[04:54.280 --> 04:58.280]  Okay, Eric, sum up the issue for me one more time, just succinctly.
[04:58.280 --> 05:04.280]  What exactly is the question you want to have answered?
[05:04.280 --> 05:10.280]  My brother didn't send him the ticket.
[05:10.280 --> 05:17.280]  And so the court, so he didn't appear within 15 days or didn't sign the ticket.
[05:17.280 --> 05:23.280]  So the court entered basically, I guess, a default judgment against him
[05:23.280 --> 05:27.280]  and sent a letter to the Department of Licensing telling him this.
[05:27.280 --> 05:31.280]  So the Department of Licensing is going to suspend his license.
[05:31.280 --> 05:44.280]  The question is, how do we get the court to vacate their order?
[05:44.280 --> 05:50.280]  Okay, as far as I know, in Washington State, they still try these as criminal cases.
[05:50.280 --> 05:55.280]  So unless he actually signs something allowing him or the statute specifically allows them
[05:55.280 --> 06:01.280]  to conduct an ex parte criminal proceeding and convicting in absentia,
[06:01.280 --> 06:07.280]  the only thing they're moving forward on now is the administrative portion.
[06:07.280 --> 06:13.280]  The problem is, is the administrative portion can't proceed properly and legally
[06:13.280 --> 06:17.280]  until there is an actual conviction on the criminal side.
[06:17.280 --> 06:23.280]  And even then, those things that they do after the fact are never things determined by a jury,
[06:23.280 --> 06:29.280]  which means they're done outside of the judicial process, i.e., they're administrative.
[06:29.280 --> 06:33.280]  That puts them right back in the realm of bills of attainder.
[06:33.280 --> 06:38.280]  You're getting punished administratively through a specific piece of legislation
[06:38.280 --> 06:43.280]  without any judicial review or finding a fact.
[06:43.280 --> 06:48.280]  And that is forbidden in every state of the union.
[06:48.280 --> 06:54.280]  Okay. Now, if they've actually got this set up as a complete administrative proceeding
[06:54.280 --> 06:57.280]  and you've acquiesced to it, that's a whole other animal.
[06:57.280 --> 07:04.280]  But as far as I know, Washington State still tries these as i.e., criminal cases.
[07:04.280 --> 07:10.280]  Okay. So have they charged your brother criminally?
[07:10.280 --> 07:12.280]  Well, all they did is send him a ticket.
[07:12.280 --> 07:14.280]  As far as I know, he didn't send it in.
[07:14.280 --> 07:18.280]  And typically what they have you do is they have...
[07:18.280 --> 07:20.280]  Wait. Stop. Stop. Back up.
[07:20.280 --> 07:23.280]  You said they sent him a ticket?
[07:23.280 --> 07:27.280]  No. No. The cop gave him a ticket.
[07:27.280 --> 07:35.280]  Okay. The cop wrote him a ticket and he filed a promise to appear.
[07:35.280 --> 07:46.280]  Is there statute in Washington that states that if you sign a promise to appear and fail to appear
[07:46.280 --> 07:51.280]  that your license is necessarily revoked?
[07:51.280 --> 07:54.280]  I don't know that.
[07:54.280 --> 08:02.280]  Okay. We probably can't help you a whole lot until you read the traffic code.
[08:02.280 --> 08:06.280]  And I would suggest that you pull out the traffic code.
[08:06.280 --> 08:16.280]  It won't take as long as you expect because that portion of the traffic code that goes to the implementation
[08:16.280 --> 08:20.280]  is just a small section generally in the front.
[08:20.280 --> 08:26.280]  And as you read through it, there will be a lot of things that you, for the most part,
[08:26.280 --> 08:32.280]  at the moment as concerns this case, you won't be terribly interested in.
[08:32.280 --> 08:34.280]  You may want to read them later.
