[00:48.840 --> 00:53.360] demanding a congressional investigatory committee be created in the wake of the NSA spying
[00:53.360 --> 00:58.240] scandal. At the same time, a global petition calling on Congress to account for the domestic
[00:58.240 --> 01:04.140] spying and to end illegal surveillance was launched at stopwatching.us. This comes as
[01:04.140 --> 01:07.920] eight senators introduced legislation on Tuesday that would require the Attorney General to
[01:07.920 --> 01:13.440] declassify significant opinions made by courts operating under the secretive Foreign Intelligence
[01:13.440 --> 01:17.360] Surveillance Act. If the bill were adopted, the government would be required to reveal
[01:17.360 --> 01:24.360] the kinds of National Security Agency surveillance activities that came to light last week.
[01:27.440 --> 01:30.860] Also on Tuesday, a jury reached a verdict siding with the City of Austin in the civil
[01:30.860 --> 01:35.720] trial against Officer Nathan Wagner, who shot and killed 20-year-old Byron Carter on May
[01:35.720 --> 01:41.160] 30, 2011. Wagner shot at and killed Carter after Carter and his friend attempted to drive
[01:41.160 --> 01:45.940] away in their car as two unannounced armed men, Officer Wagner and Rodriguez, approached
[01:45.940 --> 01:50.800] their car. Neither of the young men were armed or suspected of any crime. After Wagner was
[01:50.800 --> 01:55.600] cleared of any wrongdoing by Austin Police s internal affairs, the family of Carter filed
[01:55.600 --> 02:00.340] a civil suit claiming Byron s constitutional rights were violated and being killed by Wagner.
[02:00.340 --> 02:04.080] After five hours of deliberation, the jury decided that his rights were not violated
[02:04.080 --> 02:08.120] and being killed by Wagner as they concluded the officers were only looking out for their
[02:08.120 --> 02:12.720] own safety. In the wake of the verdict, the Wagner family was visibly distraught and many
[02:12.720 --> 02:16.760] in the community were enraged by the jury s decision. Recognizing the failure of the
[02:16.760 --> 02:21.080] state justice system and the local Monopoly Police Department, Byron Carter s grandmother

[04:35.680 --> 04:42.860] And last week when we went out, we were talking about gun control.
[04:42.860 --> 04:46.920] I'm in Austin at the moment, I was driving down and listening to the radio and there
[04:46.920 --> 04:58.160] was a program on the public radio station where they were talking to some senators.
[04:58.160 --> 05:03.580] And apparently these guys are pretty upset.
[05:03.580 --> 05:11.240] They have been pushing to get really an invasive gun control in the past.
[05:11.240 --> 05:17.200] And they put them before the Congress and just got slammed big time.
[05:17.200 --> 05:26.720] And these guys were absolutely, I don't know what the term would be, these guys were really
[05:26.720 --> 05:39.740] outraged at a number of Democratic senators, one from Alaska and three or four names specifically,
[05:39.740 --> 05:44.580] but they were just outraged that they voted against these measures.
[05:44.580 --> 05:55.740] And they mainly, the person they had on was just lying through his teeth.
[05:55.740 --> 06:06.620] He said that they got voted down handily, but that 90% of the public agreed with him.
[06:06.620 --> 06:15.360] And the reason these senators voted against the measures is because they got so much input
[06:15.360 --> 06:21.520] from their constituents that they listened to the constituents instead of the money.
[06:21.520 --> 06:33.640] And Mayor Bloomberg was talking to the stock market people who tend to donate heavily to
[06:33.640 --> 06:41.440] campaigns and twisting their arms to get them not to provide funds for these senators so
[06:41.440 --> 06:43.020] that they could get them voted out.
[06:43.020 --> 06:55.600] I thought this was the most outrageous incident or evidence in how much contempt they hold
[06:55.600 --> 07:06.360] the voter, that somehow this was just a conspiracy on the part of these senators to deny these
[07:06.360 --> 07:13.840] poor babies their control of our lives and our guns.
[07:13.840 --> 07:18.960] And they did this just to hurt these folks, not because they had good reason.
[07:18.960 --> 07:26.400] And I think the thing that bothered me the most about it was they kept calling this the
[07:26.400 --> 07:35.020] common sense requirements to stem all of this gun violence.
[07:35.020 --> 07:40.320] And I thought, are you out of your minds?
[07:40.320 --> 07:45.720] Whatever it is, it is not in any way common sense.
[07:45.720 --> 07:49.600] It is absolutely completely uncommon.
[07:49.600 --> 07:53.760] There's nothing common about it.
[07:53.760 --> 08:01.840] And the only common sense approach is to understand that human beings are human beings.
[08:01.840 --> 08:04.800] Human beings have problems.
[08:04.800 --> 08:07.600] Human beings hurt one another.
[08:07.600 --> 08:12.000] Human beings have always hurt one another.
[08:12.000 --> 08:16.440] And taking weapons away from human beings is not something we're going to be able to

