[10:11.520 --> 10:17.040] automation in various county offices and $2.50 to the records management and
[10:17.040 --> 10:19.920] preservation fund of the clerk of the court for records management and
[10:19.920 --> 10:25.840] preservation services performed by that clerk of the court. A fee deposited in
[10:25.840 --> 10:29.640] accordance with subsection F may be used only to provide funds for specific
[10:29.640 --> 10:33.000] records management and preservation including for automation purposes on
[10:33.000 --> 10:37.680] approval by the commissioner's court of a budget as provided by chapter 111
[10:37.680 --> 10:41.480] local government code. An expenditure from a records management and
[10:41.480 --> 10:45.840] preservation fund must comply with sub chapter C chapter 262 local government
[10:45.840 --> 10:49.560] code. So there are various codes that deal with how they're supposed to manage
[10:49.560 --> 10:55.920] these individual services. This is where they get the money for it. $102.006 fees
[10:55.920 --> 11:00.800] and expunction proceedings. Okay they can charge a fee if you have gone through
[11:00.800 --> 11:04.440] an expunction proceeding to have an arrest or something like that expunged
[11:04.440 --> 11:10.080] from your record. In this sections which is $006.006 they can charge you $1
[11:10.080 --> 11:15.240] plus postage for each certified mailing, $2 plus postage for each certified
[11:15.240 --> 11:21.880] mailing of certified copies and that's the only fees that are mentioned in that.
[11:21.880 --> 11:28.240] Then you get the $007.006 fees for collecting and processing site order.
[11:28.240 --> 11:32.760] County attorney, district attorney or criminal district attorney may collect a
[11:32.760 --> 11:36.760] fee if his office collects and processes a check or similar site order if the
[11:36.760 --> 11:40.720] check or similar site order has been issued or passed in a manner that makes
[11:40.720 --> 11:45.640] the issuance or passing an offense. Okay so basically this
[11:45.640 --> 11:52.600] deals with the assessment of fees for bad checks. That's all 007 deals with. Now
[11:52.600 --> 12:02.960] we get down to 008. Okay fees for services of prosecutors. Subsection A
[12:02.960 --> 12:09.560] accept as provided by subsection B a defendant convicted of a misdemeanor or
[12:09.560 --> 12:14.760] a gambling offense shall pay a fee of $25 for the trying of the case by the
[12:14.760 --> 12:19.120] district or county attorney. Well that wouldn't apply to a justice or municipal
[12:19.120 --> 12:25.600] court because the municipal attorney can't prosecute cases there and the
[12:25.600 --> 12:31.080] district attorney is forbidden by law from getting a fee when they prosecute
[12:31.080 --> 12:37.840] in a justice or municipal court. That's right out of chapter 45. So no fees
[12:37.840 --> 12:43.400] assessed under this okay in a JP court or a municipal court because the county
[12:43.400 --> 12:49.760] or district attorney is not allowed to draw fees in those sections. So no fee
[12:49.760 --> 12:54.080] for the trying of a case may be charged against a defendant prosecuted in a
[12:54.080 --> 12:58.640] justice court for violation of a penal statute or the Uniform Act regulating
[12:58.640 --> 13:04.840] traffic on highways. Right here you have an explicit mention that they cannot
[13:04.840 --> 13:11.120] assess a fee for the conviction. Okay which agrees with chapter 45 of the
[13:11.120 --> 13:16.280] Code of Criminal Procedure. C if two or more defendants are tried jointly only
[13:16.280 --> 13:21.640] one fee may be charged under this article. If the defendants sever and are
[13:21.640 --> 13:28.000] tried separately each defendant shall pay the fee. Well how does C not violate
[13:28.000 --> 13:33.280] B? No fee for the trying of a case may be charged against a defendant
[13:33.280 --> 13:38.320] prosecuted in a justice court for violation of a penal statute or the
[13:38.320 --> 13:41.680] Uniform Act regulating traffic on highways. What else is there in a
[13:41.680 --> 13:47.480] justice court? That would apply in the Code of Criminal Procedure. What else is
[13:47.480 --> 13:53.480] there? Okay the JP court can't try a conviction for an ordinance unless it's
[13:53.480 --> 13:57.200] a county ordinance but the county ordinance is to be tied to a state law.
[13:57.200 --> 14:03.520] The prosecution would still have to be carried on in the name of the state. So
[14:03.520 --> 14:09.320] we've got a problem here. C can't possibly happen as long as there's a B.
[14:09.640 --> 14:16.240] Subsection D, a defendant is liable for fees imposed by subsection A if the
[14:16.240 --> 14:20.360] defendant is convicted of an offense and one the defendant does not appeal the
[14:20.360 --> 14:27.520] conviction or two the conviction is affirmed on appeal. Again the only thing
[14:27.520 --> 14:32.880] they can be convicted of up there is a misdemeanor or a gambling offense. Pay a
[14:32.880 --> 14:41.920] fee of $25. All right how does A not violate B? No fee for the trying of a
[14:41.920 --> 14:48.880] case may be charged against a defendant prosecuted in a justice court for
[14:48.880 --> 14:55.440] violation of a penal statute. Well what the heck else is there in a gambling
[14:55.440 --> 15:02.040] offense or misdemeanor offense if it's not involving a penal statute? What else
[15:02.040 --> 15:07.840] is there? And then after the penal statute you've got or the Uniform Act
[15:07.840 --> 15:11.280] regulating traffic on highways so they can't charge you one for a traffic
[15:11.280 --> 15:19.040] citation case either. So obviously they can assess a fee under this section. Then
[15:19.040 --> 15:25.920] you've got 102.009 court costs in certain counties. In counties of
[15:25.920 --> 15:31.160] population of 3.3 million or more the commissioners court may set court costs
[15:31.160 --> 15:35.400] for persons convicted of a Class C misdemeanor in the justice courts. Court
[15:35.400 --> 15:40.000] costs set as provided by this article may not exceed $7.00 for each
[15:40.000 --> 15:47.960] conviction. So the maximum they could get under this section would be $7.00.
[15:47.960 --> 15:52.960] Hmm well again
[15:52.960 --> 16:00.760] problem. Remember now that up here 008 deals with the payment of fees to
[16:00.760 --> 16:04.400] prosecutors and we're talking about they can't charge a fee and any conviction
[16:04.400 --> 16:08.360] under those cases they can't pay a prosecutor's fee. Now down here they can
[16:08.360 --> 16:14.440] pay the court costs of $7.00 okay but the or up to $7.00 for each
[16:14.440 --> 16:20.480] conviction. So again you start taking and adding all these up and we have to
[16:20.480 --> 16:25.440] start wondering what fees are being assessed here because the total I came
[16:25.440 --> 16:32.920] up with was $19.10 total out of all the fees in this title. But I'll finish
[16:32.920 --> 16:36.200] up with that part of it on the other side when we get back. There's actually
[16:36.200 --> 16:40.760] several different fees but they are all miniscule. The total amount of them
[16:40.760 --> 16:47.920] totaling $19.10 possibly with the $7.26 but
[16:47.920 --> 16:51.760] definitely not a hundred and one like Austin is charging. All right folks this

