[00:00.000 --> 00:07.960] This is the Liberty Beat, your daily source for Liberty news and activist updates, online
[00:07.960 --> 00:09.840]  at thelibertybeat.com.
[00:09.840 --> 00:14.960] I'm Brian Hagan with your Liberty Beat for Monday, February 17th, 2014.
[00:14.960 --> 00:18.080]  Gold opened today at $1,326.
[00:18.080 --> 00:25.360] Silver opened at $21.76, while Bitcoin is trading at $647.95.
[00:25.360 --> 00:29.720] Support for the Liberty Beat comes from Roberts & Roberts Brokerage, Inc., specializing in
[00:29.720 --> 00:32.560]  precious metals since 1977.
[00:32.560 --> 00:37.840] They don't feed the banks by taking credit cards, but you can bet they take Bitcoin.
[00:37.840 --> 00:44.800]  Online at rrbi.co or by phone at 800-874-9760.
[00:44.800 --> 00:47.800]  Support also comes from GrowYourOwnGroceries.org.
[00:47.800 --> 00:53.200] Learn to grow, prepare, and preserve your own food and medicine at GrowYourOwnGroceries.org.
[00:53.200 --> 00:58.840] And from SovereignBTC, media, marketing, and consulting for the Bitcoin ecosystem.
[00:58.840 --> 01:01.840]  Online at SovereignBTC.com.
[01:01.840 --> 01:04.840] Observers are calling it an implosion.
[01:04.840 --> 01:10.080] That comes as Mt. Gox, the one-time largest platform for Bitcoin trading, sees prices
[01:10.080 --> 01:14.360] of the digital currency fall to as low as $220.
[01:14.360 --> 01:19.720] Business Insider reports the price at other exchanges remains above $600, with the Mt.
[01:19.720 --> 01:25.480] Gox situation stemming from their recent decision to halt withdrawals, citing a long-known potential
[01:25.480 --> 01:30.360]  Bitcoin weakness.
[01:30.360 --> 01:36.000] According to Al-Mayadeen Television in Lebanon, Russia may call an emergency UN Security Council
[01:36.000 --> 01:40.240] meeting to slow the escalating situation in Syria.
[01:40.240 --> 01:44.960] Russian sources stated that Washington and Paris are putting together a military intervention
[01:44.960 --> 01:47.760] plan to stop the Syrian army.
[01:47.760 --> 01:52.120] The United States and Russia have been at odds about which route to take in war-torn
[01:52.120 --> 01:53.120]  Syria.
[01:53.120 --> 01:58.360] The negotiations will continue next in Geneva.
[01:58.360 --> 02:02.880] On Friday, the Department of Justice and the Department of the Treasury issued an outline
[02:02.880 --> 02:06.160] for banks working with marijuana businesses.
[02:06.160 --> 02:10.640] Banks have been wary of opening accounts for clients who deal in marijuana, fearing persecution
[02:10.640 --> 02:12.440]  by the federal government.
[02:12.440 --> 02:16.480] As states like Colorado and Washington have moved to legalize recreational and medicinal
[02:16.480 --> 02:21.900] use of marijuana, banks have walked a fine line between state law and federal law, which
[02:21.900 --> 02:51.440] still declares marijuana to be illegal.
[02:51.440 --> 02:56.520] This is the Liberty Beat for Monday, February 17, 2014.
[03:51.440 --> 04:21.320] We'll raise up our glasses against evil forces, we'll raise up our glasses against evil forces,
[04:21.320 --> 04:49.880] we'll raise up our glasses against evil forces, we'll raise up our glasses against evil forces,
[04:49.880 --> 05:09.680] we'll raise up our glasses against evil forces, we'll raise up our glasses against evil forces,
[05:09.680 --> 05:24.440] we'll raise up our glasses against evil forces, we'll raise up our glasses against evil forces,
[05:24.440 --> 05:40.800] we'll raise up our glasses against evil forces, we'll raise up our glasses against evil forces,
[05:40.800 --> 05:55.160] we'll raise up our glasses against evil forces, we'll raise up our glasses against evil forces,
[05:55.160 --> 06:14.240] we'll raise up our glasses against evil forces, we'll raise up our glasses against evil forces,
[06:14.240 --> 06:22.680] A school suspended a student for getting into an altercation with another student, a football
[06:22.680 --> 06:33.560] player, because the football player was making very obscene remarks to the first kid's much
[06:33.560 --> 06:35.200]  younger sister.
[06:35.200 --> 06:39.700] And he interceded because he reported the bullying to the school and the school did
[06:39.700 --> 06:42.380]  nothing about it.
[06:42.380 --> 06:45.720] The altercation took place at a football event.
[06:45.720 --> 06:50.920] The instigator, alleged instigator, the football player, was suspended for two days.
[06:50.920 --> 06:58.720] The kid that came to the defense of his sister was suspended for five.
[06:58.720 --> 07:05.680] On other stupidity fronts, there's a story that's been put out where, if you remember
[07:05.680 --> 07:11.640] the movie Toy Story and the character Woody that Tom Hanks did the voice for, the little
[07:11.640 --> 07:20.480] cowboy, well, there are Woody dolls out there that have little replica six shooters in their
[07:20.480 --> 07:21.480]  holsters.
[07:21.480 --> 07:25.880] And when you hold it in your hand, the whole little pistol wouldn't reach all the way across
[07:25.880 --> 07:27.320]  the face of a penny.
[07:27.320 --> 07:30.400]  It's that small.
[07:30.400 --> 07:42.720] But the story is about TSA seizing the pistols from a child's toy simply because it looks
[07:42.720 --> 07:47.120]  like a gun.
[07:47.120 --> 07:51.240] It can't possibly shoot anything, and anything it could possibly shoot has absolutely no
[07:51.240 --> 07:57.540] chance of going anywhere and causing any harm to anything.
[07:57.540 --> 08:02.700] You could get more danger from somebody sneezing with their mouth full of bottled water than
[08:02.700 --> 08:10.260] you could from this thing, even if it could shoot, which, of course, it can't.
[08:10.260 --> 08:16.720] And then you have a president that is willing to tell everybody that less jobs, and a speaker
[08:16.720 --> 08:21.280] of the House to boot, less jobs is a good thing because you get to spend more time home
[08:21.280 --> 08:23.440]  with your kids.
[08:23.440 --> 08:29.600] Longer rooms in the emergency or longer lines in the emergency room are better because you
[08:29.600 --> 08:34.880] get to have time to visit and meet with new people.
[08:34.880 --> 08:39.540] And that if you like your insurance, you can keep it.
[08:39.540 --> 08:44.280] Now there, it's not them that are being represented as stupid.
[08:44.280 --> 08:51.040] It's the population that bought into the damn story in the first place and voted for it.
[08:51.040 --> 08:55.800] And the idiots that created it.
[08:55.800 --> 09:01.700] Go out on the street, talk to any American citizen about almost any well, presumably
[09:01.700 --> 09:08.160] well-known by people that pay attention, subject matter, and it will dawn on you just how far
[09:08.160 --> 09:17.220] down the alleged evolutionary slope the education and intelligence of the American people has
[09:17.220 --> 09:21.420]  actually sunk to.
[09:21.420 --> 09:25.720] Which brings us, of course, to the next one on the list, ignorance.
[09:25.720 --> 09:32.860] When you go out and you ask people, what state is Hollywood, California located in?
[09:32.860 --> 09:37.000]  And they can't answer the question.
[09:37.000 --> 09:43.040] Where is the Brooklyn Bridge?
[09:43.040 --> 09:51.480] You ask them questions like this and they have no clue.
[09:51.480 --> 09:53.200]  I mean, it's ridiculous.
[09:53.200 --> 09:57.160] If you haven't ever seen any of Mark Dice's videos on YouTube, go look.
[09:57.160 --> 10:05.720] If you really want to just walk away from your computer screen utterly depressed, go
[10:05.720 --> 10:10.580] watch a bunch of Mark Dice's Sign the Petition videos.
[10:10.580 --> 10:15.760] Because you will be astounded, or even better, if you want to laugh while you're getting
[10:15.760 --> 10:21.720] depressed, watch Jay Leno's old episodes of Jaywalking.
[10:21.720 --> 10:30.440] It is ridiculous just how ineptly ignorant Americans have become on virtually any subject
[10:30.440 --> 10:31.440]  matter.
[10:31.440 --> 10:34.360]  Doesn't matter what it is.
[10:34.360 --> 10:36.480] And then, of course, you have greed.
[10:36.480 --> 10:41.000] Well, you can't get past greed in virtually any place in our society these days.
[10:41.000 --> 10:42.640]  Everybody wants more than they've got.
[10:42.640 --> 10:47.000] They want it for nothing and they want it yesterday.
[10:47.000 --> 10:53.440] The welfare state is alive and well in so many ways, it's not even funny.
[10:53.440 --> 10:58.360] It is now outpacing an active job market, in fact, is it not?
[10:58.360 --> 11:03.400] We have more unemployment than we can stand.
[11:03.400 --> 11:10.040] We've got more people on welfare than those that are employed can begin to generate enough
[11:10.040 --> 11:17.520] money to support, even if they're paying taxes that they never had to pay in the first place.
[11:17.520 --> 11:19.440]  I've got an idea.
[11:19.440 --> 11:26.200] If a public servant wants to use public funds to fund that type of project, then they should
[11:26.200 --> 11:30.340] be required to start with their own.
[11:30.340 --> 11:36.520] You want to fund welfare systems for anybody, you have to match dollar for dollar what's
[11:36.520 --> 11:39.160]  going in.
[11:39.160 --> 11:44.320] If you expect the rest of us to pay for your idea of anything, then you better be willing
[11:44.320 --> 11:46.000]  to match it.
[11:46.000 --> 11:48.760] And if you're not, then you can't vote to enact it.
[11:48.760 --> 11:50.400]  You can't even submit it.
[11:50.400 --> 11:51.800]  End of story.
[11:51.800 --> 11:59.080] If you're not willing to spend your money on it, you don't get to spend mine.
[11:59.080 --> 12:05.560] So where is our common sense when we're both stupid and ignorant, rolling the one around
[12:05.560 --> 12:08.280] here these days, and then we're greedy to boot?
[12:08.280 --> 12:11.960] And then, of course, you got the love of power issue.
[12:11.960 --> 12:16.080] For the love of power issue, just look around.
[12:16.080 --> 12:24.880] Anybody in political office these days, if you think they are there to benefit you or
[12:24.880 --> 12:34.440] I in any way whatsoever, you are mistaken.
[12:34.440 --> 12:40.680] And it doesn't really even matter if they're trying to benefit us in any way, if they're
[12:40.680 --> 12:44.400]  up there alone.
[12:44.400 --> 12:48.540] That exactly was the problem that Ron Paul had the whole time he was in Congress.
[12:48.540 --> 12:50.040]  He was alone.
[12:50.040 --> 12:51.580] He wanted to do the right thing.
[12:51.580 --> 12:55.200] He in fact refused to do the wrong thing.
[12:55.200 --> 12:57.600] But what can he do alone?
[12:57.600 --> 13:01.840] He didn't have our support because we kept electing people that would oppose the very
[13:01.840 --> 13:05.600] things that we are supposed to stand for as a nation.
[13:05.600 --> 13:12.360] How can a nation survive when it's sitting here voting for everything that is designed
[13:12.360 --> 13:14.360]  to destroy it?
[13:14.360 --> 13:15.360]  That's ridiculous.
[13:15.360 --> 13:20.880] So we're right back to this list again, stupidity and ignorance.
[13:20.880 --> 13:26.000] We like America the way it is, so let's immediately elect a bunch of elitist people that want
[13:26.000 --> 13:32.640] to control everything and change it so that it suits how they want it to operate better
[13:32.640 --> 13:37.040] to suit them instead of the rest of us.
[13:37.040 --> 13:44.880] You see, the problem is our elected officials want to run everything they do as if it's
[13:44.880 --> 13:51.320]  their own private for-profit business.
[13:51.320 --> 13:53.300]  Every city's doing it.
[13:53.300 --> 13:55.240]  Every county's doing it.
[13:55.240 --> 13:57.520]  Every corporation does it.
[13:57.520 --> 14:03.520] Every area of the federal government does it.
[14:03.520 --> 14:11.080] Everything they do is a profit motive, expenditure versus income.
[14:11.080 --> 14:18.760] And in fact, we did not set up any of these entities for that purpose.
[14:18.760 --> 14:23.440] The simple fact of the matter is you go screaming to your government agency, we want you to
[14:23.440 --> 14:24.440]  do so and so.
[14:24.440 --> 14:26.920] We want you to do so and so.
[14:26.920 --> 14:30.720] Well how are they going to do it when the only source of money they have to do it with
[14:30.720 --> 14:37.360] has to come from us because they don't own anything and they're not allowed by the mandate
[14:37.360 --> 14:40.180] of why they exist to be a business.
[14:40.180 --> 14:43.400] So where do you think they're going to get money from when you start running up there
[14:43.400 --> 14:46.960] demanding in large groups that we make all these changes that require all this money
[14:46.960 --> 14:51.200] to make happen if not through the forms of taxes.
[14:51.200 --> 14:58.880] Well if they're going to levy those taxes, then what makes it your right to force a tax
[14:58.880 --> 15:05.400] upon somebody who doesn't want that thing you're screaming for?
[15:05.400 --> 15:10.160] Why should I be compelled to pay for something I absolutely disagree with?
[15:10.160 --> 15:13.360]  Let's for a second take up the abortion argument.
[15:13.360 --> 15:16.840] The government will pay for abortions, whose money are they using?
[15:16.840 --> 15:17.840]  Their own?
[15:17.840 --> 15:20.640]  No, they don't have any.
[15:20.640 --> 15:25.360] They either borrow it from the Fed and of course we know that ain't free or they take
[15:25.360 --> 15:35.280] it from us in the form of some tax and then they use it for their agenda to pay for abortions.
[15:35.280 --> 15:40.160] Now Christians of course don't want to be paying for those abortions yet they still
[15:40.160 --> 15:46.240] have to pay that same tax that the person that does want them agrees with.
[15:46.240 --> 15:53.600] Well folks that's not freedom, that's not liberty and that is not choice and it is most
[15:53.600 --> 16:03.640] certainly not a government operating under the consent of the governed because the consent
[16:03.640 --> 16:13.800] of the many under the republic as it's supposed to exist does not create a requirement of
[16:13.800 --> 16:20.440] obedience and playing along by the few.
[16:20.440 --> 16:27.320] Everything we do is supposed to be based upon individual rights.
[16:27.320 --> 16:33.840] Well how can you say you respect individual rights when you want everyone to share in
[16:33.840 --> 16:43.600] a collectivist idea and be forced to agree with it or pay for it if they don't?
[16:43.600 --> 16:51.040] It's a completely obtuse argument to say that one requires the other and you're still free.
[16:51.040 --> 16:58.080] Alright folks y'all hang on calling number 512-646-1984 we'll be right back after the
[16:58.080 --> 16:59.080]  break.
[16:59.080 --> 17:06.800] Through advances in technology our lives have greatly improved except in the area of nutrition.
[17:06.800 --> 17:11.520] People feed their pets better than they feed themselves and it's time we changed all that.
[17:11.520 --> 17:17.160] Our primary defense against aging and disease in this toxic environment is good nutrition.
[17:17.160 --> 17:23.560] In a world where natural foods have been irradiated, adulterated and mutilated, young Jevity can
[17:23.560 --> 17:25.840] provide the nutrients you need.
[17:25.840 --> 17:30.680] Logos Radio Network gets many requests to endorse all sorts of products most of which
[17:30.680 --> 17:31.800]  we reject.
[17:31.800 --> 17:37.040] We have come to trust young Jevity so much we became a marketing distributor along with
[17:37.040 --> 17:39.880] Alex Jones, Ben Fuchs and many others.

[17:46.660 --> 17:47.660]  radio.

[18:34.200 --> 18:39.320] The Michael Mears proven method is the solution for how to stop debt collectors.

[19:25.280 --> 19:34.760] Hi folks we are back this is rule of law radio the call in number 512-646-1984 I've got one