[08:17.440 --> 08:28.520] Oh, we can from probably 90% of the population, but that's the 90% who should have weapons
[08:28.520 --> 08:36.800] in order to protect them against the other 6 to 10% who should never have weapons.
[08:36.800 --> 08:46.600] And just like the struggle against prostitution and drugs, countries have been fighting against
[08:46.600 --> 08:51.400] prostitution for 6,000 years.
[08:51.400 --> 08:54.480] They never beat it, never even put a dent in it.
[08:54.480 --> 09:02.000] The drugs, the war against drugs has only made the proliferation of drugs worse.
[09:02.000 --> 09:06.800] There are things we cannot legislate away.
[09:06.800 --> 09:13.000] And guns, if we take guns away from the public, the only ones who are going to have them obviously
[09:13.000 --> 09:16.040] are the criminals.
[09:16.040 --> 09:24.320] The only common sense way to fix this is put guns in the hands of everybody.
[09:24.320 --> 09:28.680] These guys are looking for themselves a turkey shoot.
[09:28.680 --> 09:31.000] The last thing they want is the turkeys to shoot back.
[09:31.000 --> 09:37.200] I listened to this whole program and they had two people supposedly on two sides of
[09:37.200 --> 09:43.760] this issue and both of them were on the side of gun control.
[09:43.760 --> 09:49.020] One had one idea of how it should be done and another had another idea of how it should
[09:49.020 --> 09:54.760] be done and that was the public debate they were having.
[09:54.760 --> 10:03.440] And both of them feeding nothing but horse manure propaganda.

[11:04.200 --> 11:09.860] I think they figured out that people are not going to let go of their guns and so instead
[11:09.860 --> 11:15.200] of turning this thing into a bloody mess by trying to go around and grab the guns door
[11:15.200 --> 11:20.320] to door, which they still may try to do that and they have already done that in many situations.
[11:20.320 --> 11:23.440] Look at what happened with Katrina in New Orleans.
[11:23.440 --> 11:29.840] So they probably will do that in certain areas as litmus tests to see how well they can get

