[00:48.040 --> 00:53.360] 16-year-old American student Justin Hallman was visited at his home residence by agents
[00:53.360 --> 00:58.040] of the Federal Bureau of Investigation after they were apprised of his report posted on
[00:58.040 --> 01:02.880] YouTube for his high school government class. That report, for which Hallman earned an A-plus
[01:02.880 --> 01:07.760] grade and strong accolades from his government teacher, Mr. Sparks, led to questioning by
[01:07.760 --> 01:13.000] agents about why he chose to address certain topics. After a brief period of interrogation
[01:13.000 --> 01:17.360] by the unmanned federal agents, they asked Hallman that he join their ranks as an undercover
[01:17.360 --> 01:23.520] agent to spy on Americans who hold similar concerns as the ones expressed in his essay.
[01:23.520 --> 01:28.000] Concerns about the federal government, its overreach, and even the Illuminati. It is
[01:28.000 --> 01:32.000] unclear whether Mr. Hallman will be meeting with the FBI again, but it is certain that
[01:32.000 --> 01:36.000] he is ready to disclose to the news media more about his strange encounter.
[01:41.000 --> 01:45.880] Three years ago, Austinite Devin Contreras was an average healthy 16-year-old adolescent,
[01:45.880 --> 01:50.240] but a fateful night in the year 2010 forever changed his destiny. Exiting out the back
[01:50.240 --> 01:54.780] door of a big-lot store in Austin, Texas in an incident police say was a burglary, Devin
[01:54.780 --> 01:59.500] paid the ultimate penalty for his unawareness of the seriousness of his situation. In four
[01:59.500 --> 02:04.840] seconds, Contreras was shot 14 times by Austin Police Department Officer James Bowen. The
[02:04.840 --> 02:09.280] life of Devin Contreras ended that evening. Yesterday, Federal Judge Sam Sparks ruled
[02:09.280 --> 02:13.380] that the shooting by Officer Bowen did not use excessive force, despite the fact that
[02:13.380 --> 02:17.840] over a dozen rounds of ammunition were fired at the minor. However, Judge Sparks did reprimand
[02:17.840 --> 02:22.480] the police's lack of openness about the topic, determining that the Austin Police Department
[02:22.480 --> 02:28.280] showed a quote, pattern and practice of providing woefully late and incomplete discovery responses.

[03:48.960 --> 03:55.560] Well, let's see, in his latest order, he even admits that he's a sua sponte, dismissed
[03:55.560 --> 04:01.080] my informa pauperis. So, without evidence, he just decides that's okay. And apparently,
[04:01.080 --> 04:11.760] he decides his own dismissal. So, I disqualified him, and he decides to deny my motion to disqualify
[04:11.760 --> 04:22.400] him. He considers himself such an authority, and so above approach, which is interesting.
[04:22.400 --> 04:29.680] I'm looking up law on that, and it's really not, they're supposed to disqualify themselves
[04:29.680 --> 04:36.240] if there's reasonable cause that's presented that a reasonable person...
[04:36.240 --> 04:44.280] Okay, what are, okay, that's the same in Texas, but if they don't disqualify themselves, what
[04:44.280 --> 04:46.280] are they required to do then?
[04:46.280 --> 04:54.200] Well, it is not, that's what I'm trying to find out. It doesn't appear that there's,
[04:54.200 --> 05:00.560] in Texas is not one of the states that allow, Texas, and I guess probably the Fifth Circuit,
[05:00.560 --> 05:07.040] does not allow for pre-emptory disqualification.
[05:07.040 --> 05:17.040] Okay, Texas does federal. This is, I'm asking because this is an area I haven't specifically
[05:17.040 --> 05:18.040] researched.
[05:18.040 --> 05:26.400] Yeah, I'm trying to find that out, but they're supposed to, you know, avoid any preponderance
[05:26.400 --> 05:37.280] of impartiality, and, you know, when they do that, that casts a shadow on the court,
[05:37.280 --> 05:41.840] and so I don't believe he's operating in very good faith, and so it's going to have
[05:41.840 --> 05:47.080] to be something that I think I'm going to bring up to his supervisors at the Fifth Circuit,
[05:47.080 --> 05:54.640] that he refuses to, that he's moved another justice off the process of the City of Austin.
[05:54.640 --> 06:01.280] He's taken both these cases, and he's just acted sua sante, dismissed both of them as
[06:01.280 --> 06:05.760] frivolous without merit, even though there's a lot of evidence to show the contrary. He
[06:05.760 --> 06:10.680] just declares it so, and therefore it must be, and so I think that these are probably
[06:10.680 --> 06:16.400] things that are going to have to be adjudicated with his bosses at the Fifth Circuit and at
[06:16.400 --> 06:23.160] the Justice Department when I file a judicial complaint, but it does say that when it goes
[06:23.160 --> 06:30.960] above the Fifth Circuit, they can overrule everything and have him removed from the case.
