[01:14.000 --> 01:20.000]  If someone distributed any part of this classified report, they broke the law and should be prosecuted, Feinstein said.
[01:20.000 --> 01:26.000]  The senator's statements come on the heels of McClatchy releasing the 20 conclusions of the Senate Intelligence Committee's report.
[01:26.000 --> 01:34.000]  Last week, the committee voted to send the conclusions in a 480-page summary to President Obama for declassification review.
[01:34.000 --> 01:44.000]  In an appearance on Russian TV, former NSA contractor Edward Snowden asked Russian President Vladimir Putin whether Russia engaged in mass spying of Russian citizens.
[01:44.000 --> 01:51.000]  Putin said Russia does not have as much money as they have in the United States and just doesn't have the technical devices that they have in the States.

[04:46.000 --> 04:52.000]  I'm working on...I'm running the board today and I'm doing a terrible job at it. There we go, finally got it down.
[04:52.000 --> 04:56.000]  Okay, Joe, are you there?
[04:56.000 --> 05:05.000]  Okay, Joe's not here, so until we can get Joe up, I've probably messed up something, first crack out of the hat.
[05:05.000 --> 05:19.000]  So I did...last night we were talking about filing criminal complaints and the process. I haven't went through the process lately.
[05:19.000 --> 05:31.000]  And we're doing a lot more of that up here in Tarrant County area and beginning to have some really good effects from it.
[05:31.000 --> 05:38.000]  Because it seems like about the only thing that really seems to get their attention.
[05:38.000 --> 05:44.000]  And I know most of you hear this a lot. We've been through it a number of times.
[05:44.000 --> 05:57.000]  But it's been a while and we have some new listeners who may have not have heard about how to develop criminal complaints
[05:57.000 --> 06:05.000]  and then how to file them once you get them.
[06:05.000 --> 06:17.000]  I know I get a lot of feedback from this, a lot of blowback when I say I never want any of these public officials actually indicted when I file criminal charges against them now.
[06:17.000 --> 06:30.000]  Some of them may get indicted, but it's not my purpose. My purpose is to get public officials to follow the law the way the law is written.
[06:30.000 --> 06:34.000]  It doesn't matter who it applies to or how it applies to or to follow.
[06:34.000 --> 06:40.000]  We had someone on last night who was stopped by a policeman and didn't get a ticket.
[06:40.000 --> 06:52.000]  But the policeman was pushing him because he objected that he wasn't in commerce and the policeman clearly didn't know what he was talking about.
[06:52.000 --> 07:00.000]  But he felt compelled to push him like a bully on the high school parking lot.
[07:00.000 --> 07:20.000]  We have allowed our public officials to come to the belief that we are civilians and they are apparently occupiers in a occupied country.
[07:20.000 --> 07:27.000]  I had a policeman call me a civilian once and I did not take that well at all.
[07:27.000 --> 07:34.000]  Because I've been in countries where we were essentially an occupying force.
[07:34.000 --> 07:44.000]  And the position civilians are put in in occupied countries is not a position I ever want to be in, in my own country.
[07:44.000 --> 07:48.000]  But of late I tend to feel that way.
[07:48.000 --> 07:55.000]  Police officers feel like they can lie, cheat, do anything they want to.
[07:55.000 --> 08:01.000]  And they will be absolutely protected by everyone around them.
[08:01.000 --> 08:10.000]  Because of this I tend not to blame the police so much as I blame us.
[08:10.000 --> 08:16.000]  We haven't done our job as the masters to control the servants.
[08:16.000 --> 08:27.000]  So we propose a set of methods of how to go about bringing some remedy to these situations.
[08:27.000 --> 08:35.000]  And primarily there's some tools that overdoing the show for a long time and doing what we do for a long time.
[08:35.000 --> 08:43.000]  We've developed some ways of thinking about what we're doing that makes it work out a lot better.
[08:43.000 --> 08:53.000]  And the idea that we're really not trying to get someone indicted, we're not trying to call someone to lose their career.
[08:53.000 --> 08:59.000]  We just want them to follow the law. That helps to make it easier for us to do what we do.
[08:59.000 --> 09:12.000]  And it better explains the concept of not waiting until someone does something horrible.
[09:12.000 --> 09:19.000]  But when they do something horrible everybody says, well, didn't anybody see this coming?
[09:19.000 --> 09:23.000]  Well, we need to see that sort of thing coming.
[09:23.000 --> 09:28.000]  You know, I have some grandkids and I love them dearly.
[09:28.000 --> 09:38.000]  But if they go out and play in the road I'm not going to wait until one of them gets run over to go out there and get them out of the road.
[09:38.000 --> 09:46.000]  The first time one of them sets their first toe on the road, I'm going to jerk them up and tan their behind.
[09:46.000 --> 09:52.000]  Not because I want to do them any harm, because I'm the grandpa. This is my job.
[09:52.000 --> 10:04.000]  Our public officials, we ask them to enforce the law against us to protect us from ourselves, from our own distraction and carelessness.
[10:04.000 --> 10:08.000]  And we don't return the favor. We need to return the favor.
[10:08.000 --> 10:18.000]  And the best complaint to file against a public official is the itty bitty teensy nincy little bitty one.
