[00:46.400 --> 00:51.120]  The conservative educational foundation, Judicial Watch, has filed an appeal with the Supreme
[00:51.120 --> 00:56.040]  Court over the release of up to 52 images of Osama Bin Laden's death currently being
[00:56.040 --> 00:57.040]  held by the CIA.
[00:57.040 --> 01:02.520]  The CIA claims the pictures are classified and the release could trigger violence, attacks
[01:02.520 --> 01:05.280]  or acts of revenge against the United States.
[01:05.280 --> 01:10.640]  Shortly after the May 2011 announcement of Osama Bin Laden's death in Pakistan, Judicial
[01:10.640 --> 01:15.080]  Watch filed a Freedom of Information Act request with the government to release the images.
[01:15.080 --> 01:19.520]  The CIA refused, the Judicial Watch sued, and a federal judge as well as an appeals
[01:19.520 --> 01:21.920]  court supported the CIA's claims.
[01:21.920 --> 01:26.160]  The organization is now asking the Supreme Court to overturn the ruling and release the
[01:26.160 --> 01:31.480]  images, including images taken inside the compound in Pakistan where Bin Laden was killed,
[01:31.480 --> 01:38.240]  as well as images of the preparation of Bin Laden's body for burial.
[01:38.240 --> 01:42.900]  After a second wave of hunger strikes began statewide on July 8th, California authorities
[01:42.900 --> 01:47.600]  asked U.S. District Court Judge Thelton E. Henderson to allow the force-feeding of inmates
[01:47.600 --> 01:51.240]  near death, even if they signed Do Not Resuscitate orders.
[01:51.240 --> 01:55.240]  On Monday, Judge Henderson gave an approval to prison officials who claimed that inmates
[01:55.240 --> 01:59.800]  may have been coerced into the hunger strike to protest California's solitary confinement
[01:59.800 --> 02:00.800]  policies.
[02:00.800 --> 02:05.760]  Human rights groups such as Amnesty International have condemned the practice of force-feeding
[02:05.760 --> 02:08.680]  and the conditions in which the prisoners are being held.
[02:08.680 --> 02:16.960]  Approximately 136 inmates are taking part in the statewide hunger strike.
[02:16.960 --> 02:20.880]  According to the Wall Street Journal, the National Security Agency surveillance program
[02:20.880 --> 02:26.160]  is capable of collecting 75 percent of all Internet communications in the United States.
[02:26.160 --> 02:30.880]  Speaking with current and former NSA officials, the journal detailed the programs codenamed
[02:30.880 --> 02:37.040]  Blarney, Fairview, Oak Star, Lithium, and Storm Brew, and the process by which telecommunications
[02:37.040 --> 02:39.320]  companies filter the flow of information.
[02:39.320 --> 02:42.460]  The officials stated that more Americans' Internet communications are collected than
[02:42.460 --> 02:44.000]  publicly disclosed.
[02:44.000 --> 02:48.400]  The NSA also establishes the types of filters and is responsible for policing itself for
[02:48.400 --> 02:51.000]  any possible violations.

[06:11.920 --> 06:18.920]  We are going to discuss the story of Mr. Inimencio Alaniz
[06:18.920 --> 06:20.920]  I hope I'm pronouncing his name right
[06:20.920 --> 06:23.920]  Is that how you pronounce your name, sir?

[06:27.920 --> 06:28.920]  Yes, I'm here
[06:28.920 --> 06:31.920]  Okay, is that how you pronounce your name, Alaniz?

