[00:39.940 --> 00:44.520]  protesters of firing shots and throwing Molotov cocktails at officers.

[00:48.520 --> 00:52.160]  since the August 9th shooting of 18-year-old Michael Brown.
[00:52.160 --> 00:56.320]  In the early morning hours of Monday, Missouri State Highway Patrol Captain Ronald Johnson
[00:56.320 --> 01:01.040]  held a press conference detailing what led officers to fire tear gas canisters before
[01:01.040 --> 01:02.920]  the midnight curfew began.
[01:02.920 --> 01:06.360]  Johnson said there was an unrelated shooting around 8.30 p.m.
[01:06.360 --> 01:10.800]  Shortly after the shooting, looting was reported at a local McDonald's to send Domino's Pizza.
[01:10.800 --> 01:14.360]  Captain Johnson stated that a large group of protesters began making their way to a
[01:14.360 --> 01:16.800]  police command center before the curfew.

[04:49.360 --> 04:53.340]  helped a friend out with an issue that he was having today, and had to deal with some
[04:53.340 --> 05:00.120]  police officers, and so on and so forth, it was an interesting kind of morning and afternoon.
[05:00.120 --> 05:05.240]  But let's just say nothing detrimental occurred, as far as anybody going to jail, or anything
[05:05.240 --> 05:10.520]  like that, though there are some issues that will have to be continued with at some point.
[05:10.520 --> 05:14.520]  Right now everybody's home and at least getting to do something they want to do instead of
[05:14.520 --> 05:17.480]  warding off somebody in a jail cell somewhere.
[05:17.480 --> 05:22.100]  But that being said, I am hoping that the calls that we take tonight are good news,
[05:22.100 --> 05:28.200]  or at least good questions dealing with issues that will lead to good news for everybody.
[05:28.200 --> 05:36.660]  Now folks, there are a lot of things going on in the communities today about what's going
[05:36.660 --> 05:37.780]  on in government.
[05:37.780 --> 05:43.920]  Everybody is up in arms about this, that, or the other, but no one still, even at this
[05:43.920 --> 05:50.180]  point, no one is focused on solving the problems at their source.
[05:50.180 --> 05:58.500]  Everybody still wants to tackle the individual issues, and I am hoping that eventually people
[05:58.500 --> 06:05.820]  will come to understand that that will not solve the problem any better than so-called
[06:05.820 --> 06:10.640]  modern medicine can cure a disease by treating the symptoms.
[06:10.640 --> 06:16.360]  If you don't go to the root cause of the problem, you're not solving it.
[06:16.360 --> 06:21.180]  If anything, you are prolonging it.
[06:21.180 --> 06:29.100]  And I am here to tell you there are two major focal points to those issues.
[06:29.100 --> 06:33.680]  One is the fact that those issues are framed by lawyers.
[06:33.680 --> 06:39.220]  The second is the fact that those lawyers are illegally taking over every department
[06:39.220 --> 06:44.200]  of government in every state of the union and writing the laws in such a way that they
[06:44.200 --> 06:50.860]  are the only ones that have any ability whatsoever to navigate them, or at least that's what
[06:50.860 --> 06:56.480]  they want us to believe, and for the most part, they are correct because not everybody
[06:56.480 --> 07:02.100]  is willing or able to take the time and effort to dedicate themselves to learning the sleight
[07:02.100 --> 07:08.480]  of hand, the legal mumbo jumbo, the tricks of the trade, and the outright corrupt nature
[07:08.480 --> 07:12.160]  of the system as it exists.
[07:12.160 --> 07:18.320]  We have a separation of powers clause for a reason, folks.
[07:18.320 --> 07:25.520]  That reason was entirely to prevent the kind of things that we're dealing with right now.
[07:25.520 --> 07:29.920]  We want to solve these problems, we have to start with our legislators.
[07:29.920 --> 07:36.100]  And we don't give them options, we don't ask their opinion, we don't say if you would only,
[07:36.100 --> 07:39.000]  we demand it.
[07:39.000 --> 07:44.560]  And we demand it while we stand in front of their desk with a railroad tie, a bucket of
[07:44.560 --> 07:50.000]  tar and a bag of feathers if we have to.

[07:54.340 --> 07:56.840]  We can't ask anymore.

[08:17.620 --> 08:23.240]  money because you didn't wear a certain colored tie that day, or didn't strap yourself into
[08:23.240 --> 08:28.040]  your moving road vehicle that day, or any other number of things that they're using
[08:28.040 --> 08:32.680]  to steal us blind.
[08:32.680 --> 08:35.380]  The cops are not the source of the problem.
[08:35.380 --> 08:38.400]  They're one of the symptoms.
[08:38.400 --> 08:41.680]  The people that suffer at the hands of the cops are not the problem.
[08:41.680 --> 08:46.200]  Well, in a way they are because they're not taking the initiative to go after the source
[08:46.200 --> 08:50.380]  any more than anyone else is.
[08:50.380 --> 08:58.560]  But until we do that, expecting anything to change is utter lunacy.
[08:58.560 --> 09:02.200]  It's just not going to happen.
[09:02.200 --> 09:05.640]  So when is enough going to be enough?
[09:05.640 --> 09:11.960]  When do the rights that you rightfully possess that are inherent in you from our Creator,
[09:11.960 --> 09:16.280]  when do they become important enough for you to stand up and go, you know what?

