[01:55.120 --> 01:56.840]  Well, pretty much nothing.
[01:56.840 --> 02:01.240]  While the Europeans and Americans have condemned Russia's movements, China has now said they
[02:01.240 --> 02:06.000]  are largely in agreement over Ukraine, which means the Chinese and the Russians are on
[02:06.000 --> 02:08.000]  one side, the Western countries on the other.
[02:08.000 --> 02:12.220]  And in reality, the US and NATO can get mad, they can make noise, they don't have the power
[02:12.220 --> 02:13.760]  to really do much here.
[02:13.760 --> 02:18.680]  Now, what is most amazing, though, is how the United States, that has over 700 bases
[02:18.680 --> 02:23.440]  around the world, is drone-striking in Pakistan, Mali, Yemen, and Somalia.
[02:23.440 --> 02:30.040]  The US involved in Syria, in Libya, Iraq, Afghanistan, all across Northern Africa, well,
[02:30.040 --> 02:33.960]  you might say we're a little bit leveraged, but when Russia moves soldiers across the
[02:33.960 --> 02:39.160]  border into Ukraine, into areas filled with Russian-speaking people, with Russian allegiance,
[02:39.160 --> 02:44.120]  the West becomes enraged, shocked, and feels that action must be taken.

[04:17.300 --> 04:25.300]  Okay, we were kind of going through the basics. It's a little bit hard to wrap your head around,
[04:25.300 --> 04:35.300]  because when we think about a mortgage issue, we tend to pick up the issues that the other side throws at us.
[04:35.300 --> 04:47.300]  They poke us, they jab us, and we do this little dance for them. And it's hard to get people to take a step back.
[04:47.300 --> 04:59.300]  First thing is pay no attention to what the other side said, and look at the situation as clearly as you can.
[04:59.300 --> 05:11.300]  You actually want to look at both sides. But first thing you do always, if it's a foreclosure issue, is look at what is in the public record.
[05:11.300 --> 05:15.300]  Everybody knows what's in the public record.
[05:15.300 --> 05:17.300]  The moment it's there.
[05:17.300 --> 05:24.300]  Exactly. Whether they actually know it or not, they have imputed knowledge of what is in there.
[05:24.300 --> 05:28.300]  Right. That's constructive notice to the world.
[05:28.300 --> 05:33.300]  Exactly. So the first thing is look at what's in there.
[05:33.300 --> 05:46.300]  And then in Texas, we have 13.001 property code that says that any claim against real property not acknowledged
[05:46.300 --> 05:52.300]  or proven and properly filed in the county record is voidous to the holder.
[05:52.300 --> 06:07.300]  So anyone who's claiming a position of holder of any claim, go look in the record and see what the record says about how they got that claim.
[06:07.300 --> 06:27.300]  If you can't find their claim in the record, then your claim to the court is that this entity lacks standing to invoke the subject matter jurisdiction of the court.
[06:27.300 --> 06:35.300]  You don't go into the court and ask the court to rule that the person doesn't have standing.
[06:35.300 --> 06:49.300]  You go to the court and say you don't have power to rule over anything because they did not have the standing to invoke your jurisdiction.
[06:49.300 --> 06:52.300]  That changes everything.
[06:52.300 --> 06:55.300]  That potentially puts the judge on the dime.
[06:55.300 --> 07:05.300]  I had a judge that filed a challenge to subject matter jurisdiction in Garland, Texas, a JP up there.
[07:05.300 --> 07:11.300]  Without reading the challenge, he granted the forcible detainer.
[07:11.300 --> 07:24.300]  When you file a challenge to subject matter jurisdiction, it does not matter if your challenge to jurisdiction is frivolous and without standing.
[07:24.300 --> 07:42.300]  When you file it, the court loses subject matter jurisdiction immediately and they cannot regain subject matter jurisdiction until jurisdiction is proven.
[07:42.300 --> 07:51.300]  So whether or not my pleading had legal foundation or not was irrelevant.
[07:51.300 --> 07:57.300]  The judge did not hold a hearing on the motion, acted.
[07:57.300 --> 08:11.300]  He performed a judicial function and he did so in impersonation of a public official.
[08:11.300 --> 08:23.300]  He ordered the eviction of this person and had sheriff's deputies with loaded pistols come out and throw this woman out of her house she's lived in for the last 30 years.
[08:23.300 --> 08:27.300]  I call that first degree felony aggravated assault.
[08:27.300 --> 08:30.300]  You want to have yourself an attitude judge?
[08:30.300 --> 08:35.300]  I'll see if I can't tear a little of your attitude off.
