[04:13.400 --> 04:16.000]  is for this to be Friday to be a perfect day.
[04:16.000 --> 04:23.480]  I spent the first half of my day in the little town of Rockdale, Texas, where I was assisting
[04:23.480 --> 04:30.680]  someone with a case, and they had the utter fortune to appear in front of one of Texas'
[04:30.680 --> 04:34.960]  greatest idiot judges named Jerry Wagner.
[04:34.960 --> 04:42.800]  Now this municipal court judge not only obviously does not understand the law when it's put
[04:42.800 --> 04:49.760]  in front of him, but is willing to admit to criminal activity in his pursuit of convictions
[04:49.760 --> 04:52.160]  in his traffic court.
[04:52.160 --> 04:55.680]  Here's kind of how the day went.
[04:55.680 --> 05:00.680]  The individual was sent a letter telling them to appear for a pretrial hearing in the Rockdale
[05:00.680 --> 05:02.320]  Municipal Court.
[05:02.320 --> 05:06.200]  The pretrial hearing consisted, of course, of nothing more than meeting with the prosecutor
[05:06.200 --> 05:09.400]  to attempt to cut a deal.
[05:09.400 --> 05:14.520]  While we were there, the prosecutor admitted that she had never even seen the four motions
[05:14.520 --> 05:18.360]  that had been filed in this individual's case.
[05:18.360 --> 05:22.960]  To top that off, not only did the prosecutor admit they'd never seen them, when she took
[05:22.960 --> 05:28.280]  them out to the judge to have the judge actually read them, the judge went through one, but
[05:28.280 --> 05:33.400]  ignored the other three, and then proceeded to tell the prosecutor, like, I've seen these
[05:33.400 --> 05:34.400]  before.
[05:34.400 --> 05:36.600]  I've already ruled on these.
[05:36.600 --> 05:41.880]  And of course, the person I was helping objected and said, well, when did you rule on these?
[05:41.880 --> 05:46.920]  And he said, well, whenever you filed them, whenever you were here before, well, we hadn't
[05:46.920 --> 05:49.240]  seen a judge when we were there before.
[05:49.240 --> 05:52.360]  We filed these with the clerk and we had left.
[05:52.360 --> 05:57.800]  So what this judge was admitting to on our little tape recording was that he had been
[05:57.800 --> 06:04.480]  conducting ex parte proceedings for the purpose of hearing these motions and denying them.
[06:04.480 --> 06:11.800]  And then no notice was ever served on this individual regarding this hearing or the determination
[06:11.800 --> 06:14.080]  made on the motions.
[06:14.080 --> 06:20.400]  So basically, we showed up at this pretrial with nobody having done their job at all.
[06:20.400 --> 06:26.680]  And once they were tasked with having to do their job, either lying about it outright
[06:26.680 --> 06:32.440]  and ignoring the law as it's written for the case specifically.
[06:32.440 --> 06:37.400]  Now the paperwork filed in this case went specifically to the issues of lack of notice
[06:37.400 --> 06:41.040]  and therefore lack of jurisdiction.
[06:41.040 --> 06:47.920]  The judge and the prosecutor both chose to ignore the obvious failings of the lack of
[06:47.920 --> 06:53.160]  notice even though we had the entire motion written out, a copy of the page of the book
[06:53.160 --> 07:00.240]  of the Code of Criminal Procedure for 45.018b and the actual book it was copied from so
[07:00.240 --> 07:07.080]  that we could hand a copy to each of them and they both refused to look at the law.
[07:07.080 --> 07:12.920]  They were going to do what they wanted no matter what the law said.
[07:12.920 --> 07:17.760]  So my first order of business now that we're back is me and the individual in question
[07:17.760 --> 07:23.440]  will be filing judicial conduct complaints and bar grievances against both the judge
[07:23.440 --> 07:29.220]  and the prosecuting attorney for conspiring to deprive people in that court of their due
[07:29.220 --> 07:31.400]  process rights.
[07:31.400 --> 07:36.280]  Because basically this female city attorney came out and dictated to the judge the course
[07:36.280 --> 07:42.360]  of action she intended to follow in each case as she took them into the back and they negotiated
[07:42.360 --> 07:43.360]  a deal.
[07:43.360 --> 07:47.040]  Then she'd come out and hand the paperwork over to the judge, judge this is what we're
[07:47.040 --> 07:48.040]  going to do.
[07:48.040 --> 07:51.880]  They're going to do this in a week and a half and they're going to pay this if you'll walk
[07:51.880 --> 07:55.680]  her over there and tell her to do it in installments and blah, blah, blah.
[07:55.680 --> 07:59.080]  Basically the prosecutor was running the court.
[07:59.080 --> 08:08.120]  Now the judge he got snotty fast when he was asked the question when did you hear these?
[08:08.120 --> 08:11.840]  He told the individualized with well lady I've already looked at these and I've already
[08:11.840 --> 08:18.400]  ruled on these but he refused to tell us exactly when that had occurred.
[08:18.400 --> 08:24.280]  Now again like I said we never got any notice that these motions had been read and much
[08:24.280 --> 08:30.040]  less any hearing conducted on them especially considering that the purpose of a pretrial
[08:30.040 --> 08:35.040]  is to discuss the contents of motions already filed in the case.
[08:35.040 --> 08:43.640]  But that was not done today, instead the pretrial was used specifically to deal negotiate.
[08:43.640 --> 08:47.720]  Now Randy can tell you right up front that there are only a few specific reasons in
[08:47.720 --> 08:55.240]  statute that you are allowed to be summoned to appear in a court of law and deal cutting
[08:55.240 --> 08:58.840]  is not one of the things on that list.
[08:58.840 --> 08:59.840]  Prosecutor negotiation.
[08:59.840 --> 09:09.680]  Yeah you'll find all of those in 28.01 code of code procedure and almost all of them go
[09:09.680 --> 09:12.480]  to hearing motions.
[09:12.480 --> 09:18.120]  You can do it for an arraignment and the rest are hearing please emotions.
[09:18.120 --> 09:21.840]  So what we're going to do right off the bat like I say we're going to judicial conduct
[09:21.840 --> 09:26.120]  complaint and bar grieve both the judge and the attorney and we are also going to file
[09:26.120 --> 09:34.400]  a motion to disqualify both the judge and the prosecutor for conspiring to deny rights
[09:34.400 --> 09:41.520]  failing to abide by the laws associated with the duties of their office and simple plain
[09:41.520 --> 09:46.120]  old official oppression and official misconduct.
[09:46.120 --> 09:51.560]  So hang in there folks as this develops out and we take this case through the course of
[09:51.560 --> 09:54.960]  its proceedings just like we did with mine.