[08:34.280 --> 08:42.280]  It's always fun to read the codes because sometimes you find some really interesting things in the code
[08:42.280 --> 08:47.280]  and each code I read really surprises me in Texas.
[08:47.280 --> 08:50.280]  Failure to yield right of way.
[08:50.280 --> 09:02.280]  The code says if you failed yield right of way while exiting an alley, you could be charged.
[09:02.280 --> 09:06.280]  That is the only thing that applies to.
[09:06.280 --> 09:08.280]  And they size you for everything else.
[09:08.280 --> 09:11.280]  So you might want to just kind of quickly read through the code,
[09:11.280 --> 09:18.280]  but then get the Washington criminal procedure code.
[09:18.280 --> 09:26.280]  And just go through that quickly, mainly probably the first quarter of the code.
[09:26.280 --> 09:33.280]  We'll give you all of the basic due process stuff that everybody is supposed to do.
[09:33.280 --> 09:41.280]  If you have a traffic code, the traffic code will be secondary to the code of criminal procedure.
[09:41.280 --> 09:46.280]  Code of criminal procedure will define how criminal cases are addressed.
[09:46.280 --> 09:54.280]  And then you look at the traffic code to see how it makes adjustments to what they can do.
[09:54.280 --> 09:56.280]  They can't.
[09:56.280 --> 10:02.280]  The code of criminal procedure will define due process.
[10:02.280 --> 10:07.280]  And because traffic is somewhat different, there may be some adjustments in the traffic code.
[10:07.280 --> 10:10.280]  But if you find a place where one can fix conflicts with the other,
[10:10.280 --> 10:14.280]  you know, we'll just go back to code of criminal procedure.
[10:14.280 --> 10:19.280]  Get just a general quick overview.
[10:19.280 --> 10:20.280]  Just read it.
[10:20.280 --> 10:22.280]  Don't try to understand all of it.
[10:22.280 --> 10:24.280]  Just read it.
[10:24.280 --> 10:28.280]  And that's important because of the way these statutes are stuck together.
[10:28.280 --> 10:31.280]  They're not passed in order.
[10:31.280 --> 10:33.280]  They pass all these different laws.
[10:33.280 --> 10:42.280]  And then they hire a publishing company to go into the general laws or the public laws
[10:42.280 --> 10:45.280]  and codify them all together in a code.
[10:45.280 --> 10:48.280]  Go get all the ones that apply to traffic and put them in here.
[10:48.280 --> 10:57.280]  Go get all the ones that apply to criminal due process and put them in this one, call it criminal procedure.
[10:57.280 --> 11:03.280]  So, and when you read it, when they codify it, they'll have a section on venue.
[11:03.280 --> 11:06.280]  They'll have a section on culpability.
[11:06.280 --> 11:10.280]  And culpability may apply to something way in the back.
[11:10.280 --> 11:14.280]  You may read something way in the back that applies to something in the front.
[11:14.280 --> 11:21.280]  So, the way to kind of get it down, you just read to the whole thing.
[11:21.280 --> 11:23.280]  And then go back and go through it again.
[11:23.280 --> 11:26.280]  You will be surprised how quickly you can do this.
[11:26.280 --> 11:33.280]  And when you go through it the second time, you'll read something up front that has a specific requirement
[11:33.280 --> 11:39.280]  and you look at it and you'll say, ah, now I know why they put that here.
[11:39.280 --> 11:47.280]  And that's because the five chapters down there was something that this referred to.
[11:47.280 --> 11:54.280]  I talked to my county attorney and I was dumping code on him.
[11:54.280 --> 11:57.280]  And I told him we were talking about illegal practice law.
[11:57.280 --> 12:08.280]  And I said, you know, Greg, illegal act practice law only applies to someone representing someone in a personal interest suit.

