[01:21.840 --> 01:22.840]  to be unconstitutional.
[01:22.840 --> 01:27.840]  Reuters reports that Judge Frederick Schollin found no basis for the court to conclude that
[01:27.840 --> 01:29.720]  the ban was constitutional.
[01:29.720 --> 01:34.120]  The ruling is the most recent action from the five-year-old case, Palmer v. District
[01:34.120 --> 01:35.120]  of Columbia.
[01:35.120 --> 01:41.400]  In an interview with investigative reporter Julie Wilson, friends of two Austin men arrested
[01:41.400 --> 01:46.640]  on charges of terrorism last month shed light on the suspect's lives, claiming their religious
[01:46.640 --> 01:49.120]  beliefs were far from extreme.
[01:49.120 --> 01:53.600]  One of the friends said the former UT student praised America for its liberties and felt
[01:53.600 --> 01:57.600]  that Austin, Texas was the safest place for a Muslim to live.
[01:57.600 --> 02:02.280]  Now both men have pleaded guilty to the charges, but their sentencing hearing has not yet been
[02:02.280 --> 02:03.840]  scheduled.

[04:42.080 --> 04:47.080]  I've already got some people up on the board, guys if y'all can hang on just a minute
[04:47.080 --> 04:49.080]  There's something I want to go over that I've talked a little bit about
[04:49.080 --> 04:52.080]  Or I want to talk a little bit about and then I'll start taking your calls
[04:52.080 --> 04:57.080]  So I have been doing a lot of research for a long time now
[04:57.080 --> 05:03.080]  As everybody's well aware and I have really, really, really been pouring through
[05:03.080 --> 05:09.080]  Individual state constitutions, all of the versions of the various Texas constitutions
[05:09.080 --> 05:11.080]  And so on and so forth
[05:11.080 --> 05:14.080]  And I've mentioned this once before
[05:14.080 --> 05:20.080]  But the one thing that is missing from every constitution that I have read
[05:20.080 --> 05:23.080]  Which is virtually all of them
[05:23.080 --> 05:31.080]  Is a clause making it a punitive act within the control of the people
[05:31.080 --> 05:33.080]  Not the government now
[05:33.080 --> 05:40.080]  But a punitive act against a public servant if he violates a provision of that constitution
[05:40.080 --> 05:42.080]  Whatever state it's for
[05:42.080 --> 05:51.080]  That punitive provision would allow the people to basically apprehend, indict, prosecute
[05:51.080 --> 05:58.080]  And convict any public servant that violated a provision of their respective state constitution
[05:58.080 --> 06:08.080]  A single governmental entity, agent, or office would be allowed to interfere in any way with that process
[06:08.080 --> 06:15.080]  And the people's grand jury and courts would have access to all of the same resources, agencies, and departments
[06:15.080 --> 06:22.080]  That are available within the state to conduct investigations, gather evidence, and so on and so forth
[06:22.080 --> 06:33.080]  But we should not be allowing our public servants to determine whether or not they have committed a crime against us
[06:33.080 --> 06:36.080]  That is stupid
[06:36.080 --> 06:47.080]  It's utter lunacy to think that they would ever go against themselves if it would catch them up in it
[06:47.080 --> 07:02.080]  If this would not be limited to overt acts, it would be directed toward any act that did or had the potential to directly violate a provision of the said constitution
[07:02.080 --> 07:07.080]  Now, there's something I wrote up on Facebook and I'm going to read it to you real quick about the things that I'm considering for this
[07:07.080 --> 07:19.080]  I'm actually considering sitting down and writing the Bill of Rights version of this for the Texas Constitution and putting it out there to have petitions done on it
[07:19.080 --> 07:24.080]  So that we can put it up to a vote and hopefully add it to the Texas Constitution
[07:24.080 --> 07:31.080]  If you want to see the snakes crawling out of the woodwork to stop it and know exactly who you need to be watching out for
[07:31.080 --> 07:36.080]  Watch for the people that argue against having such a provision in the Constitution
[07:36.080 --> 07:45.080]  Those will be the people, especially if they already have a public service job or a politician or especially the cops
[07:45.080 --> 07:51.080]  They're not going to like what I'm proposing here and when I get through reading it, you'll see why
[07:51.080 --> 08:01.080]  First off, we have all these situations where the cops are abusing their power, they're stopping, they're questioning, they're detaining, they're searching
[08:01.080 --> 08:08.080]  And all these things without any probable cause or even any reasonable suspicion to give them grounds
[08:08.080 --> 08:19.080]  When in fact the only people that should be subject to any such treatment are public servants acting in their official capacities
[08:19.080 --> 08:29.080]  If they're on duty in their official capacities, their rights don't exist because their duties are created by us
[08:29.080 --> 08:31.080]  We control them
[08:31.080 --> 08:44.080]  So while they're acting in their public capacity, they are subject to search, they are subject to questioning, they are subject to detention, they are subject to demand for production of identification
[08:44.080 --> 08:53.080]  You're a public servant, you're telling me that you have some authority to make me do something, produce your identification, prove to me you are who you say you are
[08:53.080 --> 09:04.080]  And then tell me what law you're relying on or constitutional provision you're relying on that says you have an authority to tell me to do anything
[09:04.080 --> 09:09.080]  That's just one of the things we'll be dealing with, but let me read this to you
[09:09.080 --> 09:22.080]  The only people that should not be safe from demands to be searched, production of identification and answering non-security infrastructure related questions are our public servants when acting in their official capacities
[09:22.080 --> 09:27.080]  They are the ones with limited authority and powers, not we the people
[09:27.080 --> 09:40.080]  No politician or public servant of any kind should ever have immunity for any act that violates any individual right whatsoever regardless of the time and place that it is perpetrated
[09:40.080 --> 09:54.080]  And the specific prohibition of the use of force unless and until actual force is used that would result in imminent serious bodily injury or death or substantial damage to private property
[09:54.080 --> 09:57.080]  And then we go on to enumerate a couple things
