[05:17.120 --> 05:21.040] So what I'm going to go over tonight is some notes that I've been working on which will
[05:21.040 --> 05:26.120] be integrated into the due process book that I'm trying to get finished and hopefully in
[05:26.120 --> 05:30.440] time we'll be able to hold a due process seminar before the end of the year.
[05:30.440 --> 05:34.800] I'm not positive I'm going to make it before then to make that happen, but I am certainly
[05:34.800 --> 05:36.800] trying.
[05:36.800 --> 05:40.120] But in any case, pay close attention to the stuff that I'm talking about here because
[05:40.120 --> 05:44.640] this is stuff that you will see in that new book and this is stuff relevant to the transportation
[05:44.640 --> 05:51.520] script and to your initial appearances in these criminal courts at the lower levels
[05:51.520 --> 05:56.440] that we get herded into for lack of a better way of putting it for the purpose of getting
[05:56.440 --> 06:00.480] fleeced and that's exactly what they're doing it for.
[06:00.480 --> 06:06.120] It's not for any form of justice or because you committed any real crime, it's simply
[06:06.120 --> 06:08.880] to fleece you of your money for their revenue.
[06:08.880 --> 06:13.280] All right, so I'm basically just going to read what I've got here and go over how I'm
[06:13.280 --> 06:14.640] trying to explain it.
[06:14.640 --> 06:18.640] So just please pay attention and if you got any questions when you call in, that's great

[07:00.520 --> 07:06.840] Any effort to protect your rights from jackbooted thugs or armed robbers that want to take from
[07:06.840 --> 07:09.880] you is risky.
[07:09.880 --> 07:17.040] Something that doubts that hasn't lived very long or gone through the experience or both.
[07:17.040 --> 07:20.240] You don't stand up to a bully without risk.
[07:20.240 --> 07:24.440] That never is going to happen, okay?

[07:25.800 --> 07:29.400] I know there's risk associated with the script.

