[00:00.000 --> 00:07.000] If you're struggling to fall asleep, think twice before popping that Ambien or Xanax
[00:07.000 --> 00:08.000]  pill.
[00:08.000 --> 00:13.000] Those medications can be habit-forming and cause memory loss, even brain damage.
[00:13.000 --> 00:17.000] I'm Dr. Catherine Albrecht and I'll have the details in a moment.
[00:17.000 --> 00:19.000]  Privacy is under attack.
[00:19.000 --> 00:23.000] When you give up data about yourself, you'll never get it back again.
[00:23.000 --> 00:28.000] And once your privacy is gone, you'll find your freedoms will start to vanish too.
[00:28.000 --> 00:33.000] So protect your rights. Say no to surveillance and keep your information to yourself.
[00:33.000 --> 00:36.000]  Privacy, it's worth hanging on to.
[00:36.000 --> 00:43.000] This message is brought to you by StartPage.com, the private search engine alternative to Google, Yahoo, and Bing.
[00:43.000 --> 00:46.000]  Start over with StartPage.
[00:46.000 --> 00:50.000] Insomnia makes you tired and anxiety makes you a nervous wreck.
[00:50.000 --> 00:56.000] If you suffer from either one, your doctor may have suggested Ambien, Ativan, or Xanax.
[00:56.000 --> 01:03.000] Those drugs known as benzodiazepines have serious side effects, including dependency, memory loss, and even dementia.
[01:03.000 --> 01:13.000] Dr. Armin Neal, co-author of the book Are Your Prescriptions Killing You, says those drugs can cause sleepwalking and even trigger mania and bipolar disorder.
[01:13.000 --> 01:16.000] But if you think you're hooked, don't just quit cold turkey.
[01:16.000 --> 01:22.000] Once your body gets used to benzodiazepines, quitting suddenly can cause permanent brain damage.
[01:22.000 --> 01:25.000] It's better to taper off with the help of a doctor.
[01:25.000 --> 01:30.000] I'm Dr. Catherine Albrecht for StartPage.com, the world's most private search engine.
[01:36.000 --> 01:42.000] Attention air travelers, before you book your next flight, be sure you don't get stuck in the worst seat on the plane.
[01:42.000 --> 01:44.000]  I'll give you a hint, it's near the back.
[01:44.000 --> 01:49.000] I'm Dr. Catherine Albrecht, back with a tip from seasoned travelers after this.
[01:49.000 --> 01:55.000] Privacy is under attack. When you give up data about yourself, you'll never get it back again.
[01:55.000 --> 02:00.000] And once your privacy is gone, you'll find your freedoms will start to vanish too.
[02:00.000 --> 02:05.000] So protect your rights. Say no to surveillance and keep your information to yourself.
[02:05.000 --> 02:08.000]  Privacy, it's worth hanging onto.
[02:08.000 --> 02:15.000] This message is brought to you by StartPage.com, the private search engine alternative to Google, Yahoo, and Bing.
[02:15.000 --> 02:19.000]  Start over with StartPage.
[02:19.000 --> 02:23.000] If you've flown lately, you know the skies can be far from friendly.
[02:23.000 --> 02:27.000] There's baggage fees, jammed overhead bins, and shrinking leg room.
[02:27.000 --> 02:31.000] And of course, choosing the right seat is always a challenge.
[02:31.000 --> 02:39.000] But a survey of a thousand flyers by Skyscanner, a flight comparison website, finds one seat is the absolute worst, 31E.
[02:39.000 --> 02:42.000] It's a middle seat in the back, near the toilets.
[02:42.000 --> 02:47.000] Of course, where there's a loser, there must be a winner, and that award goes to seat 6A.
[02:47.000 --> 02:54.000] Why? Seasoned air travelers know the first few rows get to deplane first, plus 6A comes with a very nice window.
[02:54.000 --> 02:56.000]  Happy flying!
[02:56.000 --> 03:03.000] I'm Dr. Cameron Albrecht for StartPage.com, the world's most private search engine.
[03:03.000 --> 03:13.000] 馬다, what do you want?
[03:13.000 --> 03:15.000]  What you gonna do?
[03:15.000 --> 03:17.000] Will you send me some?
[03:17.000 --> 03:19.000]  Don't come near me.
[03:19.000 --> 03:23.000]  What you gonna do?
[03:23.000 --> 03:25.000]  What you gonna do?
[03:25.000 --> 03:31.000] Yeah, bad boys, bad boys.
[03:31.000 --> 03:34.700] What you gonna do? What you gonna do when they come for you?
[03:34.700 --> 03:37.800] Bad boys, bad boys What you gonna do?
[03:37.800 --> 03:40.420] What you gonna do when they come for you?
[03:40.420 --> 03:43.260] When you were eight and you had bad dreams
[03:43.260 --> 03:46.000] You're gonna go to school and earn the gold and lose
[03:46.000 --> 03:48.640] So why are you acting like a block of food?
[03:48.640 --> 03:51.320] If you're getting, then you must get cool
[03:51.320 --> 03:54.300] Bad boys, bad boys What you gonna do?
[03:54.300 --> 03:56.700] What you gonna do when they come for you?
[03:56.700 --> 04:02.700] Bad boys, bad boys. Whatcha gonna do? Jeeak whatcha gonna do When they come for you.
[04:02.700 --> 04:11.700] You took it done. That's one. You took it done. It's one. You took it done. Comon now?
[04:11.700 --> 04:16.700] Batman! Bad Boys, bad boys. Whatcha gonna do? Bad boys, bad boys. Whatcha gonna do when they come for you.
[04:16.700 --> 04:29.600] Alright bad boys, bad boys, what are you going to do when we come for you here on the rule
[04:29.600 --> 04:30.600]  of law?
[04:30.600 --> 04:39.640]  Tonight is Thursday, January the 31st, 2013, it's hard to believe we've already blown
[04:39.640 --> 04:43.080] through one month of the new year here.
[04:43.080 --> 04:51.940] What we have, and indeed this is the Logos Radio Network, you are listening at LogosRadioNetwork.com
[04:51.940 --> 04:53.740]  is the live stream.
[04:53.740 --> 04:58.520] We are blasting out on AM and FM affiliates all over the nation.
[04:58.520 --> 05:01.840] We are in the midst of a fundraiser right now.
[05:01.840 --> 05:08.260] We were going to close the fundraiser today, but we have had such overwhelming response
[05:08.260 --> 05:15.080] to the giveaways that we've been offering that we have decided to extend the fundraiser.
[05:15.080 --> 05:22.240] Especially one of the main perks that we've got going on is the AR-15, the Rock River
[05:22.240 --> 05:31.240] AR-15 that is being donated by zombie killers, ammo and guns out of Corpus Christi, Texas,
[05:31.240 --> 05:32.620] and we want to thank them very much.
[05:32.620 --> 05:36.280] You can get more information about that at LogosRadioNetwork.com.
[05:36.280 --> 05:43.400] A $20 donation is all it takes, and you will get your name put in the hat for the drawing.
[05:43.400 --> 05:49.200] Every $20 will get your name in the hat another time, so you donate $100, you get your name
[05:49.200 --> 05:51.240] in the hat five times.
[05:51.240 --> 05:59.560] What can't be the deal like that, free AR-15, and of course also second place prize is a
[05:59.560 --> 06:06.760] lower receiver for an AR-15 that is being donated by Central Texas Gun Works right here
[06:06.760 --> 06:09.240]  in Austin, Texas.
[06:09.240 --> 06:10.840]  Same thing, same drawing.
[06:10.840 --> 06:15.280] You got first place, a full AR-15 made by the Rock River Company.
[06:15.280 --> 06:17.160]  Second place is a lower receiver.
[06:17.160 --> 06:24.840] You do have to go through the Form 4473 and do an FFL transfer.
[06:24.840 --> 06:29.800] This is not a private deal, this is not a private sale or a private giveaway or anything
[06:29.800 --> 06:30.800]  like that.
[06:30.800 --> 06:36.600] This is being directly donated by these firearms dealers, so you do have to go through the FFL
[06:36.600 --> 06:37.600]  transfer.
[06:37.600 --> 06:43.440] But hey, lots of people have done it, personally, I don't really care if the government knows
[06:43.440 --> 06:44.440]  I have guns.
[06:44.440 --> 06:46.800] In fact, the more the better.
[06:46.800 --> 06:51.120] The more people that have guns and the more the government knows about it, I think it's
[06:51.120 --> 06:53.760]  better because it's such a great deterrent.
[06:53.760 --> 07:03.200] Of course, if you donate $50, you can get a free gift card for Perium Health products,
[07:03.200 --> 07:07.600] a $50 gift card, so it's like a one for one, you're not really out of anything.
[07:07.600 --> 07:10.160] They make great supplements, great products.
[07:10.160 --> 07:14.760]  I just did a protein shake and I'm feeling great.
[07:14.760 --> 07:20.320] And also, if you don't want a protein shake or any of the other Perium products, you could
[07:20.320 --> 07:26.280] get a free Hewlett Packard Light Scribe DVD Burner.
[07:26.280 --> 07:30.920] These are all donated by the listeners, and so if you need a new DVD burner for your computer,
[07:30.920 --> 07:33.200]  it's for a PC, donate $50.
[07:33.200 --> 07:40.040] For $75, you get a free 32-ounce bottle of colloidal silver or ionic silver produced
[07:40.040 --> 07:48.080] by a Silver Lungs Generator, so this is fresh stuff made by our very own Larry Wiest.
[07:48.080 --> 07:52.800] He is the host of the brand new show on this network called God and Guns.
[07:52.800 --> 07:58.160] That is from 1 to 3 p.m. every Saturday afternoon, central time.
[07:58.160 --> 08:03.360] Of course, if you donate $150, you get a bottle of colloidal and a bottle of ionic silver.
[08:03.360 --> 08:13.040] Now, folks, a small 4-ounce bottle of colloidal silver can run you like 40 bucks at the Whole
[08:13.040 --> 08:14.040]  Food Store.
[08:14.040 --> 08:20.200] A 32-ounce bottle of colloidal silver for 75 bucks, how can you beat a deal like that?
[08:20.200 --> 08:24.280] And all the proceeds go to the fundraiser of Logos Radio Network.
[08:24.280 --> 08:29.680] So, folks, please donate, get your colloidal silver, get your ionic silver, protect your
[08:29.680 --> 08:35.400] health, get your Perium health products, upgrade your computer, get your DVD burner, and of
[08:35.400 --> 08:41.520] course, for every donation, you also get your name put in the hat for every 20 bucks.
[08:41.520 --> 08:47.560] So say you donate 80 bucks, you get your bottle of colloidal silver, and you get your name
[08:47.560 --> 08:53.920] put in the hat four times for the grand prize of the Rock River AR-15.
[08:53.920 --> 08:56.880] And of course, second prize, you get the lower receiver.
[08:56.880 --> 09:02.080] And you can build your own firearm, you can build a pistol, you can build a full-on AR-15,
[09:02.080 --> 09:03.080]  whatever you want.
[09:03.080 --> 09:10.160] Now, keep in mind, you cannot sell these items, the AR-15 or the lower receiver.
[09:10.160 --> 09:15.240] You cannot sell that for profit within one year without an FFL license.
[09:15.240 --> 09:20.200] So that is the one stipulation, because this is an official FFL transfer.
[09:20.200 --> 09:25.880] But with that being said, we are going now to one of my all-time favorite guests.
[09:25.880 --> 09:29.240] He is going to rant and rail about gun rights.
[09:29.240 --> 09:36.800] And that is our very own Mr. Michael Badboy Badnarik, Mr. Michael Badnarik.
[09:36.800 --> 09:38.880] Thank you, and welcome to the show.
[09:38.880 --> 09:43.400] I love it, but what do you mean you can't sell for a year?
[09:43.400 --> 09:46.160]  Who would sell a gun?
[09:46.160 --> 09:48.920] Who would want to sell anything right now?
[09:48.920 --> 09:55.120] I mean, I'm serious, this is the time to be getting while the getting is good.
[09:55.120 --> 09:58.160] So Michael, what do you think about the AR-15 giveaway?
[09:58.160 --> 10:00.360] What awesome sponsors we have, huh?
[10:00.360 --> 10:02.480]  That is awesome.
[10:02.480 --> 10:03.480]  It really is.
[10:03.480 --> 10:04.480]  I'm jealous.
[10:04.480 --> 10:07.520]  I wish I had cash to contribute.
[10:07.520 --> 10:15.440] That's a really great, those are great sponsors, and I love the name, Zombie Killers.
[10:15.440 --> 10:16.440]  Zombie Killers?
[10:16.440 --> 10:17.440]  Absolutely.
[10:17.440 --> 10:26.560] Hey, I looked at his, when we did the show, he brought up his photo on the Skype, and
[10:26.560 --> 10:35.680] he actually put a photo up of one of the zombies he killed.
[10:35.680 --> 10:39.560] Now, Randy, what are these days you're going to get me into more trouble than I can get
[10:39.560 --> 10:42.200]  myself out of it?
[10:42.200 --> 10:43.200]  Who me?
[10:43.200 --> 10:46.200]  Yeah, you.
[10:46.200 --> 10:51.760] We had someone on last Friday talking about you.
[10:51.760 --> 10:54.760] Oh, gosh, none of it was true.
[10:54.760 --> 11:00.040] Oh, we talked about you, and we laughed, and we laughed.
[11:00.040 --> 11:01.280]  I wasn't there.
[11:01.280 --> 11:02.280]  It wasn't me.
[11:02.280 --> 11:03.280]  I don't know what he's talking about.
[11:03.280 --> 11:08.440] Now, if someone met you at a show somewhere, and you had referred to whoever it was to
[11:08.440 --> 11:17.400] me, for some reason, and he had some legal issues, and he listened to the show, and he
[11:17.400 --> 11:18.400]  was pleased.
[11:18.400 --> 11:25.440] He was happy with your reference, and I was glad that I didn't make you look like a chump.
[11:25.440 --> 11:28.600]  Well, I knew that you wouldn't do that.
[11:28.600 --> 11:33.160] You're very good at what you do, and that's just one of the many reasons that we're
[11:33.160 --> 11:34.800]  friends for so long.
[11:34.800 --> 11:41.760] So, Michael, of course, the gun issue is the hot topic right now.
[11:41.760 --> 11:45.720] It has been for several weeks, so we wanted to have you on.
[11:45.720 --> 11:50.760] Actually, every Thursday, this is the fourth Thursday in the row that we have been discussing
[11:50.760 --> 11:52.360]  this gun issue.
[11:52.360 --> 11:56.880] We've had our sponsors on the two weeks before that, and I forgot what went on the week before
[11:56.880 --> 12:02.160] that, but every week for the last month, we have been talking about guns and Second Amendment
[12:02.160 --> 12:08.600] and our right to bear arms and how the Constitution does not give us that right.
[12:08.600 --> 12:14.480] We have that right regardless of what any piece of paper says and things like that.
[12:14.480 --> 12:18.680] And last week, actually, we had Michael Cargill on.
[12:18.680 --> 12:23.280] He's the owner of Central Texas Gun Works, and I don't know if you've heard what happened
[12:23.280 --> 12:30.000] to him, but he is an FFL dealer, and he also offers classes.
[12:30.000 --> 12:35.920] He offers beginner pistol classes, concealed handgun classes, and advanced pistol classes.
[12:35.920 --> 12:42.640] Well, he has been doing business with a company called Groupon for quite a while now, and
[12:42.640 --> 12:46.240] for, I'll just review for those of you who don't know, who didn't hear the story, or
[12:46.240 --> 12:52.600] who don't know what Groupon is, Groupon is an online coupon service, okay?
