[00:44.180 --> 00:48.840] And now the news. Three schools in Polk County, Florida have implemented what's called an
[00:48.840 --> 00:53.960] I-Swipe Nano program without even receiving the students' parental permission. Stanley
[00:53.960 --> 00:58.180] Convergent Security Solutions, the company responsible for developing the program, takes
[00:58.180 --> 01:02.800] pictures of the students' irises and can then identify when and where the students get on
[01:02.800 --> 01:07.040] the bus, when they arrive at school, when and what bus the student boards, and when
[01:07.040 --> 01:11.600] and where they get off. Rob Davis, the school board's senior director of support services,
[01:11.600 --> 01:16.780] says the program is an effort to enhance students' safety and claims the I-Swipe Nano is an ideal
[01:16.780 --> 01:20.680] replacement for the card since your child won't be responsible for having to carry an
[01:20.680 --> 01:25.560] ID. One parent expressed outrage at a Facebook post saying the school has stolen information
[01:25.560 --> 01:30.760] that cannot be retrieved. Due to further backlash, the school's program is currently suspended
[01:30.760 --> 01:37.760] and Davis says that the students' information has been destroyed.
[01:39.560 --> 01:42.680] Freedom activist Adam Kokesh has announced that he's canceling the planned 4th of July
[01:42.680 --> 01:46.920] armed march on Washington, D.C. and instead is urging Second Amendment supporters to march
[01:46.920 --> 01:51.560] on their local state capitol and protest government tyranny and Second Amendment restrictions.
[01:51.560 --> 02:17.960] In an interview with InfoWars, the radio show, Kokesh said,
[02:21.560 --> 02:27.760] Boston bombing suspect Dzhokhar Sarnav suffered severe bullet wounds to the neck and has been
[02:27.760 --> 02:32.920] unable to talk until recently he regained his voice. The 19-year-old Chechnyan suspect
[02:32.920 --> 02:37.120] made a phone call to his mother from inside the Boston medical prison where he is being
[02:37.120 --> 02:42.120] held. Dzhokhar's mother said her son sounded normal but maintained his innocence. He told
[02:42.120 --> 02:48.000] her his wounds were healing rapidly and that everything was in God's hands and to be patient.

[02:58.160 --> 03:27.360] and from Capital City Automotive. Okay, here it is another Friday already. Friday
[03:27.360 --> 03:36.720] the 14th of June 2013. Thank you all for listening. We're here for our four hour info marathon
[03:36.720 --> 03:49.600] on Real Law Radio. We have the calls open from the beginning so give us a call 512-646-1984.
[03:49.600 --> 03:54.980] And I was going to start by talking about some of the things that were coming across
[03:54.980 --> 04:02.760] in the real estate area. I work with David Lewis and he just recently sent me a letter
[04:02.760 --> 04:11.100] or a document from someone in Washington State. And you look at, you know, sometimes you look
[04:11.100 --> 04:17.600] at things and you wonder where your head's been all this time. This guy sent out a debt
[04:17.600 --> 04:26.480] validation letter to the servicers and they didn't timely respond. And in the debt validation
[04:26.480 --> 04:37.440] letter he included a request to observe the original debt instrument. Well, they didn't
[04:37.440 --> 04:47.180] adequately respond so he filed a notice of default in the county record. And it's odd
[04:47.180 --> 04:58.680] how you miss things sometimes. The borrower at closing issues a deed of trust or a mortgage
[04:58.680 --> 05:09.480] depending on the state you're in. And he makes promises to the lender and grants the
[05:09.480 --> 05:17.080] lender certain privileges. These promises are in there and privileges are in there as
[05:17.080 --> 05:26.280] covenants to the contract. But he also includes restrictions on the lender that are covenants
[05:26.280 --> 05:37.240] of the contract. If you violate a covenant of the contract, the lender will file a notice
[05:37.240 --> 05:47.640] of default in the record. So why haven't we been filing notices of default in the record?
[05:47.640 --> 05:55.040] You know, they seem kind of like a really slick maneuver when I first heard about it.
[05:55.040 --> 06:01.800] But then when I looked more closely, it's much more profound. What we've been trying
[06:01.800 --> 06:12.680] to do is force the lender to show that he has agency, standing, and capacity. And we're
[06:12.680 --> 06:20.280] filing the courts and the courts are not cooperating. By filing a notice of default in the record,
[06:20.280 --> 06:30.780] you badly cloud the record. Now instead of you trying to get the other side to prove
[06:30.780 --> 06:37.400] that he has agency, standing, and capacity, you turn this whole thing on its head. Now
[06:37.400 --> 06:41.520] you put the other side in a position to where if they're going to sell the property, they
[06:41.520 --> 06:47.800] have to get that cloud off of it. If they're going to exercise the deed of trust, they
[06:47.800 --> 06:53.920] have to eliminate that notice of default. The problem is, is we're noticing them of
[06:53.920 --> 07:04.160] defaults, which goes to violations of specific covenants. And when they file default against
[07:04.160 --> 07:11.640] you, the default is for lack of payment. And there are government regulations on what they
[07:11.640 --> 07:19.920] must do, like in the notice of default, a amount to cure. But we're the borrower. Those
[07:19.920 --> 07:28.280] restrictions don't apply to us at all. So all we have to do is file the notice of default.
[07:28.280 --> 07:35.400] And if it's for a breach of contract, you can't un-breach the contract. For instance,
[07:35.400 --> 07:43.380] if you detect and determine a violation of law by the lender or a failure to abide by
[07:43.380 --> 07:52.640] any law, like Hope Attila Respa, like full disclosure, then you claim the harm under
[07:52.640 --> 08:00.320] breach of contract. And since they breached the contract reasonably before you'd sue them
[08:00.320 --> 08:06.320] for breach of contract, you'd give them notice. Well, the way to give them notice is filing
[08:06.320 --> 08:12.600] a notice of default in the public record. Now they've got a clouded title. They can't
[08:12.600 --> 08:21.040] do anything with it unless they come to the court and ask the court to remove the cloud.
[08:21.040 --> 08:29.040] And we're gonna claim that they have no power to invoke the subject matter jurisdiction
[08:29.040 --> 08:35.840] of this court because they don't have any agency standing capacity. Now they're in a
[08:35.840 --> 08:42.240] position to where in order for them to be able to raise their issue, they have to prove
[08:42.240 --> 08:47.300] up their agency standing capacity. This puts it down in a state court. I think we will
[08:47.300 --> 08:53.480] be more likely to get a good ruling out of that one. We've got a couple more, but right
[08:53.480 --> 08:59.060] now we have a caller. We have Mike on the line. I've been trying to get him on quite
[08:59.060 --> 09:02.560] a while. Hello, Mr. Mike.
[09:02.560 --> 09:08.080] Oh, hey, Mr. Kelton. I didn't want to interrupt what you were talking about.
[09:08.080 --> 09:14.040] Not a problem. I was just telling you about one issue that we had come across in the foreclosure
[09:14.040 --> 09:18.920] thing that I had looked over for two or three years and I ought to be ashamed of myself
[09:18.920 --> 09:27.620] for missing the obvious. Okay. I understand that you are still working these folks over.
[09:27.620 --> 09:33.000] You want to kind of give us a synopsis of where you're at, you know, from the beginning
[09:33.000 --> 09:36.560] so people understand the context of what you're about.
[09:36.560 --> 09:43.520] Okay. Let's see. Do you want me to start with the City of Austin or at Travis County?
[09:43.520 --> 09:51.480] Yeah, start with City of Austin. Okay. Well, back in June 2010, I was, you
[09:51.480 --> 09:57.440] know, they charged me with certain prevention TSA screening by an Austin police officer
[09:57.440 --> 10:07.360] who wasn't authorized to enforce federal aviation law. After I complained, after I was given
[10:07.360 --> 10:15.880] a court order and after the judge started to ram the court order down my throat, I was
[10:15.880 --> 10:21.720] given a order for production of audio and video. The prosecutor decided they didn't
[10:21.720 --> 10:26.720] want to do that. I moved for sanctions. They then decided that they would change charges
[10:26.720 --> 10:32.000] before a complaint had been filed and then I subpoenaed the people that had changed the
[10:32.000 --> 10:38.800] charges and they decided to change the process to avoid service of subpoena to court and
[10:38.800 --> 10:42.800] they then, you know, at some point admitted that in their own hand, you know, the court
[10:42.800 --> 10:47.200] court admitted that in their own handwriting and then when they didn't like that I acidized
[10:47.200 --> 10:53.360] that back into the court, they then sent people out to threaten and harass me, to retract
[10:53.360 --> 10:57.760] my documents. They did it twice when I noticed that in the court when they sent a police
[10:57.760 --> 11:03.440] officer to my door and wanted to arrest me for political thought or said he could arrest
[11:03.440 --> 11:10.040] me for political thought and this went back and forth. I ended up losing my case at City
[11:10.040 --> 11:15.760] of Austin with a dollar fine. They refused to produce any evidence. They wouldn't allow
[11:15.760 --> 11:26.040] me to show any audio video and so then I tried to appeal and they then tried to claim that
[11:26.040 --> 11:30.680] my payment of appellate bond was payment of fine and court costs even though there's
[11:30.680 --> 11:37.280] different amounts of money and it's all recorded in copy, Xerox copy and other forms
[11:37.280 --> 11:43.120] and they still persist in that. Eventually they changed their opinion and then allowed
[11:43.120 --> 11:48.960] me to appeal to Travis County which actually the City of Austin is not a court of record
[11:48.960 --> 11:54.580] and so they're supposed to give me a trial de novo so that's a due process violation
[11:54.580 --> 12:05.400] and then I eventually moved it up to the third court of appeals. City of Austin didn't
[12:05.400 --> 12:11.560] file even one piece of paper opposing my public brief and yet the third court found it under
[12:11.560 --> 12:18.080] power to rule against me. I then moved it to the court of criminal appeals. They sided
[12:18.080 --> 12:25.400] with the third court and then I started to, you know, I kind of lost a little bit of patience
[12:25.400 --> 12:30.840] after the court both came in to smile at comments and so then I started to file criminal complaints
[12:30.840 --> 12:37.480] in his docket and they refused to take them and so I filed it against the court of criminal
[12:37.480 --> 12:42.760] appeals all the courts all the way up and then the Texas Supreme Court into the district
[12:42.760 --> 12:47.000] attorney's office. The district attorney's office was already in receipt of criminal
[12:47.000 --> 12:53.320] affidavit filed against another incident that occurred as a result of the City of Austin
[12:53.320 --> 12:59.240] I was retaliated against by Travis County and I fought that all the way to a dismissal
[12:59.240 --> 13:06.960] with no opposition to expunction and so then I moved it into federal court and then the
[13:06.960 --> 13:20.160] federal judge just decided to dismiss the charges claiming that the judge and the police
[13:20.160 --> 13:24.880] officer were sovereign and then moved it to the fifth court of appeals. In the fifth court
[13:24.880 --> 13:30.740] I filed the supplemental material and in the supplemental material I put verified criminal
[13:30.740 --> 13:36.120] affidavits against all the people that had violated my rights all the way up including
[13:36.120 --> 13:41.960] Chief Justice of Texas Supreme Court both of them, all the Chief Justice third court,
[13:41.960 --> 13:47.560] the judge in Travis County, the judge at my municipal trial at City of Austin, all the
[13:47.560 --> 13:55.680] people that had caused the issue due process violations and actually committed you know
[13:55.680 --> 14:00.120] felony offenses along the way or something that they want to charge me with a classy
[14:00.120 --> 14:06.600] misdemeanor which is proven in video I didn't do and so right now it's sitting in the fifth
[14:06.600 --> 14:13.560] court and I filed a appellate brief. I filed it a little bit early and that's okay I'm
[14:13.560 --> 14:18.400] going to be able to recover but I also filed supplemental material with verified criminal
[14:18.400 --> 14:25.120] affidavits and I just got a letter today that the fifth court has decided in their own I
[14:25.120 --> 14:31.720] guess learned opinion and they're going to ignore the verified criminal affidavits and
[14:31.720 --> 14:40.880] so they are not going to accept that supplemental material into the record. And I guess I was
[14:40.880 --> 14:50.960] going to ask you is under I guess in Texas it would be 1517 and 1601 and 202 those are
[14:50.960 --> 14:55.920] those grant authority for magistrate upon you know presentation of verified criminal
[14:55.920 --> 15:03.000] affidavit that they show. No not not 202 210. Okay 210 okay. 210 of the code of criminal
[15:03.000 --> 15:10.480] procedure. Okay. 209 says who are magistrates and it lists all of them it lists everybody
[15:10.480 --> 15:16.520] supreme Supreme Court justices, court of criminal appeals, court of appeals, I'm sorry court
[15:16.520 --> 15:24.600] of appeals is not mentioned as magistrates there's only one. District, county, municipal
[15:24.600 --> 15:30.400] and JP where all magistrates in 210 tells them it's their duty to keep keep the peace
[15:30.400 --> 15:39.120] by all legal means and 211 when a magistrate sits for the purpose of examining into a criminal
[15:39.120 --> 15:47.840] accusation criminal charge that is a examining trial an examining court and in chapter 16
[15:47.840 --> 15:58.440] defines examining court. Okay go ahead I interrupted on. Oh so let's see right now I'm getting
[15:58.440 --> 16:03.560] to prepare my appellate briefs I already found one in I'm going to have to I made some
[16:03.560 --> 16:09.120] notes on some changes that I should make that they recommend otherwise you know it may not
[16:09.120 --> 16:13.040] be favorable if I don't make the changes so I'm gonna rewrite everything I'm gonna add
[16:13.040 --> 16:20.280] significantly to it. Okay okay we're about to go to break when we come back on the other
[16:20.280 --> 16:27.320] side I'm gonna want to talk about what you've done in a little bit more detail. Okay. And
[16:27.320 --> 16:32.920] how you've affected the system this is something that started with a class C misdemeanor and
[16:32.920 --> 16:39.880] this may have more effect Mike could wind up changing everything he's the reason I do
[16:39.880 --> 16:47.000] this show and he has done really well hang on this is Randy Kelton, Deborah Stevens,

[19:01.040 --> 19:08.040] now.
