[04:31.680 --> 04:35.740]  And I finally found a site that addressed the issue relatively well.

[04:38.900 --> 04:46.660]  And when I went through the short sale issues, I was really surprised at some of the things
[04:46.660 --> 04:50.580]  I saw in there to look for.

[05:20.140 --> 05:26.060]  There's a lot more things that you had to look for than I would have thought.

[05:29.940 --> 05:36.340]  It's recommended that you use a realtor familiar with short sales, and as you go through this,
[05:36.340 --> 05:42.100]  it'll become real clear why you need a realtor that really knows what's going on.
[05:42.100 --> 05:47.220]  The realtor will be responsible for collecting, preparing, and sending required short sale
[05:47.220 --> 05:50.940]  documents, including a preliminary HUD-1 settlement statement.
[05:50.940 --> 05:58.700]  I've spent a lot of time analyzing HUD-1 settlement statements, but I've never had
[05:58.700 --> 06:01.620]  to actually create one.
[06:01.620 --> 06:07.580]  The realtor will assist you with servicer follow-up and will complete additional tasks
[06:07.580 --> 06:12.540]  often requested by the servicer before final short sale approval is given.
[06:12.540 --> 06:22.620]  It says, Please note mortgage servicers are backlogged, which often results in long waits.
[06:22.620 --> 06:28.900]  We recommend that both borrower and realtor follow up on files as directed by the script
[06:28.900 --> 06:31.380]  in section 15.
[06:31.380 --> 06:36.220]  It has a set of scripts you use to call the servicer and the banks.
[06:36.220 --> 06:41.980]  The second thing, clean up the property of course and get it ready for sale.
[06:41.980 --> 06:46.380]  Price the property for the market, not at the mortgage balance unless the mortgage is
[06:46.380 --> 06:47.860]  the market value.
[06:47.860 --> 06:51.240]  It is possible to obtain an offer immediately.
[06:51.240 --> 06:56.460]  In most areas, the real estate market is experiencing sharp price declines.
[06:56.460 --> 07:04.860]  This has been up here for quite a while, so that may not exactly be accurate because right
[07:04.860 --> 07:08.700]  now a lot of places are beginning to increase.
[07:08.700 --> 07:20.980]  In a declining market, price for a 30-day sale because market values can decrease monthly.
[07:20.980 --> 07:25.340]  Since property has not received offers in two to three weeks, it is probably overpriced.
[07:25.340 --> 07:29.700]  We recommend that you drop pricing at realistic intervals.
[07:29.700 --> 07:32.500]  Consult your realtor until you receive an offer.
[07:32.500 --> 07:37.100]  Now, you will need to authorize your realtor and possibly your realtor's assistant to

[07:46.700 --> 07:53.820]  A letter of authorization authorizes the party such as a realtor, friend, counselor to speak
[07:53.820 --> 07:56.420]  to your mortgage servicer on your behalf.

[08:09.380 --> 08:16.660]  You fax the power of attorney to your servicer.
[08:16.660 --> 08:24.860]  It's becoming increasingly difficult with some servicers for other persons to help borrowers
[08:24.860 --> 08:28.320]  without a letter of authorization already on file.
[08:28.320 --> 08:32.980]  If you need another person to help you, please fax this authorization immediately and confirm
[08:32.980 --> 08:39.500]  to servicer that it has been received to avoid complications later.
[08:39.500 --> 08:40.500]  That's the power of attorney.
[08:40.500 --> 08:46.020]  If you file bankruptcy and you're still under jurisdiction of the court, you can review
[08:46.020 --> 08:53.620]  loan workout options with your servicer if a consent form from the bankruptcy attorney
[08:53.620 --> 09:00.740]  is faxed directly to the servicer's bankruptcy area.

[09:44.380 --> 09:50.900]  A file will not be worked on until all documents including the contract to purchase is confirmed

[09:51.900 --> 09:56.220]  The servicers will accept some documents prior to receiving the contract but it's highly
[09:56.220 --> 10:03.100]  recommended that the realtor send all documents together to the mortgage servicer and it says

[10:08.980 --> 10:15.460]  They have a list of all of the different servicers and what documents they require in order to

[10:17.420 --> 10:22.900]  The mortgage servicer most likely will want to see a summary of your financial situation

[23:11.480 --> 23:16.460]  The HUD-1 shows the servicers how funds are being distributed.
[23:16.460 --> 23:27.060]  If there are two loans, the HUD-1 should appropriate to the second lender approximately 1% of the
[23:27.060 --> 23:33.620]  second loan balance and the remainder should be appropriated to the first mortgage company.
[23:33.620 --> 23:38.740]  The title company or attorney will order pay off numbers for the loans.
[23:38.740 --> 23:44.600]  The seller should show receiving zero dollars, recommended.
[23:44.600 --> 23:50.620]  To avoid delays, make sure the real estate commission is stated correctly on the HUD-1.

