[04:06.000 --> 04:13.000]  And I hope you're gonna like this show because I'm gonna start it out with an embarrassment.
[04:13.000 --> 04:28.000]  I am somewhat embarrassed, and I get this way sometimes because I come across things that I should have seen a long time ago.
[04:28.000 --> 04:44.000]  And in this case, I'm beginning to figure something out that as it begins to make more sense, I get even more embarrassed that I didn't figure it out a long time ago.
[04:44.000 --> 04:55.000]  I had a college course when I was going to college for electrical engineering, and it was called Murphy's Law and Occam's Razor.
[04:55.000 --> 05:07.000]  And at the time, we thought that course was a big funny joke because it was a lot of fun and joking and laughing, and I'm sure everybody here is familiar with Murphy's Law.
[05:07.000 --> 05:23.000]  And I think the most poignant of all of Murphy's Law, just discussing this with someone a couple days ago, is when you're looking for something, you will always find it in the last place you look.
[05:23.000 --> 05:28.000]  I was talking to my son about it, and he said, oh, no, no, I looked at a couple places after that.
[05:28.000 --> 05:31.000]  But we had a lot of fun with Murphy's Law and Occam's Razor.
[05:31.000 --> 05:35.000]  Occam's Razor says it's very, very the most effective solution to any given problem.
[05:35.000 --> 05:38.000]  It's the simplest solution.
[05:38.000 --> 05:41.000]  And therein lies my embarrassment.
[05:41.000 --> 05:53.000]  In researching the foreclosure issue, I drank the Mer's Kool-Aid.
[05:53.000 --> 05:55.000]  I admit it, I did it.
[05:55.000 --> 06:02.000]  I also drank the Securitizing the Note Kool-Aid.
[06:02.000 --> 06:13.000]  It's taken quite a while to figure out that the banks waived those issues in front of us so that we would go chase it.
[06:13.000 --> 06:18.000]  I drank the Show Me the Note Kool-Aid.
[06:18.000 --> 06:20.000]  That's all smoke and mirrors.
[06:20.000 --> 06:36.000]  They sent us down this rabbit hole, and all they had to do was wave Mer's in front of it, in front of us, and say, oh, look at Mer's.
[06:36.000 --> 06:39.000]  Look how vulnerable Mer's is.
[06:39.000 --> 06:51.000]  Oh, please don't throw Mer's in the briar patch.
[06:51.000 --> 06:57.000]  And we all drank the Kool-Aid and jumped onto Mer's and went to just ripping them to shreds and the courts beating us up and every once in a great, great while you would get a ruling.
[06:57.000 --> 07:08.000]  But for the most part, none of the judges wanted to render a ruling that would change the world as they know it.
[07:08.000 --> 07:20.000]  They did not want to render a ruling that would change the legal background of what they're dealing with.
[07:20.000 --> 07:24.000]  Judges hate to write new law.
[07:24.000 --> 07:30.000]  So, and if you're a pro se, they're really against you anyway, no matter what.
[07:30.000 --> 07:40.000]  And then we went after the, securitizing the note, bifurcating the note from the deed of trust.
[07:40.000 --> 07:43.000]  And we ran down that rabbit hole for a while.
[07:43.000 --> 07:45.000]  And then they show me the note.
[07:45.000 --> 07:47.000]  We ran down that rabbit hole.
[07:47.000 --> 07:50.000]  And there was always something wrong with all of this.
[07:50.000 --> 07:55.000]  And I had to tell you, I was having trouble putting my finger on what was wrong with it.
[07:55.000 --> 08:02.000]  I first got news about Mer's. I had someone come to me and told me they had talked to the FBI.
[08:02.000 --> 08:12.000]  And the FBI told them that these lenders had been filing their loans with Mer's.
[08:12.000 --> 08:21.000]  They would send Mer's all the paperwork. Mer's would scan it into their system and then shred the originals.
[08:21.000 --> 08:28.000]  And I first heard that I said, say what? Nobody's that stupid.