[20:07.960 --> 20:13.080] going through this here for a minute. Now, fees for services of peace officers
[20:13.080 --> 20:19.880] which is 102.11. There are several fees they can do here but as we see in
[20:19.880 --> 20:24.680] subsection A, a defendant convicted of a felony or misdemeanor shall pay the
[20:24.680 --> 20:30.680] following fees for services performed in the case by a peace officer. $5 for
[20:30.680 --> 20:34.320] issuing a written notice to appear in the court following the defendants
[20:34.320 --> 20:38.640] violation of a traffic law, municipal ordinance or penal law of this state or
[20:38.640 --> 20:43.720] for making an arrest without warrant. So we're actually paying them for them
[20:43.720 --> 20:51.720] arresting us illegally. Get it? Let's see, what else? $50 for executing or
[20:51.720 --> 20:56.400] processing an issued arrest warrant, capious or capious profine with the fee
[20:56.400 --> 21:01.280] imposed for the services of A, the law enforcement agency that executed the
[21:01.280 --> 21:06.240] arrest warrant or capious, if the agency requests of the court, not later than the
[21:06.240 --> 21:10.200] 15th day after the date of the execution of the arrest warrant or capious, the
[21:10.200 --> 21:15.280] imposition of the fee on conviction, or B, the law enforcement agency that
[21:15.280 --> 21:19.400] processed the arrest warrant or capious, if one, the arrest warrant or capious was
[21:19.400 --> 21:24.640] not executed, or two, the executing law enforcement agency failed to request the
[21:24.640 --> 21:30.200] fee within the period required by paragraph A of this subdivision. $5
[21:30.200 --> 21:35.520] fee for summoning a witness, $35 for serving a writ not otherwise listed in
[21:35.520 --> 21:40.480] this article, $10 for taking and approving a bond and if necessary returning
[21:40.480 --> 21:47.520] the bond to the courthouse, $5 for commitment or release, again, $5 for
[21:47.520 --> 21:52.240] going in, $5 for coming out after they throw you in jail illegally because a
[21:52.240 --> 21:56.240] commitment order was never signed by a proper magistrate before they threw you
[21:56.240 --> 22:02.520] in jail in the first place, as the law requires, $5 for summoning a jury if a
[22:02.520 --> 22:06.800] jury is summoned and $8 for each day's attendance of a prisoner in a habeas
[22:06.800 --> 22:11.840] corpus case if the prisoner has been remanded to custody or held to bail. In
[22:11.840 --> 22:15.960] addition to fees provided by subsections A of this article, a defendant
[22:15.960 --> 22:21.640] required to pay fees under this article will also pay $0.29 per mile for
[22:21.640 --> 22:26.200] mileage required of an officer to perform a service listed in this subsection and
[22:26.200 --> 22:31.320] to return for performing that service. So now we've gone to $0.29 a mile in this
[22:31.320 --> 22:35.720] section. If the service provided is the execution of a writ and the writ is
[22:35.720 --> 22:39.360] directed to two or more persons or the officer executes more than one writ in a
[22:39.360 --> 22:43.800] case, the defendant is required to pay only mileage actually and necessarily
[22:43.800 --> 22:48.640] travel. In calculating mileage the officer must use the railroad or the most
[22:48.640 --> 22:53.640] practical route by private conveyance. Now why didn't it say route by motor
[22:53.640 --> 22:57.960] vehicle rather than private conveyance? That's a little oddity you need to take
[22:57.960 --> 23:02.680] note of for those of you that we know about the transportation argument. Why
[23:02.680 --> 23:10.640] would the statute right here specifically mention in subsection B of the code of
[23:10.640 --> 23:17.440] criminal procedure under 102.11 or.011 that they have to measure the
[23:17.440 --> 23:24.240] route according to railroad or private conveyance? Doesn't say by motor vehicle
[23:24.240 --> 23:30.920] which is what the officer would be in. It's by private conveyance. One of those
[23:30.920 --> 23:34.760] little transportation oddities that are in the statutes that I think we ought to
[23:34.760 --> 23:41.120] be aware of. Now the defendant shall also pay all necessary and reasonable
