[07:13.260 --> 07:17.220]  discuss some issues concerning a lawsuit my homeowner association filed
[07:17.220 --> 07:22.540]  against me for allegedly allegedly not paying annual assessments and we
[07:22.540 --> 07:27.780]  digest version of this fact surrounding the case exposed the homeowners
[07:27.780 --> 07:31.860]  association and their attorney for committing several acts of fraud is
[07:31.860 --> 07:37.260]  outlined in my countersuit in addition to the fraud plaintiffs through its
[07:37.260 --> 07:42.780]  attorney committed several counts of simulation of legal process in Florida
[07:42.780 --> 07:47.100]  person commits third-degree felony when such a person files it with the court
[07:47.100 --> 07:51.420]  documents including summons lien complaint notice or any other document
[07:51.420 --> 07:55.460]  while knowing that the basis finds those documents were known to be fraudulent
[07:55.460 --> 08:00.980]  or misrepresented facts for the purpose of obtaining property you'll notice he
[08:00.980 --> 08:06.500]  sees quoting the statute and it says documents including a summons lien
[08:06.500 --> 08:14.340]  complaint notice or other document okay when I read the statute the grin on my
[08:14.340 --> 08:19.740]  face that stretched from ear to ear lasted for about a week I got busy writing
[08:19.740 --> 08:23.060]  grievances against the attorney representing the homeowners association
[08:23.060 --> 08:27.780]  that weekend I bargained the attorney for engaging in a criminal activity
[08:27.780 --> 08:33.900]  simulation of legal process affecting the time real estate a total of real
[08:33.900 --> 08:39.300]  estate a total of eight times the first was for filing a notice of lien second
[08:39.300 --> 08:43.740]  was for filing a less pendants the third was for filing and having caused
[08:43.740 --> 08:49.220]  issue a summons the fourth was for filing the actual complaint I repeated the
[08:49.220 --> 08:55.060]  same grievances for my wife who was also named in complaint notice etc etc
[08:55.060 --> 08:59.460]  total of eight grievances were mailed over a period of two weeks for a time
[08:59.460 --> 09:07.140]  spanning 16 weeks I'm sorry we're mailed every other two weeks for a time
[09:07.140 --> 09:12.820]  spanning 16 weeks by the time I got a response from the first grievance mailed
[09:12.820 --> 09:17.340]  there was already another one mailed and the next one awaiting to be mailed
[09:17.340 --> 09:21.700]  following week I got three responses before the Florida bar stopped answering
[09:21.700 --> 09:27.220]  me altogether each response afforded the attorney the opportunity to rebut the
[09:27.220 --> 09:30.880]  allegations afforded me a second opportunity to rebut all defense made
[09:30.880 --> 09:36.340]  by the attorney first response was just as he said it would be the standard we
[09:36.340 --> 09:40.620]  have examined in the allegations made in front the lawyers conduct did not rise
[09:40.620 --> 09:45.900]  to the level of blah blah blah the first two were identical in response the third
[09:45.900 --> 09:50.460]  was a little different third were response from Florida bar stated started
[09:50.460 --> 09:54.580]  off with we appreciate time and engine taking file this complaint and all the
[09:54.580 --> 09:58.380]  supporting documents against Mr. Lawyer however we regret to inform you that
[09:58.380 --> 10:04.540]  level of conduct did not rise to a level of blah blah blah now here's where it
[10:04.540 --> 10:08.860]  got a little interesting right after their standard statement there were two
[10:08.860 --> 10:14.500]  sentences that I had to reread that followed the first sentence read our
[10:14.500 --> 10:18.980]  decision plays no part in hindering the pursuit of other legal remedies you can
[10:18.980 --> 10:24.380]  seek against Mr. Lawyer final sentence urged me to forward any court order
[10:24.380 --> 10:28.980]  sanctioning Mr. Lawyer as this would reopen the file and may potentially
[10:28.980 --> 10:34.220]  change the review committee's determination after the third response
[10:34.220 --> 10:38.180]  from the Florida bar received no further responses from them I started mailing
[10:38.180 --> 10:43.540]  out these bar grievances around October 2011 and continue to 212 until all were
[10:43.540 --> 10:48.100]  mailed and in the meantime I served the plaintiff with interrogatories and
[10:48.100 --> 10:54.780]  requests for production both discovered what requests went unanswered and a motion
[10:54.780 --> 11:01.060]  for a hearing to compel discovery static I'm sorry the statute the state
[11:01.060 --> 11:06.180]  district court calendar is such that a hearing takes about six to eight weeks
[11:06.180 --> 11:10.060]  to be scheduled here and there were there were three scheduled hearings in
[11:10.060 --> 11:17.500]  212 that Mr. Lawyer moved to continuance with just 24 hours notice even though he
[11:17.500 --> 11:21.580]  was given opportunity to select from a range of dates that would best suit his
[11:21.580 --> 11:28.940]  schedule last week the judge got to hear my motion to compel discovery motion
