[04:32.280 --> 04:42.280]  Okay. Anyway, what I want to talk about is I went with a friend on an attorney's visit here
[04:42.280 --> 04:51.280]  a day before yesterday, and this attorney is both a civil attorney and a criminal defense attorney.
[04:51.280 --> 05:05.280]  Normally, I will be more than frank with an attorney when they're saying things that I know to not be true.
[05:05.280 --> 05:11.280]  Now, the difference between most attorneys and this attorney is he never lied about anything.
[05:11.280 --> 05:15.280]  He never misled about anything.
[05:15.280 --> 05:24.280]  The only thing I found wrong is that what he said was going to happen is the reality
[05:24.280 --> 05:28.280]  versus what's supposed to happen in accordance with law.
[05:28.280 --> 05:34.280]  Now, he said he's been in a practicing attorney for 40-plus years.
[05:34.280 --> 05:43.280]  Okay, so given that we can pretty much take for granted that he sees exactly the same stuff
[05:43.280 --> 05:51.280]  that we see day in and day out, but has not done anything about it
[05:51.280 --> 05:54.280]  because he has to make his living from the system.
[05:54.280 --> 06:00.280]  He hasn't challenged it to the level that it needs to be challenged was the take that I got on it
[06:00.280 --> 06:05.280]  because, like I say, he didn't lie about anything. He was very frank and upfront.
[06:05.280 --> 06:08.280]  You can't do this. You can't do this. You can't do this.
[06:08.280 --> 06:11.280]  It isn't because the law says you can.
[06:11.280 --> 06:18.280]  It's because the system itself will never allow what you're trying to do to go further.
[06:18.280 --> 06:29.280]  Case in point, I gave the individual a list of criminal acts that these particular officers committed
[06:29.280 --> 06:36.280]  and these were DPS officers, county sheriff's deputies and Austin PD all collected together.
[06:36.280 --> 06:43.280]  It began, however, with two DPS officers who illegally arrested two individuals
[06:43.280 --> 06:48.280]  and there's absolutely no question that the arrest was illegal.
[06:48.280 --> 06:56.280]  Now, what they did was they arrested them, took them to jail, booked them in
[06:56.280 --> 07:05.280]  and immediately tried to charge both of them with failure to identify and resisting arrest.
[07:05.280 --> 07:12.280]  But the problem for them is, of course, is that they initiated the arrest on the failure to identify
[07:12.280 --> 07:17.280]  even though neither of these individuals were in any type of position
[07:17.280 --> 07:23.280]  that would have given the officer probable cause to demand identification.
[07:23.280 --> 07:28.280]  None of the events leading up to this based upon what I've been told would have constituted
[07:28.280 --> 07:32.280]  any form of probable cause on the part of the officers.
[07:32.280 --> 07:39.280]  Now, the attorney told them upfront that the law gives the officer every right to request the information
[07:39.280 --> 07:41.280]  and he's right.
[07:41.280 --> 07:51.280]  But the case law all says that that doesn't make it a responsibility of a citizen to respond.
[07:51.280 --> 07:55.280]  The citizen has every right to tell the officer to take a hike.
[07:55.280 --> 07:59.280]  I'm not doing anything. I don't have to give you that information.
[07:59.280 --> 08:05.280]  Well, these two DPS officers went through the motions of harassing the general public
[08:05.280 --> 08:10.280]  just for that particular reason because they wouldn't give them any identification
[08:10.280 --> 08:14.280]  because there was no probable cause.
[08:14.280 --> 08:21.280]  And again, the list of things that I gave the individual was the aggravated assault.
[08:21.280 --> 08:25.280]  They took them to jail, aggravated kidnapping, abuse of official capacity, and official oppression.
[08:25.280 --> 08:30.280]  That's a minimum of criminal acts by the DPS officers, minimum.
[08:30.280 --> 08:37.280]  But the attorney did exactly what I told the individual and he said, it's not going to do you any good.
