[04:45.920 --> 04:51.320]  but I had a little something I had to take care of with a friend of mine in a court case.
[04:51.320 --> 04:54.540]  And the court case wasn't until 6 p.m. and I just knew we weren't going to get back in
[04:54.540 --> 04:59.360]  time for the show, so I had to run an archive and I apologize for that. But tonight, I am
[04:59.360 --> 05:06.040]  here. Now, there is a group on Yahoo that I've been a member of for a really long time.
[05:06.040 --> 05:11.760]  It's called the No Drivers License Group and they all get together and for the most part,
[05:11.760 --> 05:18.760]  except for the occasional moron and patronut BS that somebody tries to post in there, for
[05:19.040 --> 05:23.460]  the most part they try to stay on point to black letter law, case law and things like
[05:23.460 --> 05:30.280]  that. But one of the questions that got posted there today was dealing with how do we make
[05:30.280 --> 05:37.280]  the inference that transportation as it pertains to state motor vehicle and transportation
[05:37.280 --> 05:44.280]  codes actually deals with commerce from the federal level? Well, I posted my response
[05:46.400 --> 05:50.680]  to that question and I want to go over that with you guys up until we start getting some
[05:50.680 --> 05:57.680]  callers up on the board. But the way this works is this. Title 49 of the United States
[05:57.720 --> 06:04.000]  Code is the Federal Motor Vehicle Safety Carrier Act, okay? And the whole purpose of that act
[06:04.000 --> 06:09.440]  is to set up specific regulations for motor carriers, people that use the highways as
[06:09.440 --> 06:16.440]  a place of business in order to make sure that they're safe to be used on the highways.
[06:18.280 --> 06:23.920]  The safety regulations are meant to ensure that all of the vehicles and the trailers
[06:23.920 --> 06:29.840]  and everything that they use on the highways running around amidst the general public with
[06:29.840 --> 06:35.840]  heavy equipment, full loads and things like that on these trailers and such, that they're
[06:35.840 --> 06:41.840]  not letting the maintenance slip in order to increase the profit margins and thus put
[06:41.840 --> 06:48.840]  the public at risk by that truck or trailer or whatever being on the highway traveling
[06:48.880 --> 06:55.880]  at a high rate of speed. I mean, let's face it. Nobody wants a 120,000 pound missile doing
[06:55.880 --> 07:02.880]  80 miles an hour down the highway with no brakes because some idiot forgot to patch
[07:02.880 --> 07:09.880]  the air pump or the air leak in the airlines for the brakes on a truck. So that's the reason
[07:10.600 --> 07:16.600]  for the Federal Motor Carrier Safety Act in relation to interstate commerce. Now, how
[07:16.600 --> 07:22.080]  do we know that the state codes relate to the federal code? Well, there are numerous
[07:22.080 --> 07:29.080]  ways. First and foremost, in every state's Motor Vehicle Code or Transportation Code,
[07:29.080 --> 07:36.080]  whatever they want to call it, you will find references not only to Title 49 United States
[07:36.600 --> 07:43.600]  Code, but you will also find what each state has codified as basically what they call the
[07:43.600 --> 07:50.600]  multi-state driver's license compact or license compact. Now, when you look at the fact that
[07:50.600 --> 07:56.600]  they admit in statute that this is a compact, then that immediately raised a question in
[07:56.600 --> 08:05.600]  my mind as follows. How is that possible considering that Article 1, Section 10, Paragraph 3 of
[08:05.600 --> 08:14.600]  the Federal Constitution, if in fact it was still a viable constitution, but the fact
[08:14.600 --> 08:22.600]  that it in that particular section reads as follows. No state shall, without the consent
[08:22.600 --> 08:28.600]  of Congress, and it's got several other things, but the pertinent part here is, enter into
[08:28.600 --> 08:37.600]  any agreement or compact with another state. Now, that is the totality of what we need
[08:37.600 --> 08:44.600]  to understand right here in relation to the state codes and Title 49. The state codes
[08:44.600 --> 08:52.600]  are all participating in a multi-state license compact, which the states cannot make on their
[08:52.600 --> 09:01.600]  own. They can only do that with the consent and approval of the United States Congress.