[11:39.080 --> 11:47.960]  Well, this looks like a really good place for not only a set of criminal accusations
[11:47.960 --> 11:57.240]  for obstruction of justice extortion official oppression conspiracy to commit and a really
[11:57.240 --> 12:02.520]  nice attorney a private attorney general suit.
[12:02.520 --> 12:05.800]  Yeah, works for me.
[12:05.800 --> 12:14.760]  Sue the city for all of the monies that they've collected enforcing the traffic code against
[12:14.760 --> 12:21.480]  non commercial drivers for the last umpteen years.
[12:21.480 --> 12:29.760]  So we've actually talked to our advisor there on that issue and he is of the opinion that
[12:29.760 --> 12:34.600]  the quote warrant would not actually work for the reason that each of these cases is
[12:34.600 --> 12:40.640]  an individual case when it comes to whether or not you're engaging in the in the regular
[12:40.640 --> 12:42.280]  activity.
[12:42.280 --> 12:46.600]  So if you've got something that would show us how we could do that as a quote warrant
[12:46.600 --> 12:48.480]  over and I'd be more than happy to look at it.

[12:49.480 --> 12:57.840]  I think we're warned to private attorney general in that they are exercising a consistent set
[12:57.840 --> 13:00.840]  of due process abuses.

[13:33.720 --> 13:43.680]  seven times than the citation itself, the creative circumstance where an ordinary person
[13:43.680 --> 13:49.960]  has to make a calculation and the calculation is always against their due process rights.
[13:49.960 --> 13:57.760]  And that's exactly what a private attorney general suit was designed to remedy.
[13:57.760 --> 14:05.680]  Where it's not economically feasible for a single person to sue in this regard because
[14:05.680 --> 14:11.560]  they cannot recover anywhere near the amount of cost that will be involved.
[14:11.560 --> 14:22.320]  However, if they can sue to recover the harm done to everybody, now it becomes worth suit.
[14:22.320 --> 14:27.280]  So if you sue for three times the amount of fees collected in the last 20 years in the
[14:27.280 --> 14:38.240]  traffic court in Rockdale, then they may object and say, well, we ain't been doing this kind
[14:38.240 --> 14:41.800]  of stuff for 20 years, so how many years you've been doing?
[14:41.800 --> 14:48.800]  Yeah, it'd probably be easier to say since at least the mid 60s, we're talking 70 plus
[14:48.800 --> 14:52.800]  years.
[14:52.800 --> 14:57.560]  That would be my opinion, but you know, I don't know how strong statute of limitations
[14:57.560 --> 15:06.000]  would let you go back, but you could certainly go back to good ways and let them argue back.
[15:06.000 --> 15:12.040]  So if you only, if you argue it down to one year, you triple the amount they collected
[15:12.040 --> 15:18.040]  in traffic fees in the last year, that's no small chunk of change.
[15:18.040 --> 15:19.040]  No, probably not.
[15:19.040 --> 15:25.680]  Now, at the rate these people were going through there, they're as big as Austin.