[09:57.080 --> 10:14.080]  If such an act is ever perpetrated by a public servant absent, one, an actual credible threat to the life and property of another or to themselves and two, supported by an already demonstrated willingness to harm
[10:14.080 --> 10:22.080]  In other words, military rules of engagement do not fire unless fired upon or to save the life of an innocent or bystander
[10:22.080 --> 10:36.080]  Or three, an actual sworn complaint and arrest warrant or by lawful conviction involving an actual crime where a human living or dead has suffered a palpable harm of some kind
[10:36.080 --> 10:44.080]  And four, is applicable to a public servant regardless of whether or not the criminal actor is a federal or state public servant
[10:44.080 --> 11:02.080]  Remember, crimes committed within the territorial boundaries of the states themselves are under the exclusive jurisdiction of that state where it is committed unless it is for one of the three specific and only criminal jurisdictions granted to the federal government
[11:02.080 --> 11:09.080]  Which are specifically limited to counterfeiting of federal currencies, immigration violations or treason
[11:09.080 --> 11:20.080]  In other words, I don't care if it's a federal agent committing a crime within Texas, he commits a crime here, he gets prosecuted here by us
[11:20.080 --> 11:25.080]  He can't run to the federal courts and they can't cover for him and the fed can't give him immunity
[11:25.080 --> 11:31.080]  Because he cannot commit a crime within the state, we didn't authorize the federal government to do that
[11:31.080 --> 11:40.080]  And we didn't give them jurisdiction over any crimes committed in the state if it was not related to one of those three enumerated things in their enumerated powers
[11:40.080 --> 11:48.080]  So they commit a crime within the state, they get tried within the state by the people of that state like any other common criminal
[11:48.080 --> 12:01.080]  Now, no human victim suffering a palpable harm to themselves, their property or non-tangible rights violations, then there is no crime that has been committed
[12:01.080 --> 12:22.080]  Something else that every state constitution should have a clause for ever forbidding, one, the taxation and or licensing of absolutely any form or type of private activity or property owned and used by private individuals if it is not used for any corporate function or purpose
[12:22.080 --> 12:35.080]  Two, any law regarding the individual right to purchase, own, possess, transfer, sell and carry arms and ammunition of any kind or in any quantity by private individuals
[12:35.080 --> 12:52.080]  Licensing, fingerprinting and other biometric information shall absolutely be required for any non-military public servant to be employed in a position requiring them to bear arms as a part of their official duties while on duty
[12:52.080 --> 13:06.080]  But such information shall be absolutely forbidden to be taken or requested from a private individual except as part of the punishment phase of a criminal conviction prior to incarceration
[13:06.080 --> 13:24.080]  Three, the claim of governmental necessity where that alleged necessity conflicts with individual rights and is not relating to one of the specifically delegated powers and duties or is absolutely necessary in ancillary to the fulfillment of such delegated duty
[13:24.080 --> 13:37.080]  Four, the state governing or government from exercising any power and authority other than those specifically enumerated and delegated to them just like the federal constitution does
[13:37.080 --> 13:52.080]  Five, any form of claim relating to immunity of any kind unless such determination is made by a people's grand jury after examination of the facts and evidence associated with the event for which immunity is sought
[13:52.080 --> 14:04.080]  And each constitution should contain a punitive punishment clause specifically written as applicable to all public servants regardless of position, title or duty
[14:04.080 --> 14:20.080]  It should specifically define the violation of any provision of the state constitution or the laws of the state by any public servants therein as an act of felony criminal sedition in addition to any other criminal act defined by state law
[14:20.080 --> 14:33.080]  And in such cases the acts are to be directly punishable by the people of the state themselves without any governmental involvement except maintaining the incarceration and care after conviction
[14:33.080 --> 14:45.080]  These crimes are ones for which the people themselves would be specifically and fully empowered within the language of that state's constitution to form their own posse to seize and arrest the rogue public servant
[14:45.080 --> 14:58.080]  Once the perpetrator is apprehended, the people may convene their own grand jury to investigate the criminal allegations using the full resources and capabilities of any and all state agencies
[14:58.080 --> 15:12.080]  And to also indict if enough evidence exists after investigation to believe that a crime against the constitution, laws of the state, or one or more of the people thereof has been committed by said public servants
[15:12.080 --> 15:26.080]  Furthermore, the people's grand and petty juries are bound by no judge made interpretation of the constitutional provisions or laws and may reach their own group majority consensus to same
[15:26.080 --> 15:41.080]  The people would then be fully empowered to temporarily form their own public court and impanel a petty jury randomly selected from the general public to try and if found guilty convict the rogue public servants
[15:41.080 --> 16:00.080]  And during any trial against one of the people that is not a public servant, the petty jury must be informed by the judge prior to trial that they may fully review, question, and nullify any law in whole or in part that they may find repugnant to the state constitution
[16:00.080 --> 16:18.080]  And or inapplicable to the circumstances of the case and absolutely none of this would require approval or allow any interfering any intervention by any other agency or office of government created by the state constitution or by law
[16:18.080 --> 16:41.080]  So what I want to do is start getting people petitioning for referendums for this type of amendment to their state constitution. I'm going to draw up some draft forms of that legislation and hopefully people will take it, adapt it to their state, to their constitution, and work on getting it passed