[06:32.920 --> 06:33.920]  Okay, great, excellent
[06:33.920 --> 06:39.920]  Okay, I am going to summarize the story here of Mr. Alaniz
[06:39.920 --> 06:44.920]  And some of y'all may be familiar with his story already
[06:44.920 --> 06:46.920]  This happened a few weeks ago
[06:46.920 --> 06:52.920]  He told his story in full on Gary Johnson's show on Sunday night
[06:52.920 --> 07:01.920]  Of how he was in his home and he heard a disturbance next door at the neighbors
[07:01.920 --> 07:07.920]  And he opened his door, he has a screen door and of course a regular door behind the screen door
[07:07.920 --> 07:13.920]  And he saw his neighbor apparently in some type of altercation with the police
[07:13.920 --> 07:20.920]  She had called 911 because of a domestic disturbance at her home
[07:20.920 --> 07:25.920]  I don't remember exactly what the nature of that was, but she called for help
[07:25.920 --> 07:29.920]  I think maybe she was in some kind of argument with her boyfriend or something like that
[07:29.920 --> 07:31.920]  Inimencio will fill us in on the details
[07:31.920 --> 07:34.920]  I'm just going to paint the overall picture here
[07:34.920 --> 07:40.920]  And when the police arrived, they proceeded to arrest her
[07:40.920 --> 07:44.920]  They asked her if her name was so-and-so and she said yes
[07:44.920 --> 07:49.920]  And they basically told her to turn around and started to put cuffs on her
[07:49.920 --> 07:53.920]  And she was like, well, why are you arresting me? I called you for help
[07:53.920 --> 07:57.920]  And they wouldn't tell her anything of why they were arresting her
[07:57.920 --> 08:04.920]  And they proceeded, they wanted to arrest her daughter and harass her daughter, all kinds of things
[08:04.920 --> 08:07.920]  And again, Inimencio is going to fill us in on all these details
[08:07.920 --> 08:16.920]  And apparently she was trying to fight back and so the police were calling for backup
[08:16.920 --> 08:22.920]  And during all of this, Inimencio is filming this incident from his porch
[08:22.920 --> 08:26.920]  And so one of the police told him, get back in your house
[08:26.920 --> 08:34.920]  So he proceeds to go back in the house, but he has the door still open, watching all of this scene that's going on
[08:34.920 --> 08:40.920]  And then more police show up and then they tell Inimencio, come out of your house
[08:40.920 --> 08:45.920]  And he's like, well, the other police just told me to get back in my house
[08:45.920 --> 08:49.920]  And apparently at some point Inimencio shuts the door
[08:49.920 --> 08:55.920]  Because he's very afraid and concerned about this bizarre scene that's going on
[08:55.920 --> 09:00.920]  And looking like it's starting to become directed his direction, his way
[09:00.920 --> 09:10.920]  And in a series of bizarre events, the police break through his screen door, kick in his door
[09:10.920 --> 09:19.920]  And he's got his hands up in the air and the police officer proceeds to tase Inimencio
[09:19.920 --> 09:23.920]  And they wouldn't even wait for the paramedics to arrive
[09:23.920 --> 09:27.920]  They're just pulling the barbs out before the ambulance arrives
[09:27.920 --> 09:34.920]  And then once he's got chest pains, he's feeling like he's about to have some serious medical issues
[09:34.920 --> 09:36.920]  Because of the tasering, it hurt his heart
[09:36.920 --> 09:42.920]  And the paramedics are wanting to take him for medical treatment
[09:42.920 --> 09:44.920]  Inimencio is wanting to go for medical treatment
[09:44.920 --> 09:51.920]  And at first the police are delaying him, saying, well, no, you can't go yet
[09:51.920 --> 09:55.920]  Telling the paramedics, you can't take Inimencio yet, you can't take this man yet
[09:55.920 --> 09:58.920]  Because we're not sure if he's under arrest or not
[09:58.920 --> 10:01.920]  They're not sure if he's under arrest or not
[10:01.920 --> 10:03.920]  And of course they had handcuffed him and everything
[10:03.920 --> 10:09.920]  So the police tase the man, they handcuff him, he's down on the ground
[10:09.920 --> 10:11.920]  But they're not sure if he's under arrest
[10:11.920 --> 10:15.920]  All right, well, eventually they did let him go to the hospital
[10:15.920 --> 10:18.920]  And then he was released from medical care
[10:18.920 --> 10:28.920]  But then the police proceed to take him to jail for booking, i.e. the mug shots, the fingerprints, the whole nine yards
[10:28.920 --> 10:33.920]  And he's in jail, five hours later
[10:33.920 --> 10:36.920]  Then the cops say, okay, you're released
[10:36.920 --> 10:42.920]  We're going to let you go without charge, sorry
[10:42.920 --> 10:48.920]  And Inimencio's like, well, can I see a judge?
[10:48.920 --> 10:50.920]  I haven't seen the magistrate, I haven't seen the judge
[10:50.920 --> 10:54.920]  I mean, what's going on here? What was I charged with?
[10:54.920 --> 10:55.920]  Why was I even arrested?
[10:55.920 --> 10:56.920]  They didn't tell him nothing
[10:56.920 --> 10:59.920]  Didn't give him any paperwork, nothing
[10:59.920 --> 11:02.920]  Just get out of here, okay?
[11:02.920 --> 11:08.920]  And so then he ends up getting evicted over this incident
[11:08.920 --> 11:13.920]  And I mean, I'm sorry, I'm skipping over a lot of details
[11:13.920 --> 11:15.920]  I'm going to let Mr. Alanis fill us in
[11:15.920 --> 11:21.920]  But I heard this story Sunday night while I was listening to Gary Johnson's show
[11:21.920 --> 11:23.920]  He's one of my hosts, one of the hosts on the network here
[11:23.920 --> 11:28.920]  And I'm just floored, I'm just absolutely flabbergasted
[11:28.920 --> 11:32.920]  It's just like the cops just come busting in, taste some man, okay?
[11:32.920 --> 11:36.920]  Handcuff, oh, we're not even sure if you're under arrest or not
[11:36.920 --> 11:38.920]  Can't go to the hospital, okay, you can't go to the hospital
[11:38.920 --> 11:40.920]  Okay, now you're going to jail
[11:40.920 --> 11:42.920]  And now we're kicking you out of the jail
[11:42.920 --> 11:46.920]  And no paperwork, no nothing, no judge, okay?
[11:46.920 --> 11:49.920]  And then the man gets evicted because of all the brouhaha
[11:49.920 --> 11:53.920]  I mean, you know what, this almost reminds me
[11:53.920 --> 11:56.920]  It does remind me of the passage in the scripture
[11:56.920 --> 12:03.920]  When the Roman soldiers arrested Paul, okay?
[12:03.920 --> 12:07.920]  And I think one of the Lord's other disciples
[12:07.920 --> 12:13.920]  And they were proceeding to beat him and hold them in the stocks and the whole nine yards
[12:13.920 --> 12:17.920]  And then when they found out, oh no, this man is a Roman
[12:17.920 --> 12:23.920]  He has rights and our law is very much based on Roman law
[12:23.920 --> 12:26.920]  If you read the scriptures, there has to be a magistrate
[12:26.920 --> 12:28.920]  There has to be due process
[12:28.920 --> 12:34.920]  You have to be taken directly to a magistrate before you are taken to the jail
[12:34.920 --> 12:39.920]  All these sorts of things, this comes straight out of old school Roman law
[12:39.920 --> 12:43.920]  And then when these Roman soldiers find out, oh, the man is a citizen
[12:43.920 --> 12:46.920]  And we've beaten him and held him and all this stuff
[12:46.920 --> 12:48.920]  Oh no, what are we going to do here?
[12:48.920 --> 12:50.920]  And then the magistrates got scared
[12:50.920 --> 12:56.920]  And they said, okay, they told the jailers, just let him go, just let Paul go
[12:56.920 --> 13:02.920]  And Paul said, hey, you know what, no, okay, no
[13:02.920 --> 13:05.920]  They have beaten us publicly as citizens
[13:05.920 --> 13:08.920]  We are citizens, they have beaten us publicly, they've held us
[13:08.920 --> 13:11.920]  And now they want to secretly release us
[13:11.920 --> 13:16.920]  I don't think so, but rather let the magistrates come and release us themselves
[13:16.920 --> 13:20.920]  And so Paul said, no way, he wasn't going to put up with it
[13:20.920 --> 13:26.920]  And so eventually the magistrates had to come and make a public scene to release them
[13:26.920 --> 13:32.920]  But anyway, unfortunately, this was not the case with Mr. Alanis
[13:32.920 --> 13:36.920]  They tased the man, all this brouhaha
[13:36.920 --> 13:40.920]  And then hold him in the jail, never charged with anything
[13:40.920 --> 13:45.920]  And then release him secretly, just like they tried to do to Paul, kick him out of the jail
[13:45.920 --> 13:49.920]  Get out of here and never mind
[13:49.920 --> 13:52.920]  It's just like these police, they're so rogue
[13:52.920 --> 13:57.920]  It's just like the second set of police that arrived for backup
[13:57.920 --> 14:02.920]  Because this woman was basically fighting against this arrest
[14:02.920 --> 14:07.920]  And we'll get to that later, what the details were about that
[14:07.920 --> 14:11.920]  But these cops come in there just like, oh, we just got to tase everybody
[14:11.920 --> 14:14.920]  And handcuff everybody and throw everybody in jail
[14:14.920 --> 14:16.920]  And then we'll sort it all out later
[14:16.920 --> 14:20.920]  I'm sorry, but that just don't fly with me
[14:20.920 --> 14:23.920]  That made me so mad when I was hearing this story
[14:23.920 --> 14:26.920]  And I said, we've got to get Mr. Alanis on the air
[14:26.920 --> 14:28.920]  And we've got to get Michael Cargill on the air too
[14:28.920 --> 14:32.920]  He was also a guest and he's got some issues with this too
[14:32.920 --> 14:35.920]  Related to gun ownership
[14:35.920 --> 14:39.920]  And it turns out Mr. Alanis has a concealed handgun license
[14:39.920 --> 14:46.920]  And there was issues involving his gun ownership, involving the eviction
[14:46.920 --> 14:53.920]  So we're going to go to Mr. Alanis now to kind of fill in some of these details
[14:53.920 --> 15:00.920]  Mr. Alanis, I hope I did a mostly accurate synopsis of what happened
[15:00.920 --> 15:05.920]  Can you please explain and fill us in some more on what happened
[15:05.920 --> 15:08.920]  Was that mostly a good summary there?
[15:08.920 --> 15:12.920]  You did a very good job explaining the story
[15:12.920 --> 15:13.920]  Okay
[15:13.920 --> 15:16.920]  Yes, that's very accurate
[15:16.920 --> 15:23.920]  Just also, as you were saying, when the first responding officer came on scene
[15:23.920 --> 15:27.920]  He had his taser out, a taser
[15:27.920 --> 15:32.920]  Now, as soon as I had walked out on my porch
[15:32.920 --> 15:35.920]  Figuring out what was going on while I was there yelling
[15:35.920 --> 15:37.920]  Like I said, I'm a concerned neighbor
[15:37.920 --> 15:42.920]  I make sure everything was okay, so I just went out onto my porch
[15:42.920 --> 15:45.920]  I noticed that my neighbor was still on the phone with a dispatch
[15:45.920 --> 15:48.920]  But then this is the same exact moment
[15:48.920 --> 15:52.920]  The first responding officer comes around the building with his taser drawn
[15:52.920 --> 15:55.920]  And runs straight up to my neighbor and asks her
[15:55.920 --> 15:57.920]  I mean, he tells her her name, is that your name?
[15:57.920 --> 16:00.920]  And she says yes, and then as soon as she says yes
[16:00.920 --> 16:02.920]  He says, put your hands behind your back
[16:02.920 --> 16:04.920]  Pointing the taser at her now
[16:04.920 --> 16:06.920]  So she starts like, what?
[16:06.920 --> 16:09.920]  Hold on, why am I being put under arrest?
[16:09.920 --> 16:12.920]  She don't understand, so she has a daughter with her
[16:12.920 --> 16:19.920]  And like 10 seconds pass as she starts trying to figure out why she's being put under arrest
[16:19.920 --> 16:22.920]  The second responding officer arrives on scene with video
[16:22.920 --> 16:27.920]  And now as he can see everything
[16:27.920 --> 16:29.920]  He gets out of the car and runs up to the daughter
[16:29.920 --> 16:31.920]  By the time he had showed up on scene
[16:31.920 --> 16:36.920]  The daughter had started yelling as to not know why her mother was being put under arrest
[16:36.920 --> 16:42.920]  And then it just so happened that the cop started detaining her
[16:42.920 --> 16:44.920]  Or pinning her under arrest
[16:44.920 --> 16:47.920]  And she started fighting the cop as to not knowing why she's being put under arrest
[16:47.920 --> 16:50.920]  Okay, wait, hold on, we're about to go to break