[06:30.960 --> 06:35.040] Just because he wants to stay on there doesn't mean that if they stay otherwise, he's got
[06:35.040 --> 06:44.160] to go. So that, you know, goes to me writing a good writ, and you find writing a good appellate
[06:44.160 --> 06:53.640] brief, and I think that I've got a lot of, you know, he only partially cited the correct
[06:53.640 --> 06:59.880] rules of procedure. Yes, he can dismiss if he decides there is, but he can't dismiss.
[06:59.880 --> 07:06.120] It clearly says, if there is no evidence, he must have evidence. If he has, no.
[07:06.120 --> 07:14.360] Okay, those are, I was looking for specifics, procedures in the case of a motion for disqualification.
[07:14.360 --> 07:20.800] It would seem that a judge could disqualify himself or recuse himself in the face of a
[07:20.800 --> 07:31.280] motion, but it's not equitable for him to be able to rule against his own disqualification.
[07:31.280 --> 07:39.760] There has to be something on that. In Texas law, if a judge does not voluntarily recuse
[07:39.760 --> 07:45.760] himself, then he must forward the motion to the head administrative judge of the district,
[07:45.760 --> 07:50.560] and that judge appoints someone to hear the motion. There has to be some procedure in
[07:50.560 --> 07:56.520] the Fed, because if you have a corrupt judge, a corrupt judge is not going to disqualify
[07:56.520 --> 08:05.640] himself. There has to be a remedy. Well, I believe I used fairly good statute law. I
[08:05.640 --> 08:10.880] mean, part of my 18 page was directed from the American Law Review, and it goes to the
[08:10.880 --> 08:17.240] reasonable person standard, and I think I've provided quite a bit of evidence in there
[08:17.240 --> 08:22.560] for just, you know, for a reasonable person to believe that there is justification for
[08:22.560 --> 08:28.760] him to recuse himself. Okay. Have you looked at the code? What does
[08:28.760 --> 08:31.240] the... The code say that...
[08:31.240 --> 08:45.080] We'll just... Go ahead. This would be under 18455. So, under 18 U.S.C. 455 disqualification
[08:45.080 --> 08:50.680] of judge or justice or magistrate. Any magistrate or judge of the United States shall disqualify
[08:50.680 --> 08:56.840] himself. So, I guess it means he has to in any proceeding in which his impartiality is
[08:56.840 --> 09:02.600] reasonably questioned. Well, I think I reasonably questioned it, and therefore, you know, shall
[09:02.600 --> 09:10.440] means he must do it. Does it go on to say what the procedure is
[09:10.440 --> 09:16.200] if the judge elects not to recuse him, voluntarily recuse himself?
[09:16.200 --> 09:26.040] No, it doesn't. It just says that he shall do it. And then, I did cite in two and three
[09:26.040 --> 09:31.080] of my disqualification of him tampering with a witness, because this is before he even
[09:31.080 --> 09:36.520] threatened me. You know, I believe that he was tampering with it, and so I cited both
[09:36.520 --> 09:45.640] 18 U.S.C. 1512 tampering with U.S.C. federal, and then Texas penal code 36.05 tampering
[09:45.640 --> 09:51.080] with a witness. And so, I cited those as some of my authorities, but it doesn't say what
[09:51.080 --> 09:54.680] will happen if he refuses to relinquish the bench.
[09:54.680 --> 10:02.800] Okay, then you might look at, this may be a good time for a judicial conduct complaint
[10:02.800 --> 10:07.520] against him, because that goes in just like a lawsuit.
[10:07.520 --> 10:16.760] Well, absolutely. As I see it, he's shielding the defendants from prosecution, and he knows
[10:16.760 --> 10:22.760] it's a long list of people. And so, the next thing to do is going to be, you know, I might
[10:22.760 --> 10:28.680] appeal this one, but I also might file a new lawsuit, and then I'll cite him in there in
[10:28.680 --> 10:35.900] that lawsuit. And he's, you know, he'd have a hard time sitting, you know, as a magistrate
[10:35.900 --> 10:43.860] on that court when he's listed as one of the defendants.
[10:43.860 --> 10:51.880] That should get interesting, and keep us up to date on what's going on. I'm thinking that
[10:51.880 --> 11:02.840] your case may wind up as a pivotal case, because what they've done here is so egregious, and
[11:02.840 --> 11:09.480] you've been so careful to document all of their mistakes. And I can't help but think
[11:09.480 --> 11:18.920] this is why Judge Sparks is so upset and why he screwed up so bad, because he acted ignorant,
[11:18.920 --> 11:26.480] and you were a pro se, so you weren't too intimidated by his bad attitude. That he's
[11:26.480 --> 11:31.680] used to lawyers ducking and running for cover.