[11:28.940 --> 11:33.100]  for reconsideration and the lawyers motion for protective order all in one
[11:33.100 --> 11:38.340]  day I got railroaded but not having a court reporter present but that's okay
[11:38.340 --> 11:41.980]  the judge has already been challenged on subject matter jurisdiction of my
[11:41.980 --> 11:46.300]  pleadings to which he has failed to address I also have the transcript of
[11:46.300 --> 11:51.980]  my motion to strike sham pleadings where she made the comment that she ought to
[11:51.980 --> 11:57.940]  dismiss the case so that she's inclined to grant me my motion etc but allow the
[11:57.940 --> 12:02.700]  plaintiff's count one for breach of contract to stand citing no law that
[12:02.700 --> 12:08.580]  applies to the facts that came before her the judge commented only that she will
[12:08.580 --> 12:14.260]  allow the count to stand until she gets to hear from the other side correct me
[12:14.260 --> 12:19.500]  if I'm wrong but the other side has representation speaking on its behalf
[12:19.500 --> 12:24.940]  and is not obliged to show up and testified any motions put before the
[12:24.940 --> 12:29.780]  court the court's only duty that day was to examine the sham pleadings in my
[12:29.780 --> 12:35.140]  motion and apply the law as to as the facts and evidence was brought before
[12:35.140 --> 12:42.860]  her that proved my point precisely the transcript is very damning as the judge
[12:42.860 --> 12:46.620]  agreed with all the issues I raised but still allowed the breach of contract
[12:46.620 --> 12:51.500]  to stand without addressing my motion to strike sham pleadings for the breach of
[12:51.500 --> 12:55.940]  contract claim brought forth by the plaintiff all facts and evidence which
[12:55.940 --> 13:00.340]  includes board of directors own meeting minutes supporting my allegations that
[13:00.340 --> 13:06.100]  they usurped authorities not expressly granted to them in assembling an annual
[13:06.100 --> 13:11.500]  budget that required 64 member owners to be present to approve the amount sought
[13:11.500 --> 13:16.460]  in the budget these are separate issues so I'll stay on point and tell you why
[13:16.460 --> 13:21.500]  I'm writing you today at the end of the hearing and this is just to the good
[13:21.500 --> 13:27.660]  part at the end of the hearing how last Thursday Mr. Lawyer sought me out in the
[13:27.660 --> 13:33.100]  courthouse and asked if I had a few minutes to talk we shared the elevator
[13:33.100 --> 13:37.660]  to ground floor where he made it clear to me that he believes this case has gone
[13:37.660 --> 13:41.700]  on longer than it should I agreed I said I thought you'd throw in the towel a
[13:41.700 --> 13:47.860]  long time ago he picked up on my jab and smiled a bit at least he had a sense
[13:47.860 --> 13:54.460]  humor he continued to tell me that if we're up if it were up to him that's
[13:54.460 --> 13:59.740]  exactly what you do but since the choice belongs to his client my home and
[13:59.740 --> 14:06.860]  association he has to abide by how they want to pursue he then asked how can we
[14:06.860 --> 14:14.060]  work this out so that we can bring all litigation to a close for the next 20
[14:14.060 --> 14:19.500]  minutes we negotiated pass to a settlement he thought 15 the 15,000
[14:19.500 --> 14:23.860]  amount I threw out there was a very reasonable bout but remain reminded me
[14:23.860 --> 14:28.420]  that he still had to address issues that would remain after the settlement
[14:28.420 --> 14:33.220]  fast forward to the last 10 minutes of the conversation he took me by complete
[14:33.220 --> 14:40.580]  surprise when he made the following statement mr. Mark mr. Rodriguez not to
[14:40.580 --> 14:47.500]  be disrespectful or to even bring up the matter but you kept me in front of the
[14:47.500 --> 14:52.980]  bar committee for almost a year I'm not complaining if you're right to do so but
[14:52.980 --> 14:58.740]  your writing was so effective throughout this whole action that well I'll just say
[14:58.740 --> 15:04.580]  I never encountered a defendant who has taken it to me the way you did he then
[15:04.580 --> 15:10.780]  followed up with I really I really really got to commend you for defending
[15:10.780 --> 15:15.020]  yourself the way you've done up to this point I've been doing this for almost
[15:15.020 --> 15:19.300]  15 years now and I have never come across a litigant such as yourself I'm
[15:19.300 --> 15:24.300]  going up against the best in the worst of the bunch but none have made me hit the
[15:24.300 --> 15:30.260]  books and stay up all hours of the night like you have as if that admission
[15:30.260 --> 15:35.900]  wasn't already making me feel related he added okay so you got to tell me a slight
[15:35.900 --> 15:41.380]  pause as he prepared for his next question are you a frustrated lawyer who
[15:41.380 --> 15:46.660]  left the practice at that point I couldn't contain myself any longer I
[15:46.660 --> 15:52.380]  burst out laughing he had a somewhat perplexed look on his face but he was
[15:52.380 --> 15:57.900]  anticipating a response I said right up to this point I thought you were okay