[08:35.300 --> 08:41.300]  So subject matter jurisdiction is a very powerful pleading to file.
[08:41.300 --> 08:45.300]  That's what you want to look at initially.
[08:45.300 --> 08:59.300]  And when you file it, the other side is going to come back with these alleged facts claiming how they have standing.
[08:59.300 --> 09:05.300]  And that's when you want Joe's evaluation.
[09:05.300 --> 09:09.300]  So once they commit themselves, they can't back up.
[09:09.300 --> 09:13.300]  There's something else to remember too about standing.
[09:13.300 --> 09:17.300]  Standing cannot be proven from the mouth of the agent.
[09:17.300 --> 09:21.300]  It must be proven by the mouth of the principal.
[09:21.300 --> 09:29.300]  Agency cannot be proven from the mouth of the agent.
[09:29.300 --> 09:33.300]  It must be proven from the mouth of the principal.
[09:33.300 --> 09:40.300]  In order to engage an agent with authority, he must have standing.
[09:40.300 --> 09:48.300]  So in order for them to prove standing, the agent can't come in there and testify to the court.
[09:48.300 --> 09:52.300]  The principal must come in and testify to the court.
[09:52.300 --> 10:00.300]  Now, the only thing the agent can do is present the court with verified affidavits.
[10:00.300 --> 10:14.300]  And in this case, we're charging those who prepared verified affidavits with aggravated perjury tampering with a government document because their affidavits were fraudulent.
[10:14.300 --> 10:19.300]  Well, then you have 18 U.S.C. Chapter 47, 1021.
[10:19.300 --> 10:21.300]  No, I don't want to go there.
[10:21.300 --> 10:25.300]  I want to avoid it.
[10:25.300 --> 10:27.300]  You don't want to go to Rico?
[10:27.300 --> 10:29.300]  No, I do not want to go to Rico.
[10:29.300 --> 10:31.300]  I'm going to go to Rico.
[10:31.300 --> 10:34.300]  But first, I want them prosecuted.
[10:34.300 --> 10:37.300]  And this is kind of a strategy I'm working on.
[10:37.300 --> 10:43.300]  Rather than file suit against him immediately, the first thing I'm going to do is try to get him put in prison.
[10:43.300 --> 10:46.300]  Well, let's get declaratory relief first.
[10:46.300 --> 10:48.300]  Keep a roof over your head.
[10:48.300 --> 10:49.300]  No, no, no.
[10:49.300 --> 10:51.300]  First thing I do here.
[10:51.300 --> 10:52.300]  Yeah.
[10:52.300 --> 10:53.300]  OK.
[10:53.300 --> 11:00.300]  That's the second thing we do is declaratory relief.
[11:00.300 --> 11:02.300]  My tongue got tangled.
[11:02.300 --> 11:28.300]  Declaratory relief, when you do that, you do an in rim, you sue the property, you file in action and you only ask the judge to render a declaration that this document, as filed in the record, is filed in violation of the filing requirements of the state.
[11:28.300 --> 11:34.300]  Do not allow the judge to give you any ruling beyond that.
[11:34.300 --> 11:42.300]  Do not allow the judge to rule on the validity of any claim the other party may have.
[11:42.300 --> 11:46.300]  The judges will use that to screw you with.
[11:46.300 --> 11:59.300]  They'll give you your declaratory judgment and then they will rule that the other party has no standing to enforce a claim against the property.
[11:59.300 --> 12:05.300]  When the other party appeals, the appeals court will throw it out.
[12:05.300 --> 12:17.300]  So if the judge tries to rule on anything other than the sufficiency of this document, you object and don't ask for anything. Don't ask for any damages.
[12:17.300 --> 12:18.300]  Correct.
[12:18.300 --> 12:27.300]  Just all you want him to do is rule is does this document meet the statutory filing requirements?
[12:27.300 --> 12:33.300]  Once you have that in hand, that becomes res judicata.
[12:33.300 --> 12:38.300]  Res judicata meaning laws established in your case.
[12:38.300 --> 12:41.300]  Yeah, already adjudicated.
[12:41.300 --> 12:50.300]  So now you file a wrongful foreclosure or wrongful foreclosure, they want you to tender. So don't file wrongful foreclosure.
[12:50.300 --> 12:53.300]  File for an injunctive relief first.
[12:53.300 --> 13:01.300]  Well, injunctive relief goes with the filing. That's the restraining order.
[13:01.300 --> 13:05.300]  But you file a...
[13:05.300 --> 13:06.300]  You can do that.
[13:06.300 --> 13:09.300]  I lost my place.
[13:09.300 --> 13:10.300]  Absolutely.
