[04:18.080 --> 04:27.440]  I have a quiet title action, and the original lender never answered, and so I got a default

[04:28.440 --> 04:32.320]  But then they came back, and they wanted to reopen it again.
[04:32.320 --> 04:38.520]  Well, when they went up to reopen it again, the servicer came in and wants to say, well,
[04:38.520 --> 04:42.680]  we are in the mortgage, we want parts of this.
[04:42.680 --> 04:43.680]  They didn't.
[04:43.680 --> 04:45.400]  They didn't have any assignment or anything.
[04:45.400 --> 04:53.360]  They had the note that was endorsed without recourse by both parties, both the original
[04:53.360 --> 04:55.800]  lender and the servicer had endorsed it.
[04:55.800 --> 04:56.800]  Okay.
[04:56.800 --> 04:57.800]  Hold on just a second.
[04:57.800 --> 05:06.640]  Induced without recourse, that means that they endorsed it to someone else without recourse,
[05:06.640 --> 05:09.680]  so they had no claim, and is that what that means?

[05:43.240 --> 05:45.280]  in the original hearing.
[05:45.280 --> 05:52.640]  Then they came in with an assignment or mortgage, dated the day after the hearing from the original
[05:52.640 --> 05:56.120]  lender, you know, Merz, on the hearing.

[05:58.120 --> 06:00.120]  After the hearing, the hearing that you're at?
[06:00.120 --> 06:07.120]  Yeah, the hearing to reopen the default judgment, they said, we haven't had any interest for

[06:08.120 --> 06:13.440]  Well, the one that had the assignment the day after the hearing.
[06:13.440 --> 06:15.800]  Yes, that was the servicer.
[06:15.800 --> 06:16.800]  Okay.
[06:16.800 --> 06:21.120]  And the servicer is saying they got assigned it tomorrow?
[06:21.120 --> 06:22.120]  Yeah, no.

[06:23.120 --> 06:33.400]  Like, say, on the 19th was the hearing, and the servicer was there but didn't say anything.
[06:33.400 --> 06:40.000]  The person that was the original lender said, we haven't had any interest in five years,
[06:40.000 --> 06:44.000]  but we have to reopen this case so we can straighten this all out.
[06:44.000 --> 06:47.280]  So the judge allowed it to be reopened.
[06:47.280 --> 06:55.480]  So when it was reopened, the servicer files another document with an assignment or mortgage
[06:55.480 --> 07:00.080]  to enter the case because they still weren't part of the case.
[07:00.080 --> 07:08.840]  So to replace the original lender, well, the judge hasn't ruled on them allowing the original
[07:08.840 --> 07:12.840]  lender to get loose yet, and I'm not dismissing them yet.
[07:12.840 --> 07:18.200]  So when they entered the case with the assignment or mortgage, it was from the original lender
[07:18.200 --> 07:24.520]  dated the day after the hearing that the original lender said we haven't had any interest for
[07:24.520 --> 07:25.520]  five years.
[07:25.520 --> 07:26.520]  Okay.
[07:26.520 --> 07:30.720]  Are you familiar with the correct legal term for that?
[07:30.720 --> 07:32.720]  No.
[07:32.720 --> 07:35.520]  That constitutes collateral estoppel.

[07:36.520 --> 07:42.720]  Well, I'd use that word in my summary judgment motion.

[08:26.360 --> 08:32.080]  They read me the write-off six ways from Sunday saying a half a dozen things that made no
[08:32.080 --> 08:37.200]  sense, that they don't have to record things, that it was assigned by Fannie Mae, although
[08:37.200 --> 08:43.520]  Fannie Mae's name is nowhere on the assignment, you know, that kind of stuff.
[08:43.520 --> 08:48.880]  And then I was getting a little depressed until the next day I got an answer from the
[08:48.880 --> 08:49.880]  original lender.
[08:49.880 --> 08:58.200]  And the original lender, and my quote says, original lender was not a party to this assignment
[08:58.200 --> 09:05.160]  and was not involved in the execution of September 20th assignment whatsoever.
[09:05.160 --> 09:11.080]  Original lender had no interest in the subject property to assign.
[09:11.080 --> 09:15.400]  Without any interest in the subject property, original lender could not validly execute
[09:15.400 --> 09:16.400]  such an assignment.
[09:16.400 --> 09:20.000]  That sounds like forgery to me.
[09:20.000 --> 09:23.560]  Yeah, they knew it was coming.

