[05:10.840 --> 05:16.480]  around, I see them changing dramatically. We just had someone go into the county court
[05:16.480 --> 05:26.200]  here in Austin Pro Say and got a very positive ruling from a local county judge, which in
[05:26.200 --> 05:33.800]  Travis County is extremely rare. And we'll talk about that a little later. We've had
[05:33.800 --> 05:44.440]  a number of issues just here in the last week or so that give indication that the courts
[05:44.440 --> 05:51.200]  themselves are beginning to take things differently. I was talking to Steve earlier and he referred
[05:51.200 --> 06:01.560]  me to a case out of Fort Worth where a federal judge in Fort Worth ruled that nerves because
[06:01.560 --> 06:10.240]  they didn't own the note had no power to act under the note. Now that was surprising because
[06:10.240 --> 06:19.160]  the judge who rendered the ruling, in my personal opinion, is about the most stinking, rotten,
[06:19.160 --> 06:27.720]  low down, scoundrel judge I have ever come across. And for him to rule against one of
[06:27.720 --> 06:43.400]  the banks in such a profound matter was absolutely amazing. So it looks like those people in
[06:43.400 --> 06:51.120]  public positions are beginning to realize that the public is not happy. The sleeping
[06:51.120 --> 07:00.240]  giant that Alex Jones talks about is not waking up anymore. He's awake and he is very, very
[07:00.240 --> 07:09.120]  unhappy. We're looking at an election coming up and we keep hearing about elections being
[07:09.120 --> 07:16.560]  determined by the toss of a coin. We just had one in Houston. We had one in Addison
[07:16.560 --> 07:24.840]  recently. Addison, Illinois. Addison, Illinois. Addison, Texas is a north suburb of Dallas
[07:24.840 --> 07:33.200]  and it's a couple hundred thousand people. And a city council race was determined with
[07:33.200 --> 07:43.400]  118 votes on each side. We have local county and district public officials who were looking
[07:43.400 --> 07:53.760]  at coming up for election before an electorate who is very, very unhappy with them. The very
[07:53.760 --> 08:01.840]  unhappy with the system in general. And if you are a part of the system, you will reap
[08:01.840 --> 08:09.760]  that unhappiness by association. And I think, or at least I get the feeling that the judges
[08:09.760 --> 08:15.080]  and other public officials are beginning to feel the heat. So they're beginning to
[08:15.080 --> 08:24.240]  rule according to law and instead of according to their personal biases. At least that's
[08:24.240 --> 08:35.520]  how it appears. And one of the things I did want to talk about is in the foreclosure issue.
[08:35.520 --> 08:45.680]  I've been putting together an analysis. When I first started looking into the foreclosure
[08:45.680 --> 08:54.680]  mess, there were a lot of companies around doing forensic analysis for people. And I
[08:54.680 --> 09:03.880]  looked at them and for the most part, they turned out to be worthless. One of the first
[09:03.880 --> 09:10.560]  pieces that I looked at had a forensic analysis that paid $500 for it. And I looked at the
[09:10.560 --> 09:15.560]  analysis and oh, it showed they violated this law and they violated that law and they violated
[09:15.560 --> 09:24.000]  each other law. But I looked at it and said, well, big deal. So they violated all this
[09:24.000 --> 09:33.840]  law. What can we do about it? How can we adjudicate that violation? And I had a very hard time
[09:33.840 --> 09:40.720]  finding anything that gave me any tools that I could use. So I finally got frustrated with
[09:40.720 --> 09:51.960]  it and went to work on building one myself. And what I started with primarily is what's
[09:51.960 --> 09:57.760]  in the court record because that's what we have to work with. And I pulled the documents
[09:57.760 --> 10:04.200]  from the court record and we've heard these stories about how the documents in the records
[10:04.200 --> 10:12.760]  are just a total mess. We hear this all over the internet. Well, folks, they are. They
[10:12.760 --> 10:21.680]  are absolutely an atrocious mess. It's beyond bad. It is absolutely almost unbelievable,
[10:21.680 --> 10:30.480]  the garbage I'm finding in there, at how blatantly fraudulent this documentation is.
[10:30.480 --> 10:35.360]  And I, in doing the evaluations, we start with the deed of trust and just walk down
[10:35.360 --> 10:41.520]  through each of the documents. And in doing that, I came across something that was great
[10:41.520 --> 10:47.960]  fun. I want to wait until Steve is on to address this because he's very knowledgeable in these
[10:47.960 --> 10:54.440]  areas. This is something profound enough that we may be able to take every deed of trust
[10:54.440 --> 11:00.880]  out there and turn it into toilet paper. We do have a caller on the line. If I were waiting
[11:00.880 --> 11:07.720]  for Steve to come up, I would like to go to Larry in Texas. Larry, do you have a question
[11:07.720 --> 11:20.120]  or a comment for us? Yes, I got you. You got me. Okay, good. I am involved in a foreclosure

[11:40.920 --> 11:46.400]  think that's going to help. Oh yeah, I'm a grandpa and I know the chocolate deficiencies
[11:46.400 --> 11:54.960]  when I hear it. Yeah, that's why he's making a lot of noise. Well, that's okay with grandpa
[11:54.960 --> 12:02.680]  if they make a lot of noise. Okay, you're in a foreclosure now? Yeah, well, what happened
[12:02.680 --> 12:11.080]  was is last year with Delta America, I entered into a loss mitigation process with them.
