[04:46.160 --> 04:52.760] sealed up to the court before which the defendant may be tried, writing his name across the
[04:52.760 --> 04:58.880] seal of the envelope. The voluntary statement of the defendant, the testimony, bail bonds,
[04:58.880 --> 05:03.840] and every other proceedings in the case shall be thus delivered to the clerk of the proper
[05:03.840 --> 05:17.220] court without delay. Now, I have never seen that this has ever been done and this is important
[05:17.220 --> 05:26.840] because the trial court cannot get jurisdiction until the magistrate has made a determination
[05:26.840 --> 05:36.440] of probable cause. And the way the trial court gets jurisdiction is by 1730. The magistrate
[05:36.440 --> 05:41.120] after a finding of probable cause must seal all the documents in an envelope, put his
[05:41.120 --> 05:46.880] name across the seal of the envelope, and forward it to the clerk of the court of jurisdiction.
[05:46.880 --> 05:55.040] And that must necessarily include the criminal accusation. When the court gets the criminal
[05:55.040 --> 06:00.720] accusation along with the finding of probable cause, which is evidenced by the order under
[06:00.720 --> 06:08.840] 16.17, now the trial court has jurisdiction. And the first thing the trial court will do,
[06:08.840 --> 06:16.680] once it gets jurisdiction, is hold an arraignment hearing. An arraignment hearing is a hearing
[06:16.680 --> 06:25.800] for the purpose of determining the identity of the accused and taking a plea. When you
[06:25.800 --> 06:30.720] go to court, especially traffic courts, they always call the first hearing an arraignment.
[06:30.720 --> 06:38.480] They say, whoa, Bubba, can't be an arraignment because you don't have jurisdiction yet.
[06:38.480 --> 06:43.880] When you sign the traffic ticket, if you'll look at it, you're not promising to appear
[06:43.880 --> 06:50.800] before a judge. I got a traffic ticket in Hazel, Texas. Went down to court. They called
[06:50.800 --> 06:55.160] my name and I went up and first thing I did was looked at the judge and looked at his
[06:55.160 --> 07:01.000] name and I said, Judge Edmond. I seem to remember Judge Edmond and Hazel, but I don't remember
[07:01.000 --> 07:07.120] him having that much gray hair. And the judge looked at me and said, well, Mr. Kelton, I
[07:07.120 --> 07:14.700] don't remember your belly being quite that big. Touché. But that was for the purpose
[07:14.700 --> 07:19.720] of letting him know that I wasn't too intimidated by him.
[07:19.720 --> 07:27.040] And then I told the judge, he asked me, how do I plea? I said, I don't yet. First, I
[07:27.040 --> 07:32.720] want you to hold an examining trial. Well, no, Mr. Kelton, I'm not going to hold an
[07:32.720 --> 07:37.600] examining trial. I said, well, your honor, I didn't agree to appear before a judge.
[07:37.600 --> 07:41.680] I agreed to appear before a magistrate. And the only thing a magistrate can do is hold
[07:41.680 --> 07:45.880] an examining trial. Well, Mr. Kelton, I'm not going to hold an examining trial. Well,
[07:45.880 --> 07:51.200] in that case, I want you to have that bailiff come over here and arrest you for Class A
[07:51.200 --> 07:57.080] misdemeanor, official misconduct, criminal, official oppression, the 30, violation 3903
[07:57.080 --> 08:01.900] Penal Code. No, Mr. Kelton, I'm not going to have the bailiff arrest me. When you can
[08:01.900 --> 08:09.080] arrest yourself. No, I'm not going to arrest myself. Point is, he could not have subject
[08:09.080 --> 08:16.600] matter jurisdiction. He's subject to personally being sued. The only time you can sue a judge
[08:16.600 --> 08:20.020] is when he acts without subject matter jurisdiction.
[08:20.020 --> 08:26.240] So the magistrate, after the examining trial, must seal all the documents. And that's
[08:26.240 --> 08:33.860] why the 16.17, there must be that order in there, because that's the order that gives
[08:33.860 --> 08:42.720] the trial court jurisdiction. But it doesn't get to the trial court yet. 17.31, duty of
[08:42.720 --> 08:48.700] clerks who receive such proceedings. If the proceedings be delivered to a district clerk,
[08:48.700 --> 08:53.900] he shall keep them safely and deliver them up to the next grand jury. If the proceedings
[08:53.900 --> 08:58.120] be delivered to a county clerk, he shall, without delay, deliver them to the district
[08:58.120 --> 09:08.840] or county attorney of his county. Now, this one violates Constitution because the Constitution
[09:08.840 --> 09:24.600] under 16, I forget, 16.5 per, I think it is, it requires that all criminal accusations
[09:24.600 --> 09:31.480] be brought by indictment. We're not going to go to that particular argument. It is enough
[09:31.480 --> 09:43.640] that the magistrate, after the examining trial, must file this order with the clerk of the
[09:43.640 --> 09:48.000] court in order for the court to get subject matter jurisdiction. That's essentially
[09:48.000 --> 09:56.000] due process as it goes to the magistrate and such. We'll probably do another show on
[09:56.000 --> 10:03.660] how it is actually done and what crimes they commit when they do it the way they do it.