[21:44.920 --> 21:54.920]  And like I said, I'm sitting on my porch, the cops are still trying to get my neighbors under arrest for some reason I can say
[21:54.920 --> 22:02.920]  And also like about 40 more seconds passed or 30 more seconds or I would say just about a minute
[22:02.920 --> 22:07.920]  More officers come from around my building and more officers are showing up on scene
[22:07.920 --> 22:11.920]  After the first or second responding cop said step it up over the radio
[22:11.920 --> 22:14.920]  And he got all his fellow officers to show up quick
[22:14.920 --> 22:20.920]  Now one of them officers that just responded told me to get inside, he gave me a request to get inside
[22:20.920 --> 22:25.920]  And like I said, I haven't committed no crime, if I haven't committed no crime I don't have to actually get off my porch
[22:25.920 --> 22:28.920]  Because I'm not engaged in any kind of criminal activity as far as I know
[22:28.920 --> 22:36.920]  I'm not interfering with y'all in the next yard over me and that's all on video
[22:36.920 --> 22:41.920]  And so I go inside, I agree with his request and I go inside, I step inside
[22:41.920 --> 22:47.920]  And as I step inside my screen door is closing behind me and more officers arrive on the scene
[22:47.920 --> 22:51.920]  Now one of the officers that just arrived on my scene as my door shut behind me
[22:51.920 --> 22:55.920]  Now I'm on the inside of my house watching through my screen the scene
[22:55.920 --> 23:00.920]  He barely sees me just standing there, I wouldn't even say it took that long for him to see me
[23:00.920 --> 23:09.920]  And he tells me to get the F back outside, to come outside and I'm looking at him in confusion
[23:09.920 --> 23:15.920]  I was just told to go inside, I told him, as far as I know he's been telling me to go back outside
[23:15.920 --> 23:18.920]  I don't have to go outside, I mean yes there's a request and all that stuff
[23:18.920 --> 23:22.920]  But it's just a request because like I said I haven't been engaged in any kind of criminal activity
[23:22.920 --> 23:24.920]  As far as I know I could have shut my door and that was that
[23:24.920 --> 23:30.920]  And he should have asked the fellow officers, the responding officers, is he part of it?
[23:30.920 --> 23:34.920]  Did he have any part of this or is he a criminal or something like that?
[23:34.920 --> 23:37.920]  And it was nothing like that
[23:37.920 --> 23:41.920]  So as far as I know for him coming to my house and doing all that
[23:41.920 --> 23:43.920]  Let me get back to this a little bit
[23:43.920 --> 23:49.920]  So he tells me to come back outside and like I said I'm just standing in confusion and not knowing what to do
[23:49.920 --> 23:53.920]  It didn't even take more than two seconds for him to run at my door
[23:53.920 --> 23:57.920]  And as he ran at my door he had to take the point of that door
[23:57.920 --> 24:03.920]  And he grabs the front door and like I said I haven't locked my gate, I haven't done any of that
[24:03.920 --> 24:05.920]  Which I could have
[24:05.920 --> 24:09.920]  And he starts jiggling the door as if the door is locked or broke or something
[24:09.920 --> 24:14.920]  But my door is fine and as far as I know he kicks in my bottom screen
[24:14.920 --> 24:16.920]  I've got two screens on my door and he kicks in the bottom
[24:16.920 --> 24:18.920]  Okay no wait a minute, wait a minute, back up for a second
[24:18.920 --> 24:23.920]  Okay you were watching this scene, your screen door was closed
[24:23.920 --> 24:25.920]  But you were standing behind the screen door
[24:25.920 --> 24:31.920]  He tells you to come out and get the F out is what he said of the house

[24:35.920 --> 24:41.920]  Did you at that point decide to close your inside door and just forget about this whole scene?

