[00:53.120 --> 00:57.600] government is launching a second investigation into the Ferguson, Missouri, Police Department.
[00:57.600 --> 01:02.600] The focus will be on who the officers stop and search, how suspects are treated in jail,
[01:02.600 --> 01:04.480] and the department's officer training.
[01:04.480 --> 01:08.120] The investigation will be handled by the Justice Department's Civil Rights Division.
[01:08.120 --> 01:11.880] The news comes after weeks of protests following the police shooting of 18-year-old Michael

[01:15.040 --> 01:19.620] Jacob Lavaro, the 19-year-old man arrested in Williamson County, Texas, for possessing
[01:19.620 --> 01:23.280] and selling pot brownies, received his trial date this week.
[01:23.280 --> 01:27.340] Lavaro was originally facing life in prison, but the first-degree felony charges associated
[01:27.340 --> 01:31.960] with his case were dropped, quite possibly due to the massive outcry from local and national
[01:31.960 --> 01:33.440] activists and supporters.
[01:33.440 --> 01:37.900] Justin Armand, executive director of Texans for Accountable Government, is one said supporter.
[01:37.900 --> 01:41.240] He was present during the court proceedings and told the Liberty Bean that Jacob needs
[01:41.240 --> 01:45.480] public support as he still faces charges that could carry up to 20 years in prison.
[01:45.480 --> 01:49.360] Justin called Lavaro a peaceful young man who would be considered an entrepreneur in
[01:49.360 --> 01:50.360] Colorado.
[01:50.360 --> 01:54.680] Lavaro's court date has been set for December 1, with a pretrial date set for November 12

[13:27.580 --> 13:33.200] You can file an interlocutory appeal to have a decision on that one issue.
[13:33.200 --> 13:38.760] Once you get a favorable decision on that one issue, you bring that in to your main

[21:18.520 --> 21:21.040] started stating facts.
[21:21.040 --> 21:25.780] But it is not when they started stating facts.
[21:25.780 --> 21:31.840] They started stating facts when they gave their name, said who they were employed by,
[21:31.840 --> 21:39.400] what their position is, and there's nothing to validate that.
[21:39.400 --> 21:48.320] So in the legal language, the affian has not been affirmatively identified.
[21:48.320 --> 21:51.320] The affidavit fails.
[21:51.320 --> 21:53.200] Interesting.

[22:32.680 --> 22:37.000] familiar with ballistics, they go through his credentials and that sort of thing to
[22:37.000 --> 22:40.960] qualify him to testify, do they not?

[23:39.840 --> 23:45.680] So anytime somebody comes to an affidavit, you say, here, go here, start here and just
[23:45.680 --> 23:50.760] walk down these questions and they will ask you every pertinent question that goes to
[23:50.760 --> 23:53.280] the affidavit.
[23:53.280 --> 23:59.040] I've heard this about affidavits before and I haven't focused on them enough to get it
[23:59.040 --> 24:02.600] locked in my leaky brain.
[24:02.600 --> 24:04.600] You got one of those too?

[24:06.600 --> 24:10.440] And that's why I've been designing these tools.
[24:10.440 --> 24:17.800] So it's going to be very difficult to have a check off list.