[19:31.040 --> 19:39.760] Okay, we are back. Amanda Kelton, Deborah Stevens, Rule of Law Radio, and we're talking
[19:39.760 --> 19:50.160] to Mike in Texas. Mike, your synopsis was really kind of clunky. Let me kind of go over.
[19:50.160 --> 19:57.520] Mike was charged with a Class C misdemeanor at the airport. Instead of going down to the
[19:57.520 --> 20:05.060] city and paying the fine and bending over for him, he took him on and it was just an
[20:05.060 --> 20:17.640] absolute horrendous mess. The city of Austin courts paid absolutely no attention to any
[20:17.640 --> 20:25.440] law. They refused to allow Mike to present any evidence. He really took these guys to
[20:25.440 --> 20:34.960] task and they even went so far as to set up to have his house raided at three in the morning
[20:34.960 --> 20:43.560] before he was going to a hearing, have him arrested and held for a competency evaluation.
[20:43.560 --> 20:49.440] And he found out about it. Mike, wasn't it one of the bailiffs who let that cat out of
[20:49.440 --> 21:00.000] the bag? Well, how did that work? As far as me understanding when they were going to come
[21:00.000 --> 21:05.880] to my home, I went to the Austin Police Department and went and got my record. And so I got the
[21:05.880 --> 21:11.160] press release. That was the only thing that they had. And I paid for a certified copy
[21:11.160 --> 21:15.800] and I made certain that they stamped the actual document, not the cover page, which upset
[21:15.800 --> 21:20.720] the officer. And so I actually had a genuine certified copy of the press release. And the
[21:20.720 --> 21:28.880] press release says 3 a.m. that they were to make, to approach me. And it was because of,
[21:28.880 --> 21:34.880] only because of a single document that I filed in the court nine days before. And so I had
[21:34.880 --> 21:41.960] asked the officer, so why did he want to do this at three in the morning? Did the affidavit
[21:41.960 --> 21:51.680] give you a call and ask you to investigate? And so he realized, I think, at that point
[21:51.680 --> 21:57.880] that this was not something that he wanted to argue. And he... Oh, you're talking about,
[21:57.880 --> 22:03.160] was it the lieutenant you were talking to? Oh, the ex of the officer, Johnny Williamson.
[22:03.160 --> 22:12.760] Okay. Then you sent us a recording we played on the air of Mike working over this lieutenant
[22:12.760 --> 22:14.600] or captain. What was he?
[22:14.600 --> 22:20.420] Well, he was just, I think, a sergeant. Johnny Williamson was a sergeant. And I moved up the
[22:20.420 --> 22:25.400] chain of command to Mike Taylor, ultimately. And you did play Mike Taylor's response to
[22:25.400 --> 22:31.160] you. But I don't think you played Patty Robinson, who is it? The assistant chief of police for
[22:31.160 --> 22:37.560] the City of Austin. And everyone else in the police department said it was at the behest
[22:37.560 --> 22:43.240] of a high-ranking female judge in the City of Austin Municipal Court. Well, in the affidavit
[22:43.240 --> 22:51.640] I filed, you know, claiming tampering with a witness, only people that were tampering
[22:51.640 --> 23:00.920] with me used her name. And so she was a high-ranking female judge. But when I finally got to Patty
[23:00.920 --> 23:06.320] Robinson, at least what, you know, I haven't been able to interrogate her except over the
[23:06.320 --> 23:09.680] phone, but she finally kind of just said, well, I just...
[23:09.680 --> 23:17.160] Wait a minute. You're talking on the radio to everybody like they know who Patty Robinson
[23:17.160 --> 23:24.040] is and how this connects together. Kind of give us the details to connect all the pieces
[23:24.040 --> 23:25.040] together.
[23:25.040 --> 23:29.720] Okay. Well, Patty Robinson is on the Austin Police Department. She's the assistant chief
[23:29.720 --> 23:40.200] of police for the Austin Police Department. She is, I believe, a friend or has some relationship
[23:40.200 --> 23:45.480] with Evelyn McKee in the City of Austin.
[23:45.480 --> 23:54.080] And Evelyn McKee is the head municipal judge for the City of Austin, a high-level, high-ranking
[23:54.080 --> 23:55.560] court official in Austin.
[23:55.560 --> 24:01.640] That's correct. And when people came outside of court to, you know, threaten me, you know,
[24:01.640 --> 24:08.040] eventually it was that they stated that, you know, in Texas we execute people with due
[24:08.040 --> 24:14.040] process violations. We don't care about due process. And I was told that Evelyn McKee
[24:14.040 --> 24:20.080] would appreciate it if I retracted my documents. Well, the day before, I had put in the document
[24:20.080 --> 24:30.000] appetizing that they had avoided a service of subpoenas to court by changing the subpoena
[24:30.000 --> 24:36.160] process and the timeline is through admission that they did it almost immediately, within
[24:36.160 --> 24:42.000] 45 minutes. So the people that were subpoenaed got together. They changed the process. So
[24:42.000 --> 24:46.800] they could plausibly say they weren't served and then they didn't show up because they
[24:46.800 --> 24:50.960] claimed they weren't served.
[24:50.960 --> 24:56.000] So okay, that's not likely to go down in good. And that, I take it, that's part of the criminal
[24:56.000 --> 25:01.640] charges that you filed. Okay, once you went through all of that, then you went to trial
[25:01.640 --> 25:07.440] and the judge denied you being able to file any evidence in the record, bring up any law.
[25:07.440 --> 25:10.000] Can you kind of explain what went on in that hearing?
[25:10.000 --> 25:18.040] Well, there's a number, it went on for about a day and a half. They refused to, they wouldn't
[25:18.040 --> 25:23.520] produce any audio or video. They wouldn't allow me to produce audio or video. Now remember,
[25:23.520 --> 25:31.520] this happened in what they call a TSA sterile zone. So it's, there's hardly a place that
[25:31.520 --> 25:37.360] doesn't have more cameras. I count at least nine cameras. You could get multiple camera
[25:37.360 --> 25:49.200] angles easily. And they're designed for data retention. And so they produced two unconfirmed
[25:49.200 --> 25:55.440] video that I had videographers examine that showed that they were tampered with. And there's
[25:55.440 --> 25:59.220] some other things, you know, without getting into that, they just wouldn't even allow me
[25:59.220 --> 26:06.600] to even produce that into court. On the stand, the officer changes testimony, not surprising.
[26:06.600 --> 26:15.360] And he confessed to arresting me, throwing me in handcuffs, searching me for no probable
[26:15.360 --> 26:23.120] cause, just strictly for my size. And so I noted that to the judge. He just confessed
[26:23.120 --> 26:29.040] to first degree aggravated assault because he was a police officer on duty. He was wearing
[26:29.040 --> 26:35.600] a sidearm. It was in full display. He confessed that I had done nothing wrong, just merely
[26:35.600 --> 26:42.040] my size standing there, not moving, not making any noise, not doing anything. And that was
[26:42.040 --> 26:47.280] a cause for him to just arrest me and put me in handcuffs and then, you know, search
[26:47.280 --> 26:54.460] my clothing for identification, which initially he wanted to arrest me for failure to ID.
[26:54.460 --> 27:02.120] That was his chief cause of action. His, not cause of action, now his articulatable probable
[27:02.120 --> 27:13.440] cause for arrest. The judge refused to do anything. And so it's supposedly on the record
[27:13.440 --> 27:20.560] and no judge, you know, since then has been willing to accept any of the criminal affidavits
[27:20.560 --> 27:32.080] that I put into the docket. That may be appropriate because of just the way a civil or criminal
[27:32.080 --> 27:44.600] prosecution works. The complaint can't actually be filed in a case because the complaint is
[27:44.600 --> 27:54.400] the initiation of a case itself. It can be given to the judge in his capacity as a magistrate.
[27:54.400 --> 28:05.400] So you might bushwhack them with them by mailing them to the judge and not putting him in the
[28:05.400 --> 28:06.920] filing at all.
[28:06.920 --> 28:16.120] Well, upon evidence, upon admission of a crime, isn't a judge obligated to arrest that person?
[28:16.120 --> 28:24.040] Technically, yes. Even though you didn't have, they could argue that you couldn't file these
[28:24.040 --> 28:32.560] in the record. Once the judge saw them, they were accusations that a law had been violated
[28:32.560 --> 28:38.680] and a certain person had violated that law. That was sufficient. He had a duty to take
[28:38.680 --> 28:44.520] off his judge's hat, put on his magistrate's hat and hold an examining trial.
[28:44.520 --> 28:50.560] So even though they may legitimately be able to bump the criminal complaints out of the
[28:50.560 --> 28:57.840] civil court, they still don't get past their duty as a magistrate. So any complaints for
[28:57.840 --> 29:01.320] them not holding an examining trial would still stand.
[29:01.320 --> 29:07.840] Okay, hang on, Mike. We're about to go to another break. Mike has been in this fight
[29:07.840 --> 29:17.220] for a long time and it seems always to be the last person you expect is the one that
[29:17.220 --> 29:23.740] turns out to be really the one that lets them have it. And Mike has really worked him over.
[29:23.740 --> 29:29.080] Mike's an engineer. And you know, I've talked about engineers, how all we really do is connect
[29:29.080 --> 29:38.680] the dots. And Mike has been absolutely judicious about connecting every single dot. I stumbled
[29:38.680 --> 29:42.680] over judicious. It didn't seem right calling Mike judicious.
[29:42.680 --> 29:53.120] Okay, this is Randy Kelton, Dennis Stevens, Rule of Law Radio. Our call-in number, 512-646-1984.
[29:53.120 --> 30:02.600] We'll be taking your calls all night. Give a call, get in line. We'll be right back.
[30:02.600 --> 30:08.080] Google Street View. Is it a harmless high-tech helper or a big brother bonanza? I'm Dr. Catherine
[30:08.080 --> 30:11.880] Albrecht and I'll be back in a moment to tell you how several hundred thousand Germans have
[30:11.880 --> 30:15.400] said no to Google ogling their homes.
[30:15.400 --> 30:20.740] Your search engine is watching you, recording all your searches and creating a massive database
[30:20.740 --> 30:26.640] of your personal information. That's creepy, but it doesn't have to be that way. Startpage.com
[30:26.640 --> 30:31.160] is the world's most private search engine. Startpage doesn't store your IP address, make
[30:31.160 --> 30:35.200] a record of your searches or use tracking cookies and they're third-party certified.
[30:35.200 --> 30:40.780] If you don't like big brothers spying on you, start over with Startpage. Great search results
[30:40.780 --> 30:45.240] and total privacy. Startpage.com, the world's most private search engine.
[30:45.240 --> 30:50.160] Hundreds of thousands of Germans have demanded that Google remove their homes from Street
[30:50.160 --> 30:54.640] View, the service that delivers close-ups of homes on demand. Protesters have taken
[30:54.640 --> 30:59.160] to the streets, mooning and sabotaging Google cameras and raising such a ruckus that the
[30:59.160 --> 31:03.560] government has called for new data collection protections. Street View has struck a chord
[31:03.560 --> 31:07.640] with the German people who've lived under the Gestapo and the East German police. They
[31:07.640 --> 31:12.840] know how surveillance empowers whoever controls it and has a chilling effect on freedom. Google
[31:12.840 --> 31:17.120] boasts Street Views on all seven continents and its goal is to image every public road
[31:17.120 --> 31:21.580] available. Isn't it time we started thinking about taking a stand against Google ogling
[31:21.580 --> 31:33.300] ourselves? I'm Dr. Catherine Albrecht. More news and information at CatherineAlbrecht.com.
[31:33.300 --> 31:38.680] This is Building 7, a 47-story skyscraper that fell on the afternoon of September 11th.
[31:38.680 --> 31:44.120] The government says that fire brought it down. However, 1,500 architects and engineers concluded
[31:44.120 --> 31:48.040] it was a controlled demolition. Over 6,000 of my fellow service members have given their
[31:48.040 --> 31:52.640] lives. Thousands of my fellow first responders are dying. I'm not a conspiracy theorist.
[31:52.640 --> 31:55.720] I'm a structural engineer. I'm a New York City correction officer. I'm an Air Force
[31:55.720 --> 32:00.760] pilot. I'm a father who lost his son. We're Americans and we deserve the truth. Go to
[32:00.760 --> 32:07.880] RememberBuilding7.org today. It is so enlightening to listen to 90.1 FM, but finding things on
[32:07.880 --> 32:12.640] the internet isn't so easy and neither is finding like-minded people to share it with.
