[05:14.720 --> 05:24.720] better than anything else are facts and not general esoteric facts about an overriding
[05:24.720 --> 05:27.480] problem like securitization.
[05:27.480 --> 05:33.120] And we'll have people arguing that securitization is illegal on its face.
[05:33.120 --> 05:40.160] And the court's going to say, okay, so what, how is it illegal in this case?
[05:40.160 --> 05:43.120] That's what they need to see.
[05:43.120 --> 05:45.320] Bifurcation is a problem.
[05:45.320 --> 05:51.560] Well, what's the problem with bifurcation and how does that create a claim for you?
[05:51.560 --> 05:56.040] This guy's a robo-signer, okay, so he's a robo-signer.
[05:56.040 --> 06:00.560] What proof or evidence do you have that in this particular case he didn't have authority
[06:00.560 --> 06:01.560] to sign?
[06:01.560 --> 06:06.080] And the judge has to go to the basic facts of the case.
[06:06.080 --> 06:12.600] So I put together a, or I'm in the process of putting together an analysis tool.

[06:16.240 --> 06:27.600] So it is pretty large at the moment, I restructured it today and that's why I'm ready to kind

[07:43.320 --> 07:52.960] But you have to treat the system as if it is corrupt and structure what you do so that
[07:52.960 --> 07:59.560] you are prepared for a corrupt system, because if you don't, you will eventually run into
[07:59.560 --> 08:01.800] corruption and you'll get clobbered.
[08:01.800 --> 08:09.560] So essentially that's a way to hold your mind that will help you to structure your case
[08:09.560 --> 08:14.160] so that you can stay in the game longer.
[08:14.160 --> 08:18.160] And even though the systems corrupt, there is something you can do.
[08:18.160 --> 08:21.720] You're not helpless before this system.
[08:21.720 --> 08:30.440] The lawyers, the judges, everybody in the system and your lawyers very much in the system
[08:30.440 --> 08:33.480] is shackled by the system.
[08:33.480 --> 08:39.360] The only one that's not shackled by the system is Proce.
[08:39.360 --> 08:44.840] You and I, we have more power in the system than any of these people do.
[08:44.840 --> 08:54.720] I just went to a hearing Thursday and I was real pleased that the JP had on himself really
[08:54.720 --> 08:55.720] well.
[08:55.720 --> 09:00.880] And he got it right away that something else was going on.
[09:00.880 --> 09:08.520] He ruled against me anyway, even though all of the facts were on my side.
[09:08.520 --> 09:13.280] The other side produced no facts that would support their case.
[09:13.280 --> 09:19.800] But this is an eviction hearing and the judge just rules against the person that's being
[09:19.800 --> 09:22.960] evicted, it seems, just as a matter of course.
[09:22.960 --> 09:25.240] And I planned on that.
[09:25.240 --> 09:31.040] I set this up and when the judge had rendered his ruling first thing, he hadn't read the
[09:31.040 --> 09:37.080] whole pleading and that's because I bushwhacked him with it at the last minute.
[09:37.080 --> 09:41.480] When I filed it as a challenge to subject matter jurisdiction, you can do that.
[09:41.480 --> 09:46.360] Subject matter jurisdiction can be filed at any time.
[09:46.360 --> 09:53.720] And once the judge ruled against me, I directed him to the back of the document, to the attachments,
[09:53.720 --> 10:02.560] a number of which were criminal affidavits accusing the buyers of the property and the
[10:02.560 --> 10:10.240] lawyer for the buyers of the property of specific criminal acts.
[10:10.240 --> 10:17.240] And told the judge that I wanted him to act on my criminal affidavits in accordance with
[10:17.240 --> 10:21.520] his duty and article 210211, go to court in procedure.
[10:21.520 --> 10:30.920] And that's when the judge kind of began to get the idea that I had planned for more than
[10:30.920 --> 10:37.000] him just ruling against me, that I expected him to rule against me no matter what I filed.
[10:37.000 --> 10:47.200] So I had planned for that and this plan will gather the judge up in the loop.
[10:47.200 --> 10:54.120] The judge ruled against me in this case and I can't go in and challenge the ruling.
[10:54.120 --> 11:01.120] But what I can do is move to disqualify the judge for failing to apply the law to the
[11:01.120 --> 11:06.640] facts, for failing to determine the facts in accordance with the rules of evidence and
[11:06.640 --> 11:08.520] then apply the law to the facts.
[11:08.520 --> 11:14.360] So I set him up knowing he was going to rule against me, but I had the facts in there in
[11:14.360 --> 11:17.680] order to rule against me, he had to rule against the facts.
[11:17.680 --> 11:18.680] He did that.
[11:18.680 --> 11:21.680] Now I get to go after him.
[11:21.680 --> 11:27.320] For a harm approves to me, I get to sue the judge for because he didn't have subject matter
[11:27.320 --> 11:30.040] jurisdiction to start with.