[13:10.300 --> 13:18.300]  You file a claim of fraud. In Texas, we have a special statute for illegal conversion of property.
[13:18.300 --> 13:26.300]  I think it's 141 of civil torts and remedies. It's a specific fraud statute.
[13:26.300 --> 13:34.300]  Don't file wrongful foreclosure. File fraud. If you file for fraud, then they can't ask for tender.
[13:34.300 --> 13:43.300]  If you file wrongful foreclosure, then they're going to ask you to tender the full amount of the sale of the property before you can file the suit for wrongful foreclosure.
[13:43.300 --> 13:47.300]  So you don't file that. You file for them committing fraud.
[13:47.300 --> 13:56.300]  But we have to be careful. I'm sorry to interject, but if they do file fraud, you need to file all the elements of fraud.
[13:56.300 --> 13:57.300]  Satisfy every element.
[13:57.300 --> 14:00.300]  Every one. Otherwise, they'll throw it out. You're missing one.
[14:00.300 --> 14:04.300]  Most states have nine elements. Some have four or five.
[14:04.300 --> 14:05.300]  Five.
[14:05.300 --> 14:15.300]  Go to your state fraud statutes and find out exactly what elements you've got and make sure you can satisfy all of those elements before you file.
[14:15.300 --> 14:23.300]  Exactly. In a civil action. It's similar to a criminal action in that.
[14:23.300 --> 14:30.300]  In a criminal action, you say this guy violated this statute.
[14:30.300 --> 14:37.300]  He committed this element, this element, and this element, and therefore he's in violation of this statute.
[14:37.300 --> 14:44.300]  When you file a civil action, you can't go in and say this dirty rotten scoundrel, he did this, that, and the other.
[14:44.300 --> 14:46.300]  No, no, no. That's not how it works.
[14:46.300 --> 14:54.300]  You have to claim a specific and statutorily defined cause of action.
[14:54.300 --> 14:58.300]  It's similar to accusing someone of a crime.
[14:58.300 --> 15:04.300]  You accuse someone of a cause of action, and each cause of action has elements.
[15:04.300 --> 15:12.300]  This person, the plaintiff entered into a contract negotiation with this individual.
[15:12.300 --> 15:20.300]  This individual made voluntary statements of fact.
[15:20.300 --> 15:32.300]  This individual failed to, after giving voluntary statements of fact, failed to give full disclosure of all the facts.
[15:32.300 --> 15:38.300]  The plaintiff did not have equal access to the information.
[15:38.300 --> 15:45.300]  Plaintiff accepted the statements of defendant as true.
[15:45.300 --> 15:48.300]  Plaintiff was harmed thereby.
[15:48.300 --> 15:52.300]  That's stating the elements of fraud by non-disclosure.
[15:52.300 --> 15:57.300]  Each cause of action will have a set of elements that way.
[15:57.300 --> 16:10.300]  And you have to not only claim the cause of action, you have to state facts that support each of the elements of the cause of action.
[16:10.300 --> 16:12.300]  Does that sound right, Joe?
[16:12.300 --> 16:13.300]  Correct.
[16:13.300 --> 16:20.300]  You must specific, so if you're going to cite a cause of action, then you're going to cite the statute to back it up.
[16:20.300 --> 16:29.300]  And then you're going to cite the argument as it relates to the statute, because you cannot just claim hearsay allegations.
[16:29.300 --> 16:40.300]  This is why many of the complaints that are written, I've seen tons of quiet title complaints, just tons of complaints in general, and they don't have proper causes of action.
[16:40.300 --> 16:43.300]  They're just hearsay claims, fact statements.
[16:43.300 --> 16:45.300]  I was wronged.
[16:45.300 --> 16:46.300]  They did this.
[16:46.300 --> 16:51.300]  Motion to dismiss for failure to state a claim on which recovery can be had.

[25:17.300 --> 25:27.300]  And so my question from all of that is I have been working with Randy for, well, since about
[25:27.300 --> 25:30.300]  I was six months old fighting for my house.
[25:30.300 --> 25:31.300]  I'm sorry.
[25:31.300 --> 25:39.300]  Anyway, I lost my standing because we went through a bankruptcy.
[25:39.300 --> 25:45.300]  And then I just regained my standing after reopening the bankruptcy case and then having
[25:45.300 --> 25:49.300]  the trustee finally give me my standing back.
[25:49.300 --> 25:52.300]  And that was just on the 19th was when I had standing back.
[25:52.300 --> 25:53.300]  Okay.
[25:53.300 --> 25:56.300]  So then you always had standing.