[07:32.920 --> 07:38.920] If the people you're dealing with had a real conscience, they wouldn't be standing outside
[07:38.920 --> 07:44.960] your car threatening you with harm for the purpose of collecting money because they're
[07:44.960 --> 07:47.760] certainly not doing it for public safety.
[07:47.760 --> 07:54.640] Despite what they think, reason would tell them you didn't hit anybody or anything.
[07:54.640 --> 07:59.840] It is just my opinion that your speed could have resulted in that, but I have no definitive
[07:59.840 --> 08:02.640] proof that it would have done so.
[08:02.640 --> 08:07.760] By that reasoning alone, they should have never stopped you, okay?
[08:07.760 --> 08:12.800] Because you were doing something really stupid, like a hundred in the middle of a crowded highway
[08:12.800 --> 08:17.880] and having to weave in and out of traffic so hard and so fast to avoid hitting somebody
[08:17.880 --> 08:22.800] that it was almost a dead certainty you were going to.
[08:22.800 --> 08:26.400] Then he would be justified because you're endangering everybody else.
[08:26.400 --> 08:31.160] But these guys that chase you down open highways day or night, there ain't nobody around and
[08:31.160 --> 08:36.000] all they're doing is pulling you over because their opinion is you were going too fast.
[08:36.000 --> 08:40.560] Well, that's what this script is to help to protect you from as far as being able to fight
[08:40.560 --> 08:46.160] for your rights because most of the things they do are direct violations of your rights.
[08:46.160 --> 08:50.320] When I get down a little further in this initial reading, you're going to see exactly how many
[08:50.320 --> 08:54.360] of your rights get violated at a traffic stop.
[08:54.360 --> 08:56.040] Believe me, there's plenty.
[08:56.040 --> 09:01.640] Your rights are violated from the moment that traffic stop starts until all the way through
[09:01.640 --> 09:04.040] your appeals process at the end.
[09:04.040 --> 09:09.080] Your rights are going to be violated if you fail to protect them.
[09:09.080 --> 09:11.600] So pay attention.
[09:11.600 --> 09:16.840] Now again, you are the only one that's actually on scene while this is going on.
[09:16.840 --> 09:22.120] Therefore you are the only one that is capable of judging just how far the maniac outside
[09:22.120 --> 09:26.200] your window is willing to go.
[09:26.200 --> 09:31.600] You are responsible for taking note of that and paying attention, okay?
[09:31.600 --> 09:34.160] No one else is there.
[09:34.160 --> 09:38.880] Don't get yourself injured when it's avoidable.
[09:38.880 --> 09:46.320] But at the same time, remember that if you let them win too soon, then you waived your
[09:46.320 --> 09:49.480] rights and the courts are going to look at it that way.
[09:49.480 --> 09:54.080] So there's a line there that you've got to be sure that you don't cross while at the
[09:54.080 --> 10:00.640] same time getting them to cross it just enough that you have a proper defense and record.
[10:00.640 --> 10:02.260] So keep that in mind.
[10:02.260 --> 10:07.560] No one can tell you how to handle the situation you're in at that moment because you are the
[10:07.560 --> 10:11.800] only one there.
[10:11.800 --> 10:18.960] That requires a little bit of responsibility on your part and brain exercise on your part
[10:18.960 --> 10:22.040] to decide what your best options are.
[10:22.040 --> 10:28.080] So pay attention, learn from what I'm about to tell you, apply it liberally wherever you
[10:28.080 --> 10:37.320] can but not enough or to a degree to suffer bodily harm from these people, okay?
[10:37.320 --> 10:43.640] And I'm not going to say every cop is willing to do this to you, okay?
[10:43.640 --> 10:51.120] But the odds are that you're facing one that would being much higher than the odds that
[10:51.120 --> 10:53.920] you aren't.
[10:53.920 --> 10:56.160] So take that into consideration too.
[10:56.160 --> 11:04.560] All right, that being said, you got to remember that the record you want to do has to prove
[11:04.560 --> 11:09.640] that whatever happened was not actually anything that you did but rather was an overreaction
[11:09.640 --> 11:15.200] by these overly aggressive and ill trained criminal street gang, low IQ, adrenaline junkies
[11:15.200 --> 11:18.080] on a steroid enhanced rage.
[11:18.080 --> 11:21.600] That's the kind of people you're going to wind up dealing with, okay?
[11:21.600 --> 11:25.920] It may sound like I'm going overboard but until you've actually been out there and been
[11:25.920 --> 11:31.680] accosted by one of these people, you can't say I'm wrong, okay?
[11:31.680 --> 11:35.800] Because they exist, they're out there, believe me.
[11:35.800 --> 11:40.800] All right, general do's and don'ts.
[11:40.800 --> 11:46.960] Again, a lot of these are in the script but they're not always completely explained so
[11:46.960 --> 11:51.240] that's what these notes are going to be trying to do is to explain these.
[11:51.240 --> 11:57.080] Don't ever try to educate the officer on any subject whatsoever.
[11:57.080 --> 12:02.480] Not his job, not the law, not your rights, not anything.
[12:02.480 --> 12:10.320] The side of the highway is not a school room and you are not a teacher but it is a place
[12:10.320 --> 12:14.400] where the officer has a distinct advantage over you.
[12:14.400 --> 12:20.200] He's got several guns and prior to ever stopping you, he's already used that long range radio
[12:20.200 --> 12:26.080] to call for assistance from some other bad attitude, steroid or adrenaline enhanced overly
[12:26.080 --> 12:30.280] aggressive gang member that's going to help him and not you.
[12:30.280 --> 12:32.960] You got to remember that.
[12:32.960 --> 12:39.080] Not to mention the all too often malfunctioning camera and audio recording system that will
[12:39.080 --> 12:47.840] conveniently hide what's actually happening from an official record if they need it to.
[12:47.840 --> 12:52.480] This is just another reason why I tell you do not leave home without something that does
[12:52.480 --> 12:54.440] audio and video recording.
[12:54.440 --> 13:00.960] Not now, not ever again.
[13:00.960 --> 13:09.720] Now they've got all of this stuff so besides your wits, your self control and a basic plan
[13:09.720 --> 13:15.640] of action from what's in that script what do you have?
[13:15.640 --> 13:19.900] So it would behoove you not to lose control of any of the things you have.
[13:19.900 --> 13:24.600] Your wits, your self control and your plan of making that record.
[13:24.600 --> 13:29.480] Stay calm, collected, do what you need to do, don't give them anything that would help

[14:01.160 --> 14:04.480] will be on those little papers if you're not paying attention.

[14:05.920 --> 14:10.240] Well, Austin Municipal Court does exactly that thing when you sign their little electronic
[14:10.240 --> 14:11.240] pad.
[14:11.240 --> 14:14.840] When you sign the pad in front of that clerk, they'll print out a sheet that says you waive
[14:14.840 --> 14:16.760] your right to a jury trial.
[14:16.760 --> 14:18.720] You enter a plea if not guilty.
[14:18.720 --> 14:25.040] You do all these things that that clerk has absolutely no authority to do.
[14:25.040 --> 14:29.000] And there is no official proceeding even taking place for it to be done in.
[14:29.000 --> 14:31.920] Yet it's happening right in front of you.
[14:31.920 --> 14:35.200] Don't sign electronic pads.
[14:35.200 --> 14:42.800] Get a hard copy, but don't ever refuse to sign the officer's ticket, okay?
[14:42.800 --> 14:45.320] Don't refuse to sign it.
[14:45.320 --> 14:49.080] Just simply say that you'll be happy to sign it if you'll print out a hard copy.
[14:49.080 --> 14:55.600] Make sure that's audible and clearly stated, I am not refusing to sign the ticket, but
[14:55.600 --> 14:58.840] I will not sign your electronic pad.
[14:58.840 --> 15:03.040] Hand me your hard copy of the ticket, I'll be happy to sign it.
[15:03.040 --> 15:08.640] I'm not going to let you stick my signature on something I haven't seen and read.