[11:31.680 --> 11:35.440] I skipped over some really important stuff when I was giving some highlights. I just
[11:35.440 --> 11:46.280] recalled that. So, this is kudos to you, Randy. When I initially was, you know, when the third
[11:46.280 --> 11:53.120] court of appeals kicked up my case, you know, and they entered, you know, obviously provable
[11:53.120 --> 11:58.720] perjured statements into the record, you know, one of them just being, you know, I never
[11:58.720 --> 12:05.280] objected, even though there's an inch of documents, you know, contrary to that fact, and running
[12:05.280 --> 12:10.800] the routine of filing criminal complaints in, I did get an interesting ruling from the
[12:10.800 --> 12:17.340] court of criminal appeals. And they gave an order to the third court to review it again,
[12:17.340 --> 12:24.680] and they also said that they mandated to the third court to preserve my documents. So,
[12:24.680 --> 12:29.680] I do have a letter from the third court of appeals. They wanted to destroy about 1,500
[12:29.680 --> 12:34.840] pages of documents, because they wanted, you know, to hide the evidence, obviously, destroy
[12:34.840 --> 12:39.240] the evidence. And the court of criminal appeals said, no, you shall maintain these records
[12:39.240 --> 12:47.840] for at least 25 years. So, at least I was able, through that process, to preserve the
[12:47.840 --> 12:54.960] record for future work. And I wouldn't have been able to do that without running the system.
[12:54.960 --> 13:05.160] So, thank you very much for that. And I have the district with Rosemary Lemberg. They have
[13:05.160 --> 13:11.360] a white-collar crime division looking into it. Oh, this is another interesting thing.
[13:11.360 --> 13:17.140] In the Travis County thing, I found out that there's an insurance policy for the county.
[13:17.140 --> 13:24.040] And so, I filed a claim. They accepted a claim. She's a licensed insurance investigator. And
[13:24.040 --> 13:29.480] to the best of my knowledge, I've got to find out the exact fine points. But the Travis
[13:29.480 --> 13:36.280] County attorney immediately found out about that and denied the access to their policy,
[13:36.280 --> 13:41.840] their insurance policy. It doesn't exist to the sponsor without advertising anything.
[13:41.840 --> 13:47.760] These are things that are going to have to come out. And then, but they told a licensed
[13:47.760 --> 13:54.920] insurance investigator not to process my claim. Well, to the best of my knowledge, that's
[13:54.920 --> 14:04.280] a felony offense. And I've got the attorney general of Texas looking into their denial
[14:04.280 --> 14:10.380] of my open records act. So, it's not just misdemeanor charges. It would be felony charges
[14:10.380 --> 14:16.520] for interference with a licensed public investigator, a licensed insurance investigator.
[14:16.520 --> 14:25.840] Oh, and we have a guy. I have a friend who is a licensed insurance investigator and has
[14:25.840 --> 14:32.640] been forever. I need to get him to talk to you and give you all of the ins and outs of
[14:32.640 --> 14:41.340] how to pursue that. How did you find out that the prosecutor told him this?
[14:41.340 --> 14:50.800] That the prosecutor, oh, because they told it to me. One, I didn't know how they got
[14:50.800 --> 14:56.640] my email address, but apparently Travis County somehow did some research and refused to do
[14:56.640 --> 15:02.760] a mailing. They did it through electronic service, which I put a letter in the court,
[15:02.760 --> 15:08.840] do not contact me ever again, $10,000 for each use of this. But to do that, I'm sure
[15:08.840 --> 15:15.120] they did that for not just convenience, but to avoid any possibility of sending things
[15:15.120 --> 15:18.160] through the mail and then I could cite them.
[15:18.160 --> 15:19.160] Mail fraud.
[15:19.160 --> 15:25.600] Exactly. So, I think that, but it's okay. I've got a nice little email, Shane, and we
[15:25.600 --> 15:33.760] can discuss that because we come before mediation in May and so I can ask them about their instructing
[15:33.760 --> 15:44.760] a licensed insurance investigator to not perform their duties. But there's also some bonuses
[15:44.760 --> 15:53.660] to that. By them stopping, they have a period of 180 days, I believe, to come to the station
[15:53.660 --> 15:58.440] and after that they have to rule in my favor. They can't, they lose, they waive their ability
[15:58.440 --> 16:05.360] to deny my claim. They have to, they have to side with me after 180 days. So, the clock
[16:05.360 --> 16:08.600] is ticking in my favor of that one.
[16:08.600 --> 16:16.840] Oh, wonderful. There's just something about when you start screwing things up, you know,
[16:16.840 --> 16:22.000] you've got the biggest tar baby I've ever seen. When you start screwing things up, then
[16:22.000 --> 16:27.520] you try to cover up for what you screwed up. It just keeps getting worse. The only time
[16:27.520 --> 16:34.880] it works for you is when the other guy quits. The other guy doesn't quit. Before long, this
[16:34.880 --> 16:39.720] house of cards is going to fall in on you, just like their prosecution review did.

[20:49.760 --> 20:55.760] of them that I didn't do anything wrong. And it just blows my mind, all at the beginning
[20:55.760 --> 20:59.760] of either of them. I would have been happy if they just would have apologized to handshake
[20:59.760 --> 21:04.760] or whatever, and just let me go. And they just continue to process, they stimulate legal
[21:04.760 --> 21:08.760] process. You know, in the city of Austin, the first time I came to the Magister, he
[21:08.760 --> 21:13.760] threatened and ran the documents down my throat. The second one, they tampered with government
[21:13.760 --> 21:18.760] documents right in front of my witnesses. And then the judge asked me, and there's
[21:18.760 --> 21:23.760] new charges against me, and he's saying, Liggers, the law is no excuse. And I said,
[21:23.760 --> 21:28.760] well, your honor, if Liggers' law is no excuse, do you know what these new charges are? And
[21:28.760 --> 21:35.760] she just goes, no, I don't know. You know, it just goes on and on and on.