[15:27.280 --> 15:35.280]  to sue you in a capacity of a private attorney general to collect all that funds from you.
[15:35.280 --> 15:43.280]  Send that to the city attorney or the city manager and say, okay, we fight.
[15:43.280 --> 15:47.280]  You're going to make four or 500 bucks on me.
[15:47.280 --> 15:50.280]  I'm going to cost you 10,000.
[15:50.280 --> 15:54.280]  This is a nice trade.
[15:54.280 --> 15:59.280]  And then take that lawsuit and give it to everybody you see who gets a ticket.
[15:59.280 --> 16:04.280]  Cost them 500 bucks to pay the ticket three to 500.
[16:04.280 --> 16:08.280]  And it costs you 120 bucks to sue them.

[22:52.280 --> 23:03.280]  Because what that will do is give you what psychology we call a referential index. You will lay down mental markers.
[23:03.280 --> 23:23.280]  When you go back and read it a second time, you have a full range of mental marker. So when you read a statute at the front, you'll have markers on all the codes through the rest of the code, and you'll start attaching these together.

[23:27.280 --> 23:43.280]  So they don't have a comprehensive understanding. I've read Texas Code a couple of times, and I know people who listen to the show, they hear me quoting all these statutes, me and Eddie just ripping off these statutes.
[23:43.280 --> 24:01.280]  But they don't realize they're the same ones over and over. There's only a few of them that are really important, and that's just a very specific issue. Then we go to a specific one. But once you read the code a couple of times, you know where to look.
[24:01.280 --> 24:19.280]  Let me give you an example. In the last legislature, there had been a bill proposed to increase the punishment for official oppression where bodily injury was involved from a classy misdemeanor to a felony.
[24:19.280 --> 24:37.280]  And the prosecutor came up before the legislature and told them that the only thing they could charge these officers with who beat this 15-year-old boy for a minute and a half, five of them, after he had given up, they kicked and stomped and punched for a minute and a half.
[24:37.280 --> 24:44.280]  If you don't think a minute and a half is a long time, you watch this video. It was a really long time.
[24:44.280 --> 24:50.280]  And he said all he could charge them with was official oppression, class A misdemeanor.
[24:50.280 --> 25:01.280]  And, you know, Eddie and I read the code to him. We said, wait a minute, wait a minute, there's another one. You know, I looked at it and I said, wait, wait, I remember something else.
[25:01.280 --> 25:25.280]  And I went to aggravated assault. And that little marker that got stuck in my memory led me right to 22.04 paragraph B2A that said if someone commits assault, simple assault,
[25:25.280 --> 25:38.280]  if they say something to you that a normal person would consider assaultive or threatening, and they do so while displaying a deadly weapon, that second degree felony aggravated assault.
[25:38.280 --> 25:49.280]  However, if they do that while acting under the color, meaning pretense of official authority, that's first degree felony.
[25:49.280 --> 25:56.280]  And Eddie went before the legislature and just ripped them to pieces.
[25:56.280 --> 26:04.280]  I would not have wanted to be that prosecutor who had just lied to these legislators.
[26:04.280 --> 26:17.280]  They got the law passed, but the prosecutor probably had no idea about that statute.
[26:17.280 --> 26:27.280]  They haven't read the whole thing. They don't have a comprehensive idea of how the pieces fit together. You and them do twice.
[26:27.280 --> 26:32.280]  You will have a good comprehensive idea of how the laws fit together.
[26:32.280 --> 26:40.280]  And what it will do is give you a level of freedom you have never had before.
[26:40.280 --> 26:48.280]  When those red lights come on behind you, your stomach won't turn into knots anymore.
[26:48.280 --> 26:53.280]  You won't get butterflies afraid of what's going to happen.
[26:53.280 --> 27:01.280]  When lights come on behind me, I look up at my rear view mirror and I think, come on, Bubba, take your best shot.

[48:30.280 --> 48:46.280]  I have a case that I'm working on today where the document was, the deed of trust was created on the second.
[48:46.280 --> 48:58.280]  And the deed of trust was verified, I think, on the eighth or ninth, or several days later.
[48:58.280 --> 49:08.280]  And that was one of the questions I wanted to ask is, when I see something like this,
[49:08.280 --> 49:18.280]  if I go in and say, well, you know, the closing date was on the second, the date of the jurorate was on the fifth.
[49:18.280 --> 49:25.280]  That means the jurorate is invalid and the document should be declared for it.
[49:25.280 --> 49:35.280]  Well, you've got a judge sitting up here and he's saying, wait a minute, you're going to deny the lender in his remedy
[49:35.280 --> 49:45.280]  because someone may have accidentally put a five instead of a two on the document.
[49:45.280 --> 49:55.280]  How do I make an argument that will tell the judge this was not an honest mistake?
[49:55.280 --> 50:06.280]  This is against the law and it's against the law for this reason. What would that reason be?
[50:06.280 --> 50:13.280]  The notary has a duty to verify the date on all documents.
[50:13.280 --> 50:21.280]  No, that's not where I'm going. I'm looking for something more functional.
[50:21.280 --> 50:30.280]  Not just that he has the duty. I'm looking for why did he deliberately do this?
[50:30.280 --> 50:43.280]  Or if it wasn't the notary, how, why did this document get put in the record with a closing date of one day
[50:43.280 --> 50:50.280]  and a notary signature of a later date?
[50:50.280 --> 50:59.280]  I'm going to assume this was done deliberately. They knew it was improper, but they had some other lascivious reason for doing it.
[50:59.280 --> 51:01.280]  What would that reason be?
[51:01.280 --> 51:09.280]  Are we talking about as far as the, are we talking one document that bears that or are we talking?
[51:09.280 --> 51:18.280]  No, this is, this is pretty consistent. I'm really talking about backdating.
[51:18.280 --> 51:32.280]  I'm saying the notary put the right date on there, but somebody else changed the date on the document.
[51:32.280 --> 51:42.280]  Or they brought this document to closing and closing actually happened on the fifth, but the document had the second on it.