[25:39.920 --> 25:43.920]  And like I said I closed the door out of fear because I'm not understanding why this cop is doing this

[25:45.920 --> 25:47.920]  As far as standing on my porch

[25:50.920 --> 25:52.920]  And if it wasn't going to be her calling the cops
[25:52.920 --> 25:54.920]  I most likely would have called the cops

[28:57.920 --> 29:01.920]  But I had my hands up already in the air and he tasers me
[29:01.920 --> 29:07.920]  I fall to the ground and the capacity takes me and is shocking me
[29:07.920 --> 29:13.920]  And it was longer than five seconds I felt and that was the whole scene right there

[29:17.920 --> 29:19.920]  And you could still hear the commotion going on outside
[29:19.920 --> 29:23.920]  And then that's when they dropped the knee on me and handcuffed

[36:06.940 --> 36:09.220]  and nobody could tell me why I'm being put under arrest
[36:09.220 --> 36:11.260]  or what's my offense or what my charges are.
[36:11.260 --> 36:12.740]  Everybody just keeps saying, we don't know yet,

[36:24.900 --> 36:28.220]  he already kind of like, damn, there's nothing I could do,

[36:49.540 --> 36:51.700]  on the rail looking as a criminal or not,
[36:51.700 --> 36:53.020]  or they're gonna treat me right,
[36:53.020 --> 36:54.980]  and they keep telling them, well, we don't know
[36:54.980 --> 36:56.580]  what he's, we don't know what's charged here,

[37:05.260 --> 37:07.620]  but it still took them like five or 10 minutes to do so,
[37:07.620 --> 37:09.340]  and that's all on video, so anyways,
[37:09.340 --> 37:14.220]  the cops ask him, so anyways, they tell him
[37:14.220 --> 37:16.980]  I finally arrested, they come up to me and say,
[37:16.980 --> 37:19.380]  well, you're being charged with just a city,
[37:19.380 --> 37:21.860]  I think he said city ordinance violation, that was it,
[37:21.860 --> 37:23.540]  and I tried to ask him, is that a misdemeanor felony,
[37:23.540 --> 37:25.340]  or what is that, you're not saying that to me,
[37:25.340 --> 37:28.180]  and then that's when the ambulance starts talking to them,
[37:28.180 --> 37:30.380]  gets them all confused or whatever,
[37:30.380 --> 37:32.460]  then that's when I tell them I want to go to the hospital,
[37:32.460 --> 37:35.940]  so they hook me up, strap me out there,
[37:35.940 --> 37:37.580]  we go to the hospital, we get to the hospital,
[37:37.580 --> 37:41.140]  and they check my finger out and everything, I'm fine,
[37:41.140 --> 37:44.580]  so I leave the hospital, I go to Central Brooklyn,

[37:46.140 --> 37:49.700]  the officer finally tells me, oh yeah,

[38:00.420 --> 38:02.260]  yeah, I got taken for that C too,
[38:02.260 --> 38:05.100]  and he goes, what, you got taken for a Class C?
[38:05.100 --> 38:07.660]  Yeah, but they never could, but they wouldn't tell you

[47:27.100 --> 47:35.100]  And as it turns out, he was just telling us on the break this search was conducted without his permission.
[47:35.100 --> 47:40.100]  And while he was not present, they told him they were going to search the home.
[47:40.100 --> 47:43.100]  He objected to it, and he said, well, if you're going to do it anyway,
[47:43.100 --> 47:50.100]  I want to watch to make sure y'all don't plant anything, any illegal contraband in my house, and they wouldn't let him watch either.

[48:04.100 --> 48:13.100]  And so all of this brouhaha, and now you have to change into jail clothes over a Class C misdemeanor of a city ordinance

[48:16.100 --> 48:24.100]  And now the reason that you have to put on the jail clothes is because there was a gun involved in this incident.

[48:29.100 --> 48:34.100]  Okay, but the gun was not involved in the incident, for one thing.

[49:10.100 --> 49:14.100]  So now after the officer tells me about the gun, that's why they had to change me out.

[49:16.100 --> 49:22.100]  I go in and sit, and I go see the nurse, but then also I go sit in the way, whatever they call it, the booking room.
[49:22.100 --> 49:24.100]  And they call me up for my fingerprints.
[49:24.100 --> 49:28.100]  They call me up for my mugshot, and they get all my new information down and everything.
[49:28.100 --> 49:32.100]  And then I'm waiting to see the judge.
[49:32.100 --> 49:35.100]  I want to sit there and explain to him what happened and everything like that.
[49:35.100 --> 49:38.100]  And then, you know, CV, you know, if he understands what's going on.
[49:38.100 --> 49:44.100]  And I sit there for five and a half hours, and then that's when an officer comes up to me and just says, excuse me, Inamensio Rodney.
[49:44.100 --> 49:45.100]  And I say, yeah.
[49:45.100 --> 49:47.100]  And he goes, can you come with me?
[49:47.100 --> 49:50.100]  And then so I get up, and I go with him, and I thought, you know, I was going to see the judge and everything.
[49:50.100 --> 49:52.100]  And we walk past the judge's door.
[49:52.100 --> 49:55.100]  We walk past the dress-out room to go upstairs.
[49:55.100 --> 50:02.100]  And like if you're really staying there and booking, and we're going towards the exit door, it's like the release computer room and other.
[50:02.100 --> 50:05.100]  And I asked him, what's going on?
[50:05.100 --> 50:06.100]  He said, the judge released you.
[50:06.100 --> 50:08.100]  And I said, I want to see the judge.
[50:08.100 --> 50:09.100]  I'm trying to see that.
[50:09.100 --> 50:11.100]  You know, I'm trying to see the judge, to be honest with you.
[50:11.100 --> 50:14.100]  And he goes, well, you know, he pointed out a paper on top of a paper.
[50:14.100 --> 50:17.100]  And he said, there goes the judge's signature right there.
[50:17.100 --> 50:25.100]  And he goes, he either didn't agree with the police report or he didn't agree or the police officer didn't finish his report.
[50:25.100 --> 50:30.100]  Now, all that time, he had all the time to finish his report because he changed me and did all that stuff coming to my home company.
[50:30.100 --> 50:31.100]  Okay, wait a minute.
[50:31.100 --> 50:41.100]  So it was an either-or situation, and this officer didn't know that it was either the police officer hadn't finished his report or the judge didn't agree with it?

[50:42.100 --> 50:44.100]  Yes, all the judges didn't agree with it.
[50:44.100 --> 50:48.100]  Okay, and so he points to this paper and says, here's the judge's signature.

[51:06.100 --> 51:10.100]  You know, I got paid and he goes, he just looks at me and like shows his shoulder.

[53:08.100 --> 53:11.100]  And then it's pertaining me, but they didn't put that on the paperwork.
[53:11.100 --> 53:15.100]  And then the lady says, excuse me, you just got to take them off the lease.
[53:15.100 --> 53:17.100]  She tells my mom exactly that.
[53:17.100 --> 53:20.100]  And then they should know, well, you know, that's how you got to tell them since then.
[53:20.100 --> 53:21.100]  And what's your proof?
[53:21.100 --> 53:23.100]  So then they should know, well, my mom goes for what?
[53:23.100 --> 53:29.100]  And she goes, I got a police report right here saying that there was a loaded firearm in your house involved in a criminal activity.
[53:29.100 --> 53:32.100]  And then she said, basically a deadly weapon, a round of deadly weapon.
[53:32.100 --> 53:34.100]  Whoa, wait a minute.
[53:34.100 --> 53:35.100]  Wait a minute.
[53:35.100 --> 53:36.100]  Hold on.
[53:36.100 --> 53:38.100]  The police report that nobody can get a hold of?
[53:38.100 --> 53:47.100]  The police report that they won't give to you and that they won't give to Michael Cargill and that they won't give to Infowars, but your landlord got it?