[25:56.300 --> 25:58.300]  They were just recognizing it.
[25:58.300 --> 25:59.300]  Well, yes.
[25:59.300 --> 26:03.300]  Well, we hadn't surrendered the cases to the trustee.
[26:03.300 --> 26:07.300]  And therefore, we had to put all of our cases on stay.
[26:07.300 --> 26:14.300]  And just at the very end, two appeals were just dismissed, one of them with prejudice.
[26:14.300 --> 26:17.300]  And I had appealed the eviction.
[26:17.300 --> 26:20.300]  And that one was dismissed with prejudice.
[26:20.300 --> 26:22.300]  And then I had a wrongful foreclosure.
[26:22.300 --> 26:25.300]  And that one was on appeal and they dismissed that one.
[26:25.300 --> 26:28.300]  And they had dismantled that case prior to.
[26:28.300 --> 26:35.300]  And my question is, do I bother to pursue that or do I, Joe, then pick up with new stuff
[26:35.300 --> 26:41.300]  and go back into the 120 and start something completely new?
[26:41.300 --> 26:46.300]  Well, remember, the Rule 120 is specific to Colorado.
[26:46.300 --> 26:49.300]  And that is the only state that has Rule 120 hearing.
[26:49.300 --> 26:56.300]  And there have only been a number of cases that I can count on one hand that has overcome
[26:56.300 --> 27:06.300]  a Rule 120 hearing because on a Rule 120 hearing, a holder may pursue a foreclosure action.
[27:06.300 --> 27:09.300]  There does not need to be a holder in due course.
[27:09.300 --> 27:12.300]  And it's really, really tough.
[27:12.300 --> 27:17.300]  I think there was one woman that won a case about a year ago or probably seven, eight months ago.
[27:17.300 --> 27:20.300]  And I was trying to get hold of her.
[27:20.300 --> 27:22.300]  But the Rule 120 hearings are really tough.
[27:22.300 --> 27:28.300]  BK, I love like I had I've had good success with it.
[27:28.300 --> 27:31.300]  That's just me.
[27:31.300 --> 27:34.300]  My bankruptcy is still open.
[27:34.300 --> 27:36.300]  We have one case that's still.
[27:36.300 --> 27:39.300]  How is your property listed?
[27:39.300 --> 27:42.300]  Well, at the time, we were already we had already been to the foreclosure.
[27:42.300 --> 27:44.300]  So it wasn't listed at all.
[27:44.300 --> 27:50.300]  And then when right after the eviction or just before the eviction, I filed a last minute
[27:50.300 --> 27:52.300]  to reinstate the stay.
[27:52.300 --> 27:58.300]  And so now it's on Schedule A as having a warranty deed.
[27:58.300 --> 27:59.300]  All right. So it's an asset.
[27:59.300 --> 28:05.300]  But but I prior to your bankruptcy, though, it was sold.
[28:05.300 --> 28:07.300]  Yes, we were still.
[28:07.300 --> 28:10.300]  All right. That's that's a problem that you're going to have.
[28:10.300 --> 28:15.300]  And that was similar to the Asgard case versus MERS.
[28:15.300 --> 28:23.300]  OK, pursuant to Russia, the kind of the statutory or the the judgment had already been given.
[28:23.300 --> 28:26.300]  And then the bankruptcy was filed.
[28:26.300 --> 28:35.300]  And you're trying to go through the bankruptcy court to get the bankruptcy to override the state court's decision.
[28:35.300 --> 28:38.300]  And which they won't do, actually.
[28:38.300 --> 28:40.300]  Right.
[28:40.300 --> 28:46.300]  I filed in with all of the UCC things into the bankruptcy, all the stuff that I had.
[28:46.300 --> 28:50.300]  Right. But the problem is that you're going to have is similar to the Asgard case.
[28:50.300 --> 28:55.300]  The district court already made a ruling prior to the BK.
[28:55.300 --> 28:57.300]  That's where your fight is.
[28:57.300 --> 29:04.300]  You're you're trying to have the bankruptcy overrule the district court.
[29:04.300 --> 29:07.300]  And I'm not sure if that will work.
[29:07.300 --> 29:09.300]  Yeah, I mean, I don't see it.
[29:09.300 --> 29:11.300]  You've got two different jurisdictions.
[29:11.300 --> 29:12.300]  Well, yeah.
[29:12.300 --> 29:15.300]  So the court doesn't like they don't want to undo.
[29:15.300 --> 29:21.300]  And there's actually correct in the bankruptcy that if there's a remedy in the in a non-bankruptcy court,
[29:21.300 --> 29:25.300]  they have to allow that court to make the decision.