[08:37.280 --> 08:41.280]  You can take them to any prosecuting attorney. They're not going to touch them.
[08:41.280 --> 08:45.280]  Well, we know that. We absolutely know that.
[08:45.280 --> 08:57.280]  The one place where the attorney failed to give him information was in the fact that he can take them directly to a grand jury.
[08:57.280 --> 09:02.280]  Now, the problem there, however, remains the same.
[09:02.280 --> 09:07.280]  Getting in to see them, not having the prosecutor run interference,
[09:07.280 --> 09:14.280]  and getting the grand jury to actually listen to what's in the accusation against the officer
[09:14.280 --> 09:20.280]  in order to determine whether or not a crime was even committed, that merits an indictment.
[09:20.280 --> 09:25.280]  The problem with most grand juries is as they are comprised of everyday people
[09:25.280 --> 09:35.280]  that have been carefully screened by the state to only have a status to view.
[09:35.280 --> 09:41.280]  Randy, do you agree or disagree?
[09:41.280 --> 09:45.280]  Okay, I'm going to assume that you're not there or he doesn't agree.
[09:45.280 --> 09:49.280]  There you go. The last word you said and lost.
[09:49.280 --> 09:56.280]  I said, do you agree or disagree that a grand jury, as we know them,
[09:56.280 --> 10:04.280]  are currently comprised only of people that have been carefully screened by the state to have a status point of view?
[10:04.280 --> 10:10.280]  No. I've sat down and watched them. They've got a room full of 50 or 60 people,
[10:10.280 --> 10:17.280]  and I wish that were the case, but it's worse than that.
[10:17.280 --> 10:23.280]  We have a grand jury comprised of, for the most part, ordinary people,
[10:23.280 --> 10:28.280]  which tends not to include people who listen to this show,
[10:28.280 --> 10:36.280]  because ordinary people still think that the system will protect them.
[10:36.280 --> 10:42.280]  They still have a reasonable expectation that the system is fair and honest,
[10:42.280 --> 10:47.280]  and they still trust the prosecutor when he talks to them and the judges.
[10:47.280 --> 10:54.280]  They don't consider that the judges and prosecutors are dirty, rotten lion scoundrels.
[10:54.280 --> 11:01.280]  So that's the real hurdle we have to overcome with grand jury.
[11:01.280 --> 11:09.280]  But we can overcome that. We won't overcome it if we don't start going to then.
[11:09.280 --> 11:13.280]  But all we need is one.
[11:13.280 --> 11:18.280]  All we need is one person on the grand jury who recognizes what we're talking about,
[11:18.280 --> 11:25.280]  because he was done to his son or grandson or his next door neighbor or someone he knows.
[11:25.280 --> 11:29.280]  Yeah, and that's what I'm talking about with a status point of view.
[11:29.280 --> 11:35.280]  The prosecutor is very, very careful to ask the questions that would draw those people out
[11:35.280 --> 11:42.280]  to having to respond that, yeah, they have a problem with what's being done and that has been done before,
[11:42.280 --> 11:46.280]  and they'll disqualify them from that jury. That's the problem I'm talking about.
[11:46.280 --> 11:54.280]  I understand, but that's not something we're going to be able to fix unless we start changing
[11:54.280 --> 12:02.280]  and very closely regulating how the grand jurors are selected from the group,
[12:02.280 --> 12:06.280]  from the pool that's called.
[12:06.280 --> 12:12.280]  I think we're a lot better off if we just start hammering grand jurors.
[12:12.280 --> 12:18.280]  We don't have to get every one of them indicted. We get one or two indicted,
[12:18.280 --> 12:24.280]  and it's going to terrify the rest of them. It'll terrify us just going to the grand jury
[12:24.280 --> 12:27.280]  and struggling to get it before a grand jury.