[23:41.120 --> 23:44.520] expenses for meals and lodging incurred by the officer in the performance of
[23:44.520 --> 23:47.720] services under this section to the extent such expenses meet the
[23:47.720 --> 23:54.360] requirements of section 611.001 government code. This subsection applies to one
[23:54.360 --> 23:58.960] conveying a prisoner after conviction to the county jail, two conveying a prisoner
[23:58.960 --> 24:03.040] arrested on a warrant or capious issued in another county to the court or jail of
[24:03.040 --> 24:07.640] the county, and three traveling to execute criminal process to summon or attach
[24:07.640 --> 24:12.280] a witness and to execute process not otherwise described by this article. See
[24:12.280 --> 24:17.600] if an officer attaches a witness or the order of a court outside the county the
[24:17.600 --> 24:23.160] defendant shall pay $10 per day or part of a day spent by the officer conveying
[24:23.160 --> 24:26.560] the witness and actual necessary expenses for travel by the most practical
[24:26.560 --> 24:30.760] public conveyance. In order to receive expenses under this subsection the
[24:30.760 --> 24:34.120] officer must make a sworn attempt statement of the expenses in the judge
[24:34.120 --> 24:38.720] issuing the attachment must approve the statement and we go on and we go on and
[24:38.720 --> 24:47.680] we go on. Now as we go down through 102 under title 2 we find all these little
[24:47.680 --> 24:54.880] individual fees that they can assess. Now let's understand what they can and cannot
[24:54.880 --> 25:02.120] do when it comes to these fees as far as collection. When you go to 103 of title
[25:02.120 --> 25:10.720] 2 chapter 103.001 section says the following. A cost is not payable by the
[25:10.720 --> 25:17.160] person charged with the cost until a written bill is produced or is ready to
[25:17.160 --> 25:23.960] be produced containing the items of cost signed by the officer who charged the
[25:23.960 --> 25:32.760] cost or the officer who is entitled to receive payment for the cost. 103.002
[25:32.760 --> 25:39.080] certain costs barred an officer may not impose a cost for a service not performed
[25:39.080 --> 25:48.800] or for a service for which a cost is not expressly provided by law. 103.003
[25:48.800 --> 25:56.160] collection. Subsection A a district and county attorneys, clerks of district and
[25:56.160 --> 26:00.440] county courts, sheriffs, constables and justices of the peace may collect money
[26:00.440 --> 26:05.240] payable under this title. A community supervision and correction department and
[26:05.240 --> 26:08.920] county treasurer may collect money payable under this title with the written
[26:08.920 --> 26:12.680] approval of the clerk of the court or fee officer and may collect money payable
[26:12.680 --> 26:17.520] as otherwise provided by law. The commissioners court of a county that has
[26:17.520 --> 26:22.040] implemented a collection improvement program under article 103.0033 may
[26:22.040 --> 26:27.360] collect money payable under this title or under other law. This article does not
[26:27.360 --> 26:31.040] limit the authority of a commissioner's court to contract with a private vendor
[26:31.040 --> 26:37.320] or private attorney for the provisions of collection services under article 103.0031.
[26:37.320 --> 26:46.040] Now 0031 deals with collection contracts. Okay then you have 0032 collection
[26:46.040 --> 26:50.240] improvement plans which is the other thing that spoke about up there as well.
[26:50.240 --> 27:02.120] Collection improvement program is also covered under 103.0033. Now let me show
[27:02.120 --> 27:09.240] you something else when you gets to 103.009 fee records. Each clerk of a court
[27:09.240 --> 27:13.800] or county judge justice of the peace sheriff constable and marshal shall keep
[27:13.800 --> 27:22.200] a fee record. The record must contain a statement of each fee or item of cost
[27:22.200 --> 27:28.120] charged for a service rendered in a criminal action or proceeding. The
[27:28.120 --> 27:33.000] number and style of the action or proceeding and the name of the officer