[09:18.280 --> 09:25.600]  I will not let you do this to me or anyone else any more.
[09:25.600 --> 09:32.600]  That last straw came from me way back in 2008 when it came to the state and their tax collection
[09:32.600 --> 09:35.360]  agencies for sales tax and things like that.
[09:35.360 --> 09:40.940]  And I learned a lot about it on the federal government side since way back in 1995.
[09:40.940 --> 09:46.120]  And I've been doing this at least since then as far as studying, reading, learning, challenging,
[09:46.120 --> 09:53.560]  getting answers, getting no answers and finding out how truly corrupt this system is, how
[09:53.560 --> 10:00.840]  truly ignorant most people are of what they've lost because they never had it.
[10:00.840 --> 10:05.840]  They didn't have it because they didn't grow up in a time when they, when it was allowed.
[10:05.840 --> 10:14.120]  Now their folks is a word that should never be used in relation to the people in a free
[10:14.120 --> 10:19.720]  country allowed.
[10:19.720 --> 10:31.920]  And yet the only way you do anything in America these days is because you're allowed to.
[10:31.920 --> 10:34.520]  What's wrong with this picture?
[10:34.520 --> 10:39.920]  Why are we so apathetic that we are so pathetic?
[10:39.920 --> 10:43.200]  This is ridiculous.
[10:43.200 --> 10:52.140]  No one in America should be having to teach their kids why they must never approach a
[10:52.140 --> 10:54.400]  police officer.
[10:54.400 --> 10:56.900]  Used to that was what you trained a kid to do.
[10:56.900 --> 11:03.540]  If something's wrong, if you have a problem, if you see something bad, find a police officer.
[11:03.540 --> 11:08.000]  Nowadays if a kid went looking for a police officer because he saw somebody getting mugged
[11:08.000 --> 11:12.600]  or robbed, the officer would throw the kid to the ground and write him a jaywalking ticket
[11:12.600 --> 11:16.960]  because he ran across the street waving his arms saying, help, help.
[11:16.960 --> 11:21.200]  That is how ridiculous we've let things get.
[11:21.200 --> 11:24.900]  The cops don't care about preventing crime or solving crime.
[11:24.900 --> 11:28.100]  They care about their jobs and their pensions.
[11:28.100 --> 11:36.840]  And they can only do that by running over you at the behest of those that control them.
[11:36.840 --> 11:41.000]  And here's the downside to this that really, really is going to make this bad.
[11:41.000 --> 11:46.960]  If we ever do decide to have to force a change, here's what we've done to really set ourselves

[11:49.760 --> 11:54.960]  We have allowed the very thing the state and federal constitutions absolutely forbid.
[11:54.960 --> 11:59.960]  We have allowed every municipality, every county and every state to establish a standing
[11:59.960 --> 12:04.720]  army called law enforcement.
[12:04.720 --> 12:06.800]  They're now becoming militarized.
[12:06.800 --> 12:13.240]  They have military equipment, military arms, and most of them love the idea of getting
[12:13.240 --> 12:16.360]  to use it.
[12:16.360 --> 12:17.500]  They just love it.
[12:17.500 --> 12:24.560]  They look forward to the day they get to draw a bead on somebody and pull the trigger.
[12:24.560 --> 12:29.680]  And all the good ones that would say no, at least to that degree, and I use good very
[12:29.680 --> 12:38.400]  loosely here, keep that in mind, are leaving because they can't survive in that environment.
[12:38.400 --> 12:41.520]  So what are we going to do?

[12:42.520 --> 12:43.520]  We can moan.
[12:43.520 --> 12:44.520]  We can complain.
[12:44.520 --> 12:47.960]  We can do all these things that don't accomplish anything.

[12:50.720 --> 12:55.560]  That thing about the squeaky wheel gets the grease, well, you misunderstand that little

[13:55.240 --> 14:01.160]  great grandfather who sold to both sides during the war, the Nazis and the US, he armed and
[14:01.160 --> 14:04.720]  moneyed both sides.
[14:04.720 --> 14:06.840]  What did he care who died?
[14:06.840 --> 14:08.440]  How many?
[14:08.440 --> 14:09.440]  How old?
[14:09.440 --> 14:10.440]  How young?
[14:10.440 --> 14:11.440]  What sex?

[14:12.440 --> 14:13.440]  Didn't care.
[14:13.440 --> 14:17.120]  He was getting wealthy off of the backs of those that would go to war and fight for an
[14:17.120 --> 14:22.520]  ideal that didn't really exist.
[14:22.520 --> 14:27.320]  And while I am a patriot in the sense that I believe in fighting for the rights of myself
[14:27.320 --> 14:31.520]  and my fellow man, I am no longer a patriot for a country.
[14:31.520 --> 14:39.760]  I am no longer and never again will be a patriot for a flag, never, because those are the things
[14:39.760 --> 14:48.400]  that are used to subvert humanity into doing things we ought not be doing to each other.
[14:48.400 --> 14:53.280]  They are what gets waved in front of us like a bone in front of a dog, like a carrot in
[14:53.280 --> 14:57.780]  front of a mule, to get the work out of us that they want.
[14:57.780 --> 15:01.360]  But that work is not for our benefit, it's for theirs.
[15:01.360 --> 15:08.400]  When are we going to wake up and understand that?
[15:08.400 --> 15:23.040]  Folks, I can't begin to explain how disheartened I am with the way Americans view things.
[15:23.040 --> 15:30.880]  We're developing into the most illiterate nation, the most apathetic nation, the most
[15:30.880 --> 15:35.280]  ill-informed nation of any on the planet.
[15:35.280 --> 15:43.080]  We've got a Department of Education whose sole emphasis is on destroying education.
[15:43.080 --> 15:47.960]  We've got a federal government whose sole emphasis is to destroy the very instrument
[15:47.960 --> 15:51.200]  that limits what it can do.
[15:51.200 --> 15:55.720]  We've got state governments doing exactly the same thing with the state instruments
[15:55.720 --> 16:00.600]  that say what they can and can't do.
[16:00.600 --> 16:06.080]  So when are the people going to stand up and say what we can and will do?

