[09:26.920 --> 09:31.320]  We lie to get something we want to protect the feelings of others, to prevent conflict,
[09:31.320 --> 09:36.720]  to create conflict, to get our way, as well as to fool others about who and what we are

[09:40.440 --> 09:43.640]  We lie to obtain fame, fortune, and power.
[09:43.640 --> 09:48.960]  And nowhere has this declaration become truer than in that thing we naively call the rule

[09:50.460 --> 09:54.880]  The proclamation of the rule of law itself is a lie so heinous as to deserve capital
[09:54.880 --> 09:59.360]  punishment for those that would dare propagate what can only be considered yet another of
[09:59.360 --> 10:05.120]  the greatest lies of our society, that we are a nation of laws and not of men.
[10:05.120 --> 10:10.800]  The rule of law is a preponderous lie, an insider's joke, a punchline, really, along
[10:10.800 --> 10:16.240]  with the monstrous lies about the war on drugs and the ensuing rights violations propagated
[10:16.240 --> 10:17.320]  by it.
[10:17.320 --> 10:22.120]  The acts of 9-11 coupled with fables of weapons of mass destruction in order to create the
[10:22.120 --> 10:24.400]  ensuing war on terror.
[10:24.400 --> 10:29.080]  The Oklahoma City bombing and the subsequent murder of Officer Terrence Yakey.
[10:29.080 --> 10:33.880]  Government agents murdering civilians at both Ruby Ridge, Idaho, and Waco, Texas.
[10:33.880 --> 10:39.320]  Income taxes, social security, bank bailouts, driver's licenses, automobile registration
[10:39.320 --> 10:44.640]  and forced insurance, governmental sovereignty, and oh so many others.
[10:44.640 --> 10:48.240]  All you have to do to see the proof of this is to look at our American government's criminal
[10:48.240 --> 10:53.360]  activities, both state and federal, and how those actions are being illegally protected
[10:53.360 --> 10:56.000]  both within and without the courts.
[10:56.000 --> 11:00.400]  We have gone from a nation founded on the right to individual unalienable rights and
[11:00.400 --> 11:05.520]  honest moral and ethical justice under the original rule of law known as the common
[11:05.520 --> 11:14.640]  law to an entirely new legal system, their system of just us based entirely on the assertion
[11:14.640 --> 11:20.640]  of whatever we as governmental actors decide to declare legal for our purposes is all that
[11:20.640 --> 11:21.880]  matters.
[11:21.880 --> 11:26.560]  For example, judges ignore the clear language and intent of the law in favor of their own
[11:26.560 --> 11:29.680]  opinions as to what the law actually means.
[11:29.680 --> 11:34.680]  They even go so far as to formulate and spout opinions that actually place the law in violation
[11:34.680 --> 11:40.240]  of common law and constitutional prohibitions, which are acts completely abhorrent to our
[11:40.240 --> 11:43.600]  rights and liberties in and of themselves.
[11:43.600 --> 11:47.480]  Judges declare that the law can only mean what they say it means, and we the legally
[11:47.480 --> 11:52.280]  ignorant masses will all live a better and more fulfilling life just as long as we will
[11:52.280 --> 11:56.560]  accept their reading and understand that they always know best.
[11:56.560 --> 12:01.280]  The judge is no better than a panel of jury members that were present when allegedly all
[12:01.280 --> 12:06.400]  the facts, evidence, and testimony were presented, and they made their decision accordingly as
[12:06.400 --> 12:08.040]  was their duty.
[12:08.040 --> 12:13.200]  But rest assured, some appellate court judge will reform or invalidate the jury's verdict
[12:13.200 --> 12:15.680]  if the outcome is not to the judge's liking.
[12:15.680 --> 12:21.200]  And if we choose not to accept their declaration as gospel or the all-knowing proclamations
[12:21.200 --> 12:26.200]  of an infallible legal oracle, then to whom do we take our complaints but another judge
[12:26.200 --> 12:31.440]  with the same or often even more dangerous variation of opinion?
[12:31.440 --> 12:32.880]  Consider this.
[12:32.880 --> 12:38.200]  Even if we mere mortals actually take the time to properly educate ourselves in law,