[12:27.280 --> 12:33.280]  We actually do, and in the next legislature we will be proposing legislation
[12:33.280 --> 12:39.280]  that will require grand juries to sit at least one day a month
[12:39.280 --> 12:45.280]  for the purpose of hearing complaints by private citizens.
[12:45.280 --> 12:51.280]  That alone could have the effect of changing everything.
[12:51.280 --> 12:57.280]  But until then, we need more people filing. We need more people going to grand juries
[12:57.280 --> 13:03.280]  and raising came about it so that we have more to take to our legislators
[13:03.280 --> 13:09.280]  to show that there is a positive need for it.
[13:09.280 --> 13:15.280]  If we sit back and say it's too hard and why they won't do anything anyway,
[13:15.280 --> 13:22.280]  so I won't do anything, well, in those cases nothing's going to happen.
[13:22.280 --> 13:27.280]  That's my story and I'm sticking to it.
[13:27.280 --> 13:30.280]  It's the story you're sticking to. Is that what I'm hearing there, Randy?
[13:30.280 --> 13:33.280]  Yes, it is.
[13:33.280 --> 13:37.280]  Well, yeah, what I was saying about, that's what I'm talking about
[13:37.280 --> 13:42.280]  about the status point of view is that the prosecuting attorney is very careful
[13:42.280 --> 13:46.280]  to weed out somebody with a mind of their own that is willing to look at more
[13:46.280 --> 13:51.280]  than what the prosecuting attorney wants to feed them as a line at trial
[13:51.280 --> 13:58.280]  that is willing to challenge the law as well as the facts before they make a finding of guilty
[13:58.280 --> 14:00.280]  and so on and so forth.
[14:00.280 --> 14:06.280]  The problem is the general public simply is too far asleep.
[14:06.280 --> 14:11.280]  Alex Jones is right about one thing. They're waking up to a lot of things,
[14:11.280 --> 14:16.280]  but they're not waking up to the things that are tying up their daily lives.
[14:16.280 --> 14:22.280]  They're only looking at the major catastrophes and the cover-ups that are going through those.
[14:22.280 --> 14:28.280]  They don't see that the linchpin that holds all of these major things together
[14:28.280 --> 14:35.280]  is the little bits of glue in these lower priority things
[14:35.280 --> 14:38.280]  that they don't think are worth their time and effort.
[14:38.280 --> 14:43.280]  I mean, think about that, folks. When you use something like liquid nail
[14:43.280 --> 14:49.280]  to glue two pieces of lumber together, you don't slather that stuff on there
[14:49.280 --> 14:56.280]  and the mason's do the mortar to put together a brick wall, okay?
[14:56.280 --> 15:01.280]  You put only a few dots of it down the entire length of what you want to glue together.
[15:01.280 --> 15:05.280]  You put them together. It'll spread out slowly on its own.
[15:05.280 --> 15:09.280]  It hit the two pieces together and make a much stronger bond.
[15:09.280 --> 15:13.280]  The more of it you put on there, the weaker that bond will be.
[15:13.280 --> 15:20.280]  Well, I equate all of these lower-end things like the traffic, which requires you to surrender
[15:20.280 --> 15:28.280]  more of your protected rights than any other active government I can think of.
[15:28.280 --> 15:36.280]  Even the health care bill does not invade your life as far as the number of rights
[15:36.280 --> 15:44.280]  that it requires you to sign away in order to acquire the privilege.
[15:44.280 --> 15:49.280]  And that's one of the reasons why I took this issue on
[15:49.280 --> 15:55.280]  is because I honestly believe it is the little drops of glue
[15:55.280 --> 15:59.280]  that make all the rest of this possible.
[15:59.280 --> 16:04.280]  No matter how big the conspiracy is on two different fronts,
[16:04.280 --> 16:10.280]  without something to glue it together, you can't make those two sides that come together
[16:10.280 --> 16:16.280]  and stick and stay without something to hold it there.
[16:16.280 --> 16:23.280]  And it's the people's delusion of what government authority is
[16:23.280 --> 16:33.280]  and what the people can and cannot do that is what makes that glue effective.