[19:39.480 --> 19:40.480]  on the phones.
[19:40.480 --> 19:44.000] All right George in Texas what can we do for you?
[19:44.000 --> 19:46.480] How are you doing Eddie?
[19:46.480 --> 19:47.480]  So far so grand.
[19:47.480 --> 19:53.640] You know the thing you're talking about, you ever watch candid camera in your younger years?
[19:53.640 --> 19:54.640]  Yes.
[19:54.640 --> 19:56.600]  And you know I got a video on you.
[19:56.600 --> 19:57.600] But what are you insinuating?
[19:57.600 --> 19:58.600]  Go ahead.
[19:58.600 --> 20:03.680] Well here's the thing is you know you're talking about like at the dumbed down population.
[20:03.680 --> 20:08.600] You know in some of those candid camera skits you know it's sort of like they have like
[20:08.600 --> 20:13.360] a person posing as an authority figure and how does authority figure make people do the
[20:13.360 --> 20:17.200] most asinine things because they won't question authority.
[20:17.200 --> 20:18.240]  Right.
[20:18.240 --> 20:22.800] Like go through an x-ray conveyor belt at an airport because the metal detector was
[20:22.800 --> 20:29.200] broken down stuff like that or Texas is closed and people don't really question the authority
[20:29.200 --> 20:33.960] guys out there in a cowboy hat a brown shirt brown pair of pants and a tan shirt with a
[20:33.960 --> 20:34.960]  clipboard.
[20:34.960 --> 20:41.000] And he's telling people turn around Texas is closed nobody questions it.
[20:41.000 --> 20:45.400]  I mean that I mean it's like just as good as Mark Dice's videos.
[20:45.400 --> 20:51.560] Yeah well I've got one for you to check out if you want to see the kind of stuff I'm talking
[20:51.560 --> 20:57.400] about as far as the conformity and the do as everyone else does mentality that's kept
[20:57.400 --> 21:01.080] everybody chained to the system as it exists.
[21:01.080 --> 21:07.760] Go on to YouTube and look up a video called the Ash experiment and it's spelled A-S-C-H
[21:07.760 --> 21:10.680]  the Ash experiment.
[21:10.680 --> 21:19.600] And this is all about a social interaction experiment conducted entirely on an elevator.
[21:19.600 --> 21:27.840] And when you watch it you'll see why I would like for people to pay attention to it because
[21:27.840 --> 21:36.520] what it shows is the effect of peer pressure in a controlled environment where as long
[21:36.520 --> 21:46.920] as people that you would generally consider to be reliable and intelligent you will conform
[21:46.920 --> 21:54.240] to whatever they do if they will do it as a unified front.
[21:54.240 --> 21:58.600] And it's really interesting to watch this experiment it's not very long videos like
[21:58.600 --> 22:04.840] less than two and a half minutes but what it proves about the mental state now remember
[22:04.840 --> 22:13.040] also this experiment was way back in the 40s or 50s it was it's not anything that we're
[22:13.040 --> 22:21.400] talking about today this was 30, 40, 50 years ago that this 60 years ago that this was actually
[22:21.400 --> 22:32.240] done and even then the imprinting was enormously powerful and they've used that model very
[22:32.240 --> 22:38.520] effectively to get our society to where it is right now today.
[22:38.520 --> 22:41.680] So I'm sorry I didn't mean to interrupt you what you were thinking there but I just want
[22:41.680 --> 22:45.880] to make everybody aware of that you go watch this experiment and you will see what I'm
[22:45.880 --> 22:52.320] talking about in relation to how we've become ignorant and stupid and willing to follow
[22:52.320 --> 22:59.000] what we perceive as an authority in any direction so it goes hand in hand with what you were
[22:59.000 --> 23:00.000]  commenting on.
[23:00.000 --> 23:04.940] Well you know speaking of peer pressure you know a surprising thing happened last Friday
[23:04.940 --> 23:11.640] on Valentine's Day my 13 year old son they had a presentation in the auditorium about
[23:11.640 --> 23:19.000] the talk of the birds and bees but this is what really surprised me they allowed the
[23:19.000 --> 23:25.480] parents to come in and observe and the thing is there was nothing talking about sex or
[23:25.480 --> 23:32.680] being homosexual but we're talking about abstinence and what the psychological and emotional consequences
[23:32.680 --> 23:40.040] of premarital sex out of wedlock it was very good I was impressed and they wanted us to
[23:40.040 --> 23:45.040] come and we're talking about how to tell you encourage your kids not to give them the peer
[23:45.040 --> 23:49.680] pressure and all that stuff it's very encouraging to see.
[23:49.680 --> 23:54.040] Well good I'm glad there's some improvement out there somewhere.
[23:54.040 --> 24:00.280] And the thing is a couple weeks a few weeks ago my son got in trouble because he beat
[24:00.280 --> 24:06.160] up his bully took care of his bully on the schoolyard and the thing is I told Randy
[24:06.160 --> 24:10.040] he was praying devil's advocate but I would not let my son talk to the school resource
[24:10.040 --> 24:16.480] officer the school district police force or anybody I just signed him out of school and
[24:16.480 --> 24:20.800] I just said he ain't talking and the thing is people don't realize silence is golden
[24:20.800 --> 24:27.760] he didn't have to say a word witnesses that seen the whole thing exonerated my son and
[24:27.760 --> 24:32.720] told him he was acting in self-defense and that's just a good rule to go by silence is
[24:32.720 --> 24:37.240] golden don't tell your kids to talk to anybody unless you're present.
[24:37.240 --> 24:42.440] Yeah that's pretty much the golden rule at all with any authority figures these days
[24:42.440 --> 24:45.680] shut up keep shutting up and shut up some more.
[24:45.680 --> 24:50.360] And may note on Valentine's Day my son got like about 20 carnations from 20 different
[24:50.360 --> 24:55.800] ladies on Valentine's Day because one thing to find out when a when a man stands up to
[24:55.800 --> 25:02.440] his bullies he's willing to stand up for himself ladies like it like a man that does that there's
[25:02.440 --> 25:05.240] if he ain't going to stand up for yourself or why isn't a woman's going to be coffee
[25:05.240 --> 25:07.360]  he'll still stand up for her.
[25:07.360 --> 25:11.200] Yeah obviously this is not something that would take place in California then.
[25:11.200 --> 25:17.880] No I mean but but the thing is it's more like I don't care if it's Common Core or C-scope
[25:17.880 --> 25:22.400] as parents we have to take responsibility you can't blame Obama or Washington for
[25:22.400 --> 25:29.240] branding this down the school system store it's it's up to us parents to be that countermeasure
[25:29.240 --> 25:31.480]  for them I don't care what anybody says.
[25:31.480 --> 25:34.800]  Well that part's true enough.
[25:34.800 --> 25:38.040] And you know I say and I always I always ask my son what do they give you what they tell
[25:38.040 --> 25:43.360] you in school I always ask him those questions and you know and I get to see what the curriculum
[25:43.360 --> 25:48.840] is and everything and if I got questions I always ask questions to the teacher and the
[25:48.840 --> 25:55.280] thing is this is how we can defeat the Common Core and C-scope is by asking our kids questions
[25:55.280 --> 26:02.600] and do not I mean and do not you know assume that they're doing it they're doing the job
[26:02.600 --> 26:06.560] you should be doing I mean we always have to talk to our kids and if there's something
[26:06.560 --> 26:12.520] that's wrong with they say you always get you always counteract what the school is teaching
[26:12.520 --> 26:15.920] because we are we are our kids first teachers.
[26:15.920 --> 26:18.860]  We should be.
[26:18.860 --> 26:22.520] Not everyone takes that responsibility seriously though.
[26:22.520 --> 26:28.200] Well you know parents usually use the public school as a free daycare.
[26:28.200 --> 26:32.400] You know nowadays that would be true.
[26:32.400 --> 26:37.120] And you know I see you know and I see some you know Eddie you know the thing is it's
[26:37.120 --> 26:44.800] like the school system's so bad I had to teach kids how to fill out a job application.
[26:44.800 --> 26:47.960] Teach them how to find the correct spelling of a word they were asked me how do you spell
[26:47.960 --> 26:52.440] this how you spell that and I teach them how to use a dictionary and one thing I did
[26:52.440 --> 26:58.080] I did do that my school my son's math teacher does not like and that was instead of using
[26:58.080 --> 27:03.680] a calculator I made him do his math problems on scrap paper like I used to I tell him calculator
[27:03.680 --> 27:12.520] bad scrap paper good you know in the old school ways but like I say people are too lazy.
[27:12.520 --> 27:17.280] Well they're all so ignorant they don't know how to do it themselves and they don't want
[27:17.280 --> 27:19.640] to look stupid in front of the child.
[27:19.640 --> 27:25.240] I mean yeah I mean do you use scrap paper still instead of a calculator?
[27:25.240 --> 27:30.920] Actually I was unique in my in the fact that most of the things I did that way I did almost
[27:30.920 --> 27:32.840]  entirely in my head.
[27:32.840 --> 27:37.320] There's a lot of things in math that I can do very easily in my head that make no sense
[27:37.320 --> 27:41.680] to me when you write them down on paper especially the way they tell you you have to do it algebra
[27:41.680 --> 27:46.800] in three steps always three steps and when you get there and it's like well excuse me
[27:46.800 --> 27:54.400] but x plus five equals eight there ain't but one number in the entire universe that x can
[27:54.400 --> 28:00.320] possibly be for that to be eight why do I need three steps to get there?
[28:00.320 --> 28:02.320] Yeah but sometimes the teacher wants to see that.
[28:02.320 --> 28:07.240] I understand the teacher wants to see that which makes me think the teacher's a moron.
[28:07.240 --> 28:14.440] Well I got a book from the Apollo 13 Miss Piasco and I seen a paper I got like the printing
[28:14.440 --> 28:19.160] of scrap paper by people mission control doing mathematics on scrap paper trying to figure
[28:19.160 --> 28:25.960] out how to get this this this lunar module back to earth safely you know it's all everything
[28:25.960 --> 28:30.960] was done mathematically on scrap paper they didn't have no calculators back then.
[28:30.960 --> 28:31.960]  Yeah.
[28:31.960 --> 28:37.240]  And that's why I say that's why I always like to encourage my son because I always did I
[28:37.240 --> 28:40.080] always use scrap paper to do my additions.
[28:40.080 --> 28:44.640] I mean I don't use the calculator on my android because that usually comes up wrong.
[28:44.640 --> 28:49.960] I'm afraid I'm going to put common core math into it.
[28:49.960 --> 28:51.960]  I understand that.
[28:51.960 --> 28:57.000] Yeah but anyway have a good evening all right thanks for calling in all right thank you
[28:57.000 --> 28:59.840]  all right.
[28:59.840 --> 29:06.040] All right now we're going to go to Larry in Arizona but Larry I'm less than a minute away
[29:06.040 --> 29:09.600] from a break so if you will hold on I'll be more than happy to take you when we get back
[29:09.600 --> 29:11.600]  on the other side.
[29:11.600 --> 29:17.760] Folks I'm on these four callers after Larry the call in numbers 512-646-1984 so give us
[29:17.760 --> 29:21.200] a call get on the board we can talk about whatever you need to know about on the other
[29:21.200 --> 29:28.280] side but in the meantime when we do go to break y'all be thinking about this talk to
[29:28.280 --> 29:34.920] people you better learn what your neighbor's capable of as far as mental capacities because
[29:34.920 --> 29:39.120] if things keep going the way they're going you're going to have to rely on that neighbor
[29:39.120 --> 29:43.160] if you ain't been if you're not completely able to rely on yourself and you're out in
[29:43.160 --> 29:47.280] the middle of nowhere where you don't have a choice because stupid people are every bit
[29:47.280 --> 29:53.160] as dangerous to you as those that actively seek to harm you in a lot of ways so be aware.
[29:53.160 --> 29:58.960] All right folks we'll be right back on the other side so y'all hang in there.
[29:58.960 --> 30:08.400] Is that a Harley I hear if so I hope the driver is wearing a helmet motorcycle fatalities
[30:08.400 --> 30:12.960] are way up and you won't guess among which age group I'm Dr. Catherine Hallbrecht back
[30:12.960 --> 30:15.520]  with details in a moment.
[30:15.520 --> 30:20.480] Privacy is under attack when you give up data about yourself you'll never get it back again
[30:20.480 --> 30:25.480] and once your privacy is gone you'll find your freedoms will start to vanish too so
[30:25.480 --> 30:31.040] protect your rights say no to surveillance and keep your information to yourself.
[30:31.040 --> 30:35.080] Privacy it's worth hanging on to this public service announcement is brought to you by

[30:41.800 --> 30:42.800]  startpage.
[30:42.800 --> 30:49.040] When you hear the word motorcycle most of us think of youthful rebellion you know some
[30:49.040 --> 30:53.280] teenage couple zipping down the highway with the wind whipping through their hair what
[30:53.280 --> 30:57.840] you don't picture is the driver on that Harley being a middle-aged baby boomer or even a
[30:57.840 --> 31:03.920] retiree fact is though older people are riding motorcycles more than ever and dying in greater
[31:03.920 --> 31:05.520]  numbers too.
[31:05.520 --> 31:11.000] Federal accident data shows motorcycle deaths have climbed 25 percent in 10 years half the
[31:11.000 --> 31:16.560] riders were age 40 or older and nearly a quarter were older than 50 so if you're planning on
[31:16.560 --> 31:20.880] hitting the highway wear a helmet and go easy on those hairpin turns.
[31:20.880 --> 31:30.880] I'm Dr. Catherine Hallbrecht more news and information at CatherineHallbrecht.com.

[31:36.240 --> 31:40.920] The government says that fire brought it down however 1,500 architects and engineers have
[31:40.920 --> 31:45.480] concluded it was a controlled demolition over 6,000 of my fellow service members have given
[31:45.480 --> 31:48.720] their lives and thousands of my fellow first responders are dying.
[31:48.720 --> 31:52.320]  I'm not a conspiracy theorist, I'm a structural engineer, I'm a New York City correction

[32:08.840 --> 32:13.040] going to have a free society then we're going to have to stand and defend our own rights.
[32:13.040 --> 32:16.240] Among those rights are the right to travel freely from place to place, the right to act
[32:16.240 --> 32:20.280] in our own private capacity and most importantly the right to due process of law.
[32:20.280 --> 32:24.120] Traffic courts afford us the least expensive opportunity to learn how to enforce and preserve

[33:50.040 --> 33:52.800] Alright we're getting a couple callers up on the board here.
[33:52.800 --> 33:56.960] We're going to start with Larry in Arizona, Larry what can we do for you?
[33:56.960 --> 34:06.240] Yes sir, before I learned about your traffic stop script, I was in court a few months ago
[34:06.240 --> 34:14.320] and I did know enough to question the judge whether he respected the right to travel versus
[34:14.320 --> 34:22.560] driving and I was admonished something severely for mentioning that in his courtroom and I
[34:22.560 --> 34:30.480] would love some pointers on how to, how do I counteract that kind of action from a judge?
[34:30.480 --> 34:34.700] Well the first thing is, is you know, you have to know how to hold a judge accountable
[34:34.700 --> 34:36.360]  for what they do.
[34:36.360 --> 34:42.280] In courts of no record that's more difficult because the judge believes they can say or
[34:42.280 --> 34:46.760] do anything they want because there's no official record of it under which they can be held
[34:46.760 --> 34:49.760]  accountable.
[34:49.760 --> 34:52.760]  What's the definition of a court of no record, I mean?
[34:52.760 --> 34:58.360] Court of no record is where there is no court reporter or there is no official record of
[34:58.360 --> 34:59.360]  the proceedings.
[34:59.360 --> 35:03.920] Okay, there was an official record of proceedings here.
[35:03.920 --> 35:07.560] But was the record being taken at the time?
[35:07.560 --> 35:08.560]  Yes.
[35:08.560 --> 35:12.080] Okay, so everything the judge said was on the record?
[35:12.080 --> 35:14.800]  Yes, and I have a copy of it.
[35:14.800 --> 35:19.360] Okay, then I would love to see it and I'll be able to point that out a little bit better.
[35:19.360 --> 35:24.080] But if you've actually got a transcript of what the judge said and what the judge said
[35:24.080 --> 35:30.920] was impliedly that you don't have the right to this, that or the other, then there may
[35:30.920 --> 35:32.400] be something you can do.
[35:32.400 --> 35:37.620] It won't be in the form of a lawsuit or anything unless of course what the judge said or did
[35:37.620 --> 35:42.000] can be shown to have knowingly and intentionally deprived you of a right under the right of
[35:42.000 --> 35:48.160] due process or at a protected federal right level, in which case you could sue them and
[35:48.160 --> 35:50.760]  whoever they work for.
[35:50.760 --> 35:54.760] But I would need to know more exactly about what was said and the circumstances in which
[35:54.760 --> 35:58.520] it was said before I can tell you that for sure.
[35:58.520 --> 36:03.360] Yeah, I just asked if you respected people's right to travel.
[36:03.360 --> 36:05.400]  They absolutely don't respect it.
[36:05.400 --> 36:08.040] There's no money in respecting your rights.
[36:08.040 --> 36:13.360] Yes, and he told me that would not be discussed in his courtroom.
[36:13.360 --> 36:17.640] Oh, absolutely, because they're not there to discuss what your rights are.
[36:17.640 --> 36:22.880] They're there to discuss whether or not you broke a commercial rule that you agreed to
[36:22.880 --> 36:24.320]  obey.
[36:24.320 --> 36:26.000]  That's a completely different thing.
[36:26.000 --> 36:32.640] See, the first problem you have is you went into a commercial administrative court and
[36:32.640 --> 36:37.040] you tried to argue a fundamental right.
[36:37.040 --> 36:39.200]  Can't do that.
[36:39.200 --> 36:48.000] You're trying to put out a fire with water and the fire is a legal fire and you can't
[36:48.000 --> 36:51.440] fight fire with water in court.
[36:51.440 --> 36:55.960]  I know it sounds counterintuitive and counterproductive, but it's a fact.
[36:55.960 --> 37:03.580] In the legal world, you don't use logic to make your point and win your case.
[37:03.580 --> 37:11.800] In the real world, water will put out a fire unless the fire is petroleum-based, right?
[37:11.800 --> 37:15.240] Or some other thing that can burn and supply its own oxygen source.
[37:15.240 --> 37:18.720]  The water can't put it out.
[37:18.720 --> 37:23.920] Water on certain types of fires is absolutely the wrong thing to use.
[37:23.920 --> 37:24.920]  Would you agree?
[37:24.920 --> 37:25.920]  Okay.
[37:25.920 --> 37:26.920]  I'll agree.
[37:26.920 --> 37:31.480] For instance, you don't throw water on a grease fire.
[37:31.480 --> 37:36.680] If a pan of grease on your stove catches fire and you throw water on it, you're going to
[37:36.680 --> 37:42.300] get a fireball the size of Hiroshima out of that grease and you're going to scatter it
[37:42.300 --> 37:45.600] all over your kitchen in the same shot.
[37:45.600 --> 37:50.320] You just made the problem a thousand times worse by adding water.
[37:50.320 --> 37:56.340] Well, when you go to court, same principle.
[37:56.340 --> 38:02.740] In court, you have to smother the fire and there's only two ways to do that.
[38:02.740 --> 38:09.480] You have to smother it either with a fire break or you have to smother it by equal and
[38:09.480 --> 38:13.140]  opposite opposing fire.
[38:13.140 --> 38:17.120] When you go to court and they're asserting you were engaged in a commercial activity,
[38:17.120 --> 38:23.200] which is what they're actually doing, you have to be asserting the opposite fire, not
[38:23.200 --> 38:27.040]  engaged in a commercial activity.
[38:27.040 --> 38:29.840] You understand the difference in the argument?
[38:29.840 --> 38:35.400] They're arguing engaged in a commercial activity, you have to argue not engaged in a commercial
[38:35.400 --> 38:36.400]  activity.
[38:36.400 --> 38:40.920] If you go in there arguing right to travel, that ain't the same argument in opposition
[38:40.920 --> 38:43.640]  to theirs, is it?
[38:43.640 --> 38:46.640] Because their argument is you broke a commercial rule.
[38:46.640 --> 38:48.600] Your argument is, is I have the right to travel.
[38:48.600 --> 38:51.920] Well, they're not arguing whether or not you have a right to travel.
[38:51.920 --> 38:58.160] So your rebuttal does not address their accusal.
[38:58.160 --> 38:59.160]  You follow?
[38:59.160 --> 39:00.160]  Okay.
[39:00.160 --> 39:01.160]  Yes, I do.
[39:01.160 --> 39:02.160]  Okay.
[39:02.160 --> 39:07.440] That's the problem and that is where the majority of people fail to understand the legal issue
[39:07.440 --> 39:11.840] they're facing when they go in to fight these tickets.
[39:11.840 --> 39:22.480] Okay, so when we get to court my next time and I tell the judge that I am not engaged
[39:22.480 --> 39:23.480]  in transportation.
[39:23.480 --> 39:26.360]  No, no, no.
[39:26.360 --> 39:31.040] The best way, depending upon how well you know the statutes of your state, in Texas
[39:31.040 --> 39:32.680]  that's exactly what it is.
[39:32.680 --> 39:37.920] Everything here is in a transportation code and the only thing that code regulates are
[39:37.920 --> 39:44.080] those engaged in the regulable activity of transportation.
[39:44.080 --> 39:51.000] Now in other states they disguise it a little better by saying operation of a motor vehicle.
[39:51.000 --> 39:56.800] They don't ever bring up the formal aspect of transportation like they do here in Texas.
[39:56.800 --> 39:59.760] They just put it as operation of motor vehicles.
[39:59.760 --> 40:05.740] But you have to understand from a legal standpoint what operate and motor vehicle actually are.
[40:05.740 --> 40:10.120] And if you research it far enough back you will find that it still has to do with commercial
[40:10.120 --> 40:11.600]  activity.
[40:11.600 --> 40:20.680] So the best way to approach it is what regulable activity are you asserting I was engaged in
[40:20.680 --> 40:28.280] that required me to comply with the regulations associated with it?
[40:28.280 --> 40:31.480]  That's always your legal question.
[40:31.480 --> 40:36.360] You're saying here in Texas it is you're saying I was engaged in transportation.
[40:36.360 --> 40:37.360]  Prove it.
[40:37.360 --> 40:41.920] Well, they can't prove it because there's only four ways to prove it.
[40:41.920 --> 40:44.080] They have to have a passenger manifest.
[40:44.080 --> 40:45.480] They have to have a bill of lading.
[40:45.480 --> 40:50.800] They have to have a commercial log book or they have to have a confession.
[40:50.800 --> 40:57.920] If you don't give them those things then the only way they convict you is in 100% based
[40:57.920 --> 41:03.200] on presumption of engaging in the activity.
[41:03.200 --> 41:11.960] So everything you do is geared at destroying and preventing the establishment of that presumption.
[41:11.960 --> 41:17.160]  Can you follow?
[41:17.160 --> 41:23.560] So I just hold tight to the fact I'm not engaged in transportation and I do not.
[41:23.560 --> 41:34.280] What regulable activity are you alleging I was engaged in that required me to follow
[41:34.280 --> 41:37.000] the regulations associated with it?
[41:37.000 --> 41:42.840] See the thing most people don't understand about licenses and permits, they're not a
[41:42.840 --> 41:45.740]  blanket that covers everything.
[41:45.740 --> 41:53.600] A license or permit deals only with the specific activity for which they are licensing you
[41:53.600 --> 41:56.920]  to engage, right?
[41:56.920 --> 41:58.200]  Okay.
[41:58.200 --> 42:02.960] If you get a driver's license, it doesn't cover fishing, does it?
[42:02.960 --> 42:04.560]  No.
[42:04.560 --> 42:09.800] And if you get a fishing license, it doesn't cover flying, does it?
[42:09.800 --> 42:16.720] So the license or permit is limited to the regulation of a specific activity or class
[42:16.720 --> 42:19.320]  of activity, right?
[42:19.320 --> 42:20.400]  Yes.
[42:20.400 --> 42:28.000] So where is there evidence that you were engaged in that activity and thus were subject to
[42:28.000 --> 42:31.920] the rules that regulate it?
[42:31.920 --> 42:40.120] Okay, I have it written down and I will try to get back in court as soon as I can.
[42:40.120 --> 42:45.320] Well, you need to study up on whatever constitutes your transportation code there, motor vehicle
[42:45.320 --> 42:46.720] code or whatever it is.
[42:46.720 --> 42:50.960] I highly recommend you start backtracking legislative enactments.
[42:50.960 --> 42:53.720] Go down to your state law library, get the librarian to help you.
[42:53.720 --> 42:55.680] They love this kind of research.
[42:55.680 --> 42:59.720] Dig into the law books and start tracking the statutes backwards.
[42:59.720 --> 43:06.560] Go back to the original enactment of the act that they're relying on and you will find
[43:06.560 --> 43:08.760]  several things most likely.
[43:08.760 --> 43:14.560] One, the current enactment does not comply with the requirements of your constitution
[43:14.560 --> 43:18.040] and your other laws as to how it's being used.
[43:18.040 --> 43:24.360] It also does not comply with the original language of the base enactment.
[43:24.360 --> 43:33.560] And what I mean by that is this, every statutory scheme on the books is not the actual law.
[43:33.560 --> 43:40.640] It's an agency rewrite and interpretation of regulations associated with the implementation
[43:40.640 --> 43:43.320] of the legislative act called the law.
[43:43.320 --> 43:46.840] Hang on just a second and I'll flesh that out for you a little bit more on the other
[43:46.840 --> 43:48.720] side Larry and then I can get to my next caller.
[43:48.720 --> 43:49.720]  So hang on.