[29:25.300 --> 29:29.300]  Right. And I can't tell you what rule that is, but I can look it up.
[29:29.300 --> 29:31.300]  No, that's why I know what you're saying.

[34:35.300 --> 34:42.300]  And I had actually sent – in Colorado, we have this deal where if you're a bank,
[34:42.300 --> 34:47.300]  you can go in and you can use that specific qualified holder statement.
[34:47.300 --> 34:50.300]  If you're not a bank, you can't do that.
[34:50.300 --> 35:01.300]  And so I found a document from 2011 that Chase Home Finance,
[35:01.300 --> 35:04.300]  who was the servicing company who did foreclose,
[35:04.300 --> 35:08.300]  and they brought the foreclosure on behalf of the lender that we learned later
[35:08.300 --> 35:16.300]  had relinquished all of their rights in 2006, and they brought the foreclosure in 2010.
[35:16.300 --> 35:21.300]  And they brought it on behalf of the lender and MERS.
[35:21.300 --> 35:28.300]  And then I found this document from JPMorgan Chase about Chase Home Finance,
[35:28.300 --> 35:31.300]  which was a wholly owned subsidiary, that they were merging,
[35:31.300 --> 35:36.300]  that JPMorgan Chase, a bank, was merging with a non-bank,
[35:36.300 --> 35:39.300]  which means that Chase Home Finance was never a bank
[35:39.300 --> 35:45.300]  and really could not take advantage of the qualified holder.
[35:45.300 --> 35:48.300]  So, you know, I don't know if I've got that to go to.
[35:48.300 --> 35:52.300]  I'm not really looking to get the house back, but the house is just sitting there empty
[35:52.300 --> 35:55.300]  because we have a low pendence on it.
[35:55.300 --> 36:02.300]  Okay. If Chase Home – okay, who did the foreclosure?
[36:02.300 --> 36:06.300]  Chase Home Finance or Chase Bank NA?
[36:06.300 --> 36:08.300]  Chase Home Finance.
[36:08.300 --> 36:16.300]  Okay. And they did – how did they get holder status?
[36:16.300 --> 36:25.300]  Well, it's like Joe just said, it's – they just had a copy of the note as all they had.
[36:25.300 --> 36:27.300]  They had a copy of the note.
[36:27.300 --> 36:32.300]  Okay. What I'm looking for is subject matter jurisdiction again.
[36:32.300 --> 36:37.300]  That's the one thing you can file no matter how remote in history.
[36:37.300 --> 36:46.300]  If you could show that the alleged holder lacked holder status,
[36:46.300 --> 36:51.300]  and then they did not have standing to invoke subject matter jurisdiction in the court,
[36:51.300 --> 36:55.300]  then you can go back and move to void all judgments
[36:55.300 --> 37:04.300]  because the plaintiff lacked standing to invoke subject matter jurisdiction.
[37:04.300 --> 37:09.300]  With everything else fails, that's the one thing you can always file.
[37:09.300 --> 37:13.300]  And you can file it based on newly discovered information.
[37:13.300 --> 37:18.300]  Okay. So on newly – okay. And then I'll have Joe's stuff.
[37:18.300 --> 37:24.300]  Now – and do I file that into the old case or do I file a new case?
[37:24.300 --> 37:29.300]  Into the old case. Challenge the subject matter jurisdiction in the old case.

[38:31.300 --> 38:37.300]  with prejudice because of lack of – it was supposed to be stayed because of the
[38:37.300 --> 38:41.300]  bankrupt because I lacked standing, but they dismissed it.
[38:41.300 --> 38:44.300]  And then we had a wrongful foreclosure and an appeal.
[38:44.300 --> 38:51.300]  And they – appeal because the notary has never answered into that case.
[38:51.300 --> 38:52.300]  Everyone else has.
[38:52.300 --> 38:54.300]  Chances are they're never going to either.
[38:54.300 --> 38:57.300]  That's – it was filed over a year ago.
[38:57.300 --> 38:58.300]  Yeah.
[38:58.300 --> 39:04.300]  That'll go to subject matter jurisdiction.
[39:04.300 --> 39:05.300]  Right.
[39:05.300 --> 39:12.300]  It will actually go to declaratory judgment first to disqualify the document.
[39:12.300 --> 39:19.300]  So do you have a declaratory judgment action filed against the document where
[39:19.300 --> 39:23.300]  the notary didn't respond?
[39:23.300 --> 39:24.300]  No.
[39:24.300 --> 39:27.300]  I haven't – well, I haven't had any standing to do anything, Randy,
[39:27.300 --> 39:29.300]  for over a year.