[16:33.280 --> 16:39.280]  So my intent is to make that glue so weak and so useless,
[16:39.280 --> 16:47.280]  they can't use it to bind their other things together to keep us in the dark.

[35:30.200 --> 35:37.200]  You think of it as cannon fodder you're going to get to use on his boss
[35:37.200 --> 35:44.200]  I once had my squadron commended when I was in the military
[35:44.200 --> 35:50.200]  Tell me this was after I had called the IG on him a couple of times
[35:50.200 --> 35:56.200]  And just before I was going to process off the base I was going to Vietnam
[35:56.200 --> 36:03.200]  We met at the base flying club and he told me Mr. Kelton seemed to call the inspector general quite a bit
[36:03.200 --> 36:07.200]  I said well sir it seemed like a good idea at the time
[36:07.200 --> 36:12.200]  He said well just so you know that last time you called the inspector general
[36:12.200 --> 36:18.200]  I called your officer in charge of your duty section and told him
[36:18.200 --> 36:23.200]  Whatever this airman's problem is fix it
[36:23.200 --> 36:26.200]  He said but sir I don't think he's complaining as valid
[36:26.200 --> 36:29.200]  I don't care if he's complaining as valid or not
[36:29.200 --> 36:32.200]  You fix it
[36:32.200 --> 36:36.200]  That's how it really works
[36:36.200 --> 36:40.200]  If you go to the mayor and the mayor chews out the chief
[36:40.200 --> 36:47.200]  It's not going to matter if this police officer followed every rule exactly to the letter

[36:51.200 --> 36:55.200]  We'll get his attention, we'll get his attitude adjusted

[42:05.200 --> 42:11.200]  They're very good at reaching there and pressing on your buttons to get you to do the dance form
[42:11.200 --> 42:16.200]  And when they press their little buttons and you don't dance
[42:16.200 --> 42:18.200]  There's a pattern of interruption
[42:18.200 --> 42:23.200]  It's not always outwardly noticeable
[42:23.200 --> 42:28.200]  But internally their internal warning buzzers are going off and saying
[42:28.200 --> 42:31.200]  Wait a minute, wait a minute
[42:31.200 --> 42:34.200]  This is not working the way it was supposed to
[42:34.200 --> 42:43.200]  And it has a tendency to curb their personal passions
[42:43.200 --> 42:46.200]  And make them more careful and that's what you want
[42:46.200 --> 42:51.200]  But it'll also give you much better control of what you're doing
[42:51.200 --> 42:54.200]  And make it more likely that you'll actually reach your outcome
[42:54.200 --> 42:56.200]  Because if you don't know where you're going
[42:56.200 --> 42:59.200]  You can be pretty sure you're going to wind up somewhere else

[48:57.200 --> 48:59.200]  Right, and they issue that ticket illegally

[49:07.200 --> 49:10.200]  Any peace officer may arrest without warrant

[49:18.200 --> 49:23.200]  He has to have it happen within his presence or view

[50:28.200 --> 50:29.200]  Sure, go ahead
[50:29.200 --> 50:31.200]  I once got a ticket
[50:31.200 --> 50:33.200]  I was pulling out from one side of the road
[50:33.200 --> 50:36.200]  A guy was pulling out from the opposite side of the road
[50:36.200 --> 50:43.200]  And we were separated slightly so that he was looking at the oncoming lane
[50:43.200 --> 50:45.200]  As he pulled across
[50:45.200 --> 50:46.200]  And so was I
[50:46.200 --> 50:49.200]  So we were both flipping away from each other
[50:49.200 --> 50:53.200]  He got out a little sooner so I hid his quarter pen
[50:53.200 --> 50:57.200]  And the sheriff's deputy come along and said, ah, it's not much damage
[50:57.200 --> 50:58.200]  You guys need to get that out of the street
[50:58.200 --> 51:00.200]  Put him up here in the parking lot
[51:00.200 --> 51:01.200]  So we do
[51:01.200 --> 51:07.200]  And then a local police, Lake West police officer came along later and wrote me a ticket
[51:07.200 --> 51:13.200]  So I went to the municipal court and the judge there which you typically wrote
[51:13.200 --> 51:15.200]  And I appealed it
[51:15.200 --> 51:23.200]  And in the county court, I got the officer on the stand and I passed the officer
[51:23.200 --> 51:28.200]  I held up the ticket and I said, do you recognize this document you suggested here?