[46:08.040 --> 46:27.720] All right, folks, we are back.
[46:27.720 --> 46:32.400] This is Rule of Law Radio, 512-646-1984.
[46:32.400 --> 46:35.320] All right, I am talking to Larry in Arizona.
[46:35.320 --> 46:38.400] All right, Larry, back to the statutory scheme of things.
[46:38.400 --> 46:41.680]  The statute is some agency's interpretation
[46:41.680 --> 46:46.200] of the actual bill that the legislature passed.
[46:46.200 --> 46:50.720] That is the actual law, the bill, not the statute.
[46:50.720 --> 46:53.120]  That's why you cannot introduce statute
[46:53.120 --> 46:57.120] as evidence of the law in any court anywhere.
[46:57.120 --> 47:02.080] That's why you can only do it via judicial notice.
[47:02.080 --> 47:07.080] Nowadays, you will find that the statute does not line up
[47:07.960 --> 47:12.440] with the language and intent of the actual bill.
[47:12.440 --> 47:14.720] They completely rewrite it to cover things
[47:14.720 --> 47:17.120] that was never covered by the bill.
[47:17.120 --> 47:20.880] Now here in Texas, the Texas Constitution forbids
[47:20.880 --> 47:25.160] the alteration of an enactment by amendment.
[47:25.160 --> 47:28.080] In other words, if the enactment was intended
[47:28.080 --> 47:32.800] to do a specific thing, you cannot change
[47:32.800 --> 47:36.760] what that specific thing is by amendment.
[47:36.760 --> 47:40.120] You must repeal the entire original enactment,
[47:40.120 --> 47:43.760] rewrite it with a brand new objective,
[47:43.760 --> 47:45.960]  and then reenact it.
[47:45.960 --> 47:50.480] The only thing you can amend on the fly to change
[47:50.480 --> 47:55.480] is specific understanding of the original enactment.
[47:55.480 --> 47:58.960] But you cannot change its purpose and its effect.
[47:58.960 --> 47:59.800]  You follow?
[48:00.880 --> 48:01.720]  Okay, yes.
[48:01.720 --> 48:05.080] So here in Texas, that's exactly where they've screwed up
[48:05.080 --> 48:07.400]  with the transportation code.
[48:07.400 --> 48:09.680] In the original enactment, the bill was only
[48:09.680 --> 48:13.000]  440 some odd pages long.
[48:13.000 --> 48:16.520] The rewrite in 1995 into the codification
[48:16.520 --> 48:21.520] that we call the transportation code is 3,881 pages
[48:21.520 --> 48:26.520] and it's in original form when they recodified it.
[48:27.080 --> 48:31.240] How do you go from 440 some odd to 3,881
[48:31.240 --> 48:35.960] and not have altered the base application of the law?
[48:38.720 --> 48:41.920] You would have had to go to microscopic nitpicking level
[48:41.920 --> 48:43.760] to get that many extra pages out of it,
[48:43.760 --> 48:45.920] and they did in a lot of ways.
[48:45.920 --> 48:50.920] But they also fundamentally changed the object
[48:50.920 --> 48:54.200] that the underlying law dealt with.
[48:55.080 --> 48:57.880] And they did it in such a way as to make it appear
[48:57.880 --> 49:01.800] to apply on a far larger basis
[49:01.800 --> 49:04.960] than it actually does in the original enactment.
[49:04.960 --> 49:06.920] For instance, the original enactment does not
[49:06.920 --> 49:10.400] in any way, shape, or form recognize a license
[49:10.400 --> 49:12.600]  called a driver's license.
[49:12.600 --> 49:16.460] The original enactment only recognizes operators,
[49:16.460 --> 49:20.040] commercial operators, and chauffeurs licenses.
[49:20.040 --> 49:23.800] But by amending the statutory scheme,
[49:23.800 --> 49:28.000]  they've created this thing called a driver's license
[49:28.000 --> 49:31.240]  and they've completely omitted the application
[49:31.240 --> 49:35.940] of these allowable three into the definition of that one.
[49:36.960 --> 49:39.840] So they've completely altered the licensing scheme
[49:39.840 --> 49:42.120] that the underlying law authorizes
[49:42.120 --> 49:44.220] and they can't do that, not here.
[49:45.160 --> 49:47.320] Plus the fact the original enactment
[49:47.320 --> 49:51.800] that made all of that is 1925.
[49:51.800 --> 49:53.960] So all of the original laws
[49:53.960 --> 49:57.480] that all of the current codes are supposed to be based on
[49:57.480 --> 50:01.700]  were passed by the 56th legislature in 1925.
[50:01.700 --> 50:04.080]  There's not been an actual change
[50:04.080 --> 50:07.660]  to an actual law since 1925.
[50:10.800 --> 50:13.780]  And up until 1996 at least,
[50:13.780 --> 50:18.000] the Texas Secretary of State certified
[50:18.000 --> 50:21.480] that the statutes were in compliance
[50:21.480 --> 50:23.480]  with the underlying law.
[50:25.080 --> 50:28.320]  But, well, prior to 1996.
[50:28.320 --> 50:32.000] But from 1995 forward, when they recodified
[50:32.000 --> 50:34.760] all these things, not a single one of them
[50:34.760 --> 50:37.520] has been certified by the Secretary of State
[50:37.520 --> 50:39.560] as complying with the underlying law.
[50:39.560 --> 50:44.560] Now, why do you think that would be?
[50:44.800 --> 50:47.200] Just to pull the wool over our eyes?
[50:47.200 --> 50:49.400] Well, the Secretary of State would be committing fraud
[50:49.400 --> 50:51.200]  if they certified it, wouldn't they?
[50:52.200 --> 50:53.040]  Okay.
[50:53.040 --> 50:54.960] And it would be a massive fraud
[50:54.960 --> 50:56.800] upon the people of Texas, wouldn't it?
[51:00.980 --> 51:01.960]  So what did the-
[51:01.960 --> 51:02.800]  It is, isn't it?
[51:02.800 --> 51:03.640]  It is.
[51:03.640 --> 51:06.000] So what would the Secretary of State decide to do?
[51:06.000 --> 51:07.420]  I ain't signing that.
[51:07.420 --> 51:08.860] You publish it all you want,
[51:08.860 --> 51:11.060]  but I'm not gonna certify it.
[51:11.060 --> 51:11.900]  And they don't.
[51:15.900 --> 51:18.900] So right there, there should be all kinds of warning bells
[51:18.900 --> 51:20.820]  going off saying something ain't right.
[51:25.460 --> 51:28.260] So that's why the research is gonna be necessary
[51:28.260 --> 51:29.100]  from your end.
[51:30.300 --> 51:31.140]  Okay.
[51:32.100 --> 51:34.060] You mentioned in another show,
[51:34.060 --> 51:37.500] you don't run plates on your vehicle, but you have some kind
[51:37.500 --> 51:38.340]  of a-
[51:38.340 --> 51:39.860]  That's because I don't run a vehicle.
[51:41.060 --> 51:42.660]  Okay, okay, okay.
[51:42.660 --> 51:44.940]  In Arizona, a vehicle is okay.
[51:44.940 --> 51:47.900]  It's a motor vehicle that is the-
[51:47.900 --> 51:51.740] Are either of those terms defined in the code
[51:52.780 --> 51:53.620]  that they use?
[51:53.620 --> 51:54.900]  Motor vehicle is.
[51:54.900 --> 51:57.060] Motor vehicle is, but vehicle is not.
[51:57.060 --> 51:58.940] Your positive vehicle is not.
[52:00.060 --> 52:01.660]  I'm positive it is not.
[52:01.660 --> 52:04.740] Okay, if vehicle does not have its own separate definition,
[52:04.740 --> 52:05.860]  then maybe you can.
[52:05.860 --> 52:08.940] But here in Texas, both of them have a definition,
[52:08.940 --> 52:10.700] and both of them are commercial.
[52:11.900 --> 52:16.620] Because here it says a motor vehicle is a vehicle
[52:16.620 --> 52:18.620] that is used to do this.
[52:19.900 --> 52:23.940]  Whereas a vehicle is a device that is self-propelled.
[52:26.060 --> 52:26.900]  You follow?
[52:26.900 --> 52:30.260] Yeah, here in the definition of a motor vehicle here
[52:30.260 --> 52:33.540]  the motor vehicle here is self-propelled.
[52:33.540 --> 52:36.740] It says and must be used in the furtherance
[52:36.740 --> 52:38.300]  of a commercial enterprise.
[52:38.300 --> 52:42.660] Right, so right there, that's as plain as you can get.
[52:42.660 --> 52:44.820]  They're saying you operated a motor vehicle.
[52:44.820 --> 52:47.100]  Where's your proof of a commercial enterprise?
[52:48.260 --> 52:51.380] So why are you going in arguing right to travel?
[52:51.380 --> 52:53.660] Where is your proof of a commercial enterprise?
[52:53.660 --> 52:56.860] Your own law says that's what a motor vehicle is.
[52:56.860 --> 52:59.380]  You're accusing me of operating a motor vehicle.
[52:59.380 --> 53:01.740] Where's your proof of the commercial enterprise?
[53:03.940 --> 53:04.860]  Yes, okay.
[53:08.060 --> 53:12.460] So your argument is state lacks standing.
[53:12.460 --> 53:14.620] State cannot prove motor vehicle
[53:14.620 --> 53:18.740] because state cannot prove commercial nexus.
[53:22.820 --> 53:23.660]  Okay.
[53:23.660 --> 53:28.660]  So that's why you're judged through a fit
[53:28.860 --> 53:30.060]  about right to travel.
[53:31.380 --> 53:32.220]  Okay.
[53:37.140 --> 53:38.980] But again, even if you had used it,
[53:38.980 --> 53:40.380]  it wouldn't have helped you.
[53:41.460 --> 53:45.620] Yeah, so what kind of a, you had mentioned on another show
[53:45.620 --> 53:50.380] about running some kind of a plate on your private automobile.
[53:50.380 --> 53:53.620]  Yeah, the one on, I've actually
[53:53.620 --> 53:55.180] got two cars up here right now.
[53:55.180 --> 53:57.700] One has absolutely no paperwork on it whatsoever,
[53:57.700 --> 54:00.300] and the other one has paperwork that's all expired.
[54:01.420 --> 54:04.220] It has their plates, it has their paperwork on it.
[54:04.220 --> 54:05.620] That car was gifted to me,
[54:05.620 --> 54:08.420] and I allowed everything on it to expire
[54:08.420 --> 54:11.020] so that I could use it to bait cops.
[54:12.380 --> 54:15.220] My other car does not have any of their paperwork on it.
[54:18.780 --> 54:19.620]  Okay, I-
[54:19.620 --> 54:24.620] And the plate that I have on it is one that I designed.
[54:25.900 --> 54:29.100] It simply says private, non-commercial, not for hire.
[54:30.340 --> 54:31.180]  Oh, okay.
[54:33.780 --> 54:36.260] Now see, if you had that plate on your car
[54:36.260 --> 54:38.820] and that officer in Arizona had pulled you over,
[54:39.980 --> 54:42.860] and he would have had absolutely no way
[54:43.740 --> 54:48.220] of standing a chance against that definition
[54:48.220 --> 54:51.380] if you're correct with the definition of motor vehicle.
[54:52.420 --> 54:54.660] He would have had to have admitted on the stand
[54:54.660 --> 54:56.380]  if you'd have questioned him properly.
[54:56.380 --> 54:59.100] Officer, did you see the private plate
[54:59.100 --> 55:01.940] that was on the rear of my car when you pulled me over?
[55:01.940 --> 55:04.660] Yes, and do you recall how, what it read?
[55:05.500 --> 55:10.460] Something about private, non-commercial, not for hire.
[55:10.460 --> 55:12.180] What does that mean, officer?
[55:12.180 --> 55:13.580]  Well, I don't know what it means.
[55:13.580 --> 55:16.180] Well, non-commercial, what do you believe that means?
[55:16.180 --> 55:19.100] Uh, well, I guess it means you're not in commerce.
[55:19.100 --> 55:21.540] And the not for hire, what does that mean?
[55:21.540 --> 55:23.580]  Well, I guess it means you don't hire out
[55:23.580 --> 55:26.220] or you don't hire out your car, something like that.
[55:27.260 --> 55:31.460] Okay, now officer, you charged me
[55:31.460 --> 55:35.340] with operation of a motor vehicle, did you not?
[55:35.340 --> 55:38.580]  Well, yeah, I believe that's part of the complaint.
[55:38.580 --> 55:40.580] Well, in the complaint, let me hear it.
[55:40.580 --> 55:43.620] Does this look like the complaint that was filed?
[55:43.620 --> 55:46.300] This is what the prosecutor was attempting to read
[55:46.300 --> 55:48.980] in the record at the beginning of this, correct?
[55:48.980 --> 55:51.260] Now, right here, could you tell the court
[55:51.260 --> 55:53.100] what it says right there?
[55:53.100 --> 55:55.940]  Operated a motor vehicle, isn't that what it reads?
[55:57.220 --> 56:00.100] Now, officer, how do you determine
[56:00.100 --> 56:02.740] what is and is not a motor vehicle?
[56:02.740 --> 56:04.420]  Oh, well, it's got a motor in it, don't it?
[56:04.420 --> 56:06.300] You used it on the road, didn't you?
[56:06.300 --> 56:08.260]  Objection, non-responsive.
[56:08.260 --> 56:12.260] Obviously, judge, the officer is not really clear
[56:12.260 --> 56:16.260] on the law he attempts to enforce by fiat here,
[56:16.260 --> 56:17.740] so let me help him out.
[56:17.740 --> 56:20.180] I would like the court to take judicial notice
[56:20.180 --> 56:22.500] of the statute involved in this case
[56:22.500 --> 56:24.980] that specifically states that the definition
[56:24.980 --> 56:28.300] of motor vehicle requires a commercial nexus.
[56:28.300 --> 56:31.140] The officer had forewarning that me and my car
[56:31.140 --> 56:34.220] had no commercial nexus and illegally seized me
[56:34.220 --> 56:36.820] without a warrant any of the above.
[56:36.820 --> 56:40.260] Me without a warrant anyway, but for the record,
[56:40.260 --> 56:42.780] I would like this read into the record here
[56:42.780 --> 56:45.420] where it specifically says commercial.
[56:48.060 --> 56:51.020] Now, I move the court to dismiss the case
[56:51.020 --> 56:54.420] because state has brought forth no evidence
[56:54.420 --> 56:56.220] that there was any commercial activity
[56:56.220 --> 56:58.300] being engaged in at all.
[57:00.540 --> 57:01.860] See how that would play out?
[57:02.820 --> 57:04.700]  Yes, yes, very well.
[57:04.700 --> 57:08.020] Now, you want to have a little more finesse than that
[57:08.020 --> 57:09.660] and you want to be able to lead them down
[57:09.660 --> 57:13.660] a lot more paths of lying and being stupid
[57:13.660 --> 57:15.540] so that when you do ask for that,
[57:15.540 --> 57:18.540] they can't help but give it to you without losing face.
[57:18.540 --> 57:20.340]  If they don't, they're really screwed.
[57:21.660 --> 57:23.940] But of course, that takes practice
[57:23.940 --> 57:25.180] and it takes a little bit of knowledge
[57:25.180 --> 57:28.460] about knowing how to formulate the argument
[57:28.460 --> 57:31.700] to lead them down those paths where you want them to go
[57:31.700 --> 57:33.260] so you can establish those things
[57:33.260 --> 57:36.580] so you can establish those facts and hammer them with them.
[57:39.260 --> 57:41.420]  Okay, yeah, that's what I'm working on these days
[57:41.420 --> 57:42.940] is how to learn how to get it right.
[57:42.940 --> 57:44.700] Yeah, and unfortunately, I have to give you
[57:44.700 --> 57:46.740] the abbreviated version here on the air.
[57:48.580 --> 57:50.460] But this is what my classes
[57:50.460 --> 57:52.300] down at Brave New Books are all about
[57:52.300 --> 57:55.940] and so when we open up the Tile of Law website
[57:55.940 --> 57:59.500] and we can start conducting these classes online,
[57:59.500 --> 58:01.460] then it doesn't matter where you are.
[58:01.460 --> 58:03.140] If you can get on the internet with a web browser,
[58:03.140 --> 58:05.340] you'll be able to go to class and learn this.
[58:08.420 --> 58:11.580] Okay, when an officer has taken you into court
[58:11.580 --> 58:13.780] and he looted, the officer looted,
[58:13.780 --> 58:15.700]  presuming the officer loses,
[58:15.700 --> 58:19.340] do you have any recourse on the officer, like under?
[58:19.340 --> 58:23.180] You can sue them for malicious prosecution if you win.
[58:23.180 --> 58:26.500] You need to sue them in federal court, though.
[58:26.500 --> 58:28.860] If you can show he should have never arrested you
[58:28.860 --> 58:30.780] in the first place, then you can make the argument
[58:30.780 --> 58:32.940] that he violated a protected federal right
[58:32.940 --> 58:34.620] and you can sue him for all of them.
[58:34.620 --> 58:37.340]  Aggravated assault, aggravated kidnapping,
[58:37.340 --> 58:41.780] malicious prosecution, official oppression, all of it.
[58:41.780 --> 58:44.060] All right, Larry, we're about to go to break, so.
[58:44.060 --> 58:45.740] All right, thanks for calling in.
[58:45.740 --> 58:47.100] All right, folks, we'll be right back.
[58:47.100 --> 58:50.260]  512-646-1984.
[58:50.260 --> 58:53.980] The Bible remains the most popular book in the world,
[58:53.980 --> 58:55.820] yet countless readers are frustrated
[58:55.820 --> 58:58.340] because they struggle to understand it.
[58:58.340 --> 59:01.900] Some new translations try to help by simplifying the text,
[59:01.900 --> 59:04.100] but in the process can compromise
[59:04.100 --> 59:06.860] the profound meaning of the scripture.
[59:06.860 --> 59:09.300]  Enter the recovery version.
[59:09.300 --> 59:12.380] First, this new translation is extremely faithful
[59:12.380 --> 59:14.460] and accurate, but the real story
[59:14.460 --> 59:18.100] is the more than 9,000 explanatory footnotes.
[59:18.100 --> 59:20.740] Difficult and profound passages are opened up
[59:20.740 --> 59:23.620] in a marvelous way, providing an entrance
[59:23.620 --> 59:25.460] into the riches of the word beyond
[59:25.460 --> 59:27.980]  which you've ever experienced before.