[11:31.880 --> 11:37.180] Eventually some people are going to fight back and they know that and I mean starting
[11:37.180 --> 11:43.340] a bloody mess, personally, I just don't think it's their style unless they want to do it
[11:43.340 --> 11:48.600] for the purpose of purposefully instigating that sort of thing so that they can have an
[11:48.600 --> 11:54.960] excuse to clamp down with martial law full force, which they very well may do that.
[11:54.960 --> 12:00.500] But if they do start going door to door to grab guns, it's not because they really have
[12:00.500 --> 12:02.720] the intent of grabbing all the guns.
[12:02.720 --> 12:06.720] If they start going door to door grabbing the guns, it's for the intent of starting
[12:06.720 --> 12:11.060] a civil war so that they can come down full force with full martial law.
[12:11.060 --> 12:17.400] Now what it looks like they're doing right now is that they're just buying up all the
[12:17.400 --> 12:19.780] ammo so that we don't have any.
[12:19.780 --> 12:23.080] That's what it looks like they're doing right now, but I don't put it past them to go door
[12:23.080 --> 12:27.840] to door grabbing guns for the purpose of instigating people to shoot back so they can clamp down
[12:27.840 --> 12:29.320] with full force martial law.
[12:29.320 --> 12:31.880] That's what I think.
[12:31.880 --> 12:41.240] Well one thing, their real concern was the gun lobby and then listening to them rail
[12:41.240 --> 12:49.200] against guns and the gun lobby and the American Rifle Association.
[12:49.200 --> 13:00.960] They really seem to be desperate in trying to discredit the ARA.
[13:00.960 --> 13:06.460] And now they're claiming now that they have a couple of other coalitions that may take
[13:06.460 --> 13:17.800] away the ARA's monopoly on advertising and political pressure for the gun lobby.
[13:17.800 --> 13:25.720] In listening to that and listening to it somewhat more objectively, I was really surprised at
[13:25.720 --> 13:34.820] how much real political power the American Rifle Association has.
[13:34.820 --> 13:41.800] And I fully suspect and I think they know that in spite of their efforts, the more they
[13:41.800 --> 13:50.440] try to move against the guns, move toward gun control, the stronger the American Rifle
[13:50.440 --> 13:52.960] Association gets.
[13:52.960 --> 14:00.720] And I took this whole thing as a propaganda piece trying to nullify the effect of the
[14:00.720 --> 14:04.200] American Rifle Association.
[14:04.200 --> 14:14.040] And from the frantic nature of their arguments, I was really encouraged that if these guys
[14:14.040 --> 14:25.400] would get on national radio and talk what was absolutely nonsense and just lie through
[14:25.400 --> 14:36.260] their teeth, the guy actually said that 90 percent of the public agreed with him.
[14:36.260 --> 14:44.680] Now that's in these days and times, even if you agree with them, that's going to be hard
[14:44.680 --> 14:46.880] to swallow.
[14:46.880 --> 14:54.560] To on the one hand say that there is so much support for the American Rifle Association
[14:54.560 --> 14:58.760] that we can't get any of our measures passed.
[14:58.760 --> 15:07.560] Even those simple measures of limiting the size of clips for automatic weapons.
[15:07.560 --> 15:13.880] But yet 90 percent of the people are behind their efforts.
[15:13.880 --> 15:20.600] That is so contradictory that I can't see anyone even who's on their side agreeing with
[15:20.600 --> 15:21.600] that.
[15:21.600 --> 15:28.800] That is a very good sign that tells me they are not going to get these guns removed.
[15:28.800 --> 15:35.480] And the main reason these senators did not vote for it is because their constituents
[15:35.480 --> 15:41.440] told them, you vote for that and we will vote you out.
[15:41.440 --> 15:48.000] And they understood there are two kinds of power, money and votes.
[15:48.000 --> 15:55.720] And in this case Mayor Bloomberg can pressure all these buddies in the stock market area,
[15:55.720 --> 16:02.960] but that may not help him either because the stock market, the investors, just like the
[16:02.960 --> 16:09.160] rest of the American public, will tend to be divided along the same lines that the American
[16:09.160 --> 16:12.040] public is divided along.
[16:12.040 --> 16:21.000] So I think this commentator and Bloomberg probably believe they have more power than
[16:21.000 --> 16:22.600] they actually do.

[21:40.320 --> 21:45.320] And in an armed society, no one tried to take advantage,

[21:49.320 --> 21:53.320] unless they were ready to die really fast.