[12:20.520 --> 12:31.920]  prosecutor came in and agreed to dismiss the case and had no objection to expungement.
[12:31.920 --> 12:38.280]  And the lawyer said they did what, said, I've never heard of such a thing.
[12:38.280 --> 12:42.720]  I can't imagine why they would do such a thing.
[12:42.720 --> 12:48.840]  That's because Mike kicked their butts every way from Sunday.
[12:48.840 --> 12:57.280]  He used their law the way they used their law and crammed it right down their throats.
[12:57.280 --> 13:03.600]  He's talking to a lawyer who said, well, Mr. Handel, you have really been beating us up
[13:03.600 --> 13:08.120]  lately, and he picked up a criminal complaint he had just filed against the lawyer.
[13:08.120 --> 13:15.520]  And he said he put that down and picked up the criminal affidavit behind it that demonstrated
[13:15.520 --> 13:23.400]  with absolute rock-solid proof that he had committed exactly the crime that he was accused
[13:23.400 --> 13:29.120]  of, and he said the lawyer literally lost the ability to speak.
[13:29.120 --> 13:31.720]  He was so furious.
[13:31.720 --> 13:35.920]  He was trying to say things, but no words were coming out.
[13:35.920 --> 13:43.920]  As I said, you know, Mike, you went through all this misery and grief to fight these guys.
[13:43.920 --> 13:48.800]  Getting to see that look on that lawyer's face, didn't that make it worth it?

[13:52.800 --> 14:03.160]  So there's nothing like taking on the guys who violate every law, cheat, lie, mistreat

[27:08.400 --> 27:18.400]  Most lawyers, when they start out, do criminal work because that's the easiest to get clients and get your name out and get known.
[27:18.400 --> 27:24.400]  And they see how corrupt the criminal system is.
[27:24.400 --> 27:25.400]  Oh, really?
[27:25.400 --> 27:30.400]  They're more afraid of it than you are.
[27:30.400 --> 27:37.400]  And when they're looking at the prospect of the criminal prosecution, now you're in Pennsylvania.
[27:37.400 --> 27:46.400]  In Pennsylvania, unlike most every other state, the Commonwealth states are somewhat different than the rest of the states.
[27:46.400 --> 27:50.400]  For the most part, they're based on Spanish law.
[27:50.400 --> 27:54.400]  The Commonwealth states are based on the common law.
[27:54.400 --> 28:03.400]  That's been upgraded to match the model standards as produced by the federal government for all the states so that they have similar laws.
[28:03.400 --> 28:10.400]  But what's left in some of these states are some interesting differences.
[28:10.400 --> 28:20.400]  And one of the interesting differences I've seen nowhere else is in Pennsylvania, the prosecuting attorney is given prosecutorial discretion.
[28:20.400 --> 28:26.400]  Now prosecutors exercise it everywhere else, but they don't have it, not by law.
[28:26.400 --> 28:29.400]  They just take that authority.
[28:29.400 --> 28:32.400]  In Pennsylvania, they have it.
[28:32.400 --> 28:35.400]  And on the surface, that looks like a real problem.
[28:35.400 --> 28:52.400]  However, since the prosecutor has original, has first blush discretion, the citizen in Pennsylvania is given standing.
[28:52.400 --> 28:56.400]  In other states, we have no standing before criminal prosecution.
[28:56.400 --> 29:01.400]  The criminal prosecution is exclusive to the prosecutor.