[11:06.280 --> 11:12.600] got the road map from TxDOT, and he did the survey, and Tony Koch is very thorough, and
[11:12.600 --> 11:17.600] I mean very thorough. He spent a day at the land record just doing research on our property.
[11:17.600 --> 11:25.160] He took it all the way back. We want to put it up on the fence, and we contacted TxDOT
[11:25.160 --> 11:32.040] to let them, I mean, MCI, because we had our front of our property. They marked it. MCI
[11:32.040 --> 11:33.760] did. Quest did.
[11:33.760 --> 11:39.760] Wait a minute. Wait a minute. You're using acronyms, and we don't know what they mean.

[12:08.360 --> 12:12.920] their cables are, and because of where they were, we had to have the surveyor come back
[12:12.920 --> 12:20.720] and restate the entire front. He put stakes in, and then four-foot PVC pipes with ribbons
[12:20.720 --> 12:30.320] show where the property line was. MCI is several feet inside our property. Quest is on the
[12:30.320 --> 12:33.880] property line, one minute out. They're like a snake. One minute they're outside. The next
[12:33.880 --> 12:38.960] minute they're in. They have a jig box that runs dead center of our property line, half
[12:38.960 --> 12:47.760] in, half out. Contact both companies. Quest has ignored every phone call, and the technician
[12:47.760 --> 12:52.800] says they are going to move the cable, but from what I'm gathering, what they're trying
[12:52.800 --> 12:59.760] to do is see what MCI does. If they were to do an easement, then under Texas law, anybody
[12:59.760 --> 13:03.920] gets to use an easement, so Quest wouldn't have to move.
[13:03.920 --> 13:10.480] Okay, I have a question. Okay.
[13:10.480 --> 13:16.440] How long have they been on your property? Well, apparently since 88, but we learned
[13:16.440 --> 13:22.200] about it when we had the survey done. So they were there before you purchased the
[13:22.200 --> 13:28.920] property? Yes, and their permit says they are to be on their right-of-way and not on
[13:28.920 --> 13:37.640] private property, and every owner that sold the property stated in all their titles, there
[13:37.640 --> 13:46.160] is no easement on these properties. There is one problem here, and that's adverse
[13:46.160 --> 13:56.040] possession. Well, they're in violation of their permit.
[13:56.040 --> 14:01.920] What it may do is interfere with your claim against them if their lawyers are smart enough
[14:01.920 --> 14:05.400] to figure that out. Oh, yeah.