[16:09.540 --> 16:13.520]  Government has now gotten to the point where it believes that it has an inherent right
[16:13.520 --> 16:19.280]  to exist and do as it pleases.

[21:53.800 --> 21:58.000]  They've even broke the window out of one car on a young lady and yanked her out.
[21:58.000 --> 22:03.640]  Yeah, I think in that video the officer kind of put his hand on the window and she rolled
[22:03.640 --> 22:07.560]  it up on his fingers and then the window busted.
[22:07.560 --> 22:09.640]  She was rolling it up, but she didn't actually close it.
[22:09.640 --> 22:14.400]  It was about two inches from being closed when he yanked it and busted it.
[22:14.400 --> 22:16.400]  But anyway, please go ahead with your questions.
[22:16.400 --> 22:21.400]  Yeah, the question is, do you know what the outcome of that case was in court?
[22:21.400 --> 22:28.840]  No, I do not, because I don't recall specific names of the individuals that are in the video.
[22:28.840 --> 22:33.360]  You are talking about the young black woman that was pulled out of the car by the officer,
[22:33.360 --> 22:37.780]  the specific one with the broken window, or are you talking about the one in Florida specifically?
[22:37.780 --> 22:40.480]  I thought the one with the broken window was the one in Florida.
[22:40.480 --> 22:41.480]  The woman in Florida.
[22:41.480 --> 22:45.320]  Well, it's possible, but what I'm getting at is Florida seems to be one of the worst
[22:45.320 --> 22:49.420]  places for the officer aggression against an individual that asserts their rights.
[22:49.420 --> 22:53.280]  So when I say Florida, I've actually looked at dozens upon dozens, so I'm trying to make
[22:53.280 --> 22:55.240]  sure of the correct one.
[22:55.240 --> 23:00.160]  Yeah, it's definitely in Florida and it was definitely a young black woman and they definitely
[23:00.160 --> 23:02.060]  did break the window.
[23:02.060 --> 23:05.960]  I do not know the outcome, okay?
[23:05.960 --> 23:09.400]  Is that similar to the situation in your client's case?
[23:09.400 --> 23:10.400]  A little bit.
[23:10.400 --> 23:18.040]  The difference is the officer, in my client's case, he was mitten up, they lit him up, pull
[23:18.040 --> 23:19.040]  over.
[23:19.040 --> 23:23.360]  He used to roll his window down all the way, started off the same way with the one in Florida.
[23:23.360 --> 23:31.240]  The only difference is, to my client's benefit, is they never asked him for driver's license
[23:31.240 --> 23:34.400]  registration or insurance, they never got into it.
[23:34.400 --> 23:40.040]  The entire traffic stop, from the time that he was lit up, almost up until the time he
[23:40.040 --> 23:46.040]  was arrested, for about 10 to 15 minutes, it escalated from one officer in a patrol
[23:46.040 --> 23:53.560]  car to four patrol cars, nine officers in a helicopter, all centering on only roll your
[23:53.560 --> 23:55.880]  windows down all the way.
[23:55.880 --> 24:03.080]  And he rolled his window down about two inches, driver's window down about two inches, and
[24:03.080 --> 24:06.280]  they never said why they pulled him over, they just said, hey, two inches, that's not
[24:06.280 --> 24:08.560]  enough, roll it down all the way.
[24:08.560 --> 24:14.440]  And to make a long story short, the three officers that were material in this case was
[24:14.440 --> 24:20.480]  an officer that was a backup officer, and finally the officer, the sergeant, basically
[24:20.480 --> 24:24.360]  confirmed, okay, you've rolled your back window down enough, we can see no one else is in
[24:24.360 --> 24:30.280]  the car, you have no weapons, the only thing I think going against my client is his windows
[24:30.280 --> 24:36.080]  were tinted, pretty dark so that they couldn't see in, but he remedied that by rolling them
[24:36.080 --> 24:37.080]  down.
[24:37.080 --> 24:40.960]  And ultimately, they just said, hey, look, you're not gonna roll this down, we're gonna
[24:40.960 --> 24:44.480]  bust the windows and extract him in the car and arrest you, and that's exactly what happened.
[24:44.480 --> 24:48.480]  Now, he's been charged with two separate crimes.
[24:48.480 --> 24:54.640]  One is disobeying an order, and two is obstruction of justice.
[24:54.640 --> 24:57.480]  And he wants to fight the case, so I'm gonna fight the case.
[24:57.480 --> 25:02.080]  I've been trying to tell him that this is gonna be a roll of the dice with the jury,
[25:02.080 --> 25:06.880]  but I really wanna try the case, we're gonna go to trial more than likely, and I'm just
[25:06.880 --> 25:07.880]  trying to set him straight.
[25:07.880 --> 25:11.320]  I know he's called you a couple of times, and I think he got a little misguided, not
[25:11.320 --> 25:15.400]  by you, but just by the whole experience of trial and whatnot.
[25:15.400 --> 25:20.680]  Okay, so we still, just so I can be sure I'm clear, you still do not know exactly what
