[00:49.880 --> 00:54.320]  leaving one officer dead days after he allegedly killed two other people to begin a wave of
[00:54.320 --> 00:59.000]  retribution for being fired, police said. The focus of the intensive expansive manhunt
[00:59.000 --> 01:03.520]  is Christopher Jordan Doerner, a 270-pound former Navy lieutenant who has professed his
[01:03.520 --> 01:09.080]  venom against LAPD officers he claimed ruined his life by forcing him out of his dream job.
[01:09.080 --> 01:13.960]  Doerner blames one retired officer for bungling his appeal to get his job back in an 11-page
[01:13.960 --> 01:18.760]  manifesto in which he is also complained of mistreatment by the LAPD. In that letter
[01:18.760 --> 01:24.040]  he vowed to violently target police officers and their families, whoever and wherever they
[01:24.040 --> 01:29.120]  are. The chairman of a Senate committee recessed John Brennan's CIA confirmation hearings
[01:29.120 --> 01:34.040]  and cleared the room after protesters persistently interrupted the proceedings.

[01:58.560 --> 02:03.200]  ordered the hearing recessed while the room was cleared. The protesters were shouting
[02:03.200 --> 02:10.280]  objections to legal US drone strikes and harsh interrogation methods. A severe winter storm
[02:10.280 --> 02:14.200]  is barreling towards some of the most heavily populated parts of the country today, closing
[02:14.200 --> 02:18.200]  thousands of schools, causing massive travel disruption and threatening to bring more than
[02:18.200 --> 02:23.280]  two feet of snow and gale force winds to much of the northeast. National Weather Service
[02:23.280 --> 02:28.200]  issued blizzard warnings from North New Jersey, northeast to Maine, and with New York and
[02:28.200 --> 02:33.240]  Boston expecting to be among the hardest hit, airlines canceled more than 2,400 flights across
[02:33.240 --> 02:37.320]  the region as the storm barreled eastward from the Midwest and Great Lakes according
[02:37.320 --> 02:58.320]  to FlightAware.com.
[03:07.320 --> 03:27.320]  I received my remedy today, came in the box just like the sick, I accepted for value right

[03:38.320 --> 04:05.320]  And I can take anything that belongs to me and put it to good use. What I was good for
[04:05.320 --> 04:22.320]  was the nature of what you might gain. I see something headed straight for you. I think
[04:22.320 --> 04:28.320]  it looks just like a train. It smells like a sham of thunder. I can see I'm playing fast

[04:45.380 --> 04:54.320]  about the JP Court? Yeah, I just, I mean, we were discussing the fact that, you know,
[04:54.320 --> 04:59.320]  most of the motions that you would file have to be filed 10 days prior to the hearing and
[04:59.320 --> 05:08.320]  I only had nine days notice. So I guess I could object to the inadequate notice. One other
[05:08.320 --> 05:16.320]  thing that I wanted to ask you about, the attorney firm that served the notice is out
[05:16.320 --> 05:21.320]  of Houston and they don't have any other offices and there are only two attorneys in the entire
[05:21.320 --> 05:31.320]  firm. It's a relatively small firm. If another attorney comes and stands in in this eviction
[05:31.320 --> 05:39.320]  hearing, I had contemplated doing a Rule 10 challenge, which basically says I don't think
[05:39.320 --> 05:46.320]  this attorney has any authority to, you know, to be standing in here. And once that assertion
[05:46.320 --> 05:51.320]  is made, the burden falls on the attorney to prove that he does have the authority to
[05:51.320 --> 05:58.320]  be standing in and representing the, you know, whoever he's representing. But that is
[05:58.320 --> 06:03.320]  another motion that has to be served on the attorney at least 10 days before the hearing
[06:03.320 --> 06:08.320]  but I don't have that opportunity. So if I were going to make a Rule 10 challenge, should
[06:08.320 --> 06:13.320]  I just file it, you know, a day or so before the hearing and just when they complain about
[06:13.320 --> 06:18.320]  it, you know, I didn't have 10 days notice. Well, you know, neither did I.
[06:18.320 --> 06:25.320]  Well, you know, we can, you know, we need to get a motion for continuance in Monday.
[06:25.320 --> 06:34.320]  Okay. Well, I can do that. And I actually, this judge that I'm going to see is a judge,
[06:34.320 --> 06:38.320]  all of this stuff or this eviction and everything is a continuation of things that have been
[06:38.320 --> 06:44.320]  going on since 2009. They actually, there was an eviction attempt in 2009 as well before
[06:44.320 --> 06:50.320]  the same judge. And I did manage to get a continuance in that hearing as well, which
[06:50.320 --> 06:55.320]  he told me was pretty rare. They almost never give continuances. But it was on the same
[06:55.320 --> 07:00.320]  ground that, you know, at that time I only had four days notice. And, you know, when
[07:00.320 --> 07:04.320]  I complained to the judge about it, that time was, look, I only had four days to try to
[07:04.320 --> 07:08.320]  find out what's going on here and to prepare. And there are all these things under the rules
[07:08.320 --> 07:12.320]  of procedure which say I have to, you know, do what I'm going to do 10 days before this
[07:12.320 --> 07:17.320]  hearing. I didn't even know about it until four days ago. So I'm denied my rights under
[07:17.320 --> 07:23.320]  the, you know, the rules of procedure and denied, you know, options. And he did grant a
[07:23.320 --> 07:27.320]  continuance. So I'll probably do the same thing again.
[07:27.320 --> 07:38.320]  Good, good. And then we don't want to challenge the lawyer and give him fair warning.
[07:38.320 --> 07:45.320]  Well, that's what I was going to, since I only got nine days notice, which precludes all
[07:45.320 --> 07:50.320]  of the rules throughout the rules of civil procedure, which say, you know, if you're
[07:50.320 --> 07:55.320]  going to serve this motion or that motion, it has to be done 10 days before the hearing.
[07:55.320 --> 07:59.320]  I was thinking about just filing it like a day before the hearing and when they complain
[07:59.320 --> 08:03.320]  and say, well, your honor, I didn't get 10 days notice. Well, you know what, your honor,
[08:03.320 --> 08:08.320]  neither did I. That's a good idea. That's a good strategy.
[08:08.320 --> 08:15.320]  Okay. And it raises a good issue. You need the continuance in so that your objection to
[08:15.320 --> 08:20.320]  the sufficient notices is on the record. Okay.
[08:20.320 --> 08:26.320]  And we have that in Monday. I like the rule 10 challenge.
[08:26.320 --> 08:28.320]  Yeah, I do. I would place the burden on them.
[08:28.320 --> 08:34.320]  These are great fun. And make sure you're bar-grieving for not giving you enough notice.
[08:34.320 --> 08:41.320]  Oh, yeah. Yeah, I didn't know about all this bar-grieving stuff and the judicial misconduct
[08:41.320 --> 08:46.320]  complaint stuff in the last depiction hearing a few years ago, but in this next hearing,
[08:46.320 --> 08:50.320]  it's going to be judicial misconduct complaints and bar grievances all around.
[08:50.320 --> 08:53.320]  Every time somebody opens their mouth.