[09:01.600 --> 09:08.600]  Well, how does Congress get the authority through what enumerated power to grant that
[09:08.600 --> 09:14.600]  permission for that compact? Well, of course, in this case, it is the interstate commerce
[09:14.600 --> 09:21.600]  clause, because that's exactly what Title 49 goes to. And that's exactly what Title
[09:21.600 --> 09:32.600]  49 goes to. Okay? So by Congress having to give consent for the multi-state license compact
[09:32.600 --> 09:39.600]  that everybody participates in, that right there ties that code directly into Title 49
[09:39.600 --> 09:48.600]  and interstate commerce, or commerce in general. Okay? Now we have other issues that immediately
[09:48.600 --> 09:58.600]  crop up because of that. One of those issues is the supremacy clause. The federal constitution,
[09:58.600 --> 10:08.600]  again, if it actually exists, specifically states that in all laws pursuant to the constitution,
[10:08.600 --> 10:14.600]  the federal law shall be supreme in the areas where Congress has been given power and authority.
[10:14.600 --> 10:20.600]  And of course, we all know they did that with interstate commerce, though I know and you
[10:20.600 --> 10:28.600]  know that that is a completely abused power by them attempting to go far beyond its intended
[10:28.600 --> 10:37.600]  purpose. We all know that. But for this particular instance, it is pertinent and it is there.
[10:37.600 --> 10:46.600]  So if that's the case, the federal law becomes supreme over anything the state does in relation
[10:46.600 --> 10:56.600]  to the commerce that goes interstate and intrastate. Okay? If it's part and parcel available only
[10:56.600 --> 11:08.600]  because of Title 49, then it's always intrastate. It can't just be interstate because that multi-state
[11:08.600 --> 11:15.600]  license compact is a part of the whole thing. And it's not just the driver's license, it's
[11:15.600 --> 11:21.600]  also the vehicle registrations and everything else that are part and parcel to those compacts.
[11:21.600 --> 11:29.600]  Okay? They would have to be. That would mean that if the federal law has supremacy in this
[11:29.600 --> 11:39.600]  instance, then the federal law has the controlling definitions as well. And the federal law specifically
[11:39.600 --> 11:45.600]  says motor vehicles are commercial. Now, granted, there's not case law on this because again,
[11:45.600 --> 11:51.600]  most of the stuff that I put together out of what's there is a first blush issue. No
[11:51.600 --> 11:57.600]  one's brought it up. And again, I look today, I couldn't find specific case law to this
[11:57.600 --> 12:04.600]  particular subject, but it absolutely positively makes sense as the only way it can actually
[12:04.600 --> 12:12.600]  function and be lawful. Otherwise, the states have violated the federal constitution on
[12:12.600 --> 12:19.600]  their own by entering into compacts with each other that violate this clause. And that in
[12:19.600 --> 12:30.600]  and of itself would be a problem. Okay? So, if that's controlling and the compact exists
[12:30.600 --> 12:36.600]  only because of the interstate commerce power, then that's our tie-in to United States Code
[12:36.600 --> 12:44.600]  Title 49. Let's also not forget that the administrative code of each state will list or have a separate
[12:44.600 --> 12:55.600]  chapter for every state administrative agency that the state has. Now, in Texas, the Department
[12:55.600 --> 13:00.600]  of Public Safety is a state administrative agency and their title of the administrative
[13:00.600 --> 13:07.600]  code is Title 39. You also have the Department of Transportation, which is a state administrative
[13:07.600 --> 13:13.600]  agency, and they have their own title in the state administrative code. Now, when you go
[13:13.600 --> 13:23.600]  through the Texas Transportation Code, every single chapter has a definition for department.