[51:48.280 --> 51:53.280]  That's a good question because I'm not sure I'm following you on which, okay.
[51:53.280 --> 51:57.280]  How does the backdating issue work?
[51:57.280 --> 52:01.280]  The backdating works like this.
[52:01.280 --> 52:12.280]  They have a specific date that they have to close by, which is, and this is only, this only is in regards to a refinance.
[52:12.280 --> 52:20.280]  If it's a, if the refinance deal, they have what is, is called their rate lock date.
[52:20.280 --> 52:26.280]  This, it's called something different if it's a new, a new home loan.

[01:23:23.280 --> 01:23:26.280]  because it is the nature of government to be corrupt.
[01:23:26.280 --> 01:23:30.280]  They cheat, they lie, there are no good running scoundrels.
[01:23:30.280 --> 01:23:37.280]  We use that, you know, when I had someone in Fort Lauderdale, Florida
[01:23:37.280 --> 01:23:41.280]  want me to come down there and help them with an IRS issue.
[01:23:41.280 --> 01:23:48.280]  And we use the IRS manual against the IRS and wound up getting an IRS agent fired.
[01:23:48.280 --> 01:23:49.280]  Good.
[01:23:49.280 --> 01:23:53.280]  And it did kind of feel bad about that because it wasn't my intention to get her fired.
[01:23:53.280 --> 01:24:04.280]  But what she had done was listen to a U.S. attorney and something stupid
[01:24:04.280 --> 01:24:10.280]  because the U.S. attorney told her to and she had this misplaced notion
[01:24:10.280 --> 01:24:14.280]  that the U.S. attorney would protect her and it absolutely would not.
[01:24:14.280 --> 01:24:20.280]  She's fortunate he didn't prosecute her for doing what he told her to.
[01:24:20.280 --> 01:24:21.280]  Interesting.
[01:24:21.280 --> 01:24:26.280]  And I hope that's not lost on you.
[01:24:26.280 --> 01:24:32.280]  You have to expect everybody that you deal with in the federal government
[01:24:32.280 --> 01:24:36.280]  are dirty, rotten scoundrels and turn on you in a heartbeat.

[01:25:29.280 --> 01:25:34.280]  An example of this is when I bushwacked the head criminal district judge
[01:25:34.280 --> 01:25:39.280]  in Travis County with criminal charges against the district attorney
[01:25:39.280 --> 01:25:43.280]  for secreting criminal complaints against all the highest judges in Texas
[01:25:43.280 --> 01:25:44.280]  from the grand jury.
[01:25:44.280 --> 01:25:50.280]  He said, well, Mr. Kelsen, you really need to take this to a judge's piece.
[01:25:50.280 --> 01:25:56.280]  When I was a judge's piece, I took criminal complaints, tried that judge,
[01:25:56.280 --> 01:25:59.280]  went to O'Hurb over here, and he wouldn't take them
[01:25:59.280 --> 01:26:03.280]  because there were complaints against you in there.
[01:26:03.280 --> 01:26:06.280]  See, I knew what the judge was going to tell me.
[01:26:06.280 --> 01:26:12.280]  I knew where he was going to send me and knew what he was going to do.
[01:26:12.280 --> 01:26:14.280]  You're in government.
[01:26:14.280 --> 01:26:20.280]  Look around, talk to other people who've tried to fight similar issues.

[01:26:21.280 --> 01:26:23.280]  Look, see what they did.
[01:26:23.280 --> 01:26:30.280]  And then back up, lay the groundwork to cover those spaces
[01:26:30.280 --> 01:26:37.280]  so that when you walk in, you have the appearance of having them set up.
[01:26:37.280 --> 01:26:43.280]  Now, to find those similar issues, do you think I should look into the court record
[01:26:43.280 --> 01:26:45.280]  or should I go to the union?
[01:26:45.280 --> 01:26:47.280]  I mean, ouch.

[01:26:48.280 --> 01:26:53.280]  That is a good question, which is more corrupt.
[01:26:53.280 --> 01:27:02.280]  The unions are corrupt, but the unions at least admit they're corrupt.

[01:27:04.280 --> 01:27:10.280]  When I was growing up in Chicago, I was very familiar with wise guys.
[01:27:10.280 --> 01:27:13.280]  And wise guys were criminals.

[01:27:16.280 --> 01:27:21.280]  And I could deal with them a lot better than I could to police.
[01:27:21.280 --> 01:27:28.280]  Because they had a certain degree of honor and dignity.