[14:09.320 --> 14:15.600] Well, what we did is we sent a letter to, well, Pat tried working with CI, because like
[14:15.600 --> 14:20.960] I said, Quest has not talked to us. First, they tried to do a back door to TVLB to get
[14:20.960 --> 14:28.680] TVLB to, such as that land board, to approve an easement, but we don't have a contract
[14:28.680 --> 14:36.160] for deed on that property. We have deed. Have you brought the patent forward?
[14:36.160 --> 14:40.360] Yes, we have. We got perfect title. Oh, they got a problem. You ought to go out
[14:40.360 --> 14:45.560] there with a ditch, which- Our substance is, it would be a try for title
[14:45.560 --> 14:52.600] if we had to go to court. Well, okay, here's the deal. Right now they
[14:52.600 --> 15:02.320] have it by adverse possession. So I suggest you go out there and call them and tell them
[15:02.320 --> 15:10.920] you're putting a fence in on the property line, and you want to make sure this fence
[15:10.920 --> 15:16.400] stays, so you're going to put in a foundation for this fence. And just how deep are your
[15:16.400 --> 15:23.040] lines, guys? If you don't want me cutting them, you might want to come and move them.
[15:23.040 --> 15:31.760] Well, like I said, the junction box for Quest is half in, half out. We've already told

[15:52.800 --> 15:58.440] tried to say that the drag line by Border Patrol, which they stopped doing two years
[15:58.440 --> 16:04.960] ago when we bought the property, because Kat called and talked Mr. Black, who was the second
[16:04.960 --> 16:12.960] in charge, and Sanderson for Border Patrol. Have you sent him a tort letter? Not a tort
[16:12.960 --> 16:18.600] letter. Pat talked to them. He's been emailing them. He got an email in saying they're going
[16:18.600 --> 16:23.400] to do a condemnation on our property now. If it turns out our survey's correct, because
[16:23.400 --> 16:30.520] they tried saying the survey was bad, but Pat told Mr. Law, Don Wheeler for MCI, said
[16:30.520 --> 16:35.400] his own surveyor said he wished he could work for someone like Tony Koch. Tony Koch was
[16:35.400 --> 16:42.720] that thorough. After that was when he tried going into MCI. They tried saying that it
[16:42.720 --> 16:48.640] was a road that we were putting our property line on, and it's not a road, the drag line
[16:48.640 --> 16:57.000] for Border Patrol. The vegetation's slowly coming back since they quit dragging it. Then

[23:29.960 --> 23:35.200] fence up, he said, just put it on the property line and I'll pay for half. But that's 18
[23:35.200 --> 23:39.920] acres on the north side of the fence. On the south side, the same problem. These are ranch
[23:39.920 --> 23:46.600] fences. They are not property line fences. And so there is a fence up several feet in,
[23:46.600 --> 23:52.120] but it's not on the property line. It was never meant to be. Across the street, there
[23:52.120 --> 23:59.440] are 16 feet that is actually the right of way of TechDot that's out because of where
[23:59.440 --> 24:06.480] the fence is. So the fences in this county are not on property line. And like I said,

[35:28.840 --> 35:34.880] behind my permit holders, which doesn't make me, that statement does not make me feel that
[35:34.880 --> 35:39.400] he's going to be fair, honest, and truthful.
[35:39.400 --> 35:43.400] Not at the permit holders outside the purview of the permit.
[35:43.400 --> 35:49.920] But it doesn't matter what TxDOT does. That's why you sue for a declaratory judgment. TxDOT's
[35:49.920 --> 35:53.760] not who makes that determination. That's what a judge does.

[36:16.680 --> 36:22.360] an engineer who's supposed to do a survey can say, no, he was off.
[36:22.360 --> 36:26.400] I don't know, I don't know if it would go to fraud. It would, it would certainly go
[36:26.400 --> 36:29.960] to misrepresentation of a material fact.

[37:14.600 --> 37:21.080] another's use. And they've taken that out of the statute, it's now theft. But, and
[37:21.080 --> 37:26.840] they put a fraud, they put in a special cause of action for that.

[38:41.800 --> 38:46.000] I don't know if I'd go to a criminal charge on that. It's certainly civil.