[12:38.200 --> 12:42.560]  becoming fully capable of formulating and presenting an elegant and persuasive argument
[12:42.560 --> 12:48.000]  opposing such furious opinions, more often than not we still have those arguments crushed
[12:48.000 --> 12:52.960]  under the jackbooted hills of self-important judges who refuse to admit their own ignorance
[12:52.960 --> 12:56.080]  of the law as it applies to the facts presented.
[12:56.080 --> 13:00.360]  It very rarely will matter that our argument is based soundly on legal principles that
[13:00.360 --> 13:04.320]  have existed in this country's jurisprudence since its founding.
[13:04.320 --> 13:08.720]  It will also matter very little whether or not the declared intent actually argued by
[13:08.720 --> 13:13.640]  the founding fathers in their preponderance of writings on a particular legal subject
[13:13.640 --> 13:17.920]  actually shows the judge's opinion to be fundamentally flawed.
[13:17.920 --> 13:22.520]  All that truly matters is that a judge will use his or her authority of office to impress
[13:22.520 --> 13:29.280]  upon the rest of us just how important his or her opinion is in relation to our rights.
[13:29.280 --> 13:34.480]  After all, who would know better than a judge that our allegedly unalienable rights are
[13:34.480 --> 13:40.080]  in reality totally subject to any judge's interpretations and decisions as to how those
[13:40.080 --> 13:44.840]  rights can be used or applied whenever they are even, whether they are even available
[13:44.840 --> 13:50.960]  to be claimed, or for that matter, if they actually exist at all in a particular instance.
[13:50.960 --> 13:55.040]  How did our servants supposedly attain the power and authority to declare themselves
[13:55.040 --> 14:00.520]  superior not only to the very documents we the people created to bind them to a servant-only
[14:00.520 --> 14:06.840]  status while acting in their official capacities, but also proclaim their new status as masters
[14:06.840 --> 14:08.640]  over us all?
[14:08.640 --> 14:13.840]  There is no question, if you're living in reality anyway, that the courts have unlawfully
[14:13.840 --> 14:18.440]  and unconstitutionally converted every department and agency of government from their proper
[14:18.440 --> 14:23.720]  place as servants of we the people to our overly presumptive, oppressive, and abusive
[14:23.720 --> 14:29.120]  masters with virtually no limit whatsoever on their governmental authority, allowing
[14:29.120 --> 14:34.400]  governmental agencies and their agents as a whole to do damn near anything they please.
[14:34.400 --> 14:35.900]  How?
[14:35.900 --> 14:40.400]  They have done it through the mechanism of judicial opinion and interpretation.
[14:40.400 --> 14:46.040]  It is a known fact that government agents across America daily commit numerous murders
[14:46.040 --> 14:51.720]  and other high crimes against we the people in the name of law enforcement.
[14:51.720 --> 14:56.840]  We have even learned that American politicians, including the so-called president, openly
[14:56.840 --> 15:02.000]  order, cast votes, and collude in secret cabals to perpetrate assassinations of their political
[15:02.000 --> 15:05.360]  enemies, including other Americans.
[15:05.360 --> 15:12.080]  When did such acts stop being criminal conspiracies, organized criminal activity, and callous premeditated
[15:12.080 --> 15:13.580]  murder?
[15:13.580 --> 15:20.160]  If one or more members of the general public attempted to do such things or were even alleged
[15:20.160 --> 15:25.080]  to be engaging in such things, they would be immediately arrested or killed outright
[15:25.080 --> 15:27.280]  for resisting arrest.
[15:27.280 --> 15:32.440]  If some or all of these accused were to survive, it is almost a certainty that government would
[15:32.440 --> 15:38.360]  ensure that all the necessary evidence were properly fabricated or destroyed in order
[15:38.360 --> 15:44.840]  to vindicate the governmental murders of those that were killed or ensure the conviction
[15:44.840 --> 15:48.560]  of the rightfully or wrongfully accused that survived.

