[01:01.080 --> 01:05.520]  This one from the New York Times, which reports that the CIA is secretly collecting
[01:05.520 --> 01:09.960]  bulk records of international money transfers, including transactions in and

[01:12.000 --> 01:16.280]  The Financial Records Program, which targets such companies as Western Union, is
[01:16.280 --> 01:20.360]  conducted under the same law that the NSA uses to collect phone records.
[01:20.360 --> 01:24.080]  Current and former government officials say provisions in the Patriot Act
[01:24.080 --> 01:29.280]  authorize the programs.
[01:29.280 --> 01:33.520]  The Government Accountability Office released a report Wednesday detailing
[01:33.520 --> 01:37.160]  the massive failures of the Transportation Security Administration's

[04:48.120 --> 04:56.400]  Definitely, you know, I'm sure by now everyone has seen the news and seen
[04:56.400 --> 04:58.800]  what has happened to the Philippines.
[04:58.800 --> 05:02.000]  And when I went there, I've been there twice.
[05:02.000 --> 05:05.800]  I went there when I was 15, so it was about four years back.
[05:05.800 --> 05:11.080]  I went there for two months for a school of missions, you know, learned
[05:11.080 --> 05:18.600]  about the Bible and, you know, and I taught all the Christian things, you
[05:18.600 --> 05:19.600]  know.
[05:19.600 --> 05:23.520]  You know, definitely having a conversation with God and whatnot.
[05:23.520 --> 05:28.280]  Then I went back in May, the end of May.
[05:28.280 --> 05:37.840]  I came back the first day of June, so yeah, first day, I went to the first, I went
[05:37.840 --> 05:44.040]  to the first day of June, came back, end of June, did a little bit more missions
[05:44.040 --> 05:47.520]  work, went around with some pastors.
[05:47.520 --> 05:52.560]  And the reason why I'm on the show today is because the area that was the most
[05:52.560 --> 05:59.400]  hit was Tacloban, you know, that's the big city that's on Manila, a city of
[05:59.400 --> 06:02.200]  over 200,000.
[06:02.200 --> 06:09.080]  And two minutes from there was where I stayed at a town called Dulag Lake, the
[06:09.080 --> 06:14.840]  middle, the middle of the island, you know, there's three islands, Luzon is
[06:14.840 --> 06:19.800]  the first island, Leyde is the second, but the Mindanao is the one farthest
[06:19.800 --> 06:20.800]  south.
[06:20.800 --> 06:25.240]  Tacloban and Dulag were hit the hardest.
[06:25.240 --> 06:30.560]  And I really was, you know, my heart really goes out to the people of the
[06:30.560 --> 06:31.560]  Philippines.
[06:31.560 --> 06:35.200]  Those are the people I was staying with, those are the friends I made.
[06:35.200 --> 06:41.400]  So I was thinking about, you know, what we could do for them, you know, I was
[06:41.400 --> 06:46.600]  talking to the pastors the other day and he said it wouldn't be safe, you know,
[06:46.600 --> 06:54.600]  not at this time because there's a sense of lawlessness there, it's not safe
[06:54.600 --> 06:59.080]  because everyone's hostile, you know, everyone's in panic mode and survival
[06:59.080 --> 07:00.080]  mode.
[07:00.080 --> 07:04.600]  So for me to go now would be, I'd be looked at as more of a nuisance rather
[07:04.600 --> 07:08.560]  than a help.
[07:08.560 --> 07:14.840]  So what we were thinking of is we wanted to start a fund and we were thinking,
[07:14.840 --> 07:18.440]  you know, what do we call it, what takes place.
[07:18.440 --> 07:23.000]  So after a little while thinking, I thought up what the name is called
[07:23.000 --> 07:29.600]  Rest the Broken Project Philippines and what it is is we're raising money for
[07:29.600 --> 07:36.080]  the pastors down there in the town of Dulac, the college I was staying at
[07:36.080 --> 07:40.280]  actually where I went down there was pretty much completely destroyed, you
[07:40.280 --> 07:46.880]  know, the church was destroyed, the dormitories are all destroyed, the clean
[07:46.880 --> 07:51.480]  water source, the food, the electricity, it's all gone, no more
[07:51.480 --> 07:57.560]  soil, you know, there's a lot of agriculture down there, a lot of farming,
[07:57.560 --> 08:01.720]  the salt water, you know, seeped in there so there's not going to be good soil
[08:01.720 --> 08:06.800]  for a long time, there's pretty much nothing there but what we wanted to do
[08:06.800 --> 08:11.960]  was start a fund to raise money and the money would go directly into the hands
[08:11.960 --> 08:18.320]  of the Philippine people, you know, the pastors that administer it and then,
[08:18.320 --> 08:24.200]  you know, just help with the effort as much as you possibly can, you know, as
[08:24.200 --> 08:28.400]  far as the cost, as far as, you know, where the money goes, there's no
[08:28.400 --> 08:37.680]  administration, you know, it's 100% to the people and I know I'm only 19 but
[08:37.680 --> 08:44.760]  Mr. Kelton, obviously, you and my father are both great men of integrity,
[08:44.760 --> 08:49.680]  people know your name, people know my father's name and you're very
[08:49.680 --> 08:56.280]  integral people so I would definitely, you know, happy you guys overseeing the
[08:56.280 --> 09:02.560]  funds. Well, actually, we could, we're thinking of, we're going to put up on our