[21:35.760 --> 21:41.760] Then denying the access to the records, you know, when I know that they've not provided
[21:41.760 --> 21:48.760] me the evidence, then they change charges, form new charges, I subpoena them, they avoid
[21:48.760 --> 21:54.760] service, and I get it in their own handwriting, that they avoided service, they engineered
[21:54.760 --> 22:00.760] them to avoid service by not having the subpoenas served to them. And then, you know, when I
[22:00.760 --> 22:04.760] filed that into court, the very next day, they sent people to a coffee shop I worked
[22:04.760 --> 22:10.760] at that threatened and harassed me. The first time, I didn't do anything, but the second
[22:10.760 --> 22:15.760] time was very, very obvious, and I put affidavit in. Now, I'm not sure what do they really
[22:15.760 --> 22:19.760] expect me to do, you know, if I put an affidavit in.
[22:19.760 --> 22:27.760] They expect you to just back down and go away and go hide somewhere. There was a John Wayne
[22:27.760 --> 22:37.760] movie called The Searchers, where the Indians took John Wayne's nephew, I'm sorry, niece,
[22:37.760 --> 22:45.760] and him and his nephew went chasing him and chased him for four years. And the nephew
[22:45.760 --> 22:55.760] said to John Wayne, why don't we just stop after all of this time? And he said that the
[22:55.760 --> 23:03.760] Indian don't understand a critter that'll just keep on coming. And that's their problem.
[23:03.760 --> 23:10.760] They expect you to back up and fade away, or they did expect you to. So they did stupid
[23:10.760 --> 23:14.760] stuff, and you called them on it. And once they were called on it, they did something
[23:14.760 --> 23:20.760] even more stupid to try to make the stupid thing go away. And our baby, it just kept
[23:20.760 --> 23:22.760] getting bigger and bigger and bigger.
[23:22.760 --> 23:24.760] It's like telling a lie.
[23:24.760 --> 23:33.760] You could bring the whole house of cards down on them. Go ahead, Mike.
[23:33.760 --> 23:40.760] The thing is, they put me in a situation where I had my back against all I've got to, because
[23:40.760 --> 23:44.760] there's derogatory comments that affected my ability to work. I haven't been able to
[23:44.760 --> 23:50.760] get a job as an engineer since then, because people, you know, this is a quote I'm accused
[23:50.760 --> 23:53.760] all the time of being a criminal. I'm like, there's a bottle of water in the luggage.
[23:53.760 --> 24:00.760] Well, you're a criminal, you know? And I was even told by my systems of counsel that they're
[24:00.760 --> 24:08.760] leaving these notations on my record in BPS, saying there's an open criminal investigation
[24:08.760 --> 24:13.760] just because they're trying to put financial pressure on these, so then I can't get employment
[24:13.760 --> 24:20.760] and I'll have to cave in. I mean...
[24:20.760 --> 24:27.760] They expect that they'll wear you down. And it sounds like they're realizing that you're
[24:27.760 --> 24:36.760] not wearing down, and this is what happens when somebody doesn't wear down. After a while,
[24:36.760 --> 24:40.760] this worm turns and all this stuff starts coming back after them.
[24:40.760 --> 24:45.760] Well, I'm only a couple steps away from the Supreme Court.

[26:29.760 --> 26:35.760] from the real estate deal. I got served yesterday, and I'm the defendant in a lawsuit in North
[26:35.760 --> 26:43.760] Carolina, and it has to do with my family again, and I don't know what my next move
[26:43.760 --> 26:48.760] is. I need a little bit of time, because it does wind back into some of the real estate
[26:48.760 --> 26:53.760] stuff, and I need a little bit of time. I need to not move forward until, but I'm thinking
[26:53.760 --> 26:57.760] I need to file a countersuit.

[27:01.760 --> 27:11.760] It's a trust and passing of a relative, and I am an heir with my sister and my uncle and
[27:11.760 --> 27:17.760] my brother, and my mother was trustee, but not an heir, and six months before the aunt
[27:17.760 --> 27:24.760] died, my mother and brother wiped all of her investments out and invested three and a half
[27:24.760 --> 27:29.760] million dollars into my brother's company in a debenture, which is unsecured, high-risk,
[27:29.760 --> 27:35.760] brand-new company, basically, and told the uncle in July, six months before my aunt died,
[27:35.760 --> 27:40.760] that the purpose was to keep my sister and I from getting any money. And so, but the
[27:40.760 --> 27:46.760] thing is, they took all of his money too, so he's hired a litigation firm. So we've
[27:46.760 --> 27:50.760] got non-accounting. The trustee has never noticed, my sister and I, that we're even
[27:50.760 --> 27:58.760] heirs. You've got conversion, just about everything, self-dealing, you've got a loan
[27:58.760 --> 28:03.760] given at three and a half percent interest only for five years, and then pay in principle
[28:03.760 --> 28:08.760] for ten years after that with no interest. And you can't get your money back, you can't
[28:08.760 --> 28:13.760] convert it, you waive your jury trial, and it's unbelievable. I don't think you can
[28:13.760 --> 28:17.760] stand in court, I just don't think it's defensible at all.