[36:00.400 --> 36:13.400]  So, I'm working through jurisdiction area again, but I need to know what types of emotions that we can file.

[37:57.400 --> 38:04.400]  complaining about how corrupt the family courts were and how against the fathers that they were.
[38:04.400 --> 38:09.400]  So this seems to be a pretty well universal problem.
[38:09.400 --> 38:19.400]  Yes. Anyway, what can we do to at least delay until we can get an attorney brought in?
[38:19.400 --> 38:26.400]  File and a, okay, has there been any order or concerning discovery?

[38:28.400 --> 38:36.400]  Then petition for discovery and file for a continuance to allow discovery.

[39:41.400 --> 39:49.400]  Were there facts that were misstated that would have the effect of changing the outcome?
[39:49.400 --> 39:57.400]  Yes, there's accusations of abuse and alcoholism.
[39:57.400 --> 40:02.400]  That's just not true.
[40:02.400 --> 40:08.400]  Okay, has there ever been a clinical diagnosis of alcoholism?
[40:08.400 --> 40:10.400]  No.
[40:10.400 --> 40:17.400]  Okay, that's really, yeah, that goes to defamation, but that's not perjury.
[40:17.400 --> 40:23.400]  That's somebody saying he's an alcoholic and that's an opinion.
[40:23.400 --> 40:31.400]  If they say determination of alcoholism, then they could say that as a fact, but otherwise that's an opinion.
[40:31.400 --> 40:35.400]  But child abuse is very specific, or a child, I said child abuse.
[40:35.400 --> 40:49.400]  The reason I said child abuse is there's a lot of lawyers out there that if they represent the wife who accused the husband of sexual abuse of the child as a matter of course.
[40:49.400 --> 40:51.400]  Yeah, none of that's going well.
[40:51.400 --> 41:01.400]  It's just like the wife is accusing him of being verbally abusive or whatever, which is kind of standard procedure.
[41:01.400 --> 41:04.400]  That's not going to go to aggravated perjury.
[41:04.400 --> 41:16.400]  That's going to go to her opinion of how she felt about the way she was treated, unless she's accusing him of beating her with a stick or something.
[41:16.400 --> 41:19.400]  Yeah, none of that is there.
[41:19.400 --> 41:27.400]  Okay, then those are opinions they won't go to, they won't go to perjury.
[41:27.400 --> 41:35.400]  You can only commit perjury by falsely testifying to a material fact.
[41:35.400 --> 41:53.400]  And if I go in there and I falsely testify that I'm 39 when I'm really 63, and it don't make any difference to the case, there's nothing to do with the case, that's not perjury.
[41:53.400 --> 42:07.400]  If I put something on a document that's not sworn to, and even if it's material, that's perjury.
[42:07.400 --> 42:16.400]  If I put something on a document that is sworn to and file it in a court, that's aggravated perjury.
[42:16.400 --> 42:23.400]  Or if I testify in a court to something that's untrue, and it is material, that's aggravated perjury.
[42:23.400 --> 42:40.400]  So neither of these go to perjury, and in a divorce proceeding, neither of them will actually go to slander, because this is one person's opinion.
[42:40.400 --> 42:48.400]  And I don't have anything yet that I could go after them with, and this is kind of the kind of thing that's expected in a divorce proceeding.
[42:48.400 --> 42:54.400]  And for the most part, divorce proceedings go the same way.
[42:54.400 --> 42:59.400]  They rule against a husband as a matter of course.
[42:59.400 --> 43:06.400]  The order child support, has there been a temporary child support order?
[43:06.400 --> 43:09.400]  No, there's been nothing, Randy, zero.
[43:09.400 --> 43:13.400]  Boy, they're her lawyers screwed up.
[43:13.400 --> 43:20.400]  Yeah, I know, and so I don't know how we go to final hearing when there's been nothing in the court.
[43:20.400 --> 43:25.400]  Well, yeah, that's it. There's nothing before the court. There's no inner emotions to be heard.