[13:23.600 --> 13:31.600]  And the reason that's required is that depending upon what the intent of that chapter is, that
[13:31.600 --> 13:39.600]  will determine what the definition of department must be. If it has anything at all to do with
[13:39.600 --> 13:47.600]  enforcement or safety, it's a Department of Public Safety issue and they are what is defined
[13:47.600 --> 13:56.600]  as the department. If it has to do with designing, building, marking, maintenance, and things
[13:56.600 --> 14:02.600]  of that nature, that is the Department of Transportation. And therefore, the definition
[14:02.600 --> 14:12.600]  of department in the code means the Department of Transportation. But in no chapter anywhere
[14:12.600 --> 14:21.600]  does department ever mean the Department of Public Safety and or the municipal police
[14:21.600 --> 14:29.600]  departments or the county sheriff's department. They're not in there anywhere. So that begs
[14:29.600 --> 14:36.600]  a new question. If the municipal police and the sheriff's departments are not listed in
[14:36.600 --> 14:44.600]  the definition of department as the one responsible for the enforcement or regulation under that
[14:44.600 --> 14:52.600]  specific chapter, then where does their authority to participate in the enforcement of transportation
[14:52.600 --> 15:00.600]  statutes come from? Well, it begins with the definition of police officer in Chapter 541
[15:00.600 --> 15:07.600]  of the Transportation Code, where it specifically says a police officer is any person authorized
[15:07.600 --> 15:17.600]  to arrest and enforce transportation statutes. That's what they are. That is separate and
[15:17.600 --> 15:23.600]  distinct from the definition of peace officer, which is under 2.12 of the Code of Criminal
[15:23.600 --> 15:31.600]  Procedure. And they do not use these two terms interchangeably. Each one, a peace officer
[15:31.600 --> 15:37.600]  in this instance, or a police officer in that instance, are given separate and distinct
[15:37.600 --> 15:45.600]  powers under the Transportation Code. For instance, a peace officer is given the power
[15:45.600 --> 15:55.600]  to arrest a person that has committed a violation of Subtitle C. But this becomes the question
[15:55.600 --> 16:06.600]  of how does that police officer have the power as a police officer to arrest and enforce?
[16:06.600 --> 16:12.600]  Where does he get authorized is the question. You can look through the whole Transportation
[16:12.600 --> 16:21.600]  Code. You will never find an answer to that. Now, what you will find, however, is in the
[16:21.600 --> 16:28.600]  Texas Administrative Code, under Title 37, the Department of Public Safety, you will
[16:28.600 --> 16:35.600]  find Subchapter 4, and that's got what we need to know in it. And I'll cover that a
[16:35.600 --> 16:38.600]  little bit more on the other side when we come back. All right, folks, this is Rule

[19:46.600 --> 19:53.600]  Okay, now, back on the other side of this, when you go into the administrative code and
[19:53.600 --> 20:01.600]  you dig down into Subchapter 4, you're going to find Rule 4.13. Now, when you tie Rule
[20:01.600 --> 20:10.600]  4.13 in with Rule 1.1, you're going to get a whole different picture of what the DPS
[20:10.600 --> 20:19.600]  actually is because Rule 1.1 says that, or it's 1.2 or 1.1, says that the mission of
[20:19.600 --> 20:27.600]  the Department of Public Safety is to supervise traffic on rural highways, and second one
[20:27.600 --> 20:37.600]  is to supervise and regulate commercial and for hire traffic. Notice, commercial and for
[20:37.600 --> 20:46.600]  hire traffic is what their mission to regulate is. Then when you look down to regulatory
[20:46.600 --> 20:54.600]  programs, you will find driver's licensing, safety inspection, things of that nature.
[20:54.600 --> 21:03.600]  All of the actual regulatory programs that deal with violations or public safety are
[21:03.600 --> 21:09.600]  in the regulatory schemes of the Department of Public Safety who may regulate commercial
[21:09.600 --> 21:15.600]  and for hire traffic. There's nothing in there about them regulating the general public,
[21:15.600 --> 21:22.600]  okay? They can supervise the travel on the highway by saying, go that way, it's a detour,
[21:22.600 --> 21:28.600]  the bridge is out ahead so you can't go forward, that type of deal. But to regulate, they are
[21:28.600 --> 21:35.600]  limited to commercial and for hire traffic. What is regulation? Licensing, registration,
[21:35.600 --> 21:45.600]  safety inspection, all of those are regulation, okay? Then when you go back down to 4.13,
[21:45.600 --> 21:57.600]  you find out that there's also other criteria for the local or the DPS to enforce. The DPS
[21:57.600 --> 22:05.600]  is allowed to enforce at any port of entry into the United States or at least in Texas
[22:05.600 --> 22:13.600]  or upon any highway provided it's a motor vehicle over which they have regulatory authority,
[22:13.600 --> 22:21.600]  regulatory authority again being someone that is commercial or for hire, okay? They can
[22:21.600 --> 22:30.600]  pull those over anywhere on the highway but not the general public. Rule 4.13A goes on
[22:30.600 --> 22:37.600]  to say in specific geographic locations, meaning it has to border two or more Mexican states,
[22:37.600 --> 22:44.600]  it has to border an international coastline or a coastline or something of that nature
[22:44.600 --> 22:51.600]  that borders another particular area, the Mexican states and so on and so forth. The
[22:51.600 --> 22:58.600]  geographical locations are very, very specific. Then after geographic location, there is a
[22:58.600 --> 23:05.600]  population requirement. Even if you're in the proper geographic location, do you meet
[23:05.600 --> 23:10.600]  the proper population requirements in order to get certified to enforce? And again, the
[23:10.600 --> 23:16.600]  certification to enforce applies to all agencies, state troopers, local police departments,
[23:16.600 --> 23:21.600]  sheriff's departments. Well, when you send in a public information request to the Department
[23:21.600 --> 23:29.600]  of Public Safety asking for a list of all people that are certified to enforce transportation
[23:29.600 --> 23:36.600]  statutes in accordance with Rule 4.13A and B, you get back a list that had at last year
[23:36.600 --> 23:48.600]  or year before last had only 63 people on it. 63. Austin's got over 1,200 police officers.
