[05:59.980 --> 06:07.900] Absolutely. Um, yeah, so there's a smart meter opt-out bill and the bill specifically says that anyone can make
[06:07.900 --> 06:12.940] a request to their utility company all across the state and
[06:13.500 --> 06:18.940] Opt out and there would be no fee. No punitive fee
[06:19.460 --> 06:23.620] monthly fee or anything other than that to opt out and
[06:24.020 --> 06:28.380] What the big issue is with this the utility companies are lobbying
[06:29.060 --> 06:32.940] Heavy and hard right now we on Monday
[06:32.940 --> 06:39.820] Had about we have to have 21 senators to get this bill on to the floor
[06:39.820 --> 06:43.700] And they have to do what they call and I'll go through this just really briefly
[06:44.220 --> 06:50.020] Suspended the rules because in committee there was a couple of senators our senator Kirk
[06:50.340 --> 06:54.380] Watson who voted against the bill to get it out of committee

[06:56.820 --> 06:58.700] Got a lot of flack from that
[06:58.700 --> 07:05.980] So then he said okay, he would allow it for another vote in the committee and then the committee passed it
[07:05.980 --> 07:09.120] But because he voted against it initially
[07:09.660 --> 07:15.700] They have to what they call suspended the rules and they can only do that with two-thirds of the Senate senators
[07:15.820 --> 07:23.160] Well, let me ask you something. Okay, are you what exactly are the rules to does the committee have to?
[07:23.700 --> 07:27.660] Unanimously approve the bill in order for it to pass out of committee
[07:27.660 --> 07:31.180] I mean it looked like to me like a majority of the committee
[07:31.980 --> 07:39.380] Approved it. So why does there have to be this two-thirds of the Senate? I mean what what exactly does it say about that?
[07:40.220 --> 07:46.180] Okay, good question and ever I'm gonna be real honest with you. I've just from hearsay has been told why this has occurred

[07:48.260 --> 07:56.340] Exact rule, but what I've been told is if there's one senator that votes against it that votes against it
[07:56.340 --> 08:00.220] Then you have to do this the spending of the rules because the Senate

[08:04.500 --> 08:12.440] Way that they don't want to contradict each other too much and so to get it pulled on to the Senate for even though
[08:13.380 --> 08:17.500] There was a majority that passed it. You have to do this suspension thing
[08:17.740 --> 08:23.940] So I don't understand why they do this, but let me just say it's the fact and right now we have
[08:23.940 --> 08:31.580] 17 senators out of the 21 that we need a couple of senators that agreed to support the bill

[08:33.740 --> 08:36.340] So that I tell you one thing the electric companies are
[08:36.980 --> 08:41.760] Livid right now because this thing has gotten as far as it has it got out of committee
[08:41.900 --> 08:46.660] We have 17 we had at one point 18 or 19 senators on board

[08:49.220 --> 08:56.060] so we need four senators to put this back on the floor and get a vote that we get this protection and

[08:59.860 --> 09:05.340] There are a lot of health issues associated with those smart meters. They emit high energy
[09:05.860 --> 09:08.060] radio frequency and microwave
[09:09.080 --> 09:15.660] Radiation into your home. Okay, it is just incredible. I'm very sensitive to this the radiation makes me very sick
[09:15.660 --> 09:17.660] I have friends who have autistic children
[09:17.660 --> 09:23.460] They it affects their children. I have friends who get nosebleeds headaches can't sleep
[09:23.900 --> 09:26.180] They try to speak in other bedrooms of their homes
[09:26.180 --> 09:30.500] They're basically prisoners in their own home with these health issues
[09:30.500 --> 09:34.300] And then there's another group that is very concerned about the privacy
[09:34.740 --> 09:40.300] issues with these smart meters because the data gets transferred over and you know over the
[09:41.260 --> 09:46.100] The lines through these wireless signals and you know, that's a whole nother ballgame
[09:46.100 --> 09:52.940] but the bottom line is we need four more senators to get this thing on the floor to get a vote and it will pass if
[09:52.940 --> 09:57.140] We can just get four more centers to sign on and exactly what you said
[09:57.740 --> 10:04.900] It's not often often pretty much as a lost cause with senator Kirk Watson. He's not going to vote for this

[10:11.920 --> 10:16.920] That people who want to opt out and who do not comply with the systematic
[10:18.640 --> 10:25.200] Rollout of these smart meters should have to pay and right now Austin energy here in this
[10:25.400 --> 10:28.680] In Austin in Travis County, they they service a lot of
[10:29.640 --> 10:36.320] Areas a lot of area here in Austin. They are going to have an opt-out option in September
[10:36.320 --> 10:38.240] But they're going to they want to charge
[10:38.240 --> 10:40.240] $25 per person per month
[10:40.240 --> 10:44.120] This is something that low-income families cannot afford
[10:44.120 --> 10:48.400] So here again only the wealthy can afford to opt out in
[10:48.800 --> 10:52.840] Austin if you don't want to one of those radiative smart meters on your home
[10:53.120 --> 10:56.340] so what we want to do tonight is really appeal to
[10:56.920 --> 11:01.520] Kind of take a little bit different approach a little bit different strategy on this to get these four senators
[11:01.520 --> 11:09.160] I have the list of one two, three, four five six senators that are on the fence and their areas that they represent

[11:15.360 --> 11:22.520] That live in these areas these six senators that are on the fence are really who listen to their constituents