[08:28.000 --> 08:32.000]  I mean, the uniform commercial code requires that you produce the note.
[08:32.000 --> 08:36.000]  And if they pay off the debt, they're going to have to produce the note.
[08:36.000 --> 08:39.000]  Nobody's dumb enough to shred these things.
[08:39.000 --> 08:41.000]  Oh yeah, oh yeah, that's what they did.
[08:41.000 --> 08:50.000]  And that was the common, I don't know, theory or idea for quite a while.
[08:50.000 --> 08:55.000]  Most good portion of people still believe that nonsense.
[08:55.000 --> 08:59.000]  So we went down that rabbit hole.
[08:59.000 --> 09:08.000]  It turned out that once I got the Ginny May issue or manual,
[09:08.000 --> 09:20.000]  an issuer of a security had to be registered with Ginny May as an issuer and as a compliance agent for Ginny May.
[09:20.000 --> 09:26.000]  And in order to place a note in a pool backed by Ginny May,
[09:26.000 --> 09:34.000]  the lender was required to send all the documents to a document custodian, which has turned out to be the servicer.
[09:34.000 --> 09:42.000]  And the document custodian was required to certify to Ginny May that the note met all the requirements
[09:42.000 --> 09:46.000]  for the pool that it was going in.
[09:46.000 --> 09:51.000]  And then the document custodian was required to maintain possession of all of the documents,
[09:51.000 --> 09:58.000]  specifically including the note, until termination of the contract.
[09:58.000 --> 10:00.000]  So wait a minute.
[10:00.000 --> 10:07.000]  If that's a requirement, what's this nonsense about them sending everything to Merris
[10:07.000 --> 10:17.000]  and Merris destroying the originals when Ginny May specifically required the document servicer to maintain the originals?
[10:17.000 --> 10:21.000]  All this nonsense about show me the note.
[10:21.000 --> 10:23.000]  Well, I know exactly where that note was.
[10:23.000 --> 10:25.000]  I knew where it was at all the time.
[10:25.000 --> 10:31.000]  The document custodian's got it, and he's not going to let it go.
[10:31.000 --> 10:34.000]  And he's not going to give it to Merris so they can shred it.
[10:34.000 --> 10:36.000]  That's all nonsense.
[10:36.000 --> 10:41.000]  And then they send us after bifurcating the note.
[10:41.000 --> 10:48.000]  Everybody's saying, well, you sold this note to all this pool and this pool, sold it back and forth.
[10:48.000 --> 10:50.000]  Nobody knows who wants the note.
[10:50.000 --> 10:59.000]  If you come by and you foreclose on my mortgage, well, I could have somebody come by next week and foreclose on it again.
[10:59.000 --> 11:02.000]  So prove that chain of title.
[11:02.000 --> 11:05.000]  The bank sent us chasing this nonsense.
[11:05.000 --> 11:10.000]  And if you look at the record, 95% of all the cases ruled in favor of the banks.
[11:10.000 --> 11:19.000]  Every once in a while we get a judge to rule in our favor, but very, very seldom.
[11:19.000 --> 11:22.000]  So what is the problem here?
[11:22.000 --> 11:28.000]  Well, the banks know that this is a false issue.
[11:28.000 --> 11:38.000]  All of those who've been listening to the show, you've heard us speak of accounts of people who were paid off the note and then were foreclosed on.
[11:38.000 --> 11:43.000]  Or who were foreclosed on and then a month later they got foreclosed on again.
[11:43.000 --> 11:45.000]  And I've heard of this.
[11:45.000 --> 11:53.000]  I personally have heard of this happening three times.
[11:53.000 --> 12:01.000]  Three times in seven million foreclosures.
[12:01.000 --> 12:14.000]  Okay, it's probably happened more than three times, but not enough to wise above absolute random chance.
[12:14.000 --> 12:20.000]  There is no pattern of multiple foreclosures.
[12:20.000 --> 12:27.000]  So why are the banks letting us chase this issue?
[12:27.000 --> 12:30.000]  Well, it took a while to get it sorted out.