[28:17.760 --> 28:21.760] How were you a defendant?
[28:21.760 --> 28:27.760] Because my uncle sued as the plaintiff and named everybody else's defendants.

[36:47.200 --> 36:55.040] admitted default, never proved default, so let's see. The hearing is for in 2010. They
[36:55.040 --> 37:00.740] sold the house in 2011. They transferred it to Fannie Mae. We filed a resp and telesuit
[37:00.740 --> 37:07.540] in the federal case that was eventually dismissed in July of 2012. We filed a wrongful foreclosure
[37:07.540 --> 37:15.360] case in September of 2012, and they filed... In the meantime, we had to file a bankruptcy
[37:15.360 --> 37:24.040] which was completely unrelated, and they got a relief from stay, and so they filed for
[37:24.040 --> 37:31.000] an eviction, and they actually got an eviction judgment against us on the 12th of December.
[37:31.000 --> 37:40.600] We filed an appeal, and then we filed a 13, Chapter 13, because our Chapter 7 had been
[37:40.600 --> 37:48.520] dismissed just to get a 30 days today, and on the 31st of December... Well, at the beginning
[37:48.520 --> 37:54.940] of December, we sent out our letters of intent to sue in order to set up for a quiet title.
[37:54.940 --> 37:59.520] You have to earn the right due to quiet title, so we sent out our letters of intent to sue
[37:59.520 --> 38:08.080] per in Colorado. It's Rules of Civil Procedure 105, and they want you to try to mediate to
[38:08.080 --> 38:15.160] get the quitclaim, and we sent out a $20 money order in MERS, and we mentioned the money
[38:15.160 --> 38:21.760] order in the intent to sue, and then the quitclaim on the money order in MERS, cash the check.
[38:21.760 --> 38:28.720] They didn't execute the quitclaim, but we can have a judge, I think, compel. So we filed
[38:28.720 --> 38:38.380] our quitclaim, and we filed our quiet title on the 13th of February, and meanwhile, we
[38:38.380 --> 38:45.120] evidently lacked standing on the wrongful foreclosure suit because our bankruptcy attorney
[38:45.120 --> 38:51.320] failed to list our claim against the House on Schedule B. So we've had to reopen our
[38:51.320 --> 38:58.200] Chapter 7 in order to allow the bankruptcy trustee to take it or leave it, but they've
[38:58.200 --> 39:02.540] been just dismissing everyone, no evidence, no nothing, just dismissing everyone because
[39:02.540 --> 39:09.360] we lack standing. But when we filed the quiet title, we filed an automatic stay into every
[39:09.360 --> 39:16.440] other case based on Rule 301 here in Colorado, which is the Rule of Presumption. So all of
[39:16.440 --> 39:23.600] a sudden, we're questioning the presumption of title, and every case is on hold. Every
[39:23.600 --> 39:31.900] case has stayed. And so we are still proceeding. People are still filing documents into the
[39:31.900 --> 39:37.420] wrong foreclosure, and we're answering, but it stayed. Nothing will be decided. So now
[39:37.420 --> 39:42.880] we're on the quiet title. We filed the quiet title on the 13th of February, and then on
[39:42.880 --> 39:48.800] the 8th of March, out of nowhere, the lender had three attorneys in the district court,
[39:48.800 --> 39:54.040] and they hired two new ones for the federal court to remove it to federal court. And it's
[39:54.040 --> 40:00.600] a states' rights issue, so I filed a motion to remand. I amended my pleading and took
[40:00.600 --> 40:05.800] out a federal rule, and they didn't oppose it, and they remanded it back to the state
[40:05.800 --> 40:13.900] court in 13 days. And so now we're just waiting for the John and Jane Does, who had to be
[40:13.900 --> 40:19.320] noticed through public notice, and they have until the 25th of April to file any kind of
[40:19.320 --> 40:27.420] a claim into the case. So currently I'm working on, I know these attorneys are from someplace
[40:27.420 --> 40:34.520] else. I challenged their agency, and they gave me a lineage of the company, but they
[40:34.520 --> 40:40.600] didn't give me their agency. So I'm kind of racking my head and thinking maybe what I
[40:40.600 --> 40:44.440] need to do is to find out who hired them and maybe just compel the court to force them
[40:44.440 --> 40:48.720] to show who they're really working for. But I don't know how to word that up, Randy. And
[40:48.720 --> 40:54.280] then I also have to, the lender has responded. They're the only ones really named in the
[40:54.280 --> 40:59.820] quiet title, and they've responded with a motion to dismiss, of course. But in the wrongful
[40:59.820 --> 41:05.280] foreclosure case, they responded that they transferred all of their interests shortly
[41:05.280 --> 41:13.120] after the loan was closed in 2006. They did not notice of a default. They did not know
[41:13.120 --> 41:18.680] about a foreclosure, and they had no claims against the property. So I believe that represents
[41:18.680 --> 41:24.440] judicial estoppel in the quiet title. What say ye?