[22:35.220 --> 22:46.220]  But rather about principles we have long abandoned that we must put in place once again if we are to avoid the fabric of our society being forever altered

[24:07.220 --> 24:14.220]  Rather they were attempting to protect Mr. Lawyer from me or working out a corrective action with Mr. Lawyer
[24:14.220 --> 24:17.220]  In a non-public format isn't the issue
[24:17.220 --> 24:23.220]  The issue is and remains that Mr. Lawyer had an attitude adjustment thereafter
[24:23.220 --> 24:26.220]  One more thing before I forget
[24:26.220 --> 24:33.220]  Mr. Lawyer mentioned that his legal expenses to the association have accumulated close to $20,000 thus far
[24:33.220 --> 24:38.220]  He also made mention that he would waive all his costs to the association
[24:38.220 --> 24:44.220]  If we could reach an agreement as this expense would potentially devastate the association
[24:44.220 --> 24:53.220]  Little does he know that I'm fully aware that his philanthropy is nearly his way of reducing his liability from our practice
[24:53.220 --> 25:09.220]  The association may realize that they suffer damages directly to the attorney's inability to have performed a vigorous due diligence in testing the veracity of the association's claim prior to filing a complaint

[28:39.220 --> 28:57.220]  When that occurred, it invoked those judges' duty under Article 2.10 and 2.11, Texas Code of Criminal Procedure, to institute an examining trial under Chapter 16, Code of Criminal Procedure
[28:57.220 --> 29:00.220]  And examine into the sufficiency of the allegation
[29:00.220 --> 29:09.220]  And then seal all the documents had in here and cause the name to be written across the ceiling of the envelope and forward it to the Court of Jurisdiction
[29:09.220 --> 29:17.220]  But we really don't want the commissioners being put in that position because if they didn't
[29:17.220 --> 29:21.220]  If they failed to perform a duty, they were required to perform it in the process
[29:21.220 --> 29:28.220]  And not a citizen, full and free access to and dormit right while that's a class A misdemeanor in Texas and they could be prosecuted

[47:48.220 --> 47:51.220]  So I'm assuming they have a warrant
[47:51.220 --> 47:53.220]  For my arrest for failure to appear
[47:53.220 --> 47:55.220]  Now what I was planning on doing
[47:55.220 --> 47:57.220]  Is putting in some paperwork prior to them
[47:57.220 --> 47:59.220]  Somebody told me, well, they'll give you 30 days
[47:59.220 --> 48:01.220]  Before they put a rest out for you
[48:01.220 --> 48:02.220]  A warrant for your arrest
[48:02.220 --> 48:04.220]  So I was planning on getting some paperwork
[48:04.220 --> 48:06.220]  Submitted to the court prior to then
[48:06.220 --> 48:09.220]  But like I said, the sheriff's right at my door tonight
[48:09.220 --> 48:12.220]  I did not answer
[48:12.220 --> 48:14.220]  And now I'm wondering, okay
[48:14.220 --> 48:15.220]  Now I'm kind of in a pickle
[48:15.220 --> 48:17.220]  Because I got to take care of the situation somehow
[48:17.220 --> 48:21.220]  And do you have any suggestions?