[12:44.560 --> 12:50.520] Neighborhood where they tried to blanket rezone the entire neighborhood to allow for lot
[12:50.840 --> 12:56.800] Sizes about half the size of what the minimum lot size has to be right now
[12:56.800 --> 13:03.400] Well, and we what we did is we went around and we knocked on all our neighbor's doors in the entire neighborhood
[13:03.400 --> 13:08.440] And we got a valid petition against this. This was one of the first times where the city itself
[13:09.640 --> 13:14.920] initiated like a blanket rezoning of an entire neighborhood without the
[13:15.440 --> 13:17.440] consent or without the
[13:17.680 --> 13:23.200] Basically the initiation of the people the property owners who live there or who own property there
[13:23.200 --> 13:28.000] Well, we were against this and people say well, why were you against this?
[13:28.000 --> 13:32.880] The neighborhood is already laid out. The lots are already drawn. The the houses are already built
[13:32.880 --> 13:39.280] There's not one open lot in our neighborhood. Okay, there's not there's not one lot that doesn't have a house on it
[13:39.280 --> 13:43.360] The whole place is already laid out the plats the lines the property lines everything
[13:43.360 --> 13:49.760] So what does it matter if they rezone it to allow lot sizes for half the size of what they are now?
[13:49.760 --> 13:56.960] Well, I'll tell you what it matters it matters because over over time over the course of 10 15 20 years as
[13:57.200 --> 14:01.100] Houses go up for sale on any particular given block. For example
[14:01.760 --> 14:04.280] Developers can come in and buy the houses

[14:05.000 --> 14:09.520] and then after they own the whole block then they can knock them all down and then
[14:09.680 --> 14:15.840] Cut up the block again and put twice as many houses on one particular block as was there
[14:15.840 --> 14:23.360] Before and they set everything up to make this happen because of about six or seven years ago
[14:23.800 --> 14:31.280] they what the TCAT did the Travis County Appraisal District did is that they came in and they
[14:31.840 --> 14:38.120] Basically made the they switched the appraisal values of the land and the buildings
[14:38.120 --> 14:45.760] Okay, so that what ended up happening was was that the the where you would say for example, there would be a
[14:46.120 --> 14:48.520] Lot where there would be a house that was worth
[14:49.840 --> 14:51.600] $150,000 and the land is worth 50
[14:51.600 --> 14:58.440] Well, then all of a sudden one year the the land is worth a hundred and fifty and the house is worth fifty
[14:58.560 --> 15:00.160] Well, how can that happen?
[15:00.160 --> 15:07.160] How can there be that great of a depreciation of a structure in one year and that much of an appreciation of the land in?
[15:07.160 --> 15:10.880] One year. Well, they just did it. Well, unfortunately under state law
[15:11.000 --> 15:16.520] You can't challenge that you can't protest that at the tip at the tax pro through the
[15:17.320 --> 15:24.280] Administrative or the judicial tax protest pro process you can only protest if the overall value of the land goes up
[15:24.280 --> 15:30.400] Well, why is this relevant? This is relevant because if you have a piece of property and
[15:30.400 --> 15:37.320] The structure is worth that much less than the value of the land. Guess what? You can't get a mortgage on it
[15:37.400 --> 15:43.760] Okay, that means the only people that can buy it are people that can pay cash like hmm developers, for example
[15:43.800 --> 15:46.760] Okay, so this is what they tried to do to our neighborhood
[15:46.760 --> 15:47.240] All right
[15:47.240 --> 15:52.400] And then the they were taking widows off the petition who who hadn't
[15:52.840 --> 15:56.680] Transferred the property into their own names yet after their husband was deceased
[15:56.680 --> 16:01.960] Well, we ended up going up against this and we did have a valid petition in our neighborhood
[16:01.960 --> 16:05.560] even though they tried to knock it down we had to city which forced a
[16:06.000 --> 16:11.960] Would have had to have six out of seven council members to override our neighborhood petition
[16:11.960 --> 16:16.360] Well, we got two council members on our side. Of course. One of them was not Kirk Watson

[16:17.280 --> 16:24.200] so that just threw them into a complete and total tizzy and and eventually what ended up happening was the

[38:40.820 --> 38:48.720] You get this huge pull every 25 seconds of this stuff, so you're getting the radiation and a lot of the symptoms are similar to

[46:40.780 --> 46:52.780] Well, this is something I mentioned off the air and she said maybe I should mention it on the air. I'm not sure if I should or not, but a CB radio with 100 watt linear.
[46:52.780 --> 47:11.780] If you stuck the antenna inside a Pringles potato chip can, pointed it at the smart meter and peed the mic, you could call that a remote smart meter toaster.
[47:11.780 --> 47:15.780] Good idea, except for then they'll come after you for destroying their property.
[47:15.780 --> 47:27.780] But the problem they have, you see, I had someone take out my television with a hundred watt linear once and we call the FCC and they said, sorry, Bubba.
[47:27.780 --> 47:37.780] They have the authority to broadcast if you didn't design your equipment so that it would shield out the signals you don't want to receive too bad.
[47:37.780 --> 47:42.780] Yeah. And guess what? You don't need a, you don't need any kind of special license for CB radio either.
[47:42.780 --> 47:56.780] Right. We kind of do for the hundred watt linear. They get a little excited, but if you only click it for a couple of seconds, if you point that at a car, the computer will shut down instantly.
[47:56.780 --> 48:00.780] Yeah. Try and triangulate that one if it's just falling for two seconds.
[48:00.780 --> 48:04.780] No, we are not recommending that you go out and destroy other people's property people.
[48:04.780 --> 48:14.780] But you know, the only reason I was laughing and telling Randy to say it on the air is because, well, people are going to do what they're going to do anyway, and people are going to come up with that idea on their own.
[48:14.780 --> 48:20.780] And worse comes to worse, people are going to start going after these things with a ball peen hammer if they have to shut them off.
[48:20.780 --> 48:33.780] You know, I mean, it's us mentioning things like that on the air is not going to, you know, we're not responsible for other people's actions if they choose to implement Randy's invention.