[23:48.600 --> 23:54.600]  Every one of them thinks they have the power to pull you over and write a traffic ticket.
[23:54.600 --> 24:01.600]  But not a single one of them's name appears on this list. So what are they doing? Where
[24:01.600 --> 24:06.600]  are they getting the authority to do what the laws appears to say they don't have the
[24:06.600 --> 24:16.600]  authority to do without the criteria listed in Rule 4.13A and B? Now, on top of the geographical
[24:16.600 --> 24:22.600]  and population requirements, you have B, the training requirements. And once they've been
[24:22.600 --> 24:30.600]  trained, there are certification requirements. So they have to be in a particular place.
[24:30.600 --> 24:35.600]  That particular place has to have a certain population level and there has to be proper
[24:35.600 --> 24:41.600]  training and certification to enforce the statutes that are in the Transportation Code.
[24:41.600 --> 24:48.600]  And according to the Department of Public Safety, there are only 63 non-DPS personnel
[24:48.600 --> 25:01.600]  in all of Texas that can do that. Houston, we have a problem. So when you look at this
[25:01.600 --> 25:11.600]  from a very logical relationship standpoint, something stinks. Because you cannot get from
[25:11.600 --> 25:22.600]  A to F without going through B, C, D, and E. Yet the majority of law enforcement individuals
[25:22.600 --> 25:32.600]  in Texas are now actively doing precisely that. And according to what I can find in
[25:32.600 --> 25:41.600]  the codes and in the statutes, it's illegal because no public servant can do that thing
[25:41.600 --> 25:51.600]  which is not authorized by law for that servant to do. So if there are separate training,
[25:51.600 --> 25:56.600]  certification, population, and geographical requirements before you can enforce transportation
[25:56.600 --> 26:03.600]  statutes, what are these idiots doing? Oh wait, I know what they're doing. They're committing
[26:03.600 --> 26:15.600]  fraud. They're committing extortion at the barrel of a gun. That is what they're doing.
[26:15.600 --> 26:26.600]  That, people, is why you need to be suing the cop and everybody they work for. And don't
[26:26.600 --> 26:32.600]  let anybody tell you that you can't sue a municipality or anything else because they're
[26:32.600 --> 26:40.600]  immune. They are not immune when they commit criminal acts. You may not be able to sue
[26:40.600 --> 26:48.600]  the legal entity directly, but you can dang sure sue those responsible for running it.
[26:48.600 --> 26:56.600]  And they don't have immunity when they commit crimes. They cannot use the color and authority
[26:56.600 --> 27:05.600]  of their office to perpetrate a violation of law against you and your rights. And they
[27:05.600 --> 27:13.600]  get away with it only because people have been indoctrinated down to such a level as
[27:13.600 --> 27:18.600]  to not even understand what their rights are, not to recognize when they're being taken
[27:18.600 --> 27:31.600]  away or diminished. It's sad really. It really makes me chuckle when I talk to people about
[27:31.600 --> 27:35.600]  this and they go, well, you're, you're just trying to stir up trouble. Why would you do
[27:35.600 --> 27:39.600]  that? Or, you know, you're what I'd call an abrasive individual. You're insisting that
[27:39.600 --> 27:44.600]  all these things are this way and everybody knows that just isn't the way it is. Yeah.