[48:36.220 --> 48:39.220]  That it's issued to any police officer
[48:39.220 --> 48:42.220]  In the county or the jurisdiction
[48:42.220 --> 48:47.220]  Then it orders them to arrest this person
[48:47.220 --> 48:52.220]  And bring him before me
[48:52.220 --> 48:55.220]  Warrants always are issued by a magistrate
[48:55.220 --> 48:57.220]  Not a judge
[48:57.220 --> 48:58.220]  He may be a judge
[48:58.220 --> 49:00.220]  But when he issues the warrant, he's not a judge
[49:00.220 --> 49:02.220]  He's a magistrate
[49:02.220 --> 49:05.220]  And they order the police officer
[49:05.220 --> 49:07.220]  To arrest the person
[49:07.220 --> 49:09.220]  And bring him before the magistrate
[49:09.220 --> 49:12.220]  To issue the warrant
[49:12.220 --> 49:15.220]  So go down there
[49:15.220 --> 49:18.220]  Appear at the court
[49:18.220 --> 49:22.220]  And ask to see your magistrate
[49:22.220 --> 49:24.220]  And then when you're before the magistrate
[49:24.220 --> 49:27.220]  To tell them who you are
[49:27.220 --> 49:30.220]  Now, if they subsequently arrest you
[49:30.220 --> 49:32.220]  All they'll do is they'll just take you down
[49:32.220 --> 49:35.220]  Book you and let you back out
[49:35.220 --> 49:38.220]  Most of the time they don't do their own traffic ticket
[49:38.220 --> 49:43.220]  But if they do
[49:43.220 --> 49:48.220]  Without regard to anything else
[49:48.220 --> 49:50.220]  That is false arrest
[49:50.220 --> 49:54.220]  On its face
[49:54.220 --> 49:57.220]  They can't arrest someone
[49:57.220 --> 50:01.220]  In order to bring them before a magistrate
[50:01.220 --> 50:05.220]  When they are standing before a magistrate
[50:05.220 --> 50:10.220]  So that gives them a legal problem
[50:10.220 --> 50:12.220]  Almost certainly if you go down there
[50:12.220 --> 50:14.220]  And step up in front of them
[50:14.220 --> 50:16.220]  And ask to see a magistrate
[50:16.220 --> 50:18.220]  Don't ask to see a judge
[50:18.220 --> 50:21.220]  When you signed that traffic citation
[50:21.220 --> 50:25.220]  You did not agree to see a judge
[50:25.220 --> 50:30.220]  You agreed to see a magistrate
[50:30.220 --> 50:34.220]  This is how the due process works
[50:34.220 --> 50:39.220]  When someone makes an allegation
[50:39.220 --> 50:42.220]  Of the commission of a crime
[50:42.220 --> 50:47.220]  They present that allegation to a magistrate
[50:47.220 --> 50:51.220]  Now, if the person happens to be a judge
[50:51.220 --> 50:55.220]  When that allegation is presented to the person
[50:55.220 --> 50:58.220]  The judge's hat comes off
[50:58.220 --> 51:00.220]  And the magistrate's hat goes on
[51:00.220 --> 51:03.220]  And magistrates can only do three things
[51:03.220 --> 51:05.220]  One, they can marry people
[51:05.220 --> 51:08.220]  That's just something to make a few extra bucks
[51:08.220 --> 51:11.220]  When a judge marries someone
[51:11.220 --> 51:13.220]  He's doing that as a magistrate, not a judge
[51:13.220 --> 51:14.220]  That's why a mayor can marry people
[51:14.220 --> 51:16.220]  Because he's a magistrate
[51:16.220 --> 51:20.220]  But that's just something to make a few extra bucks on the side
[51:20.220 --> 51:24.220]  They can hold an examining trial
[51:24.220 --> 51:26.220]  And in Texas there's a whole chapter
[51:26.220 --> 51:28.220]  On how an examining trial is to be held
[51:28.220 --> 51:34.220]  Chapter 16 and set bail
[51:34.220 --> 51:36.220]  That's it
[51:36.220 --> 51:39.220]  That's what magistrates do
[51:39.220 --> 51:44.220]  So, you agreed to go before a magistrate
[51:44.220 --> 51:49.220]  Because someone accused you of a crime
[51:49.220 --> 51:54.220]  And the judge, when you were accused of a crime
[51:54.220 --> 51:59.220]  The police also had the authority to arrest without a warrant
[51:59.220 --> 52:02.220]  But he would have had to take you
[52:02.220 --> 52:06.220]  Directly to the nearest magistrate
[52:06.220 --> 52:09.220]  Well, to keep him from having to do that
[52:09.220 --> 52:15.220]  They have, every state has granted a concession
[52:15.220 --> 52:18.220]  Where if you will agree to take yourself
[52:18.220 --> 52:23.220]  Before that magistrate within a given amount of time
[52:23.220 --> 52:27.220]  Then the police officer doesn't have to arrest you
[52:27.220 --> 52:30.220]  And cart you off to jail
[52:30.220 --> 52:36.220]  Well, in Texas the statute that grants the authorization
[52:36.220 --> 52:41.220]  States that the citation must state a time
[52:41.220 --> 52:48.220]  And place to appear before a magistrate
[52:48.220 --> 52:52.220]  It does not say a range of times
[52:52.220 --> 52:57.220]  It says a time and place
[52:57.220 --> 53:00.220]  Now, some jurisdictions here will actually state
[53:00.220 --> 53:03.220]  You must appear on this date
[53:03.220 --> 53:06.220]  Most say you must appear on or before
[53:06.220 --> 53:08.220]  And that makes the statute invalid
[53:08.220 --> 53:12.220]  At least here in Texas you might look at that in New York
[53:12.220 --> 53:17.220]  But in any case, the purpose of going before the magistrate
[53:17.220 --> 53:23.220]  Is so that the magistrate can examine into the sufficiency of the accusation
[53:23.220 --> 53:26.220]  And determine if there's sufficient evidence
[53:26.220 --> 53:30.220]  To give a reasonable person of ordinary prudence