[21:27.680 --> 21:36.680]  It was just absolute yucks and giggles. I called 911 on them, and it was just
[21:36.680 --> 21:38.680]  great fun. These guys are great entertainment.
[21:38.680 --> 21:47.680]  I went in Tuesday at an eviction hearing, and the judge asked who I was,
[21:47.680 --> 21:52.680]  and I told him I was Randall Kelton. And he said, well, what do you have to
[21:52.680 --> 21:59.680]  do with this case? I said, I have standing by champardy through a warranty
[21:59.680 --> 22:04.680]  deed and quitclaim deed properly filed in the county record.
[22:04.680 --> 22:10.680]  And he just sat there a minute. I don't think he had a clue as to what
[22:10.680 --> 22:16.680]  champardy was, but he didn't argue about my standing now that the fellow I
[22:16.680 --> 22:22.680]  worked with, he had given him a hard time before, and he did this time.
[22:22.680 --> 22:28.680]  But I had filed into the record, and I told the judge that I have filed into
[22:28.680 --> 22:34.680]  the record a challenge to subject matter jurisdiction as there is a
[22:34.680 --> 22:39.680]  trespass-to-trials title suit filed in the district court making a claim
[22:39.680 --> 22:44.680]  against title, and therefore this court lacks subject matter jurisdiction.
[22:44.680 --> 22:50.680]  Then he said, never read the plea because we had just filed it.
[22:50.680 --> 22:55.680]  Mr. Kelton, just because you filed a trespass-to-trials title suit does not
[22:55.680 --> 23:02.680]  mean that I don't have jurisdiction. Is that so?
[23:02.680 --> 23:06.680]  Then I'm going to deny your motion, your challenge to subject matter
[23:06.680 --> 23:10.680]  jurisdiction. Oh, okay. We're done then.
[23:10.680 --> 23:15.680]  I closed my folder, turned and walked out. I stepped through the bar, and
[23:15.680 --> 23:18.680]  then I pointed at the bailiff. I'm going to need you outside.
[23:18.680 --> 23:22.680]  And then went out in the hall. Then we had the bailiff wouldn't take a
[23:22.680 --> 23:30.680]  complaint against the judge, and the bailiff was dumb enough when he
[23:30.680 --> 23:36.680]  refused to take a criminal complaint against the judge, he made these
[23:36.680 --> 23:40.680]  remarks about how he used to work in the jail and all these people,
[23:40.680 --> 23:44.680]  learned just enough to be dangerous, and then they wind up getting
[23:44.680 --> 23:46.680]  themselves in all kinds of trouble.
[23:46.680 --> 23:49.680]  Now, if you don't have any more business here, you're going to have to
[23:49.680 --> 23:54.680]  leave the courthouse. I told him I'm not going to have to do any such
[23:54.680 --> 23:59.680]  thing. Besides, I have more business here.
[23:59.680 --> 24:06.680]  And because he said that to me, when I told him I had more business
[24:06.680 --> 24:12.680]  here, then he allowed me to stay on the condition that I had more
[24:12.680 --> 24:21.680]  business. Well, son of a gun, I didn't think my right to public
[24:21.680 --> 24:26.680]  access to the courthouse was contingent on my having business
[24:26.680 --> 24:28.680]  with the courthouse.
[24:28.680 --> 24:34.680]  Oh, I've got a text message that says the calling bridge is closed.
[24:34.680 --> 24:42.680]  Anyway, so I will be filing first degree felony aggravated assault
[24:42.680 --> 24:49.680]  against Mr. Dearing, that was the name of the bailiff.
[24:49.680 --> 24:54.680]  And here we have a situation where the judge exerted or purported to
[24:54.680 --> 24:57.680]  exert an authority he did not, of course, have, and in the process,
[24:57.680 --> 25:01.680]  denied me the full free access to the enjoyment of a right.
[25:01.680 --> 25:05.680]  That's class A misdemeanor, 3903 penal code.
[25:05.680 --> 25:13.680]  And then he committed that act in the sight and in the hearing of a
[25:13.680 --> 25:20.680]  certified police officer. More specifically, a bailiff who was
[25:20.680 --> 25:27.680]  tasked with the duty to keep the peace in the courtroom made no
[25:27.680 --> 25:32.680]  difference who breached it.
[25:32.680 --> 25:40.680]  So he failed to perform a duty he was required to perform.
[25:40.680 --> 25:47.680]  And in the process, threatened me with that loaded pistol he had on
[25:47.680 --> 25:53.680]  his hip when he told me to leave the courtroom.
[25:53.680 --> 25:59.680]  I interpreted that as carrying the implied threat that he would use
[25:59.680 --> 26:06.680]  that loaded pistol that he was prominently displaying on his hip.
[26:06.680 --> 26:10.680]  And I took that as an act of aggravated assault.
[26:10.680 --> 26:15.680]  Now, maybe he doesn't consider that pistol really important.
[26:15.680 --> 26:22.680]  But the doctrine is you take the person like you find them.
[26:22.680 --> 26:28.680]  And in this case, he found me an ex-combat veteran who has been on
[26:28.680 --> 26:36.680]  the sharp end of those things, and I take them very serious.
[26:36.680 --> 26:40.680]  So he has to take me like he finds me.
[26:40.680 --> 26:44.680]  And I took him as threatening me with the potential use of that
[26:44.680 --> 26:50.680]  deadly weapon in order to enforce the intent of his purpose.
[26:50.680 --> 26:54.680]  Then when I informed him that I had business with the court in the
[26:54.680 --> 27:00.680]  courthouse, he capitulated and allowed me to stay on the condition
[27:00.680 --> 27:04.680]  that I had business.
[27:04.680 --> 27:11.680]  I can't find that anywhere in Constitution or statute that says
[27:11.680 --> 27:19.680]  where it says all courts shall be public.
[27:19.680 --> 27:22.680]  If you have business with the court.
[27:22.680 --> 27:24.680]  Well, I didn't find that part in there.
[27:24.680 --> 27:30.680]  So I took that as him exerting the authority he didn't have and
[27:30.680 --> 27:36.680]  attempted to force me to leave the courthouse when he was committing
[27:36.680 --> 27:41.680]  an act of misfeasance in office by failing to perform a duty he was
[27:41.680 --> 27:50.680]  required to perform for the purpose of shielding the judge from prosecution.
[27:50.680 --> 27:59.680]  He issued what I consider to be a threat against my safety in order to
[27:59.680 --> 28:01.680]  deny me access to a public building.
[28:01.680 --> 28:06.680]  Now, under text penal code 207, if you threaten someone for the purpose
[28:06.680 --> 28:12.680]  of denying them access to a public building or interrupting their
[28:12.680 --> 28:17.680]  access to a public building, that's a terroristic threat on the penal
[28:17.680 --> 28:20.680]  code state of Texas.
[28:20.680 --> 28:25.680]  And it was my assertion and allegation that he did that for the purpose
[28:25.680 --> 28:31.680]  of shielding the judge from prosecution and obstruction of justice.
[28:31.680 --> 28:41.680]  The 2202A, the aggravated assault part, the part of him prominently
[28:41.680 --> 28:47.680]  displaying that deadly weapon and then committing the criminal act of
[28:47.680 --> 28:53.680]  assault while prominently displaying the deadly weapon, that's first
[28:53.680 --> 28:55.680]  degree felony.
[28:55.680 --> 29:00.680]  The shielding prosecution, I think that's only a second degree felony.
[29:00.680 --> 29:05.680]  And the 3903, that's only a class A misdemeanor.
[29:05.680 --> 29:08.680]  But the aggravated assault, that would get him 20 to life.
[29:08.680 --> 29:15.680]  I think these guys forget how serious what they're doing is.
[29:15.680 --> 29:18.680]  They think because they carry that pistol all the time that it's not so
[29:18.680 --> 29:22.680]  dangerous and because they scare people with it all the time, it's not a
[29:22.680 --> 29:23.680]  big deal.
[29:23.680 --> 29:26.680]  Well, we're going to demonstrate to them that it is a big deal, and I
[29:26.680 --> 29:35.680]  will charge the judge as respond to yet superior alleging that the bailiff
[29:35.680 --> 29:40.680]  is acting under the direction of and at the behest of the judge.
[29:40.680 --> 29:44.680]  And we're going to have fun when we get them to a grand jury.