[22:38.320 --> 22:44.320] Thank you. Well, the fun thing was about a week later, I got pulled over by another police department,
[22:44.320 --> 22:48.320] and I did everything like Eddie trained me to do.
[22:48.320 --> 22:52.320] And the officer made some bail threats and things like that.
[22:52.320 --> 22:57.320] But long story short, he just gave me a ticket, and I was able to kind of go along my way.
[22:57.320 --> 23:02.320] But I've been doing a lot of reading and a lot of homework since the last talking
[23:02.320 --> 23:05.320] and kind of going through your archives.
[23:05.320 --> 23:08.320] And you always mentioned that we're the sovereign.
[23:08.320 --> 23:12.320] And I heard you talking just a moment ago about gun control.
[23:12.320 --> 23:16.320] And I think what I'm going to mention to you today dovetails perfectly with that.
[23:16.320 --> 23:23.320] If we're the sovereign, why are we looking to have the government regulate us?
[23:23.320 --> 23:28.320] We should really put them on notice. I mean, we have a contract, which is the Constitution.
[23:28.320 --> 23:33.320] The Constitution tells the government their relationship to the people,
[23:33.320 --> 23:39.320] but it seems like our leaders and the officers of our government don't seem to get it.
[23:39.320 --> 23:47.320] So I was listening to a guy on the internet, and he made a lot of really failing points.
[23:47.320 --> 23:53.320] And the one point that he said is, first, you establish your position as an individual with that government,
[23:53.320 --> 23:58.320] because if you don't first establish your position with them in writing,
[23:58.320 --> 24:03.320] whatever happens to you, you're kind of like dead meat in the water.
[24:03.320 --> 24:12.320] But my question to you is, how do you establish your sovereign position when you get pulled over
[24:12.320 --> 24:21.320] without giving those agencies that do all of these regulatory actions prior notice?
[24:21.320 --> 24:25.320] It's like, if the Constitution doesn't clue a man, how do you clue the men before it?
[24:25.320 --> 24:30.320] And one of these guys is saying that you should give them fair notice that you're sovereign.
[24:30.320 --> 24:35.320] And these regulatory issues will not be tolerated.
[24:35.320 --> 24:43.320] And if they should be, should I encounter these officers, consider the government be known,
[24:43.320 --> 24:47.320] that these are the charges that will be incurred for all of these infractions.
[24:47.320 --> 24:51.320] And he gives a detailed list, and he actually associates a dollar charge to it.
[24:51.320 --> 25:06.320] Okay. I've heard these kinds of positions, and I had someone call in once, and whoever it was obviously had an agenda.
[25:06.320 --> 25:16.320] And he said, Mr. Kelton, how do you assert your sovereignty?
[25:16.320 --> 25:25.320] I said, I act like one. You do not have to assert your sovereignty.
[25:25.320 --> 25:37.320] You are sovereign. You do not have to explain to some low-level jackbooted thug what your position is.
[25:37.320 --> 25:56.320] He is not going to understand, and all you're going to do in trying to deal with someone who neither has the capacity nor the interest to care is generate a confrontation that you really don't need.
[25:56.320 --> 26:03.320] I suggest that we do not give police officers legal advice.
[26:03.320 --> 26:07.320] Oh, no, no. That's not the point that I was trying to make.
[26:07.320 --> 26:13.320] The point that I was trying to make is when you, like, for example, I'm preparing two letters.
[26:13.320 --> 26:19.320] One is going to be to the state attorney general, and one is going to be to the federal U.S. attorney general.
[26:19.320 --> 26:28.320] And basically it's my understanding that as long as I do no harm, I'm a free citizen of the United States of America.
[26:28.320 --> 26:35.320] If that is not the correct understanding, please write me back and give me clarity.
[26:35.320 --> 26:39.320] Okay, hold on, hold on. I'm going to suggest a somewhat different approach.

[26:41.320 --> 26:59.320] If you were the CEO of a corporation and as the CEO, you say you go into one of the, say you own a, you're the CEO of a corporation that has a chain of stores.

[27:00.320 --> 27:12.320] And you go into one of these stores and you are treated, they don't know who you are, and they treat you very badly.
[27:12.320 --> 27:14.320] How do you handle that?

[29:10.320 --> 29:20.320] At this point you're free to do what your job entails you to do, but understand that we all have choices to make and choices have consequences.

[34:25.320 --> 34:36.320] I asked the officer some questions that went directly to points of law, things that I would need to bring back later.
[34:36.320 --> 34:45.320] Unlike Eddie, he doesn't propose any kind of interaction with the government, and Deborah's going to talk about that part.
[34:45.320 --> 34:52.320] I entered into an agreement with the Department of Transportation, and I asked the officer,
[34:52.320 --> 34:58.320] did you notice the DOT number on the back of my vehicle?
[34:58.320 --> 35:00.320] He said, no, I didn't.
[35:00.320 --> 35:05.320] Well, go notice it, and then run that number.
[35:05.320 --> 35:08.320] He said, I don't do that.
[35:08.320 --> 35:09.320] Well, start doing it.
[35:09.320 --> 35:11.320] Go run the number.
[35:11.320 --> 35:14.320] And he refused, and that's all I needed.
[35:14.320 --> 35:17.320] And then he asked me if I had insurance.
[35:17.320 --> 35:22.320] I said, you can check that with your own computer.
[35:22.320 --> 35:23.320] Again, he said, I don't do that.
[35:23.320 --> 35:25.320] I said, well, start doing it.
[35:25.320 --> 35:26.320] Go check it.
[35:26.320 --> 35:28.320] He said, I'm not going to check it.
[35:28.320 --> 35:30.320] I'm not going to give you my insurance, and I'll write you a ticket.