[25:20.680 --> 25:24.640]  the stop was initiated for?
[25:24.640 --> 25:27.880]  I know that now, we all know that now, because we've had a chance to look at the police reports.
[25:27.880 --> 25:28.880]  Okay.
[25:28.880 --> 25:32.400]  They allegedly stopped, yeah, they allegedly stopped him for three reasons.
[25:32.400 --> 25:37.260]  One, he was following the car in front of him too closely, which I highly doubt that
[25:37.260 --> 25:40.400]  that's the case, because I've never heard of anyone writing a ticket for that.
[25:40.400 --> 25:44.680]  And in fact, they didn't even write him a ticket for any of these three things I'm gonna
[25:44.680 --> 25:45.680]  mention.
[25:45.680 --> 25:52.280]  Two, that he had a defective brake light, which I also highly doubt, because we're gonna
[25:52.280 --> 25:57.160]  get a mechanic certification that looked at the car prior to the traffic stop and never
[25:57.160 --> 25:59.120]  noticed the brake light being out.
[25:59.120 --> 26:01.820]  And of course, again, they didn't cite him for that.
[26:01.820 --> 26:04.280]  And three, that he had expired tags.
[26:04.280 --> 26:08.600]  Now, it is true that someone took off his tag, but his registration was out.
[26:08.600 --> 26:12.280]  If a cop would have ran the place, they would have came back valid registration.
[26:12.280 --> 26:14.840]  He just had the tag.
[26:14.840 --> 26:21.480]  But to have an officer pull you over on the freeway and notice that your tag has expired
[26:21.480 --> 26:25.720]  while traveling on the freeway, and they weren't following him for too long a period of time,
[26:25.720 --> 26:29.120]  you know, I think I'm gonna try to raise enough doubt to say that this traffic stop should
[26:29.120 --> 26:33.440]  have never been made in the first place, and if I can pull that off, then the case will
[26:33.440 --> 26:35.400]  get thrown out before it even goes to trial.
[26:35.400 --> 26:40.200]  Well, what would you say if you could potentially do that based on other reasons?
[26:40.200 --> 26:44.520]  Sure, I'm open to anything.
[26:44.520 --> 26:53.440]  But the way I've seen a lot of these cases go in California is, first, you throw off
[26:53.440 --> 26:56.920]  traffic stop altogether by saying it's not a valid stop.
[26:56.920 --> 26:59.920]  If you can do that, it's case closed.
[26:59.920 --> 27:02.600]  If you can't do that, it would proceed to trial.
[27:02.600 --> 27:08.320]  You're suggesting there's another way to avoid this from going to trial, even though you
[27:08.320 --> 27:11.520]  fail to suppress the stop.
[27:11.520 --> 27:12.520]  I'm open to that.
[27:12.520 --> 27:14.320]  I think he's got a lot of interesting ideas.
[27:14.320 --> 27:19.920]  But what I see practically working in court is only those options.
[27:19.920 --> 27:25.200]  Now, you can come up with a lot of theories, and those would preserve a right to appeal.
[27:25.200 --> 27:27.120]  But the judges say, you know what, take that up on appeal.
[27:27.120 --> 27:29.160]  We're moving forward with trial.
[27:29.160 --> 27:32.160]  That's entirely possible.
[27:32.160 --> 27:36.240]  But just to interject on this, the reason I'm saying that is because have you verified
[27:36.240 --> 27:40.280]  what level of charge each of these three things are?
[27:40.280 --> 27:45.960]  Yes, all three of these alleged charges are traffic infractions.
[27:45.960 --> 27:46.960]  Infractions.
[27:46.960 --> 27:53.120]  Okay, that's your key word there, infraction.
[27:53.120 --> 27:57.720]  You are aware that California courts have already ruled, and the California statute
[27:57.720 --> 28:03.400]  specifically state that infractions are not crimes.
[28:03.400 --> 28:06.680]  That's correct, they're not crimes.
[28:06.680 --> 28:13.840]  So what probable cause could an officer have in a civil matter to seize an individual without
[28:13.840 --> 28:15.200]  a warrant?
[28:15.200 --> 28:20.120]  And how would he get a warrant, since a warrant requires probable cause of an actual crime
[28:20.120 --> 28:23.880]  to be stated before it can be issued?
[28:23.880 --> 28:27.200]  I hear you loud and clear, and I had a chance to listen to one of your podcasts.
[28:27.200 --> 28:29.600]  So now we're getting to the crux of the issue.
[28:29.600 --> 28:36.380]  You are correct that the three infractions he was cited for are not arrestable offenses,
[28:36.380 --> 28:37.960]  they are not criminal.
[28:37.960 --> 28:42.240]  The worst that would have happened is he would have said, okay, I don't agree to any of these
[28:42.240 --> 28:46.000]  three things happening, but you want to go ahead and write me a ticket, write me a ticket.
[28:46.000 --> 28:49.240]  I'm not rolling the window down all the way, stick it through the window and I'll be on
[28:49.240 --> 28:50.240]  my way.