[10:18.000 --> 10:27.000]  The best time to slam one of them is when it comes out of the clear blue sky.
[10:27.000 --> 10:36.000]  This officer didn't even give Joe a ticket that he was on last night, but he pushed him.
[10:36.000 --> 10:51.000]  Problem with that, Joe couldn't defend himself from being pushed because the officer who pushed him was prominently displaying a deadly weapon.
[10:51.000 --> 11:01.000]  And Joe had every reason to believe that if he resisted the officer, the officer was prepared to pull and discharge that weapon.
[11:01.000 --> 11:08.000]  So Joe had every reason to believe that his life was placed in serious jeopardy.
[11:08.000 --> 11:21.000]  And our legislators fully understood that when they passed 2202B2A, 2202 aggravated assault statute.
[11:21.000 --> 11:31.000]  And it says that if someone commits simple assault, as defined by 2201, and that's offensive touching,
[11:31.000 --> 11:40.000]  it doesn't have to cause harm offensive language or offensive touching, touching the language that an ordinary person of reasonable prudence would find offensive.
[11:40.000 --> 11:52.000]  That's assault. If someone commits assault while prominently displaying a deadly weapon, that's a second degree felony.
[11:52.000 --> 12:05.000]  And the statute doesn't say if a non-public official, ordinary, everyday citizen, it says anyone.
[12:05.000 --> 12:10.000]  And then it goes on to single out public officials.
[12:10.000 --> 12:23.000]  It says that if the person who commits the assault does so while acting, while displaying a deadly weapon
[12:23.000 --> 12:32.000]  and while acting under the color or pretense of an official capacity, that's a first degree felony.
[12:32.000 --> 12:42.000]  It seems our legislators took that pistol these police wear very, very seriously.
[12:42.000 --> 12:52.000]  And they put law in place to prevent our public officials from forgetting how seriously they should take those weapons.
[12:52.000 --> 12:56.000]  This officer clearly forgot that.
[12:56.000 --> 13:08.000]  Thor, he clearly was not concerned about the potential ramifications of an allegation of first degree felony aggravated assault, which could get him to 20 to life.
[13:08.000 --> 13:16.000]  He felt absolutely protected. So how do we fix that? How do we get around him feeling absolutely protected?
[13:16.000 --> 13:19.000]  Well, as we know, the courts are corrupt.
[13:19.000 --> 13:23.000]  And this is a good old boy club. The good old boys protect one another.
[13:23.000 --> 13:27.000]  They all got their schnauz in the same trough.
[13:27.000 --> 13:30.000]  So how do we find remedy?
[13:30.000 --> 13:36.000]  Well, we find remedy by understanding that everything's political.
[13:36.000 --> 13:38.000]  The law don't matter much.
[13:38.000 --> 13:47.000]  The law is just something the political entities use to beat each other up with.
[13:47.000 --> 13:53.000]  So we do the same things, create ourselves a little politics.
[13:53.000 --> 14:05.000]  And the way we do that is we follow the adage that you never ask a public official to do anything that you actually want them to do.
[14:05.000 --> 14:13.000]  You ask public officials to do what the law specifically commands them to do.
[14:13.000 --> 14:26.000]  And the reason you don't care if they do it or not is because what you're asking them is simply your little tar baby you're holding out for them, asking them to touch it.
[14:26.000 --> 14:35.000]  Because when they don't do what the law requires them to do, they touch your tar baby and they stick to it.
[14:35.000 --> 14:47.000]  And in sticking to it, then they become a criminal actor themselves.
[14:47.000 --> 14:56.000]  And as a criminal actor themselves, the next complaint you file will be against them.
[14:56.000 --> 15:11.000]  So you've got this sergeant, chief of police, whatever he is, justice of the peace, that you go to the criminal accusation against this police officer for doing something really ignorant.
[15:11.000 --> 15:19.000]  And this official refuses to perform his duty in order to shield that person from prosecution.
[15:19.000 --> 15:29.000]  Well, now you charge this person and the best one to charge considers himself to be totally innocent.
[15:29.000 --> 15:42.000]  Because when you start filing criminal charges against the one that feels he's totally innocent, he's going to wind up wailing in righteous indignation at the one who got him in this mess.
[15:42.000 --> 15:57.000]  And then the one that you filed the complaint with against the second official, you hope that the third official doesn't take your complaint either, which be district attorney or a higher level district judge.
[15:57.000 --> 16:04.000]  You're the master so you can go anywhere you want to. Any magistrate in the state doesn't make any difference.
[16:04.000 --> 16:21.000]  And I suggest that you move up the chain as quickly as possible. Either go to the prosecutor and when he refuses, you want to go either to the attorney general or even chief justice of the supreme.
[16:21.000 --> 16:32.000]  The problem the low level officials have with the masters is the master can go right to the top.
[16:32.000 --> 16:37.000]  You start creating annoyance and problems for high level people.
[16:37.000 --> 16:44.000]  All of these guys know that in this pool, big fishes swallow little fishes.
[16:44.000 --> 16:50.000]  So we use these criminal complaints to create political pressures.