[33:48.680 --> 34:00.680]  In this issue, whether or not the justice would have concurrent jurisdiction,
[34:00.680 --> 34:08.680]  when there is a suit in the district court, is really not the issue.
[34:08.680 --> 34:16.680]  The issue here is that the judge ruled on the pleading without reading the pleading.
[34:16.680 --> 34:31.680]  Now, I have a right to a fair and competent jurist in the first instance.
[34:31.680 --> 34:37.680]  Once subject matter jurisdiction is challenged, it must be proven.
[34:37.680 --> 34:45.680]  The judge did not know how subject matter jurisdiction is challenged because he never read the pleading.
[34:45.680 --> 34:53.680]  He dismissed it out of hand without even so much as picking it up and looking at it.
[34:53.680 --> 34:59.680]  So, he was pretty arrogant up there.
[34:59.680 --> 35:03.680]  I'll see if I can't tear a little of his arrogance off.
[35:03.680 --> 35:09.680]  And in the end, I'm not going to care if he had jurisdiction or not.
[35:09.680 --> 35:18.680]  I'm not even going to care if his ruling was accurate or not.
[35:18.680 --> 35:21.680]  He didn't read the pleading.
[35:21.680 --> 35:24.680]  He did not grant me due process.
[35:24.680 --> 35:27.680]  He did not ask for comment from the other side.
[35:27.680 --> 35:36.680]  The other side never raised an objection to my motion, to my pleading.
[35:36.680 --> 35:40.680]  The judge took this action souspente.
[35:40.680 --> 35:45.680]  It certainly gives the impression of impropriety.
[35:45.680 --> 35:50.680]  And I want to see what a grand jury has to say about it.
[35:50.680 --> 35:56.680]  In the process of putting all of these different methods of going after them together,
[35:56.680 --> 36:06.680]  we will shortly get the judge a notice of tort. On notice of tort, they've got 60 days.
[36:06.680 --> 36:11.680]  And then on the 61st day, I'll file a suit against him.
[36:11.680 --> 36:17.680]  And we'll have a number of these JPs that we'll be filing these suits against.
[36:17.680 --> 36:25.680]  And what they'll do is they'll get the suit and the court will dismiss it out of hand, just the way he dismissed my case.
[36:25.680 --> 36:31.680]  If you sue a judge, the courts will dismiss it out of hand, no matter what.
[36:31.680 --> 36:35.680]  They don't care. They don't care what the law says.
[36:35.680 --> 36:38.680]  They're making a difference. They're going to do what they want to.
[36:38.680 --> 36:44.680]  They're going to do what they want to because they have been able to do what they want to.
[36:44.680 --> 36:49.680]  Nobody in that courtroom took me serious.
[36:49.680 --> 36:52.680]  And the judge forgot something.
[36:52.680 --> 36:57.680]  He was the servant. I was the master.
[36:57.680 --> 37:06.680]  I did not swear to any oath to do anything. He did.
[37:06.680 --> 37:13.680]  He swore an oath to me to grant me due process.
[37:13.680 --> 37:19.680]  And even before that, I stood up in the courtroom and told him I couldn't hear him
[37:19.680 --> 37:26.680]  and that I'm an old combat veteran and I've got some hearing loss and can you turn up the sound system
[37:26.680 --> 37:29.680]  or do you have any equipment for the hearing impaired?
[37:29.680 --> 37:32.680]  He said, no, he doesn't. He's not going to turn up the sound system.
[37:32.680 --> 37:34.680]  Well, then speak up.
[37:34.680 --> 37:39.680]  He told me to sit down and shut up or I'd be removed from the courtroom.
[37:39.680 --> 37:50.680]  Well, that's a violation of the Americans with Disabilities Act required to give reasonable accommodation.
[37:50.680 --> 37:52.680]  He's still be digging, isn't he?
[37:52.680 --> 37:55.680]  You want to have yourself an attitude, Judge?
[37:55.680 --> 38:00.680]  I'll see if I can't tear a little of your attitude off and I'm not even going to take you out behind the courthouse.
[38:00.680 --> 38:08.680]  I'll take you down to Grand Jury if they see what they think of you treating a combat veteran that way the day after Veterans Day.
[38:08.680 --> 38:12.680]  Jump.
[38:12.680 --> 38:14.680]  Sickom, boy.
[38:14.680 --> 38:16.680]  Oh, we wound up in the office.
[38:16.680 --> 38:24.680]  The bailiff wouldn't take my complaints and he sent me to the Mansfield Police Department.
[38:24.680 --> 38:33.680]  The Mansfield Police Department sent this guy out and he's all one of these guys that clearly has got high blood pressure
[38:33.680 --> 38:38.680]  because his face was already red when he walked in the door.
[38:38.680 --> 38:44.680]  And he looked like his skin was so tight if he pricked him with a pen, he would explode.
[38:44.680 --> 38:47.680]  That is an indication of anabolic steroids.
[38:47.680 --> 38:50.680]  Those guys always make me kind of nervous.
[38:50.680 --> 39:00.680]  Generally, some Dan Walter media type of guy, they want to be big and bad so they join the police force,
[39:00.680 --> 39:06.680]  but all these other cops are bigger than they are, so they start taking these steroids and pumping iron
[39:06.680 --> 39:12.680]  so they can look big and bad and it causes behavioral problems.
[39:12.680 --> 39:15.680]  And this guy was struggling with his.
[39:15.680 --> 39:19.680]  He didn't lose his cool, but I thought he was going to blow a gasket.
[39:19.680 --> 39:22.680]  His face was so red.
[39:22.680 --> 39:28.680]  When I dismissed him, he refused to take a complaint, so I told him he was dismissed, he could go.
[39:28.680 --> 39:34.680]  And he started to say something else and I told him, you can go, we're done with you.
[39:34.680 --> 39:41.680]  And I know he wanted to pull his pistol and shoot me a couple of times.
[39:41.680 --> 39:45.680]  But I did not choose Mansfield, Texas.
[39:45.680 --> 39:52.680]  I just kind of got, that's where I landed, but you've heard me talk about Ken Magnuson on the show.
[39:52.680 --> 39:59.680]  His brother is an attorney for the city of Mansfield.
[39:59.680 --> 40:09.680]  So I got an earful from Ken, but the last time I went out to the city of Mansfield,
[40:09.680 --> 40:14.680]  his brother called Ken and Ken kind of pulled me off of him.
[40:14.680 --> 40:18.680]  I made it clear to him this time he wouldn't pull me anywhere.
[40:18.680 --> 40:22.680]  That if Craig got it, you know, I didn't have anything against his brother,
[40:22.680 --> 40:26.680]  but if he got in my way, I'd roll over him like the rest of them.
[40:26.680 --> 40:40.680]  So what we did was we were going to start engaging every check and balance in the county.
[40:40.680 --> 40:46.680]  We'll file some civil suits and we'll get the district judges throwing out our civil suits
[40:46.680 --> 40:50.680]  and doing what they always do.
[40:50.680 --> 41:00.680]  So that once we have every JP in the county with allegations and suits against them,
[41:00.680 --> 41:07.680]  then we will dismiss all the suits, we'll non-suit all of them,
[41:07.680 --> 41:16.680]  and re-file as a RICO against the county and we'll file the RICO against the county and the Fed.
[41:16.680 --> 41:18.680]  That's when this will start getting interesting.
[41:18.680 --> 41:22.680]  And in the process we'll be running the complaints by a grand jury.
[41:22.680 --> 41:31.680]  There's actually a chance we may get one of them because these JP's, they are, I don't know,
[41:31.680 --> 41:36.680]  it's always the lowest judges that are the quickest to forget themselves.
[41:36.680 --> 41:43.680]  This particular judge apparently has taken some sizable contributions to his election campaign
[41:43.680 --> 41:47.680]  from some of these lawyer groups.
[41:47.680 --> 41:51.680]  So it looks like he's bought and paid for.
[41:51.680 --> 41:59.680]  And I shouldn't say his name on the air, but anyway,
[41:59.680 --> 42:04.680]  it is Judge Hayes in the seventh precinct in Tarrant County.
[42:04.680 --> 42:09.680]  And if he wants to come on the show and tell this side of the story,
[42:09.680 --> 42:14.680]  I would like nothing more than to give him equal time.
[42:14.680 --> 42:18.680]  I don't want to mention his name, but his initials are Judge Hayes, right?
[42:18.680 --> 42:19.680]  Yeah, yeah.
[42:19.680 --> 42:20.680]  Okay, gotcha.
[42:20.680 --> 42:22.680]  You know, maybe there's something that we don't know.
[42:22.680 --> 42:28.680]  Maybe he lives, you know, where he lives he may know something about all of this that I don't
[42:28.680 --> 42:31.680]  and that we don't so we don't have a perspective on what he does
[42:31.680 --> 42:34.680]  or why he does things the way he does.
[42:34.680 --> 42:36.680]  And I'd very much like him to come on.
[42:36.680 --> 42:42.680]  I've tried to get police officers, my sheriff and prosecutors to come on the air
[42:42.680 --> 42:47.680]  and explain where they live, what they have to deal with,
[42:47.680 --> 42:51.680]  not just the law but the politics, the world they live in
[42:51.680 --> 42:57.680]  so we would better understand what to expect from them
[42:57.680 --> 43:02.680]  and not feel like they're being dirty, rotten, corrupt scoundrels
[43:02.680 --> 43:06.680]  when they're just trying to deal with the pressures they have to deal with.
[43:06.680 --> 43:12.680]  So if Judge Hayes wants to come in on, I will absolutely extend him an invitation,
[43:12.680 --> 43:17.680]  but somehow I suspect he's going to decline.
[43:17.680 --> 43:22.680]  That's too bad because I think we could make a pretty good show of that.
[43:22.680 --> 43:27.680]  I'd like him to explain why he wouldn't provide me with accommodation