[47:49.400 --> 47:54.400]  Okay, has he petitioned for a court order granting visitation?

[47:56.400 --> 48:00.400]  That's not going to look good for him.
[48:00.400 --> 48:04.400]  So he hasn't raised the issue, so he can't complain about it.

[48:10.400 --> 48:24.400]  But if there's a hearing in January, you might file for sanctions, but you might get more difficulty.

[49:42.400 --> 49:51.400]  Ask for mediation prior to a ruling, ask the court for a continuance so that you can pursue mediation.

And what they do is they scare you with this letter and then they send you some forms that you need to fill out or you need to give them all your information including social security number and everything in the process.
[56:38.400 --> 56:47.400]  So I guess that's what they're trying to do. They probably don't have any of my information and they want to get me to come in and give them everything they need.
[56:47.400 --> 56:57.400]  And at the bottom it says that this is an attempt to collect a debt. Anything I do or say or whatever is going to be used for this purpose.

[01:04:00.400 --> 01:04:16.400]  That's the feeling that I have because I've seen this type of letters before and basically it's care tactics and then they're sending you a form that you need to fill in where you need to put all your personal information in it.
[01:04:16.400 --> 01:04:34.400]  Because when I checked in the county recorders, I checked for every document that was recorded on this property and it has nothing, it has no mares, no assignments to mares, no assignments to lethal long term disdain, no assignments to Oakland, nothing.
[01:04:34.400 --> 01:04:46.400]  It was just the original lender, a new century mortgage, a new century mortgage when bankrupt in 2007, therefore it's a company that doesn't exist.
[01:04:46.400 --> 01:04:59.400]  That is interesting. Do you have a lien in the record or a warranty deed?
[01:04:59.400 --> 01:05:04.400]  No.
[01:05:04.400 --> 01:05:15.400]  Here's my thought. New Century Mortgage has a deed of trust in the county record.
[01:05:15.400 --> 01:05:16.400]  Yes.
[01:05:16.400 --> 01:05:30.400]  If they went out of business without transferring or assigning the deed of trust to someone else, therefore they abandoned it.
[01:05:30.400 --> 01:05:41.400]  They're out of business now, they can't file an assignment, so the deed of trust is not enforceable.
[01:05:41.400 --> 01:06:01.400]  So set up your bulletproof trust and we don't talk about that on the air, we'll talk about that off the air, how to set up a bulletproof trust and then grant the property to the bulletproof trust.
[01:06:01.400 --> 01:06:13.400]  And then sue the lender or petition the court for a declaratory judgment on the deed of trust.
[01:06:13.400 --> 01:06:30.400]  And maintain that New Century Mortgage had the deed of trust and it's clouded your title, New Century Mortgage is no longer in existence and New Century Mortgage failed to assign the deed of trust to another entity.
[01:06:30.400 --> 01:06:40.400]  And since it is now out of business, it's unable to because it doesn't exist, therefore they abandoned it and asked the court to rule that.
[01:06:40.400 --> 01:06:43.400]  That should make things interesting.
[01:06:43.400 --> 01:06:45.400]  That sounds very interesting.
[01:06:45.400 --> 01:06:59.400]  You know what, when I opened this letter and I read it, he scared the hell out of me because there's a lot of people losing their houses even when they don't own a penny on it.
[01:06:59.400 --> 01:07:11.400]  I've got to talk to Randy, Mr. Kelkin, see what's going on with this.