[27:44.600 --> 27:48.600]  And for centuries, everybody knew that the world was flat. And for centuries, everybody
[27:48.600 --> 27:52.600]  knew you could tell what direction you were traveling in the woods because moss only grew
[27:52.600 --> 28:02.600]  on the North side of trees, right? That's the problem. Conventional wisdom over common
[28:02.600 --> 28:13.600]  sense and proper knowledge of the facts. How do we fix it? Well, for starters, you could
[28:13.600 --> 28:19.600]  get people listening to the show and come into my class. That would be good. Of course,
[28:19.600 --> 28:25.600]  you could also go out and tell everybody you meet yourself. You just have to figure out
[28:25.600 --> 28:28.600]  a way to communicate it where they won't look at you like you ought to be wearing a tinfoil

[39:03.600 --> 39:11.600]  and I'm kind of interested in, I'm dealing with it myself and I'm looking for the information.
[39:11.600 --> 39:21.600]  I found a lot but, you know, you have something in Texas which may help and I was just wondering
[39:21.600 --> 39:27.600]  how I might get that information from you. Well, what is it you think we have in Texas that may help?
[39:27.600 --> 39:33.600]  Well, I'm not sure. I just know that you said something about your mother, your mother-in-law
[39:33.600 --> 39:39.600]  a little while back was going to have her property repossessed or property taxed and you were able to
[39:39.600 --> 39:45.600]  shut that down. I was able to shut it down because I was able to prove that they did not do,
[39:45.600 --> 39:49.600]  they did not in any way shape or form comply with the law on assessing those taxes.
[39:49.600 --> 39:57.600]  You know, I understand that, yeah. But again, the law in Texas may or may not be similar to the law
[39:57.600 --> 40:05.600]  wherever you're at. I'm in Texas. Oh, okay. Now, what I was after originally was when I researched
[40:05.600 --> 40:13.600]  it, Texas Constitution has what's known as a homestead clause which specifically forbids the taxation
[40:13.600 --> 40:19.600]  or the seizing for failure to pay taxes on the homestead which is the home and up to 200 acres.
[40:19.600 --> 40:27.600]  Right. But the deal there is where the power to tax came from in the first place.
[40:27.600 --> 40:38.600]  The Texas Constitution also forbids state ad valorem taxes. Right. Okay. So, if there is no state ad valorem taxes,
[40:38.600 --> 40:44.600]  then how could there be a tax on the homestead in the first place? Exactly. Yeah.
[40:44.600 --> 40:51.600]  So, that led me to researching other things and when you go back and look in all the prior versions of the Texas Constitution
[40:51.600 --> 40:58.600]  before the 1876, even the 1876 does not authorize taxation of private property.
[40:58.600 --> 41:09.600]  It only authorizes taxation and the 1876, I believe, was amended in the early 1900s to allow for even that taxation of property.
[41:09.600 --> 41:19.600]  But in any case, it's designated as real property, not private property. And real property is actually commercial.
[41:19.600 --> 41:29.600]  That's correct. What the state has attempted to do is muddy the waters or wipe out the line between private property and commercial use property.
[41:29.600 --> 41:38.600]  Exactly. And the ad valorem tax is taxed on tangible property of a business.
[41:38.600 --> 41:45.600]  Of a particular type of business. It has to be an incorporated business or a regulable business.
[41:45.600 --> 41:53.600]  Right. Right. It can't be just any business. It can be any foreign corporation operating within the borders of the state.
[41:53.600 --> 42:04.600]  And if you go and you research certain other terms such as doing business as, you will find that that does not apply to in-state corporations.
[42:04.600 --> 42:10.600]  It only applies to out-of-state corporations that are coming into Texas to set up shop.
[42:10.600 --> 42:15.600]  Okay. That's that's new information for me. Okay. I haven't heard that, but you know.
[42:15.600 --> 42:26.600]  Yeah. When you research doing business as and some of the other terms they use to get DBAs and things like that assigned, that's what you wind up finding out.
[42:26.600 --> 42:30.600]  It's a lot of stuff I found out when I was researching the sales tax.
[42:30.600 --> 42:40.600]  But in any case, the property of the corporations is taxable because the corporation exists only by the grace of the state.
[42:40.600 --> 42:43.600]  They are creatures of statute.
