[04:13.020 --> 04:19.380] We have yet to file my, we're working on the copy of the brief for appeal, and at the same
[04:19.380 --> 04:25.060] time we're also working on an abatement to have it sent back to the trial court if they
[04:25.060 --> 04:31.140] did not correct their own clerical errors in their records, clerical errors being such
[04:31.140 --> 04:37.580] things as being declared guilty by the jury, but not guilty by the court order.
[04:37.580 --> 04:42.140] This is the epitome of organizational skills that they have there.
[04:42.140 --> 04:44.420] So we're going to see about getting the corrections made.
[04:44.420 --> 04:48.860] I will be going down this week and getting a copy of what's actually in the record.

[06:51.980 --> 06:57.420] Multiply that just in Austin by the number of tickets issued in 2010, which is the only

[07:00.460 --> 07:05.380] But just for grins and giggles, we're going to round it down from the actual number.
[07:05.380 --> 07:11.620] We're going to round it to the 304,000 that were actually out there, and then we're going
[07:11.620 --> 07:15.340] to multiply that by, oh, let's just say on average 325.
[07:15.340 --> 07:18.260] That's right between 300 and 350.
[07:18.260 --> 07:27.500] They made, oh, I don't know, $98,800,000 on that would be the total sum if they managed
[07:27.500 --> 07:29.820] to get a conviction in all of them.
[07:29.820 --> 07:32.580] What is the conviction rate in Texas?
[07:32.580 --> 07:37.980] 99.6, which may as well be 100.
[07:37.980 --> 07:40.780] There is an easy way to fight this, folks.
[07:40.780 --> 07:45.740] I say easy because the defense is three questions.
[07:45.740 --> 07:51.580] It's three questions and the same objection over and over and over.
[07:51.580 --> 07:58.340] Every single time they try to create a prima facie case of transportation, your job in
[07:58.340 --> 08:04.180] court is to destroy it, and it's very easy to do.
[08:04.180 --> 08:06.140] We're going through the court procedures and classes.
[08:06.140 --> 08:10.220] If you're not attending the classes and you're in Austin, you are missing out.
[08:10.220 --> 08:15.620] You are going to wait until something does happen before you start learning what to do
[08:15.620 --> 08:21.820] about it, and by that time it may already be too far down the road to save your butt
[08:21.820 --> 08:27.300] because you've done things at the stop and in between then and class that you should
[08:27.300 --> 08:33.700] not have done, and thus you have made your defense untenable in most cases.
[08:33.700 --> 08:40.780] So, before you get a ticket, is the time to be prepared for when you do get a ticket.
[08:40.780 --> 08:43.660] Everybody having any problem understanding that aspect of it?
[08:43.660 --> 08:48.540] It's kind of like the Boy Scout motto of be prepared.

[08:52.900 --> 08:58.540] That means they must raise revenue through other avenues.
[08:58.540 --> 09:06.580] One of those avenues is falsifying traffic citations, okay?

[20:34.660 --> 20:39.660] this again and again and again, we're trying to practice the court procedure so that everyone
[20:39.660 --> 20:47.420] can see exactly how to address what the prosecution and the witness or the judge does in a given
[20:47.420 --> 20:49.780] instance.
[20:49.780 --> 20:55.980] You will find that one of the things that you must train yourself to do and become good
[20:55.980 --> 20:59.100] at is thinking on your feet.
[20:59.100 --> 21:06.140] You simply cannot go in with a preconceived game plan into a courtroom, you can have basically
[21:06.140 --> 21:12.140] a rough outline of how you want to do something, especially when it comes to your own direct
[21:12.140 --> 21:19.380] examination of things, but you can't predict cross examination requirements and what you
[21:19.380 --> 21:25.220] may have to do during the opposition's direct examination, so you have to be listening to
[21:25.220 --> 21:31.660] everything that's going on, and the way I say it is you have to listen to what you hear.
[21:31.660 --> 21:36.260] You can sit in a room and you can hear everything going on in it, but you're not listening to
[21:36.260 --> 21:38.940] any of it, it's just noise.
[21:38.940 --> 21:44.700] It takes a specific skill and a concentration level to actually focus in and listen to one
[21:44.700 --> 21:53.060] thing out of many, and it's even harder to focus on many things out of many.
[21:53.060 --> 21:59.700] But believe me, you're going to have to learn to do that because while you may only be listening
[21:59.700 --> 22:05.780] to whoever is currently speaking in the courtroom, you're still trying to take notes, you're
[22:05.780 --> 22:12.380] still trying to formulate your own questions in response and rebuttals and things of that
[22:12.380 --> 22:13.380] nature.
[22:13.380 --> 22:19.780] Now, a lot of these are not going to be difficult simply because you really don't have a lot
[22:19.780 --> 22:23.700] of questions that you have to go into in certain areas.
[22:23.700 --> 22:29.020] There are some things that you're going to want to rebut, but that's not too difficult
[22:29.020 --> 22:32.740] if you're paying attention, but you've got to formulate those on the fly.
[22:32.740 --> 22:37.860] So you're very, very busy when you're in the courtroom as a defendant or prosecutor for
[22:37.860 --> 22:43.580] that matter, but you've got to have some idea of what your basic defense is going to be,
[22:43.580 --> 22:49.740] and in the case of these transportation cases or virtually any case involving an accusation