[52:58.480 --> 53:06.160] a monumental victory here in Colorado. It was the first TRO given in a federal court
[53:06.160 --> 53:13.080] based on a state matter, of course, bypassing the younger abstention.
[53:13.080 --> 53:14.080] Good.
[53:14.080 --> 53:23.600] Yep. So using ex parte. And then the judge was squarely in my favor and it seemed like
[53:23.600 --> 53:29.080] he was going to rule for me. And I don't know if he got pressured or what happened, but
[53:29.080 --> 53:34.480] he ended up ruling against me. I didn't in the federal court saying that I didn't have
[53:34.480 --> 53:42.000] standing due to a bankruptcy that I had filed prior. And the attorney that I had hired for
[53:42.000 --> 53:43.000] the bankruptcy.
[53:43.000 --> 53:46.320] How can you not have standing in a bankruptcy case?
[53:46.320 --> 53:53.880] It was chapter seven. And I guess you're supposed to put on your schedule B that you're going
[53:53.880 --> 54:02.120] to be doing future lawsuits. But at the time, I didn't have an enduring fact. I mean, the
[54:02.120 --> 54:05.400] only enduring fact that had occurred.
[54:05.400 --> 54:12.360] Okay. You're stipulating to something. You're making the affirmative statement. You're making
[54:12.360 --> 54:21.600] an admission that you have no remedy. There may be a remedy that you're not aware of.
[54:21.600 --> 54:27.880] So why would you want to stipulate to that? Why would you want to make that admission
[54:27.880 --> 54:31.240] that you have no remedy?

[54:34.920 --> 54:42.840] It worked out in my favor. I stipulated to an order authorizing sale because in Colorado,
[54:42.840 --> 54:48.640] we have what's called a rule 120 hearing. It's a non-judicial, it's a quasi non-judicial
[54:48.640 --> 54:56.440] hearing. You go before a judge and he can only rule on two things. Are you active military
[54:56.440 --> 55:00.600] or are you in default? And that's it. And anything else you come up with, he can...
[55:00.600 --> 55:09.360] Okay. That's not exactly what he rules on. He rules on whether or not a party has a right
[55:09.360 --> 55:16.480] to possession. He can't go to title or anything. And we're real familiar with the 120 hearings.
[55:16.480 --> 55:18.800] We always lose the 120 hearings.
[55:18.800 --> 55:24.800] Yeah, you always lose those. It's a foregone conclusion. And so I went to several, I studied
[55:24.800 --> 55:29.960] them. Nobody's winning here in Colorado. There's no lawyers out here that want to take your

[55:33.640 --> 55:39.400] Yeah, they know they're going to lose. And so it's so bad and so oppressive that it's

[55:44.160 --> 55:50.320] not going down like this. So it's been a constant dog fight every step of the way. Well, I did
[55:50.320 --> 55:55.040] the stipulated order authorizing sale and inserting a paragraph stating that I believe
[55:55.040 --> 56:00.800] it was unconstitutional. Basically, it was no contest to think that, you know, a moot
[56:00.800 --> 56:01.800] point.
[56:01.800 --> 56:07.000] Okay, wait, hold on. Let me ask you a question about the chapter seven. Did you claim the

[56:59.860 --> 57:06.920] is to determine what property goes back to a secured creditor and what property or what
[57:06.920 --> 57:12.120] debt associated with property is to be written off, okay?
[57:12.120 --> 57:23.200] So if there is no secured party or if the debt is unsecured, then you write it off.