[12:30.000 --> 12:43.000]  And that's because there are some really serious issues out there that the banks in their careless rush to see how much money they can make.
[12:43.000 --> 12:46.000]  Created for us.
[12:46.000 --> 12:53.000]  And the last thing they wanted us to do was go back to the basics.
[12:53.000 --> 13:06.000]  They wanted us chasing these very sophisticated issues that would take a lot of persuasion to get the judges to go to.
[13:06.000 --> 13:11.000]  The last thing they wanted us to do is go to first law.
[13:11.000 --> 13:17.000]  First law in contracts is the contract.
[13:17.000 --> 13:21.000]  Let's go back to the contract.
[13:21.000 --> 13:24.000]  It took me four years to get back to the contract.
[13:24.000 --> 13:26.000]  I had it there the whole time.
[13:26.000 --> 13:30.000]  What was my problem?
[13:30.000 --> 13:36.000]  I drank all this Kool-Aid and I followed all these false arguments because they were more romantic.
[13:36.000 --> 13:40.000]  They were more sophisticated.
[13:40.000 --> 13:47.000]  And I got to do really sophisticated analyses to show why this was improper.
[13:47.000 --> 13:51.000]  And the judges just didn't buy that nonsense.
[13:51.000 --> 13:54.000]  So we went back to the contract.
[13:54.000 --> 13:59.000]  I simply went back and read it a couple of times.
[13:59.000 --> 14:07.000]  And actually I've read it more than a couple of times at this point, but every time I read it, I found new stuff in it.
[14:07.000 --> 14:20.000]  And I've talked about this on the show before some of these issues, but probably there are two that are really, really big deals.
[14:20.000 --> 14:22.000]  One of them is the notary issue.
[14:22.000 --> 14:26.000]  I had someone a long time ago refer me to the notary issue.
[14:26.000 --> 14:28.000]  They told me that's the big deal.
[14:28.000 --> 14:29.000]  And I didn't listen.
[14:29.000 --> 14:33.000]  I was too busy drinking the Kool-Aid.
[14:33.000 --> 14:36.000]  I looked at something more complex.
[14:36.000 --> 14:46.000]  And then when I went back and looked at the notary issue holding micro, that really was an incredibly big deal.
[14:46.000 --> 14:52.000]  It could undermine most every foreclosure that we deal with.
[14:52.000 --> 15:03.000]  So I guess my point is, is we need to really discipline ourselves when we look at an issue.
[15:03.000 --> 15:06.000]  And don't start at the end of the issue.
[15:06.000 --> 15:11.000]  That's what the tendency is.
[15:11.000 --> 15:16.000]  You start at the end when people talk to me about criminal issues.
[15:16.000 --> 15:22.000]  They talk about the things that made them feel the most mistreated or betrayed.
[15:22.000 --> 15:27.000]  And they're surprised when I don't want to talk about those things.
[15:27.000 --> 15:29.000]  I tell them, hold on.
[15:29.000 --> 15:30.000]  Let's back up.
[15:30.000 --> 15:32.000]  Let's go back to the beginning.
[15:32.000 --> 15:39.000]  Let's go back to the first word the officer said to you.
[15:39.000 --> 15:45.000]  Let's go back to the first thing he did and walk back through the process.
[15:45.000 --> 15:53.000]  Why it took me so long to do that with the foreclosure issue is I don't know and it's frustrating.
[15:53.000 --> 16:12.000]  And I'm embarrassed at myself for taking so long to find the real issues and now we are at a point where the courts will almost have to start ruling in our favor or otherwise they will undermine the entire body of law.
[16:12.000 --> 16:14.000]  That's where you want to judge.
[16:14.000 --> 16:17.000]  He doesn't want to make new law.
[16:17.000 --> 16:32.000]  He doesn't want to make new law by giving new rulings and he certainly doesn't want to make it by going against well adjudicated, well as accepted issues.
[16:32.000 --> 16:36.000]  The first of which is the contract is the first law.