[16:05.480 --> 16:10.320]  that the very ones that are engaged in these activities are the same ones that declared

[16:21.600 --> 16:27.000]  If no man or group of men is or are above the law, then how does an unlawful and illegal
[16:27.000 --> 16:32.280]  act suddenly become lawful and legal simply because a particular man with a particular

[20:03.040 --> 20:08.320]  It will tell you at each stage what is supposed to be going on with the system versus what

[21:01.760 --> 21:05.840]  It is also a known fact that the courts and the judicial system as a whole have given
[21:05.840 --> 21:11.360]  their blessing to these heinous acts by preventing the governmental actors through the auspices
[21:11.360 --> 21:16.800]  of the judicially usurped and fabricated governmental sovereignty doctrine from being prosecuted
[21:16.800 --> 21:21.000]  as the murderous psychopathic criminals they truly are.
[21:21.000 --> 21:25.760]  Attorneys for the state refuse to prosecute, alleging lack of evidence or official immunity
[21:25.760 --> 21:30.600]  as their grounds for refusing to follow through with investigating and sending the information
[21:30.600 --> 21:33.920]  to the grand jury to obtain an indictment.
[21:33.920 --> 21:37.640]  Grand juries by both constitution and statute are required to conduct their own criminal
[21:37.640 --> 21:43.480]  investigations before handing down an indictment, regardless of the level or class of the alleged

[21:46.480 --> 21:50.920]  Prosecutors frequently act unlawfully and illegally to prevent grand juries from doing their own
[21:50.920 --> 21:55.960]  investigations and witness interviews in an attempt to block the grand jury from learning
[21:55.960 --> 22:00.640]  of these crimes by our public servants and in dotting them as the criminals they so often
[22:00.640 --> 22:01.720]  are.

[22:46.720 --> 22:51.480]  Both the judge and the prosecutor rely on this private army of remorseless individuals
[22:51.480 --> 22:55.440]  to protect and serve, but protect and serve whom?
[22:55.440 --> 22:57.560]  Why themselves, of course.
[22:57.560 --> 23:01.280]  It is most certainly not the individual members of the general public.
[23:01.280 --> 23:06.080]  You know, we the people, the ones that are actually supposed to be served and protected.
[23:06.080 --> 23:09.800]  In the court cases cited in the footnote, the courts have ruled that the police have
[23:09.800 --> 23:13.280]  no duty to protect the individual members of society.
[23:13.280 --> 23:18.520]  That their duty is to provide, or their duty to provide protection is a general duty to
[23:18.520 --> 23:21.920]  society only, not the individual.
[23:21.920 --> 23:27.640]  Therefore, using the court's logic that police officers are not required to provide individual
[23:27.640 --> 23:33.400]  protection in any given situation, but rather to act like window dressing to give the appearance
[23:33.400 --> 23:39.520]  that we are protected, I can no longer see the alleged duty for myself as an individual
[23:39.520 --> 23:44.640]  to support police services by paying monies from my own pocket, especially in support
[23:44.640 --> 23:49.520]  of services that I am not and cannot be guaranteed to receive as an individual.
[23:49.520 --> 23:54.480]  Instead, I could get together with several of my neighbors and acting as a group, hire
[23:54.480 --> 23:56.640]  our own security guard.
[23:56.640 --> 24:00.280]  Better yet, we could simply arm ourselves and train to be better prepared to protect
[24:00.280 --> 24:04.360]  ourselves and our property, as well as that of our neighbors, without the interference

[24:06.960 --> 24:11.840]  And if that is the case, then they would also have no power to exert their no carrying or