[20:39.080 --> 20:52.080]  Hey Eddie, a long-time listener, first-time caller. I wanted to personally thank you for everything that you're doing for the cause of liberty in this country. It is much appreciated.
[20:52.080 --> 20:57.080]  Well, I appreciate that. What can I do for you?
[20:57.080 --> 21:17.080]  I'll try to be as quick and concise as I possibly can. A friend of mine got a speeding violation not too long ago and decided that he wanted to implement some of the things that we've been learning through your radio program and through studying law.
[21:17.080 --> 21:32.080]  Unfortunately for him, he did not follow the script during his traffic stop. He did not record. He handed over his license. He basically did everything wrong.
[21:32.080 --> 21:49.080]  He initially responded to the complaint with an affidavit using some of the script when he realized that he had already waived those rights.
[21:49.080 --> 22:11.080]  We got together and decided to fight it administratively. The response to his affidavit was merely a court summons and we were reading through the Rules of Procedure for the Magisterial District Court of Pennsylvania
[22:11.080 --> 22:20.080]  and we immediately saw a violation in their due process when they sent us that summons.
[22:20.080 --> 22:24.080]  How so?
[22:24.080 --> 22:45.080]  Well, the Rules of Procedure stated they have to summon in a specific manner and that manner is one of three avenues. They have to send it through a sheriff or constable or through a certified or registered mail.
[22:45.080 --> 22:58.080]  It then specifies in Rule 308 how to serve upon an individual and that's where the three methods come in. The first thing was they could hand the copy to the defendant directly
[22:58.080 --> 23:16.080]  or they could hand a copy of the complaint for the summons rather to a family member of the defendant to the clerk or manager of a hotel in apartment house, boarding house of the resident of the defendant,
[23:16.080 --> 23:34.080]  or they could hand a copy of the summons at his workplace to the defendant's agent or a person in charge and the third manner in which they can serve a summons is through mailing the copy to the defendant but it must be certified or registered mail.
[23:34.080 --> 23:46.080]  Mark restricted delivery.
[23:46.080 --> 24:10.080]  If you also check to see what the particular form that notice is required to have under the statutes. For instance, here in Texas, a summons has to have the exact same format as a warrant except that in the body of it, it is directed to the individual commanding their appearance rather than to an officer to seize an arrest.
[24:10.080 --> 24:20.080]  Otherwise, it is required to be exactly like a warrant. So the form of it can also be something you need to check.
[24:20.080 --> 24:36.080]  Okay, because they just send out form letters here just like what you're talking about and it in no way complies with the requirements. See, Texas, you can only be called in court in one of three ways as well warrant subpoena or summons.
[24:36.080 --> 24:51.080]  Okay. See, only way they can get you there and each one of those things has a specific set of requirements under Texas statute and the form letters they send out do not even begin to comply with that.
[24:51.080 --> 24:57.080]  Okay, so that's kind of the avenue that we were coming from because we certainly didn't.
[24:57.080 --> 25:08.080]  Okay, you can move to quash that then, move to quash it as having no force and effective law. It's improper and invalid according to the required method of service.
[25:08.080 --> 25:15.080]  And if it's not up to the same form as required by statute, it does not have a form authorizing it to be used for that purpose.
[25:15.080 --> 25:24.080]  In which case I would file a judicial conduct complaint against the judge of the court that issued it.
[25:24.080 --> 25:37.080]  Now, the other question is, is in Pennsylvania, what is the nature of the accusation as it relates to transportation? Is it civil, criminal or administrative?
[25:37.080 --> 25:46.080]  Oh, I know that answer, but not off the top of my head. We did look that up. I do believe it's criminal.
[25:46.080 --> 25:54.080]  Okay, most likely what you're going to hear is the term quasi-criminal.
[25:54.080 --> 26:09.080]  Now, what I want you to do is search every single code in Pennsylvania for the term quasi. See if you get any hits. I'm betting you don't.
[26:09.080 --> 26:22.080]  The problem with the court saying they're quasi-criminal means it's a quasi-jurisdictional issue and no court in any state has a quasi-jurisdictional capability.
[26:22.080 --> 26:29.080]  It has to be civil, criminal or administrative or it's nothing.
[26:29.080 --> 26:36.080]  Okay. So to move to quash, we would do that within the appeal?
[26:36.080 --> 26:47.080]  No. You move to quash the summons so you don't have to appear in the court on that paperwork at all because it has no force and effective law.
[26:47.080 --> 26:51.080]  Okay, we have already passed that point.
[26:51.080 --> 26:55.080]  Oh, so y'all have already appeared in response to what they sent you?
[26:55.080 --> 27:01.080]  No, sir. We just did not appear at all. We didn't in our motion to quash.
[27:01.080 --> 27:06.080]  Okay, wait, wait, wait, wait, wait. I'm trying to make sure we're talking about the same thing here.
[27:06.080 --> 27:22.080]  The thing you're describing to me that was not delivered in compliance with the three main ways the statutes allow commanded you to appear when?
[27:22.080 --> 27:24.080]  June 10th.
[27:24.080 --> 27:33.080]  So that one is passed so you can't challenge it. Well, you can. You could still challenge it since you didn't appear.
[27:33.080 --> 27:38.080]  But do they issue warrants when you don't appear on those things?
[27:38.080 --> 27:45.080]  No, sir. They go ahead and enter a judgment for your failure.
[27:45.080 --> 27:53.080]  Okay, then this is not criminal. There is no way they can enter a judgment against you in a criminal case in your absence.
[27:53.080 --> 28:01.080]  There is no way at all. This is entirely civil administrative when they do that.
[28:01.080 --> 28:18.080]  Okay. Well, Rule 13 goes on to state that a proof of service, it must state a manner of service, a date, a time, a place of service,
[28:18.080 --> 28:27.080]  a name and a relationship of the person to whom the complaint was served and that it has to be registered or certified.
[28:27.080 --> 28:37.080]  Right. So you file a motion to void the judgment by the court because the judgment's invalid. Notice was never given.
[28:37.080 --> 28:44.080]  Notice was not provided according to law. Therefore, it was not given.
[28:44.080 --> 28:51.080]  The judgment is void. The court never acquired jurisdiction to enter the judgment.
[28:51.080 --> 28:53.080]  Correct.
[28:53.080 --> 29:01.080]  So challenge it to avoid the judgment on those grounds. Judicially conduct complained the judge of the court on those grounds.
[29:01.080 --> 29:11.080]  He entered an illegal judgment in violation of the statute of the state and the rights of the accused to proper timely and sufficient notice.
[29:11.080 --> 29:20.080]  That has three component parts. Proper meaning the notice requirements are those required by law.
[29:20.080 --> 29:31.080]  Okay. Sufficient. The individual is given enough information in that notice to know what they're required to do, when they're required to do it and how they're required to do it.
[29:31.080 --> 29:42.080]  Timely, it has to be given in advance where the individual is capable of meeting the requirements required thereof.