[01:07:16.640 --> 01:07:25.240] have security interest in property, which is what all banks do when they come after
[01:07:25.240 --> 01:07:32.220] your house in a foreclosure. Now, how do they perfect, they, the secured party, how do they
[01:07:32.220 --> 01:07:39.080] perfect their security interest? You see, you can't just come to court and say, hey,
[01:07:39.080 --> 01:07:44.760] I've got an interest in this property, let me have it. This is real property we're
[01:07:44.760 --> 01:07:49.880] talking about. So you've got to go to the public record and see if somebody staked a
[01:07:49.880 --> 01:08:03.320] person. Okay, perfection, this is a uniform commercial code, section 9312, 9-312, perfection
[01:08:03.320 --> 01:08:10.920] of security interest in chattel paper, deposit accounts, documents, goods covered by documents,
[01:08:10.920 --> 01:08:21.960] instruments, instrument property, excuse me, letters of credit and money perfected by permissive
[01:08:21.960 --> 01:08:29.200] filing, pause, permissive filing means you go to the county recorders and you file your
[01:08:29.200 --> 01:08:40.560] claim with the county recorder and temporary perfection wit. Now, I'm going to paraphrase
[01:08:40.560 --> 01:08:47.160] this. What you're probably going to be most interested in reading is paragraphs E through
[01:08:47.160 --> 01:08:56.400] H, echo through hotel, E through H. E through G is kind of a pick your situation and H are
[01:08:56.400 --> 01:09:05.200] the consequences for not following this. What this section of law does is it allows a creditor,
[01:09:05.200 --> 01:09:12.700] a 20 day temporary perfection of their security interest, which gives them 20 days from the
[01:09:12.700 --> 01:09:22.860] time they acquire this interest, gives them 20 days to file their claim in the public
[01:09:22.860 --> 01:09:29.360] county recorders, along with the land records in the county recorders office. If they fail
[01:09:29.360 --> 01:09:37.880] within that 20 days to perfect their claim, then they are not going to be able to comply
[01:09:37.880 --> 01:09:47.440] with rule 3001 of the BK rule. Therefore, the property is unsecured and the debt can
[01:09:47.440 --> 01:09:54.960] be written off. Now, I've said all that with one question in mind. What are the chances
[01:09:54.960 --> 01:10:02.400] of reopening your BK 7? Okay, so that's what I wanted to explain to you. I was booted out
[01:10:02.400 --> 01:10:06.880] of the federal court, brought to the state court, brought before a corrupt judge. He
[01:10:06.880 --> 01:10:15.280] quickly ruled against me. You don't do that in a BK. No, no, no. Okay, let's stick with
[01:10:15.280 --> 01:10:22.280] the BK. My question is, what are the chances of reopening your BK 7? I already did. I opened
[01:10:22.280 --> 01:10:32.800] the chapter 7 to strip some liens. The U.S. things filed an entry of appearance, but they've
[01:10:32.800 --> 01:10:38.720] never filed a proof of claim, and they went and opposed my agreements when I came up with
[01:10:38.720 --> 01:10:49.160] the trustee to acquire the standing. And then they entered an under the table deal with
[01:10:49.160 --> 01:10:56.680] the trustee to acquire the standing for $10,000. So he named the agreement with me first, and
[01:10:56.680 --> 01:11:01.640] then he underhandedly made one with them. And the ruling on that is going to be on the
[01:11:01.640 --> 01:11:07.120] 26th, if there's nobody that opposes it. And I sent out letters to all the creditors, telling
[01:11:07.120 --> 01:11:12.520] them that they won't get any money. I'm going to win this case. I found proof of fraud.
[01:11:12.520 --> 01:11:20.320] The note, the deed of trust, the assignment, they're all forgeries. I have proof.
[01:11:20.320 --> 01:11:24.120] That's not going to do you any good in BK. I'll tell you that right now. It's not going
[01:11:24.120 --> 01:11:33.160] to do you any good in BK. You need to refile BK, claim the property is unsecured. You have
[01:11:33.160 --> 01:11:42.960] stipulated to standing of the claimant. You didn't make them prove it up.