[27:33.680 --> 27:39.080]  used a gun she carried in her purse, she did not have a concealed carry license, she violated
[27:39.080 --> 27:44.640]  the concealed carry license law, therefore the woman must be found guilty if you find
[27:44.640 --> 27:47.600]  that she acted in violation of the law.
[27:47.600 --> 27:52.640]  The accused in a traffic ticket case can prove that the officer issued the ticket illegally,
[27:52.640 --> 27:57.800]  deny him or her the ability to actually put on any type of defense with emotion and limity,
[27:57.800 --> 28:02.400]  prohibiting them from objecting to the state's railroad job by attempting to get a conviction
[28:02.400 --> 28:08.800]  based entirely on presumption of law rather than real, tangible and factual evidence.
[28:08.800 --> 28:10.800]  Stupid, isn't it?
[28:10.800 --> 28:16.920]  But that, ladies and gentlemen, is actually a very kind sampling of the situations and
[28:16.920 --> 28:22.200]  circumstances surrounding many of the cases that occur every single day in courts across
[28:22.200 --> 28:23.520]  America.
[28:23.520 --> 28:28.840]  The law is no longer meant to protect us from harm, rather it is used solely to punish what
[28:28.840 --> 28:33.160]  are otherwise innocent acts for the purpose of revenue generation.
[28:33.160 --> 28:38.320]  Consider the fact that most of these offenses are alleged to occur in violations of statutes
[28:38.320 --> 28:43.360]  that have declared a particular act to be unlawful when in reality the act itself caused
[28:43.360 --> 28:47.120]  absolutely no harm to anyone or anything.
[28:47.120 --> 28:51.960]  Nowhere is this assertion of no harm or injury more prevalent and more ignored than in the
[28:51.960 --> 28:54.360]  traffic courts across America.
[28:54.360 --> 28:59.600]  What very few people actually understand about the traffic court scheme is that it is specifically
[28:59.600 --> 29:04.120]  designed to circumvent the most basic rights and tenants of due process.
[29:04.120 --> 29:08.240]  It is all done very subtly, at least that is the perception of those that are totally
[29:08.240 --> 29:13.400]  clueless in the first place as to the full gamut of their unalienable rights.
[29:13.400 --> 29:17.240]  If you have no idea what your due process rights are, then how will you know when you
[29:17.240 --> 29:20.880]  have been denied them, either in whole or in part?

[32:47.880 --> 32:51.960]  These traffic courts often operate under a set of procedural rules that are separate
[32:51.960 --> 32:57.120]  and distinct from the other procedural rules that normally govern similar types of cases.
[32:57.120 --> 33:02.160]  For instance, in Texas law, traffic cases are openly declared to be criminal or quasi-criminal
[33:02.160 --> 33:07.040]  in nature, and the statutes that are turned to first in relation to such cases are to
[33:07.040 --> 33:10.600]  be found in Chapter 45, Code of Criminal Procedure.
[33:10.600 --> 33:14.440]  This chapter contains procedural rules that are specific to the justice and municipal
[33:14.440 --> 33:16.160]  courts of the state.
[33:16.160 --> 33:21.360]  These courts have exclusive original jurisdiction in Class C fine-only misdemeanor cases, which
[33:21.360 --> 33:25.480]  is the classification associated with the majority of Texas traffic offenses.
[33:25.480 --> 33:30.000]  Yet, in most of these cases, there is no one that can come forward and prove an injury
[33:30.000 --> 33:34.440]  or harm that would give them standing to make a criminal accusation.
[33:34.440 --> 33:36.800]  There simply is no victim.
[33:36.800 --> 33:41.640]  Such acts in law are called nallum prohibitum, meaning that the act is considered wrong only
[33:41.640 --> 33:47.120]  because some group of individuals declared it to be so by enacting some statute or ordinance
[33:47.120 --> 33:48.640]  against it.
[33:48.640 --> 33:50.920]  The act is simply prohibited.
[33:50.920 --> 33:53.560]  It is not evil in and of itself.
[33:53.560 --> 33:58.600]  An example would be a teenager skateboarding on a downtown sidewalk, or someone walking
[33:58.600 --> 34:04.000]  across the street in the middle of the block rather than at an intersection or crosswalk.
[34:04.000 --> 34:10.040]  This is in contradistinction to a nallum insay act, one that is evil entirely in and of itself,
[34:10.040 --> 34:11.600]  such as murder.
[34:11.600 --> 34:16.440]  Allegedly, our public servants create these nallum prohibitum acts in an effort to protect
[34:16.440 --> 34:21.480]  us from ourselves, and I highly suspect to simplify their jobs.
[34:21.480 --> 34:25.800]  The problem is that I don't recall ever reading the job description of any public servant
[34:25.800 --> 34:28.960]  and finding the word nanny in it.
[34:28.960 --> 34:32.760]  What both we and they have failed to consider and actually implemented in our day-to-day
[34:32.760 --> 34:39.760]  lies is the reality that actions have consequences, sometimes good, sometimes bad.
[34:39.760 --> 34:44.480]  Stupid actions have a significantly higher percentage of bad consequences than well thought
[34:44.480 --> 34:48.120]  out actions, even higher than negligent actions.
[34:48.120 --> 34:53.560]  Apparently, science has never found it intellectually stimulating enough to look into finding an
[34:53.560 --> 34:56.640]  explanation for this ongoing human enigma.
[34:56.640 --> 35:02.000]  It took a comedian to conceptualize and announce the most perfect analysis and scientific theory
[35:02.000 --> 35:05.160]  ever conceived relative to this phenomenon.