[32:12.640 --> 32:17.640] Oh, well, I guess you haven't heard of Brave New Books then. Brave New Books? Yes. Brave
[32:17.640 --> 32:22.120] New Books has all the books and DVDs you're looking for by authors like Alex Jones, Ron
[32:22.120 --> 32:27.280] Paul, and G. Edward Griffin. They even stock inner food, Berkey products, and Calvin soaps.
[32:27.280 --> 32:32.320] There's no way a place like that exists. Go check it out for yourself. It's downtown
[32:32.320 --> 32:38.760] at 1904 Guadalupe Street, just south of UT. By UT, there's never anywhere to park down
[32:38.760 --> 32:43.920] there. Actually, they now offer a free hour of parking for paying customers at the 500
[32:43.920 --> 32:50.880] MLK parking facility just behind the bookstore. It does exist, but when are they open? Monday
[32:50.880 --> 32:59.320] through Saturday, 11 AM to 9 PM and 1 to 6 PM on Sundays. So give them a call at 512-480-2503
[32:59.320 --> 33:08.720] or check out their events page at bravenewbookstore.com. You're listening to the Logos Radio Network
[33:08.720 --> 33:35.240] at logosradionetwork.com. Okay, we are back. Randy Kelton, Debra Stevens. You're talking
[33:35.240 --> 33:41.560] to Mike in Texas. And Mike went through a tremendous amount here. These guys really
[33:41.560 --> 33:50.800] came after him. The way he went after he beat the city, he was, or during this time, he
[33:50.800 --> 34:01.160] went into the county courthouse to the, I think, was that the Sterrett building? Anyway,
[34:01.160 --> 34:10.320] the building in the back, the new building. And the guards at the metal detector, they
[34:10.320 --> 34:14.520] jumped him and arrested him and charged him with pointing a deadly weapon at him. And
[34:14.520 --> 34:21.160] it turned out it was just a recorder and he was asking them questions. He fought them.
[34:21.160 --> 34:28.880] They were threatening him with a year in jail and $10,000 fine. He fought him right up to
[34:28.880 --> 34:36.720] the courthouse steps. And on the courthouse steps, go into court for trial, the prosecutor
[34:36.720 --> 34:44.480] knuckled and dropped a... Didn't they dismiss everything, Mike? Will you explain that?
[34:44.480 --> 34:50.840] They dismissed it with no opposition to it.
[34:50.840 --> 35:00.880] It essentially said, this was all horse manure from the beginning. Have absolutely no trust
[35:00.880 --> 35:09.520] in your county prosecutor, your district prosecutor, your municipal judges. Now, you may have to
[35:09.520 --> 35:16.000] be able to have some trust in the county and district judges. I get mixed reviews there.
[35:16.000 --> 35:24.640] But as to the municipal courts, all they're there for is dollar flow. The constitution,
[35:24.640 --> 35:33.120] the laws, the right of things, they could care less. But Mike took them on. And now
[35:33.120 --> 35:37.120] you're in the Third Court, the Fifth Circuit, federal?
[35:37.120 --> 35:42.140] Fifth Circuit, federal. I'm right below the Supreme Court.
[35:42.140 --> 35:47.840] So the Supreme Court is probably looking at his documents, wanting to throw them out very
[35:47.840 --> 35:49.840] badly. Problem.
[35:49.840 --> 35:56.960] Well, I put in... You know, Deborah helped me with this. She cited Milbrook, VUS. And
[35:56.960 --> 36:02.320] so as a fall through on the last bit of my argument right now that I haven't actually
[36:02.320 --> 36:06.560] filed my final appellate brief yet, I'm going to file something very different probably.
[36:06.560 --> 36:14.360] On the one that I have filed, you know, I asked them, can a district judge overturn
[36:14.360 --> 36:21.920] Milbrook, VUS? Of course he can. Can a district judge overturn Milbrook, VUS to dismiss a
[36:21.920 --> 36:26.720] plaintiff's case? Well, of course he can. Can a district judge overturn Milbrook, VUS
[36:26.720 --> 36:33.160] to overturn to dismiss a plaintiff's case and dismiss my case? Well, of course he can.
[36:33.160 --> 36:37.880] And I did that for Milbrook. I did that for Miranda v. Arizona. And I did that for Bivens
[36:37.880 --> 36:43.440] and six unknown agents. And just wanted to let, you know, the Fifth Circuit know how
[36:43.440 --> 36:49.160] are you going to get past that with this, because your boss has said that these are
[36:49.160 --> 36:56.840] what the law is, and this is how we shall rule. And it says that, you know, in Milbrook
[36:56.840 --> 37:05.040] that they are not sovereign, not when they commit crimes in their action, in their official
[37:05.040 --> 37:13.000] duty. And Miranda says, basically, that a corporation cannot take your rights. And Bivens
[37:13.000 --> 37:18.920] has a similar flavor to that, and also that you don't have to know all the people that
[37:18.920 --> 37:25.000] were charging against you, that just the fact that they are working for an employer of the
[37:25.000 --> 37:30.120] United States, and that's good enough. And so you sue, I guess, as Deborah would say,
[37:30.120 --> 37:36.760] in a federal torn claim act, you would sue in their personal capacity and you'd sue
[37:36.760 --> 37:45.960] the United States in its official capacity, because that's my understanding. So I believe
[37:45.960 --> 37:53.240] there's a lot of due process violations. Just in federal court alone, one of the cases
[37:53.240 --> 38:00.440] I like to cite is Wovik Hopkins. I don't think I pronounced that right. Wovik Hopkins.
[38:00.440 --> 38:09.360] And that's an old Supreme Court case that has yet to be overturned. Wovik was a Chinese
[38:09.360 --> 38:13.320] launderman in San Francisco after the San Francisco fire that was seen in San Francisco
[38:13.320 --> 38:20.080] and thought it was a bad idea for him to have a fire in his home, you know, based on a recent
[38:20.080 --> 38:25.520] San Francisco fire. And he fought at the Supreme Court, and the Supreme Court said corporations
[38:25.520 --> 38:31.880] cannot take your rights. These ordinances apply to city personnel. They don't apply
[38:31.880 --> 38:40.840] to the people. And it's never been overturned. So that's another argument that, you know,
[38:40.840 --> 38:46.520] I'm probably not expecting things to go well at the 5th, but if they do, I hope so. But
[38:46.520 --> 38:51.240] if not, then I'm going to file, you know, I guess, you know, I have to go higher and
[38:51.240 --> 38:58.560] beyond that if I have to. You know, there are new and grand journals, grand juries,
[38:58.560 --> 39:05.640] and there are... You know, I've heard of other tribunals that also may have my rights
[39:05.640 --> 39:17.480] exercised at those jurisdictions also. But on all my documents I've put... I've stamped
[39:17.480 --> 39:22.760] over... I signed through postage stamps. I've actually had the post office cancel a number
[39:22.760 --> 39:35.760] of them on my documents, which I think... Okay, I'm back. What happened? Oh, okay. I
[39:35.760 --> 39:43.960] just was... Oh, I'm sorry, Mike. I dropped off the air. They just got me back on. So
[39:43.960 --> 39:49.360] I thought I stuck to my producer. Go ahead, Mike. I'm sorry. Okay. Well, I'm trying a
[39:49.360 --> 39:56.360] number of experimental legal tactics just to see how things work, and I'm open to get
[39:56.360 --> 40:04.000] some interesting responses. Well, from what I've heard so far, it should get pretty interesting.
[40:04.000 --> 40:09.940] Did you tell about Judge Sparks while I was off the air? No, I haven't discussed Judge
[40:09.940 --> 40:17.760] Sparks yet. He did take a rule that I am not to file any more dockets into the court. It
[40:17.760 --> 40:25.360] kind of started beginning with Sparks. Okay. Initially, I filed Travis County into the
[40:25.360 --> 40:31.400] federal court. Sparks, Channel Sparks, was the magistrate assigned. And then for the
[40:31.400 --> 40:42.960] City of Austin, Andrew Austin was assigned. And very early on, Samuel Sparks was commanded...
[40:42.960 --> 40:48.600] I'm not certain what the process would be, but he then had...he was magistrate over both
[40:48.600 --> 40:58.320] of my cases. And then the city didn't correspond with me. There's no record of them corresponding
[40:58.320 --> 41:05.740] with me as when they put a motion for dismissal. So I didn't know that my case was being dismissed.
[41:05.740 --> 41:14.200] And so the judge just ruled on that case was dismissed, so I went and argued that up. And
[41:14.200 --> 41:18.280] eventually it got to the point where the judge refused to accept any more criminal affidavits
[41:18.280 --> 41:26.960] into the docket. And when I had to serve the court, moving up to the 5th, and as soon as
[41:26.960 --> 41:32.440] Samuel Sparks came in, I think pretty early on, he removed my affidavit of indigency and
[41:32.440 --> 41:41.240] declared that I was now not indigent without any evidence. I had him disqualified, and
[41:41.240 --> 41:50.840] he ruled on his own disqualification and said that he's not disqualified. That's interesting.
[41:50.840 --> 41:58.880] And that's up in the fan. And when I tried to serve the court for my appellate brief,
[41:58.880 --> 42:03.440] and they refused service, and I almost was arrested just trying to provide service to
[42:03.440 --> 42:08.640] the court, and I filed additional criminal complaints into the court against the people
[42:08.640 --> 42:16.000] and their superiors for tampering with the government witness and other federal crimes.
[42:16.000 --> 42:21.920] And so I'm in the process of just writing more criminal affidavits, touching up my appellate
[42:21.920 --> 42:28.880] brief, my brief for a felon. And then- Okay, wait a minute. Is it true that Judge
[42:28.880 --> 42:37.240] Sparks called you a belligerent litigant? That is true. In the right of way, Judge Sparks
[42:37.240 --> 42:41.640] described me as a belligerent claimant, and I responded with Johnson v. U.S. that only
[42:41.640 --> 42:49.440] a belligerent claimant has rights. We've quoted this on the air before. Rights
[42:49.440 --> 43:00.360] only belong to the belligerent litigant. Absolutely is belligerent. So now we're waiting for the
[43:00.360 --> 43:05.920] fifth to rule on your appeal on Travis County, right?
[43:05.920 --> 43:10.320] Travis County, so we're waiting on the fifth to rule on the city of Austin.
[43:10.320 --> 43:16.060] Oh, the city of Austin. Good, because I was worried about the city of Austin being already
[43:16.060 --> 43:21.480] gotten swallowed, so good. So I'm city of Austin is in the fifth. That's
[43:21.480 --> 43:26.460] the one that's most likely to go right now to the U.S. Supreme Court. Travis County right
[43:26.460 --> 43:35.520] now, I guess they've been giving me orders to produce claims of release and other forms
[43:35.520 --> 43:40.680] of mediation. They want demand by this. It sounds like they might want to negotiate.
[43:40.680 --> 43:45.120] I'm not sure. Good. Okay, hang on. We'll finish up on the
[43:45.120 --> 43:49.920] other side. This is Randy Kelton, Deborah Stevens, Rule of Law Radio. Our call-in number
[43:49.920 --> 43:57.760] 512-646-1984. Candace, Dave, I see you there, and we still have one from Delaware. We'll
[43:57.760 --> 44:06.600] be right back. Mr. President, members of Congress, you've
[44:06.600 --> 44:12.840] been making a lot of noise about taking our guns away, but you might want to review history.
[44:12.840 --> 44:20.200] 1935, Gonzales, Texas territory. The authorities wanted to confiscate the big gun that protected
[44:20.200 --> 44:26.400] that colony. You know what the people said? Come and take it, because they were willing
[44:26.400 --> 44:31.920] to fight for their freedom and their guns. So are we.
[44:31.920 --> 44:39.400] Come and take it if you want it. Come and take it if you think you can. Come and take
[44:39.400 --> 44:45.800] it, but I warn you, you'll have to pry it from our cold dead hands. We want the freedom
[44:45.800 --> 44:53.600] that God gave us, so you best not cross that line. If you want this gun, you gotta come
[44:53.600 --> 45:02.920] through us and take it one shot at a time. Just like Gonzales, we're keeping our guns.

[46:25.360 --> 46:31.560] Okay, we are back. Randy Kelton, Deborah Stevens, Rule of Law Radio, and we're talking to Mike
[46:31.560 --> 46:40.120] in Texas. Okay, you're ready to take the city to the Supreme. What's your take? Do you think
[46:40.120 --> 46:44.360] that the fifth will give you that shot, Adam?
[46:44.360 --> 46:51.600] Well, I think you've been of great help, Randy. I think one of my arguments is now going to
[46:51.600 --> 46:59.520] be that how can these officials not accept verified criminal affidavits and secret crimes
[46:59.520 --> 47:07.480] in their presence that once it's been made known to them and not act upon them. Most
[47:07.480 --> 47:16.700] of the rulings have just been just blatantly outright. I'm almost dumbfounded in terms
[47:16.700 --> 47:21.120] of a word that I could express.
[47:21.120 --> 47:28.320] And they would be that callous and have that much disregard for potential consequences.