[28:47.120 --> 28:52.560] document belongs to swears up and down the jury only assessed a fine of a
[28:52.560 --> 29:00.880] hundred dollars. That was their verdict. Guilty fine $100. Yet the bill signed by
[29:00.880 --> 29:08.080] the judge and sent to him contains only one line item and that is the
[29:08.080 --> 29:13.000] assessed fine by the jury and it says the fine is a hundred and ninety
[29:13.000 --> 29:21.200] something dollars. So if the jury record when they go through and they make
[29:21.200 --> 29:26.560] their verdict they're required to write down the verdict and the amount the jury
[29:26.560 --> 29:32.320] agrees should be assessed as a fine. That has to be on the written order from the

[34:25.640 --> 34:32.360] or anything as these statutes right here require and make mandatory. If the jury
[34:32.360 --> 34:37.560] only assessed a hundred dollar fine where did the other 90-some odd dollars and
[34:37.560 --> 34:43.600] change come from? Obviously it would have had to have been from these fees but
[34:43.600 --> 34:48.400] these fees can't be charged and collected unless they're itemized on a signed
[34:48.400 --> 34:58.640] bill by the officer that is both charging and collecting those fees. Now the
[34:58.640 --> 35:06.160] problem is is this bill becomes a an official government record and if the
[35:06.160 --> 35:10.720] Municipal Court judge is signing that official government record when they
[35:10.720 --> 35:17.040] know it contains falsified information it's a fraudulent document and the act
[35:17.040 --> 35:25.120] is a felony. But this municipal judge on this order signed off that the entire
[35:25.120 --> 35:29.460] money amount lumped together in one number was the fine assessed by the
[35:29.460 --> 35:35.000] jury and that's not true because the jury only assessed a hundred dollar fine. So by
[35:35.000 --> 35:40.320] definition the record fraudulent therefore by definition it is tampered
[35:40.320 --> 35:46.480] with and since the judge is the one that attested to its authenticity under
[35:46.480 --> 35:54.680] oath by their signature with an official court seal then that judge just
[35:54.680 --> 36:01.920] committed a state jail felony in Texas. See the problem they're too stupid to

[01:38:40.720 --> 01:38:54.720] And secondly, he makes a statement in his complaint that the defendant was operating a motor vehicle, and he knows that there's no evidence that the defendant was engaged in the act of transportation.

Then the prosecutor files an information based on the police sergeant's criminal complaint, and the prosecutor declares that the defendant violated the law based on a blood specimen that she knows was taken unlawfully without a warrant.

[01:42:23.720 --> 01:42:30.720] They have to conduct an examining trial to do the suppression of evidence motion because that's where it occurs.
[01:42:30.720 --> 01:42:41.720] Read the chapter 16 of the Code of Criminal Procedure regarding an examining trial that is specifically where the magistrate is authorized to exclude evidence.
[01:42:41.720 --> 01:42:42.720] Okay.
[01:42:42.720 --> 01:42:44.720] Well, help me understand this.
[01:42:44.720 --> 01:42:52.720] The defendant has already been jailed and put on bond and never had an examining trial.