[47:51.680 --> 47:59.680]  I'm sick and tired of what's going on with our criminal injustice system.

[48:05.680 --> 48:12.680]  And anyhow, Saturday I got stopped for speed.
[48:12.680 --> 48:20.680]  I was traveling on my Harley-Davidson, what I call my missionary vessel.
[48:20.680 --> 48:24.680]  That's probably not the right term, but I got stopped.
[48:24.680 --> 48:27.680]  I pulled into the Home Depot parking lot.
[48:27.680 --> 48:32.680]  And these two guys in costumes approached me from behind.
[48:32.680 --> 48:38.680]  And at the time I was turning – at the time I stopped, you know, they'd come up from behind.
[48:38.680 --> 48:43.680]  I was turning on my iPhone to record.
[48:43.680 --> 48:50.680]  Well, there was – one of the officers ended up in front of me, and the other one was to my rear.
[48:50.680 --> 48:54.680]  And, you know, I let my emotions overcome me.
[48:54.680 --> 49:06.680]  And I kind of committed one of those – one of Eddie's forbidden things to do and opened my mouth first and asked the cop why he pulled me over.
[49:06.680 --> 49:14.680]  The cop in front of me responded by saying that by radar he caught me at 47 in a 30-mile per hour.
[49:14.680 --> 49:20.680]  Now, I realize, Randy, you're not traffic, but this is going to –
[49:20.680 --> 49:27.680]  I got a question about a criminal complaint here that I want to file on the cop.
[49:27.680 --> 49:32.680]  And so I have to kind of give you a brief as to what happened.
[49:32.680 --> 49:38.680]  You know, at this time I – this whole time I had my video on and I was recording all this.
[49:38.680 --> 49:47.680]  And, you know, my emotions were raging because, as I said, I'm sick and tired of the, you know, state violating my civil rights,
[49:47.680 --> 49:55.680]  violating my rights to due process by, you know, perpetuating this fraud every time they pull me over or pull us all over.
[49:55.680 --> 50:00.680]  And I opened my mouth again and asked, you know, when you guys came – came police officers,
[50:00.680 --> 50:06.680]  did you take a note to swear to uphold the Constitution for the American Union of States?
[50:06.680 --> 50:12.680]  And the guy in front of me or the cop in front of me looked at me as if, you know, if I didn't have my camera on,
[50:12.680 --> 50:17.680]  he was going to school me as to who was in charge of the situation.
[50:17.680 --> 50:25.680]  And neither one of the cops answered the question, but this guy in front of me looked like he was, you know,
[50:25.680 --> 50:33.680]  he was demonstrating a real level of arrogance, you know, as he was displaying his weapon with his hand on it.
[50:33.680 --> 50:39.680]  And the guy behind me or the officer behind me had his hand on his taser.
[50:39.680 --> 50:42.680]  And, you know, I wasn't any threat to these guys.
[50:42.680 --> 50:46.680]  I was just sitting on my bike.
[50:46.680 --> 50:54.680]  And I know that's probably not the right terminology, but, you know, I wasn't any threat.
[50:54.680 --> 51:03.680]  And so the officer that was behind me, he said that if I didn't produce my driver's license, that they were going to arrest me.
[51:03.680 --> 51:11.680]  And that's why, you know, I said that, you know, I will only provide it because I'm under duress.
[51:11.680 --> 51:13.680]  And you guys have loaded weapons.
[51:13.680 --> 51:22.680]  And this guy in front of me has his hand on it in which, you know, I feel it could be construed as a form of assault.
[51:22.680 --> 51:27.680]  Well, you know, I wasn't sure at the time, Randy, if that was correct.
[51:27.680 --> 51:31.680]  But he sure acted really excited when I pointed out that it was on the gun.
[51:31.680 --> 51:34.680]  Did you feel threatened?
[51:34.680 --> 51:36.680]  Yes, I did.
[51:36.680 --> 51:39.680]  That's enough.
[51:39.680 --> 51:46.680]  And I'm a combat veteran and I have been in a combat situation.
[51:46.680 --> 51:48.680]  I've had guns pointed at me.
[51:48.680 --> 51:50.680]  I open carry in the state of Arizona.
[51:50.680 --> 51:52.680]  I own weapons.
[51:52.680 --> 52:01.680]  You know, I feel like if I had my hand on my gun, you know, now I didn't have my gun open at that time.
[52:01.680 --> 52:02.680]  It was concealed.
[52:02.680 --> 52:11.680]  But, you know, if I was open carried, I had my hand on my gun and the officer would say, I think he would probably feel threatened himself.
[52:11.680 --> 52:15.680]  I think a reasonable person of ordinary prudence,
[52:15.680 --> 52:25.680]  when they see another person who is attempting to exert influence over you, who is displaying a deadly weapon
[52:25.680 --> 52:38.680]  and has his hand obviously on the weapon in a stance indicating it is preparatory to pulling the weapon,
[52:38.680 --> 52:44.680]  an ordinary person of reasonable prudence would have cause for concern.
[52:44.680 --> 52:48.680]  Okay.
[52:48.680 --> 52:52.680]  I know I certainly do.