[35:32.320 --> 35:37.320] And he wrote me a ticket for no insurance and for speeding.
[35:37.320 --> 35:43.320] That's all the interaction I had with him, and I needed that so that I could establish
[35:43.320 --> 35:49.320] in court that he had notice that I was a private operator, not in commerce.
[35:49.320 --> 35:54.320] That's what that DOT number gives him official notice of.
[35:54.320 --> 36:01.320] But beyond that, I didn't tell him what my rights are and what his duty was, and I especially
[36:01.320 --> 36:08.320] did not imply that he was going to beat me up or pull his pistol and none of that stuff
[36:08.320 --> 36:11.320] because he gave no indication.
[36:11.320 --> 36:19.320] And if one begins to get a little excited, the first thing I do is ask them, why are
[36:19.320 --> 36:23.320] you getting agitated?
[36:23.320 --> 36:27.320] Agitated is like a magic word.
[36:27.320 --> 36:34.320] Police are used to confrontation, and if they can get you into a confrontation, they can
[36:34.320 --> 36:37.320] accuse you of being agitated.
[36:37.320 --> 36:45.320] And if you appear to be agitated, that tends to authorize them to pull their billy club
[36:45.320 --> 36:50.000] or their mace or their taser or their pistol and beat you into unconsciousness because
[36:50.000 --> 36:51.000] you were agitated.
[36:51.000 --> 36:55.820] So the first thing I do is accuse them of being agitated.
[36:55.820 --> 37:00.720] And every time I've done that, they tend to recognize it.
[37:00.720 --> 37:05.440] And I want to calm down this situation.
[37:05.440 --> 37:09.880] I don't want this one getting out of hand because you're dealing with a police officer
[37:09.880 --> 37:14.240] who will lie like a dog.
[37:14.240 --> 37:19.600] He will because he knows he can because everyone will cover for him.
[37:19.600 --> 37:23.360] So I have little to do with these guys as I can.
[37:23.360 --> 37:26.120] The guy wrote me the ticket and I went away.
[37:26.120 --> 37:31.080] A couple days later, I came down to his police department and dropped a couple criminal charges
[37:31.080 --> 37:39.600] against him with his sergeant, gave him a couple of information requests and went away.
[37:39.600 --> 37:43.480] Now I can't get them to bring me to court.
[37:43.480 --> 37:49.040] They don't want to see me because I'm acting like a sovereign.
[37:49.040 --> 37:51.320] I felt like the officer did something wrong.
[37:51.320 --> 37:53.800] Last thing I'm going to do is tell the officer.
[37:53.800 --> 37:59.640] If I catch somebody breaking into my house, stealing my stuff, and he's got a pistol and
[37:59.640 --> 38:04.720] I don't, I'm going to stay back out of the way and gather as much information as I can.
[38:04.720 --> 38:10.360] And once he's gone away, I'm going to call the police and get them to go beat him up.
[38:10.360 --> 38:15.640] I was coming out of a store once and a guy was out there drunk and he's screaming at
[38:15.640 --> 38:18.600] his girlfriend.
[38:18.600 --> 38:23.840] I walked up to get to my car and they were next to my car, so I deliberately walked between
[38:23.840 --> 38:27.640] him and the car and his girlfriend.
[38:27.640 --> 38:33.320] And he hollered at me and I said, well, gee whiz, it looks like you want to fight.
[38:33.320 --> 38:35.520] And he said, I'll fight you if you want to.
[38:35.520 --> 38:37.000] I said, no, I don't want to.
[38:37.000 --> 38:38.560] But I dialed 911.
[38:38.560 --> 38:40.680] I got somebody here who want to fight with you.
[38:40.680 --> 38:43.480] And the operator answered and I said, hello, my name is Randy Kelton.

[38:45.120 --> 38:46.120] And I got this guy here.
[38:46.120 --> 38:49.320] He looks pretty drunk and he wants to fight.
[38:49.320 --> 38:54.240] Now, I don't want to fight with him, but I told him that you probably had somebody that

[38:55.400 --> 38:57.080] And the dispatcher said, oh, you bet.
[38:57.080 --> 38:59.080] We got a lot of guys that want to fight with him.