[49:21.780 --> 49:23.780] Say that again?
[49:23.780 --> 49:25.780] A rainy warrant.
[49:25.780 --> 49:27.780] Rainy warrant. No, I have not.
[49:27.780 --> 49:40.780] I could not find it in my Black's Law Dictionary, but you know that I do some transcribing from preaching and things that were done in the 1980s.
[49:40.780 --> 49:51.780] And in this particular segment, I'm just going to say it's copyrighted information, so I'm just going to say it.
[49:51.780 --> 50:03.780] Dr. Gene Scott was preaching in 1981, and he stopped to tell about an issue at the church and an attack on him personally, a legal attack on him personally.
[50:03.780 --> 50:11.780] And so I will read what he says. He says he was informed by his attorney that there is such a thing as a rainy warrant.
[50:11.780 --> 50:21.780] You don't even need a judge to pay too much attention to a hearing on it. It's usually used for dope or situations where if you don't move fast, the suspect is gone.
[50:21.780 --> 50:31.780] So all you've got to do is have a cop that can find a judge that will sign it, and the rainy warrant, you can break the doors of their house and come in and get them.
[50:31.780 --> 50:34.780] Let me read. This is California law.
[50:34.780 --> 50:36.780] This is California.
[50:36.780 --> 50:50.780] In California, explains one criminal lawyer in Mojave, an arrest warrant is a court order directing officers to arrest a certain person if and when they locate him or her for Penal Code 816.
[50:50.780 --> 50:53.780] When a judge of his period of court gets enough information.
[50:53.780 --> 50:57.780] I'm sorry, this one's just, it says rainy warrant.
[50:57.780 --> 51:01.780] Let me go ahead and read it through. It may specify.
[51:01.780 --> 51:13.780] The court gets enough information via affidavit to convince him or her from the officer's declaration that probable cause exists that an offense described has been committed and that the described defendant committed the offense.
[51:13.780 --> 51:20.780] A judge may issue a warrant of probable cause for the defendant's arrest. Such arrests are called rainy warrants.
[51:20.780 --> 51:22.780] That's just a regular warrant.
[51:22.780 --> 51:25.780] That's the same as anything, right?
[51:25.780 --> 51:35.780] Yeah, the seminal case is that of people versus rainy 1976 in comparison to a conventional arrest.
[51:35.780 --> 51:42.780] Rainy warrants are issued before a complaint has been filed against the suspect.
[51:42.780 --> 51:59.780] This may occur according to one criminal defense attorney, for example, when an officer lacks sufficient evidence to file charges, but hopes to obtain sufficient evidence to file a complaint through questioning lineups or other investigatory techniques.
[51:59.780 --> 52:12.780] That sounds like a order for a, I forget what it's called when you arrest a witness. There's a term for that.
[52:12.780 --> 52:20.780] But I understand the difference that that would be in a situation that's immediate.
[52:20.780 --> 52:22.780] Right.
[52:22.780 --> 52:31.780] Something's ongoing. Now they have the right to arrest for a felony if they didn't see it.
[52:31.780 --> 52:48.780] If someone tells them that another person committed a felony, and they have evidence that a felony has been committed, then they can arrest this person without a warrant, even if they didn't see the offense.
[52:48.780 --> 52:54.780] They can arrest without a warrant for an on-site misdemeanor offense.
[52:54.780 --> 53:03.780] They can't arrest without a warrant for a misdemeanor if they didn't see it.
[53:03.780 --> 53:13.780] They can for a felony, but only if there is a likelihood that the perpetrator will escape or destroy evidence.
[53:13.780 --> 53:16.780] And would that give them the right to break into your home?
[53:16.780 --> 53:18.780] No.
[53:18.780 --> 53:27.780] That's a good question. On a felony, they probably would have.
[53:27.780 --> 53:43.780] But what this indicates is they would have to, if they don't actually see you're here, they would have to call a judge and make a statement to the judge, and the judge can authorize the warrant.
[53:43.780 --> 53:57.780] In the Fed, a federal officer can call a federal magistrate and make an accusation over the phone.
[53:57.780 --> 54:03.780] When that occurs, the magistrate must record the conversation.
[54:03.780 --> 54:12.780] Then the magistrate can authorize the federal officer to issue the warrant, and the federal officer will sign it.
[54:12.780 --> 54:13.780] Okay.
[54:13.780 --> 54:17.780] This created a serious problem when I was in Pennsylvania.
[54:17.780 --> 54:24.780] I had a fellow there I went to help, and he was afraid he was going to be raided by the IRS.
[54:24.780 --> 54:31.780] And I had been getting calls by people who had been raided by federal officers.
[54:31.780 --> 54:44.780] They came in and took guns, gold, computers, anything of value, and then disappeared, and there never were any charges, nothing ever happened.
[54:44.780 --> 54:51.780] So I went to the federal courthouse in Philadelphia.
[54:51.780 --> 54:54.780] Deb was with me then.
[54:54.780 --> 55:00.780] And we talked to the clerk there about sealed warrants.
[55:00.780 --> 55:06.780] What was going on was the officer would issue the warrant.
[55:06.780 --> 55:12.780] He'd go through the court record and find a missing cause number.
[55:12.780 --> 55:20.780] Because when they issued a warrant, they'd give it a cause number, and when it's sealed, they removed the cause number from the record.
[55:20.780 --> 55:27.780] So if you go through the federal record and find missing numbers, that's because that's a sealed warrant.
[55:27.780 --> 55:36.780] So the officer would find a missing number, put that number on a warrant, go to the local police and say, I've got this warrant to search and seize.
[55:36.780 --> 55:38.780] We need you to run security.
[55:38.780 --> 55:42.780] The local police would come and drag everybody out of the house at two o'clock in the morning.
[55:42.780 --> 55:46.780] The feds would come in there and steal everything they got and then disappear.
[55:46.780 --> 55:47.780] Oh, great.
[55:47.780 --> 56:16.780] So we sent a letter to every federal magistrate in Pennsylvania and asked them to disclose to me the cause numbers for all warrants they had issued, sealed, and that had subsequently been executed so that I could petition the district court for a writ of mandamus ordering them to come before the court and show cause as to why the warrant was still sealed.
[56:16.780 --> 56:22.780] Well, I never got a response from a single magistrate.
[56:22.780 --> 56:27.780] However, I've never heard of that crap only anymore either.
[56:27.780 --> 56:30.780] It got quiet real quickly in there.
[56:30.780 --> 56:32.780] Yes, it did.
[56:32.780 --> 56:45.780] When the federal judges had every magistrate in the state saying what's going on here, this is exactly what I accused these people of in the letter.
[56:45.780 --> 56:50.780] So that was kind of the way you work with politics.
[56:50.780 --> 56:56.780] I didn't actually make a official accusation.
[56:56.780 --> 57:06.780] I kind of made a took a bank shot at them and it was a way to notify the magistrates that we are running up a red flag here.
[57:06.780 --> 57:07.780] You better do something.
[57:07.780 --> 57:08.780] And they got the message.
[57:08.780 --> 57:10.780] They did it.
[57:10.780 --> 57:15.780] Anyway, that was what you did.
[57:15.780 --> 57:18.780] It did get me high up on their list.
[57:18.780 --> 57:24.780] And so the poverty law center thinks we're all terrorists.