[52:52.680 --> 52:53.680]  Okay.
[52:53.680 --> 52:57.680]  So what did you want to charge the officer with?
[52:57.680 --> 53:08.680]  Well, you know, after that event happened, you know, I started getting in and doing some research.
[53:08.680 --> 53:16.680]  I pulled out what I wanted to charge him with is, and I don't know if I can,
[53:16.680 --> 53:28.680]  but the fact that he was holding on to his weapon, we have a law here in the state of Arizona and it's called misuse of a deadly weapon.
[53:28.680 --> 53:36.680]  And I don't have the statute in front of me, but, you know, I've got the Phoenix Police Operations Order.
[53:36.680 --> 53:38.680]  I found that online.
[53:38.680 --> 53:39.680]  I luckily found it.
[53:39.680 --> 53:52.680]  And in that operations order, you know, it basically describes what these guys are supposed to do as they're approaching the violator's vehicle.
[53:52.680 --> 53:59.680]  Now, there was two cops and now, you know, and it basically reads per batum,
[53:59.680 --> 54:03.680]  officers should use the following steps when approaching the violator's vehicle.
[54:03.680 --> 54:08.680]  And then it says, and I'm just going through this real quick,
[54:08.680 --> 54:15.680]  approach the violator's vehicle slowly with attention on occupants and gun hand free.
[54:15.680 --> 54:20.680]  Now, I know he used the word should use the following steps,
[54:20.680 --> 54:32.680]  but it appears to me that he's possibly violated his own policy guideline because I have this on video, Randy,
[54:32.680 --> 54:36.680]  and there was no threat to the situation whatsoever.
[54:36.680 --> 54:38.680]  I was not a threat to these guys.
[54:38.680 --> 54:40.680]  I just had my video rolling.
[54:40.680 --> 54:45.680]  And I'm almost afraid to think what might have happened if I didn't have my video rolling.
[54:45.680 --> 54:50.680]  So my thoughts are this season's in office.
[54:50.680 --> 54:53.680]  I don't know, you know, failing to perform a duty.
[54:53.680 --> 55:02.680]  You know, he failed to abide by his own policy guidelines to finish police operations order.
[55:02.680 --> 55:08.680]  Hey, John, if you don't mind me breaking in, what you're speaking to is the use of force continuum.
[55:08.680 --> 55:18.680]  You need to go to your state statutes there in Arizona and look up that term, use of force continuum.
[55:18.680 --> 55:23.680]  Read up on that and see what each step is.
[55:23.680 --> 55:28.680]  Here in Texas, it's a five-step process to killing you.
[55:28.680 --> 55:38.680]  Right. You know, okay.
[55:38.680 --> 55:48.680]  There's also a statute concerning, oh, we spoke to it last night about displaying a deadly weapon,
[55:48.680 --> 56:00.680]  and I forgot what an odd term for how you're displaying a weapon.
[56:00.680 --> 56:08.680]  That annoys me that Mr. Theron went back quite quickly in passing, and I didn't have time to ask questions concerning that.
[56:08.680 --> 56:18.680]  But it had to do with carelessly handling a weapon in public.
[56:18.680 --> 56:30.680]  But you might look, read the code. What amounts to assault and what amounts to aggravated assault?
[56:30.680 --> 56:37.680]  Yeah, I don't think I can get him under aggravated assault. I was reading some code last night.
[56:37.680 --> 56:47.680]  Okay. In Texas, we have simple assault. Simple assault is offensive touching or offensive verbiage.
[56:47.680 --> 56:56.680]  If you commit simple assault while prominently displaying a deadly weapon, that makes it aggravated assault.
[56:56.680 --> 56:57.680]  Okay.
[56:57.680 --> 57:10.680]  So if they performed any legal stop in that there was no reasonable probable cause to believe that you were engaged in transportation,
[57:10.680 --> 57:23.680]  and they prominently displayed a deadly weapon, you couldn't resist him. You couldn't tell him to go scratch, get back in your patrol car and hit the road because they had their hands on deadly weapons.
[57:23.680 --> 57:32.680]  In Texas, that's what I was talking to you earlier. That's 2202 B2A is a first degree felony.
[57:32.680 --> 57:45.680]  Our legislators considered that to be extremely important. They made it a first degree felony.
[57:45.680 --> 57:55.680]  These guys should pay attention to that. You're going to have something on that. Look in the assault statutes because that is clearly what this goes to.
[57:55.680 --> 58:00.680]  Maybe the police didn't feel like they were assaulting you. That doesn't matter.
[58:00.680 --> 58:11.680]  How the police caused you to feel, that's what matters. These guys are not just some ordinary citizen walking down the sidewalk.
[58:11.680 --> 58:23.680]  They are individuals exerting or purporting to exert an official capacity in which they could potentially have authority to cause you serious bodily harm.
[58:23.680 --> 58:27.680]  They got to be really, really careful when they do that.