[41:24.440 --> 41:35.920] Yeah, that goes directly to collateral estoppel. They cannot take a position in one case and
[41:35.920 --> 41:42.680] take a diametrically opposed position in another. Once they have made the admission that they
[41:42.680 --> 41:49.160] have no claim, they're collaterally estopped from making another admission, even if they
[41:49.160 --> 42:02.920] were incorrect on that first admission. As to agency, did you send these guys admissions?
[42:02.920 --> 42:11.120] Send them what? The request for admissions and ask them to admit that they didn't have
[42:11.120 --> 42:17.040] agency. Okay, I'll probably have to work with you
[42:17.040 --> 42:26.740] on that one. Admissions and denials are a part of discovery.
[42:26.740 --> 42:31.240] You're allowed admissions. In Texas, now I don't know about Colorado, but in Texas you're
[42:31.240 --> 42:36.920] unlimited to admissions. You can ask a million admit or deny this, admit or deny that. But
[42:36.920 --> 42:43.080] interrogatories, full length questions, interrogatories, you're limited. And I'm sure it's the same
[42:43.080 --> 42:49.440] way in Colorado. But in Texas, I also wanted to, well, I've got the floor here. I'd also
[42:49.440 --> 42:55.320] like to point out to you, Francis, that look in your Colorado statutes, because in Texas,
[42:55.320 --> 43:03.560] there's a very, very important key twist in any action that would quiet the title, such
[43:03.560 --> 43:11.240] as a quiet title action or a suit for trespass to try title. That is that in these types
[43:11.240 --> 43:17.400] of cases, the burden of proof is on the defendant to take advantage of that, if that's the same
[43:17.400 --> 43:24.960] way in Colorado. Okay, I'll find that out. You know what, I
[43:24.960 --> 43:30.840] believe it is very similar here that they have to prove up why they, and the records
[43:30.840 --> 43:38.600] don't support it. And they've already said they don't have a claim. So I, you know, that
[43:38.600 --> 43:45.480] makes sense. It fits how it should be. It's because someone else made a claim against
[43:45.480 --> 43:52.440] your title. You challenge that claim. You don't have to disprove the claim. They're
[43:52.440 --> 43:56.800] the ones that made the claim. They're the ones that have to prove it out.

[47:31.840 --> 47:40.620] foreclosure case. I think that's harassing. So I was filing a motion for sanction. Is
[47:40.620 --> 47:44.600] that appropriate? That is absolutely appropriate.
[47:44.600 --> 47:48.920] Yes. And I know even without asking, you did file
[47:48.920 --> 47:53.720] bar grievances against them. I filed one set of bar grievances with them
[47:53.720 --> 47:57.560] and I was going to file another, but I've just been having to manage all these cases
[47:57.560 --> 48:02.640] because I'm having to manage an eviction, an appeal of an eviction, a quiet title, a
[48:02.640 --> 48:07.080] probate in Florida with my dad, and now this thing with my aunt and the bankruptcy. So
[48:07.080 --> 48:17.080] I, I am a little bit behind, but on the, well, I filed three bar grievances or four bar grievances
[48:17.080 --> 48:24.680] in North Carolina. I did get that. I'm not completely out of the game. The criminal complaint
[48:24.680 --> 48:32.040] on the foreclosure with 52 people involved in it. So I have been, I've been moving forward
[48:32.040 --> 48:38.080] just hadn't done my bar grievances on these cats and I've been helping Dennis.
[48:38.080 --> 48:42.720] So this gets real big. It gets hard to keep up sometimes.