[01:27:29.280 --> 01:27:36.280]  As long as you didn't cross them, they wouldn't cross you.

[01:27:40.280 --> 01:27:42.280]  They didn't cheat you.
[01:27:42.280 --> 01:27:46.280]  If they wanted money from you, they'd come to you and say, I want money from you.
[01:27:46.280 --> 01:27:48.280]  And this is the reason I want it.
[01:27:48.280 --> 01:27:56.280]  We had, I ran, managed a restaurant and had these guys come in and turn my cigarette machines around.
[01:27:56.280 --> 01:28:00.280]  And that means don't put anything in them.
[01:28:00.280 --> 01:28:07.280]  Two weeks later, they come back and turned them back around and paid me twice as much as I would have made from them.
[01:28:07.280 --> 01:28:08.280]  Fine.
[01:28:08.280 --> 01:28:14.280]  If you're dealing with a criminal who's openly a criminal, they're easier to deal with.
[01:28:14.280 --> 01:28:16.280]  You know exactly what you're dealing with.
[01:28:16.280 --> 01:28:21.280]  The feds are a lot more difficult because they pretend like they're not criminals.
[01:28:21.280 --> 01:28:24.280]  And they are absolutely the most vicious.
[01:28:24.280 --> 01:28:33.280]  However, they also understand that they're swimming around in the pool.
[01:28:33.280 --> 01:28:36.280]  And this pool is full of fishes.
[01:28:36.280 --> 01:28:42.280]  Little fishes and bigger fishes and bigger fishes and bigger fishes.
[01:28:42.280 --> 01:28:48.280]  And everybody in the chain feels vulnerable.
[01:28:48.280 --> 01:28:56.280]  If you have done your homework, when you go to the fish that appears to be bigger than you.
[01:28:56.280 --> 01:29:06.280]  And everything he tries, you have cut him off from, then he's going to perceive that you're a bigger fish than he is.
[01:29:06.280 --> 01:29:12.280]  People in these positions are terrified because crabs in a bucket.
[01:29:12.280 --> 01:29:22.280]  The higher you are up in this organization, the more people below you have that want your position.
[01:29:22.280 --> 01:29:35.280]  In this case, don't use the manuals and the procedures only to help you create political pressure because everything is political.
[01:29:35.280 --> 01:29:43.280]  Get the politics on your side, and the politics of fear is the most powerful one.

[01:34:45.280 --> 01:35:03.280]  If you take notes electronically and then take those notes and convert them into a printed version instead of some other version like vocal,

[01:35:16.280 --> 01:35:29.280]  A transcript is notes. I was once in court and the lawyer kept asking me questions and I was telling him exactly what had been said three years before.

[01:35:33.280 --> 01:35:36.280]  Oh, no, I have a terrible memory.
[01:35:36.280 --> 01:35:44.280]  And the judge kind of ducked his head and put it in his hand. He saw what was coming. The lawyer never caught on.
[01:35:44.280 --> 01:35:50.280]  Mr. Kelton, you have a perfect memory and you can tell us exactly what happened? Oh, yes.
[01:35:50.280 --> 01:35:55.280]  And one thing I learned about testifying is never volunteer anything. I said, oh, yes.
[01:35:55.280 --> 01:35:59.280]  He expected me to elaborate and I didn't.
[01:35:59.280 --> 01:36:06.280]  Well, Mr. Kelton, if you have a terrible memory, how is it that you know exactly what was said?
[01:36:06.280 --> 01:36:11.280]  And the judge kind of ducked his head because he absolutely saw this coming.
[01:36:11.280 --> 01:36:16.280]  I said, well, I transcribed it from the recording, objection, objection.
[01:36:16.280 --> 01:36:24.280]  And the judge is shaking said, no, counselor, you opened the door.
[01:36:24.280 --> 01:36:36.280]  And he's really saying you should have saw this coming a mile off. But I did not introduce the recording because that'll raise a lot of issues.
[01:36:36.280 --> 01:36:45.280]  So I just told him exactly what was said and they said, are you sure I am absolutely certain that is exactly what was said.
[01:36:45.280 --> 01:36:54.280]  Well, if I take notes, what's the odds on the judge saying will admit admissible your your your notes in court.
[01:36:54.280 --> 01:37:05.280]  Almost always handwritten notes or notes that you have taken are extremely valuable and absolutely relevant.
[01:37:05.280 --> 01:37:10.280]  They are far more powerful than the recording itself.
[01:37:10.280 --> 01:37:21.280]  Very good, very good. So I need to continue to take notes and do what I feel that's just on my own.
[01:37:21.280 --> 01:37:24.280]  Take my own private notes like I always have.
[01:37:24.280 --> 01:37:26.280]  So take notes.
[01:37:26.280 --> 01:37:31.280]  But before you use those notes, be careful.
[01:37:31.280 --> 01:37:39.280]  Yeah, if you if you frighten everybody around you, they'll want you going no fight.