[34:21.080 --> 34:32.080]  My question for you, twofold, is can we enter that judicial complaint and conduct conjunction with that appeal?
[34:32.080 --> 34:42.080]  Well, you can, but not as a part of the appeal. The judicial conduct complaint will be filed with a different state agency using a different set of conditions and forms.
[34:42.080 --> 34:56.080]  It's not directly part of the appeal. You can attach it to what you're doing to show that there is evidence supporting your complaint against that judge for illegally entering a judgment without proper notice.
[34:56.080 --> 34:59.080]  Because he didn't do it in accordance with law.
[34:59.080 --> 35:13.080]  So on your appeal, you need to see which one applies in Pennsylvania. A motion to avoid judgment? Or I forget what the other one is.
[35:13.080 --> 35:24.080]  There's a motion to dismiss.
[35:24.080 --> 35:34.080]  You can dismiss it, but the thing about it is what you don't want to do is give legitimacy to the fact that it's an attempted appeal because it's an improper conviction.
[35:34.080 --> 35:41.080]  So go through the appellate process and have them try to avoid that judgment.
[35:41.080 --> 35:47.080]  Say the original trial court never had jurisdiction. Proper notice was never given in accordance with law.
[35:47.080 --> 35:58.080]  The notice did not comply in form or anything else. It was sent out in a way not allowed by law. Nothing it did was proper.
[35:58.080 --> 36:08.080]  The trial court never had jurisdiction to enter a judgment and then moved to dismiss the case and void the judgment.
[36:08.080 --> 36:13.080]  Okay. And also enter the judicial complaint.
[36:13.080 --> 36:22.080]  You just can enter that as attachments to show that you did file judicial conduct complaints based upon the trial court's actions.
[36:22.080 --> 36:23.080]  Okay.
[36:23.080 --> 36:35.080]  But you don't file the actual complaint as a complaint with the appeals court. That goes to whoever your judicial oversight agency is in Pennsylvania.
[36:35.080 --> 36:56.080]  Yes, sir. This conviction put him over the point limit. And so the Department of Transportation sent him a notice that his license will be suspended for 130 days when they got the notice from the appellate court
[36:56.080 --> 37:15.080]  requesting the stay of judgment. They sent another notice saying that an appeal of summary conviction does not stay the Department's actions directly resulting from that conviction.
[37:15.080 --> 37:25.080]  Well, my question is, if they harm him by suspending his license on that illegal conviction, he can sue him.
[37:25.080 --> 37:30.080]  Okay. So there's really no kind of affidavit.
[37:30.080 --> 37:47.080]  If the court ordered them to stay it and they don't, then you can move that the court hold that agency or whoever's in charge of it in contempt of a court order to stay.
[37:47.080 --> 37:54.080]  If the appeals court actually issued an order for that purpose.
[37:54.080 --> 38:06.080]  Yes, sir. It was in fact, I don't know if it was technically an order. It was written of the form was a notice.