[01:05:23.680 --> 01:05:28.680]  official oppression charges against him for that.
[01:05:28.680 --> 01:05:33.680]  You know, if he did something really outrageous, you know, okay.
[01:05:33.680 --> 01:05:38.680]  The guy was there with him, he had him thrown in jail for contempt.
[01:05:38.680 --> 01:05:41.680]  Not this time, but another time.
[01:05:41.680 --> 01:05:44.680]  And then you can expect some blowback.
[01:05:44.680 --> 01:05:48.680]  But when he tells me to sit down or he'll have me removed from the courtroom
[01:05:48.680 --> 01:05:50.680]  and I sit down and shut up,
[01:05:50.680 --> 01:05:53.680]  he don't expect me to file a judicial conduct complaint against him
[01:05:53.680 --> 01:06:00.680]  and a criminal complaint with a criminal jury because of that.
[01:06:00.680 --> 01:06:04.680]  And when the officer refused to take the complaint and told me that
[01:06:04.680 --> 01:06:10.680]  if you don't have any more business here, you're going to have to leave the courthouse,
[01:06:10.680 --> 01:06:16.680]  he didn't realize that's a criminal act.
[01:06:16.680 --> 01:06:19.680]  Yeah, he don't think it's a big deal.
[01:06:19.680 --> 01:06:24.680]  So when I come back at him with first degree felony aggravated assault for that,
[01:06:24.680 --> 01:06:26.680]  he's going to say, what?
[01:06:26.680 --> 01:06:28.680]  What did I do?
[01:06:28.680 --> 01:06:32.680]  Go explain to a grand jury that you weren't threatening to shoot me
[01:06:32.680 --> 01:06:34.680]  if I didn't leave the courtroom.
[01:06:34.680 --> 01:06:39.680]  I felt like you were threatening to shoot me if I didn't leave the courthouse.
[01:06:39.680 --> 01:06:40.680]  Oh, that's not what you meant?
[01:06:40.680 --> 01:06:43.680]  Well, you should have been clear about that.
[01:06:43.680 --> 01:06:48.680]  You should have been clear that I've got this loaded pistol here on my hip,
[01:06:48.680 --> 01:06:52.680]  but I'm not going to pull it and shoot you with it if you don't do what I tell you to.

[01:06:56.680 --> 01:07:04.680]  And it's really important that we sting them when they don't expect it.
[01:07:04.680 --> 01:07:10.680]  So they're always wondering, what are these guys going to sting me with next?

[01:07:42.680 --> 01:07:45.680]  all the disciplinary actions including their employee responses
[01:07:45.680 --> 01:07:49.680]  to all their disciplinary actions of both those officers.
[01:07:49.680 --> 01:07:55.680]  I did that request down at the, you know, code enforcement unit.
[01:07:55.680 --> 01:07:57.680]  So they've already got that.
[01:07:57.680 --> 01:08:03.680]  I hope they're getting all the, you know, the information for me together.
[01:08:03.680 --> 01:08:10.680]  I've, you know, I also sent in the complaints that I signed
[01:08:10.680 --> 01:08:19.680]  because I signed them under duress and reservation of all rights, UCC 1-308.
[01:08:19.680 --> 01:08:22.680]  And I wrote on the ticket.
[01:08:22.680 --> 01:08:25.680]  Now, Randy, I don't know if this strategy is going to work.
[01:08:25.680 --> 01:08:29.680]  But I wrote on the ticket, I do not accept this offer to contract
[01:08:29.680 --> 01:08:32.680]  and I do not consent to these proceedings.
[01:08:32.680 --> 01:08:38.680]  And I sent it certified mail and used a process server.
[01:08:38.680 --> 01:08:43.680]  And basically I said I was exercising my rights under the Federal Truth
[01:08:43.680 --> 01:08:47.680]  and Lending Act by canceling the contract, you know,
[01:08:47.680 --> 01:08:50.680]  of Arizona traffic ticket and complaints.
[01:08:50.680 --> 01:08:56.680]  And, you know, I did it, I rescinded my consent within three business days
[01:08:56.680 --> 01:09:00.680]  of utilizing the Federal Truth and Lending Act.
[01:09:00.680 --> 01:09:02.680]  Now, I did do that.
[01:09:02.680 --> 01:09:06.680]  I probably, you know, they're probably just going to kick it back and ignore.
[01:09:06.680 --> 01:09:09.680]  And I'm fully expecting that, but...
[01:09:09.680 --> 01:09:11.680]  Okay, of course they are.
[01:09:11.680 --> 01:09:13.680]  And you hope they do.

[01:09:14.680 --> 01:09:19.680]  Part of, when you were talking earlier about how, you know, when they stopped you,

[01:09:28.680 --> 01:09:32.680]  That was my crazy, I used to really be nuts.
[01:09:32.680 --> 01:09:34.680]  I mean, more so than I am now.
[01:09:34.680 --> 01:09:36.680]  I used to have this thing about being challenged.
[01:09:36.680 --> 01:09:39.680]  It made me crazy.
[01:09:39.680 --> 01:09:47.680]  But now when they pull me over, I'm thinking, okay, what can I trap you into?
[01:09:47.680 --> 01:09:51.680]  I've got all these little landmines that I'm going to lay out here in front of you.
[01:09:51.680 --> 01:09:55.680]  Which ones are you going to step on?
[01:09:55.680 --> 01:09:59.680]  And the way I put them out there is I ask you to do stuff.
[01:09:59.680 --> 01:10:02.680]  Now, I never want you to do what I'm asking you to do.
[01:10:02.680 --> 01:10:11.680]  This Officer Dearing, the other day, kept getting more excited because I wasn't getting excited.
[01:10:11.680 --> 01:10:13.680]  I didn't care what he did.
[01:10:13.680 --> 01:10:20.680]  He didn't understand that I did not want him to do what I was asking him to do.
[01:10:20.680 --> 01:10:26.680]  Because if he did what I was asking him to do, he'd ruin everything.
[01:10:26.680 --> 01:10:28.680]  I wanted to jerk his chain.
[01:10:28.680 --> 01:10:41.680]  I wanted to demonstrate that every one of these guys refused to enforce law when the law is to the benefit of the citizen
[01:10:41.680 --> 01:10:49.680]  and the detriment of a public official who's acted improperly, show a pattern of misbehavior.
[01:10:49.680 --> 01:10:55.680]  If they do it right, they screw everything up.
[01:10:55.680 --> 01:11:03.680]  I only ask them to do what the law requires them to do.
[01:11:03.680 --> 01:11:08.680]  So when they don't do what I ask them to do, they violate the law.
[01:11:08.680 --> 01:11:11.680]  That's real easy.
[01:11:11.680 --> 01:11:16.680]  And when they back up through my case, they'll see I've done that at every step.
[01:11:16.680 --> 01:11:24.680]  Once you have walked these guys through this one good time, they are not going to want to go back there.
[01:11:24.680 --> 01:11:26.680]  And they will fight you.
[01:11:26.680 --> 01:11:31.680]  When you fight them, when you take them on this way, they will never ever back down.
[01:11:31.680 --> 01:11:34.680]  They can't.
[01:11:34.680 --> 01:11:36.680]  They get caught with this.
[01:11:36.680 --> 01:11:39.680]  They can't have some pro se kicking their behinds.
[01:11:39.680 --> 01:11:44.680]  They don't care how much of the taxpayers' money they spend.
[01:11:44.680 --> 01:11:48.680]  They're not going to let you kick their behinds.
[01:11:48.680 --> 01:11:51.680]  So we kind of change things up on them.
[01:11:51.680 --> 01:12:00.680]  You need to find out what is the licensing agency for Arizona who licenses, who certifies peace officers.
[01:12:00.680 --> 01:12:02.680]  Okay.
[01:12:02.680 --> 01:12:06.680]  Make a complaint to them and file a suit against them.