[47:28.320 --> 47:36.720] Well, you know, citing the third, they made just outright fraudulent statements that were
[47:36.720 --> 47:44.840] easily provably false. They stated one time that the city tried to initially claim that
[47:44.840 --> 47:50.320] I paid the fine in court cost and that I never objected. Well, there's over 100, it's probably
[47:50.320 --> 47:55.880] 100 pages of me objecting on a daily basis, going in, filing in several pages at a time
[47:55.880 --> 48:01.680] objecting to what the city was doing. And it accumulated up to probably about half inch
[48:01.680 --> 48:08.360] thick full of documents. But yet the third court says that the court record is absent
[48:08.360 --> 48:14.000] of any objection, therefore I agree with the city's assessment that I paid fine in court
[48:14.000 --> 48:22.240] cost. You know, I mean, stuff like that, you know, and again, in the third court, the city
[48:22.240 --> 48:27.320] never filed one piece of paper opposing, not one. They didn't write a piece of paper that
[48:27.320 --> 48:32.880] just had a single word no on it. I can't think of anything simpler than that. They never
[48:32.880 --> 48:38.360] even bothered to do that. The third court ruled against me.
[48:38.360 --> 48:44.360] This is pretty egregious. And I would think they would get worried when it gets out of
[48:44.360 --> 48:51.000] the state because one of the primary cross protections is we have the state protecting
[48:51.000 --> 48:59.000] us from the Fed and the Fed protecting us from the state. And, you know, the Fifth Circuit's
[48:59.000 --> 49:07.320] not really going to have a dog in this hunt. And if they've seen how well constructed your
[49:07.320 --> 49:17.560] documentation is, they may be concerned that the Supreme would pick it up. And what if
[49:17.560 --> 49:24.160] it does get past the Fifth to the Supreme, most likely the Supreme would get it and contact
[49:24.160 --> 49:31.600] these people and they'll change some decisions so it doesn't have to go to the Supreme.
[49:31.600 --> 49:37.040] But when I filed into the Court of Criminal Appeals and then to the Texas Supreme Court,
[49:37.040 --> 49:43.640] when I filed criminal affidavits into the Texas Supreme Court, apparently just judging
[49:43.640 --> 49:51.160] by the letters that were sent, it seemed like they then told the lower court to change their
[49:51.160 --> 49:56.460] opinion. So I think that the Court of Criminal Appeals and Texas Supreme Court tried to put
[49:56.460 --> 50:02.100] pressure on the third court to change their opinion and the third court refused. The only
[50:02.100 --> 50:06.840] good thing that did happen about that after filing the criminal affidavits, it is interesting
[50:06.840 --> 50:11.580] to note that after I filed those in, two weeks later the Clerk of the Court is no longer
[50:11.580 --> 50:17.760] Clerk of the Court. Our Governor Rick Perry appointed a new Clerk of the Court, but they
[50:17.760 --> 50:25.440] also gave a ruling that my City of Austin documents were to be reserved for 25 years
[50:25.440 --> 50:32.560] at least. So initially the third court tried to destroy it, my 1,500 pages of documents
[50:32.560 --> 50:37.240] that I filed into the City of Austin.
[50:37.240 --> 50:44.640] I tried to make this go away. This could be the one to tumble things for them. The one
[50:44.640 --> 50:52.400] that changes everything just has a way of coming out of nowhere. The people coming in
[50:52.400 --> 50:57.640] the court that you would expect to give you the most fight, give you the least, and the
[50:57.640 --> 51:03.680] one from whom you least expect it tends to wind up the one that rolls over you like a
[51:03.680 --> 51:04.680] steamroller.
[51:04.680 --> 51:12.680] Well, just because the audience doesn't think that I'm just performing this as a legal
[51:12.680 --> 51:17.040] exercise, which I think everyone should, because that's the only way you can protect your
[51:17.040 --> 51:27.520] freedoms. But this drastically affected my ability to obtain employment. They kind of
[51:27.520 --> 51:32.360] put me in between a rock and a hard place. I have to fight this as hard as I have to
[51:32.360 --> 51:37.920] just to be able to, maybe in the hope of some time, be able to be employed again.
[51:37.920 --> 51:49.280] Exactly. But still, you never once ducked and run for cover. I do this, but I've been
[51:49.280 --> 51:55.600] around it a while and I'm not really afraid of them. Mike, this was his first shot out
[51:55.600 --> 52:03.680] here. He had no idea what was coming at him, never backed up, never quit. And now this
[52:03.680 --> 52:11.120] worm has turned big time. There's a good chance that the fifth is not going to want this to
[52:11.120 --> 52:18.320] go to the Supreme. Because if the Supreme justices see any of this, they're likely to
[52:18.320 --> 52:26.360] be really upset. So how long do you expect before the fifth may rule?
[52:26.360 --> 52:32.840] I've got 30 days to file my appellate brief. And then after that, 40 days for the city
[52:32.840 --> 52:38.120] to file their appellate brief. And then after that, I'm not certain what the scheduling
[52:38.120 --> 52:42.760] should be. It should be fairly quick. It is interesting to note today that I received
[52:42.760 --> 52:51.760] both the denial of supplemental material, which were largely composed of evidence and
[52:51.760 --> 53:02.160] verified criminal affidavits, and the return receipt for me filing into the circuit. So
[53:02.160 --> 53:07.600] it appears that the same day they opened it up, sent the return receipt back to me, they
[53:07.600 --> 53:15.080] also sent back a letter denying it. So I don't know how much inspection they gave these documents.
[53:15.080 --> 53:22.520] It appears that they gave it very little oversight just because both the rejection and the return
[53:22.520 --> 53:24.920] receipt was returned the same day.
[53:24.920 --> 53:30.600] Well, it may be because they were in the form of criminal affidavits and they looked at
[53:30.600 --> 53:37.200] them and said, we can't file those here. Those need to be filed somewhere else. And just
[53:37.200 --> 53:47.120] send those directly to the judge, one of the judges there in their capacity as a magistrate.
[53:47.120 --> 53:50.360] They did not give me instruction to do so. And that's one-
[53:50.360 --> 53:55.680] They won't necessarily tell you what you should do to kick their butts. They're going to leave
[53:55.680 --> 53:57.480] it up to you to figure that part out.
[53:57.480 --> 54:01.920] Well, I was going to ask you, do you think that if I were to send the same verified criminal
[54:01.920 --> 54:06.840] affidavits plus another nine for the federal court here in Austin refusing service and
[54:06.840 --> 54:13.280] the city of Austin refusing service, you know, and thereby all their superiors by respondents
[54:13.280 --> 54:23.960] to doctor and respond to superior, not disciplining their subordinates for refusing service, that
[54:23.960 --> 54:28.300] would it be tampering with the court record if I was to send it to the chief, send those
[54:28.300 --> 54:32.920] criminal affidavits to the chief justices now? Because right now I have a letter from
[54:32.920 --> 54:36.080] the court dismiss denying-
[54:36.080 --> 54:42.920] It wouldn't, the chief justices or magistrates as well. That might be a really good strategy.
[54:42.920 --> 54:46.720] Would that be tampering with their, with the judicial proceedings?
[54:46.720 --> 54:56.640] Yes. Well, you filed with the fifth circuit and they refused to accept them. So that just
[54:56.640 --> 54:59.280] takes you up the ladder one more step.
[54:59.280 --> 55:04.920] So I filed maybe with the US Supreme Court while they're ruling on my case in the fifth
[55:04.920 --> 55:05.920] circuit.
[55:05.920 --> 55:13.720] Yeah. Well, you just filed these criminal complaints with the chief justices in their
[55:13.720 --> 55:16.720] capacity as magistrates.
[55:16.720 --> 55:21.920] Now I think you had mentioned Randy that Texas did not cede the federal courthouse to the
[55:21.920 --> 55:22.920] federal government.
[55:22.920 --> 55:26.040] It doesn't matter. You have a federal case.
[55:26.040 --> 55:35.000] Why else would I be able to file criminal charges, Texas charges into Greg Abbott against
[55:35.000 --> 55:38.880] the federal judge for what he's done so far in terms of-
[55:38.880 --> 55:44.680] Absolutely. And that's going to be a political football.
[55:44.680 --> 55:50.320] Do you think I should stir it up all at the same time or maybe space it out a bit?
[55:50.320 --> 55:57.440] Well, criminals should go, criminals are totally separate from civil. And that's the problem
[55:57.440 --> 56:03.120] with filing the criminal and the civil. They're totally separate. So there's nothing to prevent
[56:03.120 --> 56:10.600] you from pursuing the criminal side, which is your duty. If you have knowledge of a felony
[56:10.600 --> 56:15.320] being committed and you don't report it, I mean, look at Title 18.
[56:15.320 --> 56:17.040] That is true.
[56:17.040 --> 56:32.960] It's 18 U.S.C. 4. Now it's not 18 U.S.C. 6295, it's 4 and 3 I think has been repealed.
[56:32.960 --> 56:38.640] It's right up there in the front like, guys, pay attention to this. If you have knowledge
[56:38.640 --> 56:44.680] of the felony that's been committed and you fail to report it, you're guilty of a crime.
[56:44.680 --> 56:48.840] So they can't come back and say, well, you can't file these complaints. Of course you
[56:48.840 --> 56:56.200] can file these complaints. And nothing in law directs a complaint to a prosecuting attorney.
[56:56.200 --> 57:00.840] Everything directs a complaint to some magistrate. And you've walked through the magistrates
[57:00.840 --> 57:07.320] up to the fifth and those magistrates refuse to act. So take it to the ultimate magistrates.
[57:07.320 --> 57:13.840] Well, I'm wondering if I should walk it to the Travis County District Judges, do all
[57:13.840 --> 57:18.040] of them first before Greg Abbott?
[57:18.040 --> 57:22.160] I think, oh, you're talking about doing all of them with the Fed?
[57:22.160 --> 57:25.800] I'm talking about doing both. I'm talking about...
[57:25.800 --> 57:35.460] Trying to keep you from doing both. More politics you create the better. The Supreme is likely
[57:35.460 --> 57:42.160] to come back to the state and Abbott is where they'd go to. And he'd say they're filing
[57:42.160 --> 57:48.200] them with me too. I think that's a real good idea.
[57:48.200 --> 57:49.200] Okay.
[57:49.200 --> 57:55.560] Okay, we do need to move on. We're about to go to our top of the hour break. Thank you
[57:55.560 --> 57:56.560] Mike.
[57:56.560 --> 57:57.560] Thank you Steve.
[57:57.560 --> 58:00.240] And keep us up to date on how this goes.
[58:00.240 --> 58:02.240] Thank you so much.
[58:02.240 --> 58:11.400] Okay, this is Randy Kelton, Deborah Stevens, Lula Gla Radio. I see Candace, Dave, Jeff,
[58:11.400 --> 58:17.600] and another Dave. Dave in Delaware and Dave in Texas. We will start back through them
[58:17.600 --> 58:22.600] on the other side. We'll try to move a little more quickly, but Mike's been around a while.
[58:22.600 --> 58:30.120] He's really fought the hard fight. So I really wanted to give him some time. But give us
[58:30.120 --> 58:33.980] a call. Get in line. As it gets closer to the end of the show, the calls tend to build
[58:33.980 --> 58:44.400] up and we do want to get to everybody. I call him number again, 512-646-1984. Give us a
[58:44.400 --> 59:14.080] call, any subject, to see if we can play Stump the Chop.

[01:00:47.080 --> 01:00:51.680] Florida have implemented what's called an I-Swipe Nano program without even receiving
[01:00:51.680 --> 01:00:56.000] the students' parental permission. Stanley Convergent Security Solutions, the company
[01:00:56.000 --> 01:01:00.840] responsible for developing the program, takes pictures of the students' irises and can then
[01:01:00.840 --> 01:01:04.960] identify when and where the students get on the bus, when they arrive at school, when
[01:01:04.960 --> 01:01:09.360] and what bus the student boards, and when and where they get off. Rob Davis, the school
[01:01:09.360 --> 01:01:13.640] board's senior director of support services, says the program is an effort to enhance student
[01:01:13.640 --> 01:01:18.720] safety and claims the I-Swipe Nano is an ideal replacement for the card since your child
[01:01:18.720 --> 01:01:23.600] won't be responsible for having to carry an ID. One parent expressed outrage at a Facebook
[01:01:23.600 --> 01:01:28.380] post saying the school has stolen information that cannot be retrieved. Due to further backlash,
[01:01:28.380 --> 01:01:32.980] the school's program is currently suspended, and Davis says that the students' information
[01:01:32.980 --> 01:01:34.560] has been destroyed.
[01:01:39.560 --> 01:01:42.680] Freedom activist Adam Kokesh has announced that he's canceling the planned 4th of July
[01:01:42.680 --> 01:01:46.920] armed march on Washington, D.C., and instead is urging Second Amendment supporters to march
[01:01:46.920 --> 01:01:51.560] on their local state capitol and protest government tyranny and Second Amendment restrictions.
[01:01:51.560 --> 01:01:56.080] In an interview with Info Wars, the radio show, Kokesh said, when it comes to this event
[01:01:56.080 --> 01:01:59.960] being executed properly, when the government has already escalated the violent tactics
[01:01:59.960 --> 01:02:04.120] against me personally as an organizer, I can't, in good conscience, go forward with a plan
[01:02:04.120 --> 01:02:08.520] that is so centrally dependent and not open source. So far, the march has gained over
[01:02:08.520 --> 01:02:13.120] 5,000 Facebook supporters. According to DC Law, a person carrying a gun outside of their
[01:02:13.120 --> 01:02:18.080] home or place of business can face up to five years in prison and a $5,000 fine.