[41:17.080 --> 41:27.080]  Anybody in California that hears this, whether it's live or on the podcast or on the stream or whatever, listen very, very carefully.
[41:27.080 --> 41:41.080]  If you are in California and you get stopped for any sort of traffic violation, the moment that you find out what the initial cause for the stop was,
[41:41.080 --> 41:51.080]  you go and look in the Motor Vehicle Code in California and see whether or not that specific offense is listed as an infraction.
[41:51.080 --> 42:02.080]  And now let me tell you why. Infractions are specifically said to not be criminal in California.
[42:02.080 --> 42:06.080]  And they're not criminal in New York either.
[42:06.080 --> 42:24.080]  So when an officer seizes you by pulling you over for an infraction, he is committing a crime because he has no authority to arrest for an infraction.
[42:24.080 --> 42:33.080]  He has no authority to interfere with you for an infraction because they are civil.
[42:33.080 --> 42:37.080]  They are not criminal.
[42:37.080 --> 42:47.080]  So the arrest to write you the ticket and proceed after that was all illegal by the sheriff's deputy.
[42:47.080 --> 42:49.080]  Got it?
[42:49.080 --> 42:53.080]  Got it. Got it.
[42:53.080 --> 43:03.080]  I'll be looking at it. So I continue to tell him that I'm exercising.
[43:03.080 --> 43:08.080]  You don't continue to tell him anything. You file a motion to dismiss all charges.
[43:08.080 --> 43:13.080]  The detention and arrest by the sheriff's deputy was illegal.
[43:13.080 --> 43:19.080]  He stopped you for an infraction, which California law specifically declares to be civil.
[43:19.080 --> 43:27.080]  Therefore, the only way he could stop you is with a valid arrest warrant, which he didn't have, right?