[12:52.600 --> 12:58.880] And so they call it Groupon, and it is nationwide, but it's also specific to your local area
[12:58.880 --> 13:04.000] and local businesses will participate and offer special deals.
[13:04.000 --> 13:10.800] You can get almost anything on Groupon, deals at local restaurants, you know, all kinds
[13:10.800 --> 13:19.680] of things, car washes, concealed handgun classes, or at least you used to be able to.
[13:19.680 --> 13:26.840] And then all of a sudden, a few weeks ago, a couple weeks ago, the CEO of Groupon just
[13:26.840 --> 13:33.800] up and decided that he was not going to allow any more Groupon deals that had anything to
[13:33.800 --> 13:35.480] do with guns at all.
[13:35.480 --> 13:43.000] And now, keep in mind that this was not a policy that he decided to put in place for
[13:43.000 --> 13:49.280] all future contracts at the time that he made this decision, which he has the right to do.
[13:49.280 --> 13:50.280]  It's his business.
[13:50.280 --> 13:55.160] I don't agree with it, but he has the right to make that decision, but no, he went further
[13:55.160 --> 13:56.160]  than that.
[13:56.160 --> 14:02.520] He decided that he was going to cancel all Groupons that were currently in progress that
[14:02.520 --> 14:04.440] had anything to do with firearms.
[14:04.440 --> 14:08.000] Well, Michael Cargo had a Groupon in progress.
[14:08.000 --> 14:12.960] These Groupon deals have a time limit because they're generally such good deals like 80%
[14:12.960 --> 14:17.240] off of this or that for, you know, it's only offered for like a week, okay?
[14:17.240 --> 14:24.040] Well, he had a Groupon in progress for concealed handgun class, and then they just cancel it.
[14:24.040 --> 14:28.640] Well, I'm sorry, but he doesn't have a right to do that because that's called breach of
[14:28.640 --> 14:29.640]  contract.
[14:29.640 --> 14:30.880]  That's a tort.
[14:30.880 --> 14:32.680]  That's a civil tort.
[14:32.680 --> 14:38.000] And so now Michael is looking into suing Groupon for breach of contract over that.
[14:38.000 --> 14:40.480] He's going to keep us posted on that.
[14:40.480 --> 14:46.880] And he is calling for a boycott of Groupon right now and not to give them a penny, not
[14:46.880 --> 14:54.020] to, if you're a business owner, don't do business with them to offer Groupons to try to bring
[14:54.020 --> 14:55.960] in more business to your business.
[14:55.960 --> 15:01.160] If you're a customer, don't get any deals from Groupon, don't buy any coupons off of
[15:01.160 --> 15:04.240] Groupon, and to call and harass them relentlessly.
[15:04.240 --> 15:07.800] If you live in the Chicago area, which is where they're based out of, go to their offices.
[15:07.800 --> 15:15.160] If you don't live in Chicago area, send them faxes, call them, email them, send them letters,
[15:15.160 --> 15:20.600] and just, for all practical purposes, just make their lives a living nightmare over what
[15:20.600 --> 15:24.200] they have done to Michael Cargill and over this decision in general.
[15:24.200 --> 15:26.640] So Michael, what do you think about that?
[15:26.640 --> 15:33.120] What do you think about these companies that are like different banks and such that are
[15:33.120 --> 15:41.760] canceling firearm dealers, bank accounts, and all this is, it's like a mafioso, a mafioso
[15:41.760 --> 15:48.920] business where they are leaning on businesses that have anything to do with firearms, this
[15:48.920 --> 15:55.640] kind of extrajudicial type of activity that is just pure thuggery to try to pressure people
[15:55.640 --> 15:58.800] into not doing business that has anything to do with firearms.
[15:58.800 --> 16:00.800] What do you think about that, Michael?
[16:00.800 --> 16:05.280] Well, you already know what I think about it, and I love it when you talk dirty, talking
[16:05.280 --> 16:07.960] about torches, stuff like that.
[16:07.960 --> 16:12.960]  Yeah, this is, it's bad.
[16:12.960 --> 16:18.200] Those people remind me of the tattletales in school.
[16:18.200 --> 16:23.760] The people who would do anything the teacher said, you know, when the teacher comes back
[16:23.760 --> 16:28.560] in the room, they say, oh, you know, Randy was talking while you were gone, they just
[16:28.560 --> 16:29.560]  tattletale and snitch.
[16:29.560 --> 16:34.800] Well, the government wants to give us all the turn in our guns, you know, and these
[16:34.800 --> 16:39.840] private companies, you know, like the guy from Groupon, it's like, oh, the government
[16:39.840 --> 16:42.520] wants you to give up your guns, so we're not going to let you do that.
[16:42.520 --> 16:45.400] We're just going to, you know, cancel all these contracts.
[16:45.400 --> 16:53.840]  Well, it's like, yeah, I wouldn't do business with them anyway, so I think it's a real good
[16:53.840 --> 16:58.160] idea for, you know, people to get together, got to stand up.
[16:58.160 --> 17:24.160]  All right, we'll be right.
[17:24.160 --> 17:41.200]  All right, we'll be right back.

[18:25.560 --> 18:30.160] letters and phone calls, how to get debt collectors out of your credit reports, how to turn the
[18:30.160 --> 18:34.360] financial tables on them and make them pay you to go away.
[18:34.360 --> 18:39.480] The Michael Meyers Proven Method is the solution for how to stop debt collectors.

[19:00.680 --> 19:29.800] You are listening to the Logos Radio Network, LogosRadioNetwork.com.
[19:29.800 --> 19:32.200] Okay folks, we are back.
[19:32.200 --> 19:35.920] This is the rule of law on the Logos Radio Network.
[19:35.920 --> 19:39.840] We are here with a very special guest and good friend, Mr. Michael Badnarik.
[19:39.840 --> 19:41.960] We're going to be talking about the gun issues.
[19:41.960 --> 19:48.000] If you have a question, you like to call and talk to Michael Badnarik, 512-646-1984.
[19:48.000 --> 19:53.440] He will be with us until nine o'clock for the next 40 minutes or so, and we are talking
[19:53.440 --> 19:56.920] about second amendment issues, gun issues, this sort of thing.
[19:56.920 --> 20:01.200] So if you have other general legal questions, please wait until after the top of the hour
[20:01.200 --> 20:02.200]  to call.
[20:02.200 --> 20:08.080] But yeah, Michael, we've got a brand new show on the network here called God and Guns hosted
[20:08.080 --> 20:09.080]  by Larry Wiest.
[20:09.080 --> 20:10.600]  It's an excellent show.
[20:10.600 --> 20:17.760] His first show he had on a friend of his, a lady who ran off an intruder firing at him.
[20:17.760 --> 20:22.600] He broke into her house in the middle of the night and she heard the stirring around and
[20:22.600 --> 20:23.600]  the banging.
[20:23.600 --> 20:30.080] It's black and so she just opened her bedroom door and just started a firing, okay?
[20:30.080 --> 20:33.160] And she didn't wait to make eye contact.
[20:33.160 --> 20:38.440] She said, hey, he didn't stop and think about it before he came in my house.
[20:38.440 --> 20:42.280] So why should I stop and think about it before I start firing at him?
[20:42.280 --> 20:48.400] So she fired and it was a pistol, I forgot what kind of pistol it was, but it was a pistol
[20:48.400 --> 20:49.400]  that fired bullets.
[20:49.400 --> 20:53.560] I think it was a 380 caliber and so of course in the dark, she wasn't quite able to see
[20:53.560 --> 21:01.280] me, but she apparently did hit him because there was blood and dripping blood on the
[21:01.280 --> 21:04.720] front porch going down the driveway when the police arrived.
[21:04.720 --> 21:06.240] They were able to take DNA samples.
[21:06.240 --> 21:08.240]  So hey, I think it's great.
[21:08.240 --> 21:10.120] People needed to be able to defend themselves.
[21:10.120 --> 21:14.600] So Michael, I just want to turn the floor over to you and just take it away.
[21:14.600 --> 21:19.280] Tell us what you think about all this madness and talk about the gun grabbing and where it's
[21:19.280 --> 21:21.920] all headed and what should we do about it?
[21:21.920 --> 21:27.560] Well, first of all, I want to let all of your listeners know that because of the high price
[21:27.560 --> 21:32.840]  of ammunition these days, I can't afford a warning shot.
[21:32.840 --> 21:41.920] So I want everybody to know that first bullet out of the barrel is going to be on target.
[21:41.920 --> 21:42.920]  Good.
[21:42.920 --> 21:43.920]  Yeah.
[21:43.920 --> 21:54.600] It is very, very sad, is very sad what's going on in this country that people are just not
[21:54.600 --> 21:58.560] smart enough to see the forest for the trees.
[21:58.560 --> 22:04.800] One of the things the government is trying to do is to disarm the population.
[22:04.800 --> 22:13.880] And one of the reasons that we've seen throughout history is so that the government can eliminate
[22:13.880 --> 22:15.920]  large numbers of people.
[22:15.920 --> 22:18.920]  We're talking millions of people.
[22:18.920 --> 22:27.800] If there are any of your listeners that have not seen the video called Innocence Betrayed,
[22:27.800 --> 22:36.240] it's a video from Jews for the Preservation of Firearms Ownership, JPFO.org.
[22:36.240 --> 22:41.000] That video is now available for free on the Internet.
[22:41.000 --> 22:46.880] Do not watch it before you go to bed because you probably won't be able to go to bed.
[22:46.880 --> 22:55.320] It's very disturbing, but it shows over and over and over again how many governments
[22:55.320 --> 23:04.840] have disarmed the people followed by almost immediately annihilating them, just eliminating
[23:04.840 --> 23:08.440] them off the out of the country.
[23:08.440 --> 23:11.680]  And it's very terrifying.
[23:11.680 --> 23:18.120] And I want to make sure that that never, never happens in the United States.
[23:18.120 --> 23:26.440] So as Thomas Jefferson said, one of the primary reasons for the people to keep their arms
[23:26.440 --> 23:30.240] is to protect themselves against tyranny and government.
[23:30.240 --> 23:34.160] And we're not talking tyranny from Russia, tyranny from China.
[23:34.160 --> 23:39.040]  We're talking tyranny from Washington, D.C.
[23:39.040 --> 23:45.680] Now 2012 was pretty much the year of the mass shooting.
[23:45.680 --> 23:50.320] I was really surprised because I didn't remember most of them and so I started doing internet
[23:50.320 --> 23:54.920] research to do an article.
[23:54.920 --> 23:57.400]  And there have been a lot.
[23:57.400 --> 24:04.000] And when the shooting happened in Connecticut, even before they announced how many bodies
[24:04.000 --> 24:11.960] because they hadn't even gotten into the school yet, I was already cognizant of the fact that
[24:11.960 --> 24:19.640] this shooting was going to generate all the anti-gun legislation, all of this talk.
[24:19.640 --> 24:29.040] And they keep saying that this has resumed the gun debate, except that there's no debate
[24:29.040 --> 24:34.520] that the government is planning to get rid of all the guns, get rid of all of your guns,
[24:34.520 --> 24:36.280] take them away from you.
[24:36.280 --> 24:42.000] And until that happens, they're going to continue to rant.
[24:42.000 --> 24:45.360]  And it's just not an option.
[24:45.360 --> 24:51.800] I ask people, you know, assuming that they were walking down a sidewalk someplace and
[24:51.800 --> 24:57.560] someone started to choke them, you know, like what they were going to do about it.
[24:57.560 --> 25:02.520] Every single person says that, you know, they would defend themselves, you know, poke them
[25:02.520 --> 25:10.560] in the eye, step on their foot, do something that would hopefully terminate the attack.
[25:10.560 --> 25:17.960]  Self-defense is an DNA-encoded biological instinct.
[25:17.960 --> 25:19.920]  I challenge anybody.
[25:19.920 --> 25:27.840] I will make a $10,000 wager that you cannot just stand there and let me choke you until
[25:27.840 --> 25:28.840]  you pass out.
[25:28.840 --> 25:34.920]  I mean, it violates your self-preservation instinct.
[25:34.920 --> 25:41.160] So we have this biological self-preservation instinct, which, you know, runs all the way
[25:41.160 --> 25:43.200]  into our DNA.
[25:43.200 --> 25:51.120] And if you choose to defend yourself with a firearm, which is the only logical, rational,
[25:51.120 --> 25:54.560] most effective way to do it, you have that right.
[25:54.560 --> 25:56.960]  Well, now, wait a minute, Michael.
[25:56.960 --> 26:02.320] There's a video out by some government entity, I forgot which one it was, Alex Jones was
[26:02.320 --> 26:07.160] talking about it today, I think it may even be a Homeland Security video, where they're
[26:07.160 --> 26:12.400] encouraging people to defend themselves with a pair of scissors if a gunman comes in.
[26:12.400 --> 26:13.920]  Now, isn't that good enough?
[26:13.920 --> 26:16.640] The government says it is.
[26:16.640 --> 26:25.960] If you think that a pair of scissors is a sufficient defense, I mean, go for it.
[26:25.960 --> 26:32.640] The Second Amendment doesn't say that you can't defend yourself with scissors, but back in
[26:32.640 --> 26:40.400] the day, when, you know, women were worried about the rape that was happening, the government's
[26:40.400 --> 26:49.880] response was to the women that you should lay there and try to enjoy it in order to
[26:49.880 --> 26:54.120] reduce the chance of additional violence.
[26:54.120 --> 27:00.400] Basically, the bottom line is, we don't want the guy to beat you up too.
[27:00.400 --> 27:02.400]  Yeah, whatever.
[27:02.400 --> 27:05.760]  So are you kidding?
[27:05.760 --> 27:09.960]  I mean, I am incensed by that.
[27:09.960 --> 27:15.000] Are these police officers going to tell their wives, well, sweetheart, you just lay there
[27:15.000 --> 27:16.480] and try to enjoy it.
[27:16.480 --> 27:17.960]  Well, how about this?
[27:17.960 --> 27:24.000] If somebody's robbing you, why don't you just stand there or sit there and enjoy it
[27:24.000 --> 27:27.160]  and just consider it a donation?
[27:27.160 --> 27:29.160]  It's like, this is insane.
[27:29.160 --> 27:37.240] And I cannot comprehend any law enforcement or any government individual actually saying
[27:37.240 --> 27:40.360]  that out loud.
[27:40.360 --> 27:47.520] I mean, if a police officer told my girlfriend that you should lay there and just try to
[27:47.520 --> 27:53.120] enjoy it, I would be in jail for beating the snot out of this police officer.
[27:53.120 --> 27:55.760]  Are you kidding me?
[27:55.760 --> 28:00.000] That is an insult to everybody's intelligence.
[28:00.000 --> 28:09.880] So as we were talking earlier this evening, what the first question is, do you think the
[28:09.880 --> 28:16.000] government is going to come to its senses and back off of its gun confiscation program?
[28:16.000 --> 28:18.280] Well, the answer is not.
[28:18.280 --> 28:20.240]  They are sociopaths.
[28:20.240 --> 28:24.280] They are never going to stop until they've got all the guns collected.
[28:24.280 --> 28:27.000] They're just not going to quit, period.
[28:27.000 --> 28:28.000]  End of story.
[28:28.000 --> 28:29.000]  They won't give up.
[28:29.000 --> 28:35.400] No, don't you remember the big quote of Dianne Feinstein, Mr. and Mrs. America, turn them
[28:35.400 --> 28:36.400]  all in.