[01:00:55.780 --> 01:01:04.780] One of the women, Gina DeJesus, told investigators that she was on her way home from school in April 2004 when a man pulled up in a van and casually offered her a ride.

[01:04:26.780 --> 01:04:39.780] Yeah, I do. Last summer, somebody went to my mother's house and told her that they needed to inspect her meter.
[01:04:39.780 --> 01:04:45.780] And what they actually did was took her old meter off her house and put in one of the smart meters.
[01:04:45.780 --> 01:04:51.780] And when I found out about it, I made some phone calls and ruffled some feathers.
[01:04:51.780 --> 01:05:04.780] And to make a long story short, I ended up talking to someone quite high up the totem pole at Encore who gave me some specs on the meters.
[01:05:04.780 --> 01:05:09.780] We actually had quite a few conversations back and forth about them.
[01:05:09.780 --> 01:05:20.780] And he pretty well agreed with my position on the meters, but he couldn't openly state a few things.
[01:05:20.780 --> 01:05:25.780] He basically said they're under the thumb of the Texas Utilities Commission that authorizes them to do that.
[01:05:25.780 --> 01:05:29.780] And I said, well, you're authorized to do it, but you're not required.
[01:05:29.780 --> 01:05:34.780] You know, I can authorize you to go mow my yard, but that doesn't mean you're required to do it.
[01:05:34.780 --> 01:05:44.780] And anyway, we sent a few emails back and forth and he basically told me that they are having a lot of problems with the meters
[01:05:44.780 --> 01:05:57.780] and that if they put a meter on a house and they have to go back and either replace it or repair it three times in a year,
[01:05:57.780 --> 01:06:00.780] they'll just put one of the old meters back on.
[01:06:00.780 --> 01:06:10.780] And according to him, they've had to do that actually quite a bit because of defective or miscalibrated meters.
[01:06:10.780 --> 01:06:20.780] Oh, that's interesting. We could find some interesting ways to confuse those meters.
[01:06:20.780 --> 01:06:31.780] Well, I wouldn't suggest damaging them, but the old meters had basically just a motor and a little disk that spins around.
[01:06:31.780 --> 01:06:35.780] These new meters, they actually have a microprocessor in them and they're very sensitive to static.
[01:06:35.780 --> 01:06:38.780] They're very sensitive to power surges.
[01:06:38.780 --> 01:06:46.780] And that's one of the things that he indicated to me is they are a lot more sensitive than the old meters.
[01:06:46.780 --> 01:06:49.780] They're more sensitive to heat. They're more sensitive to all kinds of things.
[01:06:49.780 --> 01:06:54.780] And so they're having a lot of problems with them. And as a matter of course, effectiveness.
[01:06:54.780 --> 01:07:00.780] If they're microcircuits, absolutely, there are a lot of things they're going to be very sensitive to.
[01:07:00.780 --> 01:07:07.780] When the temperature changes, the characteristics of everything in there is going to change dramatically.
[01:07:07.780 --> 01:07:16.780] I went to college for electrical engineering and heat of all of the things in circuit design,
[01:07:16.780 --> 01:07:26.780] the one pervading issue that we had to consider for everything was heat.
[01:07:26.780 --> 01:07:37.780] Can't just say this circuit will, if you apply X amount of voltage to it, it'll pass Y amount of current.
[01:07:37.780 --> 01:07:42.780] Nah, it won't. It will at a given temperature.
[01:07:42.780 --> 01:07:49.780] And you can put it all in, get it all working, and as the system heats up, all the parameters begin to change.
[01:07:49.780 --> 01:07:53.780] So we have to design within a range.
[01:07:53.780 --> 01:07:57.780] If it gets out of that range, everything changes. Everything affects everything.
[01:07:57.780 --> 01:08:01.780] And especially microcircuits here are so small.
[01:08:01.780 --> 01:08:07.780] A little extra heat, a magnifying glass, there's no telling what it'll do to that thing.
[01:08:07.780 --> 01:08:15.780] Well, if you've built very many circuits, then you know that when you're looking at the individual parts,
[01:08:15.780 --> 01:08:23.780] they all have a voltage and a current rating and a temperature range rating, so that goes to what you're saying.
[01:08:23.780 --> 01:08:30.780] But I just thought it was interesting. I kind of felt like the guy was trying to give me hints.
[01:08:30.780 --> 01:08:32.780] He did sympathize with my position.
[01:08:32.780 --> 01:08:38.780] He basically told me that, you know, as a representative of Encore, he had to take a certain position.
[01:08:38.780 --> 01:08:44.780] But if he and I were to go out privately and have a cup of coffee, he might have some other things to say about it.