[54:17.100 --> 54:20.100]  And then she tells me, well, I'm only relaying the message to somebody else.
[54:20.100 --> 54:22.100]  And then we're all like, well, where's that lady at?
[54:22.100 --> 54:24.100]  Why can't she be here doing all these things?
[54:24.100 --> 54:26.100]  And things weren't just going right.
[54:26.100 --> 54:32.100]  So I got basically evicted from my house for they say the use of a deadly weapon basically.

[54:40.100 --> 54:45.100]  Did they put this in writing what the reason was that you were getting evicted or was this just all verbal?

[55:24.100 --> 55:35.100]  And this was a completely, some kind of administrative bungle that these officers were acting on what they thought was a valid warrant.
[55:35.100 --> 55:38.100]  But it ended up she really didn't have a warrant.
[55:38.100 --> 55:39.100]  It was taken care of.
[55:39.100 --> 55:42.100]  Is that correct, NMNCO?
[55:42.100 --> 55:51.100]  Yes. As far as I know, that's what she had told me in her words that the warrant was old or something that was already taken care of
[55:51.100 --> 55:58.100]  and basically how they arrested her and all that stuff because the issues she had, you know, it was all wrong.
[55:58.100 --> 56:00.100]  It was all wrong how they went about acting.
[56:00.100 --> 56:03.100]  Do you know what this warrant was supposed to have been about?
[56:03.100 --> 56:05.100]  I'm not too sure to be honest with you.
[56:05.100 --> 56:06.100]  Okay.
[56:06.100 --> 56:09.100]  But the bottom line is they didn't tell her about why they were arresting her.
[56:09.100 --> 56:12.100]  They didn't say, we're arresting you because of an outstanding warrant.
[56:12.100 --> 56:14.100]  They didn't say anything to her, right?
[56:14.100 --> 56:23.100]  Well, as soon as she had said, gave him her name, he just already had touched her and said, put your hands behind her back
[56:23.100 --> 56:26.100]  with the tape in the opposite hand, and then that's when he goes up.
[56:26.100 --> 56:27.100]  Okay, okay.
[56:27.100 --> 56:29.100]  One more question, one more question.
[56:29.100 --> 56:37.100]  You were saying on Gary's show the other night something about they ended, she ended up being in jail for like five days or something?
[56:37.100 --> 56:39.100]  Or was it almost two weeks?
[56:39.100 --> 56:40.100]  Seven days.
[56:40.100 --> 56:41.100]  Seven days, okay.
[56:41.100 --> 56:47.100]  It was seven days and they ended up paying, the police department ended up paying her $700 a day
[56:47.100 --> 56:50.100]  for every day that they held her in jail, mistakenly.

[56:52.100 --> 56:57.100]  They paid her $100 a day or compensated her for the seven days she was in jail.
[56:57.100 --> 57:00.100]  Okay, so it was $700 total and they paid her $100.
[57:00.100 --> 57:03.100]  But she obviously, did that happen right away?
[57:03.100 --> 57:06.100]  I mean, did she file a lawsuit against them for this or did they just volunteer the money?
[57:06.100 --> 57:12.100]  They already volunteered the money, like compensated her, but she's still going through the little process to get everything done.
[57:12.100 --> 57:14.100]  Yeah, and you know what?
[57:14.100 --> 57:20.100]  Most likely, if she signed for the money, there's probably a clause in there that said that this is a settlement
[57:20.100 --> 57:22.100]  and that means that she's not, probably won't be able to sue them.

[57:25.100 --> 57:28.100]  Oh, yes she can.

[01:00:55.100 --> 01:00:57.100]  currently being held by the CIA.
[01:00:57.100 --> 01:01:00.100]  The CIA claims the pictures are classified,
[01:01:00.100 --> 01:01:05.100]  and their release could trigger violence, attacks, or acts of revenge against the United States.
[01:01:05.100 --> 01:01:10.100]  Shortly after the May 2011 announcement of Osama bin Laden's death in Pakistan,
[01:01:10.100 --> 01:01:13.100]  Judicial Watch filed a Freedom of Information Act request
[01:01:13.100 --> 01:01:15.100]  with the government to release the images.
[01:01:15.100 --> 01:01:18.100]  The CIA refused, the Judicial Watch sued, and a federal judge,
[01:01:18.100 --> 01:01:22.100]  as well as an appeals court, supported the CIA's claims.
[01:01:22.100 --> 01:01:27.100]  The organization is now asking the Supreme Court to overturn the ruling and release the images,
[01:01:27.100 --> 01:01:31.100]  including images taken inside the compound in Pakistan where bin Laden was killed,
[01:01:31.100 --> 01:01:38.100]  as well as images of the preparation of bin Laden's body for burial.
[01:01:38.100 --> 01:01:42.100]  After a second wave of hunger strikes began statewide on July 8,
[01:01:42.100 --> 01:01:46.100]  California authorities asked U.S. District Court Judge Thelton E. Henderson
[01:01:46.100 --> 01:01:48.100]  to allow the force-feeding of inmates near death,
[01:01:48.100 --> 01:01:51.100]  even if they signed do not resuscitate orders.
[01:01:51.100 --> 01:01:54.100]  On Monday, Judge Henderson gave an approval to prison officials
[01:01:54.100 --> 01:01:57.100]  who claimed that inmates may have been coerced into the hunger strike

[01:02:01.100 --> 01:02:06.100]  Human rights groups such as Amnesty International have condemned the practice of force-feeding

[01:02:17.100 --> 01:02:21.100]  According to the Wall Street Journal, the National Security Agency's surveillance program
[01:02:21.100 --> 01:02:26.100]  is capable of collecting 75 percent of all Internet communications in the United States.
[01:02:26.100 --> 01:02:30.100]  Speaking with current and former NSA officials, the journal detailed the programs,
[01:02:30.100 --> 01:02:35.100]  codenamed Blarney, Fairview, Oak Star, Lithium, and Storm Brew,

[01:09:18.100 --> 01:09:27.100]  Well, he's being evicted because the firearm, deadly weapon was used in a crime on the premises
[01:09:27.100 --> 01:09:35.100]  Is there any laws that would give a landlord grounds to evict if indeed that was true?
[01:09:35.100 --> 01:09:39.100]  If that was true, it would have to be in the lease
[01:09:39.100 --> 01:09:43.100]  And it's got to say in the lease that he's not allowed to have a firearm inside the home
[01:09:43.100 --> 01:09:48.100]  You know, and they have this little fancy wording of deadly weapon and all this other kind of stuff
[01:09:48.100 --> 01:09:51.100]  There's nothing in the Texas Pinnacle that's talking about a deadly weapon
[01:09:51.100 --> 01:09:54.100]  No, that's not what I mean, not about owning, I'm talking about the use
[01:09:54.100 --> 01:10:03.100]  Like if there was, if he had, if a tenant used a firearm in a crime on the premises
[01:10:03.100 --> 01:10:09.100]  Would that be grounds for eviction if that was the case?