[39:29.300 --> 39:30.300]  So now I've got my standing back.
[39:30.300 --> 39:36.300]  So I just – I need to file a motion for – do I file a case or just –
[39:36.300 --> 39:38.300]  No, a declaratory judgment action.
[39:38.300 --> 39:42.300]  It is a case, but it's an in rim action against the property.

[39:59.300 --> 40:04.300]  then you can go back and do a challenge to subject matter jurisdiction.
[40:04.300 --> 40:08.300]  When the court rules that the documents void and no force in effect,
[40:08.300 --> 40:13.300]  it will have been void from the beginning.
[40:13.300 --> 40:15.300]  It just didn't have a ruling on it.
[40:15.300 --> 40:21.300]  So once the judge rules that the documents void, then you go back
[40:21.300 --> 40:27.300]  with a challenge to subject matter jurisdiction with the court who did the foreclosure
[40:27.300 --> 40:34.300]  and claim that they didn't have – that the plaintiff in the foreclosure lacked
[40:34.300 --> 40:39.300]  standing to invoke subject matter jurisdiction in the court.
[40:39.300 --> 40:42.300]  Okay.
[40:42.300 --> 40:47.300]  Do some – yeah, do some research on subject matter jurisdiction.
[40:47.300 --> 40:49.300]  It is really a powerful pleading.
[40:49.300 --> 40:50.300]  Okay.
[40:50.300 --> 40:52.300]  So I'm going to Skype you for that.

[41:19.300 --> 41:22.300]  Look for an assignment or an appointment.
[41:22.300 --> 41:26.300]  Appointment of substitute trustee or an assignment of the deed of trust.
[41:26.300 --> 41:27.300]  None of those.
[41:27.300 --> 41:30.300]  Try to take – pardon me?
[41:30.300 --> 41:31.300]  None of those exist.
[41:31.300 --> 41:35.300]  When they foreclosed, the original lender was still in the record.
[41:35.300 --> 41:39.300]  They don't do a substitution of trustee because it's a public trustee in Colorado.
[41:39.300 --> 41:41.300]  Okay.
[41:41.300 --> 41:45.300]  Now what you need is Joe Esquivel's documentation
[41:45.300 --> 41:50.300]  to show that this party no longer held the note.
[41:50.300 --> 41:51.300]  Okay.
[41:51.300 --> 41:55.300]  And based on – that's based on new information.
[41:55.300 --> 41:58.300]  The fact that they didn't hold the note will go to their ability
[41:58.300 --> 42:01.300]  to invoke subject matter jurisdiction in the court.
[42:01.300 --> 42:04.300]  And you can file a challenge to subject matter jurisdiction
[42:04.300 --> 42:07.300]  no matter how remote in history.

[56:53.300 --> 57:04.300]  Because I went down and the only thing I have is 2005 with Fremont and then 2011 with Dutch Bank came in. That's the only thing that's recorded at the courthouse.

[01:08:00.300 --> 01:08:05.300]  In legal terms, we don't care if it's redundant.
[01:08:05.300 --> 01:08:10.300]  If we're referring to a specific entity, we don't say he, she, or it.
[01:08:10.300 --> 01:08:12.300]  We put the entity's name there.
[01:08:12.300 --> 01:08:17.300]  So there's there's a couple of reasons for that.
[01:08:17.300 --> 01:08:22.300]  One of them is to keep the lawyers on the other side from misconstruing what you say.
[01:08:22.300 --> 01:08:34.300]  And the other is when you're reading, you tend not to read a word by the letters that make up the word.
[01:08:34.300 --> 01:08:37.300]  You see the word and you recognize it.
[01:08:37.300 --> 01:08:47.300]  When you see a pronoun or an acronym, when you see the program pronoun, the mind has to do a quick interrupt.
[01:08:47.300 --> 01:08:49.300]  It has to stop.
[01:08:49.300 --> 01:08:51.300]  Look at the pronoun he.
[01:08:51.300 --> 01:08:53.300]  OK.
[01:08:53.300 --> 01:08:57.300]  Which he is he talking about?
[01:08:57.300 --> 01:09:05.300]  So you have to make sure that you refer the he to the right proper noun.
[01:09:05.300 --> 01:09:16.300]  When you use an acronym, even if you know what the acronym is, the mind, the inner mind stops, looks at the acronym,
[01:09:16.300 --> 01:09:35.300]  goes inside and does what we call trans derivational search and pulls out every permutation of that acronym that it can think of to make sure it's considering the right one.
[01:09:35.300 --> 01:09:37.300]  And that causes pattern interruption.