[35:24.240 --> 35:30.280]  there will always be someone that is clueless about the proper operation of a city crosswalk.
[35:30.280 --> 35:34.720]  No matter how many of these statutes someone makes, there will always be the individual
[35:34.720 --> 35:39.880]  or group stupid enough to say, I can beat that car across the intersection even with
[35:39.880 --> 35:41.120]  my broken leg.
[35:41.120 --> 35:44.000]  Sure, I can cross this street blindfolded.
[35:44.000 --> 35:45.880]  Hey, guys, watch this.
[35:45.880 --> 35:50.320]  I've only had a couple of beers, three shots of tequila, and four glasses of wine to mellow

[35:51.320 --> 35:53.320]  Let me try that fire-spinning thing.
[35:53.320 --> 35:56.240]  And my personal favorite, somebody give me a match.
[35:56.240 --> 35:59.000]  I can't see where the gas is coming from.
[35:59.000 --> 36:04.320]  I mean, really, is there an actual need for a statute making an offense to jump from the
[36:04.320 --> 36:07.480]  top of the Sears Tower without a parachute?
[36:07.480 --> 36:10.880]  Against whom exactly would that statute be enforced?
[36:10.880 --> 36:15.280]  Logically, and for the obvious reasons, you won't be able to charge an enforcement against
[36:15.280 --> 36:20.520]  the individual who did jump without a shoot, and you can't charge someone with almost jumping
[36:20.520 --> 36:23.520]  if they change their mind and climbed off the ledge.
[36:23.520 --> 36:27.760]  And the guy that jumped with a shoot could not have possibly violated according to its
[36:27.760 --> 36:32.560]  own language, unless, of course, you ask the judge to interpret the statute.
[36:32.560 --> 36:37.680]  You will learn soon enough that the term interpret is nothing more than a code word used by lawyers
[36:37.680 --> 36:42.680]  and judges, meaning rewrite the statute in a way favorable to my particular argument
[36:42.680 --> 36:46.960]  about what it means, and we'll do more on that later.
[36:46.960 --> 36:52.240]  Now, all of this is not to say that the act itself is to blame for the results of engaging
[36:52.240 --> 36:53.240]  in it.
[36:53.240 --> 36:58.120]  After all, what good does the concept and ideals of personal responsibility and liability
[36:58.120 --> 37:04.720]  do for us as individuals and as a society if we each are not willing to accept responsibility

[37:22.800 --> 37:25.120]  heat, is apathy.
[37:25.120 --> 37:29.360]  The ability to care about things, to think and do for ourselves, to be responsible and
[37:29.360 --> 37:32.760]  competent adults, and acting accordingly.
[37:32.760 --> 37:37.400]  That is the lubricating and water cooling of the engine of individual liberty and society

[37:38.880 --> 37:44.600]  Nowadays, it truly seems that no one wants to have to do or think for themselves.