[01:20:44.100 --> 01:20:51.100]  Because all kinds of evidence have already been presented against you ex parte to the magistrate

[01:20:53.100 --> 01:20:59.100]  All kinds of things like that, the standard fare, all right, that we've always been talking about

[01:21:41.100 --> 01:21:48.100]  So they came out, this woman calls the police, she is the victim
[01:21:48.100 --> 01:21:54.100]  She calls 911, the police come out
[01:21:54.100 --> 01:22:04.100]  Inimencio, did you observe the police address the issue for which the woman called in the complaint
[01:22:04.100 --> 01:22:06.100]  Not at all
[01:22:06.100 --> 01:22:10.100]  Okay, that's official misconduct
[01:22:10.100 --> 01:22:14.100]  They failed to perform a duty they were required to perform
[01:22:14.100 --> 01:22:18.100]  The fact that there may or may not have been a warrant for her arrest
[01:22:18.100 --> 01:22:23.100]  Is not relevant to the fact that she called 911 and was the victim
[01:22:23.100 --> 01:22:31.100]  So here instead of addressing her issue and providing for her the equal protection of the law
[01:22:31.100 --> 01:22:35.100]  They took action against her
[01:22:35.100 --> 01:22:39.100]  That's kind of subtle but we'll go to better ones

[01:22:41.100 --> 01:22:49.100]  The policeman based on the existence of the warrant can claim good faith, reliance on competent authority
[01:22:49.100 --> 01:22:56.100]  The daughter, did they arrest the daughter
[01:22:56.100 --> 01:22:59.100]  They did for resisting arrest
[01:22:59.100 --> 01:23:02.100]  He said yes for resisting arrest
[01:23:02.100 --> 01:23:06.100]  They arrested her for resisting arrest, that's redundant
[01:23:06.100 --> 01:23:08.100]  Okay, yeah, that's
[01:23:08.100 --> 01:23:10.100]  They can't arrest her for
[01:23:10.100 --> 01:23:12.100]  For resisting arrest
[01:23:12.100 --> 01:23:14.100]  They would have had to have charged her with something
[01:23:14.100 --> 01:23:22.100]  Now she's yelling and shouting at them and demanding to know why they're arresting her mother
[01:23:22.100 --> 01:23:29.100]  Then what they would almost certainly call that was interfering with a public servant
[01:23:29.100 --> 01:23:36.100]  Problem, you cannot interfere with a public servant verbally
[01:23:36.100 --> 01:23:38.100]  That is in the code

[01:23:39.100 --> 01:23:43.100]  And these officers would have known that
[01:23:43.100 --> 01:23:47.100]  So in order to charge for resisting arrest
[01:23:47.100 --> 01:23:53.100]  There would have had to have been a valid charge to arrest in the first place
[01:23:53.100 --> 01:23:59.100]  So that becomes false arrest, false imprisonment
[01:23:59.100 --> 01:24:05.100]  I didn't say, I don't want to say false imprisonment because that is the tort
[01:24:05.100 --> 01:24:09.100]  False imprisonment is not a crime, false imprisonment is a tort

[01:24:56.100 --> 01:25:04.100]  It matters if a reasonable person of ordinary prudence would find that offensive

[01:25:10.100 --> 01:25:13.100]  And I touch him, that wouldn't necessarily be an assault
[01:25:13.100 --> 01:25:18.100]  But a reasonable person of ordinary prudence is always the standard

[01:25:24.100 --> 01:25:29.100]  And using profanity is a specific crime
[01:25:29.100 --> 01:25:33.100]  If a police officer uses profanity, that's a crime

[01:33:42.100 --> 01:33:49.100]  And this is a republic, you're the CEO, all of these public officials work for you
[01:33:49.100 --> 01:33:53.100]  And they may only do what you have authorized them to do
[01:33:53.100 --> 01:33:58.100]  You have had put in place these laws that make it a crime
[01:33:58.100 --> 01:34:04.100]  For a public official to exert or purport to exert an authority he does not specifically have
[01:34:04.100 --> 01:34:14.100]  And I can tell you, breaking down the door of a private home in the United States is one really big deal
[01:34:14.100 --> 01:34:25.100]  Once you break that door, you are subject to criminal prosecution and civil litigation for everything you do
[01:34:25.100 --> 01:34:33.100]  They kicked his door down, then they physically attacked him with a taser
[01:34:33.100 --> 01:34:38.100]  A taser is a deadly weapon, that was a near-death experience
[01:34:38.100 --> 01:34:43.100]  You could die from that darn thing, and we have, I heard this statistic recently
[01:34:43.100 --> 01:34:49.100]  But it was a very large number of people were dying from being tasers, they tried to kill you
[01:34:49.100 --> 01:34:57.100]  And then they, after they arrested you and took you out of your private home, they rummaged through your home
[01:34:57.100 --> 01:34:59.100]  You don't know what they took out of your home
[01:34:59.100 --> 01:35:04.100]  Did you go through and inventory your house to see what may be missing?
[01:35:04.100 --> 01:35:06.100]  No, I didn't
[01:35:06.100 --> 01:35:09.100]  Yes, so you don't know what may be missing