[01:02:18.080 --> 01:02:27.760] Boston bombing suspect Dzhokhar Sarnov suffered severe bullet wounds to the neck and has been
[01:02:27.760 --> 01:02:32.920] unable to talk until recently he regained his voice. A 19-year-old Chechnyan suspect
[01:02:32.920 --> 01:02:37.080] made a phone call to his mother from inside the Boston medical prison where he is being
[01:02:37.080 --> 01:02:42.120] held. Dzhokhar's mother said her son sounded normal but maintained his innocence. He told
[01:02:42.120 --> 01:02:47.080] her his wounds were healing rapidly and that everything was in God's hands and to be patient.

[01:03:36.080 --> 01:03:47.080] in Iowa. Hello, Randi. Hello, Candice. What do you have for us tonight? Well, I had told
[01:03:47.080 --> 01:03:54.080] your sidekick there that I was just getting on tonight to support a girlfriend, Zindi,
[01:03:54.080 --> 01:04:00.080] and I thought she'd be on by now. She's feeding her young son and so she'll be coming on but
[01:04:00.080 --> 01:04:07.080] I don't really qualify for the wonderful information you have because I'm Fifth Amendment due process
[01:04:07.080 --> 01:04:12.080] and I'm taking a case to Supreme Court at the federal level. We already went to the
[01:04:12.080 --> 01:04:19.080] state level and so I'm just on to support her and I'm not a Fourteenth Amendment process
[01:04:19.080 --> 01:04:25.080] individual anymore but I really respect what you're doing. It's really needed. Wait a minute,
[01:04:25.080 --> 01:04:35.080] what does that mean, not a Fourteenth Amendment process individual? I have filed some documents
[01:04:35.080 --> 01:04:43.080] making a declaration of my state citizenship rights which is a body of knowledge that I've
[01:04:43.080 --> 01:04:50.080] been studying with Edward Allen Fife who has Liberty is Your Inheritance and Rob, who's
[01:04:50.080 --> 01:04:59.080] his co-host, is on your call a lot and he had recommended, had endorsed you and said
[01:04:59.080 --> 01:05:10.080] that you knew a lot about the traffic situation. Oh, okay. That's more Eddie than the traffic
[01:05:10.080 --> 01:05:18.080] on Monday night. But the reason I ask about the Fourteenth Amendment citizen is I understand
[01:05:18.080 --> 01:05:24.080] some of the arguments in that regard and there's someone we have on the show on occasion and
[01:05:24.080 --> 01:05:34.080] we talked about him last night was Harmon Taylor and he had, when I first met Harmon
[01:05:34.080 --> 01:05:45.080] Taylor, he was doing the Constitution classes and then he represented a client in the Oklahoma
[01:05:45.080 --> 01:05:56.080] City bombing and through that experience he discovered that the Constitution simply does
[01:05:56.080 --> 01:06:03.080] not apply. Do you have a radio in the background? No, I have a dog chewing a bone. Oh, okay.
[01:06:03.080 --> 01:06:15.080] It sounded like music. I thought only a mother would say that. You might want to talk to
[01:06:15.080 --> 01:06:21.080] Harmon or listen. I have to find out when we've had our last show with him. He talks
[01:06:21.080 --> 01:06:28.080] about choice of law and how everything is contract and when you were saying you filed
[01:06:28.080 --> 01:06:40.080] these documents, I was wondering are those documents intended to nullify contracts? No,
[01:06:40.080 --> 01:06:49.080] this would be more in the jurisdiction area because I've been studying jurisdiction
[01:06:49.080 --> 01:06:56.080] off and on for 23 years, but this is the first time there has been something that has actually
[01:06:56.080 --> 01:07:03.080] gone to the Supreme Court, a woman who, she was about 70 years old or she is now, who
[01:07:03.080 --> 01:07:13.080] actually got a ruling even though she did things imperfectly. But this is, yeah, so
[01:07:13.080 --> 01:07:21.080] it's been acknowledged. What was the ruling? What did they acknowledge? Acknowledged her
[01:07:21.080 --> 01:07:33.080] sovereignty for using state citizenship status. This status is so important and that literally,
[01:07:33.080 --> 01:07:38.080] I mean, it's the only jurisdiction matter that I've seen that I think holds water,
[01:07:38.080 --> 01:07:45.080] but not a lot of people know about it. I'm surprised Rob hasn't shared with you about
[01:07:45.080 --> 01:07:50.080] it on your call because I heard about you through him. He's in Chicago and he's
[01:07:50.080 --> 01:08:00.080] the co-host on Liberty is Your Inheritance, the talk show. Oh, 0413 is the pin on that?
[01:08:00.080 --> 01:08:09.080] It's not familiar. Rob from Illinois? Yeah, I mean this, I mean, it's been a long time.
[01:08:09.080 --> 01:08:13.080] It may have been a long time since he's called. I don't recall. I do recall a few people
[01:08:13.080 --> 01:08:23.080] from Illinois, but not in a while. I'm originally from Chicago. At least I came to Texas from
[01:08:23.080 --> 01:08:30.080] Chicago. I was originally from Tennessee, but I don't know who he is offhand. He may
[01:08:30.080 --> 01:08:39.080] be using a pseudonym. Well, it might be worthwhile to have Ed Python. He's much more articulate
[01:08:39.080 --> 01:08:45.080] on these issues than I am. I'm actually in another cycle of taking care of some other
[01:08:45.080 --> 01:08:52.080] things. I'm working on land patents right now and some other personal stuff, but he
[01:08:52.080 --> 01:09:00.080] has had 100 shows and I think it's been about three years, all on just this subject,
[01:09:00.080 --> 01:09:06.080] but all related. He goes back into history, quotes a lot of law, reads a lot out of the
[01:09:06.080 --> 01:09:15.080] book. He really sticks to the facts, not patriot philosophy. It's really good. There's issues
[01:09:15.080 --> 01:09:21.080] in there that are very squeamish for most people and it has to do with racial issues
[01:09:21.080 --> 01:09:26.080] and our status and the status in which all our government has been based upon, which
[01:09:26.080 --> 01:09:30.080] is fraudulent, not only because of the house choice.
[01:09:30.080 --> 01:09:37.080] Oh, your 14th amendment. Okay, I understand there's a lot of endurance, just race involved
[01:09:37.080 --> 01:09:40.080] in the passing of the 14th amendment.
[01:09:40.080 --> 01:09:48.080] It actually invalidated everything that's come after that because when you get blacks
[01:09:48.080 --> 01:09:56.080] in office, then that is not what our government has been founded on and women. I'm actually
[01:09:56.080 --> 01:10:02.080] a senator in the republic and we've been doing things behind the scenes for about five
[01:10:02.080 --> 01:10:08.080] years now and I'll have to resign when I bring to the table this bit of information
[01:10:08.080 --> 01:10:18.080] that I'm really surprised my cohort is overlooked. So how about maybe getting Ed on your show?
[01:10:18.080 --> 01:10:22.080] You could talk to him about it.
[01:10:22.080 --> 01:10:28.080] Okay. Can you give him my email and have him contact me if he's interested?
[01:10:28.080 --> 01:10:30.080] And what's your email, my dear?
[01:10:30.080 --> 01:10:39.080] It is randyatruleoflawradio.com and I apologize if my voice went down. I was writing his name
[01:10:39.080 --> 01:10:41.080] down with a pin that doesn't work.
[01:10:41.080 --> 01:10:46.080] Oh, I know. Mine almost didn't either. Randy at Rule of Law, right?
[01:10:46.080 --> 01:10:48.080] Yes. Rule of Law Radio.
[01:10:48.080 --> 01:10:57.080] Yeah. I like your show. I mean, it's just so good to exercise your brain around people
[01:10:57.080 --> 01:11:04.080] who really stick to the facts and the law and are just tenacious about it. I love it.
[01:11:04.080 --> 01:11:11.080] Good. Well, we try to be careful about what we promote and how we promote it because we
[01:11:11.080 --> 01:11:17.080] don't want to promote any mythology. I get caught doing that on occasion when I don't
[01:11:17.080 --> 01:11:25.080] do all my homework, but I've gotten a lot better at being careful about what I accept
[01:11:25.080 --> 01:11:27.080] and what I repeat.
[01:11:27.080 --> 01:11:34.080] I can hear that just in your voice, how you're very measured on your thinking and your processes.
[01:11:34.080 --> 01:11:39.080] Now, is it dot com? I'm sorry. After radio, is it dot com?
[01:11:39.080 --> 01:11:40.080] Yes.
[01:11:40.080 --> 01:11:41.080] Okay.
[01:11:41.080 --> 01:11:42.080] Dot com.
[01:11:42.080 --> 01:11:43.080] Okay.
[01:11:43.080 --> 01:11:51.080] I think I would like to have him on. I like good, sophisticated guests. And our listeners
[01:11:51.080 --> 01:11:58.080] tend to like sophisticated guests. I once did four hours on due process. I had been
[01:11:58.080 --> 01:12:04.080] feeding out due process a little at a time because I didn't want to feed everybody with
[01:12:04.080 --> 01:12:13.080] a fire hose. But I said, I need a archive, so I'm going to do straight due process. And
[01:12:13.080 --> 01:12:18.080] I went four hours of jumping around the code back and forth and not waiting for anybody.
[01:12:18.080 --> 01:12:24.080] If I run off and left everybody, well, the idea was you can listen to it over and over.
[01:12:24.080 --> 01:12:33.080] I got more positive input from that show than any other. And frankly, I was embarrassed.
[01:12:33.080 --> 01:12:41.080] I had been giving people bits and pieces, trying to bring them up to speed. And they
[01:12:41.080 --> 01:12:49.080] were running way ahead of me. So now I try not to underestimate my listeners. Every time
[01:12:49.080 --> 01:12:56.080] I do, I get thumped for it. So I would very much like to have some more sophisticated
[01:12:56.080 --> 01:12:58.080] guests on.
[01:12:58.080 --> 01:13:04.080] Well, your last guest was very well equipped. I was really impressed. Now, Zindi is a total
[01:13:04.080 --> 01:13:09.080] newbie at all this. And I almost called her and said, Oh, Zindi, you know, you're going
[01:13:09.080 --> 01:13:12.080] to be running with the fast pack on this one.
[01:13:12.080 --> 01:13:21.080] Oh, Mike. Mike was just terrified when he started. I do this and they trick me sometimes
[01:13:21.080 --> 01:13:26.080] and do rotten stuff to me, but I'm not afraid of them. I'd seen something that I deal with
[01:13:26.080 --> 01:13:32.080] all the time. He was terrified. I had no idea what was coming at him. And he never backed
[01:13:32.080 --> 01:13:41.080] up a half an inch. He rolled over these guys like steam rollers. He has sure taken, you
[01:13:41.080 --> 01:13:49.080] know, this is one of those deals where the student exceeds the master and he far exceeded
[01:13:49.080 --> 01:13:50.080] the master.
[01:13:50.080 --> 01:13:52.080] So you're an engineer also?
[01:13:52.080 --> 01:13:53.080] Yes.
[01:13:53.080 --> 01:14:00.080] All right. Well, you guys stick to the facts, don't you? You don't let these things distract
[01:14:00.080 --> 01:14:01.080] you.
[01:14:01.080 --> 01:14:07.080] All we do is connect dots together. And this is a problem I have with a lot of researchers.
[01:14:07.080 --> 01:14:16.080] Pro se researchers, legal reform, we get an issue and it interests us for one reason or
[01:14:16.080 --> 01:14:23.080] another, and we begin to research it. But if we're not careful, it's sort of like we
[01:14:23.080 --> 01:14:28.080] take two toilet paper rolls, empty ones, and stick one over each eyeball.
[01:14:28.080 --> 01:14:34.080] Yeah, you go down the rabbit holes and you have to keep looking around.
[01:14:34.080 --> 01:14:46.540] Yeah. We don't look back at how all of the laws are interconnected. The problem they
[01:14:46.540 --> 01:14:54.620] tend to have that I have with a lot of researchers is they tell a really good story, except they
[01:14:54.620 --> 01:15:02.740] get to these little places here and there's a dot missing. Well, they just kind of sidestep
[01:15:02.740 --> 01:15:06.860] it or hop over it and keep going.
[01:15:06.860 --> 01:15:15.640] Mike and I are engineers. We don't hop and we can't sidestep. We're not good dancers.
[01:15:15.640 --> 01:15:25.400] There's a dot there and it's missing. The reason it's missing is because if you put
[01:15:25.400 --> 01:15:29.360] that dot there, everything else begins to fall apart.
[01:15:29.360 --> 01:15:35.840] Yeah, that's the thing about law. It's not opinion and it's not philosophy, and that's
[01:15:35.840 --> 01:15:40.600] why it cultures and that's why American people, if they don't all have to become
[01:15:40.600 --> 01:15:43.360] fanatics like some of us.
[01:15:43.360 --> 01:15:46.680] Like you, like me? Okay, you're right.
[01:15:46.680 --> 01:15:54.360] Yeah, although I don't remember what I study, but I don't stop. But it cultures how to think,
[01:15:54.360 --> 01:16:01.160] and really that's our first class we should have is how to think and valuing law and what
[01:16:01.160 --> 01:16:06.280] it brings to your whole family or whole life and turn off the TV and learn to think again,
[01:16:06.280 --> 01:16:11.760] because I'm very right-brained. I'm an artist, but it's crazy that I've gotten
[01:16:11.760 --> 01:16:18.920] so attracted to law, but it's what I need and everybody needs it, really.