[53:30.220 --> 53:33.220]  Cause to believe that a crime had been committed
[53:33.220 --> 53:35.220]  And it easily committed that crime
[53:35.220 --> 53:41.220]  Now, it only requires probable cause
[53:41.220 --> 53:45.220]  It does not require proof to a certainty
[53:45.220 --> 53:49.220]  Like 50 for 50-50
[53:49.220 --> 53:58.220]  That's enough for a magistrate to order you to stand and answer
[53:58.220 --> 54:01.220]  Once the magistrate has made that determination
[54:01.220 --> 54:08.220]  And fills out an order designating that he found probable cause
[54:08.220 --> 54:11.220]  Then he's to take that documentation
[54:11.220 --> 54:14.220]  And forward it to the clerk of the court
[54:14.220 --> 54:19.220]  For the purpose of subject matter jurisdiction
[54:19.220 --> 54:23.220]  An allegation by a citizen gives a magistrate
[54:23.220 --> 54:29.220]  Subject matter jurisdiction to hold an examining trial
[54:29.220 --> 54:34.220]  A determination of probable cause by a magistrate
[54:34.220 --> 54:39.220]  Gives the court of original jurisdiction
[54:39.220 --> 54:43.220]  Jurisdiction to hear the complaint
[54:43.220 --> 54:47.220]  That's why for 17.30 in the Texas Code comes in
[54:47.220 --> 54:52.220]  It says that after the magistrate holds the hearing
[54:52.220 --> 54:56.220]  If he finds he's to issue an order stating whether he found probable cause
[54:56.220 --> 54:58.220]  Or released a person at the liberty
[54:58.220 --> 55:02.220]  They're remanded into the jail, set bail, so forth
[55:02.220 --> 55:08.220]  And if there was no warrant, then he's to issue a warrant
[55:08.220 --> 55:11.220]  Under 16-20 Code of Criminal Procedure
[55:11.220 --> 55:19.220]  Because it is that warrant that gives the court of jurisdiction
[55:19.220 --> 55:22.220]  Original jurisdiction over the case
[55:22.220 --> 55:26.220]  And he's to forward that warrant to the court of jurisdiction
[55:26.220 --> 55:29.220]  And that's how jurisdiction moves to the courts
[55:29.220 --> 55:34.220]  Well, we have some case law doing some dance around, dance around
[55:34.220 --> 55:36.220]  Trying to get around that issue
[55:36.220 --> 55:38.220]  But that's how it's supposed to work
[55:38.220 --> 55:41.220]  And what's going through all of that rigmarole is
[55:41.220 --> 55:45.220]  You signed that citation, you agreed to appear before the magistrate
[55:45.220 --> 55:50.220]  And when you didn't appear, they got all excited about it
[55:50.220 --> 55:55.220]  And were upset that you didn't do what you promised to do
[55:55.220 --> 55:58.220]  So go back and do what you promised to do
[55:58.220 --> 56:00.220]  Appeared before the magistrate
[56:00.220 --> 56:05.220]  And the failure to appear at least in Texas
[56:05.220 --> 56:09.220]  Did not apply to the list of medications
[56:09.220 --> 56:14.220]  The judge cannot file a warrant for failure to appear
[56:14.220 --> 56:16.220]  Because that constitutes a rest
[56:16.220 --> 56:20.220]  And a municipal judge or a justice of the peace
[56:20.220 --> 56:24.220]  Has no subject matter jurisdiction over a accusation
[56:24.220 --> 56:27.220]  That would involve imprisonment
[56:27.220 --> 56:31.220]  Okay, did that make sense?
[56:31.220 --> 56:33.220]  You know what? It somewhat did
[56:33.220 --> 56:38.220]  We don't sign the ticket, we don't sign them in New York here
[56:38.220 --> 56:41.220]  That's number one
[56:41.220 --> 56:44.220]  So just go ahead and contact the court and say
[56:44.220 --> 56:47.220]  Al will be coming in on such and such station
[56:47.220 --> 56:49.220]  No, no, no, don't do that
[56:49.220 --> 56:51.220]  I'll be waiting for you outside the court
[56:51.220 --> 56:54.220]  Just go to the court
[56:54.220 --> 56:58.220]  And make sure when they find out who you are
[56:58.220 --> 57:02.220]  You're standing in front of the magistrate
[57:02.220 --> 57:04.220]  So go into the court and just say
[57:04.220 --> 57:05.220]  I need to see a magistrate
[57:05.220 --> 57:07.220]  Don't tell them who I am right away
[57:07.220 --> 57:10.220]  Because then they'll arrest me
[57:10.220 --> 57:14.220]  Yeah, tell them you want to get married
[57:14.220 --> 57:16.220]  Something, anything
[57:16.220 --> 57:19.220]  Well, I know there's only one day a week
[57:19.220 --> 57:22.220]  That they hold hearings or arraignments
[57:22.220 --> 57:24.220]  And that's on Thursday night
[57:24.220 --> 57:27.220]  Good, then go in Thursday night
[57:27.220 --> 57:29.220]  That's what I was thinking about on Thursday night
[57:29.220 --> 57:33.220]  Stay under cover till then
[57:33.220 --> 57:39.220]  Okay, now, you don't have to be exactly in front of the magistrate
[57:39.220 --> 57:42.220]  If they're holding hearings on that night
[57:42.220 --> 57:46.220]  I would wait till the court convenes
[57:46.220 --> 57:48.220]  And then walk in, go up to the clerk
[57:48.220 --> 57:50.220]  Tell them you're here to see the magistrate
[57:50.220 --> 57:53.220]  You know, explain your circumstances
[57:53.220 --> 57:57.220]  And that will make you almost certain you make the warrant go away
[57:57.220 --> 58:00.220]  Okay, thank you, I appreciate that
[58:00.220 --> 58:02.220]  And then in the meantime, I'm going to put in a motion
[58:02.220 --> 58:04.220]  I've got some paperwork I'm going to put in
[58:04.220 --> 58:06.220]  Put that in at the same time