[23:56.000 --> 24:01.000]  They don't have what we call powdered water, so they silicate just to give it bulk.

[24:03.480 --> 24:08.080]  You put this on, you need it on something well-drained because for you, if you're sitting
[24:08.080 --> 24:15.600]  in water, it'll go to a liquid soap and just get it wet and then rub your hand across it
[24:15.600 --> 24:20.000]  and that will be, I rub my hand across at one time and that's plenty to shampoo my hair

[24:23.600 --> 24:29.480]  It's concentrated, it's really concentrated soap, it doesn't take much at all and the
[24:29.480 --> 24:34.000]  main thing is it doesn't have any bad habits.

[24:39.520 --> 24:42.880]  I tried to make it better worth gave it bad habits.

[01:33:41.440 --> 01:33:59.440]  A controlling case is here in Fort Worth. There's a Whole Foods Market on the west side of Fort Worth. A drunk was pulling out of the Whole Foods Market parking lot and ran the stop sign where he exited the parking lot.
[01:33:59.440 --> 01:34:08.440]  The police pulled him over, wrote him a ticket and for running the stop sign and then found that he was intoxicated and arrested him for DUI.
[01:34:08.440 --> 01:34:17.440]  Courts threw it out because that stop sign was not on a public thoroughfare.
[01:34:17.440 --> 01:34:23.440]  It was on private property. The parking lot is not a public thoroughfare.
[01:34:23.440 --> 01:34:32.440]  Even if it is the parking lot of the police department, it's still not a public thoroughfare.
[01:34:32.440 --> 01:34:36.440]  Transportation, even if you were in transportation,
[01:34:36.440 --> 01:34:40.440]  you're not when you're on that private parking lot.
[01:34:40.440 --> 01:34:46.440]  The transportation code only applies to the public thoroughfares.

[01:34:54.440 --> 01:35:09.440]  What I would have done when I realized what was going on, I would have marched right back into that clerk's office and said, excuse me, sir, or ma'am, or whoever it is, but this is not what I was trying to file.

[01:42:44.440 --> 01:42:56.440]  So you do a pre-litigation discovery to the towing company to get an accounting of all of the tows they've done from this parking lot.
[01:42:56.440 --> 01:43:08.440]  And then go around and look at some of the other complexes, and if you find the signage out of code, name them as well.
[01:43:08.440 --> 01:43:17.440]  And ask for an accounting of all of the tows made from each of these parking facilities, and then sue for all of them.
[01:43:17.440 --> 01:43:23.440]  And under a private attorney general suit, you get to keep it all.

[01:47:27.440 --> 01:47:38.440]  Any private corporation, according to the Texas Business Organization Code, says all these different criteria for different types of corporations,
[01:47:38.440 --> 01:47:48.440]  but what's all consistent is you must register with the Secretary of State and get a certificate, and they don't have it.
[01:47:48.440 --> 01:47:51.440]  Well, there's a problem with that.
[01:47:51.440 --> 01:47:59.440]  About three years ago, a state judge threw Bank of America out of Idaho.
[01:47:59.440 --> 01:48:05.440]  He said, you're not registered to do business in Idaho, get out of my state.
[01:48:05.440 --> 01:48:12.440]  Three days later, the federal courts came down and said they are registered to do business with federal government.
[01:48:12.440 --> 01:48:19.440]  They can do business in any state they want to, and you don't have a thing to say about it.
[01:48:19.440 --> 01:48:23.440]  They landed on them like a ton of bricks.
[01:48:23.440 --> 01:48:26.440]  That has been adjudicated.
[01:48:26.440 --> 01:48:28.440]  I don't think we're going to get any traction.
[01:48:28.440 --> 01:48:34.440]  There's been a lot of people who have raised that issue and it's never got anywhere.
[01:48:34.440 --> 01:48:42.440]  Well, that was an attorney I was meeting with last night here by the name of Bill Gammon, and he brought it up and we were all discussing.
[01:48:42.440 --> 01:48:52.440]  That's us pros and cons with these attorneys that had a meeting here to try to get into a defense position to help homeowners.
[01:48:52.440 --> 01:48:57.440]  Okay, tell Bill Ganon, read the contract.
[01:48:57.440 --> 01:49:02.440]  Stop drinking the Merse Kool-Aid. Stop drinking the Bank's Kool-Aid.