[23:27.860 --> 23:37.540] This state, transportation, motor vehicle, vehicle operate an enigrammatical variation
[23:37.540 --> 23:44.940] thereof, such as operator, operating, operated, et cetera, drive an enigrammatical variation
[23:44.940 --> 23:52.820] of that, such as driving, driver driven, drove, et cetera.
[23:52.820 --> 23:58.620] Police officer, and I'm trying to remember what our last one is here.
[23:58.620 --> 24:02.340] Anyway, I'll get back to that in a minute when I remember what it is.
[24:02.340 --> 24:08.780] Anyway, motor vehicle, vehicle, operator, driver, and enigrammatical variations, this
[24:08.780 --> 24:14.900] state, and transportation, absolutely for certain, those are to be objected to along
[24:14.900 --> 24:17.100] with the police officer.
[24:17.100 --> 24:21.060] Every instance, when that comes up, our objection remains the same.
[24:21.060 --> 24:26.620] It doesn't change except according to who is using the term.
[24:26.620 --> 24:33.460] The objection is the same up to a point, and then for a witness, there's additional information

[24:34.460 --> 24:38.980] But if the judge or prosecutor are the ones that are using the terms, then the objection
[24:38.980 --> 24:45.100] remains objection, assumes facts, not an evidence, not previously agreed to, and requires a legal

[24:47.940 --> 24:51.540] That's where we leave it for the prosecutor or the judge.
[24:51.540 --> 24:58.220] If the witness is using the term or phrase, then our objection is the same up to requires
[24:58.220 --> 25:01.940] a legal conclusion by the fact witness.
[25:01.940 --> 25:07.460] The fact witness is trying to use this term, and we are arguing that they don't really
[25:07.460 --> 25:14.860] understand the terminology they're using, and in order to do that, we demonstrate by continuing
[25:14.860 --> 25:23.580] the objection the respondent request that the witness be tendered for the purpose of
[25:23.580 --> 25:27.380] law dire to ascertain personal knowledge.
[25:27.380 --> 25:31.660] Well, that's going to take the court by surprise nine times out of ten, because they're not
[25:31.660 --> 25:34.580] going to expect you to know to do that.
[25:34.580 --> 25:40.060] And just for grins and giggles, they may do it just to see what you have to ask.
[25:40.060 --> 25:45.700] So if they do, then you ask the following three questions.
[25:45.700 --> 25:55.060] First question, Officer Jones, at any time during your alleged investigation, did you
[25:55.060 --> 26:03.300] obtain, discover, or did I otherwise provide you with a bill of lading?
[26:03.300 --> 26:09.140] Second question, exactly the same as the first, you simply replace bill of lading with passenger

[26:11.340 --> 26:17.940] Third question, at any time during your alleged investigation, did you obtain, discover, or
[26:17.940 --> 26:24.020] did I provide you with any evidence whatsoever that I was engaging in commercial use of

[26:33.380 --> 26:37.700] Of course, he's not going to want to answer that, but what choice does he have?

[27:29.100 --> 27:33.460] conduct an illegal search and seizure.

[40:08.380 --> 40:16.660] should be, what is the regular activity, this bureaucratic pinhead is alleging that I am
[40:16.660 --> 40:24.860] engaging in that would give them any authority over me, my property or my actions.
[40:24.860 --> 40:32.140] That's always your first question, then you're going to voice that question to them.