[28:51.240 --> 28:54.540]  Well, but the thing is, what I'm getting at is they had no authority to pull him over
[28:54.540 --> 28:56.040]  in the first place.
[28:56.040 --> 29:00.280]  They never had the right to activate their lights and pull him over.
[29:00.280 --> 29:03.040]  The infraction does not authorize them to do that.
[29:03.040 --> 29:06.360]  And you've got tons of California case laws, my understanding, and I've actually seen at
[29:06.360 --> 29:11.280]  least one case of it, I don't have it, but a guy sent me the excerpt out of it.
[29:11.280 --> 29:14.680]  But it specifically says that it's not criminal.
[29:14.680 --> 29:17.460]  An officer does not have the power of arrest.
[29:17.460 --> 29:21.840]  He cannot even detain because there's no criminal suspicion.
[29:21.840 --> 29:24.520]  There's no probable cause.
[29:24.520 --> 29:30.440]  The stop itself from the very beginning was illegal under California statute.
[29:30.440 --> 29:34.360]  Everything after that is fruit of the poison tree, right?

[34:06.560 --> 34:12.360]  That would mean not talking to the officers at all, but that would also encompass not
[34:12.360 --> 34:18.360]  providing any sort of physical information to the officer as well if that information
[34:18.360 --> 34:23.360]  could potentially incriminate him or be used against him in court, correct?
[34:23.360 --> 34:24.360]  Correct.
[34:24.360 --> 34:25.360]  Okay.
[34:25.360 --> 34:31.520]  But the fact that he did not wish to engage the officers for that purpose is an invocation
[34:31.520 --> 34:32.520]  of his right.
[34:32.520 --> 34:34.440]  He's not even required to say it.
[34:34.440 --> 34:38.780]  And we know that there's a recent Supreme Court case out there that says that once you
[34:38.780 --> 34:44.520]  start answering questions, your right to remain silent pretty well goes right out the window
[34:44.520 --> 34:49.480]  because everything you said up to that point can still be used against you and the fact
[34:49.480 --> 34:56.600]  that you refuse to answer questions can now be used against you.
[34:56.600 --> 34:59.200]  You heard about that case, right?
[34:59.200 --> 35:01.880]  Actually I don't believe that that is the case.
[35:01.880 --> 35:05.760]  Now I know that there are cases where you can invoke your right to remain silent at
[35:05.760 --> 35:11.760]  any time and refusing to answer questions beyond your invocation, I don't think that
[35:11.760 --> 35:12.760]  would be the case.
[35:12.760 --> 35:16.920]  In this particular, the case I'm describing, this was the scenario.
[35:16.920 --> 35:20.620]  The guy was being interrogated, he had been arrested and he was being interrogated for
[35:20.620 --> 35:23.680]  involvement in a murder.
[35:23.680 --> 35:28.240]  And he was freely answering questions up to the point where one of the officers asked
[35:28.240 --> 35:36.000]  him if he was the one or knew of who had actually pulled the trigger and the guy suddenly clammed
[35:36.000 --> 35:37.600]  up and demanded his lawyer.
[35:37.600 --> 35:41.320]  Well, when that went to trial, they used that information and when it got all the way up
[35:41.320 --> 35:45.980]  to the Supreme Court, the Supreme Court ruled that by answering the questions initially,
[35:45.980 --> 35:49.120]  the fact that he then clammed up could be used against him.
[35:49.120 --> 35:54.520]  Fair enough, I hadn't heard of that case, do you know the site of that?
[35:54.520 --> 35:57.280]  I can find it, it's not hard to do.
[35:57.280 --> 36:02.280]  All you gotta do is look up Supreme Court says the right to remain silent no longer
[36:02.280 --> 36:04.280]  exists.
[36:04.280 --> 36:07.160]  Okay.
[36:07.160 --> 36:11.200]  But I can find it again, that's not too hard to do.
[36:11.200 --> 36:17.080]  But in any case, please go ahead, whatever I have stepped on so far, get it out there.
[36:17.080 --> 36:18.080]  Okay.
[36:18.080 --> 36:25.040]  Well, you brought up an interesting comment about no power to detain or arrest.
[36:25.040 --> 36:32.720]  My understanding is in California, if a police officer observes someone running a red light,
[36:32.720 --> 36:37.840]  beating or running a stop sign and they go ahead and light the person up and the person
[36:37.840 --> 36:46.880]  refuses to pull over, that could create a scenario whereby they go from a traffic infraction
[36:46.880 --> 36:51.160]  to a crime because they would be felony evading.
[36:51.160 --> 36:58.600]  So I think what got the client in this case confused is that when he was lit up, he pulled
[36:58.600 --> 36:59.600]  over.
[36:59.600 --> 37:03.720]  But to suggest to him that he does not have to pull over, that might be in conflict with
[37:03.720 --> 37:09.320]  how the courts do things in California because if someone refuses to pull over, eventually
[37:09.320 --> 37:15.480]  they can use force to make him pull over and take him in and you see a lot of the TV.
[37:15.480 --> 37:20.060]  That's true, but there is case law in the books that says, now true, you can't recklessly
[37:20.060 --> 37:25.280]  endanger others when you do this, but that we do have the right to resist an unlawful
[37:25.280 --> 37:26.280]  arrest.
[37:26.280 --> 37:27.280]  Now I'm not saying your client was doing that.
[37:27.280 --> 37:30.300]  I'm just putting that out there for you to look up and check.
[37:30.300 --> 37:34.320]  But there is case law in the books that says we have the absolute right to resist an unlawful
[37:34.320 --> 37:35.320]  arrest.
[37:35.320 --> 37:38.240]  Whether the state likes it or not, we have it.
[37:38.240 --> 37:42.440]  But the point here is, and you are correct, if he pulled over, that's not going to fly
[37:42.440 --> 37:44.180]  as an excuse.
[37:44.180 --> 37:49.240]  And if you've got the video from the police cruiser to countermand that accusation, that's
[37:49.240 --> 37:51.920]  a no win statement for them.
[37:51.920 --> 37:55.840]  Yeah, here's the argument they would make.
[37:55.840 --> 38:01.200]  But I think the first point is, he was under the belief from your show, he might have misinterpreted
[38:01.200 --> 38:06.640]  or maybe you could set the record straight, but in California, if a police officer lights
[38:06.640 --> 38:13.280]  you up and you don't pull over, at some point they can arrest you for evading.
[38:13.280 --> 38:16.000]  Yeah, that's entirely possible.
[38:16.000 --> 38:17.000]  Okay.
[38:17.000 --> 38:22.000]  I'm not saying that that's not, I mean, because once you start doing something else that's
[38:22.000 --> 38:27.400]  no longer the infraction, yeah, of course they can intercede.
[38:27.400 --> 38:33.080]  Yeah, but even if you only run the red light or you only commit the speeding or you only
[38:33.080 --> 38:38.040]  run the stop sign and they light you up and you, from that point forward, obey all traffic
[38:38.040 --> 38:42.480]  laws that you just don't pull over and they're following you for 20 minutes and now they
[38:42.480 --> 38:46.720]  got a helicopter and five cars on you, he was led to believe, oh no, they still have
[38:46.720 --> 38:47.720]  no right to pull you over.
[38:47.720 --> 38:51.640]  And I was trying to tell him- Well, technically, in a lawsuit aspect, that
[38:51.640 --> 38:52.640]  is correct.
[38:52.640 --> 38:53.640]  They don't.
[38:53.640 --> 39:01.040]  But from a safety aspect, especially in California, as we should well know after all the Chris
[39:01.040 --> 39:04.600]  Donner and all the other, or I'm sorry, what was his name?
[39:04.600 --> 39:07.760]  Yeah, there was a Donner who was a police officer.
[39:07.760 --> 39:08.760]  Yeah.
[39:08.760 --> 39:11.080]  They're shooting up innocent people's cars.
[39:11.080 --> 39:13.480]  What the hell are they going to do with one they've actually decided they're going to
[39:13.480 --> 39:15.500]  chase?
[39:15.500 --> 39:17.920]  You're taking your life in your hands by not pulling over.
[39:17.920 --> 39:22.840]  The thing is, in California, my recommendation is pull over anyway, because as long as it's
[39:22.840 --> 39:26.120]  a trafficking fraction, that stops illegal.
[39:26.120 --> 39:29.240]  Take them to court and sue them for that, but don't run from them.
[39:29.240 --> 39:30.800]  Okay, got it.
[39:30.800 --> 39:32.480]  So we got the record straight on that.
[39:32.480 --> 39:38.120]  So if he gets lit up, even if it's an invalid allegation of a trafficking fraction, the
[39:38.120 --> 39:39.480]  right thing to do is to still pull over.
[39:39.480 --> 39:41.200]  So we're on the same page there.
[39:41.200 --> 39:45.960]  He did that and they came up to him and said, roll out the window.
[39:45.960 --> 39:50.760]  Now his one handicap here is his windows were tinted.