[01:37:45.280 --> 01:37:49.280]  Fortunately, everybody that I work with, I get along great with everybody.

[01:38:02.280 --> 01:38:09.280]  And so and that's the last thing I ever want to get involved with is any kind of trouble.

[01:38:15.280 --> 01:38:24.280]  I learned, I practiced, I learned private investigation over in Van Nuys, California from some very great guys.
[01:38:24.280 --> 01:38:33.280]  And I learned how to, you know, record audio notes, your things if you have to, even drop dead notes.
[01:38:33.280 --> 01:38:43.280]  Audio record them and then later write them down, you know, write them all down if you have to, or type them all up, you know, and make your notes.
[01:38:43.280 --> 01:38:51.280]  And I've learned these things and I was just trying to figure out if I can apply that with my work.
[01:38:51.280 --> 01:38:56.280]  If there's ever a future problem with my work, I'll have these notes.
[01:38:56.280 --> 01:39:02.280]  Those notes will be absolutely a gold mine.

[01:42:45.280 --> 01:42:53.280]  And the reason I know this is because I made it like a rule for me every time we were signing

[01:47:01.280 --> 01:47:08.280]  Okay. Yeah, no, I haven't found anything about back-dating because once we find the loan dust,
[01:47:08.280 --> 01:47:12.280]  they leave. I have no access to see those loan dusts anymore after that.
[01:47:12.280 --> 01:47:16.280]  And if you look on my document there on the trustee,
[01:47:16.280 --> 01:47:21.280]  the notary on my document was actually my escrow officer.
[01:47:21.280 --> 01:47:26.280]  And I don't know if it's a conflict of interest, but I know that if I'm a real estate agent,
[01:47:26.280 --> 01:47:31.280]  I cannot notarize documents for the client that I'm representing.
[01:47:31.280 --> 01:47:36.280]  So I don't know what the rules are with the public notaries.
[01:47:36.280 --> 01:47:46.280]  In a lot of the documents, she notarized so many documents for my client, she was the escrow officer and she was also the notary.
[01:47:46.280 --> 01:47:56.280]  Now, in the good old days, the real estate agent was the one that set up the appraisal
[01:47:56.280 --> 01:47:59.280]  and the loan signing document.
[01:47:59.280 --> 01:48:09.280]  Okay, from talking to Chris earlier, I would think, based on what he said,
[01:48:09.280 --> 01:48:16.280]  that there's no way the escrow agent could be the notary because he is an interested party.
[01:48:16.280 --> 01:48:21.280]  Yeah, so that's why it sounded very interesting because I know that on my document,
[01:48:21.280 --> 01:48:31.280]  I was with my escrow officer the one that signed it and I know that she signed tons and tons and tons of documents that she was the escrow officer.
[01:48:31.280 --> 01:48:35.280]  So I don't know if it would be a conflict of interest.
[01:48:35.280 --> 01:48:42.280]  Is there something in the documentation that will show the name of the escrow officer?
[01:48:42.280 --> 01:48:50.280]  I looked at it and it would never, I don't have the escrow instructions that I couldn't locate my packet.
[01:48:50.280 --> 01:48:56.280]  And when I asked for that validation, I didn't get escrow instructions.
[01:48:56.280 --> 01:48:59.280]  I just kept all the documents that we were working on.
[01:48:59.280 --> 01:49:03.280]  But it would be interesting if I could find the escrow instructions.
[01:49:03.280 --> 01:49:07.280]  Then you could see her name there because she was the escrow officer.
[01:49:07.280 --> 01:49:13.280]  I mean, I'm a hundred percent sure because we did a lot of documents,
[01:49:13.280 --> 01:49:18.280]  whether they were purchases or refinances.
[01:49:18.280 --> 01:49:29.280]  That's an interesting situation where the escrow officer is also the notary.
[01:49:29.280 --> 01:49:38.280]  And the concern is I take it that the title company is not the one that does the closing.
[01:49:38.280 --> 01:49:45.280]  I was under the impression that that was the case, but apparently it's not, is the escrow officer.
[01:49:45.280 --> 01:49:51.280]  That table, a lot of times when that's not the case, it was always me.
[01:49:51.280 --> 01:49:58.280]  The real estate agent, the loan officer was never there at the table and the escrow person and the title.
[01:49:58.280 --> 01:50:03.280]  And when we had an outside notary, then the notary.
[01:50:03.280 --> 01:50:09.280]  But whenever we signed the escrow, it was the same escrow officer, the one that notarized the documents and closing.
[01:50:09.280 --> 01:50:14.280]  We never see any other person there, not from the bank and not from title.
[01:50:14.280 --> 01:50:18.280]  And most of the time not even.
[01:50:18.280 --> 01:50:23.280]  Chris, if you're still listening, can you call back in?
[01:50:23.280 --> 01:50:32.280]  I would like to hear your take on the propriety of the escrow officer also being the notary.
[01:50:32.280 --> 01:50:40.280]  From what I've heard so far, it would seem like that that would constitute a conflict of interest,