[21:04.720 --> 21:12.160]  that the judge in this instance was very fair in what he did.
[21:12.160 --> 21:21.280]  He was giving the homeowner every chance to bring forth the proper argument.
[21:21.280 --> 21:31.640]  However, the homeowner at that time wasn't with the right argument that he was bringing
[21:31.640 --> 21:32.640]  to the court.
[21:32.640 --> 21:37.800]  He was bringing one argument, and the court could only rule on what was presented to the
[21:37.800 --> 21:40.440]  court.
[21:40.440 --> 21:49.200]  This happens many times where the homeowner thinks that they have the perfect argument,
[21:49.200 --> 21:54.240]  and then when they go in front of the judge, they realize they don't have the perfect
[21:54.240 --> 21:55.240]  argument.
[21:55.240 --> 21:59.640]  They don't have the cause of action correct.
[21:59.640 --> 22:10.520]  They don't have the proper, they have not laid the proper foundation for their complaint
[22:10.520 --> 22:13.880]  or for their answer.
[22:13.880 --> 22:19.440]  And I know many times, Randy, you even speak about this, laying the proper foundation is
[22:19.440 --> 22:28.120]  everything, because if you don't lay the proper foundation going forward, it's like building

[22:30.480 --> 22:37.840]  It's just going to get blown over, and it just happens all the time.
[22:37.840 --> 22:44.080]  You see people come to court, and they're saying, Randy, I've got a wrongful foreclosure.

[22:48.480 --> 22:55.640]  And on the face, Randy, these things all sound well and good, but what have you got to back
[22:55.640 --> 22:59.200]  up what you were saying?
[22:59.200 --> 23:05.480]  We're telling the banks that the banks are coming forth with your say claims correct.
[23:05.480 --> 23:11.520]  So now the banks are coming to the homeowners, and they're saying, hey, we're filing a motion
[23:11.520 --> 23:15.480]  to dismiss.
[23:15.480 --> 23:18.720]  Homeowners got no standing.
[23:18.720 --> 23:22.000]  Homeowners making hearsay claims.
[23:22.000 --> 23:27.840]  And this is happening whether the homeowner is the plaintiff, or if the homeowner is in
[23:27.840 --> 23:34.100]  a judicial state and the homeowner is a defendant.
[23:34.100 --> 23:38.000]  And it just happens more and more.
[23:38.000 --> 23:44.800]  We need to start setting up the people that are going to the court to have an understanding
[23:44.800 --> 23:47.880]  of what is required.
[23:47.880 --> 23:52.640]  Just because you're a homeowner, the judge is not going to say, oh, that's okay.
[23:52.640 --> 23:53.640]  You're not an attorney.
[23:53.640 --> 23:56.760]  I'm going to give you a break.
[23:56.760 --> 24:03.680]  Because unfortunately, what is happening is that the attorneys are holding the judge to
[24:03.680 --> 24:11.460]  rule correctly if the homeowner is only arguing facts, if the homeowner didn't bring forth
[24:11.460 --> 24:16.840]  a proper claim, and back it up and code pleaded.
[24:16.840 --> 24:22.960]  And when I say code pleaded, I'm saying when you bring forth a cause of action, and you're
[24:22.960 --> 24:29.400]  saying, okay, I've been hurt, okay, and, you know, I'm going to say, let's just say slander
[24:29.400 --> 24:33.720]  of title, then how do I back that up?
[24:33.720 --> 24:40.480]  I need to bring forth the elements pertaining to slander of title, and then I need to bring
[24:40.480 --> 24:48.040]  up my argument, all right, that I'm saying goes to slander of title, and then I'm going
[24:48.040 --> 24:52.560]  to cite a specific statute.
[24:52.560 --> 24:58.720]  So the judge can say, yes, okay, you fact pleaded, now you're going to code plead it.
[24:58.720 --> 25:05.840]  So when you code plead it, all right, now you have evidence to back up your argument.
[25:05.840 --> 25:12.440]  So you're not just factually making a statement, all right, so now when you back it up with
[25:12.440 --> 25:19.060]  a statute and you say, okay, here's the statute I'm using, and then you go back to your argument
[25:19.060 --> 25:28.720]  and you're going to say, okay, now here's how that argument pertains to that statute.
[25:28.720 --> 25:37.800]  And if we can get more and more people doing this, all right, we are going to have better
[25:37.800 --> 25:38.800]  results.
[25:38.800 --> 25:45.320]  Yes, and it's interesting that you should bring that up because I was building a webpage
[25:45.320 --> 25:51.160]  today and I wrote up a paper on exactly that.
[25:51.160 --> 25:59.360]  We need to understand what the judge is there to do.
[25:59.360 --> 26:01.560]  Yes, exactly.
[26:01.560 --> 26:09.000]  When the judges, the reason, Randy, we have so many bad citations, the reason we have
[26:09.000 --> 26:18.000]  so much bad case law, okay, is because we have improper arguments.
[26:18.000 --> 26:25.540]  If you bring only half an argument to the court, all right, then the judge can only
[26:25.540 --> 26:27.440]  rule out what is based.
[26:27.440 --> 26:30.680]  If you look at, first of all, that will sink.
[26:30.680 --> 26:38.600]  If you look at, again, a number of court cases that have been monumental, that in which the
[26:38.600 --> 26:49.400]  court has ruled for the banks or ruled for MERS, okay, it's really pretty interesting
[26:49.400 --> 26:52.880]  that.
[26:52.880 --> 26:58.920]  If you look at what was given to the judge, the judge based his decision on the argument.
[26:58.920 --> 27:04.600]  He based his decision on these citations that were given to him.
[27:04.600 --> 27:10.800]  When you jeopardize a case, you need to look at that entire case that you are citing because
[27:10.800 --> 27:19.560]  if you improperly cite a case that has a few good points and you're going to use this,
[27:19.560 --> 27:28.320]  and your opponent, the opposing counsel, all right, looks at that case and he finds that,
[27:28.320 --> 27:33.000]  wow, there are some things in here now that I can use since you brought up this case.
[27:33.000 --> 27:37.960]  Let's see what really happened to this case.
[27:37.960 --> 27:42.120]  People need to really take a look at what they're arguing.
[27:42.120 --> 27:45.560]  What are they bringing forth to the table?
[27:45.560 --> 27:50.200]  If I'm coming forth and I'm saying, all right, I'm going to file a quiet title action, well,
[27:50.200 --> 27:56.200]  okay, so what statute are you using for this quiet title action?
[27:56.200 --> 28:01.600]  When are you using this quiet title action?
[28:01.600 --> 28:08.560]  This is something that most people don't take a look at, you know, one needs to sit down
[28:08.560 --> 28:11.600]  and make a determination.
[28:11.600 --> 28:14.960]  What is it that I'm looking to achieve?
[28:14.960 --> 28:23.260]  Where am I today in this process that we need to address, okay?
[28:23.260 --> 28:25.220]  Am I just going into foreclosure?
[28:25.220 --> 28:28.520]  Have I been into foreclosure for a while?