[39:48.920 --> 39:53.280]  was water in the boot in the first place and where they might have left it so such a thing

[39:54.720 --> 40:00.000]  A common sense approach to law must again become the norm if we are to once again bring
[40:00.000 --> 40:04.840]  reality in order to our justice system and make it operate more in line with what was
[40:04.840 --> 40:10.360]  originally intended, that no one is above the law, especially those that are servants
[40:10.360 --> 40:11.360]  of it.
[40:11.360 --> 40:14.680]  As an example, let's ask ourselves a few questions.
[40:14.680 --> 40:19.160]  First, who is actually harmed by the fact that an individual is traveling down the road
[40:19.160 --> 40:25.160]  in their own car but that individual does not have in their pocket a 2-inch by 3-and-a-quarter
[40:25.160 --> 40:29.880]  inch piece of PVC plastic with their picture on it next to a state seal?
[40:29.880 --> 40:34.200]  Does that piece of plastic called a license possess some form of magical protection or

[41:22.760 --> 41:27.160]  How much easier would our justice system be if judges actually did the job they were hired
[41:27.160 --> 41:29.360]  to do by we the people?
[41:29.360 --> 41:34.240]  What if a judge actually took the law as it is written, actual words, phrases, and all,
[41:34.240 --> 41:38.320]  and compared the intent conveyed by its actual language to the bill of rights and the other
[41:38.320 --> 41:41.560]  provisions of the state and federal constitutions?
[41:41.560 --> 41:45.120]  Some of these courts feel that if the legal question on the constitutionality of a law
[41:45.120 --> 41:51.000]  is not raised by either party in a case, and specifically challenging its validity on those
[41:51.000 --> 41:55.840]  grounds, that it is not within their power to review that question.
[41:55.840 --> 41:59.520]  The courts were intended to be defenders of the people's rights.
[41:59.520 --> 42:05.320]  As such, they should always be acting in the best interest and on behalf of we the people.
[42:05.320 --> 42:09.760]  In which case the courts would absolutely always have the power to raise that question
[42:09.760 --> 42:15.560]  suesponte, whenever a case comes before them associated with that law.
[42:15.560 --> 42:20.160]  Let's work out an example court opinion geared toward requiring first and foremost that the
[42:20.160 --> 42:24.600]  courts at every level perform their sworn duty to the people and actually protect our
[42:24.600 --> 42:27.200]  individual on alienable rights.
[42:27.200 --> 42:31.480]  In this example opinion, what if the judges reviewing the challenge to the validity of
[42:31.480 --> 42:36.560]  that law actually thought things through properly and ruled the following?
[42:36.560 --> 42:40.360]  We have considered the clear language of the statute from the point of view of a man of
[42:40.360 --> 42:41.960]  average intelligence.
[42:41.960 --> 42:46.360]  And we have concluded that any man so educated would conclude that the statute purports to
[42:46.360 --> 42:52.600]  convey the power upon particular governmental agencies or actors, both state and federal,
[42:52.600 --> 42:57.520]  to do that thing which is reprehensible to our respective constitutions and the individual
[42:57.520 --> 42:59.880]  on alienable rights of the people.
[42:59.880 --> 43:03.840]  And therefore, such power is specifically forbidden.
[43:03.840 --> 43:08.160]  The people cannot rightfully be subjected to such user patient of their rights and property
[43:08.160 --> 43:13.520]  by their state or federal representatives or any other office or agent of government.
[43:13.520 --> 43:18.200]  Just as no man would have the individual right and power to hold sway over his neighbors
[43:18.200 --> 43:23.920]  in this manner, that man is also without authority to delegate to another via the doctrine of
[43:23.920 --> 43:27.960]  agency any power which he himself does not possess.
[43:27.960 --> 43:35.320]  It is the absolute duty of the courts to both ensure, well, interrupted by another break.

[01:07:01.680 --> 01:07:12.680]  There is the feature for individuals to act as presenters, which are the teachers basically or the host of the particular conference

[01:07:21.680 --> 01:07:27.680]  This will allow them to facilitate these workshops and things of that nature.

[01:08:01.680 --> 01:08:11.680]  that everyone needs to see, then you can assign someone else as the presenter temporarily so that their information is viewable by everyone.
[01:08:11.680 --> 01:08:19.680]  It's got whiteboard functionality so that you can actually draw on the presentation as it's being streamed out.