[01:50:44.280 --> 01:50:48.280]  I know because sometime I tried to get a notary seal.
[01:50:48.280 --> 01:50:55.280]  And then when they told me that I couldn't notarize my own documents, my client's documents,
[01:50:55.280 --> 01:50:58.280]  then I said, oh, hell no, I don't want it.
[01:50:58.280 --> 01:50:59.280]  So I didn't take it.
[01:50:59.280 --> 01:51:03.280]  But you know what, I know real estate agents that have the notary seal.
[01:51:03.280 --> 01:51:11.280]  They cannot sign their own client's documents, but they would sign my document for another agent's document.
[01:51:11.280 --> 01:51:22.280]  That's exactly what I would consider to be the situation that the escrow officer of all people couldn't also be the notary.
[01:51:22.280 --> 01:51:34.280]  And so that raises the question, how do I find out who the escrow officer was exposing?
[01:51:34.280 --> 01:51:39.280]  Well, you know what, most of the people save their documents.
[01:51:39.280 --> 01:51:40.280]  Most of the people.
[01:51:40.280 --> 01:51:48.280]  So if you ask any more of us that are involved, if they have their package with escrow instructions and everything,
[01:51:48.280 --> 01:51:53.280]  then in there you're going to see who the escrow officer and who the notary was.
[01:51:53.280 --> 01:51:57.280]  Where would his name appear in the documentation?
[01:51:57.280 --> 01:52:00.280]  It would appear on the first letters.
[01:52:00.280 --> 01:52:06.280]  Let's say you have an escrow 1697, that's A-I-L.
[01:52:06.280 --> 01:52:09.280]  In this case, ID from the lady that signed this.
[01:52:09.280 --> 01:52:16.280]  Then if you see the, it'll be the first, the letters of the name of the escrow officer.
[01:52:16.280 --> 01:52:25.280]  So who appoints the escrow officer or how does the escrow officer get into the mix?
[01:52:25.280 --> 01:52:32.280]  The real estate agent works with so many, I mean with certain escrow companies.
[01:52:32.280 --> 01:52:41.280]  So every client that I have, I always bring it to my escrow company, the escrow company that I know that is going to close the deal.
[01:52:41.280 --> 01:52:48.280]  Will that be the same company generally that will write the title insurance?
[01:52:48.280 --> 01:52:54.280]  I don't know what they write, but they do all the documents, closing documents, the hard, the final hard one,
[01:52:54.280 --> 01:53:02.280]  and they do all the numbers so that they can make the transfers that they do when they transfer the money.
[01:53:02.280 --> 01:53:10.280]  So we could seek that person out by doing a request for the closing agent.
[01:53:10.280 --> 01:53:19.280]  What does the closing agent or the escrow person have to sign that we could readily find?
[01:53:19.280 --> 01:53:28.280]  The escrow instruction and the closing document, escrow closing, because we have two sets.
[01:53:28.280 --> 01:53:34.280]  When we first start, we get a set of escrow instructions, and then when we're closing,
[01:53:34.280 --> 01:53:40.280]  then we get another set of escrow instructions with all the changes that were made through the transaction.
[01:53:40.280 --> 01:53:49.280]  And then at the end, the escrow officer signs it and puts the deal from the escrow company and they get a verified copy.
[01:53:49.280 --> 01:53:52.280]  And then at the end, they get a verified copy.
[01:53:52.280 --> 01:53:55.280]  Does the borrower get a certified copy?
[01:53:55.280 --> 01:54:02.280]  Because I remember in all the documents I've looked, seeing escrow instructions.
[01:54:02.280 --> 01:54:06.280]  They have to be by law.
[01:54:06.280 --> 01:54:11.280]  They get the first set of instructions and they also get the ones that are closing by law.
[01:54:11.280 --> 01:54:12.280]  They have to send it.
[01:54:12.280 --> 01:54:17.280]  Every one of my clients has a set when we start and a set when we close.
[01:54:17.280 --> 01:54:18.280]  Okay.
[01:54:18.280 --> 01:54:20.280]  What about the hard one settlement statement?
[01:54:20.280 --> 01:54:24.280]  Would that be considered the escrow and I guess it wouldn't?
[01:54:24.280 --> 01:54:32.280]  The escrow officer is the one that puts everything involved, taxes, insurances, interest rates,
[01:54:32.280 --> 01:54:36.280]  all the expenses involved in the loan, every single penny.
[01:54:36.280 --> 01:54:42.280]  And she's the one that creates the final hard one.
[01:54:42.280 --> 01:54:46.280]  Will his name be on the hard one?
[01:54:46.280 --> 01:54:56.280]  That I don't know, but I know that the hard one, when we get the documents, the hard one comes with the closing escrow.
[01:54:56.280 --> 01:54:57.280]  Okay.
[01:54:57.280 --> 01:55:02.280]  Do you know how the escrow agent creates the HUD one?
[01:55:02.280 --> 01:55:03.280]  Okay.
[01:55:03.280 --> 01:55:07.280]  Let me preface that question so you'll know where I'm going.
[01:55:07.280 --> 01:55:15.280]  We're maintaining that the fees on the HUD one statement were not necessarily valid.
[01:55:15.280 --> 01:55:20.280]  So how does the escrow agent know what to put on the HUD one?