[09:25.320 --> 09:35.320]  What form should a judicial notice go in that I'm in or request or just judicial notice?
[09:35.320 --> 09:41.320]  Sure. The mind generally says you are hereby directed to take judicial notice of whatever,
[09:41.320 --> 09:48.320]  but be careful what you direct to judicial notice of.
[09:48.320 --> 09:55.320]  A judicial notice of law and judicial notice of uncontestable facts.
[09:55.320 --> 09:59.320]  Right. That's all I want.
[09:59.320 --> 10:07.320]  What's in the court record? What's in the county registrar's office? That you can take judicial notice of.
[10:07.320 --> 10:11.320]  That's the only thing I do judicial notice of.
[10:11.320 --> 10:17.320]  If I state a fact, never state a fact unless you have evidence to support it.
[10:17.320 --> 10:28.320]  But you can't ask the court to take judicial notice of that because someone else may bring rebuttal evidence to your evidence in support of the facts.
[10:28.320 --> 10:38.320]  Right. Now what I want judicial notice of is certain state statutes and what's in the secretary's state record and the county record.
[10:38.320 --> 10:41.320]  Perfect. Perfect. That's what you absolutely can do.
[10:41.320 --> 10:49.320]  And the judge has a duty to determine the facts in accordance with the rules of evidence.
[10:49.320 --> 10:56.320]  Then apply the laws that comes to him, but the facts in the case, and this is a way to make sure the laws are for him.
[10:56.320 --> 11:03.320]  Well, I found out something fun about a week and a half ago before I get any of my fun stuff.
[11:03.320 --> 11:16.320]  I found a law that says that a limited partnership must be registered with secretary of state or it can't operate in the state, can't sue in the state, so on and so forth.
[11:16.320 --> 11:34.320]  And according to secretary of state's website, now I'm going to have to write a letter to secretary of state to get confirmation of this, but according to the website, there is no record of back home loan servicing LP having ever been registered with the state of New Mexico.
[11:34.320 --> 11:37.320]  Okay, you're not going to win that one.
[11:37.320 --> 11:47.320]  BAC home loans registered with the federal government, what the federal government called the judge in Utah, I don't care if they're registered in your state or not.
[11:47.320 --> 11:53.320]  So long as they registered with us, they can practice it where they want to. That's what will settle.
[11:53.320 --> 11:59.320]  My understanding was that was only with the national associations, not with the LPs.
[11:59.320 --> 12:02.320]  You could be right about that.
[12:02.320 --> 12:07.320]  But yeah, I just thought that would be interesting.
[12:07.320 --> 12:20.320]  If it's not with the LPs, if the LP is registered with the federal government and licensed to be a lender, that's what it went to.
[12:20.320 --> 12:25.320]  It didn't go to the type of company it was, it went to the type of business that we have.
[12:25.320 --> 12:29.320]  So I don't think you win it, but it'd be great fun to go after.
[12:29.320 --> 12:32.320]  Cost them more money anyway.