[34:21.600 --> 34:26.600]  But more than that, there's something we have to understand about the courts.
[34:26.600 --> 34:31.600]  And it just happened that today I was writing up a document for a webpage I was building.
[34:31.600 --> 34:34.600]  It went exactly to that.
[34:34.600 --> 34:38.600]  And I'm going to kind of read through this real quickly and do it more succinctly than
[34:38.600 --> 34:41.600]  if I do it off the cuff.
[34:41.600 --> 34:45.600]  How to save your property, sue the courts.
[34:45.600 --> 34:47.600]  That's the short and long of it.
[34:47.600 --> 34:48.600]  You can try to talk to the banks.
[34:48.600 --> 34:50.600]  You can try to reason with the banks.
[34:50.600 --> 34:52.600]  You can even try to negotiate with the banks.
[34:52.600 --> 34:57.600]  But until you sue them, they'll simply keep doing what they intend to do without any regard
[34:57.600 --> 34:59.600]  to your concerns.
[34:59.600 --> 35:05.600]  First lesson always, the banks are about money and how much they can extract, how much of
[35:05.600 --> 35:07.600]  it they can extract from you.
[35:07.600 --> 35:10.600]  Neither right, wrong, nor rule of law matter, only the bottom line.
[35:10.600 --> 35:13.600]  This is not intended as an indictment or a judgment.
[35:13.600 --> 35:15.600]  It's merely how things are.
[35:15.600 --> 35:21.600]  In the end, the only thing that will slow the juggernaut is a lawsuit as it costs them
[35:21.600 --> 35:25.600]  money and affects the bottom lines.
[35:25.600 --> 35:26.600]  You can go into court.
[35:26.600 --> 35:28.600]  You have to understand the courts are corrupt.
[35:28.600 --> 35:33.600]  If you're to prevail against the banks, you have to understand how things are as opposed
[35:33.600 --> 35:35.600]  to the way you have been led to believe.
[35:35.600 --> 35:39.600]  The first thing you need to understand is that the courts are corrupt.
[35:39.600 --> 35:40.600]  They're totally corrupt.
[35:40.600 --> 35:42.600]  Well, maybe they're not.
[35:42.600 --> 35:47.600]  However, if you are to prevail against the banks, you must act as if the court will rule
[35:47.600 --> 35:50.600]  against you out of hand at every turn.
[35:50.600 --> 35:54.600]  This is not an indictment of the courts, but rather a strategy.
[35:54.600 --> 35:59.600]  By always expecting the court to rule against you out of hand at every turn, you will be
[35:59.600 --> 36:06.600]  better able to dispel those notions about good faking fair beings and develop strategies.
[36:06.600 --> 36:14.600]  The trial court is only there to develop the facts in accordance with the rules of evidence,
[36:14.600 --> 36:19.600]  then apply the law as it comes to the facts in the case.
[36:19.600 --> 36:23.600]  We absolutely must understand this.
[36:23.600 --> 36:27.600]  You will only use the trial court for the purpose of getting the facts and the law in
[36:27.600 --> 36:29.600]  the record.
[36:29.600 --> 36:34.600]  If you understand, the only purpose of the court is to get the facts before the court
[36:34.600 --> 36:38.600]  and the law as it applies to those facts before the court.
[36:38.600 --> 36:41.600]  You won't be as concerned when the court rules against you.
[36:41.600 --> 36:46.600]  The real action is in the court of appeals.
[36:46.600 --> 36:50.600]  Do not expect the trial court to rule in your favor.
[36:50.600 --> 36:55.600]  If it does, that's nice, but of little importance in the overall scheme of things, as if you
[36:55.600 --> 36:59.600]  get a positive ruling, the other side is going to appeal.
[36:59.600 --> 37:04.600]  If the court rules against you, so long as you have the facts and the law before the
[37:04.600 --> 37:06.600]  court, you're ready to appeal yourself.
[37:06.600 --> 37:10.600]  Court of appeals is where you will be in your case.
[37:10.600 --> 37:14.600]  Facts are evidence and affidavit.
[37:14.600 --> 37:18.600]  Facts are nouns, hard things, objects, pieces of paper.
[37:18.600 --> 37:20.600]  Facts are tangible.
[37:20.600 --> 37:27.600]  Your opinions concerning alleged facts, they are intangible and not evidence.
[37:27.600 --> 37:35.600]  In order to prosecute a claim, you must have evidence the court can see, feel, and allow
[37:35.600 --> 37:37.600]  before it.
[37:37.600 --> 37:41.600]  Part missing here about foundation.
[37:41.600 --> 37:46.600]  You can't just come in and hand a fact to the court.
[37:46.600 --> 37:53.600]  If you've ever been in a traffic case, the prosecutor will bring the police officer up
[37:53.600 --> 38:00.600]  on the stand and he'll ask him his name and how long he's been a police officer and where
[38:00.600 --> 38:06.600]  he got his certification, how long he's been certified, what specific training he has in
[38:06.600 --> 38:07.600]  this area.
[38:07.600 --> 38:12.600]  This is establishing foundation for the officer's testimony.
[38:12.600 --> 38:16.600]  You can't just bring the officer on the stand and have him start testifying about what he
[38:16.600 --> 38:17.600]  did.