[42:41.740 --> 42:49.820] offenses, for actual penal code offenses, assault with a deadly weapon maybe, reckless endangerment
[42:49.820 --> 42:57.060] maybe, so on and so forth, you know the real crimes that everybody keeps saying, hey you
[42:57.060 --> 43:02.020] can't have a victimless crime, well that's the problem with the penal code folks, there
[43:02.020 --> 43:09.300] aren't any and the penal code, there's a victim, okay, with the one potential issue of public
[43:09.300 --> 43:15.580] intoxication which they also abuse almost as much as they do transportation, that's
[43:15.580 --> 43:21.220] something else we're working on, but the point is we finally got people calling in and so

[51:45.740 --> 51:46.740] Why does he not have counsel?
[51:46.740 --> 51:49.740] He had just asked for counsel.
[51:49.740 --> 51:51.740] It was his first appearance.

[51:52.740 --> 51:57.740] And I wanted to assist him and the judge said no.
[51:57.740 --> 52:00.740] So I sat down.
[52:00.740 --> 52:08.740] Then when the judge and prosecutor tried to get him to agree to bail condition, when he
[52:08.740 --> 52:14.740] had never been placed under arrest in the first place, I just called out, don't sign.
[52:14.740 --> 52:19.740] Well, he doesn't have to be under arrest for the judge to be setting bail if they're setting
[52:19.740 --> 52:21.740] him something else.
[52:21.740 --> 52:30.740] The purpose of the bail is so that they don't hold him in jail until his trial date.
[52:30.740 --> 52:37.740] The judge can set that before that in order to allow him to be free rather than in jail.
[52:37.740 --> 52:38.740] Okay.
[52:38.740 --> 52:44.740] So the purpose of the warrant, they came here to our home on a warrant.
[52:44.740 --> 52:51.740] Okay, well, the search warrant because my husband was a felon from, this is a history
[52:51.740 --> 52:53.740] of 30 years ago.
[52:53.740 --> 52:57.740] That's when he committed this so-called felony.
[52:57.740 --> 53:00.740] Didn't involve any weapons, but never mind.
[53:00.740 --> 53:03.740] That was 30 years ago.
[53:03.740 --> 53:08.740] They decided to come and take his gun now, like a year ago.
[53:08.740 --> 53:11.740] There was never any complaint or no individual.
[53:11.740 --> 53:18.740] It was just that Game Wardens had seen him in the woods hunting and had put together
[53:18.740 --> 53:25.740] the fact that he was a felon and that he had been in possession of firearms.
[53:25.740 --> 53:30.740] How close were the Game Wardens to him in the woods?
[53:30.740 --> 53:35.740] Well, they had seen him actually on a couple of occasions, but the last time they had seen
[53:35.740 --> 53:41.740] him, they were investigating a complaint of illegal hunting activity.
[53:41.740 --> 53:48.740] So they took his name and, you know, they ran a search apparently and they figured out
[53:48.740 --> 53:49.740] he was a felon.
[53:49.740 --> 53:50.740] Okay.
[53:50.740 --> 53:58.740] So they never said who the complainant was about the illegal hunting activity.
[53:58.740 --> 54:02.740] They just said they were investigating a complaint about illegal hunting.
[54:02.740 --> 54:10.740] Now, they knew in January that he was a felon, but they didn't come and do the search until
[54:10.740 --> 54:12.740] April, three months later.
[54:12.740 --> 54:15.740] That's stated in the discovery report.
[54:15.740 --> 54:22.740] Now, search warrants are supposed to be, like, because of some exigent emergency, you know,
[54:22.740 --> 54:23.740] like...
[54:23.740 --> 54:28.740] Well, no, a search warrant is for the purpose of gathering and obtaining evidence or seizing
[54:28.740 --> 54:30.740] evidence to be used later.
[54:30.740 --> 54:33.740] It doesn't have to be exigent or anything like that.
[54:33.740 --> 54:38.740] It can be seized because they intend to use it for evidence for the purpose of trial.
[54:38.740 --> 54:41.740] Now, the question here, though, is going to be this.
[54:41.740 --> 54:47.740] Are they charging them under a federal law or a state law?