[12:35.320 --> 12:45.320]  I had my pretrial settlement conference yesterday in the federal court here with the bank and the foreclosure mill.
[12:45.320 --> 12:55.320]  And they came in with the bank offering nothing and the foreclosure mill offering $1,000.
[12:55.320 --> 13:00.320]  And the magistrate asked me what I wanted.
[13:00.320 --> 13:05.320]  I told him I wanted $115,000 from each of them, two defendants.
[13:05.320 --> 13:07.320]  And so he talked to us for a little while.
[13:07.320 --> 13:12.320]  I asked how the case got here if it was originally filed in Mississippi.
[13:12.320 --> 13:22.320]  And I explained to him that I was living in Mississippi when I found these two individual company people in my credit report.
[13:22.320 --> 13:32.320]  And that during my credit report disputes with them, I learned that they had stolen a piece of property that I owned here in New Mexico.
[13:32.320 --> 13:34.320]  And so he was interested in that.
[13:34.320 --> 13:40.320]  And he explained the rules to us and that this was all confidential and off the record.
[13:40.320 --> 13:48.320]  And he wouldn't report any of it to the presiding judge and he wouldn't tell the other side anything that I didn't want them to know.
[13:48.320 --> 13:51.320]  And he wouldn't tell me anything they didn't want me to know.
[13:51.320 --> 13:55.320]  And he took me into his office and left them in the conference room.
[13:55.320 --> 14:12.320]  And he talked to me for a little while about my case and went back and talked to them for a little while and came back with the bank offering, I think, $3,000 and the foreclosure mill offering $1,500.
[14:12.320 --> 14:30.320]  And I said, you know, I appreciate that, but that's, you know, not nearly close enough. And we talked a little bit more about my case and he went back and talked to them for a while and came back and talked to me again and said that they had raised their offer to, you know, like five and two or something like that.
[14:30.320 --> 14:34.320]  I don't remember the exact numbers, but this went back and forth a couple of times.
[14:34.320 --> 14:44.320]  I lowered my settlement offer down to $90,000 each and they raised theirs to a combined total of $20,000.
[14:44.320 --> 14:53.320]  And, you know, I thanked Matt straight for his time, but I told him that, you know, just wasn't good enough and I couldn't agree to that. That was their final offer.
[14:53.320 --> 15:09.320]  And so as we were leaving, a tree came up to me and said that the attorney for the bank wanted to talk to me. I said, okay, no problem. And the attorney and I went back into the judge's chamber in his office.
[15:09.320 --> 15:23.320]  And the attorney told me that he really thought that I should take the settlement, that I didn't have a chance of winning the case and I could have $20,000 in my pocket tomorrow or I could drag this out another six months and get nothing.
[15:23.320 --> 15:30.320]  And he really felt for me and he knew I'd been screwed over, but I just didn't have a case.
[15:30.320 --> 15:43.320]  And I just smiled and told him, well, yeah, I think I do and the attorney is going to rule in my favor and if I lose, I'll appeal it. You know, we'll just see how it plays out.
[15:43.320 --> 15:59.320]  And I was just wondering if I don't have a case and I'm going to get hosed on this whole thing, oh, why did they offer to give me $20,000?
[15:59.320 --> 16:04.320]  Randy?

[16:32.320 --> 16:39.320]  So the fact that they would offer a deal to a pro say is pretty surprising.
[16:39.320 --> 16:57.320]  So you might look at bringing in a lawyer at this point. They will give him a whole lot more to a lawyer than they will to a pro say just because there's a lawyer.

[20:29.320 --> 20:50.320]  that some lawyer got raked over the coals by some beach bomb. It was a matter of faith and the banks have said for the most part they are just not going to give in to proceeds.
[20:50.320 --> 21:00.320]  But I think they are getting so many proceeds that the proceeds are costing them so much that maybe they are going to have to.
[21:00.320 --> 21:10.320]  But if, and this has been our strategy all along, is we go in and beat them up. We go in and become the proceeds from hell.
[21:10.320 --> 21:25.320]  And then once we got them beat up good, we bring in the lawyer and let the lawyer ride in on his white horse and pull these dirty rotten scumbag proceeds off those four mistreated banks and lawyers
[21:25.320 --> 21:32.320]  and get them in a position to where they can offer a reasonable deal.
[21:32.320 --> 21:39.320]  I would be willing to do that if I could find a lawyer that had the guts to take it.
[21:39.320 --> 21:44.320]  They've already made you an offer and that's going to make it a lot easier for the lawyer.
[21:44.320 --> 21:53.320]  Yeah, I've got one, I won't mention any names, but I've got one that is in the 10th Circuit that's willing to take it if it goes on appeal.
[21:53.320 --> 22:08.320]  He's a friend of mine. But as far as any local lawyers, as I mentioned before, I couldn't even find a lawyer that was willing to handle the petition for declaratory judgment on the matter of the assignment.