[28:36.400 --> 28:42.320] If I had the vote, then I would have said that, Mr. and Mrs. America, turn them all in,
[28:42.320 --> 28:44.320]  but I just couldn't do it.
[28:44.320 --> 28:47.640] No, and you never will either, because we're not going to turn them in.
[28:47.640 --> 28:50.800] See, this is what these gun grabbers don't understand.
[28:50.800 --> 28:52.800]  We already have them.
[28:52.800 --> 28:53.800]  Okay?
[28:53.800 --> 28:54.800]  Yeah.
[28:54.800 --> 28:59.120] Yeah, and we're not going to give them up.
[28:59.120 --> 29:05.400] Okay, second question, or second statement, is that since the shooting in Connecticut,
[29:05.400 --> 29:11.280] in the next three weeks, Americans purchased 10 million guns.
[29:11.280 --> 29:12.280]  Yeah.
[29:12.280 --> 29:13.280]  I question that.
[29:13.280 --> 29:14.280]  I'm a scientist.
[29:14.280 --> 29:17.400]  That's a lot of hardware.
[29:17.400 --> 29:24.040] And you know, I've had it confirmed over and over again, 10 million guns in three weeks.
[29:24.040 --> 29:26.480] And that's just what went through the NIC system.
[29:26.480 --> 29:30.800] Imagine how many more were purchased through private sale.
[29:30.800 --> 29:32.800]  Ah, man.
[29:32.800 --> 29:41.160] So these people, most of them, paid two, sometimes three times what the standard amount was to
[29:41.160 --> 29:44.640] make sure that they got their firearm.
[29:44.640 --> 29:51.160] Now is it rational to assume that people purchased three times the cost of a firearm so they
[29:51.160 --> 29:52.160]  could turn it in?
[29:52.160 --> 29:53.160]  No, I don't.
[29:53.160 --> 29:54.160]  I don't think so.
[29:54.160 --> 29:55.160]  I don't think so.
[29:55.160 --> 29:56.160]  We're going to break.
[29:56.160 --> 30:00.520] We will be right back with Mr. Michael Badnarik.
[30:00.520 --> 30:05.880] This is Building 7, a 47-story skyscraper that fell on the afternoon of September 11th.
[30:05.880 --> 30:08.160] The government says that fire brought it down.
[30:08.160 --> 30:12.920] However, 1,500 architects and engineers have concluded it was a controlled demolition.
[30:12.920 --> 30:16.960] Over 6,000 of my fellow service members have given their lives, and thousands of my fellow
[30:16.960 --> 30:18.400]  force responders have died.
[30:18.400 --> 30:19.800]  I'm not a conspiracy theorist.
[30:19.800 --> 30:20.800]  I'm not a structural engineer.
[30:20.800 --> 30:22.240]  I'm a New York City correction officer.
[30:22.240 --> 30:23.240]  I'm an Air Force pilot.
[30:23.240 --> 30:24.840]  I'm a father who lost his son.
[30:24.840 --> 30:27.400] We're Americans, and we deserve the truth.
[30:27.400 --> 30:31.040]  Go to RememberBuilding7.org today.
[30:31.040 --> 30:37.080] HempUSA.org has moved and expanded its operations for faster worldwide shipping.
[30:37.080 --> 30:42.600] Our product line has grown from five to nearly 100 items in less than five years.
[30:42.600 --> 30:46.920] Our food has grown naturally, always chemical-free, not found in stores.
[30:46.920 --> 30:51.360] Great for daily intake and perfect for your emergency storage shelter.
[30:51.360 --> 30:59.360] Call 908-6912608 or visit hempusa.org and see what our powder, seeds, and oil can do
[30:59.360 --> 31:00.360]  for you.
[31:00.360 --> 31:06.360] It is so enlightening to listen to 90.1 FM, but finding things on the Internet isn't
[31:06.360 --> 31:10.160] so easy, and neither is finding like-minded people to share it with.
[31:10.160 --> 31:13.320] Oh, well, I guess you haven't heard of Brave New Books then.
[31:13.320 --> 31:14.320]  Brave New Books?
[31:14.320 --> 31:15.320]  Yes.
[31:15.320 --> 31:19.480] Brave New Books has all the books and DVDs you're looking for by authors like Alex Jones,
[31:19.480 --> 31:21.480] Ron Paul, Angie Edward Griffin.
[31:21.480 --> 31:24.760] They even stock inner food, Berkey products, and Calvin Soaps.
[31:24.760 --> 31:27.800]  There's no way a place like that exists.
[31:27.800 --> 31:29.240] Go check it out for yourself.
[31:29.240 --> 31:33.200] It's downtown at 1904 Guadalupe Street, just south of UT.
[31:33.200 --> 31:34.200]  Oh, by UT?
[31:34.200 --> 31:36.840] There's never anywhere to park down there.
[31:36.840 --> 31:42.280] Actually, they now offer a free hour of parking for paying customers at the 500 MLK parking
[31:42.280 --> 31:44.280] facility just behind the bookstore.
[31:44.280 --> 31:48.200] It does exist, but when are they open?
[31:48.200 --> 31:53.720]  Monday through Saturday, 11 a.m. to 9 p.m., and 1 to 6 p.m. on Sundays, so get them a
[31:53.720 --> 31:59.720] call at 512-480-2503, or check out their events page at bravenewbookstore.com.
[31:59.720 --> 32:06.720]  Live, free speech radio, logosradionetwork.com.
[32:06.720 --> 32:24.640] Okay, folks, we are back.
[32:24.640 --> 32:26.120] We are here with Mr. Michael Badnarik.
[32:26.120 --> 32:31.760]  We're taking your calls, and we'd like to ask Michael a question, 512-646-1984.
[32:31.760 --> 32:36.400] We are on topic tonight about the gun issue, at least while Michael is on the line.
[32:36.400 --> 32:40.240] If you have other legal questions, please wait until after the top of the hour.
[32:40.240 --> 32:42.400] All right, we've got Benjamin in Texas.
[32:42.400 --> 32:44.240] Benjamin, thanks for calling in.
[32:44.240 --> 32:46.240] What is your question for Michael Badnarik?
[32:46.240 --> 32:47.240]  Okay.
[32:47.240 --> 32:51.400] Well, first, I'd kind of like to know who Michael is.
[32:51.400 --> 32:53.000]  I don't know who he is.
[32:53.000 --> 32:54.000]  I'm sorry.
[32:54.000 --> 32:55.440]  I didn't give Michael a proper introduction.
[32:55.440 --> 32:57.360] We've had him on so many times.
[32:57.360 --> 33:05.520] Michael Badnarik was the Libertarian candidate for president in 2004, and he got quite a
[33:05.520 --> 33:06.520]  number of votes.
[33:06.520 --> 33:12.760] He teaches a constitution class, and he also wrote the book called Good to Be King, and
[33:12.760 --> 33:19.440] it's about the fact that we are the kings and queens, not the government, so it's good
[33:19.440 --> 33:20.440]  to be kings.
[33:20.440 --> 33:23.640] Benjamin, you have a lot of background noise on your end.
[33:23.640 --> 33:27.920] It sounds like you're in the middle of a tornado or something, so I've muted you now.
[33:27.920 --> 33:31.160] I'm going to unmute you, but can you quickly ask your question, and then I'm going to have
[33:31.160 --> 33:33.400] to let you go because there's too much noise on your end.
[33:33.400 --> 33:34.400]  What is your question?
[33:34.400 --> 33:36.880]  Is there noise now?
[33:36.880 --> 33:39.000] It's much better, but go ahead, please.
[33:39.000 --> 33:40.000]  Okay.
[33:40.000 --> 33:41.000]  I'm sorry.
[33:41.000 --> 33:42.000]  I was smoking a cigarette.
[33:42.000 --> 33:50.240] Well, my question is, I'm 22 years old, and the whole gun situation that I'm hearing
[33:50.240 --> 33:57.400] about is kind of concerning because they've already taken assault rifles out of big sporting
[33:57.400 --> 34:01.760]  goods and Wal-Mart, and I'm a good citizen.
[34:01.760 --> 34:05.440] I have my guns for protection, and I value that.
[34:05.440 --> 34:09.680] I value being able to go out and buy a gun and have it, knowing that I have it.
[34:09.680 --> 34:15.040] If anybody crazy comes into my house or tries to harm my family, I have my gun.
[34:15.040 --> 34:24.880] My concern is my generation growing up, what we're going to have to face.
[34:24.880 --> 34:31.800] Well, I think that things are going to happen very, very soon.
[34:31.800 --> 34:35.160] As I was leading to, the government is not going to give up.
[34:35.160 --> 34:37.640] The people are not going to give up their guns.
[34:37.640 --> 34:42.160] The only rational conclusion is that there's going to be blood checks.
[34:42.160 --> 34:49.280] The immovable force, the irresistible force, the immovable object kind of thing, and I
[34:49.280 --> 34:52.200] think that's going to happen relatively soon.
[34:52.200 --> 34:58.280] So if we survive long enough for your generation to grow up and be in control, I think it's
[34:58.280 --> 35:04.600] going to look a lot different than it does now.
[35:04.600 --> 35:10.920] Also wondering is, I mean, for the government just to come in and try and take everybody's
[35:10.920 --> 35:18.880] gun scene, not like something that they would do, it would seem like more of a biochemically
[35:18.880 --> 35:28.760] type of thing, like through our water or some other way to, I mean, I guess what I'm wondering
[35:28.760 --> 35:33.960] is what, they're trying to take the guns away, but I mean, I could go on the street right
[35:33.960 --> 35:36.160] now and buy any kind of gun I want.
[35:36.160 --> 35:40.560] It doesn't have to be in the store, so why is the whole focus on trying to take the guns
[35:40.560 --> 35:41.560]  away?
[35:41.560 --> 35:42.560]  It seems like there's much.
[35:42.560 --> 35:47.280] Because they have to disarm the people before they can get rid of everybody.
[35:47.280 --> 35:52.120] Okay, and yeah, they can wipe people out through the water or through the chemtrails, which
[35:52.120 --> 35:58.600] they pretty much already are, but the thing is they can't do that to everybody all at
[35:58.600 --> 36:05.560] once because some people will be onto it, and a lot of us have filters where we filter
[36:05.560 --> 36:12.080] out these poisons out of our water, it will filter out their anthrax and whatever other
[36:12.080 --> 36:16.320] bio weapon they want to put in the water, it will filter out heavy metals, it will filter
[36:16.320 --> 36:21.920] out fluoride, it will filter out drugs like statins and lithium, so they're not going
[36:21.920 --> 36:24.680] to be able to get everybody through the water, they're not going to be able to get everybody
[36:24.680 --> 36:27.600] through the air either because people have filters, okay?
[36:27.600 --> 36:33.300] So they have to disarm us if they want to implement their evil plan because there's
[36:33.300 --> 36:38.040] going to be quite a number of us that will survive their biochemical attack.
[36:38.040 --> 36:40.400] We already are surviving it, all right?
[36:40.400 --> 36:42.800] So I can answer that aspect of it.
[36:42.800 --> 36:44.720] Michael, do you want to respond?
[36:44.720 --> 36:51.760] Well, you know, people ask these questions as if the government is going to be doing
[36:51.760 --> 36:56.320]  things logically, and they're not.
[36:56.320 --> 37:01.440] If you're anticipating a logical response, you are way off base.
[37:01.440 --> 37:09.920] These people are sociopaths, you know, they really don't care, and you know, if they're
[37:09.920 --> 37:16.520] planning to take the guns away, it happened in Germany, it happened in so many countries
[37:16.520 --> 37:20.680]  that it's almost a routine.
[37:20.680 --> 37:29.760] So I strongly recommend that you watch Innocence Be Trade and check out a little bit of history.
[37:29.760 --> 37:37.520] And also I will add that going around and doing gun confiscation door to door is not
[37:37.520 --> 37:44.520] really their style because they know it's going to be too messy because people are going
[37:44.520 --> 37:48.840] to fight back and it's not going to work out for them very well.
[37:48.840 --> 37:52.160] They want people to beg for their slavery.
[37:52.160 --> 37:54.880] They want to convince people to turn them in.
[37:54.880 --> 37:59.040] They want to do it, boil the frog style.
[37:59.040 --> 38:02.160] They want to do it through democracy, okay?
[38:02.160 --> 38:07.360] They want to do it through democracy to get the majority of the people to vote to take
[38:07.360 --> 38:13.360] away the rights from the minority, which is one of the topics of Michael's book, okay?
[38:13.360 --> 38:21.680] To rally people who don't understand these concepts to be against us to try to take our
[38:21.680 --> 38:22.800]  guns away from us.
[38:22.800 --> 38:28.240] So I mean, they're not going to be able to accomplish their evil plan unless they disarm
[38:28.240 --> 38:31.880] us because they won't be able to enslave us.
[38:31.880 --> 38:32.880] They won't be able to control us.
[38:32.880 --> 38:36.520] They won't be able to drag us up to their prison camps if we're armed.
[38:36.520 --> 38:38.840]  I mean, it's just, it's very simple.
[38:38.840 --> 38:46.640] I mean, even the government of China is encouraging and praising Obama for these measures and
[38:46.640 --> 38:49.840]  wanting more.
[38:49.840 --> 38:54.400] So it's kind of a, we could talk about that all night, but does that at least partially
[38:54.400 --> 38:55.400]  answer your question, Benjamin?
[38:55.400 --> 38:57.760] Yeah, I could talk to you guys all night.
[38:57.760 --> 38:58.760]  Thank you so much.
[38:58.760 --> 38:59.760]  Okay, Benjamin.
[38:59.760 --> 39:00.760]  Thank you, Benjamin.
[39:00.760 --> 39:01.760]  Thank you.
[39:01.760 --> 39:02.760]  Good night.
[39:02.760 --> 39:03.760]  All right, you too.
[39:03.760 --> 39:04.760]  Bye-bye.
[39:04.760 --> 39:05.760]  Bye-bye.
[39:05.760 --> 39:11.240] And yeah, you know, we were talking on the break about the answer to these mass shootings
[39:11.240 --> 39:14.920]  on the teachers, okay?
[39:14.920 --> 39:19.760] And we were discussing on the break, there's a private school in Marble Falls.
[39:19.760 --> 39:27.480] It was on KVU News just today, post to January 31st, Hill Country teachers taught guns.
[39:27.480 --> 39:31.120] They are going to start arming the teachers in a private school in Marble Falls.
[39:31.120 --> 39:35.800] And you mentioned there was, there's a, even a public school in the panhandle that is going
[39:35.800 --> 39:38.320] to allow teachers to have guns.
[39:38.320 --> 39:43.760] I mean, hello, we, we defend our courts with guns.
[39:43.760 --> 39:50.400] We defend our, our, our public servants with guns at the Senate and things like that.
[39:50.400 --> 39:55.000] You know, but we, we put up, how do we defend our children?
[39:55.000 --> 39:58.760] We put up a sign on the door that says no guns.
[39:58.760 --> 40:06.360] Give me a break, because it actually says turkey shoot here.
[40:06.360 --> 40:07.360]  Turkey shoot here.
[40:07.360 --> 40:08.360]  Exactly.
[40:08.360 --> 40:15.900] And my, my, when, when Michael was talking about after the shooting and incredible increase
[40:15.900 --> 40:21.800] in purchase of weapons, with the implication that people bought these weapons because they
[40:21.800 --> 40:23.800] thought the government was going to take them away from them.
[40:23.800 --> 40:26.760]  I don't think that's the reason.