[11:30.040 --> 11:40.000] But in this, okay, enough of that stuff, endopharyngeal analysis, the very first thing that I ask for
[11:40.000 --> 11:47.240] and this is an analysis that people do for themselves, so this is not for me.
[11:47.240 --> 11:57.320] If you have a legal issue of any kind, the very first thing you should do is prepare
[11:57.320 --> 12:00.600] a timeline.
[12:00.600 --> 12:07.040] Prepare a document, just an outline form that says, this happened and this happened and
[12:07.040 --> 12:08.280] this happened.
[12:08.280 --> 12:14.480] No argument, no explanation, just list out the happenings.
[12:14.480 --> 12:17.600] Walk down through the happenings.
[12:17.600 --> 12:22.320] Once you have all those together, now you have a tool you can work from, you have a
[12:22.320 --> 12:32.360] tool that will keep you oriented, that will keep you from losing track of where you're
[12:32.360 --> 12:33.760] at in time.
[12:33.760 --> 12:41.440] This is a really big problem, especially with process, when they're dealing with courts
[12:41.440 --> 12:49.240] because for the most part, for the untrained procé, they move from one emotional high
[12:49.240 --> 12:59.160] point to the next and they have full referential index.
[12:59.160 --> 13:06.320] They know how everything refers to everything else from their perspective.
[13:06.320 --> 13:13.080] But they don't think about things in terms of how everything connects to everything else.
[13:13.080 --> 13:19.440] We tend to think about things in terms of emotional high points.
[13:19.440 --> 13:22.320] So we lose all the steps in between.
[13:22.320 --> 13:29.520] I have people telling me their stories all the time and I have no idea what they're talking
[13:29.520 --> 13:31.520] about.
[13:31.520 --> 13:37.000] They jump from one thing to the next to the next to the next and I have absolutely no
[13:37.000 --> 13:39.960] idea what's going on.
[13:39.960 --> 13:44.960] And when I start questioning them on the details, they get frustrated because they feel like
[13:44.960 --> 13:48.560] I'm picking them apart on the details.
[13:48.560 --> 13:51.960] But the problem is I don't have mental orientation.
[13:51.960 --> 13:56.280] I don't know how all of this fits together, so it doesn't make sense to me.
[13:56.280 --> 14:00.200] So the first thing you need is a timeline.
[14:00.200 --> 14:07.040] Once you have that timeline, then it will become a relatively simple matter for you
[14:07.040 --> 14:10.200] to move down the timeline.
[14:10.200 --> 14:14.240] When you have the timeline, one of the things you always want to do for talking to somebody
[14:14.240 --> 14:18.880] is you don't have to give the timeline to the other person, but you have to be cognizant
[14:18.880 --> 14:21.000] of it.
[14:21.000 --> 14:28.560] And you have to be maintained awareness of where you're at in it and make sure you let
[14:28.560 --> 14:31.160] the other person know where you're at in it.
[14:31.160 --> 14:37.880] You give him markers before and after to show this rest in this place.
[14:37.880 --> 14:42.880] Then you don't lose your listener or your reader.
[14:42.880 --> 14:52.560] And then once you have the timeline, the very next thing we suggest that you do is go to
[14:52.560 --> 14:56.720] the county clerk and pull the records.
[14:56.720 --> 15:03.040] Everything has been filed with the county registrar's office.
[15:03.040 --> 15:06.280] That's where the facts are.
[15:06.280 --> 15:13.520] The documents that are filed in the county registrar's office, those are the facts that
[15:13.520 --> 15:20.000] are in the public record and absolutely cannot be refuted.
[15:20.000 --> 15:24.360] And that's the place where the lenders have screwed up the worst.
[15:24.360 --> 15:34.240] I'm thinking that they waived this securitization issue at us and bifurcation issue in MERS,
[15:34.240 --> 15:42.520] all of that to keep us out of the county record, because that's where the action is.
[15:42.520 --> 15:49.200] That's the place where you will find the details that the court can wrap their heads around
[15:49.200 --> 15:53.560] and the place where you find the details they have to pay attention to.
[15:53.560 --> 16:01.960] In my case, there was a warranty, a deed of trust by Washington Mutual Bank.
[16:01.960 --> 16:08.440] Then there was, and this was in 07, there was an assignment of substitute trustee by
[16:08.440 --> 16:18.920] JPMorgan Chase in 2011 and nothing assigning the deed of trust to JPMorgan Chase.
[16:18.920 --> 16:28.680] By definition, by statute, that assignment of substitute trustee is fraudulent and doesn't
[16:28.680 --> 16:31.880] matter if he was properly appointed.
[16:31.880 --> 16:38.120] It was not filed in the county record, therefore, it is of no force and effect and it can't
[16:38.120 --> 16:40.040] get around that part.