[22:13.320 --> 22:15.320]  They're probably afraid of the judges.

[23:35.320 --> 23:51.320]  Anyway, you told me to file the motions for dismissal to certified mail and of course we ran out of time so we went ahead down to the municipal court and I told my son, I said, I think I know what's going to happen if we do this.
[23:51.320 --> 24:06.320]  So we get there and she ends up telling us that, we told her, well, we're here on this citation, it says to be here from 8 to 5 and we're here to see Judge so-and-so.
[24:06.320 --> 24:10.320]  And she goes, Judge so-and-so, there's no Judge so-and-so here.
[24:10.320 --> 24:15.320]  And I'm like, well, it says so on that citation right here, Judge so-and-so.
[24:15.320 --> 24:20.320]  She goes, oh no, he hasn't been here for two years.
[24:20.320 --> 24:23.320]  And I said, really?
[24:23.320 --> 24:26.320]  I said, well, okay, well, who's the Judge then?
[24:26.320 --> 24:29.320]  And she said, oh, Judge, this other Judge.
[24:29.320 --> 24:31.320]  And I said, well, we're here on that then.
[24:31.320 --> 24:34.320]  And she goes, well, you're too late, we only do that from 8 to 1130.
[24:34.320 --> 24:39.320]  And I said, well, it says here on the ticket on the citation from 8 to 5.
[24:39.320 --> 24:44.320]  And she goes, oh no, no, no, we only do that stuff from 8 to 1130.
[24:44.320 --> 24:52.320]  And I said, well, you got two things on that ticket there and invalid and I said, that ticket's invalid on its face.
[24:52.320 --> 24:56.320]  And she goes, oh no, no, no, that ticket's still good.
[24:56.320 --> 25:00.320]  And I said, well, I said, okay then, I guess we'll come back on another day.
[25:00.320 --> 25:05.320]  But can you give us the paper saying that there's something that, you know, we had been here already?
[25:05.320 --> 25:09.320]  And she said, no, I can't give you nothing.
[25:09.320 --> 25:11.320]  I'll just set it up for another day.
[25:11.320 --> 25:17.320]  I said, well, okay, you know, and I was trying to explain to her, you know, that we wanted any information,

[25:20.320 --> 25:26.320]  She goes, oh no, you can only have that a day before the, you know, your court date.
[25:26.320 --> 25:30.320]  And I said, no ma'am, I said, you know, we can get it up to one day.
[25:30.320 --> 25:36.320]  And she didn't know, you know, I was trying to explain her what the statute said or what the law had said.
[25:36.320 --> 25:41.320]  And by that time, the chief of police was standing behind the desk.
[25:41.320 --> 25:42.320]  He goes, what do you want?

[35:29.320 --> 35:31.320]  I don't know what you're trying to give us here.
[35:31.320 --> 35:36.320]  I said, but we're not asking for any other kind of paper trial

[35:37.320 --> 35:39.320]  We just came here to see about the citation
[35:39.320 --> 35:43.320]  and we'll come in Tuesday and we'll see the judge.
[35:43.320 --> 35:48.320]  And he goes, oh yeah, well, you came in here
[35:48.320 --> 35:51.320]  and you said you didn't want to enter a pleading
[35:51.320 --> 35:53.320]  and automatically that makes it not guilty.
[35:53.320 --> 35:56.320]  And I was thinking at this time when he's saying all this,
[35:56.320 --> 36:02.320]  man, this guy reminds me of impersonating a judge.
[36:02.320 --> 36:07.320]  So he's telling me that I wouldn't enter a plead
[36:07.320 --> 36:13.320]  and that I had automatically be a not guilty plead
[36:13.320 --> 36:16.320]  and that I would come in for this pretrial date
[36:16.320 --> 36:17.320]  and all this stuff.
[36:17.320 --> 36:18.320]  And I said, no, no, no, no.
[36:18.320 --> 36:20.320]  I said, look, we're not agreeing to anything.
[36:20.320 --> 36:21.320]  I said, we're not signing anything.
[36:21.320 --> 36:23.320]  We're not agreeing to anything.
[36:23.320 --> 36:26.320]  And he says, well, that way you guys can get on your way
[36:26.320 --> 36:30.320]  and everything and let's just go here and talk to the clerk
[36:30.320 --> 36:32.320]  and we'll get you on your way.
[36:32.320 --> 36:34.320]  And he said, he told my son, he says,
[36:34.320 --> 36:36.320]  I need you to just come over here.
[36:36.320 --> 36:38.320]  Have this paper and have you sign this paper
[36:38.320 --> 36:39.320]  and you'll be on your way.
[36:39.320 --> 36:41.320]  And I looked at my son and I made the notion,
[36:41.320 --> 36:43.320]  I said, don't you, I told him, you know,
[36:43.320 --> 36:46.320]  not talking to him, but just like him reading my lips,
[36:46.320 --> 36:49.320]  don't you sign anything.
[36:49.320 --> 36:51.320]  And then I said, I told that city attorney,
[36:51.320 --> 36:53.320]  I said, look, we're not signing.
[36:53.320 --> 36:54.320]  He's not signing.
[36:54.320 --> 36:55.320]  We're not signing anything.
[36:55.320 --> 36:56.320]  And so he said, that's okay.