[49:35.840 --> 49:42.880] Well, at any rate, the so-called federal building wasn't actually a federal building like we

[49:44.820 --> 49:46.660] It was actually state property.
[49:46.660 --> 49:51.880] It was owned by the state of Oklahoma and the federal government was basically a tenant,
[49:51.880 --> 49:52.880] all right?
[49:52.880 --> 49:54.180] They were renting it.
[49:54.180 --> 50:01.920] And so the federal government had no jurisdiction under constitution at all under the federal
[50:01.920 --> 50:02.920] constitution.
[50:02.920 --> 50:10.880] They had zero jurisdiction to do anything, to prosecute, to make arrests.
[50:10.880 --> 50:14.060] The FBI shouldn't have been involved, nothing.
[50:14.060 --> 50:20.160] And the reason for that is because the federal government only has jurisdiction, governmental
[50:20.160 --> 50:27.880] jurisdiction on areas that are not just, land that is not just owned by the federal government,
[50:27.880 --> 50:34.120] but it has to be ceded, and that's with a C, C-E-D-E-D, ceded to the federal government
[50:34.120 --> 50:35.480] by the state.
[50:35.480 --> 50:41.480] And that means the state legislatures have to pass a law ceding a certain piece of land.
[50:41.480 --> 50:44.760] The governor has to sign it, et cetera, et cetera.
[50:44.760 --> 50:50.840] I know someone who was in the military here in Texas, the Bergstrom here, which is now
[50:50.840 --> 50:59.160] the municipal airport, used to be a military base, an air force base, but that wasn't,
[50:59.160 --> 51:03.320] the federal government didn't have jurisdiction over that land.
[51:03.320 --> 51:08.640] It was owned by the city, I mean, I'm sorry, it was owned by Travis County, it was owned
[51:08.640 --> 51:09.640] by the state.
[51:09.640 --> 51:14.500] And so whenever there was any kind of altercation, the military police couldn't even do anything.
[51:14.500 --> 51:16.760] They had to send in the sheriff, all right?
[51:16.760 --> 51:22.320] Now the post offices, things like that in general, they don't, there's no federal jurisdiction
[51:22.320 --> 51:23.320] there.
[51:23.320 --> 51:25.400] Most of the federal government's renting those buildings, all right?
[51:25.400 --> 51:29.720] I looked up all the properties in Texas that actually have federal jurisdiction and there's
[51:29.720 --> 51:31.600] only a dozen or so.
[51:31.600 --> 51:35.680] There are a few military bases, but most of them are federal prisons.
[51:35.680 --> 51:39.480] Okay, so I just want to lay this background here about the jurisdiction.
[51:39.480 --> 51:44.200] So Harmon brings in this argument, citing constitution saying, look, this should have
[51:44.200 --> 51:46.160] been a state murder case.
[51:46.160 --> 51:50.100] You guys didn't have any jurisdiction at all for one thing.
[51:50.100 --> 51:56.160] Number two, you come in and under the constitution it says if you're going to do any prosecutions
[51:56.160 --> 52:01.980] or take any cases in the court, in a federal court, you have to stay in the district where
[52:01.980 --> 52:03.720] the event occurred.
[52:03.720 --> 52:08.000] Well they not only moved it out of district, they moved the case out of state to Colorado.
[52:08.000 --> 52:15.280] Okay, well the reason they did that was because everybody, not only in Oklahoma City, but
[52:15.280 --> 52:19.400] the whole state of Oklahoma pretty much knew what had happened, that the government had
[52:19.400 --> 52:22.840] pulled it off, mainly the ATF and the FBI.
[52:22.840 --> 52:30.140] Okay, there was one media outlet, K4, that was reporting the truth and eventually they
[52:30.140 --> 52:34.240] got bought out by the New York Times and everyone who was reporting the truth got fired.
[52:34.240 --> 52:41.060] All right, so he brings in all these arguments and says, look, you guys are out of luck under