[51:28.200 --> 51:33.200]  Did you write this document? He said, yes, I did
[51:33.200 --> 51:35.200]  Did you sign it right here? He said, yes, I did
[51:35.200 --> 51:42.200]  When you sign this document, is it presumed that this signature is under oath?
[51:42.200 --> 51:44.200]  And he said to me, my knowledge, yes, it does
[51:44.200 --> 51:52.200]  He said, I asked him, ah, when the accident occurred
[51:52.200 --> 51:56.200]  You tell the jury exactly what you saw
[51:56.200 --> 51:58.200]  Well, I didn't see anything
[51:58.200 --> 52:01.200]  You didn't see anything? No, I didn't
[52:01.200 --> 52:04.200]  Well, why did you see anything?
[52:04.200 --> 52:08.200]  Well, I was on another call and I got the call to come to this accident
[52:08.200 --> 52:09.200]  Oh, okay
[52:09.200 --> 52:13.200]  So how were the automobiles positioned in the road when you got there?
[52:13.200 --> 52:16.200]  Oh, they weren't in the road when I got there
[52:16.200 --> 52:18.200]  They weren't in the road
[52:18.200 --> 52:21.200]  Did you measure the skid marks in the highway?
[52:21.200 --> 52:23.200]  Were there weren't any skid marks?
[52:23.200 --> 52:26.200]  Did you look over the glass patterns in the highway?
[52:26.200 --> 52:29.200]  Were there weren't any glass patterns?
[52:29.200 --> 52:31.200]  Then how did you know an accident occurred?
[52:31.200 --> 52:34.200]  Well, I talked to you and the other person involved
[52:34.200 --> 52:38.200]  Oh, so tell me, Officer Pringle
[52:38.200 --> 52:41.200]  When did you commit aggravated perjury?
[52:41.200 --> 52:46.200]  When you signed that citation stating that you had personal knowledge
[52:46.200 --> 52:48.200]  That I had committed this crime
[52:48.200 --> 52:52.200]  Or just now when you testified that you only had hearsay knowledge
[52:52.200 --> 52:55.200]  And the prosecutor was a brand new prosecutor
[52:55.200 --> 52:58.200]  They just brought her in and introduced her to the judge
[52:58.200 --> 53:00.200]  A young woman, she chopped up and she said,
[53:00.200 --> 53:02.200]  You're out of my object
[53:02.200 --> 53:04.200]  I said, you're out of my duty
[53:04.200 --> 53:08.200]  This is awful, he ought to be ashamed of himself
[53:08.200 --> 53:12.200]  And the judge is trying to keep from laughing
[53:12.200 --> 53:15.200]  They found me guilty
[53:15.200 --> 53:18.200]  Charged me ten dollars
[53:18.200 --> 53:20.200]  Oh, okay
[53:20.200 --> 53:24.200]  And the judge called me up, he said, Mr. Kelton
[53:24.200 --> 53:27.200]  I apologize for this case
[53:27.200 --> 53:33.200]  But I was not going to let my new prosecutor lose her first case
[53:33.200 --> 53:37.200]  I tell you, I could appreciate that
[53:37.200 --> 53:42.200]  This is a long time ago, so I wasn't quite as vicious as I am now
[53:42.200 --> 53:46.200]  But anyway, that's the point
[53:46.200 --> 53:49.200]  He did not personally see or hear
[53:49.200 --> 53:53.200]  So if you can get him on the stand
[53:53.200 --> 53:57.200]  And testify that he did not personally see or hear
[53:57.200 --> 54:04.200]  Then you don't have to prove when someone committed aggravated poetry
[54:04.200 --> 54:12.200]  You only have to prove that either one or the other of two statements
[54:12.200 --> 54:14.200]  Are mutually exclusive
[54:14.200 --> 54:21.200]  If one is true, the other has to be untrue, and it does not matter which
[54:21.200 --> 54:26.200]  That's the story that's sticking to it, and I'll butt out now
[54:26.200 --> 54:30.200]  Well, it works in this case
[54:30.200 --> 54:34.200]  But do you understand what you're up against now and what you need to do about it?