[12:11.080 --> 12:19.000]  This went on for about six months and then they sent me an offer of loss mitigation.
[12:19.000 --> 12:27.920]  They sent me the offer and when they did, when I looked at it, I looked at the FHA guidelines
[12:27.920 --> 12:33.280]  for loss mitigation and the language was incorrect in it. It was the first of all, the first
[12:33.280 --> 12:37.280]  one they sent me, they didn't have my name right. So I called Bank of America, I said,
[12:37.280 --> 12:41.160]  look, my name, I don't even know who this is you sent it to and they said, well, what
[12:41.160 --> 12:47.360]  is your name? And I told them and of course they sent me another one with my name on it.
[12:47.360 --> 12:56.600]  Well, then when they sent it, the FHA guidelines say that they can't have any language in there
[12:56.600 --> 13:03.680]  that requires a mortgager to waive their rights and they had this language in there wanting
[13:03.680 --> 13:09.000]  me to waive all my rights. And I told them I couldn't do that. Well, I had a conversation
[13:09.000 --> 13:15.680]  with them on the phone and they told me they were canceling the loss mitigation process.
[13:15.680 --> 13:21.880]  I was recording this call. About a week later, I got a letter from them saying that I had
[13:21.880 --> 13:29.400]  canceled the loss mitigation process. And so I sent them back a letter saying, no, your
[13:29.400 --> 13:33.920]  representative did, here's a copy of the recording. And then I sent them a qualified
[13:33.920 --> 13:42.040]  RESPA request, a qualified written RESPA request. That was on April 27th, okay. To
[13:42.040 --> 13:47.720]  say right now, they have not responded. They've just ignored everything that I've sent to
[13:47.720 --> 13:58.480]  them, okay. I asked them to send me a verification of the wet signature note. They haven't sent
[13:58.480 --> 14:04.600]  me anything. Well, next thing you know, recon trust takes over and recon trust says we're
[14:04.600 --> 14:10.240]  going to foreclose on your house and they're doing it through MERS. Well, I was listening
[14:10.240 --> 14:14.160]  to your show last week where you talked about going down and getting the assignment of data
[14:14.160 --> 14:23.880]  trust and looking at how it was filed. And looking at the name on here, I see evidence
[14:23.880 --> 14:34.040]  of this robo signing, okay. So during this whole time, I've sent all my communication
[14:34.040 --> 14:41.200]  with Bank of America, I sent it over to recon trust, you know, asking for a response to
[14:41.200 --> 14:48.520]  my RESPA request. They haven't answered at all. They just told me we're going to foreclosure.
[14:48.520 --> 14:57.000]  They got the sale of the house set for the third of this next month. And they sent me
[14:57.000 --> 15:02.840]  a letter the other day saying that my request to rescind the contract was denied because
[15:02.840 --> 15:13.880]  it didn't qualify. I never sent them a request. I don't even understand that. Okay. This sounds
[15:13.880 --> 15:22.000]  very familiar. I've heard this story a number of times. And the thing about loss mitigation
[15:22.000 --> 15:32.160]  and loan modification, are you familiar with the term the garden path? I'm not. Well, that's
[15:32.160 --> 15:38.880]  the path you were led down because they had no intention to modify or do anything concerning
[15:38.880 --> 15:43.880]  loan mitigation. They have every intention of foreclosing. They have no intention of
[15:43.880 --> 15:52.280]  doing anything else. They use the loan modification process to coerce people into foreclosure.
[15:52.280 --> 15:57.560]  We have people who are never behind and they ask for a loan modification. And the banks
[15:57.560 --> 16:02.360]  tell them, well, we can't give you a modification unless you're at three payments behind and
[16:02.360 --> 16:08.400]  they get three payments behind immediately foreclose. So that's what they're doing. And
[16:08.400 --> 16:15.120]  that's what they do. And I noticed, so we started that loss mitigation process in August
[16:15.120 --> 16:24.160]  of 2011 or July of 2011. In October of 2011, they went down and changed the assignment of
[16:24.160 --> 16:30.600]  the data trust. Now, I want to ask you a question because I've listened very carefully to your
[16:30.600 --> 16:37.920]  show, but not when you were talking about this. Okay. Well, hang on. We'll get to that