[38:17.600 --> 38:23.600]  He has to establish foundation for the officer's testimony before he brings it.
[38:23.600 --> 38:29.600]  When I put together a statement of facts concerning foreclosure issue, especially like a quiet
[38:29.600 --> 38:35.600]  title or a trek pass to try a title, when I get people to send me the documentation,
[38:35.600 --> 38:40.600]  the very first thing I need is a warranty deed.
[38:40.600 --> 38:44.600]  The warranty deed is a primary fact.
[38:44.600 --> 38:54.600]  I make this statement, on this day, a document was filed with the county recorder being given
[38:54.600 --> 39:00.600]  document number so-and-so entitled as follows, warranty deed.
[39:00.600 --> 39:05.600]  Stating that the document is filed in the county recorder's office on a certain day,
[39:05.600 --> 39:11.600]  given a certain number, that establishes foundation for the warranty deed.
[39:11.600 --> 39:19.600]  The warranty deed establishes the standing of the petitioner to come before the court.
[39:19.600 --> 39:26.600]  If you start your facts with the deed of trust, you have it established that you have standing
[39:26.600 --> 39:28.600]  to come before the court.
[39:28.600 --> 39:35.600]  That was highlighted recently in a case where there was a deed of trust in the record, but
[39:35.600 --> 39:37.600]  there was no warranty deed.
[39:37.600 --> 39:43.600]  I agree with you, I mean on that, with the warranty deed, Randy.
[39:43.600 --> 39:52.600]  However, I will share this, that many times what you see happening is that the parties
[39:52.600 --> 40:01.600]  that come to the court, they argue in a one-dimensional area alone.
[40:01.600 --> 40:06.600]  They argue on either the security instrument.
[40:06.600 --> 40:11.600]  They argue to the note.
[40:11.600 --> 40:14.600]  They argue to the PSA.
[40:14.600 --> 40:18.600]  They don't argue everything in tandem.
[40:18.600 --> 40:24.600]  When you argue, you need to articulate your arguments pertaining to the intangible
[40:24.600 --> 40:32.600]  promissory note, pertaining to the intangible obligation, and pertaining to the security
[40:32.600 --> 40:39.600]  instrument all at the same time and in tandem.
[40:39.600 --> 40:44.600]  Because if you just argue one, you're going to get your butt kicked.
[40:44.600 --> 40:48.600]  They're going to kick it all over the place.
[40:48.600 --> 40:53.600]  I've seen that this week in court.
[40:53.600 --> 41:00.600]  The judges, what they're doing is they're taking their court and they're turning it
[41:00.600 --> 41:13.600]  into a court of equity and they're not having it go into a court of law.
[41:13.600 --> 41:18.600]  So it's quite interesting when you're saying this that you're writing a paper on it
[41:18.600 --> 41:27.600]  because it's a foundation to see does the party have standing and what is it that the
[41:27.600 --> 41:31.600]  party is attempting to do.
[41:31.600 --> 41:33.600]  So are they looking to come forth and fight?
[41:33.600 --> 41:37.600]  Are they looking to defend?
[41:37.600 --> 41:42.600]  Many times they're trying to do the same thing at the same time and they don't know what
[41:42.600 --> 41:45.600]  it is that they're trying to do.
[41:45.600 --> 41:48.600]  They've got apples and oranges that they're arguing.
[41:48.600 --> 41:55.600]  They're saying, Your Honor, so-and-so doesn't have a leg in this game at all.
[41:55.600 --> 42:01.600]  And yet at the same time they're saying so-and-so hurt me, so-and-so did this.
[42:01.600 --> 42:08.600]  And the judges are confused, like you said, Randy, because they can only articulate their
[42:08.600 --> 42:15.600]  findings on the arguments and the facts that are brought into evidence.
[42:15.600 --> 42:23.600]  If there is nothing that is evident into the court, how is the court supposed to make a
[42:23.600 --> 42:26.600]  ruling?
[42:26.600 --> 42:33.600]  I mean, if you don't have evidence into the court, Randy, do you expect the court to rule
[42:33.600 --> 42:36.600]  in your favor?
[42:36.600 --> 42:41.600]  Well, in fact, the court has no power to rule in my favor.
[42:41.600 --> 42:50.600]  You can go to the court and give the court the most convincing argument and the, sorry,
[42:50.600 --> 42:57.600]  the most cogent argument and the most convincing reasons as to why he should rule in your favor.
[42:57.600 --> 42:59.600]  And he may agree with you.
[42:59.600 --> 43:07.600]  But if you have not given him facts and law as it applies to those facts, he has no power
[43:07.600 --> 43:11.600]  to rule in your favor.
[43:11.600 --> 43:17.600]  So first you have to establish all of the facts concerning your issue.
[43:17.600 --> 43:25.600]  Then you have to show the law that applies to those facts and how the law applies to
[43:25.600 --> 43:32.600]  the facts in a way that it leads to establishing the cause of action that you claimed.
[43:32.600 --> 43:33.600]  Correct.
[43:33.600 --> 43:34.600]  Does that make sense?
[43:34.600 --> 43:39.600]  And backing up that cause of action is everything, Randy.
[43:39.600 --> 43:40.600]  Okay.