[37:13.320 --> 37:15.320]  in the state of Texas or anything.
[37:15.320 --> 37:20.320]  It just has the city logo on it, docket notice.

[37:21.320 --> 37:23.320]  It doesn't say anything else on it.
[37:23.320 --> 37:25.320]  And so we're walking out the door
[37:25.320 --> 37:27.320]  and he's like following us.
[37:27.320 --> 37:28.320]  And I said, well, that's okay.
[37:28.320 --> 37:30.320]  I said, I got other stuff to do.
[37:30.320 --> 37:34.320]  I got to go file some criminal complaints on them.

[37:37.320 --> 37:40.320]  criminally trespassed in my son's house anyway.

[37:42.320 --> 37:44.320]  He goes, oh, no, that's just trespassing.
[37:44.320 --> 37:47.320]  Oh, that's just a class B misdemeanor is what he said.

[37:48.320 --> 37:50.320]  I said, I think more like a felony.
[37:50.320 --> 37:55.320]  He goes, he goes, well, no, no, it's just a, you know,
[37:55.320 --> 37:57.320]  trespass and, you know, that's a different matter.

[37:59.320 --> 38:01.320]  I said, but, you know, I know better.
[38:01.320 --> 38:03.320]  I said, you know, we're walking out towards the door.
[38:03.320 --> 38:06.320]  The cops are backing behind their glass wall and all that.
[38:06.320 --> 38:09.320]  And I said, but, you know, they did have deadly weapons
[38:09.320 --> 38:11.320]  and they did criminally trespass.
[38:11.320 --> 38:16.320]  So, you know, if they criminally trespassed while displaying
[38:16.320 --> 38:22.320]  a deadly weapon, acting under the color of official authority,
[38:22.320 --> 38:31.320]  2204 B2A, first degree felony, 22 lots.
[38:31.320 --> 38:35.320]  And I told them, I said, you know, as we're walking outside
[38:35.320 --> 38:37.320]  toward the outside, I'm telling them, you know,
[38:37.320 --> 38:39.320]  you guys are really something else.
[38:39.320 --> 38:41.320]  I said, you know, you're supposed to know the law
[38:41.320 --> 38:45.320]  and you guys just come up here and give us this paper.
[38:45.320 --> 38:48.320]  And, you know, all we wanted was information
[38:48.320 --> 38:49.320]  which we were entitled to.
[38:49.320 --> 38:52.320]  And you said we didn't need nothing but a citation.
[38:52.320 --> 38:54.320]  I said, well, I said, you know, it makes,
[38:54.320 --> 38:57.320]  what makes it really disgusting is that you're supposed
[38:57.320 --> 39:00.320]  to know the law and you're over here telling me all these
[39:00.320 --> 39:02.320]  lies and threatening me and stuff.
[39:02.320 --> 39:06.320]  And he's like, well, I've been practicing law for 13 years.
[39:06.320 --> 39:07.320]  I know what I'm talking about.
[39:07.320 --> 39:08.320]  I said, really?
[39:08.320 --> 39:11.320]  I said, well, then why did you agree with the clerk
[39:11.320 --> 39:15.320]  when I told him, you know, we wanted to see any records
[39:15.320 --> 39:17.320]  or any kind of, anything she had on file.
[39:17.320 --> 39:20.320]  And he said that we could only get it on the day before,
[39:20.320 --> 39:23.320]  when it says up to the day before.
[39:23.320 --> 39:25.320]  He goes, oh, what law is that?
[39:25.320 --> 39:27.320]  And I said, do you want to see that law?
[39:27.320 --> 39:28.320]  And I had a copy of it.
[39:28.320 --> 39:31.320]  And I pulled it out and I said, there's that law right there.

[39:35.320 --> 39:38.320]  what really is disgusting is how you people are entrusted

[40:20.320 --> 40:23.320]  And he started spouting on the Supreme Court and blah, blah, blah.
[40:23.320 --> 40:26.320]  And I said, oh, and the Supreme Court signed that little paper
[40:26.320 --> 40:27.320]  right in front of you.

[40:28.320 --> 40:31.320]  He goes, well, well, I went to Austin.
[40:31.320 --> 40:34.320]  And he didn't know what to say after that.

[40:36.320 --> 40:43.320]  All this little talk, you know, we had two recorders going.