[01:00:32.540 --> 01:00:35.060] They don't feed the banks by taking credit cards,
[01:00:35.060 --> 01:00:37.340] but you can bet they take Bitcoin.
[01:00:37.340 --> 01:00:42.340]  Online at rrbi.co or by phone at 800-874-9760.
[01:00:44.500 --> 01:00:47.860]  Support also comes from growyourowngroceries.org.

[01:00:50.700 --> 01:00:53.060]  At growyourowngroceries.org.
[01:00:53.060 --> 01:00:55.900] And from SovereignBTC, media, marketing,
[01:00:55.900 --> 01:00:58.340] and consulting for the Bitcoin ecosystem.
[01:00:58.340 --> 01:01:01.900]  Online at sovereignbtc.com.
[01:01:01.900 --> 01:01:04.660] Observers are calling it an implosion.
[01:01:04.660 --> 01:01:07.100] That comes as Mt. Gox, the one-time largest
[01:01:07.100 --> 01:01:09.140]  platform for Bitcoin trading,
[01:01:09.140 --> 01:01:11.180] sees prices of the digital currency
[01:01:11.180 --> 01:01:14.020]  fall to as low as $220.
[01:01:14.020 --> 01:01:15.900] Business Insider reports the price
[01:01:15.900 --> 01:01:19.220]  at other exchanges remains above $600.
[01:01:19.220 --> 01:01:21.180] With the Mt. Gox situation stemming from
[01:01:21.180 --> 01:01:24.020] their recent decision to halt withdrawals,
[01:01:24.020 --> 01:01:26.700]  citing a long-known potential Bitcoin weakness.
[01:01:30.300 --> 01:01:33.420]  According to Al-Mayadeen Television in Lebanon,
[01:01:33.420 --> 01:01:36.860] Russia may call an emergency UN Security Council meeting
[01:01:36.860 --> 01:01:40.020] to slow the escalating situation in Syria.
[01:01:40.020 --> 01:01:43.020] Russian sources stated that Washington and Paris
[01:01:43.020 --> 01:01:45.700] are putting together a military intervention plan
[01:01:45.700 --> 01:01:47.700] to stop the Syrian army.
[01:01:47.700 --> 01:01:50.340] The United States and Russia have been at odds
[01:01:50.340 --> 01:01:53.060] about which route to take in war-torn Syria.
[01:01:53.060 --> 01:01:55.740] Negotiations will continue next in Geneva.
[01:01:58.300 --> 01:02:00.220] On Friday, the Department of Justice
[01:02:00.220 --> 01:02:02.940] and the Department of the Treasury issued an outline
[01:02:02.940 --> 01:02:05.860] for banks working with marijuana businesses.
[01:02:05.860 --> 01:02:07.700] Banks have been wary of opening accounts
[01:02:07.700 --> 01:02:09.700] for clients who deal in marijuana,
[01:02:09.700 --> 01:02:12.300] fearing persecution by the federal government.
[01:02:12.300 --> 01:02:14.140] As states like Colorado and Washington
[01:02:14.140 --> 01:02:15.980] have moved to legalize recreational
[01:02:15.980 --> 01:02:18.100] and medicinal use of marijuana,
[01:02:18.100 --> 01:02:19.860]  banks have walked a fine line
[01:02:19.860 --> 01:02:21.740] between state law and federal law,
[01:02:21.740 --> 01:02:24.420] which still declares marijuana to be illegal.
[01:02:27.300 --> 01:02:30.500] Support for Liberty Beat comes from Mass Appeal Printing,

[01:02:39.220 --> 01:02:41.660] Support also comes from The Cory Moore Show,

[01:02:51.220 --> 01:02:56.220] This is the Liberty Beat for Monday, February 17th, 2014.
[01:02:56.540 --> 01:02:59.660]  Check out the website at theLibertyBeat.com.
[01:03:00.780 --> 01:03:03.540]  ["Liberty Beat"]
[01:03:05.340 --> 01:03:09.340] It's all according to the will of the Almighty.
[01:03:09.340 --> 01:03:14.340]  ["Liberty Beat"]
[01:03:17.420 --> 01:03:19.660] All right, folks, we are back.
[01:03:19.660 --> 01:03:23.700]  Rule of Law Radio 512-646-1984.
[01:03:23.700 --> 01:03:26.220] Now we're gonna go to Derek in Houston.
[01:03:26.220 --> 01:03:28.020] Derek, what can we do for you?
[01:03:28.020 --> 01:03:30.700] Hey, Eddie, how you doing tonight?
[01:03:30.700 --> 01:03:32.420]  Doing all right.
[01:03:32.420 --> 01:03:34.940]  I was calling because I'm having a legal dispute
[01:03:34.940 --> 01:03:37.260]  with my homeowners association
[01:03:37.260 --> 01:03:39.380] and I wanted to know if you knew anything
[01:03:39.380 --> 01:03:41.860] about HOAs and homeowners rights.
[01:03:41.860 --> 01:03:43.740]  I know that I refused to buy a house
[01:03:43.740 --> 01:03:45.020] that was involved in one.
[01:03:45.900 --> 01:03:48.900]  Well, I wish I was in that situation,
[01:03:48.900 --> 01:03:51.420] kind of like already stuck.
[01:03:51.420 --> 01:03:56.100] The problem you have with the HOA is it's contractual.
[01:03:56.100 --> 01:03:57.980] So the first thing you need to understand
[01:03:57.980 --> 01:03:59.380]  is the contract itself.
[01:03:59.380 --> 01:04:02.700] Where is it, who signed it, what are the terms of it,
[01:04:02.700 --> 01:04:04.220]  and who's breaking it?
[01:04:04.220 --> 01:04:05.260]  Okay, okay.
[01:04:05.260 --> 01:04:08.060]  I think they're breaking it.
[01:04:08.060 --> 01:04:10.420] Well, until you check out the terms,
[01:04:10.420 --> 01:04:12.180]  you're not gonna know that.
[01:04:12.180 --> 01:04:13.660]  Okay.
[01:04:13.660 --> 01:04:17.780]  Well, I've got a problem because I own a condominium unit
[01:04:17.780 --> 01:04:22.140]  in a condominium, apartment complex of 40 units.
[01:04:22.140 --> 01:04:23.220]  I own one unit.
[01:04:24.180 --> 01:04:27.260]  I'm getting like a lot of rainwater
[01:04:27.260 --> 01:04:29.740] coming into my unit when it rains.
[01:04:29.740 --> 01:04:30.580]  Right.
[01:04:30.580 --> 01:04:32.540]  But the homeowners association,
[01:04:32.540 --> 01:04:36.020]  they've hired a property management company
[01:04:36.020 --> 01:04:37.980] that does maintenance and repairs
[01:04:37.980 --> 01:04:40.780] to the property throughout the year.
[01:04:40.780 --> 01:04:44.060] And I've talked to the property manager
[01:04:44.060 --> 01:04:48.020] and she sent a handyman out to check out things.
[01:04:48.020 --> 01:04:53.020] And he's basically blaming me for the water damage.
[01:04:53.580 --> 01:04:57.900]  He's basically saying it's because you got leaks
[01:04:57.900 --> 01:05:00.980] in your bathroom, which is totally false.
[01:05:00.980 --> 01:05:04.060] And this occurs when it rains,
[01:05:04.060 --> 01:05:07.380] not when, you know, using the sink and shower
[01:05:07.380 --> 01:05:08.900] or the toilet or whatever.
[01:05:08.900 --> 01:05:09.740]  Okay.
[01:05:09.740 --> 01:05:11.380] Do you know where the actual source
[01:05:11.380 --> 01:05:13.860] of the water is coming from?
[01:05:13.860 --> 01:05:17.540]  I do now because I hired a structural engineer
[01:05:17.540 --> 01:05:19.700] that came out and assessed the damage
[01:05:19.700 --> 01:05:20.900] and needed some water tests.
[01:05:20.900 --> 01:05:23.860] He said it's coming through the exterior of the building.
[01:05:23.860 --> 01:05:26.900] There's holes in the walls and stuff.
[01:05:26.900 --> 01:05:29.220]  I got a report from this guy.
[01:05:29.220 --> 01:05:31.740] And he said, yeah, it's definitely not, you know,
[01:05:31.740 --> 01:05:34.100] any leaks with pipes and stuff like that.
[01:05:34.100 --> 01:05:36.100]  It's coming through the actual wall.
[01:05:36.100 --> 01:05:36.940]  Okay.
[01:05:36.940 --> 01:05:40.060] So in your condo, under the terms of your contract,
[01:05:40.060 --> 01:05:44.340] who is required to keep the exterior properly maintained
[01:05:44.340 --> 01:05:47.980] to prevent damage to the interiors, which is yours?
[01:05:47.980 --> 01:05:48.820]  Right.
[01:05:48.820 --> 01:05:52.500] Well, it says that the exterior is known as common property.
[01:05:52.500 --> 01:05:56.020] So it's owned by all of the HOA.
[01:05:56.020 --> 01:05:58.060] And they are responsible for maintaining
[01:05:58.060 --> 01:05:59.700] and repairing the common property
[01:05:59.700 --> 01:06:02.420]  while I'm responsible for maintaining
[01:06:02.420 --> 01:06:04.340]  my own individual property.
[01:06:04.340 --> 01:06:05.180]  Correct.
[01:06:05.180 --> 01:06:09.300] Which is anything inside the perimeter walls.
[01:06:09.300 --> 01:06:10.140]  Right, right.
[01:06:10.140 --> 01:06:10.980]  Okay.
[01:06:10.980 --> 01:06:13.260]  So sue them.
[01:06:13.260 --> 01:06:15.140]  I did, I did.
[01:06:15.140 --> 01:06:17.860]  I went to courts.
[01:06:17.860 --> 01:06:20.900] We're in court right now going through
[01:06:21.940 --> 01:06:23.660] this thing called the discovery process
[01:06:23.660 --> 01:06:25.820] where you get more information.
[01:06:25.820 --> 01:06:28.340] Are you using an attorney?
[01:06:28.340 --> 01:06:29.860]  I'm just doing a pro se.
[01:06:29.860 --> 01:06:30.700]  Okay.
[01:06:30.700 --> 01:06:33.940] Then how, as a pro se, have you failed to this point
[01:06:33.940 --> 01:06:36.260]  to read the contract?
[01:06:36.260 --> 01:06:37.660]  Oh, I've read the contract.
[01:06:37.660 --> 01:06:39.980]  I've actually claimed in my lawsuit
[01:06:39.980 --> 01:06:42.740] that they're breaching the contract by not.
[01:06:42.740 --> 01:06:43.580]  Okay.
[01:06:43.580 --> 01:06:44.780] Well, you threw me off when I asked that question
[01:06:44.780 --> 01:06:47.260] at the beginning and you seemed unsure of what it said.
[01:06:47.260 --> 01:06:48.220]  Oh, sorry, sorry.
[01:06:48.220 --> 01:06:49.660]  Yeah, sorry, I wasn't clear.
[01:06:49.660 --> 01:06:52.300] Yeah, I'm actually explaining in the lawsuit
[01:06:52.300 --> 01:06:53.860]  that they're breaching the contract
[01:06:53.860 --> 01:06:57.260] by failing to properly repair, maintain,
[01:06:57.260 --> 01:06:59.820]  and diagnose these problems.
[01:06:59.820 --> 01:07:02.420] Right, and you submitted certified statements
[01:07:02.420 --> 01:07:04.700] from the engineer and everybody else, right?
[01:07:04.700 --> 01:07:05.780]  Yep, yep, I did that.
[01:07:05.780 --> 01:07:06.620]  Okay.
[01:07:06.620 --> 01:07:10.300] As well as that, I would get depositions from them too.
[01:07:10.300 --> 01:07:12.700] Okay, okay, yeah, they said they would do that.
[01:07:14.180 --> 01:07:18.020] My thing is now I'm kind of getting stonewalled
[01:07:18.020 --> 01:07:20.500]  in this discovery process.
[01:07:20.500 --> 01:07:21.900]  By who?
[01:07:21.900 --> 01:07:25.340] By the attorneys representing the HOA.
[01:07:25.340 --> 01:07:28.620] The petition the court to mandate discovery.
[01:07:28.620 --> 01:07:31.620] Okay, yeah, I've done that and then the other thing is
[01:07:31.620 --> 01:07:36.260] one of the building repairmen that came out
[01:07:36.260 --> 01:07:38.740] to do repairs to the building,
[01:07:38.740 --> 01:07:40.740]  I put him in the lawsuit
[01:07:40.740 --> 01:07:43.300] and he never answered the lawsuit.
[01:07:43.300 --> 01:07:45.340]  Like I think they've got a deadline of like.
[01:07:45.340 --> 01:07:47.940] Okay, what claim did you make against him?
[01:07:49.820 --> 01:07:51.820]  Improper.
[01:07:51.820 --> 01:07:55.060] Okay, failing to properly diagnose the problem,
[01:07:55.060 --> 01:07:56.780]  number one, number two,
[01:07:56.780 --> 01:07:59.220] failing to adequately do the repairs
[01:07:59.220 --> 01:08:02.020] because the repairs he did did not stop the leaks
[01:08:03.060 --> 01:08:05.540] and the Homeowners Association was charged
[01:08:05.540 --> 01:08:06.940]  and then number three.
[01:08:07.980 --> 01:08:10.340] Okay, well you realize then what they're going to try to do
[01:08:10.340 --> 01:08:12.900] is shift the burden to the third party.
[01:08:14.060 --> 01:08:16.380] Yeah, I was thinking they were going to do that
[01:08:16.380 --> 01:08:19.220] but in fact they just engaged in blaming me
[01:08:19.220 --> 01:08:22.020]  which is totally stupid.
[01:08:22.020 --> 01:08:25.380]  They're basically saying I wasn't specific enough
[01:08:25.380 --> 01:08:29.500] in telling them what the problems were
[01:08:29.500 --> 01:08:31.620] but I don't know how to be any more clear
[01:08:31.620 --> 01:08:34.980] than to tell them come over and look at it yourself
[01:08:34.980 --> 01:08:36.620]  and they sent a handyman over
[01:08:36.620 --> 01:08:39.340]  who's basically playing stupid.
[01:08:41.140 --> 01:08:46.140] So I included this guy, the handyman in the lawsuits
[01:08:46.140 --> 01:08:51.140] and he asked the court for a summary judgment against me
[01:08:54.860 --> 01:08:59.460] but he never sent me any certified mail or anything about it
[01:08:59.460 --> 01:09:01.740] and so the judge never ruled on it
[01:09:01.740 --> 01:09:04.940] and he's never answered any of my discovery requests.
[01:09:04.940 --> 01:09:08.020] Then you file for summary judgment against him.
[01:09:08.020 --> 01:09:10.020] He can't file for any summary judgment
[01:09:10.020 --> 01:09:12.420]  that he doesn't notify you of
[01:09:12.420 --> 01:09:15.460] and he didn't respond to your claims in the suit.