[01:07:11.400 --> 01:07:25.400]  You look at every move the other side makes and ask yourself, how can I benefit from that move?
[01:07:25.400 --> 01:07:30.400]  So how can we best benefit from what they just did?
[01:07:30.400 --> 01:07:37.400]  They've given indication that they don't know who holds this mortgage.
[01:07:37.400 --> 01:07:54.400]  They haven't taken care of their paperwork because they've claimed that you're in foreclosure when you're paid up, so you use that with the courts to say, these guys don't know what's going on.
[01:07:54.400 --> 01:08:00.400]  They don't know who the lender is or that is.
[01:08:00.400 --> 01:08:09.400]  But before you do anything, you want to get a warranty deed or a lien in the record.
[01:08:09.400 --> 01:08:14.400]  And I've been looking at the warranty deed, deed of trust issue.
[01:08:14.400 --> 01:08:29.400]  And what I'm thinking is, is you set up the trust and do an assignment to the trust, just exactly like the assignments they do.
[01:08:29.400 --> 01:08:38.400]  And since this is your interest, you don't need their permission to transfer, assign your interest to someone else.
[01:08:38.400 --> 01:08:44.400]  They need your permission to assign their interest, but you don't need theirs to assign yours.
[01:08:44.400 --> 01:08:51.400]  So just assign it to the trust.
[01:08:51.400 --> 01:09:04.400]  That might look at the record in Texas if a document is filed in the record and there is something wrong with it.
[01:09:04.400 --> 01:09:09.400]  You have five years to cure it.
[01:09:09.400 --> 01:09:14.400]  I don't remember the state, but there was another state where you had six months.
[01:09:14.400 --> 01:09:16.400]  Oh, Washington, D.C.
[01:09:16.400 --> 01:09:18.400]  I just looked at something in D.C.
[01:09:18.400 --> 01:09:30.400]  And if something's filed in the record and it's an error and it is not challenged within six months, the error is cured by time.
[01:09:30.400 --> 01:09:34.400]  And that's understandable when you're dealing with a 30-year note.
[01:09:34.400 --> 01:09:46.400]  So we had an issue here in Texas where a guy got a loan with one company, but a different company filed the deed of trust.
[01:09:46.400 --> 01:09:49.400]  And then that company went out of business.
[01:09:49.400 --> 01:09:58.400]  And then the original company, eight years later, did an assignment to the company doing the foreclosure.
[01:09:58.400 --> 01:10:02.400]  We said, wait a minute, they don't have a deed of trust.
[01:10:02.400 --> 01:10:07.400]  This other company does or did.
[01:10:07.400 --> 01:10:18.400]  This first company may have given the loan out, but the deed of trust that was handed to the borrower at closing was this other company, and that company doesn't exist anymore.
[01:10:18.400 --> 01:10:29.400]  And that company didn't assign the note or the deed of trust, so it can't anymore because it's defunct, so they abandoned it.
[01:10:29.400 --> 01:10:40.400]  And since it's been there over five years, they can't argue against it because the error is cured by time.
[01:10:40.400 --> 01:10:59.400]  So how long if you dropped in a warranty deed or an assignment to your trust into the county record, and they didn't challenge it within whatever the time period is,
[01:10:59.400 --> 01:11:16.400]  any error that someone else may claim is cured by time, and it steps up. Now you have a warranty deed that is void because there is no one to enforce it.
[01:11:16.400 --> 01:11:23.400]  And you have a second one that's not void. That's an idea.