[40:48.320 --> 40:57.320]  And I said, right down, I think it's 2206, if you threaten someone

[52:53.320 --> 52:56.320]  Okay, and let me read this little part, too.
[52:56.320 --> 53:05.320]  If the district attorney receives a referral under paragraph AM, the district attorney shall, within 90 days of receiving the referral, issue charges or refuse to issue charges.
[53:05.320 --> 53:13.320]  If the district attorney refuses to issue charges, the district attorney shall forward to the judge in whose jurisdiction the crime was allegedly been committed.
[53:13.320 --> 53:18.320]  All law enforcement investigative reports on the matter that are in the custody of the district attorney.
[53:18.320 --> 53:24.320]  Is there her records and case files on the matter and a written explanation why he or she refused to issue charges?
[53:24.320 --> 53:34.320]  So if you bring this John Doe proceeding, Randy, the district attorney has to explain to a judge why he's not going to file the charges.
[53:34.320 --> 53:41.320]  Well, the good part is you get to get a copy of that.
[53:41.320 --> 53:47.320]  Well, in some cases they can hold this proceeding in secret, so it's up to the judge.
[53:47.320 --> 53:54.320]  So I know they've taken on politicians with this proceeding before though, Randy, so it can be a powerful tool.
[53:54.320 --> 54:03.320]  Oh, that could be it. You don't care if they hold it in secret, then you get to do more perception as everything.

[01:10:40.320 --> 01:10:43.320]  And what effect does that have on my mortgage and my property?
[01:10:43.320 --> 01:10:50.320]  Because her name is not on the deed, her name is not on the mortgage, and what is that to her?
[01:10:50.320 --> 01:10:55.320]  Wait, wait, okay, it's not on the mortgage and not on the warranty deed.
[01:10:55.320 --> 01:10:58.320]  That leaves her with no claim.

[01:22:45.320 --> 01:22:50.320]  So when you do get to court, it doesn't fade away.

[01:22:53.320 --> 01:22:55.320]  You have this bomb you could drop on them.
[01:22:55.320 --> 01:23:04.320]  And I really like the Bushwack method where you get them into court and Bushwack them with rescission.

[01:23:46.320 --> 01:23:58.320]  But they didn't go into it deep enough to say that when that 20 days passes, they are barred from doing anything about it.
[01:23:58.320 --> 01:24:04.320]  Okay. Well, as I understand in rescission, there still must be tender.
[01:24:04.320 --> 01:24:15.320]  That's what I'm saying. But if they don't challenge it in 20 days, that means they accepted it.
[01:24:15.320 --> 01:24:19.320]  They have 20 days to get their act together.
[01:24:19.320 --> 01:24:32.320]  And then 20 days after that, then the people, once the bank has done their part in returning the security interests and doing that,

[01:24:37.320 --> 01:24:48.320]  To tender. Okay. And this is, we put together a lawsuit based on the false fees charged at closing and the variation between the note

[01:24:57.320 --> 01:25:04.320]  So that we move for rescission and then tender by set off against the claim that we had against them.

[01:27:40.320 --> 01:27:49.320]  Yeah. The serious thing that I think it goes into is where the money comes from from the beginning, but that's reading something into it.
[01:27:49.320 --> 01:27:58.320]  But like I said, the lawyers that I have talked to, I said, no, what you pay is what you walked away from the table with.
[01:27:58.320 --> 01:28:06.320]  Yeah, but what do they mean by what you walked away from the table with? Do they mean cash in hand or value?

[01:34:13.320 --> 01:34:22.320]  One is the FTC debt buying report that was published, actually released on January 30th this year.
[01:34:22.320 --> 01:34:26.320]  So it is fresh and hot from the presses.
[01:34:26.320 --> 01:34:40.320]  And in that testimony to Congress, they reported that less than 2% of the debtors ever dispute the debt
[01:34:40.320 --> 01:34:54.320]  that less than 16% of the electronic data files that they buy from the creditors contained any documentation at all.
[01:34:54.320 --> 01:34:56.320]  At all?
[01:34:56.320 --> 01:34:59.320]  At all.
[01:34:59.320 --> 01:35:10.320]  They can also download the Unifund case, which was a presidential case, and they go to the top of the third page and it says in there
[01:35:10.320 --> 01:35:23.320]  that they load their computers with the data files that they purchased from the creditors and they purchased them on the basis of as is and with faults.
[01:35:23.320 --> 01:35:33.320]  And they load them into their computer and they cut their proprietary software loose on and it goes through the files and its queries.
[01:35:33.320 --> 01:35:37.320]  That is to say, it goes and pulls your credit report.
[01:35:37.320 --> 01:35:45.320]  And if you are worthy for them to sue you, it spits out letters to you saying you owe the debt.
[01:35:45.320 --> 01:36:00.320]  If they think that it's going to be too costly for them to pursue it, they'll take those accounts and sell them off to some different level debt collector.
[01:36:00.320 --> 01:36:19.320]  The thing that's really significant about that is at no time during that process has anybody ever looked at the files to determine if there was sufficient documentation for them to have a permissible purpose to pull your credit report.
[01:36:19.320 --> 01:36:24.320]  Oh, and with no permissible purpose of looking at felony?
[01:36:24.320 --> 01:36:33.320]  Looking at an FCRA action and as they do it multiple times, that's multiple penalties.
[01:36:33.320 --> 01:36:44.320]  Okay, now this report is 167 pages long and it is packed with what the debt collectors do to violate you.
[01:36:44.320 --> 01:36:46.320]  Oh, wonderful.
[01:36:46.320 --> 01:37:03.320]  So here's the thing that you're listening to the audience needs to take a look at. If less than 2% of the people dispute, that means that greater than 98% are being victimized.
[01:37:03.320 --> 01:37:19.320]  If the file's less than 16% of the accounts have any documentation, then what is that? 84% are unfounded and untrustworthy accounts.
[01:37:19.320 --> 01:37:22.320]  And that goes to FDCPA?