[01:11:42.960 --> 01:11:47.560] If you have listed it as secured, you need to cure that. You need to fix that.
[01:11:47.560 --> 01:11:53.480] Okay. Let me tell you a quick story. Fort Worth, woman took direction, filed Chapter
[01:11:53.480 --> 01:11:58.800] 7, claimed the property is unsecured. The bank showed up with a bunch of paperwork.
[01:11:58.800 --> 01:12:04.800] They're talking to the judge. The client said, Your Honor, counsel here has this big
[01:12:04.800 --> 01:12:09.520] stack of paperwork that they're referencing in their statements. May I see them? And the
[01:12:09.520 --> 01:12:13.940] judge said, Counselor, show them to her. She looks at them. They're her copies of her
[01:12:13.940 --> 01:12:19.660] closing document. And she followed instruction well. She said, Your Honor, I've never seen
[01:12:19.660 --> 01:12:25.200] these documents before. And the judge said, Well, isn't that your signature on these
[01:12:25.200 --> 01:12:29.960] documents? No, Your Honor, I never signed these documents. I've never seen these before.
[01:12:29.960 --> 01:12:38.360] And she said the judge ground on her for about 10 minutes, but she didn't back down. And
[01:12:38.360 --> 01:12:47.240] she was telling the truth. These were supposedly true and accurate copies of documents they
[01:12:47.240 --> 01:12:53.220] claimed she had signed. Well, they may or may not have been true or accurate copies,
[01:12:53.220 --> 01:12:58.280] but whatever they were, she had never seen those documents before.
[01:12:58.280 --> 01:13:03.320] And she certainly didn't sign them. That was not her signature.
[01:13:03.320 --> 01:13:09.440] She said after about 10 minutes, the judge grinded on her. The judge smiled real big,
[01:13:09.440 --> 01:13:14.660] turned to the lawyers and said, Well, Counselor, it seems as though she's never seen these
[01:13:14.660 --> 01:13:23.000] documents before. You will have to bring the originals into my court. They set a hearing
[01:13:23.000 --> 01:13:27.320] lawyers didn't show up. They wrote off their claim.
[01:13:27.320 --> 01:13:35.840] Okay. With my hearing that I had recently, they were supposed to show up with the original,
[01:13:35.840 --> 01:13:39.720] but the state court judge would not release them because I wrote into the state court
[01:13:39.720 --> 01:13:45.640] judge an objection to letting them leave because a crime had been committed against me because
[01:13:45.640 --> 01:13:50.760] of the fraud. And then I wanted the sheriff to deliver it, not just US Bank to come pick
[01:13:50.760 --> 01:13:53.880] them up because they were all fraud. It was a crime against me.
[01:13:53.880 --> 01:13:56.440] Did you file criminal charges against him?
[01:13:56.440 --> 01:14:02.240] No, but he turned, listen to this, the state judge, the state judge, the same one who ruled
[01:14:02.240 --> 01:14:06.840] against me, he said, you know what, I'm going to err on the side of caution. And he said,
[01:14:06.840 --> 01:14:12.200] I'm going to turn this over to the district attorney and also to the local sheriff and
[01:14:12.200 --> 01:14:16.680] I'm not releasing the originals. So we only let them have copies. Okay.
[01:14:16.680 --> 01:14:26.420] Okay. Okay. Hold on. You need to file criminal charges with the prosecuting attorney. You
[01:14:26.420 --> 01:14:33.060] need to file a verified criminal affidavit because what most likely has happened to judge
[01:14:33.060 --> 01:14:38.640] called the prosecutor and said, Hey, you want to look this over? That invokes no duty on
[01:14:38.640 --> 01:14:43.120] the part of the prosecutor. File verified criminal affidavits and actually
[01:14:43.120 --> 01:14:46.380] Against who?
[01:14:46.380 --> 01:14:49.800] Against whoever committed the fraud. Okay.
[01:14:49.800 --> 01:14:59.960] And file it with a magistrate. Colorado law is almost identical to Texas law.

[01:40:11.540 --> 01:40:22.420] have jurisdiction because this first guy failed. And that's exactly why I'm suggesting that

[01:40:32.020 --> 01:40:41.860] jurisdiction of the court. When I went to the prosecuting attorney, to the county attorney,