[15:34.520 --> 15:40.640]  And the last time I looked at it was about 10 or 12 years ago in a small town of Venus,

[37:14.220 --> 37:18.620]  performing their duty. So this is

[37:21.100 --> 37:24.540]  different cases, and the plaintiffs won
[37:24.540 --> 37:30.380]  in both cases. So there's absolutely no
[37:30.380 --> 37:33.260]  doubt you have the right to film him,
[37:33.260 --> 37:36.700]  and if you, instead of fighting a
[37:36.700 --> 37:39.660]  defensive posture, if you take on a
[37:39.660 --> 37:44.620]  offensive posture and go after the
[37:44.620 --> 37:45.740]  officer, they know that an action against
[37:45.740 --> 37:47.420]  the officer is going to ultimately be an

[42:29.020 --> 42:31.820]  with the dramatic rise in the number of
[42:31.820 --> 42:35.580]  pro se litigants. They are apparently
[42:35.580 --> 42:39.500]  seeing the internet as the incredibly
[42:39.500 --> 42:42.780]  powerful influence and they were saying
[42:42.780 --> 42:44.940]  this is a serious problem because they
[42:44.940 --> 42:48.620]  really don't have the resources to address
[42:48.620 --> 42:51.820]  all of these pro se litigants.
[42:51.820 --> 42:56.460]  And my comment was your problem, not our
[42:56.460 --> 43:01.820]  problem. And we had someone who had
[43:01.820 --> 43:06.620]  read an article in the Texas Bar
[43:06.620 --> 43:10.380]  Association magazine that indicated that
[43:10.380 --> 43:13.420]  some 20% of all the cases in Texas were
[43:13.420 --> 43:17.340]  now pro se and that was because the
[43:17.340 --> 43:22.620]  public simply did not trust lawyers.
[43:22.620 --> 43:26.140]  Lawyers have gotten so corrupt that
[43:26.140 --> 43:29.340]  nobody trusts them. They're not just
[43:29.340 --> 43:31.260]  corrupt but they're arrogant in their
[43:31.260 --> 43:33.500]  corruption and obvious in their corruption
[43:33.500 --> 43:37.260]  so nobody wants to pay them anymore.

[52:12.940 --> 52:14.620]  officer there she already had all the
[52:14.620 --> 52:17.180]  paperwork
[52:17.180 --> 52:21.180]  because that's what the truth is so
[52:21.180 --> 52:24.460]  that should work out very well except her
[52:24.460 --> 52:27.340]  statement is true and now you want to
[52:27.340 --> 52:29.260]  know when she held that hearing where
[52:29.260 --> 52:31.580]  that officer came to her and gave her
[52:31.580 --> 52:35.020]  that document and the other that was
[52:35.020 --> 52:39.180]  ex parte and that was criminal.
[52:39.180 --> 52:41.260]  Well the other thing that struck me as
[52:41.260 --> 52:43.340]  odd is and I just noticed this in the
[52:43.340 --> 52:46.220]  last few days is the time that is
[52:46.220 --> 52:50.460]  stamped on it and it is not the time

[52:53.660 --> 52:55.020]  impression these things are supposed to
[52:55.020 --> 53:00.620]  be recorded and yes they times they are
[53:00.620 --> 53:02.860]  required to keep an electronic
[53:02.860 --> 53:09.260]  recording and you should ask the jail
[53:09.260 --> 53:11.820]  under discovery to produce the recording

[53:14.140 --> 53:16.060]  magistration or whatever that hearing
[53:16.060 --> 53:19.020]  they want to call it was. Yeah and they
[53:19.020 --> 53:21.180]  time-stamped this this uh supposed
[53:21.180 --> 53:24.860]  arraignment document it's time-stamped
[53:24.860 --> 53:27.900]  at six fifty one p.m. it was three in the
[53:27.900 --> 53:32.940]  morning.

[53:36.860 --> 53:39.580]  six fifty one the evening before the
[53:39.580 --> 53:42.540]  morning or sixty six fifty one the

[54:22.140 --> 54:24.220]  guys will lie and they'll produce

[54:31.340 --> 54:33.900]  and they will absolutely falsify

[54:52.620 --> 54:55.980]  some other issue that has nothing to
[54:55.980 --> 54:57.820]  do with your case that that they're