[01:40:27.320 --> 01:40:43.320]  And I call them back to OCC and start jumping up and down because this sounds like either OCC is incompetent or they're shielding NA's from civil actions.

[01:48:31.320 --> 01:48:36.320]  Okay, hold on, hold on. Let me back up and give a synopsis.
[01:48:36.320 --> 01:48:48.320]  Daryl made a deal with the woman to help her stop foreclosure, and she wrote him a warranty deed if he could stop foreclosure and then sue the bank, whatever settlement he got, he'd give back to her.
[01:48:48.320 --> 01:49:02.320]  So that was her deal. He moved into the property to preserve it, stopped the foreclosure, then she changed her mind for some reason or other, and because she was the next cop,
[01:49:02.320 --> 01:49:09.320]  she drilled out the head, the locks drilled out and she entered the property with done in hand.
[01:49:09.320 --> 01:49:13.320]  And this she told to someone else that she did that.
[01:49:13.320 --> 01:49:26.320]  And then they brought local police and they came in and they took stuff out of the property, they took his files, they took computers, took his car,
[01:49:26.320 --> 01:49:32.320]  and they called the police to try to find out what's going on, nobody was stealing anything.
[01:49:32.320 --> 01:49:38.320]  So we kind of started digging into it and this is where we're at now.
[01:49:38.320 --> 01:49:49.320]  I mentioned earlier about a sergeant threatening someone in order to prevent them from filing criminal charges. This was Daryl.
[01:49:49.320 --> 01:49:58.320]  Okay, Daryl, we're kind of up to speed. Where are we now? Has anything happened? Did you take in the criminal complaints we made up today?
[01:49:58.320 --> 01:50:09.320]  The people claim that the secretary was not there, the mayor was not there, no one was there.
[01:50:09.320 --> 01:50:11.320]  You know, it's all blank.
[01:50:11.320 --> 01:50:16.320]  They were probably hiding out back, looking around the corner.
[01:50:16.320 --> 01:50:31.320]  It's all like everybody's hiding. At the end of the day, they've got to know by now that.
[01:50:31.320 --> 01:50:37.320]  And how do you keep avoiding dealing with it?
[01:50:37.320 --> 01:50:42.320]  I mean, I'm not really understanding why nobody won't just come forward and just deal with it.
[01:50:42.320 --> 01:50:47.320]  Well, because everybody is implicated.
[01:50:47.320 --> 01:51:00.320]  Everybody's trying to protect each other. The mayor is looking at the city getting sued, and the mayor is the one that pretty well decides how the police performs their function.
[01:51:00.320 --> 01:51:05.320]  He hires and retains the chief of police.
[01:51:05.320 --> 01:51:13.320]  And the city is pretty well responsible for what the police officers do. The police officers are all trying to protect each other.
[01:51:13.320 --> 01:51:23.320]  They got careless and stupid and have someone who didn't lay down roll over for them.
[01:51:23.320 --> 01:51:34.320]  Well, you know, the thing that really kills me about it is when I talk to the detective and I ask the detective, what grounds did you have to go into my house?
[01:51:34.320 --> 01:51:41.320]  He said that the lady told him that she was the owner.
[01:51:41.320 --> 01:51:49.320]  Her mother told him that she was the owner. And the neighbor told him that she was the owner.
[01:51:49.320 --> 01:51:57.320]  And the previous people who lived in the house told him that she was the owner. So therefore, she must be the owner.
[01:51:57.320 --> 01:52:01.320]  I said, boy have you really got it wrong.
[01:52:01.320 --> 01:52:10.320]  Well, they're more wrong than just that. It didn't matter that she was the owner.
[01:52:10.320 --> 01:52:19.320]  That was the wrong question. Who is the current resident? That's the question.
[01:52:19.320 --> 01:52:27.320]  It's not the owner who has a privacy right to the property. It is the resident.
[01:52:27.320 --> 01:52:37.320]  And it had to have been clear to them after they entered the premise that this was not the resident of the owner.
[01:52:37.320 --> 01:52:58.320]  That this was a, at worst, it was a, what do you call it, squatters, adverse possession. Then you can take property under adverse possession. If the property was empty, then you can move into the property.
[01:52:58.320 --> 01:53:10.320]  And if nobody objects, you hold it legally under adverse possession until someone comes along who is the owner, who can prove that the owner and raises an objection.
[01:53:10.320 --> 01:53:23.320]  But if they don't do that within seven years, they can't. So you can move into any empty property. It's not a crime. It goes to squatters rights.
[01:53:23.320 --> 01:53:30.320]  And this was done for abandoned property. Here we've had, this property has been empty what, two years?