[15:12.160 --> 15:19.600] Do not ever argue or discuss the events or facts relating to any accusation an officer
[15:19.600 --> 15:22.160] makes against you.
[15:22.160 --> 15:26.480] Don't do that.
[15:26.480 --> 15:31.640] Everything you say or do discussing the facts or events associated with the allegation can
[15:31.640 --> 15:36.560] be brought up against you in court.
[15:36.560 --> 15:39.600] Shut up when it comes to that.

[15:41.080 --> 15:44.880] Don't argue over any of it, okay?

[15:47.160 --> 15:54.400] Do not lose your temper, your composer, or your self-control, guaranteed that will be
[15:54.400 --> 16:00.360] used against you later if the prosecution thinks in any way that they can benefit from

[16:05.120 --> 16:08.240] being belligerent, they're being hostile, they're cursing at him.

[16:11.320 --> 16:15.000] What was the officer to do except pepper spray and tasum to subdue them and get them out

[20:47.400 --> 20:57.960] have a valid reason for stopping me, why did you stop me, okay, again, that's our question,

[21:03.080 --> 21:08.400] have to give you anything until I have a legitimate reason to believe that you're acting within
[21:08.400 --> 21:18.880] your proper authority, why did you stop me, okay, now, anything else that comes out of
[21:18.880 --> 21:23.720] your mouth that is not specifically directed at invoking a right, demanding a right or
[21:23.720 --> 21:32.360] protecting a right is going to come back and bite you in the dairy air, guaranteed, don't
[21:32.360 --> 21:41.800] be talking about anything that is outside what's in that script, just don't.

[22:45.600 --> 22:51.640] try to do it, it becomes very easy to spot where the mistakes exist, try not to make
[22:51.640 --> 23:04.160] them, all right, now do lock your car doors before you ever pull over and come to a stop,
[23:04.160 --> 23:11.440] again this is in the script, don't however do not lock your doors as the officer or
[23:11.440 --> 23:18.320] officers are approaching your car, I guarantee you the snick sound of that lock clicking

[01:48:34.680 --> 01:48:40.680] Yeah, the judge cannot play the part of the prosecutor unless this is a bench trial.