[40:26.760 --> 40:35.000] I think the reason is because it is part of the American mentality that we think if I
[40:35.000 --> 40:40.000] was near that school, or if I was a teacher in that school and I was armed, this guy would
[40:40.000 --> 40:42.080]  have himself a gunfight.
[40:42.080 --> 40:43.760]  He wouldn't have himself a turkey shoot.
[40:43.760 --> 40:48.560] If I was sitting in that theater and someone come in and opened up, he would have himself
[40:48.560 --> 40:49.560]  a fight.
[40:49.560 --> 40:50.560]  Yeah.
[40:50.560 --> 40:52.760] Tell us the story about the church, Randy, that you were telling us on the break.
[40:52.760 --> 40:53.760]  Oh yeah.
[40:53.760 --> 40:59.160] When I was in Colorado several years ago, a guy came into a church.
[40:59.160 --> 41:04.680] He was angry about something and opened up in the church while the security guard was
[41:04.680 --> 41:11.680] about almost a six foot tall, good looking, willy blonde, really sweet, nice looking lady,
[41:11.680 --> 41:17.400] walked down the aisle, blasted away at this guy, and him shooting back at her, she walked
[41:17.400 --> 41:22.920] right into a withering fire and shot him dead on the podium.
[41:22.920 --> 41:29.080] He didn't get a get to get up there and have himself a turkey shoot.
[41:29.080 --> 41:31.840] Human beings are human beings.
[41:31.840 --> 41:35.480] We are not going to change that.
[41:35.480 --> 41:40.440] Human beings have turned on one another since we have kept records.
[41:40.440 --> 41:50.240] This is not going to change a certain percentage of the human population are criminals.
[41:50.240 --> 41:52.280]  That's not going to change.
[41:52.280 --> 41:58.040] You are not going to keep weapons out of the hands of criminals.
[41:58.040 --> 42:05.760] It's not going to ever happen and we need to stop dreaming about a perfect world.
[42:05.760 --> 42:07.640]  This is not a perfect world.
[42:07.640 --> 42:13.120] If it were a perfect world, there's a good chance that you and I wouldn't be here.
[42:13.120 --> 42:24.040] The world is what it is, people attack, other people, and armed societies are polite societies.
[42:24.040 --> 42:28.880]  Just ask anybody who's been to a gun show.
[42:28.880 --> 42:29.880]  Oh yeah.
[42:29.880 --> 42:37.880] There was a police movie where two guys come in a bar and try to hold up the bar and for
[42:37.880 --> 42:43.960] 30 seconds the only sound are hammers cocking back.
[42:43.960 --> 42:48.240] One guy says to the other, wax him on the shoulder and said, I told you this was a bad
[42:48.240 --> 42:50.920]  idea.
[42:50.920 --> 42:58.000] I was once stoned to the top half of a window out of a beer joint in Kauai, Thailand.
[42:58.000 --> 43:04.120] Big fight, army, air force, two bases together, always having big fights, everybody in their
[43:04.120 --> 43:06.560]  arm to the teeth.
[43:06.560 --> 43:12.760] Everybody ever even dreamed of pulling a weapon unless you had an incredible death wish and
[43:12.760 --> 43:16.440] you wanted your own people shooting you because if you pulled a weapon in there, they would
[43:16.440 --> 43:22.080] figure you had to be so drunk that you might shoot them.
[43:22.080 --> 43:27.720] So we're not going to fix this problem because disarming the people is just irrational.
[43:27.720 --> 43:31.240]  It's completely irrational.
[43:31.240 --> 43:34.640] 96% of the people are the good guys.
[43:34.640 --> 43:38.880]  I want 96% of the people at least aren't.
[43:38.880 --> 43:44.760] Part of that other 4% is going to be armed whether I like it or not but I want the 96%
[43:44.760 --> 43:45.760]  aren't.
[43:45.760 --> 43:46.760]  I'll feel safe there.
[43:46.760 --> 43:47.760]  Yeah, me too.
[43:47.760 --> 43:48.760]  All right.
[43:48.760 --> 43:49.760]  Well, listen, we're heading to break.
[43:49.760 --> 43:52.640] We're going to go into our last segment here of the first hour.
[43:52.640 --> 43:54.640] Final segment with Michael Badnarik.
[43:54.640 --> 44:02.080] Michael, if you want to take some calls, call us 512-646-1984.
[44:02.080 --> 44:07.440] Mr. President, members of Congress, you've been making a lot of noise about taking our
[44:07.440 --> 44:08.440]  guns away.
[44:08.440 --> 44:11.440] But you might want to review history.
[44:11.440 --> 44:18.840] 1835, Gonzales, Texas Territory, the authorities wanted to confiscate the big gun that protected
[44:18.840 --> 44:19.840]  that colony.
[44:19.840 --> 44:22.640] You know what the people said?
[44:22.640 --> 44:29.920] Come and take it because they were willing to fight for their freedom and their guns.
[44:29.920 --> 44:38.000] Come and take it if you want it, come and take it if you think you can, come and take
[44:38.000 --> 44:44.480] it but I want you, you'll have to fight it from my hold against, we want the freedom
[44:44.480 --> 44:51.960] that God gave us, so you best not cross that line, if you want this gun you've got to come
[44:51.960 --> 44:54.960] through us and take it.
[44:54.960 --> 44:59.880] One shot at a time, just like Gonzales, we're keeping our guns.
[44:59.880 --> 45:04.720] Are you the plaintiff or defendant in a lawsuit?

[46:45.760 --> 47:02.080] Okay, folks, we are back. This is our final segment with Mr. Michael Badnarik. Michael,
[47:02.080 --> 47:06.280] thank you for coming on tonight with us. Thank you so much for talking with us about this
[47:06.280 --> 47:13.920] gun issue. And I think it's pretty obvious. We are not giving them up just as Steve Voss
[47:13.920 --> 47:19.120] said on the PSA during the break. Come and take it if you think you can, but you're going
[47:19.120 --> 47:24.080] to have to come through us. You're going to have to come and take it one shot at a time.
[47:24.080 --> 47:30.400] So, Michael, you've got a book out. Can you please tell us about your book and where
[47:30.400 --> 47:37.120] folks can get your new book? The name of the book is Secret Dissovereignty.
[47:37.120 --> 47:43.240] People have asked me for an advanced class. And this is about as close as I can get to
[47:43.240 --> 47:51.480] an advanced class. It talks about how to survive the Second American Revolution. And
[47:51.480 --> 48:02.240] you can get it at my website, constitutionpreservation.org. It's not for sale. It's only for barter.
[48:02.240 --> 48:09.280] And you'll find all the terms of the agreements there on my website, constitutionpreservation.org.
[48:09.280 --> 48:17.040] And you can read a significant excerpt. There's a teaser to let you know what's in the book
[48:17.040 --> 48:20.640] so that you'll know whether you want to buy it or not.
[48:20.640 --> 48:26.240] Excellent. And I highly recommend getting Michael's books. He also wrote the book Good
[48:26.240 --> 48:33.440] to Be King, which basically it's about all of us, kings and queens out there. It's the
[48:33.440 --> 48:38.080] government of the people, by the people, and for the people. We are no longer under a monarchy.
[48:38.080 --> 48:42.240] Our forefathers broke away from that. We are the kings now, and they are the public servants.
[48:42.240 --> 48:48.200] And we've got to keep that in mind. We are on top now, and we are the ones with the rights.
[48:48.200 --> 48:54.120] And we've got to keep that in mind. The differences between rights and privileges, and the fact
[48:54.120 --> 49:01.320] that rights do not come from a piece of paper. I believe in our Creator, Jesus Christ, and
[49:01.320 --> 49:07.360] I believe that we get our rights from Him. Not everyone believes in God, but folks, regardless
[49:07.360 --> 49:12.880] of what your spiritual beliefs are, you have to realize that our rights do not come from
[49:12.880 --> 49:18.160] a piece of paper. They are inherent. They are part of us. I believe they were given
[49:18.160 --> 49:23.480] to us by our Creator. And so I highly recommend that you get Michael's book Good to Be King
[49:23.480 --> 49:29.640] and get his new book. Also, from what I hear, do tell. There's some stories about Randy
[49:29.640 --> 49:32.640] in there, too. Randy and Deborah.
[49:32.640 --> 49:42.040] And me. Wow. Okay. So, Michael, we have you on for about 10 more minutes here. There's
[49:42.040 --> 49:47.280] all this big brouhaha going on, and I heard an interview today with Larry Pratt on Alex
[49:47.280 --> 49:52.600] Jones' show, and Larry was saying that he thinks they've pretty much reached the point
[49:52.600 --> 50:00.040] between his organization Gun Owners of America and the NRA that they have been able, at least
[50:00.040 --> 50:05.840] so far, to apply enough pressure. They're pretty sure that, at least from a legislative
[50:05.840 --> 50:14.200] point of view, they will be able to successfully block any legislation that could come down
[50:14.200 --> 50:19.800] the pike as far as banning specific type of weapons or this and that or the gun grabbing
[50:19.800 --> 50:25.120] or whatever, but that the real fight that they're going to be facing this year is this
[50:25.120 --> 50:31.960] business of background checks for everyone to do a private sale or even a gift. Like,
[50:31.960 --> 50:36.200] if a father wants to give a firearm to a son or something like that, they have to go to
[50:36.200 --> 50:40.960] a little background check, and so that appears to be what they're facing right now that they
[50:40.960 --> 50:46.520] believe is the biggest challenge, but that doesn't mean that Obama isn't going to try
[50:46.520 --> 50:51.400] to do something through executive order, and of course, through all the bureaucratic agencies,
[50:51.400 --> 50:56.280] and that doesn't mean that they're not going to try to regulate us to death and send us
[50:56.280 --> 51:03.320] through all these mental exams and this and that or get to the point that if you have
[51:03.320 --> 51:08.760] a parking ticket, you can't own a gun and this and that. What is your take on all of
[51:08.760 --> 51:15.240] this, Michael? Where do you really think this is all headed and what can we do to stop it
[51:15.240 --> 51:22.120] before it gets to the point of bloody revolution or do you think that's even possible?
[51:22.120 --> 51:30.760] It's not possible to stop it. These people, if a logical rational discussion was able
[51:30.760 --> 51:38.920] to solve the problem, we would have solved it already. It doesn't take a rocket scientist
[51:38.920 --> 51:46.160] to figure out that you have a right to keep in their arms. You've got a right to self-defense.
[51:46.160 --> 51:50.600] I'm not the only person out there talking about this stuff. There are lots of people
[51:50.600 --> 51:59.200] who have got really good information about the Constitution, so if information was going
[51:59.200 --> 52:07.520] to solve it, then it would have already. These people are never going to stop. They're never
[52:07.520 --> 52:12.520] going to give up. If you think you're going to sweet talk your way out of it, you are
[52:12.520 --> 52:19.000] terribly mistaken. The only way, the only way we're going to be able to stop these
[52:19.000 --> 52:25.600] people when they come, because they will, is to put them out of your misery. They are
[52:25.600 --> 52:30.600] coming to try to kill you and you've got to be ready to kill them first.
[52:30.600 --> 52:35.120] Michael, I like that. Don't put them out of their misery. Put them out of your misery.
[52:35.120 --> 52:41.840] That's a good one. Yeah. It's like, you know, this is going to hurt you a whole lot more
[52:41.840 --> 52:51.000] than it hurts me. Indeed. Well, Randy, what do you have to say about it? I was too busy
[52:51.000 --> 53:00.720] chuckling over that statement. I have to agree with it. I don't have guns, but I'm not against
[53:00.720 --> 53:05.840] guns. I want everybody to have guns. I've just spent too much time on the sharp end
[53:05.840 --> 53:14.440] of them. But having spent time on the sharp end of them, I understand the reality. And
[53:14.440 --> 53:20.320] these, Michael is exactly right. These folks want to get rid of guns and they don't want
[53:20.320 --> 53:28.600] to get rid of guns to keep guns from hurting people. They want to get rid of the guns for
[53:28.600 --> 53:36.240] the very reason our forefathers put the right to have the protected right to have the guns
[53:36.240 --> 53:42.520] in the Constitution. I've said that wrong. They forbade the government to interfere with
[53:42.520 --> 53:48.080] that right. And they didn't forbid the government to interfere with that right so that we could
[53:48.080 --> 53:55.320] use guns to protect ourselves. Michael, tell them what the reason they gave us the right
[53:55.320 --> 54:01.640] to keep guns is. Well, the reason they identified our right, they didn't give it to us, but
[54:01.640 --> 54:08.080] the reason they identified our right is so that we could defend ourselves from tyranny
[54:08.080 --> 54:18.120] in our own government. Now, one of the biggest problems is denial. Most of the people out
[54:18.120 --> 54:25.840] there are going, not my government. My government would never do that. Barack Obama, no, he's
[54:25.840 --> 54:33.400] a good guy. Well, that's what they thought in Germany, too. You know, they thought,
[54:33.400 --> 54:39.480] oh gosh, Adolf Hitler, what a good guy. He invented the Volkswagen. Now all of us can
[54:39.480 --> 54:47.680] drive around. He's on our side. He would never do anything to hurt us. And, you know, it
[54:47.680 --> 54:54.800] is that denial, that unwillingness to accept the bad things that are happening in your
[54:54.800 --> 55:05.440] own country that causes you to just idly sit by and not take the appropriate action. You
[55:05.440 --> 55:11.800] know, we've got to, you know, we've got to straighten up. We've got to admit to ourselves
[55:11.800 --> 55:19.480] that all these bad things are happening and it's our responsibility to fix it, hopefully
[55:19.480 --> 55:27.280] before it gets any more out of control. So, you know, I have been jumping up and down
[55:27.280 --> 55:33.280] and ranting and raving and trying to get people to see the light, you know, and people are
[55:33.280 --> 55:41.680] like, it's difficult for me to believe that anybody could be dumb enough not to see the
[55:41.680 --> 55:47.600] answer. And at this point, if you don't see the answer, it's because you don't want to
[55:47.600 --> 55:52.760] see the answer. And if you're working for the government, it's because you've got an
[55:52.760 --> 55:59.160] ulterior motive. Well, apparently a lot of people are seeing the answer, Michael, because
[55:59.160 --> 56:04.800] even as you pointed out yourself, since the Sandy Hook shooting took place, the 10 million
[56:04.800 --> 56:08.920] guns have been, have been sold and that's just what's on record through the next system.
[56:08.920 --> 56:15.360] So I think a lot of people are starting to see the light finally. It's about time. It's
[56:15.360 --> 56:21.360] like being on the stern of the Titanic with water up to your knees going, is there a problem
[56:21.360 --> 56:31.560] with the boat? Yeah, and there's only one lifeboat left and you better be on it. Better
[56:31.560 --> 56:41.080] be on it. Better get while the getting is good. So anyway, I hope that your listeners
[56:41.080 --> 56:45.800] are taking it seriously. We, you know, we laugh and joke and have a good time when we're
[56:45.800 --> 56:54.280] on the program, but this is a serious problem. It is a really serious problem. And I don't
[56:54.280 --> 57:03.440] want your listeners just going to sit by and think that we're only having fun. Well, you
[57:03.440 --> 57:07.960] know, we got to have a little gallows humor once in a while, as they say, because if you
[57:07.960 --> 57:12.520] don't laugh, eventually you're going to cry and then, you know, we do a lot of screaming
[57:12.520 --> 57:19.320] as well and ranting. But yeah, it is a serious problem and we've got to deal with it. And
[57:19.320 --> 57:24.440] I know how I'm dealing with it, Michael. I found it. I'm dealing with it the same way
[57:24.440 --> 57:28.200] that all these other people are dealing with it that have bought these 10 million guns.