[50:46.200 --> 50:52.040] required in Colorado. It's the only question they ask is if you're in the military and

[51:03.960 --> 51:11.720] only time I ever used the word default was I said, if we're in default, then you're telling

[52:42.400 --> 52:50.680] use excessive force. Is that the same judge Sparks? That's Judge Sparks. Yes, it is. It
[52:50.680 --> 52:56.560] is the same judge. Oh, what a delightful person he must be. He should meet my mother. He's
[52:56.560 --> 53:10.540] a widow now. Maybe he can marry her. I ain't touching that one. Well, maybe if Mike keeps
[53:10.540 --> 53:18.240] it up, he may, we may wind up rid of Sparks. Sparks donated half a million dollars to the

[54:06.400 --> 54:10.640] you can find a nexus somewhere, I found that one of the judges involved with one of our
[54:10.640 --> 54:15.280] cases has MERS and sometimes it's just an inference, but of course you still run up
[54:15.280 --> 54:21.800] against that they get to make their own decision. Well, let me, if you don't mind, let me parallel
[54:21.800 --> 54:28.360] that with this. There's a guy here in Austin who has discovered that not one judge, let
[54:28.360 --> 54:35.720] me repeat that, not one judge, not only in the state of Texas, but in every state with
[54:35.720 --> 54:44.600] the single exception of New York, not one judge has a real oath of office. Now this
[54:44.600 --> 54:52.160] goes to an age old principle. They're called maxims. The maxim is if you recuse all, you
[54:52.160 --> 55:00.320] recuse none. Now my research indicates that every government employee, I don't care if
[55:00.320 --> 55:05.080] he's, if he's picking up trash for the city, digging ditches, I don't care if he's a judge
[55:05.080 --> 55:13.120] on the federal bench, every government employee, their pension is very, very, very deeply invested
[55:13.120 --> 55:18.120] in mortgage backed securities. Many of these judges who have a lot of extra money have
[55:18.120 --> 55:25.280] taken money out of their own coffers and invested even deeper in some of these remics in these
[55:25.280 --> 55:35.720] mortgage backed securities. So they all have a reason to protect their investments in their
[55:35.720 --> 55:44.480] pension funds. But we go back to the same principle. If you recuse all, you recuse none.
[55:44.480 --> 55:53.560] Or if you dismiss all, you dismiss none. But on this issue, this is not one where you actually
[55:53.560 --> 56:01.680] have to recuse all. You just recuse one. Just recuse that one, yeah. Yeah. So we can take
[56:01.680 --> 56:06.680] them on individually. Yeah, but the next one in line is going to be just as guilty as the
[56:06.680 --> 56:12.080] one you just threw in the trash. You've got to, well, you likely, you know, you might
[56:12.080 --> 56:19.640] get a judge that you might get a better shot with. This is true. I've had two decent ones
[56:19.640 --> 56:24.240] and two bad ones in the district court. And I think I had a pretty decent one in the federal
[56:24.240 --> 56:29.560] court too. I didn't have a very good magistrate, but the judge was very, he considered things.
[56:29.560 --> 56:35.160] But right now, the one that he grabbed the quiet title and he was already on the wrongful
[56:35.160 --> 56:39.720] foreclosure. And they're just expecting, I think, to dismiss it because I lack standing
[56:39.720 --> 56:47.880] because the trustee is the real party in interest until that bankruptcy is reclosed. That's
[56:47.880 --> 56:56.080] just one of the things. So what are you looking at? You're pretty close to getting yours pretty
[56:56.080 --> 57:01.480] well sewed up, aren't you? Well, the bankruptcy attorney, I mean the bankruptcy
[57:01.480 --> 57:05.920] trustee decided to reopen the whole thing and decided that somehow or another I had
[57:05.920 --> 57:10.680] more than two nickels to rub together. And he reopened everything last Wednesday when
[57:10.680 --> 57:14.900] it was supposed to close day after tomorrow and the judge had put it together so it would
[57:14.900 --> 57:20.640] only be open for 30 days. And so he's going to take a look. I sent him a bunch of documents,
[57:20.640 --> 57:26.920] but if he goes ahead and lets go of it, then yes, we are very close. We'd be very close
[57:26.920 --> 57:36.480] to having the title quieted. And then we would be looking to find some serious motivation
[57:36.480 --> 57:43.760] to get them to cough up something for the last two years of knucklehead hell they put
[57:43.760 --> 57:51.520] me through all of us through. And then, you know, then we would be done with that at least.

[01:04:36.280 --> 01:04:43.440] wondering what Steve's thoughts are as to a correct oath of office. Okay. The issue
[01:04:43.440 --> 01:04:50.680] that was raised in this gentleman's pleading was that there is supposed to be two oaths,
[01:04:50.680 --> 01:04:58.240] one for the state, one for the United States. Now, he said, the judge said, in this case,
[01:04:58.240 --> 01:05:04.680] he said, I'm not beholding to the United States Constitution. This man asked him, he
[01:05:04.680 --> 01:05:10.180] said, are you beholding to the Texas Constitution? He said, I certainly am, yes. Well, let me
[01:05:10.180 --> 01:05:17.180] draw your attention to, I believe it was something in Article 1 where it said that Texas was
[01:05:17.180 --> 01:05:28.100] established a free state subject only to the Constitution of the United States. So that
[01:05:28.100 --> 01:05:38.640] means that their oath is to be to wit, quote unquote, to wit, which means quote unquote.
[01:05:38.640 --> 01:05:47.500] That means that the verbiage in the United States Constitution is supposed to be quote
[01:05:47.500 --> 01:05:57.000] unquote, and it is not. They are supposed to have an oath where they will not only protect
[01:05:57.000 --> 01:06:01.280] the Constitution, but they will obey it.
[01:06:01.280 --> 01:06:06.560] It's the obey part that they left out. Hey, I'll protect it, you bet. We'll put it in

[01:07:08.800 --> 01:07:16.680] of living within the county. I took it to the assessor and I asked her if it was arbitrary
[01:07:16.680 --> 01:07:22.000] or if it was based on facts but her knowledge, and she told me that it was based on facts
[01:07:22.000 --> 01:07:25.720] but her knowledge, and I said, excellent, then I must be in the right place. I put it
[01:07:25.720 --> 01:07:28.800] down on the desk and I split it across here and I said, you wouldn't have any problem
[01:07:28.800 --> 01:07:33.960] finding that under penalty of perjury. Oh no, we don't do that. I found that very interesting.