[01:15:43.680 --> 01:15:50.680]  When I was at the city of Mansfield, I called the police and this officer showed up and said, you know, we're going to have to step outside.

[01:15:56.680 --> 01:16:01.680]  I said, well, are we going to step out there so you can take my complaints?

[01:34:10.680 --> 01:34:14.680]  who were not allowed to make a record by record,
[01:34:14.680 --> 01:34:17.680]  have access to an accurate transcript,
[01:34:17.680 --> 01:34:25.680]  or make a record in the motions to help the appeal.
[01:34:25.680 --> 01:34:29.680]  So basically, no access to the verbal record,
[01:34:29.680 --> 01:34:35.680]  no access to audio recording, and no access to transcripts.
[01:34:35.680 --> 01:34:37.680]  You know, what do you think?

[01:34:49.680 --> 01:34:53.680]  However, there is something else that's specifically designed
[01:34:53.680 --> 01:35:01.680]  for this kind of issue, and that's a private attorney general suit
[01:35:01.680 --> 01:35:06.680]  where you have several thousand people who are critically injured
[01:35:06.680 --> 01:35:12.680]  over some company's bad drugs.
[01:35:12.680 --> 01:35:15.680]  That's a good vehicle for a class action suit.
[01:35:15.680 --> 01:35:22.680]  But where the amount of harm is relatively small compared to the litigation cost,
[01:35:22.680 --> 01:35:26.680]  that's what a private attorney general suit is for.
[01:35:26.680 --> 01:35:28.680]  Okay.
[01:35:28.680 --> 01:35:36.680]  That is where you take one person who has been harmed by this issue
[01:35:36.680 --> 01:35:42.680]  and sue in his capacity and for all others similarly situated.
[01:35:42.680 --> 01:35:48.680]  Now you can go in and bring in these other people who have been harmed
[01:35:48.680 --> 01:35:54.680]  or mistreated and add their issues to the court,
[01:35:54.680 --> 01:36:00.680]  but you don't have them all engaged as plaintiffs.
[01:36:00.680 --> 01:36:02.680]  In a class action suit, the first thing you're going to do
[01:36:02.680 --> 01:36:05.680]  is come in and try to break apart your class.
[01:36:05.680 --> 01:36:07.680]  Right.
[01:36:07.680 --> 01:36:11.680]  And you've got 50 people in a class action suit,
[01:36:11.680 --> 01:36:14.680]  especially one this small of this nature.
[01:36:14.680 --> 01:36:18.680]  Everybody's going to have their own idea of how it should be handled.
[01:36:18.680 --> 01:36:21.680]  Nobody's going to be happy.
[01:36:21.680 --> 01:36:25.680]  It will be really difficult and unwieldy.
[01:36:25.680 --> 01:36:31.680]  But a private attorney general suit, that's something else.
[01:36:31.680 --> 01:36:32.680]  Julius can...
[01:36:32.680 --> 01:36:35.680]  I've never heard of it.
[01:36:35.680 --> 01:36:36.680]  Okay.
[01:36:36.680 --> 01:36:42.680]  Well, it is not a special legal provision.
[01:36:42.680 --> 01:36:47.680]  It's merely what the courts call this kind of a suit.
[01:36:47.680 --> 01:36:54.680]  You can sue in your own behalf and on the behalf of all others similarly situated.
[01:36:54.680 --> 01:36:57.680]  That's well adjudicated in law,
[01:36:57.680 --> 01:37:00.680]  and that's what they call a private attorney general suit.
[01:37:00.680 --> 01:37:03.680]  You hear all this stuff about, I'm going to be a private attorney general.
[01:37:03.680 --> 01:37:05.680]  There are no private attorney generals.
[01:37:05.680 --> 01:37:06.680]  Right.
[01:37:06.680 --> 01:37:10.680]  There may be something in the Fed that Rod Class knows something about,
[01:37:10.680 --> 01:37:13.680]  specifically in the federal venue,
[01:37:13.680 --> 01:37:18.680]  but as far as the states are concerned, there are no private attorney generals.
[01:37:18.680 --> 01:37:22.680]  There are only private attorney general suits.
[01:37:22.680 --> 01:37:25.680]  So you could do a private attorney general.
[01:37:25.680 --> 01:37:31.680]  Then you can use all of these other people as supporting witnesses,
[01:37:31.680 --> 01:37:34.680]  but you don't have them all engaged in the suit.
[01:37:34.680 --> 01:37:36.680]  Does that make sense?
[01:37:36.680 --> 01:37:37.680]  Yeah.
[01:37:37.680 --> 01:37:38.680]  So can we expect...
[01:37:38.680 --> 01:37:41.680]  Oh, it makes great sense.
[01:37:41.680 --> 01:37:43.680]  Okay.
[01:37:43.680 --> 01:37:45.680]  What do you think the violation is?
[01:37:45.680 --> 01:37:49.680]  Inability to access the record, inability for appeal?
[01:37:49.680 --> 01:37:54.680]  I mean, what do you think these damages exactly are in legal terms?
[01:37:54.680 --> 01:38:00.680]  Well, how much is your liberty worth to you?
[01:38:00.680 --> 01:38:01.680]  No.
[01:38:01.680 --> 01:38:06.680]  I mean, I am also concerned about price and what we could say,
[01:38:06.680 --> 01:38:12.680]  but also what would these exact legal terms of not being able to use a recorder,
[01:38:12.680 --> 01:38:15.680]  not being able to put something in the record that can help appeal...
[01:38:15.680 --> 01:38:20.680]  This is purely due process.
[01:38:20.680 --> 01:38:23.680]  This is a due process tort.
[01:38:23.680 --> 01:38:26.680]  Let me chime in here for a second, Randy.
[01:38:26.680 --> 01:38:31.680]  The JP courts are not courts of record here in the state of Texas.
[01:38:31.680 --> 01:38:33.680]  Most generally, they are not.
[01:38:33.680 --> 01:38:40.680]  That is why if you lose in the JP court,
[01:38:40.680 --> 01:38:46.680]  the form of trial that you get on appeal is a trial de novo.
[01:38:46.680 --> 01:38:51.680]  The trial de novo goes to the county court, and that is a court of record.