[57:28.200 --> 57:32.600] So Michael, we've got about a little less than a minute left in this segment. Why don't
[57:32.600 --> 57:37.560] you plug your website and your book again one more time and give us some closing comments.
[57:37.560 --> 57:48.440]  The website is constitutionpreservation.org, not constitutional. It's just constitutionpreservation.org.
[57:48.440 --> 57:55.240] The name of the new book is Secret Positivity. You can read excerpts from the book and find
[57:55.240 --> 58:03.080] out how to acquire one. And, you know, when I was in the hospital in 2009 with my heart
[58:03.080 --> 58:09.000] broken, I got two shopping bags filled with get-well cards. Most of those cards said,
[58:09.000 --> 58:15.880] Michael, you can't die. You have to restore liberty as if it was my responsibility. Well,
[58:15.880 --> 58:25.160] my response to that is, when I die, liberty is no longer my problem. So, you know, your
[58:25.160 --> 58:30.840] listeners better buck up and start taking responsibility for their own liberty because
[58:30.840 --> 58:34.840] I'm not sure how long I'm going to be around after having written this book.
[58:34.840 --> 58:42.040] Look, we are all responsible for protecting our own liberty and working together we can
[58:42.040 --> 58:46.120] all protect our own liberty. Michael, thank you very much for joining us tonight.
[58:47.080 --> 58:49.480] I love you guys. Take care. Thanks for all the good work.
[58:50.360 --> 58:55.960] The Bible remains the most popular book in the world, yet countless readers are frustrated
[58:55.960 --> 59:01.160] because they struggle to understand it. Some new translations try to help by simplifying
[59:01.160 --> 59:06.120] the text, but in the process can compromise the profound meaning of the Scripture.
[59:07.080 --> 59:13.560] Enter the recovery version. First, this new translation is extremely faithful and accurate,
[59:13.560 --> 59:19.640] but the real story is the more than 9,000 explanatory footnotes. Difficult and profound
[59:19.640 --> 59:25.160] passages are opened up in a marvelous way, providing an entrance into the riches of the word
[59:25.160 --> 59:30.520] beyond which you've ever experienced before. Bibles for America would like to give you a
[59:30.520 --> 59:36.200] free recovery version simply for the asking. This comprehensive yet compact study Bible

[01:00:02.120 --> 01:00:07.160] Once upon a time, your printer was not a privacy risk, but today's printers are often connected
[01:00:07.160 --> 01:00:12.200] to Wi-Fi networks, making them a treasure trove for hackers. Under Catherine Albrecht,
[01:00:12.200 --> 01:00:19.320] back with details on the potential spy in your office. Next. Privacy is under attack. When you
[01:00:19.320 --> 01:00:24.360] give up data about yourself, you'll never get it back again. And once your privacy is gone,
[01:00:24.360 --> 01:00:30.520] you'll find your freedoms will start to vanish too. So protect your rights. Say no to surveillance
[01:00:30.520 --> 01:00:36.440] and keep your information to yourself. Privacy, it's worth hanging on to. This message is brought
[01:00:36.440 --> 01:00:42.520] to you by StartPage.com, the private search engine alternative to Google, Yahoo, and Bing.
[01:00:42.520 --> 01:00:49.720] Start over with StartPage. Hacking somebody through their printer sounds like an urban legend,
[01:00:49.720 --> 01:00:54.360] but now that printers have hard drives, email capacity, and are connected to the internet,
[01:00:54.360 --> 01:01:00.440] they've become attractive to attackers. Here's an example. Samsung printers sold up until October
[01:01:00.440 --> 01:01:06.520] 2012 had a security flaw that lets hackers send fake faxes, copy sensitive documents,
[01:01:06.520 --> 01:01:13.400] and spy on you or your company by eavesdropping on your Wi-Fi traffic. Yikes. Your best defense
[01:01:13.400 --> 01:01:18.920] is to change the default password, add antivirus and malware protection, and get that printer
[01:01:18.920 --> 01:01:24.360] behind a firewall. If you don't, you could be the next victim. I'm Dr. Catherine Albrecht
[01:01:24.360 --> 01:01:33.720] for StartPage.com, the world's most private search engine. Hey, wipe that grin off your face.
[01:01:34.280 --> 01:01:38.840] States across the U.S. are officially forbidding people from smiling when they get their driver's
[01:01:38.840 --> 01:01:44.840] license photos taken. I'm Dr. Catherine Albrecht. Back to tell you why the long faces of the DMV.
[01:01:44.840 --> 01:01:51.400] Next. Privacy is under attack. When you give up data about yourself, you'll never get it back again,
[01:01:51.400 --> 01:01:55.800] and once your privacy is gone, you'll find your freedoms will start to vanish too.
[01:01:56.440 --> 01:02:02.600] So protect your rights. Say no to surveillance and keep your information to yourself. Privacy,
[01:02:02.600 --> 01:02:07.240] it's worth hanging on to. This message is brought to you by StartPage.com,
[01:02:07.240 --> 01:02:13.240] the private search engine alternative to Google, Yahoo, and Bing. Start over with StartPage.
[01:02:15.320 --> 01:02:19.240]  If you're applying for a driver's license in a growing number of U.S. states,
[01:02:19.240 --> 01:02:24.680] don't even think about smiling. A big grin in your photo is now considered illegal.
[01:02:24.680 --> 01:02:29.800] That's because smiling defeats the software they use to map and measure people's features for facial
[01:02:29.800 --> 01:02:34.760] recognition. Officials say they're preventing identity theft by comparing new license photos
[01:02:34.760 --> 01:02:39.560] with existing ones. But of course, once they've got your scowling mug in their database,
[01:02:39.560 --> 01:02:44.760] they can use it to track you. All police need to ID you in a public place is to snap your
[01:02:44.760 --> 01:02:50.360] picture on the street and compare it against what's on file. How long does that take? The answer,
[01:02:50.360 --> 01:02:56.360] one second. I'm Dr. Catherine Albrecht for StartPage.com, the world's most private search engine.
[01:02:56.360 --> 01:03:08.840] Looking for some truth? You found it. LogosRadioNetwork.com.
[01:03:26.360 --> 01:03:52.840] Okay, folks, we are back. This is the rule of law
[01:03:52.840 --> 01:04:02.840] on the LogosRadio Network. LogosRadioNetwork.com. Tonight is Thursday, January 31st, 2013. Hard
[01:04:02.840 --> 01:04:09.560] to believe that the first month of 2013 has already blown by. And we just finished a fantastic
[01:04:09.560 --> 01:04:14.360] interview with Mr. Michael Badnarik. Folks, the phone lines are now open to talk about
[01:04:14.360 --> 01:04:18.520] any issue you would like to discuss on legal issues or if you want to talk about the gun
[01:04:18.520 --> 01:04:26.920] issues some more, 512-646-1984. But before we go on, I want to plug the fundraiser one more time
[01:04:26.920 --> 01:04:33.000] for those of you who weren't tuned in right at the top of the hour. We are in the midst of the
[01:04:33.000 --> 01:04:38.840] fundraiser. I have extended it to the end of February because this gun giveaway got dropped
[01:04:38.840 --> 01:04:47.640] in my lap around January 10th. And so I need to give folks time, have time to get the word out to
[01:04:47.640 --> 01:04:54.760] folks who haven't heard yet, that for $20, you will get your name put in the hat for the drawing
[01:04:54.760 --> 01:05:02.520] for the giveaway of the Rock River AR-15 donated by Zombie Killers Ammo and Guns in Corpus Christi,
[01:05:02.520 --> 01:05:11.720] Texas. And also the second place prize is the lower receiver for an AR-15 made by Spikes Tactical.
[01:05:11.720 --> 01:05:17.560] And that is being donated by Central Texas Gun Works, Michael Cargill, right here in Austin,
[01:05:17.560 --> 01:05:24.520] Texas. He is the gentleman that is basically leading the tirade against Groupon because of what
[01:05:24.520 --> 01:05:30.040] they did to him over his concealed handgun classes. And it's just absolutely ridiculous.
[01:05:30.040 --> 01:05:37.720] I mean, the man is teaching classes. He offers these classes for free, you know, beginner pistol
[01:05:37.720 --> 01:05:43.560] classes, advanced pistol classes. He offers some classes for free to people who really,
[01:05:43.560 --> 01:05:49.560] really need them, especially like, you know, women who may be extremely financially challenged
[01:05:49.560 --> 01:05:55.720] and they want to learn how to defend themselves. And I mean, this is somebody who is here standing
[01:05:55.720 --> 01:06:01.400] up to teach law-abiding citizens how to follow the gun laws in Texas to help them get a concealed
[01:06:01.400 --> 01:06:09.560] handgun permit, to learn mediation techniques and how to diffuse the situations without it
[01:06:09.560 --> 01:06:13.800] getting to the point of firearms, all these kinds of things, teaching people responsible
[01:06:13.800 --> 01:06:19.160] firearm ownership and Groupon wants to shut this sort of thing down. I mean, this is absolutely
[01:06:19.160 --> 01:06:26.120] ridiculous. So at any rate, he is also sponsoring this giveaway and he is donating the Spikes
[01:06:26.120 --> 01:06:31.720] Technical AR-15 lower receiver. That is the second prize. Of course, the grand prize is the
[01:06:31.720 --> 01:06:37.560] Rock River AR-15 there for $20. You get your name in the hat. If you want to donate more,
[01:06:37.560 --> 01:06:43.480] $100. You get your name in the hat five times. We've got the DVD burners, the Purium gift cards,
[01:06:43.480 --> 01:06:48.840] the colloidal silver, the ionic silver. So, folks, please go to LogosRadioNetwork.com.
[01:06:48.840 --> 01:06:55.080] We're trying to raise $10,000. My original goal was to raise $7,000 by the end of January.
[01:06:55.080 --> 01:07:01.320] That's not happening. We have about $5,700, almost $6,000 with what's come in the mail so far,
[01:07:01.960 --> 01:07:06.040] not quite making our original goal of $7,000 by the end of January.
[01:07:06.040 --> 01:07:10.520] My real goal, I really wanted to try to raise $10,000. I wasn't sure if I'd be able to do it,
[01:07:10.520 --> 01:07:14.360] so I set the goal a little bit lower. But now that we've got all these perks and all these
[01:07:14.360 --> 01:07:18.760] giveaways and the firearm and everything, I've decided to increase the goal to $10,000, which
[01:07:18.760 --> 01:07:24.840] is what I really need to give the network a good shot in the arm so that we can pay back
[01:07:24.840 --> 01:07:30.440] our loans so that we can upgrade our equipment so that we can put a little aside to pay these
[01:07:30.440 --> 01:07:35.400] ongoing operating expenses that keep increasing. Folks, we need to have a little buffer. We need
[01:07:35.400 --> 01:07:41.240] to have a little safety zone here for the network because for years we have just been,
[01:07:42.200 --> 01:07:46.200] from week to week sometimes, not knowing how we're going to pay the bills.
[01:07:46.920 --> 01:07:54.200]  I used to work a full-time job as a physical therapist and I quit my full-time job. I had to,
[01:07:54.200 --> 01:07:59.480] in order to have time to run this network, and basically my husband, Jerry Stevens,
[01:07:59.480 --> 01:08:05.240] piano tuner, piano technician, he is able to take care of us. And for the most part,
[01:08:05.240 --> 01:08:09.880] he's funding the bills of the network too. But folks, it just gets to be too much for us sometimes.
[01:08:10.440 --> 01:08:15.800] I'm not asking for a handout. I want to make that clear. I'm not asking for money to pay my own
[01:08:15.800 --> 01:08:21.960] bills. My husband can take care of us, but it just gets to be a little bit too much sometimes
[01:08:21.960 --> 01:08:30.200] for Jerry and for Randy and Eddie to have to pay for everything ourselves. We do have the sponsors,
[01:08:30.200 --> 01:08:36.040] but most of the sponsors are on commission. And so that means if folks don't buy the products of
[01:08:36.040 --> 01:08:41.640] our sponsors, we don't get paid. And that means we have to pay for it ourselves. And it just gets
[01:08:41.640 --> 01:08:46.520] to be a little much for us that all the time, all the time, it's like, how are we going to pay the
[01:08:46.520 --> 01:08:51.400] bills this month? How are we going to pay the bills this month? Folks, there's no way for us to be
[01:08:51.400 --> 01:08:57.720] able to improve the quality, to add shows, to get new servers. Equipment starts to fall apart.
[01:08:57.720 --> 01:09:02.040] We have to upgrade equipment. I had a workstation blow up a few months ago. It was extremely
[01:09:02.040 --> 01:09:06.840] expensive to replace because I had to go to fries and build a computer over the weekend. I couldn't
[01:09:06.840 --> 01:09:12.520] take my time and shop for good deals on the internet and stuff like that. Folks, we need to have a
[01:09:12.520 --> 01:09:17.800] little buffer put aside. We've spent all our savings. Jerry and I and Randy and Eddie,
[01:09:17.800 --> 01:09:23.960] we have blown our savings on the network. We're going day to day here and we need to have a little
[01:09:23.960 --> 01:09:29.480] safety zone so that we can stay on the air and not have to worry about these things so much. So
[01:09:29.480 --> 01:09:34.680] folks, please help us reach our goal of $10,000. It's really not that much. I mean, most networks,
[01:09:34.680 --> 01:09:40.200] it costs that much to run their network every month. I'm doing things on a shoestring budget here.
[01:09:40.200 --> 01:09:47.400] And so I think we're doing pretty well to get you guys and gals out there, the quality of service
[01:09:48.200 --> 01:09:53.560] for the price. I don't charge for the archives. We don't charge for the stream. We're giving away
[01:09:53.560 --> 01:09:59.320] free legal advice on the air. We're doing everything we can to get you guys the best quality
[01:09:59.320 --> 01:10:05.480] information for free as much as possible, but we do need your help to stay on the air. So hey,
[01:10:05.480 --> 01:10:10.280] take advantage of the perks. You get the free gift cards for the health food. You get your free
[01:10:10.280 --> 01:10:16.280] DVD burner. If you need to upgrade your computer too, you get the colloidal silver, the ionic
[01:10:16.280 --> 01:10:23.960] silver preserve your health. You get your shot at winning firearm. So please help us to help you.
[01:10:23.960 --> 01:10:30.120] All right. That's all I'm going to say about that. LogosRadioNetwork.com is where to go to ship in.
[01:10:30.120 --> 01:10:33.320] All right. We've got some calls now. Randy, would you like to take some calls?
[01:10:33.320 --> 01:10:41.400] Absolutely. Okay. We've got Steve in New Mexico. Steve, thanks for calling in. What is your question
[01:10:41.400 --> 01:10:50.040] for us tonight? Thanks. A few months ago, I spoke with you guys about if you're a victim of a crime
[01:10:50.040 --> 01:10:57.640] like you've had your rights violated or something like that, you can send a document to the grand
[01:10:57.640 --> 01:11:04.040] jury for their consideration. And I'm in New Mexico, and I've talked to a few people about
[01:11:04.040 --> 01:11:11.240] this, and I think the way you guys recommended was to send a certified mail to the individual grand
[01:11:11.240 --> 01:11:20.840] jurors. And the people here are telling me that when the grand jury receives it or when it goes
[01:11:20.840 --> 01:11:26.680] there, that the attorney will seize the document and prevent the grand jurors from reading it.