[01:42:53.720 --> 01:42:58.720] Well, the jail part doesn't have anything to do specifically with the examining trial.
[01:42:58.720 --> 01:43:08.720] The examining trial may or may not come immediately with or after the 15.17 hearing.

[01:43:09.720 --> 01:43:18.720] They are not necessarily the same proceeding.
[01:43:18.720 --> 01:43:28.720] They can be if everybody's got all their ducks in a row, all their witnesses and all their evidence are right there right then, a magistrate could conduct an examining trial.
[01:43:28.720 --> 01:43:32.720] But the odds of that being the case are slim to none.
[01:43:32.720 --> 01:43:37.720] So generally the examining trial will come at a later time or a later date.

[01:46:30.720 --> 01:46:45.720] Regarding this examining trial that we're talking about, the defendant has received a summons ordering him to attend an arraignment this week and there's been no opportunity for examining trial.
[01:46:45.720 --> 01:46:48.720] They're moving to arraignment.
[01:46:48.720 --> 01:46:57.720] Well, arraignment also would come after examining trial because they can't conduct an arraignment without an establishment of probable cause.
[01:46:57.720 --> 01:47:05.720] If you get rid of the blood, then they have no tangible evidence to back up their asserted probable cause.
[01:47:05.720 --> 01:47:15.720] You also have the issue of the doctor's letter stating that the reason for the condition of the eyes on the individual in question had nothing to do with alcohol.
[01:47:15.720 --> 01:47:17.720] They had to do with an eye infection.
[01:47:17.720 --> 01:47:20.720] Correct.
[01:47:20.720 --> 01:47:36.720] I'm a little confused about one thing and that is that since the court has ordered him for an arraignment hearing, have they said we don't get an examining trial?
[01:47:36.720 --> 01:47:44.720] Well, that's what they're trying to say, but they can't go to an arraignment hearing if there's a motion to suppress evidence that they have to review.
[01:47:44.720 --> 01:47:53.720] That's the only way they can do a motion to suppress regarding any evidence is through the proceedings of an examining trial.
[01:47:53.720 --> 01:47:57.720] That's the only place the statute allows them to do it.
[01:47:57.720 --> 01:48:10.720] The only time the judge could do it after that is if it's discovered at trial or some other point that the evidence is fabricated or tainted and therefore inadmissible.
[01:48:10.720 --> 01:48:20.720] Okay, now regarding the motions for suppression of evidence and the motions for discovery that had been filed into the court record,
[01:48:20.720 --> 01:48:36.720] we were prevented by the court for to set those motions for hearing because of the ending appointment of assistance, court-appointed assistance of counsel.
[01:48:36.720 --> 01:48:45.720] And they said that the court-appointed assistance of counsel would be required to set those for hearing.
[01:48:45.720 --> 01:48:59.720] And what I'm hearing you say is that they have to be set for hearing prior to this so-called arraignment so that we can demand an examination trial instead of the arraignment hearing.
[01:48:59.720 --> 01:49:13.720] Well, you could demand the examining trial regardless. You have the right to the examining trial when the arrest was made without a warrant and there's issues that the examining trial was meant to cover still to be covered.
[01:49:13.720 --> 01:49:15.720] Okay.
[01:49:15.720 --> 01:49:21.720] Now they want to tell you that you only have a right to that in a felony case, but that's simply not true.
[01:49:21.720 --> 01:49:22.720] Right.
[01:49:22.720 --> 01:49:34.720] The rule of thumb is any arrest without warrant is automatically considered to be an unlawful arrest and therefore they must make two probable cause determinations.
[01:49:34.720 --> 01:49:40.720] One, was the arrest itself lawful and based on probable cause?
[01:49:40.720 --> 01:49:53.720] Two, does the evidence that resulted from that arrest and search and seizure or whatever constitute probable cause to proceed to an actual trial?
[01:49:53.720 --> 01:50:01.720] They have to get two types of probable cause established in the record if they make an arrest without warrant.
[01:50:01.720 --> 01:50:06.720] They absolutely skip over the arrest part every single time.
[01:50:06.720 --> 01:50:09.720] Right.
[01:50:09.720 --> 01:50:10.720] Okay.
[01:50:10.720 --> 01:50:25.720] So you need the case law and the argument that an arrest without warrant is automatically considered unlawful and probable cause for the arrest must be established.
[01:50:25.720 --> 01:50:31.720] The procedure for doing that is the Chapter 16 examining trial.
[01:50:31.720 --> 01:50:36.720] Okay.