[43:28.080 --> 43:35.080]  And what is the grounds on which they can obtain a valid arrest warrant?
[43:35.080 --> 43:36.080]  Warrant.
[43:36.080 --> 43:44.080]  They have to have a statement of probable cause to believe that a crime is being committed to get that warrant.
[43:44.080 --> 43:48.080]  So they can't even get an arrest warrant for an infraction.

[48:43.080 --> 48:52.080]  They couldn't let it out. They had to be there for 30 days and the charges are $220 for the tow and $70 a day.

[49:00.080 --> 49:09.080]  nor can the tow company retain it on his order alone. There has to be a court order for them to do that.

[49:14.080 --> 49:22.080]  I'm quite sure, yeah, the tow company, if I'm quite sure if you research the statutes dealing with tow companies in California,

[49:26.080 --> 49:33.080]  They cannot refuse to turn it over to them if they've properly shown evidence of ownership and demanded to release the car
[49:33.080 --> 49:41.080]  and paid the necessary fees to get it out. They can't just keep it on a cop's say so.
[49:41.080 --> 49:49.080]  That makes the cop the judge and jury. He can't be the judge and jury.

[01:40:46.680 --> 01:40:50.680]  Everything prior to that pointed to simply just arrest.
[01:40:50.680 --> 01:41:00.680]  What I want to know is those two terms stop and detain a loophole in which they can get around the Miranda process.

[01:46:46.680 --> 01:47:00.680]  This is showing it to be valid effective July 1, 2015, so you need to see if there's an earlier revision of this that said the same thing based upon whatever they're trying to pass now to change it or if it's all new.

[01:47:04.680 --> 01:47:13.680]  Failure to perform any act required or the performance of any act prohibited by this title, okay?

[01:50:27.680 --> 01:50:36.680]  Codes are regulatory interpretations of agencies relating to the law, but they are not the law.