[01:10:29.680 --> 01:10:45.680]  So that if something like that does come up, then we can have a high level of probability of saying, look, the website and the owners of the website had nothing to do with what was going on in this.
[01:10:45.680 --> 01:10:53.680]  And here's our evidence if you come after us, but we're not going to give it to you until you make it necessary by prosecuting us.
[01:10:53.680 --> 01:11:15.680]  But in any case, it's not something we want to do, but folks you know as well as I do, that if government can find a way to cause us problems, then and stop our voice, they will do it, even if it means fabricating and falsifying evidence, hacking and destroying websites, credibility, and the whole nine yards.
[01:11:15.680 --> 01:11:28.680]  So in order to stay in the public ear and eye to bring you the information you need, we will do what's necessary to protect the integrity of the site and the owners and the host.

[01:11:49.680 --> 01:12:18.680]  I appealed it and the opinion I got from the county judge, and I've got this in writing, was that the individuals right are often regulated by the state's police power. And I've been told that I could contact the Secretary of State and see if everyone that was involved, if their, you know, bonds were current and renewed
[01:12:18.680 --> 01:12:32.680]  and on the up and up and all that. And other than that, I just wanted to get your thoughts on what, you know, what if any avenues I could take to pursue this, whether it be a federal case, things like that.
[01:12:32.680 --> 01:12:35.680]  I just wanted to get your thoughts on that.
[01:12:35.680 --> 01:12:48.680]  Well, the answer to that's going to be varied. As far as whether or not you have a federal suit or not, it depends on whether or not you are alleging the violation of a federally protected right.
[01:12:48.680 --> 01:13:05.680]  The right of due process, for instance, is one of the federally protected rights, the right of liberty, the right to not be wrongfully prosecuted, the right to not be falsely imprisoned, the right to not have our property taken without just compensation, and so on and so forth.
[01:13:05.680 --> 01:13:09.680]  These are all protected rights at the federal level.
[01:13:09.680 --> 01:13:23.680]  The distinction there is when a right is something that's granted by statute at the state level. For instance, the state legislature has created certain procedural rights within the Code of Criminal Procedure.
[01:13:23.680 --> 01:13:42.680]  Now, there are oftentimes places where those statutory rights are in line with or against a federally protected right. And the federal courts, including the Supreme Court, have ruled before that, and the Texas courts also, for that matter,
[01:13:42.680 --> 01:14:01.680]  that the rights of due process do not amount to anything that the state legislature may deem to consider proper. The right of due process is the same as it was under the common law prior to the formation of the state, period.
[01:14:01.680 --> 01:14:14.680]  And that's the only way it can be. Any judge that tells you the common law does not exist in Texas doesn't know his history and does not have a clue about the basis of law in this country.
[01:14:14.680 --> 01:14:29.680]  The Constitution itself is a common law document. The Texas Constitution is a common law document. Everything in it is the language of the common law as it was understood at the time it was written.
[01:14:29.680 --> 01:14:50.680]  That predates and precedes in authority any and all statutory enactments of the legislature. They cannot diminish or destroy any of the common law fundamental rights as they existed at the time of the founding of this nation or Texas in general.
[01:14:50.680 --> 01:14:58.680]  Okay. You mentioned specifically due process. What about the common law right to travel?
[01:14:58.680 --> 01:15:12.680]  Okay. The common law right to travel is not a right to travel per se. It is a right of liberty. It is the right to use one's own property for one's own private pleasure and business.
[01:15:12.680 --> 01:15:24.680]  It is a conjoined right developed on those two areas of rights. Liberty is the right to change one's location at will.
[01:15:24.680 --> 01:15:44.680]  Okay. The right to property is to be able to use property that you've bought and paid for and you rightfully own for any purpose for which it was originally intended and designed as long as that use is not directed at the harm of another person or their property.
[01:15:44.680 --> 01:15:59.680]  So there is no specific right to travel. There is the specific right of liberty and the right to own and use property and that is something the courts ought to know.
[01:15:59.680 --> 01:16:25.680]  All right. Okay. So, and I mean I had all the Supreme Court rulings in my initial brief that I presented. But I'm just curious, you know, as I know now and you've spoken about in the past of can I pursue this on constitutional grounds
[01:16:25.680 --> 01:16:33.680]  before I've already made, gone down the wrong path in their, in their administrative law proceeding.