[01:35:35.100 --> 01:35:42.100]  Did you observe the office or make a due diligence effort to locate a magistrate?
[01:35:42.100 --> 01:35:45.100]  Yes, I did
[01:35:45.100 --> 01:35:58.100]  Okay, when you said that an officer told you that the magistrate released you, how the hell did he do that?
[01:35:58.100 --> 01:36:02.100]  I'm sorry, how the heck did he do that?
[01:36:02.100 --> 01:36:08.100]  You know, when you go before a magistrate, you know, one of the questions I have people ask the magistrate
[01:36:08.100 --> 01:36:13.100]  And this is one I asked the magistrate when they arrested me in Williams County
[01:36:13.100 --> 01:36:17.100]  They convened a hearing, they bring me up in front of the judge
[01:36:17.100 --> 01:36:19.100]  And I said, your honor, I have a question
[01:36:19.100 --> 01:36:21.100]  He said, well, what's that, Mr. Kelton?
[01:36:21.100 --> 01:36:24.100]  You have a folder there in front of you
[01:36:24.100 --> 01:36:27.100]  Does it have any information about me?
[01:36:27.100 --> 01:36:30.100]  Well, yes, Mr. Kelton, it does
[01:36:30.100 --> 01:36:33.100]  Where did you get that?
[01:36:33.100 --> 01:36:38.100]  And this magistrate was also a lawyer and he knew exactly where I was going
[01:36:38.100 --> 01:36:49.100]  Who entered evidence into this hearing when I wasn't present and didn't have opportunity to object to the evidence?
[01:36:49.100 --> 01:36:52.100]  He held an ex parte hearing
[01:36:52.100 --> 01:37:01.100]  While I'm being held in jail, he holds a hearing with these officers and makes a determination of probable cause
[01:37:01.100 --> 01:37:03.100]  That's criminal
[01:37:03.100 --> 01:37:07.100]  That's criminal on part of the magistrate
[01:37:07.100 --> 01:37:12.100]  And when you go after the magistrate, the magistrate is going to get real excited about that
[01:37:12.100 --> 01:37:17.100]  Happens every single time anyone is arrested
[01:37:17.100 --> 01:37:25.100]  The best one to go after is the one who actually thinks he's doing everything right
[01:37:25.100 --> 01:37:30.100]  And these magistrates, they don't have a clue as to what's going on
[01:37:30.100 --> 01:37:41.100]  When you come after him for doing what he does every day, day in, day out, he's going to say, holy crapola
[01:37:41.100 --> 01:37:44.100]  Okay, Randy, this brings me to a question concerning this magistrate
[01:37:44.100 --> 01:37:50.100]  Number one, NMNCO doesn't even know who it is because he never got any paperwork from the jail
[01:37:50.100 --> 01:37:57.100]  And furthermore, what that officer told him in the jail upon release, that could be a total lie
[01:37:57.100 --> 01:38:04.100]  This case may not have ever even come before any magistrate inside that jail
[01:38:04.100 --> 01:38:10.100]  The police, the jailers may have just realized, oops, we made a boo-boo
[01:38:10.100 --> 01:38:17.100]  And decided to just release him before anything ever even got to any magistrates
[01:38:17.100 --> 01:38:20.100]  And number one, he doesn't know what magistrate it is, who he's supposed to go after
[01:38:20.100 --> 01:38:26.100]  And so this brings me to the point about getting information out of the police about what happened
[01:38:26.100 --> 01:38:31.100]  And not only about who this magistrate was, if there was even a magistrate
[01:38:31.100 --> 01:38:36.100]  We need to get the paperwork from the jail, okay, we need to also get the police report
[01:38:36.100 --> 01:38:42.100]  And this goes to some events that have already transpired in this case concerning the fact that
[01:38:42.100 --> 01:38:49.100]  Michael Cargill tried to get the police report concerning the incident of the tasing and the arrest
[01:38:49.100 --> 01:38:55.100]  And Michael, isn't it true that they told you, sorry, they can't give it to you because it was restricted
[01:38:55.100 --> 01:38:57.100]  Is that correct?
[01:38:57.100 --> 01:39:00.100]  That is correct, we could not get it because it was restricted
[01:39:00.100 --> 01:39:06.100]  And I also had Alex Jones show, those people go over there to the police APD and ask for the same record as well
[01:39:06.100 --> 01:39:10.100]  And they were told the same thing, that it was also restricted
[01:39:10.100 --> 01:39:14.100]  So then I went to get, I went to get Indimentio, I went to Indimentio
[01:39:14.100 --> 01:39:17.100]  I want you to get a copy of your own police report
[01:39:17.100 --> 01:39:22.100]  And he was even denied getting a copy of his own police report because it was restricted
[01:39:22.100 --> 01:39:25.100]  Okay, here's the trick for that
[01:39:25.100 --> 01:39:31.100]  When they say it's restricted, you dial 911
[01:39:31.100 --> 01:39:36.100]  There is nothing more fun than calling the police on the police
[01:39:36.100 --> 01:39:40.100]  Yeah, what about, but they're inside the police station, you call 911
[01:39:40.100 --> 01:39:44.100]  That's even better, you call the sheriff's department
[01:39:44.100 --> 01:39:46.100]  I didn't even come down here and arrest you
[01:39:46.100 --> 01:39:49.100]  Hey you, what did you say your name was?
[01:39:49.100 --> 01:39:53.100]  The sheriff's department is better, yeah
[01:39:53.100 --> 01:39:57.100]  If you're at the city police department, then you call the sheriff's department
[01:39:57.100 --> 01:40:04.100]  Okay, and what is the crime when you call the sheriff's department, when you're at the police station asking to see the police report
[01:40:04.100 --> 01:40:08.100]  And they refuse to give it, they say it's quote restricted, which there is no such thing in law
[01:40:08.100 --> 01:40:12.100]  Then you call the sheriff's department and say, what do you tell them?
[01:40:12.100 --> 01:40:16.100]  What crime is being committed by them restricting the document?
[01:40:16.100 --> 01:40:19.100]  What law is being broken?
[01:40:19.100 --> 01:40:25.100]  This one is real easy, everybody should have this statute tattooed in reverse on your forehead
[01:40:25.100 --> 01:40:32.100]  So every time you look in the mirror you see it, 39.03 penal code
[01:40:32.100 --> 01:40:41.100]  If a public official exerts or purports to exert an authority, he does not specifically have
[01:40:41.100 --> 01:40:48.100]  And in the process, nausea and full free access to enjoyment right, that's class A misdemeanor in Texas
[01:40:48.100 --> 01:40:59.100]  You have, okay, 1.29 Texas Code of Criminal Procedure says all courts shall be public
[01:40:59.100 --> 01:41:04.100]  Wait a minute, we're not talking about the courts, we're talking about the police report
[01:41:04.100 --> 01:41:06.100]  That is a court document
[01:41:06.100 --> 01:41:08.100]  That's a court document
[01:41:08.100 --> 01:41:14.100]  All courts shall be public
[01:41:14.100 --> 01:41:18.100]  Now he secrets a police report
[01:41:18.100 --> 01:41:24.100]  A police report is a document filed into the court record
[01:41:24.100 --> 01:41:29.100]  Without the police report there's no evidence of the crime
[01:41:29.100 --> 01:41:34.100]  Once a person's been arrested, if they're arrested without a warrant
[01:41:34.100 --> 01:41:38.100]  They're to be taken directly before a magistrate, the magistrate to hold an examining trial
[01:41:38.100 --> 01:41:41.100]  Make a determination of probable cause
[01:41:41.100 --> 01:41:46.100]  And under 1620 Code of Criminal Procedure he is to create a warrant
[01:41:46.100 --> 01:41:53.100]  It is the warrant that gives the trial court subject matter jurisdiction
[01:41:53.100 --> 01:41:56.100]  That's the only, there's two things the magistrate does
[01:41:56.100 --> 01:42:04.100]  He makes a determination of probable cause and records that under 16.17 he issues an order
[01:42:04.100 --> 01:42:07.100]  Showing whether he found probable cause or released the person
[01:42:07.100 --> 01:42:13.100]  And then under 1620, if the person was not arrested on an existing warrant
[01:42:13.100 --> 01:42:16.100]  Then he's to create a warrant
[01:42:16.100 --> 01:42:20.100]  And forward that to the clerk's court of jurisdiction
[01:42:20.100 --> 01:42:25.100]  Without that warrant there is no jurisdiction
[01:42:25.100 --> 01:42:30.100]  So, if you were released
[01:42:30.100 --> 01:42:37.100]  You want to see the 1617 order by the court showing that he held an examining trial
[01:42:37.100 --> 01:42:40.100]  Examining the sufficiency of the allegation
[01:42:40.100 --> 01:42:45.100]  And then made the determination that there was no probable cause
[01:42:45.100 --> 01:42:51.100]  And the way you want to find that is you go to the clerk of the court of jurisdiction
[01:42:51.100 --> 01:42:56.100]  Because article 17.30 Texas Code of Criminal Procedure says
[01:42:56.100 --> 01:42:59.100]  After an examining trial
[01:42:59.100 --> 01:43:04.100]  The magistrate shall seal all documents had in the hearing
[01:43:04.100 --> 01:43:09.100]  Cause his name to be written across the seal of the envelope
[01:43:09.100 --> 01:43:14.100]  And forward it to the clerk of the court of jurisdiction
[01:43:14.100 --> 01:43:18.100]  If the clerk of the court of jurisdiction doesn't have it
[01:43:18.100 --> 01:43:20.100]  It doesn't exist
[01:43:20.100 --> 01:43:23.100]  Okay, that brings up a good point
[01:43:23.100 --> 01:43:28.100]  In this case the court of jurisdiction would most likely be the municipal court
[01:43:28.100 --> 01:43:32.100]  If indeed this was a class C if there even was a charge
[01:43:32.100 --> 01:43:35.100]  Have y'all gone to the municipal courthouse yet
[01:43:35.100 --> 01:43:39.100]  To see if anything has been filed on your name?