[40:02.520 --> 40:06.360]  Well, now here's the other thing though, keep this in mind as a point of defense.
[40:06.360 --> 40:11.680]  They've never shown that his windows violated the tint rules, did they?
[40:11.680 --> 40:14.920]  They didn't make a statement that they were darker than allowed by law or anything like
[40:14.920 --> 40:16.080]  that.

[40:17.800 --> 40:21.000]  So the fact that they're tinted in that case is simply irrelevant.
[40:21.000 --> 40:23.840]  He just didn't like the fact that he couldn't see into the car.

[40:40.720 --> 40:45.560]  And the issue here is does the officer have a safety interest to say, hey, I got to have
[40:45.560 --> 40:48.680]  you roll the windows down enough to be able to see through the car.
[40:48.680 --> 40:52.280]  We get past that issue because he did go ahead and say, okay, I'm rolling down the windows.
[40:52.280 --> 40:53.280]  And he did roll down the windows.
[40:53.280 --> 40:58.260]  And it got to the point where the sergeant was actually having a three-minute conversation
[40:58.260 --> 41:03.440]  with him and even said on the radio back to the headquarters, hey, a single male black
[41:03.440 --> 41:06.960]  in the car refusing to roll down windows down all the way.
[41:06.960 --> 41:07.960]  So that's where they are.
[41:07.960 --> 41:14.040]  Now, the two criminal charges he's charged with is refusing to obey an order and obstruction
[41:14.040 --> 41:15.040]  of justice.
[41:15.040 --> 41:21.920]  Now, on the refusal to obey an order, that's when we cross the line from a traffic infraction
[41:21.920 --> 41:24.880]  to a crime, an allegation of a crime.
[41:24.880 --> 41:25.880]  That's what he's been charged with.
[41:25.880 --> 41:31.620]  Now, I suppose in the future, if he runs into a situation like that again, he might be better
[41:31.620 --> 41:34.240]  off just rolling the windows down all the way and say, okay, I'm rolling the windows
[41:34.240 --> 41:37.240]  down all the way, but go ahead and write me the ticket if you want to.
[41:37.240 --> 41:38.240]  And then he'll fight the ticket.
[41:38.240 --> 41:41.120]  And if he beats the ticket, then he can file a lawsuit.
[41:41.120 --> 41:42.120]  Okay.
[41:42.120 --> 41:47.720]  Is there a California statute that says the officer's safety concern trumps the one in
[41:47.720 --> 41:50.320]  the car's safety concern?
[41:50.320 --> 41:55.680]  See, the problem here is the officer thinks rolling down the windows is a lawful order.
[41:55.680 --> 41:56.680]  It's not.
[41:56.680 --> 42:01.040]  There's nothing that allows him to order you to roll down your car and compromise your
[42:01.040 --> 42:04.200]  safety in sake for his.
[42:04.200 --> 42:09.400]  Nor can he say roll down your windows so that I can look around the interior car to see
[42:09.400 --> 42:13.040]  if there's something I can spot to accuse you of.
[42:13.040 --> 42:14.520]  That's a Fifth Amendment violation.
[42:14.520 --> 42:18.800]  If he can't see in, that's not your problem as long as the reason he can't see in is not
[42:18.800 --> 42:20.800]  illegal.
[42:20.800 --> 42:25.560]  I think those are great points and I think that's what's going to be brought to the jury.
[42:25.560 --> 42:27.680]  The issue is, was this a valid order?
[42:27.680 --> 42:28.760]  That's the crux of this case.
[42:28.760 --> 42:32.620]  But I just want you to be aware, I was surprised about this myself.
[42:32.620 --> 42:40.920]  There is a U.S. Supreme Court case, Pennsylvania v. MIM, 98 Supreme Court 330, 1977, which
[42:40.920 --> 42:49.120]  stated that if an officer orders you to get out of the car and you refuse, that can create
[42:49.120 --> 42:50.200]  an issue.
[42:50.200 --> 42:55.280]  In Pennsylvania v. MIM, the person complied with the order and said, hey, they should
[42:55.280 --> 42:57.000]  have never told me to get out of the car in the first place.
[42:57.000 --> 43:01.240]  And as a result, the officer saw a bullet, did a pass down, found a weapon, charged him
[43:01.240 --> 43:05.280]  with carrying a concealed weapon, and the defense lawyer in that case successfully argued
[43:05.280 --> 43:09.680]  at the trial level, hey, that's not a valid order to tell somebody to get out of the car.
[43:09.680 --> 43:11.800]  I want the gun suppressed.
[43:11.800 --> 43:14.600]  And the court ruled in the defense lawyer's favor.
[43:14.600 --> 43:18.600]  Unfortunately, it did go all the way to the U.S. Supreme Court and they said the safety
[43:18.600 --> 43:24.380]  of the officer does trump, and they didn't use the word, trumps the safety of the driver,
[43:24.380 --> 43:31.800]  but basically stated trumps the privacy rights of the driver to stay in the driver's seat.
[43:31.800 --> 43:33.320]  So that's just the side note.
[43:33.320 --> 43:34.320]  It doesn't apply in...
[43:34.320 --> 43:35.320]  Yeah.
[43:35.320 --> 43:37.520]  But again, that's to get out of the car.