[01:16:18.920 --> 01:16:28.240] Even an artist needs some structure on which to develop their art. And the statutes and
[01:16:28.240 --> 01:16:35.520] codes to Mike and I, they're just tech manuals. We don't have any opinion about them. It's
[01:16:35.520 --> 01:16:40.360] like mother nature's laws. She has these laws. You don't have to like them if you don't
[01:16:40.360 --> 01:16:46.600] want to, but you got to follow them. So we follow them and our problems we tend to have
[01:16:46.600 --> 01:16:52.640] is going to come to that blank spot. We can't step over. Thank you, Candace. You've give
[01:16:52.640 --> 01:17:22.240] us a lot of time. We're about to go to break. Call in number 512-646-1984.

[01:19:24.760 --> 01:19:33.200] Okay, we are back. We're in the Kelton Blue Stevens. And Candace, thank you for giving
[01:19:33.200 --> 01:19:40.800] us your time. I suspect that you'll wind up making a good guest. You have apparently done
[01:19:40.800 --> 01:19:51.520] a lot of research. And quite frankly, Candace, doing a show like this, talking about the
[01:19:51.520 --> 01:19:58.880] research you've done and what you know is a very good mental exercise. Because I'm sitting
[01:19:58.880 --> 01:20:06.520] here behind the microphone and essentially I'm talking to air. I can't see the person
[01:20:06.520 --> 01:20:12.720] I'm talking to. I can't gauge how they're reacting and responding. You mentioned earlier
[01:20:12.720 --> 01:20:20.400] that my voice sounds measured. And that's why because I'm talking to someone I can't
[01:20:20.400 --> 01:20:29.340] see. So, I try to measure my delivery and the language I use so that I can take this
[01:20:29.340 --> 01:20:39.360] image that's in my mind and reform it into a different medium, which is language, and
[01:20:39.360 --> 01:20:46.880] cause it to coalesce in your mind with the same meaning that I intended. Now, I know
[01:20:46.880 --> 01:20:55.080] that never really happens. But we strive to come as close as we can. And in this case,
[01:20:55.080 --> 01:21:01.940] and we're talking to a lot of people, so I have to structure what I'm saying to appeal
[01:21:01.940 --> 01:21:10.640] to a wider range of people is a very good mental exercise. Mike is an incredible individual,
[01:21:10.640 --> 01:21:14.840] but he sucks at telling his story. And if you're listening, Mike, you suck at telling
[01:21:14.840 --> 01:21:24.480] his story. Because we forget to use referential index. We forget to tie all the little pieces
[01:21:24.480 --> 01:21:32.560] together. Mike has got so much to tell. He moves from one interesting thing to the next
[01:21:32.560 --> 01:21:40.720] to the next to the next. But we don't have good linkages. We don't have points that
[01:21:40.720 --> 01:21:50.960] we can tie this information to. So, for me, doing this show has been a great exercise
[01:21:50.960 --> 01:22:01.560] in how to discipline your mind and discipline how you think about your subject. You might
[01:22:01.560 --> 01:22:10.700] find it interesting doing a show on this 14th Amendment citizen issue. Okay, thank you very
[01:22:10.700 --> 01:22:17.360] much, Candace. We're going to move ahead. We've got three more callers. Don't be a stranger
[01:22:17.360 --> 01:22:23.280] and if your friend hasn't called in, get a hold of her and get her to call in. Thank
[01:22:23.280 --> 01:22:30.000] you, Candace. Now we're going to go to Dave in Texas. Hello, Dave.
[01:22:30.000 --> 01:22:36.400] Randy, good evening. How are you, sir? I am good. I don't care what everybody says.
[01:22:36.400 --> 01:22:44.000] Well, great. Great. Hey, Randy, I've got a little issue. I spoke to you probably a month
[01:22:44.000 --> 01:22:51.800] ago about a JP judge who gave me 72 hours in the county jail, Tarrant County, because
[01:22:51.800 --> 01:22:58.960] I told him he was a defendant of a federal lawsuit. This gentleman, I went and faced
[01:22:58.960 --> 01:23:09.640] him again and he did another writ of possession on the same property that he's a defendant
[01:23:09.640 --> 01:23:16.160] on and sent the constables over to evict my tenant out of his property. To me, it seems
[01:23:16.160 --> 01:23:21.000] like he's retaliating against me. Who is this magistrate?
[01:23:21.000 --> 01:23:31.880] His name is Clifford Matthew Hayes out of Precinct 7 in Mansfield.
[01:23:31.880 --> 01:23:36.360] I know him. Does he still have a beard?
[01:23:36.360 --> 01:23:42.080] Yeah. Well, you know, him and his, he's got a brother who looks like they're not actually
[01:23:42.080 --> 01:23:50.120] related, but Swearingen in great downtown Fort Worth. And I want to say Precinct 1,
[01:23:50.120 --> 01:23:51.120] but yes.
[01:23:51.120 --> 01:24:00.240] Okay. I know that guy. I was sitting in his office or outside his office one day waiting
[01:24:00.240 --> 01:24:08.960] for a trial. And this, these two DPS officers came in and they went up to the clerk at the
[01:24:08.960 --> 01:24:13.360] window and turned to come back. And this one stopped and turned to look and looked at me
[01:24:13.360 --> 01:24:22.880] and said, aren't you Randy Kelton? I said, have you got a warrant out for me? Oh no,
[01:24:22.880 --> 01:24:29.400] no, no. He said he was in Wise County when I was hammering him in Wise County. So I was
[01:24:29.400 --> 01:24:34.560] amazed. He recognized me. So this was in this judge's office. So we have kind of worked
[01:24:34.560 --> 01:24:41.280] him over pretty good. And he needs some more working over.
[01:24:41.280 --> 01:24:55.480] So you said he was a party in this issue. How is he a party or how is he interested?
[01:24:55.480 --> 01:25:02.680] As far as the suit itself, I believe we've got him for accepting documents, the security
[01:25:02.680 --> 01:25:09.720] instrument, a copy of a security instrument, which we made statement that it is a copy
[01:25:09.720 --> 01:25:16.400] of a security instrument and it's violation of the USC code. I think we brought him in
[01:25:16.400 --> 01:25:22.440] underneath that way in the federal suit. But wait, hold on, hold on. You have a federal
[01:25:22.440 --> 01:25:29.760] suit. Yes. Wendy. Oh, you filed the federal suit. We have the federal suit the day before
[01:25:29.760 --> 01:25:36.040] the forceful detainer action. Okay. Did you file? How long ago was that? About a month
[01:25:36.040 --> 01:25:45.880] and a half ago. Okay. You only got 30 days. Did you file a removal? Did you have him disqualify?
[01:25:45.880 --> 01:25:54.240] No. Remove his issue to the state, to the federal court. No. Okay. Did they evict your
[01:25:54.240 --> 01:26:03.600] tenant? Just yesterday. That's not going to be good. Your tenant's not going to be happy.
[01:26:03.600 --> 01:26:13.760] No, she was not. Not at all. And here's the deal. This property was conveyed to us. You
[01:26:13.760 --> 01:26:18.080] had mentioned that you had a property conveyed to you subject to. That's how I took this
[01:26:18.080 --> 01:26:24.740] property. It was conveyed to me roughly about a year and a half ago. They foreclosed under
[01:26:24.740 --> 01:26:31.500] the previous borrower's name and they did this writ of possession under the previous
[01:26:31.500 --> 01:26:39.600] borrower's name. So it's been in proper service as well. Yeah, that lack of notice. You might
[01:26:39.600 --> 01:26:47.040] file a state action and ask for no restraining order. Now, if you can get it overturned,
[01:26:47.040 --> 01:26:54.920] the harm is done. Who did the foreclosure and what authority did they have to do that
[01:26:54.920 --> 01:27:03.440] foreclosure? Bank of America used Mr. Stockman, if you're aware of him. I'm aware of him.
[01:27:03.440 --> 01:27:09.360] That would be deaf and frapping and kiss my behind. On that particular property, I want
[01:27:09.360 --> 01:27:21.440] to say yes. Okay. And Stockton is the trustee? Yes. Okay. Have you examined the county record?
[01:27:21.440 --> 01:27:28.600] Not yet. Okay. Take the phone receiver and beat yourself around the eyes and ears. Go
[01:27:28.600 --> 01:27:35.520] to the county record. Yes. And there should be a warranty deed. Yes. And then there will
[01:27:35.520 --> 01:27:44.400] be a deed of trust. Correct. Have you looked at the deed of trust? Yes, I have. Is MERS
[01:27:44.400 --> 01:27:55.160] included in the deed of trust? Yes. Okay. Who was the original lender? Countrywide.
[01:27:55.160 --> 01:28:05.640] Okay. Is there a corporate assignment from countrywide to Bank of America? Not that I'm
[01:28:05.640 --> 01:28:11.080] aware of. Again, I got to visit the public record, but I don't believe so. Okay. This
[01:28:11.080 --> 01:28:20.120] is Tarrant County? Yes. You can do it online? Yes. Okay. When you first go in, it won't
[01:28:20.120 --> 01:28:27.000] work. And go back to the initial page, you have to install a Java applet. Right, which
[01:28:27.000 --> 01:28:33.080] I do. Okay, good. If you got that installed, then it'll work. Yes. Okay. Then every time
[01:28:33.080 --> 01:28:41.160] you pull a document, especially a deed of trust, up on the top on the left-hand side,
[01:28:41.160 --> 01:28:48.440] it's either the second or third tab over, there is one that says related documents.
[01:28:48.440 --> 01:28:55.600] Okay. That'll get you a lot of stuff you wouldn't otherwise find. Okay, great. I appreciate
[01:28:55.600 --> 01:29:00.440] that. Yes. Primarily do that on the deed of trust. If it's related to the deed of trust,
[01:29:00.440 --> 01:29:07.200] you should get it. And do you know how to capture the documents? Yes. Okay, good, good.
[01:29:07.200 --> 01:29:13.720] I've got a little print me applet, a little application that I added to the system. When
[01:29:13.720 --> 01:29:21.320] I hit print screen, it opens this up and I can crop out the section I want to print.
[01:29:21.320 --> 01:29:27.760] Okay. So that I can just select the page itself and save the page without all the background
[01:29:27.760 --> 01:29:35.120] stuff. And that works out really well. Okay. Get all of the documents from the county record
[01:29:35.120 --> 01:29:41.560] and plot the chain of title. If you need help with it, call me. Send me an email, Randy
[01:29:41.560 --> 01:29:50.760] at Remedies. I'm sorry, randyatruleoflawradio.com. And I'll give you some pointers. I also have

[01:30:07.600 --> 01:30:12.080] modern day marvels can also turn you into toast? I'm Dr. Catherine Albrecht and I'll
[01:30:12.080 --> 01:30:17.340] be back in a moment with the skin crawling scoop on a looming laptop health hazard.
[01:30:17.340 --> 01:30:22.680] Your search engine is watching you, recording all your searches and creating a massive database
[01:30:22.680 --> 01:30:28.560] of your personal information. That's creepy, but it doesn't have to be that way. Startpage.com

[01:30:48.520 --> 01:30:54.280] on your lap and you could become high tech toast. Laptop temperatures can reach 125 degrees
[01:30:54.280 --> 01:30:58.760] or more, super heating the surfaces where they're perched. If that surface is someplace
[01:30:58.760 --> 01:31:04.640] on your body, you could get toasted skin syndrome, a condition that causes discolored, blotchy
[01:31:04.640 --> 01:31:09.340] skin. You won't drop dead from toasted skin syndrome, but doctors say long term laptop
[01:31:09.340 --> 01:31:14.280] heat could permanently model your flesh. Well, that's just ugly. Laptop heating could even
[01:31:14.280 --> 01:31:19.560] lead to skin cancer and cause infertility in men. So leave the toasting to the toaster.
[01:31:19.560 --> 01:31:24.440] Put your laptop on a tabletop or shield your skin with a protective pad to head off this
[01:31:24.440 --> 01:31:29.160] overheating health hazard. I'm Dr. Catherine Albrecht. More news and information at Catherine

[01:33:32.160 --> 01:33:41.040] Okay, we are back. Randy Kelton, Deborah Stevens, Rule of Law Radio, and we're talking
[01:33:41.040 --> 01:33:47.840] to Dave in Texas. Dave, you said you filed a federal suit.
[01:33:47.840 --> 01:33:55.760] That is correct. Yes, sir. Did you get a Rule 12 motion to dismiss?
[01:33:55.760 --> 01:33:59.320] Not yet. Oh, so how long ago did you file the Fed?
[01:33:59.320 --> 01:34:05.040] Again, about a month and a half ago. File a motion for no answer default. Did
[01:34:05.040 --> 01:34:08.400] you get an answer? Not yet, no.
[01:34:08.400 --> 01:34:15.480] Twenty-one days from the date they received service, did you have them served?
[01:34:15.480 --> 01:34:21.280] Yeah. That was a long wait. You there, Dave?
[01:34:21.280 --> 01:34:25.720] Yes, I am. Did you have them served?
[01:34:25.720 --> 01:34:31.920] Not all the parties are fully served yet. Oh, okay. So that'll toll the time. Were any
[01:34:31.920 --> 01:34:36.160] of the parties served over 21 days ago? No.