[54:47.740 --> 54:49.740] I'm not clear on that because...
[54:49.740 --> 54:50.740] Okay.
[54:50.740 --> 54:56.740] Then what you need to be finding out is when were these laws enacted, both federal and state,
[54:56.740 --> 55:00.740] that they could possibly charge them under, when were they enacted?
[55:00.740 --> 55:02.740] Because here's their problem.
[55:02.740 --> 55:08.740] If he became a felon prior to the enactment of these laws making it illegal for a felon
[55:08.740 --> 55:16.740] to own a gun, then that would make that law retroactive, and those are forbidden.
[55:16.740 --> 55:22.740] They can't make a law retroactive to something that occurred in the past.
[55:22.740 --> 55:25.740] It has to carry forward from its enactment date.
[55:25.740 --> 55:28.740] It can't be prior to that.
[55:28.740 --> 55:29.740] Okay.
[55:29.740 --> 55:35.740] So if he became a felon, well, and that's another thing I wanted to ask you is if you
[55:35.740 --> 55:45.740] think it would be possible to open the case that created his felon status?
[55:45.740 --> 55:49.740] You're not going to reopen the 30-year-old case unless you have some new evidence that
[55:49.740 --> 55:55.740] would prove him to be different than what was done at trial, and the court deans it
[55:55.740 --> 55:58.740] relevant to the issue.
[55:58.740 --> 56:01.740] They're not going to just reopen it out of cause.
[56:01.740 --> 56:05.740] You've got to have some new evidence that would give them grounds to open it and have
[56:05.740 --> 56:10.740] a likelihood of changing your husband's status at trial.
[56:10.740 --> 56:11.740] Okay.
[56:11.740 --> 56:17.740] Well, the one thing I can see is that he had a court-appointed lawyer back then, and his
[56:17.740 --> 56:24.740] court-appointed lawyer quit, dropped him, because he went to work for the state, the
[56:24.740 --> 56:27.740] prosecuting office, in other words.
[56:27.740 --> 56:28.740] And he said, oh, don't worry.
[56:28.740 --> 56:32.740] I won't tell anything about your case.
[56:32.740 --> 56:34.740] And he shouldn't have.
[56:34.740 --> 56:37.740] Do you have any evidence that he did?
[56:37.740 --> 56:39.740] Well, no.
[56:39.740 --> 56:40.740] He's 30 years old.
[56:40.740 --> 56:43.740] I didn't even know my husband back then.
[56:43.740 --> 56:48.740] I mean, we met soon after and we married.
[56:48.740 --> 56:52.740] We moved to New Hampshire for six years.
[56:52.740 --> 56:57.740] He had the idea that he was not supposed to possess guns for five years.
[56:57.740 --> 57:03.740] He hunted only with a bone arrow for those five years, six years actually.
[57:03.740 --> 57:09.740] We moved back to Maine six years after his probation was over.
[57:09.740 --> 57:17.740] He never got any communication from the state of Maine saying that he was still not allowed
[57:17.740 --> 57:21.740] to possess firearm, never had any communication from them whatsoever.
[57:21.740 --> 57:27.740] He applied for a hunting license, apparently answered the question wrong.
[57:27.740 --> 57:33.740] You know, we didn't know back then what certain words meant and prohibited.
[57:33.740 --> 57:41.740] So, Bellin's status, he thought he was okay to possess a firearm after five years.
[57:41.740 --> 57:44.740] So, applied for his license, got it.
[57:44.740 --> 57:49.740] Now, they're charging him with falsifying information.
[57:49.740 --> 57:56.740] The state has been giving him hunting license for the past 25 or more years.
[57:56.740 --> 58:02.740] He's been a responsible hunter and gun owner.
[58:02.740 --> 58:10.740] Alright, well, again, unless you can actually show new evidence to make them reopen the case,
[58:10.740 --> 58:13.740] I doubt that that's going to happen.
[58:13.740 --> 58:19.740] But as far as the rest of it, you need to be checking into those laws and see whether or not they are actually being used
[58:19.740 --> 58:24.740] retroactively, which would make them illegal.