[42:43.600 --> 42:50.600]  So as a creation of government, government can do anything with them it wants to tax them, seize them, put them out of business.
[42:50.600 --> 42:57.600]  Makes no difference. There's even federal case law to that effect that says the power to tax is the power to destroy.
[42:57.600 --> 43:03.600]  Because anything that you create, you can do what you want with.
[43:03.600 --> 43:10.600]  Well, the difference there is the state did not create the private property belonging to the individuals.
[43:10.600 --> 43:14.600]  So are the private citizen or whatever you want to call ourselves.
[43:14.600 --> 43:22.600]  But in any particular case, the corporation itself cannot own property, even if it's in the corporation's name, because it's a fiction.
[43:22.600 --> 43:34.600]  Yes, I understand that part too. Okay. But as long as it's in that fiction's name and it's used for that fiction's purpose in a commercial capacity, the state can tax it at any rate it wants.
[43:34.600 --> 43:37.600]  That's who they're supposed to tax.
[43:37.600 --> 43:46.600]  But they're shifting the burden of that corporate tax onto the back of the people in order to give tax incentives to those businesses to draw them in.
[43:46.600 --> 43:49.600]  Hang on just a second, Harold, and we'll finish this up on the other side.

[47:17.600 --> 47:22.600]  He's probably done a lot more, you know, seven, eight, nine years or whatever.
[47:22.600 --> 47:33.600]  But basically, he just went through the codes and said, hey, you can't call my home a real property because that applies to business.
[47:33.600 --> 47:37.600]  You know, you're actually doing fraud.
[47:37.600 --> 47:46.600]  And, you know, so it goes about his method basically based on, you know, here's the code, here's what the code says,
[47:46.600 --> 47:54.600]  here's what you're trying to apply to my home, private property, to tell me that I owe you taxes.
[47:54.600 --> 48:04.600]  So, you know, basically bottom line, we're just committing fraud and hoping they get away with it.
[48:04.600 --> 48:09.600]  Yeah. Well, that's true.
[48:09.600 --> 48:16.600]  I mean, and it's like I said, transportation code, IRS, property, who knows,
[48:16.600 --> 48:21.600]  probably pretty much everything that the government does is based on fraud.
[48:21.600 --> 48:23.600]  Yeah.
[48:23.600 --> 48:30.600]  So, like I said, you had some information that you were going to send to this person in Florida.
[48:30.600 --> 48:38.600]  You told her, just send you an email at Eddie at RiverBlawRadio.com and you would shoot over whatever you had.

[50:34.600 --> 50:41.600]  in getting ourselves extricated from the mess that these idiots in charge have put us in.
[50:41.600 --> 50:53.600]  And number two, it would be very helpful to you to know what you should and should not do before you run into the problem of having to use this information.
[50:53.600 --> 51:04.600]  Because again, a lot of how well you do depends entirely on how well and how much you practice what you have to do.
[51:04.600 --> 51:10.600]  I'm trying to get people to understand that when it comes to using the scripts, when it comes to going to court,
[51:10.600 --> 51:20.600]  when it comes to doing virtually anything in relation to this stuff, this is not a natural skill, it is a learned skill.
[51:20.600 --> 51:29.600]  And learning in this instance is facilitated by practice, which is exactly what we're doing in the classes.
[51:29.600 --> 51:33.600]  We are doing practical application practices.
[51:33.600 --> 51:40.600]  We're role playing so that you get experience of actually standing up in front of people that you don't know,
[51:40.600 --> 51:50.600]  asking questions, arguing about answers, and so on and so forth, just like you would have to know to do in court.
[51:50.600 --> 51:56.600]  Also, how to remain calm, not let the situation get the better of you, no matter what's going on around you,
[51:56.600 --> 52:03.600]  which is helpful when you're dealing with the traffic stop or any other public servant encounter.

[53:39.600 --> 53:47.600]  I was wondering if during trial they use the term police officer.
[53:47.600 --> 53:52.600]  Should I object? Absolutely.
[53:52.600 --> 53:57.600]  OK, I should object the OK.
[53:57.600 --> 54:05.600]  If he's trying to enforce a transportation statute, then the use of the term police officer is relevant as a deadly sin, isn't it?
[54:05.600 --> 54:10.600]  Yes, sir. So you're going to object to it.
[54:10.600 --> 54:13.600]  OK, I object and I say.