[01:53:30.320 --> 01:53:31.320]  Two years.
[01:53:31.320 --> 01:53:37.320]  Yes. So these police should have known this, that you can move into the property under adverse possession.
[01:53:37.320 --> 01:53:45.320]  And if the owner comes along and sees you in the property, they have to evict you. They can't enter.
[01:53:45.320 --> 01:53:56.320]  Because you have possession, even it's adverse, and it can be overcome. But until it is, you got rights, you got privacy rights.
[01:53:56.320 --> 01:54:05.320]  No way these police could not have known that. It just, this was a woman who was an ex-policewoman, right?
[01:54:05.320 --> 01:54:17.320]  She was an ex-policewoman. You know, those were her friends. She stated to someone that told me what she said, that she was an ex-police officer.
[01:54:17.320 --> 01:54:27.320]  Those were her friends. And that, you know, she could do whatever she wanted to do. And she, you know, basically did it.
[01:54:27.320 --> 01:54:35.320]  Yeah. And that's the thing, that they're used to people not knowing what we teach on this show.
[01:54:35.320 --> 01:54:45.320]  They're used to people just trying to deal with them. They're not used to people coming right at them.
[01:54:45.320 --> 01:55:04.320]  And what Daryl's going to do now is file criminal charges against the woman who entered, the detective that he talked to that indicated that he was in the property.
[01:55:04.320 --> 01:55:18.320]  And the sergeant who smart-mouthed them and threatened him with criminal charges against him in order to prevent him from pursuing action against his fellow buddy police officers.
[01:55:18.320 --> 01:55:23.320]  He was squeezing up behind this thin blue line.
[01:55:23.320 --> 01:55:37.320]  Well, he may find that this line is a whole lot thinner and he intended it for you to be. Because from what I've seen of these guys, they will protect one another as long as it's easy.
[01:55:37.320 --> 01:55:44.320]  But when we start coming at them, he will throw everybody to the walls.
[01:55:44.320 --> 01:55:55.320]  So we're charging him with time for the witness, 3,605 penal code, and it's failing in state of Texas.
[01:55:55.320 --> 01:56:01.320]  So you want to smart-mouth me, Bubba? We'll see how that works out for you.
[01:56:01.320 --> 01:56:15.320]  Right. And I'm so traumatized. It's just beyond belief. I mean, they trashed the house out. They flipped over the beds. They put all the drawers out. They broke everything up.
[01:56:15.320 --> 01:56:27.320]  And then whatever they wanted, they took it. They, you know, the police took, they claim they have possession of the car. They claim they have possession of the files, but they don't have possession of anything else.
[01:56:27.320 --> 01:56:41.320]  But everything else, if that broken, is missing. All of my TVs are missing. My money is missing. You know, my furniture is missing. Everything is missing, you know.
[01:56:41.320 --> 01:56:50.320]  And I just can't even believe. I don't believe this could even happen right in your face.
[01:56:50.320 --> 01:57:02.320]  Well, the reason you don't believe that is you don't want to listen to this show enough is you hear a lot of this kind of stuff. The police are absolutely out of control.
[01:57:02.320 --> 01:57:12.320]  They're out of control beyond belief. I call them up on the telephone and I go, what did I do to deserve this? They told me point blank, nothing.
[01:57:12.320 --> 01:57:23.320]  I said, well, is there a warrant for my risk? No. But was there a warrant issued to go into my house? No. I said, what did you say to go back to my house?
[01:57:23.320 --> 01:57:35.320]  He said, I don't, why not? You didn't do anything. I say, well, you know, okay, why is this happening to me? Well, I can't tell you that.
[01:57:35.320 --> 01:57:45.320]  Yeah, they were all closing ranks because at some point they had to realize this was a mistake.
[01:57:45.320 --> 01:57:54.320]  That they had really acted stupid and they were hoping that you wouldn't know how to come after them.
[01:57:54.320 --> 01:58:04.320]  When the mayor sees those criminal complaints tomorrow or Monday, I suspect he's going to get real excited.
[01:58:04.320 --> 01:58:11.320]  Apparently, the mayor has a business there in Glenhight. You just need to find out where it is and you get the complaints to him.
[01:58:11.320 --> 01:58:16.320]  We're not going to give the mayor notice that he's a magistrate.
[01:58:16.320 --> 01:58:20.320]  Daryl's not a lawyer and has no duty to give him legal advice.
[01:58:20.320 --> 01:58:26.320]  But when he doesn't act in accordance with the matter, his duty as a magistrate, everybody here knows what we're going to do to him.