[48:08.600 --> 48:16.600]  Anyway, they gave me a paper saying that the reason for refusal to report was no authority to report,
[48:16.600 --> 48:22.600]  and then code section reference, and then they gave me government code 27201.
[48:22.600 --> 48:29.600]  And basically, they told me if I continue to – the paper says in the investment – what does it say?
[48:29.600 --> 48:33.600]  It is a public offense to further attempt to report a document without an order of report.
[48:33.600 --> 48:38.600]  They want me to get some type of order of report to record this document.
[48:38.600 --> 48:43.600]  Yeah, just file for a petition for declaratory judgment.
[48:43.600 --> 48:46.600]  I'm sorry, petition for what? Petition to what?
[48:46.600 --> 48:50.600]  Petition for declaratory judgment.
[48:50.600 --> 48:55.600]  Before you do that, you might want to check with your – run that by your AG.

[49:05.600 --> 49:11.600]  They think that you're trying to file some kind of wacky patriot mythological thing out there.
[49:11.600 --> 49:13.600]  So run it by your AG.
[49:13.600 --> 49:19.600]  There's a lady out here in Texas who had problems with her clerk,
[49:19.600 --> 49:26.600]  and she ran it by the AG Greg Abbott here in Texas, and Greg Abbott wrote a nice little letter to the clerk
[49:26.600 --> 49:36.600]  and said you will file these documents just as he wants them done or as she wants them done.

[49:38.600 --> 49:39.600]  Correct.
[49:39.600 --> 49:48.600]  And in California, it is a crime for the clerk to file a document that's not authorized to be filed.
[49:48.600 --> 49:57.600]  That's why I suggested declaratory judgment, and that's why the clerk referred him to a judgment.

[50:00.600 --> 50:05.600]  The clerk is uncomfortable about filing this document.
[50:05.600 --> 50:08.600]  So it sounds like she did exactly right.

[50:55.600 --> 50:59.600]  So she's most likely gotten somewhat sensitive.
[50:59.600 --> 51:00.600]  Yeah.
[51:00.600 --> 51:03.600]  Well, there's a lot of people that are doing administrative processes.
[51:03.600 --> 51:04.600]  Yes.
[51:04.600 --> 51:08.600]  And, you know, there is a lot to be said for what is being filed.
[51:08.600 --> 51:16.600]  If you look back, Joe, at a couple of years ago, there were many homeowners, thousands, that were trying to reconvey their property.
[51:16.600 --> 51:17.600]  Okay.
[51:17.600 --> 51:20.600]  So you hear all crazy things that were being tried.
[51:20.600 --> 51:25.600]  So the homeowner is trying to cover her butt as to the proper documentation.
[51:25.600 --> 51:30.600]  So you need to pull up your statute pertaining to recordation.
[51:30.600 --> 51:31.600]  Recordation.
[51:31.600 --> 51:32.600]  Okay.