[01:06:57.220 --> 01:07:03.220]  And you made a new case, you dismissed and refiled this behind my back to a new case
[01:07:03.220 --> 01:07:09.220]  And you didn't give me a pre-trial when I dotted my eyes and crossed my teeth to get one

[01:34:38.220 --> 01:34:47.220]  Well, let's see. I'm sure where I left off with most of the audience. I think how did it work out on the water bottle case?
[01:34:47.220 --> 01:34:53.220]  Let's see. I was found guilty with a $1 fine.
[01:34:53.220 --> 01:35:02.220]  And so when I went to go for appeal, and actually, from my understanding, the city of Austin is not a court of record.
[01:35:02.220 --> 01:35:10.220]  And it can't be because of its charter. And I don't fully know those details well enough. I think Katie Craig knows that a little bit better.
[01:35:10.220 --> 01:35:18.220]  I did put a motion for a new trial, and I'm supposed to be allowed a trial de novo. And so I know in the beginning you're quite a quadrant.
[01:35:18.220 --> 01:35:22.220]  What are we going to do? What are we going to do? We don't know how to appeal from this.
[01:35:22.220 --> 01:35:30.220]  And that was because they couldn't quite engineer, I believe, how they were going to sure change my due process.
[01:35:30.220 --> 01:35:36.220]  And so the route they ended up taking was they said I would have to go to an appeal.
[01:35:36.220 --> 01:35:43.220]  And so I appealed to Travis County, and I paid $71, and they said, no, no, no.
[01:35:43.220 --> 01:35:48.220]  You paid $69, which I get later and later. And you paid finding court files you're not entitled to appeal.
[01:35:48.220 --> 01:35:55.220]  Yeah, well, I got a money order here. It says $71, not $69 in there.
[01:35:55.220 --> 01:36:09.220]  Anyway, it goes up to Travis County, you know, spend the time writing the pellet for you. It goes up, and he just immediately dismisses it, J. David Phillips, and said, well, you paid finding court costs $69.
[01:36:09.220 --> 01:36:16.220]  And so I put a notice to fraud in this court, and a friend and I went to get his open bond.
[01:36:16.220 --> 01:36:25.220]  Really, I have that right now. And so the friend and I went in, and I was wearing an audio recorder under my shirt, my t-shirt.
[01:36:25.220 --> 01:36:31.220]  And it's a well-being, very nice. And we asked for the judges of the bond, and eventually we got robbed of the judges' court.
[01:36:31.220 --> 01:36:40.220]  And he said, well, you know, the bond is filed with the proper people. And my friend looked at each other and we're going, oh, filed with the proper people.
[01:36:40.220 --> 01:36:46.220]  Oh, so much better. Thank you very much. Oh, by the way, can you still sell us a bond?
[01:36:46.220 --> 01:36:53.220]  And so she goes back to the judge and then comes back with sheriff deputies and tried to have us arrested.
[01:36:53.220 --> 01:36:56.220]  One got there out of recording the whole time. We're being very nice.
[01:36:56.220 --> 01:37:03.220]  And so she perjured herself and lied to the deputies and said that she told us to leave multiple times and refused to leave.
[01:37:03.220 --> 01:37:14.220]  And she felt threatened and called them. And, you know, eventually I was not arrested, but my friend had an outstanding warrant for his arrest in the city of Austin,
[01:37:14.220 --> 01:37:19.220]  even though there's no charges against him. They just had a warrant for his arrest just to be arrested.
[01:37:19.220 --> 01:37:23.220]  And I'd even brought the court magistrate just to be put in jail.
[01:37:23.220 --> 01:37:35.220]  Anyways, that's a side note. So I filed to the Third Court of Appeals. They sit on it for over a year. And then finally they go, well, you paid finding court costs.
[01:37:35.220 --> 01:37:45.220]  You're not entitled. And they made a bunch of false statements in there that, you know, stating some things like, well, Handel never claimed to object to that.
[01:37:45.220 --> 01:37:54.220]  So therefore, you know, he must have agreed to it. Well, you know, there's over an inch of filings on a daily basis, you know, several pages each day,
[01:37:54.220 --> 01:38:00.220]  covering to about an inch of paperwork. I looked in the docket and let me, that I objected.
[01:38:00.220 --> 01:38:05.220]  So they had to commit outright perjury and fraud in the Third Court to the 90.
[01:38:05.220 --> 01:38:14.220]  I moved to the Court of Criminal Appeals, found the petition for discretionary review. They kicked it out saying, oh, you paid finding court costs.
[01:38:14.220 --> 01:38:31.220]  I find a petition for review. And they kicked that one out because they say, well, you forgot to put a clause in there stating the work going to waste the court's time.
[01:38:31.220 --> 01:38:42.220]  And I didn't have that oversight. I didn't put it in. And so my response then was, I went back to the Court because he was being quite a smart aleck, I felt.
[01:38:42.220 --> 01:38:46.220]  And I said, well, you know, all these judges are magistrates. I'm telling you what they say, huh?
[01:38:46.220 --> 01:38:53.220]  I said, well, if I present to them a criminal complaint, the criminal activated, you know, are they going to act on it? Well, no, they won't.
[01:38:53.220 --> 01:39:05.220]  Okay. So I filed criminal complaints against all the people up to that point, including the Chief Justice of the Third Court, into and directed to Keller.
[01:39:05.220 --> 01:39:11.220]  And she refused it. And I got a nice little letter back saying, well, you know, we're going to ignore everything you do, but we did save them.
[01:39:11.220 --> 01:39:19.220]  I said, okay, that's fine. And so I sent more criminal affidavits to cross the hallway to the Texas Supreme Court.
[01:39:19.220 --> 01:39:26.220]  And I get a nice letter back saying that we destroyed all your verified criminal affidavits.
[01:39:26.220 --> 01:39:34.220]  And just as a side note, I don't know if that has anything to do with what I did, but two weeks later, that clerk who worked out there doesn't have a job anymore.
[01:39:34.220 --> 01:39:39.220]  Perry replaced her. I think it seemed like her, I can't remember, but they were replaced.
[01:39:39.220 --> 01:39:44.220]  I don't know if it had anything to do with me, but I got a nice little letter back that they destroyed a pile of criminal documents.
[01:39:44.220 --> 01:39:54.220]  And I sent back criminal affidavits, you know, from against all the justices, including Keller, including Woodson, including Phillips, Alameda,
[01:39:54.220 --> 01:40:03.220]  Patty Robinson, who had directed her officers to threaten and intimidate me, you know, etc. All in all, you're recording for them, you're shown.
[01:40:03.220 --> 01:40:18.220]  And then I, after that, I found a new one against Keller or Jefferson Wallace, and sent all those to Lemberg. And I do, I do have a letter from Ned saying they were getting an investigation on that.
[01:40:18.220 --> 01:40:33.220]  Now, I file everything, file my Travis, and so you've, criminal, well, a plaintiff's original complaint, so I filed those in federal district court. So it's in the United States District Court,
[01:40:33.220 --> 01:40:50.220]  Western Division, Austin District, and let's see, they both are, except it is timely, they're all considered initially emeritus. I was initially ruled indigent in both of them.
[01:40:50.220 --> 01:41:03.220]  One of them went to Judge Sparks, and one to an Andrew Austin. Somehow Sam Sparks took over both of them. And so initially I was declared indigent in both of them,
[01:41:03.220 --> 01:41:10.220]  and now Sam Sparks has taken it over, and as soon as I think he started to figure out what's going on, he declared me not indigent.
[01:41:10.220 --> 01:41:21.220]  Without any evidence to his rules to Sponte, he's dismissed it as trivial as to Sponte, even though they were originally considered emeritus.
[01:41:21.220 --> 01:41:36.220]  And so I'm in the process of trying to move it up to the Fifth Court of District as appeals. And I have a letter saying maybe they're waiting, they're waiting my response, and they'll make a decision if I'm indigent or not, not Sam Sparks.
[01:41:36.220 --> 01:41:55.220]  But anyways, I did put a disqualification in last week, and Sam Sparks refuses to monitor that. In his, you know, one of his orders, I mean, I really can't believe that he's a federal district judge,
[01:41:55.220 --> 01:42:13.220]  you know, looking at some of his orders, he cites no law, he just acts, I'll say no, I just dismiss it. He declared me as belligerent. And so in my disqualification, I took the opportunity to define the word belligerent,
[01:42:13.220 --> 01:42:28.220]  since he left it undefined, and I defined it via USB Johnson, where it is the belligerent claimant, you know, available to the belligerent claimant who further stands to the claim of rights in the county,
[01:42:28.220 --> 01:42:34.220]  you must be willing to engage in sustained combat. So, you know, setting a little bit more echoes.
[01:42:34.220 --> 01:42:45.220]  The privilege against self-incrimination is neither recorded to the passive restraint nor to the person who is ignoring his rights, nor to the one who is indifferent thereto. It is a fighting clause.
[01:42:45.220 --> 01:42:58.220]  Its benefits can be retained only by sustained combat. It cannot be claimed by attorney or solicitor. It is belligerent claimant person, Macalester Henkel, available to belligerent claimant person.
[01:42:58.220 --> 01:43:13.220]  He further stated that to the claim of rights of his country, you must be willing to engage in sustained combat. So, you know, I just do that in just to basically annoy him.
[01:43:13.220 --> 01:43:16.220]  I think you're having too much fun with this.
[01:43:16.220 --> 01:43:31.220]  Oh, no, I'm definitely not having fun at all. This is not fun at all. But, um, so I put in, you know, you know, the authorities, I put, you know, 28 USC 455 describing why he's disqualified.