[01:08:44.780 --> 01:08:46.780] So it pretty much let me know.
[01:08:46.780 --> 01:08:54.780] And one of the things that he admitted to me is that they have done absolutely zero health testing on these things before they started deploying them out in the field.
[01:08:54.780 --> 01:09:06.780] That was something that we really should look at because these guys will be subject to some tremendous litigation.
[01:09:06.780 --> 01:09:09.780] And I let him know that in not so many terms.
[01:09:09.780 --> 01:09:15.780] You know, I told him that, you know, my mother has some sensitive medical equipment in the house.
[01:09:15.780 --> 01:09:31.780] And based on the specs, he gave me the specs, the power ratings, you know, how many watts the micro pulses are and how frequent they are and the range and the frequency and all kinds of stuff.
[01:09:31.780 --> 01:09:41.780] And I basically let him know in not so many words that, you know, that seems like something that could very easily interfere with some of the sensitive medical equipment that she has in the house.
[01:09:41.780 --> 01:09:46.780] Did these things fall within the FCC Part 15 parameters?
[01:09:46.780 --> 01:09:48.780] Yes, they do.
[01:09:48.780 --> 01:09:50.780] Yeah, they do. I've already looked at that.
[01:09:50.780 --> 01:09:56.780] And hey, Randy, this business about the litigation, that was one thing I was going to mention while Laura was on.
[01:09:56.780 --> 01:09:58.780] I wanted to ask her if she thought it would be a good talking point.
[01:09:58.780 --> 01:10:03.780] I think it is a good talking point anyway regarding the cost.
[01:10:03.780 --> 01:10:21.780] Okay, because the opposition, the official story of the opposition is that it's going to cost the utilities company a lot more to allow people to opt out and everyone else shouldn't have to pay for you to opt out.
[01:10:21.780 --> 01:10:37.780] And one of my solutions to that not only is, well, why should I have to pay to not get assaulted, I mentioned that, but the other issue is these utilities companies are going to get the living you-know-what sued out of them.
[01:10:37.780 --> 01:10:48.780] Who knows, hundreds, thousands of times, all the litigation that is going to come down on those utilities companies over these smart meters for not providing an opt out.
[01:10:48.780 --> 01:10:53.780] That is going to raise the cost of everyone's electric bill.
[01:10:53.780 --> 01:11:14.780] Okay, and I would dare to say that the amount that everyone's electric bill is going to increase as a result of this litigation is going to far, far outweigh any minuscule cost, additional cost that it would cost people to opt out of this.
[01:11:14.780 --> 01:11:20.780] All right, so there's a solution for you to tell these senators when they say, well, it's going to cost more money.
[01:11:20.780 --> 01:11:26.780] Yeah, it's going to cost more money, a lot more money if they don't provide the opt out.
[01:11:26.780 --> 01:11:43.780] Yeah, and well, from what I've been reading, just in California alone, because California was one of the first places to get them, get the meters, and just in California alone, there have already been 13,000 small core claims filed over these smart meters.
[01:11:43.780 --> 01:11:50.780] But we need to, I think people need to move it out of the small claims courts, move it into the federal courts.
[01:11:50.780 --> 01:12:03.780] I mean, this guy just, he openly admitted that A, there's been no health testing on them whatsoever, and B, they put no shielding in them whatsoever to keep the radio pulses from going into the house.
[01:12:03.780 --> 01:12:13.780] So it, you know, it radiates in all directions, and you know, I just, I think that's pretty arrogant.
[01:12:13.780 --> 01:12:18.780] You know, they know they haven't done any health testing, and they know they're not doing anything to shield the people who are...
[01:12:18.780 --> 01:12:21.780] No shielding, now that is interesting.
[01:12:21.780 --> 01:12:26.780] You know, you said about the radiation possibly affecting medical equipment.
[01:12:26.780 --> 01:12:42.780] That is not likely, because the manufacturers of medical equipment are very well aware of the potential and possibilities for radio interference, and they designed very effective Faraday screens for that purpose.
[01:12:42.780 --> 01:13:04.780] However, no shielding, huh? That means if I had a pretty good size CB radio, and I happened to set it up on the other side of the walls where that meter was, and I had myself a directional antenna that you can make real easy with a Pringles can.