[24:20.160 --> 24:29.200] Well, if we can start off with, did the alleged affiant state his or her name?
[24:29.200 --> 24:32.280] Did the affiant state who he or she works for?
[24:32.280 --> 24:41.240] No, did the affiant provide any evidence to support his assertion of identity, employment,
[24:41.240 --> 24:42.240] whatever?
[24:42.240 --> 24:49.220] You and I would understand that, but the common individual, somebody that's just searching
[24:49.220 --> 24:54.080] Google doesn't know daylight dark.
[24:54.080 --> 25:00.560] The real purpose of a nice, well-constructed questionnaire is really to teach them.
[25:00.560 --> 25:07.160] You want to ask them questions that causes him to say, I would have never thought of
[25:07.160 --> 25:08.560] asking that.
[25:08.560 --> 25:13.320] Or why did he ask this particular question at this time?
[25:13.320 --> 25:20.000] You're presuming or assuming that someone is intuitive enough.
[25:20.000 --> 25:29.200] In many cases, one just by happenstance comes across your questionnaire, then you're presuming
[25:29.200 --> 25:36.480] that they're intuitive enough for that to make that cognitive connection.
[25:36.480 --> 25:43.200] And I don't want to call the majority of Americans stupid, but there's YouTube evidence of it.
[25:43.200 --> 25:48.440] But our listeners are pretty much intuitive.
[25:48.440 --> 25:54.880] They at least know enough to go ferret stuff out for themselves, but the common individual
[25:54.880 --> 25:55.880] doesn't.
[25:55.880 --> 26:02.080] So the question is not for the ordinary, the general public.
[26:02.080 --> 26:08.480] This is for someone who is looking at their issue and an affidavit comes up.
[26:08.480 --> 26:17.840] And then you say, hey, you got this affidavit here, here's how you evaluate the affidavit.
[26:17.840 --> 26:24.060] If you sit down and if you're really good with affidavits, then you consider what would
[26:24.060 --> 26:29.760] be the first question I would ask someone about an affidavit.
[26:29.760 --> 26:34.640] And then what do I expect them to answer, yes or no, or whatever.
[26:34.640 --> 26:38.480] And then based on that answer, what would I ask them next?
[26:38.480 --> 26:43.600] Then the structure I use to develop one is I ask them a question.
[26:43.600 --> 26:52.040] I try to ask for a Boolean, a yes, no answer, and assume they always say yes to every question
[26:52.040 --> 26:54.860] I ask them.
[26:54.860 --> 26:59.360] And I question all the way out to the end of the last question I'd ask.
[26:59.360 --> 27:07.440] That's why I do this in a map, use one of these mind mapping programs, because then
[27:07.440 --> 27:11.200] I can see it.
[27:11.200 --> 27:17.840] Once you get to the end, you get to the last question you'd ask them, back up to the previous
[27:17.840 --> 27:21.120] question and assume they said no, what would you ask them then?
[27:21.120 --> 27:22.480] And then back up again.
[27:22.480 --> 27:27.840] When you get to the end of the first set of questions, you'll have 80% of everything.
[27:27.840 --> 27:32.680] You start backing up and they say no, you may ask one, two questions, then you go up
[27:32.680 --> 27:35.760] and pull the top section down and go back to the same place you were.
[27:35.760 --> 27:42.440] By the time you get back to the first question you ask, you have your whole expertise on
[27:42.440 --> 27:45.200] the subject mapped out.
[27:45.200 --> 27:50.520] Now when you come to a new piece of information, you can look at the map and say, I should
[27:50.520 --> 27:58.400] put a question right here and you drop that into place and you can take this expertise
[27:58.400 --> 28:06.000] and give it to somebody else and they can have access to your whole expertise.
[28:06.000 --> 28:14.040] So we need to get Jeff in touch with you, which Jeff, I'm sure you still got Randy's

[28:18.120 --> 28:23.000] If you have time, and for what you're doing with the credit thing, Jeff, I'd like you
[28:23.000 --> 28:31.360] to look at this, look at some of the questionnaires I've put together and try to do the questionnaires
[28:31.360 --> 28:42.760] on focused subjects and then we take those focused subjects and stitch them together.
[28:42.760 --> 28:49.040] Most of this, when I go through these, it finally became clear that the vast majority
[28:49.040 --> 28:56.520] of the issues most everybody has, there's a set of core issues, everybody's got them.
[28:56.520 --> 28:58.840] So I'm going to get to those somewhere.
[28:58.840 --> 29:04.480] So when I come to one the first time, we map it out and we put it over here in a map.
[29:04.480 --> 29:10.800] So I go to the next guy and he's got other issues, but he's going to get to this part.
[29:10.800 --> 29:14.960] And then when I get to that part, I just go grab that one and drop it in.
[29:14.960 --> 29:21.720] After a while, you're just pulling pieces you've already developed, drop them in.
[29:21.720 --> 29:30.320] You can map out a guy's issue really, really fast and put in front of him all of the information
[29:30.320 --> 29:38.560] that applies to his particular issue without him having to learn the whole field.
[29:38.560 --> 29:41.840] And that's been part of the problem with trying to help someone.