[46:59.200 --> 47:03.040]  I noticed with the woman in Florida is when they kept telling her to roll the windows
[47:03.040 --> 47:07.280]  down, finally he said, okay, get out of the car, and she refused to get out of the car.
[47:07.280 --> 47:11.880]  So it's kind of funny that we have this horrible rule out there that these officers can at
[47:11.880 --> 47:16.120]  any time order you to get out of the car, yet they're not capitalizing on it or taking
[47:16.120 --> 47:17.120]  advantage of it.
[47:17.120 --> 47:18.120]  So I disagree with the rule.
[47:18.120 --> 47:19.120]  I don't think it's a fair rule.
[47:19.120 --> 47:21.600]  I think people should be able to stay in their car.
[47:21.600 --> 47:27.080]  But an observation I'm making is that officers typically don't utilize that to make their
[47:27.080 --> 47:30.120]  case for obstruction or disobeying an order.
[47:30.120 --> 47:33.160]  And in my client's case, they never ordered him to get out of the car.
[47:33.160 --> 47:35.560]  They only ordered him to roll the windows down all the way.
[47:35.560 --> 47:40.320]  That's what he was being arrested for, and that's what led to the obstruction or delay.
[47:40.320 --> 47:43.440]  And in the police report, they never specifically stated what justice he obstructed.
[47:43.440 --> 47:46.560]  We can only assume it prevented him from writing a ticket.
[47:46.560 --> 47:50.200]  However, they never tried to write him a ticket, and even if they did, they could have handed
[47:50.200 --> 47:51.840]  it to him through the window.
[47:51.840 --> 47:52.840]  Exactly.
[47:52.840 --> 47:57.760]  They cannot argue that he obstructed their ability to do what they stopped him for.
[47:57.760 --> 48:00.280]  That's exactly the point.
[48:00.280 --> 48:03.080]  That is exactly the point.
[48:03.080 --> 48:07.600]  I think one of the arguments that the prosecutors may make is, well, come on, he wanted to get
[48:07.600 --> 48:11.600]  the guy's driver's license, registration, and insurance, and without that, he couldn't
[48:11.600 --> 48:12.600]  write a ticket.
[48:12.600 --> 48:15.720]  But the counter to that is, hey, you never actually asked him for it.
[48:15.720 --> 48:16.720]  Yeah.
[48:16.720 --> 48:21.280]  Not only is that one counter, the other one is, can any of the information that the officer
[48:21.280 --> 48:24.840]  was demanding be used against my client in a court of law to potentially incriminate
[48:24.840 --> 48:26.840]  him in any way?
[48:26.840 --> 48:30.320]  For instance, if he handed him an expired license or expired insurance, they could have
[48:30.320 --> 48:32.880]  charged him with something else, right?
[48:32.880 --> 48:33.880]  That's right.
[48:33.880 --> 48:34.880]  Okay.
[48:34.880 --> 48:40.040]  So how can they say that you're required to provide this when the statute is in violation
[48:40.040 --> 48:43.120]  of a protected, unalienable right when it demands that you do so?
[48:43.120 --> 48:47.680]  It's requiring that you waive a right to exercise their so-called privilege.
[48:47.680 --> 48:50.880]  And there's case law that says that can't happen.
[48:50.880 --> 48:56.920]  You cannot compel anyone to waive a right to exercise a privilege for any reason.
[48:56.920 --> 48:57.920]  Yeah.
[48:57.920 --> 49:01.000]  I mean, I think another thing a defendant can do or a driver could do is just say, look,
[49:01.000 --> 49:02.000]  I don't have it.
[49:02.000 --> 49:03.000]  And then you're not refusing.
[49:03.000 --> 49:04.000]  You're just not providing it.
[49:04.000 --> 49:05.000]  Exactly.
[49:05.000 --> 49:10.680]  It turns out in this case, he did not have anything incriminating.
[49:10.680 --> 49:15.000]  The first counter is they never asked him for it.
[49:15.000 --> 49:18.480]  So I think their argument is going to be, hey, we didn't bother to get to the point
[49:18.480 --> 49:19.880]  asking for registration insurance.
[49:19.880 --> 49:21.720]  We couldn't even get cash rolled out of the window.
[49:21.720 --> 49:27.120]  So in the end, I think it's a case that I'll be comfortable with with a jury, but what
[49:27.120 --> 49:32.080]  I was trying to point out to them is it's not a slam dunk in front of the judge because
[49:32.080 --> 49:38.040]  the law is kind of gray in this area because the violation is refusing to obey an order.
[49:38.040 --> 49:40.560]  The gray area is what is a valid order.
[49:40.560 --> 49:41.560]  We know...
[49:41.560 --> 49:42.560]  Exactly.
[49:42.560 --> 49:43.560]  US Supreme Court.
[49:43.560 --> 49:44.560]  Yeah.
[49:44.560 --> 49:49.720]  And I've actually, on my Facebook page, I actually did a dissertation on lawful orders.
[49:49.720 --> 49:54.800]  And one of the primary arguments I make is it is not a lawful order unless it has a lawful
[49:54.800 --> 49:56.920]  purpose.
[49:56.920 --> 49:57.920]  That's simple.
[49:57.920 --> 50:01.800]  Otherwise, any arbitrary statement out of an officer's mouth could be construed as an
[50:01.800 --> 50:04.000]  order, whether it actually is valid or not.
[50:04.000 --> 50:05.000]  That's right.
[50:05.000 --> 50:07.320]  He could say, get out of the car and start break dancing.
[50:07.320 --> 50:09.320]  That cannot be a valid order.
[50:09.320 --> 50:10.320]  Exactly.