[52:41.060 --> 52:42.200] the constitution.
[52:42.200 --> 52:43.920] This was state property.
[52:43.920 --> 52:44.920] You had no jurisdiction.
[52:44.920 --> 52:47.880] Furthermore, you moved it out of state, on and on and on.
[52:47.880 --> 52:49.200] You have no case.
[52:49.200 --> 52:50.480] We want a stay of execution.
[52:50.480 --> 52:52.720] We want to depose McVeigh, et cetera, et cetera.
[52:52.720 --> 52:57.940] Well the court ruled against them, and so the trial court.
[52:57.940 --> 53:04.600] So they appealed to the appellate court, which was I believe 7th Circuit.
[53:04.600 --> 53:07.880] And here's what the court of appeals said.
[53:07.880 --> 53:13.960] The federal court of appeals said in this case, you can look it up, Graham v. Lapin.
[53:13.960 --> 53:17.720] This was a case where Harman represented, and this was a case where Harman calls it
[53:17.720 --> 53:19.980] the padded two by four.
[53:19.980 --> 53:23.200] And I think he's maybe being a little nice saying that there was actually some padding
[53:23.200 --> 53:24.200] on it.
[53:24.200 --> 53:32.680] Basically what the 7th Circuit told Harman and his clients was that, you know what, the
[53:32.680 --> 53:39.040] constitution doesn't matter because everything is by commercial agreement and we're not under
[53:39.040 --> 53:40.540] the constitution anymore.
[53:40.540 --> 53:43.140] The constitution is the supreme law of the land.
[53:43.140 --> 53:44.140] But guess what?
[53:44.140 --> 53:45.640] We're not under law of the land anymore.
[53:45.640 --> 53:47.680] We are under maritime law.
[53:47.680 --> 53:51.880] And they cited Title 18 Section 7.
[53:51.880 --> 53:54.280] And I'm going to read it to you here.
[53:54.280 --> 54:02.520] This is a special maritime and territorial jurisdiction of the United States defined.
[54:02.520 --> 54:04.400] And there's several paragraphs here.
[54:04.400 --> 54:13.480] And I believe the one that, yes, it's paragraph 3 was the applicable paragraph.
[54:13.480 --> 54:19.580] It says that there is special maritime and territorial jurisdiction of the United States,
[54:19.580 --> 54:25.400] paragraph 3, any lands reserved or acquired for the use of the United States and under
[54:25.400 --> 54:32.240] the exclusive or concurrent jurisdiction thereof, or any place purchased or otherwise acquired
[54:32.240 --> 54:38.280] by the United States by consent of the legislature of the state in which the name shall be for
[54:38.280 --> 54:44.280] the erection of a Ford magazine, arsenal, dockyard, or other needful building.
[54:44.280 --> 54:45.280] Okay.
[54:45.280 --> 54:48.980] So basically this was a needful building, all right?
[54:48.980 --> 54:54.760] And so the federal, the court system, the 7th Circuit Court of Appeals told Harman and
[54:54.760 --> 54:57.720] everyone else, constitution doesn't matter.
[54:57.720 --> 54:59.160] We have maritime jurisdiction.
[54:59.160 --> 55:06.520] We have special maritime territorial jurisdiction because basically we have reserved this building
[55:06.520 --> 55:09.720] for our use.
[55:09.720 --> 55:17.120] And so, well, wait a minute, how can this be when it seems that this statute is in complete
[55:17.120 --> 55:18.960] and direct violation of the constitution?
[55:18.960 --> 55:23.080] Well, the answer is the constitution doesn't matter.
[55:23.080 --> 55:25.720] There is no constitution anymore.
[55:25.720 --> 55:32.400] Everything is by commercial agreement now that we are in the funny money system.
[55:32.400 --> 55:33.880] Everything is by statute.
[55:33.880 --> 55:35.440] Everything is by commercial agreement.
[55:35.440 --> 55:38.160] There's no such thing as an unconstitutional law.
[55:38.160 --> 55:47.240] They could pass whatever laws they want, but it matters not to us unless we agree to it.