[01:11:26.680 --> 01:11:33.640] Is that correct? That's the standard procedure. Okay. So is there any way to get
[01:11:35.640 --> 01:11:43.080] the complaint before the grand jury bypassing the attorneys from seeing it? Because the attorneys
[01:11:43.080 --> 01:11:48.600] are... Not at the moment, not unless we can get laws changed. But there are methods. We have all
[01:11:48.600 --> 01:12:00.200] the checks and balances we need. If a prosecuting attorney intercepts a mailed document that is
[01:12:00.200 --> 01:12:13.000]  mailed to a specific person, that comes under, I think it's 1343, title 18, USC 1343, mailed
[01:12:13.000 --> 01:12:22.840] tampering with the mail. Okay. And the feds won't smile on that kind of behavior. Okay. Is it possible
[01:12:22.840 --> 01:12:28.280] just like... I happen to know where the grand jury convenes. Is it possible just to walk to that
[01:12:28.280 --> 01:12:37.000] location and try to appear before the grand jury? Okay. Here's the way I do that. Okay. I walk up to
[01:12:37.000 --> 01:12:44.360] the bailiff, who there'll be a bailiff standing in front of the door of the grand jury. And the
[01:12:44.360 --> 01:12:49.800] first thing you do is you tell him your name. You don't want him asking you questions. Okay. I tell him,
[01:12:50.440 --> 01:12:56.040] my name is Randall Kelton, instruct the foreman that I have business with the grand jury. Okay.
[01:12:56.840 --> 01:13:05.000] And he will always say, may I tell him the nature of the business? And I say, yes, you may give him
[01:13:05.000 --> 01:13:11.880] this. And if a prosecutor attorney comes along and says anything, ask the bailiff to arrest him
[01:13:11.880 --> 01:13:19.480] for jury tampering. This is not his business. If the bailiff wants to give the document to the
[01:13:19.480 --> 01:13:28.920] grand jury, to the prosecutor, I was in Charleston County, Texas, walked up to the bailiff, the
[01:13:28.920 --> 01:13:34.680] bailiff knew precisely who I was. I told him, my name is Randall Kelton, instruct the foreman that I
[01:13:34.680 --> 01:13:39.320] have business with the grand jury. May I tell him the nature of the business? Yes, you may. I handed
[01:13:39.320 --> 01:13:44.760] him these documents and he stood there and he kind of looked back and forth for a moment. And I said,
[01:13:46.360 --> 01:13:54.760] I know what you're thinking. You're thinking I should call the prosecuting attorney and see what
[01:13:54.760 --> 01:14:02.520] he wants me to do. Well, those complaints you have in your hand are against the prosecuting attorney.
[01:14:03.880 --> 01:14:10.840] If you call the prosecutor, I will consider that an act of obstruction of justice tampering with
[01:14:10.840 --> 01:14:19.560] a witness. And my next set of complaints will be against you. He said, are you threatening me?
[01:14:19.560 --> 01:14:29.320] Oh, absolutely not. I promise you, if you don't give that to the foreman of the grand jury, I will
[01:14:29.320 --> 01:14:38.760] be back with criminal charges against you. He did, he gave the grand jury. And I wound up presenting
[01:14:38.760 --> 01:14:46.840] the district attorney to the grand jury. Now, in order to facilitate this, I had to set them up.
[01:14:46.840 --> 01:14:55.880] I first sent criminal complaints to the prosecuting attorney. In Texas, we have a special statute,
[01:14:55.880 --> 01:15:01.560] 2.03, which directs the prosecuting attorney in the matter of a complaint against a public
[01:15:01.560 --> 01:15:07.000] official to present the complaint to the grand jury. You probably don't have that in Mexico.
[01:15:07.800 --> 01:15:13.960] So what you do instead is you mail the documentation to the grand jury and
[01:15:13.960 --> 01:15:22.120] on the top of it, you put a cover letter to the foreman asking the foreman to initial this document
[01:15:22.120 --> 01:15:28.440] and date it and return it to you in the included stamp selfish envelope so that you will know that
[01:15:28.440 --> 01:15:35.720] he actually got the document because the prosecuting attorney has a real bad habit of tampering with
[01:15:35.720 --> 01:15:43.480] you with mail directed to a grand jury member. So if you don't get that letter back within a week,
[01:15:45.720 --> 01:15:53.800] then you have reasonable probable cause to believe that someone at the courthouse tampered with the
[01:15:53.800 --> 01:16:01.800] U.S. mail. And while that is a federal crime, it's also an act of official oppression or official
[01:16:01.800 --> 01:16:10.120] misconduct and most every state will have that because that statute reflects 18 U.S. Code 242
[01:16:11.400 --> 01:16:20.120] and when the states all adopted the model, the penal code and criminal code criminal procedure,
[01:16:20.120 --> 01:16:25.640] then that's in most every set of code. And there's always going to be a code for official misconduct.
[01:16:25.640 --> 01:16:32.680] So you charge the prosecuting attorney with official misconduct for secreting government
[01:16:32.680 --> 01:16:38.760] documents, that's probably another one you could charge from the person or office is directed to.
[01:16:40.040 --> 01:16:43.560] You make up the complaint against the prosecutor and go down there with the complaint against the
[01:16:43.560 --> 01:16:49.160] prosecutor. When he tries to interfere with you, then you file against him. Hang on, we're about
[01:16:49.160 --> 01:16:53.800] to go to break. This is Randy Kelton, Tim Stevens, Eddie Craig, and Rue of Law Radio,

[01:19:26.840 --> 01:19:51.560] Okay, we are back. Randy Kelton, Debra Stevens, Rue Blau Radio. We were talking to Stephen,
[01:19:51.560 --> 01:19:57.320] New Mexico. Stephen, we're going out. You were trying to make a comment. Oh, yeah. Okay. So,
[01:19:57.320 --> 01:20:02.840] I just want to summarize. So, tomorrow, I happen to know where they'll be convening. So,
[01:20:03.480 --> 01:20:09.560] I'm going to go to that location with my complaints and there's going to be a bailiff there.
[01:20:10.120 --> 01:20:13.800] And then I'm going to tell the bailiff to instruct the foreman that I have business with
[01:20:13.800 --> 01:20:18.040] a grand jury. He's going to say, what's the nature of the business? I hand him the criminal
[01:20:18.040 --> 01:20:27.160] complaints and tell him to give that to the grand jury. And if he refuses, it'd be obstruction of
[01:20:27.160 --> 01:20:35.000] justice. If I'm somehow not successful, you're saying to use certified mail using... Yes,
[01:20:35.000 --> 01:20:43.960]  let me explain....four person with a self-adempt envelope having him initial a sheet so that I
[01:20:43.960 --> 01:20:52.120] know that he got the complaints. Yeah, you put that in the package. Make sure it's in a sealed
[01:20:52.120 --> 01:20:59.240] folder. Okay. You do not want the bailiff thumbing through it. Okay. And if the bailiff interferes
[01:20:59.240 --> 01:21:04.840] with you, don't argue with the bailiff and, above all, do not give the bailiff any legal advice.
[01:21:06.280 --> 01:21:11.400] This may take you a little while. It takes a few steps and a little time, but the setup is very
[01:21:11.400 --> 01:21:19.720] powerful. You go and give it to the bailiff. If the bailiff refuses, they don't argue with him,
[01:21:19.720 --> 01:21:26.440] just go away. Then prepare a set of criminal complaints against the bailiff, accusing the
[01:21:26.440 --> 01:21:36.360] bailiff of jury tampering and obstruction of justice. And you come back the next time they meet
[01:21:36.360 --> 01:21:47.480] and you ask the bailiff to secure another bailiff. As you have documents for the grand jury
[01:21:48.360 --> 01:21:53.160] and you need another bailiff other than him to give them to the former to the grand jury.
[01:21:54.600 --> 01:21:59.000] And he's going to say, why is that? You're going to say, well, these complaints are against you.
[01:21:59.000 --> 01:22:09.560] So what does he do now? Does he shield the grand jury from hearing criminal complaints
[01:22:09.560 --> 01:22:20.040] against himself? See the problem? You give him a conundrum. So he's likely to go get the prosecuting
[01:22:20.040 --> 01:22:30.840] attorney. And the prosecuting attorney is likely to come and give you sage advice. Oh, you should
[01:22:30.840 --> 01:22:40.760] do this, that or the other. And you just thank the grand district attorney profusely for his sage
[01:22:40.760 --> 01:22:51.000] advice and then file against him. Okay. So what they do if you don't argue with them,
[01:22:52.760 --> 01:23:01.800] don't give them legal advice and always hope they don't do what you ask them to do. Okay.
[01:23:02.840 --> 01:23:07.640] If you hope they're going to do what you ask them to, you'll be disappointed.
[01:23:07.640 --> 01:23:14.360] If you hope they don't do it so you can kick them in the professional teeth,
[01:23:15.400 --> 01:23:20.760] they will never disappoint you. Okay. And you just turn the crank on them.
[01:23:21.480 --> 01:23:28.040] All right. So give it a try. Just try not to have too much fun with it. Never,
[01:23:28.920 --> 01:23:36.840] ever give them legal advice. Okay. Tell them what you want to do when they tell you you can't do it.
[01:23:36.840 --> 01:23:42.600] Just say, okay. And then you go prepare charges against them and come back. And
[01:23:43.640 --> 01:23:50.920] this will keep you from, keep them from being able to manipulate you into a confrontation.
[01:23:51.560 --> 01:23:59.480] Okay. And you will always lose the confrontation. I'm sorry. Federal grand jurors, they're on duty
[01:23:59.480 --> 01:24:04.840] for 18 months. Is that correct? I think so. Are you filing this at a federal grand jury?
[01:24:04.840 --> 01:24:11.000] Yeah, I'm doing both. I'm going to go to federal and county. I suggest you do the federal different.
[01:24:11.800 --> 01:24:18.440] Okay. With the federal, you don't go there. Do everything by mail. Don't ever let them see you.
[01:24:19.080 --> 01:24:29.000] Okay. Send it certified, registered, restricted, form into the grand jury.
[01:24:29.000 --> 01:24:35.960] All right. And in this one, you put a letter that asks the grand jury foreman
[01:24:35.960 --> 01:24:42.920] to initial this letter and send it back to you. Stipulate that you do not want him to sign it
[01:24:43.800 --> 01:24:48.520] because the U.S. attorney has a rubber stamp with his name on it
[01:24:50.120 --> 01:24:55.720] that he uses to stamp superseding indictments when he secrets those from grand jurors.
[01:24:55.720 --> 01:25:01.000] And you do not want the U.S. attorney rubber stamping this document when he,
[01:25:01.000 --> 01:25:09.560] if he intercepts this package. Okay. So the U.S. attorney will get it, open it,
[01:25:10.360 --> 01:25:18.600] read that and say, oops, this guy set me up. Yes, matter of fact, we did. And then if you
[01:25:18.600 --> 01:25:26.920] don't get the letter back within a week, then you send a complaint to a local federal judge against
[01:25:26.920 --> 01:25:33.160] the district attorney accusing the district attorney of tampering with the mail and tampering
[01:25:33.160 --> 01:25:40.760] with the government document and obstruction of justice. Okay. And then you wait a week and
[01:25:40.760 --> 01:25:48.520] send a letter to the grand jury asking the grand jury or telling the grand jury that you have
[01:25:48.520 --> 01:25:55.240] evidence of crime against the district judge for not presenting your complaints to the grand jury
[01:25:56.360 --> 01:26:02.680] against the prosecuting attorney. Okay. And they will see that you're just following steps.
[01:26:02.680 --> 01:26:08.600] It makes everything political. Okay. They see somebody out there setting them up. And the guy
[01:26:08.600 --> 01:26:14.360] you originally or whoever it was you originally complained about, he's going to have himself
[01:26:14.360 --> 01:26:21.480] a lot of trouble. Right. Because it's all political and this will create a lot of political pressure
[01:26:22.120 --> 01:26:29.880] and they may actually pursue your original. Can't guarantee it, but this is the best strategy I know
[01:26:29.880 --> 01:26:38.440] us. Randy, what about do prosecutors and judges have, does their immunity apply just civilly or
[01:26:38.440 --> 01:26:45.000] does it apply if they have criminal charges against them as well? There is absolutely
[01:26:45.960 --> 01:26:54.360] no immunity from criminal prosecution of any kind written into any law. Period.
[01:26:55.640 --> 01:27:02.840] All right. So that immunity, it is immunity that the judges crafted out for themselves.
[01:27:02.840 --> 01:27:09.560] Okay. But it only goes to civil litigation. It does not go to criminal. Okay.
[01:27:11.640 --> 01:27:16.360] Okay. Thanks for your help. And I'll keep you guys updated and let you know how it goes.
[01:27:16.920 --> 01:27:24.760] Wonderful. Thank you. Okay. We're going to go to Danny in Illinois. Hello, Danny. I understand
[01:27:24.760 --> 01:27:34.920] you have a IRS question. That's correct. Okay. Keep in mind IRS is not my area. I've done some
[01:27:34.920 --> 01:27:40.600] research in it, but not enough to be able to speak definitively to the issue. Right.
[01:27:41.480 --> 01:27:46.520] All this has to do with the documents being filed and with the county clerk.
[01:27:46.520 --> 01:27:58.040] You're talking about a IRS lien? Yeah, a notice of lien. Okay. Notice of lien. Well,
[01:27:58.040 --> 01:28:05.320] that's, you can't actually file a lien. We used to have guys in the Patriot community
[01:28:05.320 --> 01:28:09.880] running around saying, show me the lien, show me the lien. Well, you can't show somebody a lien.
[01:28:09.880 --> 01:28:16.760] A lien is not something that has physical existence. A lien is a situation that is
[01:28:16.760 --> 01:28:25.000] created as a matter of law. So you can only give notice that the lien exists as a matter of law.
[01:28:25.000 --> 01:28:33.320] So it is a notice of lien and the IRS does not have to follow the state filing requirements.
[01:28:33.320 --> 01:28:40.440] All of the states have entered into a special agreement with the IRS that allows the IRS
[01:28:41.320 --> 01:28:47.320] to file these notices of liens the way they do. And all those folks who are raising those
[01:28:47.320 --> 01:28:54.040] arguments haven't read the code. Actually, Deborah, you're there. You're the one that found this.
[01:28:54.040 --> 01:29:00.280] Yeah, I did find that. That was many years ago when we were in Pennsylvania. There are two different
[01:29:00.280 --> 01:29:07.880] statutes that govern filing notices of liens, notices of liens, excuse me, with these county
[01:29:07.880 --> 01:29:16.440] clerks. One of the statutes applies to everybody but the IRS or everybody but federal entities.
[01:29:16.440 --> 01:29:24.200] And the other statute governs the IRS and other federal entities. It's a special statute. I forgot
[01:29:24.200 --> 01:29:30.200] what it's called, something about the uniform federal tax lien statute or something like
[01:29:30.200 --> 01:29:39.320] that. And all of the states pretty much have decided to comply with this statute and to enact
[01:29:39.320 --> 01:29:47.000] it into law. And so the IRS, basically, they are in compliance of law. They don't have to go through
[01:29:47.000 --> 01:29:52.200] all the hoops that most people have to or most entities have to go through to file notices of
[01:29:52.200 --> 01:29:57.800] liens. So that's that. All right, we're going to break right now, Danny. Hold on. We'll be right back.
[01:29:57.800 --> 01:30:05.080] This is a rule of law. A noble lie, Oklahoma City, 1995 will change forever the way you look at the
[01:30:05.080 --> 01:30:09.640] true nature of terrorism. Based on the damage pattern to the building, but the government
[01:30:09.640 --> 01:30:15.320] seems impossible. The grand jury did not want to hear anything I had to say. The decision was made
[01:30:15.320 --> 01:30:21.400] not to pursue any more of those individuals. Some of these columns were ripped up, shredded,
[01:30:21.400 --> 01:30:26.520] tossed around. The people that did the things they did knew doggone well what they were doing.