[50:11.320 --> 50:17.880]  So again, I think he cleared up a few things about pulling over and whatnot.

[51:41.680 --> 51:45.560]  a health problem or whatever, he wouldn't be able to make the first trial.
[51:45.560 --> 51:50.600]  So they were granted a continuance and then this is back on June 26th.
[51:50.600 --> 51:55.720]  So the arraignment was last Thursday or the pretrial hearing was last Thursday and then
[51:55.720 --> 51:57.240]  today was supposed to be the jury trial.
[51:57.240 --> 52:03.440]  Well, I go in there today at 830 in the morning is when it was supposed to be, I show up an
[52:03.440 --> 52:07.760]  hour early, the door is open, I go in and sit down and the bailiff comes up and asks
[52:07.760 --> 52:12.360]  me what do I need today?
[52:12.360 --> 52:18.880]  And I told him, I'm here for a jury trial and he said, oh no, you've been rescheduled
[52:18.880 --> 52:20.880]  to Wednesday.
[52:20.880 --> 52:29.420]  Now there was no, whenever the continuance was given previously, a new notice to appear
[52:29.420 --> 52:33.960]  was generated and filled out and signed by myself, the state's attorney and obviously
[52:33.960 --> 52:36.960]  the judge and some other folks.
[52:36.960 --> 52:40.240]  But that never happened this time.
[52:40.240 --> 52:43.680]  Obviously when I went in on Thursday, that didn't happen.
[52:43.680 --> 52:53.600]  And the judge is claiming that he said that my jury trial date is now on a Wednesday.
[52:53.600 --> 52:57.840]  Wait a minute, the bailiff's claiming or the judge is claiming?
[52:57.840 --> 53:00.560]  The judge sent the bailiff out to tell me that.

[54:28.200 --> 54:29.200]  the time.
[54:29.200 --> 54:32.920]  So, um, so what, what am I looking at now?
[54:32.920 --> 54:39.120]  I mean, what, uh, well, the thing is if, what have they done?
[54:39.120 --> 54:43.000]  They told you that you were supposed to have a jury trial and they said, it's set for this
[54:43.000 --> 54:45.000]  day after tomorrow.

[54:46.000 --> 54:47.000]  Okay.
[54:47.000 --> 54:52.160]  Then there's nothing in the record saying that then call them and tell them to send

[55:00.860 --> 55:05.460]  to me, no notice was given of the change, nothing, not even a phone call, which I wouldn't
[55:05.460 --> 55:10.660]  have accepted as notice, but still, so I need something in writing saying that my case has
[55:10.660 --> 55:13.840]  been changed from Monday to Wednesday.

[55:15.480 --> 55:22.080]  And then if that doesn't happen, um, what would, what would be the next step?
[55:22.080 --> 55:27.260]  I mean, well, then the thing about it is you don't have anything except the last signed

[55:30.080 --> 55:33.760]  So it's kind of up to you, whether you're not, whether or not you show up on Wednesday,

[01:13:10.560 --> 01:13:11.560]  They won't hear an appeal.
[01:13:11.560 --> 01:13:15.880]  In other words, Texas law is set up where as long as you get fined less than a hundred
[01:13:15.880 --> 01:13:20.800]  dollars, you have no recourse but to pay, or they'll take it from you by force again
[01:13:20.800 --> 01:13:25.080]  because you cannot appeal it regardless of anything else, no matter how many due process
[01:13:25.080 --> 01:13:27.080]  violations existed.
[01:13:27.080 --> 01:13:32.940]  So your only hope is to get a fine in excess of a hundred dollars at trial or to raise
[01:13:32.940 --> 01:13:39.800]  constitutional issues or to raise jurisdictional issues that can't be ignored later.

[01:36:32.980 --> 01:36:37.460]  The person is arguing in violation of the use of the terminology because it requires

[01:36:42.160 --> 01:36:46.700]  using that terminology as if that's the only way for the case to go and we know darn well
[01:36:46.700 --> 01:36:49.960]  it isn't.
[01:36:49.960 --> 01:36:56.160]  So you cannot count on the courts to do the right thing, not at this day and age.
[01:36:56.160 --> 01:36:59.960]  That's one of the reasons why we have to go to the source of what's causing this problem.