[01:48:44.680 --> 01:48:53.680] Well, I was looking up some cases that you told me about, you were telling me about civil arrest.
[01:48:53.680 --> 01:48:55.680] I saw it in a few weeks back.
[01:48:55.680 --> 01:49:03.680] And you told me to look at the case law for civil arrest because I told you driving without a seat belt
[01:49:03.680 --> 01:49:07.680] is a civil offense in Michigan and it's not criminal.
[01:49:07.680 --> 01:49:11.680] But the officers said that that's the reason you pulled me over.
[01:49:11.680 --> 01:49:22.680] So, you gave me some case law to that effect and I was just doing some searches on arrest in civil cases.
[01:49:22.680 --> 01:49:33.680] And basically, I found a whole plethora of cases where when that happens,
[01:49:33.680 --> 01:49:41.680] the defendant sued and of course, I failed to sue when they were arrested illegally from civil arrest.
[01:49:41.680 --> 01:49:42.680] Absolutely.
[01:49:42.680 --> 01:49:49.680] And the courts well should because that is false arrest or false imprisonment depending upon what your state criteria for it is.
[01:49:49.680 --> 01:49:52.680] Here in Texas, it's false imprisonment, not arrest.
[01:49:52.680 --> 01:49:54.680] No, I'm just saying.
[01:49:54.680 --> 01:50:04.680] But just when you arrest the custodially also, when they say that they have you on the custodial arrest,
[01:50:04.680 --> 01:50:11.680] this one guy in Michigan, he had some heroin on him and they arrested him for cracking his windshield
[01:50:11.680 --> 01:50:17.680] and they had to let him go because basically the arrest itself was unlawful
[01:50:17.680 --> 01:50:20.680] so anything they uncovered was true to the poison tree.
[01:50:20.680 --> 01:50:22.680] Exactly.
[01:50:22.680 --> 01:50:26.680] So, yes, I still have to melt.
[01:50:26.680 --> 01:50:33.680] I don't know if this is universal, but when you want to give something, a copy to the judge.
[01:50:33.680 --> 01:50:34.680] A copy of what?
[01:50:34.680 --> 01:50:36.680] A motion.
[01:50:36.680 --> 01:50:42.680] You don't, well, okay, let me clarify something real quick so we don't confuse anybody that may be listening.
[01:50:42.680 --> 01:50:47.680] You don't actually file your original copies by giving them to the judge.
[01:50:47.680 --> 01:50:50.680] You file them with the clerk of the court.
[01:50:50.680 --> 01:50:55.680] Now, in court, you can have extra copies and give one to the judge
[01:50:55.680 --> 01:51:00.680] if he doesn't have the one you filed with the court available at the time.
[01:51:00.680 --> 01:51:03.680] Oh, so everything that goes in the court records is what the judge sees.
[01:51:03.680 --> 01:51:05.680] Exactly.
[01:51:05.680 --> 01:51:07.680] Okay, all right.
[01:51:07.680 --> 01:51:12.680] Now, there is a possibility the clerks will have it and the judge will not while they're sitting on the bench
[01:51:12.680 --> 01:51:15.680] and the clerk can either fish it out of the file and hand it to them
[01:51:15.680 --> 01:51:21.680] or you can just say, well, judge, I've got a copy of it right here if you'd like to do that instead of having to tear the file apart.
[01:51:21.680 --> 01:51:22.680] Okay.
[01:51:22.680 --> 01:51:30.680] Because the Michigan, they said that the way you give something to the judges, you got to write judge's copy on it, circle it.
[01:51:30.680 --> 01:51:36.680] That's if you're going to give it to, yeah, if you're going to give it to them in court, then that would probably be the way to do it.
[01:51:36.680 --> 01:51:43.680] But when you're filing it, you always file at least two copies in the court anyway.
[01:51:43.680 --> 01:51:44.680] I didn't know that.
[01:51:44.680 --> 01:51:49.680] Yeah, I always do that simply because that gives them an extra copy.

[01:51:52.680 --> 01:51:57.680] In each one of your pages on your motion, is time stamped or?
[01:51:57.680 --> 01:52:00.680] No, no, no, it just has to be stamped in one place.
[01:52:00.680 --> 01:52:08.680] Now, some courts stamp every page, but most of them just put a stamp either on the last page or the front page.

[01:52:11.680 --> 01:52:21.680] Okay, yeah, because the clerk tried to just do one stamp and I asked her, but she stamped each page and she did it for me, so I didn't.
[01:52:21.680 --> 01:52:24.680] Yeah, they'll do it if you ask them, but it doesn't have to be done.
[01:52:24.680 --> 01:52:36.680] As long as the motion is stapled together and hasn't been separated, then it's evident that that is the motion that was filed from the front or last page file stamp.
[01:52:36.680 --> 01:52:40.680] Yeah, I usually don't staple mine, so I usually want each one of mine.
[01:52:40.680 --> 01:52:55.680] Well, I don't staple them while I'm working on them and doing signatures and things like that, but once they become sets that I'm going to deliver to somebody, now I don't staple the copies I'm keeping, but I do staple the copies I'm filing.

[01:52:57.680 --> 01:53:02.680] And I do staple the copies that I'm serving on the other parties.

[01:54:54.680 --> 01:55:07.680] Dean Clifford is wrong is because the cop is not engaged in a commercially regulable activity for the purpose of profiteering personally, like a driver or an operator is.

[01:55:17.680 --> 01:55:31.680] When you produce a license that says you are permitted to do a certain thing, and the reason I want the license is because I'm asserting you broke a rule associated with that thing.

[01:55:38.680 --> 01:55:48.680] Dean also once said that arguing that you weren't engaged in transportation in the first place is not the best way to go.

[01:55:58.680 --> 01:56:16.680] That's the problem, Andrew, with so many of these folks. They do all kinds of stuff that sounds great until you actually need proof that what they're saying has merit in the courts and they don't get it.
[01:56:16.680 --> 01:56:28.680] I'm not saying that there isn't a grain of truth in what they're saying, but you can't use it in court to your advantage if you don't have a way to support it that the courts accept.

[01:56:47.680 --> 01:56:58.680] I'm not talking about why they don't do anything else. I don't have any evidence of why they're not putting it on his record. Neither does he.
[01:56:58.680 --> 01:57:08.680] He is making an assumption that what he's doing is what kept them from doing that, but he doesn't have any actual evidence of that.