[01:30:26.520 --> 01:30:33.800] Expose the cover up now at thenovelive.com. The rule of law radio network is proud to present

[01:32:55.240 --> 01:33:07.480] Okay folks we are back, this is the rule of law, Randy Kelton, Eddie Craig, Deborah Stevens,
[01:33:07.480 --> 01:33:13.440] and yeah, sorry to bust everyone's bubble on this issue about the notices of tax lien.
[01:33:13.440 --> 01:33:20.400] I've heard this argument for a long time and when we were up in Pennsylvania, one of our
[01:33:20.400 --> 01:33:27.800] clients was wanting us to look into this to see if we could basically get these notices
[01:33:27.800 --> 01:33:34.360] of lien and these liens voided because they didn't follow the statute governing the proper
[01:33:34.360 --> 01:33:38.280] procedure for filing notices of lien with the county.
[01:33:38.280 --> 01:33:44.720] And so we just, Randy and I marched down the law library and started doing some research
[01:33:44.720 --> 01:33:53.840] and, you know, I found the statute in less than 10 minutes, okay, and it really wasn't
[01:33:53.840 --> 01:33:59.280] that hard to find, I mean it wasn't that hard to find at all, I mean I had to look through
[01:33:59.280 --> 01:34:06.960] about three or four books on tax liens and liens in general and I mean it was right there
[01:34:06.960 --> 01:34:12.880] at the table of contents and this wasn't even on the internet and so folks, to me this is
[01:34:12.880 --> 01:34:20.520] a lesson in people find what they want to find and I'm not talking about me, it's like
[01:34:20.520 --> 01:34:27.560] people have select, what I call selective finding, they want reality to be a certain
[01:34:27.560 --> 01:34:33.920] way and so they'll look for case law, alright hold on, Randy I think the cops are coming
[01:34:33.920 --> 01:34:40.480] for you, okay, people will look and I'm not saying everyone but I've seen that this is
[01:34:40.480 --> 01:34:45.360] a tendency sometimes with pro se litigants.
[01:34:45.360 --> 01:34:53.000] They look for statutes and they look for case law to back up their position and there's
[01:34:53.000 --> 01:34:58.760] nothing wrong with that, you want to find statute and case law that backs up your position
[01:34:58.760 --> 01:35:03.920] but more than that, folks, you should be looking for case law and statute that shoots down
[01:35:03.920 --> 01:35:06.000]  your position, okay.
[01:35:06.000 --> 01:35:12.280] You have to be objective when you're doing research on an issue because I'll tell you
[01:35:12.280 --> 01:35:19.160] what, it's a heck of a lot better to get shot down in the law library than to get shot down
[01:35:19.160 --> 01:35:25.320] in court and so just because you find something that you think backs up your position, don't
[01:35:25.320 --> 01:35:30.680] start jumping for joy and thinking that you got your case beat, you better look twice as
[01:35:30.680 --> 01:35:35.480] hard or ten times as hard for case law and statute that will shoot down your position,
[01:35:35.480 --> 01:35:40.000] you better find it yourself because believe me, if you can find it, the other side's already
[01:35:40.000 --> 01:35:43.480] found it so that's all I have to say on that issue, Randy.
[01:35:43.480 --> 01:35:52.160] Yeah, I've been there quoting this, a statute and the attorney, this was the prosecutor attorney,
[01:35:52.160 --> 01:35:59.520] it was a, it wasn't a criminal case, it was a bond issue for a friend of mine had a bonding
[01:35:59.520 --> 01:36:09.640] company and it had been repealed the year before, that really, really sucked but I
[01:36:09.640 --> 01:36:15.440] learned a lesson from that, he really made me look like a chop and laughed and snickered
[01:36:15.440 --> 01:36:24.640] the whole time, I don't let that happen to me anymore, check your facts, never make a
[01:36:24.640 --> 01:36:33.320] proactive statement of fact that you cannot, that you do not have evidence to back up,
[01:36:33.320 --> 01:36:40.480] never make a proactive statement of law out of your own mouth, you must make it out of
[01:36:40.480 --> 01:36:49.320] the mouth of the courts, those two adages will protect you, it's difficult to do that,
[01:36:49.320 --> 01:36:57.840] maybe you have to do your homework but that's how things have to work, okay.
[01:36:57.840 --> 01:37:05.000] All right, Danny, does that help and we do have one, two, three, four other callers on
[01:37:05.000 --> 01:37:09.560] the line so let's try to move quickly folks, we've only got one and a half segments left,
[01:37:09.560 --> 01:37:11.560]  go ahead Danny.
[01:37:11.560 --> 01:37:16.800] I got that information from you the last time I talked to you but anyway you let everybody
[01:37:16.800 --> 01:37:24.800] else know about it, now the question I wanted to ask you is once they put phylo lean, it's
[01:37:24.800 --> 01:37:33.920] for a certain amount, is that something that's flexible, this would be something that's possible,
[01:37:33.920 --> 01:37:41.800] it's flexible, phylo lean for a certain amount, then like a month later can they say well
[01:37:41.800 --> 01:37:47.400] now the lean is for this amount and without anything else, no they would have to refile,
[01:37:47.400 --> 01:37:54.080] well exactly that's what happened, yeah they can change the amount, no okay hold on, hold
[01:37:54.080 --> 01:38:05.760] on they can refile and change the amount, the claim they make against you, it can change,
[01:38:05.760 --> 01:38:15.320] did they exercise the lean, they froze my accounts, okay they sold your property for,
[01:38:15.320 --> 01:38:24.760] no they, okay that's a levy, that's not a lean, okay listen, the lean amount does not
[01:38:24.760 --> 01:38:31.400] necessarily have anything to do with the amount that you owe them at the moment, when they
[01:38:31.400 --> 01:38:38.520] filed the lean, they filed the lean based on what was owed at that moment, your indebtedness
[01:38:38.520 --> 01:38:50.720] may increase and if they liquidate the property, they can take from the property, well it doesn't
[01:38:50.720 --> 01:38:56.760] matter, they can take from whatever you would receive for the property, if they sell the
[01:38:56.760 --> 01:39:03.480] property, whatever they receive from the property, they can take from it what you owe them, they
[01:39:03.480 --> 01:39:08.200] can take the amount of the lean but if you owe them more, they can still take that if
[01:39:08.200 --> 01:39:13.120] you have it, they filed the lean because you probably didn't have enough in your accounts
[01:39:13.120 --> 01:39:19.080] for them to come and take it all, so they filed the lean, it is on my accounts, it's
[01:39:19.080 --> 01:39:25.880] not on my property, okay, it's a notice, it's a notice of federal tax lean and it's for
[01:39:25.880 --> 01:39:32.880] a certain amount and then when I got the information from the bank just a day or two ago, it's
[01:39:32.880 --> 01:39:42.280] for quite a bit more, okay, so that's a lean against you personally, yes, oh okay, well
[01:39:42.280 --> 01:39:48.760] they can take anything you got for the amount that you owe them, the IRS can do that, they
[01:39:48.760 --> 01:39:55.560] don't have to have it in the form of a filed lean, all they have to do is have a tax levy,
[01:39:55.560 --> 01:40:01.040] okay, and the signature is not the same as the name that's underneath it, I guess that
[01:40:01.040 --> 01:40:07.840] doesn't mean anything, that doesn't mean anything, they can have more than one person
[01:40:07.840 --> 01:40:14.240] that has power of attorney for the IRS, typically all those names are just, they're fake names
[01:40:14.240 --> 01:40:20.240] anyway, they're names of computers and that's all legal then, I see, no it's not legal
[01:40:20.240 --> 01:40:29.520] but you can't prove it, if you could prove that that signatory didn't exist then you
[01:40:29.520 --> 01:40:35.800] could claim tampering with the government document but there's a problem there, that's
[01:40:35.800 --> 01:40:43.000]  a not a fight, pick your fights you're careful, that's a frivolous fight, it'll get you nowhere,
[01:40:43.000 --> 01:40:48.080] even if you win it you haven't won anything, because if the guy didn't exist who are you
[01:40:48.080 --> 01:40:52.760] going to go after? Yeah, one of the, last time I talked to you
[01:40:52.760 --> 01:40:59.040] said that he'd be available on Monday but he ended up not, ended up having a, who would
[01:40:59.040 --> 01:41:03.320] be available on Monday, oh David, but he's there now, you mean Eddie?
[01:41:03.320 --> 01:41:10.760] David Lewis, well what is David's number? Well we can't get out people's numbers on
[01:41:10.760 --> 01:41:17.920] the air, send me an email, I'll send it to you, so send you an email to just ask for
[01:41:17.920 --> 01:41:20.800] David's number? Yeah, yeah, just go to any restaurant in
[01:41:20.800 --> 01:41:24.920] Austin and look on the toilet walls. Oh, come on.
[01:41:24.920 --> 01:41:29.360] Send me an email at Randy at Ribbidi's in real estate.
[01:41:29.360 --> 01:41:32.000] Alright, thanks for your help. Okay, thank you.
[01:41:32.000 --> 01:41:34.400] You're welcome. Alright, we need to blaze through these
[01:41:34.400 --> 01:41:40.440] calls Randy, we're coming to the end of this segment, we got David in Texas, David, thank
[01:41:40.440 --> 01:41:44.240] you for calling, what is your question tonight, I believe it's about a PI, go ahead.
[01:41:44.240 --> 01:41:49.760] Yes, thank you for taking my call, I'm going to just kind of give you the outskirts over
[01:41:49.760 --> 01:41:58.240] here, I had a PI back in July and I did prostay on there and this is before listening to you
[01:41:58.240 --> 01:42:07.520] guys, I entered a plea of not guilty, represented myself before a jury and ended up of course
[01:42:07.520 --> 01:42:12.520] being found guilty on it, being fined and there was three different charges, one was
[01:42:12.520 --> 01:42:19.080] a city, that one was county and the other two were city, a PI walking in a roadway
[01:42:19.080 --> 01:42:25.000] where a public sidewalk was available and the other was resisting arrest, which is the
[01:42:25.000 --> 01:42:31.680] county charge, then it was dropped to interfering with a public official's duties and now I'm
[01:42:31.680 --> 01:42:38.560] scheduled to, I wanted to, I guess the court sent out a letter saying I need to show up,
[01:42:38.560 --> 01:42:43.440] I showed up and- Okay, okay, wait, you need to move quickly, we're running out of time.
[01:42:43.440 --> 01:42:50.680] Okay, well they informed me that the option that they were giving me was a $375 fine
[01:42:50.680 --> 01:42:57.600] and 60 days in jail for the county charge on that and my question is, what do I need
[01:42:57.600 --> 01:43:01.640] to go in there, because I'm scheduled to go in there on February the 12th and enter
[01:43:01.640 --> 01:43:05.960] a plea and I don't want to go in there and enter a plea because I know it was a ring
[01:43:05.960 --> 01:43:09.440] circus whenever I went in there and entered monthly and went through that day for the
[01:43:09.440 --> 01:43:10.440]  PI.
[01:43:10.440 --> 01:43:14.040] Oh, are you asking for a whole lot more than we can give you?
[01:43:14.040 --> 01:43:19.680] You may want to call back on Monday, David, is this hearing that's scheduled for you
[01:43:19.680 --> 01:43:24.720] to quote unquote enter a plea, is this the, would be the first appearance that you would
[01:43:24.720 --> 01:43:25.920]  make in the case?
[01:43:25.920 --> 01:43:30.120] Well, the first appearance was them just telling me what was initially going to be
[01:43:30.120 --> 01:43:31.120]  offered.
[01:43:31.120 --> 01:43:32.120] Well, is this going to be a trial?
[01:43:32.120 --> 01:43:36.560]  Right, well, I don't feel that I'm guilty on it.
[01:43:36.560 --> 01:43:37.560]  Well, I don't know.
[01:43:37.560 --> 01:43:38.560]  Yes or no?
[01:43:38.560 --> 01:43:39.560]  Is it a trial or not?
[01:43:39.560 --> 01:43:40.560]  What's coming up?
[01:43:40.560 --> 01:43:41.560]  No, it's not.
[01:43:41.560 --> 01:43:46.640] Okay, then you don't have to enter a plea because the statute says that the judge doesn't
[01:43:46.640 --> 01:43:51.400] even have jurisdiction to take a plea until after a jury has already been impaneled.
[01:43:51.400 --> 01:43:55.000] David, hold on one second, we'll be right back on the other side.
[01:43:55.000 --> 01:44:00.680] I suggest you call in to Eddie on Monday, we'll be right back folks.
[01:44:00.680 --> 01:44:05.560] David is so enlightening to listen to 90.1 FM, but finding things on the internet isn't
[01:44:05.560 --> 01:44:09.360] so easy, and neither is finding like-minded people to share it with.
[01:44:09.360 --> 01:44:12.520] Oh, well, I guess you haven't heard of Brave New Books then.
[01:44:12.520 --> 01:44:13.520]  Brave New Books?
[01:44:13.520 --> 01:44:18.160] Yes, Brave New Books has all the books and DVDs you're looking for by authors like Alex
[01:44:18.160 --> 01:44:23.120] Jones, Ron Paul, Angie Albert Griffin, they even stock inner food, Burkey products, and
[01:44:23.120 --> 01:44:24.120]  Calvin Soaps.
[01:44:24.120 --> 01:44:27.000]  There's no way a place like that exists.
[01:44:27.000 --> 01:44:28.440] Go check it out for yourself.
[01:44:28.440 --> 01:44:32.160] It's downtown at 1904 Guadalupe Street, just south of UT.
[01:44:32.160 --> 01:44:36.120] Oh, by UT, there's never anywhere to park down there.
[01:44:36.120 --> 01:44:41.480] Actually, they now offer a free hour of parking for paying customers at the 500 MLK parking
[01:44:41.480 --> 01:44:43.480] facility just behind the bookstore.
[01:44:43.480 --> 01:44:47.360] It does exist, but when are they open?
[01:44:47.360 --> 01:44:55.960] Monday through Saturday, 11am to 9pm and 1-6pm on Sundays, so get them a call at 512-480-2503
[01:44:55.960 --> 01:44:58.880] or check out their events page at bravenewbookstore.com.
[01:45:26.360 --> 01:45:28.360] And now you can, too.

[01:46:22.960 --> 01:46:26.960] Okay, folks, we are back.
[01:46:26.960 --> 01:46:28.400]  We're into our final segment.
[01:46:28.400 --> 01:46:30.400] The board is jammed up with callers.
[01:46:30.400 --> 01:46:33.960] Folks, if we can't get to you tonight, call back in tomorrow night.
[01:46:33.960 --> 01:46:36.960]  Randy does his four-hour info marathon.
[01:46:36.960 --> 01:46:40.200] There will be plenty of time to spend with everybody tomorrow night.
[01:46:40.200 --> 01:46:42.480] I'm sorry, we probably are not going to get to everyone.
[01:46:42.480 --> 01:46:46.680] David, listen, your case is going to take at least a half an hour to deal with, and
[01:46:46.680 --> 01:46:51.280] we don't even have enough time left in the show to answer all your questions and to help
[01:46:51.280 --> 01:46:52.280]  you.
[01:46:52.280 --> 01:46:54.280] Can you please call back on Monday and talk to Eddie?
[01:46:54.280 --> 01:46:55.280]  Sure.
[01:46:55.280 --> 01:46:57.280] Can I get just one little bit of information?