[01:13:56.400 --> 01:14:04.400]  I followed up with some paperwork to respondeat superior, the president of the village, for a notice of harm,
[01:14:04.400 --> 01:14:10.400]  and then I filed two sworn affidavits, which were actually criminal complaints, into the record too.
[01:14:10.400 --> 01:14:15.400]  And then about a week later, they called me down there to have a little conference with him,
[01:14:15.400 --> 01:14:20.400]  and they told me that they had suspended the guy from work for three days.
[01:14:20.400 --> 01:14:27.400]  Wonderful. You suppose that you got his attitude adjusted?
[01:14:27.400 --> 01:14:30.400]  Oh, I did more than that. When I was in their offices too, I said,
[01:14:30.400 --> 01:14:34.400]  This guy stares at me and drives by me slowly every time I'm checking my trap.
[01:14:34.400 --> 01:14:37.400]  I said, I filed the criminal charges against this guy.
[01:14:37.400 --> 01:14:41.400]  If I had thinner skin, I would think that he's trying to intimidate a witness.
[01:14:41.400 --> 01:14:45.400]  So, the last time I saw him on Main Street, he was coming down the street the opposite way as me,
[01:14:45.400 --> 01:14:53.400]  and I was looking at him to see if it was him, and he turned his head so far around, you won't believe it.