[01:09:37.300 --> 01:09:47.300]  You ever talking to someone and somebody comes in and asks you a question, you answer the question, you turn back and you say, what are we talking about?
[01:09:47.300 --> 01:09:53.300]  I do conversational hypnosis and one of the tools I'll use to trigger amnesia.
[01:09:53.300 --> 01:09:55.300]  You're doing it right now.
[01:09:55.300 --> 01:09:58.300]  It's a pattern interruption.
[01:09:58.300 --> 01:10:03.300]  I do a pattern interruption and then change the subject and you'll forget what we were talking about.
[01:10:03.300 --> 01:10:15.300]  So when you use an acronym or a pronoun, if it's not absolutely certain what that pronoun refers to, the mind will trip.
[01:10:15.300 --> 01:10:19.300]  It'll stop and have to verify what it's seeing.
[01:10:19.300 --> 01:10:23.300]  And that causes pattern interruption, drops you out of the flow.
[01:10:23.300 --> 01:10:30.300]  If you see an acronym, it always knocks you out of the flow of the document because you have to look at those letters,
[01:10:30.300 --> 01:10:40.300]  convert those letters into go into your memory and figure out what those letters mean and make sure that the letters match the meaning you have in your mind.
[01:10:40.300 --> 01:10:43.300]  That completely knocks you out of the flow of a document.
[01:10:43.300 --> 01:10:46.300]  Never, ever use an acronym.
[01:10:46.300 --> 01:10:51.300]  RESPA, Real Estate Settlement Procedures Act.
[01:10:51.300 --> 01:10:59.300]  When you're reading a document and you see Real Estate Settlement Procedures Act, your mind will see that as one word.
[01:10:59.300 --> 01:11:02.300]  And it won't even slow you down.
[01:11:02.300 --> 01:11:05.300]  Boom, you'll see it and just keep going.
[01:11:05.300 --> 01:11:10.300]  When you look at it, it looks like it's a lot of words, but your mind don't see it as a lot of words.
[01:11:10.300 --> 01:11:16.300]  And it doesn't have to stop and say, am I interpreting this right?
[01:11:16.300 --> 01:11:19.300]  OK, does that make sense, Jonathan?
[01:11:19.300 --> 01:11:20.300]  Yes.
[01:11:20.300 --> 01:11:23.300]  There's a whole lot shorter way.

[01:14:07.300 --> 01:14:16.300]  If you want someone to understand what you're writing, who here hasn't had an opportunity to read a book
[01:14:16.300 --> 01:14:21.300]  to where when you start reading it, you just kind of fall into it.
[01:14:21.300 --> 01:14:26.300]  And then an hour later, you come out of the material.
[01:14:26.300 --> 01:14:37.300]  When someone can do that, they haven't done anything that caused any kind of internal mental interrupt.
[01:14:37.300 --> 01:14:45.300]  They didn't cause you to stumble anywhere and cause you to say, did you mean this or did you mean that?
[01:14:45.300 --> 01:14:47.300]  Or what's he talking about here?
[01:14:47.300 --> 01:14:53.300]  They didn't create any questions that they didn't immediately answer
[01:14:53.300 --> 01:15:02.300]  or create questions that they just answered so that when the reader gets to that issue
[01:15:02.300 --> 01:15:08.300]  and the question comes to mind, they'll think, oh, he just answered that, they just keep on flowing along.
[01:15:08.300 --> 01:15:11.300]  A lot of this goes to flow.
[01:15:11.300 --> 01:15:18.300]  We have judges. Everything I write, I write for a grand jury.
[01:15:18.300 --> 01:15:22.300]  I write for an eighth grader.
[01:15:22.300 --> 01:15:31.300]  And it's not because we doubt the intelligence of the judges or the grand jurors or whoever is going to read our documents.
[01:15:31.300 --> 01:15:33.300]  It's because they're busy.
[01:15:33.300 --> 01:15:38.300]  They don't have time to struggle with a complex document.
[01:15:38.300 --> 01:15:43.300]  They need to be able to read it through once and get it.
[01:15:43.300 --> 01:15:47.300]  That's what will give us a good reading.
[01:15:47.300 --> 01:15:54.300]  A lawyer uses the standard format document that every lawyer uses in the court.
[01:15:54.300 --> 01:16:00.300]  The process comes along and gives the judge a pleading that's very well crafted
[01:16:00.300 --> 01:16:04.300]  and lots of good case law that the courts never seen before.
[01:16:04.300 --> 01:16:11.300]  And he says, I'm going to read 20 cases I've never seen before denied.