[01:46:57.280 --> 01:46:59.280]  He has mentioned a statute.
[01:46:59.280 --> 01:47:00.600] What statute would that fall under?
[01:47:00.600 --> 01:47:01.600]  I can't remember.
[01:47:01.600 --> 01:47:05.280] I'd have to look it up, but we talk about it all the time, but it has to look in the
[01:47:05.280 --> 01:47:07.280]  Code of Criminal Procedure.
[01:47:07.280 --> 01:47:08.280]  Okay.
[01:47:08.280 --> 01:47:18.160] And one other quick thing, when I show up on the 12th, again, I remember listening one
[01:47:18.160 --> 01:47:23.040] time where Randy, I believe it was Randy, said that there needs to be paperwork filed
[01:47:23.040 --> 01:47:25.880] before I go in there, and they refuse to enter a plea.
[01:47:25.880 --> 01:47:26.880]  Yes.
[01:47:26.880 --> 01:47:29.280] We can talk about that some more on Monday.
[01:47:29.280 --> 01:47:30.280]  We've got time.
[01:47:30.280 --> 01:47:31.280]  Okay.
[01:47:31.280 --> 01:47:32.280] So please call back in on Monday.
[01:47:32.280 --> 01:47:34.640] I'll be on the air with Eddie, and we can go over this again.
[01:47:34.640 --> 01:47:39.880] But yeah, listen, the only time the court even has jurisdiction to accept a plea is
[01:47:39.880 --> 01:47:41.600] after a jury has already been impaneled.
[01:47:41.600 --> 01:47:46.160] If this isn't the trial, then look, they try to pressure people into taking, into giving
[01:47:46.160 --> 01:47:52.040] a plea early, and the reason for that is because they're trying to get you to waive your objection
[01:47:52.040 --> 01:47:53.840]  to impersonal jurisdiction.
[01:47:53.840 --> 01:47:54.840]  All right?
[01:47:54.840 --> 01:47:56.160] And we will go over that some more on Monday.
[01:47:56.160 --> 01:47:57.160] But call back in on Monday.
[01:47:57.160 --> 01:47:58.160]  Okay, David?
[01:47:58.160 --> 01:47:59.160]  Okay.
[01:47:59.160 --> 01:48:00.160]  Thank you.
[01:48:00.160 --> 01:48:01.160]  All right.
[01:48:01.160 --> 01:48:02.160]  Great.
[01:48:02.160 --> 01:48:03.160]  Thanks.
[01:48:03.160 --> 01:48:04.160] All right, folks, we need to move quickly now.
[01:48:04.160 --> 01:48:05.160]  We've only got less than 10 minutes left.
[01:48:05.160 --> 01:48:07.160] We've got four callers on the board.
[01:48:07.160 --> 01:48:08.680] Let's try to move as quickly as possible.
[01:48:08.680 --> 01:48:11.160] Gary from Texas, what is your question or comment tonight?
[01:48:11.160 --> 01:48:12.800]  Hey, David.
[01:48:12.800 --> 01:48:20.920] You said regarding the Code of Criminal Procedure, Article 28.05, or 04, it's a caution of charge
[01:48:20.920 --> 01:48:28.480] in misdemeanor, and the capsule of the situation is there was a, I'm helping somebody who got
[01:48:28.480 --> 01:48:35.920] a DWI that took a blood test, obtained a test without a warrant, there was no accident, there
[01:48:35.920 --> 01:48:41.280] was nothing involved, so they were required to get a warrant, they didn't do it.
[01:48:41.280 --> 01:48:51.280] And now the prosecutor has filed an information based on the test, which was illegally obtained.
[01:48:51.280 --> 01:48:58.800] So my question is, is there a cause of action against the prosecutor for filing an information
[01:48:58.800 --> 01:49:02.760]  based on evidence that's unlawfully obtained?
[01:49:02.760 --> 01:49:03.760]  No.
[01:49:03.760 --> 01:49:06.080]  In the short, no.
[01:49:06.080 --> 01:49:17.000] The judges have provided essentially absolute immunity for prosecutors from civil litigation.
[01:49:17.000 --> 01:49:24.520] There is, however, the American Bar Association Standards for the Prosecutorial Function, and
[01:49:24.520 --> 01:49:32.480] you can find that on barbrevens.net, and there are potentially criminal accusations to bring
[01:49:32.480 --> 01:49:37.560]  against the prosecutor.
[01:49:37.560 --> 01:49:45.160] If the prosecutor is knowingly presenting false evidence, then if the evidence is illegally
[01:49:45.160 --> 01:49:52.640] obtained as false evidence, that's jury tampering obstruction of justice.
[01:49:52.640 --> 01:49:55.080] And that's a complaint you could file with the Attorney General.
[01:49:55.080 --> 01:50:02.600] Well, Randy, what about Title 42, Section 1983 suit over malicious prosecution?
[01:50:02.600 --> 01:50:10.640] No, that doesn't, this is a state prosecution and that doesn't go to a federal civil rights
[01:50:10.640 --> 01:50:11.640]  violation.
[01:50:11.640 --> 01:50:12.640]  Are you sure?
[01:50:12.640 --> 01:50:16.120] It doesn't go to federal civil rights violation, aren't people's civil rights protected by
[01:50:16.120 --> 01:50:17.680] the feds no matter what?
[01:50:17.680 --> 01:50:18.680]  No.
[01:50:18.680 --> 01:50:19.680]  Well, not necessarily.
[01:50:19.680 --> 01:50:28.600] This is a state prosecution and he can't claim that his rights have been deprived because
[01:50:28.600 --> 01:50:38.040] the prosecutor attempted to introduce evidence unless he can show, you know, this is where
[01:50:38.040 --> 01:50:45.600] it's a technical issue about whether or not the evidence can be presented.
[01:50:45.600 --> 01:50:49.120] And all crimes are thought crimes.
[01:50:49.120 --> 01:50:56.280] You would have to be able to prove that the prosecutor knew that this evidence was subject
[01:50:56.280 --> 01:51:05.400] to the poison of the well doctrine and that wouldn't give him a cause.
[01:51:05.400 --> 01:51:18.240] But in the state, it would because the state specifically requires under 2.01 that the
[01:51:18.240 --> 01:51:23.280] prosecutor not secure evidence to, it shall be the primary duty of the prosecutor to determine
[01:51:23.280 --> 01:51:28.120] the not secure conviction but to ensure the prosecution, to ensure that justice is served
[01:51:28.120 --> 01:51:35.080] and shall not seek with evidence or witnesses from the, shall not seek with evidence or
[01:51:35.080 --> 01:51:38.840] witnesses that would show the innocence of the accused or mitigate the guilt of the accused
[01:51:38.840 --> 01:51:45.480] and evidence of improper taking of the blood sample would mitigate the guilt of the accused.
[01:51:45.480 --> 01:51:51.080] So he had violated the law relating to his office, that's very specific, and you could
[01:51:51.080 --> 01:51:57.600] go with 3903 penal code and under 3903 and in Chapter 39, you could file the complaint
[01:51:57.600 --> 01:52:03.360] with the Attorney General as authorized by 39.015.
[01:52:03.360 --> 01:52:10.960] We have filed a motion to suppress the evidence because it was obtained unlawfully without
[01:52:10.960 --> 01:52:11.960]  a warrant.
[01:52:11.960 --> 01:52:20.040] And we've also filed a motion for discovery asking for any warrant that was issued prior
[01:52:20.040 --> 01:52:26.040] to the taking of this blood sample, which by the way, the defendant objected to numerous
[01:52:26.040 --> 01:52:27.040]  times.
[01:52:27.040 --> 01:52:30.040] The taking of the blood?
[01:52:30.040 --> 01:52:33.800]  Who took the blood?
[01:52:33.800 --> 01:52:40.760] It was done at a medical facility and that we've done a Public Information Act request
[01:52:40.760 --> 01:52:47.320] to the medical facility to make sure that they were qualified under...
[01:52:47.320 --> 01:52:50.920] Have him file criminally against the medical facility personnel?
[01:52:50.920 --> 01:52:53.400]  Yep, absolutely.
[01:52:53.400 --> 01:52:55.600]  That'll make them real unhappy.
[01:52:55.600 --> 01:52:57.920]  Yeah, okay.
[01:52:57.920 --> 01:53:01.680] That kind of goes to corruption of blood.
[01:53:01.680 --> 01:53:09.760] I never have heard anybody raise that issue, but that's directly to corruption of blood.
[01:53:09.760 --> 01:53:12.520] Listen, Constitution, that might get you federal.
[01:53:12.520 --> 01:53:15.240] Okay, Gary, listen, can you call back in tomorrow so we can continue?
[01:53:15.240 --> 01:53:17.760] I want to try to jam in at least one more call if we can.
[01:53:17.760 --> 01:53:19.560]  I will certainly call back tomorrow.
[01:53:19.560 --> 01:53:20.560]  All right, great.
[01:53:20.560 --> 01:53:21.560]  Thanks, Gary.
[01:53:21.560 --> 01:53:25.240] Okay, let's see if we can get in at least one, maybe two more calls.
[01:53:25.240 --> 01:53:26.240]  We've got Mark from Wisconsin.
[01:53:26.240 --> 01:53:27.800] Mark, thank you for calling in.
[01:53:27.800 --> 01:53:28.800]  What's your question tonight?
[01:53:28.800 --> 01:53:29.800]  Hello, you two.
[01:53:29.800 --> 01:53:37.040] Hey, I was going through our municipal court code here and it says all citations or complaints
[01:53:37.040 --> 01:53:41.280] shall be signed by a law enforcement officer and they're not signed in any of them.
[01:53:41.280 --> 01:53:48.000] I'm wondering what could be done with that, should it be a motion to strike or a defective
[01:53:48.000 --> 01:53:49.000]  complaint?
[01:53:49.000 --> 01:53:52.960] A motion to challenge the subject matter jurisdiction.
[01:53:52.960 --> 01:53:54.360]  Right off the bat?
[01:53:54.360 --> 01:53:58.400] The document is insufficient to invoke the subject matter jurisdiction of the court as
[01:53:58.400 --> 01:54:02.640] it fails to meet the rules of filing.
[01:54:02.640 --> 01:54:09.840] And then when the judge denies your motion, then you file charges against the judge for
[01:54:09.840 --> 01:54:12.840]  impersonating the judicial officer.
[01:54:12.840 --> 01:54:18.000] Okay, okay, and does that hold true in municipal court too?
[01:54:18.000 --> 01:54:21.160] You don't have to make a plea on your initial appearance?
[01:54:21.160 --> 01:54:23.400] It depends on your state law.
[01:54:23.400 --> 01:54:29.240] This is all governed by state law and the code of criminal procedure here, it's very clear
[01:54:29.240 --> 01:54:35.720] when you can enter a plea, when the court has jurisdiction to accept a plea.
[01:54:35.720 --> 01:54:40.240] Okay, and I was going to mention in the civil code there.
[01:54:40.240 --> 01:54:44.960] Wait, hold on, hold on, hold on, a truck was going by.
[01:54:44.960 --> 01:54:45.960]  Go ahead.
[01:54:45.960 --> 01:54:53.440] Oh, I was going to say, I'm pretty sure they could amend that citation, you guys, but so
[01:54:53.440 --> 01:54:57.720] I was wondering if I should hold back on that, it says they can amend it if they're noticed
[01:54:57.720 --> 01:55:03.280] of it in the civil code, but not the municipal code.
[01:55:03.280 --> 01:55:10.240] There may be, okay, this goes to subject matter jurisdiction.
[01:55:10.240 --> 01:55:13.240] So yeah, you could bushwhack them with it later.
[01:55:13.240 --> 01:55:15.240]  Okay.
[01:55:15.240 --> 01:55:23.160] You can bushwhack them with it after they've already gone through the rigmarole and subjected
[01:55:23.160 --> 01:55:33.280] the person to all of this difficulty and then go back and file impersonating a judicial
[01:55:33.280 --> 01:55:42.800] officer against the judge, sue the municipality, and if the officer subsequently testified
[01:55:42.800 --> 01:55:48.800] charges anybody who participated, you can have a lot of fun with that one.
[01:55:48.800 --> 01:55:52.880] This is, bear in mind too, this is municipal too, so it's probably going to be definitely
[01:55:52.880 --> 01:55:55.880] trial de novo, Randy, how can I have some fun with this?
[01:55:55.880 --> 01:56:02.280] Oh, okay, I need to understand what trial de novo means.
[01:56:02.280 --> 01:56:13.040] Trial de novo merely means that it's a do-over for the purpose of perfecting appeal.
[01:56:13.040 --> 01:56:20.720] Trial de novo merely means that you do not have to appeal based on writ of error.
[01:56:20.720 --> 01:56:29.240] It does not shield them from due process violations, neither does it shield them from false testimony.
[01:56:29.240 --> 01:56:36.320] If they falsely testify in this trial and you appeal, they can't say that, oh, you can't
[01:56:36.320 --> 01:56:41.600] bring that in because this is trial de novo.
[01:56:41.600 --> 01:56:46.440] Because it's not trial de novo for any other reason other than to perfect appeal.
[01:56:46.440 --> 01:56:47.440]  Okay.
[01:56:47.440 --> 01:56:51.280] So, I'm just going to send a notice to the cop and I know she's not going to do anything
[01:56:51.280 --> 01:56:53.880] about it, and I'll bushwack him with that later, huh?
[01:56:53.880 --> 01:56:56.280] Yes, bushwack is great fun.
[01:56:56.280 --> 01:56:58.720] All right, thanks for that.
[01:56:58.720 --> 01:57:06.560] I was in a court recently in Frisco, Texas, and the lawyer complained it was eviction
[01:57:06.560 --> 01:57:12.720] hearing that on a piece of property, a guy wrote me a warranty deed too.
[01:57:12.720 --> 01:57:22.560] This motion should be stricken because I just got it an hour ago, and I said, your honor,
[01:57:22.560 --> 01:57:25.120] he knows better than that.
[01:57:25.120 --> 01:57:29.000] This is a challenge to subject matter of jurisdiction.
[01:57:29.000 --> 01:57:37.440] It can be filed at any time, and I just said, your honor, yeah, yeah, yeah, I know, I know.
[01:57:37.440 --> 01:57:39.160]  It was a 30-page motion.
[01:57:39.160 --> 01:57:42.240] I gave it to him an hour before court.
[01:57:42.240 --> 01:57:43.840] They were not happy cameras.
[01:57:43.840 --> 01:57:48.160] Okay, listen, we are at the end of the show, and I did want to say I did find the statute
[01:57:48.160 --> 01:57:49.440]  in Texas.
[01:57:49.440 --> 01:57:56.880] It's article 45.023 in the Code of Criminal Procedure, Defendants' Plee, After the jury
[01:57:56.880 --> 01:58:05.720] is impaneled or after the defendant has waived trial by jury, the defendant may plead guilty
[01:58:05.720 --> 01:58:12.560] or not guilty, or enter a plea of no low contend rate, or enter the special plea of double
[01:58:12.560 --> 01:58:20.520] jeopardy, and then furthermore, article 45.024 says if the defendant refuses to plead, then
[01:58:20.520 --> 01:58:24.000] the judge shall enter a plea of not guilty.
[01:58:24.000 --> 01:58:30.120] If the defendant refuses to plead, okay, so folks, the jury has to be impaneled, all right.
[01:58:30.120 --> 01:58:34.720] We'll talk some more about this, Eddie and I, on Monday, and I'm sorry, Mark.
[01:58:34.720 --> 01:58:36.840]  We can't finish your call.