[01:20:02.780 --> 01:20:13.780] So, I have to ask you questions about the case. I'm still up on appeal and I want to know what to do with my appeal.
[01:20:13.780 --> 01:20:19.780] My appeals attorney did not put anything in the brief in my side, in my letter that I wrote her.
[01:20:19.780 --> 01:20:21.780] She didn't put any of that in her brief.
[01:20:21.780 --> 01:20:33.780] And during the trial, the three big things that appeared to have happened was the prosecutor was past the statute of limitations and I called him on that.
[01:20:33.780 --> 01:20:39.780] I objected and the judge could have cared less. He told me that was my job to worry about it, not his.
[01:20:39.780 --> 01:20:49.780] Before the trial, the prosecutor had written me or sent me a sniper letter, which was meant to intimidate me into pleading guilty.
[01:20:49.780 --> 01:20:56.780] And I didn't, so I went to court and the prosecutor called me a sniper.
[01:20:56.780 --> 01:21:02.780] The third thing and the most obvious to me was that the prosecutor hid evidence.
[01:21:02.780 --> 01:21:14.780] I asked for a person had called in a telephone tip on me that came out and a police officer had taken down his statement and put it in a police report.
[01:21:14.780 --> 01:21:16.780] All of that was gone.
[01:21:16.780 --> 01:21:24.780] So just to give your listeners, to go back to the beginning, I was arrested at Mississippi State University.
[01:21:24.780 --> 01:21:34.780] I had a rifle, a bolt action rifle in my apartment closet, my bedroom closet, and they arrested me for a weapon on campus.
[01:21:34.780 --> 01:21:45.780] But I said that the apartments were not on campus and I was about 100 yards outside of the property line, or the property sign, the big sign that says Mississippi State.
[01:21:45.780 --> 01:21:51.780] Also, I didn't have a contract with the college that had anything to do with the apartment.
[01:21:51.780 --> 01:21:56.780] And I took these into court and I said them.
[01:21:56.780 --> 01:21:58.780] And the jury actually looked very interested.
[01:21:58.780 --> 01:22:03.780] Also, my mailing address is different from the campuses and I checked in at the post office.
[01:22:03.780 --> 01:22:08.780] And sure enough, they have a certain address and zip code and my apartments were in a different city.
[01:22:08.780 --> 01:22:12.780] It was a different city name and a different zip code.
[01:22:12.780 --> 01:22:18.780] I put all these out in court and the jury looked very interested in that.
[01:22:18.780 --> 01:22:22.780] I almost thought for a while that the jury was going to go on my side.
[01:22:22.780 --> 01:22:27.780] But then the prosecutor started up with the sniper stuff and that scared the jury.
[01:22:27.780 --> 01:22:30.780] So I wound up getting convicted.
[01:22:30.780 --> 01:22:39.780] But in my brief to the appeals attorney, I brought up the statute of limitations, the sniper letter, and the fact that he hid evidence.
[01:22:39.780 --> 01:22:44.780] And the prosecutor couldn't deny that he hid evidence because that came out.
[01:22:44.780 --> 01:22:49.780] The policeman that was testifying said yes, there was a person that called in and yes, there was another police officer.
[01:22:49.780 --> 01:22:52.780] And so I immediately objected.
[01:22:52.780 --> 01:22:55.780] And so the prosecutor couldn't hide that.
[01:22:55.780 --> 01:23:08.780] So now that my public defender appeals attorney did not put that in her brief, I'm wondering if I'm going to lose my appeal, if she's trying to engineer my loss.

[01:23:56.780 --> 01:24:03.780] I chose not to do that because, and I'll take your listeners back again real quickly.
[01:24:03.780 --> 01:24:13.780] I had my first public defender that I had for my trial was threatening me also with sniper charges, and then she even threatened me with murder charges.
[01:24:13.780 --> 01:24:21.780] She said that she was going to tell my bail bondsman that I had murdered two people because I was part of a militia.
[01:24:21.780 --> 01:24:29.780] And my bail bondsman called me up just really frantic, saying that they want you down there at the courthouse to arrest you for double homicide with some kind of militia group.
[01:24:29.780 --> 01:24:32.780] And I actually got her on tape recording saying that.
[01:24:32.780 --> 01:24:41.780] And you should file obstruction of justice tampering with a witness against her.
[01:24:41.780 --> 01:24:44.780] Against my original public defender or the bail bondsman?
[01:24:44.780 --> 01:24:47.780] Yes, the one that made the statement.
[01:24:47.780 --> 01:24:51.780] Oh, okay. File. Okay.
[01:24:51.780 --> 01:24:54.780] That's tampering with a witness.
[01:24:54.780 --> 01:24:57.780] Oh, okay. By having my attorney tell my bail bondsman?

[01:25:18.780 --> 01:25:29.780] She did a couple of other sneaky things, and I fired her, and then I just represented myself, which was a terrible idea, but I did a better job than she did because she was going to get me hung.
[01:25:29.780 --> 01:25:45.780] So when I received my appeals attorney, my appeals attorney, I wrote a letter saying the things that the first attorney had done, and I was looking at, like, ineffective assistance of counsel.
[01:25:45.780 --> 01:25:53.780] My appeals attorney immediately said, well, since you fired her, she's not responsible, and she got out of responsibility.
[01:25:53.780 --> 01:26:04.780] So when she sent me a letter saying I could file my own brief, she made it sound like you can file your own brief, but that gets her out of being responsible.
[01:26:04.780 --> 01:26:09.780] So I just, you know, and in prison, you know, you can't really ask your name for advice.
[01:26:09.780 --> 01:26:16.780] So I just took on the decision, and I said, I'm not going to file a brief because I don't want this woman trying to wiggle out from under this.
[01:26:16.780 --> 01:26:18.780] So I may have done the wrong thing.
[01:26:18.780 --> 01:26:28.780] Well, you can still file in a, you can petition the court for permission to file an amended brief now that you're out of prison and you can do your proper research.