[01:19:33.740 --> 01:19:41.740] I wanted to speak with you a little bit about going into court on a traffic case with pending warrants.
[01:19:41.740 --> 01:19:49.740] My girlfriend at one point had actually quite a few traffic tickets that she never went to court on.
[01:19:49.740 --> 01:19:54.740] They all turned in failure to appear for about the last year and a half or so.
[01:19:54.740 --> 01:20:00.740] We've been, you know, finding them at various points and we've managed to get most of them dismissed.
[01:20:00.740 --> 01:20:06.740] But she has one more pending case and she has a couple of active warrants.
[01:20:06.740 --> 01:20:12.740] The last three or maybe four times that she's been in court, they've told her, you have active warrants.
[01:20:12.740 --> 01:20:17.740] You need to take care of them, but for whatever reason they've opted not to arrest her.
[01:20:17.740 --> 01:20:24.740] We got, after her last appearance in court, we got a letter from an attorney firm.
[01:20:24.740 --> 01:20:28.740] It's basically a debt collection letter, but they're trying to collect on the warrants.
[01:20:28.740 --> 01:20:29.740] Right.
[01:20:29.740 --> 01:20:39.740] We sent a response to that, basically a debt validation kind of tweaked a little bit for warrants as opposed to a traditional debt.
[01:20:39.740 --> 01:20:41.740] You gave them 10 days to respond.
[01:20:41.740 --> 01:20:43.740] That's been a little over a month.
[01:20:43.740 --> 01:20:45.740] Haven't heard anything back from them.
[01:20:45.740 --> 01:20:53.740] She has her final case coming up here in about four or five weeks and she still has those active warrants.
[01:20:53.740 --> 01:21:00.740] And I'm suspecting that they may, you know, try to either call or block or make an example of her.
[01:21:00.740 --> 01:21:04.740] What would you suggest in terms of, you know, stepping into court?
[01:21:04.740 --> 01:21:09.740] Even though she's been there several times with the active warrants and they've recognized them and have opted not to arrest her,
[01:21:09.740 --> 01:21:16.740] I'm suspecting that, you know, they may be getting a little bit tired of it, what would you suggest in terms of...
[01:21:16.740 --> 01:21:22.740] Okay, I'm assuming that at these moment, at the moment, these warrants are not from this court.
[01:21:22.740 --> 01:21:24.740] They are, yes.
[01:21:24.740 --> 01:21:26.740] They're in the same court?
[01:21:26.740 --> 01:21:30.740] They're in the same court that keeps telling her you have active warrants, you need to take care of them.
[01:21:30.740 --> 01:21:36.740] Well, then they've kind of created a problem for themselves by not acting on those warrants.
[01:21:36.740 --> 01:21:42.740] Well, and this is the same court where we've been getting all the other cases dismissed as well, so...
[01:21:42.740 --> 01:21:48.740] Right, but what I'm saying is that the court knows there's an outstanding warrant and it fails to act on that warrant.
[01:21:48.740 --> 01:21:52.740] The court is, in essence, saying the warrants not valid to begin with.
[01:21:52.740 --> 01:21:54.740] Okay.
[01:21:54.740 --> 01:22:01.740] Well, you know, my understanding is in order to get a letter from a, you know, third-party collection firm about it,
[01:22:01.740 --> 01:22:07.740] would indicate to me that they've actually, you know, maybe written the warrants off or sold them or whatever it is that they do with them.
[01:22:07.740 --> 01:22:12.740] Yeah, they've sent them out for collection, and if they've done that, they can't act on them.
[01:22:12.740 --> 01:22:13.740] Okay.
[01:22:13.740 --> 01:22:19.740] But the other issue they've got is, are these fine only Class C offenses these warrants are for?
[01:22:19.740 --> 01:22:24.740] They're failure to appear is on old traffic tickets.
[01:22:24.740 --> 01:22:26.740] All of which are Class C, right?
[01:22:26.740 --> 01:22:27.740] Yeah.
[01:22:27.740 --> 01:22:30.740] Okay, then the failure to appear would be Class C.
[01:22:30.740 --> 01:22:36.740] And they cannot issue failure to appears on Class C. There's no statutory authority for it.
[01:22:36.740 --> 01:22:39.740] Zero, nada, none.
[01:22:39.740 --> 01:22:41.740] Okay.
[01:22:41.740 --> 01:22:47.740] They try to use 543.009, I believe it is, or 11.
[01:22:47.740 --> 01:22:56.740] The dealing with person commits an offense if they fail to appear in compliance with the notice to appear regardless of the disposition of the charge alleged.
[01:22:56.740 --> 01:22:57.740] Yep.
[01:22:57.740 --> 01:23:08.740] But that can only be applicable according to the controlling statute, which in the transportation code, that particular section is general.