[01:46:50.500 --> 01:46:54.500]  And I'm trying to figure out how strongly I can oppose this.
[01:46:54.500 --> 01:46:58.500]  It starts out, I ABC declare as follows.
[01:46:58.500 --> 01:47:10.500]  The facts stated herein are within my personal knowledge, and I further affirmatively state that if sworn as a witness, I couldn't would competently testify there too.
[01:47:10.500 --> 01:47:13.500]  Okay, that's nicely done.
[01:47:13.500 --> 01:47:18.500]  Is that a future tense of an affidavit?
[01:47:18.500 --> 01:47:21.500]  Wait a minute. Say that again?
[01:47:21.500 --> 01:47:30.500]  He says, if sworn as a witness, I couldn't would competently testify there too.
[01:47:30.500 --> 01:47:37.500]  So I'm reading that he's not swearing now, he's saying he's sworn as a witness in the future.
[01:47:37.500 --> 01:47:41.500]  Does this document have a jurat on it?
[01:47:41.500 --> 01:47:43.500]  At the bottom it does.
[01:47:43.500 --> 01:47:54.500]  Yeah, does he have a statement at the bottom that all of the facts stated above are true and accurate to the best of his knowledge or words to benefit?
[01:47:54.500 --> 01:47:56.500]  Something close to that, yes.
[01:47:56.500 --> 01:48:10.500]  Okay, then this one is verified, and what he's saying is that this is a verified affidavit, and he's prepared to testify under oath to the same facts that are in here.
[01:48:10.500 --> 01:48:13.500]  No, you don't have a claim there.
[01:48:13.500 --> 01:48:17.500]  Okay, I've got two other points about this then.
[01:48:17.500 --> 01:48:31.500]  In one of his items, he makes a legal conclusion which basically gets thrown out, and then in another one, he testifies as to the knowledge of other witnesses.
[01:48:31.500 --> 01:48:37.500]  Oh, you're saying in another affidavit or in another paragraph?
[01:48:37.500 --> 01:48:40.500]  Yes, in the affidavit.
[01:48:40.500 --> 01:48:47.500]  He testifies as to knowledge of other people.
[01:48:47.500 --> 01:48:54.500]  Is it clear from the statement that he's testifying to the knowledge of other people?
[01:48:54.500 --> 01:48:58.500]  Yeah, it starts out no other individual.
[01:48:58.500 --> 01:49:00.500]  Wait a minute.
[01:49:00.500 --> 01:49:10.500]  Okay, is he stating facts alleged to be in his personal knowledge that are actually in the personal knowledge of someone else?
[01:49:10.500 --> 01:49:12.500]  Yeah.
[01:49:12.500 --> 01:49:26.500]  Okay, so it's not clear if you read the document and didn't already know, you would think this was in his personal knowledge and not know that he made no reference to this other person.
[01:49:26.500 --> 01:49:31.500]  No, he's making references to knowledge of other person.
[01:49:31.500 --> 01:49:32.500]  Okay.
[01:49:32.500 --> 01:49:34.500]  And that's very clear.
[01:49:34.500 --> 01:49:43.500]  Okay, he can do that if it's for the purpose of giving foundation to facts that he's stated.
[01:49:43.500 --> 01:49:51.500]  But if he's stating as fact what someone else knows, you can move to strike that.
[01:49:51.500 --> 01:49:54.500]  Okay, well that's what I'm planning on doing.
[01:49:54.500 --> 01:49:59.500]  Yeah, so look at how he used that information.
[01:49:59.500 --> 01:50:11.500]  If it's used to give his information credence or foundation, then he can use it because that's not the relevant fact.
[01:50:11.500 --> 01:50:19.500]  And if those facts are not material, they don't matter anyway.
[01:50:19.500 --> 01:50:28.500]  So I wouldn't move to strike information that was not material.
[01:50:28.500 --> 01:50:33.500]  If it doesn't matter, it doesn't matter.
[01:50:33.500 --> 01:50:39.500]  Right, yeah, but this is material where he's trying to state facts that he doesn't have knowledge of.
[01:50:39.500 --> 01:50:43.500]  That's aggravated perjury.
[01:50:43.500 --> 01:50:45.500]  That's more than strike depleting.
[01:50:45.500 --> 01:50:48.500]  That's aggravated perjury.
[01:50:48.500 --> 01:50:53.500]  It doesn't matter if what he states is true.
[01:50:53.500 --> 01:50:58.500]  If he states he has personal knowledge when he doesn't, that's aggravated perjury.
[01:50:58.500 --> 01:51:06.500]  That would mislead the court.
[01:51:06.500 --> 01:51:15.500]  So you might look at that if you want to use that tool and this really goes to the politics of cases.
[01:51:15.500 --> 01:51:22.500]  And just what we say, you'll never win your case simply because you have the law and the facts on your side.
[01:51:22.500 --> 01:51:25.500]  Right, yeah, this is very political.
[01:51:25.500 --> 01:51:28.500]  Yeah, you will only win your case if you have the politics.
[01:51:28.500 --> 01:51:42.500]  And if this guy prepared a document and testified to his personal knowledge and stated facts that were not in his personal knowledge, that's aggravated perjury.
[01:51:42.500 --> 01:51:45.500]  Right, well that's what I believe he did.
[01:51:45.500 --> 01:52:04.500]  Even if the facts are true, he's misleading the court by bringing facts before the court that are not properly before the court.
[01:52:04.500 --> 01:52:11.500]  And he's disguising the fact that they're not properly before the court.
[01:52:11.500 --> 01:52:15.500]  Is this guy a professional?
[01:52:15.500 --> 01:52:17.500]  Yes.
[01:52:17.500 --> 01:52:20.500]  Oh, then he has to know better.
[01:52:20.500 --> 01:52:27.500]  If you're an ordinary citizen, that's kind of a vague issue.
[01:52:27.500 --> 01:52:38.500]  And it may be hard for an ordinary reasonable person of ordinary prudence to make these subtle distinctions.
[01:52:38.500 --> 01:52:42.500]  If he is a professional, he can't make that claim.
[01:52:42.500 --> 01:52:54.500]  If he committed perjury, he did it on purpose with full knowledge of the culpability or the nature of his act.
[01:52:54.500 --> 01:52:57.500]  So that might be one way to go after him.
[01:52:57.500 --> 01:52:59.500]  All right, well thank you, I agree with that.
[01:52:59.500 --> 01:53:02.500]  Can I make a quick comment on Juan's call?