[01:12:26.600 --> 01:12:28.600]  You will lose those.
[01:12:28.600 --> 01:12:36.600]  However, unique to Texas, all of Texas land was patented during the rain.
[01:12:36.600 --> 01:12:43.600]  I will say of the Republic of Texas before the state took over or took place of the Republic
[01:12:43.600 --> 01:12:50.600]  of Texas, all land with the exception of 2% that being the only real public land belonging
[01:12:50.600 --> 01:12:54.600]  to school districts was patented.
[01:12:54.600 --> 01:13:00.600]  Now, here in Texas, and I think it may be the same in other states, you might look up
[01:13:00.600 --> 01:13:03.600]  the history of land patents in California.
[01:13:03.600 --> 01:13:08.600]  However, to use Texas as an example, there's two things you can do.
[01:13:08.600 --> 01:13:12.600]  You can either get the new one without the mineral or water rights, or you can accept
[01:13:12.600 --> 01:13:20.600]  the existing patent that was issued by the Republic of Texas along with the water rights
[01:13:20.600 --> 01:13:22.600]  and the mineral rights.
[01:13:22.600 --> 01:13:23.600]  OK.
[01:13:23.600 --> 01:13:29.600]  When you patent your land, please keep in mind this is the difference between ownership
[01:13:29.600 --> 01:13:35.600]  interest and absolute ownership.
[01:13:35.600 --> 01:13:46.600]  If you possess land or possess property by deed, that is inferior to a patent.
[01:13:46.600 --> 01:13:47.600]  OK.
[01:13:47.600 --> 01:13:51.600]  A patent is superior to any deed.
[01:13:51.600 --> 01:13:52.600]  OK.
[01:13:52.600 --> 01:13:56.600]  Now, what comes along with that?
[01:13:56.600 --> 01:14:06.600]  Well, if you accept a patent and you take ownership of the land, now you can challenge
[01:14:06.600 --> 01:14:07.600]  taxing authorities.
[01:14:07.600 --> 01:14:11.600]  You can challenge their right to patent what belongs to you.
[01:14:11.600 --> 01:14:13.600]  You own it.
[01:14:13.600 --> 01:14:20.600]  If you only have ownership interest by deed, they're going to tax you as much as they can
[01:14:20.600 --> 01:14:22.600]  as often as they can.
[01:14:22.600 --> 01:14:24.600]  They're going to squeeze you dry.
[01:14:24.600 --> 01:14:31.600]  However, if you own something, now you can challenge another party's claim to some type
[01:14:31.600 --> 01:14:34.600]  of attachment to what you own.
[01:14:34.600 --> 01:14:38.600]  And if they cannot prove up their claim, then they've got to back off.
[01:14:38.600 --> 01:14:45.600]  In the case of taxing authorities for property taxes, if you challenge their right to tax
[01:14:45.600 --> 01:14:53.600]  your land showing superior, ultimate ownership, superior title, nobody has a lien on my property,
[01:14:53.600 --> 01:14:57.600]  it's mine, this land is mine, what right do you have to it?
[01:14:57.600 --> 01:15:02.600]  If they cannot prove up within the eyes of the law that they have the authority and the
[01:15:02.600 --> 01:15:06.600]  right and all that to tax you, guess what they got to do?
[01:15:06.600 --> 01:15:09.600]  They got to remove your property from tax rolls.
[01:15:09.600 --> 01:15:10.600]  Yes.
[01:15:10.600 --> 01:15:13.600]  That creates another problem.
[01:15:13.600 --> 01:15:20.600]  If you're off the tax rolls and your house catches on fire, who's going to pee on it
[01:15:20.600 --> 01:15:23.600]  to put it out?
[01:15:23.600 --> 01:15:25.600]  Well, guess what?
[01:15:25.600 --> 01:15:26.600]  Guess what?
[01:15:26.600 --> 01:15:27.600]  Hang on.

[01:37:28.600 --> 01:37:35.600]  then we charge them with negligence for making a negligent claim.

[01:39:36.600 --> 01:39:49.600]  And we put all the statute that says that we can request it and the lender must produce it or the debtor may cease all payments without dishonor.

[01:39:52.600 --> 01:39:58.600]  Yeah, and once we've ceased payments without dishonor, then they've demanded payment again,
[01:39:58.600 --> 01:40:07.600]  and 15 U.S. Code 1692-G forbids them from making further attempts to collect the debt
[01:40:07.600 --> 01:40:13.600]  subsequent to the filing of the debt validation letter and property validation in the debt.
[01:40:13.600 --> 01:40:26.600]  So those are the facts, and we maintain that by making this demand for payment after receiving the debt validation letter,
[01:40:26.600 --> 01:40:35.600]  and prior to validating the debt, they violated this code, and the violation of the code is the date that they committed negligence.
[01:40:35.600 --> 01:40:39.600]  I have fraud claims in there, but I really need to take them out.
[01:40:39.600 --> 01:40:45.600]  I have all of the elements in there, but they always complain about my—no matter what you—
[01:40:45.600 --> 01:40:50.600]  whenever you claim fraud, they always complain that you don't have all the elements.

[01:48:47.600 --> 01:49:00.600]  When Bank of America came to the clerk and filed a deed of trust or a mortgage, was this in California or Illinois?

[01:49:02.600 --> 01:49:10.600]  Okay. When Bank of America came to the clerk and filed a deed of trust, that deed of trust was fraudulent
[01:49:10.600 --> 01:49:18.600]  because the deed of trust claimed that Bank of America had a claim against your property.

