laundry list of things that they've got to be
[01:27:31.720 --> 01:27:33.720]  To be a peace officer, yes
[01:27:33.720 --> 01:27:38.720]  But a police officer can simply be anyone that's been properly authorized
[01:27:38.720 --> 01:27:41.720]  A crosswalk guard is a police officer
[01:27:41.720 --> 01:27:44.720]  City code enforcement is a police officer
[01:27:44.720 --> 01:27:51.720]  But they are only allowed to police the specific thing they've been given authority over
[01:27:51.720 --> 01:27:56.720]  The crosswalk, code enforcement and nothing else
[01:27:56.720 --> 01:28:02.720]  That is exactly why a municipal cop cannot enforce code violations
[01:28:02.720 --> 01:28:06.720]  He can only back up the code enforcement officer
[01:28:06.720 --> 01:28:10.720]  Who is the only one authorized to enforce them

[01:36:53.720 --> 01:37:00.720]  Well, that depends on what's written into the terms of your lease agreement and the policy of the place you're living