[01:09:15.460 --> 01:09:16.980]  He's defaulted.
[01:09:16.980 --> 01:09:18.300]  Right, well he.
[01:09:18.300 --> 01:09:20.700] Provided you can prove you served him.
[01:09:20.700 --> 01:09:22.980] Right, right, he responded to the court
[01:09:22.980 --> 01:09:24.820] but he never sent me anything
[01:09:24.820 --> 01:09:26.700] and so I only recently found out
[01:09:26.700 --> 01:09:27.980] that he responded to the court
[01:09:27.980 --> 01:09:30.780] like six months after he responded to the court.
[01:09:32.260 --> 01:09:36.580] So I sent like at least five or six certified letters
[01:09:36.580 --> 01:09:38.180] to him saying hey, this is a reminder
[01:09:38.180 --> 01:09:41.460] that you're supposed to answer the discovery request
[01:09:41.460 --> 01:09:43.500]  that I included in the lawsuit
[01:09:43.500 --> 01:09:47.060] and he's ignoring getting the certified mail
[01:09:47.060 --> 01:09:48.860]  from the post office.
[01:09:48.860 --> 01:09:52.900] So not sure if I can do a motion to compel
[01:09:52.900 --> 01:09:55.940] and bring him to court if he's not even gonna
[01:09:55.940 --> 01:09:58.900] accept notice of anything from me.
[01:09:58.900 --> 01:10:00.700] Sure, because you can make the allegation
[01:10:00.700 --> 01:10:02.620]  he's avoiding service.
[01:10:02.620 --> 01:10:03.820]  Okay, okay.
[01:10:05.100 --> 01:10:07.100]  So, all right, okay.
[01:10:07.100 --> 01:10:10.220] Is there any specific way that I have to do that?
[01:10:10.220 --> 01:10:12.420] Do I need to send him another certified letter
[01:10:12.420 --> 01:10:14.780] or do I have to have it served to him
[01:10:14.780 --> 01:10:18.060]  by a sheriff or a constable or something?
[01:10:18.060 --> 01:10:20.500] It would always be better to have it served
[01:10:20.500 --> 01:10:22.980] by someone that can force the return.
[01:10:24.540 --> 01:10:28.820] But the issue here is is that if you can prove,
[01:10:28.820 --> 01:10:31.220] now you just need to read to what the requirements are.
[01:10:31.220 --> 01:10:33.780] If you can prove that you made every effort
[01:10:33.780 --> 01:10:35.820] to make valid legal notice,
[01:10:35.820 --> 01:10:38.100] there's always an exception on the civil side.
[01:10:38.100 --> 01:10:40.380]  I'm pretty sure there's an exception.
[01:10:40.380 --> 01:10:43.700] That if you made a reasonable legal effort
[01:10:43.700 --> 01:10:45.300] to notify the other party
[01:10:46.180 --> 01:10:51.060] and based upon the information available to you,
[01:10:52.500 --> 01:10:54.420]  then service is done.
[01:10:54.420 --> 01:10:56.500] But the thing about it is,
[01:10:56.500 --> 01:11:01.500] is this guy was acting as an agent of the HOA, correct?
[01:11:01.700 --> 01:11:02.660]  Yeah, he was.
[01:11:02.660 --> 01:11:06.140] So service to the principal is service to the agent.
[01:11:06.140 --> 01:11:09.140] Service to the agent is service to the principal.
[01:11:09.140 --> 01:11:11.900] Oh, okay, so I could actually serve him.
[01:11:11.900 --> 01:11:13.060]  If I'm hearing you right,
[01:11:13.060 --> 01:11:15.220]  I can actually serve him
[01:11:15.220 --> 01:11:17.740]  at the property management company's address
[01:11:17.740 --> 01:11:18.900] since he was working for them.
[01:11:18.900 --> 01:11:20.820] Well, when you noticed them
[01:11:20.820 --> 01:11:23.700] and you claimed he was operating under their umbrella
[01:11:23.700 --> 01:11:27.500] and you specifically named him in the suit,
[01:11:27.500 --> 01:11:30.700] then that notice is trickled down or it should have been.
[01:11:30.700 --> 01:11:33.020]  Right, right, okay, okay.
[01:11:34.140 --> 01:11:37.460] Other thing I wanted to ask you was,
[01:11:37.460 --> 01:11:39.700] do you know anything about like ethics
[01:11:39.700 --> 01:11:43.820] as far as it pertains to lawyers and stuff?
[01:11:43.820 --> 01:11:45.020]  Yeah, there aren't any.
[01:11:48.060 --> 01:11:48.900]  I don't know.
[01:11:48.900 --> 01:11:53.900]  If I have a beef with a lawyer, what do I do?
[01:11:54.140 --> 01:11:56.300] Well, that depends on what the beef is.
[01:11:56.300 --> 01:11:58.740]  There's always bar grievances.
[01:11:58.740 --> 01:12:00.420]  Okay, what's that?
[01:12:00.420 --> 01:12:02.540]  A bar grievance is where you file a complaint
[01:12:02.540 --> 01:12:05.380] with the Bar Association against the attorney.
[01:12:05.380 --> 01:12:08.580]  Okay, so that's non-legal, right?
[01:12:08.580 --> 01:12:11.540]  Well, you don't sue him with a bar grievance,
[01:12:11.540 --> 01:12:13.340] but you can file a bar grievance
[01:12:13.340 --> 01:12:16.180] which affects his malpractice insurance.
[01:12:16.180 --> 01:12:17.140]  Oh, okay, okay.
[01:12:17.140 --> 01:12:20.780] All right, and then if he's actually your attorney
[01:12:20.780 --> 01:12:23.580] and he's not doing something that's in your best interest
[01:12:23.580 --> 01:12:25.740] within the bounds of the law,
[01:12:25.740 --> 01:12:28.260] then you can also sue him for malpractice.
[01:12:28.260 --> 01:12:30.820]  Okay, he's not my attorney.
[01:12:30.820 --> 01:12:35.420] Yeah, then bar grieving is unless his actions
[01:12:35.420 --> 01:12:37.140]  cause you a direct harm,
[01:12:37.140 --> 01:12:39.460] then you can still sue him for malpractice
[01:12:39.460 --> 01:12:41.580] if those actions were not authorized
[01:12:41.580 --> 01:12:43.620] or ethical under the law.
[01:12:43.620 --> 01:12:44.740]  Okay, okay.
[01:12:44.740 --> 01:12:46.900] Well, all right, I'll tell you what this lawyer's doing.
[01:12:46.900 --> 01:12:49.740] He told me if he think it's right or wrong or whatever.
[01:12:50.820 --> 01:12:54.740] The lawyer that is representing the other side,
[01:12:54.740 --> 01:12:58.340] basically the HOA, the property management company,
[01:12:58.340 --> 01:13:01.500] one of his colleagues at his law firm
[01:13:01.500 --> 01:13:04.820] is sending me demand notices.
[01:13:04.820 --> 01:13:06.940] His partner at the law firm
[01:13:06.940 --> 01:13:09.900] is serving as a debt collector against me,
[01:13:09.900 --> 01:13:12.300] like trying to collect a debt against me
[01:13:13.300 --> 01:13:18.300] in relation to fines, HOA fines.
[01:13:18.300 --> 01:13:20.140]  They're basically trying to fine me
[01:13:20.140 --> 01:13:24.100] for attempting to fix what they refuse to fix.
[01:13:24.100 --> 01:13:27.220] Basically, I'm trying to fix this water issue coming in
[01:13:27.220 --> 01:13:30.340] and they're trying to fine me for attempting to fix that.
[01:13:30.340 --> 01:13:34.700] So basically, they're sending me these fine notices
[01:13:34.700 --> 01:13:36.220]  and I don't think, I don't know, to me,
[01:13:36.220 --> 01:13:38.100]  it just doesn't seem right
[01:13:38.100 --> 01:13:40.340]  because it's in litigation already.
[01:13:40.340 --> 01:13:41.820]  It's in the court of law
[01:13:41.820 --> 01:13:45.820] and to me, I'm feeling pressure to drop the lawsuit.
[01:13:45.820 --> 01:13:48.620]  Okay, he is bound
[01:13:48.620 --> 01:13:51.260] by the Fair Debt Collection Practices Act.
[01:13:51.260 --> 01:13:53.620] You need to be using that.
[01:13:53.620 --> 01:13:54.460]  Okay.
[01:13:54.460 --> 01:13:57.940] You can sue him in federal court $1,000 a pop
[01:13:57.940 --> 01:14:00.180]  for everything he does.
[01:14:00.180 --> 01:14:01.420]  Okay.
[01:14:01.420 --> 01:14:06.420]  When he fails to comply 100%, 99.9 ain't good enough,
[01:14:07.420 --> 01:14:11.420] 100% with the requirements of the FDCPA.
[01:14:11.420 --> 01:14:12.260]  Okay.
[01:14:12.260 --> 01:14:13.740] And if he's putting it on your credit,
[01:14:13.740 --> 01:14:15.180] then you can also get him
[01:14:15.180 --> 01:14:17.540] under the Fair Credit Reporting Act.
[01:14:17.540 --> 01:14:19.820] Okay, what was the first one, the Fair Debt?
[01:14:19.820 --> 01:14:22.340] Fair Debt Collection Practices Act.
[01:14:22.340 --> 01:14:23.460]  Fair Debt Collection.
[01:14:23.460 --> 01:14:25.180] Yeah, that's what the Michael Mears method
[01:14:25.180 --> 01:14:27.780] on the Rule of All Radio website deals with.
[01:14:27.780 --> 01:14:28.620]  Okay.
[01:14:28.620 --> 01:14:31.740] It's all about filing suit under the FDCPA.
[01:14:31.740 --> 01:14:33.620] But the other side of that coin
[01:14:33.620 --> 01:14:36.140] is Fair Credit Reporting Act.
[01:14:36.140 --> 01:14:38.260] If they are reporting on your credit
[01:14:38.260 --> 01:14:40.340]  and they're doing it detrimentally
[01:14:40.340 --> 01:14:43.740] and without lawful authority and properly,
[01:14:45.260 --> 01:14:46.900] then they're guilty of that as well
[01:14:46.900 --> 01:14:48.660] and you can go after them for that.
[01:14:48.660 --> 01:14:50.580] So you can hit them twice.
[01:14:50.580 --> 01:14:54.180] What if it's not him, it's his partner at the law firm?
[01:14:54.180 --> 01:14:55.220]  Doesn't matter.
[01:14:55.220 --> 01:14:57.220] You're gonna be suing the law firm
[01:14:57.220 --> 01:14:58.980] and the individual as well.
[01:14:58.980 --> 01:15:01.860] So it's gonna hit them both whether they like it or not.
[01:15:01.860 --> 01:15:03.220]  Oh, I see, I see.
[01:15:03.220 --> 01:15:06.380] You're gonna sue the lawyer and the firm.
[01:15:06.380 --> 01:15:07.220]  Okay, okay.
[01:15:07.220 --> 01:15:11.220] So one, I can do a bar grievance against the lawyer
[01:15:11.220 --> 01:15:13.940]  if it's saying, look, I don't think it's right.
[01:15:13.940 --> 01:15:14.780]  Correct.
[01:15:14.780 --> 01:15:16.860]  That's your state level remedy.
[01:15:16.860 --> 01:15:17.700]  Okay.
[01:15:17.700 --> 01:15:22.380] And then the other federal remedy is the FDCPA and SCRA.
[01:15:22.380 --> 01:15:25.260] Okay, FDCPA and then the fair.
[01:15:25.260 --> 01:15:26.780]  Credit reporting.
[01:15:26.780 --> 01:15:28.300]  Credit reporting act, okay.
[01:15:28.300 --> 01:15:29.580]  All right, gotcha.
[01:15:29.580 --> 01:15:33.860] Okay, so now that I'm involved in this litigation,
[01:15:35.500 --> 01:15:36.860]  I'm trying to figure out,
[01:15:36.860 --> 01:15:38.660]  I'm in the discovery process.
[01:15:38.660 --> 01:15:41.740] I'm trying to figure out what all the steps are
[01:15:41.740 --> 01:15:45.020] to get to the final trial, represent myself,
[01:15:45.020 --> 01:15:46.620]  and I wanna win the case.
[01:15:46.620 --> 01:15:49.460] Okay, do you have Juris Dictionary?
[01:15:49.460 --> 01:15:50.460]  What does that mean?
[01:15:50.460 --> 01:15:52.700] Juris Dictionary is the legal course
[01:15:52.700 --> 01:15:55.580] that Dr. Frederick Gray is an attorney out of Florida
[01:15:55.580 --> 01:15:58.660] put together to help people file and maintain
[01:15:58.660 --> 01:16:01.740] and execute their lawsuits without a lawyer.
[01:16:01.740 --> 01:16:02.580]  Okay.
[01:16:02.580 --> 01:16:05.020] It goes through all of that.
[01:16:05.020 --> 01:16:05.860]  Okay.
[01:16:05.860 --> 01:16:09.100] And the process is essentially the same in every state
[01:16:09.100 --> 01:16:12.420] with some variances according to the actual local rules
[01:16:12.420 --> 01:16:13.460] of procedure and so on,
[01:16:13.460 --> 01:16:16.060] which you're required to get with the court
[01:16:16.060 --> 01:16:18.260] to find out what the local rules of procedure are
[01:16:18.260 --> 01:16:20.460] and what the Texas rules of evidence are
[01:16:20.460 --> 01:16:22.060] and things of that nature.
[01:16:22.060 --> 01:16:24.900] But as far as the paperwork and your evidence
[01:16:24.900 --> 01:16:26.340] and how to, and all that stuff,
[01:16:26.340 --> 01:16:27.820] the proper way of getting it introduced
[01:16:27.820 --> 01:16:29.020]  and laying foundation,
[01:16:29.020 --> 01:16:32.100] all that's covered by the Juris Dictionary course.
[01:16:32.100 --> 01:16:33.380]  Juris Dictionary, okay.
[01:16:33.380 --> 01:16:34.860]  All right, I'll check that out.
[01:16:34.860 --> 01:16:36.460]  Okay.
[01:16:36.460 --> 01:16:38.020] Yeah, I hear the music coming on now.
[01:16:38.020 --> 01:16:39.060]  Yeah.
[01:16:39.060 --> 01:16:41.820] Okay, do you have to go?
[01:16:41.820 --> 01:16:43.660]  Yeah, I've gotta take a break.
[01:16:43.660 --> 01:16:44.500]  Okay.
[01:16:44.500 --> 01:16:46.380] We'll wrap this up real quick on the other side
[01:16:46.380 --> 01:16:48.260] because I got other callers too, okay?
[01:16:48.260 --> 01:16:49.100]  Okay.
[01:16:49.100 --> 01:16:50.020]  All right, we'll be right back.
[01:16:50.020 --> 01:16:52.100] All right, folks, we'll be right back on the other side.
[01:16:52.100 --> 01:16:54.740] Five, one, two, six, four, six, 1984.
[01:16:54.740 --> 01:16:56.220]  We'll be right back.