[01:34:36.160 --> 01:34:41.020] Oh, okay. No, we just started serving them.
[01:34:41.020 --> 01:34:47.880] What was the nature of the claims you made? Underneath Fair Debt Collection Practice Act
[01:34:47.880 --> 01:34:54.480] violations of fair debt collection. Which one? Do you have no offhand?
[01:34:54.480 --> 01:34:58.000] No, I'd be getting some Randy without looking at it.
[01:34:58.000 --> 01:35:06.080] Okay. It's probably 1692G, one to show agency standing in capacity.
[01:35:06.080 --> 01:35:09.520] We went down the list, so I'll show that then there.
[01:35:09.520 --> 01:35:17.440] Okay. You might consider, once you look at the Deed of Trust, look very carefully at
[01:35:17.440 --> 01:35:22.560] the covenants of the Deed of Trust. Generally starting with about 13. Everything before
[01:35:22.560 --> 01:35:29.320] 13 is stuff that you promised to do as the lender, the borrower promises to do. Everything
[01:35:29.320 --> 01:35:43.160] after 13 goes to privileges and restrictions on the lender. 13 is generally goes to the
[01:35:43.160 --> 01:35:52.920] fees they can charge. 14 to serviceability, you have to abide by all law, and 15 to notices.
[01:35:52.920 --> 01:36:00.440] 19, 20, 20 is a common one, unless you have an FHA loan. If you have an FHA loan, 20 isn't
[01:36:00.440 --> 01:36:07.160] in there, that authorizes the lender to sell a portion of the note or the entire note together
[01:36:07.160 --> 01:36:14.520] with the security instrument. If you have an indication of bifurcation, you claim, instead
[01:36:14.520 --> 01:36:24.380] of the federal issues you could claim, like Hopatillo-Espa, you claim breach of contract
[01:36:24.380 --> 01:36:25.380] under 15.
[01:36:25.380 --> 01:36:26.380] Okay.
[01:36:26.380 --> 01:36:35.720] I'm sorry, 14 and 15. The federal court, if you're pro se, they're going to toss it.
[01:36:35.720 --> 01:36:36.720] Okay.
[01:36:36.720 --> 01:36:38.720] It's just expected.
[01:36:38.720 --> 01:36:42.360] Right. We've had a couple of them tossed already.
[01:36:42.360 --> 01:36:48.760] Okay. But you go in the state court, and what I suggest, since they've already evicted,
[01:36:48.760 --> 01:36:55.880] they've created the harm, now go back and look close at those court records, at the
[01:36:55.880 --> 01:37:01.360] clerk's document, what's filed in the county registrar's office, and look at those covenants
[01:37:01.360 --> 01:37:13.680] on the deed of trust. Look at the covenants on the deed of trust. They always breach the
[01:37:13.680 --> 01:37:21.560] covenants of the deed of trust. Do you have access to the documentation from the original
[01:37:21.560 --> 01:37:25.920] loan from the person who got the loan?
[01:37:25.920 --> 01:37:27.800] I'm sorry, one more time, please.
[01:37:27.800 --> 01:37:30.800] Okay. I take it you got assigned a warranty deed?
[01:37:30.800 --> 01:37:31.800] I did.
[01:37:31.800 --> 01:37:35.800] Do you have access to the person who signed you the warranty deed? Can you get paperwork
[01:37:35.800 --> 01:37:38.200] from them?
[01:37:38.200 --> 01:37:42.360] They gave me everything they had when we did our transfer.
[01:37:42.360 --> 01:37:48.040] Did they have a HUD-1, Truth in Lending, and Note?
[01:37:48.040 --> 01:37:49.040] Yes.
[01:37:49.040 --> 01:37:58.160] Good. If you have those, you can do a calculation. I have a huge spreadsheet I use that if you'll
[01:37:58.160 --> 01:38:08.200] go on remediesinrealestate.com, click the calculate fraud page, and fill in those numbers,
[01:38:08.200 --> 01:38:14.120] I'll send you back an evaluation of how much claim you can make against them for false
[01:38:14.120 --> 01:38:15.120] fees.
[01:38:15.120 --> 01:38:17.120] Oh, okay. Great.
[01:38:17.120 --> 01:38:27.680] That one comes up a whopper, at least usually. But when you look at the record, once you've
[01:38:27.680 --> 01:38:34.200] looked at the documentation, it'll give you more violations of covenants. Then we look
[01:38:34.200 --> 01:38:39.320] at filing a notice of default against the lender.
[01:38:39.320 --> 01:38:40.320] Okay.
[01:38:40.320 --> 01:38:47.320] You file that in the record, and that'll cloud title. Did a third party purchase or did the
[01:38:47.320 --> 01:38:48.560] bank buy it back?
[01:38:48.560 --> 01:38:50.560] The bank bought it back.
[01:38:50.560 --> 01:38:57.840] Good. Then file a notice of default against the bank.
[01:38:57.840 --> 01:38:59.880] Okay.
[01:38:59.880 --> 01:39:09.040] And then the bank will have a fit, and they'll file a trespass to try title in order to quieten
[01:39:09.040 --> 01:39:15.760] the title for your notice of default. And then in order to establish that, they have
[01:39:15.760 --> 01:39:19.600] to come into court and prove they didn't default.
[01:39:19.600 --> 01:39:20.600] Okay.
[01:39:20.600 --> 01:39:32.640] This changes the shoe to the other foot. And for any document that you have, once you file
[01:39:32.640 --> 01:39:43.620] the notice of default, then you file a 51903 if you're in Texas on the deed of trust. Otherwise,
[01:39:43.620 --> 01:39:53.560] you'll file a petition for declaratory judgment. If it goes to a... In Texas, it's a little
[01:39:53.560 --> 01:40:00.920] more complex because we have a 51903 just goes to the deed of trust.
[01:40:00.920 --> 01:40:03.720] What is a 51903, Randy?
[01:40:03.720 --> 01:40:06.400] That's the government code.
[01:40:06.400 --> 01:40:07.400] Okay.
[01:40:07.400 --> 01:40:17.080] 51901, 2 and 3, these were statutes put in to thwart the Republic of Texas when they
[01:40:17.080 --> 01:40:24.000] were filing a lot of liens against public officials. But now we get to use it back on
[01:40:24.000 --> 01:40:29.760] them. On a deed of trust issue where a document purports to create a lien, you can file an
[01:40:29.760 --> 01:40:36.960] action under 51903. It goes to the judge, the other party doesn't get noticed, and the
[01:40:36.960 --> 01:40:43.840] judge hears no testimony. He pleads strictly on the documents. So if you give him a document
[01:40:43.840 --> 01:40:50.560] that sufficiently supports that the particular document that was filed was fraudulent, the
[01:40:50.560 --> 01:40:57.600] judge can rule it fraudulent without any testimony from the other side.
[01:40:57.600 --> 01:40:58.600] Really?
[01:40:58.600 --> 01:40:59.600] Yep.
[01:40:59.600 --> 01:41:00.600] Okay. Okay.
[01:41:00.600 --> 01:41:13.460] Then you look at... I think it's Torch and Remedy Code 137. And they eliminated the cause
[01:41:13.460 --> 01:41:22.000] of action for illegal conversion and made it a criminal claim. Now to replace conversion
[01:41:22.000 --> 01:41:31.680] as a cause of action, they put in the Fraud Recovery Act, and that's in the Business and
[01:41:31.680 --> 01:41:42.200] Commerce Code. That gives you a cause of action to sue under illegal conversion on the property.
[01:41:42.200 --> 01:41:49.560] So if you can go to the court and show him that the deed of trust was faulty or that
[01:41:49.560 --> 01:41:58.420] an assignment was made by a party who had no power to make the assignment, or an appointment
[01:41:58.420 --> 01:42:03.600] of a substitute trustee was made by someone who didn't have power to make the appointment,
[01:42:03.600 --> 01:42:12.160] and get the judge to agree with you, or the notary was invalid, or the signatory lacked
[01:42:12.160 --> 01:42:20.520] power of attorney to sign for the entity, if the judge agrees with you and rules against
[01:42:20.520 --> 01:42:26.880] the document and gives you your declaratory judgment, the foreclosure is wrongful as a
[01:42:26.880 --> 01:42:28.120] matter of law.
[01:42:28.120 --> 01:42:35.640] Well, Randy, let me ask you this. The appointed substitution trustee, David Stockman, when
[01:42:35.640 --> 01:42:41.920] he becomes that appointed substitute trustee, isn't it his responsibility to file that
[01:42:41.920 --> 01:42:47.040] document 21 days before he forecloses on that property?
[01:42:47.040 --> 01:42:54.600] Okay. That brings up an issue. Yeah, they're required to file that notice of default 21
[01:42:54.600 --> 01:43:01.880] days. But there is something in the record that indicates, it tells the clerk that she
[01:43:01.880 --> 01:43:12.360] only has to retain that document for, I think, 60 days. So when they file the document, they
[01:43:12.360 --> 01:43:19.020] don't actually file it in the regular county record. They file it elsewhere and then they
[01:43:19.020 --> 01:43:27.380] destroy it. So there's no record of it. And that's one of the issues I would bring, that
[01:43:27.380 --> 01:43:29.800] they're required to file that notice.
[01:43:29.800 --> 01:43:39.480] Now they're required to send a copy to the borrower, first-class mail. And if they didn't
[01:43:39.480 --> 01:43:41.880] send it with a green card, you didn't get it.
[01:43:41.880 --> 01:43:42.880] That's correct.
[01:43:42.880 --> 01:43:47.660] And the only other way they could prove that they made the notice was have it properly
[01:43:47.660 --> 01:43:53.520] filed in the record and they don't as a matter of course. So that's the interesting one to
[01:43:53.520 --> 01:43:58.160] argue. Hang on. This is Randy Kelton, David Stevens, Rule of Law Radio. We'll be right
[01:43:58.160 --> 01:44:02.160] back on the other side.
[01:44:02.160 --> 01:44:07.120] It is so enlightening to listen to 90.1 FM, but finding things on the Internet isn't so
[01:44:07.120 --> 01:44:10.800] easy and neither is finding like-minded people to share it with.
[01:44:10.800 --> 01:44:13.480] Oh, well, I guess you haven't heard of Brave New Books then.
[01:44:13.480 --> 01:44:15.000] Brave New Books?
[01:44:15.000 --> 01:44:19.560] Yes. Brave New Books has all the books and DVDs you're looking for by authors like Alex
[01:44:19.560 --> 01:44:24.520] Jones, Ron Paul, Angie Edward Griffin. They even stock inner food, Berkey products and
[01:44:24.520 --> 01:44:25.520] Calvin soaps.
[01:44:25.520 --> 01:44:28.400] There's no way a place like that exists.
[01:44:28.400 --> 01:44:33.920] Go check it out for yourself. It's downtown at 1904 Guadalupe Street, just south of UT.
[01:44:33.920 --> 01:44:37.440] By UT, there's never anywhere to park down there.
[01:44:37.440 --> 01:44:42.840] Actually, they now offer a free hour of parking for paying customers at the 500 MLK Parking
[01:44:42.840 --> 01:44:44.640] Facility, just behind the bookstore.
[01:44:44.640 --> 01:44:48.840] It does exist. But when are they open?
[01:44:48.840 --> 01:44:54.240] Monday through Saturday, 11 AM to 9 PM and 1 to 6 PM on Sundays. So give them a call

[01:46:22.680 --> 01:46:27.960] We are back. Randy Kelton, Deborah Stevens, Rule of Law Radio, and Dave, I kind of took
[01:46:27.960 --> 01:46:36.520] some extra time here because there are so many claims that we have available to make
[01:46:36.520 --> 01:46:41.200] that you probably don't realize how many there are.
[01:46:41.200 --> 01:46:52.800] The idea of getting a declaratory judgment, a trespass to try title, that gives them more
[01:46:52.800 --> 01:47:01.360] warning than if you go in and you say to the court, the only issue I have before the court
[01:47:01.360 --> 01:47:05.280] is this particular document.
[01:47:05.280 --> 01:47:12.240] Based on evidence from the four corners of the document, it's evident that this document
[01:47:12.240 --> 01:47:19.160] is insufficient for filing according to the rules of the state.
[01:47:19.160 --> 01:47:31.920] 13.001 says that a claim or a document affecting a claim must be acknowledged or proven and
[01:47:31.920 --> 01:47:35.120] properly filed in the county record.
[01:47:35.120 --> 01:47:41.880] So if you can undermine the notary, then it's not properly acknowledged.
[01:47:41.880 --> 01:47:49.560] So you're not asking the judge to rule that the claim in the document's not valid.
[01:47:49.560 --> 01:47:56.040] You're simply addressing whether or not they followed all the rules when they filed it.
[01:47:56.040 --> 01:48:00.400] And if he rules, well, no, they didn't.
[01:48:00.400 --> 01:48:04.760] What you're to have, or you'd normally have in your back pocket a warranty deed, but you've
[01:48:04.760 --> 01:48:08.360] already got one.
[01:48:08.360 --> 01:48:15.400] If you can get them to rule that one of the documents on which the, well, for instance,
[01:48:15.400 --> 01:48:20.140] especially the deed of trust, if you can get them to rule that the deed of trust is for
[01:48:20.140 --> 01:48:26.900] any reason insufficient, then the deed of trust goes away.