[01:16:11.300 --> 01:16:19.300]  Now, that may not be right, but the judge is after all a human being and he's busy.
[01:16:19.300 --> 01:16:25.300]  And he needs to be able to read through this quickly, get to the point, make his decision and go on.
[01:16:25.300 --> 01:16:29.300]  So what we're talking about here is actually some finer points.
[01:16:29.300 --> 01:16:39.300]  But the reason I'm talking about this with John is because I had to understand, had difficulty understanding where he was going from the beginning.
[01:16:39.300 --> 01:16:41.300]  These are the kinds of things that cause those difficulties.

[01:21:02.300 --> 01:21:13.300]  But now three or four years later, after the company's been out of business for three or four years, they can't come along and make this trade, this assignment,
[01:21:13.300 --> 01:21:20.300]  that when they went out of business, they abandoned the claim on the security instrument.
[01:21:20.300 --> 01:21:26.300]  Right, because in the pool and service agreement, it says they made no assignments to Carrington.
[01:21:26.300 --> 01:21:36.300]  And the pooling and service agreement, you don't care about any of that. The only thing you care about is what is in the county registrar's office.

[01:21:49.300 --> 01:22:05.300]  They can't bring the claim before the court. When Craig Watkins, a district attorney for Dallas County, sued MERS for failing to file all of these assignments and changes to beneficial interest in the county record,
[01:22:05.300 --> 01:22:16.300]  MERS came back and claimed that their suit was frivolous because there was no requirement for MERS to file these notices.
[01:22:16.300 --> 01:22:25.300]  But they went on to say, however, if we don't file those notices, we may not have a perfected claim.
[01:22:25.300 --> 01:22:35.300]  And I read that and I said, that's exactly how I read the code. This is a free country. You are free to screw yourself if you want to.
[01:22:35.300 --> 01:22:44.300]  And Craig Watkins shouldn't be complaining because MERS screwed themselves by not filing the proper recordings.
[01:22:44.300 --> 01:22:56.300]  So first, before you get to anything else, walk down that chain of documents in the county record.
[01:22:56.300 --> 01:23:05.300]  If your claim is not properly filed there, you cannot enforce it, period.
[01:23:05.300 --> 01:23:17.300]  Now, we have a specific statute in Texas 13.001 that says a claim not acknowledged or proven and properly filed in the record is void as to the holder.
[01:23:17.300 --> 01:23:28.300]  Every state is going to have a corresponding statute. Otherwise, the county registrar's office would be of no value.
[01:23:28.300 --> 01:23:31.300]  So somewhere in your code, you're going to find that.

[01:24:38.300 --> 01:24:46.300]  It's a merge of trust. The original lender is out of business, taken over by the Office of Control of the Currency.

[01:24:57.300 --> 01:25:14.300]  The homeowner sent a debt validation letter in December to Merge, the trustee, and the bank, which JP Morgan Chase, and he invoked UCC.
[01:25:14.300 --> 01:25:19.300]  Hold on. Was Washington Mutual the original lender?
[01:25:19.300 --> 01:25:26.300]  No. It was a small bank out of Spartanburg, South Carolina, first national bank of the South.

[01:25:30.300 --> 01:25:40.300]  Yes. Merge pops up a year and a half later saying that they assigned the deed of trust and they substituted it.
[01:25:40.300 --> 01:25:51.300]  Let me make a suggestion. Since that company was out of business and Merge could not act as an agent for that company,
[01:25:51.300 --> 01:25:58.300]  the filing of this document in the record constituted two acts.
[01:25:58.300 --> 01:26:11.300]  First, someone prepared this document and then took this document to a notary and swore under oath to the veracity of the statements in the document,
[01:26:11.300 --> 01:26:23.300]  knowing that they lacked standing to represent a non-existent client. That's aggravated perjury.
[01:26:23.300 --> 01:26:38.300]  Then they filed this document in the county record that had false statements in it, statements of material fact that they knew to be untrue and intended that they be taken as true.
[01:26:38.300 --> 01:26:44.300]  That's tampering with the government document. If you look in the North Carolina general statutes, you'll find both of those.
[01:26:44.300 --> 01:26:57.300]  Those are penal crimes. File criminal charges against them for aggravated perjury tampering with the government document.
[01:26:57.300 --> 01:27:04.300]  This is what we're missing. People are doing these things and we're saying, oh, that's wrong. That's wrong. Yeah, look at the code.
[01:27:04.300 --> 01:27:13.300]  How is it wrong? What makes it wrong? Statute on aggravated perjury, statute on tampering with the government document is what makes it wrong.