[01:18:01.140 --> 01:18:02.660] My name is Jessica Arman.
[01:18:02.660 --> 01:18:05.500] I'm an activist, a GCN listener and mother of three.
[01:18:05.500 --> 01:18:07.980] Our drinking water and food are filled with fluoride
[01:18:07.980 --> 01:18:10.380] and other contaminants that harm our teeth and gums.
[01:18:10.380 --> 01:18:13.140] To protect my family, I created My Magic Mud,
[01:18:13.140 --> 01:18:15.700] an all natural teeth brightening and strengthening remedy.
[01:18:15.700 --> 01:18:18.580] My Magic Mud is a soft powder that polishes your teeth,
[01:18:18.580 --> 01:18:21.220] reduces sensitivity and removes harmful toxins
[01:18:21.220 --> 01:18:22.420] from deep inside your mouth.
[01:18:22.420 --> 01:18:24.460]  You deserve a bright, healthy smile.
[01:18:24.460 --> 01:18:26.980]  Visit mymagicmud.com and get yours today.
[01:18:26.980 --> 01:18:29.180]  That's mymagicmud.com.
[01:18:29.180 --> 01:18:30.580] Hi, this is Kurt Hildebrand.
[01:18:30.580 --> 01:18:32.300]  I've been using Magic Mud for a while now
[01:18:32.300 --> 01:18:33.940]  and I just can't believe how much healthier
[01:18:33.940 --> 01:18:35.300] my teeth and gums feel.
[01:18:35.300 --> 01:18:36.660]  I love the product.
[01:18:36.660 --> 01:18:39.060] This is Anna Martin, the libertarian homeschooler.
[01:18:39.060 --> 01:18:40.740]  I homeschool so I drink coffee
[01:18:40.740 --> 01:18:42.940]  and I drink coffee so I use Magic Mud.
[01:18:42.940 --> 01:18:44.620] It gets my teeth really clean.
[01:18:44.620 --> 01:18:45.540]  Give it a try.
[01:18:45.540 --> 01:18:47.180] This is John Bush of the Liberty Beat.
[01:18:47.180 --> 01:18:48.900] My wife and I use My Magic Mud
[01:18:48.900 --> 01:18:50.140] because it brightens our smile
[01:18:50.140 --> 01:18:52.820] and our daughter uses it because it makes brushing fun.
[01:18:52.820 --> 01:18:54.780] To get your can of My Magic Mud,
[01:18:54.780 --> 01:18:59.420] go to Brave New Books or order it online at mymagicmud.com.
[01:19:01.060 --> 01:19:06.060] This is the Logos Mopogos Radio Network.
[01:19:06.060 --> 01:19:11.060] Radio, network, radio, network, network, network, network.
[01:19:11.620 --> 01:19:14.460]  ["Don't Forget Me"]
[01:19:15.540 --> 01:19:17.460]  Ain't gonna blind me.
[01:19:21.460 --> 01:19:23.300] All right, folks, we are back.
[01:19:23.300 --> 01:19:25.740] We're gonna finish this up with Derek
[01:19:25.740 --> 01:19:27.300] and then we're gonna go to Corey and Michael.
[01:19:27.300 --> 01:19:28.260] All right, Derek, go ahead.
[01:19:28.260 --> 01:19:29.700]  Let's wrap this up.
[01:19:29.700 --> 01:19:31.500] Okay, thanks for talking to me.
[01:19:31.500 --> 01:19:32.320]  I really appreciate it.
[01:19:32.320 --> 01:19:33.160]  Sure.
[01:19:33.160 --> 01:19:33.980]  Let's wrap it up real quick.
[01:19:33.980 --> 01:19:35.540] So while you were going on break,
[01:19:35.540 --> 01:19:37.820] I was looking up this thing, Juris Dictionary.
[01:19:37.820 --> 01:19:38.660]  Yeah.
[01:19:38.660 --> 01:19:41.260] Dr. Frederick Graves, that was a major.
[01:19:41.260 --> 01:19:45.340]  Okay, so yeah, it's a book that he's wrote or something.
[01:19:45.340 --> 01:19:47.380]  It's an entire course.
[01:19:47.380 --> 01:19:51.220]  It's DVDs that's got PDFs of documents.
[01:19:51.220 --> 01:19:53.020]  It's got flash video on it
[01:19:53.020 --> 01:19:57.420] for the educational videos that he's got.
[01:19:57.420 --> 01:20:00.420]  So it's a completely self-contained course.
[01:20:00.420 --> 01:20:02.820] Okay, yeah, I just need something like that
[01:20:02.820 --> 01:20:04.700] with some kind of flow chart
[01:20:04.700 --> 01:20:06.020] or something that tells me something.
[01:20:06.020 --> 01:20:08.700] He's got a free flow chart of the litigation process
[01:20:08.700 --> 01:20:10.140]  on the website.
[01:20:10.140 --> 01:20:12.860]  Oh, okay, where's that website at?
[01:20:12.860 --> 01:20:14.620]  Well, jurisdictionary.com.
[01:20:14.620 --> 01:20:15.460] But if you order it,
[01:20:15.460 --> 01:20:17.180] please order it through the logo site
[01:20:17.180 --> 01:20:19.320] because that gets us a little bit of money
[01:20:19.320 --> 01:20:21.380] to help keep the network going.
[01:20:21.380 --> 01:20:22.580]  Yeah, yeah, definitely.
[01:20:22.580 --> 01:20:24.180] But yeah, when you go to his site,
[01:20:24.180 --> 01:20:27.620]  he's got a free litigation flow chart
[01:20:27.620 --> 01:20:29.180]  that you can download.
[01:20:29.180 --> 01:20:31.820]  What's the logo site so I can download it?
[01:20:31.820 --> 01:20:33.980] Well, you can do it from the rule of law.
[01:20:33.980 --> 01:20:35.740]  Just go to ruleoflawradio.com
[01:20:35.740 --> 01:20:37.900] and purchase it through there.
[01:20:37.900 --> 01:20:40.540] And then you just go to jurisdictionary.com after that
[01:20:40.540 --> 01:20:42.500] if you wanna download the flow chart.
[01:20:42.500 --> 01:20:44.940] Okay, all right, well, thank you so much, Eddie.
[01:20:44.940 --> 01:20:47.020] I appreciate you talking to me tonight.
[01:20:47.020 --> 01:20:48.620]  And yeah, have a good night.
[01:20:48.620 --> 01:20:50.700] Thanks, Derek, thanks for calling in.
[01:20:50.700 --> 01:20:51.540]  Thanks, bye.
[01:20:51.540 --> 01:20:52.380]  Bye-bye.
[01:20:52.380 --> 01:20:54.940] All right, now we're gonna go to Corey in New York.
[01:20:54.940 --> 01:20:56.580] Corey, what can we do for you?
[01:20:58.140 --> 01:20:59.900] Hey, Eddie, thanks for taking my call.
[01:20:59.900 --> 01:21:00.740]  Yes, sir.
[01:21:00.740 --> 01:21:05.740] Hey, I was wondering if you guys have heard of us
[01:21:06.540 --> 01:21:09.340] here in New York or are doing the common law grand jury?
[01:21:10.940 --> 01:21:13.460] If you heard that y'all are doing it?
[01:21:15.420 --> 01:21:17.980]  Yeah, yeah, there's a group here which I'm part of.
[01:21:17.980 --> 01:21:21.100]  We're constituting common law grand juries
[01:21:21.100 --> 01:21:23.780]  in each of New York's 62 counties.
[01:21:23.780 --> 01:21:26.300] Okay, does New York have anything on the books
[01:21:26.300 --> 01:21:28.140] that recognizes common law juries?
[01:21:28.140 --> 01:21:32.060] We're pointing to the federal Supreme Court cases,
[01:21:32.060 --> 01:21:37.060]  U.S. v. Williams, 1992, which was our basis.
[01:21:38.340 --> 01:21:40.700]  Okay, well, I haven't seen those cases
[01:21:40.700 --> 01:21:42.700] on that specific subject, so if you've got a list
[01:21:42.700 --> 01:21:45.220]  of cases you're referencing, I'd appreciate copies of them
[01:21:45.220 --> 01:21:46.940] and the arguments you're using from them
[01:21:46.940 --> 01:21:49.300] to know how you're trying to apply it.
[01:21:51.100 --> 01:21:53.660]  Yeah, I'm fairly young at this.
[01:21:54.540 --> 01:21:56.540] I've gone through most of the jurisdictionary stuff
[01:21:56.540 --> 01:21:59.260] and studied common law for a while,
[01:21:59.260 --> 01:22:00.580]  kind of a prerequisite to anybody
[01:22:00.580 --> 01:22:03.500] who wants to join the event here,
[01:22:03.500 --> 01:22:08.380] but there's quite a few of us here that are into this here
[01:22:08.380 --> 01:22:10.500] that I was just kind of curious if you had any input
[01:22:10.500 --> 01:22:11.820] in general as far as the common law.
[01:22:11.820 --> 01:22:15.100]  Well, generally, a lot of states don't recognize
[01:22:15.100 --> 01:22:17.060] any grand jury that's not put together
[01:22:17.060 --> 01:22:19.980] in accordance with the way the Constitution sets it up.
[01:22:19.980 --> 01:22:22.980] Here in Texas, the Constitution specifically
[01:22:22.980 --> 01:22:26.260] sets grand juries to be convened
[01:22:26.260 --> 01:22:27.940] by the judge of a district court.
[01:22:28.940 --> 01:22:31.060]  It's not something the people themselves
[01:22:31.060 --> 01:22:35.100] under the Constitutional authority can convene.
[01:22:35.100 --> 01:22:39.220] Now, if we go back a little further
[01:22:39.220 --> 01:22:42.340] to the original sets of Constitutional mandates,
[01:22:42.340 --> 01:22:47.340] then that is not the case, but as of at least the 1876 version,
[01:22:48.140 --> 01:22:50.580]  it's been altered where district judges
[01:22:50.580 --> 01:22:53.580] are the only ones in Texas that can convene them.
[01:22:53.580 --> 01:22:56.660] So while everybody is talking about it,
[01:22:56.660 --> 01:22:59.740] the Texas Constitution at the moment
[01:22:59.740 --> 01:23:03.340] has set a specific manner for it.
[01:23:06.100 --> 01:23:08.540] So it's not of and for the people
[01:23:08.540 --> 01:23:10.620] then controlled by the court?
[01:23:10.620 --> 01:23:15.260] As far as it's convening, yes, but here,
[01:23:15.260 --> 01:23:20.260] but anyone that is more or less the,
[01:23:22.540 --> 01:23:24.260] for lack of a better way of putting it,
[01:23:24.260 --> 01:23:28.260]  any believable, respectable individual
[01:23:28.260 --> 01:23:31.700] can go before the grand jury
[01:23:31.700 --> 01:23:34.580] for the purpose of testifying to a criminal act.
[01:23:36.460 --> 01:23:39.860] So it's not like we don't have access to the grand jury
[01:23:39.860 --> 01:23:42.100]  while they're in session, we do.
[01:23:42.100 --> 01:23:45.500] Right, we just sometimes have to play in tackle
[01:23:45.500 --> 01:23:48.180] with the prosecutor to get to them.
[01:23:48.180 --> 01:23:49.020]  I see.
[01:23:50.620 --> 01:23:52.980]  Yeah, I suspect the same here
[01:23:52.980 --> 01:23:57.580] that they don't want the public to be in touch with.
[01:23:57.580 --> 01:23:58.500]  Well, of course not.
[01:23:58.500 --> 01:24:00.180]  They don't want the public complaining
[01:24:00.180 --> 01:24:02.660] that the public servants are the ones
[01:24:02.660 --> 01:24:04.460] that should be getting indicted.
[01:24:07.180 --> 01:24:08.260]  Right, right, right.
[01:24:10.780 --> 01:24:11.620]  Okay.
[01:24:11.620 --> 01:24:15.700]  Well, I don't know how many listeners you have,
[01:24:15.700 --> 01:24:18.660] but maybe we could have a shout out
[01:24:18.660 --> 01:24:19.980] to anybody that might want to look into it
[01:24:19.980 --> 01:24:22.140]  because it's a national thing.
[01:24:22.140 --> 01:24:23.660] It sounds like the Republic of Texas
[01:24:23.660 --> 01:24:25.660] is probably going to be a tough time,
[01:24:25.660 --> 01:24:28.700] but there's a lot of states that are actually doing this now
[01:24:28.700 --> 01:24:32.260] through this one central source,
[01:24:32.260 --> 01:24:33.340] if you want to call it that,
[01:24:33.340 --> 01:24:36.140] but it's called the National Liberty Alliance.
[01:24:36.140 --> 01:24:41.140] It's dot org dot com dot org,
[01:24:41.580 --> 01:24:43.980] the National Liberty Alliance dot org.
[01:24:45.700 --> 01:24:48.140] A lot of interesting resource material there,
[01:24:48.140 --> 01:24:49.740]  maybe constituting information
[01:24:49.740 --> 01:24:53.500] on whoever might be listening to the state.
[01:24:53.500 --> 01:24:54.580] Hey, there was also something else
[01:24:54.580 --> 01:24:56.460] that I was more specifically calling for.
[01:24:56.460 --> 01:24:58.260]  I wonder if I might discuss with you.
[01:24:59.980 --> 01:25:00.820]  All right.
[01:25:02.260 --> 01:25:03.940] My wife and I are both fiscal permit holders
[01:25:03.940 --> 01:25:04.780]  here in New York.
[01:25:04.780 --> 01:25:07.780] They mandate that if you want to carry a concealed handgun.
[01:25:10.860 --> 01:25:11.700]  I'm sure you're aware of this,
[01:25:11.700 --> 01:25:13.660] but concealed carry only here.
[01:25:13.660 --> 01:25:15.100]  No, there's no hoping.
[01:25:16.260 --> 01:25:19.340] Anyway, I had it for a couple of years here
[01:25:19.340 --> 01:25:21.820] and they're a little touchy about gun sharing in New York
[01:25:21.820 --> 01:25:23.300] when you run into the police.
[01:25:23.300 --> 01:25:27.260] And believe it or not, my license was suspended
[01:25:27.260 --> 01:25:28.140]  a few weeks back.
[01:25:28.140 --> 01:25:32.780]  I considered rescinding my driver's license for three years,
[01:25:32.780 --> 01:25:33.620]  but I haven't done it.
[01:25:33.620 --> 01:25:34.980]  The more I think about it,
[01:25:34.980 --> 01:25:36.340]  there's not really a reason to rescind it.
[01:25:36.340 --> 01:25:38.340]  I just don't want to act in commerce.
[01:25:38.340 --> 01:25:41.820] Well, the problem is is they don't recognize a rescission.
[01:25:41.820 --> 01:25:45.300] The best thing to do is just let it expire naturally.
[01:25:46.820 --> 01:25:49.140] Because if you send it back,
[01:25:49.140 --> 01:25:52.220] they will not recognize that you rescinded it.
[01:25:52.220 --> 01:25:53.300]  I see.
[01:25:53.300 --> 01:25:55.460] There's no lawful way to rescind it?
[01:25:55.460 --> 01:25:58.700] Well, you can always surrender the license
[01:26:00.260 --> 01:26:03.420] and they usually have a procedure for doing that,
[01:26:03.420 --> 01:26:08.420]  but that's a different process than rescinding it, okay?
[01:26:08.460 --> 01:26:10.940] And generally, if you do it,
[01:26:10.940 --> 01:26:12.820] you want to make darn certain
[01:26:12.820 --> 01:26:14.540] that you get something from them
[01:26:14.540 --> 01:26:17.620] that states that they recognize that you've done so,
[01:26:17.620 --> 01:26:19.180] whichever way you do it.
[01:26:21.460 --> 01:26:23.500]  So don't rescind is what you're saying
[01:26:23.500 --> 01:26:24.940] and I should surrender and get proof.
[01:26:24.940 --> 01:26:27.420]  I don't know that you've got a legal process
[01:26:27.420 --> 01:26:29.300]  by which to rescind,
[01:26:29.300 --> 01:26:32.740] but you do have one almost always
[01:26:32.740 --> 01:26:37.740] for which to surrender or to render.
[01:26:38.140 --> 01:26:38.980]  Okay.
[01:26:38.980 --> 01:26:43.260] The state asked me to surrender the physical license to them.
[01:26:43.260 --> 01:26:44.820] They passed some law here in New York
[01:26:44.820 --> 01:26:46.820] and not too long ago, a year or two ago,
[01:26:46.820 --> 01:26:50.100] that if you have back taxes to the state,
[01:26:50.100 --> 01:26:51.340] they can take your license away.
[01:26:51.340 --> 01:26:53.740]  So they took my wife's license,
[01:26:53.740 --> 01:26:55.860] they took my license and they suspended it.
[01:26:56.900 --> 01:26:58.700]  And they said I could get a conditional
[01:26:58.700 --> 01:27:01.860] if I went down and signed up, but I never did.
[01:27:01.860 --> 01:27:03.620] Well, sure enough, I get pulled over
[01:27:04.660 --> 01:27:07.340] in my local village where I do business
[01:27:07.340 --> 01:27:09.260]  and have a little shoe shop.
[01:27:09.260 --> 01:27:11.820] And they ganked me out of the car.
[01:27:11.820 --> 01:27:13.980]  I didn't want to give them my suspended license,
[01:27:13.980 --> 01:27:15.220] but I gave them my physical permit
[01:27:15.220 --> 01:27:17.820] and they got offended and ganked me out of the car
[01:27:17.820 --> 01:27:19.660] at Taser Point and threatened to tase me with it
[01:27:19.660 --> 01:27:22.060] and cuff me and stuff me in the back of their car.
[01:27:25.420 --> 01:27:27.700] You know, this is crazy up here.
[01:27:27.700 --> 01:27:29.660]  I don't know what to tell you.
[01:27:29.660 --> 01:27:33.380] Well, the same way as everywhere, that lack of license
[01:27:33.380 --> 01:27:35.660]  means a lack of control.
[01:27:35.660 --> 01:27:39.700] And that lack of control is what they absolutely detest.
[01:27:42.620 --> 01:27:46.820] Yeah, so I got to go tomorrow and figure it out
[01:27:46.820 --> 01:27:49.900] whether I want to get a conditional license or surrender.
[01:27:49.900 --> 01:27:51.380] My wife is probably going to get a conditional,
[01:27:51.380 --> 01:27:53.260] she doesn't want to mess with this stuff.
[01:27:53.260 --> 01:27:57.060]  But I don't know what the best question is.
[01:27:57.060 --> 01:28:02.060] Anyway, I've got a lot of things to figure out here.
[01:28:05.180 --> 01:28:06.580]  I don't know if I should,
[01:28:06.580 --> 01:28:09.620] I called in the plaintiff at the office, their sergeant,
[01:28:09.620 --> 01:28:11.980] telling me deprivation of rights,
[01:28:11.980 --> 01:28:13.740] assault and all of this stuff.
[01:28:16.260 --> 01:28:19.900] I never surrendered to life during the process.
[01:28:19.900 --> 01:28:21.060] They had me in the back of the car
[01:28:21.060 --> 01:28:24.060] and they took it from my wallet.
[01:28:26.140 --> 01:28:26.980]  I don't know.
[01:28:26.980 --> 01:28:29.220] Now you just got to go after them.
[01:28:29.220 --> 01:28:30.940]  Yeah, yeah.
[01:28:30.940 --> 01:28:32.300] So you mentioned that I was listening
[01:28:32.300 --> 01:28:34.020] to your other caller there.
[01:28:34.020 --> 01:28:36.860]  I made a note about the original enactment,
[01:28:36.860 --> 01:28:38.940]  finding the original enactment
[01:28:38.940 --> 01:28:43.300] that creates the DMV statute.
[01:28:43.300 --> 01:28:46.100] Yeah, well, the last one.
[01:28:46.100 --> 01:28:49.020] But you want to go all the way back to the original one
[01:28:49.020 --> 01:28:52.860] to see how it began, what its intended purpose was,
[01:28:52.860 --> 01:28:56.180] and to see if that intended purpose was ever altered
[01:28:56.180 --> 01:28:58.860]  through any new legislation.
[01:28:58.860 --> 01:29:02.220] And if it was, was it done in accordance
[01:29:02.220 --> 01:29:04.820] with the constitutional method for doing so?
[01:29:05.740 --> 01:29:08.180] Here in Texas, it absolutely has not been
[01:29:08.180 --> 01:29:09.700] in any way, shape or form.
[01:29:09.700 --> 01:29:14.100] Not only has it never been changed at the law level,
[01:29:14.100 --> 01:29:16.060]  but their amendment process
[01:29:16.060 --> 01:29:17.980] for what they've done to the statute
[01:29:17.980 --> 01:29:21.300] does not comply with the Texas constitution,
[01:29:21.300 --> 01:29:24.340] requirements of rescission and reenactment
[01:29:24.340 --> 01:29:26.420] for that type of thing.
[01:29:26.420 --> 01:29:28.900] So there can be a myriad of ways
[01:29:28.900 --> 01:29:31.500] that they screw up when they're doing these things.
[01:29:33.660 --> 01:29:34.500]  Okay?
[01:29:39.540 --> 01:29:41.860]  Yeah, I got a break, and I've got half an hour
[01:29:41.860 --> 01:29:43.100] to get the rest of these callers.
[01:29:43.100 --> 01:29:44.660] So I'm going to have to let you go on that one,
[01:29:44.660 --> 01:29:46.140] and you have to try me back next week
[01:29:46.140 --> 01:29:48.740] or call me on Thursday or Friday with Randy and Debra.
[01:29:50.420 --> 01:29:51.260]  All right?
[01:29:51.260 --> 01:29:52.940] All right, Corey, thanks for calling in.
[01:29:52.940 --> 01:29:54.260]  All right, guys, y'all hang on.
[01:29:54.260 --> 01:29:55.700]  I'll pick y'all up on the other side,
[01:29:55.700 --> 01:29:57.140]  and we'll get this rounded out.
[01:29:57.140 --> 01:29:58.260]  We'll be right back.
[01:30:03.180 --> 01:30:06.300] Michigan may soon require kids' body fat ratings
[01:30:06.300 --> 01:30:09.860] to be sent to a state registry instead of to their parents.
[01:30:09.860 --> 01:30:12.580] I'm Dr. Catherine Albrecht, and if this seems wrong to you,
[01:30:12.580 --> 01:30:15.220] then you won't want to miss my next segment.
[01:30:15.220 --> 01:30:17.180]  Privacy is under attack.
[01:30:17.180 --> 01:30:19.060] When you give up data about yourself,
[01:30:19.060 --> 01:30:20.780]  you'll never get it back again.
[01:30:20.780 --> 01:30:22.580] And once your privacy is gone,
[01:30:22.580 --> 01:30:25.540] you'll find your freedoms will start to vanish too.
[01:30:25.540 --> 01:30:28.460] So protect your rights, say no to surveillance,
[01:30:28.460 --> 01:30:30.820] and keep your information to yourself.
[01:30:30.820 --> 01:30:33.340]  Privacy, it's worth hanging on to.
[01:30:33.340 --> 01:30:34.700]  This public service announcement
[01:30:34.700 --> 01:30:36.900]  is brought to you by StartPage.com,
[01:30:36.900 --> 01:30:38.780] the private search engine alternative