[34:34.780 --> 34:41.460]  And then it references a negotiator, and I have to admit, I've never done a short sale
[34:41.460 --> 34:46.460]  so I don't know much about them, and I've never heard of a negotiator.
[34:46.460 --> 34:54.380]  It doesn't explain what the negotiator is, apparently the negotiator works with the servicer
[34:54.380 --> 34:59.500]  because it goes on to say that the negotiator may send your realtor a couple of amendments
[34:59.500 --> 35:01.140]  for you to sign.
[35:01.140 --> 35:05.820]  You and the realtor should continually ask if there are any missing documents when you
[35:05.820 --> 35:10.860]  follow up as the file may have been updated with current documents or documents can be

[35:56.020 --> 36:02.420]  Important, before signing the document, we recommend that you understand how the servicers

[36:04.860 --> 36:08.020]  Some will release you from any liability altogether.
[36:08.020 --> 36:14.860]  Some will issue a 1099-C. Some, before approval, will ask you to sign
[36:14.860 --> 36:21.700]  a promissory note to define a payment plan to pay all a part of the shortfall, and some,
[36:21.700 --> 36:29.220]  before approval, will want you to sign a statement accepting responsibility for the shortfall.
[36:29.220 --> 36:34.220]  In this latter situation, they will state that a recovery department will call after
[36:34.220 --> 36:36.620]  the sale to make payment arrangements.
[36:36.620 --> 36:42.700]  This debt is unsecured and can be settled often for a small percentage of the total.
[36:42.700 --> 36:46.540]  Some borrowers file bankruptcy later to eliminate this debt.

[41:29.860 --> 41:40.260]  And while the bar associations, the standards say that the standards do not create a cause

[42:02.860 --> 42:09.380]  So the bar is kind of lying to you when, well actually they're not, they're saying this
[42:09.380 --> 42:17.740]  standard doesn't create a claim against the lawyer.

[42:26.940 --> 42:31.140]  violation, that's what creates the cause of action.

[47:35.840 --> 47:40.740]  When I do a tort letter, I write the lawsuit, take the heading off and footer off and the
[47:40.740 --> 47:49.140]  prayer and where the prayer was, I put in, I have been harmed in this amount, make me
[47:49.140 --> 47:53.900]  hold to be sued.
[47:53.900 --> 47:54.980]  That's your tort letter.
[47:54.980 --> 48:00.580]  When they look at it, it's not just a threat letter.
[48:00.580 --> 48:04.820]  When you're threatening to file a lawsuit against them, they look at that tort letter
[48:04.820 --> 48:09.540]  that looks like a lawsuit and they know you're not kidding.

[49:42.060 --> 49:49.020]  me the biggest cases she had and it took her a while to understand what I was doing.
[49:49.020 --> 49:57.700]  I found one case that this guy did his motions on really expensive rag paper, really well
[49:57.700 --> 49:59.100]  structured.
[49:59.100 --> 50:04.100]  I don't know who this guy was, but he was one class attorney.
[50:04.100 --> 50:07.620]  I found a 32-page motion in limine.
[50:07.620 --> 50:16.940]  A motion in limine is a list of all of the questions they can't ask you.
[50:16.940 --> 50:19.380]  And I have had so much fun with that.
[50:19.380 --> 50:26.660]  I was sitting in court and the judge is going through all of these and he gets to hypnotic
[50:26.660 --> 50:37.500]  interviews and I asked for any transcripts of all hypnotic interviews.
[50:37.500 --> 50:39.900]  The judge wanted to go play golf or something.
[50:39.900 --> 50:40.900]  He was annoyed.
[50:40.900 --> 50:42.900]  He said, Mr. Kelton, were you hypnotized?
[50:42.900 --> 50:45.260]  Well, I don't know, judge.
[50:45.260 --> 50:47.660]  You know how they make you forget that kind of stuff.
[50:47.660 --> 50:48.660]  Ask him.
[50:48.660 --> 50:49.660]  Denied, denied.
[50:49.660 --> 50:58.980]  Oh, he was really, really unhappy, but there were two or three in there that were absolutely
[50:58.980 --> 51:00.900]  critical.
[51:00.900 --> 51:12.100]  One of the in limine issues he granted and then the prosecutor asked exactly that question.
[51:12.100 --> 51:22.060]  He forbade any questions about any prior legal history, any prior criminal history and the
[51:22.060 --> 51:28.260]  motion in limine strictly forbade it because the question is improper anyway.
[51:28.260 --> 51:35.740]  And he asked the sheriff, the prosecutor asked the sheriff if he had had any prior experience
[51:35.740 --> 51:36.740]  with me.
[51:36.740 --> 51:50.260]  I objected, the judge overruled, the sheriff got on the stand and lied like a dog and I
[51:50.260 --> 51:51.580]  later proved it.
[51:51.580 --> 51:56.900]  That's probably what won my case for me.
[51:56.900 --> 51:58.620]  So he should have paid attention.
[51:58.620 --> 52:05.060]  So go down to the courthouse and ask the clerk to show you the biggest files they got.
[52:05.060 --> 52:13.220]  Ask her, who is the best criminal defense attorney to practice in this jurisdiction?
[52:13.220 --> 52:19.020]  And then ask to see some of his cases and just thumb through them.
[52:19.020 --> 52:26.260]  This will give you all the case law, it'll give you the forms that the lawyers use and
[52:26.260 --> 52:27.680]  you'll find discovery in there.
[52:27.680 --> 52:32.960]  You will find things to discover you never thought of.
[52:32.960 --> 52:38.340]  The easiest research you can do is right there in the courthouse.
[52:38.340 --> 52:43.820]  I'm confused, Randy, my attorney, I don't think my attorney ever filed a motion for
[52:43.820 --> 52:44.820]  discovery.
[52:44.820 --> 52:51.540]  He just simply sent me the same packet that they had sent me in the last trial.
[52:51.540 --> 52:56.820]  I never got any kind of order saying that this has been filed.
[52:56.820 --> 53:01.820]  So I'm going to file my own motion for discovery, right?
[53:01.820 --> 53:02.920]  Yes.
[53:02.920 --> 53:08.900]  If another has been filed, the prosecutor will jump up and down and wave his arms and
[53:08.900 --> 53:12.620]  rail in righteous indignation, who cares, let him.