[01:23:08.740 --> 01:23:15.740] Whereas when you go back to the code of criminal procedure dealing with the issuance of a warrant, that's local and specific.
[01:23:15.740 --> 01:23:39.740] When you look at 15.17G, 27.14D, you find out in 14.06B and C in correspondence with 1517G, you can see very quickly that the court's authority to issue a warrant for failure to appear is specific to 14.06C offenses.
[01:23:39.740 --> 01:23:49.740] And those are Class A and B only. There is nothing in 1517 that authorizes Class C offense warrant.
[01:23:49.740 --> 01:24:01.740] Then you go to 27.14D, which says if the individual fails to appear on the notice to appear, the court shall ensure that the complaint is generated.
[01:24:01.740 --> 01:24:08.740] But it does not in any way authorize the issuance of a warrant for that failure to appear.
[01:24:08.740 --> 01:24:14.740] Okay. So if they do try to enforce these, what is the best recourse?
[01:24:14.740 --> 01:24:21.740] The best way to do it is be prepared to post a bond. Go in ready to post a bond if they arrest her.
[01:24:21.740 --> 01:24:22.740] We're prepared for that.
[01:24:22.740 --> 01:24:38.740] Okay. The second thing is, is bar grieve the judge, and I'm sorry, judici condo complained the judge for issuing a false warrant. Also bar grieve whatever prosecuting idiot asked for it.
[01:24:38.740 --> 01:24:45.740] Well, being that we have a little over a month before she has to go to court, it sounds like those are things that we may be able to do ahead of time.
[01:24:45.740 --> 01:24:46.740] Absolutely.
[01:24:46.740 --> 01:24:52.740] Do them as soon as possible and see if those warrants still exist when that hits the fan.
[01:24:52.740 --> 01:25:01.740] Okay. Okay. Yeah. I mean, we could, you know, approach it from the standpoint of, hey, we got this debt collection letter from this firm.
[01:25:01.740 --> 01:25:12.740] No, wrong issue. One thing has nothing to do with the other. The issue is the warrants were illegally issued.
[01:25:12.740 --> 01:25:20.740] Right. But I'm saying in terms, just use that strictly from the standpoint of saying buying through this, it has come to our attention that these warrants were issued.
[01:25:20.740 --> 01:25:25.740] And no, the court has already told you the warrants been issued.
[01:25:25.740 --> 01:25:26.740] Right.
[01:25:26.740 --> 01:25:32.740] Okay. So it's not buying through the debt collection letter. It's through the court.
[01:25:32.740 --> 01:25:44.740] But the failure of the court to act on them at the time they informed you is a clue that the court knows two possibilities exist. They've sent it out for collections and therefore they are forbidden to act on it.
[01:25:44.740 --> 01:25:56.740] Or they cannot issue the warrant and they know it'd be illegal. And if you know that and you come back at them, they don't have a leg to stand on because they actively know the authority under law.
[01:25:56.740 --> 01:25:57.740] I see.
[01:25:57.740 --> 01:26:06.740] They heard last court appearance was April 30th and it was the following week when they turned those warrants over to this debt collection firm.
[01:26:06.740 --> 01:26:12.740] So at the time, you know, it had, as far as we know, the warrants had not been sold or written on.
[01:26:12.740 --> 01:26:20.740] Okay. Then the court by its own admission and inaction has told you that they know the warrants are not legal and valid.
[01:26:20.740 --> 01:26:21.740] Okay.
[01:26:21.740 --> 01:26:32.740] So what I would do is I would continue on, do what you have to do with the appearance in court. If they arrest her then, the harm is done. Now there's no backing out.
[01:26:32.740 --> 01:26:38.740] At that point, you do everything possible to sue the living tar out of everybody.
[01:26:38.740 --> 01:26:48.740] Well, and such a suit would probably have more weight if we had tried to preempt, you know, in other words, said, look, we know these warrants exist. We know that they were issued with no authority.
[01:26:48.740 --> 01:26:51.740] You file a motion to recall warrant.
[01:26:51.740 --> 01:26:53.740] Motion to recall warrant.
[01:26:53.740 --> 01:26:54.740] Yep.
[01:26:54.740 --> 01:27:02.740] Well, that's because it's just one you make. Motions are made as you need them, not because they pre-exist.
[01:27:02.740 --> 01:27:11.740] I mean, we move the court to recall the warrant. Here's why. There's no authority in law to issue it according to the provisions of blah, blah, blah, and blah, blah, blah.