[01:30:38.780 --> 01:30:40.860] to Google, Yahoo, and Bing.
[01:30:40.860 --> 01:30:43.140]  Start over with StartPage.
[01:30:44.380 --> 01:30:47.620] Like much of the country, Michigan has an obesity problem.
[01:30:47.620 --> 01:30:51.940] 65% of adults and 12% of kids are considered overweight.
[01:30:51.940 --> 01:30:54.940] But now Governor Rick Snyder plans to require children
[01:30:54.940 --> 01:30:57.500] to get weight screenings and have their body fat ratings
[01:30:57.500 --> 01:31:01.140] sent to a state registry rather than to their own parents.
[01:31:01.140 --> 01:31:04.180]  That's right, if a kid's weight passes a certain threshold,
[01:31:04.180 --> 01:31:07.100] children and their parents will get called in by a doctor
[01:31:07.100 --> 01:31:08.940] to discuss the weight problem.
[01:31:08.940 --> 01:31:10.860]  Meanwhile, the child's medical profile
[01:31:10.860 --> 01:31:14.260] will be closely monitored by big government, big brother.
[01:31:14.260 --> 01:31:17.220]  Nobody's encouraging obesity here, but what's next?
[01:31:17.220 --> 01:31:18.780] Taking kids away from their parents
[01:31:18.780 --> 01:31:20.660]  if they don't lose the weight?
[01:31:20.660 --> 01:31:23.020] Dr. Catherine Albrecht, more news and information
[01:31:23.020 --> 01:31:24.820]  at CatherineAlbrecht.com.
[01:31:30.740 --> 01:31:31.580]  I lost my son.
[01:31:31.580 --> 01:31:32.420]  My nephew.
[01:31:32.420 --> 01:31:33.240]  My uncle.
[01:31:33.240 --> 01:31:34.080]  My son.
[01:31:34.080 --> 01:31:35.140]  On September 11th, 2001.
[01:31:35.140 --> 01:31:37.500]  Most people don't know that a third tower
[01:31:37.500 --> 01:31:38.820]  fell on September 11th.
[01:31:38.820 --> 01:31:41.900]  World Trade Center 7, a 47-story skyscraper
[01:31:41.900 --> 01:31:43.140]  was not hit by a plane.
[01:31:43.140 --> 01:31:44.860]  Although the official explanation
[01:31:44.860 --> 01:31:46.860] is that fire brought down Building 7.
[01:31:46.860 --> 01:31:49.700]  Over 1,200 architects and engineers
[01:31:49.700 --> 01:31:51.300] looked into the evidence and believed
[01:31:51.300 --> 01:31:52.620] there is more to the story.
[01:31:52.620 --> 01:31:54.140] Bring justice to my son.
[01:31:54.140 --> 01:31:54.980]  My uncle.
[01:31:54.980 --> 01:31:55.800]  My nephew.
[01:31:55.800 --> 01:31:56.640]  My son.
[01:31:56.640 --> 01:31:57.980]  Go to buildingwatch.org.
[01:31:57.980 --> 01:32:01.060] Why it fell, why it matters, and what you can do.
[01:32:01.060 --> 01:32:03.580] Nutritious food is real body armor.
[01:32:03.580 --> 01:32:06.740] It builds muscle, burns fat, improves digestion,
[01:32:06.740 --> 01:32:09.780] and feeds the entire body the nutrients it needs.
[01:32:09.780 --> 01:32:12.220] Did you know the US government banned the hemp plant
[01:32:12.220 --> 01:32:13.820] from growing in the United States
[01:32:13.820 --> 01:32:15.980] and classified it as a schedule one drug
[01:32:15.980 --> 01:32:18.060] to hide it behind a marijuana plant?
[01:32:18.060 --> 01:32:19.980] People have been confused about this plant
[01:32:19.980 --> 01:32:23.740] for over 80 years, and many still don't know what hemp is.
[01:32:23.740 --> 01:32:26.260] So now you know hemp is not marijuana,
[01:32:26.260 --> 01:32:28.100] and marijuana is not hemp.
[01:32:28.100 --> 01:32:30.740] They are different varieties of the same species.
[01:32:30.740 --> 01:32:34.220] HempUSA.org wants the world to know these basic facts
[01:32:34.220 --> 01:32:36.940] and to help people understand that hemp protein powder
[01:32:36.940 --> 01:32:39.980] is the best kept health secret you need to know about.
[01:32:39.980 --> 01:32:43.780] Remember, hemp protein powder contains 53% protein,
[01:32:43.780 --> 01:32:47.300]  is gluten-free, anti-inflammatory, non-GMO,
[01:32:47.300 --> 01:32:48.940] and is loaded with nutrients.
[01:32:48.940 --> 01:32:51.980]  Call 888-910-4367.
[01:32:51.980 --> 01:32:54.620]  888-910-4367.
[01:32:54.620 --> 01:32:57.900] And see what our powder, seeds, and oil can do for you.
[01:32:57.900 --> 01:33:00.940]  Only at hempUSA.org.
[01:33:04.260 --> 01:33:07.780] You're listening to the Logos Radio Network
[01:33:07.780 --> 01:33:10.700]  at LogosRadioNetwork.com.
[01:33:13.060 --> 01:33:15.300] Yeah, who you want to check, who you're taking from,
[01:33:15.300 --> 01:33:17.660] who you want to check, who you want to check,
[01:33:17.660 --> 01:33:20.220]  men are free, don't they, you can't check me.
[01:33:20.220 --> 01:33:23.380] I'm a fact, all of them check me when they want it,
[01:33:23.380 --> 01:33:24.220] check me when they need it.
[01:33:24.220 --> 01:33:25.180] All right, folks, we are back.
[01:33:25.180 --> 01:33:28.260] This is Little Law Radio, and Deborah won't stop in here
[01:33:28.260 --> 01:33:30.780] for just a moment and address a little bit on the grand juries
[01:33:30.780 --> 01:33:32.300] that Cory was talking about a little bit ago.
[01:33:32.300 --> 01:33:33.140]  Deborah?
[01:33:33.140 --> 01:33:34.140] Yes, I'm gonna make this real quick
[01:33:34.140 --> 01:33:35.900]  so nobody's got other callers.
[01:33:35.900 --> 01:33:40.140] The whole reason I got into all this legal study
[01:33:40.140 --> 01:33:43.220] was over this exact issue, the grand juries
[01:33:43.220 --> 01:33:47.020] and citizen grand juries, are they legit or not?
[01:33:47.020 --> 01:33:48.660] And I can tell you right now,
[01:33:48.660 --> 01:33:51.340] I have not seen any state in which they're legit
[01:33:51.340 --> 01:33:52.700] nor at the federal level.
[01:33:52.700 --> 01:33:56.060] And I'm very familiar with this USV Williams case.
[01:33:56.060 --> 01:33:59.660] And what that case is about is making it very clear
[01:33:59.660 --> 01:34:01.980] that there are two functions of the grand jury.
[01:34:01.980 --> 01:34:05.980] Most people are familiar with the shielding function,
[01:34:05.980 --> 01:34:08.620] which is to shield from malicious prosecution
[01:34:08.620 --> 01:34:12.140] or prosecution against political dissidents, et cetera.
[01:34:12.140 --> 01:34:16.420] But the grand jury also has the function of a sword,
[01:34:16.420 --> 01:34:19.740] which is a prosecutorial function to indict
[01:34:19.740 --> 01:34:24.740] and sometimes even prosecute rogue public servants.
[01:34:25.500 --> 01:34:27.100] And that's what that case is about.
[01:34:27.100 --> 01:34:29.780] It has nothing to do with citizen grand juries.
[01:34:29.780 --> 01:34:32.660] And we can form our own citizen grand juries all day long,
[01:34:32.660 --> 01:34:33.900] but they have no power.
[01:34:33.900 --> 01:34:36.420]  There's the system, the court system
[01:34:36.420 --> 01:34:38.460] does not have to recognize our indictments,
[01:34:38.460 --> 01:34:41.540] unless as Eddie says, is something that is set up
[01:34:41.540 --> 01:34:44.940] for with authority under the constitutions of these states
[01:34:44.940 --> 01:34:46.860] or the feds, and it's not, okay?
[01:34:46.860 --> 01:34:49.060] So it is a dead end road.
[01:34:49.060 --> 01:34:50.180]  Forget about it.
[01:34:50.180 --> 01:34:53.620] The only people who are doing anything with it at all,
[01:34:53.620 --> 01:34:56.300] really with any force, if you will,
[01:34:56.300 --> 01:35:00.900] are like groups, free groups up in the Pacific Northwest,
[01:35:00.900 --> 01:35:03.820] like Montana, where they're forming their own courts
[01:35:03.820 --> 01:35:05.260] and their own grand juries,
[01:35:05.260 --> 01:35:07.420]  and they're going out and arresting,
[01:35:07.420 --> 01:35:09.620]  basically kidnapping public servants
[01:35:09.620 --> 01:35:12.020] and trying them in their own kangaroo courts
[01:35:12.020 --> 01:35:14.100] with their own citizen grand juries,
[01:35:14.100 --> 01:35:16.660] and they're also having shootouts with the feds.
[01:35:16.660 --> 01:35:18.660]  Okay, so just don't bother.
[01:35:18.660 --> 01:35:20.180]  We don't need it anyway.
[01:35:20.180 --> 01:35:22.740] Like Eddie said, the way to handle it
[01:35:22.740 --> 01:35:23.980] is you access the grand jury.
[01:35:23.980 --> 01:35:25.460] We have access to our grand juries.
[01:35:25.460 --> 01:35:27.460] The prosecutor will try to run interference,
[01:35:27.460 --> 01:35:29.420] but there are ways to deal with that.
[01:35:29.420 --> 01:35:32.100] And for more information on that,
[01:35:32.100 --> 01:35:34.660] we can talk about that with Randy Samo on Thursday night.
[01:35:34.660 --> 01:35:37.220] There's ways to deal with the prosecutor
[01:35:37.220 --> 01:35:39.340] so that we can have access to our grand juries.
[01:35:39.340 --> 01:35:41.620] In fact, we do have access to our grand juries
[01:35:41.620 --> 01:35:43.060]  without a whole lot of interference
[01:35:43.060 --> 01:35:44.380] here in Travis County now
[01:35:44.380 --> 01:35:45.820]  because of some of Randy's methods.
[01:35:45.820 --> 01:35:47.540] So we can talk about that more on Thursday.
[01:35:47.540 --> 01:35:49.060]  I just wanna make it clear.
[01:35:49.060 --> 01:35:50.300]  Don't go down that path.
[01:35:50.300 --> 01:35:51.420]  It's a dead-end road.
[01:35:51.420 --> 01:35:52.540] We don't need to do it anyway.
[01:35:52.540 --> 01:35:54.460] We have access to our own grand juries.
[01:35:54.460 --> 01:35:55.300]  Okay, that's all.
[01:35:55.300 --> 01:35:56.120]  Thank you, Eddie.
[01:35:56.120 --> 01:35:57.220]  All right, thanks, Deborah.
[01:35:57.220 --> 01:35:59.500] All right, now we're gonna go to Michael in Texas.
[01:35:59.500 --> 01:36:02.060] Michael, what can I do for you?
[01:36:02.060 --> 01:36:03.020]  Good evening, Eddie.
[01:36:03.020 --> 01:36:04.500]  I had several questions
[01:36:04.500 --> 01:36:07.700] regarding perfecting the appeal process.
[01:36:07.700 --> 01:36:10.220] Okay, what type of case?
[01:36:10.220 --> 01:36:11.060]  What's that?
[01:36:11.060 --> 01:36:12.100]  What type of case?
[01:36:16.580 --> 01:36:17.420]  Hello?
[01:36:21.020 --> 01:36:21.860]  Michael?
[01:36:26.780 --> 01:36:27.620]  Michael.
[01:36:29.860 --> 01:36:33.180] Okay, he either dropped off or muted his phone or something
[01:36:33.180 --> 01:36:36.380] so I'll give him just a minute or two to come back on.
[01:36:36.380 --> 01:36:38.020] In the meantime, I'll take the next caller
[01:36:38.020 --> 01:36:39.620]  while we're waiting.
[01:36:39.620 --> 01:36:40.780]  Jim in Ohio.
[01:36:40.780 --> 01:36:41.780]  Jim, what's up?
[01:36:43.220 --> 01:36:44.460]  Hey, good evening.
[01:36:44.460 --> 01:36:45.700]  Good evening.
[01:36:45.700 --> 01:36:49.780]  I have heard you all mention a statute
[01:36:49.780 --> 01:36:53.860]  that I was wondering about where it's located,
[01:36:53.860 --> 01:36:57.380] whether it was a federal or a Texas state statute.
[01:36:57.380 --> 01:37:00.420]  I first heard Randy back in 07 mention this
[01:37:01.420 --> 01:37:03.580]  and the wording goes,
[01:37:03.580 --> 01:37:07.100]  if a public official attempts,
[01:37:07.100 --> 01:37:10.180] asserts or attempts to assert an authority
[01:37:10.180 --> 01:37:13.380] they do not have and in the process deny-
[01:37:13.380 --> 01:37:14.220]  It's case law.
[01:37:15.300 --> 01:37:17.620]  It's not a statute, it's case law.
[01:37:17.620 --> 01:37:18.460]  Uh-huh.
[01:37:20.020 --> 01:37:22.940] Can you quote the case for me or do you have it-
[01:37:22.940 --> 01:37:27.500] I don't know specifically what the case is, Randy would,
[01:37:27.500 --> 01:37:30.100]  but I haven't read that particular case.
[01:37:30.100 --> 01:37:33.580] I forget what the name of it is.
[01:37:33.580 --> 01:37:34.900]  He's mentioned it a couple of times
[01:37:34.900 --> 01:37:37.500] but I've never really had time to delve into it.
[01:37:37.500 --> 01:37:40.500]  But yeah, he's quoting from a case.
[01:37:40.500 --> 01:37:42.780]  Okay, okay.
[01:37:42.780 --> 01:37:46.220] But it was considered to be felonious in nature, right?
[01:37:48.660 --> 01:37:50.780] What do you mean by felonious?
[01:37:50.780 --> 01:37:53.820] Well, I thought that when he was quoting it
[01:37:53.820 --> 01:37:58.340] that he said that if they interrupt you
[01:37:58.340 --> 01:38:01.300] in the exercise of a right that it was a felony.
[01:38:01.300 --> 01:38:02.980] That depends upon the right
[01:38:02.980 --> 01:38:05.300] and how they interfered with it.
[01:38:05.300 --> 01:38:08.940] Most of the, the feds don't really deal
[01:38:08.940 --> 01:38:10.300]  in a lot of misdemeanors.
[01:38:10.300 --> 01:38:11.860] Most of what they do,
[01:38:11.860 --> 01:38:14.980] if they violate a protected right at the state level
[01:38:14.980 --> 01:38:17.860] then usually that involves some sort of federal felony
[01:38:17.860 --> 01:38:19.660]  if it's a federally protected right.
[01:38:22.100 --> 01:38:25.260] Was that in fact coming from federal case law?
[01:38:25.260 --> 01:38:28.940] The quote that he uses is yes.
[01:38:28.940 --> 01:38:33.620] But the actual felony will be defined in Title 18.
[01:38:33.620 --> 01:38:34.460]  Right.
[01:38:35.900 --> 01:38:37.380]  Okay.
[01:38:37.380 --> 01:38:41.780] Well, I'll maybe I'll call back Friday on the big session
[01:38:41.780 --> 01:38:44.820] and see if I can find out where that's at.
[01:38:44.820 --> 01:38:47.300] All right, well, please do.
[01:38:47.300 --> 01:38:48.900]  All right, good night.
[01:38:48.900 --> 01:38:49.740]  Thanks.
[01:38:50.900 --> 01:38:54.420] All right, now we're gonna go to Doug in Texas.
[01:38:54.420 --> 01:38:57.060] I guess our other guy dropped off there.
[01:38:57.060 --> 01:38:58.860] If he calls back in, please let me know.
[01:38:58.860 --> 01:38:59.700] All right, Doug, go ahead.
[01:38:59.700 --> 01:39:01.100] What can we do for you?
[01:39:01.100 --> 01:39:05.900] Yeah, Eddie, do you have any idea
[01:39:05.900 --> 01:39:10.900] whether it's proper for somebody to go down and file a deed,
[01:39:12.100 --> 01:39:17.100]  a deed, I'm having trouble with my voice,
[01:39:17.420 --> 01:39:22.420]  a deed, a deed in county court.
[01:39:22.420 --> 01:39:24.380]  County court.
[01:39:24.380 --> 01:39:26.540] Isn't this something you called me about here
[01:39:26.540 --> 01:39:27.940] two or three weeks ago, Doug?
[01:39:27.940 --> 01:39:31.460]  Someone filed a deed against a piece of property?
[01:39:31.460 --> 01:39:32.940]  That I had, right.
[01:39:32.940 --> 01:39:34.540]  Okay.
[01:39:34.540 --> 01:39:35.380]  Okay.
[01:39:35.380 --> 01:39:38.620] And what do you mean by filed a deed with the court?
[01:39:38.620 --> 01:39:40.380]  Deeds aren't filed with the courts.
[01:39:40.380 --> 01:39:42.940] They may be used in court as evidence,
[01:39:42.940 --> 01:39:44.460] but they're not filed with the court,
[01:39:44.460 --> 01:39:46.380]  they're filed with the county clerk.
[01:39:46.380 --> 01:39:48.020] Right, with the county clerk.
[01:39:48.020 --> 01:39:53.020] And now I got notice of it, that a deed was filed
[01:39:56.580 --> 01:39:59.100]  on my property and then I...
[01:40:04.940 --> 01:40:08.020] Do you possess a deed for the property?
[01:40:08.020 --> 01:40:08.860]  Yes.
[01:40:08.860 --> 01:40:10.020]  Okay.
[01:40:10.020 --> 01:40:12.380] Then in order for that other deed
[01:40:12.380 --> 01:40:14.540] to be anywhere near valid,
[01:40:15.420 --> 01:40:17.700] they would have to show that there was a bill of sale
[01:40:17.700 --> 01:40:21.820] or a real estate transfer of that deeded property.
[01:40:21.820 --> 01:40:23.900]  If they can't produce that,
[01:40:23.900 --> 01:40:25.780] then what you need to be doing
[01:40:25.780 --> 01:40:28.140] is going down to the county clerk
[01:40:28.140 --> 01:40:30.460]  and filing a complaint with them
[01:40:30.460 --> 01:40:35.060] that their official record contains a fraudulent document
[01:40:35.060 --> 01:40:37.220] in the form of the other deed.
[01:40:37.220 --> 01:40:40.180] And you need to make them aware of it
[01:40:40.180 --> 01:40:43.660] and challenge the validity of the document
[01:40:43.660 --> 01:40:47.780]  as being not a fraud.
[01:40:49.140 --> 01:40:52.140]  Well, what he says is that I didn't file,
[01:40:56.220 --> 01:40:59.220]  I didn't file, I have the deed.
[01:41:04.780 --> 01:41:07.380]  Well, you can't get a deed if it's not filed, Doug.
[01:41:07.380 --> 01:41:12.060]  It's filed somewhere by somebody or it's not a deed.
[01:41:12.060 --> 01:41:15.260]  They're giving me back the attorney.
[01:41:17.260 --> 01:41:22.260] Okay, what you may not have changed the name on the deed,
[01:41:22.260 --> 01:41:25.180] but you still possess the deed.
[01:41:25.180 --> 01:41:26.020]  Why?
[01:41:26.020 --> 01:41:30.060] Okay, well, the deed has still been filed.
[01:41:30.060 --> 01:41:31.380]  No, I didn't file it.
[01:41:31.380 --> 01:41:35.900] No, Doug, it had to be filed to even exist.
[01:41:35.900 --> 01:41:40.900] Exist because the county is the one that issues the deed
[01:41:41.900 --> 01:41:43.740] and they can only do that
[01:41:43.740 --> 01:41:47.100] if the property has been registered to get the deed.
[01:41:49.620 --> 01:41:52.180] Well, it was a bill of sales.
[01:41:52.180 --> 01:41:56.620] I bought the property from this guy and then I-
[01:41:56.620 --> 01:41:58.420]  A bill of sale is not a deed.
[01:41:59.260 --> 01:42:01.420] Do you have both of them?
[01:42:01.420 --> 01:42:03.900]  Yeah, I mean, I got it from their lawyer
[01:42:03.900 --> 01:42:08.060] that said I had paid the amount required
[01:42:09.060 --> 01:42:14.060]  and I had a limp possession of the property.
[01:42:15.460 --> 01:42:17.820] Okay, so who filed the other deed?
[01:42:19.180 --> 01:42:23.420] The lady, the deceased husband.
[01:42:25.860 --> 01:42:28.940] The wife of the deceased husband,
[01:42:28.940 --> 01:42:30.500] the deceased husband being the one
[01:42:30.500 --> 01:42:32.300] you bought the property from?
[01:42:32.300 --> 01:42:33.900]  Right, right.
[01:42:33.900 --> 01:42:37.780] Okay, then you still need to take your bill of sale
[01:42:37.780 --> 01:42:41.380] and your deed down there to challenge
[01:42:41.380 --> 01:42:43.380]  that deed that she's filed.
[01:42:43.380 --> 01:42:45.300]  If you don't do that,
[01:42:45.300 --> 01:42:48.020] she's gonna wind up with that property in your host.
[01:42:50.420 --> 01:42:51.940]  Okay.
[01:42:51.940 --> 01:42:53.060]  Okay?
[01:42:53.060 --> 01:42:55.300] All right, Eddie, thank you very much.
[01:42:55.300 --> 01:42:56.140]  You're welcome.
[01:42:56.140 --> 01:42:58.380] And I'd also make sure to get in touch with the lawyer
[01:42:58.380 --> 01:43:00.020] that originally gave it to you
[01:43:00.020 --> 01:43:05.020] and let him know that the woman is now attempting to go back
[01:43:06.020 --> 01:43:08.580] and now is she divorced from the guy
[01:43:08.580 --> 01:43:10.460] or were they married when he died?
[01:43:10.460 --> 01:43:11.500]  He died.
[01:43:11.500 --> 01:43:14.820] No, no, no, was she married to him when he died?
[01:43:15.700 --> 01:43:16.620]  Yeah.
[01:43:16.620 --> 01:43:19.180] They weren't on the outs or anything?
[01:43:19.180 --> 01:43:20.020]  No.
[01:43:20.020 --> 01:43:22.060] Okay, then you need to contact that attorney
[01:43:22.060 --> 01:43:24.500] and let him know that he needs to be telling her
[01:43:24.500 --> 01:43:27.060] that property's been sold and she can't claim it on a deed.
[01:43:27.060 --> 01:43:29.980] You have the deed and you have the bill of sale.
[01:43:29.980 --> 01:43:31.540]  No, Eddie.
[01:43:31.540 --> 01:43:33.940]  Please help me, please.
[01:43:33.940 --> 01:43:35.460]  Okay.
[01:43:35.460 --> 01:43:36.540] All right, hang on, Doug.
[01:43:36.540 --> 01:43:38.780]  I'll try to understand that when I get back.
[01:43:38.780 --> 01:43:39.620]  Hold on.
[01:43:40.500 --> 01:43:42.100] All right, folks, we got one more.
[01:43:42.100 --> 01:43:43.340]  Johnny, you're on the board there,
[01:43:43.340 --> 01:43:44.700] so hang on and I will make sure
[01:43:44.700 --> 01:43:46.220] to get to you on the other side.
[01:43:46.220 --> 01:43:48.060] This is our last segment coming up.