[54:34.200 --> 54:36.200]  Yes, so...
[54:36.200 --> 54:38.200]  The statute is very clear
[54:38.200 --> 54:42.200]  The officer has to have the offense committed in his presence or view
[54:42.200 --> 54:46.200]  Or he better have a warrant in his hand to arrest you
[54:46.200 --> 54:54.200]  There is no law in Texas that allows a citation for an A, B, or C criminal misdemeanor
[54:54.200 --> 54:59.200]  To be written to someone unless they have been placed in a custodial arrest
[54:59.200 --> 55:04.200]  In every single instance, if it's a criminal citation
[55:04.200 --> 55:12.200]  They have to have placed you into a custodial arrest in order to issue it
[55:12.200 --> 55:15.200]  Okay, so you're saying just because he did not...
[55:15.200 --> 55:19.200]  Wait, wait, wait, there's another piece to that
[55:19.200 --> 55:26.200]  The officer cannot issue the citation under law
[55:26.200 --> 55:33.200]  As a citation, as a complaint and holds you based on the complaint
[55:33.200 --> 55:40.200]  For a classy misdemeanor, unless he personally saw or heard the offense being committed
[55:40.200 --> 55:46.200]  Now, if the accident had occurred
[55:46.200 --> 55:50.200]  And you were fall down and drunk
[55:50.200 --> 55:56.200]  And you had been speeding so fast that you hit the other car hard enough
[55:56.200 --> 56:01.200]  That it could be reasonably presumed that you were driving in excess of the speed limit
[56:01.200 --> 56:03.200]  Now that's a felony
[56:03.200 --> 56:08.200]  Somebody else could tell the officer, I saw this person commit a felony
[56:08.200 --> 56:11.200]  And you need to arrest him so he doesn't get away
[56:11.200 --> 56:16.200]  In that case, the officer can arrest without having seen or heard the offense
[56:16.200 --> 56:22.200]  But only for a felony, not for a misdemeanor
[56:22.200 --> 56:25.200]  If he believes the misdemeanor has been committed
[56:25.200 --> 56:29.200]  And it has not been committed in his sight or in his presence
[56:29.200 --> 56:36.200]  He must go to a magistrate, make his file a criminal complaint with the magistrate
[56:36.200 --> 56:38.200]  With an affidavit of probable cause
[56:38.200 --> 56:43.200]  And the magistrate must make a determination of probable cause
[56:43.200 --> 56:46.200]  In issue of warrant
[56:46.200 --> 56:50.200]  He must issue an order under 16-17 to go to criminal procedure
[56:50.200 --> 56:54.200]  In issue of warrant under 16-20
[56:54.200 --> 56:57.200]  That's how that's done
[56:57.200 --> 57:01.200]  Now this thing of writing a ticket on the side of the road
[57:01.200 --> 57:07.200]  Allowing the officer to release you on personal reconnaissance
[57:07.200 --> 57:12.200]  Was only for an offense in his sight and in his presence
[57:12.200 --> 57:16.200]  Or within his sight or hearing
[57:16.200 --> 57:24.200]  There is no provision for him writing the citation when it wasn't in his sight or hearing
[57:24.200 --> 57:29.200]  That's all I got to say about that
[57:29.200 --> 57:39.200]  So basically I could go in and say not guilty just because he was not around
[57:39.200 --> 57:44.200]  No, you do not enter a plea under any circumstances
[57:44.200 --> 57:49.200]  If there's going to be a plea entered, force them to do it
[57:49.200 --> 57:56.200]  Do not enter a plea, make no effort to enter a plea, refuse to enter a plea
[57:56.200 --> 58:00.200]  The moment you enter a plea you are waving in for sign on jurisdiction