[01:27:16.740 --> 01:27:18.740] I'll definitely get started on that.
[01:27:18.740 --> 01:27:33.740] Okay. I mean, you can make any motion you want, but we always make them in writing, okay? You can move the court to open the window, close the door, lower the air conditioner, whatever. That's still a motion.
[01:27:33.740 --> 01:27:44.740] Yeah, I get that. Now, in this particular case, the motion to recall warrant would be done in conjunction with the currently pending case, but if we wanted to preempt that, would we have to?
[01:27:44.740 --> 01:27:50.740] You still, you file that along with the judicial conduct complaint and the bar agreements.

[01:28:49.740 --> 01:28:58.740] For instance, the issuing of a warrant is required to be done by a disinterested magistrate, someone that is not presiding over the case.

[01:37:41.740 --> 01:37:53.740] And when I say their individual states, I'm talking about the actual people of that state, not the small group called the state representatives and legislature of that state that sent them.
[01:37:53.740 --> 01:38:10.740] The state has no more authority in the form of its representative government to declare they want to set up a whole new government when the people themselves don't create that concept and offer them that power because the people are the government in this country.
[01:38:10.740 --> 01:38:12.740] And that's where that argument's coming from.

[01:38:14.740 --> 01:38:16.740] You know, I don't know.

[01:51:22.740 --> 01:51:33.740] One of the things that I took from taking to the traffic seminar there was, that really helped you a lot, was read the law.
[01:51:33.740 --> 01:51:36.740] Or whatever it is they're calling the law.

[01:51:38.740 --> 01:51:48.740] But, you know, instead of going on all the theories and stuff like that, just read the law and use the law against them.
[01:51:48.740 --> 01:51:57.740] But the woman that called in about her husband, that they went after for a felon in possession of a firearm,
[01:51:57.740 --> 01:52:09.740] and she was saying, and I don't remember what state she was from, but she was saying that after five years she could possess a firearm in Michigan.
[01:52:09.740 --> 01:52:22.740] The law states that a felon after five years, and it's either five to ten years, something like that, after conviction can possess a firearm.
[01:52:22.740 --> 01:52:39.740] But if you read the law further, it says, if that felon applies with the state to get their right return to them, so it's not automatic.
[01:52:39.740 --> 01:52:53.740] The law does state that you do get your right back, but you have to apply with them, and then they look into it to see what you were charged with, and do they feel that you're a threat to community and that sort of...
[01:52:53.740 --> 01:52:55.740] Right.
[01:52:55.740 --> 01:53:08.740] But I don't... listening to her, I think that they were just looking at the first part of the law and not reading all the way through, and never did go back and apply.
[01:53:08.740 --> 01:53:26.740] I don't know because my neighbor went through the same thing, assuming that just because he either heard from somebody or read a little bit and said, yeah, after five years you can have a firearm,
[01:53:26.740 --> 01:53:37.740] and went home, started using it, and ended up getting thrown back in jail because he never applied to get their permission to possess one again.
[01:53:37.740 --> 01:53:44.740] Yeah, that's the problem with this. You've already had the punishment for the crime.
[01:53:44.740 --> 01:53:51.740] If they didn't think that you were punished long enough, then they should have left you in jail. Parole should not be an option.
[01:53:51.740 --> 01:53:58.740] And once you've gotten out of jail, that's the end of it. You've already been punished for the offense.
[01:53:58.740 --> 01:54:09.740] You can't continue to withhold my rights because of any other reason. I served my time. That's it. Leave me alone after that.
[01:54:09.740 --> 01:54:15.740] If I don't screw up and mess around and hurt anybody else, you have no cause to be messing with me or mine.