[22:09.280 --> 22:14.760] they call it is generally in the county court or the county clerk's office, where they might
[22:14.760 --> 22:19.120] have a special registry, although the only place I've heard of that is in Australia.
[22:19.120 --> 22:26.880] Here they, in Australia they have a state location that's not really a part of the courts, but
[22:26.880 --> 22:27.880] we won't go there.
[22:27.880 --> 22:34.520] Anyway, still you can go to the county clerk and find out where these records are kept.
[22:34.520 --> 22:45.280] And there's kind of a method we've worked out that goes to certain issues that occur.
[22:45.280 --> 22:54.040] In Texas law, 13.001 property code, and it's a little bit too long just to quote it, but
[22:54.040 --> 23:02.600] to paraphrase it, it says that any claim against real property not properly filed in the county
[23:02.600 --> 23:12.400] record is void, or it's, void has to that lender, but it's a little more wordy because
[23:12.400 --> 23:21.200] it says that the claim is not necessarily void, it's just that whoever holds that claim
[23:21.200 --> 23:28.480] can't express the claim until they've properly filed it in the county record.
[23:28.480 --> 23:34.120] So properly filed was the key word.
[23:34.120 --> 23:45.200] The most of the foreclosures in Texas will have a notice of foreclosure sale, but if
[23:45.200 --> 23:53.680] you go search the records on a given piece of property, you won't find that notice because
[23:53.680 --> 24:01.680] the statute for that notice says that the clerk only has to keep that record for I
[24:01.680 --> 24:05.520] think 60 or 90 days.
[24:05.520 --> 24:13.360] Well most of the jurisdictions now keep everything in an electronic format.
[24:13.360 --> 24:22.640] They put it in the computer and one thing database managers really, really hate to do
[24:22.640 --> 24:30.560] is purge data from their computer system, as well as they have to, but these days with
[24:30.560 --> 24:38.400] memory getting so cheap, they don't tend to like to purge their system so the information
[24:38.400 --> 24:48.320] is still in the databases, but because they're only required to keep it for 60 days, it doesn't
[24:48.320 --> 24:56.400] get filed with the property, they apparently filed it in a special index.
[24:56.400 --> 25:02.160] And that would be okay except for one other minor little detail.
[25:02.160 --> 25:12.960] The deed of trust or mortgage always requires that a notice of acceleration if the lender
[25:12.960 --> 25:22.320] decides to exercise this option to foreclose and files a notice of acceleration, then that
[25:22.320 --> 25:29.040] has to be filed in the county record on the property, but what they're doing here in Texas
[25:29.040 --> 25:36.480] is they're filing a notice of foreclosure sale and notice of acceleration in one document,
[25:36.480 --> 25:42.000] and that doesn't get in the county record. Now that gives them a problem.
[25:46.000 --> 25:56.000] Okay, I have a question about a bar grievance on an attorney, one of my most favorite subjects.