[58:00.200 --> 58:04.200]  We do not waive anything
[58:04.200 --> 58:08.200]  Okay

[01:33:55.200 --> 01:34:07.200]  Now if you're using your vehicle to go pick up materials and transport them for someone else

[01:34:12.200 --> 01:34:22.200]  But if you're using your vehicle to transport your own product to your job site
[01:34:22.200 --> 01:34:27.200]  And you're not being paid for that time, you are indirectly
[01:34:27.200 --> 01:34:31.200]  But in order to be in commerce, you have to be paid directly
[01:34:31.200 --> 01:34:37.200]  What I mentioned earlier about being registered with the Department of Transportation
[01:34:37.200 --> 01:34:41.200]  As a private operator goes to these issues
[01:34:41.200 --> 01:34:48.200]  If you're a farmer and you raise wheat, you need to get the wheat to market
[01:34:48.200 --> 01:34:56.200]  That's not in commerce, you're not being paid directly to haul the wheat
[01:34:56.200 --> 01:35:01.200]  You have to haul the wheat in order to sell it
[01:35:01.200 --> 01:35:07.200]  But you're not transporting product for hire
[01:35:07.200 --> 01:35:12.200]  You're not doing it, the farmer's not doing it, I'm not doing it
[01:35:12.200 --> 01:35:19.200]  So you could put the same notice on your vehicle
[01:35:19.200 --> 01:35:25.200]  It is a vehicle, it is licensed as a vehicle
[01:35:25.200 --> 01:35:30.200]  And the operator does have a commercial license
[01:35:30.200 --> 01:35:33.200]  Certainly operated in commerce
[01:35:33.200 --> 01:35:37.200]  It's a provision to tell them that you're not operating in commerce and they can't get around it
[01:35:37.200 --> 01:35:40.200]  So you're never in commerce
[01:35:40.200 --> 01:35:48.200]  And it's up to them to determine or to prove that I was in commerce in the second place
[01:35:48.200 --> 01:35:52.200]  They have to have reason to believe
[01:35:52.200 --> 01:36:00.200]  And if you had a sign on your truck that said plumbing parts hauled for hire
[01:36:00.200 --> 01:36:07.200]  Then they may have reasonable probable cost to believe that you're in commerce
[01:36:07.200 --> 01:36:17.200]  But if you have your tools and pipes on the top and a sign that says that you are a plumber
[01:36:17.200 --> 01:36:23.200]  That is reasonable probable cost to believe that you are not in commerce

[01:38:11.200 --> 01:38:16.200]  I've never seen a chicken in my life that harbors fleas
[01:38:16.200 --> 01:38:17.200]  Never
[01:38:17.200 --> 01:38:19.200]  They touch every inch of their body with their beaks
[01:38:19.200 --> 01:38:22.200]  So they clean themselves very particularly
[01:38:22.200 --> 01:38:26.200]  I'd venture a guest that their dogs please get onto my chickens

[01:42:10.200 --> 01:42:14.200]  Two others can walk down this road
[01:42:14.200 --> 01:42:19.200]  And then you take that complaint to the district attorney

[01:42:24.200 --> 01:42:30.200]  You take that to the DA and he is going to say, you have got to be kidding

[01:42:40.200 --> 01:42:44.200]  And then you crash the complaint against the DA and send it to the Chief Justice
[01:42:44.200 --> 01:42:47.200]  In the Supreme Court of State of Texas
[01:42:47.200 --> 01:42:53.200]  And ask the Supreme Court judge to hold an examining trial
[01:42:53.200 --> 01:42:58.200]  And make a determination of probable cause against the district attorney
[01:42:58.200 --> 01:43:05.200]  For a clear and direct violation of 2.03 Texas Code of Criminal Procedure