[01:49:14.100 --> 01:49:26.100]  Under the Public Information Act, a violation of the Act under Government Code 552 is the Public Information Act
[01:49:26.100 --> 01:49:36.100]  552.353 says a violation of this Act is official misconduct, class A misdemeanor
[01:49:36.100 --> 01:49:43.100]  But court records don't fall under the Public Information Act
[01:49:43.100 --> 01:49:50.100]  They fall under the Constitutional provision for a fair and public court
[01:49:50.100 --> 01:49:54.100]  And what if these police reports are not filed with the court, then how can they
[01:49:54.100 --> 01:50:14.100]  Yes, they are. The only way that a criminal, that a case can be initiated is for some person to file a criminal affidavit with some magistrate
[01:50:14.100 --> 01:50:19.100]  And that police report is the criminal affidavit
[01:50:19.100 --> 01:50:20.100]  Okay
[01:50:20.100 --> 01:50:31.100]  And once it's filed with that magistrate, the magistrate must make a determination of probable cause based on that document
[01:50:31.100 --> 01:50:34.100]  If the person hasn't been arrested yet
[01:50:34.100 --> 01:50:44.100]  If the person has been arrested, then he must hold an examining trial, read the affidavit
[01:50:44.100 --> 01:50:52.100]  He must, the prosecution must enter the evidence in accordance with the rules of evidence
[01:50:52.100 --> 01:51:03.100]  They must offer the evidence to the court, give the opposition opportunity to examine the evidence and object to the evidence
[01:51:03.100 --> 01:51:08.100]  And if the court overrules the objection, then it's entered into the court
[01:51:08.100 --> 01:51:15.100]  So, in listening to the story, he said that the magistrate said that he didn't agree with the officer
[01:51:15.100 --> 01:51:19.100]  Well, how the heck did he do that?
[01:51:19.100 --> 01:51:21.100]  Where did he get the evidence?
[01:51:21.100 --> 01:51:23.100]  How is he going to find out who the
[01:51:23.100 --> 01:51:24.100]  Who gave this?
[01:51:24.100 --> 01:51:25.100]  Yeah, and how is he going to
[01:51:25.100 --> 01:51:26.100]  Who gave it to him?
[01:51:26.100 --> 01:51:29.100]  How is he going to find out who the magistrate is? He doesn't even know, Randy
[01:51:29.100 --> 01:51:32.100]  Who cares? We don't care who the magistrate is
[01:51:32.100 --> 01:51:34.100]  That's the good part
[01:51:34.100 --> 01:51:38.100]  Some magistrate committed a crime, we don't care which one
[01:51:38.100 --> 01:51:44.100]  We can claim some magistrate and secure that information through discovery later
[01:51:44.100 --> 01:51:49.100]  And it's even better if no magistrate did it
[01:51:49.100 --> 01:51:58.100]  Because we can accuse the head administrative judge for the city of Austin
[01:51:58.100 --> 01:52:00.100]  Elizabeth, what's her name
[01:52:00.100 --> 01:52:07.100]  We can accuse her because every judge, every municipal judge in Austin works under her
[01:52:07.100 --> 01:52:09.100]  She's responding at security
[01:52:09.100 --> 01:52:11.100]  Okay, good point, good point
[01:52:11.100 --> 01:52:16.100]  So, the best thing to go after is the innocent person
[01:52:16.100 --> 01:52:20.100]  This judge is going to say, what are you talking about? I didn't do anything
[01:52:20.100 --> 01:52:25.100]  And this is going to go back to the police department and climb down their throats
[01:52:25.100 --> 01:52:33.100]  So, you are the sovereign, you're the CEO
[01:52:33.100 --> 01:52:41.100]  You only answer to the mayor and the chief of police and the heads of agencies
[01:52:41.100 --> 01:52:46.100]  You don't deal with chumps, you're the CEO
[01:52:46.100 --> 01:52:48.100]  You hold those people responsible
[01:52:48.100 --> 01:52:53.100]  And you leave it to them to administer the people they hire
[01:52:53.100 --> 01:52:57.100]  So, any complaint you file, any criminal accusation
[01:52:57.100 --> 01:53:01.100]  If it's against the police department, you should file it against Acevedo
[01:53:01.100 --> 01:53:05.100]  He is responding at Superior
[01:53:05.100 --> 01:53:12.100]  Every police officer in Austin does exactly what Acevedo tells him to do

[01:53:54.100 --> 01:54:01.100]  And I mean, we're talking, surely this was a several hundred thousand dollar ordeal here

[01:56:25.100 --> 01:56:32.100]  If you commit two Class A misdemeanors, it can bump up to a felony

[01:56:38.100 --> 01:56:46.100]  But if the value of the government property is over a certain amount, then it can go to a felony
[01:56:46.100 --> 01:56:51.100]  And so when you start adding up how much the cop cars are worth
[01:56:51.100 --> 01:56:56.100]  And how much the jail building is worth and things like this
[01:56:56.100 --> 01:57:01.100]  I mean, it could easily get into the millions, which is certainly a felony

[01:57:03.100 --> 01:57:14.100]  Somebody authorized the payment of this money in order to shield the perpetrators from prosecution

[01:57:18.100 --> 01:57:25.100]  So someone embezzled money from the city of Austin, the taxpayers of the city of Austin
[01:57:25.100 --> 01:57:30.100]  For the purpose of shielding these people from prosecution
[01:57:30.100 --> 01:57:35.100]  When you start looking through the code, it's very well structured
