[14:51.040 --> 14:58.040]  We didn't do our homework, figure out what was going on, what was wrong, and make sure it doesn't happen again.

[27:40.000 --> 27:46.760]  government document and explain to him that he accused, he cited the person for violating
[27:46.760 --> 27:53.200]  the no safety sticker and no proof of financial responsibility insurance when she was driving
[27:53.200 --> 27:59.640]  in an automobile that according to the citation had to have her plates on it.
[27:59.640 --> 28:04.400]  And he said, looked at it and said, ooh, I would not have written that ticket.
[28:04.400 --> 28:08.280]  I said, that I wouldn't have to ask the judge to arrest you.
[28:08.280 --> 28:14.720]  And I told him, you know, you know, the judge is not going to issue a warrant for this officer's
[28:14.720 --> 28:15.720]  arrest.
[28:15.720 --> 28:16.720]  He said, I know that.
[28:16.720 --> 28:19.840]  Then I'm going to have to ask you to arrest the judge.
[28:19.840 --> 28:24.120]  Oh, man, you know I can't arrest the judge.

[28:25.120 --> 28:31.280]  But then I get to say to you, well, Bubba, life is filled with little decisions.

[28:36.200 --> 28:46.200]  But I went ahead and left that be because the judge, frankly, the judge was very civil.

[28:57.040 --> 29:01.280]  So I doubt that she's been a judge long enough to really get burned out in the position.

[34:31.980 --> 34:41.260]  No, no, one person, actually he could sign it himself if he owns property, if he owns
[34:41.260 --> 34:49.900]  property that's worth in excess of double the amount of bond then he can sign a surety

[49:13.660 --> 49:26.100]  This is peculiar because in Texas, they passed a special law just for the Republic of Texas.
[49:26.100 --> 49:32.620]  The Republic of Texas was filing all of these liens against public officials.
[49:32.620 --> 49:40.460]  And the problem was as reprehensible as they may have considered the liens to be technically
[49:40.460 --> 49:48.140]  under the Uniform Commercial Code, they were legal proper liens.
[49:48.140 --> 49:50.780]  So these guys are having a hard time addressing them.
[49:50.780 --> 49:57.060]  So they come up with this great idea, they'll get this legislation that will allow a judge
[49:57.060 --> 50:04.700]  with no notice to the other party to just rule that a document that's filed in the county
[50:04.700 --> 50:11.460]  record is void, and they have two procedures to get that done with.
[50:11.460 --> 50:18.500]  A 51109 authorizes the clerk if the clerk believes that a document is fraudulent.
[50:18.500 --> 50:23.180]  She has two days to present that to the district judge.
[50:23.180 --> 50:30.340]  And if a private person or someone other than the clerk believes that a document is fraudulent,
[50:30.340 --> 50:37.980]  that no charge is no filing fee, they can prepare a filing with the court asking the
[50:37.980 --> 50:42.140]  court to declare the document void.
[50:42.140 --> 50:51.500]  And the court with no notice to the party who filed the document will hold a hearing
[50:51.500 --> 50:59.580]  where in there is no oral argument and simply make a ruling on the document.
[50:59.580 --> 51:06.700]  Now there is no way that statute will pass constitutional muster.
[51:06.700 --> 51:11.420]  They did that to screw the Republic of Texas.
[51:11.420 --> 51:17.460]  I love it when they do that because now we get to use it to screw the banks.
[51:17.460 --> 51:25.220]  There's a little bit of case law on that at this point, and the case law goes to 51903.
[51:25.220 --> 51:33.900]  I don't see any on 51901, but the banks are whining, well, we didn't get any proper notice
[51:33.900 --> 51:38.900]  and blah, blah, blah, and the courts are saying, well, that's what the statute says.
[51:38.900 --> 51:41.420]  This was done in accordance with the statute.
[51:41.420 --> 51:48.420]  So apparently none of them have brought a constitutional issue as yet.
[51:48.420 --> 51:53.460]  And that's okay with me because first I want to go to the clerks.
[51:53.460 --> 52:05.300]  And we have someone I prepared a letter for who sent it to the clerk over a issue in Dallas.
[52:05.300 --> 52:12.740]  And as far as we can tell, the clerk did not give it to the district judge.
[52:12.740 --> 52:20.140]  And this was one of those really, really obviously stupid filings where a bank that
[52:20.140 --> 52:27.900]  had no mention in the record at all anywhere filed a notice of appointment of substitute
[52:27.900 --> 52:30.100]  trustee.
[52:30.100 --> 52:38.460]  So we went to the, we showed this to the clerk in the letter, and that in the record of the
[52:38.460 --> 52:47.260]  clerk there is no reference to this entity at all, and that goes directly to the definition
[52:47.260 --> 52:53.860]  of a fraudulent filing as contained in 51901.
[52:53.860 --> 53:00.340]  It defines a fraudulent filing in the registrar's office as a document that is not authorized
[53:00.340 --> 53:07.660]  by any entity who is filed in the court record showing standing to grant authority.
[53:07.660 --> 53:14.500]  So this was exactly right on point to the legislation.
[53:14.500 --> 53:19.940]  And as far as we can tell, the county attorney never gave it to the district court.
[53:19.940 --> 53:27.340]  So we put in an information request and requested the policies and procedures of the county
[53:27.340 --> 53:39.020]  clerk concerning, promulgated by the clerk to ensure compliance with 51901.
[53:39.020 --> 53:48.380]  And we got back this response from the district attorney, which gave their procedures for
[53:48.380 --> 53:52.740]  filing documents in the county registrar's office.
[53:52.740 --> 53:55.220]  But that wasn't what we asked about.
[53:55.220 --> 54:02.580]  And the only reference to 51901 is we abide by 51901, you'll see it.
[54:02.580 --> 54:11.660]  So since they abided by 51901, and we could not find evidence they had done so, we filed
[54:11.660 --> 54:18.340]  a criminal complaint with the same DA that gave this stupid response to the open record
[54:18.340 --> 54:19.340]  request.
[54:19.340 --> 54:23.780]  So clearly the clerk had followed the advice of the district attorney.
[54:23.780 --> 54:29.700]  Now we're filing criminal charges against the clerk with the district attorney.
[54:29.700 --> 54:34.180]  And we know what the district attorney's going to do with that criminal complaint.
[54:34.180 --> 54:40.060]  And when the district attorney does that, we start doing our little dance on them, and
[54:40.060 --> 54:47.060]  put the routine on them, and stir them up a little politics, and then go to them and
[54:47.060 --> 54:50.260]  say, oh, gosh, this is usually fixed.

[01:22:27.820 --> 01:22:34.220]  the 8th, they ruled that I'm not entitled to an appeal because I paid the fine and court
[01:22:34.220 --> 01:22:40.820]  cost, even though the check is dealt for a greater amount of money than what the payment
[01:22:40.820 --> 01:22:43.260]  would be.
[01:22:43.260 --> 01:22:50.500]  And so, I then tried to decide how I want to proceed.
[01:22:50.500 --> 01:22:57.500]  I guess I could go federal, or an option might be to go to their superiors, which would