[01:47:52.220 --> 01:47:59.220]  Then that should get tampered with a witness obstruction of justice. Those are felonies.
[01:47:59.220 --> 01:48:10.220]  Absolutely. I can't believe he would be so brazen and so ignorant of the law of himself to just put it in an order.

[01:48:12.220 --> 01:48:18.220]  I see the court not to take any more of my filings.
[01:48:18.220 --> 01:48:25.220]  Yeah, that's outlawing.
[01:48:25.220 --> 01:48:35.220]  So, I mean, you know what I've got? I've got to do it. I mean, just because he says it, I've got to challenge it now.

[01:48:41.220 --> 01:48:51.220]  We just got a big ruling down recently by a really bad guy in prison for 30 years.
[01:48:51.220 --> 01:48:59.220]  He wrote his certiori to the Supreme with a pencil in prison.
[01:48:59.220 --> 01:49:04.220]  They not only took it, but they ruled in his favor unanimous.
[01:49:04.220 --> 01:49:14.220]  I actually put that in. I put Milberg v. U.S. and I put Vivins and Six and the Hunts on agents.
[01:49:14.220 --> 01:49:19.220]  This is at the end because he's declared to the people that I'm charging.
[01:49:19.220 --> 01:49:24.220]  Actually, in both my criminal complaints, I tried to go very mild.
[01:49:24.220 --> 01:49:29.220]  I've only cited just a very few people, especially because I can't afford it.
[01:49:29.220 --> 01:49:37.220]  But, you know, I didn't want to make a big deal out of this. I'm trying to get this off my record and they are just fighting it tooth and nail.
[01:49:37.220 --> 01:49:52.220]  But, you know, I did cite that in the end, you know, I cite, you know, that he's declaring that the people that are opposing me as they are, let's see,
[01:49:52.220 --> 01:50:01.220]  which is exact words, that they are absolutely immune, absolutely immune.
[01:50:01.220 --> 01:50:11.220]  Even though I cite statutes, you know, that show that when a judge acts in administrative duty, they are accountable.
[01:50:11.220 --> 01:50:24.220]  They can be held accountable. And that would be, let's see, let's see, Forster v. White, Stutman v. Sparksman, Morales v. Waco.
[01:50:24.220 --> 01:50:30.220]  A judge is not immune for torture sex committed in purely administrative nonjudicial capacity.
[01:50:30.220 --> 01:50:37.220]  I put that just before my bulliger and claimant comment, you know, where I define bulliger and claimant crime that he left undefined.
[01:50:37.220 --> 01:50:46.220]  And then I end it with, I end it with Milberg v. U.S. and I live it with, live it with Biven v. Six on an agent.
[01:50:46.220 --> 01:50:58.220]  So, you know, I cite their quotes in there. And it's just totally amazing that he's just operating this way almost, I don't know.