[01:29:16.780 --> 01:29:23.780] The DNA didn't match and it turned out the prosecutor had evidence that would indicate
[01:29:23.780 --> 01:29:28.780] this guy was not guilty and he hid it from the court.
[01:29:28.780 --> 01:29:32.780] Now they're going after the prosecutor.
[01:29:32.780 --> 01:29:36.780] So you make allegations of the same thing on this prosecutor.
[01:29:36.780 --> 01:29:38.780] It's a pretty sensitive subject right now.
[01:29:38.780 --> 01:29:41.780] But since you're on probation, I wouldn't be a pro.

[01:34:47.780 --> 01:35:06.780] And after the break, before they reconvened the court, I told the lawyer that either you tell this judge that Robert is too ill to continue, or I'll interrupt the court and insist that the court stop this case.
[01:35:06.780 --> 01:35:08.780] They're going to kill Robert.
[01:35:08.780 --> 01:35:10.780] The judge, the lawyer knew it.
[01:35:10.780 --> 01:35:12.780] He did not care.
[01:35:12.780 --> 01:35:13.780] Wow.
[01:35:13.780 --> 01:35:17.780] The judge stopped the heat, you know, I threatened the lawyer.
[01:35:17.780 --> 01:35:24.780] So the lawyer went to the judge and the judge told him, well, he'll continue the case, but he's got to go to the doctor.
[01:35:24.780 --> 01:35:26.780] They put him in a hospital immediately.
[01:35:26.780 --> 01:35:37.780] Oh, that would have been depraved heart murder if Robert had had died there, or if not depraved heart assault, and it should have been anyway.

[01:35:38.780 --> 01:35:42.780] His lawyer was there to make sure Robert did not win.
[01:35:42.780 --> 01:35:43.780] Okay.

[01:35:48.780 --> 01:35:51.780] Well, she's the one that was threatening the sniper charges and stuff.

[01:35:56.780 --> 01:35:58.780] I knew who called on me.
[01:35:58.780 --> 01:36:05.780] My roommate and I had gotten into a fight and he turned around and dropped a dime on me because he was mad at me.
[01:36:05.780 --> 01:36:13.780] And I know my roommate well enough that he never expected for it to go this far, but he definitely dropped a dime on me.
[01:36:13.780 --> 01:36:21.780] So they brought in a campus security guard that claimed to have, well, he's the one who signed the complaint.
[01:36:21.780 --> 01:36:31.780] He signed an affidavit as the witness with personal witness or personal knowledge.
[01:36:31.780 --> 01:36:37.780] And so easily, I mean, I'm not a good lawyer, but I easily jumped up and said, well, do you have personal knowledge?
[01:36:37.780 --> 01:36:39.780] Are you firsthand knowledge?
[01:36:39.780 --> 01:36:40.780] Do you have firsthand knowledge?
[01:36:40.780 --> 01:36:42.780] And he goes, yes.
[01:36:42.780 --> 01:36:45.780] And I said, well, are you the one that called in on me?
[01:36:45.780 --> 01:36:47.780] And I didn't tell him, but I know who it was.
[01:36:47.780 --> 01:36:49.780] I just said, are you the one that called in?
[01:36:49.780 --> 01:36:51.780] And he had to say, well, no.
[01:36:51.780 --> 01:36:57.780] Well, finally I questioned him a couple of times and he had to admit that, yeah, someone called in.
[01:36:57.780 --> 01:37:02.780] And he made the mistake of saying that he got his information off of a report.

[01:37:44.780 --> 01:37:46.780] And all of this is missing.
[01:37:46.780 --> 01:37:48.780] This is egregious.
[01:37:48.780 --> 01:37:51.780] The appeals court will never go for this.
[01:37:51.780 --> 01:37:56.780] And I'm sitting here watching this woman just really get loud and boisterous in court.

[01:38:56.780 --> 01:39:01.780] Well, I kept objecting to the witnesses being missing and the evidence missing.
[01:39:01.780 --> 01:39:03.780] He would say that's irrelevant.
[01:39:03.780 --> 01:39:06.780] And even the judge came in and said, I don't see any relevance in this missing evidence.
[01:39:06.780 --> 01:39:10.780] And I kept saying objection, felonious criminal intent.
[01:39:10.780 --> 01:39:12.780] And then the judge would interrupt me.
[01:39:12.780 --> 01:39:14.780] But I must have done that 20 times.

[01:39:15.780 --> 01:39:20.780] So I hope that that will come back and help me and bite him in the butt.