[26:03.600 --> 26:11.360] You're a little soft, or maybe that was some background noise, go ahead.
[26:12.480 --> 26:20.240] Okay, hey, what I have is an attorney that right before the trial date, I found out that
[26:21.040 --> 26:27.360] the information he had in my file, it didn't happen in my file. All the stuff I'd given him
[26:27.360 --> 26:33.200] wasn't there. So what ended up happening was I ended up taking a plea because I mean this guy
[26:33.200 --> 26:38.720] was coming back from vacation a couple days before my trial, and I mean I didn't trust the whole
[26:38.720 --> 26:46.560] situation, and what I'm doing is I'm writing up a bar grievance on him, and I went through your

[38:21.600 --> 38:31.360] consumer protection laws but they set in your ability to adjudicate them so short and so
[38:31.360 --> 38:37.840] restrictive that it's extremely difficult to actually try to seek remedy from them and the
[38:37.840 --> 38:46.720] courts. The courts just deny them out of hand so the remedies are really kind of just a smokescreen
[38:46.720 --> 38:53.360] to make it look like the legislature is actually doing something to protect us when in fact
[38:53.360 --> 38:58.320] they're taking money from the people who are stealing from us not to protect us.
[38:58.320 --> 39:09.680] The state bar associations, they're probably absolutely the worst. The only thing that might
[39:09.680 --> 39:19.600] be worse than them are the judicial conduct commissions. They're all really there to
[39:19.600 --> 39:28.000] protect their buddies and give the illusion of oversight but we know what their problem is.
[39:29.600 --> 39:33.680] They don't control the insurance companies so that's what we really care about.
[39:34.320 --> 39:43.440] So in the end it's not terribly important how accurate you prepare the complaint because
[39:43.440 --> 39:49.120] we pretty well know the state bar is going to trash the complaint no matter what you file.

[40:46.560 --> 40:56.640] built. I have a section that said the lawyer failed to do whatever their you know we have a
[40:56.640 --> 41:04.080] statute says that the lawyer shall do this. I converted it into did the lawyer fail to do this
[41:04.080 --> 41:11.120] or if it says the lawyers shall not do something I say did the lawyer do this and then state what
[41:11.120 --> 41:16.960] it is it makes it a whole lot easier to get through these because you can go through them
[41:16.960 --> 41:22.160] really quickly that way and you don't have to try to study these things forgot what the heck
[41:22.160 --> 41:34.640] they're trying to say so give that a try and each separate issue should be a different grievance.

[42:13.040 --> 42:17.200] letter saying hey listen you know I can't be there and I told him you know when I showed up
[42:17.200 --> 42:21.280] hey you know my my attorney's not here and told me they'll remain me not to say anything
[42:21.280 --> 42:26.320] but he went ahead with it anyways. So he denied you the right you're right the counsel.
[42:27.280 --> 42:36.640] Yeah he does. Charging criminally with that. Well because I saw in the it's a SCR chapter 62
[42:36.640 --> 42:44.080] standards of courtesy and decorum for the courts of Wisconsin and it said judges court
[42:44.080 --> 42:50.560] commissioners lawyers clerks and court personnel shall at all times do all of the following. Well
[42:50.560 --> 42:56.640] let's get to G. In scheduling all hearings meetings and conferences be considered of the
[42:56.640 --> 43:02.960] time schedules of the participants and grant reasonable extensions of time when they will
[43:02.960 --> 43:06.800] not adversely affect the court calendar or client's interests.
[43:06.800 --> 43:16.800] Well this absolutely adversely affected your interest. It made it impossible for you to
[43:16.800 --> 43:25.760] have a do a say in the hearing to be able to argue for the injunction. So he denied you

[43:32.080 --> 43:37.600] a grand jury how that's OK or it probably won't get to a grand jury but let him explain to the
[43:37.600 --> 43:42.160] prosecutor and while you're hammered on the prosecutor and everybody else stir him up a

[52:56.240 --> 53:02.560] about me filing criminal charges against him. I really expected him to get upset and say well
[53:02.560 --> 53:10.400] you can't do this but he did not. He kept his mouth shut and when the judge ruled against me
[53:10.400 --> 53:23.040] I said your honor did you read my entire pleading and he said well Mr. Carlson I made the
[53:23.840 --> 53:30.560] ruling based on your arguments. Well yes I understand that your honor but I have right
[53:31.680 --> 53:37.920] to have my pleading considered and he was this was getting right at lunchtime and he said
[53:37.920 --> 53:44.000] Mr. Carlson I should have taken you earlier earlier in the day. I said yes you should have

[01:33:57.680 --> 01:34:03.840] into a big fight with them so i basically stopped paying them told them that i would be glad to