[01:38:51.680 --> 01:38:54.680]  And they'll probably tell you that, well, okay,
[01:38:54.680 --> 01:38:56.680]  I'm going to hand you your backside like it or not,
[01:38:56.680 --> 01:38:58.680]  and you can appeal this if you want.
[01:38:58.680 --> 01:38:59.680]  Right.
[01:38:59.680 --> 01:39:03.680]  You would file for trial de novo and then go into a court of record.
[01:39:03.680 --> 01:39:09.680]  But this does not go to a judicial economy.
[01:39:09.680 --> 01:39:13.680]  It kind of clogs things up, doesn't it?
[01:39:13.680 --> 01:39:19.680]  Okay, no, there's another issue about a trial de novo.
[01:39:19.680 --> 01:39:24.680]  And the courts are deliberately misconstruing.
[01:39:24.680 --> 01:39:31.680]  They're saying you can't record this because this is not a court of record,
[01:39:31.680 --> 01:39:34.680]  and you have a right to trial de novo.
[01:39:34.680 --> 01:39:39.680]  And I had a hearing where I was questioning an officer
[01:39:39.680 --> 01:39:44.680]  about his testimony in the original hearing,
[01:39:44.680 --> 01:39:49.680]  and the prosecutor jumped up and said, Jackson, Your Honor, this is trial de novo.
[01:39:49.680 --> 01:39:52.680]  I said, yes, Your Honor, it is trial de novo.
[01:39:52.680 --> 01:40:00.680]  But it is only trial de novo for the purpose of perfecting my appeal.
[01:40:00.680 --> 01:40:09.680]  It is not trial de novo for the purpose of shielding this officer from aggravated perjury charges.
[01:40:09.680 --> 01:40:14.680]  What he said in that original court, he said in that original court,
[01:40:14.680 --> 01:40:18.680]  and trial de novo does not erase it.
[01:40:18.680 --> 01:40:24.680]  And the judge sat there and looked at me a second, and he turned to the prosecutor.
[01:40:24.680 --> 01:40:26.680]  Well, Miss Prosecutor?
[01:40:26.680 --> 01:40:31.680]  Can't withdraw my objection.
[01:40:31.680 --> 01:40:32.680]  Got her.
[01:40:32.680 --> 01:40:38.680]  And that's, you know, the problem with them not allowing us to record that
[01:40:38.680 --> 01:40:45.680]  is now they are free to commit crimes against us that can't be supported.
[01:40:45.680 --> 01:40:49.680]  I've got some men in Austin that are so angry about this,
[01:40:49.680 --> 01:40:53.680]  they're willing to go to jail just on a contempt of court for having a reporter.
[01:40:53.680 --> 01:40:58.680]  And I'm telling anybody out there, you don't need to just have one recorder on your body either,
[01:40:58.680 --> 01:41:01.680]  and you should have court watchers.
[01:41:01.680 --> 01:41:06.680]  That is the issue we need to take.
[01:41:06.680 --> 01:41:14.680]  Anyone who brings in a recorder and is told that they cannot record the courtroom
[01:41:14.680 --> 01:41:16.680]  needs to sue the judge.
[01:41:16.680 --> 01:41:18.680]  We have the case law.
[01:41:18.680 --> 01:41:20.680]  We have the statutory law.
[01:41:20.680 --> 01:41:27.680]  I was at a JP's office in Arlington a couple weeks ago,
[01:41:27.680 --> 01:41:33.680]  and the constable come over and said, you're going to have to turn off that cell phone.
[01:41:33.680 --> 01:41:36.680]  I said, I'm not going to do any such thing.
[01:41:36.680 --> 01:41:40.680]  And the clerk said, well, sir, she pointed to the wall behind me.
[01:41:40.680 --> 01:41:47.680]  I have this policy that says no electronic devices can be turned on in the offices here.
[01:41:47.680 --> 01:41:54.680]  I said, well, you've got your policy and I've got my constitution and specific statute
[01:41:54.680 --> 01:42:01.680]  and some really cool case law so you can use your policy for toilet paper.
[01:42:01.680 --> 01:42:07.680]  And the day before, the few days before when I was there, I had called 911 on them.
[01:42:07.680 --> 01:42:12.680]  So the clerk said, all right, all right.
[01:42:12.680 --> 01:42:16.680]  But they clearly do not have that right.
[01:42:16.680 --> 01:42:21.680]  Maybe that's the way I need to take Julius because he has it on recorder with the judge
[01:42:21.680 --> 01:42:29.680]  in the municipal court like last week or so saying you've got to turn your recorder off.
[01:42:29.680 --> 01:42:31.680]  So maybe that's enough.
[01:42:31.680 --> 01:42:33.680]  You say we've got case law.
[01:42:33.680 --> 01:42:34.680]  Oh, yeah.
[01:42:34.680 --> 01:42:37.680]  Glick, Glick v.
[01:42:37.680 --> 01:42:39.680]  This might be where.
[01:42:39.680 --> 01:42:40.680]  Okay.
[01:42:40.680 --> 01:42:49.680]  This is a recent case out of New Jersey where the court ruled and essentially sui sponte
[01:42:49.680 --> 01:42:55.680]  because this particular issue was not exactly before the court.
[01:42:55.680 --> 01:43:05.680]  What was before the court was a statute that forbid for bad someone to secretly videotape public officials
[01:43:05.680 --> 01:43:10.680]  or secretly record public officials in the performance of their duty.
[01:43:10.680 --> 01:43:13.680]  And they ruled that that was unconstitutional.
[01:43:13.680 --> 01:43:23.680]  But in the process of the ruling, the courts stated that it is well settled in law
[01:43:23.680 --> 01:43:33.680]  that the public has a First Amendment right to record their public officials in the performance of their duty.
[01:43:33.680 --> 01:43:35.680]  That was real clear.
[01:43:35.680 --> 01:43:37.680]  And that wasn't before the court.
[01:43:37.680 --> 01:43:40.680]  They were just simply clarifying that issue.
[01:43:40.680 --> 01:43:43.680]  I guess they felt the issue needed it.
[01:43:43.680 --> 01:43:45.680]  And that was the supreme that did that.