[53:13.620 --> 53:18.340]  Is there anything special that I want to put on the motion?
[53:18.340 --> 53:19.820]  This goes to your case.
[53:19.820 --> 53:24.320]  You want to put in everything you can about that apartment building.
[53:24.320 --> 53:37.260]  You want the contract between the university and the apartment owners.
[53:37.260 --> 53:41.420]  Go back and look at all of the stuff you researched on that and you want them to provide you with
[53:41.420 --> 53:42.420]  every bit of that.
[53:42.420 --> 53:50.060]  You want the name of every witness and how you can contact for those witnesses so that
[53:50.060 --> 53:54.420]  you can, so you, you want to be able to vet out the witnesses.

[53:55.580 --> 54:01.420]  Well that makes sense because the motion for discovery that my attorney had filed before,
[54:01.420 --> 54:06.620]  obviously they didn't really file one, um, did not have anything specific.
[54:06.620 --> 54:08.460]  It was just a general motion.
[54:08.460 --> 54:11.700]  Please give all the names of witnesses in chief.
[54:11.700 --> 54:19.940]  Now this is interesting that the prosecution intends to bring the court name of everyone
[54:19.940 --> 54:24.980]  with whom they have discussed this case and developed information.
[54:24.980 --> 54:27.500]  Go down and look in the record.
[54:27.500 --> 54:31.300]  You will find a good discovery motion.
[54:31.300 --> 54:35.700]  Most of these attorneys have a standard discovery motion.
[54:35.700 --> 54:42.180]  They have a standard motion in limine that just covers everything.
[54:42.180 --> 54:48.800]  So they pull this out and it's got everything in it and what they do instead of writing
[54:48.800 --> 54:52.380]  the motion, they redact the motion.
[54:52.380 --> 54:56.700]  They say, ah, we don't need this, we don't need this, we don't need this, but this keeps
[54:56.700 --> 54:57.700]  them from missing anything.
[54:57.700 --> 54:59.420]  So you'll find them in the record.
[54:59.420 --> 55:00.420]  Okay.
[55:00.420 --> 55:01.420]  I got it.
[55:01.420 --> 55:02.420]  Okay.
[55:02.420 --> 55:07.180]  I will work on the motion on the, uh, for discovery and the motion in limine and then
[55:07.180 --> 55:09.020]  give you a call next week.

[55:47.580 --> 55:49.100]  the hearing.

[55:53.220 --> 56:00.020]  And your motion dismissed, did it include, uh, the challenge because there was required

[56:46.300 --> 56:50.060]  So you probably have enough in there to have the challenge.

[57:27.980 --> 57:33.620]  Anything that's the same, you state the only changes in this document are to this paragraph,

[57:36.900 --> 57:42.380]  So they don't gripe so loud about having to go back and spend all the time to go over
[57:42.380 --> 57:44.820]  this document again.
[57:44.820 --> 57:51.880]  If you certify in the document that these are the only changes, then the prosecutor
[57:51.880 --> 57:56.460]  can go read all of it if he wants to, but he doesn't have to.