[01:51:24.220 --> 01:51:33.220]  And he's, all he's doing is acting susponte. He just says, without evidence, I just declare.

[01:51:39.220 --> 01:51:44.220]  He put a motion to dismiss. I didn't know. And so that's what he does, part of his grounds.
[01:51:44.220 --> 01:51:50.220]  Well, you know, I'm dismissing to human object. Well, I didn't know to object, because he didn't send me a document.

[01:52:02.220 --> 01:52:11.220]  That's what I'm writing right now. I've got already got it written, but I already have a written mandamus.

[01:52:15.220 --> 01:52:24.220]  It should be acceptable for the Fifth Circuit. So I changed everything so it would be satisfactory.

[01:53:17.220 --> 01:53:29.220]  Mike, have you looked at a judicial conduct complaint in the Fed? That is a whole different animal than one in the state.
[01:53:29.220 --> 01:53:40.220]  Yeah, absolutely. And I've already looked at it, and I already said that when he first started dismissing stuff without any justification that I considered.
[01:53:40.220 --> 01:53:48.220]  But, you know, when he recharacterized the COS number, those were grounds for judicial disability.
[01:53:48.220 --> 01:53:57.220]  I actually cited in that, you know, that you were in danger to the public safety.
[01:53:57.220 --> 01:54:07.220]  I bet there's a good chance that Judge Sparks is not going to send you a Christmas card this year.
[01:54:07.220 --> 01:54:22.220]  That's a safe bet. This is why judges hate process, because every once in a while they run across one of these that knows how to clean their clocks.

[01:54:27.220 --> 01:54:47.220]  Well, I've gotten, you know, a nice compliment. I sent one of these to a friend whose wife is attorney, and she said that she was embarrassed because she spent all that money and time on law school, and she couldn't write a document as well as I did.

[01:54:49.220 --> 01:55:06.220]  That may be a lot of the reason that Judge Sparks is so upset, is because your work is good, and he can't get around it, and you're after him, and he can't get you off of it.
[01:55:06.220 --> 01:55:29.220]  Well, he's never, I'm looking through this whole document, and I'm looking for any citation in law. It's just, you know, I don't see one citation, I don't see one, see, I'm trying to find anything that, you know, he cited.
[01:55:29.220 --> 01:55:34.220]  Did you send him a request for finding two fact and conclusions in law?
[01:55:34.220 --> 01:55:43.220]  Absolutely, because he dismissed it with everything without evidence. It's just dismissed. I just, I decide that it's dismissed without any evidence.
[01:55:43.220 --> 01:55:55.220]  You know, I cite the statutes for that also, that a judge, it's under, it's in the rules that a judge does a discretion to dismiss if he has evidence that something is fabulous.
[01:55:55.220 --> 01:56:11.220]  However, I'm putting things that are verified into the record that, you know, a, you know, I have evidence that show the initial, it was a serious or cause, was completely groundless, and I was, one of the things I did do is I put something in clean hands.
[01:56:11.220 --> 01:56:23.220]  I said I come to the court with clean hands, they're preferable with video evidence. However, the statutes come to court with dirty hands, or unclean hands.
[01:56:23.220 --> 01:56:31.220]  And I said, I think maybe Judge Sparks might be shaking hands with some people.
[01:56:31.220 --> 01:56:38.220]  That's probably a little bit too smart, I shouldn't have put that in there, I was a little bit disappointed.
[01:56:38.220 --> 01:56:46.220]  Really expecting a higher level of decorum and professionalism in the several quarters.

[01:57:00.220 --> 01:57:22.220]  You know, he initially dismissed it, you know, he dismissed, you know, even though he came in with Mayor Toreas, even though he said, I want, he's ordering mediation between me and the side, and he initially dismissed it.
[01:57:22.220 --> 01:57:32.220]  In the same sentence, he says, and the handle, you know, can't write a legal document, and therefore, you know, all these things are dismissed for being frivolous.
[01:57:32.220 --> 01:57:39.220]  And then one of his, the documents I put in as assistance to legal counsel, and he denies that too.
[01:57:39.220 --> 01:57:46.220]  So I guess I'm, I'm not entitled to legal counsel, even though I can't write any good legal documents.
[01:57:46.220 --> 01:57:52.220]  But he can't, he hasn't responded to any of the citations in law that I put in.

[01:57:55.220 --> 01:57:59.220]  But he says I'm not entitled to it, even though he's dismissed everything.