[54:13.600 --> 54:24.600]  The use assumes facts not in evidence, not probably agreed to and previously agreed to previous agreed to and require a legal conclusion.

[54:27.600 --> 54:38.600]  Cool. I got another thing to object to. They say anything. That's one of the deadly sins in regards to transportation.
[54:38.600 --> 54:46.600]  I object to that and say, well, they can't they can't prove the charge without going to transportation because that's where the charge exists.
[54:46.600 --> 54:55.600]  So if you hear any and it's eight deadly sins now, by the way, if you hear any of the deadly sins, you object.
[54:55.600 --> 54:59.600]  And it's always the same objection. The eighth deadly sin is law.
[54:59.600 --> 55:04.600]  If they try to say that you violated a law, then you're going to object to it.
[55:04.600 --> 55:16.600]  Because what they're actually doing is charging you with violating a statute which is separate and distinct from the law that it is written from.
[55:16.600 --> 55:19.600]  OK.
[55:19.600 --> 55:31.600]  So the statute would contradict contradict the law. It may or may not accurately reflect the intent or even the language of the law.
[55:31.600 --> 55:36.600]  OK, so I object to law also. Well, that was my question. Thank you.

[55:53.600 --> 55:59.600]  And I pulled my paperwork from back January 5th to 2011.
[55:59.600 --> 56:08.600]  I got a ticket, actually two tickets, didn't realize I didn't even know that I was my license was suspended or invalid for two years,
[56:08.600 --> 56:16.600]  got pulled over, got a driving on suspended license and speeding ticket and talked to the district attorney.
[56:16.600 --> 56:26.600]  He dropped the gun and paid my fines or two years worth of fines or whatever, got caught up on that and then did defensive driving for the ticket.
[56:26.600 --> 56:32.600]  But then after after all that, I ended up getting a notice from DPS for surcharges.
[56:32.600 --> 56:38.600]  Yeah, exactly. And they were going to try to suspend my license because they found out that I was driving under suspended license.
[56:38.600 --> 56:45.600]  But, you know, I wasn't even aware of all this and, you know, kind of made me feel like there was some double jeopardy going on there.
[56:45.600 --> 56:51.600]  But I know you said it's a bill of pains and penalties, but I ended up hiring an attorney and going to court.
[56:51.600 --> 57:03.600]  The JP, you know, found no cause for when it opened up a folder for like, I mean, 300 dollars basically in two minutes.
[57:03.600 --> 57:08.600]  And, you know, the judge found or show no cause or something like that.
[57:08.600 --> 57:15.600]  And I was just wondering, do I have any recourse in that to go back now and sue the DPS?
[57:15.600 --> 57:19.600]  I know you've mentioned. So you want me to tell you the truth or you want me to lie to you?
[57:19.600 --> 57:22.600]  I mean, just tell me the truth. No, no.
[57:22.600 --> 57:27.600]  And here's why. You agreed the moment you paid the fine instead of fought.
[57:27.600 --> 57:34.600]  You agreed. You waived any complaint whatsoever to the bill of pains and penalties because you agreed it applied.
[57:34.600 --> 57:42.600]  The moment you subjected yourself to the transportation code, you subjected yourself to the administrative penalties that go with it.
[57:42.600 --> 57:46.600]  OK. So is that basically the moment that I sent them the letter requesting the hearing?
[57:46.600 --> 57:49.600]  No, it was the moment you paid the fine.
[57:49.600 --> 57:51.600]  OK.
[57:51.600 --> 57:57.600]  On the original charges, when you did that, that was when it was all gone.
[57:57.600 --> 58:02.600]  Now that I still hold till we go through the break. We got a few seconds.
[58:02.600 --> 58:09.600]  Go ahead. OK. I was just wondering, basically, if I was to get another speeding ticket or another, you know,
[58:09.600 --> 58:15.600]  some other type of traffic charge and was assessed more points and then had to go back to another hearing.
[58:15.600 --> 58:21.600]  Refuse that hearing. Well, again, it all depends upon the terms of what they do after the fact.
[58:21.600 --> 58:26.600]  If they say you can't get another ticket next amount of time and you do, then you're in violation of that agreement.
[58:26.600 --> 58:30.600]  And whatever the penalty there was to the agreement will kick in.
[58:30.600 --> 58:34.600]  OK. So I've already agreed to their. Possibly, yes.