[01:49:02.780 --> 01:49:04.780] And the court's going to say, did you sign that?
[01:49:04.780 --> 01:49:06.780] You say, yeah, I did.
[01:49:06.780 --> 01:49:10.780] However, that's not relevant.
[01:49:10.780 --> 01:49:24.780] What is relevant is, is the state law that sets the requirements for the filing of a document in the Registrar of Deeds Office.
[01:49:24.780 --> 01:49:30.780] Your position is not whether or not you actually signed this document.
[01:49:30.780 --> 01:49:39.780] Your position is, is that the document is insufficient for filing as a matter of law.
[01:49:39.780 --> 01:49:47.780] The first action, what you're doing with these letters is setting up a declaratory judgment action.
[01:49:47.780 --> 01:49:58.780] And you go in and you file a complaint with the court and ask the court to look at the four corners of this document.
[01:49:58.780 --> 01:50:10.780] Based on the four corners of this document, the evidence is that this document is not sufficient for filing based on this flaw.
[01:50:10.780 --> 01:50:19.780] And you ask the court to look at this document and determine whether or not it meets the statutory filing requirements.
[01:50:19.780 --> 01:50:29.780] The statutory filing requirement in California requires that it be properly authenticated.
[01:50:29.780 --> 01:50:42.780] If there is no evidence of a ledger, did you sign a ledger at the time for the notary?
[01:50:42.780 --> 01:50:45.780] I believe that I did. I believe that I did.
[01:50:45.780 --> 01:50:53.780] Okay, here's the issue. I have a guy in Sacramento. He was a real estate agent.
[01:50:53.780 --> 01:50:59.780] And he knew the notary. He had been to a number of closings with that same notary.
[01:50:59.780 --> 01:51:05.780] He filed a request with the notary for the sequential ledger, didn't get an answer.
[01:51:05.780 --> 01:51:11.780] So he sent to the, I'm sorry, his letter came back to him.
[01:51:11.780 --> 01:51:19.780] So he sent, he went to the secretary of state to find the current address on file with the secretary of state.
[01:51:19.780 --> 01:51:25.780] Secretary of state said, we never heard of this person.
[01:51:25.780 --> 01:51:29.780] She wasn't a notary to start with.
[01:51:29.780 --> 01:51:30.780] Wow.
[01:51:30.780 --> 01:51:33.780] Now, are they that stupid?
[01:51:33.780 --> 01:51:35.780] Yeah, that is.
[01:51:35.780 --> 01:51:42.780] Okay, let me give you another little piece of information. Chris is not screening calls tonight.
[01:51:42.780 --> 01:51:45.780] He will be tomorrow night, but he's a notary.
[01:51:45.780 --> 01:51:53.780] And the company he's with, their lawyer, his wife was a notary with him.
[01:51:53.780 --> 01:52:01.780] The lawyer quit being a lawyer and became a notary because he made more money.
[01:52:01.780 --> 01:52:08.780] So it cost him, the notary doesn't just sign the document, they set up the hearing.
[01:52:08.780 --> 01:52:15.780] They set up the closing hearing and apparently they get quite a bit of money for all the stuff they do.
[01:52:15.780 --> 01:52:19.780] So there's more money involved and it cost them a lot more.
[01:52:19.780 --> 01:52:29.780] So they have a monetary incentive to cut corners, but this is an incredibly stupid corner to cut.
[01:52:29.780 --> 01:52:34.780] They file that thing with a fraudulent notary. That's a felony.
[01:52:34.780 --> 01:52:40.780] So you want to set this up. This is all set in this stage.
[01:52:40.780 --> 01:52:48.780] If you can get a judge to rule that, yes, you're right, this document is not sufficient for filing.
[01:52:48.780 --> 01:52:58.780] And if the filer of this document wants to be able to act on this, they need to file one that's proper.
[01:52:58.780 --> 01:53:02.780] So they have the option of filing one correctly.
[01:53:02.780 --> 01:53:08.780] So that's all he's ruling. You don't want him to rule anything else. You would object to him ruling anything else.
[01:53:08.780 --> 01:53:13.780] Don't rule on the underlying claim, just on this document alone.
[01:53:13.780 --> 01:53:22.780] If you get that, now you come back with a quiet title action and you ask the court to rule.
[01:53:22.780 --> 01:53:31.780] Now you rule on the effect of the document or any action subsequently taken based on that document.
[01:53:31.780 --> 01:53:37.780] You ask for quiet title as concerns this claim because the document is insufficient.
[01:53:37.780 --> 01:53:46.780] And when you're asking for a bigger claim, now the judge is going to look more closely.
[01:53:46.780 --> 01:53:52.780] But when he looks back at the issue of the document, that's res judicata.
[01:53:52.780 --> 01:53:56.780] That's already been adjudicated and he can't go back and revisit it.
[01:53:56.780 --> 01:53:59.780] He has to trust that the other court did their job.
[01:53:59.780 --> 01:54:03.780] So now you come in res judicata, you get your quiet title.
[01:54:03.780 --> 01:54:11.780] Now you sue him for wrongful foreclosure about setting up your chess pieces.
[01:54:11.780 --> 01:54:14.780] This is not checkers we're playing here.
[01:54:14.780 --> 01:54:29.780] So get all that done. Now you have a bankruptcy where the claim has been extinguished in the bankruptcy.
[01:54:29.780 --> 01:54:35.780] So even if they sell the property, they have to give you all the money.
[01:54:35.780 --> 01:54:41.780] And if they sell the property for less than it's worth, they have to give you the difference.
[01:54:41.780 --> 01:54:46.780] But since you didn't want to sell the property, this is criminal.
[01:54:46.780 --> 01:54:51.780] I recently went into court and filed criminal charges against the purchaser of the property.
[01:54:51.780 --> 01:55:00.780] And you might look at who they show as the purchaser and whoever the president of the company is or CEO filed criminally against him.
[01:55:00.780 --> 01:55:15.780] Yeah, it was like national mortgage something rather. And I have the information at home. Unfortunately, I'm at my job.
[01:55:15.780 --> 01:55:23.780] File federal criminal charges against the CEO.
[01:55:23.780 --> 01:55:31.780] They'll make them go away. But I can assure you when people start filing criminal charges, everybody gets nervous.

[01:57:15.780 --> 01:57:23.780] Actually, Wells Fargo became the servicer. That does not mean that they purchased it.
[01:57:23.780 --> 01:57:40.780] They're merely a contractor. And this is important and an important distinction because Wells Fargo as Wells Fargo Bank in a when they are in the lending business there.

[01:57:44.780 --> 01:57:54.780] But when they come into the state as a servicer, they're not under the federal umbrella. They have to be registered in the state and they're subject to the state laws.