[01:46:22.900 --> 01:46:24.300] This is Rule of Law Radio.
[01:46:24.300 --> 01:46:25.820] We're going to try and finish up with Doug.
[01:46:25.820 --> 01:46:28.180] All right, Doug, you were saying something about the deed
[01:46:28.180 --> 01:46:30.140] when I said you need to take them both down there.
[01:46:30.140 --> 01:46:31.540] So what was that again?
[01:46:32.420 --> 01:46:35.740] They were both written by her and overrised by her
[01:46:35.740 --> 01:46:38.100] and they say that I had bought the property,
[01:46:39.100 --> 01:46:43.420] the one she gave me in 2012.
[01:46:44.180 --> 01:46:46.980]  I didn't register it.
[01:46:46.980 --> 01:46:49.660] I didn't go down there and register it, but I have it.
[01:46:50.660 --> 01:46:56.620] Overrised by a lawyer and then she came back
[01:46:56.620 --> 01:47:03.100] and sent me a letter that says that she sent her agent
[01:47:03.100 --> 01:47:04.980] down there to register it.
[01:47:06.060 --> 01:47:08.780] Another rise assigned by the same lady.
[01:47:10.220 --> 01:47:24.100] And it says that I agreed to all of the covenants
[01:47:24.100 --> 01:47:27.660] and agreements and this and that and the other
[01:47:29.060 --> 01:47:33.140]  were registered or unregistered.
[01:47:33.140 --> 01:47:36.900] In other words, she gave all the mineral rights
[01:47:38.300 --> 01:47:40.900] and then Agnes was able to own the property
[01:47:40.900 --> 01:47:44.020] for the rest of her life and this and that and the other
[01:47:46.060 --> 01:47:48.900] without my knowledge or permission.
[01:47:50.300 --> 01:47:53.180] Is any of that in writing with any agreement that you have
[01:47:53.180 --> 01:47:54.900] when you purchased the property?
[01:47:54.900 --> 01:47:56.260]  No.
[01:47:56.260 --> 01:47:59.740] Well, then she has no leg to stand on.
[01:47:59.740 --> 01:48:04.740]  I purchased 5.52 acres of land
[01:48:06.100 --> 01:48:09.980] and that's what the sales contract is
[01:48:11.380 --> 01:48:12.580]  and I paid them that.
[01:48:15.660 --> 01:48:20.580] Well, then if you have no other agreements with them
[01:48:20.580 --> 01:48:23.460] other than the purchase of the land with no stipulations
[01:48:23.460 --> 01:48:26.540] or anything of that, then what she's done
[01:48:26.540 --> 01:48:30.180] is she's filed a fraudulent document in the county record.
[01:48:30.180 --> 01:48:31.340]  That's a felony.
[01:48:32.180 --> 01:48:33.380]  Okay.
[01:48:33.380 --> 01:48:35.580] And you need to make her aware that that's a felony
[01:48:35.580 --> 01:48:38.060] and you're gonna give her exactly X number of days
[01:48:38.060 --> 01:48:41.300] to go down and withdraw it or you're gonna have no choice
[01:48:41.300 --> 01:48:43.300] but to file criminal charges against her.
[01:48:46.340 --> 01:48:48.820] All right, Eddie, thank you very much.
[01:48:48.820 --> 01:48:50.900]  You're welcome.
[01:48:50.900 --> 01:48:52.180]  Okay, have a good night.
[01:48:52.180 --> 01:48:53.220]  You too.
[01:48:53.220 --> 01:48:54.140]  All right.
[01:48:54.140 --> 01:48:56.380] All right, my other caller up in this period here,
[01:48:56.380 --> 01:48:57.780]  where did Johnny go?
[01:48:59.380 --> 01:49:02.340] Well, he may have been ready, but he ain't there right now
[01:49:02.340 --> 01:49:03.700] so that makes him not ready
[01:49:03.700 --> 01:49:05.460]  and I can't do nothing about that.
[01:49:06.620 --> 01:49:08.140] Call screen and you wanna see if you can solve
[01:49:08.140 --> 01:49:10.940] that problem for me unless he's out there actually listening
[01:49:12.380 --> 01:49:14.020] and I knocked this thing off the stand
[01:49:14.020 --> 01:49:16.180] before it actually makes a difference here.
[01:49:16.180 --> 01:49:19.860] Anyway, Johnny, if you are listening, give me a call back.
[01:49:19.860 --> 01:49:20.820]  All right.
[01:49:20.820 --> 01:49:23.220]  Now, if he doesn't, I'm gonna go ahead
[01:49:23.220 --> 01:49:25.700] and try to fill this in until I get at least one more caller
[01:49:25.700 --> 01:49:26.580]  on the board here.
[01:49:28.220 --> 01:49:32.100] Now, back to the thing I was talking about originally,
[01:49:32.100 --> 01:49:36.340] what we let them get away with and what we do for ourselves,
[01:49:36.340 --> 01:49:39.020] what Doug was just talking about is a good example.
[01:49:39.020 --> 01:49:42.860] You have somebody that wants to take advantage
[01:49:42.860 --> 01:49:45.020]  of a situation for whatever reason
[01:49:45.020 --> 01:49:46.300] and they go and do something
[01:49:46.300 --> 01:49:48.580] like what this lady appears to have done
[01:49:48.580 --> 01:49:52.060] and try to reclaim property that she knows
[01:49:52.060 --> 01:49:57.060] she has already sold to another party and no longer owns
[01:49:57.660 --> 01:50:01.260] but is now attempting to regain control of the property
[01:50:02.140 --> 01:50:05.500] through the means of filing a false deed
[01:50:06.740 --> 01:50:10.180] and in making claims of a contract that
[01:50:10.180 --> 01:50:14.580] if everything is as described does not exist,
[01:50:14.580 --> 01:50:16.900] that is going to create problems
[01:50:16.900 --> 01:50:19.180] all the way around for everybody.
[01:50:19.180 --> 01:50:21.460]  If they don't take it as a criminal case,
[01:50:21.460 --> 01:50:23.180]  then that's gonna leave a civil action
[01:50:23.180 --> 01:50:26.860] to have to be pursued to get the lady's deed nullified
[01:50:26.860 --> 01:50:28.620] and to make sure everything happens.
[01:50:28.620 --> 01:50:33.420] But at the same time, that's gonna also put the property
[01:50:33.420 --> 01:50:36.260] back onto the registry as a mandate,
[01:50:36.260 --> 01:50:39.660] probably by the county or whatever and so on and so forth.
[01:50:39.660 --> 01:50:41.340] So it's one of those situations where they try
[01:50:41.340 --> 01:50:43.460] to take advantage of the fact that you know more
[01:50:43.460 --> 01:50:48.460] than they do in some ways, but they just do this stuff.
[01:50:48.980 --> 01:50:52.180]  Anyway, okay, I got a couple of more people
[01:50:52.180 --> 01:50:53.860] up on the board here all of a sudden
[01:50:54.780 --> 01:50:56.020] and none of them are Johnny.
[01:50:56.020 --> 01:51:00.620] So I'm gonna go to Rob in Illinois who is first up here.
[01:51:00.620 --> 01:51:02.500] All right, Rob, what can we do for you?
[01:51:02.500 --> 01:51:04.740] Okay, Eddie, I was just calling in
[01:51:04.740 --> 01:51:06.900] can I help you fill time here?
[01:51:06.900 --> 01:51:08.100]  But I'll just take a minute
[01:51:08.100 --> 01:51:10.260] since you got somebody waiting.
[01:51:10.260 --> 01:51:12.580] Have you heard from that kid, Brian,
[01:51:12.580 --> 01:51:15.700] the young man Brian from Northern Illinois here
[01:51:15.700 --> 01:51:17.460] about that red light camera?
[01:51:17.460 --> 01:51:18.980] Has he tried to contact you?
[01:51:18.980 --> 01:51:20.380]  I do not know.
[01:51:20.380 --> 01:51:24.300] I have actually been trying to play catch up on emails.
[01:51:24.300 --> 01:51:28.700] I don't recall seeing it, but if I do come across it,
[01:51:28.700 --> 01:51:32.420] I will be very sure to send it on to you as we discussed.
[01:51:32.420 --> 01:51:33.780] Okay, all right, thank you.
[01:51:33.780 --> 01:51:35.500] Yeah, I'd like to get ahold of them.
[01:51:35.500 --> 01:51:37.580]  I did find out some stuff
[01:51:37.580 --> 01:51:39.420] about the red light camera violation
[01:51:39.420 --> 01:51:42.100] and I think everybody can go on
[01:51:42.100 --> 01:51:43.540] and find it within their own state.
[01:51:43.540 --> 01:51:46.340]  I think it's all publicized on the internet,
[01:51:46.340 --> 01:51:47.420]  but he is right.
[01:51:47.420 --> 01:51:52.420]  It says here there's nine or 10 things here
[01:51:53.500 --> 01:51:57.420] that they attend requirements that the notice shall include
[01:51:57.420 --> 01:51:58.700]  and I won't go into all of them.
[01:51:58.700 --> 01:52:03.700] So he was right about the date and time of the violation.
[01:52:04.220 --> 01:52:05.060]  Yeah.
[01:52:05.060 --> 01:52:05.940]  All that stuff, so it's great.
[01:52:05.940 --> 01:52:08.980] So thank you, Eddie, for helping us all out here
[01:52:08.980 --> 01:52:11.220] and bringing this and shedding some light on this.
[01:52:11.220 --> 01:52:12.380]  Oh, not a problem.
[01:52:12.380 --> 01:52:14.260]  I'm glad that I can provide a form
[01:52:14.260 --> 01:52:16.220]  if I can't actually help directly.
[01:52:16.220 --> 01:52:17.060]  Right.
[01:52:18.260 --> 01:52:19.100]  Okay.
[01:52:19.100 --> 01:52:20.060]  Okay, great, thanks.
[01:52:20.060 --> 01:52:21.380] All right, Rob, thanks for calling in.
[01:52:21.380 --> 01:52:22.580]  Okay, sure, Eddie.
[01:52:22.580 --> 01:52:24.060]  All right.
[01:52:24.060 --> 01:52:26.900] It appears Corey in New York has called back in.
[01:52:26.900 --> 01:52:28.660]  All right, Corey, what's up?
[01:52:28.660 --> 01:52:30.700] Yeah, hey, I was doing the same thing.
[01:52:30.700 --> 01:52:33.180] I was just gonna fill some time till Tom came back,
[01:52:33.180 --> 01:52:34.220]  I realized. All right.
[01:52:34.220 --> 01:52:35.500] So let's see if we can finish up
[01:52:35.500 --> 01:52:37.940] with where you were going before.
[01:52:37.940 --> 01:52:39.500]  Yeah, one quick comment.
[01:52:39.500 --> 01:52:41.940] She mentioned, she called it a citizen grand jury,
[01:52:41.940 --> 01:52:44.220]  and I know there's all those negative connotations
[01:52:44.220 --> 01:52:46.180] about calling herself sovereign and whatnot,
[01:52:46.180 --> 01:52:47.020]  but we-
[01:52:47.020 --> 01:52:49.300] Well, the thing is a common law grand jury
[01:52:49.300 --> 01:52:50.820]  is the same thing.
[01:52:50.820 --> 01:52:53.340] They use those terms interchangeable.
[01:52:53.340 --> 01:52:56.620]  A common law grand jury is a citizen's grand jury
[01:52:56.620 --> 01:53:00.020] because it's convened outside of governmental action.
[01:53:00.020 --> 01:53:05.020] The problem is, now that she started mentioning the case,
[01:53:05.620 --> 01:53:07.460] I remember the facts of the case.
[01:53:07.460 --> 01:53:10.180] I just don't remember what the name of the case is.
[01:53:10.180 --> 01:53:11.020]  Yeah.
[01:53:11.020 --> 01:53:13.620] But I would still like to see
[01:53:13.620 --> 01:53:16.820] what you're trying to make an argument with and why.
[01:53:16.820 --> 01:53:17.660]  Yeah.
[01:53:17.660 --> 01:53:20.180] Just for no other reason than to just simply say,
[01:53:20.180 --> 01:53:23.380] well, here's either where you might wanna change
[01:53:23.380 --> 01:53:25.060] the argument or here's why the argument
[01:53:25.060 --> 01:53:27.140]  ain't ever gonna fly.
[01:53:27.140 --> 01:53:28.820] Well, why can't we assert our power
[01:53:28.820 --> 01:53:30.380] and make them listen to a grand jury
[01:53:30.380 --> 01:53:32.140]  and honor our indictment?
[01:53:32.140 --> 01:53:34.900] Because we didn't put anything in place ahead of time
[01:53:34.900 --> 01:53:36.940] to make sure they had to.
[01:53:36.940 --> 01:53:39.140] They don't obey the constitution we gave them.
[01:53:39.140 --> 01:53:40.340] Why would they obey it
[01:53:40.340 --> 01:53:43.100] when we're trying to retake control of it?
[01:53:43.100 --> 01:53:43.940]  Sure.
[01:53:43.940 --> 01:53:45.500]  Yeah, that's a good point.
[01:53:45.500 --> 01:53:46.660]  Yeah.
[01:53:46.660 --> 01:53:49.420]  Maybe, what's the young lady's name
[01:53:49.420 --> 01:53:50.660]  who spoke there for a moment?
[01:53:50.660 --> 01:53:51.500]  Deborah.
[01:53:51.500 --> 01:53:53.420]  She's one of my co-hosts.
[01:53:53.420 --> 01:53:55.420] Yeah, maybe she would hop on there,
[01:53:55.420 --> 01:53:56.780]  the website that I mentioned before,
[01:53:56.780 --> 01:54:00.940] and if there's something that refutes all these guys,
[01:54:00.940 --> 01:54:03.980] what they're saying about the lawfulness of this,
[01:54:03.980 --> 01:54:05.420]  then I'd like to hear it,
[01:54:05.420 --> 01:54:08.180]  because like I said, I'm young at this.
[01:54:08.180 --> 01:54:11.860] Well, the thing is, whether or not it's refutable
[01:54:11.860 --> 01:54:13.580] depends entirely on whether or not
[01:54:13.580 --> 01:54:16.140]  you're reading the case law properly.
[01:54:16.140 --> 01:54:17.740] And I'm gonna tell you right now,
[01:54:17.740 --> 01:54:22.340]  most patriot intentions
[01:54:23.500 --> 01:54:28.500] begin with bad readings and understandings of case law.
[01:54:30.460 --> 01:54:33.300] I cannot tell you the number of cases
[01:54:33.300 --> 01:54:36.900] that are on the internet with all of these quotes
[01:54:36.900 --> 01:54:41.900] that are 100% precisely what the patriot community needs
[01:54:42.660 --> 01:54:45.780] to make their point, but they're all fabricated.
[01:54:47.660 --> 01:54:52.660] The language that the case is cited with doesn't exist.
[01:54:52.820 --> 01:54:56.780] The premise of the case as cited doesn't exist.
[01:54:57.700 --> 01:55:01.420]  It's a complete and utter fabrication.
[01:55:01.420 --> 01:55:05.900] And that is where you will get murdered in court.
[01:55:05.900 --> 01:55:08.220] Yeah, kind of like going to a protest or something.
[01:55:08.220 --> 01:55:11.100]  Exactly, it's disinformation strategy.
[01:55:11.100 --> 01:55:13.060] Oh, get them quoting this case over here
[01:55:13.060 --> 01:55:14.700] and then let the attorney take them into court
[01:55:14.700 --> 01:55:16.620] and prove they don't know what the hell they're talking about.
[01:55:16.620 --> 01:55:18.740]  Guaranteed slam, don't win.
[01:55:18.740 --> 01:55:19.580]  Yeah.
[01:55:19.580 --> 01:55:20.860] And then they'll stand there and go,
[01:55:20.860 --> 01:55:24.620] see, this is why the bar's needed.
[01:55:24.620 --> 01:55:28.780] This is why only lawyers get to talk about the law.
[01:55:28.780 --> 01:55:32.700] This is why only judges get to say what it means
[01:55:32.700 --> 01:55:35.940] because you simpletons out there
[01:55:35.940 --> 01:55:39.340]  can't understand it without us.
[01:55:39.340 --> 01:55:40.180]  Yeah.
[01:55:40.180 --> 01:55:43.980]  That's exactly how that's intended to work.
[01:55:43.980 --> 01:55:46.860] By you not making the effort to fully understand
[01:55:46.860 --> 01:55:49.940] the legal argument and the legal premise behind the argument,
[01:55:49.940 --> 01:55:52.380] you walk right into that trap.
[01:55:52.380 --> 01:55:55.580] Right, so do you believe that in New York,
[01:55:55.580 --> 01:55:57.380]  like the driver's license for instance,
[01:55:57.380 --> 01:55:59.540]  that has like...
[01:55:59.540 --> 01:56:01.500]  Okay, yeah, absolutely.
[01:56:01.500 --> 01:56:04.940]  There's one thing that I absolutely know for sure.
[01:56:04.940 --> 01:56:09.940] Any government issued license or permit
[01:56:09.940 --> 01:56:11.860] has two things behind it.
[01:56:11.860 --> 01:56:14.700] One, it must be in an activity
[01:56:14.700 --> 01:56:17.460] that government has an authority to regulate.
[01:56:17.460 --> 01:56:19.900] Two, it must be in something
[01:56:19.900 --> 01:56:24.540] that would be absolutely illegal to do without the license
[01:56:24.540 --> 01:56:27.700] in relation to something commercial.
[01:56:27.700 --> 01:56:31.020] Every license or permit has a commercial nexus.
[01:56:31.020 --> 01:56:32.740] Does not matter what it is.
[01:56:32.740 --> 01:56:35.700] It's either to manufacture something for profit,
[01:56:35.700 --> 01:56:38.220] to do some sort of business for profit,
[01:56:38.220 --> 01:56:43.220] or to alter something that naturally exists
[01:56:43.740 --> 01:56:46.500]  or whatever for profit.
[01:56:46.500 --> 01:56:51.100] It's for conducting some sort of business enterprise
[01:56:51.100 --> 01:56:54.140] on one end or the other or in between.
[01:56:54.140 --> 01:56:57.820] Every license or permit is for that purpose.
[01:56:59.900 --> 01:57:01.460]  Right, gotcha.
[01:57:01.460 --> 01:57:04.660] So not necessary, that in your opinion.
[01:57:04.660 --> 01:57:06.900] If you're not engaged in the regular activity
[01:57:06.900 --> 01:57:09.860] to which it applies, not necessary.
[01:57:09.860 --> 01:57:11.780]  Yeah, they're gonna call me nuts
[01:57:11.780 --> 01:57:14.060]  for saying that I wasn't driving.
[01:57:16.340 --> 01:57:19.060]  Well, you don't say I'm not driving.
[01:57:19.060 --> 01:57:20.740]  That's attempting to educate.
[01:57:20.740 --> 01:57:22.020]  We don't do that, do we?
[01:57:22.020 --> 01:57:24.260]  Hmm, no.
[01:57:24.260 --> 01:57:29.260] We simply ask, what is your evidence that I was driving?
[01:57:29.780 --> 01:57:31.100]  Mm-hmm.
[01:57:31.100 --> 01:57:33.580] And in order for you to have evidence of driving,
[01:57:33.580 --> 01:57:35.780] then you have to have evidence of an activity