[01:49:32.440 --> 01:49:43.440]  Well, I know they came underneath the Banking Act of 1938, and then still they have bylaws and they have board of directors.

[01:49:51.440 --> 01:49:55.440]  I hear you. It's kind of like a tax case in the federal court.

[01:49:58.440 --> 01:50:05.440]  It's the same thing with Fannie Mae, but I just wanted to get that out there because the more people we can go down and look at these things,

[01:50:46.440 --> 01:50:58.440]  I talked to Bill Gammon once and he was filing 51903 actions and he couldn't get the judges to rule on them.
[01:50:58.440 --> 01:51:05.440]  Well, if I can get the judge off the dime easy enough because some prosaed, I can keep the judge in his behind,
[01:51:05.440 --> 01:51:13.440]  but something occurred to me about 51903, that could be a real trap.
[01:51:13.440 --> 01:51:24.440]  Because once you filed a 51903, is the judge rules against you, that's not appealable.
[01:51:24.440 --> 01:51:26.440]  So that's a done deal.
[01:51:26.440 --> 01:51:32.440]  I've actually had people go down and file those because I heard you on the show talk about it,
[01:51:32.440 --> 01:51:37.440]  so I went down and looked it up and it was true, so I had people go file the motions.
[01:51:37.440 --> 01:51:42.440]  I've had two judges there in Travis County not even want to rule on it at all.
[01:51:42.440 --> 01:51:51.440]  Well, you can petition for a writ of mandamus from the Court of Appeals ordering him to do his job.
[01:51:51.440 --> 01:51:55.440]  If he doesn't want to rule on it, file a judicial contract complaint against him.
[01:51:55.440 --> 01:52:00.440]  Go down to the grand jury and ask the district attorney to arrest him.
[01:52:00.440 --> 01:52:07.440]  Misbeisance in office, fail to perform a duty he's required to perform.
[01:52:07.440 --> 01:52:12.440]  Work code says we can do that.

[01:53:00.440 --> 01:53:09.440]  Instead of complaining about these judges failing to determine the facts in accordance with the rules of evidence,
[01:53:09.440 --> 01:53:17.440]  and then applying the law as it comes to them to the facts in the case, that's a ministerial duty.
[01:53:17.440 --> 01:53:27.440]  Fail to do that, we should go down and appeal to a grand jury of our peers, not to a court of their peers.
[01:53:27.440 --> 01:53:31.440]  We start pushing to get these guys in front of a grand jury.
[01:53:31.440 --> 01:53:39.440]  We're going to start getting their attention because grand juries like playing Russian roulette.
[01:53:39.440 --> 01:53:45.440]  What if that jerk actually gets to one of the grand jury members and they pick it up,
[01:53:45.440 --> 01:53:51.440]  and they look at it and they decide he's right, I'm history.
[01:53:51.440 --> 01:53:57.440]  We need something to think about, and I'm looking at doing that, but my concern was 51903,

[01:54:03.440 --> 01:54:11.440]  is that it's an expert to the hearing, nobody's there, just a judge, no oral argument based on the pleadings,

[01:54:17.440 --> 01:54:22.440]  And they set that up because of the so-called Republic of Texas people that were filing liens,

[01:54:28.440 --> 01:54:35.440]  we can't get it to collapse, and I get confused with this engineering degree here in my head.