[01:49:19.600 --> 01:49:23.600]  But they already sold it. They didn't have one anymore.
[01:49:23.600 --> 01:49:30.600]  Well, what's interesting about the whole situation is that if you do a search on the Bloomberg Terminal,
[01:49:30.600 --> 01:49:44.600]  it'll show a Fannie Mae Remic Trust and the acquisition date is exactly 31 days later from what they're reporting on their Fannie Mae website.
[01:49:44.600 --> 01:49:47.600]  Can you say that one more time?
[01:49:47.600 --> 01:50:03.600]  I said what is interesting is the Fannie Mae website reports them buying or purchasing the loan on December 1st of 2009.
[01:50:03.600 --> 01:50:15.600]  But when you do a Bloomberg search, it says that a Fannie Mae Remic Trust, the acquisition date was 31 days later, which was January 1st, 2010.
[01:50:15.600 --> 01:50:19.600]  All right. Here, let me ask you this. When you say who's doing the Bloomberg search,
[01:50:19.600 --> 01:50:26.600]  because what you need to do is you need to go into the trust agreement. You need to go into the start-up date and the issue date.
[01:50:26.600 --> 01:50:35.600]  All right. There's two different things. All right. The date it was issued and the date that it starts up are 30 days apart, 29 to 30 days, depending upon the month.
[01:50:35.600 --> 01:50:37.600]  Okay. Well, the issue date-
[01:50:37.600 --> 01:50:50.600]  and what you have to understand is what was sold to Fannie Mae. Fannie Mae purchases mortgage loan instrument interest.
[01:50:50.600 --> 01:51:03.600]  They purchase a partial interest of the mortgage loan instrument, that partial interest being the payment intangible, the transferable record.
[01:51:03.600 --> 01:51:16.600]  So they say if you're in California, all right, within your deed of trust covenant 20, the note or a partial interest of the note,
[01:51:16.600 --> 01:51:24.600]  together with the security instrument, may be sold one or more times without notice to the borrower.
[01:51:24.600 --> 01:51:39.600]  That's what they say. However, that is a legal impossibility as the security instrument can only follow a properly perfected note.
[01:51:39.600 --> 01:51:45.600]  The security instrument cannot follow a partial interest of the note.
[01:51:45.600 --> 01:51:56.600]  So regardless of what it says, the homeowner for a innocence of consciousness did not understand what he was signing when he signed that unilateral contract.
[01:51:56.600 --> 01:52:07.600]  Did you understand when you signed the contract what that contract meant? Because you only had about 80 or 90 pages in front of you that you had to sign.
[01:52:07.600 --> 01:52:08.600]  Correct.
[01:52:08.600 --> 01:52:17.600]  And I will tell you, even in the states that have attorneys, the attorneys do not have an understanding of what that contract says.
[01:52:17.600 --> 01:52:24.600]  It's a one-sided contract that was written by another party and it's given to you.
[01:52:24.600 --> 01:52:28.600]  And you're told, trust me, would I lie?
[01:52:28.600 --> 01:52:33.600]  I have read the contract several times.
[01:52:33.600 --> 01:52:34.600]  Me too.
[01:52:34.600 --> 01:52:37.600]  I cannot make sense of it.
[01:52:37.600 --> 01:52:42.600]  So when you understand what was sold to Fannie Mae, all right?
[01:52:42.600 --> 01:52:49.600]  So if you have your trust agreement pertaining to that trust, all right?
[01:52:49.600 --> 01:52:55.600]  So what you're going to do is you're going to look at the issue date and you're going to look at the startup date.
[01:52:55.600 --> 01:52:57.600]  There's two different dates.
[01:52:57.600 --> 01:52:58.600]  And again.
[01:52:58.600 --> 01:53:01.600]  I have an issue date and I have an issue date.
[01:53:01.600 --> 01:53:02.600]  Okay.
[01:53:02.600 --> 01:53:05.600]  So what is the issue date and what is the startup date?
[01:53:05.600 --> 01:53:17.600]  The issue date is January 1, 2010 and the issue date, excuse me, the acquisition date is January 1, 2010 and the issue date is January 29, 2010.
[01:53:17.600 --> 01:53:18.600]  Okay.
[01:53:18.600 --> 01:53:25.600]  So the later date is going to be the latest date in which assets can be put into the trust.
[01:53:25.600 --> 01:53:30.600]  And again, you have to have an understanding as to what is an asset?
[01:53:30.600 --> 01:53:33.600]  What is a conveyance?
[01:53:33.600 --> 01:53:36.600]  A conveyance is a transfer.
[01:53:36.600 --> 01:53:42.600]  Now, is a sale a conveyance?
[01:53:42.600 --> 01:53:45.600]  Is a conveyance a sale?
[01:53:45.600 --> 01:53:46.600]  It depends.
[01:53:46.600 --> 01:53:49.600]  Is there consideration?
[01:53:49.600 --> 01:53:52.600]  So these are things you need to have an understanding about.
[01:53:52.600 --> 01:53:54.600]  What was sold?
[01:53:54.600 --> 01:53:55.600]  When was sold?
[01:53:55.600 --> 01:53:56.600]  All right.
[01:53:56.600 --> 01:54:10.600]  If you go to the deposition of Linda DiMartini in the Kemp versus Countrywide case, and I believe it's on page 14, Linda DiMartini states, Countrywide is in the business of selling beneficial interest.
[01:54:10.600 --> 01:54:15.600]  Countrywide is not in the business of selling notes.
[01:54:15.600 --> 01:54:43.600]  And so now when you look at when these banks come forth and they come to the court, and whether it's Wells Fargo claiming successor in ownership to Wachovia, who's claiming successor in interest to World Savings Bank or JPMorgan Chase saying, you know, I'm the successor in interest to Washington Mutual or Bank of America coming forth saying I'm successor to Countrywide.

[01:54:46.600 --> 01:54:50.600]  They acquired personal property, Brian.
[01:54:50.600 --> 01:54:52.600]  Not real property.
[01:54:52.600 --> 01:54:54.600]  They've acquired personal property.
[01:54:54.600 --> 01:55:05.600]  In the case of Bank of America and Countrywide, all right, Bank of America acquired hundreds of thousands of boxes filled with millions of pieces of paper.
[01:55:05.600 --> 01:55:19.600]  And within some of these pieces of paper, all right, there were debt obligations that were evidenced by these pieces of paper that were one-time promissory notes.
[01:55:19.600 --> 01:55:48.600]  But with that promise to pay ripped out and sold on the secondary market, there was no debt to evidence, and with the debt being sold and no longer evidenced by that tangible piece of paper, you've now decreased the value of the security instrument causing that security instrument to be a nullity by operation of law.
[01:55:48.600 --> 01:55:58.600]  So they have a piece of paper which is simple possession with no legal rights conferred.
[01:55:58.600 --> 01:56:06.600]  Because in order to acquire legal rights, you need to acquire them statutorily.
[01:56:06.600 --> 01:56:19.600]  To acquire them statutorily, all right, then there's certain things they must have done in order to acquire these rights. Does that make sense?