[56:35.760 --> 56:43.120] Common law crimes, all right, everything else is by commercial agreement.

[56:46.360 --> 56:50.080] The law only applies to you, the statutes and the statutes themselves only apply to
[56:50.080 --> 56:54.040] you if you have agreed to be regulated by them.

[57:09.880 --> 57:16.680] letter, because the minute you ask them for anything, you've just opted into their commercial

[57:18.680 --> 57:21.520] So, and also we have to dispel this myth about sovereign citizen.

[57:57.440 --> 58:02.440] And that's one reason why the bad guys get all bent out of shape about people that call
[58:02.440 --> 58:08.840] themselves sovereigns, because what the legal connotation really is, I say, I'm a free human

[58:10.840 --> 58:14.560] I don't, I don't call myself a sovereign, but at the least don't ever call yourself
[58:14.560 --> 58:17.840] a sovereign citizen because that's an oxymoron.

[58:18.840 --> 58:21.480] That's, that's like saying I'm black and white at the same time.

[01:06:08.280 --> 01:06:14.640] arguments matter not because the Constitution doesn't matter because we are under special
[01:06:14.640 --> 01:06:20.680] maritime and territorial jurisdiction of the United States, they said, regarding this particular
[01:06:20.680 --> 01:06:28.160] situation because it has to do with the building that the United States was using, okay?
[01:06:28.160 --> 01:06:37.600] And it says here, paragraph 3, Section 18, I'm sorry, Title 18, Section 7, any lands
[01:06:37.600 --> 01:06:45.160] reserved or acquired for the use of the United States and under the exclusive or concurrent
[01:06:45.160 --> 01:06:51.200] jurisdiction thereof or any place purchased or otherwise acquired by the United States
[01:06:51.200 --> 01:06:55.780] by consent of the legislature of the state in which the same shall be for erection of

[01:07:15.920 --> 01:07:22.640] government has special maritime territorial jurisdiction in this matter.
[01:07:22.640 --> 01:07:25.240] The Constitution does not matter.
[01:07:25.240 --> 01:07:30.280] All this stuff about it being state land and that it should have been a state murder case
[01:07:30.280 --> 01:07:37.500] and how dare we move the trial out of Oklahoma to Colorado, none of that matters.
[01:07:37.500 --> 01:07:43.920] We get to do whatever we want because we have special territorial maritime jurisdiction.
[01:07:43.920 --> 01:07:50.360] Well that would seem to conflict with what the Constitution says.
[01:07:50.360 --> 01:07:58.360] So the question, I begged the question of Harmon, I said, so Harmon, did you file a
[01:07:58.360 --> 01:08:04.200] petition for certiorari to the Supreme Court to challenge this ruling?
[01:08:04.200 --> 01:08:06.520] And he said, no, he didn't take it to the Supreme Court.
[01:08:06.520 --> 01:08:09.040] And I said, why not?
[01:08:09.040 --> 01:08:13.800] This statute is obviously unconstitutional.
[01:08:13.800 --> 01:08:19.320] And he says there was no reason to take it to the Supreme Court because he knew he would
[01:08:19.320 --> 01:08:21.220] have lost.
[01:08:21.220 --> 01:08:23.480] They basically told him the answer.
[01:08:23.480 --> 01:08:25.400] The Constitution doesn't matter.
[01:08:25.400 --> 01:08:29.100] We're under maritime law, period.
[01:08:29.100 --> 01:08:32.800] Everything is by commercial agreement that I believe they even use the term commercial
[01:08:32.800 --> 01:08:33.800] agreement in the case.

[01:09:00.240 --> 01:09:07.760] It turned his whole career on its ear because he realized there was no point in filing a
[01:09:07.760 --> 01:09:13.380] petition for certiorari to the Supreme Court because they had already told him the Constitution

[01:09:14.380 --> 01:09:20.960] Even though it would appear on its face that this statute, Title 18, Section 7, is unconstitutional.
[01:09:20.960 --> 01:09:25.880] The Seventh Circuit had already told him it's not unconstitutional because the Constitution
[01:09:25.880 --> 01:09:26.880] doesn't matter.
[01:09:26.880 --> 01:09:30.480] We get to do whatever we want because we're in funny money, we're in maritime law.

[01:48:10.280 --> 01:48:15.940] That means it's not a trust document at all, it's a mortgage.
[01:48:15.940 --> 01:48:23.240] That you granted the property to MERS and not the trustee, so the document is void.

[01:48:25.900 --> 01:48:31.920] We can go in and show that these guys never had power to foreclose and we have a number
[01:48:31.920 --> 01:48:42.020] of tools we can use and we'll go in and file a petition for declaratory judgment on the

[01:48:49.360 --> 01:48:57.200] And if I remember right in your case, Countrywide went out of business in 2010 and Countrywide
[01:48:57.200 --> 01:49:03.880] purports to have filed an assignment in 2012, not.
[01:49:03.880 --> 01:49:09.000] They couldn't file an assignment in 2012, they didn't exist.
[01:49:09.000 --> 01:49:13.340] So there was no assignment to whoever's doing the foreclosure.
[01:49:13.340 --> 01:49:21.140] If you can go in and get the court to rule that the assignment of deed of trust is filed
[01:49:21.140 --> 01:49:27.760] and the record is void, then as a matter of law, the foreclosure is void.

[01:52:23.080 --> 01:52:26.480] They immediately sold the note to somebody else.
[01:52:26.480 --> 01:52:31.920] So if they're claiming you haven't been foreclosed on, that's the first thing you want to do