[01:48:26.900 --> 01:48:30.920] And that's why I look so close at all the covenants.
[01:48:30.920 --> 01:48:37.920] You file a notice of default and then you follow 51903 saying, these guys breached this
[01:48:37.920 --> 01:48:42.760] contract or the contract itself.
[01:48:42.760 --> 01:48:47.840] I do a lot of argument about the deed of trust being farted on its face.
[01:48:47.840 --> 01:48:54.160] I mean, look at the transfer of rights section.
[01:48:54.160 --> 01:48:58.760] It transfers the rights to the property to the trustee.
[01:48:58.760 --> 01:49:06.520] Then you go down to the very next paragraph together with, and that's together with all
[01:49:06.520 --> 01:49:12.400] improvements or additions to the property are included in the collateral.
[01:49:12.400 --> 01:49:17.120] And then if it's a MERS document, then it says, you understand that MERS does not hold
[01:49:17.120 --> 01:49:22.200] beneficial interest, but only holds legal title.
[01:49:22.200 --> 01:49:29.440] Well, there are two forms of title, equitable and legal.
[01:49:29.440 --> 01:49:34.960] Now, the beneficiary holds equitable title.
[01:49:34.960 --> 01:49:41.480] So any equity coming in based on the promise to pay would go to the beneficiary.
[01:49:41.480 --> 01:49:44.040] They hold equitable title.
[01:49:44.040 --> 01:49:48.400] Legal title was transferred to the trustee.
[01:49:48.400 --> 01:49:49.400] That's the only other title.
[01:49:49.400 --> 01:49:50.400] That's the only other claim.
[01:49:50.400 --> 01:49:59.920] The very next paragraph, they take it away from the trustee and give it to MERS.
[01:49:59.920 --> 01:50:07.480] Texas Torts and, I think it's Texas Business and Commerce, get those backwards, Torts and
[01:50:07.480 --> 01:50:10.160] Remedies Business and Commerce.
[01:50:10.160 --> 01:50:17.080] I think this one is Business and Commerce, 2102.
[01:50:17.080 --> 01:50:30.280] It forbids the lender in Texas from requiring the borrower to transfer the property to the
[01:50:30.280 --> 01:50:31.280] lender.
[01:50:31.280 --> 01:50:35.080] I've heard you say that in a few recordings, yes.
[01:50:35.080 --> 01:50:47.040] So when you transfer the legal interest to the property to MERS as an agent for the lender,
[01:50:47.040 --> 01:50:58.000] that makes the deed of trust void on its face because it's in violation of, I think it's
[01:50:58.000 --> 01:51:03.480] 2201, Business and Commerce Code, it's either 2201 or 2102.
[01:51:03.480 --> 01:51:09.040] So that's one that a judge can wrap his head around that stuff a whole lot easier than
[01:51:09.040 --> 01:51:14.920] he can bifurcation and show me the note.
[01:51:14.920 --> 01:51:19.320] He holds the deed of trust, but he doesn't hold the note, so he has no authority.
[01:51:19.320 --> 01:51:20.320] It's too complicated.
[01:51:20.320 --> 01:51:21.320] Okay.
[01:51:21.320 --> 01:51:27.880] A lot of these arguments won that way, are you aware of?
[01:51:27.880 --> 01:51:28.880] Do what?
[01:51:28.880 --> 01:51:33.840] Are a lot of these arguments won by that issue alone?
[01:51:33.840 --> 01:51:36.080] The bifurcation issue?
[01:51:36.080 --> 01:51:37.080] I'm sorry, Randy.
[01:51:37.080 --> 01:51:39.840] Are you saying the bifurcation issue?
[01:51:39.840 --> 01:51:40.840] Yes.
[01:51:40.840 --> 01:51:45.000] Is this in federal or state court, these are winning?
[01:51:45.000 --> 01:51:49.220] In state court, are these being won?
[01:51:49.220 --> 01:51:51.520] And you're in Texas.
[01:51:51.520 --> 01:52:00.800] That is good to hear because it's taken the judges a while to really get to understand
[01:52:00.800 --> 01:52:06.520] these issues, and I've been hearing more and more wins in the state court.
[01:52:06.520 --> 01:52:09.040] So we've been sending people to federal courts.
[01:52:09.040 --> 01:52:14.960] The state court may be a better bet because the judges in the state court, they don't
[01:52:14.960 --> 01:52:19.920] have the political pressures that the federal judges do to protect the federal banks.
[01:52:19.920 --> 01:52:20.920] Okay.
[01:52:20.920 --> 01:52:24.360] The state court is closer to the people.
[01:52:24.360 --> 01:52:28.960] And I don't want to take it from your other listeners, but I do have one other question.
[01:52:28.960 --> 01:52:29.960] Okay.
[01:52:29.960 --> 01:52:38.680] In another precinct, JP, forceful detainer action, I was ordered, I'd been moved around
[01:52:38.680 --> 01:52:44.720] from four different precincts on the same property for a forceful detainer action, and
[01:52:44.720 --> 01:52:48.080] they sent me to precinct five, Gary Ritchie.
[01:52:48.080 --> 01:52:53.720] When I got there, Gary Ritchie sitting in the stands, and they brought in a visiting
[01:52:53.720 --> 01:52:56.120] judge, Barbara Farrell.
[01:52:56.120 --> 01:53:03.120] I did my due diligence on Mrs. Farrell, and she doesn't have anything filed with the county
[01:53:03.120 --> 01:53:11.920] clerk nor the secretary of state saying any documents, oath of office, a bribery statement,
[01:53:11.920 --> 01:53:12.920] anything.
[01:53:12.920 --> 01:53:18.160] Did you ask the bailiff to arrest her?
[01:53:18.160 --> 01:53:24.040] For two weeks ago, I sent certified mail and I asked the head constable in precinct five
[01:53:24.040 --> 01:53:25.040] to arrest her.
[01:53:25.040 --> 01:53:27.400] He says, man, I've known her for 20 some years.
[01:53:27.400 --> 01:53:30.320] I said, I don't care how long you all known her for.
[01:53:30.320 --> 01:53:37.280] So I did a follow-up call this morning that, Mr. Siegel, did you arrest this imposter?
[01:53:37.280 --> 01:53:46.400] And he says, Mr. Wethi, I took that complaint that you sent me and I took it to the DA.
[01:53:46.400 --> 01:53:47.560] I said, which DA?
[01:53:47.560 --> 01:53:49.160] We got plenty in Tarrant County.
[01:53:49.160 --> 01:53:56.080] Well, I took it over to the civil division, Shannon, Shannon, I forget what his name is.
[01:53:56.080 --> 01:53:57.920] Ann Diamond is the head of the civil division.
[01:53:57.920 --> 01:54:06.120] Well, I want to say Joe Shannon, but anyway, I spoke to this DA today and I said, sir,
[01:54:06.120 --> 01:54:07.120] you've got this complaint.
[01:54:07.120 --> 01:54:12.880] He says, well, he says, I represent all these people and I know everybody and your claim
[01:54:12.880 --> 01:54:13.880] is bogus.
[01:54:13.880 --> 01:54:22.680] He says, but I advise you take it to the Texas Bar Association, make a complaint.
[01:54:22.680 --> 01:54:40.120] Well, he has a problem, exactly 2.03 and 2.03 the legislature did not mince words.
[01:54:40.120 --> 01:54:41.740] They were very clear.
[01:54:41.740 --> 01:54:44.160] So this is how we create the politics.
[01:54:44.160 --> 01:54:51.400] Now you go after him, you do this a little bit and you'll find their attitudes begin
[01:54:51.400 --> 01:54:52.880] to change.
[01:54:52.880 --> 01:54:58.000] Well that's what we're looking for because this week alone in white settlement on another
[01:54:58.000 --> 01:55:03.280] property I was out, they evicted my tenant that I put in that property.
[01:55:03.280 --> 01:55:07.920] They told me I'm not the property owner, didn't even ask me for documentation.
[01:55:07.920 --> 01:55:14.080] They said, Mr. Hayes said he's put you in jail and you're nothing but a con artist.
[01:55:14.080 --> 01:55:18.760] I said, wait a minute, what are you guys all talking about me?
[01:55:18.760 --> 01:55:23.080] I own this property and they said, no sir, you are to leave.
[01:55:23.080 --> 01:55:27.500] You've got a criminal trespass warning issued to you right now.
[01:55:27.500 --> 01:55:29.000] Who did that?
[01:55:29.000 --> 01:55:33.160] That was precinct four out of ASL.
[01:55:33.160 --> 01:55:35.320] The constable's office.
[01:55:35.320 --> 01:55:39.480] That's a fee, Oh, precincts four out of ASL.
[01:55:39.480 --> 01:55:40.480] Yes.
[01:55:40.480 --> 01:55:43.560] Oh, I don't know that.
[01:55:43.560 --> 01:55:47.800] He was an elderly gentleman who was out on site and his boss.
[01:55:47.800 --> 01:55:52.440] I forget what he said his boss name was in ASL.
[01:55:52.440 --> 01:56:01.600] Oh, cause I know that I've got criminal charges against the J.P. in Lake Worth.
[01:56:01.600 --> 01:56:04.320] You know what?
[01:56:04.320 --> 01:56:05.320] I'm sorry.
[01:56:05.320 --> 01:56:06.320] I did say ASL.
[01:56:06.320 --> 01:56:07.320] It is Lake Worth.
[01:56:07.320 --> 01:56:09.520] Precinct four is Lake Worth.
[01:56:09.520 --> 01:56:10.520] Okay.
[01:56:10.520 --> 01:56:11.520] That's a woman.
[01:56:11.520 --> 01:56:13.400] Oh, is it?
[01:56:13.400 --> 01:56:15.400] Her name's Wright.
[01:56:15.400 --> 01:56:16.840] Okay.
[01:56:16.840 --> 01:56:21.880] He wouldn't let me see some documents, said I was a security risk.
[01:56:21.880 --> 01:56:25.720] I tried to get her bailiff to arrest her and he refused.
[01:56:25.720 --> 01:56:27.600] So I went to the constable.
[01:56:27.600 --> 01:56:28.600] The constable refused.
[01:56:28.600 --> 01:56:31.800] I went across the streets of the sheriff's department.
[01:56:31.800 --> 01:56:36.320] Sheriff's department refused while the constable was standing there and it was a captain on
[01:56:36.320 --> 01:56:37.920] the sheriff's department.
[01:56:37.920 --> 01:56:43.320] I turned to the constable, constable, tell this captain on the sheriff's department to
[01:56:43.320 --> 01:56:46.360] take his chicken suit off.
[01:56:46.360 --> 01:56:53.520] And the sheriff captain said, no constable, I'm not taking my chicken suit off.
[01:56:53.520 --> 01:56:55.880] They sent me to the district attorney.
[01:56:55.880 --> 01:56:59.600] District attorney suggested I should take it to the sheriff's department.
[01:56:59.600 --> 01:57:03.920] And I told him, no, I'll be taking this to the grand jury.
[01:57:03.920 --> 01:57:08.920] And the only thing you guys get to decide is whether you interfere with me in the process.
[01:57:08.920 --> 01:57:13.360] So they're familiar with the process.
[01:57:13.360 --> 01:57:24.920] If you go down to the court when the grand jury's meeting, ask them, where is the grand
[01:57:24.920 --> 01:57:27.720] jury meeting?
[01:57:27.720 --> 01:57:30.440] And they'll probably tell you.
[01:57:30.440 --> 01:57:31.520] Not necessarily.
[01:57:31.520 --> 01:57:33.520] They're keeping it hush-hush.
[01:57:33.520 --> 01:57:41.560] Then go down beforehand and during the day, sometime when the grand jury won't be there,
[01:57:41.560 --> 01:57:49.760] or I sometimes I fib to them and tell them that my son is doing a report for high school
[01:57:49.760 --> 01:57:56.500] on grand juries and just be fascinated and ask them where, does the grand jury have their
[01:57:56.500 --> 01:57:57.500] own court?
[01:57:57.500 --> 01:57:58.880] Where do they meet at?
[01:57:58.880 --> 01:58:03.440] And these people will drag you around and show you everything.
[01:58:03.440 --> 01:58:08.960] Once you know, then you go down and you hand a packet to the bailiff, you approach the
[01:58:08.960 --> 01:58:13.640] bailiff and say, tell him your name, instruct the foreman that I have business with the
[01:58:13.640 --> 01:58:14.640] court.
[01:58:14.640 --> 01:58:17.080] And he'll say, may I tell him the nature of the business?
[01:58:17.080 --> 01:58:23.200] Yes, you may give him these, give them to him and then turn and walk away.
[01:58:23.200 --> 01:58:30.160] Now the district attorney's office will recognize the procedure.
[01:58:30.160 --> 01:58:32.520] They've seen it before.
[01:58:32.520 --> 01:58:35.680] So very good chance they won't attempt to interfere.
[01:58:35.680 --> 01:58:39.200] And then you won't have to go after them.
[01:58:39.200 --> 01:58:40.840] Okay, hang on.
[01:58:40.840 --> 01:58:42.080] We'll finish up on the other side.
[01:58:42.080 --> 01:58:45.040] This is Randy Kelton, Deborah Stevens, Rule of Law Radio.

[01:59:04.600 --> 01:59:07.840] the profound meaning of the scripture.