[01:53:04.500 --> 01:53:11.500]  If you're going into a trust, I think a conveyance is going to be stronger than an assignment.
[01:53:11.500 --> 01:53:17.500]  Because a trust has to be a split between equitable interest and legal interest.

[01:53:22.500 --> 01:53:25.500]  Well, I haven't seen the difference.

[01:53:30.500 --> 01:53:41.500]  The reason I'm saying assignment is if you do a warranty deed, the courts tend to look at that as though you're trying to steal the property.

[01:53:49.500 --> 01:53:51.500]  They don't.
[01:53:51.500 --> 01:54:01.500]  So, okay, an assignment would have the same effect, but this is exactly the tool the bank is using.
[01:54:01.500 --> 01:54:05.500]  I know, but I've never seen it done on the other side.
[01:54:05.500 --> 01:54:10.500]  I just had somebody do that.
[01:54:10.500 --> 01:54:15.500]  And we're going to get to see how the courts react to it.
[01:54:15.500 --> 01:54:21.500]  This is the same guy I just wrote this document for as a challenge to subject matter jurisdiction.
[01:54:21.500 --> 01:54:24.500]  He's accusing these guys of felonies.
[01:54:24.500 --> 01:54:37.500]  This is the same guy that we sent a letter to the county clerk notifying the clerk that this particular document that had been filed in the record was fraudulent.
[01:54:37.500 --> 01:54:39.500]  Well, that makes it interesting.
[01:54:39.500 --> 01:54:59.500]  In Texas, we have a statute 51901 government code, which says that if the clerk believes that a document has been fraudulently filed, she has two days to report that to the district court.
[01:54:59.500 --> 01:55:18.500]  And what we're saying is, is we gave the clerk uncontrovertible evidence to show that this document was, by the definition of fraudulent contained in 51901, was in fact fraudulent.
[01:55:18.500 --> 01:55:23.500]  So she can't say she doesn't believe incontrovertible facts, or he.
[01:55:23.500 --> 01:55:25.500]  This was a he.
[01:55:25.500 --> 01:55:38.500]  Yeah, and he did not give it to the district clerk. So we filed, we filed a request to the clerk asking for the policy.
[01:55:38.500 --> 01:55:41.500]  There are policies concerning 51901.
[01:55:41.500 --> 01:55:45.500]  And we got back, oh, we abide by 51901.
[01:55:45.500 --> 01:55:52.500]  So we didn't take that as responsive and filed criminal charges against the clerk.
[01:55:52.500 --> 01:55:55.500]  That was a hoot.
[01:55:55.500 --> 01:56:07.500]  And we filed a complaint with the very prosecutor who answered our information request.
[01:56:07.500 --> 01:56:13.500]  And that was so that the clerk would say, well, you didn't handle that well. Good. Very well.
[01:56:13.500 --> 01:56:23.500]  So we're beginning to, to move with this criminal side.
[01:56:23.500 --> 01:56:26.500]  And that statement about that.
[01:56:26.500 --> 01:56:39.500]  Yes, people actually do commit these crimes to the point where you feel that you have a duty to file a criminal complaint.
[01:56:39.500 --> 01:56:48.500]  Does the grand jury and the prosecutors have a duty to follow through just like they would if the law enforcement filed the same complaint?
[01:56:48.500 --> 01:56:56.500]  Yes, they do. There's no difference between you and law enforcement and any difference that occurs, they created it.
[01:56:56.500 --> 01:56:59.500]  Now you're in Pennsylvania, in Pennsylvania.
[01:56:59.500 --> 01:57:01.500]  I always have a law enforcement.
[01:57:01.500 --> 01:57:03.500]  Pardon me?
[01:57:03.500 --> 01:57:06.500]  All we have is law enforcement in Pennsylvania.
[01:57:06.500 --> 01:57:13.500]  Well, you don't, you have grand juries, but a district court has to have a panel of grand juries whenever they feel like it.
[01:57:13.500 --> 01:57:16.500]  You don't need it. You've got something better.
[01:57:16.500 --> 01:57:19.500]  Right. We've got the police officers there.
[01:57:19.500 --> 01:57:25.500]  Well, the prosecuting attorney has prosecutorial discretion by statute.
[01:57:25.500 --> 01:57:26.500]  Correct.
[01:57:26.500 --> 01:57:34.500]  But because of that, you have, you have, you have standing.
[01:57:34.500 --> 01:57:42.500]  If the prosecutor refuses to prosecute, you can appeal to Court of Comm, please, to the district court, all the way up to the Supreme.
[01:57:42.500 --> 01:57:49.500]  To appeal to the AP first, and then take the AP to common place.
[01:57:49.500 --> 01:57:54.500]  That's not the way I read the code there, but you know more, you're there.
[01:57:54.500 --> 01:57:57.500]  But you still get to, oh, that's even better.
[01:57:57.500 --> 01:58:01.500]  I like that even better, you get to involve more in it.