[01:52:29.680 --> 01:52:37.680]  Well, you are, in my opinion, a true Ameriman, and I just want to talk this evening a little bit.
[01:52:37.680 --> 01:52:50.680]  I just want to talk to you a little bit about what's going on in Texas and a bit of a trend as far as going down this road of fighting these public servants, especially concerning the traffic violations in Texas.
[01:52:50.680 --> 01:53:04.680]  From my experience, as far as it's like a multi-headed Hydra, not only do you have to deal with the officer on the street, you have to do everything correctly, and I agree with everything you're saying.
[01:53:04.680 --> 01:53:17.680]  To deal with the officer on the street, you have to understand and know all these things, and not only do with him, but you can also deal with your local municipal or county, whatever, judge in court.
[01:53:17.680 --> 01:53:32.680]  The problem that I'm seeing, and I just hope it could allay my fears, is that for an individual to go down this path of freedom and resistance against this crowd, excuse my language,
[01:53:32.680 --> 01:53:48.680]  what I found out is that you can beat the cop on the street, and you can even beat your local municipal judge, your county judge, or whatever, assuming somebody listens to what you say and actually applies it.
[01:53:48.680 --> 01:54:11.680]  However, what I found is that regardless, even if you beat the officer on the street, the judge and the court, as far as traffic violations in Texas have had, and I understand it's a de facto bill of paying penalties without judicial review,
[01:54:11.680 --> 01:54:32.680]  but even if you win and get these traffic tickets dismissed or anything like that, the Texas Department of Public Safety does in fact still count it at least on your driving, commercial driving record as a violation, infraction, whatever the terminology is for Texas,
[01:54:32.680 --> 01:54:38.680]  and they penalize you for it and add on their surcharges and all this other stuff.
[01:54:38.680 --> 01:54:47.680]  Actually, that's because you don't show them that the charges were dismissed or that you were not convicted of them.
[01:54:47.680 --> 01:54:57.680]  They say, see, this is the problem with the way they do it. This is how it violates your rights. I could write an entire book on rights violations associated with the transportation code and not even blink.
[01:54:57.680 --> 01:55:12.680]  It would be so thick. I mean, you have to measure the thing. But still, when they do what they're doing with these administrative surcharges and things, those are most assuredly administrative punishments which a judge and a jury never rules on.
[01:55:12.680 --> 01:55:18.680]  They never rule on it. They are absolutely unconstitutional on their face.
[01:55:18.680 --> 01:55:33.680]  I understand that. Okay. They have to be challenged as such. You're going to have to sue the Department of Public Safety for punishing you without judicial review on an unconstitutional bill of pains and penalties fine.
[01:55:33.680 --> 01:55:46.680]  The legislature has no authority to authorize that and the DPS has no authority to enforce it. They cannot say that it's consensual because you're objecting to it.
[01:55:46.680 --> 01:56:00.680]  Right. And they never tell you that you're waiving these rights to get their privilege. And there's federal case law that says you cannot be compelled or forced to waive a right in order to use a privilege or to get it.
[01:56:00.680 --> 01:56:02.680]  Right.
[01:56:02.680 --> 01:56:17.680]  Well, my fear is that the further I go down this path of the whole traveling argument, eventually I'm afraid that it's going to get to the point where the DPS, of course, it'll all be unconstitutional and everything like that in complete violations.
[01:56:17.680 --> 01:56:28.680]  But they're eventually going to basically ban me from ever having a commercial driver's license again. And in the future, I don't know, but in the future I might score a better job or something.
[01:56:28.680 --> 01:56:34.680]  And they might require me to actually get a commercial driver's license and those, you know, what?
[01:56:34.680 --> 01:56:44.680]  Again, they cannot legitimately withhold a privilege if they require you to waive a right to get the privilege. You can sue them for that too.
[01:56:44.680 --> 01:56:49.680]  They can't deprive you and your ability to earn a livelihood. They can't do it.
[01:56:49.680 --> 01:56:54.680]  It's a lot, it's a lot scarier to go after the whole of the DPS than it is to...
[01:56:54.680 --> 01:57:00.680]  I perfectly understand that, believe me. I'm not saying it's going to be easy and I'm definitely not saying it's going to be cheap.
[01:57:00.680 --> 01:57:10.680]  But the fact of the matter is, unless we change the laws that lets them get away with doing this, the only place we've got to get them is in the courts.
[01:57:10.680 --> 01:57:21.680]  We've got to get the rules they're operating under declared unconstitutional or repugnant to due process or violative of the Bill of Rights, something.
[01:57:21.680 --> 01:57:25.680]  Let me throw a little something at you real quick for the end.
[01:57:25.680 --> 01:57:34.680]  I have on audio recording the, I guess, the DPS headquarters. When you call into their main office and often ask them questions about your driving record,
[01:57:34.680 --> 01:57:45.680]  I have them on audio recording quoting me statutes that they claim given the authority to do specific things and the statutes do not exist.
[01:57:45.680 --> 01:57:52.680]  Well, send me a list of what they're telling you they're using and I can tell you whether or not they exist and where.