[01:43:05.200 --> 01:43:10.200]  Which has the effect of violating the law relating to his office
[01:43:10.200 --> 01:43:15.200]  Which under 39.03 Peele Code is a class A misdemeanor
[01:43:15.200 --> 01:43:19.200]  And the Chief Justice is going to refuse
[01:43:19.200 --> 01:43:24.200]  And you go back to the district attorney with criminal charges against the Chief Justice

[01:53:35.200 --> 01:53:38.200]  He said that there was no court reporter or anything like that
[01:53:38.200 --> 01:53:46.200]  So I demanded the names and addresses of everybody in this courtroom to call as potential witnesses to these proceedings
[01:53:46.200 --> 01:53:48.200]  And he refused that, of course, two before
[01:53:48.200 --> 01:53:59.200]  I told him I was their impropriet persona in my proper person when he asked if I was going to represent myself
[01:53:59.200 --> 01:54:02.200]  I told him I don't represent myself, I am myself
[01:54:02.200 --> 01:54:06.200]  And I told him that he asked me did I understand the charges being laid against me
[01:54:06.200 --> 01:54:08.200]  And I told him no, I don't understand
[01:54:08.200 --> 01:54:12.200]  This pretend information that you've given me that goes to charge an offense
[01:54:12.200 --> 01:54:17.200]  It doesn't specifically state who it is that I injured and how I injured them
[01:54:17.200 --> 01:54:25.200]  And the prosecutor chimes up and says, well, you broke the state law, you know, you broke the law
[01:54:25.200 --> 01:54:29.200]  Well, so you're saying the state, my question was, so the state's the victim you're saying?
[01:54:29.200 --> 01:54:33.200]  They said, yeah, the state's the victim, well, what's the state's injury?
[01:54:33.200 --> 01:54:40.200]  And they just looked at my, they just looked at me and I said, I'm Richard Smith, there's no, there's no, the state doesn't have any injury
[01:54:40.200 --> 01:54:43.200]  I mean, you're saying that I obstructed government process
[01:54:43.200 --> 01:54:50.200]  Well, that sounds more like a civil case where if I damaged the, if I wasted the government's time, you should be sued me civilly
[01:54:50.200 --> 01:54:55.200]  Certainly not a criminal case, at best, at best this would be a criminal case, I told the judge
[01:54:55.200 --> 01:55:01.200]  And so I moved to Smith for lack of jurisdiction, there's no subject matter jurisdiction in the case
[01:55:01.200 --> 01:55:05.200]  There's no injury, there's no crime
[01:55:05.200 --> 01:55:12.200]  You're claiming that the state's the victim, but the state has no injury
[01:55:12.200 --> 01:55:15.200]  Well, I moved to Smith for lack of jurisdiction, you have no jurisdiction in the case
[01:55:15.200 --> 01:55:21.200]  The judge continues and I say, judge, I can't believe that you're going to continue to hear this case
[01:55:21.200 --> 01:55:27.200]  And wage your judicial immunity when you have an established jurisdiction in the case
[01:55:27.200 --> 01:55:33.200]  And that judge just went, his face just went pale, I'll never forget that, the judge's face just went pale when I told him
[01:55:33.200 --> 01:55:38.200]  And a couple days later that case was dismissed, they dismissed that case
[01:55:38.200 --> 01:55:46.200]  So I really, really liked your guys' information on, on grand jury, on the grand jury stuff
[01:55:46.200 --> 01:55:52.200]  And what I'm doing for you guys is I've printed off a lot of the information that I've found