[01:07:33.960 --> 01:07:41.200] So I started reading. And I've come to the conclusion that the property tax code, or
[01:07:41.200 --> 01:07:49.240] the property and tax code that is in the Texas statute, does not apply to non-commercial
[01:07:49.240 --> 01:07:57.240] privately owned land, owned by a man, woman, or any other creation of God. Everything is
[01:07:57.240 --> 01:08:04.240] a statutory term and defined in statute as something other than a man or woman. I got
[01:08:04.240 --> 01:08:11.760] a call, I withheld paying. The first person to show up at the door was an alleged attorney
[01:08:11.760 --> 01:08:18.960] for the school district, and he alleged that I had some contractual obligation to the school
[01:08:18.960 --> 01:08:25.360] district. And I questioned him about the contract, and I questioned him about his cause of action,
[01:08:25.360 --> 01:08:31.680] and he didn't have any of it. No verified claim, no witnesses, didn't have anything
[01:08:31.680 --> 01:08:41.240] to offer me. So would you say that a court gains jurisdiction with pleadings sufficient
[01:08:41.240 --> 01:08:49.680] to invoke the Court's Judicial Power Act? What I'm asking is, if either the plaintiff
[01:08:49.680 --> 01:08:57.080] or the defendant has no pleadings that were sufficient, then the case is the point. Am
[01:08:57.080 --> 01:09:04.760] I assuming that correct? The plaintiff would lack standing to invoke
[01:09:04.760 --> 01:09:12.600] the subject matter jurisdiction of the court. Right. And from what I understand, that an
[01:09:12.600 --> 01:09:19.440] attorney lacks sufficient standing if he's standing alone, meaning he has to have some
[01:09:19.440 --> 01:09:26.600] kind of verified complaint or this with personal first-hand knowledge for anybody that's going
[01:09:26.600 --> 01:09:32.960] to stand up in court and swear or affirm that I've done them wrong or anything else. Is
[01:09:32.960 --> 01:09:38.400] that correct? Right. Well, the attorney doesn't swear on
[01:09:38.400 --> 01:09:50.440] his oath. However, under Texas law, the attorney is responsible for the claims that he makes.
[01:09:50.440 --> 01:09:58.000] The attorney may not accept the veracity of his client. He must perform his own investigation
[01:09:58.000 --> 01:10:02.280] to ensure that the claims by his client are valid.
[01:10:02.280 --> 01:10:13.280] Now, if the attorney makes a proactive statement of fact to the court and that statement and
[01:10:13.280 --> 01:10:22.080] it is material and the statement of fact is untrue, that's aggravated perjury. But normally
[01:10:22.080 --> 01:10:34.580] the attorney doesn't testify. He submits documents. But if the document that makes a proactive
[01:10:34.580 --> 01:10:44.760] statement of fact or law, not law, just proactive statement of fact is not authenticated, affirmed
[01:10:44.760 --> 01:10:53.520] and authenticated by the principal, then it's unacceptable, then it's inadmissible.

[01:47:59.120 --> 01:48:04.520] local county or district attorney the attorney general has concurrent diction with that consenting
[01:48:04.520 --> 01:48:11.960] local prosecutor to prosecute an offense under this chapter so okay here's the issue consent
[01:48:11.960 --> 01:48:21.680] is the issue the if the prosecutor is the accused there's two options either the prosecutor
[01:48:21.680 --> 01:48:29.680] must petition the district court to appoint an attorney pro tem or since the attorney
[01:48:29.680 --> 01:48:38.200] general has concurrent jurisdiction then we follow with the attorney general since he
[01:48:38.200 --> 01:48:45.560] has concurrent jurisdiction and since the the district attorney is disqualified then

[01:52:45.400 --> 01:52:52.320] just unelected done appointed bureaucrats who don't oftentimes don't know a whole lot
[01:52:52.320 --> 01:52:57.080] and then in that study I came across a lot of case law that says if you agree to take
[01:52:57.080 --> 01:53:05.120] a case to mediation and people who perform the mediation don't know the law and they
[01:53:05.120 --> 01:53:11.080] rule you know they rule against you they they issue a ruling with some becoming even if
[01:53:11.080 --> 01:53:17.760] they even if their ruling isn't you know a complete odds with the law you agreed to take
[01:53:17.760 --> 01:53:22.480] it there and so whatever decision they issue is binding and I raised some objections over
[01:53:22.480 --> 01:53:26.280] that and finally got the district court to agree that okay no we don't have to go to
[01:53:26.280 --> 01:53:31.200] mediation so I just if mike's still listening he might want to do a little bit of research
[01:53:31.200 --> 01:53:37.520] on that yeah well but mike the reason mike brought that up his judge had already dismissed