[01:54:26.740 --> 01:54:33.740] Well, yeah, they're looking for a way to convert everybody into a permanent criminal so they can use that as the excuse to deprive them of any and all rights,
[01:54:33.740 --> 01:54:37.740] most especially the right to keep in their arms.
[01:54:37.740 --> 01:54:48.740] Absolutely, and that's, you know, probably the most about the second most important right we have.
[01:54:48.740 --> 01:54:51.740] Well, I'd go along with that.
[01:54:51.740 --> 01:55:00.740] All right, I just thought I'd throw that in there just, you know, so if you're still listening, you know, pick up the book and read it and see if that's where they're coming.
[01:55:00.740 --> 01:55:08.740] Yeah, that's always the first rule, folks. You have to read the law or statute or ordinance they're attempting to come after you with.
[01:55:08.740 --> 01:55:19.740] And don't just stop at the one they show you in the book. Go back and find the original enrolled bill that created that version they're showing you in the book.
[01:55:19.740 --> 01:55:29.740] Backtrack it a little bit. Do your research. Go to the history of that statute. See if it ever said what they're trying to convince you it says.
[01:55:29.740 --> 01:55:34.740] Because odds are they are wrong.
[01:55:34.740 --> 01:55:44.740] And I'm not going to say that they're wrong by accident because these are people telling you this that are supposed to be learned in the law and they aren't.
[01:55:44.740 --> 01:55:50.740] All you have to do is show them the law and look at their face when they read it to know that they aren't.
[01:55:50.740 --> 01:56:02.740] Because what they thought it said, and what it actually says, obviously doesn't reconcile with that little brain tumor they have that they actually think allows them to process things.
[01:56:02.740 --> 01:56:12.740] I mean, I appreciate the call, Terry. You are right. The first thing you have to do always is go read what they're charging you with.
[01:56:12.740 --> 01:56:18.740] But don't stop there. Backtrack it. Go all the way back to when it began.
[01:56:18.740 --> 01:56:32.740] The bill at the legislative level or congressional level, whatever you can find on the subject to see what the original intent of that bill was and is once it was passed.

[01:56:34.740 --> 01:56:44.740] Yeah. That has always been my biggest hurdle is I learned an awful lot from the traffic seminar and the information I got.
[01:56:44.740 --> 01:56:46.740] I learned an awful lot from listening to you.
[01:56:46.740 --> 01:56:51.740] But of course, Texas law is different than Michigan law.
[01:56:51.740 --> 01:57:09.740] And I think this might apply to a lot of people throughout the country is when you're backtracking, maybe sometime in one of your shows you can give us a little bit of information on what the best way is of searching the original law.
[01:57:09.740 --> 01:57:13.740] Because that's been my hardest problem is trying to go back then.
[01:57:13.740 --> 01:57:29.740] Well, usually the statute will show you the legislative history at the bottom. It'll show in 76 Legislature 1999, 84 Legislature 2000, and so on and so forth at the bottom of the statute.
[01:57:29.740 --> 01:57:31.740] That's your legislative history.
[01:57:31.740 --> 01:57:38.740] What you can do is find how many times that particular version of the statute has been amended by looking at that.
[01:57:38.740 --> 01:57:45.740] But once you exhaust that list, then you have to start backtracking through what they call the old codes in most states.
[01:57:45.740 --> 01:57:48.740] And the old codes are the actual books.
[01:57:48.740 --> 01:57:54.740] And the actual books will have references to the prior versions written right into them.
[01:57:54.740 --> 01:58:00.740] And they'll tell you what old book to go look at and what section of the old book to go look at.
[01:58:00.740 --> 01:58:09.740] And if you'll backtrack this stuff all the way back to its origination, you'll find out what its original meaning and intent is.
[01:58:09.740 --> 01:58:16.740] So, normally when you're backtracking like that, you get to a point where it's not in line.
[01:58:16.740 --> 01:58:19.740] Oh yeah, you'll get to that point very, very soon.
[01:58:19.740 --> 01:58:20.740] Right.
[01:58:20.740 --> 01:58:26.740] And that's why you have to get to a law library and somebody that knows what they're doing.
[01:58:26.740 --> 01:58:31.740] And you should get like the law librarian to help you out with that.

[01:58:32.740 --> 01:58:36.740] Most of them are going to be college or university libraries.
[01:58:36.740 --> 01:58:38.740] And the librarians are very helpful. They're very friendly.
[01:58:38.740 --> 01:58:49.740] You can go up to them and say, look, I'm new to legal research and I would really appreciate it if you'd show me how to use the law books and the shepherds and those things.