[01:55:21.280 --> 01:55:31.280]  The way I can answer that, the best for me is by just going over the questions that we go through like when I'm talking to the escrow officer.
[01:55:31.280 --> 01:55:37.280]  The escrow officer calls me and they say, Juan, is your client going to have a...
[01:55:37.280 --> 01:55:43.280]  We have an insurance in there for one year that if something breaks in anything, then it gets repaired.
[01:55:43.280 --> 01:55:44.280]  And who's paying for it?
[01:55:44.280 --> 01:55:53.280]  Then I'm telling the escrow officer, the lender is paying for that according to our contract or the buyer pays for it according to our contract.
[01:55:53.280 --> 01:55:55.280]  So who's going to pay this?
[01:55:55.280 --> 01:55:57.280]  What about the back taxes?
[01:55:57.280 --> 01:56:08.280]  So she has to put everything in there because by then she already has what we call a title search.
[01:56:08.280 --> 01:56:29.280]  Okay, on the fees that are charged on the HUD one settlement statement, does the escrow agent require invoices or evidence of the fee of the charge?
[01:56:29.280 --> 01:56:44.280]  This is the way they do it and the only things that you can call invoices is when we get some type of insurance like that one that I told you that covers for the four year.
[01:56:44.280 --> 01:56:53.280]  Then with the escrow closing instructions, she will send us the verification that we have that coverage for a year on the property.
[01:56:53.280 --> 01:56:57.280]  But other than that, we don't get any other invoices.
[01:56:57.280 --> 01:57:06.280]  So whatever the escrow agent is told, he just accepts it and puts it on the HUD one?
[01:57:06.280 --> 01:57:07.280]  Yes.
[01:57:07.280 --> 01:57:17.280]  And the way she's communicating, like if she has questions for me, then I have to tell her how it went down, how it's supposed to be put in there.
[01:57:17.280 --> 01:57:31.280]  Okay, so on the fees on the HUD one settlement statement, the escrow agent doesn't get any actual validation of the amounts charged.
[01:57:31.280 --> 01:57:34.280]  He just accepts whatever you're telling?
[01:57:34.280 --> 01:57:36.280]  Yeah, pretty much.
[01:57:36.280 --> 01:57:47.280]  Because we never get any receipts or invoices or anything, he just gets it down in there.

[01:57:49.280 --> 01:58:03.280]  Oh, that is wonderful news because we're claiming that all of the fees are fraudulent because those fees weren't documented.
[01:58:03.280 --> 01:58:11.280]  And we're demanding that the lender improve up all the fees or face criminal fraud charges against him.
[01:58:11.280 --> 01:58:14.280]  So what you just told me is exactly what I wanted to hear.
